Review of Rabbi Chiyyaโ€™s Oath Rule

ื’ืžืจื here on ื“ืฃ ื” ืขืžื•ื“ ื comes ื‘ื”ืžืฉืš to the ื“ื™ืŸ that the ื’ืžืจื spoke about before on ื“ืฃ ื’ ืขืžื•ื“ ื, ื’ ืขืžื•ื“ ื‘, which was the ื“ื™ืŸ of ืจื‘ื™ ื—ื™ื™ื. So what did we learn about the ื“ื™ืŸ of ืจื‘ื™ ื—ื™ื™ื? Normally we know that if you're a ืžื•ื“ื” ื‘ืžืงืฆืช you have to swear. That means if someone admits to part, he swears. If you're ื›ื•ืคืจ ื‘ื”ื›ืœ, if you deny the whole thing, you don't have to swear. Like when a guy says you owe me a hundred dollars, and he answers I owe you 50, so obviously the 50 that he admits he pays, but he has to swear on the other he has to swear. But if he denied the whole thing, he doesn't, ืžื“ืื•ืจื™ื™ืชื. ื“ืจื‘ื ืŸ he do. Came ืจื‘ื™ ื—ื™ื™ื, ืจื‘ื™ ื—ื™ื™ื was ืžื—ื“ืฉ a ื—ื™ื“ื•ืฉ, he said that this is not only if you admit, and also if there's ื”ืขื“ืืช ืขื“ื™ื. That means you deny it, let's say he says you owe me a hundred dollars, he says I don't owe you a penny, but then you have two ืขื“ื™ื who claim that he owes him 50, you also have to swear on the other 50. The 50 that they that they testify about, obviously you have to pay, the ืขื“ื™ื say you owe, you owe. But the other 50 you have to swear. Even though the guy says I'm a ื›ื•ืคืจ ื‘ื”ื›ืœ, I didn't admit to anything, but just like if you admit yourself, that's called ื”ื•ื“ืืช ืคื™ื•, if your own mouth admits to part, that is ืžื—ื™ื™ื‘ you, that obligates you to swear on the rest, so ืจื‘ื™ ื—ื™ื™ื brings ืจืื™ื”, same thing if ืขื“ื™ื are ืžื—ื™ื™ื‘ you part, ืขื“ื™ื obligate you to depart to swear on the rest. So in continuation to that, the

Shepherd Story Illustrating the Rule

ื’ืžืจื brings on ื“ืฃ ื” ืขืžื•ื“ ื a story: ื”ื”ื•ื ืจืขื™ื, there was this shepherd, ื“ื”ื•ื” ืžืกืจื™ ืœื™ื” ื›ืœ ื™ื•ืžื ื—ื™ื•ืชื ื‘ืกื”ื“ื™, that people used to give him every day animals to take care of with witnesses. Obviously they didn't trust the guy, with witnesses. ื™ื•ืžื ื—ื“ ืžืกืจื• ืœื™ื” ื‘ืœื ืกื”ื“ื™, one day they gave him without witnesses. What happened then? ืœืกื•ืฃ ืืžืจ ืœื”ื•, later when they came to collect it back, he said to them ืœื ื”ื™ื• ื“ื‘ืจื™ื ืžืขื•ืœื. Nothing, you never gave me. ืืชื• ืกื”ื“ื™ ืืกื”ื™ื“ื• ื‘ื™ื” ื“ืื›ืœ ืชืจืชื™ ืžื ื™ื™ื”ื•. Two witnesses came and said we saw two which we know were yours, he ate, he ate up, the animals, two of the animals he ate up. ืืžืจ ืจื‘ ื–ื™ืจื, so ืจื‘ ื–ื™ืจื said, ืื ืื™ืชื ืœื“ืจื‘ื™ ื—ื™ื™ื ืงืžื™ื™ืชื, if we follow the ื“ื™ืŸ of ืจื‘ื™ ื—ื™ื™ื, ื™ืฉืชื‘ืข ืืฉืืจื, this guy has to swear because it's exactly the same case of ืจื‘ื™ ื—ื™ื™ื. Someone comes to him, the people who gave him came and said let's say I don't know how much, it doesn't say, but let's say they said we gave we gave you 10 ื‘ื”ืžื•ืช. What did he do? Denied the whole thing. But there are two ืขื“ื™ื for two. What does ืจื‘ื™ ื—ื™ื™ื say in a case like that? He denied the whole thing, but two ืขื“ื™ื say part, so you pay the part and you have to swear on the rest. So that's exactly what you have to do here. ืืžืจ ืœื™ื” ืื‘ื™ื™, so ืื‘ื™ื™ said to him, ืื™ ืžืฉืชื‘ืข, what are you telling me? If ืจื‘ื™ ื—ื™ื™ื is right, if we follow ืจื‘ื™ ื—ื™ื™ื, then this guy will have to swear? ื•ื”ื ื’ื–ืœืŸ

A Thief Cannot Swear โ€“ Transfer of Oath

ื”ื•ื! He's a ื’ื–ืœืŸ, and a ื’ื–ืœืŸ can't swear, you don't trust a ื’ื–ืœืŸ. How do you know he's a ื’ื–ืœืŸ? Because we have two ืขื“ื™ื that he ate up. What's the difference between a ื’ื–ืœืŸ and a ื›ื•ืคืจ? Huh? What's the difference between a ื’ื–ืœืŸ and a ื›ื•ืคืจ? Okay, if there's ืขื“ื™ื. In the other place, yeah, if there's ืขื“ื™ื. No, but that's what Oh, you're asking the regular case of ืจื‘ื™ ื—ื™ื™ื? Yeah. There it's ืžืฉืชืžื•ื˜ื™ ืงืžืฉืชืžื™ื˜. Maybe ื˜ืืงืข the reason he denied it because he doesn't have the money. Why do we assume that's the reason? No, the ืกื‘ืจื is ืžืžื™ืœื he's not called a ื’ื–ืœืŸ. He's not trying to steal, he's trying to push off, to stall for time he doesn't have. This guy can't say that, because the animals were there and he ate up the animals. He had no right to use them. ืืžืจ ืœื™ื”, so ืจื‘ ื–ื™ืจื said you're right, ืฉื›ื ื’ื“ื• ืงืืžื™ื ื. I didn't mean he should swear. He is obligated to swear. Since he's a ื’ื–ืœืŸ, he can't swear, so let the other guy swear and collect. Usually when you swear is when someone wants you to pay and you claim you don't owe, you swear, like a regular ืžื•ื“ื” ื‘ืžืงืฆืช. You say I owe you a hundred dollars, I claim I owe you 50, so the 50 I pay, the other one, in order for me not to pay, I have to swear. And if I swear, I don't pay. You don't find ever that you swear and collect. But in this case, because he's ื‘ืขืฆื ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, because he fits into the case of ืจื‘ื™ ื—ื™ื™ื, so ืจื‘ื™ ื—ื™ื™ื said you're ื—ื™ื™ื‘ ืฉื‘ื•ืขื”, but he can't swear, ืจื‘ ื–ื™ืจื tells ืื‘ื™ื™: you're right, he can't swear because he's a ื’ื–ืœืŸ, but his the ื“ื™ืŸ ืฉื‘ื•ืขื” is there, so the ื“ื™ืŸ is transfer the ืฉื‘ื•ืขื” to the other guy, ืฉื›ื ื’ื“ื• ื ืฉื‘ืข ื•ื ื•ื˜ืœ, so the other guy swears. So really what I meant, there is a ืฉื‘ื•ืขื” here, but not that he should swear and ืžืžื™ืœื won't have to pay. Because we thought what he meant was the two that the ืขื“ื™ื said obviously he has to pay, ืื™ื™ they claimed eight more, swear that you never took those you got those eight and you'll be ืคื˜ื•ืจ. That you can't do because you never trust him. Let the other guy, he's a ื’ื–ืœืŸ, let the other guy swear. If the other guy swears, so if the other guy swears we gave you, that will force him to pay. If the other guy won't want to swear, then he won't pay. But you transfer the ืฉื‘ื•ืขื” from him to the other guy. Why? Because he cannot swear. He gets the whole 10? If he if the other guy swears, yeah. paid all that. The two he swears because of the ืขื“ื™ื, and the other eight because the other guy swore, and we accept the guy's ืฉื‘ื•ืขื”. They saw he ate two animals, so how how do they know that this was the animal? I guess they asked him on him. That's a ืฉืืœื”, ื ืงืฉื™ื ืื•ื™ืฃ ื ืžืขืฉื”. It means that, yeah, it must be a case where they knew, for sure. Why did they have to swear? What what was He would be a ืžื•ื“ื” ื‘ืžืงืฆืช. No, but what was the What did he say? A ืจื‘ื™ ื—ื™ื™ื. What does ืจื‘ื™ ื—ื™ื™ื's case say? No, I mean what is this the ืกื“ืจ of the ืฉื‘ื•ืขื”? What do you do? The wording of the ืฉื‘ื•ืขื”? Oh, if he would swear, then he would swear, \"I swear that I do not owe you anything more than this.\" That's it? Simple ืฉื‘ื•ืขื”? Simple ืฉื‘ื•ืขื”. In this case, they will swear, the other guys will swear that, \"You do owe us more.\" Well, Rabbi, what is a ืžื•ื“ื” ื‘ืžืงืฆืช swear? That's what That the rest, he is ืคื˜ื•ืจ. That he doesn't owe all the other money. Right. If I say I owe you No, 50 I admit. A ืžื•ื“ื” ื‘ืžืงืฆืช admits to something. He has to swear that the other That does not. And the same thing when the ืขื“ื™ื come and say 50, he has to swear. So, those 50 are out of the question, he has to pay them. But the other 50, he has to swear as like he was a ืžื•ื“ื” ื‘ืžืงืฆืช. This guy is in that situation, but he can't swear because he's a ื’ื–ืœืŸ, so the ื“ื™ืŸ by a ื’ื–ืœืŸ is that he is ืฉื›ื ื’ื“ื•, they transfer the ืฉื‘ื•ืขื” to the other guy. Comes ืชื•ืกืคื•ืช and ืชื•ืกืคื•ืช asks a ืงืฉื™ื, ืชื™ืžื. No, ื•ืื ืชืืžืจ, ืžืื™ ืฉื ื, why is this different? ื“ื”ื ื‘ื—ืฉื•ื“ ืขืœ ื”ืฉื‘ื•ืขื” ืฉื›ื ื’ื“ื• ื ืฉื‘ืข ื•ื ื•ื˜ืœ, why is it that in a case where a guy can't swear because we suspect that he's gonna lie, so the other guy swears? ืืžืื™ ืœื ืืžืจื™ื ืŸ

When Inability to Swear Means Payment

ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื? Why don't we say the rule like we say in other places that if you are a ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” and you can't swear, you got to pay? Where is the example? ื›ื“ืืžืจื™ื ืŸ, ื›ื“ืืžืจ like we say, ื’ื‘ื™ ื—ืžืฉื™ืŸ ื™ื“ืขื ื ื•ื—ืžืฉื™ืŸ ืœื ื™ื“ืขื ื. The ื“ื™ืŸ is like this, what happens if he tells him, \"You owe me a hundred dollars.\" He says, \"50 I owe you, the other 50 I don't know.\" Don't you remember? \"I don't know, maybe I do, maybe I don't.\" Now, this guy is a ืžื•ื“ื” ื‘ืžืงืฆืช. So, he's a ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, but he can't swear, because he always says, \"I don't know.\" So the ื“ื™ืŸ is ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข, can't swear, you got to pay, ืžืฉืœื. Or ื ืกื›ื ื“ืจื‘ื™ ืื‘ื, the famous case of the silver, that ืจื‘ื™ ืื‘ื's case, where the guy grabbed a piece of silver out of his friend's. There was an ืขื“ ืื—ื“. Normally an ืขื“ ืื—ื“ makes you swear, so in this case, he brought him to a ื“ื™ืŸ ืชื•ืจื” and he brought him to the to the ื‘ื™ืช ื“ื™ืŸ, saying, \"This guy grabbed my silver.\" What did the guy answer? \"It's mine. I admit I grabbed, because it was mine.\" Now here is a strange case, why? Had there been two ืขื“ื™ื that he grabbed, he would have to pay. That's the ื“ื™ืŸ, because if you grabbed it, ื”ืžื•ืฆื™ื ืžื—ื‘ื™ืจื• ืขืœื™ื• ื”ืจืื™ื”. Since he had it, ื—ื–ืงื” is it's his. I grabbed it, so I have to give it back. If you want to prove later, prove, but I have to give it back. If two ืขื“ื™ื would come, there are no two ืขื“ื™ื here. Usually when there's a case where two ืขื“ื™ื make you pay, ืขื“ ืื—ื“ makes you swear. So in this case, if there'd be two ืขื“ื™ื, he'd have to give it back. Since there is one ืขื“, he has to swear. But the ื’ืžืจื says they didn't know what to do. What's he gonna swear? You, when you have an ืขื“ ืื—ื“ that you have to swear against him, you have to swear to contradict the ืขื“. Like a regular case, if I say, \"I don't owe you any money,\" and you bring an ืขื“ ืื—ื“ that I do owe you, so I have to swear. The ืขื“ ืื—ื“ says I owe you, I have to swear I don't. What's gonna happen here? What does the ืขื“ ืื—ื“ say? \"You took it.\" \"You took it. I admit I took it, what am I gonna swear?\" \"Mine.\" \"Well, it's mine! But I can't swear that it's mine, because there's no ืขื“ ืื—ื“ saying it's not mine. I only have to swear against the ืขื“ ืื—ื“.\" So, what is here? So he is a ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, because there is an ืขื“ ืื—ื“ against him, which means had two ืขื“ื™ื would have made him pay, so an ืขื“ ืื—ื“ is like a two, but make him swear. So he's a ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, he can't swear. ืžืฉืœื! You got to pay. So ืชื•ืกืคื•ืช asks, so the same thing here also. This guy is a ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” here. He cannot swear, because he's a ื’ื–ืœืŸ. Pay! Why is the ื“ื™ืŸ that the other guy has to swear? Which means the other guy has to swear, if the guy swears, I pay. But what happens if the other guy says, \"Ah, I don't want to swear\"? Then I'll get away with it! Why? Why shouldn't it be the ื“ื™ืŸ, ื“ื™ืŸ ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื? ืขื ื˜ืคืขืจื˜ ืชื•ืกืคื•ืช, two ืชื™ืจื•ืฆื™ื. ื™ืฉ ืœื•ืžืจ that ื”ื›ื, here in this case, ืื™ ืืžืจื™ื ืŸ ืžืฉืœื, had we said by a ื’ื–ืœืŸ that every time he has to swear and he can't because he's a ื’ื–ืœืŸ, he has to pay, ืœื ืฉื‘ืงืช ื—ื™ื™, can't exist that way. ื›ืœ ื”ืขื•ืœื ื™ื‘ื™ืื•ื”ื• ืœื™ื“ื™ ืฉื‘ื•ืขื”, everybody wants could come and make him a ืฉื‘ื•ืขื”, ื•ื™ื˜ืœื• ื›ืœ ืืฉืจ ืœื•, and take everything away. Anybody wants money from him will come and say this, \"You you owe me a hundred dollars.\" And let's say, not that you You owe me 50, I'll come and say, \"You owe me a hundred.\" What's gonna happen? And he's gonna be a ืžื•ื“ื” ื‘ืžืงืฆืช, but he can't swear, he's gonna have to pay! Why can't he swear? Because he's a ื’ื–ืœืŸ. See if he'd be a regular guy, I say a hundred, he says 50, swear! ืื“ืจื‘ื”, if you're saying the truth, swear! But he can't swear. Once you're a ื’ื–ืœืŸ, it's always? Yeah, unless you do ืชืฉื•ื‘ื”. Good, so yeah, but till he does ืชืฉื•ื‘ื” Where he did ืชืฉื•ื‘ื”? No, but you you can't make such a ื“ื™ืŸ, he says, that a ื’ื–ืœืŸ can't cannot swear, ืžืžื™ืœื he should pay, because it'll, a ืงื ืก he'll be paying. See, when a guy could swear, people try to get money out of him. But if the ื“ื™ืŸ is that he swears, so he'll swear and get the, and be ืคื˜ื•ืจ. But this guy can't swear, so he'll always take away money from him, so you can't make ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. ื•ืขื•ื“, another ืชื™ืจื•ืฅ, ื“ื”ืชื, by the other cases, ืืžืจ ืœื™ื”, we say to this guy who has to swear, let's say the guy who says, \"Half, 50 I know, 50 I don't know.\" So we tell him like this: ืฉื‘ื•ืขื” ื“ืื•ืจื™ื™ืชื ืจืžื™ื ืขืœื™ืš, you have to swear. ืื™ืŸ ื‘ืจื™ืจื”, ืชืฉื‘ืข. You have to swear, but you can't swear. The ื˜ืขื ื” you're ื˜ืขื ื™ื ื’ is a kind of ื˜ืขื ื” that doesn't allow the ืฉื‘ื•ืขื”. So, if you can't swear, you got to pay. ืื‘ืœ ื”ื›ื, ื”ื•ื ื‘ืจืฆื•ื ื• ื ืฉื‘ืข. But in the case of a ื’ื–ืœืŸ, it's not the ืคืฉื˜ he's ื˜ืขื ื™ื ื’ a ื˜ืขื ื” that doesn't allow a ืฉื‘ื•ืขื”. He could swear, and he screams, \"I'm ready to swear!\" ืื ื ื ื™ื—ื ื•, if we let him. We don't let him swear, so why should he pay, ืœืžื” ื”ื•ื ื™ืฉืœื? He could swear. No, it depends why he can't swear, because we don't trust him. Because we don't let him. We don't let him, we say, \"You have...\" But ืœืคื•ืขืœ, ืžืฆื“ his ื˜ืขื ื”, it's a ื˜ืขื ื” that he could swear. In this case, he could swear. He says, \"I'm ready to swear that I only took, that if it's more than two, I don't have. And then I'll be ืคื˜ื•ืจ.\" Why can't he swear? Because we don't let him. We don't say ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. We only say ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื in a case where what he's ื˜ืขื ื™ื ื’ is a ื˜ืขื ื” which is ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, but he can't, like \"I don't know,\" or the case of an ืขื“ ืื—ื“ where he says, \"I grabbed mine.\" So whatever you're saying doesn't allow the ืฉื‘ื•ืขื” to take place. So then we say, good, so it's no one's fault, but ืœืคื•ืขืœ, pay me up. But if what you're ื˜ืขื ื™ื ื’, the guy says, \"I'm ready to give you the ืฉื‘ื•ืขื”, you're not letting me, so I have to pay?\" So we ื˜ืืงืข don't say pay. So what's the case of a ื’ื–ืœืŸ? We say instead of ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื, and he has to pay, we say ืฉื›ื ื’ื“ื• ื ืฉื‘ืข, the other guy swears. The bottom line here, we have two ืชื™ืจื•ืฆื™ื in ืชื•ืกืคื•ืช. Not only two ืชื™ืจื•ืฆื™ื, there's a big difference between the two.

First Tosafot Reason for Not Paying

According to the first ืชื™ืจื•ืฅ, ื‘ืืžืช, you could have said here ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. According to the first ืชื™ืจื•ืฅ, what's the first ืชื™ืจื•ืฅ? If we're going to make him pay, then there's no end to it, so always he'll have to give money. So that's what we're saying is that even though ื‘ืืžืช, this is a case where you could have said ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื, there's a practical, technical reason why we don't do that. But the second answer says that the whole ื›ืœืœ of ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื doesn't apply here. We're saying here it's a case where it doesn't apply, because he's ื˜ืขื ื™ื ื’ a ื˜ืขื ื” which he could swear, ืืœื ืžืื™, we don't let him. So, but the ืฉืืœื” is, not a ืงืฉื™ื, the ืฉืืœื” is what is the ืžื—ืœื•ืงืช, what are the two sides here, whether in this case ื‘ืขืฆื you could say ืžืชื•ืš ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื or not? How does the second one hold that you don't say ืžืชื•ืš ืฉืื™ื ื•, and the first one says, well, you would say, but for some reason you don't. So just understand the two sides to go a little bit deeper. Then there's another ืฉืืœื”. The ื’ืžืจื in ืฉื‘ื•ืขื•ืช says like this: what happens if you have an argument, two people, and this guy is a ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, but he can't swear because he's a ื’ื–ืœืŸ, but the other guy is also a ื’ื–ืœืŸ? ื ื’ื ื‘ ืคื•ืŸ ื ื’ื ื‘ ืคื˜ื•ืจ. Which can even, a ื’ื ื‘ is ื—ืฉื•ื“ too! So normally, if the guy, the guy who has to swear is a ื’ื–ืœืŸ, we say ืฉื›ื ื’ื“ื• ื ืฉื‘ืข, the other guy swears. The other guy can't swear either. So the ืžืฉื ื” says ื—ื–ืจื” ืฉื‘ื•ืขื” ืœืžืงื•ืžื”. The ืฉื‘ื•ืขื” goes back to its place. Which place? There's a ืžื—ืœื•ืงืช. Who made Who made the concept of a ืฉื‘ื•ืขื”? The ืื™ื™ื‘ืขืจืฉื˜ืขืจ. Turn to the ืื™ื™ื‘ืขืจืฉื˜ืขืจ and say go back to ื”ืจ ืกื™ื ื™. You give the ืฉื‘ื•ืขื” back to this. There's no ืฉื‘ื•ืขื” here. And if there's no ืฉื‘ื•ืขื” here, you can't blame the guy. He can't swear, but he's, and therefore you don't pay. You don't swear and you don't pay. ืจื‘ื•ืชื™ื ื• ืฉื‘ื‘ื‘ืœ ืื•ืžืจื™ื, they say no, ื—ื–ืจื” ืฉื‘ื•ืขื” ืœืžื—ื•ื™ื™ื‘ ืœื”. It goes back to the place to the first guy. But the first guy can't swear, so we say ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. So the second ืคืฉื˜ says that because he can't, this can't, the other guy can't swear either, so we take it back to the first, and the first is the one that be- that stays ืžื—ื•ื™ื™ื‘, and we say and actually we say ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. The ืงืฉื™ื is, according to the second ืชื™ืจื•ืฅ of ืชื•ืกืคื•ืช, how do we say that? The second ืชื™ืจื•ืฅ of ืชื•ืกืคื•ืช says that in a case where a guy is ready to swear, ืืœื ืžืื™ we don't let him swear, we do not say you pay. So how come over there you do? The fact that the other guy is also a ื—ืฉื•ื“, he screams, \"Why do you make me pay? I know the ื“ื™ืŸ, the ื“ื™ืŸ is that if a person is ื—ืฉื•ื“, you can't make him pay, because he's ready to swear, we just don't let him.\" So he says, \"Why should I pay now? Because the other guy is also a ื—ืฉื•ื“?\" So we see from here that ื‘ืขืฆื you could say even by the case of a ื—ืฉื•ื“. But that doesn't fit with the second ืคืฉื˜ of ืชื•ืกืคื•ืช. So how does ืชื•ืกืคื•ืช work? Then there's another ืงืฉื™ื. The ื’ืžืจื here on ื“ืฃ ื”' ืขืžื•ื“ ื‘' has a whole ืกื•ื’ื™ื Looking into this ืฉืืœื”. Is ื—ืฉื•ื“ ืืžืžื•ื ื ื—ืฉื•ื“ ืืฉื‘ื•ืขื” or not? If someone is suspected, we're afraid he's stealing, he's ready to steal, do we also suspect that he's going to swear false? And ืžืžื™ืœื we can't make him swear, or not? He's ื—ืฉื•ื“ ืืžืžื•ื ื, he's we're afraid he's going to steal, but it doesn't mean he's going to swear false. The ื’ืžืจื wants to bring a ืจืื™ื” that ื—ืฉื•ื“ ืืžืžื•ื ื is not ื—ืฉื•ื“ ืืฉื‘ื•ืขื”. If you suspect a guy for ืžืžื•ืŸ, for money, you don't suspect him ืืฉื‘ื•ืขื”, from the case of ืžื•ื“ื” ื‘ืžืงืฆืช. Regular case. A normal ืžื•ื“ื” ื‘ืžืงืฆืช, what is the ืคืฉื˜? We make him swear. Why do we make him swear? Because we're afraid that when he says, \"I only owe you 50,\" he's lying. Really he owes him the whole thing. And the 50 that he's denying is because he wants to steal it. So the reason we make a ืžื•ื“ื” ื‘ืžืงืฆืช swear because we're ื—ื•ืฉื“ ืืžืžื•ื ื. How could the ืชื•ืจื” say make him swear? If ื—ืฉื•ื“ ืืžืžื•ื ื ื—ืฉื•ื“ ืืฉื‘ื•ืขื”, how could the ืชื•ืจื”? And the ื’ืžืจื answers he's not ื—ืฉื•ื“, whatever it is. Comes the ืงืฆื•ืช, and the ืงืฆื•ืช asks, brings a ืชื•ืกืคื•ืช, where ืชื•ืกืคื•ืช says that this whole ื“ื™ืŸ, even if we hold ื—ืฉื•ื“ ืืžืžื•ื ื ื—ืฉื•ื“ ืืฉื‘ื•ืขื”, that if you suspect him on money, you suspect him on a ืฉื‘ื•ืขื”, it's only ืžื“ืจื‘ื ืŸ, not ืžื“ืื•ืจื™ื™ืชื. If the whole thing is ืžื“ืจื‘ื ืŸ, then how does the ื’ืžืจื bring a ืจืื™ื” ืžื•ื“ื” ื‘ืžืงืฆืช? ืžื•ื“ื” ื‘ืžืงืฆืช is ื—ื™ื™ื‘ a ืฉื‘ื•ืขื” from the ืชื•ืจื”. According to ืชื•ืกืคื•ืช, at the time of the ืชื•ืจื”, for sure ื—ืฉื•ื“ ืืžืžื•ื ื was not ื—ืฉื•ื“ ืืฉื‘ื•ืขื”. The whole ืฉืืœื” in the ื’ืžืจื whether yeah or not is now. So how could the ื’ืžืจื bring a ืจืื™ื” from a ืžื•ื“ื” ื‘ืžืงืฆืช which is a ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื? In the time of ื“ืื•ืจื™ื™ืชื, for sure if someone was ื—ืฉื•ื“ ืืžืžื•ืŸ, was not ื—ืฉื•ื“ ืืฉื‘ื•ืขื”, that's why even the ืชื•ืจื” made him swear. So he's asking a ืงืฉื™ื, how does the ื’ืžืจื bring a ืจืื™ื” from this? Okay, so to answer these three things, so we have three things to understand. Number one again, in ืชื•ืกืคื•ืช we have two ืคืฉื˜ื™ื. One ืคืฉื˜ seems that by a person who's ื—ืฉื•ื“, that he'd swear false, we could ื‘ืขืฆื say ืžืฉืœื, there's a technical reason why we don't. And the second side it says we ื‘ืขืฆื cannot say it, doesn't apply there. What's the ืกื‘ืจื? Then the second thing what he asked, if according to the second ืชื™ืจื•ืฅ of ืชื•ืกืคื•ืช, that in the case where a person is ready to swear, we just don't let him, we can't say you pay, how come when they're both ื—ืฉื•ื“ we do say that he has to pay? And the third one, well how does the ื’ืžืจื bring a ืจืื™ื” from ืžื•ื“ื” ื‘ืžืงืฆืช, that a person who's ื—ืฉื•ื“ ืืžืžื•ื ื ื—ืฉื•ื“ ืืฉื‘ื•ืขื”, so the ืงืฆื•ืช says, well if it's only ืžื“ืจื‘ื ืŸ this whole thing of bringing a ืจืื™ื” ืžื•ื“ื” ื‘ืžืงืฆืช? To explain that, I have to go into another ืคืจื˜ here. What's the ืคืฉื˜ ื—ืฉื•ื“ ืืฉื‘ื•ืขื”? A person who's ื—ืฉื•ื“, we say a person who swore false can never be believed for a ืฉื‘ื•ืขื”, till he does ืชืฉื•ื‘ื”. What's the ืคืฉื˜ swore false? The ืฉื•ืœื—ืŸ ืขืจื•ืš has a ื“ื™ืŸ like this: if a person swore false, and we caught him that he lied, he swore false, so from then on he can't swear. But he says what happens, but this is only ืœืฉืขื‘ืจ. The guy swears, \"I never borrowed the money,\" or something. What happens if it's for the future? A guy swears tomorrow 3:00 I'm going to... do a ื ื“ืจ. No, a ืฉื‘ื•ืขื”. There's a ื“ื™ืŸ of a ื ื“ืจ and of ืฉื‘ื•ืขื”. He makes a ืฉื‘ื•ืขื”, \"I swear I'm going to do this and this,\" and comes ืœืคื•ืขืœ he doesn't do it. The bottom line, he swore false. Is this guy also called ื—ืฉื•ื“ ืืฉื‘ื•ืขื”? No, that would be ืœื‘ื˜ืœ. But you could make a ืฉื‘ื•ืขื” like that. Tomorrow I'm going to... Good, no, but ืœืคื•ืขืœ, looking tomorrow, he swore, he's ืขื•ื‘ืจ on an ืื™ืกื•ืจ ืฉื‘ื•ืขื”. This guy is definitely ืขื•ื‘ืจ on an ืื™ืกื•ืจ ืฉื‘ื•ืขื”. So the ืฉืืœื” is like this, do we look at this guy he's ื—ืฉื•ื“ to swear false? You could say no, you could say when he swore, it wasn't false. All that happened was since he swore, he became ืืกื•ืจ to do something. So what is he ืขื•ื‘ืจ? On an ืื™ืกื•ืจ, not on a ืฉื‘ื•ืขื”. Or you could say no, the bottom line is that he swore, and now he didn't keep the ืฉื‘ื•ืขื”, so it's a ืฉื‘ื•ืขืช ืฉื•ื. So ืฉื•ืœื—ืŸ ืขืจื•ืš brings two ื“ืขื•ืช. That's only because he swore something negative. If he swears I'm going to do something positive... Same thing, no, and you didn't listen. So you swore false. It's false, but not because of a sin. No, or you didn't keep, or you didn't keep what you said, but it's not that you swore false. You could say the ืฉื‘ื•ืขื” was a good ืฉื‘ื•ืขื”. You're allowed to swear I'll do this and this. And later you didn't keep what you, but it's not that you swore false, you didn't keep what you swore. So the

Two Opinions on Future Swearings

ืฉื•ืœื—ืŸ ืขืจื•ืš brings two ื“ืขื•ืช. ืœืžืขืฉื”, what do we do? There's two ื“ืขื•ืช. So we have a ืžื—ืœื•ืงืช in the ืื—ืจื•ื ื™ื how we what to do ื‘ืคื•ืขืœ. A ืžื—ืœื•ืงืช between the ื›ื ืกืช ื”ื’ื“ื•ืœื” and the ืฉืขืจ ืžืฉืคื˜. The ื›ื ืกืช ื”ื’ื“ื•ืœื” says like this: since it's a ืกืคืง, so we don't know if this guy is considered ื—ืฉื•ื“ or not. According to one opinion, he's considered a ื—ืฉื•ื“, even though it was for the future, but ืœืคื•ืขืœ, according to the other opinion he's not considered ื—ืฉื•ื“ ืืฉื‘ื•ืขื”. So we don't know if he's a, he's a ืกืคืง ื—ืฉื•ื“. So we can't make him swear, you can't make him swear ืžืกืคืง. But you can't make him pay money either, because by not making him swear and making him pay, based on what? A ืกืคืง? ืžืกืคืง ืœื ืžืคืงื™ื ืŸ ืžืžื•ื ื. You can't collect money on a ืกืคืง, you can only collect money if you owe the ื•ื“ืื™. We don't know, because maybe he could swear, and if he'll swear, he won't pay. So how could you tell him we don't want you to swear, and ืžืžื™ืœื you'll have to pay? You can't do that. So the ื›ื ืกืช ื”ื’ื“ื•ืœื” says that the bottom line in a case like this, where the guy swore for the future and didn't keep his ืฉื‘ื•ืขื”, later on, if a situation happens where he has to swear, we can't make him swear, because maybe he's a ื—ืฉื•ื“. But we can't make him pay either. The

Sha'ar Mishpatโ€™s Solution: Other Party Swears

ืฉืขืจ ืžืฉืคื˜ says, no. Since we can't make him swear, he's like any ื—ืฉื•ื“ which can't swear. What's the ื“ื™ืŸ by a ื—ืฉื•ื“ that can't swear? ืฉื›ื ื’ื“ื•. Nothing to shout about. What's the ื“ื™ืŸ by a ื—ืฉื•ื“? ืฉื›ื ื’ื“ื•! So the other guy swears. So in this case, yeah, we don't make him, we we the other guy swears, and if the other guy swears, we make him pay. So again, so the ื›ื ืกืช ื”ื’ื“ื•ืœื” learns that this is a case of a ืกืคืง, and by a ืกืคืง you can't make a guy swear ืžืกืคืง, and you can't make a guy pay ืžืกืคืง. So that's it. There's a ืกืคืง in the second one? No, the other guy is No, wait, there is a ืกืคืง. That's something else, but you have to on a regular case. This is not assuming the ืฉืืœื” on why do you do that? If you make If you can't, if a ื—ืฉื•ื“, then you No, the ื“ื™ืŸ is that we don't No, the ื“ื™ืŸ is that ืฉื›ื ื’ื“ื•. By a ื—ืฉื•ื“, the second guy, the other guy swears. That's the ื“ื™ืŸ. The ืฉืืœื”, do we do the same thing here too? Who's the other guy though here? The guy he's arguing with. No, but I mean if you swear you're going to do something tomorrow No, that's not this. If a guy swore, \"I'm going to do something tomorrow,\" and he doesn't do it. Later on, he has a dispute with somebody and we want to make him swear. It's a ืกืคืง, it's a ืžื—ืœื•ืงืช, two opinions whether this guy is considered a ื—ืฉื•ื“ or not. But since he's a ืกืคืง, two opinions and we don't know, it's called ืกืคื™ืงื ื“ื“ื™ื ื. It's a ืกืคืง in the ื“ื™ืŸ. So we can't make him swear. The ืฉืืœื”, do we make him pay, because do we make the other guy swear or not? So one opinion says, why should you make the other guy swear? Because we're not sure, it's only a ืกืคืง. You can't make the other guy swear ืžืกืคืง. So then make him pay? You can't make him pay ืžืกืคืง either. According to the ื›ื ืกืช ื”ื’ื“ื•ืœื”, what do they do then? No, nothing, so you're ืคื˜ื•ืจ. Yeah, yeah, that's it. You're ืคื˜ื•ืจ and he doesn't pay, right. And according to the ืฉืขืจ ืžืฉืคื˜, he says since he's a ืกืคืง ื—ืฉื•ื“ He has to pay. so he's like a ื—ืฉื•ื“. It's not fair. And so that, so what do you do by a ื—ืฉื•ื“? He can't, the other guy swears. A guy can't pay ื‘ืœื™ ื ื“ืจ? You always have to pay ื‘ืœื™ ื ื“ืจ, that's for sure. Now, what's the ืกื‘ืจื of the ืžื—ืœื•ืงืช between these two ืฉื™ื˜ื•ืช? I'll tell you. He has to swear ื‘ืœื™ ื ื“ืจ. We

Understanding the Purpose of a ืฉื‘ื•ืขื”

have to look into, what's the ื’ื“ืจ of a ืฉื‘ื•ืขื”? What's the ื’ื“ืจ of a ืฉื‘ื•ืขื”? When we say that there's a certain case, whatever the ื“ื™ืŸ is, you got to swear. You can learn that the ืขื ื™ืŸ of a ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ. Since this is the ืžืฆื‘, the ืชื•ืจื” says, here you need a verification of what happened, of the truth. When a person swears, what does it say? You say you don't Let's say Let's say ืžื•ื“ื” ื‘ืžืงืฆืช. ืžื•ื“ื” ื‘ืžืงืฆืช, I say you owe me $100, you say you owe 50. The ืชื•ืจื” says, you're ื—ื™ื™ื‘ a ืฉื‘ื•ืขื”. What does that mean? The ืชื•ืจื” says in this case, if you verify through a ืฉื‘ื•ืขื” that you don't owe the other 50, that's a verification and and you don't owe the money. So that's a ื‘ื™ืจื•ืจ. Same thing with an ืขื“ ืื—ื“. If you say you don't owe me anything and I have an ืขื“ ืื—ื“ that you owe me, the ืขื“ ืื—ื“ makes you swear. What does that mean? This ืขื“ ืื—ื“ forces that we need a ื‘ื™ืจื•ืจ here. If there wouldn't be an ืขื“ ืื—ื“, ื”ืžื•ืฆื™ื ืžื—ื‘ื™ืจื• ืขืœื™ื• ื”ืจืื™ื”, you don't pay. But since there's an ืขื“ ืื—ื“, it needs an extra ื‘ื™ืจื•ืจ, an extra verification, and by swearing, this will verify what happened. That's the ืขื ื™ืŸ of a ืฉื‘ื•ืขื”. There's another way to learn a ืฉื‘ื•ืขื”. It's not that, it's not a verification. A ืฉื‘ื•ืขื” is like this, that the ืชื•ืจื” says that in this and this case, whatever the case is, we can't make you pay unless the guy doesn't swear. In other words, the guy who says, \"I don't owe,\" whether I don't owe the 50 or I don't owe against the ืขื“ ืื—ื“, doesn't have to pay. The only time he'll have to pay if he doesn't swear. It's like a ื“ื™ืŸ of ืคื™ืจืขื•ืŸ. It's a way of collecting. You want to collect the money from him? No, the ืชื•ืจื” says in this case, if it's ื›ื•ืคืจ ื”ื›ืœ, you can't collect. So ืžื•ื“ื” ื‘ืžืงืฆืช, you could collect, but when could you collect? Only if the guy doesn't swear. That's what it is. The ื ืคืงื ืžื™ื ื” ื‘ืืžืช between these two ways is, I'll tell you what it is.

First Approach: ืฉื‘ื•ืขื” as Verification

According to the first way, take for the case of a ื—ืฉื•ื“. According to the first way, you know why a ื—ืฉื•ื“ doesn't swear? Because if the ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, even if he swears, we will not have a ื‘ื™ืจื•ืจ. Imagine a guy swears, but you don't know if you could trust him. The whole idea of a ืฉื‘ื•ืขื” is that through this, we clarify, we figure out what happened. But later, the guy swears and we still don't know what happened. So that so you it's a waste of a ืฉื‘ื•ืขื”. There's no ืฉื‘ื•ืขื” if it's A ื‘ื™ืจื•ืจ. No ื‘ื™ืจื•ืจ, ืžืžื™ืœื there is no ืฉื‘ื•ืขื”. So the whole ืฉื‘ื•ืขื” is nothing. According to the second way, no. The whole ืขื ื™ืŸ of ืฉื‘ื•ืขื” is because we can't make you collect unless the guy swears. By a ื—ืฉื•ื“, we just don't let him swear. But in theory, the ืฉื‘ื•ืขื” could be a ืฉื‘ื•ืขื”, because it's not a ื‘ื™ืจื•ืจ. Even a guy who's a ื—ืฉื•ื“ could swear, but ื‘ื™ืช ื“ื™ืŸ will not let the guy swear because he's a ื—ืฉื•ื“, so we don't want him to swear. Something like that. These two ways will be the reason for the ืžื—ืœื•ืงืช between the ื›ื ืกืช ื”ื’ื“ื•ืœื” and the ืฉืขืจ ืžืฉืคื˜. If the reason is because ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, and by a ื—ืฉื•ื“, it will not do the ื‘ื™ืจื•ืจ, a ืกืคืง ื—ืฉื•ื“ will also not do the ื‘ื™ืจื•ืจ. If we, what's ืกืคืง ื—ืฉื•ื“? We don't know if we could trust the guy. So there's a certain case where we definitely can't trust him, and there are a certain case where maybe we can't trust him. But the bottom line is, if the guy will swear, will we know what happened or not? ืกืคืง ื‘ื™ืจื•ืจ. So ืกืคืง ื‘ื™ืจื•ืจ, no such thing as a ืกืคืง ื‘ื™ืจื•ืจ. You ever hear of a ืกืคืง ื‘ื™ืจื•ืจ? Either it's ืžื‘ื•ืจืจ, and it's a ืกืคืง if it's ืžื‘ื•ืจืจ. We learned when it comes to a ืฉื‘ื•ืขื” people won't swear falsely. But this guy's a ื—ืฉื•ื“, that's the thing. That's by a regular person, but by a ื—ืฉื•ื“, not. So it comes out that a ืกืคืง ื—ืฉื•ื“ is exactly like a ื—ืฉื•ื“. If the whole idea of a ืฉื‘ื•ืขื” is it's a ื‘ื™ืจื•ืจ. It's not a ืคื•ืฉืข. It's not a ืคื•ืฉืข. No, now you can say we don't know. Oh, ืกืคืง ื—ืฉื•ื“ is a ืกืคืง, can be ื“ืื•ืจื™ื™ืชื, ื“ืจื‘ื ืŸ. No, the ืกืคืง ื‘ื™ืจื•ืจ, there's no such thing as a ืกืคืง ื‘ื™ืจื•ืจ. I always give the example of ืกืคื™ืจื” as the ื“ื‘ืจ ืื‘ืจื”ื says, the ืจื‘ื™ brings it, and he says it's a ืฉื›ืœ'ื“ื™ื’ืข ืกื‘ืจื, you cannot count ืกืคื™ืจื” ืžืกืคืง. I mentioned it the other week, last couple of weeks. You can't count. Can't say, well, I'll count today two or three. The whole idea of counting is to know what happened, to know what it is. If I count and I still don't know, it's like it's like I didn't count. How does it help to you had a ืกืคืง counting? There's no such thing as a ืกืคืง ื‘ื™ืจื•ืจ. I gave you the example of a ืฉื˜ืจ. The whole idea of a ืฉื˜ืจ is to verify what he borrowed money. If I have a ืฉื˜ืจ that's written in such a way that after I read it, I still don't know whether Tom owes, say, okay, so at least there's a ืกืคืง. It's nothing. There's no such thing as a ืกืคืง ืฉื˜ืจ. Same thing here, there's no thing as a ืกืคืง ื‘ื™ืจื•ืจ. ื‘ื™ืจื•ืจ means ื•ื“ืื™. If you don't know, it's not. So what's the difference if you're a ื—ืฉื•ื“ for sure, or you're a ืกืคืง ื—ืฉื•ื“ which we're still not sure, so it's no ืฉื‘ื•ืขื”. But if you learn that the ืฉื‘ื•ืขื” is not because of you're a ื‘ื™ืจื•ืจ, there's a ื“ื™ืŸ ืฉื‘ื•ืขื”. So if there's a ื“ื™ืŸ ืฉื‘ื•ืขื”, in the case where there's a ืกืคืง, so there's a ืกืคืง ื“ื™ืŸ ืฉื‘ื•ืขื”. That's the ืžื—ืœื•ืงืช. The ื›ื ืกืช ื”ื’ื“ื•ืœื” says that in this case, you can't collect at all. Why? Because it's a ืกืคืง. He holds the second way, that a ืฉื‘ื•ืขื” is not a ื‘ื™ืจื•ืจ. ืžืžื™ืœื there's a ื“ื™ืŸ you have to swear. In this case where there's a ืกืคืง, so it's a ืกืคืง if you have to swear. So there's a ืกืคืง, what can you do about it? You can't do ืžืกืคืง, you can't make him swear ืžืกืคืง. You can't collect money ืžืกืคืง. But the ืฉืขืจ ืžืฉืคื˜ will learn that it's a ื‘ื™ืจื•ืจ. And if it's a ื‘ื™ืจื•ืจ, so a ืกืคืง ื—ืฉื•ื“ is exactly like a ื—ืฉื•ื“. What's the ื“ื™ืŸ by a ื—ืฉื•ื“? The other person. The other person swears, so that's why he says in this case also the other person swears. Okay. So we have the two sides. There's another ืžื—ืœื•ืงืช that we could explain with these two sides. The ืžื—ืœื•ืงืช is like this, the the ืงืฆื•ืช brings the ืžืจื“ื›ื™, that the ืžืจื“ื›ื™ says like this, that the ืจืžื‘\"ื says, what happens if one of the the guy who has to swear is a ื—ืฉื•ื“? But the other guy, the other ื‘ืขืœ ื“ื™ืŸ says, I don't care, he's a ื—ืฉื•ื“, I'll accept the ืฉื‘ื•ืขื”. I'll accept it. So the ืจืžื‘\"ื says, too bad. Can't accept it, this this ืฉื‘ื•ืขื” is for the ื‘ื™ืช ื“ื™ืŸ, not for the other guy. That's right. The ืžืจื“ื›ื™ brings other ืฉื™ื˜ื•ืช, no. The other ืฉื™ื˜ื” says, no, good. If the ื‘ืขืœ ื“ื™ืŸ accepts it, ื’ืขื–ื•ื ื˜ืขืจื”ื™ื™ื˜, so he could swear. What's the ืกื‘ืจื here? The ืกื‘ืจื is very ืคืฉื•ื˜. If a ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, what happens if, and and by a ื—ืฉื•ื“ it's not a ื‘ื™ืจื•ืจ, but if the guy himself says, I accept that ื‘ื™ืจื•ืจ, ื’ืขื–ื•ื ื˜ืขืจื”ื™ื™ื˜. ืชืฉื•ื‘ื”? No, what do you mean ืชืฉื•ื‘ื”? He did ืชืฉื•ื‘ื” like. No, the other guy says, not him. No, the guy who's, a guy against the guy. He wants to collect. And he says this guy has to swear, but ื‘ื™ืช ื“ื™ืŸ says he can't swear, he's a ื—ืฉื•ื“. So he says, I don't care, I accept. If it's a ื‘ื™ืจื•ืจ, I can, ืขืœ ื“ืจืš ืžืฉืœ, if a ืขื“ is a ืงืจื•ื‘, you can't accept him. What happens if the ื‘ืขืœ ื“ื™ืŸ says, I don't care if he's a ืงืจื•ื‘? You're going to bring an ืขื“, your brother's going to be ืžืขื™ื“ that you're right. So beforehand, I said, you know what? I don't care who you bring. If you bring an ืขื“ against me, I'll accept it. Then why make, that's the ื“ื™ืŸ, you're allowed to. But why make him swear? If he says, oh, because he holds he's not going to swear. He hopes he's not going to swear. But he says, but if he does swear, I accept it. So if it's a ื‘ื™ืจื•ืจ, fine, you could do it. ืขืœ ื“ืจืš, look at another example. A ื“ื™ื™ืŸ. A ื“ื™ื™ืŸ can't be a ืงืจื•ื‘, cuz whatever he ืคืกืง'ื ืก doesn't count. But if you accept the ื“ื™ื™ืŸ of, this, I accept the ืงืจื•ื‘ of, I accept two ืงืจื•ื‘ื™ื, you could do it. ื”ืงืจื•ื‘ of the other side. Any ืงืจื•ื‘, even for his side, you know, ืงืจื•ื‘ to you and he can accept a ืงืจื•ื‘ of the other side. What about a ืงื˜ืŸ? You're allowed to give the same waiver to a ืงื˜ืŸ? No, ืงื˜ืŸ is not a It's not a ืžืฆื™ืื•ืช. It's not, yeah, it's not a ืขื“ื•ืช. You could accept ื“ื™ื™ื ื™ื, ื’' ืจื•ืขื™ ื‘ืงืจ. If I say we two have an argument and we say, you know what, let's take three people who are not ื“ื™ื™ื ื™ื, don't know anything, but whatever they'll say we'll do. That's ืคืกืง ื“ื™ืŸ. And whatever they ืคืกืง, and if they take a ืงื ื™ืŸ, that's a ืคืกืง ื“ื™ืŸ. Same thing here. So if it's a ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, then we understand the ืฉื™ื˜ื”, the other ืฉื™ื˜ื” who say that if he accepts it, you accept that ื‘ื™ืจื•ืจ. But for somebody who's a ืฉืงืจ Not a ืฉืงืจ, we don't know. ื—ืฉื•ื“. ื—ืฉื•ื“! We don't know if he's going to lie. And this, so the ื‘ื™ืจื•ืจ is not a real ื‘ื™ืจื•ืจ. ืžืžื™ืœื, if it's not a real ื‘ื™ืจื•ืจ, it's not a ื‘ื™ืจื•ืจ at all. But if I accept that ื‘ื™ืจื•ืจ, just like ืขื“ื•ืช, ืขื“ื•ืช is a ื‘ื™ืจื•ืจ. A ืงืจื•ื‘ is not a ื‘ื™ืจื•ืจ. I accept the ืงืจื•ื‘, you're going to do it. So you're saying that when the ืจื‘ื ืŸ say, \"No, we're not going to allow,\" can you do it So, no, they have no right not to allow. If they don't want, but no, the ืจืžื‘ืดื says you can't. Why? Because the ืจืžื‘ืดื I'm saying holds that it's not a ื‘ื™ืจื•ืจ. It's a ื“ื™ืŸ of ืฉื‘ื•ืขื”. And if it's a ื“ื™ืŸ of ืฉื‘ื•ืขื”, so nothing to do with him, what do you mean not to do with him? It's a ื“ื™ืŸ that we don't let you swear. What did we say before? That the other side is or it's a ื‘ื™ืจื•ืจ, and a ื—ืฉื•ื“ has no ื‘ื™ืจื•ืจ, or it's a ื“ื™ืŸ, and therefore a ื—ืฉื•ื“ can't swear because, not because he can't swear, we will not allow to swear. So if it's not, it's up to us to allow or not to allow, what do you mean the guy accepts it? So who are you to accept it? If the problem is because it's a ื‘ื™ืจื•ืจ and and you think it's not a ื‘ื™ืจื•ืจ, I accept the ื‘ื™ืจื•ืจ. So a person who accepts a ื‘ื™ืจื•ืจ against himself, you could accept it, and if you say it, we accept it. But if it's a ื“ื™ืŸ that ื‘ื™ืช ื“ื™ืŸ makes, it's a ื“ื™ืŸ that you swear you could, if you don't, if you swear in order to be able to collect if you don't swear, and by a ื—ืฉื•ื“ we don't allow you to do it, so what do we care the guy accepts it? We're not allowed, ื‘ื™ืช ื“ื™ืŸ doesn't allow. That's what the ืจืžื‘ืดื holds. So it comes out according to this that what is it the ืจืžื‘ืดื holds? That the ื’ื“ืจ of ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ. Yeah, so there's a So it comes out that the ืจืžื‘ืดื holds that it's a ื‘ื™ืจื•ืจ. Fine. And it's not a ื‘ื™ืจื•ืจ, sorry, no, not a ื‘ื™ืจื•ืจ, it's a ื“ื™ืŸ. It's a ื“ื™ืŸ. So ื“ื™ืŸ is But this seems to contradict a different ื”ืœื›ื” in ืจืžื‘ืดื. The ืจืžื‘ืดื says what happens if a guy swore? A dispute and a guy swore. Later ืขื“ื™ื came and said that this guy is a ื—ืฉื•ื“. They testified this guy is a ื—ืฉื•ื“. It was found out later that he was a ื—ืฉื•ื“. After the ืฉื‘ื•ืขื”. After the ืฉื‘ื•ืขื”. So the ืจืžื‘ืดื says the ืฉื‘ื•ืขื” is no good. ืœืžืคืจืข? ืœืžืคืจืข. Now the

Rambamโ€™s Contradiction on Swearing Rules

question is why? If you hold it's a ื‘ื™ืจื•ืจ, then we understand. Since it's a ื‘ื™ืจื•ืจ, we didn't know it's no good, we thought this was a ื‘ื™ืจื•ืจ. Now we found out that the ื‘ื™ืจื•ืจ is not a real ื‘ื™ืจื•ืจ because the guy who said it is not then I understand why it doesn't work. But if we're saying that the ืจืžื‘ืดื holds that it's not a ื‘ื™ืจื•ืจ, it's a ื“ื™ืŸ, so the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”, ืืœื ืžืื™ we don't let him swear, but if he swore, the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”, so what's wrong here, ืœืคื•ืขืœ he swore? We didn't catch him, so therefore you know he swore. So yeah, but ืœืคื•ืขืœ he swore. And if we're saying that the ืฉื‘ื•ืขื” ื‘ืขืฆื is a good ืฉื‘ื•ืขื” even if he swore, even if he's a ื—ืฉื•ื“ So it's a contradiction? Yes, it seems to be a So that's the contradiction in ืจืžื‘ืดื. Because before we said the ืจืžื‘ืดื says that it's not a ื‘ื™ืจื•ืจ, and ืžืžื™ืœื the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”, ืืœื ืžืื™ we don't let him, and therefore if the guy says, \"I accept it,\" we say, \"Who cares what you accept? We don't let him.\" And now we're saying that the ืจืžื‘ืดื holds that it's a ื‘ื™ืจื•ืจ, because the ืจืžื‘ืดื says that in this case if we if the guy swore already, it's no good. Why is it no good? If we say that the ืจืžื‘ืดื holds that ื‘ืขืฆื the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”, ืืœื ืžืื™ we don't let him, but in the case where we let him, by mistake we let him, but ื‘ืคื•ืขืœ we let him Is there a ืขื ื™ืŸ that it's a mixture of both, ื‘ื™ืจื•ืจ and a ืฉื‘ื•ืขื”? Because the whole point of the ืจื‘ื ืŸ coming and saying we don't let him do it is bringing the ืขื ื™ืŸ of ื‘ื™ืจื•ืจ into the whole mix. Okay, I hear what you're saying. I will say something similar, yeah. I want to say this ื•ื•ืืจื˜, similar, that ืื™ืŸ ื”ื›ื™ ื ืžื™ the ืจืžื‘ืดื holds it's not a ื‘ื™ืจื•ืจ, and therefore when a person when a person swears the the reason why a ื—ืฉื•ื“ doesn't swear is because we don't let him, but the ืฉื‘ื•ืขื” ื‘ืขืฆื is a ืฉื‘ื•ืขื”. But the ืจืžื‘ืดื holds another ื“ื™ืŸ, which is a little bit what you're saying: The whole ืชื•ืงืฃ, the whole concept of a ืฉื‘ื•ืขื” is only if it's through ื‘ื™ืช ื“ื™ืŸ. Only through ื‘ื™ืช ื“ื™ืŸ. There's a ื“ื™ืŸ somewhere, where ืจื‘ื ื• ื—ื ื ืืœ says that if a person had a dispute and then he swore, \"I swear,\" whatever, then he takes it to the ื‘ื™ืช ื“ื™ืŸ, that ืฉื‘ื•ืขื” doesn't count. What, there's a ืžื•ื“ื” ื‘ืžืงืฆืช, but he swore out of the ื‘ื™ืช ื“ื™ืŸ, he has to reswear because that ืฉื‘ื•ืขื” doesn't count. Why not? So he says because the whole concept of a ืฉื‘ื•ืขื”, what you swear privately, that's another ื”ืœื›ื”. The ื“ื™ื ื™ ืฉื‘ื•ืขื” where where we find by ืžืžื•ืŸ, it's a ื“ื™ืŸ that ื‘ื™ืช ื“ื™ืŸ has to be ืžื—ื™ื™ื‘ you. Therefore, this is the ืคืฉื˜ in the ืจืžื‘ืดื. It's like a combination of both. What is the ืคืฉื˜? ื‘ืืžืช ืฉื‘ื•ืขื” is not a ื‘ื™ืจื•ืจ, it's a ื“ื™ืŸ. And therefore when a person swears, even if he's a ื—ืฉื•ื“, the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”. The case where we said that we found out later, ืขื“ื™ื came and said, we found out ืœืžืคืจืข that had we had we known, we would never have let him. The ืฉื‘ื•ืขื” was not a ืฉื‘ื•ืขื”. So ืžืžื™ืœื it's not a ืฉื‘ื•ืขื” ื‘ื‘ื™ืช ื“ื™ืŸ. For a different reason. So it's not a ืฉื‘ื•ืขื” through ื‘ื™ืช ื“ื™ืŸ because it's a ืฉื‘ื•ืขื” done with the false understanding of ื‘ื™ืช ื“ื™ืŸ, ืžืžื™ืœื ื‘ื™ืช ื“ื™ืŸ didn't swear. So the whole concept of a ืฉื‘ื•ืขื” comes if it's with the validation of ื‘ื™ืช ื“ื™ืŸ, if ื‘ื™ืช ื“ื™ืŸ makes you swear. In this case, so it's not because ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ. It's ื ื•ื’ืข to another ื“ื™ืŸ. It's too long to bring in another What happens? What happens if he swore in a ื‘ื™ืช ื“ื™ืŸ, and then they find later that he was he was a cheater? That's what they're saying, no, that's the case it's talking about. But I'm saying, so ืœืžืคืจืข, he did swear in a ื‘ื™ืช ื“ื™ืŸ. Yeah, but that's not called in ื‘ื™ืช ื“ื™ืŸ. I'll bring an example in a second. If we find out later that it's a case where we would not have wanted him to swear, so ื‘ืืžืช in theory we never let him swear. We let him swear under false under false information. So really, looking back, we really didn't this guy we never make swear. We make swear somebody else. We didn't know he was a relative. Yeah, yeah. So we would never let him swear. So it's not like the ืฉื‘ื•ืขื” is no good, we didn't want him to swear. I'll give you an example, I don't want to go into ื‘ืืจื™ื›ื•ืช. There's a case: what happens if a guy brings two ืฉื˜ืจื•ืช to a guy? I have a ืฉื˜ืจ that you owe me a hundred, another ืฉื˜ืจ you owe me a hundred. Each ืฉื˜ืจ has one one ืขื“ on it. Only one. One ืขื“. So there's a ืžื—ืœื•ืงืช. One ืฉื™ื˜ื” is, put the two together so you have one you have two ืขื“ื™ื on one, you can't collect two hundred, but together you have one hundred for sure. Then there's another ืฉื™ื˜ื” that says, yeah, but you have two people saying one hundred. Two people say you owe a hundred dollars. Hundred each. Hundred each. He's claiming two hundred dollars. Oh, two hundred dollars. Yeah, I'm claiming two hundred. But I have one ืขื“ for each, so if they put part of the two things and you have and you have two ืขื“ื™ื for a hundred. Collects one and then he has He collects a hundred. No, he collects a hundred, that's one ืฉื™ื˜ื”. The other ืฉื™ื˜ื” says no, he has a choice. He could say, what are you talking about? The guy could say, no, no, each ืฉื˜ืจ has one ืขื“. What's the ื“ื™ืŸ by one ืขื“? You have to swear. I want him to swear for each one separately, hoping that the guy won't swear. Swear? Cuz he's Cuz the guy who's claiming claims that he's He wants two hundred dollars. No, not only he wants, he says it's true. He hopes the guy won't lie, won't swear false. I'm going to get my two hundred. So why should I accept it if I'll get a hundred? So comes the the ืจื™ืืดื–, and the ืจื™ืืดื– says, I think we don't do this. We don't do this. We make him swear, we don't let him choose. Combine. No, we don't let him choose between the two. What we do is we combine and he collects a hundred. But the question is why? Why can't he collect the whole hundred? What's the matter? Well, he can't collect two hundred. One on each. One ืขื“ on each. Why can't he collect two? Two hundred for sure not. Not without a ืฉื‘ื•ืขื”. Two ืฉื‘ื•ืขื•ืช, two Oh, and let each one separately, and each one he swears, or he doesn't want to swear so he has Why? Because a hundred is for sure we know he owes.

Combining Two Witnesses for a Hundred Dollar Claim

How do you know he owes a hundred? Because you have two ืขื“ื™ื for a hundred! Two different ืฉื˜ืจื•ืช. We have two ืขื“ื™ื for a hundred dollars. How is this a part of it? For this a hundred, for that a hundred. The ื—ื™ืœื•ืง is, even though they're two separate hundreds, but ื‘ืคื•ืขืœ there's two ืขื“ื™ื for a hundred. Right. We're ืžืฆื˜ืจืฃ the two, so two ืขื“ื™ื for a hundred. So we're or two ืขื“ื™ื for a hundred or each one separate, and then you have to swear, hoping you'll get two hundred, but we don't let him. The ืจื™ืืดื– says we don't do that. And the question is why? The guy screams, I'm telling you he's lying. I know he's not going to swear false. I I I I know the guy, he's not going to swear false, so I'll collect them all. Why don't you let me collect two hundred? So the answer they give is for this reason: because if ื‘ื™ืช ื“ื™ืŸ has a right not to let, so there is no ื—ื™ื•ื‘ ืฉื‘ื•ืขื” here. If ื‘ื™ืช ื“ื™ืŸ feels that we want to combine the two because they don't want to they don't want to make him swear because it'll be ืฉื‘ื•ืขืช ืฉื•ื•ื, possible, anyway, so if we have a ื‘ืจื™ืจื” to do this, so if ื‘ื™ืช ื“ื™ืŸ doesn't allow him to swear, then it's no ื—ื™ื•ื‘ ืฉื‘ื•ืขื”. The guy can't come and scream there's a ื—ื™ื•ื‘ ืฉื‘ื•ืขื”, because ื‘ื™ืช ื“ื™ืŸ has a reason not to let him. And the whole ื“ื™ืŸ of ืฉื‘ื•ืขื” is only if ื‘ื™ืช ื“ื™ืŸ makes you swear. So the same thing we want to say over here, also, that the

Rambam on Invalidating an Oath When Suspect Discovered

ืจืžื‘ืดื says if we find out later that the guy was a ื—ืฉื•ื“, so his ืฉื‘ื•ืขื” is off, the ืฉื‘ื•ืขื” is not valid. Why? Not because the ืจืžื‘ืดื holds the ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, and then we found that there was no ื‘ื™ืจื•ืจ, because since didn't have the requirements since ื‘ื™ืช ื“ื™ืŸ, we know now ื‘ื™ืช ื“ื™ืŸ would not have let, so ื‘ืคื•ืขืœ, ื‘ื™ืช ื“ื™ืŸ didn't let. In theory, it's as if ื‘ื™ืช ื“ื™ืŸ didn't let. ื‘ื™ืช ื“ื™ืŸ let somebody else, ื‘ื™ืช ื“ื™ืŸ let a guy who's not ื›ืฉืจ, but the guy that they didn't know. I'll give you an example from the case of of of I mentioned this once before, the ืจื‘ ื—ื™ื™ื's ืคืฉื˜ in the case of ืขื“ื™ื ื–ื•ืžืžื™ื, that the ื“ื™ืŸ is when two ืขื“ื™ื come and say, you killed somebody, and then two other ืขื“ื™ื come and ืžื–ื™ื them, so the ื“ื™ืŸ is ื•ืขืฉื™ืชื ืœื• ื›ืืฉืจ ื–ืžื, you kill the first two ืขื“ื™ื. But the ื“ื™ืŸ is only if they wanted it to happen, but if they did it already, let's say two ืขื“ื™ื said this guy ืžื—ืœืœ ืฉื‘ืช, and ื‘ื™ืช ื“ื™ืŸ killed the guy, and then you ืžื–ื™ื them, then you don't. ื•ืขืฉื™ืชื ืœื• ื›ืืฉืจ ื–ืžื ืœืขืฉื•ืช ืœืื—ื™ื• ื•ืœื ื›ืืฉืจ ืขืฉื”, not if he did it. The ืจืžื‘ืดื has a strange ืฉื™ื˜ื” that this ื›ืœืœ is only by ืžื™ืชื”, not by ืžืœืงื•ืช and not by ืžืžื•ืŸ. If two people come and say this guy did an ืขื‘ื™ืจื”, he deserves ืžืœืงื•ืช, and ื‘ื™ืช ื“ื™ืŸ gave him the ืžืœืงื•ืช, and then two other ืขื“ื™ื came and ืžื–ื™ื them, you will still give the ืžืœืงื•ืช. And we don't say here ื›ืืฉืจ ื–ืžื ื•ืœื ื›ืืฉืจ ืขืฉื”. Why? Why? The ืจืื‘ืดื“ says, I don't know what the ืจืžื‘ืดื is talking about, the ืจืžื‘ืดื is making a mistake, there's no such thing, it's a ื›ืœืœ by everything in any case that you find, you catch him. So regarding ืžืžื•ืŸ, ืชื•ืกืคื•ืช says it's not a problem, because ืžืžื•ืŸ, there's no such thing done, you always get the money back. The question is by ืžืœืงื•ืช, why? So different ืกื‘ืจื•ืช, why how about ืžื™ืชื” and so on. So

Rav Chaim Brisker on Malkot When Witnesses Prove False

ืจื‘ ื—ื™ื™ื ื‘ืจื™ืกืงืขืจ has an interesting ืกื‘ืจื. He says like this: By ืžืœืงื•ืช specifically, there is a special ื”ืœื›ื” of ืžืœืงื•ืช. There's a special ื“ื™ืŸ how you give it, how much you give it, how the strap is, there's a ื“ื™ืŸ of ืžืœืงื•ืช. When they came and said, \"This guy did, ate ื—ื–ื™ืจ.\" For eating ื—ื–ื™ืจ he deserves ืžืœืงื•ืช. They wanted the guy to get ืžืœืงื•ืช. ื‘ืคื•ืขืœ, when you showed that they were false, so ื‘ืคื•ืขืœ there was The ืžืœืงื•ืช was not, not ื›ื“ื™ืŸ. If it's not ื›ื“ื™ืŸ, it doesn't happen to be ืžืœืงื•ืช. So they never got the guy to have ืžืœืงื•ืช! So, what happened was they got the guy to get hit, but not ืžืœืงื•ืช. So it's not ื›ืืฉืจ ื–ืžื. In this case no ืฉื‘ื•ืขื”? So I want to use it as an example, just like over there. Since now we look back and we say that even though ื‘ืฉืขืช ืžืขืฉื” they gave him, it was ืขืœ ืคื™ ื‘ื™ืช ื“ื™ืŸ, and ืขืœ ืคื™ ื‘ื™ืช ื“ื™ืŸ, then it was a ื“ื™ืŸ ืžืœืงื•ืช, but now that we found out that it wasn't, it was false, ืžืžื™ืœื the whole ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ falls off, it's not a ื“ื™ืŸ ืžืœืงื•ืช, same thing here by the ืฉื‘ื•ืขื”. Because the ืฉื‘ื•ืขื” we we let him swear, but now that ืขื“ื™ื came and said he's ื—ืฉื•ื“, so we look back and say, \"Hey, we've never let him swear, so we didn't let him swear,\" and so ืžืžื™ืœื ื˜ืขื• ืœืžืคืจืข ืขืœ ื”ืฉื‘ื•ืขื”. So it's not because it's a ื‘ื™ืจื•ืจ. Okay, so it comes out like this, that

Twoโ€‘Step Reasoning on Oath Obligation for a Suspect

according to the ืจืžื‘ืดื we have these two things. We have when a person is ื—ืฉื•ื“, there's two things: number one, we don't let him swear, ื‘ื™ืช ื“ื™ืŸ doesn't let him swear. But there's another ื“ื™ืŸ we said, because ื‘ื™ืช ื“ื™ืŸ doesn't let him swear, it's not a ืฉื‘ื•ืขื”! There's two steps. See, according to that other opinion, it's ื‘ื™ืจื•ืจ. So, one step: ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ. By a ื—ืฉื•ื“ there's no ื‘ื™ืจื•ืจ, so there's no ืฉื‘ื•ืขื”. According to the ืจืžื‘ืดื, it's not like this. It's not because of a ื‘ื™ืจื•ืจ, so by a ื—ืฉื•ื“ there's also a ื“ื™ืŸ ืฉื‘ื•ืขื”, and just we don't let him swear. Now, as a result, if we don't let him swear, that makes it that there is no ืฉื‘ื•ืขื”, because a ืฉื‘ื•ืขื” is only ืขืœ ืคื™ ื‘ื™ืช ื“ื™ืŸ. But there are two steps here. So I want to say like this: when ืชื•ืกืคื•ืช says that this ื“ื™ืŸ of ื—ืฉื•ื“ ืืžืžื•ื ื, ื—ืฉื•ื“ ืืฉื‘ื•ืขื” is ื“ืจื‘ื ืŸ only, ืชื•ืกืคื•ืช means the second step, not the first. That means like this: ืžื“ืื•ืจื™ื™ืชื, if someone is ื—ืฉื•ื“ ืืžืžื•ื ื, we don't let him swear. Came the ืจื‘ื ืŸ, and the ืจื‘ื ืŸ said that because of that, there is no ืฉื‘ื•ืขื”. That answers the ืงื•ืฉื™ื of the ืงืฆื•ืช right away. The ืงืฆื•ืช asked: how does the ื’ืžืจื want to bring a ืจืื™ื” ื—ืฉื•ื“ ืืžืžื•ื ื is not ื—ืฉื•ื“ ืืฉื‘ื•ืขื” from ืžื•ื“ื” ื‘ืžืงืฆืช? How could a ืžื•ื“ื” ื‘ืžืงืฆืช swear, isn't he ื—ืฉื•ื“ ืืžืžื•ื ื? Why are we making him swear? Because we're afraid he's stealing. And nevertheless, the ืชื•ืจื” says he swears, that's a ืกื™ืžืŸ we don't suspect him someone who is ื—ืฉื•ื“ ืืžืžื•ืŸ, ื—ืฉื•ื“ ืืฉื‘ื•ืขื”. So the ืงืฆื•ืช asks: ืžื•ื“ื” ื‘ืžืงืฆืช is a ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื, this ื“ื™ืŸ of ื—ืฉื•ื“ ืžื—ืฉื•ื“ is ื“ืจื‘ื ืŸ, ืชื•ืกืคื•ืช says, so what's the ืจืื™ื”? I'm saying, it's a ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื. Even according to ืชื•ืกืคื•ืช says it's ื“ืจื‘ื ืŸ, ืชื•ืกืคื•ืช doesn't mean that the whole thing is ื“ืจื‘ื ืŸ. The fact that you don't let a guy swear if he's ื—ืฉื•ื“, that's ื“ืื•ืจื™ื™ืชื! What did the ืจื‘ื ืŸ add? They added another step, that even if he does swear, it's not a ืฉื‘ื•ืขื”. That's the second thing. That's not It's to be ืžื‘ื˜ืœ. That's that's the ืจื‘ื ืŸ. They're not obliged for a ืฉื‘ื•ืขื”. And that's what the ื’ืžืจื brings a ืจืื™ื”: ืžื•ื“ื” ื‘ืžืงืฆืช swears, so the ื’ืžืจื says, how do we let him swear? A ืกื™ืžืŸ that we don't care. And if you do care, you wouldn't let him swear. And this ื“ื™ืŸ that you do care is a ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื, even according to ืชื•ืกืคื•ืช. What's not ื“ืื•ืจื™ื™ืชื is the second step. That's ืžื‘ื˜ืœ, the second step is ืžื‘ื˜ืœ it. The second step makes the ืฉื‘ื•ืขื” is no ืฉื‘ื•ืขื”. So when ืชื•ืกืคื•ืช says that it's only a ื“ื™ืŸ ื“ืจื‘ื ืŸ, doesn't mean that the fact that we don't let him swear is a ื“ื™ืŸ ื“ืจื‘ื ืŸ. What the ื“ื™ืŸ ื“ืจื‘ื ืŸ is, that the ืฉื‘ื•ืขื” is no ืฉื‘ื•ืขื”. But the fact that if you don't let him swear if we hold ื—ืฉื•ื“ ืขืœ ื”ืžืžื•ื ื” is ื—ืฉื•ื“ ืขืœ ื”ืฉื‘ื•ืขื” is a ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื. If it's a ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื you never get to the second step. Right, that's Then if the ืจื‘ื ืŸ says, \"Actually, no, the ืจื‘ื ืŸ made it so it's not a ืฉื‘ื•ืขื”.\" In other words, this ื“ื™ืŸ that if you found out later, it doesn't work, that's what the ืจื‘ื ืŸ made a ื“ื™ืŸ. But you could say that if it's ื“ืื•ืจื™ื™ืชื that you're not allowed to swear, yeah, you couldn't But ื“ืื•ืจื™ื™ืชื comes out, no, the ื“ืื•ืจื™ื™ืชื says, no! We're saying the ื“ืื•ืจื™ื™ืชื is that you don't let him swear, not that it's no ืฉื‘ื•ืขื”. Ah, so According to the ืจืžื‘ืดื, that ื‘ืืžืช the ืฉื‘ื•ืขื” is, it's not a ื‘ื™ืจื•ืจ, the ืฉื‘ื•ืขื” is like the ืฉื‘ื•ืขื”. ืืœื ืžืื™? The ืชื•ืจื” says, \"Don't let him swear.\" But the way it's ืžื“ืื•ืจื™ื™ืชื, don't let him swear, but if he ื›ืืคื˜ ืืจื™ื™ืŸ, somehow he swore, it's a good ืฉื‘ื•ืขื”! Came the ืจื‘ื ืŸ, said, \"Sorry, has to be through a ื‘ื™ืช ื“ื™ืŸ, and if not a ื‘ื™ืช ื“ื™ืŸ, there's no ืฉื‘ื•ืขื”.\" Ah. So what the ื’ืžืจื is asking here, if ื—ืฉื•ื“ ืžื—ืฉื•ื“ ื”ืฉื‘ื•ืขื”, is it's talking about the ื“ื™ืŸ ื“ืื•ืจื™ื™ืชื, even though ืชื•ืกืคื•ืช says it's ื“ืจื‘ื ืŸ. ื“ืจื‘ื ืŸ's the second step! And for that the ื’ืžืจื brings the ืจืื™ื” here. So the answer is the ื“ืื•ืจื™ื™ืชื part is the active, is the Is a is a ื“ื™ืŸ that you don't swear, that you don't let him swear, is ื“ืื•ืจื™ื™ืชื. Only when we're making a conscious decision, that's the Yeah. Now according to this, it comes out like this. You're saying that's the ืจื‘ื ืŸ's No, but because the ืจื‘ื ืŸ are the ones that decide what's better for society. Yeah, yeah, but here also here the ืจื‘ื ืŸ the ืชื•ืจื” says don't let, but the ืชื•ืจื” didn't go as far as saying that even if he swore it's no ืฉื‘ื•ืขื”. That the ืจื‘ื ืŸ didn't say, that the ืชื•ืจื” didn't say. And the ืจื‘ื ืŸ went further, and they took away all the ืฉื‘ื•ืขื•ืช, for whatever reason, for society, for whatever reason. Yeah, but here Yes, but here the ื’ื‘ืจื was already before. Yeah. And the ืจื‘ื ืŸ, yeah, yeah, yeah, yeah, yeah, but if ื“ืื•ืจื™ื™ืชื can make something into the ื’ื‘ืจื, ืชื•ืจื” could make a lot of things into the ื’ื‘ืจื. Now according to this, it comes out like this: that ืžื“ืื•ืจื™ื™ืชื, if you learn this way, ืžื“ืื•ืจื™ื™ืชื the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”, even by a ื—ืฉื•ื“ the ืฉื‘ื•ืขื” is a ืฉื‘ื•ืขื”. The ืจื‘ื ืŸ said the ืฉื‘ื•ืขื” is not a ืฉื‘ื•ืขื”. That's the second step. So ืœื›ืื•ืจื” it's like this: when we say ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” ื•ืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื, that if you're ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” and if you can't swear you have to pay, you know when that is? That is when there is no ืฉื‘ื•ืขื”. You're ืžื—ื•ื™ื™ื‘ a ืฉื‘ื•ืขื”, you're a case where you should swear, but there is no ื“ื™ืŸ ืฉื‘ื•ืขื” here. Like the guy who says, \"Fifty I admit I owe, the rest I don't know.\" You're a ืžื•ื“ื” ื‘ืžืงืฆืช, so you're ืžื—ื•ื™ื™ื‘ a ืฉื‘ื•ืขื”, but there is no concept of a ืฉื‘ื•ืขื” here, ื‘ืคื•ืขืœ. You can't swear, \"I don't know,\" that's not swearing, so there is no ื’ื“ืจ ืฉื‘ื•ืขื”. Same thing in ื—ื˜ืคื” ื“ืจื‘ ืื‘ื: if the guy says, \"I grabbed it, but I grabbed mine,\" and the ืขื“ is not saying it didn't, it's not yours, there's no, that's where we say ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” ื•ืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. In a case where there is a ื“ื™ืŸ ื‘ืคื•ืขืœ, a ื“ื™ืŸ ืฉื‘ื•ืขื”, there you wouldn't say ืžืฉืœื. If there's a ื“ื™ืŸ ืฉื‘ื•ืขื”, how could you say pay? When do you say pay? When you're ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื”, but the ืฉื‘ื•ืขื”, well, fell away, there is no ืฉื‘ื•ืขื”, so instead of that you got to pay. In a case where you can't swear, but there is a ื’ื“ืจ ืฉื‘ื•ืขื”, then you don't say ืžืฉืœื. Now by a ื—ืฉื•ื“, ืžืฉืœื is to pay. But in this case of a ื—ืฉื•ื“, let's see. In the case of a ื—ืฉื•ื“, is there a ื“ื™ืŸ ืฉื‘ื•ืขื” or not? Well, it depends. According to the ืจืžื‘ืดื, there is. According to the other ืฉื™ื˜ื•ืช, there isn't. So if you hold that by a ื—ืฉื•ื“ there is no ืฉื‘ื•ืขื”, because a ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, and in this case there is no ื‘ื™ืจื•ืจ, so this is exactly like every time you're ืžื—ื•ื™ื™ื‘ ืฉื‘ื•ืขื” ื•ืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข. There's no, and he's ืžืฉืœื. If you hold that ื‘ืขืฆื there is a ื“ื™ืŸ ืฉื‘ื•ืขื”, because like we saw, like the ืจืžื‘ืดื holds ื‘ืขืฆื there is a ื“ื™ืŸ ืฉื‘ื•ืขื”, if there is ื‘ืขืฆื a ื“ื™ืŸ ืฉื‘ื•ืขื”, then you can't say ืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. That's the difference between the two reasons. The first reason of ืชื•ืกืคื•ืช says why by a ื—ืฉื•ื“ we don't say ืžืฉืœื, ื‘ืขืฆื you should say, ืชื•ืกืคื•ืช says, because we're afraid that people will take away all his money. At least ื‘ืขืฆื there is. ื‘ืขืฆื what would fit here? It should be ืžืฉืœื. Why? Because the first ืชื™ืจื•ืฅ of ืชื•ืกืคื•ืช holds that by a ื—ืฉื•ื“, not like the ืจืžื‘ืดื, by a ื—ืฉื•ื“ there is no ื“ื™ืŸ ืฉื‘ื•ืขื”. ืฉื‘ื•ืขื” is a ื‘ื™ืจื•ืจ, and by a ื—ืฉื•ื“ there is no ื‘ื™ืจื•ืจ, so there is no ืฉื‘ื•ืขื”. So this is exactly like the other cases, so you have to be ืžืฉืœื. ืืœื ืžืื™, ืชื•ืกืคื•ืช says people will grab his money. The second ืชื™ืจื•ืฅ holds like the ืจืžื‘ืดื, that there is a ื“ื™ืŸ ืฉื‘ื•ืขื” ื‘ืขืฆื ืžื“ืื•ืจื™ื™ืชื, there is a ื“ื™ืŸ ืฉื‘ื•ืขื” even by a ื—ืฉื•ื“. If there is ื‘ืขืฆื a ื“ื™ืŸ ืฉื‘ื•ืขื”, that's what ืชื•ืกืคื•ืช says, the only reason he doesn't swear is because we don't let him. So then in that case we don't say ืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. Look in the words of ืชื•ืกืคื•ืช. The second ืชื™ืจื•ืฅ says, right, ื”ืชื ืืžืจ by there we say we have a ืฉื‘ื•ืขื” ื“ืื•ืจื™ื™ืชื, ืื™ ืชืฉื‘ืข ืื™ ืชืฉืœื, you can't swear so there's no ืฉื‘ื•ืขื”. ืื‘ืœ ื”ื›ื, here, ื”ื•ื ื‘ืจืฆื•ืŸ ื™ื™ืฉื‘ืข, he wants to swear, ื•ืื™ืŸ ืžื ื™ื—ื™ืŸ ืื•ืชื•, if we let him. In other words ืชื•ืกืคื•ืช is stressing this point that the whole reason he doesn't swear by a ื—ืฉื•ื“ is because we don't let him, but ื‘ืขืฆื there's a, if there's ื‘ืขืฆื a ืฉื‘ื•ืขื”, you can't say the ืชื™ืจื•ืฅ ืฉืื™ื ื• ื™ื›ื•ืœ ืœื™ืฉื‘ืข ืžืฉืœื. So the second ืชื™ืจื•ืฅ of ืชื•ืกืคื•ืช holds like the ืจืžื‘ืดื. I will ask a ืฉืืœื”, but the ืจื‘ื ืŸ said there is no ืฉื‘ื•ืขื”. So when the ืจื‘ื ืŸ said there is no ืฉื‘ื•ืขื”, so the bottom line there is no more ืฉื‘ื•ืขื”, so why isn't it ืžืฉืœื? When the ืจื‘ื ืŸ made ื“ื™ื ื™ื, they said ืœื›ืชื—ื™ืœื” by a ื—ืฉื•ื“ we take away the ืฉื‘ื•ืขื”, but we make the other guy swear. They never allowed, see if there would be two steps, they take away the ืฉื‘ื•ืขื”, finished. Okay, now there is no ืฉื‘ื•ืขื”. What happens if there is no ืฉื‘ื•ืขื”? You're ืžื—ื•ื™ื™ื‘ a ืฉื‘ื•ืขื”, but there is no ืฉื‘ื•ืขื”, ืžืฉืœื! That's not what the ืจื‘ื ืŸ did. At the same time when they took away the ืฉื‘ื•ืขื”, they said let the other guy swear! So there's no step here of of of of of no ืฉื‘ื•ืขื”, of of saying that there is no ืฉื‘ื•ืขื” and then stop, so therefore ืžืฉืœื. So therefore, the ืคืฉื˜ is that the ืจื‘ื ืŸ, that the ืจื‘ื ืŸ ืชืงื ื” has no problem, because the ืจื‘ื ืŸ said ืฉื›ื ื’ื“ื•, that's what ืชื•ืกืคื•ืช says. According to the second ืคืฉื˜, ืžื“ืื•ืจื™ื™ืชื there is a ืฉื‘ื•ืขื”, so ืžื“ืื•ืจื™ื™ืชื you can't say ืžืฉืœื, and when the ืจื‘ื ืŸ said that there is no ืฉื‘ื•ืขื”, they together with saying there is no ืฉื‘ื•ืขื”, they right away said let the other guy swear. What would be in a case where the ืจื‘ื ืŸ said this, and it's not possible for the other guy to swear? Then the ืฉื‘ื•ืขื” fell off! We'll go back to ืžืฉืœื! That answers the other ืงืฉื™ื. What was the other ืงืฉื™ื? If they're both ื—ืฉื•ื“, they're both ื—ืฉื•ื“, we said you can't make the other guy swear, ื—ื–ืจื” ืฉื‘ื•ืขื”, the other first guy is ื—ื™ื™ื‘, and since he can't swear, he pays. So we asked a ืงืฉื™ื, according to the second ืชื™ืจื•ืฅ of ืชื•ืกืคื•ืช, anytime where you're ready to swear but the ื‘ื™ืช ื“ื™ืŸ doesn't let you, you you you can't say ืžืฉืœื, because he claims, so what's the ื—ื™ืœื•ืง if the other guy is ื—ืฉื•ื“? But he is claiming, \"How could you make me pay when I want to swear?\" The ืคืฉื˜ is different, because the the moment the other guy is also a ื—ืฉื•ื“, so there is no ื“ื™ืŸ ื“ืจื‘ื ืŸ that the other guy swears, so what remains? That this guy is ื—ื™ื™ื‘ a ืฉื‘ื•ืขื”, and there is no ืฉื‘ื•ืขื”. Who said there is no ืฉื‘ื•ืขื”? The ืจื‘ื ืŸ said there is no ืฉื‘ื•ืขื”. I'm saying there is no The ืจื‘ื ืŸ took away the ืฉื‘ื•ืขื”, there's nobody to swear, the ืจื‘ื ืŸ took away the ืฉื‘ื•ืขื”. When did the ืจื‘ื ืŸ not take away the ืฉื‘ื•ืขื”? They did take away, but when did they? ื‘ืฉืขืช together with taking away the ืฉื‘ื•ืขื”, they came and said transfer. Transfer. So you say ืชื ื—ื–ื™ ืžื“ืื•ืจื™ื™ืชื there is a ืฉื‘ื•ืขื”, so he can't say ืžืฉืœื. But what did the ืจื‘ื ืŸ do? The ืจื‘ื ืŸ, when they said it, they said right away give back to transfer the ืฉื‘ื•ืขื”. But in a case where the ืจื‘ื ืŸ did not say transfer the ืฉื‘ื•ืขื”, why did they not say? Because the other guy is also a ื—ืฉื•ื“. So what remains? It remains that there is no ืฉื‘ื•ืขื” ืžื“ืจื‘ื ืŸ, but if there's no ืฉื‘ื•ืขื” ืžื“ืจื‘ื ืŸ ืžืžื™ืœื there is no ืฉื‘ื•ืขื”, so you say ืžืฉืœื. No, but I know, now I'm saying that the reason is not because he just can't The reason is because there is no ืฉื‘ื•ืขื”. When do you say ืžืฉืœื? When there is no ื“ื™ืŸ ืฉื‘ื•ืขื”. You're ืžื—ื•ื™ื‘ a ืฉื‘ื•ืขื” and there is no ื“ื™ืŸ ืฉื‘ื•ืขื”. Remains no ื“ื™ืŸ ืฉื‘ื•ืขื”. According to the ืจืžื‘ืดื by a regular ื—ืฉื•ื“ there is a ื“ื™ืŸ ืฉื‘ื•ืขื” ืžื“ืื•ืจื™ื™ืชื. No, that's what I'm saying. The ื›ืœืœ is when do we say ืžืฉืœื? When there is no ืฉื‘ื•ืขื”. So instead of a ืฉื‘ื•ืขื”, you pay. But if there is a ื“ื™ืŸ ืฉื‘ื•ืขื”, there is no instead, because the ื“ื™ืŸ ืฉื‘ื•ืขื” is still here. So according to the ืจืžื‘ืดื by a regular ื—ืฉื•ื“, there's still a ื“ื™ืŸ ืฉื‘ื•ืขื”, you don't say ืžืฉืœื. Either the ืจื‘ื ืŸ took it away, the ืจื‘ื ืŸ right away changed it to ืฉื›ื ื’ื“ื•. But in a case where they couldn't change it, so it remains there is no ืฉื‘ื•ืขื”. ื”ืœื›ื” ื›ืจื‘ื•ืชื™ื ื• ืฉื‘ื‘ื‘ืœ. Yeah, the ืจืžื‘ืดื ืคืกืง that he has to pay, that it goes back to him, he's ืžื—ื•ื™ื‘ ืฉื‘ื•ืขื” and you don't look at the other guy at all, he pays. The ื’ืžืจื uses the ืœืฉื•ืŸ ืจื‘ื•ืชื™ื ื• ืฉื‘ื‘ื‘ืœ, ืจื‘ื•ืชื™ื ื• ืฉื‘ืืจืฅ ื™ืฉืจืืœ. You pay 50. That's why?

Concept of Combining Witnesses (ืฆื™ืจื•ืฃ) for Monetary Claims

Because for 50 you have for sure two ืขื“ื™ื. Because ื™ืฉ ื‘ื›ืœืœ ืžืืชื™ื ืžื ื”. You have a 100, you have 50 in 100. In the 100 you have 50. So the other 50 we don't know because we only have one witness. A cow? A cow is worth how much? Now you are also saying two different loans, what's the difference if it's a cow or not? Yeah, the value, yeah, money is the value. Yeah, money is value. Right, but ืกื•ืฃ ื›ืœ ืกื•ืฃ you have two ืขื“ื™ื. That's the whole ื—ื™ื“ื•ืฉ that there's a ืฆื™ืจื•ืฃ of these two. Common denominator, it's the value, so we have There's a ืฉืืœื”, ื”ื•ื ื’ื•ืคื™ื” is a ืฉืืœื” do we combine In some places you say ื“ื‘ืจ ื•ืœื ื—ืฆื™ ื“ื‘ืจ. And each one is a ื—ืฆื™ ื“ื‘ืจ. ืœืžืฉืœ if you have by two ืฉืขืจื•ืช is the ืฉืืœื”. ืฉืขืจื•ืช, when a person has to be a ื’ื“ื•ืœ to be ื—ื™ื™ื‘. You have two witnesses. Two witnesses have to see that they have two ืฉืขืจื•ืช, two hairs. What happens you have one witness saw one hair, one on the other hair? They're attached. What happens you have one witness saw two hair, and another witness saw other two hair? See, you have two witnesses for a hair. Not everybody agrees with that. No, because each two witnesses see two hairs. Each ืขื“ is only It's the same, that's like analogous That's a ืฆื™ืจื•ืฃ, exactly the same thing. ืฆื™ืจื•ืฃ, we know a lot about ืฆื™ืจื•ืฃ. 231. ื™ื™ืฉืจ ื›ื—! Thank you, Rabbi. Thank you, it's not it's nothing without you guys, man. Just want you know, just ask Roz, it's nothing without you guys. Because I'm nothing.
