Jewish Audio on Chabad.org. Today's 砖讬注讜专 will be 诪住讻转 讘讘讗 诪爪讬注讗 讚祝 讻状讝, but we will start two lines from the bottom of the 注诪讜讚 on 讚祝 讻状讜 注诪讜讚 讘壮. The 讙诪专讗 quotes the 诪砖谞讛. It said in the 诪砖谞讛: 讛诇讜拽讞 驻讬专讜转 诪讞讘讬专讜 讜讻讜诇讬. If someone buys 驻讬专讜转, produce, from his friend, or his friend sent him 驻讬专讜转, and he found money in the 驻讬专讜转 that he got, so the 诪砖谞讛 says: 讛专讬 讗诇讜 砖诇讜, he's able to keep it. So the 讙诪专讗 explains: 讗诪专 专讬砖 诇拽讬砖 诪砖讜诐 专讘讬 讬谞讗讬, 专讬砖 诇拽讬砖 said in the name of 专讘讬 讬谞讗讬: 诇讗 砖谞讜, this was not taught, 讗诇讗 讘诇讜拽讞 诪谉 讛转讙专, only if you buy the fruit from the merchant. Since the merchant himself bought it from many 讘注诇讬 讘转讬诐, from many different people, and as 专砖状讬 says, this is something that has no 住讬诪谉. And we don't know from which of the people it fell. Since the merchant that bought it mixed them all up, so we don't know from which 讘注诇 讛讘讬转 it came from. So therefore, you're allowed to keep it because the 讘注诇 讛讘讬转 himself is definitely 诪讬讗砖 knowing that that merchant he sold it to bought the fruit, other fruit from different merchants, too, so the finder will not know whom to return it to. And therefore, he is 诪讬讗砖, and that is the reason why the one that bought it is able to keep it. 讗讘诇 讘诇讜拽讞 诪讘注诇 讛讘讬转, but if you buy directly from a 讘注诇 讛讘讬转, so you know you buy it from a merchant and he himself bought it from many 讘注诇讬 讘转讬诐. So we don't know from which 讘注诇 讛讘讬转 this money came, therefore you do not have to return it, and you're allowed to keep it. But

Tosafot's Question on Merchant vs Owner

转讜住驻讜转 asks a 拽砖讬讗. According to this, why did the 讙诪专讗 say that this 讚讬谉 was only taught if you buy it from a merchant? Why didn't the 讙诪专讗 say that this 讚讬谉 is talking by the merchant himself? Since the reason why if you bought it from a merchant you do not have to return it, because since the merchant bought it from many people, so you don't know from which one it came from, why can't we say the same 讚讬谉 by the merchant himself? Since the merchant himself bought it from many people, so he doesn't know to which one to return it. So therefore, the owner, the one that lost it definitely is 诪讬讗砖 knowing that the merchant himself that bought from him also bought other fruit from other people, so the merchant will not know whom to return it. So he is 诪讬讗砖, therefore the merchant is able to keep it. So why do we have to say that the 诪砖谞讛 is talking in a case that a person bought it from the merchant, and you don't have to return it because the merchant himself bought it from many people? Why can't we say they're talking about the merchant himself? That if the merchant found it, he does not have to return it because he bought his fruit from many different people, and he doesn't know whom to return it to, and therefore he's allowed to keep it. And 转讜住驻讜转 says that the reason the 讙诪专讗 doesn't want to speak about the merchant himself is because there it's not a clear-cut 讚讬谉. There is a case where if the merchant himself bought it, that he should have to return it. And that is, for instance, if he bought it and he didn't get a chance to mix the fruit yet. So he knows each package where he bought it from, so if he finds money in one of the packages, he would know from what whom this package came, and therefore he would have to return it. While in the case of a person that bought it from the merchant, by the time it comes to the customer who buys it from the merchant, it is already mixed up by the merchant. So then he doesn't know already which fruit came from which person, and therefore the buyer from the merchant does not have to return it. And that is the reason 转讜住驻讜转 says the 讙诪专讗 would rather pick the case of a person who bought it from the merchant, cuz then in all cases you're allowed to keep it, while if the 讙诪专讗 would say that this is speaking about the merchant himself, it is not a clear-cut 讚讬谉, not in all cases would be the 讚讬谉 that he would be able to keep it. Another 转讬专抓 转讜住驻讜转 gives is that even without this reason that the merchant probably mixed up the fruit, that is the reason why you're allowed to keep it, there is still a reason why you're allowed to keep it. The reason is because the person who found it, if he is a buyer from the merchant, doesn't know who lost it, the merchant or the 讘注诇 讛讘讬转? Even if the merchant bought it from one 讘注诇 讛讘讬转, still there is a 住驻拽 by the customer from the merchant whether it belongs to the merchant or belongs to the 讘注诇 讛讘讬转. And therefore, he does not have to return it, while the merchant himself knows from whom he bought it. And then 转讜住驻讜转 goes on even more, that even if we're going to say that usually the money doesn't fall out any other time but at the time of threshing, so then we know for sure it fell from the 讘注诇 讛讘讬转, not from the merchant, so then the 住驻拽 that we just said that the customer doesn't know whether to return it to the merchant or to 讘注诇 讛讘讬转 falls off, because he knows for sure it didn't fall from the merchant, it definitely fell from the 讘注诇 讛讘讬转, still 转讜住驻讜转 says he would not have to return it, because he doesn't know from which 讘注诇 讛讘讬转 the merchant bought it. While the merchant himself knows from which 讘注诇 讛讘讬转 he bought it and he would have to return it. But then 转讜住驻讜转 asks, according to this, even if the merchant found it, he should be able to keep it, because the 讘注诇 讛讘讬转 knows that when he sells it to the merchant, the merchant is going to sell it to others, and If the buyer from the merchant will find it, he will not know whom to return it to because he does not know from who, which 讘注诇 讛讘讬转 the 转讙专, the merchant bought it. So, therefore, why don't we say that the 讘注诇 讛讘讬转 who sold it to the merchant is definitely 诪讬讬讗砖, thinking that probably the merchant already sold it to the customer, and therefore he will never get it back? So, even if the merchant himself found it, he should be able to keep it because we assume that the 讘注诇 讛讘讬转 was 诪讬讬讗砖. And 转讜住驻讜转 says that this is also not a clear-cut thing, because it's possible that the merchant should find it before there is even a chance that he should have sold it to others. And in a case like that, the owner, the one that lost it, is not 诪讬讬讗砖. And therefore, the 讙诪专讗 does not want to pick the example of the merchant himself, because it is not clear that in all cases he would be able to keep it. Therefore, the 讙诪专讗 says that the case of the 诪砖谞讛, where you are definitely allowed to keep it, it is if you are a customer from the merchant. So then you're definitely allowed to keep it because you don't know from which 讘注诇 讛讘讬转 the merchant bought it, and therefore you do not have to return it. And now we

Transition to Mishnah on Returning Lost Items

will continue with the 诪砖谞讛. The 诪砖谞讛 here refers to the 驻住讜拽 that deals with the 诪爪讜讛 of 讛砖讘转 讗讘讬讚讛. And this is a 驻住讜拽 in 驻专砖转 讻讬 转爪讗, 拽驻讬讟诇 讻"讘, 驻住讜拽 讙'. This 驻住讜拽 comes after the first two 驻住讜拽讬诐. 驻住讜拽 讗' starts with the words: 诇讗 转专讗讛 讗转 砖讜专 讗讞讬讱 讗讜 讗转 砖讬讜 谞讚讞讬诐 讜讛转注诇诪转 诪讛诐 讛砖讘 转砖讬讘诐 诇讗讞讬讱. That if you see an ox of your brother, or a sheep of your brother, and you find them, do not turn away from it, you must return it to your brother. Then the 驻住讜拽 讘' continues: 讜讗诐 诇讗 拽专讜讘 讗讞讬讱 讗诇讬讱 讜诇讗 讬讚注转讜, if your brother is not close to you, you do not know him, 讜讗住驻转讜 讗诇 转讜讱 讘讬转讱, take it into your house, 讜讛讬讛 注诪讱, it should be with you, 注讚 讚专讜砖 讗讞讬讱 讗讜转讜, till your brother will look for it, search for it, 讜讛砖讘讜转讜 诇讜, and then you will return it to him. Then comes 驻住讜拽 讙', and it says like this: 讜讻谉 转注砖讛 诇讞诪讜专讜, the same you should do with his donkey, 讜讻谉 转注砖讛 诇砖诪诇转讜, the same you should do with his garment, 讜讻谉 转注砖讛 诇讻诇 讗讘讚转 讗讞讬讱 讗砖专 转讗讘讚 诪诪谞讜 讜诪爪讗转讛, so you should do with any object that your brother will lose, that will be lost from him and you will find, 诇讗 转讜讻诇 诇讛转注诇诐, you are not allowed to turn away, close your eyes from it, make yourself as if you do not see it. In other words, if you see anything that's lost from your brother, from another 讗讬讚, you must take it and return it. If you do not know who it belongs to, hold it till you will find the person it belongs to and you will return it to him. So the

Question: Why Mention the Garment Separately

诪砖谞讛 asks, why did the 驻住讜拽 have to specify that you should do the same to the 砖诪诇讛, to the garment of your brother? And the 诪砖谞讛 starts like this: 讗祝 讛砖诪诇讛 讛讬转讛 讘讻诇诇 讻诇 讗诇讜. The garment was also included in all these, since the 驻住讜拽 says: 讜讻谉 转注砖讛 诇讻诇 讗讘讚转 讗讞讬讱, so you should do to anything that your brother loses, so we understand any garment or any object he loses. So why did the 驻住讜拽 have to specify that so you should do to his garment? Isn't garment included in 讻诇 讗讘讚转 讗讞讬讱? And the 讙诪专讗 will also explain why we need the other words: 讞诪讜专讜 and 砖诪诇转讜, etc. But the 诪砖谞讛 is dealing with the word 砖诪诇讛. That 砖诪诇讛 was also included in the 驻住讜拽 of 讻诇 讗讘讚转 讗讞讬讱. 讜诇诪讛 讬爪讗转? Why did it go out? Why was it mentioned separately in addition to the general word of 讻诇 讗讘讚转 讗讞讬讱? 诇讛拽讬砖 讗诇讬讛, to compare to it. This is supposed to teach you a 讚讬谉, that we're supposed to compare all 讗讘讬讚讜转 to 砖诪诇讛. 诇讜诪专 诇讱, to tell you: 诪讛 砖诪诇讛 诪讬讜讞讚转 砖讬砖 讘讛 住讬诪谞讬诐 讜讬砖 诇讛 转讜讘注讬诐, just like a garment is something that definitely has 住讬诪谞讬诐, most garments have 住讬诪谞讬诐, it is also something that has somebody who will claim it, who will look for it. Since a garment was made by a person, so it has an owner, it has somebody that owns it. It is not like a natural thing that not necessarily belongs to anybody. But this is something that was made by somebody, so this belongs to somebody. So the 转讜专讛 tells us that by mentioning 砖诪诇讛, you should learn out that only objects which are similar to a 砖诪诇讛 you must return. Just like a 砖诪诇讛 has 住讬诪谞讬诐, and it belongs to somebody, it has somebody that will claim it, 讗祝 讻诇 讚讘专 砖讬砖 讘讜 住讬诪谞讬诐 讜讬砖 诇讜 转讜讘注讬诐 讞讬讬讘 诇讛讻专讬讝. So too, anything which has a 住讬诪谉 and anything which has an owner, has somebody who will claim it, you have to announce it, you have to return it. But if it doesn't have 住讬诪谞讬诐, or if it doesn't have anybody who will claim it, then you do not have to return it. In other words, if it's something that the owner was 诪讬讬讗砖, so it doesn't have an owner anymore, so then you are allowed to keep it. And the 讙诪专讗 explains it: 诪讗讬 讘讻诇诇 讻诇 讗诇讜? What did the 诪砖谞讛 mean when it said that 砖诪诇讛 was included in all these? 讗诪专 专讘讗, so 专讘讗 said it meant: 讘讻诇诇 讻诇 讗讘讚转 讗讞讬讱. cluded in the words 讻诇 讗讘讚转 讗讞讬讱, all the objects that your brother lost, and the 诪砖谞讛 is trying to explain why the 驻住讜拽 has to mention separately the word 砖诪诇讛. Then the 讙诪专讗 continues.

Rava Asks About Torah's List of Examples

When the 转讜专讛 speaks about the 诪爪讜讛 of 讛砖讘转 讗讘讬讚讛 that if you find an object belonging to another 讬讬讚 you must return it, so the 转讜专讛 mentions a few examples. It mentions 砖讜专. It starts off by saying 诇讗 转专讗讛 讗转 砖讜专 讗讞讬讱, do not see the ox of your brother lost, and not return it, in other words, you must return his ox. The 转讜专讛 also mentions 砖讬讜, his sheep. The 转讜专讛 also mentions that so you should do to his donkey, so you should do to his garment, and then the 转讜专讛 says and so you should do to anything else that he lost. So why did the 转讜专讛 have to specify and give an example of an ox, a donkey, a sheep, and a garment? And he says, 爪专讬讻讗, we need them all. 讚讗讬 讻转讘 专讞诪谞讗 砖诪诇讛, if the 转讜专讛 would just write the example of a garment, 讛讜讛 讗诪讬谞讗, I would think, 讛谞讬 诪讬诇讬 讘注讚讬诐 讚讙讜驻讛 讜住讬诪谞讬诐 讚讙讜驻讛, that you only return the object, the garment, if there are witnesses that recognize the garment itself, or if there are 住讬诪谞讬诐 in the garment itself. 讗讘诇, but 讞诪讜专 讘注讚讬诐 讚讗讜讻祝 讜住讬诪谞讬诐 讚讗讜讻祝, 讗讬诪讗 诇讗 谞讛讚专讬 诇讬讛. But if you have a donkey, and the witnesses recognize the saddle of the donkey, or there are 住讬诪谞讬诐 in the saddle of the donkey, I would think that you do not return the donkey based on the witnesses of the saddle or the 住讬诪谞讬诐 of the saddle. 讻转讘 专讞诪谞讗 讞诪讜专, therefore the 转讜专讛 also mentions 讞诪讜专, an extra word, giving an example of a donkey to teach us, 讚讗驻讬诇讜 讞诪讜专 讘住讬诪谞讬 讗讜讻祝, that even if the 讞诪讜专, you do not recognize the 讞诪讜专 itself, but there are 住讬诪谞讬诐 on the saddle of the 讞诪讜专, you also return the 讞诪讜专. 砖讜专 讜砖讛 讚讻转讘 专讞诪谞讗 诇诪讛 诇讬? So now we know why the 转讜专讛 has to write 砖诪诇讛, and the 转讜专讛 has to write 讞诪讜专. But why does the 转讜专讛 have to write the example of an ox and the example of a sheep? So he says,

Lesson from Ox Example and Tail Shearing

砖讜专, the reason the 转讜专讛 also gives an example of an ox, to teach us 讚讗驻讬诇讜 诇讙讬讝转 讝谞讘讜, that even the shearing of the tail, that if there is hair in the tail and you shear, you cut off that hair, you must return that too. That when you return the ox, you must return everything that came along with it, including the hair that grew on its tail, even though it's very little, nevertheless you must return it. And 砖讛, the reason the 转讜专讛 gives another example of 砖讛, which is also an extra word, 诇讙讬讝讜转讬讛, to tell you that the shearing of the sheep must be returned, too. That the wool that you took off the sheep must be returned when you return the sheep. But then the 讙诪专讗 asks, 讜诇讬讻转讜讘 专讞诪谞讗 砖讜专, why doesn't the 转讜专讛 just write 砖讜专? We would know from there 讚讗驻讬诇讜 诇讙讬讝转 讝谞讘讜, that even the shearing of its tail must be returned, so I would know myself 讜讻诇 砖讻谉 诇讙讬讝讜转讬讛, certainly that if you have the wool from the sheep you must certainly return. If you must return the hair of the tail, which is so little, you certainly must return the wool of the sheep. So why does the 转讜专讛 have to tell us that this, too, must be returned by adding the extra word 砖讛? For the truth is, there is no answer to this 拽砖讬讗. But while 专讘讗 was saying that there is no answer why the 转讜专讛 has to write the word 砖讛, he already mentions another word, that the word 讞诪讜专 that it says by the 讚讬谉 of 讘讜专 according to 专讘讬 讬讛讜讚讛 is also an extra word. Concerning the 讚讬谉 of 讘讜专, it's one of the 讗讘讜转 谞讝讬拽讬谉, one of the kinds of damages that a person would have to pay for. If a person digs a hole, the 转讜专讛 says, 讜谞驻诇 砖诪讛 砖讜专 讗讜 讞诪讜专, if an ox or a donkey fall in and are damaged, you must pay for them. And the 讙诪专讗 says that we learn out from these two words, 讜谞驻诇 砖诪讛 砖讜专 讗讜 讞诪讜专, if an ox or a donkey would fall in, so why does the 转讜专讛 mention these two examples? To teach us two 讚讬谞讬诐: 砖讜专 讜诇讗 讗讚诐, and not a person. If a person would fall in, the one that made the hole would be 驻讟讜专. 讞诪讜专 讜诇讗 讻诇讬诐. And the word donkey teaches us only if a donkey falls in and not 讻诇讬诐. If vessels fall in and are broken, then the owner of the 讘讜专, of the pit, does not have to pay for it. 专讘讬 讬讛讜讚讛 holds that even if 讻诇讬诐 fall in, you do have to pay. So according to 专讘讬 讬讛讜讚讛, why does the 转讜专讛 have to mention 讞诪讜专, since there is nothing that we learn out from the word 讞诪讜专? And that's what the 讙诪专讗 says here, that the word 讞诪讜专 that's written in the 转讜专讛 in connection to the 讚讬谉 of 讘讜专, according to 专讘讬 讬讛讜讚讛, is a 拽砖讬讗. We have no answer why the 转讜专讛 writes that word. And the word 砖讛 that the 转讜专讛 writes concerning 讗讘讬讚讛 讗讘讬讚讛, that is a 拽讜砖讬讗 讗诇讬讘讗 讚讻讜诇讬 注诇诪讗. That is a 拽讜砖讬讗 according to everybody, we don't have an answer why the 转讜专讛 has to write the word 砖讛. But then the 讙诪专讗 asks, 讜讗讬诪讗, let me say, 诇讙诇诇讬诐 讛讜讗 讚讗转讗, that this extra word comes to teach us that the manure from the sheep also has to be returned. So the 讙诪专讗 says, this couldn't be, because 讙诇诇讬诐 讗驻拽讜专讬 诪驻拽专 诇讛讜. It is so little, it is worth so little that the owner definitely is 诪驻拽讬专, gives up his ownership over it, so we cannot say that the 转讜专讛 tells us that you must return that too. But then the 讙诪专讗 says, 讜讚讬诇诪讗 诇住讬诪谞讬诐 讛讜讗 讚讗转讗? Maybe the reason the 转讜专讛 writes this extra word is to teach us the 讚讬谉 of 住讬诪谞讬诐? To teach us that if you have a 住讬诪谉, you must return it with the 住讬诪谉, because 讚讗讬讘注讬讗 诇谉, because later on in the 讙诪专讗, the 讙诪专讗 has a question whether 住讬诪谞讬诐 讚讗讜专讬讬转讗 or 讚专讘谞谉, whether this 讚讬谉 that we know that if a person gives a 住讬诪谉 on an object, you must return it to him, is this a 讚讬谉 诪讚讗讜专讬讬转讗, is this a 讚讬谉 from the 转讜专讛, or it is only a 讚讬谉 诪讚专讘谞谉? 诪讚讗讜专讬讬转讗, you would not have to return an object just by 住讬诪谞讬诐. The only way you'd have to return an object is if the person would bring witnesses that recognize that this object is his. The 专讘谞谉 are the ones that said that if he gives 住讬诪谞讬诐, you should return it. So since we have a 住驻拽, we do not know whether 住讬诪谞讬诐 is 讚讗讜专讬讬转讗 or 讚专讘谞谉, so maybe 讻转讘 专讞诪谞讗 砖讛, that's why the 转讜专讛 wrote this extra word 砖讛, to teach us 讚讗驻讬诇讜 讘住讬诪谞讬诐 诪讛讚专讬谞谉, that even with 住讬诪谞讬诐 you do return, and 住讬诪谞讬诐 讚讗讜专讬讬转讗, and that would prove that 住讬诪谞讬诐 are 讚讗讜专讬讬转讗. Since we have an extra word that must come to teach us a new 讚讬谉 concerning the 讛诇讻讛 of 讛砖讘转 讗讘讬讚讛, of when you return an object, so why not say that it comes to teach that you should return it with 住讬诪谞讬诐? So the 讙诪专讗 says, no, 讗诪专讬, I will tell you, it couldn't be that way. 诪讚拽转谞讬 诇讬讛 诇转谞讗 诇住讬诪谞讬诐 讙讘讬 砖诪诇讛, since the 转谞讗 of our 诪砖谞讛 mentions the 讚讬谉 of 住讬诪谞讬诐 in connection to the word 砖诪诇讛, 诪讚拽转谞讬, because in the 诪砖谞讛 it said, 诪讛 砖诪诇讛 诪讬讜讞讚转 砖讬砖 讘讛 住讬诪谞讬诐 讜讬砖 诇讛 转讜讘注讬诐, 讞讬讬讘 诇讛讻专讬讝, that just like 砖诪诇讛 has 住讬诪谞讬诐 and 砖诪诇讛 has 转讜讘注讬诐, has a person that would ask for it, it belongs to somebody, you must announce it, 讗祝 讻诇 讚讘专 砖讬砖 讘讛 住讬诪谞讬诐 讜讬砖 诇讛 转讜讘注讬诐, 讞讬讬讘 诇讛讻专讬讝, so too we learn out from the word 砖诪诇讛 that anything that has 住讬诪谞讬诐 and anything that has an owner, that's what you must announce, but if it doesn't have 住讬诪谞讬诐 and doesn't have an owner, you don't have to announce. So here we see that the 诪砖谞讛 mentions 住讬诪谞讬诐 in connection to 砖诪诇讛. So obviously, 住讬诪谞讬诐 is not learned out from the word 砖讛. 砖诪注 诪讬谞讛, that teaches us 讚砖讛 诇讗讜 诇住讬诪谞讬诐 讛讜讗 讚讗转讗, that the word 砖讛 doesn't come to teach us 住讬诪谞讬诐. 砖讛 must teach us something else. And as 专砖''讬 explains that the 讙诪专讗 means to say that from the 转谞讗 of the 诪砖谞讛 we see that the 转谞讗 knew that 住讬诪谞讬诐 is not learned out from 砖讛, since he mentions 住讬诪谞讬诐 in connection to 砖诪诇讛. So 住讬诪谞讬诐 is not learned out from 砖讛, it is in connection to 砖诪诇讛. Now what does he do with 砖讛? So obviously the 转谞讗 knew what the word 砖讛 comes to teach us, because if the 转谞讗 also wouldn't know what the word 砖讛 comes to teach us, why didn't he learn that 住讬诪谞讬诐 are learned out from 砖讛? So obviously the 转谞讗 knew that there is some 诇讬诪讜讚 from 砖讛. The word 砖诪诇讛 is connected to 住讬诪谞讬诐. We are the ones that don't know what the word 砖讛 comes to teach us, but one thing is sure, that it does not come to teach us 住讬诪谞讬诐, because we see the 转谞讗 of the 诪砖谞讛 mentions 住讬诪谞讬诐 in connection to 砖诪诇讛. 转讜住驻讜转 makes a few important points here. When the 讙诪专讗 mentioned at the beginning that the reason why the 驻住讜拽 writes 讞诪讜专 to teach us that you also return the 讞诪讜专 if there are 注讚讬诐 for the saddle or there are 住讬诪谞讬诐 on the saddle, so 转讜住驻讜转 says that the reason we mention 注讚讬诐 of the saddle, that is only if we hold 住讬诪谞讬诐 are not 讚讗讜专讬讬转讗, then we say that the 驻住讜拽 comes to teach us that you have 注讚讬诐 on the saddle, but if you hold 住讬诪谞讬诐 are 讚讗讜专讬讬转讗, you wouldn't need 注讚讬诐, the 住讬诪谞讬诐 of the saddle would be enough too. That's what the 驻住讜拽 would mean, because if 住讬诪谞讬诐 are 讚讗讜专讬讬转讗, the 驻住讜拽 could refer to the 住讬诪谞讬诐 too. Then another thing that 转讜住驻讜转 says, when the 讙诪专讗 said the reason it says 砖讜专 is to teach us that even 讙讬讝转 讝谞讘讜, that even the shearing of the tail, the hair that grows on the tail of the 砖讜专 must be returned, so 转讜住驻讜转 asks, why do we need a 驻住讜拽 for that? 诪诪讛 谞驻砖讱, does it have a 砖讜讛 驻专讜讟讛? Is the hair enough that it's worth a 砖讜讛 驻专讜讟讛, then certainly you have to return it. Anything that belongs to your friend, you must return, why should you think that you shouldn't have to return this? On the other hand, if it doesn't have a 砖讜讛 驻专讜讟讛, then you really don't have to return it. The 讙诪专讗 later on says that anything that's less than a 砖讜讛 驻专讜讟讛, you do not have to return. So how can we say that the 驻住讜拽 comes to teach us that you do have to return it? So what does the 驻住讜拽 mean? And 转讜住驻讜转 answers, the 驻住讜拽 comes to tell us that you must cut off that hair at the time

Why the Torah writes the word 砖讛

when it is proper for it to be cut off, even if it doesn't have a 砖讜讛 驻专讜讟讛 at the time when you're cutting it off, still the 讚讬谉 is that if this is what is supposed to be done to this animal, you must do it. Then 转讜住驻讜转 has another 拽砖讬讗. The 讙诪专讗 asks, why does the 转讜专讛 have to write the word 砖讛? And in the end of the 讙诪专讗, we do not have an answer to that question. So 转讜住驻讜转 asks, why can't we say that 诪讬诇转讗 讚讗转讬讗 讘拽诇 讜讞讜诪专 讟专讞 讜讻转讘 诇讛 拽专讗? The whole 拽砖讬讗 is based that you cannot say that the 转讜专讛 writes the word 砖讛 to teach us that the shearing, the wool, must be returned, because that could be learned out from a 拽诇 讜讞讜诪专, that 诪讛 讚讛讗 by 砖讜专, the 转讜专讛 tells us that the hair that grows on its tail must be returned, certainly the shearing of the sheep must be returned. So since it is a 拽诇 讜讞讜诪专, the 转讜专讛 doesn't have to tell us that. And that is the reason the 讙诪专讗 asks how we cannot say that 砖讛 comes to teach us the 讚讬谉 that you must return the wool. So we're back with the question, what does the 转讜专讛 teach us with the word 砖讛? And at the 诪住拽谞讗, we have no answer. But we have a rule that sometimes, something that we learn out from a 拽诇 讜讞讜诪专, nevertheless, the 转讜专讛 teaches us. That is called 诪讬诇转讗 讚讗转讬讗 讘拽诇 讜讞讜诪专, something that learn comes from a 拽诇 讜讞讜诪专, 讟专讞 讜讻转讘 诇讛 拽专讗. The 转讜专讛 is 诪讟专讬讞 itself, the 转讜专讛 bothers itself, so to speak, and nevertheless writes it. So here too, why can we not say that even though we could learn it out from a 拽诇 讜讞讜诪专, nevertheless, the 转讜专讛 writes it, and tells us the 讚讬谉 outright, that you do have to return the wool that is taken from the 砖讛? And that is the reason the 转讜专讛 writes the word 砖讛. And 转讜住驻讜转 answers that after we learn out from the word 砖讜专 that the hair that grows on the tail of the 砖讜专 you must return, so now the shearing of the sheep is already included in 讻诇 讗讘讬讚转 讗讞讬讱, in the general 讚讬谉 that you must return any object. If the 转讜专讛 would not tell us that by a 砖讜专 you must return the hair that was cut off from the tail, then we would think that this is 诇讻转讞讬诇讛 not included in the 讚讬谉 of 讛砖讘转 讗讘讬讚讛. After the 转讜专讛 tells us already the 讚讬谉 by 砖讜专, that the hair that grows on the tail must be returned, so now we know that even the shearing is also included in the 讚讬谉 of 讛砖讘转 讗讘讬讚讛. So now, since the 转讜专讛 gives a general 讚讬谉, 讻诇 讗讘讬讚转 讗讞讬讱, that anything that is lost you must return, automatically the wool of the sheep is already included. So then it wouldn't be a case of something that is learned out from a 拽诇 讜讞讜诪专, the 转讜专讛 writes it. Because that's only in the case where the 转讜专讛 does not write the 讚讬谉 otherwise, it is only a 拽诇 讜讞讜诪专 that we know. So we say that even though we would know it ourselves, the 转讜专讛 nevertheless wants to write it. But here the case is not that we only would learn it out from a 拽诇 讜讞讜诪专, the 转讜专讛 actually writes it. Since the 转讜专讛 on one hand tells us that the hair from the 砖讜专 is to be returned, so we know that this is included in 讛砖讘转 讗讘讬讚讛. And the 转讜专讛 writes that anything that's an 讗讘讬讚讛 must be returned, so it's as if the 转讜专讛 tells us already that the wool must be returned. So here we cannot say that this is the reason why the 转讜专讛 writes the word 砖讛. And therefore, the 讙诪专讗 remains in a 诪住拽谞讗 that we do not know why the 转讜专讛 writes the word 砖讛. Now we'll continue with the 讙诪专讗.

Excluding loss of value less than a pruta

转谞讜 专讘谞谉, the 专讘谞谉 learned, 讗砖专 转讗讘讚, the 驻住讜拽 says that this 讚讬谉 applies to any object 讗砖专 转讗讘讚 that will be lost. So what does that word come to teach us? 驻专讟, to exclude 诇讗讘讬讚讛 砖讗讬谉 讘讛 砖讜讛 驻专讜讟讛, an 讗讘讬讚讛 that doesn't have the worth of a 驻专讜讟讛, that if you find an object which is worth less than a 驻专讜讟讛, you do not have to return it. 专讘讬 讬讛讜讚讛 讗讜诪专, and 专讘讬 讬讛讜讚讛 says that we learn out this 讚讬谉 from another word. The 驻住讜拽 says that anything that will be lost to your friend, 讜诪爪讗转讛, and you will find it, so this comes to teach us 驻专讟, to exclude 诇讗讘讬讚讛 砖讗讬谉 讘讛 砖讜讛 驻专讜讟讛, that if it's an 讗讘讬讚讛 that doesn't have a 驻专讜讟讛, you do not have to return it. Since it says you will find it, there will be something that will be found, but if it has no 驻专讜讟讛, it is not something, it is not worth anything, and therefore you do not have to return it. And the 讙诪专讗 asks: 诪讗讬 讘讬谞讬讬讛讜? What is the difference? What is the difference whether we learn out this 讚讬谉, that if it has no 砖讜讛 驻专讜讟讛 you don't have to return it, whether we learn it out from the word 讗砖专 转讗讘讚, that if you will lose it has to be a substantial amount that was lost, or we learn it out from the word 讜诪爪讗转讛, that it has to be a substantial amount that you find? The 讚讬谉 is the same. 讗诪专 讗讘讬讬, so 讗讘讬讬 said, 诪砖诪注讜转 讚讜专砖讬谉 讗讬讻讗 讘讬谞讬讬讛讜. The difference is only the 诪砖诪注讜转, how we 讚专砖谉 this 讚讬谉. From which word is 诪砖诪注 this 讚讬谉? So the truth is there is no 谞驻拽讗 诪讬谞讛, no difference in 讛诇讻讛 whether we learn it out from 讗砖专 转讗讘讚 or from 讜诪爪讗转讛. The 诪讞诇讜拽转 is only which of the two words is more 诪砖诪注 this 讚讬谉. 诪专 谞驻拽讗 诇讬讛 诪讗砖专 转讗讘讚, one only learns it out from 讗砖专 转讗讘讚, he feels that this word has more meaning to show that if it's less than a 驻专讜讟讛 you don't have to return it, 讜诪专, and one 谞驻拽讗 诇讬讛 诪讜诪爪讗转讛, and one learns it out from the word 讜诪爪讗转讛. And then the 讙诪专讗 asks: 讜诇诪讗谉 讚谞驻拽讗 诇讬讛 诪讗砖专 转讗讘讚... one that learns it out from the words 讗砖专 转讗讘讚, 讛讗讬 讜诪爪讗转讛 诪讗讬 注讘讬讚 诇讬讛? What does he do with the word 讜诪爪讗转讛, since it's an extra word? The 转讜专讛 says, so you should do to any object that your brother lost, and you will find it. If the 转讜专讛 wouldn't write the word 讜诪爪讗转讛, we would know it, too. Because this whole 驻专砖讛 is speaking about a person who finds an 讗讘讬讚讛, that he must return it. So the question is, the one that uses the word 讜诪爪讗转讛 to teach us that if it's less than a 驻专讜讟讛 you do not have to return it, so we know why the 转讜专讛 writes 讜诪爪讗转讛. But according to the one that uses the 讗砖专 转讗讘讚 for that 讚讬谉, what does he do with 讜诪爪讗转讛? And the 讙诪专讗 answers, 讛讛讜讗 诪讘注讬 诇讬讛 诇讻讚专讘讬谞讗. He needs that to teach us the 讚讬谉 that 专讘讬谞讗 taught. It means to tell us that it came to your hand. That even if the object came to your hand already, you must return it. Not only if you see an object lost, you must pick it up and return it, but also after it came to you, you have an obligation to return it. And as 专砖"讬 says, what does that mean to tell us? It means to tell us that this 讚讬谉 that we learn out from the 驻住讜拽 of 讛砖讘转 讗讘讬讚讛, that only an object of a 讬讬讚 must be returned, but if it's an object belongs to a 讙讜讬, you do not have to return, so we would think that only if you see an object of a 讙讜讬, you do not have to pick it up to return it, but if the object already came to you, you picked it up already, that even if it's of a 讙讜讬, you also must return it. That's why the 驻住讜拽 says 讜诪爪讗转讛, that even if you found it already, it came to your hand, so all the 讚讬谞讬诐 of 讛砖讘转 讗讘讬讚讛 apply, including this 讚讬谉 that if it's a 讙讜讬's object, it does not have to be returned. Then the 讙诪专讗 asks, 讜诇诪讗谉 讚谞驻拽讗 诇讬讛 诪讜诪爪讗转讛, the one that learns out the 讚讬谉 that if it's less than a 砖讜讛 驻专讜讟讛 you do not have to return it from the word 讜诪爪讗转讛, 讛讗讬 讗砖专 转讗讘讚 诪讗讬 注讘讬讚 诇讬讛? What does he do with the words 讗砖专 转讗讘讚? Because they are also extra words. When the 转讜专讛 says, so you should do to any lost object of your brother, so we already would know that he lost it. Why does the 转讜专讛 have to add that so you should do to every lost object of your brother that he lost, 讗砖专 转讗讘讚? These words are extra. And the 讙诪专讗 answers, 诪讘注讬 诇讬讛, we need it, 诇讻讚专讘讬 讬讜讞谞谉, for the 讚讬谉 that 专讘讬 讬讜讞谞谉 said. 讚讗诪专 专讘讬 讬讜讞谞谉 诪砖讜诐 专讘讬 砖诪注讜谉 讘谉 讬讜讞讬, 专讘讬 讬讜讞谞谉 said in the name of 专讘讬 砖诪注讜谉 讘谉 讬讜讞讬, 诪谞讬讬谉 诇讗讘讬讚讛 砖砖讟驻讛 谞讛专 砖讛讬讗 诪讜转专转? How do we know that if it was an 讗讘讬讚讛 that was swept away by the river, that you're allowed to keep it? If you find an 讗讘讬讚讛 that was swept away by the river, you're allowed to keep it, he learns it out, 砖谞讗诪专, because the 转讜专讛 says, 讻谉 转注砖讛 诇讻诇 讗讘讚转 讗讞讬讱 讗砖专 转讗讘讚 诪诪谞讜 讜诪爪讗转讛, that to anybody else, either. It's lost in such a way that it's lost from everybody. No one can get it at that point when it was swept away with the river. And here we know that if it was swept away from the river, then you do not have to return it. And this we learn out from the words 讗砖专 转讗讘讚 诪诪谞讜, that if it's lost only from him. And this answers the question: What does he do with the words 讗砖专 转讗讘讚 诪诪谞讜? He learns out this 讚讬谉 from these words. But then

Rav Yochanan's ruling on items lost in a river

the 讙诪专讗 asks, 讜讗讬讚讱, the other one, 讛讗 讚专讘讬谞讗 诪谞讗 诇讬讛? The one that uses the words 讜诪爪讗转讛, as we said before, to teach us that if it's less than a 砖讜讛 驻专讜讟讛 you do not have to return it, where does he know the 讚讬谉 of 专讘讬谞讗? 专讘讬谞讗, we mentioned before, said that even if the object came to your hand, you also do not have to return if it's a 讙讜讬's, and that we know from the word 讜诪爪讗转讛, that even if you found it already, you still do not have to return it if it's a 讙讜讬's. How does he know that 讚讬谉, since he uses the word 讜诪爪讗转讛 to teach us the 讚讬谉 of 砖讜讛 驻专讜讟讛? And the 讙诪专讗 says, 谞驻拽讗 诇讬讛, he learns it out, 诪讜诪爪讗转讛, from the extra 讜'. It could have said 诪爪讗转讛, and then already we would have known that it has to be a 砖讜讛 驻专讜讟讛, because if it's less than a 砖讜讛 驻专讜讟讛, it's not a substantial thing that you found. Why does the 转讜专讛 have to write 讜诪爪讗转讛 with an extra 讜'? So that comes to teach us another 讚讬谉. The other 讚讬谉, that even if you found it already, still all the 讚讬谞讬诐 of 讛砖讘转 讗讘讬讚讛 apply, meaning that if it was a 讙讜讬's, you do not have to return it. Then the 讙诪专讗 asks, 讜讗讬讚讱, 讛讗 讚专讘讬 讬讜讞谞谉 诪谞讗 诇讬讛? The other one, the one that uses the words of 讗砖专 转讗讘讚 to teach us it has to be a 砖讜讛 驻专讜讟讛, how does he know the 讚讬谉 of 专讘讬 讬讜讞谞谉, that if it was swept away by the river, you do not have to return it? And 专讘讬 讬讜讞谞谉 learned it out from the words 讗砖专 转讗讘讚 诪诪谞讜, but he uses the words 讗砖专 转讗讘讚 诪诪谞讜 to teach us it has to be a 砖讜讛 驻专讜讟讛, how will he know the 讚讬谉 of 专讘讬 讬讜讞谞谉? And the 讙诪专讗 says, 谞驻拽讗 诇讬讛 诪诪谞讜, he learns it out from the word 诪诪谞讜. The 讚讬谉 that it has to be a 砖讜讛 驻专讜讟讛 is learned out from the words 讗砖专 转讗讘讚, and this extra 讚讬谉, that if it's lost not only from him, you do not have to return it, that is learned out from the extra word 诪诪谞讜. Now the 讙诪专讗 asks 讗讬讚讱: So according to the other one, what will he do with the word 诪诪谞讜? So he says 诪诪谞讜 诇讗 诪砖诪注 诇讬讛. The word 诪诪谞讜 is not 诪砖诪注 to him as an extra word, this is not a word that could teach us any 讚讬谉, and therefore it is not considered an extra word. And the 讙诪专讗 continues: 专讘讗 讗诪专, but 专讘讗 says, this goes back to the question we asked before: What is the difference whether we learn out the 讚讬谉 of 砖讜讛 驻专讜讟讛 from the words 讗砖专 转讗讘讚 or from the words 讜诪爪讗转讛? And 讗讘讬讬 answered, there is really no difference, it's just a 诪讞诇讜拽转 which word is 诪砖诪注 this 讚讬谉. But 专讘讗 says, "No, there is a difference in 讛诇讻讛: 驻专讜讟讛 砖讛讜讝诇讛 讗讬讻讗 讘讬谞讬讬讛讜." A 驻专讜讟讛 that depreciated, that is the difference between them. 诪讗谉 讚讗诪专 讗砖专 转讗讘讚 讗讬讻讗, the one that learns out from 讗砖专 转讗讘讚 that that teaches us it has to be 砖讜讛 驻专讜讟讛, so since when it was lost it was worth a 驻专讜讟讛, so then you would have to return it, even though when you found it it wasn't worth a 驻专讜讟讛, but still you have to return it, because the main thing depends on 讗砖专 转讗讘讚, in the time when you lost it. 讜诪讗谉 讚讗诪专 讜诪爪讗转讛, the one that learns out the 讚讬谉 of 驻专讜讟讛 from the word 讜诪爪讗转讛, 诇讬讻讗. Since when you found it it wasn't worth a 驻专讜讟讛, so you would not have to return it, because now it is not worth a 驻专讜讟讛. But then the 讙诪专讗 asks, how can you say that? 讜诇诪讗谉 讚讗诪专 讗砖专 转讗讘讚, according to the one that learns it out from 讗砖专 转讗讘讚, still 讛讗 讘注讬谞谉 讜诪爪讗转讛, still it has to be 讜诪爪讗转讛. He 讟讗拽注 learns it out from the word 讗砖专 转讗讘讚, but the 驻住讜拽 nevertheless says 讜诪爪讗转讛, that you found it, so there has to be a 驻专讜讟讛 when you found it too. So how can you say that according to the 诪讗谉 讚讗诪专 that learns it out from 讗砖专 转讗讘讚, if it was not worth a 驻专讜讟讛 when you found it you still have to return it as long as it was worth a 驻专讜讟讛 when you lost it, but nevertheless the 转讜专讛 does say 讜诪爪讗转讛 that you have to find a substantial object, 讜诇讬讻讗, and it's not there? So how can you say that this is the 诪讞诇讜拽转? 讗诇讗, so the 讙诪专讗 says, we say the opposite: 驻专讜讟讛 砖讛讜拽专讛 讗讬讻讗 讘讬谞讬讬讛讜. A 驻专讜讟讛 that appreciated is the 诪讞诇讜拽转. In other words, when you lost it it wasn't worth a 驻专讜讟讛, but when you found it it was worth a 驻专讜讟讛. 诪讗谉 讚讗诪专 讜诪爪讗转讛, the one that says we learn it out from 讜诪爪讗转讛, 讗讬讻讗, it's there. Since when you found it it was worth a 驻专讜讟讛, you must return it. 讜诪讗谉 讚讗诪专 讗砖专 转讗讘讚, the one that learns it out from 讗砖专 转讗讘讚, 诇讬讻讗, it's not there, because when you lost it it wasn't worth a 驻专讜讟讛. But the 讙诪专讗 asks the same question as before: 讜诇诪讗谉 讚讗诪专 讜诪爪讗转讛, according to the one that learns it out from 讜诪爪讗转讛, 讛讗 讘注讬谞谉 讗砖专 转讗讘讚 讜诇讬讻讗, don't we need it should be 讗砖专 转讗讘讚, it should be a 驻专讜讟讛 when you lost it, and it's not there? Even though he learns it out from 讜诪爪讗转讛, but nevertheless the 转讜专讛 does say 讗砖专 转讗讘讚, that you only have to return an object that you lost, which means an object which has a substantial value at least of a 驻专讜讟讛 when you lost it too. So how can you say that according to the one that learns it out from 讜诪爪讗转讛, even if it wasn't worth a 驻专讜讟讛 when you lost it, still you have to return it? 讗诇讗, so the 讙诪专讗 says: 驻专讜讟讛 砖讛讜讝诇讛 讜讞讝专讛 讜讛讜拽专讛 讗讬讻讗 讘讬谞讬讬讛讜. The 诪讞诇讜拽转 is in a case where when you lost it it was worth a 驻专讜讟讛, in between it depreciated and it's not worth a 驻专讜讟讛, but by the time he found it, it was again worth a 驻专讜讟讛. So this is the 诪讞诇讜拽转: 诪讗谉 讚讗诪专 讗砖专 转讗讘讚 讗讬讻讗, the one that says that we learn it out from the words 讗砖专 转讗讘讚, so there is, when you lost it it was worth a 驻专讜讟讛, therefore you must return it. He needs that you should have the 砖讬注讜专 of 讗讘讬讚讛, which means a 砖讜讛 驻专讜讟讛, from the time it was lost through the time when it was found, and since in between there was a time when it wasn't worth a 驻专讜讟讛, therefore you would not have to return it, because he says that we learn it out 讜诪爪讗转讛 that till the finding it has to be worth a 驻专讜讟讛 throughout the whole time, and therefore if in between it was not worth a 驻专讜讟讛 you do not have to return it. This 讚讬谉 that you have to return an object if someone gives you the 住讬诪谞讬诐, is this a 讚讬谉 诪讚讗讜专讬讬转讗 from the 转讜专讛, or is this a 讚讬谉 only 诪讚专讘谞谉? And the

Is 住讬诪谞讬诐 a Biblical or Rabbinic requirement?

讙诪专讗 says, 诪讗讬 谞驻拽讗 诪讬谞讛? What difference does it make? Because whether it's 讚讗讜专讬讬转讗 or 讚专讘谞谉, nevertheless you have to return it with 住讬诪谞讬诐! So the 讙诪专讗 says the 谞驻拽讗 诪讬谞讛 would be 诇讗讛讚讜专讬 讙讟 讗砖讛 讘住讬诪谞讬诐, whether you return a 讙讟 of a woman with 住讬诪谞讬诐. If a 砖诇讬讞, an agent, brought a 讙讟 from the husband to give to the wife and he lost it before he gave it, and then they found it and he gives 住讬诪谞讬诐 on the 讙讟, are you able or allowed to return this 讙讟 to this agent with the 住讬诪谞讬诐 he gives? 讗讬 讗诪专转 住讬诪谞讬诐 讚讗讜专讬讬转讗, if you say 住讬诪谞讬诐 is a 讚讬谉 of the 转讜专讛, 诪讛讚专讬谞谉, you would give back. 讜讗讬 讗诪专转 讚专讘谞谉, but if you say 住讬诪谞讬诐 are only 诪讚专讘谞谉, 讻讬 注讘讜讚 专讘谞谉 转拽谞转讗, when did the 专讘谞谉 make this 转拽谞讛? 讘诪诪讜谞讗, only by 诪诪讜谉, by money things, then the 专讘谞谉 had a right to make this 转拽谞讛, because, as 专砖状讬 explains, 讛驻拽专 讘讬转 The 讚讬谉 is that the 专讘谞谉 have the authority over the money of a person, so the 专讘谞谉 诪爪讚 讛讚讬谉 of the 转讜专讛 have a right to say that money that belongs to a person should not belong to him anymore or any similar thing like that. So therefore, even if 诪讚讗讜专讬讬转讗 you do not return it with 住讬诪谞讬诐, which means that 诪讚讗讜专讬讬转讗 the object should remain in the hands of the one that found it, he is the owner. Nevertheless, the 专讘谞谉 have a right to make a 转拽谞讛 and say that the object that 诪讚讗讜专讬讬转讗 belongs to the finder should be given back to the loser. But that's only in the case of 诪诪讜谉, 讗讘诇 讘讗讬住讜专讗, but in the case of 讗讬住讜专, things which are not connected to money, but connected to 讗讬住讜专讬诐, to 讚讬谞讬诐, 诇讗 注讘讚讜 专讘谞谉 转拽谞转讗, the 讞讻诪讬诐 did not make a 转拽谞讛. And therefore, in the case of a 讙讟, since it is not 诪诪讜谉, there is no 转拽谞讛 of the 专讘谞谉, and therefore, you would not return the 讙讟 to the 砖诇讬讞 with 住讬诪谞讬诐. So the question is, are 住讬诪谞讬诐 讚讗讜专讬讬转讗 or 讚专讘谞谉? And the 讙诪专讗 says, 转讗 砖诪注, come here, I'll try to answer your question. We learn in our 诪砖谞讛, 讗祝 砖诪诇讛 讛讬转讛 讘讻诇诇 讻诇 讗诇讛, that 砖诪诇讛, the word 砖诪诇讛 was included in the words 讜讻谉 转注砖讛 诇讻诇 讗讘讚转 讗讞讬讱. 讜诇诪讛 讬爪转讛? Why did it go out? Why did the 转讜专讛 write it separately? 诇讛拽讬砖 讗诇讬讛, to compare to it, 讜诇讜诪专 诇讱, and to tell you, 诪讛 砖诪诇讛 诪讬讜讞讚转 砖讬砖 诇讛 住讬诪谞讬诐 讜讬砖 诇讛 转讜讘注讬诐 讞讬讬讘 诇讛讻专讬讝, that just like a garment is something that has 住讬诪谞讬诐 and has an owner, has a person who will claim it, you have to announce it, 讗祝 讻诇 讚讘专 砖讬砖 诇讜 住讬诪谞讬诐 讜讬砖 诇讜 转讜讘注讬诐 讞讬讬讘 诇讛讻专讬讝, so too, any object that has a 住讬诪谉 and has a person who claims it, you must return. So here we see clearly in the 诪砖谞讛 that we learn out from the word 砖诪诇讛 that you must return an object with 住讬诪谞讬诐. So we see clearly that 住讬诪谞讬诐 are 讚讗讜专讬讬转讗, because we learn it out from the 驻住讜拽, from the word 砖诪诇讛 that is written in the 转讜专讛. But the 讙诪专讗 says, no, 转谞讗 转讜讘注讬诐 讗爪讟专讬讻讗 诇讬讛. The reason the 转谞讗 wrote this was for the word 转讜讘注讬诐. The main thing we learn out from 砖诪诇讛 is that only if there is somebody who claims it, that's when you have to return, and we do not learn out the 讚讬谉 of 住讬诪谞讬诐 from 砖诪诇讛. And 住讬诪谞讬诐 讻讚讬 谞住讘讛, the word 住讬诪谞讬诐 that he mentioned in the 诪砖谞讛 was just by the way. Really he did not mean to say that we learn out 住讬诪谞讬诐 from 砖诪诇讛. But since he already mentioned something which we find in 砖诪诇讛 that we do learn out from 砖诪诇讛, and that is the 讚讬谉 of 转讜讘注讬诐, he already mentions something else which could be only 诪讚专讘谞谉, and he also includes it in the 诇讬诪讜讚 even though this is not the real 诇讬诪讜讚. He mentions it by the way. It's only so to speak an 讗住诪讻转讗. Could be that it's 讚专讘谞谉, but the 专讘谞谉 only connected it to this 驻住讜拽, and that is why the 转谞讗 mentions it. But it is not a 讚讬谉 that we learn out from this 驻住讜拽. Since there is something else we learn out from this 驻住讜拽, the 讚讬谉 of 讬砖 诇讜 转讜讘注讬诐, only if it has someone who claims it, but if no one claims it, in other words, the owner was 诪转讬讬讗砖, you do not have to return it, so since that is learned out from the 驻住讜拽, we do not know for sure that the word, the 讚讬谉 of 住讬诪谞讬诐 could also be learned out from the 驻住讜拽. Maybe that was mentioned just by the way. Then the 讙诪专讗 continues,

Returning a donkey with saddle marks

转讗 砖诪注, we learned in the 讘专讬讬转讗 that you have to return a 讞诪讜专 讘住讬诪谞讬 讗讜讻祝, that if you have 住讬诪谞讬诐 on the saddle, you must return the donkey with the 住讬诪谞讬诐 of the saddle. So we see clearly that 住讬诪谞讬诐 are 讚讗讜专讬讬转讗, because we learn it out from the word 讞诪讜专 that's written in the 转讜专讛. And the 讙诪专讗 says, 讗讬诪讗, say, 讘注讚讬 讗讜讻祝. It doesn't mean with the 住讬诪谞讬诐 of the saddle, but the 注讚讬诐 of the saddle, that if 注讚讬诐 come and recognize the saddle, automatically you have to return the donkey too. 转讗 砖诪注, come here, I'll answer you the question from a different 讘专讬讬转讗. It says in the 驻住讜拽, 讜讛讬讛 注诪讱 注讚 讚专讜砖 讗讞讬讱 讗讜转讜, that it should be with you, the object that you found, and you do not know whom to return it to, it should stay with you till your brother will search for it. 讜讻讬 转注诇讛 注诇 讚注转讱, would you think 砖讬转谞谞讜 诇讜 拽讜讚诐 砖讬讚专砖谞讜, that you should return it before he asks for it? Certainly, when he asks for it, you return it. Why does the 转讜专讛 have to say it should stay with you till he asks for it? Without the 驻住讜拽, we would understand ourselves that before he asks for it, you can't return it to him. 讗诇讗, what does the 驻住讜拽 mean? 讚专砖讛讜, you search him out. It doesn't mean that till your brother will search for the object. It means 注讚 讚专讜砖 讗讞讬讱 讗讜转讜, till you search your brother out, 讗诐 专诪讗讬 讛讜讗 讗讜 讗讬谞讜 专诪讗讬. Search him out whether he is a thief or not a thief. In other words, do not return it to

Verifying Ownership with 住讬诪谞讬诐 vs Witnesses

him just because he says it's his, search it out, find out to see whether he's saying the truth or not. Now how do we do that? 诪讗讬 诇讗讜, don't you think 讘住讬诪谞讬诐? Ask him for 住讬诪谞讬诐, and if he gives you 住讬诪谞讬诐, you know he's saying the truth. And if we learn this way, it means that the 转讜专讛 is telling us that if your brother gives you 住讬诪谞讬诐, return it. So we see 住讬诪谞讬诐 are 讚讗讜专讬讬转讗. And the 讙诪专讗 says, 诇讗, no, what the 转讜专讛 could mean is 讘注讚讬诐. How do you search to see whether he's saying the truth or not? Let him bring witnesses. If he brings witnesses that recognize this object that is his, then you return it. Then the 讙诪专讗 continues, 转讗 砖诪注, come here, we learned, 讗讬谉 诪注讬讚讬谉 讗诇讗 注诇 驻专爪讜祝 驻谞讬诐 注诐 讛讞讜讟诐, that if an person comes to testify that this woman's husband died, and therefore she's allowed to remarry, so you cannot testify only if you recognize the person through his face together with the nose. If the nose was cut off, then this testimony is not valid. It's only if he recognizes the face together with the nose. 讗祝 注诇 驻讬 砖讬砖 住讬诪谞讬诐 讘讙讜驻讜 讜讘讻诇讬讜, even though there are 住讬诪谞讬诐 in the body, and there are 住讬诪谞讬诐 in the vessel, in the clothes of this person, that is not enough. You must recognize the face with the nose. So 砖诪注 诪讬谞讛, from here we see clearly, 住讬诪谞讬诐 诇讗讜 讚讗讜专讬讬转讗, 住讬诪谞讬诐 are not from the 转讜专讛. Since it says here that even if there are 住讬诪谞讬诐 in the 讙讜驻讜 and the 讻诇讬诐, you still cannot testify through these 住讬诪谞讬诐, so we see 住讬诪谞讬诐 are not 讚讗讜专讬讬转讗. And the 讙诪专讗 says, 讗诪专, I could tell you, it's no 专讗讬讛 from there. Which 住讬诪谞讬诐 does it mean are not valid? Only special type of 住讬诪谞讬诐. 讙讜驻讜, when we say that there are 住讬诪谞讬诐 in the body, and that is not enough, that only means the 讗专讜讱 讜讙讜抓, whether he's long or short. Such a 住讬诪谉 is not valid because there are a lot of people that are short, a lot of people that are long. And when we said that the 住讬诪谞讬诐 of the 讻诇讬诐 are not valid, these 讻诇讬讜, the reason why that's not valid, 讚讞讬讬砖讬谞谉 诇砖讗诇讛, because we're afraid maybe he borrowed it. So how can you testify that this person died because he wore certain clothes? Maybe he borrowed this clothes. And the

讙诪专讗 says, how can you say that? How can you return a donkey with the 住讬诪谞讬诐 that are given on the saddle? A person does not borrow a saddle 诪砖讜诐 讚诪住专讘诇 诇讬讛 诇讞诪专讗, because it hurts the 讞诪讜专 to wear a saddle that was taken from another 讞诪讜专, and therefore we are sure this wasn't borrowed. 讗讬讘注讬转 讗讬诪讗, or I could tell you, that when it says that the 住讬诪谞讬诐 of the 讻诇讬诐 are not valid, because 讻诇讬讜, what did he mean by 讻诇讬诐? 讘讞讬讜专讬 讜讘住讜诪拽讬, white or red depending on the color, and that is not a 住讬诪谉, because a lot of people have 讻诇讬诐 which have the same colors, and therefore it is not valid. But otherwise, maybe 住讬诪谞讬诐, other types of 住讬诪谞讬诐 are 诪讚讗讜专讬讬转讗 and are valid. So he says, 讗诇讗, if so, 讛讗 讚转谞讬讗, we learned in a 讘专讬讬转讗, 诪爪讗讜 拽砖讜专 讘讻讬住, if the 砖诇讬讞 of the 讙讟 lost the 讙讟, and then he found it tied up with his wallet, 讗讜 讘讗专谞拽讬, or in his purse, 讜讘讟讘注转, or with his ring, 讗讜 砖诪爪讗讜 讘讬谉 讻诇讬讜, or he found the 讙讟 amongst his own 讻诇讬诐, 讗驻讬诇讜 讝诪谉 诪专讜讘讛, even if he found it much later, a long time after he lost it. Because like this we say that if you lose a 讙讟, and you find it much later, the 讙讟 is 驻住讜诇. But here since he had the 住讬诪谞讬诐, 讻砖专, the 讙讟 would be 讻砖专. 讜讗讬 住诇拽讗 讚注转讱 讞讬讬砖讬谞谉 诇砖讗诇讛, but now he's asking, if you're afraid maybe you borrowed the 讻诇讬诐, 讻讬 诪爪讗讜 拽砖讜专 讘讻讬住 讗诪讗讬 讻砖专? If you find it tied to your wallet, why is it 讻砖专? 谞讬讞讜砖, let us be afraid, 诇砖讗诇讛, that maybe it was borrowed. In other words, even though we recognize that this is his wallet, maybe he lent his wallet to somebody else, and it's somebody else's 讙讟 that was connected to this wallet? Somebody else who has the same name and the wife has the same name, and the 讙讟 was written for the other woman, and the 讚讬谉 is by a 讙讟 it must be written 诇砖诪讛, it must be written specifically for this woman. So maybe this 讙讟 is a 讙讟 for another woman, and the reason he found it with his wallet because he lent his wallet to somebody else? And the 讙诪专讗 answers, 讗诪专讬, I'll tell you, 讻讬住 讜讗专谞拽讬 讜讟讘注转 诇讗 诪讜砖诇讬 讗讬谞砖讬. A

If you lend your ring to somebody else, that person could use this to forge things, and therefore a person doesn't lend out a ring. So therefore, in these cases we are not afraid 诇砖讗诇讛 and that's why we would return the 讙讟. But normally we are afraid 诇砖讗诇讛 that a person maybe borrowed the 讻诇讬诐, and therefore if you have a 住讬诪谉 in the 讻诇讬诐 of this dead person, we cannot testify that this is the person that died. But 转讜住驻讜转 asks a very simple 拽讜砖讬讗 on this 讙诪专讗. Why can't the 讙诪专讗 use this 讘专讬讬转讗 of 诪爪讗讜 拽砖讜专 讘讻讬住 讗讜 讘讗专谞拽讬 讘讟讘注转 as a 专讗讬讛 for 住讬诪谞讬诐 讚讗讜专讬讬转讗? Since we say here that if you found the 讙讟 that's tied to the wallet, you have to return it to the one that gives the 住讬诪谉 on the wallet, to the 砖诇讬讞, so here we see 住讬诪谞讬诐 are 讚讗讜专讬讬转讗. The 讙诪专讗 uses this 讘专讬讬转讗 just to prove that we are not 讞讬讬砖讬谞谉 诇砖讗诇讛, we do not think that maybe it was lent out. But why can't they use the same 讘专讬讬转讗 to prove the question that we asked? Why can't we prove from here that by giving a 住讬诪谉 on the wallet you return to him the 讙讟, so we see 住讬诪谞讬诐 讚讗讜专讬讬转讗. And 转讜住驻讜转 says that it's no 专讗讬讛 from here, because maybe here the case is not that somebody else found it and you will return it to him because he gave a 住讬诪谉 on the wallet, maybe it is speaking in a case where the 砖诇讬讞 himself that lost the 讙讟, he himself found it. He claims he recognizes the 讙讟 and he found it. So in a case like that, since he is the person himself that found it, here he would be believed. But if somebody else would find it, and he would give a 住讬诪谉 on it, we have no 专讗讬讛 from here that it would be returned, and therefore we have no 专讗讬讛 from here that 住讬诪谞讬诐 are 讚讗讜专讬讬转讗. Then the 讙诪专讗 continues, 诇讬诪讗 讻转谞讗讬, let us say that whether 住讬诪谞讬诐 are 讚讗讜专讬讬转讗 or 讚专讘谞谉 is really a 诪讞诇讜拽转 between 转谞讗讬? Maybe this person really had a white wart, a wart at that place, and the person he is trying to testify about had a brown wart. I will give the real 住讬诪谞讬诐 of it, 讜砖拽讬诇谞讗 诇讛, and I will take it. In other words, all people who lose objects are happy that there is such a 讚讬谉 that you return it with 住讬诪谞讬诐, because sometimes it's possible that a person who lost it will not have 注讚讬诐 to testify it's his, so if there would be no 讚讬谉 that you return with 住讬诪谞讬诐, he'll never get it back. So he'd rather the 讚讬谉 should be that you do return with 住讬诪谞讬诐. 讗讬讬, the question is, maybe someone else will also come and give 住讬诪谞讬诐, someone who is not the owner, and he will get it, so the loser, the one that lost the object will never get it back? So he assumes in his mind that probably no one knows the real 住讬诪谞讬诐 of it. The only one that knows the real 住讬诪谞讬诐 is myself, the one that lost it. So probably I will get it back. I will come and give the real 住讬诪谞讬诐 of it, and I will get it back. So that is the reason why the 讞讻诪讬诐 made this 转拽谞讛, that even though 诪讚讗讜专讬讬转讗 you should not return the object with 住讬诪谞讬诐, but nevertheless, 诪讚专讘谞谉 you should return it with 住讬诪谞讬诐, because this is something that people are happy with. It is for the favor of all people who lose objects.
