Intro: Mishnah on caring for found objects

ื“ืฃ ืœ' ืขืžื•ื“ ื', from the top of the ืขืžื•ื“. The ื’ืžืจื quotes the ืžืฉื ื”. It said in the ืžืฉื ื”, if you find an object, you must take care of it and make sure that it doesn't get ruined. And it says if you find a ื›ืกื•ืช, if you find a garment, ืฉื•ื˜ื—ื” ืœืฆืจื›ื”, you should stretch it out for its own benefit, ืื‘ืœ ืœื ืœื›ื‘ื•ื“ื• ื•ื›ื•ืœื™, and not for the person's honor. A person should not use the ืื‘ื™ื“ื” for his benefit, he should only stretch it out for the benefit of the garment. Because if you will not stretch it out, it could get ruined after a while, and therefore, you have to stretch it out. The ื’ืžืจื asks the ืฉืืœื”: ืื™ื‘ืขื™ื ืœื”ื•, they asked an ืื™ื‘ืขื™ื, the ืชืœืžื™ื“ื™ื of the ื™ืฉื™ื‘ื” asked a question: ืœืฆืจื›ื• ื•ืœืฆืจื›ื” ืžืื™, what would be the ื“ื™ืŸ if he wants to do something with it which will be for the benefit of the object, but at the same time, it'll also be for his own benefit? Can he do it or not? And ืชื•ืกืคื•ืช explains that the whole ืฉืืœื” is only concerning stretching out clothes, but otherwise there would be no ืฉืืœื”. Because we see from the ื’ืžืจื before that you are allowed to use it for yourself and for the object. Because, for instance, we said before that a ืกืคืจ, you should every twelve months roll it, or you should read in it. While you're reading in it, you yourself have benefit, too, but at the same time you're doing it for the benefit of the object. So we see clearly in the ื’ืžืจื that if you do it for the benefit of the object and for your own benefit, you're allowed. So why did the ื’ืžืจื, all of a sudden, have a question here if you're allowed to use it when it'll be for the benefit of the object and yourself? Therefore, ืชื•ืกืคื•ืช says the ื’ืžืจื's ืฉืืœื” is only in a case where we are afraid that maybe by using it for your benefit, too, you might use it too much and then you might spoil the object. In the case of the ืกืคืจ, we're not afraid that you will do that. Because since the ื—ื›ืžื™ื made a time when you have to read in it, whether it's once in thirty days or once in twelve months, and also we made a ื“ื™ืŸ that you should not learn in it something you never learned before, because then there is more chance that you might ruin it. Also the ื“ื™ืŸ is, as we said before, you're not allowed to learn in it and review. So since there are so many restrictions concerning learning in a ืกืคืจ, we are not afraid you'll learn in it too much and you will ruin it. And the same when we said that ื›ืœื™ ื ื—ืฉืช, if you find copper ื›ืœื™ื, so the ื’ืžืจื says later on that you should use it even for ื—ืžื™ืŸ, even for warm, and if you find ื›ืœื™ ื›ืกืฃ, silver ื›ืœื™ื, you could use it for cold, and that means, as ืชื•ืกืคื•ืช proves, even if you're going to have benefit yourself from it, nevertheless you're allowed. So ืชื•ืกืคื•ืช says there, too, because you cannot spoil it by using it yourself. But in the case where we are afraid that if you will use it for your own benefit, too, you might use it too much and it might get spoiled, for instance, in the case of the clothes, if you will stretch it, so you might stretch it too long because you have benefit, too, and then you might ruin it, so the ืฉืืœื” is, do we make a ื’ื–ื™ืจื”, and we say you're not allowed to use it for your own benefit, you only should do it for the benefit of the ื›ืœื™, or we don't make such a ื’ื–ื™ืจื”? And that is the ื’ืžืจื's ืฉืืœื”. The ื’ืžืจื answers: ืชื ืฉืžืข, come here, I will answer your question. We learn in the ืžืฉื ื”: ืฉื•ื˜ื—ื” ืœืฆืจื›ื”, that you should stretch it out for its benefit, for the benefit of the garment. So we could be ืžื“ื™ื™ืง here: ืœืฆืจื›ื” ืื™ืŸ, for the benefit of it, of the garment, you are allowed, ื”ื ืœืฆืจื›ื• ื•ืœืฆืจื›ื” ืœื, but for his benefit and its benefit, you are not allowed. It's ืžืฉืžืข in the ืžืฉื ื” only for the benefit of the object, but not also for your benefit. So the ื’ืžืจื says: No, you can't prove it from there, because ืื™ืžื ืกื™ืคื, look further in the ืžืฉื ื”. It says there: ืื‘ืœ ืœื ืœื›ื‘ื•ื“ื•, but you shouldn't stretch it out for your own honor, for the benefit of the person. So here we could be ืžื“ื™ื™ืง just the opposite: ืœื›ื‘ื•ื“ื• ื”ื•ื ื“ืœื, for his honor he is not allowed, ื”ื ืœืฆืจื›ื• ื•ืœืฆืจื›ื” ืฉืคื™ืจ ื“ืžื™, but if he's going to do it for both, for its use, for its benefit, and for his benefit, you are allowed. Since only if it is for his ื›ื‘ื•ื“ itself, only for his ื›ื‘ื•ื“ you're not allowed, is ืžืฉืžืข, but if for both, you are allowed. So from the ืจื™ืฉื it's ืžืฉืžืข that you're not allowed to use it for both, and from the ืกื™ืคื it's ืžืฉืžืข you are allowed. ืืœื ืžื”ื ืœื™ื›ื ืœืžืฉืžืข ืžื™ื ื”. So we see that from the ืžืฉื ื” here, we can't be ืžืฉืžืข anything, we can't be ืžื“ื™ื™ืง in any way, so we can't prove the ื“ื™ืŸ from the ืžืฉื ื” at all. Then the ื’ืžืจื says: ืชื ืฉืžืข, come here, I'll prove it from a different place. We learned: ืœื ื™ืฉื˜ื—ื ื•, you should not stretch it, ืœื ืขืœ ื’ื‘ื™ ืžื˜ื”, not on a bed, ื•ืœื ืขืœ ื’ื‘ื™ ืžื’ื•ื“, and not on a frame, a special frame made for stretching clothes. So you should not do it ืœืฆืจื›ื•, for his benefit, ืื‘ืœ ื™ืฉื˜ื—ื ื• ืขืœ ื’ื‘ื™ ืขืœ ื’ื‘ื™ ืžื˜ื”, but you should stretch it on a bed, ื•ืขืœ ื’ื‘ื™ ืžื’ื“, on a frame, ืœืฆื•ืจื›ื”, for its benefit, for the benefit of the object, so that the object shouldn't get ruined. ื ื–ื“ืžื ื• ืœื• ืื•ืจื—ื™ืŸ, if he happened to have guests, then the ื“ื™ืŸ is ืœื ื™ืฉื˜ื—ื ื• ืœื ืขืœ ื’ื‘ื™ ืžื˜ื”, do not stretch it, not on a bed, ื•ืœื ืขืœ ื’ื‘ื™ ืžื’ื“, not on a frame, ื‘ื™ืŸ ืœืฆื•ืจื›ื• ื‘ื™ืŸ ืœืฆื•ืจื›ื”, whether it is for his benefit or even for her benefit, for its benefit, not even for the benefit of the object. Since you have guests there, don't even stretch it then for the benefit of the object. And at this

Guests scenario: why stretching is prohibited

point the ื’ืžืจื feels that the reason is, because since you have guests there, so you're using it for your own benefit too. You're showing off to the guests that you have this garment. So we feel that the reason why you shouldn't stretch it out, even for the benefit of the object when you have guests, because then it's ืœืฆื•ืจื›ื• ื•ืœืฆื•ืจื›ื”, because then you also have benefit. So according to that, we see that if you're going to do it for the benefit of the object and your own benefit, you're not allowed. As we see that if you have guests, you're not allowed to stretch it out even for the benefit of the object. And the ื’ืžืจื says no, ืฉืื ื™ ื”ืชื, there it's different, ื“ืžื™ื›ืœื™ื ื›ืœื™ื ืœื”. The reason you're not allowed to stretch it out is not because it is also for your benefit, because this might ruin it. Why might it ruin it? ืื™ ืžืฉื•ื ืขื™ื ื, or because of an ืขื™ืŸ ื”ืจืข, of an evil eye, since there are guests there, who knows, maybe they might have an ืขื™ืŸ ื”ืจืข on it and that will ruin it. ืื™ ืžืฉื•ื ื’ื ื‘ื™, or we saw because of ื’ื ื‘ื™ื, robbers, since there are strangers there, we don't know, they'll see it, they might want it and steal it. That is the reason why you shouldn't stretch it out when the guests are there. But we have no ืจืื™ื” that if it is for the benefit of the object and the benefit of the person, you're also not allowed. Then the ื’ืžืจื says ืชื ืฉืžืข, come hear, I'll answer your question from a different place. We

Entry to Rebecca: laws of the unworked calf

learned ื”ื›ื ื™ืกื” ืœืจื‘ืงื”. And as ืจืฉ"ื™ says, this refers to the ื“ื™ืŸ of ืขื’ืœื” ืขืจื•ืคื”, and ืชื•ืกืคื•ืช says that this refers to the ื“ื™ืŸ of ืคืจื” ืื“ื•ืžื”. ืขื’ืœื” ืขืจื•ืคื” is the case if you would find a person dead in a place that you don't know who killed him, and he is someplace in the woods, so there is a whole process you have to go through. And the end is that you have to bring the ื–ืงื ื™ื from the closest city, and they have to bring an ืขื’ืœื”, they have to bring a calf, and that calf's head has to be chopped off, and there are certain things they have to say, etc. And the ืคืกื•ืง says in ืฉื•ืคื˜ื™ื, ืงืคื™ื˜ืœ ื›"ื, ืคืกื•ืง ื’', that this ืขื’ืœื” has to be an ืขื’ืœืช ื‘ืงืจ ืืฉืจ ืœื ืขื•ื‘ื“ ื‘ื”, a calf that wasn't worked with, ืืฉืจ ืœื ืžืฉื›ื” ื‘ืขื•ืœ, that didn't pull a yoke. So from here we know that it has to be a calf that wasn't worked with. That's an ืขื’ืœื” ืขืจื•ืคื”. Concerning ืคืจื” ืื“ื•ืžื”, that is a ื“ื™ืŸ in ืคืจืฉืช ื—ืงืช, that you have to take a red cow, and there's a whole thing that you have to do with it, and after you burn it the ashes are mixed with water and used to sprinkle on a person who became a ื˜ืžื ืžืช. And there we also find the ื“ื™ืŸ that it's not allowed to be a cow that was ever worked with. So here we learn ื”ื›ื ื™ืกื” ืœืจื‘ืงื”, if you put it into the team, they used to have a team of three or four cows, and that's how they used to thresh. So if you took this ืขื’ืœื” ืขืจื•ืคื” or this ืคืจื” ืื“ื•ืžื”, and you put it into the team, but the purpose of doing that was not in order for it to work, to thresh, but the reason you did it because you wanted this ืขื’ืœื”, this calf, or this cow, you wanted it to nurse from its mother, but ื•ื“ืฉื”, accidentally it did thresh, it did some work, still ื›ืฉืจื”, it is still ื›ืฉืจ, you still could use this calf for an ืขื’ืœื” ืขืจื•ืคื” or this red cow for a ืคืจื” ืื“ื•ืžื”. But if you put it in ื‘ืฉื‘ื™ืœ ืฉืชื™ื ืง ื•ืชื“ื•ืฉ, you had in mind ืœื›ืชื—ื™ืœื”, that let her nurse and also at the same time let her thresh also, so then ืคืกื•ืœื”, it is ืคืกื•ืœ. So from here the

Combining personal and object benefit: case of Agala/Parah

ื’ืžืจื proves, ื•ื”ื ื”ื›ื ื“ืœืฆื•ืจื›ื• ื•ืœืฆื•ืจื›ื” ื”ื•ื, here, in the second case, when you put it in for it to nurse and for it to thresh, so it is like you would do it for its purpose and for the person's purpose. Because putting it in to nurse is for the purpose of the calf or the cow, which is allowed, but at the same time you also had in mind it should work for you. So here we have a combination of both, ื•ืงืชื ื™, and we learned ืคืกื•ืœื”, that it's ืคืกื•ืœ. So here we see that wherever there's a ื“ื™ืŸ that you're not allowed to use it for your benefit, so you're also not allowed to use it for the benefit of the thing together with your benefit. And ืชื•ืกืคื•ืช makes the question even stronger. ืชื•ืกืคื•ืช says that the ืกื™ืคื of this ืชื•ืกืคืชื that we brought here, that if you took it in just to nurse it's ื›ืฉืจ, and if you took it in to nurse and to thresh it's ืคืกื•ืœ, the ืกื™ืคื there it says clearly that if you worked with it ืœืฆื•ืจื›ื•, for the person's benefit, it's ืคืกื•ืœ. If you did it ืœืฆื•ืจื›ื”, you did something with it for the benefit of the calf itself or of the cow itself, it's ื›ืฉืจ. So we see clearly in the ื‘ืจื™ื™ืชื that if you did it for your ืฆื•ืจืš, for yourself, it's ืคืกื•ืœ, and in this part of the ื‘ืจื™ื™ืชื it said, that if you did it for both purposes, it is also ืคืกื•ืœ. So from here we see clearly that whenever you're not allowed to use it ืœืฆืจื›ื•, for the purpose of the person, if you do it at the same time, the purpose of the person and for the purpose of the thing, it is considered as if you did it for your purpose and it's ืคืกื•ืœ. So the same thing should be here concerning the ืื‘ื™ื“ื”, when we say that you're not allowed to use it for your purpose, so you're also not allowed to use it for your purpose together with the purpose of the object. And the ื’ืžืจื says, no, it's not a ืจืื™ื”. ืฉืื ื™ ื”ืชื, concerning the ื“ื™ืŸ of an ืขื’ืœื” ืขืจื•ืคื” or ืคืจื” ืื“ื•ืžื”, it's different. ื“ืืžืจ ืงืจื, because here the ืคืกื•ืง says clearly ืืฉืจ ืœื ืขื•ื‘ื“ ื‘ื”, that no work should be done with it ืžื›ืœ ืžืงื•ื, in any way. So here there's a special ื“ื™ืŸ, the ืชื•ืจื” says clearly that no work in what way whatsoever is allowed to be done with this ืขื’ืœื” ืขืจื•ืคื”. And therefore, even if it was done also for the purpose of the ืขื’ืœื”, but as long as work was done with it, it is ืคืกื•ืœ. So from here we have no ืจืื™ื” that in all cases where you're not allowed to use it for your purpose, you're not allowed to use it at the same time for your purpose and the purpose of the object, because here there is a special ืคืกื•ืง that no work should be done with it whatsoever. But the ื’ืžืจื asks: ืื™ ื”ื›ื™, if you're going to tell me that no work whatsoever is allowed to be done with the ืขื’ืœื” ืขืจื•ืคื”, ืืคื™ืœื• ืจื™ืฉื ื ืžื™, in the ืจื™ืฉื the ื“ื™ืŸ should also be it should be ืคืกื•ืœ. Why is the ื“ื™ืŸ that if you took it in to nurse, only to nurse, but it did thresh, it is ื›ืฉืจ because you didn't intend it to thresh? But who cares? Since you just said that the ืคืกื•ืง says as long as some work was done with it it is ืคืกื•ืœ, so in the ืจื™ืฉื, since it did thresh, whether you wanted it or not, ืœืคื•ืขืœ, it did do work, so it should be ืคืกื•ืœ. But the ื’ืžืจื says, no, ืœื ื“ืžื™ื ืืœื ืœื”ื ื“ืชื ืŸ, the case of the ืจื™ืฉื where you took it in just to nurse, and it threshed by itself, is similar to another case where we do find it's ื›ืฉืจ. ื“ืชื ืŸ, because we learned in the ืžืฉื ื”: ืฉื›ืŸ ืขืœื™ื” ืขื•ืฃ, this is concerning a ืคืจื” ืื“ื•ืžื”, that since the ื“ื™ืŸ is you're not allowed to have a yoke on the ืคืจื” ืื“ื•ืžื”, if an ืขื•ืฃ rested on the ืคืจื”, ื›ืฉืจื”, the ืคืจื” is still ื›ืฉืจื”. And the reason for that is because the person is not happy with it, he has no benefit from the fact that a bird rested on the back of the ืคืจื”, and therefore it's ื›ืฉืจื”. ืขืœื” ืขืœื™ื” ื–ื›ืจ, but if a male went on this ืคืจื”, ืคืกื•ืœื”, it's ืคืกื•ืœ, because the person is happy. Because through this male, the ืคืจื” will give birth to a calf, so he will gain, so he is happy that the ื–ื›ืจ went on the ืคืจื”, and therefore it is ืคืกื•ืœ because this because it is considered like a yoke. But the question is, why is it ื›ืฉืจ if the ืขื•ืฃ went on it? So we said because the person is not happy with it. Now who says there is a difference whether the person is happy or not? But the ื’ืžืจื says, ืžืื™ ื˜ืขืžื, what is the reason? ื›ื“ืจื‘ ืคืคื, like ืจื‘ ืคืคื said. ื“ืืžืจ ืจื‘ ืคืคื, ืจื‘ ืคืคื said, the ืชื•ืจื” says ืืฉืจ ืœื ืขื•ื‘ื“ ื‘ื”. It should be a calf that was not worked with. Now the way it's written is ืข-ื‘-ื“, which means ืขื‘ื“, he did not work with it, but the way it's read is ืขื•ื‘ื“, it was not worked with. So he explains: ืื™ ื›ืชื™ื‘ ืขื•ื‘ื“ ื•ืงืจื™ื ืŸ ืขื•ื‘ื“, if the ืชื•ืจื” would say ืขื•ื‘ื“ and we would read it ืขื•ื‘ื“, which means it was not worked with, ื”ื•ื” ืืžื™ื ื, I would think, ืืคื™ืœื• ืžืžื™ืœื, even if it was worked with by itself, you didn't work with it, it did work by itself, it should also be ืคืกื•ืœ. ื•ืื™ ื›ืชื™ื‘ ืขื‘ื“ ื•ืงืจื™ื ืŸ ืขื‘ื“, if the ืชื•ืจื” would write ืขื‘ื“ as it does, and we would read it ืขื‘ื“, which would mean that he did not work with it, ื”ื•ื” ืืžื™ื ื, I would think, ืขื“ ื“ืขื‘ื“ ื‘ื” ืื™ื”ื•, that the only time it's ืคืกื•ืœ if he actually worked with it, but if it worked by itself, then it wouldn't be ืคืกื•ืœ. ื”ืฉืชื ื“ื›ืชื™ื‘ ืขื‘ื“ ื•ืงืจื™ื ืŸ ืขื•ื‘ื“, now the ืชื•ืจื” writes ืขื‘ื“, but we read it ืขื•ื‘ื“, so both are true. ื‘ืขื™ื ืŸ ืขื•ื‘ื“ ื“ื•ืžื™ื ื“ืขื‘ื“. We need ืขื•ื‘ื“, was worked by itself, similar to as if he worked with it. In other words, when is it ืคืกื•ืœ? Only if we have the combination of both, that even if it worked by itself, but it worked by itself in such a way which is as if the person worked with it. ืžื” ืขื‘ื“ ื“ื ื™ื—ื ืœื™ื”, just like if he would work himself, he would be happy with it, ืืฃ ืขื•ื‘ื“ ื“ื ื™ื—ื ืœื™ื”, also if it was worked with, it worked by itself, also the only time it's ืคืกื•ืœ is if he is happy with it. So from this ืคืกื•ืง we see that the only time the ืขื’ืœื” ืขืจื•ืคื”, and the same thing applies to ืคืจื” ืื“ื•ืžื”, is ืคืกื•ืœ if even if it worked by itself, but as long as the person is happy with the work. Therefore, if ืฉื›ืŸ ืขืœื™ื” ืขื•ืฃ, if a bird rested on the back of the ืคืจื” ืื“ื•ืžื” or the ืขื’ืœื” ืขืจื•ืคื”, since the person is not happy with it, so even though there was a yoke on it, there was some work done with it, but that work doesn't make it ืคืกื•ืœ. But the same is in the ื‘ืจื™ื™ืชื that we brought before, that if he took this ืขื’ืœื” ืขืจื•ืคื” or this ืคืจื” ืื“ื•ืžื”, put it into the team in order for it to nurse, and it did some work, since in that case, he is not happy with the work it did, that's why the ื“ื™ืŸ is that it's ื›ืฉืจ. But in the second case where he ืœื›ืชื—ื™ืœื” intended to put it in so it should nurse and do work, so here he is happy with the work, in that case it is ืคืกื•ืœ. But when here we do not see what would be the ื“ื™ืŸ normally in other circumstances, in other cases, when you combine ืฆืจื›ื• and ืฆืจื›ื”, whether it's ืคืกื•ืœ or not, because here we have a special ืคืกื•ืง that tells us ืืฉืจ ืœื ืขื•ื‘ื“ ื‘ื”, that if work was done with it and he is happy with it, even if at the same time it was for the benefit of the ืขื’ืœื” ืขืจื•ืคื” or the ืคืจื” ืื“ื•ืžื”, still it is ืคืกื•ืœ. So we have a special ืคืกื•ืง. But in a case where we do not have that special ืคืกื•ืง, we don't know what will be the ื“ื™ืŸ if you use it ืœืฆืจื›ื• for his benefit, together with ืœืฆืจื›ื” with the benefit of the object. Then the ื’ืžืจื continues, we

Mishnah on using silver, copper, gold, glass vessels

learned in the ืžืฉื ื”, ื›ืœื™ ื›ืกืฃ ื•ื›ืœื™ ื ื—ื•ืฉืช ืžืฉืชืžืฉ ื‘ื”ื ื•ื›ื•ืœื™, if you find silver ื›ืœื™ื or you find copper ื›ืœื™ื, so the ื“ื™ืŸ is in the ืžืฉื ื” that you should use it ืœืฆืจื›ืŸ for their benefit, but not long enough that it should get ruined. And then the ืžืฉื ื” said further, if you find ื›ืœื™ ื–ื”ื‘ ื•ื›ืœื™ ื–ื›ื•ื›ื™ืช, gold vessels or glass vessels, ืœื ื™ื’ืข ื‘ื”ืŸ ืขื“ ืฉื™ื‘ื ืืœื™ื”ื•, do not touch it till ืืœื™ื”ื• ื”ื ื‘ื™ื comes, you should not use it at all. And the ื’ืžืจื says, ืชื ื• ืจื‘ื ืŸ, the ืจื‘ื ืŸ learned, ื”ืžื•ืฆื ื›ืœื™ ืขืฅ, if you find wooden vessels, ืžืฉืชืžืฉ ื‘ื”ืŸ, you should use it, ื‘ืฉื‘ื™ืœ ืฉืœื ื™ืจืงื‘ื•, so they shouldn't rot. ื›ืœื™ ื ื—ื•ืฉืช, if you find copper vessels, ืžืฉืชืžืฉ ื‘ื”ืŸ ื‘ื—ืžื™ืŸ, you should use it with hot water, ืื‘ืœ ืœื ืขืœ ื™ื“ื™ ื”ืื•ืจ, but you cannot use it through fire, ืžืคื ื™ ืฉืžืฉื—ื™ืงืŸ, because that ruins them completely. ื›ืœื™ ื›ืกืฃ, if you find silver ื›ืœื™ื, ืžืฉืชืžืฉ ื‘ื”ืŸ ื‘ืฆื•ื ืŸ, you can only use it for cold, ืื‘ืœ ืœื ื‘ื—ืžื™ืŸ, but not for hot, ืžืคื ื™ ืฉืžืฉื—ื™ืจืŸ, because it makes it black. ืžื’ืจื™ืคื•ืช ื•ื›ืจื›ื•ืžื•ืช, if you find an axes or shovels, ืžืฉืชืžืฉ ื‘ื”ืŸ ื‘ืจืš, you only use it for soft things, ืื‘ืœ ืœื ื‘ืงืฉื”, but not for hard things, ืžืคื ื™ ืฉืžืคื—ื™ืชืŸ, because you will ruin it. ื›ืœื™ ื–ื”ื‘ ื•ื›ืœื™ ื–ื›ื•ื›ื™ืช, if you find golden vessels or glass vessels, ืœื ื™ื’ืข ื‘ื”ืŸ ืขื“ ืฉื™ื‘ื ืืœื™ื”ื•, do not touch it till ืืœื™ื”ื• comes, in other words, till the person comes to claim it, or if he doesn't come, then it's forever, you should not touch it. And the ื‘ืจื™ื™ืชื continues, ื›ื“ืจืš ืฉืืžืจื• ื‘ืื‘ื™ื“ื”, the same as we said, if you find an ืื‘ื™ื“ื”, a lost object, ื›ืš ืืžืจื• ื‘ืคืงื“ื•ืŸ, the same ื“ื™ืŸ applies to a ืคืงื“ื•ืŸ. If someone gave you something to watch for him, so then you must do the same thing. You must make sure it doesn't get ruined, so therefore, from time to time you must use it, and the same usage as we said concerning an ืื‘ื™ื“ื”. But then the ื’ืžืจื asks, ืคืงื“ื•ืŸ ืžืื™ ืขื‘ื™ื“ืชื™ื” ื’ื‘ื™ื”, we're talking about a ืคืงื“ื•ืŸ, if someone gave him something to watch, why should he be obligated to do these things, to use it in order for it not to get ruined? Let the owner of the object come from time to time and use it and do with it what he wants, in order to make sure it doesn't get ruined. Why should the one that's holding the ืคืงื“ื•ืŸ be obligated to do it for him? The ื’ืžืจื answers, ืืžืจ ืจื‘ ืื“ื ื‘ืจ ื—ืžื ืืžืจ ืจื‘ ืฉืฉืช, ืจื‘ ืื“ื ื‘ืจ ื—ืžื said in the name of ืจื‘ ืฉืฉืช, ื‘ืคืงื“ื•ืŸ ืฉื”ืœื›ื• ื‘ืขืœื™ื”ื ืœืžื“ื™ื ืช ื”ื™ื, but what we mean here is a ืคืงื“ื•ืŸ that the owner went away to a faraway country and the owner is not here to do it, so then the one that's watching it for him, he has the obligation to do it for the owner. Then the ื’ืžืจื continues, we said in the ืžืฉื ื”, ืžืฆื ืฉืง ืื• ืงื•ืคื”, if you find a sack or a pile, ื•ื›ืœ ื“ื‘ืจ ืฉืื™ืŸ ื“ืจื›ื• ืœื™ื˜ื•ืœ, or anything that it is not the ื“ืจืš of the person who found it to take, it is beyond his ื›ื‘ื•ื“ to take it, ื”ืจื™ ื–ื” ืœื ื™ื˜ื•ืœ, then he doesn't have to take it. And the ื’ืžืจื asks, ืžื ื ื”ื ื™ ืžื™ืœื™, how do we know that? How do we know that if it's not your ื›ื‘ื•ื“ to take it, you are not obligated to fulfill the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื”? ืชื ื• ืจื‘ื ืŸ, because the ืจื‘ื ืŸ learned, ื•ื”ืชืขืœืžืช, the ืคืกื•ืง says, ื•ื”ืชืขืœืžืช, you should hide yourself. This is the ืคืกื•ืง concerning ื”ืฉื‘ืช ืื‘ื™ื“ื”. It's a ืคืกื•ืง in ืคืจืฉืช ื›ื™ ืชืฆื, ืงืคื™ื˜ืœ ื›"ื‘, ืคืกื•ืง ื'. And the ืคืกื•ืง starts off by saying, ืœื ืชืจืื” ืืช ืฉื•ืจ ืื—ื™ืš ืื• ืืช ืฉื™ื• ื ื“ื—ื™ื ื•ื”ืชืขืœืžืช ืžื”ื, ื”ืฉื‘ ืชืฉื™ื‘ื ืœืื—ื™ืš. Do not see a lost article of your brother and you should hide yourself from it, but you should return it. So really the ืคืฉื˜, ืคืฉื˜ in the ืคืกื•ืง is that you should not hide yourself from it. You should not close your eyes and make yourself as if you don't see it, but you should return it. But nevertheless, the way the ืชื•ืจื” expresses itself, the ืชื•ืจื” uses the term ื•ื”ืชืขืœืžืช ืžื”ื, that you should hide yourself from them. It is as if the ืชื•ืจื” is saying that if you see a lost article of your brother, you could close your eyes from it. So what does that mean? So the ื’ืžืจื ื“ืจืฉ'ื ืก that ืคืขืžื™ื ืฉืืชื” ืžืชืขืœื ื•ืคืขืžื™ื ืฉืื™ ืืชื” ืžืชืขืœื, that at times you are allowed to hide yourself from it, and at times you are not allowed to hide yourself from it. ื”ื ื›ื™ืฆื“? How is it? What is the ืคืฉื˜ that there are times that you are allowed to hide yourself from it and you don't have to return it? ื›ื’ื•ืŸ ืฉื”ื™ื” ื›ื”ืŸ ื•ื”ื™ื ื‘ื‘ื™ืช ื”ืงื‘ืจื•ืช, if he was a ื›ื”ืŸ and the object was on a graveyard, in a cemetery, and the ื“ื™ืŸ is that a ื›ื”ืŸ is not allowed to become ื˜ืžื, so he's not allowed to go on to the

cemetery. ืื• ืฉื”ื™ื” ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•, or he was a ืชืœืžื™ื“ ื—ื›ื and it's not in his ื›ื‘ื•ื“ that he should carry that object, ืื• ืฉื”ื™ืชื” ืžืœืื›ืชื• ืฉืœื• ืžืจื•ื‘ื” ืžืฉืœ ื—ื‘ื™ืจื•, or if his work was more than his friend's. The time he would have to waste to pick up that object would be more than the whole object is worth. So he would have a greater loss than the gain of his friend. In all these cases, how do we know that you don't have to fulfill the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื”, of returning the object? ืœื›ืš ื ืืžืจ ื•ื”ืชืขืœืžืช ืžื”ื. Therefore the ืชื•ืจื” says you should hide yourself from them, that there are cases, these cases, that you are allowed to hide yourself and not return the object. The ื’ืžืจื asks, ื•ืœืžืื™ ืื™ืฆื˜ืจื™ืš ืงืจื? For which of these three cases do we need this special ืคืกื•ืง? ืื™ืœื™ืžื, if you're going to tell me, ืœื›ื”ืŸ ื•ื”ื™ื ื‘ื‘ื™ืช ื”ืงื‘ืจื•ืช, if it is concerning the ื“ื™ืŸ that if he was a ื›ื”ืŸ and the object was in the cemetery, and the ืคืกื•ืง tells us that the ื›ื”ืŸ does not have to go into the cemetery to pick up the object and return it, ืคืฉื™ื˜ื, that is simple. Without this ืคืกื•ืง we would know this ื“ื™ืŸ, because ื”ืื™ ืขืฉื” ื•ื”ืื™ ืœื ืชืขืฉื” ื•ืขืฉื”. Because the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื” is only an ืขืฉื”, it's a positive ืžืฆื•ื”. The ืคืกื•ืง says ื”ืฉื‘ ืชืฉื™ื‘ื. But the ืื™ืกื•ืจ of a ื›ื”ืŸ becoming ื˜ืžื is a ืœื ืชืขืฉื” and an ืขืฉื”. It is a negative ืžืฆื•ื” and a positive ืžืฆื•ื”. The

Positive Command Overrides Negative Restriction

negative ืžืฆื•ื” is of not becoming ื˜ืžื, and the ืขืฉื”, the positive ืžืฆื•ื” is the ืžืฆื•ื” of ืงื“ื•ืฉื™ื ื™ื”ื™ื•. The ืคืกื•ืง says that they should be holy, and this includes the ื“ื™ืŸ of them not becoming ื˜ืžื. So this is a positive ืžืฆื•ื”. And the ื›ืœืœ is that ื•ืœื ืืชื™ ืขืฉื” ื•ื“ื—ื™ ืืช ืœื ืชืขืฉื” ื•ืขืฉื”. A ืขืฉื”, a positive ืžืฆื•ื”, cannot push away a ืœื ืชืขืฉื” and an ืขืฉื”. Like this the ื›ืœืœ is, the rule is, that whenever we have a contradiction between an ืขืฉื” and a ืœื ืชืขืฉื”, a positive ืžืฆื•ื” and a negative ืžืฆื•ื”, so we say ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”, the positive ืžืฆื•ื” pushes away the negative ืžืฆื•ื”. For instance, if a person has a garment that if he will put in ืฆื™ืฆื™ืช into this garment it'll be ืฉืขื˜ื ื–, but if he will not put ืฆื™ืฆื™ืช into this garment, then he will not fulfill the ืžืฆื•ื” of ืฆื™ืฆื™ืช. So the question is, what should he do? Should he put in ืฆื™ืฆื™ืช and fulfill the ืขืฉื” of ืฆื™ืฆื™ืช, and at the same time he will transgress the ืขื‘ื™ืจื” of wearing ืฉืขื˜ื ื–, or do we say he should not put in the ืฆื™ืฆื™ืช, he should keep the ืžืฆื•ื” of not wearing ืฉืขื˜ื ื– and not keep the ืžืฆื•ื” of wearing ืฆื™ืฆื™ืช? So we say ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”, the positive ืžืฆื•ื” pushes away the negative ืžืฆื•ื”, so the ื“ื™ืŸ is he should put in ืฆื™ืฆื™ืช, because ืฆื™ืฆื™ืช is an ืขืฉื”, and he should go against the ืœื ืชืขืฉื” of wearing ืฉืขื˜ื ื–. But this rule of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” is only if it's an ืขืฉื” against a ืœื ืชืขืฉื”. But if it's an ืขืฉื” against a ืœื ืชืขืฉื” and an ืขืฉื”, then we do not say that you fulfill the ืขืฉื”, but you'd rather fulfill the ืœื ืชืขืฉื” and the ืขืฉื” on the other end, and go against this ืขืฉื”. And really, that's what's here. The ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื” is an ืขืฉื”. The ืื™ืกื•ืจ of a ื›ื”ืŸ becoming ื˜ืžื is a ืœื ืชืขืฉื” and an ืขืฉื”. So even if we would not have this special ืคืกื•ืง that tells us that at certain times you are not obligated to fulfill the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื”, we would still know that if he is a ื›ื”ืŸ and the ืื‘ื™ื“ื” is in the cemetery he is not allowed to pick it up, because he is not allowed to do the ืขืฉื” of ื”ืฉื‘ืช ืื‘ื™ื“ื” and transgress the ืœื ืชืขืฉื” and the ืขืฉื” of becoming ื˜ืžื. So we

cannot say that the ืคืกื•ืง goes for that. ื•ืขื•ื“, another reason why we can't say the ืคืกื•ืง comes for that, because without the ืคืกื•ืง we would know it anyway, because ืœื ื“ื—ื™ื ืŸ ืื™ืกื•ืจื ืžืงืžื™ ืžืžื•ื ื. We do not push away an ืื™ืกื•ืจ because of ืžืžื•ืŸ, because of a monetary thing. This ื“ื™ืŸ of ื”ืฉื‘ืช ืื‘ื™ื“ื” is a monetary ื“ื™ืŸ, a ื“ื™ืŸ for the sake of money, to save that person's money. The ืื™ืกื•ืจ of a ื›ื”ืŸ becoming ื˜ืžื is not a ื“ื™ืŸ ืžืžื•ืŸ, it has nothing to do with money, it is an ืื™ืกื•ืจ. And the rule is that we do not push away an ืื™ืกื•ืจ for the sake of ืžืžื•ืŸ, for the sake of money. So even if not for this ืคืกื•ืง, we still would know that the ื›ื”ืŸ is not allowed to go into the ื‘ื™ืช ื”ืงื‘ืจื•ืช to pick up the ืื‘ื™ื“ื”. ืืœื, so for what will you tell me does this ืคืกื•ืง come? ืœืฉืœื• ืžืจื•ื‘ื” ืžืฉืœ ื—ื‘ื™ืจื•? To tell us if his loss, his time that he will spend to pick up the ืื‘ื™ื“ื”, will be a greater loss for him than the whole the ืื‘ื™ื“ื” is worth, so then the ื“ื™ืŸ is that you do not have to pick up the ืื‘ื™ื“ื”, if it comes for that, we don't need a ืคืกื•ืง for that either, because ืžื“ืจื‘ ื™ื”ื•ื“ื” ืืžืจ ืจื‘ ื ืคืงื, we could learn that out from what ืจื‘ ื™ื”ื•ื“ื” said in the name of ืจื‘, ืืžืจ ืจื‘ ื™ื”ื•ื“ื” ืืžืจ ืจื‘, because ืจื‘ ื™ื”ื•ื“ื” said in the name of ืจื‘: the ืคืกื•ืง says ืืคืก ื›ื™ ืœื ื™ื”ื™ื” ื‘ืš ืื‘ื™ื•ืŸ, that there will be no poor person amongst you. So from here we learn out that a person should not do anything that will bring him to become poor. So we learn out from here ืฉืœืš ืงื•ื“ื ืœืฉืœ ื›ืœ ืื“ื, that to save your own money comes before saving someone else's money. So from here we know that if by you saving his object you will have a greater loss than him, so then you do not have to pick up his object. So we know it from this ืคืกื•ืง, so we don't need that ืคืกื•ืง ื•ื”ืชืขืœืžืช to tell us this ื“ื™ืŸ. ืืœื, so for which ื“ื™ืŸ does it come? ืœื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•, that if he is a ืชืœืžื™ื“ ื—ื›ื and it's not his ื›ื‘ื•ื“ to carry this object in the street, so the ืคืกื•ืง tells us that in a case like that ื•ื”ืชืขืœืžืช, he's allowed to hide himself, which and he is not obligated to fulfill the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื”. Then the ื’ืžืจื continues,

Obligation Once You Begin Returning

ืืžืจ ืจื‘ื, ืจื‘ื said: ื”ื›ื™ืฉื”, if this ื–ืงืŸ already hit this object, this animal for instance, in order to return it to its owner, ื—ื™ื™ื‘ ื‘ื”, already he's ื—ื™ื™ื‘. Since he started doing something to bring it back to its owner, so then already he is obligated to take it all the way and bring it back to its owner. And the ื’ืžืจื tells a story, ืื‘ื™ื™ ื”ื•ื” ื™ืชื™ื‘ ืงืžื™ื” ื“ืจื‘ื”, ืื‘ื™ื™ was sitting in front of ืจื‘ื”. ื—ื–ืจื ืœื”ื ืš ืขื™ื–ื™ ื“ืงื™ื™ืžื, he saw these goats that were there. ืฉืงืœ ืงืœื ื•ืฉื“ื ื‘ื”ื•, he picked something up and he threw it at them. ืืžืจ ืœื™ื”, so ืจื‘ื” said to him: ืื™ื—ื™ื™ื‘ืช ื‘ื”ื•, now you are ืžื—ื•ื™ื™ื‘. Since you did something to start bringing it, so now you are already obligated to bring it all the way to its owner. ืงื•ื ืื”ื“ืจื™ื ื”ื•, get up and return it to its owner. Then the ื’ืžืจื asks a question: ืื™ื‘ืขื™ื ืœื”ื•, there was a question asked in the ื™ืฉื™ื‘ื”: ื“ืจื›ื• ืœื”ื—ื–ื™ืจ ื‘ืฉื“ื” ื•ืื™ืŸ ื“ืจื›ื• ืœื”ื—ื–ื™ืจ ื‘ืขื™ืจ ืžืื™? If he is a person, and this is an object that it would be his ื“ืจืš, that if it would be in the field he would be able to return it, it wouldn't be beyond his ื›ื‘ื•ื“, but in the city it is beyond his ื›ื‘ื•ื“. Since in the field there're not too many people, so he's not really embarrassed, but in the city where there are more people he is embarrassed. So in the city he would not return it, but in the field he would return it. So what would be the ื“ื™ืŸ if he found it in the field? ืžื™ ืืžืจื™ื ืŸ, do we say ื”ืฉื‘ื” ืžืขืœื™ื™ืชื ื‘ืขื™ื ืŸ, we need a complete return, ื•ื›ื™ื•ืŸ ื“ืœืื• ื“ืจื›ื™ื” ืœื”ื—ื–ื™ืจ ื‘ืขื™ืจ ืœื ืœื™ื—ื™ื™ื‘, since it's not his ื“ืจืš to return this object in the city, he is not obligated, so even if he finds it in the field. So on the place where he found it it is his ื“ืจืš to return it, but still we say you do not have to take it because you'll have to eventually get to the city with it, and in the city it is not your ื“ืจืš, so therefore you are not obligated to take it even in the field. ืื• ื“ื™ืœืžื, or maybe ื‘ืฉื“ื” ืžื™ื”ื ืื™ืกื•ืจื ื“ื—ื™ื™ื‘ ืœื™ื”, in the field you are obligated because that there it is your ื“ืจืš. So in the field you must take it, and as soon as you take it in the field, ื•ื›ื™ื•ืŸ ื“ืื™ื—ื™ื™ื‘ ืœื™ื” ื‘ืฉื“ื”, since you are ืžื—ื•ื™ื™ื‘ in the field, ืื™ื—ื™ื™ื‘ ืœื™ื” ื—ื•ื‘ ืœื™ื” ื‘ืขื™ืจ? So you are already ื—ื™ื™ื‘ in the city too. As we said before, as soon as you start, you must finish already. So here too, since in the field you must take it, so you started already, so you already must return it all the way even in the city. So what is the ื“ื™ืŸ? So the ื’ืžืจื says: ืชื™ืงื•, this remains an unanswered question.

Obligation to Return for Others

ืืžืจ ืจื‘ื, ืจื‘ื said the ื“ื™ืŸ: ื›ืœ ืฉื‘ืฉืœื• ืžื—ื–ื™ืจ, ื‘ืฉืœ ื—ื‘ื™ืจื• ื ืžื™ ืžื—ื–ื™ืจ. Anything that if it would be his own, and he would have found it himself, he would have taken it back, so if he finds the same type of object that belongs to somebody else, he must return it too. ื•ื›ืœ ืฉื‘ืฉืœื• ืคื•ืจืง ื•ื˜ื•ืขืŸ, ื‘ืฉืœ ื—ื‘ื™ืจื• ื ืžื™ ืคื•ืจืง ื•ื˜ื•ืขืŸ. There is a ื“ื™ืŸ that if you see your friend that he is trying to load his donkey and he can't manage to do it, ืขื–ื‘ ืชืขื–ื‘ ืขืžื•, you must help him load it. Or if you see he cannot unload, you must help him unload. And there too we find a ื“ื™ืŸ that if he is a ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•, he is a ืชืœืžื™ื“ ื—ื›ื and it's not his ื›ื‘ื•ื“ to load or unload a donkey, he is not obligated to load or to unload. So he says the ื“ื™ืŸ that if it would be your own you would load and unload, so you also have to do it if it's somebody else's. You are obligated with the ืžืฆื•ื” of ืขื–ื‘ ืชืขื–ื‘ ืขืžื•. And the ื’ืžืจื tells a story: ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ ื”ื•ื” ืงืื–ื™ืœ ื‘ืื•ืจื—ื, he was going in the street. ืคื’ืข ื‘ื™ื” ื”ื”ื•ื ื’ื‘ืจื, he met this man, ื”ื•ื” ื“ืจื™ ืคื™ืกื›ื ื“ืื•ืคื, he was carrying a load of wood. ืื•ืชื‘ื™ื ื”ื•, he put even an ืขื‘ื™ืจื” of stealing. So therefore he was ืžืคืงื™ืจ it, so it doesn't belong to anybody, and he saved himself the trouble of helping the man put it on his back. So what did he do? ื”ื“ืจ ื–ื›ื” ื‘ื”, so that same man, since it was ื”ืคืงืจ, he was ื–ื•ื›ื”, he acquired it, he made a ืงื ื™ืŸ on it, and now it became his again. And now he wanted again to put it on his back, and again he wanted ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ to help him. ื”ื“ืจ ื™ื”ื™ื‘ ืœื™ื” ืคืœื’ื ื“ื–ื•ื–ื ื•ืืคืงืจื™ื”, he gave him again a half a ื–ื•ื– and he was ืžืคืงื™ืจ it. He bought it back again, so now again he didn't have the obligation of helping him put it on his shoulder because it's not his, and he was ืžืคืงื™ืจ it. ื—ื–ื™ื™ื” ื“ื”ื•ื” ืงื ื‘ืขื™ ืœืžื”ื“ืจ ืœืžื™ื–ื›ื ื‘ื™ื”, so ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ saw that he wanted to take it again, he wanted to be ื–ื•ื›ื” in it again. ืืžืจ ืœื™ื”, so he said to him, ืœื›ื•ืœื™ ืขืœืžื ืืคืงืจืชื™ื”, I was ืžืคืงื™ืจ it for everybody, ื•ืœืš ืœื ืืคืงืจืชื™ื”, and for you, I wasn't ืžืคืงื™ืจ it. I didn't have in mind that it should be ื”ืคืงืจ for you too, and therefore you cannot take it. The ื’ืžืจื asks,

Definition of Ownerless Property

ืžื™ ื”ื•ื™ ื”ืคืงืจ ื›ื™ ื”ืื™ ื’ื•ื•ื ื? Is it ื”ืคืงืจ in such a way? If you're ืžืคืงื™ืจ it for some people and for some people not, is it ื”ืคืงืจ? ื•ื”ืชื ืŸ, didn't we learn in a ืžืฉื ื”, ื‘ื™ืช ืฉืžืื™ ืื•ืžืจื™ื, ื‘ื™ืช ืฉืžืื™ say, ื”ืคืงืจ ืœืขื ื™ื™ื ื”ืคืงืจ, that if you are ืžืคืงื™ืจ something, you give up ownership over something, but you say it's only ื”ืคืงืจ for poor people, it still is ื”ืคืงืจ. So a poor person is able to be ื–ื•ื›ื”, to take it, but a rich man, not. ื•ื‘ื™ืช ื”ืœืœ ืื•ืžืจื™ื, and ื‘ื™ืช ื”ืœืœ say, ืื™ื ื• ื”ืคืงืจ, it's not ื”ืคืงืจ, ืขื“ ืฉื™ื”ื ื”ืคืงืจ ืœืขื ื™ื™ื ื•ืœืขืฉื™ืจื™ื, it should be ื”ืคืงืจ for poor people and for rich people, ื›ืฉืžื™ื˜ื”, just like ืฉืžื™ื˜ื”. The year of ืฉืžื™ื˜ื”, the seventh year, the ื“ื™ืŸ is that all the fruit, all the things that grow in the field are ื”ืคืงืจ, and there it's ื”ืคืงืจ for everybody. So whenever you make something ื”ืคืงืจ it has to be similar to ืฉืžื™ื˜ื”, it has to be ื”ืคืงืจ for everybody. So here too, how did ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ say that it's ื”ืคืงืจ only for everybody but not for this person? Don't we ืคืกืงืŸ like ื‘ื™ืช ื”ืœืœ that ื”ืคืงืจ is only if it's ื”ืคืงืจ for everybody? ืืœื the ื’ืžืจื answers, ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ ืœื›ื•ืœื™ ืขืœืžื ืืคืงืจืชื™ื”, ื‘ืืžืช he was ืžืคืงื™ืจ it for everybody, ื•ื‘ืžื™ืœื™ ื‘ืขืœืžื ื”ื•ื ื“ืื•ืงืžื™ื”, he just said these words because he hoped that that man wouldn't know the ื“ื™ืŸ, so that man would think that it's ื”ืคืงืจ for others, not for him, and he wouldn't take it. But really, ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ had in mind to be ืžืคืงื™ืจ it for everybody. And then the ื’ืžืจื asks, why did ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ have to go through this whole trouble in order to save himself from helping him to put it on his shoulder? He wasn't obligated to do it to begin with, because ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ was a ืชืœืžื™ื“ ื—ื›ื, and it wasn't his ื›ื‘ื•ื“ to do it, and we said before that if you are a ืชืœืžื™ื“ ื—ื›ื and it's not the ื›ื‘ื•ื“ for you to do it, then you don't have to do it. So he wasn't obligated to do it to begin with. And the ื’ืžืจื answers, ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ ื”ื•ื ื“ืขื‘ื“. ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ did it beyond the obligation of the ื“ื™ืŸ. Really ืขืœ ืคื™ ื“ื™ืŸ he didn't have to, he wanted to do more than the ื“ื™ืŸ, and therefore he bought it from him so he shouldn't have to, even after ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, put it on his back. ื“ืชื ื™ ืจื‘ ื™ื•ืกืฃ, because ืจื‘ ื™ื•ืกืฃ learned, there's a ืคืกื•ืง in ืคืจืฉืช ื™ืชืจื• that says ื•ื”ื•ื“ืขืช ืœื”ื, this is ืงืคื™ื˜ืœ ื™"ื—, ืคืกื•ืง ื›'. It starts off with the words ื•ื”ื–ื”ืจืช ืืชื”ื ืืช ื”ื—ืงื™ื ื•ืืช ื”ืชื•ืจื•ืช, you should warn them the laws and the ืชื•ืจื•ืช, ื•ื”ื•ื“ืขืช ืœื”ื ืืช ื”ื“ืจืš ื™ืœื›ื• ื‘ื”, and you should notify them the way they should go in, ื•ืืช ื”ืžืขืฉื” ืืฉืจ ื™ืขืฉื•ืŸ, and the acts that they should do. So concerning the ื“ื™ื ื™ื of the ืชื•ืจื”, that is the first part of the ืคืกื•ืง, where it says you should warn them the ื—ื•ืงื™ื and the ืชื•ืจื•ืช, that means you should teach them the ื“ื™ื ื™ื. So what does the ืคืกื•ืง mean when it continues ื•ื”ื•ื“ืขืช ืœื”ื ืืช ื”ื“ืจืš ื™ืœื›ื• ื‘ื” ื•ืืช ื”ืžืขืฉื” ืืฉืจ ื™ืขืฉื•ืŸ, you should notify them the way they should go in and the acts that they should do? So ืจื‘ ื™ื•ืกืฃ learned, ื•ื”ื•ื“ืขืช ืœื”ื, when it says you should notify them, ื–ื” ื‘ื™ืช ื—ื™ื™ื”ื, that is their livelihood, that you should teach them, as ืจืฉ"ื™ says, a trade so they should be able to make a livelihood. ืืช ื”ื“ืจืš, it says the way, ื–ื• ื’ืžื™ืœื•ืช ื—ืกื“ื™ื, teach them ื’ืžื™ืœื•ืช ื—ืกื“ื™ื, kindness. Then the ืคืกื•ืง continues, ื™ืœื›ื• ื‘ื”, they should go in it, so he says, the word ื™ืœื›ื•, they should go, ื–ื• ื‘ื™ืงื•ืจ ื—ื•ืœื™ื, that is visiting the sick, going to visit the sick. ื‘ื”, when it says in it, ื–ื• ืงื‘ื•ืจื”, that you should help bury somebody who doesn't have anybody to bury him. Then ื•ืืช ื”ืžืขืฉื”, that you should do the act, ื–ื” ื”ื“ื™ืŸ, that refers to the ื“ื™ืŸ. ืืฉืจ ื™ืขืฉื•ืŸ, ื–ื• ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, that they should do, that is more than the requirements of the ื“ื™ืŸ. So here we see that the ืชื•ืจื” says a person should do more than the ื“ื™ืŸ requires of him. So that is the reason why ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™ bought off that pile of wood from that person, even though he wasn't obligated to help him load anyway, because he wants to do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ. Then the ื’ืžืจื continues, ืืžืจ ืžืจ, we just learned ื™ืœื›ื• ื–ื” ื‘ื™ืงื•ืจ ื—ื•ืœื™ื, that the word ื™ืœื›ื• means that you should visit the sick. So the ื’ืžืจื asks, ื”ื™ื™ื ื• ื’ืžื™ืœื•ืช ื—ืกื“ื™ื, isn't this ื’ืžื™ืœื•ืช ื—ืกื“ื™ื? Since the previous words ืืช ื”ื“ืจืš we said meant ื’ืžื™ืœื•ืช ื—ืกื“ื™ื, so why isn't ื‘ื™ืงื•ืจ ื—ื•ืœื™ื, visiting the sick, included in ื’ืžื™ืœื•ืช ื—ืกื“ื™ื? So why do we need a special word to teach us that you have to have ื‘ื™ืงื•ืจ ื—ื•ืœื™ื? The ื’ืžืจื says ืœื ื ืฆืจื›ื”, does not have to tell us

Going Beyond the Letter of the Law

ืืœื ืœื‘ืŸ ื’ื™ืœื•, that even a ื‘ืŸ ื’ื™ืœื• you must visit. A ื‘ืŸ ื’ื™ืœื• is somebody who was born at the same time as the first person, at the same hour, under the same star, and nevertheless you should visit him, because I would think that him you should not visit. ื“ืืžืจ ืžืจ, because we learned, ื‘ืŸ ื’ื™ืœื•, if you go to visit your ื‘ืŸ ื’ื™ืœื•, ื ื•ื˜ืœ ืื—ื“ ืžืฉืฉื™ื ื‘ื—ืœื™ื•, you take away one sixtieth of his sickness. So I would think you shouldn't visit him because then you take part of his sickness. So the ื“ื™ืŸ is ืืคื™ืœื• ื”ื›ื™ ืžื‘ืขื™ื ืœื™ื” ืœืžื™ื–ืœ ืœื’ื‘ื™ื”, still you should go to him. That's what the ืคืกื•ืง teaches us, that you should be ืžื‘ืงืจ ื—ื•ืœื™ื even if it will cause you harm. Then we said ื‘ื” ื–ื• ืงื‘ื•ืจื”. The word ื‘ื” teaches us that you have to help bury a person. So the ื’ืžืจื asks, ื”ื™ื™ื ื• ื’ืžื™ืœื•ืช ื—ืกื“ื™ื, isn't this included in ื’ืžื™ืœื•ืช ื—ืกื“ื™ื? And the ื’ืžืจื says ืœื ื ืฆืจื›ื” ืืœื ืœื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•, that if he's a ืชืœืžื™ื“ ื—ื›ื and it's not his ื›ื‘ื•ื“ that he should involve himself in burying somebody, nevertheless the ืชื•ืจื” tells us that you should, that the ื“ื™ืŸ of ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื• does not apply concerning the ื“ื™ืŸ of ืงื‘ื•ืจื”. Then the ืคืกื•ืง said ืืฉืจ ื™ืขืฉื•ืŸ ื–ื• ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, you should do, that means that you should do more than the requirement of the ื“ื™ืŸ.

Jerusalemโ€™s Fall and Exceeding the Law

ื“ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, because ืจื‘ื™ ื™ื•ื—ื ืŸ said, ืœื ื—ืจื‘ื” ื™ืจื•ืฉืœื™ื ืืœื ืขืœ ืฉื“ื ื• ื‘ื” ื“ื™ืŸ ืชื•ืจื”, ื™ืจื•ืฉืœื™ื did not become destroyed only because they ืคืกืง'ื ื“ there according to the ื“ื™ืŸ of the ืชื•ืจื”. So the ื’ืžืจื asks, what's wrong with that? ืืœื ื“ื™ื ื™ ื“ืžื’ื™ื–ืชื ืœื“ื™ื™ื ื•, how should they ืคืกืง'ืŸ there? Not according to the ืชื•ืจื”, but according to the those people who force others to do by force? ืืœื ืื™ืžื, so the ื’ืžืจื says say what does it mean? ืฉื”ืขืžื™ื“ื• ื“ื™ื ื™ื”ื ืขืœ ื“ื™ืŸ ืชื•ืจื”, they put all their ื“ื™ื ื™ื on the ื“ื™ืŸ of the ืชื•ืจื”, ื•ืœื ืขื‘ื“ื• ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, they did not do more than the ื“ื™ืŸ requires. And that is enough that because of that ื™ืจื•ืฉืœื™ื was destroyed. So we see here how important it is for a person to do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ. Concerning what we learned before, the ื“ื™ืŸ by ืขื’ืœื” ืขืจื•ืคื” and by ืคืจื” ืื“ื•ืžื”, that you're not allowed to do any work with it because the ืคืกื•ืง says ืืฉืจ ืœื ืขื•ื‘ื“ ื‘ื”. And the word is written ืขื‘ื“, and we read ืขื•ื‘ื“. And we say the ืคืฉื˜ is that even if the work was done by itself, but as long as it was ื“ื•ืžื™ื ื“ืขื‘ื“, as if you did the work with it, in other words you were happy, so then the ื“ื™ืŸ is that it's ืคืกื•ืœ. So concerning that, ืชื•ืกืคื•ืช asks a ืงืฉื™ื, that this ืคืกื•ืง is written by ืขื’ืœื” ืขืจื•ืคื”, not by ืคืจื” ืื“ื•ืžื”. So how do we know that the same ื“ื™ืŸ applies by ืคืจื” ืื“ื•ืžื”? And ืชื•ืกืคื•ืช answers that since we see there are similar ื“ื™ื ื™ื by the ื“ื™ืŸ of ืขื’ืœื” ืขืจื•ืคื” and ืคืจื” ืื“ื•ืžื” concerning the ืคืกื•ืœ of ืขื•ืœ, that you're not allowed to have a yoke on it, you're not allowed to have any work done with it, so then from since we see the ื“ื™ื ื™ื are equal, so we understand that all the ื“ื™ื ื™ื are equal. And therefore, also concerning this ื“ื™ืŸ, that if the work was done by itself, but it was similar to as if it was done through you, it is ืคืกื•ืœ, so we learn out the ื“ื™ืŸ by ืคืจื” ืื“ื•ืžื” from the ื“ื™ืŸ of ืขื’ืœื” ืขืจื•ืคื”. Then ืชื•ืกืคื•ืช asks another ืงืฉื™ื. We

Male on Red Heifer โ€“ Happiness Debate

said that if ืขืœื” ืขืœื™ื” ื–ื›ืจ, it's ืคืกื•ืœ, that if a ื–ื›ืจ, a male, went on the ืคืจื” ืื“ื•ืžื”, it is ืคืกื•ืœ. Why? Because the person who saw it is happy, because through this he's going to gain a calf. The ืคืจื” ืื“ื•ืžื” will become pregnant and he will gain a calf, so it's ื ื™ื—ื ืœื™ื”, he's happy. Since he is happy, we say that that is ืคืกื•ืœ. So ืชื•ืกืคื•ืช asks that ืœื›ืื•ืจื”, the person should not be happy, because if he will be happy, then the ื“ื™ืŸ is that the ืคืจื” ืื“ื•ืžื” will become ืคืกื•ืœ. So let's see what is the gain and what is the loss. Why should he be happy? Because he will gain the calf, but at the same time he will lose the whole ืคืจื” ืื“ื•ืžื”. Now, a ืคืจื” ืื“ื•ืžื” is worth a lot of money. The calf that he will get is only worth a little bit amount of money. So why should he be happy because of the gain that he will get through the calf, when through that he will lose the whole ืคืจื”, which is a much greater loss? So therefore, ื‘ืคืฉื˜ื•ืช we should assume the person is not happy. So since the person is not happy, then the ื“ื™ืŸ should be that the ืคืจื” should not become ืคืกื•ืœ. And ืชื•ืกืคื•ืช answers that we could go ahead and say now that we're going to say that he is not happy, since he is not happy, then the ืคืจื” is ื›ืฉืจ. Now, since the ืคืจื” is ื›ืฉืจ, automatically there is no loss in the ืคืจื”. If there There is no loss in the ืคืจื”, so he is already happy that a ื–ื›ืจ went on, because he will gain the calf and not lose the ืคืจื”. So automatically he does become happy. And the moment we say he is happy, automatically the ืคืจื” ืื“ื•ืžื” is ืคืกื•ืœ. And that's why the ื“ื™ืŸ is that the ืคืจื” ืื“ื•ืžื” is ืคืกื•ืœ.

Threshing vs Male on Heifer Distinction

Another question that ืชื•ืกืคื•ืช asks is, what is the difference between ืขืœื” ืขืœื™ื” ื–ื›ืจ and ื”ื›ื ื™ืกื” ืœืจื‘ืงื” ื•ื“ืฉื”? We said that if a ื–ื›ืจ went on it, since he is happy because he will gain, therefore the ืคืจื” ืื“ื•ืžื” is ืคืกื•ืœ. On the other hand, if he put that ืขื’ืœื” ืขืจื•ืคื” or ืคืจื” ืื“ื•ืžื” in the ืจื‘ืงื”, in the team, and he intended for it to nurse, but it did thresh, we say it is ื›ืฉืจ because that's not what he intended. But why don't we say that ื‘ื“ื™ืขื‘ื“, since it did thresh, he is happy, he gained on the deal? So since he gained, it's ื ื™ื—ื ืœื™ื”. So therefore, the ืคืจื” should be ืคืกื•ืœ. Just like by ืขืœื” ืขืœื™ื” ื–ื›ืจ, we say since he is happy that it happened, it is ืคืกื•ืœ, so too, he is happy that the ืคืจื” threshed, and the ื“ื™ืŸ should be it should be ืคืกื•ืœ. ืชื•ืกืคื•ืช answers that there is a difference. By the case of ืขืœื” ืขืœื™ื” ื–ื›ืจ, since there is a gain, a real gain, because the ืคืจื” will become pregnant and he will have a calf, so then it's ื ื™ื—ื ืœื™ื”. By the case of the threshing, he gains very little, because even if not for this ืคืจื”, the threshing would have been done through the other ones that are in that team. So there's a very little gain, so here we do not consider it as if the person is happy, and therefore the

The status of the wood load and ื”ืคืงืจ

ื“ื™ืŸ is that it's ื›ืฉืจ. Concerning the story the ื’ืžืจื brought with ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจื‘ื™ ื™ื•ืกื™, when he met this person, and he asked him to help him load the load of wood on his back, so he bought it from him and he was ืžืคืงื™ืจ it, and we said that the reason he was ืžืคืงื™ืจ it because he didn't want that if somebody would find it should be ืขื•ื‘ืจ ืขืœ ืื™ืกื•ืจ ื’ื–ืœ, so ืชื•ืกืคื•ืช asks a ืงืฉื™ื, we know a ื“ื™ืŸ that ื”ืคืงืจ is only ื”ืคืงืจ if it was done in front of three people. The reason for that is so that one of the three should be able to be ื–ื•ื›ื” if he wants, and the other two should be witnesses. But here, there were no other people there, so how could he have been ืžืคืงื™ืจ it in front of this one person? And ืชื•ืกืคื•ืช answers that maybe here there were three people, or ืชื•ืกืคื•ืช says ืžื“ืื•ืจื™ื™ืชื you don't have to have three, and therefore even if you don't have three, it's also ื”ืคืงืจ. And ืชื•ืกืคื•ืช adds that if it's in a case where we know for sure, ืื ืŸ ืกื”ื“ื™, we are like witnesses, we know for sure that he really had in mind to be ืžืคืงื™ืจ it, then it's ื”ืคืงืจ even if it was not done in front of three. When the ื’ืžืจื said that ืœื ื—ืจื‘ื” ื™ืจื•ืฉืœื™ื ืืœื ืขืœ ืฉื”ืขืžื™ื“ื• ื“ื™ื ื™ื”ื ืขืœ ื“ื™ืŸ ืชื•ืจื” ื•ืœื ืขื‘ื“ื• ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, that the reason ื™ืจื•ืฉืœื™ื was destroyed was because they did everything ืขืœ ืคื™ ื“ื™ืŸ and they didn't do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, so

Reasons for the destruction of the Temple

ืชื•ืกืคื•ืช asks a ืงืฉื™ื, the ื’ืžืจื says in ื™ื•ืžื that the reason why the ื‘ื™ืช ื”ืžืงื“ืฉ was destroyed was because of ืฉื ืืช ื—ื ื, because the people hated each other for no reason. So here it says the reason because of not doing ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, and there the ื’ืžืจื gives the reason because of ืฉื ืืช ื—ื ื, and ืชื•ืกืคื•ืช answers that both of them were ื’ื•ืจื, they were both reasons for the ื—ื•ืจื‘ืŸ ื‘ื™ืช ื”ืžืงื“ืฉ. Concerning this ืขื ื™ืŸ that because they did not do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, that is the reason why the ื‘ื™ืช ื”ืžืงื“ืฉ was destroyed, so it says in many ืกืคืจื™ื that ืœื›ืื•ืจื”, why is that such a terrible thing? The ื“ื™ืŸ is that you have to do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, but why is that a terrible thing that this is a reason for the ื—ื•ืจื‘ืŸ ื‘ื™ืช ื”ืžืงื“ืฉ, for the destruction of the ื‘ื™ืช ื”ืžืงื“ืฉ? And the answer that they give is that doing ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ shows that a person really has ื—ื‘ื™ื‘ื•ืช ื”ืžืฆื•ื”, loves the ืžืฆื•ื”, and wants to do really what ื”ืฉื wants. To give a ืžืฉืœ, if you have an ืขื‘ื“, you have a servant or a slave, and he does everything that he is supposed to, that still doesn't prove that he really likes his master and he wants to help and do everything for his master, because maybe the reason he does it is because he is afraid that if he will not do what his master wants him to do, he will be punished, or for other reasons, but it doesn't mean that he really loves his master. The only way you know that he loves his master is when he comes to a point when he is not asked to do something, but he understands that his master would be happy if it would be done, and if he wouldn't do it he wouldn't be punished, nothing will happen, and still he goes ahead and does it because he knows that this will satisfy his master, that really shows that he loves his master. And the same with the ืื™ื“ืŸ and ื”ืฉื. When we do the ืžืฆื•ืช just the way we're supposed to, that doesn't prove that we really love ื”ืฉื, that we really love the ืžืฆื•ืช. Since we are ืžืืžื™ื ื™ื ื‘ื ื™ ืžืืžื™ื ื™ื, we believe in ื”ืฉื, we believe that ื”ืฉื commanded us to do it, and we believe that ื”ืฉื will punish us if ื—ืก ื•ืฉืœื•ื we will not do it, so because we are afraid of the punishment, that's why we do the ืžืฆื•ืช. But that doesn't prove that we really love ื”ืฉื and we want to do everything to satisfy ื”ืฉื. When do we show that we really love ื”ืฉื is if we do more than we are required. to do. That shows that we don't do the ืžืฆื•ื•ืช because we are afraid of punishment, but we do them because we know that this is the ืจืฆื•ืŸ ื”ืฉื, this is the will of ื”ืฉื, and we want to satisfy ื”ืฉื. And

Lack of love leading to Temple's ruin

that's why, in the time of the ื—ื•ืจื‘ืŸ ื‘ื™ืช ื”ืžืงื“ืฉ, when the ืื™ื“ืŸ did not do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, that showed that the ืื™ื“ืŸ did not really care about ื”ืฉื, they did not love ื”ืฉื, they just did it out of fear that they might be punished. So, since ื”ืฉื saw that they do not have the love to Him, so He said that therefore I will not show My love to you, and therefore He allowed the ื‘ื™ืช ื”ืžืงื“ืฉ to be destroyed. Because the ื‘ื™ืช ื”ืžืงื“ืฉ shows that ื”ืฉื loves us, that ื‘ื™ืช ื”ืžืงื“ืฉ shows that ื”ืฉื dwells amongst the ืื™ื“ืŸ and is close to us, but when the ืื™ื“ืŸ showed to ื”ืฉื that they are not close to Him, so then ื”ืฉื said, I will show you that I am not close to you, and that's why this was the reason for the ื‘ื™ืช ื”ืžืงื“ืฉ to be destroyed. This is similar to what the ื’ืžืจื says in ื ื“ืจื™ื, that the reason why ื™ืจื•ืฉืœื™ื was destroyed was because ืœื ื‘ืจื›ื• ื‘ืชื•ืจื” ืชื—ื™ืœื”, they didn't make ื‘ืจื›ืช ื”ืชื•ืจื”, they didn't say the ื‘ืจื›ื•ืช before they learned. And as the ืชืœืžื™ื“ื™ ืจื‘ื™ื ื• ื™ื•ื ื” explain, that it doesn't mean physically they didn't make the ื‘ืจื›ืช ื”ืชื•ืจื”, it means that they didn't feel the ื—ืฉื™ื‘ื•ืช ื”ืชื•ืจื”, they didn't feel the importance of the ืชื•ืจื”. And as the ืกืคืจื™ื explain, based on the ื‘ืดื—, that what it means is that when they learned ืชื•ืจื”, they didn't feel the ืงื“ื•ืฉืช ื”ืชื•ืจื”. When they learned ืชื•ืจื”, they didn't feel that the reason they're learning ืชื•ืจื” is because these words of the ืชื•ืจื” are ื—ื›ืžืชื• ืฉืœ ื”ืงื“ื•ืฉ ื‘ืจื•ืš ื”ื•ื, this is the wisdom of ื”ืฉื, and when you learn ืชื•ืจื”, you get close to ื”ืฉื. When they learned ืชื•ืจื”, they had in mind that they have to learn ืชื•ืจื” because they are obligated, plus the ืชื•ืจื” is a very interesting ื—ื›ืžื”, a very interesting subject, and therefore they learned ืชื•ืจื”. But the ืงื“ื•ืฉื” of ืชื•ืจื”, the ื—ื‘ื™ื‘ื•ืช to the ืงื“ื•ืฉื” of ืชื•ืจื”, the importance of the ืงื“ื•ืฉื” of ืชื•ืจื”, they did not feel. And that's the reason why the ื‘ื™ืช ื”ืžืงื“ืฉ was destroyed. So these two reasons go together. When it says here that they did not do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, and when the ื’ืžืจื says there that the reason ื™ืจื•ืฉืœื™ื was destroyed was because they did not feel the ื—ืฉื™ื‘ื•ืช, the ืงื“ื•ืฉื” of ืชื•ืจื”, really go together. They really mean the same thing. Here too, when they did the ืžืฆื•ื•ืช and they did not do ืœืคื ื™ื ืžืฉื•ืจืช ื”ื“ื™ืŸ, that shows that they didn't have the real feeling of ื—ื‘ื™ื‘ื•ืช, of love to ื”ืฉื. And so too when they learned ืชื•ืจื” without the proper approach, without the proper feeling that the ืชื•ืจื” is ืงื“ื•ืฉื”, that the ืชื•ืจื” is the wisdom of ื”ืฉื, it also shows that they didn't have the proper love to ื”ืฉื. So these two reasons go together, that when they showed ื”ืฉื that they don't have the proper love to Him, so ื”ืฉื said, then I will let the ื‘ื™ืช ื”ืžืงื“ืฉ be destroyed, because then I will not show you My love to you, because ื”ืฉื works ืžื™ื“ื” ื›ื ื’ื“ ืžื™ื“ื”, and since they did not show their love to Him, He did not show His love to them.

Returning lost items: rule of the elder

Concerning what ืจื‘ื said in the ื’ืžืจื before, ื›ืœ ืฉื‘ืฉืœื• ืžื—ื–ื™ืจ ื‘ืฉืœ ื—ื‘ื™ืจื• ื ืžื™ ืžื—ื–ื™ืจ, that anything that if it would be your own you would return it, you would take it, so too if it is your friend's you must take it. So the ืžื”ืจืฉืดืœ asks a ืงืฉื™ื: according to this ื›ืœืœ, what difference is there between a ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื• and other people? In other words, why did the ื’ืžืจื say before that if he's a ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•, then he doesn't have to return it? The same ื“ื™ืŸ applies to everybody! There is a ื›ืœืœ: we have to look, if it would be his own he would bring it back, then he has to return it to his friend too. If it would be his own he wouldn't bring it back, then he doesn't have to return his friend's either. So what does it have to do with the ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•? Especially that there is a ืžื—ืœื•ืงืช whether this ื“ื™ืŸ of ื–ืงืŸ is only a ื–ืงืŸ ื‘ื—ื›ืžืช ื”ืชื•ืจื”, only if he's a ืชืœืžื™ื“ ื—ื›ื, that's when the ื“ื™ืŸ is that he doesn't have to return it, or any person who is a person of ื›ื‘ื•ื“ and he wouldn't do it for himself, he doesn't have to do it for someone else. So according to the opinion that it doesn't mean ื“ื•ื•ืงื a ืชืœืžื™ื“ ื—ื›ื, it means anybody who it's not his ื›ื‘ื•ื“ to take that object in the street, he is not obligated to bring it back, that's what ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื• means, so what is the meaning in this whole term of ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื•? It all should depend on this rule whether he would take his own object or not. And the ืžื”ืจืฉืดืœ answers that what it means is that ืกืชื by a person we assume that his ื—ื–ืงื” is that he would take it back, and therefore normally, unless we know for sure that he wouldn't take his own, we assume he would take his own and therefore he is obligated to take his friend's too. By a ื–ืงืŸ, by a ื›ื‘ื•ื“ื™ืงืข person, then we say that ืžืŸ ื”ืกืชื he wouldn't take it, and therefore we say that normally as ื–ืงืŸ, it is not ืœืคื™ ื›ื‘ื•ื“ื•, and he doesn't have to bring it back. Others answer that the reason the ื‘ืจื™ื™ืชื picked the ืœืฉื•ืŸ of ื–ืงืŸ ื•ืื™ื ื” ืœืคื™ ื›ื‘ื•ื“ื• to tell us that the only time you are ืคื˜ื•ืจ from ื”ืฉื‘ืช ืื‘ื™ื“ื” if you wouldn't have taken your own is only if the reason you wouldn't take your own is because of ื›ื‘ื•ื“. But what would be if the reason he wouldn't take it if it would be his own is because he has a lot of money and he doesn't mind to lose the money. In a case like that we don't say this ื›ืœืœ that since you wouldn't take your own you don't take your friend's, and the ื“ื™ืŸ would be that you would have to take your friend's, you would have to fulfill the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื”.

Elder's exemption and burial obligations

Concerning the ืงืฉื™ื the ื’ืžืจื asked on ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ when he said to the man that I was ืžืคืงื™ืจ it for everybody but not for you. So the ื’ืžืจื asked, how can that be ื”ืคืงืจ when we learn in the ืžืฉื ื”, ื‘ื™ืช ืฉืžืื™ holds if you're ืžืคืงื™ืจ it just ืœืขื ื™ื™ื it's still ื”ืคืงืจ, ื‘ื™ืช ื”ืœืœ says it's not ื”ืคืงืจ unless it's ื”ืคืงืจ for ืขื ื™ื™ื and for ืขืฉื™ืจื™ื ื›ืฉืžื™ื˜ื”, so it comes out that you have to be ืžืคืงื™ืจ it for everybody, so how did the ื”ืคืงืจ of ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ help? And the ื’ืžืจื answered that he really was ืžืคืงื™ืจ it for everybody, he just said that he was ืžืคืงื™ืจ it just for others, not for him. So the ืจ"ืฉ in ืคืื”, ืคืจืง ื• ืžืฉื ื” ื, brings a ื™ืจื•ืฉืœืžื™. In ื™ืจื•ืฉืœืžื™ in ืคืื” ืคืจืง ื• ื”ืœื›ื” ื, there's a ืžื—ืœื•ืงืช between ืจื‘ื™ ื™ื•ื—ื ืŸ and ืจื™ืฉ ืœืงื™ืฉ what the reason of ื‘ื™ืช ื”ืœืœ is that you have to be ืžืคืงื™ืจ it ืœืขื ื™ื™ื and ืœืขืฉื™ืจื™ื. ืจื‘ื™ ื™ื•ื—ื ืŸ says that even according to ื‘ื™ืช ื”ืœืœ, you don't have to be ืžืคืงื™ืจ it for the whole world. Because he doesn't hold that they learn it out from ืฉืžื™ื˜ื”, that it has to be ื”ืคืงืจ for everybody, they learn it out from the word ืื•ืชื. So from here we know that it has to be ื”ืคืงืจ not only for ืขื ื™ื™ื, but also for ืขืฉื™ืจื™ื, but we don't learn out the ื“ื™ืŸ that it has to be ื”ืคืงืจ for everybody. And therefore, according to ืจื‘ื™ ื™ื•ื—ื ืŸ, according to ื‘ื™ืช ื”ืœืœ, if he is ืžืคืงื™ืจ it just for ื™ื™ื“ืŸ and not for ื’ื•ื™ื, he's ืžืคืงื™ืจ it just for people from this city and not people from another city, even according to ื‘ื™ืช ื”ืœืœ is ื”ืคืงืจ, as long as it's ืœืขื ื™ื™ื and ืœืขืฉื™ืจื™ื, but it doesn't have to include everybody in the world. ืจื™ืฉ ืœืงื™ืฉ holds that ื‘ื™ืช ื”ืœืœ learns it out from ืฉืžื™ื˜ื”. Just like ืฉืžื™ื˜ื” is ื”ืคืงืจ for everybody, so too ื”ืคืงืจ has to be for everybody. So according to that, since we have ืจื‘ื™ ื™ื•ื—ื ืŸ who holds that even according to ื‘ื™ืช ื”ืœืœ it doesn't have to be ื”ืคืงืจ for everybody, so what kind of ืงืฉื™ื did the ื’ืžืจื here ask on ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™, and how was he able to be ืžืคืงื™ืจ it for everybody except this one person, since according to ื‘ื™ืช ื”ืœืœ it has to be ื”ืคืงืจ ืœืขื ื™ื™ื and ืœืขืฉื™ืจื™ื? Maybe ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ holds like ืจื‘ื™ ื™ื•ื—ื ืŸ, that you could be ืžืคืงื™ืจ it for some people and not for others, as long as it's for ืขื ื™ื™ื and for ืขืฉื™ืจื™ื? And he answers, that really what the ื’ืžืจื meant here was not a ืงืฉื™ื on ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™, but really it's a ืงืฉื™ื on ืจื™ืฉ ืœืงื™ืฉ. That ืœื›ืื•ืจื” from here we see that ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ holds like ืจื‘ื™ ื™ื•ื—ื ืŸ, so how would ืจื™ืฉ ืœืงื™ืฉ explain the story of ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™? That's what the ื’ืžืจื meant to ask. And that's what the ื’ืžืจื answered, that we could answer even according to ืจื™ืฉ ืœืงื™ืฉ, that ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ does fit according to ืจื™ืฉ ืœืงื™ืฉ, because really he was ืžืคืงื™ืจ it for everybody, he just said that he was ืžืคืงื™ืจ it for others, not for him. On the other hand, others want to use this ื’ืžืจื as a ืจืื™ื” that the ื”ืœื›ื” is like ืจื™ืฉ ืœืงื™ืฉ. Since the ื’ืžืจื asks a ืงืฉื™ื on ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ in a ืœืฉื•ืŸ ืกืชื, and the ื’ืžืจื asks, how could he do it, since we learn in the ืžืฉื ื” that ื‘ื™ืช ื”ืœืœ says it has to be ื”ืคืงืจ ืœืขื ื™ื™ื ื•ืœืขืฉื™ืจื™ื, and the ื’ืžืจื doesn't mention ืจื™ืฉ ืœืงื™ืฉ's name, is a ืจืื™ื” that the ื’ืžืจื accepts the ื”ืœื›ื” like ืจื™ืฉ ืœืงื™ืฉ. Because if the ื”ืœื›ื” would not be like ืจื™ืฉ ืœืงื™ืฉ, the ื”ืœื›ื” would be like ืจื‘ื™ ื™ื•ื—ื ืŸ, and the ืงืฉื™ื of the ื’ืžืจื is only that how will ืจื™ืฉ ืœืงื™ืฉ himself explain the story of ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ who was a ืชื ื, so then the ื’ืžืจื should have said: ื•ืœืจื™ืฉ ืœืงื™ืฉ ืžื™ ื”ื•ื” ื”ืคืงืจ ื›ื™ ื”ืื™ ื’ื•ื•ื ื? According to ืจื™ืฉ ืœืงื™ืฉ, is it ื”ืคืงืจ in such a way? And since the ื’ืžืจื didn't mention ืจื™ืฉ ืœืงื™ืฉ at all, the ื’ืžืจื asked with a ืคืฉื˜ื•ืช that how could ืจื‘ื™ ื™ืฉืžืขืืœ ื‘ืจ ืจื‘ื™ ื™ื•ืกื™ do it when ื‘ื™ืช ื”ืœืœ says it has to be ืœืขื ื™ื™ื ื•ืœืขืฉื™ืจื™ื, and this only fits according to ืจื™ืฉ ืœืงื™ืฉ, is ืžืฉืžืข that the ื”ืœื›ื” is like ืจื™ืฉ ืœืงื™ืฉ. Even though there is a ื›ืœืœ that only in three places the ื”ืœื›ื” is like ืจื™ืฉ ืœืงื™ืฉ against ืจื‘ื™ ื™ื•ื—ื ืŸ, so we must say that this ื›ืœืœ is only concerning the ืžื—ืœื•ืงืช that we have in ื‘ื‘ืœื™, but not concerning the ืžื—ืœื•ืงืช between ืจื‘ื™ ื™ื•ื—ื ืŸ and ืจื™ืฉ ืœืงื™ืฉ in ื™ืจื•ืฉืœืžื™. And it could be that in such a ืžื—ืœื•ืงืช the ื”ืœื›ื” could be like ืจื™ืฉ ืœืงื™ืฉ. This is the opinion of the ื ื•ื“ืข ื‘ื™ื”ื•ื“ื” in ืžื”ื“ื•ืจื ืงืžื ืื‘ืŸ ื”ืขื–ืจ ืกื™ืžืŸ ื ื˜. Concerning what the ื’ืžืจื said before that from the word ื‘ื• we learn out ืงื‘ื•ืจื”, and the ื’ืžืจื asked, and isn't this ื’ืžื™ืœื•ืช ื—ืกื“ื™ื? And the ื’ืžืจื answered that it comes for ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื•, that even if he's a ื–ืงืŸ and it's not his ื›ื‘ื•ื“ to involve himself in burial, nevertheless he has to involve himself in burial. So some ask a ืงืฉื™ื, why do we need a ืคืกื•ืง to tell us that a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• still has to be ืžืชืขืกืง in ืงื‘ื•ืจื”, why should we think that he is ืคื˜ื•ืจ? It is a ืžืฆื•ื” to bury a person on the day that he passes away. So since it's a ืžืฆื•ื”, we know for sure that even if he is a ื–ืงืŸ he must fulfill the ืžืฆื•ื”. And as we see that when it comes to the ื“ื™ืŸ of ื”ืฉื‘ืช ืื‘ื™ื“ื”, if not for the special ืคืกื•ืง of ื•ื”ืชืขืœืžืช, we would think that even a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• is obligated to fulfill the ืžืฆื•ื” of ื”ืฉื‘ืช ืื‘ื™ื“ื”, because it's a ืžืฆื•ื”. So why should we think that by the case of ืงื‘ื•ืจื” where we do not have this special ืคืกื•ืง that tells us that he's ืคื˜ื•ืจ, why should we need a ืคืกื•ืง to tell us that he's ื—ื™ื™ื‘? As long as we don't have a ืคืกื•ืง that he is ืคื˜ื•ืจ, we assume for sure that he is ื—ื™ื™ื‘ since it is a ืžืฆื•ื”. And we can't say that we learn it out from ื”ืฉื‘ืช ืื‘ื™ื“ื”, that after we have the ืคืกื•ืง by ื”ืฉื‘ืช ืื‘ื™ื“ื” that if he is a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• he is not ืžื—ื•ื™ื™ื‘ ื”ืฉื‘ืช ืื‘ื™ื“ื”, so from there we would learn out and say the same applies also to ืงื‘ื•ืจื”, that if he's a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• he would be ืคื˜ื•ืจ, and that is the reason why we need the ืคืกื•ืง ื‘ื• to tell us that he's ื—ื™ื™ื‘, we can't say that. Because ืœื›ืชื—ื™ืœื” we wouldn't be able to learn it out from ื”ืฉื‘ืช ืื‘ื™ื“ื”, because we have a rule that ืื™ืกื•ืจื ืžืžืžื•ื ื ืœื ื™ืœืคื™ื ืŸ. A ืื™ืกื•ืจ from ืžืžื•ืŸ we can't learn out. There, it is ืžืžื•ืŸ. The ื“ื™ืŸ of ื”ืฉื‘ืช ืื‘ื™ื“ื” is ืžืžื•ืŸ. So by ืžืžื•ืŸ we say that ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• is ืคื˜ื•ืจ. But we can't learn out ืื™ืกื•ืจ, which is the ื“ื™ืŸ of ืงื‘ื•ืจื”, which is a ืžืฆื•ื” connected to the ืขื ื™ื ื™ื of ืื™ืกื•ืจ, there we can't learn out from ื”ืฉื‘ืช ืื‘ื™ื“ื”. So since we can't learn out from ื”ืฉื‘ืช ืื‘ื™ื“ื”, we have no reason to say that a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• would be ืคื˜ื•ืจ. Now since we have no reason to say that he would be ืคื˜ื•ืจ, why does do we need a ืคืกื•ืง to tell us that he's ื—ื™ื™ื‘? And the answer that this whole ื“ื™ืŸ that we are ืžื—ื™ื™ื‘ a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื• in ืงื‘ื•ืจื” does not refer to a ืžืช ืžืฆื•ื”. Because for a ืžืช ืžืฆื•ื” we don't need a ืคืกื•ืง. The ืคืกื•ืง only goes in the case where he is not a ืžืช ืžืฆื•ื”, where there are others that are able to be ืžืชืขืกืง to involve themselves in burying him. So here we would think that since he is a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื•, so he should let others do it and he shouldn't do it himself. His doing is only the category of ื’ืžื™ืœื•ืช ื—ืกื“ื™ื, not more than that. So here we would think that since he is a ื–ืงืŸ ื•ืื™ื ื• ืœืคื™ ื›ื‘ื•ื“ื•, the ืžืฆื•ื” will be fulfilled anyway because others will do it, so here we would think that he is ืคื˜ื•ืจ. That's why we need the ืคืกื•ืง ื‘ื• to tell us that nevertheless, he should get involved in the burial of that person, and fulfill this ืžืฆื•ื” of ื’ืžื™ืœื•ืช ื—ืกื“ื™ื.
