Intro to Sota Daf 18

Jewish Audio on Chabad.org. Today's 砖讬注讜专 will be 诪住讻转 住讜讟讛 讚祝 讬状讞. We will start on the fifth line from the beginning of 注诪讜讚 讗壮. 讙诪专讗 says, 讘注讬 专讘讗, 专讘讗 asked a question: 讻转讘 砖转讬 诪讙讬诇讜转 诇砖转讬 住讜讟讜转, if he wrote two 诪讙讬诇讜转 for two 住讜讟讜转, as it should be, but 讜诪讞拽谉 诇转讜讱 讻讜住 讗讞讚, but he erased it into one cup, because the 讚讬谉 is that you have to write a 诪讙讬诇讛 with the different 驻住讜拽讬诐 of the 驻专砖讛 of 住讜讟讛 for every 住讜讟讛, and you have to erase it into a cup of water that has sand from the floor of the 讘讬转 讛诪拽讚砖. And every 住讜讟讛 must have a separate cup of water with a separate 诪讙讬诇讛 written for this 住讜讟讛, and you erase it into her cup and then she drinks it. So 专讘讗's question was: if you wrote two 诪讙讬诇讜转 for two 住讜讟讜转, but you erased them into one cup of water, 诪讛讜, what is the 讚讬谉? And the reason for his question is: 讻转讬讘讛 诇砖诪讛 讘注讬谞谉 讜讛讗讬讻讗. The

Writing and erasing 诇砖诪讛

main thing is that when we write the 诪讙讬诇讛, we have to write it 诇砖诪讛, we have to write it with the intentions for this specific woman. And as 专砖状讬 says, because the 驻住讜拽 says: 讜注砖讛 诇讛 讛讻讛谉 讗转 讻诇 讛转讜专讛 讛讝讗转, that the 讻讛谉 should do to her as this 讚讬谉 is, so since the 转讜专讛 uses the 诇砖讜谉 讜注砖讛 诇讛, should be done to her, so we 讚专砖谉, 诇讛 means 诇砖诪讛, that it has to be done to her, for her sake, intending for this specific woman, which means it has to be done 诇砖诪讛. So if the main thing that has to be written 诇砖诪讛, and that 讜讛讗讬讻讗, that was here, because since they wrote two separate 诪讙讬诇讜转 for the two separate women, so it was written 诇砖诪讛, because for every woman they wrote a separate 诪讙讬诇讛 intending for this specific woman. 讗讜 讚讬诇诪讗, maybe, 讘注讬谞谉 谞诪讬 诪讞讬拽讛 诇砖诪讛? We also have to erase it 诇砖诪讛 for this specific woman, and therefore it has to be 谞讬讻专, you have to be able to see that the erasing was done for this specific woman. And since they were both erased into one cup, so you can't tell that the erasing was done for this specific woman because they both went into the same cup. So the question is: is it okay or not? And he continues: 讜讗诐 转诪爪讬 诇讜诪专, and if you're going to want to say that 讘注讬谞谉 谞诪讬 诪讞讬拽讛 诇砖诪讛, that you do have to erase it 诇砖诪讛, and therefore the case mentioned before would not be good because it did not have the 诪讞讬拽讛 诇砖诪讛, he has another question:

Erasing into two cups then mixing

What would be the 讚讬谉 if 诪讞拽谉 讘砖转讬 讻讜住讜转, he did erase it into two separate cups, so you even have the 诪讞讬拽讛 诇砖诪讛, the erasing for the sake of this specific woman, but 讜讞讝专 讜注讬专讘谉, then he mixed the two cups together, 诪讛讜, what is the 讚讬谉 then? Do we say that 诪讞讬拽讛 诇砖诪讛 讘注讬谞谉 讜讛讗讬讻讗, you have to erase it 诇砖诪讛, and you have it because you did erase 诇砖诪讛, because when you erased it, you did it into two separate cups, so each woman was 谞讬讻专 that it was erased for her. 讗讜 讚讬诇诪讗, or maybe, 讛讗 诇讗讜 讚讬讚讛 拽讗 砖转讬讛 讜讛讗 诇讗讜 讚讬讚讛 拽讗 砖转讬讛, this one is not drinking hers, and this one is not drinking hers? Since it was mixed together, so when each of the women drink, maybe she is not drinking her own water, and therefore it should not be good. And he continues: 讜讗诐 转诪爪讬 诇讜诪专, and if you're going to want to say that we do accept this 住讘专讗 that 讛讗 诇讗讜 讚讬讚讛 拽讗 砖转讬讛 讜讛讗 诇讗讜 讚讬讚讛 拽讗 砖转讬讛, that this one is not drinking hers, and this one is not drinking hers, therefore in the case where he mixed them together and you gave it to them to drink, it would not be good, I have another question, he says:

Separating after mixing: retroactive separation

What would be the 讚讬谉 if 讞讝专 讜讞诇拽谉, 诪讛讜? If he later on separated, divided it again, he erased two 诪讙讬诇讜转 into two cups, then he mixed them together, and then he separated it again into two cups, 诪讛讜, what is the 讚讬谉? Do we say 讬砖 讘专讬专讛 讗讜 讗讬谉 讘专讬专讛? Do we accept the 住讘专讗 that 讛讜讘专专 讛讚讘专 诇诪驻专注, that retrospective there was a differentiation, or don't we accept the 住讘专讗 of 讛讜讘专专 讛讚讘专 诇诪驻专注 that retrospective there was a differentiation? Because sometimes we accept the 讻诇诇 of 讘专讬专讛, which means that when we have to have two things separated, and they are not separated, they are together, but later on we separate the two, so then there is a 住讘专讗 to say that after we separate it, looking back retroactive, it's as if the separation already took place before, but we just didn't know about it. Just to give an example, we have the case that it is brought down in 诪专讜讘讛 in 讘讘讗 拽诪讗 讚祝 住状讟 注诪讜讚 讘壮, earlier in 讙讬讟讬谉 讚祝 讻状讛 注诪讜讚 讗壮, and different places in 砖状住. And this is the case of 讛诇讜拽讞 讬讬谉 诪讘讬谉 讛讻讜转讬讬诐. If someone buys wine And he knows that there was no 转专讜诪讛 and 诪注砖专 taken off from the wine. And the 讚讬谉 is that you're not allowed to drink wine before you take off the 转专讜诪讛 and the 诪注砖专, etc., because it is 讟讘诇. So let's say instead of him first taking off 2% for 转专讜诪讛 and 10% for 诪注砖专, so what he would say is that the 2% that will be left at the end when I finish with this barrel, and the 10% that will be left at the end, that should be the 转专讜诪讛 and the 诪注砖专. So if we hold of the 住讘专讗, 讛讜讘专专 讛讚讘专 诇诪驻专注, that we look back retroactive and we say it is as if it was separated before, then this is okay to do. Because after he will leave over at the end the 转专讜诪讛 and the 诪注砖专, we will look back and say that originally these 10% and these 2% were the 转专讜诪讛 and the 诪注砖专. So therefore when he drank the wine, it was not 讟讘诇 that he drank. He drank the 讞讜诇讬谉 after the 转专讜诪讛 and the 诪注砖专 was taken off. If we do not accept this 住讘专讗 of 讛讜讘专专 讛讚讘专 诇诪驻专注, that we look back retroactive and we say that it was already divided before, then while he drank the wine, it was still 讟讘诇. Just at the end when he leaves over the 转专讜诪讛 and the 诪注砖专, that's when it becomes 转专讜诪讛 讜诪注砖专. So therefore, according to the opinion that says that we do not say 讘专讬专讛, we do not say 讛讜讘专专 讛讚讘专 诇诪驻专注, he could not do this. He couldn't drink first and then leave over the 转专讜诪讛 讜诪注砖专 at the end. He would have to first take off 转专讜诪讛 讜诪注砖专 and then he would be able to drink. And this is 专讘讗's question here too. Do we say here 讛讜讘专专 讛讚讘专 诇诪驻专注 or not? In the

Applying 讘专讬专讛 to water cups

case where he erased the two 诪讙讬诇讜转 into the two cups of water, then he mixed the two cups together, and then he separated them. If we say 讘专讬专讛, if we say 讛讜讘专专 讛讚讘专 诇诪驻专注, that retroactive we look at it as if it was separated before too, then it would be good. Because it's as if the separation that took place now really took place before, and the whole time they were two cups of water, and therefore it is 讻砖专 to be used for two 住讜讟讜转. But if we do not say 讘专讬专讛, we do not accept this 住讘专讗 here of 讛讜讘专专 讛讚讘专 诇诪驻专注, so then what we would be saying is that when he separated the two, he did it now, but before it was not separated, it was together. And therefore this would not be able to be used for two 住讜讟讜转, because at one point the two cups of water were mixed together. And even though the truth is that the case of 讘专讬专讛 here is not exactly as the case of 讘专讬专讛 that we mentioned before, because in the case of 讘专讬专讛 that we mentioned before, the case of the 转专讜诪讛 and the 诪注砖专, there it was never separated. Then, when it becomes separated, when the 转专讜诪讛 and the 诪注砖专 is left over, we're able to say that this separation really was there the whole time. In our case, even if we're going to say 讘专讬专讛, there still will be a problem. Because since before they were separated because he put them into two separate cups, then he mixed them together, and then he separated, so even if we're going to say that it was separated before, but how do we know that the separation that took place now is the exact same separation as it was originally? In other words, here it was separated before and then got mixed and then was separated again. So here if we say 讘专讬专讛, what we would have to say is that the separation that's going to take place later goes back retroactive, and it's as if this is the exact same separation as it was before. So really the case of 讘专讬专讛 here is not exactly as the case of 讘专讬专讛 in the example given before or in other cases of 讘专讬专讛. Nevertheless, 转讜住驻讜转 says that we do find in other places the case of 讘专讬专讛 even in a case where it was first separated, and then got mixed, and then got separated again, that we say 讛讜讘专专 讛讚讘专 诇诪驻专注, we look at it retroactive and we say as if the separation that's now is the exact same separation as before. So since we do say 讘专讬专讛 even in a case like that, that is 专讘讗's question here: do we say here too 讘专讬专讛, and therefore the 讚讬谉 would be that you could use this water for the two 住讜讟讜转, or we do not say 讘专讬专讛 and you cannot use these waters for the two 住讜讟讜转? And the 讙诪专讗 says, 转讬拽讜, that we stay with the question, there is no answer to this question. Then the 讙诪专讗 continues, 讘注讬 专讘讗, 专讘讗 asked a question:

Drinking through a straw: is it valid?

讛砖拽讛 讘住讬讘 诪讛讜? If he gave her to drink the water through a straw, 讘砖驻讜驻专转 诪讛讜? through a tube, 讚专讱 砖转讬讛 讘讻讱, do we say that this is a form of drinking and therefore it is okay, 讗讜 讗讬谉 讚专讱 砖转讬讛 讘讻讱, or this is not considered the normal way of drinking and therefore it should be no good? And the 讙诪专讗 says, 转讬拽讜, this remains unanswered. And 转讜住驻讜转 brings here that we do find in the 讙诪专讗 in 驻住讞讬诐 that using a straw is not considered 讚专讱 讗讻讬诇讛, the normal way of eating, and this is concerning the 讚讬谉 of 诪爪讛. The 讙诪专讗 says in 驻住讞讬诐 讚祝 拽讟状讜 注诪讜讚 讘壮, 讻专讻诐 讘住讬讘, if he took the 诪爪讛 and you surrounded it with a straw, 讗驻讬 诪爪讛 诇讗 讬爪讗, you're not 讬讜爪讗 the 诪爪讜讛 of 诪爪讛. So we see from there that to eat it through a straw is not the normal way of eating. 转讜住驻讜转 says, why can't the 讙诪专讗 prove it from there? The 讙诪专讗's question here was, is it considered 讚专讱 砖转讬讛, the normal way of drinking through a straw, why can't we answer that question through bringing in the 讙诪专讗 there, and the 讙诪专讗 says that eating with a straw is not 讚专讱 讗讻讬诇讛, is not the normal way of eating? And 转讜住驻讜转 says very simple: over there, when you covered the food, the 诪爪讛, with a straw, that is definitely not 讚专讱 讗讻讬诇讛, that is not a normal way of eating. But here, you're not covering the drink with the straw, you're using just the straw as a tool, that through the straw you are drinking the water itself. That is the 讙诪专讗's question: is that considered 讚专讱 砖转讬讛, or is it not considered 讚专讱 砖转讬讛? Is it considered the normal way of drinking or not? And the 讙诪专讗 remains with a 转讬拽讜. Then the 讙诪专讗 continues: 讘注讬 专讘 讗砖讬, 专讘 讗砖讬 asked a question in a 讘注讬讗:

Spilled water: does remaining count?

谞砖驻讻讜 诪讛谉, if some of the water spilled out, 讜谞砖转讬讬专讜 诪讛谉, but some of it was left over, 诪讛讜, what is the 讚讬谉? 诇讻转讞讬诇讛, definitely she must drink all the water, but in a case where some of it spilled out, what is the 讚讬谉? Could she just drink the rest or not? 转讬拽讜, this also remains unanswered. Why are two 砖讘讜注讜转 mentioned in the 转讜专讛 concerning 住讜讟讛? Because when we look into the 驻专砖讛 of 住讜讟讛, which is in 驻专砖转 谞砖讗, 拽驻讬讟诇 讛', we see that in 驻住讜拽 讬"讟, it starts off: 讜讛砖讘讬注 讗讜转讛 讛讻讛谉, the 讻讛谉 should make her swear, 讜讗诪专 讗诇 讛讗砖讛, he would say to the woman, 讗诐 诇讗 砖讻讘 讗讬砖 讗讜转讱 讜讗诐 诇讗 砖讟讬转 讟讜诪讗讛 转讞转 讗讬砖讱, if you didn't do the 注讘讬专讛, 讛谞拽讬 诪诪讬 讛诪专讬诐 讛诪讗专专讬诐 讛讗诇讛, you should be clean from the water. And then the 驻住讜拽 continues in 驻住讜拽 讻': 讜讗转 讻讬 砖讟讬转 转讞转 讗讬砖讱 讜讻讬 谞讟诪讗转, if you did become 讟诪讗讛, you did do the 注讘讬专讛, 讜讬转谉 讗讬砖 讘讱 讗转 砖讻讘转讜 诪讘诇注讚讬 讗讬砖讱, and another man slept with you other than your husband, so then the 驻住讜拽, 讻"讗, continues again: 讜讛砖讘讬注 讛讻讛谉 讗转 讛讗砖讛 讘砖讘讜注转 讛讗诇讛, the 讻讛谉 should make the woman swear with the 砖讘讜注讛, the oath of the curse, 讜讗诪专 讛讻讛谉 诇讗砖讛, and the 讻讛谉 should say to the woman, 讬转谉 讛' 讗讜转讱 诇讗诇讛 讜诇砖讘讜注讛 讘转讜讱 注诪讱, 讛' should give you for a curse and for a 砖讘讜注讛 in your nation, 讘转转 讛' 讗转 讬专讻讱 谞讜驻诇转 讜讗转 讘讟谞讱 爪讘讛, 讛' will make that your thigh should fall and your stomach should blow up. And then 驻住讜拽 讻"讘 continues: 讜讘讗讜 讛诪讬诐 讛诪讗专专讬诐 讛讗诇讛 讘诪注讬讱, and this water that will curse will come into your stomach, 诇爪讘讜转 讘讟谉 讜诇谞驻讬诇 讬专讱, to blow up your stomach and to have your thigh drop. But we see here that the 转讜专讛 mentions the word 砖讘讜注讛 twice: in the beginning of 驻住讜拽 讬"讟 it says, 讜讛砖讘讬注 讗讜转讛 讛讻讛谉 讜讗诪专 讗诇 讛讗砖讛, the 讻讛谉 should make the woman swear and speak to the woman, then in 驻住讜拽 讻"讗 it says again, 讜讛砖讘讬注 讛讻讛谉 讗转 讛讗砖讛 讘砖讘讜注转 讛讗诇讛, that the 讻讛谉 should make the woman swear with the 砖讘讜注讛 of the curse, 讜讗诪专 讛讻讛谉 诇讗砖讛, and he should say to the woman. So 专讘 讝讬专讗 in the name of 专讘's 拽砖讬讗 was, why does the 转讜专讛 mention twice a 砖讘讜注讛 concerning 住讜讟讛? And he answers:

Understanding the two types of 砖讘讜注讜转

讗讞转 拽讜讚诐 砖谞诪讞拽讛 诪讙讬诇讛, one is before the 诪讙讬诇讛 was erased, 讜讗讞转 诇讗讞专 砖谞诪讞拽讛, one is after the 诪讙讬诇讛 was erased. In other words, one 砖讘讜注讛 you make her swear before you erase the 诪讙讬诇讛, and there's a second 砖讘讜注讛 that you make her swear after you erase the 诪讙讬诇讛. 诪转拽讬祝 诇讛 专讘讗, but 专讘讗 asked a 拽砖讬讗: how could you say that? 转专讜讜讬讬讛讜 拽讜讚诐 砖谞诪讞拽讛 诪讙讬诇讛 讻转讬讘谉! Both are mentioned in the 转讜专讛 before the 诪讙讬诇讛 was erased! Because after both 砖讘讜注讜转, the 转讜专讛 says in 驻住讜拽 讻"讙, 讜讻转讘 讗转 讛讗诇转 讛讗诇讛 讛讻讛谉 讘住驻专, that the 讻讛谉 should write these words, these curses on a 住驻专, on a 诪讙讬诇讛, 讜诪讞讛 讗诇 诪讬 讛诪专讬诐, and he should erase it into the water that cursed! So we see that the both 砖讘讜注讜转 come before the 诪讙讬诇讛 is erased, so how could he say that one 砖讘讜注讛 is before the 诪讙讬诇讛 is erased and one is after the 诪讙讬诇讛 is erased? 讗诇讗 讗诪专 专讘讗, so therefore 专讘讗 said: 讗讞转 砖讘讜注讛 砖讬砖 注诪讛 讗诇讛, one 砖讘讜注讛 is a 砖讘讜注讛 that goes along with a curse, 讜讗讞转 砖讘讜注讛 砖讗讬谉 注诪讛 讗诇讛, and one is a 砖讘讜注讛 that doesn't have a curse with it. And he explains: 讛讬讻讬 讚诪讬 砖讘讜注讛 砖讬砖 注诪讛 讗诇讛? What do we mean a 砖讘讜注讛 that has a curse with it? What would he say? Which kind of 砖讘讜注讛 would he make her swear that has a curse along with it? 讗诪专 专讘 注诪专诐 讗诪专 专讘, so 专讘 注诪专诐 in the name of 专讘 said, it would mean: 诪砖讘讬注 讗谞讬 注诇讬讱, I make you swear, 砖诇讗 谞讟诪讗转, that you didn't become 讟诪讗讛, 砖讗诐 谞讟诪讗转, because if you did become 讟诪讗讛, 讬讘讜讗讜 讘讱, these 拽诇诇讜转 should come unto you. So we see here a 砖讘讜注讛 that has a 拽诇诇讛 with it, because he starts off by saying: I make you swear that you didn't become 讟诪讗讛, that if you did become 讟诪讗讛, all these 拽诇诇讜转, all these curses should come upon you. Well, that's a 砖讘讜注讛 with a 拽诇诇讛 together. 讗诪专 专讘讗, but 专讘讗 said: 讗诇讛 诇讞讜讚 诇讞讜讚讛 拽讬讬诪讗 讜砖讘讜注讛 诇讞讜讚讛 拽讬讬诪讗. This is not a 砖讘讜注讛 that has a curse in the 砖讘讜注讛, but this curse is a separate thing here, and the 砖讘讜注讛 is a separate thing here. First you start off by saying, "I make you swear that you didn't become 讟诪讗讛," that's the 砖讘讜注讛. Then he adds, "if you did become 讟诪讗讛, then the 拽诇诇讜转 should come upon you." So that's a separate 拽诇诇讛. This is not what we said before, a 砖讘讜注讛 砖讬砖 注诪讛 讗诇讛, a 砖讘讜注讛 that has a 拽诇诇讛 in it, but this is a 砖讘讜注讛 and a 拽诇诇讛 as two separate things. 讗诇讗 讗诪专 专讘讗, so therefore 专讘讗 said, what is a 砖讘讜注讛 that has a 拽诇诇讛 in it? 诪砖讘讬注 讗谞讬 注诇讬讱, "I make you swear 砖讗诐 谞讟诪讗转 讬讘讜讗讜 讘讱," that if you became 讟诪讗讛, these 拽诇诇讜转 should come upon you. So here you don't have two things here. First you make her swear that she didn't become 讟诪讗讛, and then you say, "if you did become 讟诪讗讛, the 拽诇诇讜转 should come upon you," but the 砖讘讜注讛 诇讻转讞讬诇讛 is, "I make you swear that if you became 讟诪讗讛, the 拽诇诇讜转 should come upon you." 讗诪专 专讘 讗砖讬, 专讘 讗砖讬 said, 讗诇讛 讗讬讻讗, 砖讘讜注讛 诇讬讻讗. In this case, all you have is a 拽诇诇讛, but you don't have a 砖讘讜注讛. He didn't make her swear concerning anything that she did, he just made her swear that if she became 讟诪讗讛, she would get the 拽诇诇讜转. So all it is is a 拽诇诇讛. The whole 砖讘讜注讛 is only a 拽诇诇讛, but there is no 砖讘讜注讛 here saying he's making her swear that she didn't become 讟诪讗讛. 讗诇讗 讗诪专 专讘 讗砖讬, so therefore 专讘 讗砖讬 said, what is a 砖讘讜注讛 砖讬砖 注诪讛 讗诇讛, what is a 砖讘讜注讛 that has a 拽诇诇讛 in it? He says to her, 诪砖讘讬注 讗谞讬 注诇讬讱 砖诇讗 谞讟诪讗转, "I make you swear that you didn't become 讟诪讗讛, 讜讗诐 谞讟诪讗转 讬讘讜讗讜 讘讱, and if you did become 讟诪讗讛, the 拽诇诇讜转 should come upon you." So here you have two things, but they're really together. You have the 砖讘讜注讛 that she didn't become 讟诪讗讛, then you say, "if you did become 讟诪讗讛, they should come upon you," but this is part of the 砖讘讜注讛. He makes her swear that if she did become 讟诪讗讛, the 拽诇诇讜转 come upon her. This is not like the case that 专讘 注诪专诐 said in the name of 专讘, that he says to her, "I make you swear that you didn't become 讟诪讗讛, because if you did become 讟诪讗讛, the 拽诇诇讜转 should come upon you," because in that case, the second half, where he says, "if you became 讟诪讗讛, the 拽诇诇讜转 should come upon you," is not part of the 砖讘讜注讛. This is a side statement. It says, "I make you swear that you didn't become 讟诪讗讛," and he's adding, "because if you did, the 拽诇诇讜转 will come upon you." So there, the 讙诪专讗 asks the 拽砖讬讗, the 砖讘讜注讛 is separate and the 拽诇诇讛 is separate. The way 专讘 讗砖讬 says it is different. He says that both of the things are included in the 砖讘讜注讛. He says to her, "I make you swear that you didn't become 讟诪讗讛, and if you did become 讟诪讗讛, the 拽诇诇讜转 should come upon you." So this is part of the 砖讘讜注讛. The 砖讘讜注讛 says two things. He makes her swear two things: that you didn't become 讟诪讗讛, and this is included in the 砖讘讜注讛, if you did become 讟诪讗讛, then the 拽诇诇讜转 should come upon you. So this is the case of a 砖讘讜注讛 砖讬砖 讘讛 讗诇讛, a 砖讘讜注讛, but in the 砖讘讜注讛, you also have a curse. And this is the 转讬专抓 on the 砖讗诇讛, why the 驻住讜拽 has two 砖讘讜注讜转, because one 砖讘讜注讛 is without an 讗诇讛, without a curse, because in the first 驻住讜拽, 驻住讜拽 讬状讟, it just says 讜讛砖讘讬注 讗讜转讛 讛讻讛谉, that the 讻讛谉 should make her swear, but there is no curse there. In 驻住讜拽 讻状讗, when the 转讜专讛 says 讜讛砖讘讬注 讛讻讛谉 讗转 讛讗砖讛 讘砖讘讜注转 讛讗诇讛, there we have a 砖讘讜注讛 with a curse together, and that is the expression as 专讘 讗砖讬 said, that he tells, says to her, "I make you swear that you didn't become 讟诪讗讛, and if you did, the curse should come upon you." Now we will continue with the 诪砖谞讛. The 诪砖谞讛 says, 注诇 诪讛 讛讬讗 讗讜诪专转 讗诪谉 讗诪谉, and on what does she say 讗诪谉 讗诪谉? Because if you look in the 驻专砖讛 of 住讜讟讛, at the end of the different things the 讻讛谉 is supposed to say to her, so at the end of 驻住讜拽 讻状讘, the 驻住讜拽 says, 讜讗诪专讛 讛讗砖讛 讗诪谉 讗诪谉, the woman should say 讗诪谉 讗诪谉. The reason she says 讗诪谉 is, as we know, that 讗诪谉 is an acceptance of a 砖讘讜注讛. If someone says to somebody else, "I make you swear this and that," and the other person answers 讗诪谉, that is as if the other person himself made the 砖讘讜注讛, swore. So therefore, we understand why the woman has to answer 讗诪谉. The question is, why does she answer 讗诪谉 twice? Why does she say 讗诪谉 讗诪谉? So the 驻砖讟 is, the 诪砖谞讛 says, 讗诪谉 注诇 讛讗诇讛, 讗诪谉 注诇 讛砖讘讜注讛, 讗诪谉 on the curse, and 讗诪谉 on the 砖讘讜注讛, on the oath. Another reason is 讗诪谉 诪讗讬砖 讝讛, 讗诪谉 诪讗讬砖 讗讞专, 讗诪谉 that I did not do the 注讘讬专讛 with this man that you're suspecting me with, but also she says 讗诪谉 that I didn't do the 注讘讬专讛 with any other man. In other words, even though he only suspected her with one man, and the reason she drinks this water and she becomes a 住讜讟讛 is because of that man that her husband suspected her and warned her not to hide with, but at the same time, while he already makes her swear on this man, he is 诪讙诇讙诇 on her, he brings upon her the 砖讘讜注讛 for any other man. Even though normally he has no right to come to her and say, "swear to me that you didn't go with any other man," but while he's already making her swear on this man, where the 讛诇讻讛 is that he is allowed to make make her swear, he should make her swear, so already we are 诪讙诇讙诇, and we make her swear that you didn't do the 注讘讬专讛 with any other man. Also, the 讗诪谉 讗诪谉 means, 讗诪谉 砖诇讗 砖讟讬转讬 讗专讜住讛 讜谞砖讜讗讛, 讗诪谉 that I didn't become a 住讜讟讛, I didn't do an 注讘讬专讛 while I was an 讗专讜住讛, and also while I was a 谞砖讜讗讛. Because there are two stages to the process of marriage. First there is 讗讬专讜住讬谉, then there is 谞讬砖讜讗讬谉. 讗讬专讜住讬谉 means engagement, and 谞讬砖讜讗讬谉 means the marriage. And when we say here engagement, we don't mean engagement as we call nowadays, because nowadays engagement is only a promise that he is going to marry her, but it doesn't mean that she becomes an 讗砖转 讗讬砖, a married woman. But the way it used to be is that when they were engaged, he would give her the 拽讬讚讜砖讬谉, that was called 讗讬专讜住讬谉 or 拽讬讚讜砖讬谉, and from that moment on, she becomes an 讗砖转 讗讬砖, a married woman. A year later, he would marry her, that

Historical Combination of 拽讬讚讜砖讬谉 and 谞讬砖讜讗讬谉

would be called 谞讬砖讜讗讬谉, through the 讞讜驻讛, and then she would be able to go home, and she was 100% his wife. Nowadays, we do both of these things together under the 讞讜驻讛. We have the 拽讬讚讜砖讬谉, and then right away we have the 谞讬砖讜讗讬谉. But the way it used to be was that first you had the 拽讬讚讜砖讬谉, and a year later there would be the 谞讬砖讜讗讬谉. So, it comes out that there was a year when she was an 讗专讜住讛, she was engaged, but she was an 讗砖转 讗讬砖 already, and she wasn't with her husband at home. And if during that time she would have relations with another man, the penalty would be death, like a regular 讗砖转 讗讬砖. The only difference is it would be a different type of death penalty than after the 谞讬砖讜讗讬谉, but nevertheless she was considered an 讗砖转 讗讬砖, and it would be a 讞讬讜讘 of 诪讬转讛. So, when he brings her to the 讘讬转 讛诪拽讚砖, and he gives her to drink because of that man that she suspected him of, he tells her, "Say 讗诪谉 that you didn't do anything wrong while you were an 讗专讜住讛, while you were engaged to me before the 谞讬砖讜讗讬谉, and also after the 谞讬砖讜讗讬谉." If the case is that she was a 讬讘诪讛, if the case of this 住讜讟讛 was that he didn't marry her regularly, but she was first married to his brother, and his brother died without children, the 讚讬谉 is that the brother has to be 诪讬讬讘诐 her or give her 讞诇讬爪讛. So, let's say this 住讜讟讛 was a 讬讘诪讛. He married her because his brother died, and he was 诪讬讬讘诐 her. So, when she says 讗诪谉 讗诪谉 to him, so what he means to say is, and he tells her, "Say 讗诪谉 that when you were a 砖讜诪专转 讬讘诐, that you didn't do the 注讘讬专讛 while you were awaiting 讬讬讘讜诐." After her husband died, before she gets married to his brother, she is considered a 砖讜诪专转 讬讘诐, she's awaiting 讬讬讘讜诐. At that time, she's not allowed to have relations with any other man, because there is a 诇讗讜. The 转讜专讛 says, "诇讗 转讛讬讛 讗砖转 讛诪转 讛讞讜爪讛 诇讗讬砖 讝专", that the wife of the one that died is not allowed to be with any other stranger except her 讬讘诐, which is her brother-in-law, her husband's brother. So,

Swearing Requirements for 砖讜诪专转 讬讘诐

when he takes this 住讜讟讛 to the 讘讬转 讛诪拽讚砖, and makes her swear that she didn't do the 注讘讬专讛 with the one that he suspects her of, he tells her, "Say 讗诪谉 that while you were a 砖讜诪专转 讬讘诐, while you were awaiting me to be 诪讬讬讘诐 you, you also didn't sin, and 讜讻谞讜住讛, and you didn't sin after I married you, after I took you into my house and you became my wife." Also, the two 讗诪谉's mean: 讗诪谉 砖诇讗 谞讟诪讗转讬, 讜讗诐 谞讟诪讗转讬 讬讘讜讗讜 讘讬. 讗诪谉 that I didn't become 讟诪讗讛, I didn't do the 注讘讬专讛, and if I did become 讟诪讗讛, I did do the 注讘讬专讛, those curses should come upon me. 专' 诪讗讬专 讗讜诪专, 专' 诪讗讬专 says: 讗诪谉 砖诇讗 谞讟诪讗转讬, 讗诪谉 that I didn't become 讟诪讗讛 before. 讗诪谉 砖诇讗 讗讬讟诪讗, 讗诪谉 that I will never become 讟诪讗讛. Never meaning in a case that if she would become 讟诪讗讛, she would become 讗住讜专讛 to her husband. And as 专砖"讬 brings here from the 讙诪专讗 later on, it doesn't mean that if she will ever become 讟诪讗讛 later, now the 诪讬诐 讛诪讗专专讬诐 will have effect on her, but what it means is, she drinks the water now, if she will ever become 讟诪讗讛 later, so then the water will start taking effect then. Then the 诪砖谞讛 continues: 讛讻诇 砖讜讬谉, everyone agrees, 砖讗讬谉 诪转谞讛 注诪讛, that he cannot make a condition with her. In

Limits on Conditions (诪转谞讛) Before Engagement

other words, he cannot be 诪讙诇讙诇 on her to swear, 诇讗 注诇 拽讜讚诐 砖转转讗专住, not on the 注讘讬专讜转 that she did before she became engaged to him. In other words, he cannot say to her, "Say 讗诪谉 that you weren't 诪讝谞讛, you didn't commit adultery before you were engaged to me." And also, we will learn now the 讙讬专住讗 in the 诪砖谞讛 as the 讘"讞 brings it down according to 专砖"讬, that also not 诇讗 注诇 讗讞专 砖转转讙专砖 讜转住转专 诇讗讞讚, not after if I will ever divorce you, and then you will hide with somebody, 讜转讟诪讗, and you will become 讟诪讗讛, 讜讗讞专 讻讱 讬讞讝讬专谞讛, and I will take you back, 诇讗 讛讬讛 诪转谞讛 注诪讛, for that he didn't make a condition. In other words, there is a possibility that he would divorce his wife, and then later on he will take her back, because the 讚讬谉 is that if you divorce your wife and she does not marry somebody else, then you are allowed to take her back. The 讚讬谉 of 诪讞讝讬专 讙专讜砖转讜, that you're not allowed to take back your divorcee, that is only if after you divorced her, she married somebody else. But if she didn't marry somebody else, then the first husband is allowed to take her back. So we might think that he could make her swear that if he divorces her and then takes her back, he wants her to swear that she will not be 诪讝谞讛 in the time between the first marriage and the second marriage while she was not married to him. So the 诪砖谞讛 said that for that he cannot make this condition. And the reason is, because the conditions that he could make, which means the 讙诇讙讜诇 砖讘讜注讛 that he could have her swear, is only concerning those things that if she would become 讟诪讗讛 in that case, she would be 讗住讜专讛 to live with her husband. But in a case where even if she did do the 注讘讬专讛, she still is not 讗住讜专讛 to him, he cannot make her swear for that. And therefore, he cannot make her swear that before she became an 讗专讜住讛, before she was engaged to him, she wasn't 诪讝谞讛, because even if she was 诪讝谞讛 then, she's still allowed to go to her husband because she was not an 讗砖转 讗讬砖, she was not a married woman then.

Conditions Regarding 诪讝谞讛 Between Two Marriages

Also the case of her being 诪讝谞讛 in between the two marriages, he can't have her swear that, because even if she would be 诪讝谞讛 between the two marriages, her husband could marry her. In other words, the 讚讬谉 that you're not allowed to marry your wife after she married somebody else is only if she married somebody else after you divorced her, but if she was 诪讝谞讛 with somebody else after the divorce, her first husband is allowed to take her back. So therefore he cannot make her swear that, "After I will divorce you, you will be 诪讝谞讛 before I remarry you," because even if she did that, she is not 讗住讜专讛 to her husband. And that is what the 诪砖谞讛 continues: 讝讛 讛讻诇诇, this is the rule, 讻诇 砖转讬讘注诇 讜诇讗 讛讬转讛 讗住讜专讛 诇讜, if any case that she will have relations with somebody and she still will not become 讗住讜专讛 to him, 诇讗 讛讬讛 诪转谞讛 注诪讛, for something like that, he couldn't be 诪转谞讛 with her, he couldn't make the condition with her, he couldn't make her swear for that. Then there is another 讙讬专住讗 that the 讘状讞 brings down in the 诪砖谞讛. And the 驻砖讟 in that 讙讬专住讗 is that if he divorced her and then he remarried her, so by the second marriage, if she is a 住讜讟讛 during the second marriage, he cannot make her swear then that she was not 诪讝谞讛 in the time between the first marriage and the second. Because as the 诪砖谞讛 says, since even if she was 诪讝谞讛, she was not 讗住讜专讛 to him, he could remarry her, so therefore he cannot make her swear for that. And now we will continue with the 讙诪专讗.

砖讜诪专转 讬讘诐 Who Committed Adultery

讗诪专 专讘 讛讜谞讗, 专讘 讛讜谞讗 said, 砖讜诪专转 讬讘诐 砖讝讬谞转讛, a woman who's awaiting 讬讘讜诐, her husband died without children, and now she is awaiting her husband's brother to be 诪讬讬讘诐 her, 砖讝讬谞转讛, if she was 诪讝谞讛, 讗住讜专讛 诇讬讘诪讛, she is 讗住讜专讛 to marry her 讬讘诐. Just like an 讗砖转 讗讬砖, a married woman who is 诪讝谞讛, she is not allowed to go back to her husband, so too a 砖讜诪专转 讬讘诐 who is 诪讝谞讛 is not allowed to marry her 讬讘诐. Even though she wasn't married to him at that time yet, she was not his wife, but since she was his 砖讜诪专转 讬讘诐, she was awaiting his 讬讘讜诐, if she was 诪讝谞讛, she is not allowed to marry him. And the 讙诪专讗 asks: 诪谞讗 诇讬讛? How do we know that? How do we know that even though she wasn't his wife, but since she was his 砖讜诪专转 讬讘诐, if she was 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐, he is not allowed to marry her? And the 讙诪专讗 answers: 诪讚拽转谞讬 砖讜诪专转 讬讘诐 讜讻谞讜住讛, since it says in the 诪砖谞讛 that one of the things that are meant with the 讗诪谉 讗诪谉 is that he tells her that she should say 讗诪谉 that she wasn't 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐 and while she was married to him. So 讗讬 讗诪专转 讘砖诇诪讗 讗住讜专讛, if you're going to say that a 砖讜诪专转 讬讘诐 that is 诪讝谞讛 is 讗住讜专讛 to marry her 讬讘诐, 诪砖讜诐 讛讻讬 诪转谞讛 讘讛讚讛, therefore he makes this condition too. He tells her that she should swear that she wasn't 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐, because if she would have been 诪讝谞讛, then she would be 讗住讜专讛 to him. 讗诇讗 讗讬 讗诪专转, but if you're going to say that 诇讗 讗住讜专讛, that even if she was 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐, she doesn't become 讗住讜专讛 to him, 讛讬讻讬 诪转谞讛 讘讛讚讛? How could he make her swear on this 注谞讬谉, how could he make this condition? 讜讛转谞谉, didn't we learn in the 诪砖谞讛: 讝讛 讛讻诇诇, this is the rule, 讻诇 砖讗讬诇讜 转讬讘注诇 讜诇讗 转讛讗 讗住讜专讛 诇讜, any case that if she would have relations with somebody, she still would not be 讗住讜专讛 to him, 诇讗 讛讬讛 诪转谞讛 注诪讛, for something like that, he couldn't make the condition with her, he couldn't make her swear for that. So how could he could he make her swear that she wasn't 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐? So that proves that a woman who is a 砖讜诪专转 讬讘诐 who is 诪讝谞讛 is 讗住讜专 to her 讬讘诐. 讗讬 专讘 讛诪谞讜谞讗 had a good 专讗讬讛 from our 诪砖谞讛, that a 砖讜诪专转 讬讘诐 that's 诪讝谞讛 is 讗住讜专 to her 讬讘诐, because otherwise, how could he make her swear that she wasn't 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐? 讗诇讗 讛讗 讚拽转谞讬 砖讜诪专转 讬讘诐 讜讻谞讜住讛, when it says in the 诪砖谞讛 he makes her swear that she wasn't 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐, 讻诪讗谉? 讻专讘讬 注拽讬讘讗! That goes according to 专讘讬 注拽讬讘讗, 讚讗诪专 专讘讬 注拽讬讘讗 says, 讗讬谉 拽讬讚讜砖讬谉 转讜驻住讬谉 讘讞讬讬讘讬 诇讗讜讬谉, that the 拽讬讚讜砖讬谉 are not valid if the marriage is prohibited by a 诇讗讜. It's a 诪讞诇讜拽转 between 专讘讬 注拽讬讘讗 and the 专讘谞谉. 专讘谞谉 hold that 拽讬讚讜砖讬谉 转讜驻住讬谉 讘讞讬讬讘讬 诇讗讜讬谉, that a woman who is prohibited to somebody only through a 诇讗讜, through a negative prohibition of the 转讜专讛, so then the 拽讬讚讜砖讬谉 is 转讜驻住. If the man gives her 拽讬讚讜砖讬谉, she becomes his wife. He is not allowed to live with her. He must divorce her, but nevertheless, if he was 诪拽讚砖 her, the 拽讬讚讜砖讬谉 is 转讜驻住. The only case the 拽讬讚讜砖讬谉 are not 转讜驻住讬谉, that the marriage is not valid at all, is if it is 讞讬讬讘讬 讻专讬转讜转. If it is not only prohibited through a 诇讗讜, but the 转讜专讛 says that such a relation would be 讞讬讬讘 讻专转, the punishment would be 讻专转, in such a case, if he gives her 拽讬讚讜砖讬谉, the 拽讬讚讜砖讬谉 are not 转讜驻住讬谉. But according to 专讘讬 注拽讬讘讗, the 拽讬讚讜砖讬谉 are not 转讜驻住讬谉 also by 讞讬讬讘讬 诇讗讜讬谉. And this

Rabbi Akiva vs Rabbanim on 拽讬讚讜砖讬谉 Validity

leads us to another difference: that according to the 专讘谞谉, the child is a 诪诪讝专 only from a marriage that was 讞讬讬讘讬 讻专讬转讜转, that the 注讘讬专讛 is 讻专转. According to 专讘讬 注拽讬讘讗, even from a 讞讬讬讘讬 诇讗讜讬谉, even if the prohibition is only a 诇讗讜, the child that is born from that relation is also a 诪诪讝专. Since 专讘讬 注拽讬讘讗 holds that also by 讞讬讬讘讬 诇讗讜讬谉 the 拽讬讚讜砖讬谉 is not 转讜驻住, it is not valid, so the child is a 诪诪讝专. But according to the 专讘谞谉, the child is a 诪诪讝专 only from 讞讬讬讘讬 讻专讬转讜转. And this is what the 讙诪专讗 says here: that the 诪砖谞讛 goes according to 专讘讬 注拽讬讘讗, who holds that the 拽讬讚讜砖讬谉 is not 转讜驻住 讘讞讬讬讘讬 诇讗讜讬谉, 讜诪砖讜讬 诇讛 讻讬 注专讜讛. And according to 专讘讬 注拽讬讘讗, he makes her like an 注专讜讛, that 讞讬讬讘讬 诇讗讜讬谉 has the same 讚讬谉 like an 注专讜讛, which is 讞讬讬讘讬 讻专讬转讜转. So according to 专讘讬 注拽讬讘讗, all the 讚讬谞讬诐 that we know apply to 讞讬讬讘讬 讻专讬转讜转 also apply to 讞讬讬讘讬 诇讗讜讬谉. And therefore, according to 专讘讬 注拽讬讘讗, just like when a woman is 诪讝谞讛 while she's married to somebody, which is 讻专转 and also 诪讬转转 讘讬转 讚讬谉, the 讚讬谉 is that she cannot remain married to her husband, the same would be with a 砖讜诪专转 讬讘诐, that if someone was 诪讝谞讛 with a 砖讜诪专转 讬讘诐, which is only a 诇讗讜, she cannot go to her 讬讘诐. So therefore, we have no 专讗讬讛 from our 诪砖谞讛 that we hold that a 砖讜诪专转 讬讘诐 which is 诪讝谞讛 is 讗住讜专 to her 讬讘诐 from the fact that the 诪砖谞讛 says that he makes her swear that she wasn't 诪讝谞讛 while she was a 砖讜诪专转 讬讘诐, because the 诪砖谞讛 goes according to 专讘讬 注拽讬讘讗, and according to 专讘讬 注拽讬讘讗, it is true that a 砖讜诪专转 讬讘诐 that's 诪讝谞讛 is 讗住讜专 to her 讬讘诐. But according to the 专讘谞谉 that hold that only by 讞讬讬讘讬 讻专讬转讜转 the 拽讬讚讜砖讬谉 are not 转讜驻住, but 讞讬讬讘讬 诇讗讜讬谉 the 拽讬讚讜砖讬谉 are 转讜驻住, they would hold that a 砖讜诪专转 讬讘诐 that's 诪讝谞讛 is 诪讜转专 to her 讬讘诐. This is the opinion of 诪注专讘讗. But obviously 专讘 讛诪谞讜谞讗 did not hold that way. 专讘 讛诪谞讜谞讗 held that even according to the 专讘谞谉 that hold that 拽讬讚讜砖讬谉 are 转讜驻住 讘讞讬讬讘讬 诇讗讜讬谉, nevertheless, a 砖讜诪专转 讬讘诐 that's 诪讝谞讛 is 讗住讜专 to her 讬讘诐. And 转讜住驻讜转 explains that what should be the reason for that? If the 拽讬讚讜砖讬谉 are 转讜驻住 讘讞讬讬讘讬 诇讗讜讬谉, why should the 砖讜诪专转 讬讘诐 that's 诪讝谞讛, which is only a 诇讗讜, why should she be 讗住讜专 to her 讬讘诐? So according to 专讘 讛诪谞讜谞讗, 转讜住驻讜转 explains because the 驻住讜拽 says, 诇讗 转讛讬讛 讗砖转 讛诪转 讛讞讜爪讛 诇讗讬砖 讝专, which means that the wife of the deceased should not be outside to a strange person, so we 讚专砖'谉 when the 转讜专讛 says she should not be, that it means to say that if she will marry somebody else, it will not be, which means the 拽讬讚讜砖讬谉 will not be 转讜驻住. So therefore, even though 拽讬讚讜砖讬谉 are 转讜驻住 讘讞讬讬讘讬 诇讗讜讬谉 according to the 专讘谞谉, 砖讜诪专转 讬讘诐 is an exception. It's as if the 转讜专讛 says clearly that this case the 拽讬讚讜砖讬谉 are not 转讜驻住. And therefore, even according to the 专讘谞谉, 专讘 讛诪谞讜谞讗 holds that if a 砖讜诪专转 讬讘诐 is 诪讝谞讛, then the 讚讬谉 is that she is not allowed to go to her 讬讘诐. Then the 讙诪专讗 continues,

Can One Condition on Prior Marriages?

讘注讬 专讘 讬专诪讬讛, 专讘 讬专诪讬讛 asked the question, 诪讛讜, what is the 讚讬谉, 砖讬转谞讛 讗讚诐 注诇 谞砖讜讗讬谉 讛专讗砖讜谞讬诐, can he make a condition on the previous marriage? In other words, if he married her first and then divorced her, and then married again, and then he suspected her of a man, and he made her drink the water, can he make her swear that she wasn't 诪讝谞讛 while she was married to him in the first marriage? 讗讜 注诇 谞砖讜讗讬 讗讞讬讜, on the marriage of his brother, if he was 诪讬讘诐 her and then he made her into a 住讜讟讛, can he make her swear that while she was married to his brother, she was not 诪讝谞讛? And the 讙诪专讗 answers 转讗 砖诪注, come here, I will answer your question. We learn in the 诪砖谞讛, 讝讛 讛讻诇诇, this is the rule: 讻诇 砖转讬讘注诇, in any case that if she would have relations with somebody 讜诇讗 转讛讗 讗住讜专讛 诇讜, and she wouldn't become 讗住讜专讛 to him, 诇讗 讛讬讛 诪转谞讛 注诪讛, for that he couldn't make the condition, he couldn't make her swear for that. So we see from there 讛讗 讗住讬专讛 讛讻讗 谞诪讬 讚诪转谞讛, but in a case where if she would have relations with somebody, this would make her 讗住讜专讛 to her husband, he could make her swear from that. 砖诪注 诪讬谞讛, from here we see that in the two cases we mentioned, he could make her swear. Because if she was 诪讝谞讛 during the first marriage, she is not allowed to live with him now either, because the 讚讬谉 is that an 讗砖转 讗讬砖 that's 诪讝谞讛 cannot go to her husband even if her husband divorces her, he cannot take her back. So therefore, if she was 诪讝谞讛 in the first marriage, she would become 讗住讜专讛 to him, so now, even though it's the second marriage, he's allowed to make her swear that she wasn't 诪讝谞讛 in the first marriage. And the same is with the brother, because the 讚讬谉 is that if she was 诪讝谞讛 while she was married to the brother, she is not allowed to become a 讬讘讜诐 to his brother after he dies. So therefore, if she is a 住讜讟讛 during the marriage of the brother, he is allowed to make her swear that she was not 诪讝谞讛 while she was married before to his brother, because if she would have been 诪讝谞讛, she would have become 讗住讜专讛 to him. There's one thing important to make clear here, because one might ask: what is the 讙诪专讗's 砖讗诇讛? Whether he is allowed to make her swear concerning the marriage of his brother, it seems like this is exactly what the 诪砖谞讛 was talking about! Because in the 诪砖谞讛 it said that she says 讗诪谉 砖诇讗 住讟讬转讬 讗专讜住讛 讜谞砖讜讗讛 讜砖讜诪专转 讬讘诐 讜讻谞讜住讛. She says 讗诪谉 that I didn't become a 住讜讟讛, I didn't do the 注讘讬专讛 while I was engaged, while I was married, while I was a 砖讜诪专转 讬讘诐, and while I was married to you. So it seems as if he is making her swear for the marriage of his brother. Because this is the order of things: before she was a 砖讜诪专转 讬讘诐, we see here, she was a 谞砖讜讗讛, and before that she was an 讗专讜住讛. Now, to whom was she the 讗专讜住讛 and to whom was she the 谞砖讜讗讛, to whom was she engaged and to whom was she married before she was a 砖讜诪专转 讬讘诐, before she became his 讬讘诪讛? So obviously it must be that she was married to his brother. So we see from the 诪砖谞讛 that what he says is, he makes her swear that she didn't do the 注讘讬专讛 while she was engaged or married to his brother, and then she says while she was a 砖讜诪专转 讬讘诐 and married to him. So we see clearly from the 诪砖谞讛 that you could make her swear for the marriage of the brother. So what is the 讙诪专讗's 砖讗诇讛? So 专砖状讬 says that this is not the 驻砖讟 in the 诪砖谞讛. The 驻砖讟 in the 诪砖谞讛, as we had learned it when we learned the 诪砖谞讛, is that the 诪砖谞讛 is divided into two cases. One case is she says that she swears she didn't become a 住讜讟讛 while she was an 讗专讜住讛 讜谞砖讜讗讛, while she was engaged or married to him. This is a case where he married her not as a 讬讘诪讛. Then when it says in the 诪砖谞讛 讜砖讜诪专转 讬讘诐 讜讻谞讜住讛, that's a separate case, another woman. If the case happened to be that she was married to him through 讬讘讜诐, so then he makes her swear that she wasn't 诪讝谞讛 while she was awaiting 讬讘讜诐 and while she was married to him after he was 诪讬讘诐 her. But this is not talking about the same woman that we would say that the 讗专讜住讛 讜谞砖讜讗讛 that the 诪砖谞讛 mentions means when she was engaged and married to his brother. This means engaged and married to him, if he married her not through 讬讘讜诐. On the other hand, if he married her through 讬讘讜诐, he says the other expression, 砖讜诪专转 讬讘诐 讜讻谞讜住讛. But we don't see from the 诪砖谞讛 what would be the 讚讬谉 concerning the marriage of his brother. And therefore, the 讙诪专讗 asks: can he make her swear that she wasn't 诪讝谞讛 while she was married to his brother? And the 讙诪专讗's answer is: yes, that he could make her swear that, too. Now we continue with the 讙诪专讗. The 讙诪专讗 explains the 诪砖谞讛. It says, 专讘讬 诪讗讬专 讗讜诪专, 专讘讬 诪讗讬专 said, 讗诪谉 砖诇讗 谞讟诪讗转讬 讜讻讜壮. The 诪砖谞讛 said that 专讘讬 诪讗讬专 says the two 讗诪谉's mean: 讗诪谉 that I didn't become 讟诪讗讛 in the past, and 讗诪谉 that I will not become 讟诪讗讛 in the future. 转谞讬讗, we learned in a 讘专讬讬转讗, 诇讗 讻砖讗诪专 专讘讬 诪讗讬专 讗诪谉 砖诇讗 讗讟诪讗, it doesn't mean what 专讘讬 诪讗讬专 says, that she says 讗诪谉 that she will not become 讟诪讗讛 in the future, it doesn't mean that she, 讗诐 转讬讟诪讗, if she will become 讟诪讗讛 in the future, 诪讬诐 讘讜讚拽讬谉 讗讜转讛 诪注讻砖讬讜, the water starts taking effect now already. 讗诇讗, but the 驻砖讟 is, 诇讻砖转讟诪讗, when she will become 讟诪讗讛, 诪讬诐 诪注专注专讬谉 讗讜转讛, the water will start awakening and it starts stirring again in her, 讜讘讜讚拽讬谉 讗讜转讛, and then it will take effect. And 专砖状讬 says it's similar to a person who has liquid in himself, and then if the liquid goes up to the throat, he starts choking on it. And that's what would happen: she drinks the water now and it stays in her, if she ever becomes 讟诪讗讛, then the water is reawakened again and goes up to her throat, and she starts choking, and the water takes effect then. According to 专讘讬 诪讗讬专 who says that you could make her swear for the future, can you make her swear for a second marriage? In other words, if he will ever divorce her and then remarry her, so he wants to make her swear now that if this will ever happen, she will not become 讟诪讗讛 then? Do we say, 讛砖转讗 诪讬讛讗 诇讗 讗住讬专讗 诇讬讛, that now she is not 讗住讜专 to him, now she is married to him, and he didn't divorce her yet that we should be able to speak about the next marriage? 讗讜 讚讬诇诪讗, or maybe, 讝讬诪谞讬谉 讚诪讙专砖 诇讛, it is possible, it could happen that he will divorce her, 讜讛讚专 诪讛讚专 诇讛, and then he will take her back, and therefore he is allowed to make her swear now for the second marriage. And the 讙诪专讗 says, 转讗 砖诪注, come hear, I will answer your question. We learned in a 诪砖谞讛, 讛讻诇 砖讜讬谉, everyone agrees, 砖诇讗 讛讬讛 诪转谞讛 注诪讛, 诇讗 注诇 拽讜讚诐 砖转转讗专住, that he wasn't allowed to make the condition, make her swear, on the 注讘讬专讜转 that she did before she became engaged to him, and also, 讜诇讗 讗讞专 砖转转讙专砖 讜转住转专 诇讗讞讚, and not concerning after he will divorce her, and she would then, after he divorces her, hide with somebody, 讜转讟诪讗, and she will become 讟诪讗讛, 讜讗讞专 讻讱 讬讞讝讬专谞讛, and then he

Conditions on the Wife Between Marriages

would take her back, for that, 诇讗 讛讬讛 诪转谞讛, for that he couldn't make the condition, he couldn't make her swear. In other words, he couldn't make her swear for the future for the time in between the first marriage and the second marriage. So it comes out, 讛讗 讬讞讝讬专谞讛 讜转讟诪讗, but if he'll take her back and she will become 讟诪讗讛 after he takes her back, 讛讻讬 谞诪讬 讚诪转谞讛, for that he could make her swear. He just can't make her swear for the time between the marriages, but it seems like the 诪砖谞讛 is saying that for the time after he takes her back, he could make the condition, he could make her swear. 砖诪注 诪讬谞讛, so from here we see that for the second marriage, he could make her swear even now. Then the 讙诪专讗 continues, 转谞讜 专讘谞谉, and the 专讘谞谉 learned, the 驻住讜拽 says, 讝讗转 转讜专转 讛拽谞讗讜转, this is the 转讜专讛 of the 拽谞讗讜转, of the jealousies, which means of the 住讜讟讜转, 诪诇诪讚, this comes to teach us, 砖讛讗砖讛 砖讜转讛 讜砖讜谞讛, that a woman is able to drink as a 住讜讟讛 and do it again. If her husband will warn her again, and she will again hide, she will again have a 讚讬谉 of a 住讜讟讛, and have to drink again. And this is learned out from the word 讛拽谞讗讜转. 讛拽谞讗讜转, 诇砖讜谉 专讘讬诐, in plural, it says this is the 讚讬谉 of the jealousies to teach us that every time it happens, the same 讚讬谉 will apply again. That even if it happens more than once, the same 讚讬谉 applies that she drinks as a 住讜讟讛. 专讘讬 讬讛讜讚讛 讗讜诪专, but 专讘讬 讬讛讜讚讛 says, 讝讗转, since it says 讝讗转 转讜专转 讛拽谞讗讜转, this is the law of the 拽谞讗讜转, the word 讝讗转 comes to be 诪诪注讟, comes to exclude, to teach us, 砖讗讬谉 讛讗砖讛 砖讜转讛 讜砖讜谞讛, that a woman cannot drink and then repeat it again. Only once it could happen, but if it happens again, she doesn't become a 住讜讟讛, she doesn't drink.

Rabbi Yehuda鈥檚 Story of the Well鈥慏igger

讗诪专 专讘讬 讬讛讜讚讛, and 专讘讬 讬讛讜讚讛 said, 诪注砖讛, there was a story, 讜讛注讬讚 诇驻谞讬谞讜 谞讞讜谞讬讗 讞讜驻专 砖讬讞讬谉, that this person 谞讞讜谞讬讗, the one that used to dig the holes, the wells in 讬专讜砖诇讬诐 for the people who would come up to 讬专讜砖诇讬诐 for 讬讜诐 讟讜讘 to fulfill the 诪爪讜讛 of 注诇讬讛 诇专讙诇, so his job was he would dig the wells for their water. So this person 谞讞讜谞讬讗 讞讜驻专 砖讬讞讬谉 testified in front of us, 砖讛讗砖讛 砖讜转讛 讜砖讜谞讛, that he knows the 讚讬谉 is that a woman could drink as a 住讜讟讛 and then repeat it again. 讜拽讘诇谞讜 注讚讜转讜, and we accepted his testimony, 讘砖谞讬 讗谞砖讬诐, only by two men. If her husband died, and then she remarried, and her second husband warns her, and she goes and hides with a man, so then we accepted the testimony that she becomes a 住讜讟讛 again. 讗讘诇 诇讗 讘讗讬砖 讗讞讚, but we didn't accept the testimony concerning one man, that if the same husband warns her again, and she hides again, she does not drink the water of a 住讜讟讛. 讜讞讻诪讬诐 讗讜诪专讬诐, but the 讞讻诪讬诐 say, 讗讬谉 讛讗砖讛 砖讜转讛 讜砖讜谞讛, a woman does not drink and then drink again, 讘讬谉 讘讗讬砖 讗讞讚 讘讬谉 讘砖谞讬 讗谞砖讬诐, whether it's by the same husband or by two husbands. So we

Three Opinions on Repeating the Sota Penalty

have three opinions here: the 转谞讗 拽诪讗 holds that in all cases she could drink again; 专讘讬 讬讛讜讚讛 holds that only by a second husband she could drink again, but not in the same husband; while the 讞讻诪讬诐 hold that she could never drink again. And the reason why 专讘讬 讬讛讜讚讛 makes this difference, that by the second husband she could drink again, and by the first husband, by the same husband, she cannot drink again, 专砖状讬 explains very simply. Because as we see in the 讙诪专讗, we do have two words concerning the 住讜讟讛: one word that tells us that she could drink again, and that is the word 转讜专转, which comes to be 诪专讘讛 that she could drink again; then we have one word, 讝讗转, which comes to be 诪诪注讟, to exclude, that she cannot drink again. So therefore, 专讘讬 讬讛讜讚讛 says that both of the 驻住讜拽讬诐 make sense: in the case of the same husband, we 讚专砖谉 讝讗转 that she cannot drink again, in the case of another husband, There we 讚专砖谉 转讜专转 that she could drink again. And that's where the 讙诪专讗 comes up now with a question. The 讙诪专讗 asks, 讜转谞讗 拽诪讗 谞诪讬, the 转谞讗 拽诪讗 too, 讛讻转讬讘 讝讗转, doesn't it say 讝讗转? How could the 转谞讗 拽诪讗 say that in all cases she is allowed to drink again when the 驻住讜拽 says 讝讗转, which comes to exclude that there should be at least certain cases where she could not drink again? And the same 拽砖讬讗 is 讜专讘谞谉 讘转专讗讬 谞诪讬, also the second 专讘谞谉 that hold that she could never drink again, 讛讻转讬讘 转讜专转, doesn't it say 转讜专转, which comes to include that at least in certain cases she should be able to drink again? So 讗诪专 专讘讗, 专讘讗 answered: 讘讗讬砖 讗讞讚 讜讘讜注诇 讗讞讚, if it's the same husband and she is suspected from the same man, 讚讻讜诇讬 注诇诪讗 诇讗 驻诇讬讙讬, no one argues, everyone agrees 讚讗讬谉 讗砖讛 砖讜转讛 讜砖讜谞讛, that a woman cannot drink again, 讚讻转讬讘 讝讗转, because it says 讝讗转, it comes to exclude if it's the same husband and the same man. 讘砖谞讬 讗谞砖讬诐 讜砖谞讬 讘讜注诇讬诐, if it's two husbands and she is suspected from two men, in other words, first her husband suspected her concerning a certain man and she drank, then her husband divorced her and she remarried, and her second husband suspected her from another man, so here too 讚讻讜诇讬 注诇诪讗 诇讗 驻诇讬讙讬, no one argues, everyone agrees 讚讛讗砖讛 砖讜转讛 讜砖讜谞讛, that she could drink again, 讚讻转讬讘 转讜专转, because the 转讜专讛 says 转讜专转 comes to be 诪专讘讛, to include that in certain cases she could drink again, and this is the case. So that

Parsing 讝讗转 and 转讜专转 for Inclusion/Exclusion

automatically this answers the question what the 转谞讗 拽诪讗 does with 讝讗转, and what do the 专讘谞谉 do with 转讜专转, because the 转谞讗 拽诪讗 will 讚专砖谉 讝讗转 comes to exclude the case of the same husband with the same man. The 专讘谞谉, what do they do with 转讜专转? They say that comes to include the case where it's a second husband and a second man. 讻讬 驻诇讬讙讬, where is the argument of these three opinions? 讘讗讬砖 讗讞讚 讜砖谞讬 讘讜注诇讬诐, if it's the same husband, but suspected from another man, 讗讜 讘砖谞讬 讗谞砖讬诐 讜讘讜注诇 讗讞讚, or by a second husband, but he suspects her from the same man. So here there is a 诪讞诇讜拽转. 转谞讗 拽诪讗 住讘专, the first 转谞讗 holds, 转讜专转 诇专讘讜讬讬 讻讜诇讛讜. He says when we approach the 驻住讜拽, so first thing we see is the 转讜专讛 comes to include all cases. Since it says 转讜专转, so it comes to include all cases. Therefore, we assume that in all cases she is allowed to drink again, but since it says 讝讗转, 诇诪讬注讜讟讬 讗讬砖 讗讞讚 讜讘讜注诇 讗讞讚, so it comes to exclude the minimum, which is one case, and that is the furthest extreme case, and that would be if it's the same husband and the same man. So that's when the 转讜专讛 says she does not drink again. 讜专讘谞谉 讘转专讗讬 住讘专讬, but the second 专讘谞谉, they hold just the opposite: 讝讗转 诇诪讬注讜讟讬 讻讜诇讛讜. We approach it the other way. We start off, since it says 讝讗转, comes to exclude, so it excludes everything, that in all cases the woman could not drink again, but since it says 转讜专转 and the word 转讜专转 comes to include, so we include the furthest extreme: 诇专讘讜讬讬, that comes to include to add 砖谞讬 讗谞砖讬诐 讜砖谞讬 讘讜注诇讬诐, that if it's two husbands and suspected from two men, then she could drink a second time. But 专讘讬 讬讛讜讚讛, 专讘讬 讬讛讜讚讛 says like this. And as 专砖''讬 explains the opinion of 专讘讬 讬讛讜讚讛, according to 专讘讬 讬讛讜讚讛 they're both equal: we have a word 讝讗转, which comes to exclude; we have a word 转讜专转, which comes to include, and we don't know which one to exclude and which ones to include. So therefore, 专讘讬 讬讛讜讚讛 feels that the 转讜专讛 gave it over to the 讞讻诪讬诐 that they should decide which cases are included or added, and which cases are excluded. And therefore, he says, we assume that if it's the same husband, that is a case where we should exclude. Since the husband warned her the first time and brought her to the 讘讬转 讛诪拽讚砖 and she drank and he found her clean, otherwise she would have died, that shows that the husband is a very suspicious husband. And therefore, when he suspects her again, even if it's from another man, but since we see already that he's a suspicious husband without basis, therefore the 住讘专讗 makes us say that he is not able to make her drink again. And this is what the 讙诪专讗 says: according to 专讘讬 讬讛讜讚讛, 讝讗转 诇诪讬注讜讟讬 转专转讬, and 转讜专转 诇专讘讜讬讬 转专转讬. 讝讗转 comes to exclude, and we exclude two cases. 转讜专转 comes to include, it comes to include two cases. Because altogether we have here four cases: two extremes, one case two husbands with two men, the other case the same husband with the same man, and then we have the two cases in between: one case of the two husbands with the same man, and the other case is one husband with two men. So he says like this: the word 讝讗转 comes to exclude two cases, and the word 转讜专转 comes to include two cases. Now which are the two? As we said before, the one with the same husband, the 住讘专讗 says that that we should exclude. He says, 讝讗转 诇诪讬注讜讟讬 转专转讬, 讝讗转 comes to exclude two cases, so it excludes definitely 讗讬砖 讗讞讚 讜讘讜注诇 讗讞讚, the same husband with the same man definitely is excluded that she can't drink again, but it also comes to exclude 讗讬砖 讗讞讚 讜砖谞讬 讘讜注诇讬诐, if it's the same husband And suspected of two men, also she can't drink, and the reason for that is, as we said before, that since we saw he suspected her once, and she drank and she was clean, that shows that he is a suspicious husband without a basis, and therefore the 住讘专讗 says that he shouldn't be able to suspect her again and have her drink again, even if it's another man that he suspects her from. And the word 转讜专转 is 诇专讘讜转 砖转讬诐. The word 转讜专转 comes to include two. Which two? 砖谞讬 讗谞砖讬诐 讜讘讜注诇 讗讞讚, if it's two husbands and suspected from the same man, but as long as it's two husbands, so here we don't have that 住讘专讗 that this husband is a suspicious husband, and therefore she does drink again if the second husband suspects her, even if it's from the same man. And certainly it comes to include if it's 砖谞讬 讗谞砖讬诐 讜砖谞讬 讘讜注诇讬诐, two husbands and suspected from two men, that if her husband suspected her first from a man and then he divorced her, and the second husband suspected her from another man, she certainly drinks again by the second husband. Concerning what we learned before that according to 专讘讬 讬讛讜讚讛, if it was two husbands and the same man, he says then she would drink a second time, but if it was the same husband, then she would not drink a second time. So we see from this 讙诪专讗 that the 住讘专讗 of 专讘讬 讬讛讜讚讛 is that by two different people there is more 住讘专讗 that you should be able to repeat the thing rather than by one person.

Tosafot鈥檚 Question from Kiddushin on Re鈥憇ale

转讜住驻讜转 asks a 拽讜砖讬讗 in the first 驻专拽 of 拽讬讚讜砖讬谉 讚祝 讬状讞 注诪讜讚 讗壮, the 讙诪专讗 says there concerning a person who stole and didn't have any money to pay, so the 讚讬谉 is that he is sold as an 注讘讚 注讘专讬, and the money that he gets for his sale, that goes to pay the 讙谞讬讘讛. And the 讙诪专讗 there learns out from the word 讘讙谞讘转讜, because the 转讜专讛 says 讜谞诪讻专 讘讙谞讘转讜, he should be sold for his 讙谞讬讘讛. So the 讙诪专讗 learns out from here that if he is sold once, you can't sell him a second time. And the 讙诪专讗 explains that that only could be done by two people: if he stole later on from another person, so then we say if he was already sold for stealing from one person before, he cannot be sold later for stealing from another person. But if he stole again from the same person, then he could be sold again. So we see from there that it's more 住讘专讗 to say that you should be able to repeat the action if it's with the same person rather than by two people. And in this 讙诪专讗 it seems to be saying that it's more 住讘专讗 to repeat the action if it was done by two people rather than by one person. This 拽讜砖讬讗, 转讜住驻讜转 says, is only according to the way 转讜住驻讜转 learns 驻砖讟 in the 讙诪专讗 in 拽讬讚讜砖讬谉, but the way 专砖状讬 learns the 驻砖讟 in that 讙诪专讗 拽讬讚讜砖讬谉, this is 诇讻转讞讬诇讛 no 拽讜砖讬讗, because this is not what the 讙诪专讗 in 拽讬讚讜砖讬谉 is saying according to 专砖状讬's 驻砖讟. Because 专砖状讬 learns there that when the 讙诪专讗 makes a difference between one person and two people, it is not whether he stole from the same person or whether he stole from two different people. The difference is when he was taken to 讘讬转 讚讬谉. If he was taken to 讘讬转 讚讬谉 from both people together, then the 讚讬谉 is that he could only be sold once, because the two 讚讬谉 转讜专讜转, the two 讙谞讬讘讜转 that he had, are really like one because he was taken to 讘讬转 讚讬谉 together for both of them. But if he was taken to 讘讬转 讚讬谉 from two people separately, so then the 讚讬谉 is that he could be sold first for the first 讙谞讬讘讛 and later on sold for the second 讙谞讬讘讛. So according to that 驻砖讟 in the 讙诪专讗 in 拽讬讚讜砖讬谉, there is no contradiction between that 讙诪专讗 and the 讙诪专讗 here in 住讜讟讛.

Concerning what the 讙诪专讗 says later on that the opinion of the 专讘谞谉 讘转专讗讬 is that a woman cannot become a 住讜讟讛 twice, cannot drink a second time, and the 讙诪专讗 讟讗拽注 asks a 拽讜砖讬讗, what do they do with the word 转讜专转, and then the 讙诪专讗 answers it, so 转讜住驻讜转 asks a 拽讜砖讬讗, in the 讙诪专讗 in 讻专讬转讜转 讚祝 讻状讝 注诪讜讚 讘壮, the 讙诪专讗 says that a man could bring one 拽专讘谉 for his wife, the 住讜讟讛, even if he warned her concerning many men. So we see clearly that we hold that you could warn your wife concerning many men and she becomes a 住讜讟讛. And here the 讞讻诪讬诐 hold a woman cannot become a 住讜讟讛 more than once. And 转讜住驻讜转 answers there's a big difference: there we were talking about a case that he warned her once concerning a man, then he warned her concerning another man, but he warned her the second time, or the third, or whatever it might be, before she drank for the first, and there we say that she would drink once for all the different warnings. Our 讙诪专讗 here is talking about when he warned her and she already drank, and then he warned her again. The question is, can she drink a second time for a second warning? And that's where we have the 诪讞诇讜拽转 here between the 转谞讗 拽诪讗, 专讘讬 讬讛讜讚讛, and the 专讘谞谉 讘转专讗讬.
