Opening Verse and Its Basic Meaning

This week's parsha, it says the pasuk: ืžื™ ื‘ืขืœ ื“ื‘ืจื™ื, who is the man of the words, he should come forth. This is talking about a din Torah. ืœืขืจื ื˜ ืืค ื“ื™ ื’ืžืจื, the Gemara learns from here ืื– ืื™ืŸ ื ื–ืงืงื™ืŸ ืืœื ืœืชื•ื‘ืข ืชื—ื™ืœื”, that you get, when it comes to a din Torah, you have a ืชื•ื‘ืข and a ื ืชื‘ืข, you have a plaintiff and a defendant. So the plaintiff is the one that starts speaking first. ื“ืขืจ ื‘ืขืœ ื“ื‘ืจื™ื, ืชื•ื‘ืข, ื™ื’ื™ืฉ ื“ื‘ืจื™ื• ืืœื™ื”ื, he should bring the words to the Beit Din, so he comes first. That's the peshat of what the Gemara says. ืื™ื– ืžืคืจืฉ ื“ืขืจ ืฉืดืš ืื– ื“ืืก ืžื™ื™ื ื˜, ื“ื™ ืคืฉื˜ ืื– ื“ื™ ื”ืœื›ื” ืื™ื–, the Shach learns the peshat is pashut, simple words, ืื– ื‘ื™ืช ื“ื™ืŸ ื”ืขืจื˜ ืฆื• ืขืจืฉื˜ ื“ื™ ื˜ืขื ื•ืช ืคื•ืŸ ืชื•ื‘ืข ืื•ืŸ ื ืื›ื“ืขื ื“ื™ ืจื™ื™ื“ ืคื•ืŸ ื ืชื‘ืข. First the Beit Din hears the ื˜ืขื ื•ืช of the plaintiff, of the ืชื•ื‘ืข, and then they hear the ื ืชื‘ืข, what the ื ืชื‘ืข answers. ืื•ืŸ ื ื ืคืงื ืžื™ื ื” ืœืžืขืฉื” ื‘ืืžืช ื˜ืขื ื•ืช ืžืขืŸ ื”ืขืจื˜ ืฆื• ืขืจืฉื˜? And the Shach says what's nafka mina, what does it make a difference who comes first? So he says yes, there is nafka mina in a ืคืืœ ืคื•ืŸ ื ืžื•ื“ื” ื‘ืžืงืฆืช. A case where a person is a ืžื•ื“ื” ื‘ืžืงืฆืช, that's where it'll make a difference. Lichora, what's, again, what's the difference? If

The Significance of Muda Bโ€™Miktsat

he's a ืžื•ื“ื” ื‘ืžืงืฆืช, he's a ืžื•ื“ื” ื‘ืžืงืฆืช. What's nafka mina who says it first, says it later? So he says, no, interesting, the din is We know a ืžื•ื“ื” ื‘ืžืงืฆืช, someone who admits to part, he has to pay whatever he admits, and for the rest he has to swear mid'oraita. And if he swears, he becomes patur. When is this din that he has to swear, and otherwise if he doesn't want to swear he has to pay? For instance, a guy says to him, "You owe me $100." After he says, "You owe me $100," and he says, "I only owe you 50," so his answer, his being a ืžื•ื“ื” ื‘ืžืงืฆืช came after the ืชื‘ื™ืขื”, after the guy claimed the whole thing, then the din of ืžื•ื“ื” ื‘ืžืงืฆืช applies and he has to swear mid'oraita. ืื‘ืขืจ ืื•ื™ื‘ ื“ืขืจ ื ืชื‘ืข ื”ื•ื“ื” ื‘-ื ืณ, ื“ืืš ื›ื“ืืš ื”ืื˜ ื“ืขืจ ืชื•ื‘ืข ื’ืขืชื‘ืข ื‘-ืงืณ? What happens if it worked the other way? A guy comes over to somebody else in ื‘ื™ืช ื“ื™ืŸ and he says, "You know, I owe you $50." The guy says, "What are you talking about? You owe me 100!" So he said 50 before the guy claimed the claimed the rest. He is a ื ื™ืฉื˜ ืงื™ื™ืŸ ืžื•ื“ื” ื‘ืžืงืฆืช, ืื•ืŸ ืขืจ ืื™ื– ืคื˜ื•ืจ ืคื•ืŸ ื ืฉื‘ื•ืขื” ื“ืื•ืจื™ื™ืชื. And you're That's the din. It's patur from a shvua d'oraisa. If you Yeah. He doesn't know what the guy's going to claim. He wants to He doesn't know the guy's going Er weiรŸt er ist schuldig gegangen? Yeah. So like this he does patur from a shvua. He does that. Taki, so then the other guy has to be smart to ื›ืืค ืืจื™ื™ืŸ and call him before. That's all. He's lying. So that's a modeh bemiktzas. So you

Migo Principles Applied to Partial Admissions

can ask on every modeh bemiktzas, he should believe as a migo. If he's modeh in 50, he could have said for 10. We don't say a ืžื™ื’ื• ืžืžืžื•ืŸ ืœืžืžื•ืŸ. We don't say a migo on one money because he could have said different money, that's I paid you. Huh? I paid you. That, you wouldn't believe. No, that's not the migo? If it's like you have a shtar, don't believe him. That's a different thing. But, a migo The migo of kofer hakol, oh, that's what you mean! That's the kashya of the ื’ืžืจื, ื‘ื’ืœืœ ืžื” ืืžืจื” ืชื•ืจื” ืžื•ื“ื” ื‘ืžืงืฆืช ื™ืฉื‘ืข, the Gemara asks why does he swear? So Tosafos says, what's the Gemara's she'eilah? He should be believed with a migo, could have been a kofer hakol. That's something else. Could have denied even this money. So that's a migo on this money, but if he could have said differently, could have said less, that we don't say. Anyway, this is not related to the whole sugya here. So, is that why the tovea has to speak first, so we don't get into that situation? So we'll see in a second. What Why the difference Why don't they say a migo at all? Huh? The Gemara answers, ืื™ืŸ ืื“ื ืžืขื™ื– ืคื ื™ื• ื‘ืคื ื™ ื‘ืขืœ ื—ื•ื‘ื•. The Gemara says a person doesn't have the chutzpah to say that. But let let us finish this piece and we'll see.

Why the Plaintiff Must Speak First

ื“ืขืจ ื˜ืขื ืคืืจ ื“ืขืจ ื”ืœื›ื” ืื™ื–, the reason for this halachah: Why is it that only if he if the tovea comes first with the full amount, that and he's modeh bemiktzas, then he's chayav a shvua, but otherwise not? So he says like this: Be'emet, this guy's modeh, why did he wait bichlal to come to ื‘ื™ืช ื“ื™ืŸ? If you owed the money, and you know you owed the, at least what's yours, you say you owe 50, you should have come to ื‘ื™ืช ื“ื™ืŸ and paid the 50. ื“ื™ื•ื•ืืœื“ ืขืจ ื”ืื˜ ื ื™ืฉื˜ ื’ืขื˜ืืŸ ื•ื•ืืก ืขืจ ื”ืื˜ ื’ืขื“ืืจืคื˜ ื˜ืืŸ, ืื•ืŸ ืขืจ ืื™ื– ื’ืขื‘ืœื™ื‘ืŸ ื ื ืชื‘ืข ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ, but since you didn't say it, you waited for him to claim, for him to call you to ื‘ื™ืช ื“ื™ืŸ to become a ื ืชื‘ืข, you should have been the guy coming in first! You let him, in other words, you didn't want to pay first. You thought maybe the guy won't will forget, whatever, he won't claim. Because of that, ืื™ื– ื“ืขืจืคืืจ ื ื–ืงืงื™ืŸ ืœืชื•ื‘ืข ืชื—ื™ืœื” ื›ื“ื™ ืขืจ ื–ืืœ ื–ื™ื™ืŸ ืžื—ื•ื™ื™ื‘ ื ืฉื‘ื•ืขื” ื“ืื•ืจื™ื™ืชื. We let him go first because we want you to swear, because we have ta'anot to you: why, if you claim you owe 50, why didn't you pay? Why didn't you come first and say, "I owe you 50, here's $50"? So you let him come first, so we do that. We say let him speak first, kedei you should be chayav a shevuah. Okay, that's the din. So, comes out this din that the ืชื•ื‘ืข speaks first is ื ื•ื’ืข ืœื”ืœื›ื”, not only ืคืฉื•ื˜ in the procedure of a ื‘ื™ืช ื“ื™ืŸ, who do you let speak first? It's ื ื•ื’ืข ืคืฉื•ื˜ ืœืžืขืฉื”. If this guy speaks first, so that the ืชื•ื‘ืข speaks first, then he has to swear if he is a ืžื•ื“ื” ื‘ืžืงืฆืช, and if the ืชื•ื‘ืข if the ื ืชื‘ืข speaks first, then he is patur from being from a ืฉื‘ื•ืขืช ืžื•ื“ื” ื‘ืžืงืฆืช. Why don't they, maybe they forgot? Why don't they, maybe not. Weiter zogt the Gemara, then the Gemara continues,

When the Defendant Is Asked to Speak First

Sometimes, we do ask the ื ืชื‘ืข to be first. ื‘ื”ื™ื›ื™ ื“ืžื™ ื“ืงืื–ืœื™ ื ื›ืกื™ื”, the Gemara: when? When his property is becoming cheap, meaning. Is the Shach ืžื‘ืื™ืจ, so the Shach explains ื‘ื”ืžืฉืš to his ืคื™ืจื•ืฉ ืื™ืŸ ื ื–ืงืงื™ืŸ ืื™ืŸ ื ื–ืงืงื™ืŸ ืœืชื•ื‘ืข ืชื—ื™ืœื”, ื‘ื”ืžืฉืš to what he said before, why we ask the ืชื•ื‘ืข to come first, based on that he explains this Gemara. The whole ืงื•ืฉื™ื of the ื˜ืขื ื” that we have to the ื ืชื‘ืข: why didn't you pay whatever you owe, you claim you owe, you should pay. If the reason he says "I didn't pay" is not because he thought he'll get away with it and not have to pay anything, nor weil in In other words, in order to pay, he had to have money. So, sometimes you have to sell, sell property in order to get cash. It was a bad time. It was a time when the properties were cheap, so he thought, "It's not Now is not a good time to sell." Or the opposite, or even more, sometimes if people know how you're desperate for money, that itself makes it cheap. If that's the reason, oh, Then we ask him to get go first. Because the Shach learns that the only reason we ask him to come later because we have a complaint against him. We want you to swear because you did something wrong. What was your wrong? Why didn't you pay the money, whatever you owe? But if there is a good excuse, because it's it would have been cheap and he would have lost money, oh, that makes sense. In that case, we'd let him speak first. So, why do we let him go first though, who? So, if he didn't he was We don't have a ื˜ืขื ื” against him. So, but ืกืชื, why him first? We we can let go first. If he happens to be there first, let him speak first. It's not that we make him go first. Like this, we ื‘ื“ื•ื•ืงื don't let him go first, and in this case, we let him go first. If he wants to go first, be able to go first, let him go first.

Spiritual Insight: Nigleh and Ruchniyut

Wie schon geredt viel mal, the Rebbe says, as I said many times, whatever we have in an halachah in nigleh is in ruchniyut. Va-adaravah, works the opposite. See, we are thinking that from ื ื’ืœื” we take it to ืจื•ื—ื ื™ื•ืช. It's the opposite. The ืชื•ืจื” ืœื›ืชื—ื™ืœื”, before the ืื‘ืขืฉื˜ืขืจ put it gave it down here, it was by the ืื‘ืขืฉื˜ืขืจ ืœืžืขืœื” in ืจื•ื—ื ื™ื•ืช, ื•ืžืฉื ื ืกืข ื•ื™ืจื“, in Tanya it says, and from ืœืžืขืœื” it came down ืขื“ ืฉื ืชืœื‘ืฉื” ื‘ืขื ื™ื ื™ ืขื•ืœื ื”ื–ื”, till it came down ื‘ืขื ื™ื ื™ ืขื•ืœื ื”ื–ื”. ื ื’ืœื” comes from the way it's in ืจื•ื—ื ื™ื•ืช, so that's the main part of the Torah. Und noch mehr, more than that, Certain things in ื ื’ืœื”, you can't really really understand it, whatever explanation you give, you can't understand unless you'll know the ืคื ื™ืžื™ื•ืช ื”ืขื ื™ืŸ. He brings a Likkutei Sichos ื—ืœืง ื˜ืณ by a certain, by Michael the Rebbe explains it, but another place is that the really way to explain this is if you understand it ืขืœ ืคื™ ื—ืกื™ื“ื•ืช. But the bottom line is that it's ืขืœ ืคื™ ื—ืกื™ื“ื•ืช is everything has to have a ื‘ื™ืื•ืจ ืขืœ ืคื™ ื—ืกื™ื“ื•ืช in ืขื‘ื•ื“ื” ืจื•ื—ื ื™ื•ืช. So, obviously, this thing is also going to need a ื‘ื™ืื•ืจ ืขืœ ืคื™ in in ืจื•ื—ื ื™ื•ืช. It doesn't quote here, but it's based on a on the Alshich. The Alshich says that people think, everyone knows that there is ืจื•ื—ื ื™ื•ืช'ื“ื™ืงืข ืขื ื™ื ื™ื in Torah, so people think that ื”ืชื•ืจื” ืžื“ื‘ืจืช ื‘ืชื—ืชื•ื ื™ื ื•ืจื•ืžื–ืช ื‘ืขืœื™ื•ื ื™ื. Torah talks about things down here. Torah hints to higher, that's a mistake. ื‘ืขื™ืงืจ it's ืœืžืขืœื”, it's a ืจืžื–, this down here that we have to do is a ืจืžื–. You happen to know where is it in the Alshich? Exactly, which I mean, the Alshich on the Chumash? No, that's not on the Chumash. It's Torat Moshe, wasn't it? Torat Moshe Yeah, but it's it's on No, it's I'm sorry. I'm sorry. Good if you brought that, it's not the Alshich, it's the Shelah. I said Alshich, it's the Shelah, that's why I'm wondering, you're asking Chumash, Shelah is not on the Shelah, not Alshich. It's the Shlah. Okay. He's using the Shlah, yeah? Huh? Well, the Rebbe brings the ืžืจืื” ืžืงื•ืžื•ืช a lot in different places, I don't know. Huh? Yeah. No, who he was, yeah, but he asked where exactly, which places it is. ืขืœ ื“ืจืš ื–ื” ืื™ื– ื‘ืขื ื™ื™ื ื ื•, same thing here. The peshat is that the If you look at simple peshat, the ืฉ"ืš peshat is not so clear. ืคื•ืŸ ืœืฉื•ืŸ ื—ื–"ืœ, ื ื–ืงืงื™ืŸ ืœืชื•ื‘ืข ืชื—ื™ืœื”, it says that we always go with the ืชื•ื‘ืข first. ืชื•ื‘ืข ืกืชื, it doesn't say which situation, we always let the ืชื•ื‘ืข go first, ืื™ื– ืžืฉืžืข, ืื– ื“ืืก ืื™ื– ื ืขื ื™ืŸ ื›ืœืœื™ ื•ื•ืืก ืื™ื– ื ื ืคืงื ืžื™ื ื” ืœืคื•ืขืœ in ื›ืžื” ื•ื›ืžื” ืื•ืคื ื™ื ืคื•ืŸ ืชื‘ื™ืขื”, and it's not davka by ืžื•ื“ื” ื‘ืžืงืฆืช. See the Shach says it's only ื ื•ื’ืข, where does it make a difference, is by ืžื•ื“ื” ื‘ืžืงืฆืช. It's not, you find all kinds of cases. ืื•ืŸ ืœื•ื™ื˜ ืคื™ืจื•ืฉ ื”ืฉ"ืš ืงื•ืžื˜ ืื•ื™ืก, but according to the Shach it comes out, ืื– ื“ื™ ื ืคืงื ืžื™ื ื” ืœืคื•ืขืœ ืื™ื– ื ืืจ ืื™ืŸ ื ืกื•ื’ ืชื‘ื™ืขื” ื•ื•ืืก ื“ืขืจ ื ืชื‘ืข ืื™ื– ื ืžื•ื“ื” ื‘ืžืงืฆืช. It's only in that case, or he says this is an example of cases where... No. He said that's where it's ื ื•ื’ืข ืœืคื•ืขืœ. That's where it makes a difference. ืขื•ื‘ื“ื” we do it always, but from the Gemara is ืžืฉืžืข that it's ื ื•ื’ืข always, and he brings in the ื”ืขืจื” here that the Sema ื˜ืืงืข brings that there are so many ืคืฉื˜ื™ื, and they're all true. So many nafka minot for the ื“ื™ื ื™ื, whether he comes first or not. But according to the Shach is ืžืฉืžืข that the main, the only nafka mina is by ืžื•ื“ื” ื‘ืžืงืฆืช. So the question is, but it doesn't fit to the ืœืฉื•ืŸ. Laying via ืคื ื™ืžื™ in the ืžืืžืจ, ืื™ื– ื“ืืก ืื‘ืขืจ ืคืืจืฉื˜ืขื ื“ื™ืง. If you go into deeper peshat, we'll understand this. For in ืขื‘ื•ื“ื” ืจื•ื—ื ื™ืช is ืจื•ื‘ื ื›ื›ื•ืœื ืคื•ืŸ ืชื•ื‘ืข ืื•ืŸ ื ืชื‘ืข ืคืืจื‘ื•ื ื“ืŸ ืžื™ื˜ ืžื•ื“ื” ื‘ืžืงืฆืช, because if you look at the concept of a of a ืชื•ื‘ืข and a ื ืชื‘ืข, of a plaintiff and a defendant, in ืจื•ื—ื ื™ื•ืช, it's always a ืžื•ื“ื” ื‘ืžืงืฆืช. And we'll say why. So therefore, when it comes in halachah, where is it ื ื•ื’ืข ืœืคื•ืขืœ, by ืžื•ื“ื” ื‘ืžืงืฆืช, because in ruchniyut it's all ืžื•ื“ื” ื‘ืžืงืฆืช. That's if the guy's only non-religious, or the same type of... That's not ืžื•ื“ื” ื‘ืžืงืฆืช, that's a different peshat. That's also ruchniyut it could be here. That's not ืžื•ื“ื” ื‘ืžืงืฆืช. Here it's ืžื•ื“ื” ื‘ืžืงืฆืช. So explains, the ืชื‘ื™ืขื” ืคื•ืŸ ื ื™ื™ื“, when we talk about a Yid in ืขื‘ื•ื“ื” ืจื•ื—ื ื™ืช, who is the ืชื•ื‘ืข? Who is the one that's the plaintiff that claims? It's the yetzer hara. It's the yetzer hara. First the yetzer hara comes and causes you to do an Not maybe a real chet, a real aveirah, but there's a more finer level of aveirah. Chet means a missing. First it's the same guy. First he comes down and tries to convince you, and then he becomes the satan. First is the yetzer hara, the yetzer hara convinces you, then he becomes the prosecutor. But der emet der ืžื•ืฉื’ ืคื•ืŸ ืžืœืื™ื is kipshuto. When you use the word mele'im, full, means pashut. Full means full, means that the whole metziut is full of mitzvot. ื“ืืก ื”ื™ื™ืกื˜ ืื– ืื™ืŸ ื•ื•ืืก ืคืืจ ื ื™ื™ื“ ืขืก ื–ืืœ ื–ื™ืš ื ืืจ ืจืขื“ืŸ, any type of Yid we're talking about, ืื™ื– ื‘ื™ื™ ืื™ื ื ื™ืฉื˜ ืฉื™ื™ืš ื“ื™ ืžืฆื™ืื•ืช ืคื•ืŸ ืื™ื ื’ืื ืฆืŸ ืจืข, ื—ืก ื•ืฉืœื•ื. To be completely bad, that's not shayach. That's what he said. That's for sure. Every Yid has good in him. ืื•ืŸ ื“ืขืจ ืขื ื™ืŸ, and this that we just said, ืื– ืืœืข ื“ืจื’ื•ืช ืคื•ืŸ ืื™ื“ืŸ, that all levels of ืื™ื“ืŸ, ืกื™ื™ ื ืฆื“ื™ืง, ื•ื•ืืก ืื™ืŸ ืฆื“ื™ืง ื‘ืืจืฅ ืืฉืจ ื™ืขืฉื” ื˜ื•ื‘ ื•ืœื ื™ื—ื˜ื, there's no tzadik in the world that does only good, doesn't sin, ืขืœ ื›ืœ ืคื ื™ื ื—ื˜ื ื‘ืœืฉื•ืŸ ื—ืกืจื•ืŸ, or at least maybe not a sin, but is missing something. Whether you're a tzadik, you're a ืžื•ื“ื” ื‘ืžืงืฆืช. Why? He admits a little bit. Even a tzaddik has little bit that he admits to the yetzer hara. A little bit he says you are right. I I takeh, I'm not so 100%. And so he's ืžื•ื“ื” a little bit to the yetzer hara. Even a rasha is also only a ืžื•ื“ื” ื‘ืžืงืฆืช. He's ืžื•ื“ื”, but he's not saying you're right 100% that I fully, fully aveirot. No, he's only ืžื•ื“ื” ื‘ืžืงืฆืช. And this inyan is ืžืจื•ืžื– in ืคืกื•ืง ืคื•ืŸ ื•ื•ืื ืขืŸ ืžื™ืจ ืœืขืจื ืขืŸ ืืค ื“ืขื ื“ื™ืŸ ืคื•ืŸ ืžื•ื“ื” ื‘ืžืงืฆืช. It's hinted in this pasuk from where we know the whole concept of ืžื•ื“ื” ื‘ืžืงืฆืช. What does the pasuk say? What's it go like that? The guy's claiming from him something and whatever he's claiming, you owe me, and he answers ื›ื™ ื”ื•ื ื–ื”. So how does the Gemara learn out ืžื•ื“ื” ื‘ืžืงืฆืช? Because ื›ื™ ื”ื•ื ื–ื” means this is it. In other words, seems like he's telling The guy is asking for something, he says, "No, no, this is it," meaning he's admitting to something, he doesn't say it's not. This is the pasuk. Now this ืจื•ื—ื ื™ื•ืช'ื“ื™ืงืข ืคืฉื˜ is hinted in this pasuk. ืœื•ื™ื˜ืŸ ืื•ื™ืกื˜ื™ื™ื˜ืฉ ืคื•ืŸ ืคืกื•ืง in ืขื‘ื•ื“ื” ืจื•ื—ื ื™ื•ืช, the way we explained in ืจื•ื—ื ื™ื•ืช, what is the peshat of this is the ืชื‘ื™ืขื”, what is the claim? ื›ืœ ื“ื‘ืจ ืคืฉืข means ืคืฉืข is ืœืฉื•ืŸ ืคืฉื™ืขื”, negligent, bad. So ืกื™ื™ if a person is a ืคื•ืฉืข, ืื•ืŸ ืกื™ื™ ืขืœ ื›ืœ ืื‘ื™ื“ื”, or something that's lost, ื“ืืก ืื™ื– ื ืืจ in an ืื•ืคืŸ ืคื•ืŸ an ืื‘ื™ื“ื” ื•ื—ืกืจื•ืŸ. ืื‘ื™ื“ื” means you lose something, you're missing something. ืขืจ ื˜ื•ื˜ ื ื™ืฉื˜ ื•ื•ื™ืคื™ืœ ืขืจ ื•ื•ืืœื˜ ื’ืขืงืขื ื˜ ื˜ื•ืŸ in ื–ื™ื™ืŸ ืฉืœื™ื—ื•ืช, he didn't do enough. So even a guy like that, that's like that could be the tzaddik. The tzaddik is also missing not doing enough. He didn't do enough, so what's wrong with that? So part, certain koach, which could have done more, is lost. So the pasuk says whether it's a ื›ืœ ื“ื‘ืจ ืคืฉืข, both sides, whether you're a person who is a bad, bad person or you're a person which is good, you just lost a little bit. ืื•ืŸ ื“ื™ ืคื™ืจ ืคืจื˜ื™ื: ืขืœ ืฉื•ืจ, ืขืœ ื—ืžื•ืจ, ืขืœ ืฉื”, ืขืœ ืฉืœืžื”, in the middle the Torah gives examples: an ox or a donkey or a sheep or a or a garment, ื–ื™ื™ื ืขืŸ ืคื™ืจ ืกื•ื’ื™ื in ื ืคืฉ ื”ื‘ื”ืžื™ืช ื•ื•ืืก ืคื™ืจืŸ ืฆื• ื“ืขืจ ื›ืœ ื“ื‘ืจ ืคืฉืข ืื•ืŸ ืื‘ื™ื“ื”. In Chassidus it explains that there are four types of ื ืคืฉ ื”ื‘ื”ืžื™ืช, but the four types of ื ืคืฉ ื”ื‘ื”ืžื™ืช bring you to one of the two: or a ื›ืœ ื“ื‘ืจ ืคืฉืข, or you're a bad guy, or you're a good guy, but you're just missing a little bit. ืื™ื– ืื– ื“ื™ ืชื‘ื™ืขื•ืช, ืขืœ ื›ืœ ื“ื‘ืจ ืคืฉืข, ืขืœ ื›ืœ ืื‘ื™ื“ื”, when the yetzer hara, who's the ืชื•ื‘ืข, claims that you are ื›ืœ ื“ื‘ืจ ืคืฉืข or ื›ืœ ืื‘ื™ื“ื”, ืขื ื˜ืคืขืจื˜ a ืื™ื“, ืืฉืจ ื™ืืžืจ, what does the Yid say? Whatever you claim you're right, but it's only a ืžืงืฆืช of me. He's a ืžื•ื“ื” ื‘ืžืงืฆืช. And he says that he's not not completely. And this is the ืจื•ื—ื ื™ื•ืช'ื“ื™ืงืข ืคืฉื˜ of ืžื•ื“ื” ื‘ืžืงืฆืช. I'm just bringing, I say mentioning something which seems strange here, that it doesn't really fit to the simple ืคืฉื˜ of ืžื•ื“ื” ื‘ืžืงืฆืช. ืžื•ื“ื” ื‘ืžืงืฆืช means, what's the, what's the other side of ืžื•ื“ื” ื‘ืžืงืฆืช? ื”ื›ื•ืคืจ ื‘ื›ืœ. In this way, what's the other side of ืžื•ื“ื” ื‘ืžืงืฆืช? ืžื•ื“ื” ื‘ื›ืœ. Says a Yid is only a ืžื•ื“ื” ื‘ืžืงืฆืช, he's not ืžื•ื“ื” to everything. A Yid will never admit to say that you're saying I'm completely bad, it's not true. In halacha that's up, it's not like that. He's not saying that I'm completely ืžื•ื“ื” to you, he's not saying I'm denying the whole thing. Anyway, but ืœืคื•ืขืœ, the the ืžื•ื“ื” ื‘ืžืงืฆืช is the same. Say I paid. I suffered, I did... No, that's what, I'm saying what he's saying here. He doesn't say a Yid doesn't tell him that nothing, I don't owe anything, in other words I'm not bad, I'm completely good. No, no, he's ืžื•ื“ื” to a ืžืงืฆืช. The other side would have been if he would deny the whole thing. That's... Huh? So that's why he's a ืžื•ื“ื” ื‘ืžืงืฆืช. And not what? Not ื›ื•ืคืจ ื‘ื›ืœ to say That's what his ื‘ืื•ื•ืืจืขื ืขืŸ is. His ื‘ืื•ื•ืืจืขื ืขืŸ is that that no Yid has completely bad. So a Yid is only ืžื•ื“ื” ื‘ืžืงืฆืช, not completely bad. Completely bad would mean ืžื•ื“ื” completely. ื™ืฆืจ ื”ืจืข ืชื•ื‘ืข, says you're bad, so a Yid is not saying you're right. He's not ืžื•ื“ื” completely, he's only a ืžื•ื“ื” ื‘ืžืงืฆืช, which is the other way. He's not ื›ื•ืคืจ ื‘ื›ืœ ืžืฆื“ ื–ื”. He's not ื›ื•ืคืจ ื‘ื›ืœ also, but the way the Rebbe describes it, he's not describing that he's not a ื›ื•ืคืจ ื‘ื›ืœ, but he's at least ืžื•ื“ื” ื‘ืžืงืฆืช, he's saying farkert, a Yid cannot be completely bad. So a Yid cannot be ืžื•ื“ื” completely. That's what he says. But is takeh it's ื›ื•ืœื• ืžืกืชืžื that

Muda b'Miktzat Requires a Shevuah

also. Okay, so what's the din here? So we know what it means. So a guy is a ืžื•ื“ื” ื‘ืžืงืฆืช. And he's ืžื•ื“ื” a little bit that he does something bad, but not completely. ื“ืขืจ ืคืกืง ื“ื™ืŸ ืคื•ืŸ ืชื•ืจื” ืื™ื– ืื– a ืžื•ื“ื” ื‘ืžืงืฆืช is chayav a shevuah. If a person is a ืžื•ื“ื” ื‘ืžืงืฆืช, he have to swear. ื“ื•ื•ืงื ื“ื•ืจืš ื“ืขืจ ืฉื‘ื•ืขื” ื’ืœื™ื™ื‘ื˜ ืžืขืŸ ืื™ื ืื•ื™ืฃ ื“ืขื ื—ืœืง ื•ื•ืืก ืขืจ ืื™ื– ื ื™ืฉื˜ ืžื•ื“ื”. Because when do we believe the guy that the part that he doesn't admit that we believe him he's right? That's only through a shevuah. In ืขื‘ื•ื“ื”, ืจื•ื—ื ื™ื•ืช ืžื™ื™ื ื˜ ื“ืืก in ruchniyus it means like this, ื•ื‘ืืœื“ ืขืจ ืื™ื– ืฉื•ื™ืŸ ื“ื•ืจื›ื’ืขืคืืœืŸ a ืžืงืฆืช ืืจื™ื™ืŸ ืื™ืŸ ืจืฉื•ืช ื”ื™ืฆืจ since he takeh has stumbled and partially ืžืงืฆืช he came into the ืจืฉื•ืช of the ื™ืฆืจ ื”ืจืข, ื“ืืจืฃ ืขืจ ื”ืื‘ืŸ a ืชื•ืกืคืช ื›ื— ืฆื• ืืคื”ื™ื˜ืŸ ื–ื™ืš ืื– ืžืขืŸ ื–ืืœ ืžืขืจ ื ื™ืฉื˜ ืืจื™ื™ื ืคืืœืŸ ืื™ืŸ ืจืฉื•ืชื•. Now he needs extra kochos. Because if he fell in a little bit, you know, the Megillah says a pasuk: ื”ื—ืœื•ืช ืœื ืคื•ืœ, ื ืคื•ืœ ืชื™ืคื•ืœ. If you started, you could fall completely. So he needs So if he'll go normal, he'll fall. So he needs extra kochos. ืื™ืš ื ื™ื˜ ื“ื•ืจืš ื ื™ืฉื˜ ื•ื•ืขืœืŸ ืžื•ื“ื” ื–ื™ื™ืŸ ืžื•ื“ื” ื‘ืขื™ื–ื•ื‘ ื™ืจื•ื—ื. We don't even want him to be ืžื•ื“ื” to the whole thing, and normally you say if you're modeh, you're helped. So we don't want him to fall into his ืจืฉื•ืช to be modeh to him b'klal. We The Aibershter doesn't want to let him to be modeh to the yetzer hara that, "Oh, you're right." ืื•ืŸ ืฆื• ืœื™ื‘ ื“ืขื ืื™ื– ืžืขืŸ ืื™ื ืžืฉื‘ื™ืข. Whatever you said you which remained in which is in kedusha shouldn't get schlepped in. When the Plaintiff Comes First, Avoid Shevuah

There is a way, sometimes, See, when do you have to swear, which is a risk? If the ืชื•ื‘ืข comes first. So it says, sometimes the ื ืชื‘ืข can come first and then you'll avoid the shvuah. Then you will not need a shevuah. That was the only reason you need a shevuah because part of you got caught by the yetzer hara, so the other parts has we'll get the kochot. But there's another etzah how to make sure that you don't fall into the trap without a shevuah. Huh? Hurry and do teshuvah? No, that's way simple. And that is ื•ื•ืขืŸ ืžืขืŸ ื˜ืขื ื”'ื˜ ื›ื–ื™ืœื ื ื›ืกื™. If you claim, "Mine ื ื›ืกื™ื are cheap." Cuz that's what we said. This is hinted in this week's parshah, in some of the pesukim later on. What is the pesukim? ื ืืš ื“ื™ ื•ื•ืขืจื˜ืขืจ "ื•ืขื‘ื“ืชื ืืช ื”' ืืœืงื™ื›ื", after the words where it says you should serve ื”ืฉื, ื•ื•ืืก ื“ืืžื™ื˜ ื•ื•ืขืจื˜ ื’ืขืžื™ื™ื ื˜ ื›ืœืœื•ืช ื”ืขื‘ื•ื“ื”. So ืžืฉื›ืœื” and ืขืงืจื” means that the ahavah and yirah is not working. ืื•ืŸ ื“ื™ ืกื™ื‘ื” ืคื•ืŸ ื“ืขื ืื™ื–, what's the reason why a person's ahavah v'yirah doesn't stay, he doesn't get it? "ื‘ืืจืฆืš", ืคื•ืŸ ืœืฉื•ืŸ ืจืฆื•ืŸ. The word ืืจืฆืš comes from the word ratzon, will. ื‘ืฉืขืช ื ืื™ื“ ื”ืื˜ ืืŸ ืื™ื™ื’ืขื ืขื ืจืฆื•ืŸ, if you have your own will, ื ืฉื‘ื™ืขืช ืจืฆื•ืŸ ืคื•ืŸ ื–ื™ื™ืŸ ืขื‘ื•ื“ื”, if you're satisfied, is so happy about what you do, ื•ื•ืืก ื“ืืก ื•ื•ื™ื™ื–ื˜ ืื– ืขืจ ืื™ื– ืžืจื’ื™ืฉ ื–ื™ื™ืŸ ืžืฆื™ืื•ืช, that shows you feel your ืžืฆื™ืื•ืช. ืขืจ ืื™ื– ืขื•ื‘ื“ ื”ืฉื, I'm so happy I'm serving Hashem. ืขืจ ื”ืื˜ ืื”ื‘ื” ื•ื™ืจืื”, he has ahavah v'yirah. And even if you have yirah, you're going to lose it, because it's not the real ahavat Hashem, yirat Hashem, you care about yourself. So ื‘ืฉืขืช you have ahavah v'yirah, you're ื˜ืืงืข serving Hashem, but it's limited, ื ืืจ ื•ื•ื™ืคื™ืœ ืขืจ ื”ืื˜ ืคืืจ ื–ื™ื™ืŸ ืขื‘ื•ื“ื” ืฉื‘ื™ืขืช ืจืฆื•ืŸ. And then you start making... Here you do everything, but based on how much you feel. This is ืžืฉื›ืœื” ื•ืขืงืจื”, that you ืคืฉื•ื˜ lose your ahavah v'yirah. So the pasuk wants to tell you, what is the eitzah not to lose your ahavah v'yirah? ืœื›ืื•ืจื” you could lose it because you have your ืืจืฆืš, your ืžืฆื™ืื•ืช. Till now we thought ืžืกืคืจ ื™ืžื™ืš ืืžืœื means you have to fill your... your days. But if you do that, Hashem will make it as a promise, your days will be filled. I will fill. Yeah, but he's ื˜ื™ื™ื˜ืฉื™ื ื’, it's a remez, that the importance of the days. So the first pshat, he didn't say it, but the first pshat is going at the words that ืžืกืคืจ ื™ืžื™ืš ืืžืœื, you should make it should be filled with me, whatever how you ื˜ื™ื™ื˜ืฉ. Meaning, even if there are some days that you ื˜ืืงืข missed out, that you missed you didn't do your ืฉืœื™ื—ื•ืช, ืื“ืขืจ ืืคื™ืœื• ื’ืขื˜ืืŸ ืขื ื™ื ื™ื ืฉืœ ื”ื™ืคืš ืจื—ืžื ื ืœื™ืฆืœืŸ, maybe not only you didn't do what you're supposed to, you did opposite things. That means ืขืฆืžื•ืช ื•ืžื”ื•ืช ื–ื” ื™ืชื‘ืจืš, ื“ืขืจ ืื•ื™ื‘ืขืจืฉื˜ืขืจ, the ืขืฆื of the ืื•ื™ื‘ืขืจืฉื˜ืขืจ, ื•ื•ืืก ืื™ื– ื”ืขื›ืขืจ ืคื•ืŸ ื™ืขื“ืŸ ืฉื ืื•ืŸ ืคื•ืŸ ื“ืขื ืื– ืขืก ื–ืืœ ืืŸ ืจื™ืจืŸ ื ืคื’ื. Himself, which is higher than Havayah, any name. And a madregah where anything wrong that you did doesn't affect Him anyway, ืื™ื– ืขืจ ืžื‘ื˜ื™ื—, ื“ืขืจ ืื•ื™ื‘ืขืจืฉื˜ืขืจ promises ืื– ืขืจ ื•ื•ืขื˜ ืžืžืœื ื–ื™ื™ืŸ ื•ืžืฉืœื™ื ื–ื™ื™ืŸ ื“ื™ ืคืืจืคืขืœื˜ืข ื˜ืขื’, that He's going to fill and be mashlim those missed days, ืื•ืŸ ืืœืข ื–ื™ื™ื ืข ื˜ืขื’ ื•ื•ืขืœืŸ ื–ื™ื™ืŸ ื’ืื ืฅ ื‘ืฉืœื™ืžื•ืช, everything will be ื‘ืฉืœื™ืžื•ืช. Because ืžืกืคืจ ื™ืžื™ืš ืืžืœื, that you count the days and ืžืžื™ืœื ื“ืขืจ ืื•ื™ื‘ืขืจืฉื˜ืขืจ promises, "I will fill your days." Now what does it got to do to before? We said before that the guy's a ืžื•ื“ื” ื‘ืžืงืฆืช. ืžื•ื“ื” ื‘ืžืงืฆืช means that he admits that a little bit he he's in the in the hands of the yetzer hara. The yetzer hara wants to schlepp him completely. To get rid of that not that shouldn't happen, he has to swear. What for does he has to swear? To give him extra kochos. But extra kochos is a problem because what happens if you don't use it? You're wasting even more. So the eitzah

Shachโ€™s Rule on Swearing with Cheap Assets

not to swear, according to the Shach is if you ื˜ืขื ื”'ื˜, which means that the ืžืฆื‘ is that your ื ื›ืกื™ื are cheap. Meaning, ื“ืืก ืื™ื– ืื•ื™ืš ื“ืขืจ ื‘ื™ืื•ืจ ืคื ื™ืžื™ in der halachah. You don't get the ืฉื‘ื•ืขื” and there's another way to make sure that you don't get schlepped into the yetzer hara. What is it? It's like this. What does it mean? ื“ื™ ื™ืืจืŸ ืื•ืŸ ื›ื—ื•ืช ื•ื•ืืก ื“ืขืจ ืื•ื™ื‘ืขืจืฉื˜ืขืจ ื’ื™ื˜ ื ื™ื™ื“ืŸ ื“ื•ืจื›ืฆื•ืคื™ืจืŸ ื–ื™ื™ืŸ ืฉืœื™ื—ื•ืช ื‘ืขืœืžื ื“ื“ื™ืŸ, the days, the years and the kochos the ืื•ื™ื‘ืขืจืฉื˜ืขืจ gives a ื™ื™ื“ to fulfill his shlichus in this world, ื“ืืก ื–ื™ื™ื ืขืŸ ื“ื™ ื ื›ืกื™ื ืคื•ืŸ ื ื™ื™ื“ืŸ. So, what he's saying is if a ื™ื™ื“ is a ืžื•ื“ื” ื‘ืžืงืฆืช, so what is the eitzah how to make sure that you don't get schlepped in more? Very simple. Work yourself up to become battel to the Eibershter completely. Alternative Avodah Replaces Special Powers

Not only that, the bad part will also be changed over. So normally you have to swear, you get special koachot, he says, but instead of giving you special koachot there's an avodah you could do. I don't know which one is harder. This avodah is a hard avodah too. But could be this is not so hard. It's it's it's hard to reach it, but it's it's not madregot, it's just like a like an ืื™ืฉ ืคืฉื•ื˜ has a bitul to the Eibershter completely. Basically become an ืื™ืฉ ืคืฉื•ื˜. If you become an ืื™ืฉ ืคืฉื•ื˜ completely ibergegeben to the Eibershter, then the yetzer hara has nothing to say, and you don't need to have special koachot and special things, then you're guaranteed that you won't fall into the trap. What if you're already in the trap? No, he said you're in the trap. That's why you're a ืžื•ื“ื” ื‘ืžืงืฆืช. You're in the trap, so that's why you admit to the yetzer hara, "Yes, you're right. I'm I'm in the trap." So the yetzer hara wants to schlepp him more. So in order to make sure, when you realize that and you want to make sure it doesn't schlepp you, start thinking yourself that you're battel.
