Tumah vs Asur: Niddah and Mikveh Issues

could be tamei and not asur, or asur and not tamei? Not now, I'm saying basically, not not now, that No, why? She's still temeah. We have tumah now. Ela mai we can't get rid of it, so we can't apply it. But we are temei, and this makes it טומאת נדה. If it makes it טומאת נדה, then that makes it asur. So she goes to the mikveh she just takes away the tumah. She can't take away טומאת מת she can't take away, because we have no פרה אדומה. That's all. So the tumah is there, huh? No, it takes away the tumah also. But you're tamei for other reasons. Why should a woman be temeah and not asurah? Can it be a woman being a נדה לגבי טומאה she has a din of a niddah, and in those days when there was a דין טומאה and she touched something it's tamei, but she wasn't אסורה לבעלה? Forget But now when she goes to the mikveh that's a mikveh that would be מכשיר her for for for tumah of course, for sure. Yeah. No, not for טומאת מת. We're all טמאי מת. No, but it takes away טומאת נדה. Oh, it takes away Yeah, she takes away the טומאת נדה, טומאת נדה is a separate tumah. כל אלו אבות הטומאה, נדה is an No. No, טומאת מת is an אב הטומאה. מת, yeah. And niddah is not Okay, to live like that, yeah, it's not not. You said this was Rabbi Akiva Eiger? Rabbi Yosef Engel. Rabbi Yosef Engel?

Safek in Niddah: Gemara and Tosafot Analysis

Did he answer? He says that He has a chakirah there. Look at that! He has a chakirah. And he brings a re'ayah. He brings a re'ayah from a Gemara, it's a long a long piece, but The Gemara asks Which Gemara? Gemara in in Bava Kama. The Gemara says, the Gemara says a case, whatever the case is, that we know a din, there's a chiluk between a safek, by a case of a niddah between a safek and a safek sfeika. Safek is mutar it says in the Gemara? If there's a safek he's asur, and a safek sfeika is mutar. If it's a safek that she's a niddah or not, she has a din of a niddah, if it's a safek Now, Tosafos ask a kashya, by טומאה there's a klal: ספק טומאה ברשות היחיד טמא, אפילו if it's a safek sfeika. ספק טומאה ברשות הרבים is טהור אפילו one safek. So when is this case that this niddah if one safek it's okay, it's not okay and two sfeikot is okay? What is it? Is it ברשות היחיד, then even a safek sfeika should be If if it's not So Tosafos answers: לגבי איסור. לגבי איסור, so it comes out like this: imagine let's say this is a safek sfeika in a רשות היחיד. Asur. And she's טמאה because לגבי טומאה even a safek sfeika, but לגבי איסור ספק ספיקא is mutar. So this would be a woman that she'll be teme'ah, and she'll be מותרת לבעלה. What happens opposite? If it's one safek in a רשות הרבים, לגבי טומאה it's mutar, because רשות הרבים is always mutar, but לגבי איסור it's asur, because one safek is always asur. So from that he brings a ra'ayah that they're two separate ענינים. And the Rabbi brings it, the Rabbi says he holds also that way, that it's they are two separate ענינים. Okay, vayter. Tanina it says in a in a ברייתא, לגבי a certain pasuk it says

Gideon's Idol: The Z'vuv Cult Explained

after Gideon had the war and and he made the Yidden do teshuvah, but then after he after he died, they became again וישימו להם בעל ברית לאלהים. They became like allies to the avodah zarah. So which avodah zarah was it? זבוב. זבוב בעל עקרון, name of avodah zarah. And what did they do? Melamed it means, שכל אחד ואחד עשה דמות יראתו, everyone make like an image of his עבודה זרה, ומניחה בתוך כיסו, he held it in the pocket. כיון שזכר, the moment you remind yourself about it, מוציאה מתוך כיסו, you take it out of your pocket, ומחבקה ומנשקה, hug it and kiss it. That's how meshuga they were. That's crazy! Sheer avodah zarah. It's the same thing with today, they go and They don't They don't think that whatever is their god, that's the symbol of it. But this this was their god, they had their god in the, yeah, their god in the pocket! You know, when when I was in China, so they have, I saw over there, I said, \"What is your god?\" So I saw over there like three pieces of stone from the sea. It was over there like in a museum, and they worshipped it. Yes, they said this is our god. How crazy can one get? Yeah, in Japan, in Tokyo. Everybody had the same one or everybody had their own? No, it's like a temple, you know, in this in the temple they have In the temple they have these three, and I and and I asked, \"What is your god?\" He said, \"Here.\" \"This is your god.\" That's crazy! והם משתחוים לזה? They make ketoret. You know, big things. Like a Buddha, okay, it's not a rock, so it's a, unless that's a different special No, that's not a they don't think that's their god. Yeah. A statue, no? Yeah, it's just a symbol, a likeness. But it used to it used to be it used to be in the older days in the older days when people used to worship avodah zarah, it used to come true, and that was the whole nisayon of it. People used to daven to a rock that they have a success, and Hashem used to make a person successful, and that was a whole כח הטומאה, it was a כח הטומאה. כח טומאה, הא? לא, ש And then Hashem took out, and then we took the, the רבנן took out, they made a, they took out the the נסיון from עבודה זרה. That's why barely anyone does it anymore. Yeah, so you have these cults like, you know, cults with, uh, In in in China that they don't, they don't think the statue itself, it's just, it's just a statue of the the Buddha. Look at how No, in this case it's in Okay,

Why the Jordan River Ship Is Considered Tumah

אמר רבי חנינא בן עקביא, עקביא says, מפני מה אמרו ספינת הירדן טמאה? Why did they say that a ship that's taken to the Yarden is tamei? So, what it is it is the Gemara brings out a the inyan can bring out a small piece. It says bichlal, a ספינה is not מקבל טומאה, because in order to מקבל טומאה it has to be something that you could carry it when it's full or when it's empty. So if it's a כלי, if you can't carry it like that, then it's not a כלי, then it's not. ספינת הירדן should be the same. It's a ספינה, and a ספינה, when you load it up, you can't carry it, mimela, it's missing one of the conditions of being able to מקבל טומאה. Why did the chachamim say this? They can't pick it up? Yeah, it's too heavy? Too heavy, לכובדו. So, why is this? Yeah, so he says, מפני שטוענין אותה ביבשה ומורידין אותה למים, because they load it because it's attached to the ground. In the sense what we said, no, it's attached to the ground. It becomes heavy, so mimela it's not a כלי. So you can't take it out of the water, the water is attached to the ground. That's because it's מחובר לקרקע. No, no. Anything that floats, you could say the same thing, it's not true. Yeah. טוענין ביבשה No, so here he says the reason is because these were small ones that they would load on dry land, ומורידין אותה, and they would pick it up and put it into the water. A boat that is smaller, if it's smaller, that's why it's מקבל טומאה. It's like a canoe. Yeah, yeah. It's a כלי. Huh? Mimela it's a כלי, ממילא it's a כלי. So,

Never Miss a Shiur: Learning as Lifeline

אמר רב יהודה אמר רב, said רב, לעולם אל ימנע אדם את עצמו מבית המדרש, אפילו שעה אחת. You should never stay away from the from the shiur, from the yeshiva, from the learning, even once, even one time. Why? שהרי כמה שנים נשנית משנה זו בבית המדרש, for many years this was a Mishnah learned in the Beit Midrash, this din that ספינת הירדן is מקבל טומאה, ולא נתגלה טעמה, we didn't know the reason, עד שבא רבי חנינא בן עקביא ופירשה, until Rabbi Chanina ben Akavia came. Had the guy missed, punkt that day, he would not know because no one knew the reason. And here, punkt, he gets So you never know what kind of chiddushim you're going to hear when you come, so you got to come. Yeah. That's what I'm saying. What chiddush? The chiddush, the pshat of this דין. No, he says a person should never miss a shiur. Why? Because here's an example: here's a דין that the ספינת הירדן is מקבל טומאה, and no one knew the reason. And punkt one day they explained it in yeshiva, Rabbi Chanina. That means that if a person would miss that one day, he wouldn't know the reason. So that means that every day you have to go. You have to come, you don't miss even one, because you never know what kind of Giving us his advice. Good advice, yeah. the importance of It's mevarer the halacha. finding the halacha. But no, it's mevarer, it's mevarer the halacha.

Uncovering Halacha: Mevarah and Its Significance

Otherwise it's in קליפות, the reason for the halacha is Because otherwise, if you don't know the reason, and the halacha is not clear, and it says this halacha is kept in captivity, in the קליפות. The fact that it's not clear, that's העלם והסתר. And when you mevarer it, you look through it and you come to a decision, and you mevarer, you're taking it out from its captivity, the halacha. Yeah. ספינת הירדן, it means on the ירדן? Yeah, it means the ירדן. The ירדן, that's the river. Yeah. No, those not. Those not, those are too big. And those are too, not מקבל טומאה. אמר רבי יונתן, רבי יונתן says, לעולם אל ימנע אדם עצמו, את עצמו מבית המדרש ומדברי תורה, a person should never stay away from the beit midrash, never stay away from תורה, אפילו בשעת מיתה, even when he's dying. שנאמר, it says, זאת התורה אדם כי ימות באהל. This is the Torah, a person dying in a tent. אפילו בשעת מיתה תהא עוסק בתורה. Even when you're dying, as long as obviously you can, you should learn Torah. We find like so many tzadikim that they when they were dying they they were just involved in Torah, they were saying Torah, they were saying Torah. What does it mean in chasidut the pshat of the אוהל? Dies in a tent? Yeah, you mean the next thing, that a person should kill should die over the Torah. אמר ריש לקיש: אין דברי תורה מתקיימין אלא במי שממית עצמו עליה. Torah doesn't stay only unless a person kills himself for it, meaning puts his life completely into it. שנאמר the same pasuk: זאת התורה, this is how you have the תורה, אדם כי ימות באהל, you have to die in the tent, and you have to put yourself over completely to learn. Then the Torah stays. What does it mean? It means it doesn't stay. You don't remember it, and it doesn't, and it's not only don't remember it, it doesn't penetrate into you, it doesn't become part of you. Yeah. כי ימות באהל Ah. Doesn't mean that it has to be all day. You could learn for 5 minutes, but you're totally given over, yeah. Why did you say so many people? שממית עצמו עליה means he kills himself like What we're doing it right now? Everything, like Dead. Yeah, yeah. Remember the Rebbe once said, I mean, he should Imagine how is it possible, live like Shabbos. Phone rings, don't think of answering. Same thing when you're learning, don't don't think of answering. Out of sight, out of mind, out of Right. So, the

Do Not Move Your Neighbor's Boundary: Hasagat Gevul

גמרא, אמר רבי חייא בר אבא אמר רבי יוחנן, רבי יוחנן, מאי דכתיב, it says, לא תסיג גבול רעך, do not move over the גבול, the border of your friend, אשר גבלו ראשונים, that the original Rishonim made. Now pashut pshat of it means hasagat gevul. Now the real pashut pshat of hasagat gevul is let's say you have, you're two neighbors and this is my חלק, this is your חלק, and there's a fence in between. At night when you're sleeping, I can go over and move my f- move the fence over. You won't know the difference. Tomorrow you wake up, you don't know, so I stole some parts from you. That's the taytsh pashut. But here it says different things. From that we got the word, the idea of that if you take away someone's business, you call hasagat gevul. Same idea. But here the pasuk says do not be מסיג גבול, do not take away the border, אשר גבלו ראשונים, that the Rishonim made. So he says גבול שגבלו ראשונים לא תסיג. That גבול that they made, the Rishonim made up, don't take that away. What is that? מאי גבלו ראשונים? What did the Rishonim In other words, who are the Rishonim that we're talking about that they made?

Seir's Descendants: Land Knowledge and Halachic Boundaries

אמר רב שמואל בר נחמני אמר רבי יוחנן, כתיב it says like this, אלה בני שעיר החרי ישבי הארץ. These are the In in in in Vayishlach is it? These are the children of Seir Hachori that live in the earth. אטו כולי עלמא יתבי ברקיעא נינהו? Whoever knows who's in the sky? Seir is Esav. אלא when it says ישבי הארץ means שהיו בקיאין בישובה של ארץ. They were so well well-versed in in in the in the ground. שהיו אומרים, they were saying מלא קנה זה לזית. They would look at a piece of land like that and they would say oh, this is good for olives. מלא קנה זה לגפנים, this is good for grapes. מלא קנה זה לתאנה, this is good for figs. That's טייטש ישבי הארץ. חרי, what is טייטש חרי? שמריחין את הארץ. These are people who would smell. They would feel the sand and smell it, oh this is good for this. Good farmers. Yeah, they were very They were mamash gevaldig in this. וחוי, it says חוי, אמר רב פפא שהיו טועמין את הארץ כחוי, they would taste the ground like a snake. A snake eats earth, they would take it in their mouth. Rabbi Acha bar Yaakov אמר, Rabbi Acha says חרי means שנעשו בני חורין מנכסיהן, a different reason. The testers? Yeah, the testers. חרי means what's חרי? They were free. These people were chased out of their lands, mimeila they were free of working on their lands. Whatever, but the bottom line what he's trying to say here, here we have a group of people that were so baki in in the ground. מה זה חורין? They're lost in the shame. They lost their money? Not the money, they lost their They were kicked out of their country. They lost their land, so they're free from the land. But what he's trying to say here is, so here you have people who are so baki, and therefore these people, what they knew is how far you have to stay away from somebody else. If he has something growing, how far you have to move away on your side so it shouldn't interfere with that יניקה. That's what he says. So not on, this is not an halacha, that's halacha. We're talking about taking away the person's One second, one second. So this is what he's saying. When the פסוק לא תסיג גבול, they made up they knew exactly to tell you that if this guy's growing olives, on your side you better stay away five inches. In another place So what the pasuk is telling you, you can't change that. These are called the rishonim, the earlier generations who knew what to decide. Whatever they decided in how far you have to move, don't be מסיג גבול, don't move that. What about fruit that come to my side? Fruit, mango, that of my neighbor, come to mine. It's mine or his? Yours. Yours. Mine. Whatever my my tree go to him, is his. Yeah, that's both ways. Now is it a reshut if you don't like or does it have to be is it a strong halacha? In other words, with derech eretz you don't have to take it. What? But you can take it. What? The fruit that's on your side. You can. You can, I said you can, but you don't have to. In other words Why would you have to? I'm saying derech eretz you might you know, it's his tree, you might accepted their decision Yeah, because they were right! They knew what they were doing! and applied it to kilayim, because now they knew how the things were too close together that they clambered over. Yeah, yeah, yeah. So these who the the descendants of Esav kicked They weren't They weren't Right, right, right. The pesukim say that they kicked them out. There's what? They're not going to fix this, right? I don't know, but It's common already. There's what? Yeah. A big leak. It's just a hole. Yeah, in the hallway right here. I've seen it before, yeah. Last time it rained. You
