Intro to Horayot Tractate and Scope

Jewish audio on Chabad.org. Today's ืฉื™ืขื•ืจ will be in ืžืกื›ืช ื”ื•ืจื™ื•ืช ื“ืฃ ื–', but we'll start on ื“ืฃ ื•' ืขืžื•ื“ ื‘' from the beginning of the ืคืจืง. In this ืคืจืง, the ื’ืžืจื will discuss, in addition to the ื“ื™ื ื™ื of ื”ื•ืจืืช ื‘ื™ืช ื“ื™ืŸ, if the ื‘ื™ืช ื“ื™ืŸ ืคืกืง'ื ื“ that you're allowed to do an ืขื‘ื™ืจื”, and then the people followed the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ, so then there is a ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, and if it was concerning ืขื‘ื•ื“ื” ื–ืจื”, so then they bring a ืคืจ and a ืฉืขื™ืจ for a ื—ื˜ืืช and an ืขื•ืœื”. In addition to that, this will also discuss the ื“ื™ื ื™ื of a ื›ื”ืŸ ื’ื“ื•ืœ, or as he is referred to here in this ืคืจืง as ื›ื”ืŸ ืžืฉื™ื—, because the ื“ื™ืŸ is that a ื›ื”ืŸ ื’ื“ื•ืœ, when he does an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, which means also an ืขื‘ื™ืจื” that if he would have done it ื‘ืžื–ื™ื“, he would have gotten ื›ืจืช, so then he also has to bring a special ืงืจื‘ืŸ. Not like a ื™ื—ื™ื“, an individual, when he does an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, he has to bring a ื›ืฉื‘ื” or a ืฉืขื™ืจื”, but a ื›ื”ืŸ ื’ื“ื•ืœ, if he does an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, he has to bring a ืคืจ. The same ืงืจื‘ืŸ as the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. So just like when the ื‘ื™ืช ื“ื™ืŸ ืคืกืง'ื ื“ and the ืฆื™ื‘ื•ืจ did, so then there is a ื“ื™ืŸ of a ืคืจ, so too, when the ื›ื”ืŸ ื’ื“ื•ืœ did an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, there is a ื“ื™ืŸ of a ืคืจ. In this ืคืจืง, we also discuss the ืงืจื‘ืŸ of a ื ืฉื™ื, which really means a ืžืœืš, that if a king does an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, there is also a special ืงืจื‘ืŸ that he has to bring, not like the ืงืจื‘ืŸ of a ื™ื—ื™ื“. He brings a special ืงืจื‘ืŸ, a ืฉืขื™ืจ. And in this ืคืจืง, we're going to discuss the ื“ื™ื ื™ื of a ื›ื”ืŸ ื’ื“ื•ืœ bringing his ืงืจื‘ืŸ, and of a ื ืฉื™ื bringing his ืงืจื‘ืŸ, and of a ื™ื—ื™ื“ bringing his ืงืจื‘ืŸ. Now,

When the Kohen Gadol Must Bring a Par

one of the ื“ื™ื ื™ื concerning a ื›ื”ืŸ ื’ื“ื•ืœ is that just like concerning ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, the ื“ื™ืŸ is that when do you bring this ืงืจื‘ืŸ? Only if this came after a ื”ื•ืจืื”, after ื‘ื™ืช ื“ื™ืŸ ืคืกืง'ื ื“ by mistake that you're allowed to do the ืขื‘ื™ืจื”, and based on that ืคืกืง ื“ื™ืŸ the people did it, that's when you bring the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, concerning a ื›ื”ืŸ ื’ื“ื•ืœ, it's the same thing: that first there has to be a ืคืกืง ื“ื™ืŸ, he has to ืคืกืง'ืŸ for himself that it's ืžื•ืชืจ, then, if he followed his own ืคืกืง ื“ื™ืŸ, there is a ื“ื™ืŸ of a ืคืจ of the ื›ื”ืŸ ื’ื“ื•ืœ. But if it was done without a ืคืกืง ื“ื™ืŸ, if the ื›ื”ืŸ ื’ื“ื•ืœ just ื‘ืฉื•ื’ื’ did an ืขื‘ื™ืจื”, so then he brings no ืงืจื‘ืŸ at all. Not like a ื™ื—ื™ื“ that brings a ืงืจื‘ืŸ just for the ืฉื’ื’ืช ืžืขืฉื”, just for doing the ืžืขืฉื”, the act ื‘ืฉื•ื’ื’, but a ื›ื”ืŸ ื’ื“ื•ืœ has to bring a ืงืจื‘ืŸ only if it was ืฉื’ื’ืช ืžืขืฉื” that came after ื”ื•ืจืื”, after a ืคืกืง ื“ื™ืŸ. And this is what the ืžืฉื ื” here is going to discuss. And the ืžืฉื ื” starts: ื”ื•ืจื” ื›ื”ืŸ ืžืฉื™ื— ืœืขืฆืžื•, if the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืง'ื ื“ to himself ื‘ืฉื•ื’ื’, by mistake, he ืคืกืง'ื ื“ a certain ื“ื™ืŸ wrong, by mistake, ื•ืขืฉื” ืฉื•ื’ื’, and then he did the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, because of his ืคืกืง ื“ื™ืŸ, ืžื‘ื™ื ืคืจ, so he brings this special ืงืจื‘ืŸ ื—ื˜ืืช, which is a ืคืจ.

Intentional vs Mistaken Rulings and Exemption

ืฉื•ื’ื’ ื•ืขืฉื” ืžื–ื™ื“, if he ืคืกืง'ื ื“ ื‘ืฉื•ื’ื’, he made a mistake in his ืคืกืง ื“ื™ืŸ and he ืคืกืง'ื ื“ you're allowed to do the ืขื‘ื™ืจื”, and he did that ื‘ืฉื•ื’ื’, but when it came to do the ืขื‘ื™ืจื”, he did it ื‘ืžื–ื™ื“, ืื• ืžื–ื™ื“ ื•ืขืฉื” ืฉื•ื’ื’, or he ืคืกืง'ื ื“ the ื“ื™ืŸ wrong ื‘ืžื–ื™ื“, and he did the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, that could be ืคืกืง'ื ื“ intentionally wrong, but when it came to do it, he didn't do it because of his ืคืกืง ื“ื™ืŸ, he did it intentionally, knowing that it was wrong, and he just did it, ืคื˜ื•ืจ, then he is ืคื˜ื•ืจ from any ืงืจื‘ืŸ. He doesn't bring his ืงืจื‘ืŸ ืคืจ, because the ืคืจ is only brought if there was ืฉื’ื’ืช ื”ื•ืจืื” and ืฉื’ื’ืช ืžืขืฉื”. He made a mistake in the ืคืกืง ื“ื™ืŸ, and then he made a mistake in the ืžืขืฉื”. But if one of the two were ื‘ืžื–ื™ื“, he doesn't bring his ืคืจ. He also doesn't bring the regular ืงืจื‘ืŸ ื—ื˜ืืช of a ื™ื—ื™ื“, because we know that a ื›ื”ืŸ ื’ื“ื•ืœ never brings the regular ืงืจื‘ืŸ ื—ื˜ืืช of a ื™ื—ื™ื“. So, therefore, in this case, he would bring no ืงืจื‘ืŸ at all. And the ืžืฉื ื” explains, ืฉื”ื•ืจืืช ื›ื”ืŸ ืžืฉื™ื— ืœืขืฆืžื• ื›ื”ื•ืจืืช ื‘ื™ืช ื“ื™ืŸ ืœืฆื™ื‘ื•ืจ, because the ื“ื™ืŸ of ื”ื•ืจืืช ื›ื”ืŸ ืžืฉื™ื— for himself, the ื“ื™ืŸ of the ืคืกืง ื“ื™ืŸ of the ื›ื”ืŸ ื’ื“ื•ืœ for himself has the same ื“ื™ืŸ as the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ for the ืฆื™ื‘ื•ืจ. Just like in the case of the ืฆื™ื‘ื•ืจ, when will there be a ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ? Only if they had both: there was ื”ื•ืจืืช ื‘ื™ืช ื“ื™ืŸ ื‘ืฉื•ื’ื’, and there was the ืฉื’ื’ืช ืžืขืฉื” ื‘ืฉื•ื’ื’, and it has to be both. The same with a ื›ื”ืŸ ื’ื“ื•ืœ, when does he bring that ืงืจื‘ืŸ ืคืจ? Only if there were both: he ืคืกืง'ื ื“ for himself ื‘ืฉื•ื’ื’, and then, based on that, he did the ืžืขืฉื” ื‘ืฉื•ื’ื’. But if one of the two was ื‘ืžื–ื™ื“, then he doesn't bring this ืงืจื‘ืŸ. But there is a difference between the ื“ื™ืŸ of a ื›ื”ืŸ ื’ื“ื•ืœ and the ื“ื™ืŸ of the ืฆื™ื‘ื•ืจ. By the ื“ื™ืŸ of the ืฆื™ื‘ื•ืจ, if there wasn't ื”ื•ืจืื”, but there was just ืฉื’ื’ืช ืžืขืฉื” of the people, they would have to bring their own personal ืงืจื‘ืŸ ื—ื˜ืืช. But by a ื›ื”ืŸ ื’ื“ื•ืœ, if there wasn't the ื”ื•ืจืื”, there was just ืฉื’ื’ืช ืžืขืฉื”, so then he doesn't bring a ืงืจื‘ืŸ at all. As the ื’ืžืจื later learns out from the ืคืกื•ืง, ืžืขื ื”ืืจืฅ, so this comes to exclude the ื›ื”ืŸ ืžืฉื™ื—, because by the ืงืจื‘ืŸ ื—ื˜ืืช the ืคืกื•ืง says that if a person ืžืขื ื”ืืจืฅ, from the people of the land, from the nation of the land will do an ืขื‘ื™ืจื”, he brings that personal private ืงืจื‘ืŸ ื—ื˜ืืช. So from the words ืžืขื ื”ืืจืฅ, we ื“ืจืฉ'ืŸ that only if it was a simple person, an ordinary person, but if it was a ื›ื”ืŸ ืžืฉื™ื—, the ื›ื”ืŸ ื’ื“ื•ืœ doesn't bring ever that ืงืจื‘ืŸ ื—ื˜ืืช of a ื™ื—ื™ื“. And therefore, if the way it happened was that it doesn't fit to the conditions of his special ืคืจ, so he doesn't bring any ืงืจื‘ืŸ, because the regular ืงืจื‘ืŸ ื—ื˜ืืช of a ื™ื—ื™ื“ he doesn't bring ever. And the ื’ืžืจื says: ืฉื•ื’ื’ ื•ืขืฉื” ืฉื•ื’ื’ ืžื‘ื™ื ืคืจ, ืคืฉื™ื˜ื. The ืžืฉื ื”'s first ื“ื™ืŸ was that if the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืงื 'ื“ for himself ื‘ืฉื•ื’ื’, and then he did the ืžืขืฉื” based on that ืคืกืง ื“ื™ืŸ ื‘ืฉื•ื’ื’, so he brings his ืงืจื‘ืŸ, which is a ืคืจ, ืคืฉื™ื˜ื. That is, in fact, that is the regular ื“ื™ืŸ of the ืคืจ of the ื›ื”ืŸ ื’ื“ื•ืœ. ืืžืจ ืื‘ื™ื™, ืื‘ื™ื™ said: ื”ื›ื ื‘ืžืื™ ืขืกืงื™ื ืŸ, here we're talking in a case, ื›ื’ื•ืŸ, for instance, ืฉื”ื•ืจื”, that he ืคืกืงื 'ื“ for himself a certain ืขื‘ื™ืจื” is allowed, ื•ืฉื›ื— ืžืื™ื–ื” ื˜ืขื ื”ื•ืจื”, and he forgot for what reason he ืคืกืงื 'ื“, and then he went along and did that ืขื‘ื™ืจื”, ื•ื‘ืฉืขืช ืขืฉื™ื”, and when he did that ืขื‘ื™ืจื”, ืืžืจ, he said: ื”ืจื™ื ื™ ืขื•ืฉื” ืขืœ ื“ืขืช ื”ื•ืจืืชื™, I am doing this act on the ื“ืขืช of my ืคืกืง ื“ื™ืŸ, because I ืคืกืงื 'ื“ before that this is allowed, that's why I am doing this. ืžื”ื• ื“ืชื™ืžื, I would think, ื›ื™ื•ืŸ ื“ืื™ืœื• ืื™ื“ื›ืจื™ื”, maybe if he would have remembered his reason that he gave before why he ืคืกืงื 'ื“ that it is ืžื•ืชืจ, ืฉืžื ื”ื“ืจ ื‘ื™ื”, he might have changed his mind, and the only reason he did the act now because of his ืคืกืง ื“ื™ืŸ was because he didn't remember the reason that he ืคืกืงื 'ื“. So I would think ื›-ืžื–ื™ื“ ื“ืžื™, it is considered like ืžื–ื™ื“, ื•ืœื ืœื—ื™ื™ื‘, he shouldn't have to bring this ืงืจื‘ืŸ. ืงื ืžืฉืžืข ืœืŸ, the ืžืฉื ื” comes to tell us, that nevertheless, it is still ืฉื•ื’ื’. And since earlier he ืคืกืงื 'ื“ ื‘ืฉื•ื’ื’, and when he did the ืžืขืฉื”, it was ื‘ืฉื•ื’ื’ based on his ืคืกืง ื“ื™ืŸ, so even though at that time he didn't remember the reason, nevertheless, he is ื—ื™ื™ื‘ this ืงืจื‘ืŸ, and we do not say that since he didn't remember it should be considered ืžื–ื™ื“ because maybe if he would have remembered now he would have realized it was wrong. Nevertheless, we say it is still ืฉื•ื’ื’, and he does bring his ืงืจื‘ืŸ ื—ื˜ืืช. Then the ื’ืžืจื continues, it says in the ืžืฉื ื”: ืžื–ื™ื“ ื•ืขืฉื” ืฉื•ื’ื’ ื•ื›ื•ืœื™, if he ืคืกืงื 'ื“ wrongly ื‘ืžื–ื™ื“, but then he did the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, so the ื“ื™ืŸ is that he is ืคื˜ื•ืจ. The ื’ืžืจื says: ืžื ื ื”ื ื™ ืžื™ืœื™? How do we know this ื“ื™ืŸ? ืชื ื• ืจื‘ื ืŸ, because the ืจื‘ื ืŸ learned: The ืคืกื•ืง says: ืœืืฉืžืช ื”ืขื. This is the ืคืกื•ืง in ืคืจืฉืช ื•ื™ืงืจื, ืคืจืง ื“, ืคืกื•ืง ื’, and this is the ืคืกื•ืง that starts with the ื“ื™ืŸ of the special ืงืจื‘ืŸ of the ื›ื”ืŸ ื’ื“ื•ืœ, and the ืคืกื•ืง starts: ืื ื”ื›ื”ืŸ ื”ืžืฉื™ื— ื™ื—ื˜ื, if the ื›ื”ืŸ who is anointed, which means the ื›ื”ืŸ ื’ื“ื•ืœ, would sin, ืœืืฉืžืช ื”ืขื, for the sin of the nation, and the ืคืกื•ืง continues: ื•ื”ืงืจื™ื‘ ืขืœ ื—ื˜ืืชื• ืืฉืจ ื—ื˜ื ืคืจ ื‘ืŸ ื‘ืงืจ ืชืžื™ื ืœื”' ืœื—ื˜ืืช, he will have to bring for his ื—ื˜ืืช a ืคืจ ื‘ืŸ ื‘ืงืจ for ื”'. So the ืคืกื•ืง says concerning the ื›ื”ืŸ ื’ื“ื•ืœ: ืœืืฉืžืช ื”ืขื, to the ืขื‘ื™ืจื” of the nation, what does the ืคืกื•ืง mean with that? ื”ืจื™ ืžืฉื™ื— ื›ืฆื™ื‘ื•ืจ, to tell us that this ื›ื”ืŸ ืžืฉื™ื—, the ื›ื”ืŸ ื’ื“ื•ืœ, has the same ื“ื™ืŸ as the ืขื, as the ืฆื™ื‘ื•ืจ. And therefore, just like by the ืฆื™ื‘ื•ืจ the ื“ื™ืŸ is that if the ื‘ื™ืช ื“ื™ืŸ ืคืกืงื 'ื“ ื‘ืฉื•ื’ื’, and then the people followed the ืคืกืง ื“ื™ืŸ ื‘ืฉื•ื’ื’, that's when you bring the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. But if the ื‘ื™ืช ื“ื™ืŸ ืคืกืงื 'ื“ ื‘ืžื–ื™ื“, and the people did it ื‘ืฉื•ื’ื’, then there is no ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. The same is concerning the ื›ื”ืŸ ื’ื“ื•ืœ, that if he ืคืกืงื 'ื“ for himself ื‘ืžื–ื™ื“, and then he did it ื‘ืฉื•ื’ื’, he doesn't bring this ืคืจ ื›ื”ืŸ ืžืฉื™ื—. And the ื’ืžืจื continues: ื•ื”ืœื ื“ื™ืŸ ื”ื•ื, but ื‘ืืžืช, why do we need the ืคืกื•ืง to learn this out? There is a ืกื‘ืจื to say that a ื›ื”ืŸ ื’ื“ื•ืœ has the same ื“ื™ืŸ as a ืฆื™ื‘ื•ืจ. Because we see that ื›ื”ืŸ ื’ื“ื•ืœ and ืฆื™ื‘ื•ืจ are similar: ืฆื™ื‘ื•ืจ ืžื•ืฆื ืžื›ืœืœ ื™ื—ื™ื“, the ืงืจื‘ืŸ of a ืฆื™ื‘ื•ืจ is excluded from a ื™ื—ื™ื“, that if a ืฆื™ื‘ื•ืจ did an ืขื‘ื™ืจื” they bring a different ืงืจื‘ืŸ than if a ื™ื—ื™ื“ did an ืขื‘ื™ืจื”, ื•ืžืฉื™ื— ืžื•ืฆื ืžื›ืœืœ ื™ื—ื™ื“, and the ื›ื”ืŸ ืžืฉื™ื—, the ื›ื”ืŸ ื’ื“ื•ืœ is also excluded from the ื™ื—ื™ื“, he also has a special ืงืจื‘ืŸ, not the same ืงืจื‘ืŸ as a ื™ื—ื™ื“. So we compare the two and say: ืžื” ืฆื™ื‘ื•ืจ ืื™ื ื• ื—ื™ื™ื‘ ืืœื ืขืœ ื”ืขืœื ื“ื‘ืจ ืขื ืฉื’ื’ืช ืžืขืฉื”, that just like a ืฆื™ื‘ื•ืจ is not ื—ื™ื™ื‘ the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ only if there was ื”ืขืœื ื“ื‘ืจ, which means ื‘ื™ืช ื“ื™ืŸ ืคืกืงื 'ื“ wrong by mistake, and then with that came along the ืฉื’ื’ืช ืžืขืฉื”, that the people did the ืขื‘ื™ืจื” based on this ืคืกืง ื“ื™ืŸ ื‘ืฉื•ื’ื’, ืืฃ ืžืฉื™ื—, so too, the ื›ื”ืŸ ื’ื“ื•ืœ, ืœื ื™ื”ื ื—ื™ื™ื‘, he shouldn't be ื—ื™ื™ื‘ ืืœื ืขืœ ื”ืขืœื ื“ื‘ืจ ืขื ืฉื’ื’ืช ืžืขืฉื”, only if there was first ื”ืขืœื ื“ื‘ืจ, he ืคืกืงื 'ื“ for himself wrong ื‘ืฉื•ื’ื’, and then there was ืฉื’ื’ืช ืžืขืฉื”, he did the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’ based on his ืคืกืง ื“ื™ืŸ. So really, we don't need the ืคืกื•ืง 'ืœืืฉืžืช ื”ืขื' to tell us that the ื›ื”ืŸ ื’ื“ื•ืœ has the same ื“ื™ืŸ as a ืฆื™ื‘ื•ืจ, that if he ืคืกืงื 'ื“ ื‘ืžื–ื™ื“ wrong, so then there would be no ืงืจื‘ืŸ of ืคืจ ื›ื”ืŸ ืžืฉื™ื—, because we would learn it out by comparing it to the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. ืื• ื›ืœืš ืœื“ืจืš ื–ื•, but ื‘ืืžืช we could go to a different way, which means that we don't necessarily have to say ืขืœ ืคื™ ืกื‘ืจื that a ื›ื”ืŸ ื’ื“ื•ืœ would have the same ื“ื™ืŸ as a ืฆื™ื‘ื•ืจ. Maybe he wouldn't have the same ื“ื™ืŸ as a ืฆื™ื‘ื•ืจ. Why? We would be able to compare it to something else: We'd say ื ืฉื™ื ืžื•ืฆื ืžื›ืœืœ ื™ื—ื™ื“, a ื ืฉื™ื, which is a king, also is excluded from the ื™ื—ื™ื“, which means if a ื ืฉื™ื does the ืขื‘ื™ืจื”, he also has a different ืงืจื‘ืŸ than a ื™ื—ื™ื“, ื•ืžืฉื™ื— ืžื•ืฆื ืžื›ืœืœ ื™ื—ื™ื“, and the ื›ื”ืŸ ื’ื“ื•ืœ is excluded from the ื™ื—ื™ื“, so let's compare the ื›ื”ืŸ ืžืฉื™ื— to the ื ืฉื™ื, and say ืžื” ื ืฉื™ื ืžื™ื™ืชื™ ื‘ืฉื’ื’ืช ืžืขืฉื” ื‘ืœื ื”ืขืœื ื“ื‘ืจ, just like the ื ืฉื™ื, he brings his ืงืจื‘ืŸ, just by doing the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, without a previous ืคืกืง ื“ื™ืŸ, without ื”ืขืœื ื“ื‘ืจ which means by a wrong ืคืกืง ื“ื™ืŸ. ืืฃ ืžืฉื™ื—, maybe the ื›ื”ืŸ ื’ื“ื•ืœ also, ืžื™ื™ืชื™ ื‘ืฉื’ื’ืช ืžืขืฉื” ื‘ืœื ื”ืขืœื ื“ื‘ืจ, would bring just by doing the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, without ื”ืขืœื ื“ื‘ืจ, without a previous ืคืกืง ื“ื™ืŸ ื‘ืฉื•ื’ื’. So we were able to compare it to ืฆื™ื‘ื•ืจ, and then we would say that he only brings his ืงืจื‘ืŸ if there was first ื”ืขืœื ื“ื‘ืจ, but on the other hand we're able to compare it to ื ืฉื™ื, and say that he would bring his ืงืจื‘ืŸ even if there was no ื”ืขืœื ื“ื‘ืจ. ื ื—ื–ื™ ืœืื™ ืžื“ืžื™, let's see to which one of the two is it closer, is it more similar? ืฆื™ื‘ื•ืจ ื‘ืคืจ, the ืงืจื‘ืŸ of the ืฆื™ื‘ื•ืจ is a ืคืจ, a bull, and also there is another ื“ื™ืŸ concerning ืฆื™ื‘ื•ืจ, ื•ืื™ืŸ ืžื‘ื™ืื™ืŸ ืืฉื ืชืœื•ื™, ืฆื™ื‘ื•ืจ doesn't bring an ืืฉื ืชืœื•ื™. The ื“ื™ืŸ of ืืฉื ืชืœื•ื™ is, you know, if a person does an act which it's possible that this is an ืขื‘ื™ืจื” which you are ื—ื™ื™ื‘ a ื—ื˜ืืช for, but he's not even sure if he did that ืขื‘ื™ืจื”, so for that you bring an ืืฉื ืชืœื•ื™. Now the ื“ื™ืŸ is that the ืฆื™ื‘ื•ืจ doesn't bring an ืืฉื ืชืœื•ื™. If the whole ืฆื™ื‘ื•ืจ did a ืกืคืง ืขื‘ื™ืจื” that you are ื—ื™ื™ื‘ a ื—ื˜ืืช for, you don't bring an ืืฉื ืชืœื•ื™ at all. So we see a ื“ื™ืŸ by a ืฆื™ื‘ื•ืจ that ืฆื™ื‘ื•ืจ has to bring a ืคืจ. The ืฆื™ื‘ื•ืจ has a ื“ื™ืŸ that they don't ever bring an ืืฉื ืชืœื•ื™. ื•ืžืฉื™ื— ื‘ืคืจ ื•ืื™ืŸ ืžื‘ื™ื ืืฉื ืชืœื•ื™, the ื“ื™ืŸ concerning the ื›ื”ืŸ ื’ื“ื•ืœ is the same, as his ืงืจื‘ืŸ is also a ืคืจ, and there's another similar ื“ื™ืŸ of a ื›ื”ืŸ ื’ื“ื•ืœ to the ืฆื™ื‘ื•ืจ, that he never brings an ืืฉื ืชืœื•ื™. If a ื›ื”ืŸ ื’ื“ื•ืœ does an ืขื‘ื™ืจื” which is a ืกืคืง, maybe it is an ืขื‘ื™ืจื” maybe not, so he also doesn't bring an ืืฉื ืชืœื•ื™, as the ื’ืžืจื will learn out later. So we compare the two and say ืžื” ืฆื™ื‘ื•ืจ ืื™ื ื• ื—ื™ื™ื‘ ืืœื ืขืœ ื”ืขืœื ื“ื‘ืจ ืขื ืฉื’ื’ืช ืžืขืฉื”, that just like ืฆื™ื‘ื•ืจ is only ื—ื™ื™ื‘ if there was ื”ืขืœื ื“ื‘ืจ with ืฉื’ื’ืช ืžืขืฉื”, ืืฃ ืžืฉื™ื— ืœื ื™ื”ื ื—ื™ื™ื‘ ืืœื ืขืœ ื”ืขืœื ื“ื‘ืจ ืขื ืฉื’ื’ืช ืžืขืฉื”. So too the ื›ื”ืŸ ื’ื“ื•ืœ would not be ื—ื™ื™ื‘ unless there's ื”ืขืœื ื“ื‘ืจ with ืฉื’ื’ืช ืžืขืฉื”. In other words, this answered the question we said before. Should we compare the ื›ื”ืŸ ื’ื“ื•ืœ to ืฆื™ื‘ื•ืจ, or should we compare it to ื ืฉื™ื? And now we see that the ื›ื”ืŸ ื’ื“ื•ืœ is more similar to the ืฆื™ื‘ื•ืจ than to the ื ืฉื™ื, because in these two ways the ื›ื”ืŸ ื’ื“ื•ืœ is similar to ืฆื™ื‘ื•ืจ, and not to ื ืฉื™ื. And therefore we compare it to ืฆื™ื‘ื•ืจ, and we say that just like ืฆื™ื‘ื•ืจ, the only time you're ื—ื™ื™ื‘ is if there was ื”ืขืœื ื“ื‘ืจ with ืฉื’ื’ืช ืžืขืฉื”, so too the ื›ื”ืŸ ื’ื“ื•ืœ is only ื—ื™ื™ื‘ if there was ื”ืขืœื ื“ื‘ืจ with ืฉื’ื’ืช ืžืขืฉื”. ืื• ื›ืœืš ืœื“ืจืš ื–ื•, but on the other hand, maybe we could go to a different way, maybe we could find a different ืกื‘ืจื that would tell us that we should better compare it to ื ืฉื™ื than to compare it to ืฆื™ื‘ื•ืจ. Because ื ืฉื™ื ืžื™ื™ืชื™ ืฉืขื™ืจื” ื‘ืขื‘ื•ื“ื” ื–ืจื”, a ื ืฉื™ื, if his ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’ was concerning ืขื‘ื•ื“ื” ื–ืจื”, he brings a ืฉืขื™ืจื” like any ื™ื—ื™ื“. And this is in ืคืจืฉืช ืฉืœื—, ืคื™ืกืงื ื˜ืดื• ืคืกื•ืง ื›ืดื–. There it speaks about a person who does an ืขื‘ื™ืจื” of ืขื‘ื•ื“ื” ื–ืจื” ื‘ืฉื•ื’ื’. It says: ื•ืื ื ืคืฉ ืื—ืช ืชื—ื˜ื ื‘ืฉื’ื’ื”, if one person will do this ืขื‘ื™ืจื” of ืขื‘ื•ื“ื” ื–ืจื” ื‘ืฉื•ื’ื’, ื•ื”ืงืจื™ื‘ื” ืขื– ื‘ืช ืฉื ืชื” ืœื—ื˜ืืช, then he has to bring a ืฉืขื™ืจื” for a ื—ื˜ืืช. And this ื“ื™ืŸ applies whether this ื™ื—ื™ื“ that did this ืขื‘ื™ืจื” of ืขื‘ื•ื“ื” ื–ืจื” was a regular ordinary person, or it was the ื ืฉื™ื, or it was even the ื›ื”ืŸ ื’ื“ื•ืœ. They all bring the same ืงืจื‘ืŸ. It is only the ืฆื™ื‘ื•ืจ, if they did an ืขื‘ื™ืจื” based on the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ concerning ืขื‘ื•ื“ื” ื–ืจื”, they bring a special ืงืจื‘ืŸ which is a ืคืจ and a ืฉืขื™ืจ, a ืคืจ ืœืขื•ืœื” and a ืฉืขื™ืจ ืœื—ื˜ืืช. In other words, when there is an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’ done by all other ืขื‘ื™ืจื•ืช that are ื‘ื›ืจืช, all other thirty ืขื‘ื™ืจื•ืช, then we have four categories of a ื—ื˜ืืช: if a ื™ื—ื™ื“ does an ืขื‘ื™ืจื”, then he brings a ื›ืฉื‘ื” or a ืฉืขื™ืจื”; if the ื›ื”ืŸ ื’ื“ื•ืœ does an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, then he brings a ืคืจ; if the ื ืฉื™ื does an ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, he brings a ืฉืขื™ืจ; if the ืฆื™ื‘ื•ืจ does the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, then they bring a ืคืจ. But that is only concerning other ืขื‘ื™ืจื•ืช. If this ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’ was concerning ืขื‘ื•ื“ื” ื–ืจื”, there are only two categories: or the ืฆื™ื‘ื•ืจ, or the ื™ื—ื™ื“. Now in this ื“ื™ืŸ of ื™ื—ื™ื“ includes the ื ืฉื™ื and the ื›ื”ืŸ ื’ื“ื•ืœ, which means that concerning ืขื‘ื•ื“ื” ื–ืจื”, the ื ืฉื™ื and the ื›ื”ืŸ ื’ื“ื•ืœ and the ื™ื—ื™ื“ have the same ื“ื™ืŸ, that they all have to bring a ืฉืขื™ืจื”. There is only a ืฆื™ื‘ื•ืจ that is different, that if the ืฆื™ื‘ื•ืจ did the ืขื‘ื™ืจื” of ืขื‘ื•ื“ื” ื–ืจื” ื‘ืฉื•ื’ื’, then they bring a ืคืจ for an ืขื•ืœื” and a ืฉืขื™ืจ for a ื—ื˜ืืช. And this is what the ื’ืžืจื is saying here: that maybe we should compare the ื›ื”ืŸ ื’ื“ื•ืœ better to the ื ืฉื™ื, because we see in one way he is similar to the ื ืฉื™ื more than to the ืฆื™ื‘ื•ืจ, because the ื ืฉื™ื brings a ืฉืขื™ืจื” by ืขื‘ื•ื“ื” ื–ืจื”, and also ืžื™ื™ืชื™ ืืฉื ื•ื“ืื™. The ื“ื™ืŸ is that a ื ืฉื™ื has to bring a ืงืจื‘ืŸ ืืฉื, because we know amongst the ืืฉืžื•ืช we have ืืฉื ืชืœื•ื™ and ืืฉื ื•ื“ืื™. ืืฉื ืชืœื•ื™, as we said before, if you do an act which is a ืกืคืง, maybe it is an ืขื‘ื™ืจื” that you're ื—ื™ื™ื‘ a ื—ื˜ืืช for it. You cannot bring a ื—ื˜ืืช because you're not sure, so you bring an ืืฉื ืชืœื•ื™. ืืฉื ื•ื“ืื™ is, for instance, ืืฉื ื’ื–ืœื•ืช or ืืฉื ืžืขื™ืœื•ืช. There's a certain condition when you steal that as a result of your stealing, you have to bring a ืงืจื‘ืŸ ืืฉื. Or if you are ืžื•ืขืœ ื‘ื”ืงื“ืฉ, you have use of ื”ืงื“ืฉ if you're not allowed, you have to bring ืืฉื ืžืขื™ืœื•ืช. And these ืืฉืžื•ืช do not come because of a ืกืคืง, they are called ืืฉื ื•ื“ืื™. So the ื“ื™ืŸ is that a ื ืฉื™ื has to bring an ืืฉื ื•ื“ืื™. If the ื ืฉื™ื did the ืขื‘ื™ืจื”, like for instance the stealing with the condition that is ืžื—ื™ื™ื‘ a person an ืืฉื, so he also would have to bring an ืืฉื, the ืืฉื ื’ื–ืœื•ืช. Or if he was ืžื•ืขืœ ื‘ื”ืงื“ืฉ, he also has to bring the ืืฉื ืžืขื™ืœื•ืช. ื•ืžืฉื™ื— ืžื‘ื™ื ืฉืขื™ืจื” ื‘ืขื‘ื•ื“ื” ื–ืจื”. And the ื›ื”ืŸ ืžืฉื™ื— also brings a ืฉืขื™ืจื” for ืขื‘ื•ื“ื” ื–ืจื”, the same as the ื ืฉื™ื, which is the same really as the ื™ื—ื™ื“. ื•ืžื‘ื™ื ืืฉื ื•ื“ืื™. And the ื›ื”ืŸ ื’ื“ื•ืœ also has to bring an ืืฉื ื•ื“ืื™, while there is no ื“ื™ืŸ of ืืฉื ื•ื“ืื™ by the ืฆื™ื‘ื•ืจ, because by the ืืฉื ื•ื“ืื™ the ืคืกื•ืง says ื•ื ืคืฉ, and the ืฆื™ื‘ื•ืจ is not ื ืคืฉ. So therefore the ืฆื™ื‘ื•ืจ does not bring an ืืฉื ื•ื“ืื™. So we see that in a certain way, the ื›ื”ืŸ ื’ื“ื•ืœ is more similar to the ื ืฉื™ื than he is to the ืฆื™ื‘ื•ืจ with these two ืขื ื™ื ื™ื. So let's say, ืžื” ื ืฉื™ื ืžื‘ื™ื ื‘ืฉื’ื’ืช ืžืขืฉื”, so therefore just like a ื ืฉื™ื brings his ืงืจื‘ืŸ ื—ื˜ืืช just for ืฉื’ื’ืช ืžืขืฉื”, just for doing the act ื‘ืฉื•ื’ื’ without a previous ืคืกืง ื“ื™ืŸ, ืืฃ ืžืฉื™ื— ืžื‘ื™ื ื‘ืฉื’ื’ืช ืžืขืฉื”, so too the ื›ื”ืŸ ืžืฉื™ื— would bring his ืงืจื‘ืŸ ื—ื˜ืืช just for ืฉื’ื’ืช ืžืขืฉื”. So we're back to the question: what should we compare to? There is a ืกื‘ืจื to compare the ื›ื”ืŸ ื’ื“ื•ืœ to the ืฆื™ื‘ื•ืจ more than to the ื ืฉื™ื. On the other hand, there is a ืกื‘ืจื to compare the ื›ื”ืŸ ื’ื“ื•ืœ to the ื ืฉื™ื more than to the ืฆื™ื‘ื•ืจ. But since we don't know, ืชืœืžื•ื“ ืœื•ืžืจ, that's why we have to have the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, that by the ืงืจื‘ืŸ ื—ื˜ืืช of the ื›ื”ืŸ ื’ื“ื•ืœ it says ืœืืฉืžืช ื”ืขื, to the ืขื‘ื™ืจื” of the ืขื, to tell us ื”ืจื™ ื”ื•ื ืžืฉื™ื— ื›ืฆื™ื‘ื•ืจ, that the ืžืฉื™ื— is like the ืขื, like the ืฆื™ื‘ื•ืจ. And we say, ืžื” ืฆื™ื‘ื•ืจ ืื™ื ื• ืžื‘ื™ื ืืœื ืขืœ ื”ืขืœื ื“ื‘ืจ ืขื ืฉื’ื’ืช ืžืขืฉื”, just like the ืฆื™ื‘ื•ืจ brings their ืคืจ ื”ืขืœื ื“ื‘ืจ only if there was ื”ืขืœื ื“ื‘ืจ together with ืฉื’ื’ืช ืžืขืฉื”, ืืฃ ืžืฉื™ื— ืื™ื ื• ืžื‘ื™ื ืืœื ืขืœ ื”ืขืœื ื“ื‘ืจ ืขื ืฉื’ื’ืช ืžืขืฉื”, so too the ื›ื”ืŸ ื’ื“ื•ืœ doesn't bring unless there was first ื”ืขืœื ื“ื‘ืจ and then there was ืฉื’ื’ืช ืžืขืฉื”. Then the ื’ืžืจื asks: if you say that the ื›ื”ืŸ ื’ื“ื•ืœ has the same ื“ื™ืŸ like the ืฆื™ื‘ื•ืจ, ืื™ ืžื”, we could say, ืžื” ืฆื™ื‘ื•ืจ ื”ื•ืจื• ื•ืขืฉื• ืื—ืจื™ื ื‘ื”ื•ืจืืชื ื—ื™ื™ื‘ื™ืŸ, just like by the ืฆื™ื‘ื•ืจ the ื“ื™ืŸ is that the ื‘ื™ืช ื“ื™ืŸ ืคืกืง'ื ื“ and then the people followed the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ and they did like the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ, that's when you are ื—ื™ื™ื‘, ืืฃ ืžืฉื™ื—, also the ื›ื”ืŸ ื’ื“ื•ืœ, maybe the ื“ื™ืŸ is ื›ืฉื”ื•ืจื” ื•ืขืฉื• ืื—ืจื™ื ื‘ื”ื•ืจืืชื• ื™ื”ื ื—ื™ื™ื‘, that if the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืง'ื ื“ and others did according to his ืคืกืง ื“ื™ืŸ, then he is ื—ื™ื™ื‘. We're saying the whole time that the ื›ื”ืŸ ื’ื“ื•ืœ is ื—ื™ื™ื‘ if he ืคืกืง'ื ื“ for himself and then he himself did according to his ืคืกืง ื“ื™ืŸ. But if we compare ื›ื”ืŸ ื’ื“ื•ืœ to ืฆื™ื‘ื•ืจ, just like by ืฆื™ื‘ื•ืจ the ืคืกืง ื“ื™ืŸ came from one group of people and the ืžืขืฉื” was done through another group of people, the ื‘ื™ืช ื“ื™ืŸ ืคืกืง'ื ื“ and the people followed, maybe by ื›ื”ืŸ ื’ื“ื•ืœ would be the same, that if he ืคืกืง'ื ื“ and others did according to his ืคืกืง ื“ื™ืŸ, that's when he is ื—ื™ื™ื‘? ืชืœืžื•ื“ ืœื•ืžืจ, but the ืคืกื•ืง says ื•ื”ืงืจื™ื‘ ืขืœ ื—ื˜ืืชื• ืืฉืจ ื—ื˜ื, he should bring his ืงืจื‘ืŸ for the ืขื‘ื™ืจื” that he did. So we ื“ืจืฉ'ืŸ: ืขืœ ืžื” ืฉื—ื˜ื ื”ื•ื ืžื‘ื™ื, on an ืขื‘ื™ืจื” that he himself did he brings a ืงืจื‘ืŸ, ื•ืื™ื ื• ืžื‘ื™ื ืขืœ ืžื” ืฉื—ื˜ืื• ืื—ืจื™ื, but he doesn't bring the ืงืจื‘ืŸ for an ืขื‘ื™ืจื” that others did. Then the ื’ืžืจื says: ืืžืจ ืžืจ, we learned before, ืžืฉื™ื— ื‘ืคืจ ื•ืื™ืŸ ืžื‘ื™ื ืืฉื ืชืœื•ื™. That the ื›ื”ืŸ ืžืฉื™ื—, his similarity to the ืฆื™ื‘ื•ืจ is that he brings a ืคืจ as a ื—ื˜ืืช just like the ืฆื™ื‘ื•ืจ, and also he doesn't bring an ืืฉื ืชืœื•ื™ just like the ืฆื™ื‘ื•ืจ. But the ื’ืžืจื asks: ืžื ืœืŸ ื“ืื™ืŸ ืžื‘ื™ื ืืฉื ืชืœื•ื™, how do we know that a ื›ื”ืŸ ื’ื“ื•ืœ does not bring an ืืฉื ืชืœื•ื™? That if he did an act which is a ืกืคืง, maybe it is an ืขื‘ื™ืจื” that you are ื—ื™ื™ื‘ a ื—ื˜ืืช for, how do we know he would not bring a ืงืจื‘ืŸ ืืฉื ืชืœื•ื™ for that? And the ื’ืžืจื answers: ื“ื›ืชื™ื‘, because it says in ืคืกื•ืง concerning ืืฉื ืชืœื•ื™, and this is in ืคืจืฉืช ื•ื™ืงืจื ืงืคื™ื˜ืœ ื”, ืคืกื•ืง ื™ืดื— says, ื•ื›ื™ืคืจ ืขืœื™ื• ื”ื›ื”ืŸ ืขืœ ืฉื’ื’ืชื• ืืฉืจ ืฉื’ื’, that the ื›ื”ืŸ should forgive on him for the ืฉื•ื’ื’ that he did ื‘ืฉื•ื’ื’. So what is the ืคืกื•ืง trying to tell us? That ืžื™ ืฉื—ื˜ืืชื• ื•ืฉื’ื’ืชื• ืฉื•ื”, that who is included in this ื“ื™ืŸ of ืืฉื ืชืœื•ื™? Only a person that his ื—ื˜ืืช and his ืฉื•ื’ื’ are equal, which means that he brings a ื—ื˜ืืช for his ืฉื•ื’ื’. ื™ืฆื, this comes to exclude, ืžืฉื™ื—, the ื›ื”ืŸ ื’ื“ื•ืœ, ืฉืื™ืŸ ืฉื’ื’ืชื• ื•ื—ื˜ืืชื• ืฉื•ื”, that his ืฉื•ื’ื’ and his ื—ื˜ืืช are not the same. In other words, when does he bring a ื—ื˜ืืช? Not just for doing the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’, but he brings a ื—ื˜ืืช only if there was first ื”ืขืœื ื“ื‘ืจ, which means if he first ืคืกืง'ื ื“ wrong and then he did the act, that's when he brings a ืงืจื‘ืŸ ื—ื˜ืืช. So his ืฉื•ื’ื’ and the ื—ื˜ืืช are not the same. And the ืคืกื•ืง concerning ืืฉื ืชืœื•ื™ tells us that who brings an ืืฉื ืชืœื•ื™? Only a person that his ื—ื˜ืืช and his ืฉื•ื’ื’ are the same. So this comes to exclude the ื›ื”ืŸ ื’ื“ื•ืœ, because and his ืฉื•ื’ื’ and his ื—ื˜ืืช are not the same. How do we know that? ื“ื›ืชื™ื‘ ืœืืฉืžืช ื”ืขื, because the ืคืกื•ืง by ื›ื”ืŸ ื’ื“ื•ืœ says ืœืืฉืžืช ื”ืขื, which teaches us ื”ืจื™ ื”ื•ื ืžืฉื™ื— ื›ืฆื‘ื•ืจ. That the ื›ื”ืŸ ื’ื“ื•ืœ is like the ืฆื™ื‘ื•ืจ. Just like the ืฆื™ื‘ื•ืจ brings the ืงืจื‘ืŸ ืคืจ ื”ืขืœื ื“ื‘ืจ only if

there was first ื”ืขืœื ื“ื‘ืจ, if first there was a mistake in ืคืกืง ื“ื™ืŸ, so too, the ื›ื”ืŸ ื’ื“ื•ืœ would bring his ืงืจื‘ืŸ ื—ื˜ืืช only if there was first a mistake in the ืคืกืง ื“ื™ืŸ. ืžืžื™ืœื, we know from here that by the ื›ื”ืŸ ื’ื“ื•ืœ, his ื—ื˜ืืช and ืฉื•ื’ื’ are not the same. Now, since his ื—ื˜ืืช and ืฉื•ื’ื’ are not the same, he is excluded from the ื“ื™ืŸ of ืืฉื ืชืœื•ื™. Because by ืืฉื ืชืœื•ื™, the ืคืกื•ืง says that who brings ืืฉื ืชืœื•ื™? Only ืขืœ ืฉื’ื’ืชื• ืืฉืจ ืฉื’ื’, which means a person that his ื—ื˜ืืช and the ืฉื•ื’ื’ are the same. But the ื’ืžืจื asks, "How can you say that? ืœืืฉืžืช ื”ืขื ืขืœ ื›ืจื—ืš ืœื ืงืื™." The ื’ืžืจื before, when it said that the ื›ื”ืŸ ื’ื“ื•ืœ does not bring an ืืฉื ืชืœื•ื™, the ื’ืžืจื definitely could not have meant what we just said now. Because what we just said now is that how do we know he doesn't bring an ืืฉื ืชืœื•ื™? Because since the ืคืกื•ืง says ืœืืฉืžืช ื”ืขื to teach us that he only brings a ื—ื˜ืืช if there was first ื”ืขืœื ื“ื‘ืจ, ืžืžื™ืœื, we know from there that his ืฉื•ื’ื’ and his ื—ื˜ืืช are not the same, and therefore, he's excluded from ืืฉื ืชืœื•ื™. But the ื’ืžืจื before was talking if the words ืœืืฉืžืช ื”ืขื would not have been written. The ื’ืžืจื started off by saying, "How do we know that the ื›ื”ืŸ ื’ื“ื•ืœ brings his ืงืจื‘ืŸ ื—ื˜ืืช only if there was ื”ืขืœื ื“ื‘ืจ? Because it says ืœืืฉืžืช ื”ืขื." But then the ื’ืžืจื was goes on and says, "Why do we need the ืคืกื•ืง ืœืืฉืžืช ื”ืขื? Even if there wouldn't have been written ืœืืฉืžืช ื”ืขื, we still would have known that a ื›ื”ืŸ ื’ื“ื•ืœ only brings it if there was first ื”ืขืœื ื“ื‘ืจ, because we would have compared it to ืฆื™ื‘ื•ืจ. And why would we have compared him to ืฆื™ื‘ื•ืจ? Because he is similar to ืฆื™ื‘ื•ืจ, and one of the things he is similar is that a ืฆื™ื‘ื•ืจ doesn't bring an ืืฉื ืชืœื•ื™, so he doesn't bring an ืืฉื ืชืœื•ื™, also. And then since we see that he is close, similar to ืฆื™ื‘ื•ืจ, so we would say just like ืฆื™ื‘ื•ืจ brings only with ื”ืขืœื ื“ื‘ืจ, so he also would bring with ื”ืขืœื ื“ื‘ืจ. And the question is, why do we need the ืคืกื•ืง ืœืืฉืžืช ื”ืขื to teach us that?" What we're saying now is, that how do we know that a ื›ื”ืŸ ื’ื“ื•ืœ doesn't bring an ืืฉื ืชืœื•ื™? It's all based because the ืคืกื•ืง says ืœืืฉืžืช ื”ืขื, which tells us that he only brings if there was first ื”ืขืœื ื“ื‘ืจ. ืžืžื™ืœื, he is excluded from the ื“ื™ืŸ of ืืฉื ืชืœื•ื™, because there it says, ืขืœ ืฉื’ื’ืชื• ืืฉืจ ืฉื’ื’. It has to be ื—ื˜ืืชื• ื•ืฉื’ื’ืชื• ืฉื•ื•ืช. So, it means that the only way we know a ื›ื”ืŸ ื’ื“ื•ืœ is ืคื˜ื•ืจ from an ืืฉื ืชืœื•ื™ is only after we have the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, and we know from there that he only brings with ื”ืขืœื ื“ื‘ืจ, not just ืฉื’ื’ืช ืžืขืฉื”. So, then we could exclude him from ืืฉื ืชืœื•ื™. But, then in the ื’ืžืจื before, when we said that the ื›ื”ืŸ ื’ื“ื•ืœ doesn't bring an ืืฉื ืชืœื•ื™, this was before we had the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, which means without the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, and before we know yet that a ื›ื”ืŸ ื’ื“ื•ืœ only brings his ืงืจื‘ืŸ if there was ื”ืขืœื ื“ื‘ืจ. As a matter of fact, this is exactly what we're trying to learn out first. The ื’ืžืจื there is looking a way to learn out that a ื›ื”ืŸ ื’ื“ื•ืœ only brings with ื”ืขืœื ื“ื‘ืจ. And we learned it out to the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, and the ื’ืžืจื is saying we don't need ืœืืฉืžืช ื”ืขื, we could have learned it out without. And what are we saying then? That how would we learn it out without ืœืืฉืžืช ื”ืขื? In other words, without the ืคืกื•ืง that teaches us that he only brings with ื”ืขืœื ื“ื‘ืจ, we would have learned it out anyway that he brings only with ื”ืขืœื ื“ื‘ืจ, from the fact that he doesn't bring an ืืฉื ืชืœื•ื™. When the whole ื“ื™ืŸ that he doesn't bring an ืืฉื ืชืœื•ื™ only comes as a result of this ื“ื™ืŸ that he only brings with ื”ืขืœื ื“ื‘ืจ? So, how can the ื’ืžืจื before say that how do we know that the ื›ื”ืŸ ื’ื“ื•ืœ brings only with ื”ืขืœื ื“ื‘ืจ by comparing it to ืฆื™ื‘ื•ืจ, based on the fact that he doesn't bring an ืืฉื ืชืœื•ื™, which that itself comes as a result from the ื“ื™ืŸ that he doesn't bring only with ื”ืขืœื ื“ื‘ืจ? Therefore, the ื’ืžืจื says, ืืœื ืืฉื ื›ื“ื™ ื ืกื‘ื”. You must say that when the ื’ืžืจื before says that without the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, we would have still known that a ื›ื”ืŸ ื’ื“ื•ืœ only brings with ื”ืขืœื ื“ื‘ืจ, because we would have compared it to ืฆื™ื‘ื•ืจ, and the ื’ืžืจื says two ways a ื›ื”ืŸ ื’ื“ื•ืœ is compared to ืฆื™ื‘ื•ืจ. One is because they bring a ืคืจ and he brings a ืคืจ, and other thing is because they don't bring an ืืฉื ืชืœื•ื™, and he doesn't bring an ืืฉื ืชืœื•ื™. The words ืืฉื ืชืœื•ื™ was mentioned for no reason. Really, that is extra, because it is not because of an ืืฉื ืชืœื•ื™ that we compare a ื›ื”ืŸ ื’ื“ื•ืœ to ืฆื™ื‘ื•ืจ, because here we are talking in a case before we even know that a ื›ื”ืŸ ื’ื“ื•ืœ doesn't bring an ืืฉื ืชืœื•ื™. So, therefore, what the ื’ืžืจื really meant was that we compare a ื›ื”ืŸ ื’ื“ื•ืœ to ืฆื™ื‘ื•ืจ just because the ืฆื™ื‘ื•ืจ brings a ืคืจ, and the ื›ื”ืŸ ื’ื“ื•ืœ brings a ืคืจ. But, since ืœืคื•ืขืœ ืžืžืฉ, a ื›ื”ืŸ ื’ื“ื•ืœ doesn't bring an ืืฉื ืชืœื•ื™ after we know the ื“ื™ืŸ that he only brings with ื”ืขืœื ื“ื‘ืจ, we already know that he doesn't bring an ืืฉื ืชืœื•ื™, so, therefore, the ื’ืžืจื mentioned that there, too. But ืœื›ืชื—ื™ืœื”, to say that this was the reason the ื’ืžืจื had in mind, how we could learn out without the ืคืกื•ืง ืœืืฉืžืช ื”ืขื, we can't say, because if you don't have ืœืืฉืžืช ื”ืขื and we yet don't know the ื“ื™ืŸ that a ื›ื”ืŸ ื’ื“ื•ืœ only brings his ืงืจื‘ืŸ with ื”ืขืœื ื“ื‘ืจ, we wouldn't know the ื“ื™ืŸ either that he doesn't bring an ืืฉื ืชืœื•ื™. Then we continue with the ืžืฉื ื”.

Mishna on individual versus communal atonement

If the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืง'ื ื˜ on his own for himself, and he himself did that ืขื‘ื™ืจื”, so then And really there's a ืžื—ืœื•ืงืช in the ืžืฉื ื” before whether the ื‘ื™ืช ื“ื™ืŸ is the one that brings the ืงืจื‘ืŸ, ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื‘ื•ืจ, or the ืฆื‘ื•ืจ brings. And ืจื‘ื™ ืžืื™ืจ was the one that said that the ื‘ื™ืช ื“ื™ืŸ brings. So the ืžืฉื ื” here mentions that the ื‘ื™ืช ื“ื™ืŸ brings, because a ืกืชื ืžืฉื ื” here goes according to ืจื‘ื™ ืžืื™ืจ. And therefore it mentions that the ื‘ื™ืช ื“ื™ืŸ is the one that brings the ืงืจื‘ืŸ. And now we will learn the ื’ืžืจื. ื’ืžืจื asks: ืžื ื ื”ื ื™ ืžื™ืœื™? How do we know this ื“ื™ืŸ, that if the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืงื ื˜ the same ื“ื™ืŸ as the ื‘ื™ืช ื“ื™ืŸ ืคืกืงื ื˜, and he did the same ืขื‘ื™ืจื” as the ืฆื‘ื•ืจ did because of the ื‘ื™ืช ื“ื™ืŸ, and he did it because of himself, he doesn't have to bring his own ืงืจื‘ืŸ, but is included in their ืงืจื‘ืŸ? ื“ืชื ื• ืจื‘ื ืŸ, that the ืจื‘ื ืŸ learns: ื”ื•ืจื” ืขื ื”ืฆื‘ื•ืจ ื•ืขืฉื” ืขื ื”ืฆื‘ื•ืจ, the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืงื ื˜ with the ืฆื‘ื•ืจ, and did with the ืฆื‘ื•ืจ. ืฆื™ื‘ื•ืจ, ื™ื›ื•ืœ I would think ื™ื‘ื™ื ืคืจ ืœืขืฆืžื•, that he should bring his own ืคืจ, ื•ื”ื“ื™ืŸ ื”ื•ื, but there is a ืกื‘ืจื to say that he shouldn't bring his own ืคืจ, because ื ืฉื™ื ืžื•ืฆื ืžื›ืœืœ ื™ื—ื™ื“, we know that the ื ืฉื™ื is excluded from the ื™ื—ื™ื“. A

Comparing the Nasi to the Kohen Gadol

ื ืฉื™ื has a special ืงืจื‘ืŸ ื—ื˜ืืช, different than a ื™ื—ื™ื“. ื•ืžืฉื™ื— ืžื•ืฆื ืžื›ืœืœ ื™ื—ื™ื“, the ื›ื”ืŸ ืžืฉื™ื— is also excluded from the ื™ื—ื™ื“. He also has a different ืงืจื‘ืŸ than the ื™ื—ื™ื“. So we see that the ื ืฉื™ื and the ื›ื”ืŸ ื’ื“ื•ืœ are similar, so we should compare the two and say: ืžื” ื ืฉื™ื ื—ื˜ื ื‘ืคื ื™ ืขืฆืžื•, ื™ื‘ื™ื ื‘ืคื ื™ ืขืฆืžื•. Just like a ื ืฉื™ื, if he did an ืขื‘ื™ืจื” by himself, then he brings his own ืงืจื‘ืŸ by himself; ื—ื˜ื ืขื ื”ืฆื‘ื•ืจ, if he sinned together with the ืฆื™ื‘ื•ืจ, ืžืชื›ืคืจ ืœื• ืขื ื”ืฆื‘ื•ืจ, his ื›ืคืจื” comes with the ืฆื™ื‘ื•ืจ, which means that if he was part of the ืฆื™ื‘ื•ืจ that followed the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ, then the ื ืฉื™ื would not bring his own private ืงืจื‘ืŸ ื—ื˜ืืช. He would be included in the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. When does a ื ืฉื™ื bring his own private ืงืจื‘ืŸ ื—ื˜ืืช? The same way if a ื™ื—ื™ื“ would bring his own ืงืจื‘ืŸ ื—ื˜ืืช. In the same condition, when we say a ื™ื—ื™ื“ would have to bring his own private ื—ื˜ืืช, a ื ืฉื™ื would also have to bring. The difference is what the ื—ื˜ืืช would be: by a ื™ื—ื™ื“ it would be a ื›ืฉื‘ื” ืื• ืฉืขื™ืจื”, and by a ื ืฉื™ื it would be a ืฉืขื™ืจ. But in the case where the ื™ื—ื™ื“ doesn't have to bring his own personal ื—ื˜ืืช, the ื ืฉื™ื also wouldn't bring. In other words, if the ื ืฉื™ื did the ืขื‘ื™ืจื” together with the ืฆื™ื‘ื•ืจ, so then the ื ืฉื™ื would be included in the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. So we say, ืืฃ ืžืฉื™ื—, so too concerning the ื›ื”ืŸ ืžืฉื™ื—, since he is similar to the ื ืฉื™ื, that ื—ื˜ื ื‘ืคื ื™ ืขืฆืžื•, ื™ื‘ื™ื ื‘ืคื ื™ ืขืฆืžื•. If he sinned by himself, so he brings his own ืงืจื‘ืŸ; ื—ื˜ื ืขื ื”ืฆื‘ื•ืจ, ืžืชื›ืคืจ ืœื• ืขื ื”ืฆื‘ื•ืจ. If he

Kohen Gadolโ€™s inclusion in communal sacrifice

sinned together with the ืฆื™ื‘ื•ืจ, then he is included in the ื›ืคืจื” of the ืฆื™ื‘ื•ืจ. That's one ืกื‘ืจื we could say, that he shouldn't have to bring his own ืงืจื‘ืŸ. ืœื, no, you can't compare the two, because ืื ืืžืจืช ื‘ื ืฉื™ื, if we say this ื“ื™ืŸ by a ื ืฉื™ื, it is true, ืฉื›ืŸ ืžืชื›ืคืจ ืœื• ืขื ื”ืฆื‘ื•ืจ ื‘ื™ื•ื ื”ื›ืคื•ืจื™ื. We see that at another time, the ื ืฉื™ื is included in the ื›ืคืจื” of the whole ืฆื™ื‘ื•ืจ, and that is on ื™ื•ื ื›ื™ืคื•ืจ. Because on ื™ื•ื ื›ื™ืคื•ืจ we know there is a special ืงืจื‘ืŸ that the ื›ื”ืŸ ื’ื“ื•ืœ brings for the whole ืฆื™ื‘ื•ืจ, and the ื ืฉื™ื is included in that ืงืจื‘ืŸ. There is no special ืงืจื‘ืŸ ื—ื˜ืืช on ื™ื•ื ื›ื™ืคื•ืจ for the ื ืฉื™ื. So he is included in the ืฆื™ื‘ื•ืจ. So since we see that a ื ืฉื™ื is included in the ืงืจื‘ืŸ of the ืฆื™ื‘ื•ืจ ื‘ื™ื•ื ื›ื™ืคื•ืจ, so ืžืžื™ืœื we understand that in other cases, when he did the ืขื‘ื™ืจื” together with the ืฆื™ื‘ื•ืจ, he's also included in their ืงืจื‘ืŸ. ืชืืžืจ ื‘ืžืฉื™ื—, but say concerning the ื›ื”ืŸ ื’ื“ื•ืœ, ืฉืื™ื ื• ืžืชื›ืคืจ ืœื• ืขื ื”ืฆื‘ื•ืจ ื‘ื™ื•ื ื”ื›ืคื•ืจื™ื, that he is not ืžืชื›ืคืจ together with the ืฆื™ื‘ื•ืจ on ื™ื•ื ื›ื™ืคื•ืจ, because on ื™ื•ื ื›ื™ืคื•ืจ we know there is a special ืงืจื‘ืŸ that the ื›ื”ืŸ ื’ื“ื•ืœ brings for himself. So ื”ื•ืื™ืœ ื•ืื™ื ื• ืžืชื›ืคืจ ืœื• ืขื ื”ืฆื‘ื•ืจ ื‘ื™ื•ื ื”ื›ืคื•ืจื™ื, so therefore, since he doesn't get his ื›ืคืจื” together with the ืฆื™ื‘ื•ืจ on ื™ื•ื ื›ื™ืคื•ืจ, ื™ื›ื•ืœ I would think ื™ื‘ื™ื ืคืจ ืœืขืฆืžื•, that he should bring his own ืคืจ, and in the case where he did the ืขื‘ื™ืจื” together with the ืฆื™ื‘ื•ืจ, he still should have to bring his own ืคืจ, because he never is included in the ืฆื™ื‘ื•ืจ, even on ื™ื•ื ื›ื™ืคื•ืจ not. ืชืœืžื•ื“ ืœื•ืžืจ, therefore we have a ืคืกื•ืง: ืขืœ ื—ื˜ืืชื• ืืฉืจ ื—ื˜ื. The ืคืกื•ืง concerning the ืคืจ of the ื›ื”ืŸ ืžืฉื™ื— says that he should bring his ืงืจื‘ืŸ for the ืขื‘ื™ืจื” that he sinned. Okay, so what does that ืคืกื•ืง mean? ื—ื˜ื ื‘ืคื ื™ ืขืฆืžื•, ื™ื‘ื™ื ื‘ืคื ื™ ืขืฆืžื•, that if he sinned by himself, that's when he brings his ืงืจื‘ืŸ; ื—ื˜ื ืขื ื”ืฆื‘ื•ืจ, but if he sinned not himself, but he sinned together with the ืฆื™ื‘ื•ืจ, ืžืชื›ืคืจ ืœื• ืขื ื”ืฆื‘ื•ืจ. So then his ื›ืคืจื” is together with the ืฆื™ื‘ื•ืจ, he doesn't bring his own private ืงืจื‘ืŸ ื—ื˜ืืช, but he is included in the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. And then the ื’ืžืจื asks: ื”ื™ื›ื™ ื“ืžื™, what is the case here of the ื›ื”ืŸ ื’ื“ื•ืœ that ืคืกืงื ื“ the ื“ื™ืŸ together with the ืฆื™ื‘ื•ืจ? ืื™ืœื™ืžื ื“ื”ื•ื ืžื•ืคืœื ื•ื”ืŸ ืื™ื ื ืžื•ืคืœืื™ื, if we're going to say that the ื›ื”ืŸ ื’ื“ื•ืœ is the ืžื•ืคืœื of the ื‘ื™ืช ื“ื™ืŸ, which means the head of the ื‘ื™ืช ื“ื™ืŸ, and we learned earlier that if the ื‘ื™ืช ื“ื™ืŸ ืคืกืงื ื“ and the ืžื•ืคืœื wasn't there, then the whole ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ doesn't apply. And we must say that this ืžื•ืคืœื himself is not part of the ื‘ื™ืช ื“ื™ืŸ, because if he would be himself a member of the ื‘ื™ืช ื“ื™ืŸ, then even if he wouldn't be the ืžื•ืคืœื, if he would just be an ordinary member, also it would be no ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, because we learned before that when is there a ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ only if when the ื‘ื™ืช ื“ื™ืŸ ืคืกืงื ื“ every member of ื‘ื™ืช ื“ื™ืŸ was there. ืœืื• ื“ื•ืงื the highest member, even the simplest one. So therefore when it says ื“ื•ืงื that if the ืžื•ืคืœื is missing from the ื‘ื™ืช ื“ื™ืŸ, the ืคืกืง ื“ื™ืŸ is no ืคืกืง ื“ื™ืŸ and there is no ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, it means that the ืžื•ืคืœื was not a member of the ืกื ื”ื“ืจื™ืŸ, and nevertheless he has to be there. So the question here is: if the ื›ื”ืŸ ื’ื“ื•ืœ was the ืžื•ืคืœื, and the others were not ืžื•ืคืœืื™ื, they weren't in the category of ืžื•ืคืœื, ืคืฉื™ื˜ื, certainly ื“ืžืชื›ืคืจ ืœื• ื‘ืคื ื™ ืขืฆืžื•. Certainly that if he ืคืกืงื ื“ in one ื“ื™ืŸ and they ืคืกืงื ื“ in another ื“ื™ืŸ, and we said the ื“ื™ืŸ is that he does have to bring his own ืงืจื‘ืŸ, that is simple. Why? Because ื”ื•ืจืื” ื“ื™ืœื”ื•ืŸ ื•ืœื ื›ืœื•ื, because their ืคืกืง ื“ื™ืŸ doesn't count at all, ื•ื‘ืขื• ืื™ืชื•ื™ื™ ื›ืฉื‘ื” ืื• ืฉืขื™ืจื” ื›ืœ ื—ื“ ื•ื—ื“. And therefore, based on their ืคืกืง ื“ื™ืŸ, every individual would have to bring his own private ืงืจื‘ืŸ ื—ื˜ืืช, a ื›ืฉื‘ื” ืื• ืฉืขื™ืจื”. Because as we know, the only time there is a ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, which automatically means that there is no ื“ื™ืŸ on each individual to bring his own ืงืจื‘ืŸ ื—ื˜ืืช is only if the ืžื•ืคืœื was there. Now if the case was that the ื›ื”ืŸ ื’ื“ื•ืœ was the ืžื•ืคืœื and they are not a ืžื•ืคืœื, and the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืง'ื ื“ for himself in one ื“ื™ืŸ, and they ืคืกืง'ื ื“ in another ื“ื™ืŸ, certainly he cannot be included in theirs. But not only because he ืคืกืง'ื ื“ a different ืขื‘ื™ืจื” than they did, because their ืคืกืง ื“ื™ืŸ ืœื›ืชื—ื™ืœื” is no ืคืกืง ื“ื™ืŸ, and they wouldn't bring a ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ at all, but every individual would have to bring his own private ืงืจื‘ืŸ ื—ื˜ืืช. Because since the ืžื•ืคืœื wasn't there, we learned before that if the ืžื•ืคืœื is missing from the ื‘ื™ืช ื“ื™ืŸ, there is no ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. ื•ืื™ ื“ืื™ื ื”ื• ืžื•ืคืœืื™ืŸ ื•ื”ื•ื ืœืื• ืžื•ืคืœื, now if the case is that they are ืžื•ืคืœืื™ืŸ, they had a ืžื•ืคืœื there, but he himself is not a ืžื•ืคืœื, then the question is ืืžืื™ ืžืชื›ืคืจ ืœื™ื” ื‘ืคื ื™ ืขืฆืžื•? Then why should he have to bring his own ืงืจื‘ืŸ ื‘ื›ืœืœ? ื”ื•ืจืื” ื“ื™ื“ื™ื” ื•ืœืื• ื›ืœื•ื ื”ื™ื, his ืคืกืง ื“ื™ืŸ is no ืคืกืง ื“ื™ืŸ. We know that when does a ื›ื”ืŸ ื’ื“ื•ืœ bring his ืคืจ? Only if his ืขื‘ื™ืจื” followed a ืคืกืง ื“ื™ืŸ that he ืคืกืง'ื ื“ for himself. But if he wasn't a ืžื•ืคืœื, then his ืคืกืง ื“ื™ืŸ is not a ืคืกืง ื“ื™ืŸ to begin with. So then ื‘ื›ืœืœ he wouldn't have to bring a ืงืจื‘ืŸ ื—ื˜ืืช. So what do we mean that he would have to bring his own ืงืจื‘ืŸ? ืืžืจ ืจื‘ ืคืคื, therefore ืจื‘ ืคืคื said, ื›ื’ื•ืŸ, the case would be for instance ืฉื”ื™ื• ืžื•ืคืœืื™ืŸ ืฉื ื™ื”ื, both were ืžื•ืคืœื. He was a ืžื•ืคืœื, and the ื‘ื™ืช ื“ื™ืŸ that ืคืกืง'ื ื“ also had a ืžื•ืคืœื. And therefore, if the case is that he ืคืกืง'ื ื“ in one ื“ื™ืŸ and they ืคืกืง'ื ื“ in another ื“ื™ืŸ, then they bring the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, and he brings his own ืคืจ ื›ื”ืŸ ืžืฉื™ื—. If it was in the same ื“ื™ืŸ, so then they bring a ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, and he is included in that ืคืจ, and he doesn't have to bring his own ืคืจ ื›ื”ืŸ ืžืฉื™ื—. Then the ื’ืžืจื says: ืกื‘ืจ ืื‘ื™ื™ ืœืžื™ืžืจ, ืื‘ื™ื™ thought to say, ื—ื˜ื ื‘ืคื ื™ ืขืฆืžื• ื•ื”ื•ืจื• ื‘ืคื ื™ ืขืฆืžืŸ, ื”ื™ื›ื™ ื“ืžื™? That what do we mean when we say that he ืคืกืง'ื ื“ for himself and they ืคืกืง'ื ื“ for themselves, not together with the ื‘ื™ืช ื“ื™ืŸ, so then he has to bring his own ืงืจื‘ืŸ? It means ื“ื™ืชื‘ื™ ื‘ืฉื ื™ ืžืงื•ืžื•ืช, that they were sitting in

two places, ื•ืงื ืžื•ืจื™ ื‘ืชืจื™ ืื™ืกื•ืจื™, and they ืคืกืง'ื ื“ in two ืื™ืกื•ืจื™ื. The ื‘ื™ืช ื“ื™ืŸ was in one place, he was in another place. The ื‘ื™ืช ื“ื™ืŸ ืคืกืง'ื ื“ their ืคืกืง ื“ื™ืŸ in one ืื™ืกื•ืจ, for instance in ืขื‘ื•ื“ื” ื–ืจื”, and he, sitting in the other place, ืคืกืง'ื ื“ it concerning another ื“ื™ืŸ, for instance concerning ื—ืœื‘. So then he brings his own ืงืจื‘ืŸ. But if they were sitting in the same place, even if he ืคืกืง'ื ื“ it concerning a different ื“ื™ืŸ, he still would be included in the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. ืืžืจ ืœื™ื” ืจื‘ื, so ืจื‘ื said to him: ืื˜ื• ืฉื ื™ ืžืงื•ืžื•ืช ื’ื•ืจืžื™ืŸ? Do two places cause? In other words, what difference does it make if they were in two places or in one place? ืืœื, therefore ืจื‘ื says, ืืคื™ืœื• ื™ืชื‘ื™ ื‘ื—ื“ ืžืงื•ื, even if they were sitting in one place, he was sitting in the same place with the ื‘ื™ืช ื“ื™ืŸ, ืื‘ืœ ื›ื™ื•ื•ืŸ ื“ืงื ืžื•ืจื™ ื‘ืชืจื™ ืื™ืกื•ืจื™, but since they were ืคืกืง'ืขื ื™ื ื’ in two ืื™ืกื•ืจื™ื, ื—ื˜ื ื‘ืคื ื™ ืขืฆืžื• ื”ื•ื, so his ืขื‘ื™ืจื” is considered a separate ืขื‘ื™ืจื”, and therefore he has to bring his own separate ืงืจื‘ืŸ. And now the ื’ืžืจื is going to explain to give an example of what do we mean that he ืคืกืง'ื ื“ in one ืื™ืกื•ืจ and they ืคืกืง'ื ื“ in another ืื™ืกื•ืจ. ืคืฉื™ื˜ื, that is simple, ื“ื”ื•ื ื‘ื—ืœื‘ ื•ื”ื ื‘ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื, that if he

ืคืกืง'ื ื“ concerning ื—ืœื‘, that you're allowed to eat a certain type of ื—ืœื‘, and they ืคืกืง'ื ื“ concerning ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื, ื—ื˜ื ื‘ืคื ื™ ืขืฆืžื• ื”ื•ื, that is definitely considered a separate ืขื‘ื™ืจื”. Why? ื“ื”ื ื—ืœื•ืงื™ืŸ ื‘ื˜ืขืžื™ื™ื”ื• ื•ื—ืœื•ืงื™ืŸ ื‘ืงืจื‘ื ื•ืช, it's a different reason, it's a different type of ืขื‘ื™ืจื”, and in addition to that, there are different ืงืจื‘ื ื•ืช. ื“ื”ื•ื ื‘ืคืจ ื•ื”ื ื‘ืคืจ ื•ืฉืขื™ืจ. Because when the ื›ื”ืŸ ื’ื“ื•ืœ ืคืกืง'ื ืก that you're allowed to eat ื—ืœื‘ for himself and then does it, he has to bring a ืคืจ ื›ื”ืŸ ืžืฉื™ื—. But the ืฆื™ื‘ื•ืจ in this case when they ืคืกืง'ื ื“ concerning ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื, they have to bring a ืคืจ ื•ืฉืขื™ืจ. By other ืขื‘ื™ืจื•ืช the ืฆื™ื‘ื•ืจ has to bring a ืคืจ also, but if the ืฆื™ื‘ื•ืจ ืคืกืง'ื ื“ concerning ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื, so then the ื“ื™ืŸ is a ืคืจ ื•ืฉืขื™ืจ, so it's a complete different ืงืจื‘ืŸ. ื“ื”ื ืงื ืžื™ื™ืชื™ ื”ื ื”ื• ืฉืขื™ืจ ื•ื”ื•ื ืœื ืžื™ื™ืชื™, because you see they bring an extra ืฉืขื™ืจ, in addition to the ืคืจ they bring a ืฉืขื™ืจ, and he doesn't bring the ืฉืขื™ืจ. So therefore it's a separate ืขื‘ื™ืจื”, and he is not included in their ืงืจื‘ืŸ, and he brings his own ืงืจื‘ืŸ. ื•ื›ืœ ืฉื›ืŸ, certainly if it was different, ื”ื•ื ื‘ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื ื•ื”ื ื‘ื—ืœื‘. If he ืคืกืง'ื ื“ concerning ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื for himself, and they ืคืกืง'ื ื“ concerning ื—ืœื‘, ื“ื—ืœื•ืงื™ืŸ ื‘ืงืจื‘ื ื•ืชื™ื”ืŸ ืœื’ืžืจื™, so here they're completely different in the ืงืจื‘ืŸ. ื“ื”ื•ื ืฉืขื™ืจื”, because he brings a ืฉืขื™ืจื”. As we said before, that by ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื a ื›ื”ืŸ ื’ื“ื•ืœ is the same as a regular ื™ื—ื™ื“. And therefore, he would bring a ืฉืขื™ืจื”, ื•ืื™ื ื”ื• ืคืจ, and the ืฆื™ื‘ื•ืจ would bring a ืคืจ, because the ืฆื™ื‘ื•ืจ when they ืคืกืง'ื ื“ concerning ื—ืœื‘ they bring a ืคืจ, so it's a complete different ืงืจื‘ืŸ. So it's even more than the case before. In the case before, when he ืคืกืง'ื ื“ by ื—ืœื‘ and then by ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื, they're also different ืงืจื‘ื ื•ืช. The difference is only one thing: he brings a ืคืจ, and they bring a ืคืจ. The thing is they, in addition to the ืคืจ, bring a ืฉืขื™ืจ. But in one way, they are similar. Nevertheless, we said, since ืกื•ืฃ ื›ืœ ืกื•ืฃ it's a different ืงืจื‘ืŸ, we understand that he brings his own ืงืจื‘ืŸ. But certainly in a case where he ืคืกืง'ื ื“ concerning ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื and they concerning ื—ืœื‘, then ืœื›ืชื—ื™ืœื” completely the ืงืจื‘ืŸ is different. Not the ืคืฉื˜ in one way is the same and in another thing is different. ืœื›ืชื—ื™ืœื” they're different. He brings a ืฉืขื™ืจื” ืฉืขื™ืจื”, and they bring a ืคืจ. ืืœื the ืฉืืœื” is, ื”ื•ื ื‘ื—ืœื‘ ื”ืžื›ืกื” ืืช ื”ืงืจื‘, ื•ื”ื ื‘ื—ืœื‘ ืฉืขืœ ื”ื“ืงื™ืŸ, ืžื”ื•? If he ืคืกืงื ื˜ concerning ื—ืœื‘, but what kind of ื—ืœื‘? ื—ืœื‘ which covers the ืงืจื‘, the fat of the entrails, and they ืคืกืงื ื˜ concerning the ื—ืœื‘ which is on the ื“ืงื™ืŸ, the ื—ืœื‘ of the small bowels, ืžื”ื•, what is the ื“ื™ืŸ here? ืžื™ ืืžืจื™ื ืŸ, do we say ืืฃ ืขืœ ื’ื‘ ื“ืงืจื‘ื ื ืฉื•ื”, even though the ืงืจื‘ืŸ is the same, because they both ืคืกืงื ื˜ concerning ื—ืœื‘, so they both have to bring a ืคืจ. But ื›ื™ื•ื•ืŸ ื“ืžืชืจื™ ืงืจืื™ ืงืืชื™, since these two ืื™ืกื•ืจื™ื of ื—ืœื‘ come from two separate ืคืกื•ืงื™ื, ื”ื ืคืœื™ื’ื™ ื‘ื˜ืขืžื™ื™ื”ื•, so they are different in their reasons, and therefore it's considered that he ืคืกืงื ื˜ it concerning a different ืขื‘ื™ืจื” than they did. And even though ื—ืœื‘ is an ืื™ืกื•ืจ which is clearly written in the ืชื•ืจื”, and we said in the ื’ืžืจื earlier that if they ืคืกืงื ื˜ a ื“ื™ืŸ concerning a ื“ื™ืŸ which is clearly written in the ืชื•ืจื”, which even the ืฆื“ื•ืงื™ื ืžื•ื“ื• ื‘ื™ื”, then the whole ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ doesn't apply, and the same thing would be concerning the ืคืจ ื›ื”ืŸ ืžืฉื™ื—, that if he ืคืกืงื ื˜ concerning a ื“ื™ืŸ which is clearly written in the ืชื•ืจื”, there is no ื“ื™ืŸ of ืคืจ ื›ื”ืŸ ืžืฉื™ื—. So how can the ื’ืžืจื give an example here of them ืคืกืงื ื™ื ื’ concerning ื—ืœื‘? So ืจืฉืดื™ explains that this is not clearly written in the ืชื•ืจื”. We learn it out from ืœื™ืžื•ื“ื™ื. The ืชื•ืจื” does mention ื—ืœื‘, but this type of ื—ืœื‘ here is not really written in the ืชื•ืจื” clearly and therefore, concerning this ื—ืœื‘ there would be a ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ and ืคืจ ื›ื”ืŸ ืžืฉื™ื—. Or ืจืฉืดื™ says that maybe their argument was concerning a ื›ื–ื™ืช, whether you have to have a ื›ื–ื™ืช in order to be ื—ื™ื™ื‘ or not, and that is definitely not written clearly in the ืชื•ืจื”. But whatever it is, the ื’ืžืจื's question is that if he ืคืกืงื ื˜ concerning ื—ืœื‘ which is on the ืงืจื‘ and they ืคืกืงื ื˜ concerning ื—ืœื‘ of the ื“ืงื™ืŸ, do we say that since they are learned out from two separate ืคืกื•ืงื™ื, so then it is considered that they ืคืกืงื ื˜ in two separate ื“ื™ื ื™ื, ืื• ื“ื™ืœืžื, or maybe ืฉื ื—ืœื‘ ืื—ื“ ื”ื•ื, the name ื—ืœื‘ is the same, and therefore it is considered the same ืื™ืกื•ืจ and he wouldn't bring his own ืงืจื‘ืŸ, but he would be included in their ืงืจื‘ืŸ. And the ื’ืžืจื continues, ืื ืชืžืฆื™ ืœื•ืžืจ, if for some reason you are going to say that ืฉื ื—ืœื‘ ืื—ื“ ื”ื•ื, that it's one name of ื—ืœื‘ and therefore he would not bring his own ืงืจื‘ืŸ, what would be the ื“ื™ืŸ ื”ื•ื ื‘ื—ืœื‘ ื•ื”ื ื‘ื“ื, ืžื”ื•?

Milk versus blood: separate offenses?

He ืคืกืงื ื˜ concerning ื—ืœื‘ and they ืคืกืงื ื˜ concerning blood, he allowed himself to eat ื—ืœื‘ and the ื‘ื™ืช ื“ื™ืŸ allowed the ืฆื™ื‘ื•ืจ to drink blood. ืžื™ ืืžืจื™ื ืŸ, do we say ื‘ื˜ืขืžื™ื™ื”ื• ืคืœื™ื’ื™, here definitely they are different reasons, which means definitely they are two separate ืื™ืกื•ืจื™ื, and therefore he would be ื—ื™ื™ื‘ his own ืงืจื‘ืŸ, ืื• ื“ื™ืœืžื, or maybe ื›ื™ื•ื•ืŸ ื“ืฉื•ื•ื™ื• ื‘ืงืจื‘ืŸ, since they are the same ืงืจื‘ืŸ, because for ื—ืœื‘ and for ื“ื you bring the same ืงืจื‘ืŸ, so I would think ื‘ืชืจ ืงืจื‘ืŸ ืื–ืœื™ื ืŸ, we go after the ืงืจื‘ืŸ, and it is considered as if they ืคืกืงื ื˜ concerning the same ืขื ื™ืŸ, and therefore he would not have to bring his own ืงืจื‘ืŸ. And the ื’ืžืจื says ืชื™ืงื•, this question remains unanswered. Then the ื’ืžืจื quotes from the ืžืฉื ื”, it said ืฉืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ ืขื“ ืฉื™ื•ืจื• ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช ื•ื›ื•ืœื™, that in what way do we see that a ื›ื”ืŸ ืžืฉื™ื— is similar to the ืฆื™ื‘ื•ืจ? That just like the ืฆื™ื‘ื•ืจ is not ื—ื™ื™ื‘ unless they ืคืกืงื ื˜ to be ืžื‘ื˜ืœ part of the ืžืฆื•ื” and to be ืžืงื™ื™ื part of the ืžืฆื•ื”, the same the ื›ื”ืŸ ื’ื“ื•ืœ, when is he ื—ื™ื™ื‘? Only if he ืคืกืงื ื˜ to be ืžืงื™ื™ื part of the ืžืฆื•ื” and to be ืžื‘ื˜ืœ part of the ืžืฆื•ื”. And the ื’ืžืจื says ืžื ื ื”ื ื™ ืžื™ืœื™, how do we know that ืขื“ ืฉื™ื•ืจื• ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช, that when is the ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ only if they ืคืกืงื ื˜ to be ืžื‘ื˜ืœ part and to be ืžืงื™ื™ื part? And the ื’ืžืจื says ื›ื™ ื“ืืžืจื™ื ืŸ ื‘ืื™ื“ืš ืคื™ืจืงื, like we said in the other ืคืจืง, that we learn it out from the ืคืกื•ืง ื•ื ืขืœื ื“ื‘ืจ, it says that the thing will be covered from the eyes of the ืขื“ื”, so we say ื“ื‘ืจ ื•ืœื ื›ืœ ื”ื’ื•ืฃ, only a thing, which means part of the ืžืฆื•ื” will be hidden, will be mistaken, but not the whole ื’ื•ืฃ, not the whole ืžืฆื•ื”, but if the whole ืžืฆื•ื” was mistaken, then there is no ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. ื•ื›ืŸ ื”ืžืฉื™ื—, the

Kohen Mashiach Liability Mirrors Publicโ€™s Partial Violation Rule

ืžืฉื ื” says so too the ื›ื”ืŸ ืžืฉื™ื—, that he also is only ื—ื™ื™ื‘ his ืคืจ ื›ื”ืŸ ืžืฉื™ื— if it was only ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช. ืžื ืœืŸ, the ื’ืžืจื says how do we know that? And the answer is ื“ื›ืชื™ื‘, because the ืคืกื•ืง says ืœืืฉืžืช ื”ืขื, the ื›ื”ืŸ ื’ื“ื•ืœ will sin to the ืขื‘ื™ืจื” of the ืขื. What does that mean? ื”ืจื™ ืžืฉื™ื— ื›ืฆื™ื‘ื•ืจ, that the ืžืฉื™ื— has the same ื“ื™ืŸ as the ืฆื™ื‘ื•ืจ and therefore by him we also say the ื“ื™ืŸ that he's only ื—ื™ื™ื‘ if he ืคืกืงื ื˜ ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช. And then the ืžืฉื ื” continued, ื•ืœื ื‘ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื ื•ื›ื•ืœื™, and by ืขื‘ื•ื“ื” ื–ืจื” also, when is the ืฆื™ื‘ื•ืจ ื—ื™ื™ื‘ for ืขื‘ื•ื“ื” ื–ืจื”? Only if they ืคืกืงื ื˜ ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช. But if they would have ืคืกืงื ื˜ that there is no ืขื‘ื•ื“ื” ื–ืจื” in the ืชื•ืจื”, then they wouldn't have to bring their special ืงืจื‘ืŸ concerning ืขื‘ื•ื“ื” ื–ืจื”. And the ื’ืžืจื asks ืžื ืœืŸ, how do we know this ื“ื™ืŸ? And the ื’ืžืจื answers ื“ืชื ื• ืจื‘ื ืŸ, because the ืจื‘ื ืŸ learned, ืœืคื™ ืฉื™ืฆืืช ืขื‘ื•ื“ืช ื›ื•ื›ื‘ื™ื ืœื“ื•ืŸ ื‘ืขืฆืžื•, since ืขื‘ื•ื“ื” ื–ืจื” went out of the rule to be judged by itself, because ืขื‘ื•ื“ื” ื–ืจื” is also an ืขื‘ื™ืจื” that you get ื›ืจืช for. So ื‘ืืžืช ืขื‘ื•ื“ื” ื–ืจื” is included in the general ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. Nevertheless, the ืชื•ืจื” took out ืขื‘ื•ื“ื” ื–ืจื” from the ื›ืœืœ, and made ืขื‘ื•ื“ื” ื–ืจื” a special ื“ื™ืŸ. For all other ืขื‘ื™ืจื•ืช that you get ื›ืจืช for, there is a ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. For ืขื‘ื•ื“ื” ื–ืจื”, the ืชื•ืจื” said there is a ืคืจ and a ืฉืขื™ืจ, a special ื“ื™ืŸ of an ืขื•ืœื” and a ื—ื˜ืืช. So, since ืขื‘ื•ื“ื” ื–ืจื” was taken out of the general ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, ื™ื›ื•ืœ, I would think, you were ื—ื™ื™ื‘ on a ืขืงื™ืจืช ืžืฆื•ื” ื›ื•ืœื”, that you should be ื—ื™ื™ื‘ by ืขื‘ื•ื“ื” ื–ืจื” even if they tear out the whole ืžืฆื•ื”, even if ื‘ื™ืช ื“ื™ืŸ would ืคืกืงืŸ that there is no ื“ื™ืŸ of ืขื‘ื•ื“ื” ื–ืจื” at all, still, you would have to bring the ืงืจื‘ืŸ of ืขื‘ื•ื“ื” ื–ืจื”. Cause this ื“ื™ืŸ that we said before that we learn out only if you are ืžื‘ื˜ืœ ืžืงืฆืช ื•ืžืงื™ื™ื ืžืงืฆืช, that's when there is a ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, and we learned it out from the ืคืกื•ืง "ื•ื ืขืœื ื“ื‘ืจ", that ืคืกื•ืง is said concerning the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. But now that ืขื‘ื•ื“ื” ื–ืจื” is taken out from the regular ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, so this ืคืกื•ืง, "ื•ื ืขืœื ื“ื‘ืจ", which teaches us ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช, doesn't apply to ืขื‘ื•ื“ื” ื–ืจื”. So, we

Special Avodah Zarah Offering Even If Whole Prohibition Is Nullified

would think that by ืขื‘ื•ื“ื” ื–ืจื”, ื˜ืืงืข the ื“ื™ืŸ is different, that even if they were ืžื‘ื˜ืœ the whole ื“ื™ืŸ of ืขื‘ื•ื“ื” ื–ืจื”, there is also this special ืงืจื‘ืŸ of ืขื‘ื•ื“ื” ื–ืจื”. Therefore, we learn out, ื ืืžืจ ื›ืืŸ ืžืขื™ื ื™ ื•ื ืืžืจ ืœื”ืœืŸ ืžืขื™ื ื™. By ืขื‘ื•ื“ื” ื–ืจื” the ืคืกื•ืง says "ืžืขื™ื ื™", and by the regular ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ the ืคืกื•ืง says "ืžืขื™ื ื™". ืžื” ืœื”ืœืŸ ื‘ื‘ื™ืช ื“ื™ืŸ ืืฃ ื›ืืŸ ื ืžื™ ื‘ื‘ื™ืช ื“ื™ืŸ. So, we know that the ืคืกื•ืง here that it says you bring a ืคืจ and a ืฉืขื™ืจ for a ื—ื˜ืืช and an ืขื•ืœื”, is speaking by ื‘ื™ืช ื“ื™ืŸ, just like by the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. We know that when do you bring that ืงืจื‘ืŸ? Only if it came after a ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ. So, we know that by ืขื‘ื•ื“ื” ื–ืจื”, when do you bring this ืคืจ ื•ืฉืขื™ืจ? Only if it came after a ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ. And the reason we need this ืœื™ืžื•ื“, because by ืขื‘ื•ื“ื” ื–ืจื” it doesn't say it has to come through the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ, cause there it says, "ื•ื”ื™ื” ืื ืžืขื™ื ื™ ื”ืขื“ื” ื ืขืฉืชื” ืœืฉื’ื’ื”", if from the eyes of the community it was done ื‘ืฉื’ื’ื”. Now, there we can't say that the word ืขื“ื” means the ื‘ื™ืช ื“ื™ืŸ, because it says, "ืžืขื™ื ื™ ื”ืขื“ื” ื ืขืฉืชื” ืœืฉื’ื’ื”", that from the ืขื™ื ื™ ื”ืขื“ื” it was done ื‘ืฉื’ื’ื”. That's as if it's saying that the ืขื“ื” did it. Now, if the ืขื“ื” means ื‘ื™ืช ื“ื™ืŸ, it's as if it's saying that the ื‘ื™ืช ื“ื™ืŸ did it. And the ื“ื™ืŸ is that the ืžืขืฉื” is ืชืœื•ื™ in the ืฆื™ื‘ื•ืจ, it is the ื”ื•ืจืื” that is ืชืœื•ื™ in ื‘ื™ืช ื“ื™ืŸ. So therefore, over there by ืขื‘ื•ื“ื” ื–ืจื” where it says "ื•ื”ื™ื” ืื ืžืขื™ื ื™ ื”ืขื“ื” ื ืขืฉืชื”", it ื˜ืืงืข doesn't mean ื‘ื™ืช ื“ื™ืŸ. Now, since that doesn't mean ื‘ื™ืช ื“ื™ืŸ, the ืคืกื•ืง doesn't mention that this comes only after a ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ. So therefore, we have to learn it out with the ื’ื–ื™ืจื” ืฉื•ื” from the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. That just like over there it definitely does mean ื‘ื™ืช ื“ื™ืŸ, and that we know because the ืคืกื•ืง says "ื•ื ืขืœื ื“ื‘ืจ ืžืขื™ื ื™ ื”ืงื”ืœ", and that is ื‘ื™ืช ื“ื™ืŸ. So too, in the case of ืขื‘ื•ื“ื” ื–ืจื”, when are they ื—ื™ื™ื‘ this ืงืจื‘ืŸ? Only if it came through a ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ. And we also learn out another ื“ื™ืŸ, ื•ืžื” ืœื”ืœืŸ ื“ื‘ืจ ื•ืœื ื›ืœ ื”ื’ื•ืฃ, and just like by the case of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, when is this ืงืจื‘ืŸ ื—ื™ื™ื‘? Only if they were ืžื‘ื˜ืœ part of it, but not the whole ื’ื•ืฃ, ืืฃ ื›ืืŸ ื ืžื™ ื“ื‘ืจ ื•ืœื ื›ืœ ื”ื’ื•ืฃ. So, too by ืขื‘ื•ื“ื” ื–ืจื”, when are they ื—ื™ื™ื‘ this special ืงืจื‘ืŸ, ืคืจ ื•ืฉืขื™ืจ, for ืขื‘ื•ื“ื” ื–ืจื”? Only if the ื‘ื™ืช ื“ื™ืŸ was ืžื‘ื˜ืœ part of the ื“ื™ืŸ of ืขื‘ื•ื“ื” ื–ืจื”. But if the ื‘ื™ืช ื“ื™ืŸ was ืžื‘ื˜ืœ the whole ื“ื™ืŸ of ืขื‘ื•ื“ื” ื–ืจื”, then there is no special ื“ื™ืŸ of the ืงืจื‘ืŸ for ืขื‘ื•ื“ื” ื–ืจื”. But

Tosafotโ€™s Question on Deriving Avodah Zarah Law

ืชื•ืกืคื•ืช asks a ืงืฉื™ื on the last thing that we just learned, that we learn out from the ื’ื–ื™ืจื” ืฉื•ื” "ืžืขื™ื ื™", that we learn out ืขื‘ื•ื“ื” ื–ืจื” from ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. Just like by ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, it came through ื‘ื™ืช ื“ื™ืŸ, so too by ืขื‘ื•ื“ื” ื–ืจื”, the only time they're ื—ื™ื™ื‘ that special ืงืจื‘ืŸ, only if it comes with the ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ. And as we said before, because by ืขื‘ื•ื“ื” ื–ืจื” it doesn't mention ื‘ื™ืช ื“ื™ืŸ. All it says is, "ื•ื”ื™ื” ืื ืžืขื™ื ื™ ื”ืขื“ื” ื ืขืฉืชื” ืœืฉื’ื’ื”", and that doesn't mean ื‘ื™ืช ื“ื™ืŸ. So, how do we know it has to come through a ื”ื•ืจืื” from ื‘ื™ืช ื“ื™ืŸ? So, we have the ื’ื–ื™ืจื” ืฉื•ื” "ืžืขื™ื ื™" "ืžืขื™ื ื™" from ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, and just like over there where it says "ื•ื ืขืœื ื“ื‘ืจ ืžืขื™ื ื™ ื”ืงื”ืœ", it means ื‘ื™ืช ื“ื™ืŸ, so by ืขื‘ื•ื“ื” ื–ืจื” also it means that it came through the ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ. But ืชื•ืกืคื•ืช asks a ืงืฉื™ื, in the first ืคืจืง in ื“ืฃ ื”' ืขืžื•ื“ ื‘' on the top of the ืขืžื•ื“, when the ื’ืžืจื asked that according to ืจื‘ื™ ืฉืžืขื•ืŸ and ืจื‘ื™ ืžืื™ืจ, how do we know the ื”ื•ืจืื” ืชืœื•ื™ื” ื‘ื‘ื™ืช ื“ื™ืŸ ื•ืžืขืฉื” ืชืœื•ื™ ื‘ืงื”ืœ? So ืื‘ื™ื™ said because the ืคืกื•ืง says "ื•ื”ื™ื” ืื ืžืขื™ื ื™ ื”ืขื“ื” ื ืขืฉืชื” ืœืฉื’ื’ื”", so from that ืคืกื•ืง we learn out that it has to come through a ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ. And the ื’ืžืจื over there says, "ื•ื”ื ื›ื™ ื›ืชื™ื‘ื™ ื”ื ื™ ืงืจืื™ ื‘ืขื‘ื•ื“ื” ื–ืจื” ื”ื•ื ื“ื›ืชื™ื‘ื™", that this ืคืกื•ืง that we just quoted is by ืขื‘ื•ื“ื” ื–ืจื”. So, how do we know that by all other ืขื‘ื™ืจื•ืช it also depends on ื‘ื™ืช ื“ื™ืŸ? And the ื’ืžืจื answers, "ื™ืœืคื™ื ืŸ ืžืขื™ื ื™ ืžืขื™ื ื™". We learn out a ื’ื–ื™ืจื” ืฉื•ื” "ืžืขื™ื ื™" "ืžืขื™ื ื™". Just like by ืขื‘ื•ื“ื” ื–ืจื”, where it says "ืžืขื™ื ื™", it has to come through the ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ, so we know by other ืขื‘ื™ืจื•ืช, also it has to come through a ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ. So, this is ืžืžืฉ the opposite of what the ื’ืžืจื is saying here. The ื’ืžืจื here is saying that how do we know that by ืขื‘ื•ื“ื” ื–ืจื” it has to come through ื‘ื™ืช ื“ื™ืŸ, we learn it out from other ืขื‘ื™ืจื•ืช. And over there it said that we learn out other ืขื‘ื™ืจื•ืช from ืขื‘ื•ื“ื” ื–ืจื”. So, ืชื•ืกืคื•ืช answers that ื‘ืืžืช what ืื‘ื™ื™ meant to say there was ืžืžืฉ like the ื’ืžืจื says here. That by ืขื‘ื•ื“ื” ื–ืจื” ื˜ืืงืข we don't know that it has to come through ื‘ื™ืช ื“ื™ืŸ. And the only way we know that it has to come through ื‘ื™ืช ื“ื™ืŸ is because we learn it with a ื’ื–ื™ืจื” ืฉื•ื” from ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ by all other ืขื‘ื™ืจื•ืช, that just like there it comes through ื‘ื™ืช ื“ื™ืŸ, so too by ืขื‘ื•ื“ื” ื–ืจื” it has to come through ื‘ื™ืช ื“ื™ืŸ. What the ื’ืžืจื meant over there that we learn out from ืขื‘ื•ื“ื” ื–ืจื” to other ืžืฆื•ืช, that ื”ื•ืจืื” ืชืœื•ื™ื” ื‘ื‘ื™ืช ื“ื™ืŸ ื•ืžืขืฉื” ืชืœื•ื™ ื‘ืงื”ืœ, the ื’ืžืจื didn't mean concerning Concerning the first part, that it has to come through a ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ, it meant the second half, that the ืžืขืฉื” has to come through the ืงื”ืœ, because there the ื’ืžืจื said that from the ืคืกื•ืง we learn out ื”ื•ืจืื” ืชืœื•ื™ื” ื‘ื‘ื™ืช ื“ื™ืŸ ื•ืžืขืฉื” ืชืœื•ื™ ื‘ืงื”ืœ. So concerning the second half, ืžืขืฉื” ืชืœื•ื™ ื‘ืงื”ืœ, that we would not know by other ืžืฆื•ืช, by ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, if we would not learn it out from ืขื‘ื•ื“ื” ื–ืจื”. Because by ืขื‘ื•ื“ื” ื–ืจื” it says that ื•ื”ื™ื” ืื ืžืขื™ื ื™ ื”ืขื“ื” ื ืขืฉืชื” ืœืฉื’ื’ื”, so here it says that the ืขื“ื” has to do the ืขื‘ื™ืจื” ื‘ืฉื•ื’ื’. So by ืขื‘ื•ื“ื” ื–ืจื” we know that the ืžืขืฉื” is ืชืœื•ื™ ื‘ืงื”ืœ. So we learn out this part from ืขื‘ื•ื“ื” ื–ืจื” to ืฉืืจ ืžืฆื•ืช, to ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ. And that's how the two ื’ืžืจื•ืช fit: that it has to do with ื‘ื™ืช ื“ื™ืŸ, we learn out ืขื‘ื•ื“ื” ื–ืจื” from ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ; that the ืžืขืฉื” is ืชืœื•ื™ ื‘ืงื”ืœ, that we learn out by ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ from ืขื‘ื•ื“ื” ื–ืจื”.

Deriving Publicโ€™s Partial Violation Rule from โ€˜Vanโ€™alem Dvarโ€™

Concerning where the ื’ืžืจื said that how do we know that when is there a ื“ื™ืŸ of ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ only if they're ืžื‘ื˜ืœ ืžืงืฆืช ื•ืžืงื™ื™ื ืžืงืฆืช is because we learn it out from the ืคืกื•ืง ื•ื ืขืœื ื“ื‘ืจ, ื“ื‘ืจ ื•ืœื ื›ืœ ื”ื’ื•ืฃ. And then the ื’ืžืจื said how do we know that a ื›ื”ืŸ ืžืฉื™ื— has the same ื“ื™ืŸ? So the ื’ืžืจื said, because it says ืœืืฉืžืช ื”ืขื, that a ืžืฉื™ื— is ื›ืฆื™ื‘ื•ืจ. So the ืชื•ืกืคื•ืช ื”ืจื"ืฉ asks a ืงืฉื™ื, why do we have to learn out ื›ื”ืŸ ืžืฉื™ื— from ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ? And ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ itself is taken because the ืคืกื•ืง says ื“ื‘ืจ, and we say ื“ื‘ืจ ื•ืœื ื›ืœ ื”ื’ื•ืฃ, we have a ืคืกื•ืง by ื›ื”ืŸ ื’ื“ื•ืœ himself which could tell us the same ื“ื™ืŸ, because the ืคืกื•ืง says there that he will do an ืขื‘ื™ืจื”, so it says ืžืื—ืช ืžื”ื ื”. He will do from one of them. From one of them, which means not the whole thing. So that tells us clearly that when is he ื—ื™ื™ื‘? Only if he was ืžื‘ื˜ืœ ืžืงืฆืช. But if he was ืžื‘ื˜ืœ the whole thing, he is not ื—ื™ื™ื‘. And the ืจื"ืฉ answers from there it's no ืจืื™ื”, because that is a ืคืกื•ืง that speaks about the ืขืฉื™ื”. It says ื•ืขืฉื” ืžืื—ืช ืžื”ื ื”, he will do the ืขื‘ื™ืจื” from one of them. So we know that when it comes to do the ืขื‘ื™ืจื”, when is he ื—ื™ื™ื‘? Only if he is ืžื‘ื˜ืœ part of the ืขื‘ื™ืจื”, not the whole thing. But what we're trying to learn out here is not concerning the ืขื‘ื™ืจื” when it's done, but concerning the ื”ื•ืจืื”, the ืคืกืง ื“ื™ืŸ, that when is the ื›ื”ืŸ ื’ื“ื•ืœ ื—ื™ื™ื‘? Only if his ืคืกืง ื“ื™ืŸ ืœื›ืชื—ื™ืœื” was only ืœื‘ื˜ืœ ืžืงืฆืช. But let's say if his ืคืกืง ื“ื™ืŸ was to ืžื‘ื˜ืœ the whole thing, but the ืขื‘ื™ืจื” he did was only ืžืงืฆืช, then he is also ืคื˜ื•ืจ. So from the ืคืกื•ืง ืžืื—ืช ืžื”ื ื” we would only know that if he did part of the ืขื‘ื™ืจื”, then he is ื—ื™ื™ื‘. But how would we know that he has to ืคืกืงืŸ also concerning part of the ืขื‘ื™ืจื”? So that the ื’ืžืจื says we learn out because we compare ืžืฉื™ื— to ืฆื™ื‘ื•ืจ from the ืคืกื•ืง ืœืืฉืžืช ื”ืขื. And then the ืจื"ืฉ says that anyway we couldn't use the ืž of ืžืื—ืช ืžื”ื ื” to tell us that a ื›ื”ืŸ ื’ื“ื•ืœ would only be ื—ื™ื™ื‘ if it was ืžื‘ื˜ืœ ืžืงืฆืช, because that ืž is used for something else. The ื’ืžืจื in ืฉื‘ืช says that we learn this ืคืกื•ืง to teach us that if a person wrote ืฉื ืžืฉืžืขื•ืŸ, he's ื—ื™ื™ื‘. If he wrote ืฉื™ืŸ ืžื, intending to write the whole name ืฉืžืขื•ืŸ, but he just wrote the word ืฉื, he is also ื—ื™ื™ื‘. And how do we know that? Because the ืคืกื•ืง says ืžืื—ืช ืžื”ื ื”, even if it was part of the name he intended to write, he is ื—ื™ื™ื‘. So since the ืคืกื•ืง is used up for that, so we already can't use the ืคืกื•ืง for the ื“ื™ืŸ that the ืจื"ืฉ asks we should use it for here.

Rashi on Beth Din vs. Public Responsibility in Mishnah

Concerning what it said in the ืžืฉื ื” that ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ ืขื“ ืฉื™ื•ืจื• ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช, that ื‘ื™ืช ื“ื™ืŸ is not ื—ื™ื™ื‘ unless they ืคืกืงืŸ to be ืžื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช, so we mentioned that ืจืฉ"ื™ says that even though there is a ืžื—ืœื•ืงืช who brings the ืงืจื‘ืŸ, whether it's the ื‘ื™ืช ื“ื™ืŸ that brings or the ืฆื™ื‘ื•ืจ brings, so when the ืžืฉื ื” says that the ื‘ื™ืช ื“ื™ืŸ brings, ืกืชื ืžืฉื ื” ื›ืจื‘ื™ ืžืื™ืจ, and ืจื‘ื™ ืžืื™ืจ is of the opinion that holds that the ื‘ื™ืช ื“ื™ืŸ brings. So the ืจื"ืฉ asks a ืงืฉื™ื here that ืœื›ืื•ืจื” this contradicts what ืจืฉ"ื™ himself said in the beginning of the ืคืจืง. Because in the beginning of the ืคืจืง, where it says that ืฉืžื•ืืœ said ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ ืขื“ ืฉื™ืืžืจื• ืœื”ื ืžื•ืชืจื™ืŸ ืืชื, that ื‘ื™ืช ื“ื™ืŸ is not ื—ื™ื™ื‘ unless they said in the ืคืกืง ื“ื™ืŸ you are allowed to do it, so there ืจืฉ"ื™ said that when it says ื‘ื™ืช ื“ื™ืŸ is not ื—ื™ื™ื‘, it doesn't mean because we ืคืกืงืŸ that the ื‘ื™ืช ื“ื™ืŸ is the one that's ื—ื™ื™ื‘, it means whoever is ื—ื™ื™ื‘, whether it is the ื‘ื™ืช ื“ื™ืŸ or the ืฆื™ื‘ื•ืจ, and when it says the ืœืฉื•ืŸ ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ, it means because it is only if it followed the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ. So we see here that ืจืฉ"ื™ learns that when it says ื‘ื™ืช ื“ื™ืŸ, it doesn't mean ื“ื•ืงื ื‘ื™ืช ื“ื™ืŸ. It just means the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, and since it comes through a ื”ื•ืจืื” of ื‘ื™ืช ื“ื™ืŸ, we could use the ืœืฉื•ืŸ of ื‘ื™ืช ื“ื™ืŸ. So how come here ืจืฉ"ื™ is ืžื“ื™ื™ืง that when it says in the ืžืฉื ื” that ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ ืขื“ ืฉื™ื•ืจื• ืœื‘ื˜ืœ ืžืงืฆืช ื•ืœืงื™ื™ื ืžืงืฆืช, this is a ืจืื™ื” that the ืžืฉื ื” ืคืกืงื ืก that the ื‘ื™ืช ื“ื™ืŸ is the one that brings? Maybe here too it means the ืคืจ ื”ืขืœื ื“ื‘ืจ ืฉืœ ืฆื™ื‘ื•ืจ, but when it says ื‘ื™ืช ื“ื™ืŸ is because it depends on the ืคืกืง ื“ื™ืŸ of ื‘ื™ืช ื“ื™ืŸ? So the ืจื"ืฉ answers maybe the ืคืฉื˜ is that over there, where it just says the ืœืฉื•ืŸ ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ, it is not a ืจืื™ื” that the ื‘ื™ืช ื“ื™ืŸ is the one that brings. But here, since it says right after that ื•ื›ืŸ ื”ืžืฉื™ื—, and by ืžืฉื™ื— it ื˜ืืงืข means the ื›ื”ืŸ ืžืฉื™ื— himself who brings the ืงืจื‘ืŸ, so here where it says ืื™ืŸ ื‘ื™ืช ื“ื™ืŸ ื—ื™ื™ื‘ื™ืŸ, it's ืžืฉืžืข that the ื‘ื™ืช ื“ื™ืŸ ื˜ืืงืข themselves are the one that are ื—ื™ื™ื‘. And that's why here the ืจืฉ"ื™ says that it ื˜ืืงืข follows the opinion that the ื‘ื™ืช ื“ื™ืŸ is the one that brings.
