Opening: Tractate Sanhedrin Chapter Two Introduction

Jewish audio on Chabad.org. This 砖讬注讜专 will be 诪住讻转 住谞讛讚专讬谉 讚祝 讬状讞. We will start from the beginning of the second 驻专拽. And the 诪砖谞讛 starts off by saying: 讻讛谉 讙讚讜诇 讚谉 讜讚谞讬谉 讗讜转讜. A 讻讛谉 讙讚讜诇 can judge, he can be a 讚讬讬谉, and he can be judged. And 转讜住驻讜转 explains the reason why this 驻专拽 starts with the 讚讬谞讬诐 of 讻讛谉 讙讚讜诇, and later goes on with the 讚讬谞讬诐 of a 诪诇讱, even though this is in middle of 住谞讛讚专讬谉, in middle of the 讚讬谞讬诐 of 住谞讛讚专讬谉, as the first 驻专拽 discussed the 讚讬谞讬诐 of 住谞讛讚专讬谉 and the 驻专拽讬诐 afterwards will also be concerning the 讚讬谞讬诐 of 住谞讛讚专讬谉, so why did the 诪砖谞讛 in middle come in with a 驻专拽 concerning the 讻讛谉 讙讚讜诇 and then the 诪诇讱? 转讜住驻讜转 says, because since we mentioned the 讚讬谉 of a 讻讛谉 讙讚讜诇 in the previous 驻专拽, it said that when you come to judge a 讻讛谉 讙讚讜诇, you must have a 讘讬转 讚讬谉 of 71, so we spoke about a 讻讛谉 讙讚讜诇, so he already goes into the 讚讬谞讬诐 of 讻讛谉 讙讚讜诇. Now, since he already mentioned the 讚讬谞讬诐 of a 讻讛谉 讙讚讜诇, he already goes into the 讚讬谞讬诐 of a 诪诇讱, who is in a level higher than the 讻讛谉 讙讚讜诇, and when he finishes with that, he goes back to the 讚讬谞讬诐 of 住谞讛讚专讬谉. But the 诪砖谞讛 said that the 讻讛谉 讙讚讜诇 can judge and can be judged, 诪注讬讚 讜诪注讬讚讬谉 讗讜转讜, he could testify, and he could be testified for. 讞讜诇抓 讜讞讜诇爪讬谉 诇讗砖转讜, he could give 讞诇讬爪讛, and his wife gets 讞诇讬爪讛. The 讚讬谉 of 讞诇讬爪讛 is, is that if a person dies without children and leaves a wife, and he has a brother, so his brother must be 诪讬讬讘诐, marry the wife of his brother, or if he doesn't want, he's able to give 讞诇讬爪讛 instead. So what the 诪砖谞讛 says that a 讻讛谉 讙讚讜诇 gives 讞诇讬爪讛, that if his brother died and left a wife without children, the 讻讛谉 讙讚讜诇 gives her 讞诇讬爪讛, and also, if the 讻讛谉 讙讚讜诇 dies and has no children, so then his wife gets 讞诇讬爪讛 by the brother of the 讻讛谉 讙讚讜诇. 讜诪讬讬讘诪讬谉 讗转 讗砖转讜, and you could be 诪讬讬讘诐 his wife, if the 讻讛谉 讙讚讜诇 dies without children, so the brother of the 讻讛谉 讙讚讜诇 is allowed to be 诪讬讬讘诐, marry the wife of the 讻讛谉 讙讚讜诇, 讗讘诇 讛讜讗 讗讬谞讜 诪讬讬讘诐, but he cannot give 讬讘讜诐. If his brother dies, so he cannot marry the widow of his brother, 诪驻谞讬 砖讛讜讗 讗住讜专 讘讗诇诪谞讛, because he is not allowed to marry an 讗诇诪谞讛. A 讻讛谉 讙讚讜诇 is not allowed to marry a widow, so this wife of his brother is a widow, and since he is not allowed to marry a widow, he can't marry her. So the only thing he could do is give her 讞诇讬爪讛.

Kohen Gadol Prohibited from Touching the Dead

诪转 诇讜 诪转, if a person died in the family of the 讻讛谉 讙讚讜诇, 讗讬谞讜 讬讜爪讗 讗讞专 讛诪讟讛, he's not allowed to follow the bed. And it doesn't only mean that he's not allowed to touch the bed, that's a 诪驻讜专砖 驻住讜拽 where it says that he's not allowed to become 讟诪讗 even to those relatives that a regular 讻讛谉, a 讻讛谉 讛讚讬讜讟, is allowed to become 讟诪讗, a 讻讛谉 讙讚讜诇 is not allowed. But what the 诪砖谞讛 is saying here, that not only can't he touch, you can't even follow the bed. And the reason is, because he might come to touch it. If he follows it, he might come to touch it. And this is what the 驻住讜拽 means when the 驻住讜拽 says: 诪谉 讛诪拽讚砖 诇讗 讬爪讗, the 讻讛谉 讙讚讜诇 should not go out from the 诪拽讚砖, that means that he should not go out from his 拽讚讜砖讛. It doesn't mean actually the 讘讬转 讛诪拽讚砖, it means from his 拽讚讜砖讛. He shouldn't do anything that might bring him to desecrate his 拽讚讜砖讛. And therefore, he should not only not actually become 讟诪讗, but he also should not do anything that might lead him to become 讟诪讗. And therefore, he can't even follow the bed of the 诪转. So what is done when the bed is carried and there are other mourners, other 讗讘诇讬诐 that follow the bed? 讗诇讗 讛谉 谞讻住讬谉 讜讛讜讗 谞讙诇讛, they are hidden and he is revealed. 讛谉 谞讙诇讬谉 讜讛讜讗 谞讻住讛, they are revealed and he is hidden. And this means, as 专砖状讬 explains, that when they follow the bed, you make it so that when they go into the street to follow the bed, he is not allowed to enter the street. But when they turn the corner, when they go out of that street, that means they are hidden, that's when he is revealed, that's when he is allowed to go into that street. Now, in the second street that they entered and they are revealed there, they are there, so he has to be hidden, which means he cannot enter that street. He has to stay far behind. 讜讬讜爪讗 注诪讛谉, and he goes out with them. That's the way he follows them, 注讚 驻转讞 砖注专 讛注讬专, till the door of the gate of the city.

Rabbi Meir vs Rabbi Yehuda on Mourning Restrictions

讚讘专讬 专讘讬 诪讗讬专, this is the opinion of 专讘讬 诪讗讬专. 专讘讬 讬讛讜讚讛 讗讜诪专, 专讘讬 讬讛讜讚讛 says: 讗讬谞讜 讬讜爪讗 诪谉 讛诪拽讚砖, he doesn't go out of the 讘讬转 讛诪拽讚砖 at all, 诪砖讜诐 砖谞讗诪专, because the 驻住讜拽 says: 诪谉 讛诪拽讚砖 诇讗 讬爪讗, he should not go out of the 诪拽讚砖. And 专讘讬 讬讛讜讚讛 learns that this means literally that he cannot go out of the 讘讬转 讛诪拽讚砖. According to 专讘讬 诪讗讬专, as we said before, he learns that means he should not go out of his 拽讚讜砖讛. He should stay far away that it shouldn't cause him to leave the 拽讚讜砖讛, to become 讟诪讗. But 专讘讬 讬讛讜讚讛 learns that means literally that he is not allowed to go out of the 诪拽讚砖, he doesn't follow the bed at all. Now the normal way it's usually done is, the way it used to be done at that time was, that the 讗讘诇 would stand in one place and the people who were 诪谞讞诐 the 讗讘诇, on the way from the 诇讜讬讛, they would pass by the 讗讘诇 and be 诪谞讞诐 him. Not like it's done now, that the people stand in two lines, and the 讗讘诇 passes in between the lines. But it used to be done that the 讗讘诇 would stand in one place and the people would make a 砖讜专讛, a line, and they would pass by one after another and they would comfort the 讗讘诇, they would be 诪谞讞诐 the 讗讘诇. So that's how it usually is. But in the case of the 讻讛谉 讙讚讜诇, 讛诪诪讜谞讛 诪诪爪注 讘讬谞讜 诇讘讬谉 讛注诐. The 诪诪讜谞讛, that means the one that is appointed, that means the 住讙谉, the second in command to the 讻讛谉 讙讚讜诇. So he would be between him and the other people, that he would be standing as 专砖''讬 says on his right side and all other people would be on the left side, so it comes out that the 讻讛谉 讙讚讜诇 is in the middle. And that's the way he would walk to be 诪谞讞诐 the 讗讘诇. 讜讻砖讛讜讗 诪转谞讞诐 诪讗讞专讬诐, when he is comforted by others, if he is the 讗讘诇 and others comfort him, 讻诇 讛注诐 讗讜诪专讬诐 诇讜, all the people say to him, 讗谞讜 讻驻专转讱, we are your 讻驻专讛, that means that you should have a 讻驻专讛, a forgiveness of 讛砖诐 through us. We should be instead of you for anything 讞住 讜砖诇讜诐 that is supposed to happen to you because of this, we should be in your place. 讜讛讜讗 讗讜诪专 诇讛诐, and he would say to them, 转转讘专讻讜 诪谉 讛砖诪讬诐, you should be blessed from heaven. 讜讻砖诪讘专讬谉 讗讜转讜, when they feed him the 住注讜讚转 讛讘专讗讛, because the 讚讬谉 is that an 讗讘诇 is not allowed to eat his first meal after the funeral from his own, it is supposed to be brought into the house from others. So when they bring him the food for the first meal, 讻诇 讛注诐 诪住讜讘讬谉 注诇 讛讗专抓, all the people sit on the floor, 讜讛讜讗 诪讬住讘 注诇 讛住驻住诇, and he sits on the bench. In other words, out of 讻讘讜讚 he sits on the bench. The other people, they sit on the floor, they are the ones that are supposed to feel themselves like 讗讘诇讬诐. They are the ones that are supposed to have the 爪注专 for the 讗讘诇讜转. But he, the 讻讛谉 讙讚讜诇, sits on the bench in a form of 讻讘讜讚. Then the 诪砖谞讛 continues: 讛诪诇讱, the king, 诇讗 讚谉 讜诇讗 讚谞讬谉 讗讜转讜, he cannot judge and he cannot be judged. 诇讗 诪注讬讚 讜诇讗 诪注讬讚讬谉 讗讜转讜, he cannot testify and he cannot be testified for. 诇讗 讞讜诇抓 讜诇讗 讞讜诇爪讬谉 诇讗砖转讜, he doesn't give 讞诇讬爪讛, if his brother dies without children, he doesn't give 讞诇讬爪讛 to his brother's wife. And also if he dies, his brother does not give 讞诇讬爪讛 to his wife. 诇讗 诪讬讘诐 讜诇讗 诪讬讘诪讬谉 诇讗砖转讜, he cannot be 诪讬讘诐, if his brother dies, he cannot marry in the form of 讬讬讘讜诐 his brother's wife. And also if he dies, his brother cannot marry his wife. 专讘讬 讬讛讜讚讛 讗讜诪专, 专讘讬 讬讛讜讚讛 says, 讗诐 专爪讛 诇讞诇讜抓 讗讜 诇讬讬讘诐, if the king wants to give 讞诇讬爪讛 or wants to be 诪讬讘诐, 讝讻讜专 诇讟讜讘, he is remembered for the good. In other words, he doesn't have to, but if he wants, he does a good deed. It is better if he does do that. 讗诪专讜 诇讜, but they said to him, 讗讬谉 砖讜诪注讬谉 诇讜, they don't listen to him. He felt that if he wants, he could do it. But the 讞讻诪讬诐 said to him no, even if he wants, we do not listen to him, we do not let him do it. 讜讗讬谉 谞讜砖讗讬谉 讗诇诪谞转讜, you are not allowed to marry the widow of a king. 专讘讬 讬讛讜讚讛 讗讜诪专, 专讘讬 讬讛讜讚讛 says, 谞讜砖讗 讛诪诇讱 讗诇诪谞转讜 砖诇 诪诇讱, that a king is allowed to marry the widow of another king. 砖讻谉 诪爪讬谞讜 讘讚讜讚, as we find by 讚讜讚, 砖谞砖讗 讗诇诪谞转讜 砖诇 砖讗讜诇, that he married the widow of 砖讗讜诇, 砖谞讗诪专, as it says, 讜讗转谞讛 诇讱 讗转 讘讬转 讗讚讜谞讬讱, I will give you the house of your master, 讜讗转 谞砖讬 讗讚讜谞讬讱 讘讞讬拽讱, and the wives of your master in your lap. So we see that he did marry the wife of 砖讗讜诇, so we see that a king is allowed to marry the widow of another king. Then the 讙诪专讗 continues: We said in the 诪砖谞讛: 讻讛谉 讙讚讜诇 讚谉, that the 讻讛谉 讙讚讜诇 is allowed to judge. But the 讙诪专讗 asks: 驻砖讬讟讗, isn't it simple? Why should we think that a 讻讛谉 讙讚讜诇 is not allowed to judge? The 讙诪专讗 says: 讚谞讬谉 讗讜转讜 讗爪讟专讬讻讗 诇讬讛. 讘讗诪转 that 讟讗拽注 is no 讞讬讚讜砖. The 讞讬讚讜砖 is what he really wants to tell us is that he can be judged. And since he already says that he can be judged and that is a 讞讬讚讜砖, so the 诪砖谞讛 already mentions that he can judge. But the 讙诪专讗 asks: 讛讗 谞诪讬 驻砖讬讟讗, this is also simple. Why should we think that a 讻讛谉 讙讚讜诇 cannot be judged? 讗讬 诇讗 讚讬讬谞讬谞谉 诇讬讛, because if we cannot judge him, 讗讬讛讜 讛讬讻讬 讚讬讬谉, how could he judge? Since we said before that he definitely could judge, now if he definitely could judge, he certainly could also be judged. Because if he couldn't be judged, he couldn't judge. 讚讻转讬讘, because it says, 讛转拽讜砖砖讜 讜拽讜砖讜, which 驻砖讜讟 驻砖讟 means you should gather. But here the 讙诪专讗 uses the word for a different 驻砖讟. 讜讗诪专 专讬砖 诇拽讬砖, 专讬砖 诇拽讬砖 says that what it means is, 拽砖讜讟 注爪诪讱, first make yourself nice, beautify yourself, 讜讗讞专 讻讱 讜讗讞专 讻讱 拽砖讜讟 讗讞专讬诐, then beautify others. In other words, if you don't make yourself nice, you can't do anything for others. And in this case it would mean, if he himself cannot be judged, then he cannot judge others. And since we know for sure that he can judge others, so that itself shows that he can be judged. So 诪诪讬诇讗, why does the 诪砖谞讛 have to tell us that he can be judged? And because of that it also tells us that he can judge, it is clear, simple that this is the 讚讬谉. The 讙诪专讗 says 讗诇讗 the truth is, 讗讬讬讚讬 讚拽讘注讬 诇诪讬转谞讬 诪诇讱 诇讗 讚谉 讜诇讗 讚谞讬谉 讗讜转讜, since the 诪砖谞讛 later wants to say that a king cannot judge and cannot be judged, 转谞讬 谞诪讬 讻讛谉 讙讚讜诇 讚谉 讜讚谞讬谉, so therefore it already sets for thinking a 讻讛谉 讙讚讜诇 also that he can judge and can be judged. So 讟讗拽注 by a 讻讛谉 讙讚讜诇 it's no 讞讬讚讜砖, but since by a 诪诇讱 it is a 讞讬讚讜砖 that he cannot judge and cannot be judged, so therefore the 诪砖谞讛 says that a 讻讛谉 讙讚讜诇 can judge and can be judged. 讗讬讘注讬转 讗讬诪讗, the 讙诪专讗 says if you want, I can give you another 转讬专讜抓. 讛讻讗 拽讗 诪砖诪注 诇谉, this 诪砖谞讛 tries to tell us, 讻讚转谞讬讗, tries to tell us the 讞讬讚讜砖 as we learned in another 讘专讬讬转讗. Because we learn in a 讘专讬讬转讗, 讻讛谉 讙讚讜诇 砖讛专讙 讗转 讛谞驻砖, if a 讻讛谉 讙讚讜诇 killed a person, 讘诪讝讬讚 if he did it intentionally, 谞讛专讙, he gets killed for it. 讘砖讜讙讙 if he killed him unintentionally, 讙讜诇讛, he goes to 讙诇讜转, he goes to 注专讬 诪拽诇讟, because this is the 讚讬谉 that if a person kills somebody unintentionally, he has to run away to one of the cities of refuge, to one of the 注专讬 诪拽诇讟. So the 讘专讬讬转讗 says here that a 讻讛谉 讙讚讜诇 also goes to 注专讬 诪拽诇讟 if he killed somebody 讘砖讜讙讙. Then the 讘专讬讬转讗 continues, 讜注讜讘专 注诇 注砖讛 讜注诇 诇讗 转注砖讛, 讻讛谉 讙讚讜诇 is 注讜讘专, transgresses a positive 诪爪讜讛 and a negative 诪爪讜讛, 讜讛专讬 讛讜讗 讻讛讚讬讜讟 诇讻诇 讚讘专讬讜, and he is like an ordinary person for everything. And the 讙诪专讗 will soon ask, what does this mean that he is 注讜讘专 on an 注砖讛 and a 诇讗 转注砖讛? But at the meantime we see here that the 讘专讬讬转讗 tells us a 讞讬讚讜砖 that a 讻讛谉 讙讚讜诇 who killed somebody gets killed. If he killed somebody 讘砖讜讙讙, he goes to 讙诇讜转. And the 讙诪专讗 will soon explain what the 讞讬讚讜砖 of the 讘专讬讬转讗 is. So whatever the 讞讬讚讜砖 of the 讘专讬讬转讗 is, that is also the 讞讬讚讜砖 of the 诪砖谞讛. That he is judged, meaning that if he killed somebody, he gets killed. If he killed somebody 讘砖讜讙讙, he also goes to 讙诇讜转. But the 讙诪专讗 asks, 讘诪讝讬讚 谞讛专讙, we just said that if the 讻讛谉 讙讚讜诇 killed somebody intentionally, he gets killed, 驻砖讬讟讗, isn't that simple? The 讙诪专讗 says 讘砖讜讙讙 讙讜诇讛 讗讬爪讟专讬讻讗 诇讬讛, the 讞讬讚讜砖 that he wants to tell us really is that if he killed somebody unintentionally, he has to go to 讙诇讜转. And because it already wants to say that if he kills 讘砖讜讙讙 he goes to 讙诇讜转, it already mentions that if he kills 讘诪讝讬讚, he gets killed. But the 讙诪专讗 asks, 讛讗 谞诪讬 驻砖讬讟讗, isn't that also simple? Why should we think that a 讻讛谉 讙讚讜诇 who killed somebody 讘砖讜讙讙 should not go to 讙诇讜转, so that the 讘专讬讬转讗 should have to tell us a 讞讬讚讜砖 that he does go to 讙诇讜转? What would be the reason we should think he shouldn't go to 讙诇讜转? The 讙诪专讗 says 讗讬爪讟专讬讱, it does have to tell us, 讚住诇拽讗 讚注转讱 讗诪讬谞讗, I would have thought, 讛讜讗讬诇 讜讻转讬讘, since it says in the 驻住讜拽 concerning the 讚讬谉 of 注专讬 诪拽诇讟, 讜讬砖讘 讘讛 注讚 诪讜转 讛讻讛谉 讛讙讚讜诇, that the person who goes to 讙诇讜转 for killing somebody 讘砖讜讙讙 has to live there till the death of the 讻讛谉 讙讚讜诇. So 讗讬诪讗, I would say, 讻诇 讚讗讬转 诇讬讛 转拽谞转讗 讘讞讝专讛, anybody who has a 转拽谞讛 by ever leaving 讙诇讜转, 诇讬讙诇讬, he goes to 讙诇讜转. 讚诇讬转 诇讬讛 转拽谞转讗 讘讞讝专讛, 诇讗 诇讬讙诇讬. Whoever doesn't have a 转拽谞讛, cannot leave the 讙诇讜转, should 诇讻转讞讬诇讛 not go. In other words, we would think that since the 转讜专讛 says that he should stay there till the death of the 讻讛谉 讙讚讜诇, this is not just a time limit how long he should stay, but this is also a condition in the 讚讬谉 of 注专讬 诪拽诇讟. That when does a person go to 注专讬 诪拽诇讟, only if he is able to stay there with a limit, up to the death of the 讻讛谉 讙讚讜诇. But a person who for some reason doesn't have this limit, will have to stay there forever, he 诇讻转讞讬诇讛 does not go to 讙诇讜转. 讚转谞谉, because we learn in a 诪砖谞讛, 讛讛讜专讙 讻讛谉 讙讚讜诇, if somebody kills the 讻讛谉 讙讚讜诇, 讗讜 讻讛谉 讙讚讜诇 砖讛专讙 讗转 讛谞驻砖, or a 讻讛谉 讙讚讜诇 who killed a person, 讗讬谞谉 讬讜爪讗讬诐 诪砖诐 诇注讜诇诐, they never leave. Because by them there is no time limit of up to the death of the 讻讛谉 讙讚讜诇. And as 转讜住驻讜转 explains, this is only if there was no new 讻讛谉 讙讚讜诇 appointed before the 讙诪专 讚讬谉. Before the verdict was given that they have to go to 讙诇讜转, there was no new 讻讛谉 讙讚讜诇 yet. Because if there was a new 讻讛谉 讙讚讜诇 before then, then even in this case they have a time limit. For instance, the one that killed the 讻讛谉 讙讚讜诇, so even though now when he killed him there is no 讻讛谉 讙讚讜诇, but by the time he went to 讙诇讜转, there was a 讻讛谉 讙讚讜诇 already. So he stays in 讙诇讜转 up to the death of the 讻讛谉 讙讚讜诇. And the same thing if a 讻讛谉 讙讚讜诇 killed somebody, so they're able to appoint a new 讻讛谉 讙讚讜诇, and he would stay there till the new 讻讛谉 讙讚讜诇 dies. So when the the 诪砖谞讛 says that if someone kills a 讻讛谉 讙讚讜诇 or a 讻讛谉 讙讚讜诇 who kills somebody stays there forever, it means that there was no other 讻讛谉 讙讚讜诇 appointed yet. And also 转讜住驻讜转 says that there is no 诪砖讜讞 砖注讘专, because the 讚讬谉 is that if there was a 讻讛谉 讙讚讜诇 that was taken away from his position for whatever reason, he also makes the person of 注专讬 诪拽诇讟 leave. If he dies, the one that's in 注专讬 诪拽诇讟 is able to leave. So in this case, if a person killed a 讻讛谉 讙讚讜诇, and there was a 讻讛谉 诪砖讜讞 砖注讘专 around, he also has a time limit. Or if the 讻讛谉 讙讚讜诇 killed a person, and there is a 讻讛谉 诪砖讜讞 around, so he also has a time limit. So therefore we must say that here we are talking in a case that there is no 诪砖讜讞 砖注讘专. And then 转讜住驻讜转 also adds that there is an opinion that says that the 诪砖讜讞 诪诇讞诪讛 also makes the person go back. Not the 讻讛谉 讙讚讜诇, but the the person who was anointed as being the general of the army. Now according to that opinion, we must say that this is a case where there was no 诪砖讜讞 诪诇讞诪讛 either. But 诇驻讜注诇 we see here that a 讻讛谉 讙讚讜诇 who killed somebody will not leave 注专讬 诪拽诇讟 forever. Now we would think that since he will stay there forever, he 诇讻转讞讬诇讛 does not have to go to 注专讬 诪拽诇讟. Because we would think that when the 转讜专讛 says that you stay in 注专讬 诪拽诇讟 up to the death of the 讻讛谉 讙讚讜诇, that is a condition in the 讚讬谞讬诐 of 注专讬 诪拽诇讟. So therefore 讗讬诪讗 I would say 诇讗 讬讙诇讛, he should not go to 讙诇讜转, 拽讗 诪砖诪注 诇谉, therefore we have to tell us that a 讻讛谉 讙讚讜诇 who killed a person 讘砖讜讙讙 does go to 注专讬 诪拽诇讟. So it is a 讞讬讚讜砖 that a 讻讛谉 讙讚讜诇 that killed 讘砖讜讙讙 goes to 注专讬 诪拽诇讟, and that's what the 讘专讬讬转讗 wants to tell us, and because the 讘专讬讬转讗 tells us already that, it already mentioned that if he kills 讘诪讝讬讚, he gets killed. And this is really what our 诪砖谞讛 also means according to this 驻砖讟. When it says that a 讻讛谉 讙讚讜诇 can be judged, it is a 讞讬讚讜砖. The 讞讬讚讜砖 is that if he kills somebody 讘砖讜讙讙, he is judged, and he is sent to 注专讬 诪拽诇讟, and this is a 讞讬讚讜砖 because we would have thought that he doesn't go to 注专讬 诪拽诇讟 because of the 驻住讜拽 that says that you stay there up to the death of the 讻讛谉 讙讚讜诇. But then the 讙诪专讗 asks: 讜讗讬诪讗 讛讻讬 谞诪讬? Maybe it is so? Maybe it is true that a 讻讛谉 讙讚讜诇 who killed somebody should not go to 注专讬 诪拽诇讟, because this 驻住讜拽 where it says that he stays there till the death of the 讻讛谉 讙讚讜诇 cannot be fulfilled by him? What makes us so sure that the 讚讬谉 is that he does go to 注专讬 诪拽诇讟? And the 讙诪专讗 answers: 讗诪专 拽专讗, the 驻住讜拽 says, 诇谞讜住 砖诪讛 讻诇 专讜爪讞. Concerning 注专讬 诪拽诇讟 it says that this is a city that in that city should run away every murderer, so since it says every murderer, 讗驻讬诇讜 讻讛谉 讙讚讜诇 讘诪砖诪注, even a 讻讛谉 讙讚讜诇 is also 诪砖诪注, is also included in this 讚讬谉 of going to 注专讬 诪拽诇讟. Then the 讙诪专讗 continues, it said in that 讘专讬讬转讗 that we brought before, 注讜讘专 注诇 注砖讛 讜注诇 诇讗 转注砖讛, that he is 注讜讘专, he transgresses, a positive 诪爪讜讛 and a negative 诪爪讜讛. So the 讙诪专讗 asks: What does that mean? From the 诇砖讜谉 it's 诪砖诪注 that a 讻讛谉 讙讚讜诇 should be 注讜讘专 on an 注砖讛 and should be 注讜讘专 on a 诇讗 转注砖讛? 诇讗 住讙讬 讚诇讗 注讘专? It's not okay if he doesn't do it? In other words, it's not good if he's not 注讜讘专, he must be 注讜讘专 on an 注砖讛 and a 诇讗 转注砖讛? But the 讙诪专讗 says: 讛讻讬 拽讗诪专, this is what the 讘专讬讬转讗 meant: 讗诐 注讘专 注诇 注砖讛 讜注诇 诇讗 转注砖讛, if he was 注讜讘专 on an 注砖讛 and a 诇讗 转注砖讛, 讛专讬 讛讜讗 讻讛讚讬讜讟 诇讻诇 讚讘专讬讜, then he has a 讚讬谉 like an ordinary person, and he is judged by a 讘讬转 讚讬谉 of three like any other person. So when the 讘专讬讬转讗 said the two things that he is 注讜讘专 on an 注砖讛 and a 诇讗 转注砖讛, then it continued that he has a 讚讬谉 like a 讛讚讬讜讟 for everything, these are not two separate things. This goes together, that he if he is 注讜讘专 on an 注砖讛 and a 诇讗 转注砖讛, then he is judged like a 讛讚讬讜讟. So the 讙诪专讗 asks: 驻砖讬讟讗, this is also simple. Why should we think that a 讻讛谉 讙讚讜诇 should not be judged like a 讛讚讬讜讟? The 讙诪专讗 says: 住诇拽讗 讚注转讱 讗诪讬谞讗, I would think, 讛讜讗讬诇 讜转谞谉, since we learned in the 诪砖谞讛: 讗讬谉 讚谞讬谉 诇讗 讗转 讛砖讘讟 讜诇讗 讗转 谞讘讬讗 讛砖拽专 讜诇讗 讗转 讻讛谉 讙讚讜诇 讗诇讗 注诇 驻讬 讘讬转 讚讬谉 砖诇 砖讘注讬诐 讜讗讞讚, that you do not judge a complete 砖讘讟, or a false prophet, or a 讻讛谉 讙讚讜诇 only if you have a 讘讬转 讚讬谉 of 71. In other words, when there's a question of capital punishment concerning the 讻讛谉 讙讚讜诇, he is not judged by a 讘讬转 讚讬谉 of 23 like a 讛讚讬讜讟, like an ordinary person, but he is judged by a 讘讬转 讚讬谉 of 71. And the reason for that is 讚讗诪专 专讘 讗讚讗 讘专 讗讛讘讛, that 专讘 讗讚讗 讘专 讗讛讘讛 says, because the 驻住讜拽 says, 讻诇 讛讚讘专 讛讙讚讜诇 讬讘讬讗讜 讗诇讬讱, that when 讬转专讜 asked 诪砖讛 to appoint 讚讬讬谞讬诐 instead of him sitting and judging all day, he said to him that smaller things should be judged by the other 讚讬讬谞讬诐, but 讻诇 讛讚讘专 讛讙讚讜诇, that any big thing should be brought to you. So he 讚专砖谞'住, what does that mean? 讚讘专讜 砖诇 讙讚讜诇, the things of the great person. That when it comes to judge a great person, you have to judge it through 诪砖讛 himself, and 诪砖讛 was in place of 71, so from there we know that when you judge the 讻讛谉 讙讚讜诇, who is the 讙讚讜诇, it has to be done through a 讘讬转 讚讬谉 of 71. So since we learned that when you judge the capital punishment of a 讻讛谉 讙讚讜诇 has to be done through a 讘讬转 讚讬谉 of 71, not like when you judge an ordinary person, 讗讬诪讗, so I would think, 讻诇 讚讘专讜 砖诇 讙讚讜诇, that anything that applies to the 讙讚讜诇, any type of judgment that applies to the 讻讛谉 讙讚讜诇 has to be judged through a 讘讬转 讚讬谉 of 71. And if that would be true and a 讘讬转 讚讬谉 of three

Judging a High Priest Like a Layperson

would not be enough like by a 讛讚讬讜讟. Therefore 拽讗 诪砖诪注 诇谉, he has to tell us that if he is 注讜讘专 on an 注砖讛 or on a 诇讗 转注砖讛, he is like a 讛讚讬讜讟 and you judge him with a 讘讬转 讚讬谉 of three. And then the 讙诪专讗 asks, 讜讗讬诪讗 讛讻讬 谞诪讬, maybe it is so? What makes us so sure that when you judge the 讻讛谉 讙讚讜诇 by an 注砖讛 or a 诇讗 转注砖讛 you do not need a 讘讬转 讚讬谉 of 71? Maybe it is true that anything that applies to the 讻讛谉 讙讚讜诇 must be judged through 讘讬转 讚讬谉 of 71? But the 讙诪专讗 says, 诪讬 讻转讬讘 讚讘专讬 讙讚讜诇? 诇驻讜注诇, the 驻住讜拽 does not say the the 讚讘专讬, the things of the 讙讚讜诇. If the 驻住讜拽 would say that, then we would say anything that applies to the 讙讚讜诇 is judged by a 讘讬转 讚讬谉 of 71. What it does say is, "讛讚讘专 讛讙讚讜诇" 讻转讬讘. The big thing. So even though we 讚专砖谉 that it refers to the person who is big, that when we judge the person who is big you need a 讘讬转 讚讬谉 of 71, but 诇驻讜注诇 it also says the big thing. So what does that mean? 讚讘专 讙讚讜诇 诪诪砖, only if it's actually the big thing. Now what is the big thing? The big thing is when it's capital punishment. So from here we know that when we judge the big person who's the 讻讛谉 讙讚讜诇 concerning a big thing, which is capital punishment, that's when we need 诪砖讛, which is in the place of 71. That's when we need a 讘讬转 讚讬谉 of 71. But otherwise, if he's 注讜讘专 on an 注砖讛 or on a 诇讗 转注砖讛, you judge him with a 讘讬转 讚讬谉 of three like you judge a regular 讛讚讬讜讟. Then the

Testimony Rules for the High Priest

讙诪专讗 continues, it's said in the 诪砖谞讛, 诪注讬讚 讜诪注讬讚讬谉 讗讜转讜. He testifies and he is testified against. The 讙诪专讗 says, 诪注讬讚, you say that he is allowed to testify, he should testify, 讜拽转谞讬, I'll ask you a question, we learn in a 讘专讬讬转讗, 讜讛转注诇诪转, this refers to the 诪爪讜讛 of 讛砖讘转 讗讘讬讚讛. And this is a 驻住讜拽 in 驻专砖转 讻讬 转爪讗, the beginning of 拽驻讬讟诇 讻"讘, it says, 诇讗 转专讗讛 讗转 砖讜专 讗讞讬讱 讗讜 讗转 砖讬讜 谞讚讞讬诐, you do not see the ox of your brother or his sheep being pushed away, 讜讛转注诇诪转 诪讛诐, and you will hide yourself, cover yourself up from them. The 转讜专讛 says, "Don't do that, but 讛砖讘 转砖讬讘诐 诇讗讞讬讱, return them to your brother." And this is the source of the 诪爪讜讛 of 讛砖讘转 讗讘讬讚讛 that you must return a lost object to another 讬讬讚. But 诇驻讜注诇, the expression the 转讜专讛 uses is 讜讛转注诇诪转, that you should hide yourself, you should cover yourself up. And the 讙诪专讗 learns out from here that 驻注诪讬诐 砖讗转讛 诪转注诇诐 讜驻注诪讬诐 砖讗讬 讗转讛 诪转注诇诐, that sometimes you are allowed to hide yourself, in other words, sometimes you are not obligated to pick up the object, and sometimes you are not you're not allowed to hide yourself, you are obligated to pick it up. Now, 讛讬讻讬 讚诪讬, when is it? In other words, when is the 讚讬谉 that you must pick up and when not? So when you must pick up the 讗讘讬讚讛 there's no question, under normal circumstances you must pick up the 讗讘讬讚讛. But when is the case when you are not obligated to pick up the 讗讘讬讚讛, you are allowed to hide yourself from it? The

Exceptions to Picking Up Lost Objects

case is 讻讛谉 讜讛讜讗 讘讘讬转 讛拽讘专讜转. If he's a 讻讛谉 and the 讗讘讬讚讛, the object, is in the cemetery, and we know a 讻讛谉 is not allowed to become 讟诪讗, so he's not allowed to enter a cemetery, so in a case like that if the 讻讛谉 sees the lost object in the cemetery, he should not pick it up. Or 讝拽谉 讜讗讬谞讛 诇驻讬 讻讘讜讚讜, if he's a 转诇诪讬讚 讞讻诐 and it's not fit for him, for his 讻讘讜讚, for his honor that he should pick up the 讗讘讬讚讛, so then he is not allowed, so he doesn't have to pick up the 讗讘讬讚讛. 讗讜, or 砖讛讬转讛 诪诇讗讻讛 砖诇讜 诪专讜讘讛 诪砖诇 讞讘讬专讜, or if his work was more than his friend's, in other words the loss that he's going to have by the time he waits to pick up the object will be more than the worth of the object, so then the gain of his friend by him picking up the object will be less than his loss, so then he is not obligated to pick up the 讗讘讬讚讛 of his friend. 诇讻讱 谞讗诪专 讜讛转注诇诪转, so therefore it says 讜讛转注诇诪转, that you should hide yourself, to tell us that sometimes you are allowed to hide yourself, you don't have to pick up the object. So

Human Dignity Overrides the Prohibition to Ignore

from here we see that 讻讘讜讚 讛讘专讬讜转, the 讻讘讜讚 of people, overweighs this 诪爪讜讛 of 讛砖讘转 讗讘讬讚讛. And even though normally there is a 诇讗讜, 诇讗 转讜讻诇 诇讛转注诇诐, that you're not allowed to cover yourself, but in a case where it's 讻讘讜讚 讛讘专讬讜转, it's 讻讘讜讚 for the person who we're dealing with, so in his honor we say this 讻讘讜讚 overweighs the 诇讗讜 of 诇讗 转讜讻诇 诇讛转注诇诐. So according to that, the same thing should apply to a 讻讛谉 讙讚讜诇, because 讘讗诪转 it is not right, it is not according to 讻讘讜讚 for the 讻讛谉 讙讚讜诇 to come to 讘讬转 讚讬谉 to testify. So why shouldn't this 注谞讬谉 of 讻讘讜讚 of the 讻讛谉 讙讚讜诇 overrule this 讞讬讜讘 of having to come to 讘讬转 讚讬谉 if you have a 注讚讜转 to testify? Because like this we know the 讚讬谉 is if a person knows a testimony for his friend, he must come to 讘讬转 讚讬谉 to testify. And as the 驻住讜拽 says, 讜讗诐 诇讜讗 讬讙讬讚 讜谞砖讗 注讜谞讜, if he doesn't say, doesn't come to 讘讬转 讚讬谉 to testify, then he has an 注讘讬专讛. But in the case of the 讻讛谉 讙讚讜诇, since it's not 讻讘讜讚 for him to do it, so why shouldn't the 讻讘讜讚 of the 讻讛谉 讙讚讜诇 over overweigh this 讞讬讜讘 of coming to 讘讬转 讚讬谉 to testify, just like the 讻讘讜讚 讛讘专讬讜转 overweighs the 诇讗讜 of 诇讗 转讜讻诇 诇讛转注诇诐? 讙诪专讗 says, 讗诪专 专讘 讬讜住祝, 专讘 讬讜住祝 said, you are right, that normally 讟讗拽注 he doesn't have to come to 讘讬转 讚讬谉 to testify. But

King's Testimony and the Son of the King

when we say in the 诪砖谞讛 he does testify, 诪注讬讚 诇诪诇讱, he testifies for the king. If he has anything to testify for a king, then it is not against his 讻讘讜讚, so then he is supposed to come to 讘讬转 讚讬谉. But the 讙诪专讗 says, 讜转谞谉, didn't we learn, 诇讗 讚谉 讜诇讗 讚谞讬谉 讗讜转讜, that a king can't judge and cannot be judged, 诇讗 诪注讬讚 讜诇讗 诪注讬讚讬谉 讗讜转讜, he doesn't testify and he is not testified for? So, we see that a king is never testified for. So, how can we say that when does a 讻讛谉 讙讚讜诇 come to 讘讬转 讚讬谉 to testify if he testifies for a king? 讗诇讗 讗诪专 专讘 讝讬专讗, therefore 专讘 讝讬专讗 said, what it means is, 诪注讬讚 诇讘谉 诪诇讱, that he testifies if it is for the son of the king. But the 讙诪专讗 asks, 讘谉 诪诇讱 讛讚讬讜讟 讛讜讗! A son of a king has the same 讚讬谉 like a regular, ordinary person. That just like we say that he should not testify for an ordinary person because of his 讻讘讜讚, so too, he should not testify for the 讘谉 诪诇讱. 讗诇讗, therefore, the 讙诪专讗 has a 驻砖讟 like this: 诪注讬讚 讘驻谞讬 诪诇讱, he testifies in front of the king. And as 专砖状讬 explains, it means that he really comes to testify for the son of the king, but for that itself he still couldn't come because the son of the king is an ordinary person, but he does it in front of the 诪诇讱, that the 诪诇讱 sits in 讘讬转 讚讬谉 and he comes in front of that 诪诇讱 in 讘讬转 讚讬谉 and testifies for the son of the 诪诇讱, and that's when he is allowed to testify because in this case, since it's in front of the 诪诇讱, it is not against the 讻讘讜讚 of the 讻讛谉 讙讚讜诇. But

Can a King Sit on the Sanhedrin?

the 讙诪专讗 asks, 讜讻讬 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉? But you don't appoint a king in 住谞讛讚专讬谉! We just said that he will testify in 住谞讛讚专讬谉 in front of the king, so what it seems to be saying is that a king is going to be part of the 住谞讛讚专讬谉, but we know that you do not appoint a king as part of the 住谞讛讚专讬谉! The 讙诪专讗 says, 诪砖讜诐 讬拽专讗 讚讻讛谉 讙讚讜诇, because of the 讻讘讜讚 of the 讻讛谉 讙讚讜诇, 讗转讬, he will come, 讜讬转讬讘, and he will sit, 诪拽讘诇讬谉 诇讛 诇住讛讚讜转讬讛, and he will receive and listen to the testimony of the 讻讛谉 讙讚讜诇, 讻讜诇讬 讛讗讬, 讜讗讝讬诇, he will get up and leave, 讜诪注讬讬谞讬谞谉 诇讬讛 讗谞谉 讘讚讬谞讗, and we will look into the 讚讬谉. In other words, he only comes in honor of the 讻讛谉 讙讚讜诇. Since it is a testimony for his son, so therefore we want the 讻讛谉 讙讚讜诇 to come, but the 讻讛谉 讙讚讜诇 just should come is not allowed because the son of the king has a 讚讬谉 of an 讛讚讬讜讟. So, what we do is, the 诪诇讱 comes, and in front of the 诪诇讱, the 讻讛谉 讙讚讜诇 is allowed to testify because it's not against his 讻讘讜讚, and as soon as he finishes his testimony, the 诪诇讱 leaves, and the 讘讬转 讚讬谉 sits and looks into the 讚讬谉. But

Tosafot鈥檚 Challenge: Dignity vs Monetary Laws

转讜住驻讜转 ask a 拽砖讬讗, that when the 讙诪专讗 asked, how can the 讻讛谉 讙讚讜诇 be 诪注讬讚, how can he come to 讘讬转 讚讬谉 to testify when we know that 讻讘讜讚 讛讘专讬讜转 is stronger than the 诇讗讜 of 诇讗 转讜讻诇 诇讛转注诇诐, so the 讻讘讜讚 of the 讻讛谉 讙讚讜诇 should also be stronger, that he shouldn't have to come to 讘讬转 讚讬谉 to testify? 转讜住驻讜转 ask that 诇讻讗讜专讛 this 讚讬谉 that 讻讘讜讚 讛讘专讬讜转 is stronger than a 诇讗 转注砖讛 of the 转讜专讛 only applies if it's a case of 讚讬谞讬 诪诪讜谞讜转, a case of a 诇讗 转注砖讛 concerning money. For instance, the case of picking up an 讗讘讬讚讛, which is a monetary 讚讬谉. So, there we say that 讻讘讜讚 讛讘专讬讜转 is stronger than the 诇讗 转注砖讛 of 诇讗 转讜讻诇 诇讛转注诇诐. But in a case where it's an 讗讬住讜专, in the 讚讬谞讬诐 of 讗讬住讜专讬谉, not of 讚讬谞讬 诪诪讜谞讜转, then we have a 讻诇诇 that 讗讬谉 讞讻诪讛 讜讗讬谉 转讘讜谞讛 诇谞讙讚 讛壮, that nothing stands in the way against 讛壮. In other words, 讻讘讜讚 讛讘专讬讜转 will not push away a 讚讬谉 which is not in the 讙讚专 of 讚讬谞讬 诪诪讜谞讜转. Therefore, 转讜住驻讜转 ask, maybe when it says in the 诪砖谞讛 that the 讻讛谉 讙讚讜诇 comes to the 讘讬转 讚讬谉 to testify, that refers to a testimony that's not concerning 讚讬谞讬 诪诪讜谞讜转, but a testimony concerning 讗讬住讜专. For instance, if he comes to testify in 注讚讜转 讛讞讜讚砖, he saw the 诇讘谞讛 in its time and he comes to 讘讬转 讚讬谉 to testify about the 诇讘谞讛 in order for the 讘讬转 讚讬谉 to be able to establish 专讗砖 讞讜讚砖, and in this case, we can't say that the 讻讘讜讚 of the 讻讛谉 讙讚讜诇 should push away this 讚讬谉, so what is the 讙诪专讗's 拽砖讬讗 that how can the 诪砖谞讛 say that a 讻讛谉 讙讚讜诇 comes to testify? So, what is the 讙诪专讗's question that how can the 诪砖谞讛 say that a 讻讛谉 讙讚讜诇 has to come and testify? And 转讜住驻讜转 answer that when it says in the 诪砖谞讛 that a 讻讛谉 讙讚讜诇 is 诪注讬讚, it's 诪砖诪注 that it refers to all cases. It refers to 讗讬住讜专 and also to 讚讬谞讬 诪诪讜谞讜转. Just like in the second case of the 诪砖谞讛, where it says a 诪诇讱 is not 诪注讬讚, and there it means he's not 诪注讬讚 not for 讗讬住讜专 and not for 讚讬谞讬 诪诪讜谞讜转. So, therefore, when it says by a 讻讛谉 讙讚讜诇 that he is 诪注讬讚, it means for 讗讬住讜专 and for 讚讬谞讬 诪诪讜谞讜转. So, since the 诪砖谞讛 says that a 讻讛谉 讙讚讜诇 is 诪注讬讚 for 讚讬谞讬 诪诪讜谞讜转, that's what the 讙诪专讗's 拽砖讬讗 is: Why should he have to be 诪注讬讚 for 讚讬谞讬 诪诪讜谞讜转 when by 讚讬谞讬 诪诪讜谞讜转 the 讻诇诇 is that 讻讘讜讚 讛讘专讬讜转 is stronger than the 诇讗讜 of 讚讬谞讬 诪诪讜谞讜转? Another 驻砖讟 that 转讜住驻讜转 says is different, not like we just said that the 诪砖谞讛 means 讗讬住讜专 and 诪诪讜谉, that you do not appoint a 诪诇讱 in 住谞讛讚专讬谉. And the answer of the 讙诪专讗 is that because of the 讻讘讜讚 of the 讻讛谉 讙讚讜诇, the 诪诇讱 comes in, listens to the testimony, and then he leaves. So 转讜住驻讜转 asks a 拽砖讬讗: When the 讙诪专讗 asked that 讗讬谉 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉, why did the 讙诪专讗 have to quote a 讘专讬讬转讗? Why couldn't the 讙诪专讗 quote our 诪砖谞讛? When we answer that he is 诪注讬讚 in front of the 诪诇讱, and we thought it meant that the 诪诇讱 is part of the 住谞讛讚专讬谉, the 讙诪专讗 should have asked right away: How can the 诪诇讱 be part of 住谞讛讚专讬谉 when it says in the 诪砖谞讛 by us that 诪诇讱 诇讗 讚谉, that a 诪诇讱 cannot judge? Why do we have to find a 讘专讬讬转讗 where it says 讗讬谉 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉, that you cannot appoint a king in 住谞讛讚专讬谉, when we have a 讘驻讬专讜砖 a 诪砖谞讛 where it says the 诪诇讱 cannot judge, so obviously he cannot be part of 住谞讛讚专讬谉? And the question goes further. The question is on the 讘专讬讬转讗 itself: What is the 讞讬讚讜砖 of the 讘专讬讬转讗? Since there is a 讘驻讬专讜砖 a 诪砖谞讛 where it says 讛诪诇讱 诇讗 讚谉, the 诪诇讱 cannot judge, so obviously he cannot be part of the 住谞讛讚专讬谉, so why does the 讘专讬讬转讗 have to say that 讗讬谉 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉, that you cannot appoint a 诪诇讱 in 住谞讛讚专讬谉? And 转讜住驻讜转 answers, in the name of the 诪讛专"诐, that from the 诪砖谞讛 itself it's no 专讗讬讛. When it says in the 诪砖谞讛 that a 诪诇讱 does not judge, we would think a 诪诇讱 himself cannot judge. And the reason for that being, since he himself cannot be judged, so therefore he cannot judge, as we quoted before the 驻住讜拽, 讛转拽讜砖砖讜 讜拽讜砖讜. But it doesn't mean that a 诪诇讱 cannot be part of 住谞讛讚专讬谉 and he should judge together with others, since if he would judge together with others, then the verdict would not be based only on the 诪诇讱, it would be based on the others also. So from the 诪砖谞讛 itself we have no 专讗讬讛 that a 诪诇讱 cannot be part of 住谞讛讚专讬谉. Therefore, the 讙诪专讗 had to bring the 讘专讬讬转讗 where it says 讘驻讬专讜砖 讗讬谉 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉, that you cannot appoint a 诪诇讱 in 住谞讛讚专讬谉. And this is the 讞讬讚讜砖 of the 讘专讬讬转讗 over the 诪砖谞讛. But then 转讜住驻讜转 asks a 拽砖讬讗, that when the 讙诪专讗 said that we're talking about the case where you're judging the son of the 诪诇讱, and that's what the 讙诪专讗 said, that the 讻讛谉 讙讚讜诇 who will testify for the son of the 诪诇讱 will do it in front of the 诪诇讱, and the 讙诪专讗 thought that the 诪诇讱 will be part of the 住谞讛讚专讬谉, and that is why the 讙诪专讗 asked that a 诪诇讱 cannot be appointed as part of the 住谞讛讚专讬谉. So 转讜住驻讜转 asks: How did the 讙诪专讗 诇讻转讞讬诇讛 have a 讛讜讛 讗诪讬谞讗 that the king could judge his son? A father cannot judge the case of his own son. So at this point when the 讙诪专讗 thought that the 诪诇讱 will be part of the 住谞讛讚专讬谉, and we are judging his son, what kind of 讛讜讛 讗诪讬谞讗 was it that he can be part of the 住谞讛讚专讬谉? And 转讜住驻讜转 answers that the 驻砖讟 in the 讙诪专讗 is a little bit differently, and this will also answer to the previous 拽砖讬讗 that 转讜住驻讜转 asked. The 讙诪专讗 讟讗拽注 knew that a 诪诇讱 cannot be part of the 住谞讛讚专讬谉, and this is from our 诪砖谞讛, where it says in the 诪砖谞讛 诪诇讱 诇讗 讚谉, he cannot judge, and the 讙诪专讗 understood that this doesn't only mean he cannot judge himself, it means he cannot even judge together with others in 住谞讛讚专讬谉. So what the 讙诪专讗 thought at this point was, not that the king should judge his son. We're talking in a case where the son is being judged, and the 讻讛谉 讙讚讜诇 will come to testify for the son of the king, and the king will just sit there listening to what goes on in the 住谞讛讚专讬谉. And that's what the 讙诪专讗 meant, 诇讻转讞讬诇讛 even, that the 讻讛谉 讙讚讜诇 will come to testify in front of the 诪诇讱. And then when the 讙诪专讗 asked the 拽砖讬讗 that we learned 讗讬谉 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉, that you cannot appoint a 诪诇讱 in 住谞讛讚专讬谉, the 讙诪专讗 thought that it means that not only can't you appoint him as a member of the 住谞讛讚专讬谉, but he can't even sit in the 住谞讛讚专讬谉 to listen what goes on there. And that's what the 讙诪专讗 asked: that how can you say that the 讻讛谉 讙讚讜诇 will judge the son of the king, in front of the king, when the king is not allowed to sit in the 住谞讛讚专讬谉. And this is the reason why the 讙诪专讗 did not bring our 诪砖谞讛, the 讙诪专讗 brought that 讘专讬讬转讗, and the 讙诪专讗 learned the 驻砖讟 in that 讘专讬讬转讗 that a 诪诇讱 can 讘讻诇诇 not sit in 住谞讛讚专讬谉. And the 讙诪专讗's answer was that even though he cannot sit in 住谞讛讚专讬谉, but he could just sit there while the 讻讛谉 讙讚讜诇 testifies, and then he gets up and leaves, and the 住谞讛讚专讬谉, they go through the case all by themselves. Another 拽砖讬讗 that 转讜住驻讜转 asks: 诇讻转讞讬诇讛, in the first 转讬专抓, when the 讙诪专讗 asked, "Why should the 讻讛谉 讙讚讜诇 have to testify?" and the 讙诪专讗 answered that it means that he testifies for the king, and the 讙诪专讗 asked a 拽砖讬讗, "How can you say that, when we learned in our 诪砖谞讛 诪诇讱 诇讗 讚谉 讜诇讗 讚谞讬谉 讗讜转讜, that a king cannot be judged, so we cannot say that the case is that the 讻讛谉 讙讚讜诇 testifies for the king, because the king cannot be judged?" 转讜住驻讜转 asks: It says later on in the 讙诪专讗 that only 诪诇讻讬 讬砖专讗诇 are in the 讚讬谉 of 诇讗 讚谞讬谉 讜诇讗 讚谞讬谉 讗讜转诐, but 诪诇讻讬 讘讬转 讚讜讚, the kings from the house of 讚讜讚, on them does not apply this 讚讬谉 that they cannot be judged. So why can't we say that when it says in the 诪砖谞讛 that a king cannot judge and not be judged, that speaks about 诪诇讻讬 讬砖专讗诇. When it says in the 诪砖谞讛 that the 讻讛谉 讙讚讜诇 testifies, and we will explain that it means he testifies for the king, that refers to 诪诇讻讬 讘讬转 讚讜讚, and 诪诇讻讬 讘讬转 讚讜讚 are judged? And 转讜住驻讜转 answers that 诪住转诪讗 the whole 诪砖谞讛 speaks in the same case, it would all be concerning 诪诇讻讬 讬砖专讗诇. If we say that when it says in the 诪砖谞讛 that the king is not judged refers to 诪诇讻讬 讬砖专讗诇, so when the 诪砖谞讛 says that the 讻讛谉 讙讚讜诇 testifies, and we explain that it means concerning a king, it would also mean concerning 诪诇讻讬 讬砖专讗诇, and therefore there would be a contradiction, and therefore we cannot answer that there is a difference between 诪诇讻讬 讬砖专讗诇 and 诪诇讻讬 讘讬转 讚讜讚. Now we

will continue with the 讙诪专讗: 讙讜驻讗. Now we're going to quote the 讙讜祝, the 讘专讬讬转讗 itself that we mentioned before. Says in the 讘专讬讬转讗: 讗讬谉 诪讜砖讬讘讬谉 诪诇讱 讘住谞讛讚专讬谉, you're not allowed to appoint a king in the 住谞讛讚专讬谉, 讜诇讗 诪诇讱 讜讻讛谉 讙讚讜诇 讘注讬讘讜专 砖谞讛, and you shouldn't appoint a king and a 讻讛谉 讙讚讜诇 when you judge the 注讬讘讜专 砖谞讛, when the 住谞讛讚专讬谉 discusses whether to add an extra month to the year, so the king and the 讻讛谉 讙讚讜诇 should not be there. And the 讙诪专讗 gives the reason for these 讚讬谞讬诐: 诪诇讱 讘住谞讛讚专讬谉, the reason why the king should not be part of the 住谞讛讚专讬谉: 讻讚讻转讬讘, because the 驻住讜拽 says, 诇讗 转注谞讛 注诇 专讘, this a 驻住讜拽 in 驻专砖转 诪砖驻讟讬诐, 拽驻讬讟诇 讻"讙, 驻住讜拽 讘', where it says, 讜诇讗 转注谞讛 注诇 专讘 诇谞讟转, should not answer for an argument to bend, which means that when you have an argument come in front of you, do not just answer and that's it, you have to look into the case and 驻住拽谉 讘讗诪转 the way the 讚讬谉 is. But the way the 讙诪专讗 讚专砖谞'住 here, that since the word 专讬讘 usually is written with a 讬', and here it's written without a 讬', so as if it says, 诇讗 转注谞讛 注诇 专讘, you should not answer for the 专讘, for the leader, which means to say that you should not say your opinion against the opinion of the head. Now, if the king is going to be part of the 住谞讛讚专讬谉, no one will be able to give a different opinion because of this 驻住讜拽, 诇讗 转注谞讛 注诇 专讘, and therefore, we do not appoint the king as part of the 住谞讛讚专讬谉. Then the

Why the High Priest Is Excluded from Leap-Year Court

other 讚讬谉 where it said 诇讗 诪诇讱 讜诇讗 讻讛谉 讙讚讜诇 讘注讬讘讜专 砖谞讛, the king or the 讻讛谉 讙讚讜诇 should not be part of the 住谞讛讚专讬谉 when they judge the 注讬讘讜专 砖谞讛, the reason is: 诪诇讱 诪砖讜诐 讗驻住谞讬讗, the king because of 讗驻住谞讬讗, as 专砖"讬 explains, it means that a king has to feed the army, and based on the 注讬讘讜专 砖谞讛 will change how much money he will have to spend for the feeding of the army. And therefore, the king would rather have that every year should be 诪注讜讘专. So since there is a personal reason why the king would want it to be 诪注讜讘专, so therefore he cannot be part of the 住谞讛讚专讬谉 when they judge the 注讬讘讜专 砖谞讛. And a 讻讛谉 讙讚讜诇 诪砖讜诐 爪讬谞讛, the 讻讛谉 讙讚讜诇 because of the cold. As 专砖"讬 says, that if they're going to be 诪注讘专 讚讬 砖谞讛, it'll come out that 转砖专讬 will be really when 讞砖讜谉 should have been, that means that it'll be a colder climate. If they wouldn't be 诪注讘专 讚讬 砖谞讛, it'll still be a month earlier, it won't be so cold. If they will be 诪注讘专 讚讬 砖谞讛, then it'll come out that 转砖专讬 will be a month later, so the weather of 讞砖讜谉 will be in 转砖专讬, so it'll be cold. And since the 讻讛谉 讙讚讜诇 has to go to the 诪拽讜讛 on 讬讜诐 讻讬驻讜专 five times, and it's cold, so therefore he would rather they should not be 诪注讘专 讚讬 砖谞讛. So since he could have a personal reason why he should not want to be 诪注讘专 讚讬 砖谞讛, so maybe because of that his opinion will be not to be 诪注讘专, so therefore 诇讻转讞讬诇讛 we do not let the 讻讛谉 讙讚讜诇 to be part of this 讘讬转 讚讬谉 that is going to be 诪注讘专 讚讬 砖谞讛. But

Tosafot on the Cold Reason for Exclusion

转讜住驻讜转 asks a 拽砖讬讗 on 专砖"讬, that how can we say that this is because of the 讟讘讬诇讛 when we find in the 讙诪专讗 讬讜诪讗 that they used to make the 诪拽讜讛 warm if it was cold? So what was the 讻讛谉 讙讚讜诇 afraid of? So therefore 转讜住驻讜转 learns that it is not because of the 诪拽讜讛, but because of the floor. Since when you do the 注讘讜讚讛 in the 讘讬转 讛诪拽讚砖, you weren't allowed to wear shoes, and it was a stone floor, so it was cold, and since the 讻讛谉 讙讚讜诇 has to do the 注讘讜讚讛 On Yom Kippur all day, so if it'll be pushed off, it'll be colder weather, he will be standing all day barefoot on the cold floor, therefore he'd rather they shouldn't be 诪注讘专, so it'll be warmer weather and he will not have to stand on the cold floor, the floor won't be cold. And therefore we do not allow the 讻讛谉 讙讚讜诇 to be part of this 讘讬转 讚讬谉 who is going to be 诪注讘专 the 砖谞讛. Then the 讙诪专讗 continues: 讗诪专 专讘 驻驻讗, 专讘 驻驻讗 said, 砖诪注 诪讬谞讛, from here we understand, from this that we said that the reason why a 讻讛谉 讙讚讜诇 can't be part of the 讘讬转 讚讬谉 of 注讬讘讜专 砖谞讛 is because of the 爪讬谞讛, we're afraid that he will not want the year to be 诪注讜讘专, because he will want that in 转砖专讬 there should not be the weather of 讞砖讜讜谉, and if you will be 诪注讘专 the 砖谞讛, then in 转砖专讬 you will have the weather of 讞砖讜讜谉, so from that we see that 砖转讗 讘转专 讬专讞讗 讗讝讬诇, that the year follows the month. That means that if we are 诪注讘专 the 砖谞讛, what happens is the weather still comes in its same time. If that

Weather Consistency and Intercalation Debate

month should have been 讞砖讜讜谉, and it should have had the weather of 讞砖讜讜谉, so even if we are 诪注讘专 the year, nevertheless the weather stays the same. At the same time when we would have had the weather of 讞砖讜讜谉, we will have that weather, even though when we were 诪注讘专 the 砖谞讛, that month really now is not 讞砖讜讜谉, it is 转砖专讬, but still in 转砖专讬 you will have the weather of 讞砖讜讜谉, since the weather does not depend on the 注讬讘讜专 砖谞讛, that depends on its own season. And we see that from this, because if it would be different, if it would be that when we're 诪注讘专 the 砖谞讛, it also pushes off the weather, then why is the 讻讛谉 讙讚讜诇 worried that they should be 诪注讘专 the 砖谞讛? What difference does it make? If they'll be 诪注讘专 the 砖谞讛, so the weather will be pushed off, so when it comes to 转砖专讬 it'll have the weather of 转砖专讬, and not the weather of 讞砖讜讜谉. And since we said that we are worried the 讻讛谉 讙讚讜诇 will not want to be 诪注讘专 the 砖谞讛 because of this, obviously if you 诪注讘专 the 砖谞讛, the weather still stays the same, and therefore if 转砖专讬 is pushed off, 转砖专讬 will have the weather of 讞砖讜讜谉. This is the way 专砖状讬 learns. But 转讜住驻讜转 asks that 诇讻讗讜专讛 the whole purpose of making 注讬讘讜专 砖谞讛 is in order to straighten out the 转拽讜驻讛. Since the seasons don't depend on the moon, the seasons depend on the sun, and the months follow the moon. So the reason we make an 注讬讘讜专 砖谞讛, one of the reasons at least, is for the 转拽讜驻讛, that we should have the right season in the right month. So it comes out that when we are 诪注讘专 the 砖谞讛, the whole idea is that when 转砖专讬 comes, we should have the right season, the right weather in 转砖专讬 as it fits for 转砖专讬. When we see that the 转拽讜驻讛 will not fit, that means that the weather, the season of 转砖专讬 will not be the right season, so we push off with a month in order that in 转砖专讬 we should have the right weather of 转砖专讬. So what does the 讙诪专讗 mean here that we see from this that the weather still stays the same, that when we make 注讬讘讜专 砖谞讛 we will have the weather of 讞砖讜讜谉 in the month of 转砖专讬, when it is not so? We will have the weather of 转砖专讬 in the month of 转砖专讬! The whole idea is, when the 讞讻诪讬诐 would see that the weather of 转砖专讬 will, might not be the right weather, it'll be too hot, the season of summer will still be in the time of 转砖专讬, that's why you push it off in order to have the weather of 转砖专讬, the season of 转砖专讬 in the month of 转砖专讬. So it comes out that whenever we make an 注讬讘讜专 砖谞讛, it is in order to have the right weather in 转砖专讬. So what does the 讙诪专讗 here mean that when we make an 注讬讘讜专 砖谞讛, we have the weather of 讞砖讜讜谉 in the month of 转砖专讬? Therefore 转讜住驻讜转 says, we must say that in this 讙诪专讗 we are talking in a case when they were 诪注讘专 the 砖谞讛 not because of the 转拽讜驻讛, because we learned earlier in the 讙诪专讗 that there are two more reasons why we are 诪注讘专 the 砖谞讛: because of 讗讘讬讘 and because of 驻讬专讜转. Now in that case, as far as the season is concerned, 转砖专讬 would have had its normal season, its normal weather, and the reason we push it off is for something else. Now in that case, when we push it off, when 转砖专讬 comes, it will not have the weather of 转砖专讬, but it will have the weather of 讞砖讜讜谉, because if you wouldn't have pushed it off, it would have had the normal season, the normal weather of 转砖专讬. Now that we pushed it off, it's going to have the weather of 讞砖讜讜谉. Then the 讙诪专讗 asks: 讗讬谞讬, it is not so! How can you say that when we make 注讬讘讜专 砖谞讛, we will have the weather of the next month in the earlier month?

Shepherds' Tale and Adding a Second Adar

讜讛谞讱 讙' 专注讬讗, there's a story that there were three shepherds, 讚讛讜讜 拽讬讬诪讬 that they were standing, 讜砖诪注讬谞讛讜 专讘谞谉, and the 专讘谞谉 heard, 讚拽讗诪专讬 that they were saying, 讞讚 讗诪专, one said: 讗诐 讘讻讬专 讜诇拽讬砖 讻讞讚讗 讬谞抓, 讚讬谉 讛讜讗 讗讚专. If the earth is going to be warm and it'll grow together, the one that is soft and the one that is hard, that means as 专砖状讬 says, the wheat that was planted in the beginning of the month and the barley that's planted later, if they will both grow out together, then this is 讗讚专, this is the weather of 讗讚专. 讜讗讬 诇讗, and if not, 诇讬转 讚讬谉 讗讚专, this is not 讗讚专, this is 砖讘讟. In other words, if it is 讗讚专, then this is what should happen, but if they see that this doesn't happen, then this proves this is 砖讘讟. That's what one of them said. 讜讞讚 讗诪专, the other one said that 讗诐 转讜专 讘爪驻专 讘爪讬讙诇讗 讬诪讜讝, if in the morning it'll be so cold till the the ox will be close to dying, it'll be so cold that it'll hurt him, he'll be close to dying, 讜讘讟讬讛专讗 讘讟讜诇 转讗讬谞讛 讬转诪讜讱, and if in the afternoon the heat will be so strong that the ox will have to stand in the the shade of the fig tree because of the heat, so 讜讬砖诇讞 诪砖讻讬讛, and he's going to stretch out his skin, which means he's going to scratch himself on this fig tree because of the heat, so if this will happen, 讚讬谉 讛讜讗 讗讚专, then we know it's 讗讚专. 讜讗诐 诇讗讜, if not, 诇讬转 讚讬谉 讗讚专, it's not 讗讚专, because then this will have the weather of 砖讘讟, then we will know that this is not 讗讚专, but this is 砖讘讟. 讜讞讚 讗诪专, and one said, 讗诐 拽讬讚讜诐 转拽讬祝 诇讞讝讗 讚讬讛讗 讬驻讞 讘专讜讞 谞驻讬拽 诇拽讬讘诇讬讛, that means that if the strength of the winter will already be weakened that when an east wind will blow and your breath can prevail against it, then you know that this is the month of 讗讚专. 讜讗诐 诇讗讜, and if not, 诇讬转 讚讬谉 讗讚专, this is not 讗讚专. In other words, if it's colder than that, then this is not 讗讚专, but this is 砖讘讟. And what happened when the 专讘谞谉 heard this, 讜注讘专讜 专讘谞谉 诇讛讛讬讗 砖转讗, the 专讘谞谉 were 诪注讘专 that year, they added another 讗讚专. In other words, what they did was that since that time 讗讚专 had the weather of 砖讘讟, so what they did was they made a second 讗讚专 so that the second 讗讚专 would have the weather of 讗讚专. Now, according to this, it comes out that when the 讞讻诪讬诐 look into being 诪注讘专 the year, whether to add another month or not, they take in consideration to make sure that the weather should be in its proper time. And therefore, when they heard from them that this was not the weather of 讗讚专, they added another month in order that 讗讚专 should have the weather of 讗讚专. So therefore, by the time 转砖专讬 comes around, 转砖专讬 will always have the weather of 转砖专讬, because we see that if the weather does not fit to the month, the 讞讻诪讬诐 will, based on that, see whether to be 诪注讘专 讛砖谞讛 or not. So how could we say before that when the 讞讻诪讬诐 诪注讘专 the year, you have the weather of 讞砖讜谉 in the month of 转砖专讬, when here we see that when the 讞讻诪讬诐 诪注讘专 the year, they make sure that this is so that the weather of the month should be in its right time? And the 讙诪专讗 answers: 讜转住讘专讗, what do you think, 专讘谞谉 讗专驻住讗 住诪讜讱, that the 专讘谞谉 really relied on what these shepherds said? 讗诇讗 专讘谞谉 讗讞砖讘讜谞讬讬讛讜 住诪讜讱, the 专讘谞谉 relied on their own 讞砖讘讜谞讜转, and they, for their own reasons, felt that you have to make an 注讬讘讜专 砖谞讛. 讜专注讬 讘拽专 讗讬住转讬讜注讬 讛讜讗 讚讗讬住转讬讬注讗 诪讬诇转讗, when they heard these 专注讬 讘拽专, these shepherds speaking, all it did was help to them and show them that they were right in their calculation, but it's not because of the weather that they did it. And here we see that it doesn't depend on the weather. Sometimes it does work out with the weather, but sometimes it doesn't work out. But if the 讞讻诪讬诐 have their own reasons why to be 诪注讘专 讛砖谞讛, even if the weather will not fit to the month, nevertheless the 讞讻诪讬诐 诪注讘专 讛砖谞讛, and therefore we understand why the 讻讛谉 讙讚讜诇 sometimes could not want the 注讬讘讜专 砖谞讛, because he doesn't want that the weather of 讞砖讜谉 should be in the month of 转砖专讬. And the 讙诪专讗 continues, we

Kohen Gadol's Chalitza and Yibum Rules

learn in the 诪砖谞讛: 讞讜诇抓 讜讞讜诇爪讬谉 诇讗砖转讜, that a 讻讛谉 讙讚讜诇 would give 讞诇讬爪讛 if his brother died without children, he would give 讞诇讬爪讛 to his wife. Also, if the 讻讛谉 讙讚讜诇 died, then his brother would give 讞诇讬爪讛 to his wife. And then the 诪砖谞讛 continued: 讜诪讬讘诪讬谉 讗转 讗砖转讜 讗讘诇 讛讜讗 讗讬谞讜 诪讬讬讘诐, that if he died and his brother wants to marry his wife and perform 讬讘讜诐, he is allowed, but he cannot 诪讬讬讘诐 the wife of his brother. If his brother died without children, he must give 讞诇讬爪讛, he can't 诪讬讬讘诐 her, he can't marry her. And the reason the 诪砖谞讛 gives: 诪驻谞讬 砖讛讜讗 讗住讜专 讘讗诇诪谞讛, because since he's a 讻讛谉 讙讚讜诇, and a 讻讛谉 讙讚讜诇 is not allowed to marry a widow, so therefore he is not allowed to be 诪讬讬讘诐 his brother's wife because then he would be marrying a widow. So the 讙诪专讗 asks: 拽驻住讬拽 讜转谞讬, the 诪砖谞讛 makes it very clear without any conditions, that 诇讗 砖谞讗 诪谉 讛讗讬专讜住讬谉 讜诇讗 砖谞讗 诪谉 讛谞讬砖讜讗讬谉, that when we say that he cannot give 讬讘讜诐 to his brother's wife because she is a widow, it doesn't make a difference what kind of widow is she is, whether she's a widow 诪谉 讛讗讬专讜住讬谉 or a widow 诪谉 讛谞讬砖讜讗讬谉. When you give 拽讬讚讜砖讬谉 to a woman, she becomes an 讗砖转 讗讬砖, she is married to you, but she is still considered an 讗专讜住讛. And then later, when you take her under the 讞讜驻讛, then she is considered a 谞砖讜讗讛. And as soon as 谞讬砖讜讗讬谉 took place, then she is allowed to have relations with her husband. Now the 讚讬谉 of 讬讘讜诐 applies to a widow whether she was widowed from the 讗讬专讜住讬谉 or from the 谞讬砖讜讗讬谉. If a person gives 拽讬讚讜砖讬谉 to a woman and then he dies before he actually gave her 谞讬砖讜讗讬谉, there is also a 讚讬谉 of 讬讘讜诐. So in this case where it says that a 讻讛谉 讙讚讜诇 cannot give 讬讘讜诐 to his brother's wife, without making any differences, is 诪砖诪注 that whether she became a widow from the 讗讬专讜住讬谉 or if she became a widow from the 谞讬砖讜讗讬谉. And the 讙诪专讗 asks: 讘砖诇诪讗 诪谉 讛谞讬砖讜讗讬谉, we understand why if she became a widow after already the marriage, why the 讻讛谉 讙讚讜诇 cannot marry her, because 讛讜讬 注砖讛 讜诇讗 转注砖讛. Because then the 讻讛谉 讙讚讜诇, if he would marry her, would be transgressing a positive 诪爪讜讛 and a negative 诪爪讜讛. Because the 讻讛谉 讙讚讜诇 has a 诇讗 转注砖讛, a negative 诪爪讜讛 of not being allowed to marry an 讗诇诪谞讛. The 驻住讜拽 says that a 讻讛谉 讙讚讜诇 should not marry an 讗诇诪谞讛. In addition to that, the 讻讛谉 讙讚讜诇 also has a positive 诪爪讜讛, 诪爪讜转 注砖讛, that he must marry a 讘转讜诇讛. It says 讗砖讛 讘讘转讜诇讬讛 讬拽讞, he must take a virgin. Now, if she already was married to his brother, so now she is not a virgin. So she has both: she is a widow, and she is not a virgin. So if the 讻讛谉 讙讚讜诇 would marry her, he would be going against the 诇讗 转注砖讛 because he would be marrying an 讗诇诪谞讛, he also would be going against the 注砖讛 because she is not a virgin. And the rule is 讜讗讬谉 注砖讛 讚讜讞讛 诇讗 转注砖讛 讜注砖讛, that an 注砖讛, a positive 诪爪讜讛, cannot push away a negative 诪爪讜讛 with a positive 诪爪讜讛. Like this we have a rule that 注砖讛 讚讜讞讛 诇讗 转注砖讛. If there is a 诪爪讜讛 a person is supposed to perform, but at the same time when he's going to perform the 诪爪讜讛 he will have to be 注讜讘专 on a 诇讗 转注砖讛, on a negative 诪爪讜讛, so the 讚讬谉 is he should do the 诪爪讜转 注砖讛, he should do the positive 诪爪讜讛 and push away, transgress the 诇讗 转注砖讛. But if the 注讘讬专讛 he will be doing will not only be a 诇讗 转注砖讛, but it'll be an 注砖讛 and a 诇讗 转注砖讛, he will be going against a positive 诪爪讜讛 and a negative 诪爪讜讛, then we say he should not do the 诪爪讜讛, because an 注砖讛 is not stronger than the 诇讗 转注砖讛 and the 注砖讛 together. And therefore here, too, it is a 诪爪讜讛 for a person to give 讬讘讜诐. So normally we would say the 注砖讛 of 讬讘讜诐 should push away the 诇讗 转注砖讛 of a 讻讛谉 讙讚讜诇 marrying an 讗诇诪谞讛. And therefore he should marry her even though she's an 讗诇诪谞讛. But 诇驻讜注诇 we said that it's not only a 诇讗 转注砖讛, but there is an 注砖讛 also. The 转讜专讛 says he must marry a virgin. So therefore, if he does marry her, he goes against the 注砖讛 and the 诇讗 转注砖讛. So we understand why he is not allowed to give her 讬讘讜诐, even though there is a 诪爪讜转 注砖讛 of 讬讘讜诐, because this 诪爪讜转 注砖讛 cannot push away the 诇讗 转注砖讛 and the 注砖讛 that a 讻讛谉 讙讚讜诇 has not to marry her. 讗诇讗 诪谉 讛讗讬专讜住讬谉, but if she became a widow only after the 讗讬专讜住讬谉, which means that she never became his wife, so she never had relations with her husband, so she still is a 讘转讜诇讛, she still is a virgin. She is a widow, because since her husband died she is an 讗诇诪谞讛, but she is still a 讘转讜诇讛. 讗诪讗讬, so then why do we say that the 讻讛谉 讙讚讜诇 cannot give her 讬讘讜诐? 讬讘讗 注砖讛 讜讬讚讞讛 诇讗 转注砖讛, why can't the 注砖讛 of 讬讘讜诐 come and push away the 诇讗 转注砖讛 that the 讻讛谉 讙讚讜诇 has of marrying an 讗诇诪谞讛, and here he will not be transgressing the 注砖讛 because she is still a virgin? And the 讙诪专讗 answers:

Halachic Decree: First vs. Second Intercourse

讙讝讬专讛 讘讬讗讛 专讗砖讜谞讛 讗讟讜 讘讬讗讛 砖谞讬讬讛. That the reason the 讞讻诪讬诐 said that he should not 诪讬讬讘诐 is because it's a 讙讝讬专讛. We're afraid to allow him to have the first 讘讬讗讛, the first relations with her, because it might come to have the second, because the 诪爪讜转 注砖讛 of 讬讘讜诐 is only the first time he has relations with her. The second time already, there is no more 诪爪讜讛. Now that she's his wife, there is no more 诪爪讜讛. So a 讻讛谉 讙讚讜诇 would not be allowed to have a second time relations with her, because now that there is no more 诪爪讜讛, and on the other hand, she is an 讗诇诪谞讛. So 讘讗诪转, even if we would say the 讻讛谉 讙讚讜诇 should 诪讬讬讘诐, it would only allow him to have the 讘讬讗讛 专讗砖讜谞讛, but the 讞讻诪讬诐 felt if they're going to allow him to have the 讘讬讗讛 专讗砖讜谞讛, he might come to have the second 讘讬讗讛 also, so therefore the 讞讻诪讬诐 said he should never 诪讬讬讘诐 and not even have the 讘讬讗讛 专讗砖讜谞讛. And the 讙诪专讗 says 转谞讬讗 谞诪讬 讛讻讬, we 转拽讬 learn in a 讘专讬讬转讗, this is to prove that the second 讘讬讗讛 is 讗住讜专, because it says 讗诐 拽讚诪讜 讜讘注诇讜 讘讬讗讛 专讗砖讜谞讛 拽谞讜. This refers to all those people who for some reason are forbidden to 诪讬讬讘诐, because of whatever reasons. So it says that they're not even allowed to have the first 讘讬讗讛, even though in the first 讘讬讗讛 there is a 诪爪讜讛. But nevertheless, 讗诐 拽讚诪讜 讜讘注诇讜 讘讬讗讛 专讗砖讜谞讛, if they went ahead and they did have the first 讘讬讗讛, 拽谞讜, they acquired and they fulfilled the 诪爪讜讛 of 讬讘讜诐, but still 讜讗住讜专 诇拽讬讬诪讛 讘讘讬讗讛 砖谞讬讬讛, they're not allowed to hold them and have a second 讘讬讗讛. So since they're not allowed to have a second 讘讬讗讛, the 讞讻诪讬诐 made a 讙讝讬专讛 they shouldn't have the first 讘讬讗讛 either. And so too by the 讻讛谉 讙讚讜诇, 诪爪讚 讛讚讬谉 he would be able to have the first 讘讬讗讛 because of the 诪爪讜讛 of 讬讘讜诐, but the 讞讻诪讬诐 made a 讙讝讬专讛 讘讬讗讛 专讗砖讜谞讛 讗讟讜 讘讬讗讛 砖谞讬讬讛. Then the 讙诪专讗 continues, we

Kohen Gadol Leaving the Temple Restrictions

learn in the 诪砖谞讛: 诪转 诇讜 诪转 讜讻讜', that if a person died in the family of the 讻讛谉 讙讚讜诇, so it says he is not allowed to follow the bed. But what does he do? As it says, when they enter the street, he waits, and when they turn the corner, that's when he goes into the street. But the 讙诪专讗 says 转谞讜 专讘谞谉, the 专讘谞谉 learned. It says in the 驻住讜拽: 诪谉 讛诪拽讚砖 诇讗 讬爪讗, that a 讻讛谉 讙讚讜诇 should not go out of the 诪拽讚砖. So we 讚专砖谉: 诇讗 讬爪讗 注诪讛谉, he should not go out together with them, 讗讘诇 讬讜爪讗 讛讜讗 讗讞专讬讛谉, but he could go out behind them. 讻讬爪讚, how do you do it? 讛谉 谞讻住讬谉 讜讛讜讗 谞讙诇讛, they are hidden and that's when he he's revealed. In other words, when they leave the street, that's when he enters the street. 讛谉 谞讙诇讬谉 讜讛讜讗 谞讻住讛, when they enter the other street, he is hidden, he does not enter the street. That means that he could go, but he could not go together with them. Then the 讙诪专讗 continues. It said in the 诪砖谞讛, 讜讬讜爪讗 注讚 驻转讞 讜讻讜诇讬, and he can go out up to the door of the gate of the city. That's the opinion of 专讘讬 诪讗讬专. But 专讘讬 讬讛讜讚讛 said that he can't go out of the 诪拽讚砖 at all, as the 驻住讜拽 says, 讜诪谉 讛诪拽讚砖 诇讗 讬爪讗, that from the 诪拽讚砖 he should not go out. But the 讙诪专讗 asks, 砖驻讬专 拽讗诪专 专讘讬 讬讛讜讚讛, doesn't 专讘讬 讬讛讜讚讛 say right? It seems like 专讘讬 讬讛讜讚讛 is right. If the 驻住讜拽 says he should not go out of the 诪拽讚砖, it's 诪砖诪注 he should not go out at all. So how could 专讘讬 诪讗讬专 say that he could go, but just follows behind? 讗诪专 诇讱 专讘讬 诪讗讬专, 专讘讬 诪讗讬专 will answer you, 讗讬 讛讻讬, if it's so like you say, that it means literally he cannot go out of the 诪拽讚砖, 诇讘讬转讜 谞诪讬 诇讗, he shouldn't be able to go to his house either. 讗诇讗 讛讻讗 拽讗诪专, therefore 专讘讬 诪讗讬专 says, this is the 驻砖讟 in the 驻住讜拽, 诪谉 讛诪拽讚砖 诇讗 讬爪讗, what does that mean? 诪拽讚讜砖转讜 诇讗 讬爪讗, he should not go out of his 拽讚讜砖讛. What it means is, not only shouldn't he become 讟诪讗, because that's the 驻住讜拽 before, 诇讗讘讬讜 讜诇讗诪讜 诇讗 讬讟诪讗, he shouldn't become 讟诪讗 to his father or mother, what it means is, he shouldn't do anything that could make him come to a point where he will become 讟诪讗. He should stay away. So therefore, to be close to the to 诪讬讟讛, he's not allowed, because he might touch the 诪讬讟讛. But 讻讬讜讜谉 讚讗讬转 诇讬讛 讛讬讻专讗, but if he goes behind, so there is a 讛讬讻专, there is something to remind him that he's not allowed to touch, 诇讗 讗转讬 诇诪讬谞讙注, so he will not come to touch. So therefore, he is allowed to go a little bit further, because this is what the 驻住讜拽 means, 诪谉 讛诪拽讚砖 诇讗 讬爪讗, 诪拽讚讜砖转讜 诇讗 讬爪讗.

Rabbi Yehuda's Reasoning About Grief and Accident

The 讙诪专讗 asks, 讜专讘讬 讬讛讜讚讛, it's a good 拽讜砖讬讗 on 专讘讬 讬讛讜讚讛, what will 专讘讬 讬讛讜讚讛 answer to this? So he says, 讗讙讘 诪专讬专讬讛, because of his bitterness, since he's an 讗讘诇, so he feels very bitter, 讚讬诇诪讗 诪拽专讬 讜讗转讬 诇诪谞讙注, it might happen that by mistake he will touch. Normally if there is a 讛讬讻专, we're not afraid he will come to do the 注讘讬专讛. But but in a case where he is in grief, so there we are afraid maybe he will not be careful, and he will come to touch.
