Why Paying Double Applies More Broadly Than Paying Four or Five Times

Part of Bava Kama (Iyun)

A shiur on Bava Kama 62b (Perek Merubah) explaining why the penalty of kefel (double payment) for theft applies to any stolen item, while the penalty of arba'ah va'chamisha (four- or five-fold payment) applies only to a stolen sheep or ox that was then slaughtered or sold.

Intro: k'fal vs Four-and-Five Penalties

Let's take the words top, I guess, here in ื‘ื‘ื ืงืžื, ื“ืฃ ืกืดื‘ ืขืžื•ื“ ื‘ืณ, ืคืจืง ืžืจื•ื‘ื”. So the ืžืฉื ื” starts with ืžืจื•ื‘ื” ืžื™ื“ืช ืชืฉืœื•ืžื™ ื›ืคืœ ืžืžื™ื“ืช ืชืฉืœื•ืžื™ ืืจื‘ืขื” ื•ื—ืžื™ืฉื”, that the ื“ื™ืŸ of paying ื›ืคืœ is more than the ื“ื™ืŸ of paying ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. ื›ืคืœ you pay if you're a ื’ื ื‘. A person who steals and he's caught has to pay double, that's ื›ืคืœ. Then there's another ื“ื™ืŸ that if you steal a ืฉื” or a ืฉื•ืจ, a sheep or an ox, and you ืฉื—ื˜ it or you sell it, that's called ื˜ื‘ื™ื—ื” ื•ืžื›ื™ืจื”, then you have to pay for this ืฉื”, for the sheep you have to pay four times as much, and for the ox you have to pay five times as much, a special ื“ื™ืŸ. So the ืžืฉื ื” says here that ื›ืคืœ is more, includes more cases than the case of ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. Why? ื›ืคืœ you pay whether it's something that's living or an object that doesn't have life, whether you steal an animal or you steal any other object, and you're caught, you have to pay double. But this ื“ื™ืŸ that you have to pay sometimes four or five times as much only applies if it happens to be a ืฉื•ืจ, an ox, then you pay five, or a ืฉื”, then you pay four. ืฉื ืืžืจ, because the ืคืกื•ืง says: ื›ื™ ื™ื’ื ื•ื‘ ืื™ืฉ ืฉื•ืจ ืื• ืฉื” ื•ื˜ื‘ื—ื• ืื• ืžื›ืจื•, if you ื’ื ื‘, you steal an ox or a sheep, and you ืฉื—ื˜ it or you sell it, ื•ื’ื•ืณ etc., the ืคืกื•ืง continues, that's when you pay four times the amount of the sheep and five times the amount of the ox. That's the ืžืฉื ื”. Comes the ื’ืžืจื, and the ื’ืžืจื says that the ืžืฉื ื” here only mentions one difference between ื›ืคืœ and ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. There's

Gemaraโ€™s Debate: Two Opinions on the Claimant

another difference that we could have mentioned, and I'll say in a moment what it is, and since the ืžืฉื ื” does not mention that difference, obviously the ืžืฉื ื” holds that there is no difference. What is the other difference? There areโ€”there is a ื“ื™ืŸ of a ื’ื ื‘โ€”we need a lot of introduction hereโ€”there is a ื“ื™ืŸ of a ื’ื ื‘, and there is a ื“ื™ืŸ of a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘. ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ means somebody who ื˜ื•ืขื ืณืก that it was stolen. Basically this is talking by a ืฉื•ืžืจ. If you give someone to watch your object, and you come to him and you tell him give it back, and he answers you it got stolen, and he swearsโ€”these are all the conditionsโ€”and he swears that it got stolen, and then we catch him that he's lying, so the ื“ื™ืŸ is that this guy has to pay ื›ืคืœ. That's what we learn out from a ืคืกื•ืง in the ื’ืžืจื later on. We learn...huh? ืฉื•ืžืจ ื—ื™ื ื, ืฉื•ืžืจ ืฉื›ืจ. If he says it got stolen, ื—ื™ื™ื‘, because a ืฉื•ืžืจ ืฉื›ืจ pays for it, for if it got stolen. ืฉื•ืžืจ ื—ื™ื ื, who normally, if it would actually have gotten stolen would have been ืคื˜ื•ืจ, so he tried to get out of it, and he said that it got stolen, and also he swore, that's the whole thing, he swore, then we catch him. So he has a ื“ื™ืŸ like a ื’ื ื‘, and we learn out from a ืคืกื•ืง that he pays ื›ืคืœ, he pays double as if he would have stolen himself. Now the

Does a Claimant Also Pay Four-and-Five?

question is, what happens if he not only ื˜ื•ืขื ืณื“, but then later is ื˜ื‘ื— ื•ืžื›ืจ? What? Well, what happens if he says it got lost, and then we catch him that he took it? He doesn't pay ื›ืคืœ. Only if he ื˜ื•ืขื ืณืก ื˜ืขื ืช ื’ื ื‘. Not what he did, he ื˜ื•ืขื ืณื“ it got stolen, and then we, and he swore, and then we caught him, he has a ื“ื™ืŸ like a ื’ื ื‘. Because not every time that you steal from somebody you're ื—ื™ื™ื‘ ื›ืคืœ. A ื’ื–ืœืŸ is not ื—ื™ื™ื‘ ื›ืคืœ, only a ื’ื ื‘. Because a ื’ื–โ€”I've made the ื—ื™ืœื•ืงโ€”a ื’ื ื‘ is someone who is a thief quietly. A ื’ื–ืœืŸ, he comes openly, makes a holdup, takes, so he doesn't pay ื›ืคืœ. Only a ื’ื ื‘ pays, so there's a special ื“ื™ืŸ by a ื’ื ื‘. Here we have another ื“ื™ืŸ, that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, that's what we call him, a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, who is the ืฉื•ืžืจ, the one that watched an object and claimed it got stolen and swore and was caught that he lied, he also has to pay ื›ืคืœ. Now what is the ื“ื™ืŸ if not only did he claim it got stolen and we found that he did it, but he ืฉื—ื˜-ed it, and it happened to be an ox, or he ืฉื—ื˜, it happens to be a ืฉื”, will he pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”? So the ื’ืžืจื says: ืœื›ืื•ืจื” we would think there's a difference, that he only ื›ืคืœ, the ื“ื™ืŸ of ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ only pays ื›ืคืœ, but there is no ื“ื™ืŸ of ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. But if that would be true, then the ืžืฉื ื” would have mentioned it. The ืžืฉื ื” is trying to tell us the difference between ื›ืคืœ and ืืจื‘ืขื” ื•ื—ืžื™ืฉื”, and it says ื›ืคืœ applies to everything, ืืจื‘ืขื” ื•ื—ืžื™ืฉื” only to an ox and a ืฉื”. Now, if it was ืฉื—ื˜-ed and was, or it was sold, the ืžืฉื ื” did not say that there's another difference between the two, that ื›ืคืœ applies by a ื’ื ื‘ and a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, and ืืจื‘ืขื” ื•ื—ืžื™ืฉื” only applies to a ื’ื ื‘, not to a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘. The ืžืฉื ื” didn't say that. Obviously the ืžืฉื ื” holds that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ also will pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. So the

Rabbi Chiyya Bar Abbaโ€™s Position on Four-and-Five

ื’ืžืจื says, ืžืกื™ื™ืข ืœื™ื” ืœืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื. This fact that the ืžืฉื ื” does not make that difference proves that ืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื is right. What did he say? ื“ืืžืจ ืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, ื”ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ ื‘ืคืงื“ื•ืŸ, if someone ื˜ื•ืขืŸ's by a ืคืงื“ื•ืŸ, by an object that was given to him to watch that it got stolen, ืžืฉืœื ืชืฉืœื•ืžื™ ื›ืคืœ, so he pays ื›ืคืœ, and he adds, ื˜ื‘ื— ื•ืžื›ืจ, if he ืฉื—ื˜ it or sold it and it happened to be an ox or a or a ืฉื”, ืžืฉืœื ืชืฉืœื•ืžื™ ืืจื‘ืขื” ื•ื—ืžื™ืฉื”, he does pay. So a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื” also. That's one ืœืฉื•ืŸ in the ื’ืžืจื. ืื™ื›ื ื“ืืžืจื™, there's another ืœืฉื•ืŸ. Some say differently, some say the ื’ืžืจื asked, do we have such a ืจืื™ื” from our ืžืฉื ื”? And the ื’ืžืจื says it's no ืจืื™ื”, maybe the ืžืฉื ื” left it out. The ืžืฉื ื” doesn't have to write everything, every difference that is written, ืชื ื ื•ืฉื™ื™ืจ. And ืžืžื™ืœื there is no ืจืื™ื” from the ืžืฉื ื”. And therefore, it's possible that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื›ืคืœ, but does not pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. Pays double if you catch him took it, but if he ืฉื—ื˜ it or and if it's a ืฉื” or a ืฉื•ืจ, he doesn't pay. Huh? But ืชื•ืกืคื•ืช asks, ืžืื™ ืฉื™ื™ืจ ื“ื”ืื™ ืฉื™ื™ืจ? And then goes in there are other things that could be left out. Yeah, we're dealing with this case now. Now, clearly the the ื’ืžืจื did not make two opinions whether a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื” or not. All the ื’ืžืจื was wondering whether we have a proof from our ืžืฉื ื”. So, one opinion says there is a proof, the fact that the ืžืฉื ื” didn't mention it, a ืกื™ืžืŸ there is no difference, and there is no proof. But there is no argument whether the ื“ื™ืŸ is like that. On the other hand, the fact that the ืžืฉื ื” the ื’ืžืจื is looking to see whether there is a proof in the ืžืฉื ื”, maybe the ืžืฉื ื” is not a proof, and maybe the ืคืฉื˜ is that he's ืคื˜ื•ืจ, a ืกื™ืžืŸ that there are two sides to it. So, we do see in the ื’ืžืจื that there are two sides to this concept whether a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ will pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื” or not. ื“ืืก ื”ื™ื™ืกื˜ ืื–ื•ื™, for sure a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื›ืคืœ, that is not a question because that's learned out from a ืคืกื•ืง, there is not a ืฉืืœื”. The discussion here is whether a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ will also have the other ื“ื™ืŸ of a ื’ื ื‘, that if ื˜ื‘ื— ื•ืžื›ืจ by a ืฉื•ืจ ื•ืฉื”, will he pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”? Now we have two sides. What we have to focus on, what are the two sides to under to see whether a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ will pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื” or will not pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”? That's one thing here. Later on in the ื’ืžืจื, we find something along the same lines. The ื’ืžืจื later on, on ื“ืฃ ืกื’ ืขืžื•ื“ ื‘, discusses this ื“ื™ืŸ of a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ that he does pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. But the ื’ืžืจื wants to know where we know it from. One opinion says that we know it from an extra ืคืกื•ืง where it says ื’ื ื‘, ื”ื’ื ื‘. It should have said ื’ื ื‘, and it says ื”ื’ื ื‘. Anyway, we have an extra ืœื™ืžื•ื“ that teaches us that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื“' ื•ื”', pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. There's another opinion in the ื’ืžืจื that it's not learned out from that extra ืคืกื•ืง, because the extra ืคืกื•ืง is not extra, it has another ื“ื™ืŸ. So what do we how do we know a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื”? So the ื’ืžืจื says, well, we compare it to a ื’ื ื‘, and because it's next written in the ืคืกื•ืง next to a ื’ื ื‘, we compare it to a ื’ื ื‘. Just like a ื’ื ื‘ pays ื›ืคืœ, so by a ืฉื•ืจ ื•ืฉื”, ื˜ื‘ื— ื•ืžื›ืจ pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื”, so a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ does the same. Now, we see here again something similar: that one opinion says we can't just compare it to a ื’ื ื‘, we gotta have a special ืœื™ืžื•ื“. That's to say the fact that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื›ืคืœ is not enough to tell me, so automatically he pays ื“' ื•ื”'. No, we gotta have a special ืคืกื•ืง, because we would not have known it directly from a ื’ื ื‘. The other opinion says no, we could compare it to a ื’ื ื‘, and just like a ื’ื ื‘, just like he pays ื›ืคืœ, pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื”, a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื›ืคืœ, pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื” also. So again we see another two opinions here whether we ืขืœ ืคื™ ืฉื›ืœ can compare and learn out the fact that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื“' ื•ื”' from the fact that he pays ื›ืคืœ, and we'll compare it to a ื’ื ื‘. So one opinion says we can't, we need a special ืคืกื•ืง for it, and one opinion says we could. Again, we have to see what is the two sides, whether it's a logical thing and we don't need a special ืคืกื•ืง for it, or it's not. Why would he? He's not a ื’ื ื‘. He's a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, but not a ื’ื ื‘. So a ื˜ื•ืขืŸ ื˜ืขื ืช ืื‘ื“ also? So any a ื’ื–ืœืŸ is also we call a ื’ื ื‘? What happens if somebody denies a ืžืœื•ื”? And if someone denies if I owe someone money, someone owes me money and he denies it, does he pay ื›ืคืœ? And we catch him, he pay ื›ืคืœ? No. ื›ืคืœ is only paid by a ื’ื ื‘. He's, in our terms, in the ืœืฉื•ืŸ ื‘ื ื™ ืื“ื, we would Oh, this guy's a ื’ื ื‘! He didn't pay his loan, didn't pay his debt. But he doesn't have a ื“ื™ืŸ of a ื’ื ื‘. A ื’ื–ืœืŸ, a ื’ื–ืœืŸ is worse than a ื’ื ื‘, but still doesn't pay ื›ืคืœ. I'm saying, so ื›ืคืœ is strictly by a ื’ื ื‘. So here, the ื—ื™ื“ื•ืฉ of the ืชื•ืจื” is that ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ also pays ื›ืคืœ. But the ืฉืืœื” is what about ื“ืณ ื•ื”ืณ? Does that, and that ื“ื™ืŸ is a big ื—ื™ื“ื•ืฉ that you pay ื“ืณ ื•ื”ืณ. So, so do you or don't you? So one ืกื‘ืจื says that you don't. I mean, you do, but normally you wouldn't, we need a ืคืกื•ืง. And one ืกื‘ืจื says, no, the fact we compare the two, so we need the two sides. Okay. Let's look, in order to understand that, let's look to see ื‘ื›ืœืœ how do we describe the difference between a ื’ื ื‘ and ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘? So the ื’ืžืจื on ื“ืฃ ืกืดื“ ืขืžื•ื“ ื‘ืณ gives us a term, and says like this. The difference is by a ื’ื ื‘, by a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, ื‘ื”ื™ืชืจื ืืชื ืœื™ื“ื™ื”. And by a ื’ื ื‘, ื‘ืื™ืกื•ืจื ืืชื ืœื™ื“ื™ื”. How did it get to his hand? How did he get the object? So a ื’ื ื‘ got it ื‘ืื™ืกื•ืจ. He actually stole it. A ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ got it ื‘ื”ื™ืชืจ. Now he decided to lie. So that's the difference. This difference is not only here. This difference we had earlier in the ื’ืžืจื. Earlier on ื“ืฃ ื“ืณ ืขืžื•ื“ ื‘ืณ, we already had this. And I think in one of the ืฉื™ืขื•ืจื™ื this came up. There we have ืจื‘ื™ ื—ื™ื™ื and ืจื‘ื™ ืื•ืฉืขื™ื. ืจื‘ื™ ืื•ืฉืขื™ื says that not only are there four ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, there are 13 ืื‘ื•ืช ื ื–ื™ืงื™ืŸ. Among the 13 ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, he mentions a ืฉื•ืžืจ ื—ื™ื ื. If you're a ืฉื•ืžืจ, so sometimes, if you're lying, you have to pay. And then more comes ืจื‘ื™ ื—ื™ื™ื, says, I have more! I have 24 ืื‘ื•ืช ื ื–ื™ืงื™ืŸ. Amongst ืจื‘ื™ ื—ื™ื™ื's 24 ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, he has a ื’ื ื‘. One of them is a ื’ื ื‘. So the ื’ืžืจื asks, how come ืจื‘ื™ ืื•ืฉืขื™ื did not count all those that ืจื‘ื™ ื—ื™ื™ื counted? Why didn't ืจื‘ื™ ืื•ืฉืขื™ื? And the ื’ืžืจื gives reasons, because many of the things that ืจื‘ื™ ื—ื™ื™ื counts happen to be a ืงื ืก, and ืจื‘ื™ ืื•ืฉืขื™ื doesn't deal with ืงื ืก. Then concerning ื’ื ื‘, why doesn't ืจื‘ื™ ืื•ืฉืขื™ื mention ื’ื ื‘? The ื’ืžืจื says I'll tell you why. Because he feels it's included in what he already mentioned. Since he mentioned one of the ื ื–ื™ืงื™ืŸ, ืื‘ื•ืช ื ื–ื™ืงื™ืŸ is a ืฉื•ืžืจ, that a ืฉื•ืžืจ is a watchman who denies the object, and we catch him, he has to pay. Now one of the ways of his denial is that he's a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘. So he's a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, and he pays ื›ืคืœ like a ื’ื ื‘. So when ืจื‘ื™ ืื•ืฉืขื™ื said that one of the ืื‘ื•ืช ื ื–ื™ืงื™ืŸ is a ืฉื•ืžืจ, which includes ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘, that includes ื’ื ื‘ already. So why does he have to repeat and say that there's another one ื’ื ื‘? It's included. Then the ื’ืžืจื asks, so how come ืจื‘ื™ ื—ื™ื™ื doesn't include it? How come ืจื‘ื™ ื—ื™ื™ื considers it as separate? Because he mentions all the 13 of ืจื‘ื™ ืื•ืฉืขื™ื, which one of them is a ืฉื•ืžืจ, and then he mentions separately ื’ื ื‘. So the ื’ืžืจื says because he divides it into two. What's the difference? He counts separately when the object came to him ื‘ืื™ืกื•ืจ, and separately that the object came ื‘ื”ื™ืชืจ. So a ื’ื ื‘ is a ืžื–ื™ืง where the object came to him ื‘ืื™ืกื•ืจ, and according to ืจื‘ื™, to ืจื‘ื™ ืื•ืฉืขื™ื, and, and the ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ came ื‘ื”ื™ืชืจ. So that's why he does count as this. Now

Comparing ื ื–ื™ืงื™ืŸ Categories: Rabbi Chiyya vs Rabbi Oshiya

let's us understand, why doesn't ืจื‘ื™ ืื•ืฉืขื™ื do that? Why doesn't he count it as two just like ืจื‘ื™ ื—ื™ื™ื does for the same reason? So obviously they're arguing like this: the fact is they both agree to the ืžืฆื™ืื•ืช. There's no question. A ื’ื ื‘ got it ื‘ืื™ืกื•ืจ, and he got it ื‘ื”ื™ืชืจ, that's not a question. The ืžื—ืœื•ืงืช is whether is that enough to divide it into two categories. So the ืกื‘ืจื to say it's one category, that's ืจื‘ื™ ืื•ืฉืขื™ื. Even though this came ื‘ื”ื™ืชืจ, this came ื‘ืื™ืกื•ืจ, it's still considered one category. And ืจื‘ื™ ื—ื™ื™ื holds two categories. What's the basis of this, this difference? Whether it's considered is one category, ืžื—ืœื•ืงืช is whether it's one category or two categories. So the basis of it is this: first I'll say the basis, and then I'll explain the, where this comes from. The basis is based, you could say at least, this is a ืกื‘ืจื, that it's based on a ื—ืงื™ืจื”. It can be quite clever. When the ืชื•ืจื” said that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ื›ืคืœ like a ื’ื ื‘, what did the ืชื•ืจื” mean to say? If the ืชื•ืจื” said that ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ becomes a ื’ื ื‘, the ืชื•ืจื” says that a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is a ื’ื ื‘. We thought that a ื’ื ื‘ is only somebody goes and pickpockets. The ืชื•ืจื” says no, a ื˜ื•ืขืŸ ื˜ืขื ืช is also a ื’ื ื‘! And therefore, just like this guy pays ื›ืคืœ, you can pay ื›ืคืœ. Or you can say the ืชื•ืจื” says no, a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is not a ื’ื ื‘. But the ืชื•ืจื” says that he also pays ื›ืคืœ. Who says, we are under impression that only a ื’ื ื‘ pays ื›ืคืœ. Comes the ืชื•ืจื”, says not only a ื’ื ื‘, there is another case: he happens not to be a ื’ื ื‘, but the ืชื•ืจื” said also. A ื’ื–ืœืŸ doesn't pay ื›ืคืœ, a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ does. So the ืฉืืœื” is, is a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ one category with a ื’ื ื‘, in other words, ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ became a ื’ื ื‘, and or did the ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ remain not a ื’ื ื‘, but ืืฃ ืขืœ ืคื™ ื›ืŸ the ืชื•ืจื” is ืžื—ื™ื™ื‘? What is this based on? Why would we say these two ืกื‘ืจื•ืช? In order to understand why we would have these two ืกื‘ืจื•ืช, we have to go back to something I think, I

Concept of ืกืคืง and Its Impact on Halacha

think it happened to be the last ืฉื™ืขื•ืจ we had. I don't, I'm not sure if it was the last one, where we discussed the concept of ืกืคืง. And I said that there is a ื’ื“ืจ, discussion concerning ืกืคืง ืฉืžื™ืจื”. And we started it with like this, that there are certain things that if it's a ืกืคืง whether it is that, then not the ืคืฉื˜ that you have a ืกืคืง of the not that you have this, you have a ืกืคืง this. It's nothing. There are certain things which their whole ืžืฆื™ืื•ืช is only if it's ื•ื“ืื™, if it's for sure. If it's a ืกืคืง, then it's ื•ื“ืื™ nothing. And I remember the example I gave which now fits more in this time of the year, ืกืคื™ืจื”. Is there such a thing as counting ืกืคื™ืจื” with a ืกืคืง? The ืžืฉืœ if someone doesn't know which night is tonight, it's the night the tenth or eleventh. So what's the problem? Make a ื‘ืจื›ื” and count both! So ืžืžื” ื ืคืฉืš one of them is right. So the ื“ื‘ืจ ืื‘ืจื”ื says there is no such thing, because the whole concept of counting is an opposite of a ืกืคืง. Counting means I'm counting in order to know what I have. Imagine if I count and count and count and at the end I still don't know what I have. I didn't count. I mean, I used I attempted to count it, but I didn't do any ืžืฆื™ืื•ืช of counting. Now, someone might ask, but sometimes, let's say, you don't know exactly, but you know it ื‘ืขืจืš. You counted and you didn't It's or 99 or 100. So that I so I explained, it's ืžืžื” ื ืคืฉืš. If you're interested in knowing ื‘ืขืจืš, then it's ื•ื“ืื™, then it's not a ืกืคืง. You know for sure what ื‘ืขืจืš it is. If you're interested in knowing exactly, so then you don't know. So you don't know, so there's no such thing as counting with ืกืคืง. So what does this mean? That the there is such a thing that if it's a ืกืคืง of it, then it's automatically nothing, because there are certain things which the whole ืžืฆื™ืื•ืช of that concept is ื‘ื™ืจื•ืจ, is ื•ื“ืื™. To have a ืกืคืง of that, then you don't have the ื‘ื™ืจื•ืจ. It's like saying there is a concept that maybe we have a ืกืคืง ื•ื“ืื™. ื•ื“ืื™ is not ืกืคืง, and ืกืคืง is not ื•ื“ืื™. You can have a ืกืคืง ื‘ืจื›ื”, but you can't have a ืกืคืง ื•ื“ืื™. So those things which their whole ืžืฆื™ืื•ืช is ื•ื“ืื™, is ื‘ื™ืจื•ืจ, you can't have a ืกืคืง ื‘ื™ืจื•ืจ. So ื›ื“ืจืš, like to give an example, the other example I gave that time, was from the ื’ื˜, the case of the ืฉื˜ืจ ืฉื—ืจื•ืจ by an ืขื‘ื“, if someone writes a ืฉื˜ืจ to an ืขื‘ื“, he is ืžืฉื—ืจืจ, he is free, but what he wrote was, \"All my possessions are given over to you.\" He is part of his possessions, so he gives him himself over. So the guy In a case like that, the guy becomes free and gets everything that the master owns. What happens, the ื’ืžืจื says, if he wrote, \"All my possessions belong to you are given over, except his house?\" And the ื’ืžืจื says, not only doesn't he get the house, he doesn't get anything. He doesn't He doesn't even become free. And the ื’ืžืจื says why? No, but tell him you could give somebody because we're afraid that maybe when he left out something, that house, maybe he meant to leave something else out also, and that something else could be him, so we don't know. And the question is, so we don't know, maybe. Maybe not. But the ื’ืžืจื feels that the the ื’ืžืจื feels that sometimes a person would want to make him feel good, not write clearly, so this is how people would write. So there is a ืกืคืง in that. But we're not sure. Maybe he meant what he wrote. Maybe he meant he's giving him his freedom, giving him everything except his house. So why is So the ื’ืžืจื should have said that this guy, we're not so sure he is free because we don't know what the guy meant, so he should be a ืกืคืง ืžืฉื•ื—ืจืจ. He should be free ืกืคืง, maybe a ืกืคืง ืขื‘ื“, ืกืคืง ื‘ืŸ ื—ื•ืจื™ืŸ. But the ื’ืžืจื says no. He is definitely not free at all. And the ื’ืžืจื gives the reason, because ืœืื• ื›ืจื™ืชื•ืช ื’ื™ื˜ื” ื”ื•ื. It's not cutting off, which means the ืขื ื™ืŸ of a ื’ื˜ or a ืฉื˜ืจ ืฉื—ืจื•ืจ, which is the same concept, is to cut off between the two. If when you cut it off there still remains a connection, it's not. Remember, I used the example of the ื’ืžืจื where it says if The ื’ืžืจื gives the example if you give a ื’ื˜ with strings attached and you're holding on to the string, it's not a ื’ื˜. Why? Because there's some attachment. Same thing here. If you give a ื’ื˜ and there is a ืกืคืง if the if the ื’ื˜ cuts off, so not the ืคืฉื˜ she is a ืกืคืง ืžื’ื•ืจืฉืช. So there is no ื’ื˜ whatsoever because there is still a connection between the two, the fact that there is a ืกืคืง. So there is nothing. So ืœืื• ื›ืจื™ืชื•ืช. So here again we see that a ื’ื“ืจ of a ื’ื˜, ื›ืจื™ืชื•ืช, is ื•ื“ืื™. The moment it's ืกืคืง, it's not ื›ืจื™ืชื•ืช at all. So ื›ื“ืจืš like any ืฉื˜ืจ. What's the whole concept of writing a ืฉื˜ืจ? Writing a ืฉื˜ืจ is so we should verify something. Imagine you write a ืฉื˜ืจ and and after you read the ืฉื˜ืจ it's still not clear if he owes him the money or not. So you say, \"Well, it's a such a ืฉื˜ื™ืงืœ ืฉื˜ืจ.\" It's not a ืฉื˜ืจ at all! The whole concept of a ืฉื˜ืจ is to know for sure. And if you write a ืฉื˜ืจ and you don't know for sure, it's nothing. It's a ืกืคืง ืฉื˜ืจ. And there are other examples, I think I gave last time, in the ื‘ื™ืช ื”ืžืงื“ืฉ. So we came to that at that time, we came to ืกืคืง ืฉืžื™ืจื”. If you have something and it's a ืกืคืง if the guy will watch it or not, or if it's called a ืฉืžื™ืจื”, so is it Okay, that's not a good ืฉืžื™ืจื”, because you're not sure, but is it any ืฉืžื™ืจื”? So on one hand, you could say ืกืคืง ืฉืžื™ืจื” is nothing, because the whole idea of ืฉืžื™ืจื”, of watching, is a general concept of being sure. If I give you something to watch, which means I want to be guaranteed, at least as much as possible in human behavior. That time we were talking about an ืื›ืกื ืื™, that an ืื›ืกื ืื™ was a ืกืคืง ืฉืžื™ืจื”. But I'm just here bringing out the general idea. So if you give a guy something to watch and it's a ืกืคืง if he'll watch it, so on one hand, if you look, watching, giving to watch means that I feel comfortable, guaranteed that I'm it's

Understanding ืกืคืง and the concept of ืฉืžื™ืจื”

it's it's safe. So there's no such thing, if it's a ืกืคืง, I'm not guaranteed, so it's not a so not watch. On the other hand, you could say no, that who says that it's at least it's better than nothing. So it's a little bit of ืฉืžื™ืจื”. There is a concept of a ืžืงืฆืช ืฉืžื™ืจื”. There is a concept what we find in in ื’ืžืจื of ืฉืžื™ืจื” ืžืขื•ืœื”, ืฉืžื™ืจื” ืคื—ื•ืชื”. There's a better ืฉืžื™ืจื”, a weaker ืฉืžื™ืจื”. So this a weak ืฉืžื™ืจื”, but it's also ืฉืžื™ืจื”. So it depends on what? Whether ืฉืžื™ืจื”, the concept of ืฉืžื™ืจื” means one general concept of that guarantee, which some of ืฉืžื™ืจื” doesn't have that, so it's nothing, or you look at it, no, specifically, that little bit that I feel better is is good enough, and it's something. And we made said then ืžื—ืœื•ืงืช ืจืฉืดื™ and ืชื•ืกืคื•ืช, ืžื—ืœื•ืงืช ืจื‘ื™ ื™ื•ื—ื ืŸ ื•ืจื™ืฉ ืœืงื™ืฉ. So I want to go from that to another step. ื–ืžืŸ ืฉืžื™ืจื”. ื–ืžืŸ ืฉืžื™ืจื”. If I give somebody to watch something for 30 days, so do we look at all of it as one idea of the whole time as one, or every time is separate? It means like this: if the whole concept of ืฉืžื™ืจื” is a one general look, so when I'm leaving the house, and I'm leaving you in charge for 30 days, I want to feel comfortable that I'm, this house is safe. If the person will watch it only for 10 days, and the other 10 days he won't watch it, so the 10 days don't count either, because if ืฉืžื™ืจื” is looked upon as one general ื ืงื•ื“ื” of guarantee, I don't have that, because there are certain days he doesn't watch. On the other hand, you could say no, that ืฉืžื™ืจื” is the day that's watched is fine, the day that's not watched is bad, but you can't say that the days that are watched are no good. In other words, I would use these words using the ืจืื’ืื˜ืฉืื•ื•ืขืจ style, is the time of ืฉืžื™ืจื” one ื ืงื•ื“ื” for the whole ื–ืžืŸ, or is every moment of the ืฉืžื™ืจื” a ื ืงื•ื“ื” for itself? This is watched, this is a ื ืงื•ื“ื” for itself. See, the ืจืื’ืื˜ืฉืื•ื•ืขืจ has a ื—ืงื™ืจื” like this by ื–ืžืŸ ื‘ื›ืœืœ, which is not what we're talking about. In general, he says, anytime you borrow something for a time or you listen for a time, is ื–ืžืŸ one ื ืงื•ื“ื”, or every moment is, and he makes a very interesting difference. It depends what you're interested in. If you're interested in the ื”ืžืฉืš ื”ื–ืžืŸ, in the in the ืฉื˜ื— ื”ื–ืžืŸ, in the space of time, then everyone is a ื ืงื•ื“ื”. If you're interested in the end, then it's all one ื ืงื•ื“ื”. For instance, at certain times, if I want to go to your house, and to get to your house I have to go three blocks, it's all one ื ืงื•ื“ื”. I'm not interested in these steps. As a matter of fact, if you lived closer, I'd be happier. But if the doctor tells somebody, you know, every day you have to walk three blocks, so every step is part of the three blocks, so every step is a separate ื ืงื•ื“ื”. But if you're interested in the end, okay, I then it's all only a ื”ื›ืฉืจ, only that. But that's ื ื•ื’ืข to ื–ืžืŸ. We're not talking about ื–ืžืŸ here, we're talking about ืฉืžื™ืจื”, the ื–ืžืŸ of ืฉืžื™ืจื”, because we're looking at if we say like I said before that ืฉืžื™ืจื” is one general idea, so there's one ื ืงื•ื“ื” of ืฉืžื™ืจื”. If we say that ืฉืžื™ืจื” is not a general concept of I am guaranteed this will be, but we're looking at it individually, so every moment of the ืฉืžื™ืจื” now it's watched is fine, if it's not watched later, it's not fine. It seems that we could say that this is a ืžื—ืœื•ืงืช in the ืจืืฉื•ื ื™ื, earlier on. There's a

Gemara case of five guardians and liability

ื“ื™ืŸ in ื’ืžืจื here ื“ืฃ ื™ืดื˜, ืžืกืจ ืฉื•ืจื• ืœื—ืžืฉื” ื‘ื ื™ ืื“ื, a person gives over his ox to five people to watch, ื•ืคืฉืข ื‘ื• ืื—ื“ ืžื”ืŸ, and one of them did not watch it, ื•ื”ื–ื™ืง, and the ืฉื•ืจ went out and was ืžื–ื™ืง, ื—ื™ื™ื‘. This one guy is ื—ื™ื™ื‘. And the ื’ืžืจื explains: ื”ื™ื›ื™ ื“ืžื™, what is the case? ืื™ืœื™ืžื ื“ื‘ืœืื• ืื™ื”ื• ืœื ื”ื•ื™ ืžื™ืชืจ, if it's a case that because he dropped out, he gave it over to five because you need five people to watch it, and when he went away, it cannot be watched, ืคืฉื™ื˜ื, ื“ืงื ืขื‘ื™ื“! Certainly, he's a it's his he did it! ืืœื, what is the ื—ื™ื“ื•ืฉ that we're saying that the guy is ื—ื™ื™ื‘? ื“ื‘ืœืื• ืื™ื”ื• ื ืžื™ ืžื™ืชืจ. That ื‘ืืžืช if he drops out, it could be watched by the other four. Then the ื’ืžืจื asks: ืžืื™ ืงื ืขื‘ื™ื“? So what did he do? Why is he ื—ื™ื™ื‘? Now, these words ืžืื™ ืงื ืขื‘ื™ื“, what did he do, why is he ื—ื™ื™ื‘, is a ืžื—ืœื•ืงืช ืจืฉืดื™ and ืชื•ืกืคื•ืช. ืจืฉืดื™ learns ืžืื™ ืงื ืขื‘ื™ื“ means ื•ืื™ื ื• ื—ื™ื™ื‘ ื›ืœื•ื. This guy who was given to watch and dropped out, but that could be watched without him, should not be ื—ื™ื™ื‘ at all, because when he dropped out, it still could be watched! ืชื•ืกืคื•ืช says when it says ืžืื™ ืงื ืขื‘ื™ื“, it means ืžืื™ ืงื ืขื‘ื™ื“ ื˜ืคื™ ืžืื—ืจื™ื ื™? Why is he responsible more than the others? Should all be ื—ื™ื™ื‘, but he also, in other words, he should be part of it, he should also be ื—ื™ื™ื‘. So there's a ืžื—ืœื•ืงืช ืจืฉืดื™ and ืชื•ืกืคื•ืช here. No, ืจืฉืดื™ says he is not. The guy who dropped out? Yeah. No, but it's according to ืชื•ืกืคื•ืช, all five of them, all five of them were needed? No, no, no, no. So according to ืชื•ืกืคื•ืช, they Not according, the ื’ืžืจื mentions, what is the case, ื“ื™ืŸ in the case where all five are not needed? If they're all needed, for sure he dropped out, he's ื—ื™ื™ื‘ completely. But if they could be it's watched without him, so ืจืฉ''ื™ so the ื’ืžืจื said that he shouldn't be ื—ื™ื™ื‘. So ืจืฉ''ื™ says it means he shouldn't be ื—ื™ื™ื‘ at all. ืชื•ืกืคื•ืช says that he still should be ื—ื™ื™ื‘ like everybody else. Liable part. He liable part, that's what ืชื•ืกืคื•ืช says, a liable partner. And ืจืฉ''ื™ says no, this guy should be ืคื˜ื•ืจ completely. This is the ืžื—ืœื•ืงืช. So we have a ืžื—ืœื•ืงืช ืจืฉ''ื™ and ืชื•ืกืคื•ืช. The

Rambam vs Tur on collective responsibility in ืฉืžื™ืจื”

ืจืžื‘''ื rules like ืชื•ืกืคื•ืช. The ืจืžื‘''ื says in a case like this, ื›ื•ืœื, they're all responsible, ืืฃ he's responsible together with them, they're all responsible. The ืจื''ืฉ and automatically the ื˜ื•ืจ, because the ื˜ื•ืจ follows usually the ืจื''ืฉ because it was his father, so the says like ืจืฉ''ื™, that he's ืคื˜ื•ืจ completely. And let's see what the ืจื''ืฉ says. The ืจื''ืฉ explains why he feels his ืฉื™ื˜ื” is. He's ืคื˜ื•ืจ and the other ones are ื—ื™ื™ื‘? They were Yeah, they didn't watch it properly, they could have watched and they didn't. But he says like this: ื•ืœืื• ืื™ื”ื• ื ืžื™ ืžื ื˜ืจ, without him it could be watched too, ืžืื™ ืงื ืขื‘ื™ื“, so what did he do? ื›ืœื•ืžืจ, ื•ืคื˜ื•ืจ ืœื’ืžืจื™. And explains, ื›ื’ื•ืŸ ืฉื”ืื—ืจื™ื ืœื ืกื™ืœืงื• ืขืฆืžื ืžืฉืžื™ืจืช ื”ืฉื”, the other ones didn't drop, didn't push take themselves away from watching it, ื›ืฉืคืจืฉ ื”ื”ื•ื ืื—ื“, when this guy didn't, ื•ืœื ืจืื• ืœืคืจื•ืฉ, and didn't want, they said we're ready to continue. ื•ื›ื™ื•ืŸ ืฉื ืฉืืจื• ื‘ืฉืžื™ืจืช ื”ืฉื”, since they continued watching the ืฉื”, ื•ื™ื›ื•ืœื™ืŸ ืœืฉืžืจื• ื‘ืœื ื”ื”ื•ื ืื—ื“, and they could watch it without this one guy, ื”ืŸ ื—ื™ื™ื‘ื™ืŸ ื•ื”ื•ื ืคื˜ื•ืจ, so they're ื—ื™ื™ื‘ and he's ืคื˜ื•ืจ. Why is he ืคื˜ื•ืจ? ืฉื”ืจื™ ืžืกืจ ืœื›ื•ืœื ื”ืฉื”, cause he gave over to all, the guy who gave over, the owner, who gave it to watch, gave it to all of them, ืœื›ืœ ืžื™ ืฉื™ื›ื•ืœ ืœืฉืžืจื•, anybody who wants, ื•ื ืชืจืฆื• ืœืฉืžืจื• ืืคื™ืœื• ื‘ืœืขื“ื™ื•, and they agreed to watch it without him. ืื‘ืœ ืื ืืžืจื•, had they said to him, no, if you leave we leave too, he had no right to leave. But the case here is where they agreed we'll watch. Now if the case is they agreed to watch, so the ืฉืืœื” is now on ืชื•ืกืคื•ืช. Why would why would ืชื•ืกืคื•ืช say he's ื—ื™ื™ื‘? Why would ืชื•ืกืคื•ืช Huh? Okay. No, ืฉื•ืžืจ, if you take upon yourself to watch you'll watch. So the ืฉืืœื” is now that the ืจื''ืฉ is ืžืกื‘ื™ืจ why that the ื˜ื•ืจ says the same thing, why he's ืคื˜ื•ืจ ืœื’ืžืจื™, because what's the problem? They could watch it, they agreed to watch it. Why does ืชื•ืกืคื•ืช say you're ื—ื™ื™ื‘? So some ืื—ืจื•ื ื™ื explain that ืชื•ืกืคื•ืช says you're ื—ื™ื™ื‘, why? Because he had no right to drop out. Since he was ืžืงื‘ืœ upon himself to watch it, you can't drop out, you have responsibility to to continue because you were ืžืงื‘ืœ upon yourself. So the ืฉืืœื” is now, okay, makes a lot of sense. You were ืžืงื‘ืœ, so you you promised you're going to watch it, you why how could you drop out? So what's the ืกื‘ืจื of the ืจื''ืฉ? The ืจื''ืฉ says well, because they are able to watch it. But why doesn't he say, well, but you accepted it? It seems like according to ืจืฉ''ื™ and ืชื•ืกืคื•ืช it matters who you're answering to. If you're answering to the guy who gave it to them, if I give it to five people and they make up between each other who you know, one, four of them say to the other one you can go, we don't care, we'll still watch it. I don't care what you guys made up, to me you're still liable, all five. On the other hand, if it matters what the four people made up, and as long as the owner gets paid, How how could they made up on his ื—ืฉื‘ื•ืŸ? That's that's what ืชื•ืกืคื•ืช that's what ืชื•ืกืคื•ืช would say. How can you make up on my ื—ืฉื‘ื•ืŸ? I gave it to all five, one drops out and you come to me. Right, exactly. Right, and what does the ืจื''ืฉ say? So that's a The ืจื''ืฉ says listen, owner, you're going to get paid. It's just a matter of which what which people have to pay. No, but the but he could ื˜ืขื ื” these guys ื˜ืขื ื”, \"We only want to pay a fourth. You took us back a quarter, we don't want to pay the whole thing.\" So, it's according to the ืจื''ืฉ, you go to these four and you say, \"Listen, you Why, why? because you wanted to let the guy off.\" Yeah, but this guy was part of it! This guy took responsibility like they did! Then they can say they can say, \"We would have never taken the job had we known No, no, when he dropped out they agreed! agreed? Oh, they agreed. But still to the owner, they could say to the owner, \"We agreed that's us, but we are only four and we could have watched it and didn't watch it.\" So that's but we have but we have the two sides here. The ืฉืืœื” is, what are the two sides? So, ืœื›ืื•ืจื”, what it comes out is the two sides are like this: what I want to I want to say is I want to divide this into two parts. We have the ืฉืžื™ืจื”, the actual watching it, and then we have the ืงื‘ืœืช ื”ืฉืžื™ืจื”, the accepting to watch. These are two ืขื ื™ื ื™ื. The ืฉืžื™ืจื” has no problem here, it's being watched with the other four. The problem is the ืงื‘ืœืช ื”ืฉืžื™ืจื”, he accepted, now how could you drop out? So, I want to say that whether his dropping out of the ืงื‘ืœืช ื”ืฉืžื™ืจื” is a problem or not will depend on this ื—ืงื™ืจื” that we said before. What did we say before? That there's a ืฉืืœื” whether all the ื ืงื•ื“ื•ืช of the whole time is one ื ืงื•ื“ื”, or each moment is another ื ืงื•ื“ื”. And the difference would be, when he accepted upon it to watch, if it's all one ื ืงื•ื“ื”, by him dropping dropping out after 10 days that he accepted 30 days, \"I'll watch it for you,\" after 10 days he went dropped out, so not only did he not keep the ืฉืžื™ืจื”, as far as he's concerned, he didn't keep the ืงื‘ืœื”, because there's one ืงื‘ืœื” for all. So, he broke the ืงื‘ืœื”. That's a problem. If you hold that it's every second another thing, so what's the ืคืฉื˜? He, the first ืจื’ืข he was accepted, he kept it, the next ืจื’ืข kept it for 10 days, and now what he did, now he didn't continue watching it. But there is really basically nothing wrong that he did. The ืงื‘ืœื” that he accepted, he kept. The ืฉืžื™ืจื” of the object is being done, so what's his problem? I'll put it in other words: there's a ื—ืงื™ืจื” that we could ask, and it will be connected to this: is the ืงื‘ืœืช ื”ืฉืžื™ืจื”, the fact that he accepts the watching, is it a ืคืขื•ืœื” ื ืžืฉื›ืช or not? I'll explain it. Is the ืคืฉื˜ that you accept once to watch, and that once, that's it? Now you are responsible to be the watchman. Or do we say it's as if every second you Because I accepted for 30 days, every second it's renewed again. I have to watch it. Now, as if I accepted it again, as if I accept that. Similar to what we spoke about ืฉืœื™ื—ื•ืช. When a person is appointed to be a ืฉืœื™ื—, so we have a ื—ืงื™ืจื” there: is the ืคืฉื˜ that you appoint him once, now he is the ืฉืœื™ื—, now he goes and does what the guy wants? The guy made him a ืฉืœื™ื— to be ืžืงื“ืฉ ืืช ื”ืื™ืฉื”, now he can go and ืžืงื“ืฉ the woman, or we say no, every second it's as if he renewed the ืฉืœื™ื—ื•ืช again? And it's not ืกืชื a ื—ืงื™ืจื”, but it's ื ื•ื’ืข to a ืžื—ืœื•ืงืช, as I explained once the ืžื—ืœื•ืงืช between the ืจืžื‘\"ื and the ื˜ื•ืจ: if someone makes a ืฉืœื™ื— to give a ื’ื˜, and then the ืžืฉืœื—, the man that gave that made the ืฉืœื™ื—, became a ืฉื•ื˜ื”, cracked up, he's not normal anymore, can the ืฉืœื™ื— go to give a ื’ื˜? So, the ืจืžื‘\"ื says that ืžื“ืื•ืจื™ื™ืชื you could. The ืจื‘ื ืŸ said you can't, but ืžื“ืื•ืจื™ื™ืชื you could. And the ื˜ื•ืจ says, \"No, ืžื“ืื•ืจื™ื™ืชื you can't.\" So, some of the ืื—ืจื•ื ื™ื explain it like this: it depends if you hold ืžื™ื ื•ื™ ื”ืฉืœื™ื—ื•ืช, making a ืฉืœื™ื—, is a ืคืขื•ืœื” ื ืžืฉื›ืช or not. If it's a one-time thing, then when he made him into a ืฉืœื™ื—, he was normal. Now he is a ืฉืœื™ื—, now he's not normal, and therefore he could go ahead and give the ื’ื˜. The ืื™, what happens if the if the ืžืฉืœื— would have died? Then he still can't give he can't give the ื’ื˜, but a different reason: because you have no husband for whom to divorce her. Not yeah, not because the ืฉืœื™ื—ื•ืช is no good. There's no husband. But as long as there is husband is alive, ื, he's a ืฉื•ื˜ื”, so now he couldn't give the ื’ื˜, or he couldn't make a ืฉืœื™ื—, but when he made it, it was good, so he can give it. If you hold it's a ืคืขื•ืœื” ื ืžืฉื›ืช, what's the ืคืฉื˜? That every second, so the reason that he's able to give the ื’ื˜ later, because a minute ago he made me into a ืฉืœื™ื—. Why? Because a minute ago before that. But if a minute ago he can't make you into a ืฉืœื™ื—, because he's a ืฉื•ื˜ื” now, so I can't be a ืฉืœื™ื—, so you can't give the ื’ื˜. So ืžื“ืื•ืจื™ื™ืชื there's no ืฉืœื™ื—ื•ืช. So we see a ืžื—ืœื•ืงืช between these two whether ื‘ืฉืขืชื• we have a ืคืขื•ืœื” ื ืžืฉื›ืช or not. These two cases, whether it's The same thing you could say, just like we're talking about ืžื™ื ื•ื™ ื”ืฉืœื™ื—ื•ืช as appointing a ืฉืœื™ื—, the same thing would be by ืงื‘ืœืช ื”ืฉืžื™ืจื”. If I accept to watch, it's not my thing, I'm not responsible for it, I took responsibility. Is the ืคืฉื˜, I once took response- ืงื‘ืœื” and that's it? Or, every second I renew it as if it's renewed? Now, what would be the difference? If it's every If it's one ืงื‘ืœื”, if I later stop watching it in middle of the time, what am I doing? I am destroying that ืงื‘ืœื”. I'm not keeping that, because there is only one ืงื‘ืœื”. I'm not I'm destroying the ืงื‘ืœื”. If every ืจื’ืข is a second ืงื‘ืœื” is, so I watched it for 10 days, I was ืžืงื‘ืœ and I watched it, and then the ืงื‘ืœื” renewed itself and I watched it. What's now is, I'm not continuing, that's all it is. I'm not continuing the ืงื‘ืœื”, but I'm not breaking the ืงื‘ืœื” that I did. So it comes out as, I'm not continuing the ืงื‘ืœื”, but the ืงื‘ืœื” that I did before was good. As far as the object is concerned, it's being watched, because if the other four can't watch it, then there's another problem: I'm responsible for it to make sure it's watched. But this case, where the other four could, is being watched, so what's the problem? Because since it's a ืคืขื•ืœื” ื ืžืฉื›ืช, I'm not destroying what happened in the beginning, I'm just not continuing. ืขืœ ื“ืจืš, I'll give you an example of a ืฉื™ื—ื” from this week's ืคืจืฉื”, from ืคืจืฉืช ืงื“ื•ืฉื™ื, that the ืจื‘ื™ explains, brings the ืจื•ื’ื˜ืฉื•ื‘ืจ. The ืจื•ื’ื˜ืฉื•ื‘ืจ speaks about ื’ื ื‘ื” and ื’ื–ืœื”. And the ืจื•ื’ื˜ืฉื•ื‘ืจ says like this, that when a person steals, it's a ืคืขื•ืœื” ื ืžืฉื›ืช. A person steals, it's not that you stole it once and you did one ืขื‘ื™ืจื”. Every second you are stealing again, as if you're stealing again, you're stealing again, you're stealing again. It is. It's a ืคืขื•ืœื” ื ืžืฉื›ืช. ื ืžืฉื›ืช means it is It's an ongoing thing. It is a ืคืขื•ืœื” ื ืžืฉื›ืช. And the ืจื•ื’ื˜ืฉื•ื‘ืจ says, based on this, he explains the ืจืžื‘\"ื. The ืจืžื‘\"ื says that if a person steals, you don't get ืžืœืงื•ืช. Why don't you get ืžืœืงื•ืช? So the ืจืžื‘\"ื says, because this is a ืœืื• ื”ื ื™ืชืŸ ืœืชืฉืœื•ืžื™ื. It's a ืœืื• that you can pay for. And the rule is, a ืœืื• that you can pay for, you don't get ืžืœืงื•ืช. Fragged the ืจื•ื’ื˜ืฉื•ื‘ืจ, the ืจืžื‘\"ื should have said it's a ืœืื• ื”ื ื™ืชืง ืœืขืฉื”. There's a ื“ื™ืŸ that any ืœืื• that has it's a negative commandment, that has a positive commandment that fixes the ืœืื•, then you don't get ืžืœืงื•ืช for it. ืœืžืฉืœ, it says by ืฉื™ืœื•ื— ื”ืงืŸ, it says don't take the mother together with the ื‘ื ื™ื. If you did take it, ืฉืœื— ืชืฉืœื—, it says send it away. So by sending it away, you will fix the ืœืื•. So the ืจืžื‘ืดื should have said that by ื’ื ื‘ื” ื•ื’ื–ื™ืœื” there's a ืœืื•, ืœื ืชื’ื ื•ื‘, ืœื ืชื’ื–ื•ืœ, and then there's a ืขืฉื”, ื•ื”ืฉื™ื‘ ืืช ื”ื’ื–ื™ืœื”. So it should be a... So he says, why doesn't the ืจืžื‘ืดื say it's a ืœืื• ื”ื ื™ืชืง ืœืขืฉื”? He said because it's not. When is a ืœืื• ื”ื ื™ืชืง ืœืขืฉื” fixes up, if it's a one-time thing, you did an ืขื‘ื™ืจื”, then the ืชื•ืจื” says do the ืขืฉื”. What do you think the ืชื•ืจื” meant? By doing the ืขืฉื”, you will fix what you did. But if it's a ืœืื• that continues, when you do the ืขืฉื”, you know what you do? You just stop it from continuing. That's all, but you don't fix what happened before. So he says since ื’ื ื‘ื” is a ืคืขื•ืœื” ื ืžืฉื›ืช, so it's not a ืœืื• ื”ื ื™ืชืง ืœืขืฉื”, it doesn't fix before. I'm using the same logic here. If you, if ืงื‘ืœืช ื”ืฉืžื™ืจื” is a ืคืขื•ืœื” ื ืžืฉื›ืช, then when you stop watching it, you're not destroying all the ืงื‘ืœื” that you had before. What you are stopping is the continuation. But who cares? It's being watched by the other guys. So according to this ืกื‘ืจื, there's nothing that you did. You kept your ืงื‘ืœื”, and the ืฉืžื™ืจื” is done. If you hold it's not a ืคืขื•ืœื” ื ืžืฉื›ืช, it's only one because there's one big ื’ื“ืจ of ืฉืžื™ืจื”, and it's all one big thing. So all the time, the thirty days that you watch is all one thing. And if I stop in the middle, I'm breaking that big balloon, I'm breaking that big ืงื‘ืœื”. So I destroying what I did before, that I can't do. And if I do it, even though it's being watched, but I am destroying my ืงื‘ืœื”, I have to pay. And that's a ืžื—ืœื•ืงืช ืจืฉืดื™ and ืชื•ืกืคื•ืช, and the ืจืžื‘ืดื, and and the ืจืžื‘ืดื against ื”ืจืืดืฉ and the ื˜ื•ืจ. So what comes out to be the bottom line of all this? The bottom line is that we

Continuous vs single point view of ืงื‘ืœืช ื”ืฉืžื™ืจื”

have two ways of looking at ืฉืžื™ืจื”, which is ื ื•ื’ืข to several, like ืฉืžื™ืจื”, ื ื•ื’ืข to ื–ืžืŸ, but the ื ืงื•ื“ื” is, do we look at it's all one ื ืงื•ื“ื” the whole time, or is it ื ืงื•ื“ื•ืช ื ืงื•ื“ื•ืช, and by not watching it, I don't break it? Based on this, let's go back to ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘. When a person, we said that there is a ืกื‘ืจื to say that the ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is a ื’ื ื‘. We said two ืกื‘ืจื•ืช. One ืกื‘ืจื is he's not a ื’ื ื‘, but he's ื—ื™ื™ื‘ ื›ืคืœ. Other ืกื‘ืจื is no, maybe he is a ื’ื ื‘. The question is, what can, how can you say he's a ื’ื ื‘? I mean, he's a thief, but he's not a ื’ื ื‘ in ื”ืœื›ื”. He's a bad guy. He's taking someone's money. But to be a ื’ื ื‘, you have to do the ืคืขื•ืœื” of ื’ื ื‘ื”. You have to steal. You have to go, take something away. You have to steal. This guy didn't steal. So why would I even think that maybe he's a ื’ื ื‘? I'll tell you why. If you hold that ืฉืžื™ืจื” is one big big thing, when you stop ืฉืžื™ืจื” in the middle, you are breaking the ืงื‘ืœื”. So when this guy took the object from the, from the guy to watch, and the watching is one big thing, and today he decided to deny it, what he did was, the time, the taking that he did then was ื’ื ื‘ื”. So he did a ืคืขื•ืœื” of ื’ื ื‘ื”. If you hold that it's, ืœืžืคืจืข? Now ืœืžืคืจืข it was ื’ื ื‘ื”. If you did not, if we say ืฉืžื™ืจื” is ื ืงื•ื“ื•ืช ื ืงื•ื“ื•ืช, so till now what he took it for watching, he watched it, and it's fine. ืืœื ืžืื™, he should continue watching it. Today is stopping, but today is not taking it. But if you're saying that by doing today is breaking what he took before, so it comes out that what he took before, ื’ืœื•ื™ื™ ืžื™ืœืชื ืœืžืคืจืข, ืœืžืคืจืข that he took it, so he is a ื’ื ื‘. Huh? It kind of holds like that, right. And so ืœืคื™ ื–ื” what comes out, that this guy did a ืคืขื•ืœื” of ื’ื ื‘ื”. So when we look at ืืชื ืœื™ื“ื• ื‘ื”ื™ืชืจ, that ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ he got it ื‘ื”ื™ืชืจ, when he took it, it was ื‘ื”ื™ืชืจ, but retroact- active, looking at later, what he took it then was ื‘ืื™ืกื•ืจ. And that's the difference. If you hold that its whole ื–ืžืŸ is one big thing, so then he is a real ื’ื ื‘, and he took it ื‘ืื™ืกื•ืจ. If you say it's not, then he took it ื‘ื”ื™ืชืจ. Huh? No, yeah. You could say no, no, you could... he might not be talking about ืฉืžื™ืจื”, talking about the ืงื‘ืœื”. Yeah, sure. Could be, there's not one. Not if you say one thing ืคืขื•ืœื” ื ืžืฉื›ืช, everything has to be... Yeah, ื’ื ื‘ื” the ืจืณ ืืœื—ื ืŸ says it is. Yes, yeah. ืื‘ืœ ืฉืžื™ืจื”, ืงื‘ืœืช ืฉืžื™ืจื” is ืœืื• ื“ื•ื•ืงื. Yeah, yeah, I'm saying it doesn't mean that if you hold by one, you have to hold by the other. Each, each case could be dealt, you could hold here yes and here not. But what I'm coming out, comes out like this. We said before that what's the ืžื—ืœื•ืงืช the ืคืจืดื— and ื”ื‘ืดืฉ? Whether we consider ื’ื ื‘ and ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ as

Two categories for a thief claimant

two categories or not. And what was the reason? Why should it be two categories? One is ื‘ื”ื™ืชืจ, one is ื‘ืื™ืกื•ืจ. That's what the ืคืจืดื— held. The ื‘ืดืฉ we said no, he doesn't make a difference. But we asked why. Now we know why, because he said it's not called taking ื‘ื”ื™ืชืจ, because they're both taken ื‘ืื™ืกื•ืจ, because a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is a ื’ื ื‘. So it comes out that what we have here is two ืฉื™ื˜ื•ืช. We have two ืฉื™ื˜ื•ืช whether a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is a ื’ื ื‘, or ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is not a ื’ื ื‘. But what comes out of result? If a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ is a ื’ื ื‘, for sure he pays ืืจื‘ืขื” ื•ื—ืžืฉื”, like every ื’ื ื‘. A ื’ื ื‘ pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. If he's not a ื’ื ื‘, then he the ืชื•ืจื” tells you he pays ื›ืคืœ, fine. How do you know he pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื”? I don't know, he's not in the ืคืกื•ืง. But other, but but maybe he doesn't even pay, because there's no ื“ื™ืŸ, but the other one we have to pay. We need a ืคืกื•ืง. Why do we need a ืคืกื•ืง? Because any, after all, it's a ื’ื ื‘, but it's retroactive. So there are conditions, there are extra little cases to make it, but the general ื ืงื•ื“ื” is that he's a ื’ื ื‘. So when we started off by saying that in the ืžืฉื ื”, in the ื’ืžืจื it comes out that there are two, two ืกื‘ืจื•ืช, whether a ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ pays ืืจื‘ืขื” ื•ื—ืžื™ืฉื” or not, this is the two sides. The two sides are, if he's a real ื’ื ื‘, you automatically pay ืืจื‘ืขื” ื•ื—ืžื™ืฉื”. If he's only a, he's not a real ื’ื ื‘, why? Because he did not steal, the ืชื•ืจื” is ืžื—ื“ืฉ that by ื˜ื•ืขืŸ ื˜ืขื ืช ื’ื ื‘ you pay ื›ืคืœ, but what's the ืจืื™ื” for ืืจื‘ืขื” ื•ื—ืžื™ืฉื”? So we talked it out. Then even if you hold that yes, you can also say, is it a ืฉื›ืœ'ื“ื™ืงืข ื–ืืš or not? So we said there are two ืกื‘ืจื•ืช in the ื’ืžืจื. One ืกื‘ืจื” is that we need an extra ืคืกื•ืง for it, and one ืกื‘ืจื” is that of a ืฉื›ืœ, we learn to compare it to a ื’ื ื‘. The one that holds that he becomes the real ื’ื ื‘, so we don't need the extra ืคืกื•ืง for this. He became a ื’ื ื‘, so just like a ื’ื ื‘ pays ื›ืคืœ, and ืืจื‘ืขื” ื•ื—ืžื™ืฉื” he also pays. But if not, then we have to have that extra ืคืกื•ืง, and that's why he has the ืคืกื•ืง ื’ื ื‘ ื™ื’ื ื‘. What are all? Talking All what? All, what? Retroactive, but why is this a ื ืงื•ื“ื” of a ื–ืžืŸ? I don't see how the ื–ืžืŸ, you could think It's not, we're not talking about ื–ืžืŸ. He's giving an example of ื–ืžืŸ, but we're talking about ืฉืžื™ืจื”. But even this ื–ืžืŸ, but Oh, that's it. For a ื’ื ื‘ like or ืฉืžื™ืจื”? For all, we're all, every ืขื‘ื™ืจื” is a ื’ื ื‘. It's a ืžืขืฉื”, ืจื‘ ื—ื™ื™ื said that, he brought it to him. He

Rav Chaim rejects the 'everything continues' view

says this ื›ื•ืœื” ื ืžืฉื›ืช, ืจื‘ ื—ื™ื™ื did not accept it. The next day he gave him a ืžื–ืœ ื˜ื•ื‘. He said to him, \"Why?\" He said, \"I just got married.\" According to your ืฉื™ื˜ื”, I just got married, isn't it? Yeah, because ืจื‘ ื—ื™ื™ื did not accept this ืกื‘ืจื” of ื›ื•ืœื” ื ืžืฉื›ืช. Like a ืชืฉื•ื‘ื”, ื—ื™ื™ื ื‘ืจื™ืกืงืขืจ. Like a ืชืฉื•ื‘ื”, it has this, a big thing, like the ืจื‘ื™ ื›ื•ืœื” ื ืžืฉื›ืช, you have so many ืฉื™ื—ื•ืช and the ืจื‘ื™ has a big Yeah. Even though some places he argues, good for him, but ืจื‘ ื—ื™ื™ื ื‘ืจื™ืกืงืขืจ did not, no, it's like they don't, this whole ืกื‘ืจื” of ื›ื•ืœื” ื ืžืฉื›ืช they don't, doesn't hold. Nah, they fight with this. I once said this to somebody who worked for someone, for Briskers in yeshiva, \"Ah, this is a ื•ื•ื™ืฅ!\" A what? A joke, a joke. A ื•ื•ื™ืฅ is a joke. ื•ื•ื™ืฅ. They don't. No, no, they they don't they don't negate everything. But well, I don't understand why the ืฉืžื™ืจื” is, I understand the idea of the ื ืงื•ื“ื” of the ื›ื•ืœื” ื ืžืฉื›ืช, but if somebody tells you straight out, \"I'm giving you this for a period from today for 30 days from now,\" all your theories sort of fall out because you're being very specific. You're telling him that Let me ask you a question. I

30โ€‘day watch contract and breach scenario

hire you for 30 days to watch my object and I pay you $500 to keep an eye on this for 30 days, right, right? $10 a day. 10 days later you turn around and say \"I'm not watching this.\" I owe you I owe you $100? I owe you nothing. Well, the truth is you you don't owe anything. That is a Why? Maybe I owe you for 10 days? No, no, but that's the point. If you make a contract for 30 days, That depends. you breach on the 29th day, you breach it. That depends, it depends if it's all one or not, and maybe whatever I did I did. But I I understand the theory of whatever you did you did, but I'm I'm sort of that's if if there's a void, you don't know and you're trying to figure out what he meant, which the ื’ืžืจื tries to do a lot, but if I know what you meant, you meant 30 days, you were Yeah, but you know why you meant it, because you wanted it to be watched. Exactly. And it was watched, by the other guys! That's a different story. That that But what if so what if he only had one guy, let's say they never had the four guys. He's ื—ื™ื™ื‘. Then there's no question he's ื—ื™ื™ื‘. Then why But he's ื—ื™ื™ื‘ not because of ื›ื•ืœื” ื ืžืฉื›ืช or anything or not for, because he didn't watch it! Because, if I said there is a case where the ืฉืžื™ืจื” is not being done, then you're certainly ื—ื™ื™ื‘, or if these four people couldn't watch it and you drop out, you're you're ื—ื™ื™ื‘. That's for sure. But the

Liability when the watch is actually performed

case where everything is the ืฉืžื™ืจื” is done, the guy wanted to be watched, it's watched. So then why do you even talk about the Well the ืฉืืœื” is, is this guy ื—ื™ื™ื‘? If it failed, it wasn't, but if it failed, something happened to it, if a payer was ืžื–ื™ืง. So why talk about ื›ื•ืœื” ื ืžืฉื›ืช? Why why do you even have to get into that whole Oh, because we're trying to say why is this guy not responsible? He's not responsible because he because it was watched by No, but what does what do what do they say ืคืฉื˜ in ืชื•ืกืคื•ืช? Because after all you accepted to watch and you're not keeping it. You're part of this group. You're part of the group and you're not. So, but you didn't keep it when they were watching it either. You didn't keep it, let's say you kept it for 10 days then you walked away, Right. according to ืชื•ืกืคื•ืช you still didn't keep it, you didn't keep the ืฉืžื™ืจื”, not the not the Yeah, that's No, the ืฉืžื™ืจื” is on the object. It's You is the ืงื‘ืœื”, you were ืžืงื‘ืœ, the object has to be ืฉืžื•ืจ. Right. So that object is ืฉืžื•ืจ. The problem is you, that's the whole ื•ื•ืืจื˜. If the object is ืฉืžื•ืจ, as far as the ื‘ืขืœื™ื is concerned, it's done. But the ืฉืืœื” is, is am I responsible because I So that's that's ืงื‘ืœื”, that's not ืฉืžื™ืจื”. I'm holding you guilty in theory, and practically the item was watched. No, but who cares? But the other guys could say, \"We're only paying each one is paying a fifth, and you pay the other fifth.\" This is not about the other guys. This is about you're guilty in theory. No, it is. No, no, these guys don't want to pay. We're talking do they have a right to say, \"We're not paying and you pay a fifth\"? And they'll tell him, \"You pay a fifth\", and the ืฉืืœื”, can he say, \"No\"? So from from the other guy's perspective, it's a it's an issue of ืฉืžื™ืจื”. The other guys are talking about No, but he gave him also. But the ืฉืืœื” is, since he was ืžืงื‘ืœ, does he have that responsibility? I I understand. Did he do anything wrong? So the the

Tosafotโ€™s plain reading on recipientโ€™s wrongdoing

way they're ืžืกื‘ื™ืจ ืคืฉื˜ in ืชื•ืกืคื•ืช is that he did wrong.
