Writing about Chametz ownership

Huh? Sell them? We write to sell any place where there might be chametz. So they mean chametz of 讘诇讜注 of the 讻诇讬. If you sold him the 讻诇讬, you don't need it. It's not 驻砖讜讟 that you could write that for the 讻诇讬, some people say you can't write that. That's what we do. It's a minhag Chabad. Wait, but but Pesach still doesn't care if if your if you you have in mind to to keep it, however small the crumb, right? You'll still be over. Okay. Even if you don't have in mind. That's what I'm saying, it doesn't It doesn't make It doesn't make it any better that that that you're that you Right, right. You're still over. So why does everybody like who's sitting to be is the Gemara have to be 讬驻讛? Anything is There's not I mean 讬驻讛 讬驻讛 is like, ah, this you have a a 转讗讜讜讛 for. This is something special. So take what it says. But I tell you, it's not 驻讬专讜专讬谉, it's not 讘讟诇 诪讗诇讬讜. The Gemara first talks about 驻讬专讜专讬谉, small things. That is 讘讟诇 诪讗诇讬讜. So 讬驻讛 is But you might find something that's not 讘讟诇 诪讗诇讬讜. And they say, 讚注转讬讛 注诇讬讛 means it's 讗讬谞讜 讘讟诇 诪讗诇讬讜. That's what 讬驻讛 means. Yeah, 讬驻讛 and 讚注转讬讛 注诇讬讛 together. It doesn't mean scrumptious. It means that it's more than just a crumb. I always think of finding a nice cookie over there. Yeah, but even the crumb is not so How should I know? What kind of crumb? The Gemara starts off, maybe the reason Huh? Crumb can be to be over over on it, look at it. It wasn't a kezayit. A kezayit wasn't, how does the Gemara All kinds of breadcrumbs. The Gemara The Gemara says lechatchila maybe the reason you have to be mevatel it's because of 驻讬专讜专讬谉. The Gemara says, no, 驻讬专讜专讬谉 诇讬转 讘讛讜 讞砖讬讘讜转讗, they're batel by itself. So is it a kezayit or not? Mima nafshach. If it's a kezayit, why is it batel by itself? 讗诇讗 what, it's not a kezayit? So what's the hava amina? By kezayit, you're not 注讜讘专 讘讘诇 讬专讗讛?

Poskim on transgression status

But the Alter Rebbe 驻住拽谞讟 that you're not 注讜讘专 and there's no 讞爪讬 砖讬注讜专. By 讘诇 讬专讗讛 讘诇 讬诪爪讗, there's no 讞爪讬 砖讬注讜专 like this. Even where there is a din of a shiur By chametz it's not a 讞爪讬 砖讬注讜专? Achilah, yeah. Why, 讞爪讬 砖讬注讜专 Every issur there is a 讞爪讬 砖讬注讜专. That's what I'm saying, that there's no 讞爪讬 砖讬注讜专 by by by chametz? There is chametz by you're 注讜讘专 讚讗讜专讬讬转讗 on achilah. Every issur, every issur you're 注讜讘专 讚讗讜专讬讬转讗. Chametz you're no, but you're 注讜讘专 讚讗讜专讬讬转讗 by 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛. Right. And chametz is 讻诇 砖讛讜讗. No. 讻诇 砖讛讜讗 There is an 讗讬住讜专 讻诇 砖讛讜讗 by chametz? There is an issur, but not for not 讻诇 砖讛讜讗. Even if you hold 讞爪讬 砖讬注讜专 is mutar, by 讞诪抓 讻诇 砖讛讜讗 is asur. 讞诪抓 讻诇 砖讛讜讗, even if you don't hold 讞爪讬 砖讬注讜专 That's When we say 讞诪抓 讘诪砖讛讜, we mean 转注专讜讘转. It means it's not 讘讟诇. We're not talking about 转注专讜讘转 now, we're talking about you have a piece of chametz that's less than a kezayit, a 讞爪讬 砖讬注讜专. Is it mutar or asur? Any piece of food, 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛. 驻住拽谞讜 讚讬谉. Like who? Halachah. Rabbi Yochanan says that halachah is 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛. He knows it from 讻诇 讞诇讘. And chazi l'itztarufi. By chametz, there's an additional pasuk. Right? The Rambam says that chametz is asur any little bit 砖谞讗诪专 讻诇 诪讞诪爪转 诇讗 转讗讻诇讜. And all the mefarshim, the Kesef Mishneh, the Mishneh LaMelech, everyone asks, why do you need a special pasuk for? Why is it worse than any other issur where we learn it out from the 驻住讜拽 讻诇 讞诇讘? And they find all kinds of biurim to answer. So

Halacha of a half鈥憁easure of Chametz

there is a 讗讬住讜专 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛 by 讗讻讬诇转 讞诪抓, eating chametz. But 讘诇 讬专讗讛 讘诇 讬诪爪讗, the Alter Rebbe says clearly, 讘诇 讬专讗讛 讘诇 讬诪爪讗 is only if it's a 讻讝讬转 讚讗讜专讬讬转讗. If it's not a kezayit, you're not 注讜讘专 诪讚讗讜专讬讬转讗. Derabbanan, he says, you have to be meva'er it, but not 诪讚讗讜专讬讬转讗. And then in Kuntras Acharon, the Alter Rebbe says, why not? He doesn't say why, he just says that the 讞讻诐 爪讘讬 讻转讘 讟注诐 谞讻讜谉. The Chacham Tzvi gives a good reason why. The Chacham Tzvi gives two reasons and the Alter Rebbe obviously means the second reason. But then there's a reason another reason given by the Sha'agat Aryeh. Why why is 讘诇 讬专讗讛 different than any other issur? Every issur there's no there's 讞爪讬 砖讬注讜专 is 讗住讜专 诪讚讗讜专讬讬转讗, and 讘诇 讬专讗讛 not. So number one, the Chacham Tzvi says that 讘诇 讬专讗讛 that 讞爪讬 砖讬注讜专 is asur only by 诪讬讚转 讗讻讬诇讛, only by food. We learn it out from the 驻住讜拽 讻诇 讞诇讘, always by food. Then he says another sevara. Maybe not only by food, by food or by anything that involves a 驻注讜诇讛, an act. Because 驻注讜诇转讜 讗讞砖讘讬讛. Since you did a 驻注讜诇讛, it's already something. But any issur that's without a 驻注讜诇讛, like 讘诇 讬专讗讛, how are you 注讜讘专 讘诇 讬专讗讛? You just sit back and you don't destroy your chametz, you're not mevatel it, then there is no 讞爪讬 砖讬注讜专. And then the Shagat Aryeh has a very geshmacke vort.

Shaagat Aryeh's argument about half鈥憁easure

The Shagat Aryeh says like this: when is 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛 is if when you eat you have a 讞爪讬 砖讬注讜专, you eat a 讞爪讬 砖讬注讜专 or whatever you do a 讞爪讬 砖讬注讜专, then if you would be 诪爪讟专祝 another half it'll Not let's say, 讞讝讬 诇讗讬爪讟专讜驻讬, but if you 诪爪讟专祝 another half, it'll make the first half 诇诪驻专注 讗住讜专, retroactive. That's what happens normal, right? If I eat a half a 讻讝讬转 of 讞讝讬专 someone eats half a 讻讝讬转 讞讝讬专, and then and that's all he planned to eat, and then, within the 砖讬注讜专 of 讗讻讬诇转 驻专住, he decides to eat another half. So what happens then? That first half that he ate when he ate it now becomes treif, now now becomes part of the issur. Then 讞爪讬 砖讬注讜专 is asur. But in a case where even if you'll be 诪爪讟专祝 the other half, it won't work retroactive, like by 讘诇 讬专讗讛. A person has a half a 讻讝讬转 讞诪抓. What are we What'll happen? He'll add another half. When he adds another half, from when will he be 注讜讘专 on the chametz? From when he added it. It's not retroactive that before he was 注讜讘专. Yeah. So then there is no 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛. So here the 驻讬专讜专讬谉, the question is back: so 讞爪讬 砖讬注讜专, whatever the reason is, 讞爪讬 砖讬注讜专 is not 讗住讜专 讘讘诇 讬专讗讛, why does the Gemara say 驻讬专讜专讬谉? So I

Altar Rabbi鈥檚 observation on crumbs

saw this, saw the Alter Rebbe in Kuntres Acharon says that 驻讬专讜专讬谉 could mean kezayis. So when I saw it, I was so surprised. You believe that? I couldn't believe it. Says Kuntres Acharon 住讬诪谉 转诪状讘, it's not a Kuntres Acharon, even it says a 讙讬诇讬讜谉 on the Kuntres Acharon, it's a 讛注专讛 on the Kuntres Acharon, here, yeah, this is where he says: 注讬讬谉 转砖讜讘转 讞讻诐 爪讘讬 住讬诪谉 驻状讜, 讟注诐 谞讻讜谉 诇诪讛 讗讬谉 讞爪讬 砖讬注讜专 讗住讜专 诪谉 讛转讜专讛 讘讘诇 讬专讗讛. But here on the side he says: 讚诪讬讬专讬 讘驻讬专讜专讬谉 砖讬砖 讘讛谉 讻讝讬转, 讜讚讜讜拽讗 讙诇讜住拽讗 讬驻讬驻讬讛 讞砖讜讘讛 讚讚注转讬讛 注讬诇讜讬讛, 讜诇讗 驻讬专讜专讬谉 砖讘讗专抓, 驻讬专讜专讬谉 that's been on the ground, 砖讗讬谉 讚注转讬讛 注讬诇讜讬讛, 讗祝 注诇 驻讬 砖讬砖 讘讛谉 讻讝讬转. And then he goes on and he says: 诪砖讻讞转 诇讛 驻讬专讜专讬谉 砖讗祝 砖讬砖 讘讛谉 讻讝讬转, you can find 驻讬专讜专讬谉, 讚诇讗 讬爪讗讜 诪讻诇诇 驻讬专讜专讬谉, 讻讚转谞讬讗, is even if it has a 讻讝讬转, 诇讗 讬爪讗讜 诪讻诇诇, 讻讚转谞讬讗 brings a Mishnah in Berachos, 驻专拽 讞壮 讚讘专讻讜转. Did you ever talk about whether it's breadcrumbs? The 谞讟讬诇转 驻讬专讜专讬谉 砖讬砖 讘讛诐 讻讝讬转. I mean a lot of 驻讬专讜专讬谉 together. Breadcrumbs, yeah. Yeah, but then it's not Must mitztaref them. Because a kezayis has to be in one piece. If you have a 讞爪讬 讝讬转 讞诪抓 here and a 讞爪讬 讝讬转, it's not. No, you have a whole pile of 驻讬专讜专讬谉, and it's all in one bag, push them together. Not in a bag even, it's on the ground. You want to push them together. But it has to be together mamash. Could be. So why does he say why is 讚注转讬讛 注讬诇讜讬讛 if it's a kezayis? Hm? So why is 讚注转讬讛 注讬诇讜讬讛? Why isn't 讚注转讬讛 注讬诇讜讬讛 if it's kezayis? Why is it 讛驻拽专 诪诪讬诇讗 if it's a Oh, because it's 讘讗专抓. 驻讬专讜专讬谉 means mostly crumbs. Just because it's 讘讗专抓, that makes it therefore 讛驻拽专 诪诪讬诇讗? Yeah, the

Gavra's ruling on non鈥慶ountable crumbs

Gemara says 诇讗 讞砖讬讘讬, the Gemara's 诇砖讜谉 is 诇讗 讞砖讬讘讬. Usually it's pashut it's small. No. Yeah, but 驻砖讟讗 讚诪讬诇转讗 the way the way you hear it Oh, because it's ma'us on the ground, and you no one's going to eat it? Doesn't say ma'us, he says the words, the words: only a I mean, a mamash a 讞讬讚讜砖 讙讚讜诇. But how else are you going to explain the Gemara? I wouldn't eat it off the ground. Yeah, so it's not chashuv. Even if you have a kezayit. But you can try to say that the Gemara meant 驻讞讜转 诪讻讝讬转. Why? Why was it measured still because it comes by way of chametz? Well, then it can't be you're not allowed to definitely fine, comes in a Oh, it has a complete cheftza. It's completely what chametz is forbidden for. It has the your chametz and it's matzah and it's on Pesach. It becomes too much chametz? Too much in The concept of chametz is there in full. I don't mean too much in quantity. This idea that if you have one piece and then you have another and and it only and it only counts if if it would have been a case where it goes back, how how did I mean, that fits, but how do you know that that's How did he guess that that's the idea that that's true? Makes sense. Just just No, he's trying to explain there's a din that 讘诇 讬专讗讛 doesn't have 讞爪讬 砖讬注讜专, so he's looking why. So this is a sevara why. Uh-huh. Now the

Altar Rabbi鈥檚 lingering question

question is the Alter Rebbe, why doesn't he bring it? Why does the Alter Rebbe bring the reason of the Chacham Tzvi, why doesn't he bring the reason of the Shaagas Aryeh? This reason. What's the reason of the Chacham Tzvi? Because it has to be or achilah, or a pe'ulah that you do, because then something that you do is chashuv. So from the Rebbe it's mashma that the reason the Alter Rebbe doesn't bring the Shaagas Aryeh, because it doesn't really fit with the way the real pshat in 讞爪讬 砖讬注讜专 is. There are two pshatim in 讞爪讬 砖讬注讜专, why why 讞爪讬 砖讬注讜专 is asur. The Gemara gives the reason because 讞讝讬 诇讗讬爪讟专讜驻讬, because it could be mitztaref to the other half. So the Tzlach learns, it's a technical thing. If the Torah would be matir to eat a half a shiur, know what could be? You would eat a half a shiur, and then you decide maybe to eat and then you'll add and then it'll be asur. That's that 讞讝讬 诇讗讬爪讟专讜驻讬, it's able to be mitztaref. And according to that he says, what happens if you eat a half a shiur the last few minutes of the day? Let's say in Pesach, the last minute of Pesach. Or the last minute of Yom Kippur. That's Tzlach, man. So he says you're allowed, you're not asur. Because the whole reason is he might be mitztaref. Here, even if he mitztaref, it's too late already. But the the the Pri Megadim doesn't learn like that. And the and the 专讘讬 拽讗讻讟 讝讬讱 讗讬谉 讚注诐. Actually, this whole inyan of 讞爪讬 砖讬注讜专 used to be a 诇讬讜讘讗讜讜讬讟砖注专 住讜讙讬讗 讗诪讗诇, because till all the Likutei Sichot came out, there was very little from the Rebbe written in nigleh. One of the things that was available in nigleh was 讞爪讬 砖讬注讜专. So everyone knew, knew the inyan of 讞爪讬 砖讬注讜专. So the Rebbe brings the Rogatchover that 讞爪讬 that the whole we say the reason 讞爪讬 砖讬注讜专 is asur because it could be mitztaref, it's not a practical thing. It's a theoretical thing. It's a re'ayah. Because you could be mitztaref another half to it to make it asur, that's a proof that a half is also asur. Imagine if a half is mutar, yeah? So you have a half a mutar, and you put another half which is mutar, put them together it becomes asur. What kind of crazy thing is that? Because the whole, the whole though. Well, you have two separate things. That's a prima facie third thing. That's how chafza and gavra is, two. Well, the Pri Megadim says it. Oh. So the Pri Megadim says it, and the Rogatchover is has his sevara that this is a re'ayah, and therefore, according to that, it's not like the pilpul. If it's a re'ayah, it's only a re'ayah that it has the 诪讛讜转 讛讗讬住讜专. Because if it wouldn't have the 诪讛讜转 讛讗讬住讜专, then it would be basically 0 + 0 = 0. It's heter plus heter, how does it become? Well, even by 讘砖专 讘讞诇讘 it's a chidush. It says 讘砖专 讘讞诇讘 is a chidush. And there, it's two separate 注谞讬谞讬诐 at least. You mix basar with b'chalav. Here, what are you mixing? Physical mass. Isn't it atom atom binding? Right, if that one's not a problem and that one's not a problem, and you put them together and it's a whole atom. Or two separate things or the same thing? Oh. Basically. So that's because of a ra'ayah of 讞爪讬 砖讬注讜专. But the ra'ayah is no, there it's a ra'ayah that each one has be'etzem the issur. And that would be

Halachic analogy: digging a hole

What about the the person digging the hole? He only dug he digs it partway and Dug a half? Yeah. Can't dig a half a hole. No, no, I mean here Like a ten tefachim. He only digs it five tefachim, and the other guy dig it the rest, doesn't matter. So together they're What's the halacha, then? Only the the guy No, the last one is chayav. What about 砖讜讛 驻专讜讟讛? You give something that's not 砖讜讛 驻专讜讟讛, you give something else that's also not 砖讜讛 驻专讜讟讛. Together they are. So that's metztaref, yeah. Huh? So you give it together, yeah. Not not one after another, you give it together. Yeah. Then you're then you're a prutah. You get so these are a 砖讜讛 驻专讜讟讛, not this. Yeah. That's what this Rashi in regard to all people of 专讗讛 讜诪爪讗 is talking about a ra'ayah that it's mid'oraita, so when you argue, you have to come with a 讻诇 转讜讱. If they have to, they have peshat in that Rashi, all the perush in Rashi goes off from the ta'am of heter is right to go buy it, but because of 专讗讛 讜诪爪讗. Yeah. Yeah. Yeah. I say at the end like I said be'emet, you can say this and it fits the words, but this is not perush of gavra and cheftza in 专讗讛 讜诪爪讗. And it fits, mistama it's gavra and cheftza, 专讜讗讛 is a gavra, 诪爪讗 is a cheftza, that's for sure. I mean that's the obvious thing. Right.
