Why the Torah Splits Damage Into Four Categories
Part of Bava Kama: chapter 1 · 59:36
Opens Bava Kamma's Mishnah on the four avos nezikin (ox, pit, grazing, fire), working through why horn-damage differs when attached versus detached and how bite counts as a derivative of horn, not tooth.

Jewish audio on chabad.org. Today's 砖讬注讜专, we're going to start a new 住讚专 of the 砖砖讛 住讚专讬 诪砖谞讛. We're entering the 住讚专 谞讝讬拽讬谉, the 住讚专 in 诪砖谞讬讜转 that deals with the 讚讬谞讬诐 of 讛讬讝拽, with the 讚讬谞讬诐 of damage, and we will start with the first 诪住讻转讗 in 住讚专 谞讝讬拽讬谉, which is 诪住讻转讗 讘讘讗 拽诪讗. The word 讘讘讗 拽诪讗 means the first gate, because we have three gates within the same category, and they are referred to as 讘讘讗 拽诪讗, 讘讘讗 诪爪讬注讗, and 讘讘讗 讘转专讗, which means the first gate, the second gate, and the third gate. And according to some opinions, really these three 诪住讻转讜转 are really one 诪住讻转讗, just three parts to the same 诪住讻转讗, and that's why they are referred to as three different sections of the same 诪住讻转讗 as 讘讘讗 拽诪讗, 讘讘讗 诪爪讬注讗, and 讘讘讗 讘转专讗. The 诪住讻转讗 we are going to start, which is the 诪住讻转讗 讘讘讗 拽诪讗, is going to deal with the damages that a person causes to another and the payments he must make for the damage that he caused. And when we say a person causes damage to another, it doesn't necessarily mean that he himself personally causes the damage, but it also means and includes the damage that is caused by something that is owned by the person, and therefore he is responsible to pay for those damages. And the beginning of the 诪住讻转讗 will deal mainly with four principal categories of damages that a person is responsible for. And
before we get into learning the 诪砖谞讛, we will first go through some of the 驻住讜拽讬诐 in the 转讜专讛 that are the source for these categories of damages that a person will be responsible for. In 驻专砖转 诪砖驻讟讬诐, which is in 讞讜诪砖 砖诪讜转, in 拽驻讬讟诇 讻\"讗, we find in 驻住讜拽 讻\"讞, it says, 讜讻讬 讬讙讞 砖讜专 讗转 讗讬砖 讗讜 讗转 讗砖讛 讜诪转, that if an ox will gore a person and the person will die, so then the punishment is 住拽讜诇 讬住拽诇 讛砖讜专, that the 砖讜专, the ox, must be stoned, and as the 驻住讜拽 continues, and it is 讗住讜专 讘讛谞讗讛, a person may not have any benefit from that ox. And then the owner of the ox, the 转讜专讛 says, 讗诐 讻驻专 讬讜砖转 注诇讬讜 讜谞转谉 驻讚讬讜谉 谞驻砖讜 讻讻诇 讗砖专 讬讜砖转 注诇讬讜, that there is a certain amount of payment that the owner of the ox must pay for the death that was caused through his ox. So here we have the 驻住讜拽讬诐 that deal with the goring of an ox that killed a person. Then the 驻住讜拽 continues in 驻住讜拽 诇\"讙, where it says, 讜讻讬 讬驻转讞 讗讬砖 讘讜专, if a person will open up a pit, 讗讜 讻讬 讬讻专讛 讗讬砖 讘讜专, or if a person will dig a pit, 讜诇讗 讬讻住谞讜, and he will not cover it, 讜谞驻诇 砖诪讛 砖讜专 讗讜 讞诪讜专, and in that pit an ox or a donkey will fall in, so the 转讜专讛 says, 讘注诇 讛讘讜专 讬砖诇诐 讻住祝 讬砖讬讘 诇讘注诇讬讜 讜讛诪转 讬讛讬讛 诇讜, which means that the owner of this pit, the one that dug it or the one that opened it up, is responsible to pay for the damage that he caused, since an ox or a donkey fell in and got hurt or killed, and therefore there was a loss of money caused to the owner of that ox, so the one that made the pit is responsible to pay. Then the 驻住讜拽 continues in 驻住讜拽 诇\"讛, 讜讻讬 讬讙祝 砖讜专 讗讬砖 讗转 砖讜专 专注讛讜 讜诪转, that if an ox that belongs to a person will make a collision with an ox that belongs to somebody else, 讜诪转, and the other ox died, in other words, the first ox caused damage to the owner of the other ox by killing his ox, so the 讚讬谉 is, as the 驻住讜拽 continues, that the owner of the first ox must pay. Then the 驻住讜拽 continues later on in 拽驻讬讟诇 讻\"讘, 驻住讜拽 讚', 讻讬 讬讘注专 讗讬砖 砖讚讛 讗讜 讻专诐 讜砖诇讞 讗转 讘注讬专讜 讜讘注专 讘砖讚讛 讗讞专 诪讬讟讘 砖讚讛讜 讜诪讬讟讘 讻专诪讜 讬砖诇诐, which means that if a person will send his animal to someone else's yard, to someone else's field, and as the 讙诪专讗 will explain, it doesn't mean only if he sent, but even if the animal went by itself, and what the animal did, as the 讙诪专讗 will explain, it means that the animal either stamped, stepped on the food, on the things that grow in someone else's field, or the animal ate things that belong to somebody else in somebody else's field, then the owner of the animal must pay for the damage that his animal, his ox, for instance, caused. to his friend. Then the 驻住讜拽 continues in 驻住讜拽 讛, 讻讬 转爪讗 讗砖 讜诪爪讗讛 拽讜爪讬诐, if a fire will go out, and it will find thorns, 讜谞讗讻诇 讙讚讬砖 讗讜 讛拽诪讛 讗讜 讛砖讚讛, and it will burn the wheat, the grain that's in someone else's field, 砖诇诐 讬砖诇诐 讛诪讘注专 讗转 讛讘注专讛. So the one that made the fire has to pay for the damage that his fire caused. Then we have 驻住讜拽讬诐 in 驻专砖讛 讗诪讜专, in 讞讜诪砖 讜讬拽专讗, 拽驻讬讟诇 讻"讚. So there the 转讜专讛 says in 驻住讜拽 讬"讞, 讜诪讻讛 谞驻砖 讘讛诪讛 讬砖诇诪谞讛. If someone hit the 谞驻砖 of a 讘讛诪讛, in other words, if somebody kills somebody else's animal, so the 讚讬谉 is 讬砖诇诪谞讛, he must pay for it. And then the 驻住讜拽 continues in 驻住讜拽 讻"讗, 讜诪讻讛 讘讛诪讛 讬砖诇诪谞讛, that if you hit a 讘讛诪讛, which means if you cause damage to another person's 讘讛诪讛, you didn't kill it, but you caused some damage to it, 讬砖诇诪谞讛, you must also pay.
Based on all these 驻住讜拽讬诐, the 讙诪专讗 will learn out that we find four general categories of kinds of damage that a person is able to cause to his friend. And we will find differences of opinion in the 讙诪专讗 exactly which the four are. But we will go through them all, which add up to six, and the 讙诪专讗 will explain which four of the six are considered the four principal categories. But from these 驻住讜拽讬诐, we come out with six different types of damage that is caused by a person to his friend. Three are damages that are caused by an ox, by the ox that belongs to a person. And these three are referred to as 拽专谉, 砖谉, and 专讙诇. 拽专谉 means the horn, 砖谉 is the tooth, 专讙诇 is the foot. Because as we noticed from the 驻住讜拽讬诐 before, there is a possibility for an ox to cause damage to another person through goring, that is 拽专谉, using his horn, or through eating the other person's things, which would be referred to as 砖谉, which is the tooth, and another category, another way a person's ox is able to cause damage to his friend, is through 专讙诇, through the foot, when he stamps, when he goes over other person's property and breaks it and damages it. So these are three which are included in the ox. Then we have the damage a person is able to cause somebody through making a hole, and then because that he didn't cover the hole, someone else's things fell in and were damaged, that is another category of damage. Then we have a damage that could be caused through a fire, as we learned in the 驻住讜拽, that if you start a fire and it burns, destroys someone else's property, you're responsible to pay. And then there is a damage that could be caused through the person himself. If the person himself damages someone else's property, for instance, kills someone else's animal, or hurts someone else's animal, which really means that he caused a 讛讬讝拽 of money, a loss of money to his friend, he is responsible to pay. Now, it must be made clear that when we say that these are principal categories of damage, it doesn't mean that because they were done by different parts of the body, for instance, one was done through the horn, the other one was done through the teeth, and the other one was done through the feet, therefore they are considered different categories, but these are different categories in kinds of damage, and the part of the body is just a general idea of that whenever it is done with that part of the body, usually it is done in a certain way. In other words, the different categories of damage have different characteristics, and the 讙诪专讗 will explain exactly the different characteristics of the different kinds of damage. For instance, the characteristic of the damage done through 拽专谉, through a horn, is that 讻讜讜谞转讜 诇讛讝讬拽, that it is intending to be 诪讝讬拽, to damage. And therefore, we consider it as a separate category, not only because it was done by the horn, but that represents a general category of whenever an ox damages property of somebody else with the intention of damaging, that is in the category of 拽专谉. The category of 专讙诇, for instance, is 讛讬讝拽讗 诪爪讜讬. It is a kind of damage that is very common. Since the animal walks, and whenever there is something under its feet, it will step on it and therefore damage it, so any damage which is 讛讬讝拽讗 诪爪讜讬, which is a common damage, will be in the category of 专讙诇. And 砖谉, for instance, the tooth, represents a kind of damage when 讬砖 讛谞讗讛 诇讛讝讬拽讜, when there is a pleasure, a benefit to the animal through its damage. damage. Just like when the animal eats something, and therefore caused the damage to the other person, but it's a kind of damage that the animal had a benefit from. So anytime the animal will damage, when there is a 讛谞讗讛, a pleasure to the animal through its damage, that will be in the category of 砖谉. And the same with the other kinds of damages, each one has its own characteristics, and therefore it is considered a separate category of damage. Now,
being that these are different categories of damage, different 讚讬谞讬诐 could apply to the different categories, whether it is concerning when you are 讞讬讬讘 to pay and when you are 驻讟讜专 to pay. There could be different conditions concerning one kind of damage that you would have to pay under such conditions, while if it would happen through a different kind of damage, you would be 驻讟讜专 to pay, or it would be consider, concerning the amount of money you have to pay. That one type of damage you might have to pay more than if it happened through a different type of damage. And one of the 讚讬谞讬诐 that are important to note before we even start the 讙诪专讗 is that concerning the category of 拽专谉, there is a difference between a 转诐 and a 诪讜注讚. 拽专谉, being that it is a kind of damage where 讻讜讜谞转讜 诇讛讝讬拽, where the animal intends to damage, therefore this is called 诪砖讜谞讛. This is a kind of damage which is really not a normal thing to do. It is a change in the style, in the nature of the animal. And therefore, if it happened the first time by this animal, or even the second time, or according to some opinions even a third time, the animal is still considered a 转诐. And therefore, the owner would only have to pay 讞爪讬 谞讝拽, half of the damage that the animal caused. Afterwards, after the third time, if the animal damages again, now the owner would have to pay 谞讝拽 砖诇诐, the complete amount of money that the damage was. While by other kinds of damage, the other categories, even if it happens the first time, the owner must pay 谞讝拽 砖诇诐, the complete 谞讝拽, the complete amount of money. Another difference between 拽专谉 and the other categories of 谞讝拽 is that 拽专谉 you only pay 诪讙讜驻讜, which means even that half of the 谞讝拽, half of the amount of money of damage that the owner has to pay, you only pay up to the worth of the animal that caused the damage. For instance, if the animal that caused the damage was worth $50, and the damage that he caused was worth 110, then if we would just have to pay half of the damage, it means he would have to pay 55. But since the animal itself is not worth more than 50, so then the owner would not have to pay more than 50. While in the other categories of damage, in addition to the fact that you pay 谞讝拽 砖诇诐, the complete amount of money, you also pay 诪谉 讛注诇讬讬讛, which means that it doesn't depend on the worth of the animal, but you have to pay the full amount of money, whether you have to go take it from your house or wherever you would get it, you would have to pay the complete amount of money that the damage was. And there are many, many more 讚讬谞讬诐 in the different categories of 谞讝讬拽讬谉, as we will learn throughout the 驻专拽. And now we will learn the 诪砖谞讛 inside. The
诪砖谞讛 says, 讗专讘注讛 讗讘讜转 谞讝讬拽讬谉, there are four fathers of damages, which means that there are four general, principal categories in damages. And the 诪砖谞讛 mentions them: 讛砖讜专, the ox. And there are two opinions in the 讙诪专讗 later on, what that refers to. According to one opinion, it refers to all three categories of 谞讝讬拽讬谉 that we find in the ox, which means 拽专谉, 砖谉, 讜专讙诇. So the 诪砖谞讛 just gives one general word, but it really means all three. And according to another opinion, the word 砖讜专 refers to one of the three, which is 专讙诇, to the damage that is caused through the foot of the ox. And the 讙诪专讗 explains the reasons why we should, according to one opinion, hold it means all three, and why the other opinion holds it only means 专讙诇. The second one is 讜讛讘讜专, the pit. Then 讜讛诪讘注讛. In the 讙诪专讗, we also have a 诪讞诇讜拽转 what 诪讘注讛 means. According to one opinion, the one that holds that 砖讜专 means 专讙诇, he learns that 诪讘注讛 means 砖谉, the second category, the other category within the ox. According to the opinion that holds that 砖讜专 means all three, so the word 诪讘注讛 means the person. That if the person personally causes damage to somebody, he is also one of the categories in the 讗讘讜转 谞讝讬拽讬谉. And the 讙诪专讗 later on will explain why, according to this opinion that holds that 砖讜专 means 专讙诇 and 诪讘注讛 means 砖谉, why the 诪砖谞讛 doesn't mention 拽专谉, and why the 诪砖谞讛 and it doesn't mention 讗讚诐 when the person himself damages. And then we have the fourth one, 讜讛讛讘注专, which means the fire. These are four principal categories. And as 专砖"讬 says, why are these referred to as 讗讘讜转? So 专砖"讬 says, because the ones that are mentioned in the 转讜专讛 specifically outright, they are referred to as 讗讘讜转. And the 诪砖谞讛 continues, 诇讗 讛专讬 讛砖讜专 讻讛专讬 讛诪讘注讛. 砖讜专 is not like 诪讘注讛. The 诪砖谞讛 here is trying to answer an obvious question. One might ask, why did the 转讜专讛 have to tell us all four categories of damage? Why wouldn't it be enough if the 转讜专讛 would just say that if you cause damage to another person through 砖讜专 for instance, you are obligated to pay? So we would understand ourselves that just like you cause the damage through 砖讜专 you have to pay, the same if you would cause the damage through any other way, you would have to pay. So the 转讜专讛 could have just told us one of these categories, and we would understand the rest. The only way we could answer that question is if we would find that there is a 讞讜诪专讗 in one of them over the other. In other words, if there is something stricter, if there is a reason in one of them why we would think that there is more reason that this one pays damage, and that same reason we do not find in the other kinds, that would answer the question why the 转讜专讛 has to write them both. Because if the 转讜专讛 would write the first, we would think that only in that case you have to pay, because that has that special 讞讜诪专讗, and the other that does not have the special 讞讜诪专讗, we would think you do not have to pay. And therefore the 转讜专讛 has to write the second one too to tell us that even though the other one does not have this 讞讜诪专讗, nevertheless you would have to pay. And that's what the 诪砖谞讛 is saying: 诇讗 讛专讬 讛砖讜专 讻讛专讬 讛诪讘注讛. 砖讜专 has a 讞讜诪专讗 over 诪讘注讛. There is something in 砖讜专 that 诪讘注讛 doesn't have. There is some reason in 砖讜专 why 砖讜专 has to pay that we do not find in 诪讘注讛. And therefore, if the 转讜专讛 would just tell us 砖讜专, we would not know that 诪讘注讛 also has to pay. And the 讙诪专讗 later on will explain which is the 讞讜诪专讗 that 砖讜专 has over 诪讘注讛. And the 讙诪专讗 will explain it according to both opinions: whether 砖讜专 means 专讙诇 and 诪讘注讛 means 砖谉, or the other opinion that 砖讜专 means all three and 诪讘注讛 means 讗讚诐. But the 讙诪专讗 will explain what is the 讞讜诪专讗 that 砖讜专 has over 诪讘注讛, which would be the reason why if the 转讜专讛 would just tell us 砖讜专, we would not know 诪讘注讛. But the question comes up now, that if there is a 讞讜诪专讗 in 砖讜专 over 诪讘注讛, so why didn't the 转讜专讛 just write 诪讘注讛 and not write 砖讜专? And we would understand ourselves that if 诪讘注讛 has to pay, even though it doesn't have that special 讞讜诪专讗, certainly 砖讜专 has to pay when it does have that 讞讜诪专讗. So the 转讜专讛 should have just written 诪讘注讛 and not 砖讜专. So the 诪砖谞讛 continues, 讜诇讗 讛专讬 讛诪讘注讛 讻讛专讬 讛砖讜专. There is some special 讞讜诪专讗 in 诪讘注讛 that 砖讜专 doesn't have. And therefore, if the 转讜专讛 would just write 诪讘注讛, I would think that only 诪讘注讛, being that it has that 讞讜诪专讗, only that has to pay, but 砖讜专 which does not have that 讞讜诪专讗, you do not have to pay. And therefore the 转讜专讛 has to write 砖讜专 also. In other words, since there is a 讞讜诪专讗 in 砖讜专 over 诪讘注讛, and a 讞讜诪专讗 in 诪讘注讛 over 砖讜专, therefore the 转讜专讛 has to write them both. Now the 诪砖谞讛 is going to explain, why isn't it enough that the 转讜专讛 should write just 砖讜专 and 诪讘注讛, and we wouldn't need 讗砖, the 转讜专讛 didn't have to tell us fire, and we would understand ourselves that if you cause damage through 砖讜专 or through 诪讘注讛 you have to pay, so too if you cause damage through 讗砖, through a fire, you also have to pay? And the 诪砖谞讛 says that it wouldn't be enough because there is a 讞讜诪专讗 that we find in 砖讜专 and 诪讘注讛 which we do not find in 讗砖. And therefore if the 转讜专讛 would just write 砖讜专 and 诪讘注讛, we would not understand ourselves that you're also 讞讬讬讘 by 讗砖. We would think that only 砖讜专 and 诪讘注讛, being that they have this 讞讜诪专讗, that's why you have to pay, while 讗砖 that doesn't have this 讞讜诪专讗, the fire doesn't have this 讞讜诪专讗, you do not have to pay. And in this case, the 诪砖谞讛 tells us 讘驻讬专讜砖 which is the 讞讜诪专讗 that we find in 砖讜专 and 诪讘注讛 that 讗砖 doesn't have. And the 讞讜诪专讗 is 专讜讞 讞讬讬诐. They both are alive. They're both done through something which is alive. Whether 砖讜专 and and 诪讘注讛 means 砖谉 and 专讙诇, or it means all three categories and 讗讚诐, but whatever it is, it has a 专讜讞 讞讬讬诐, it is done through something that is alive. And that is a reason why we would think a person should have to pay, while 讗砖 is done through something which doesn't have any life, we would think maybe does not have to pay. And therefore the 转讜专讛 also has to write 讗砖. Now the question is, so let the 转讜专讛 just write these three and we wouldn't need the fourth, which is 讘讜专? But the 诪砖谞讛 continues continues: 讜诇讗 讝讛 讜讝讛 砖讚专讻谉 诇讬诇讱 讜诇讛讝讬拽, that these three are not like the other, the 讘讜专, being that they have a 讞讜诪专讗 that they travel and they cause the damage. So they are not like 讛专讬 讛讘讜专, like the pit, 砖讗讬谉 讚专讻讜 诇讬诇讱 讜诇讛讝讬拽. It doesn't have the characteristic of going and being 诪讝讬拽. These three, the way they cause the damage is by traveling. They go to the one they cause the damage to. And therefore we would think that only in these three categories do you have to pay. But if you cause damage through a 讘讜专, since the 讘讜专 does not travel, does not go to the object it causes the damage to, the object or the person or whatever it was came to the pit, so here we would think that maybe you do not have to pay. So if the 转讜专讛 would not write 讘驻讬专讜砖 that if you cause damage through a 讘讜专 you have to pay, we would not know that. And therefore, the 转讜专讛 also has to mention 讘讜专. And the 诪砖谞讛 continues, 讛爪讚 讛砖讜讛 砖讘讛谉, the common point in all four is 砖讚专讻谉 诇讛讝讬拽. It is common that they would cause damage, all four are common to cause damage. 讜砖诪讬专转谉 注诇讬讱, all four are things that you are obligated to watch. They are in your control, and you are able to watch them. And the 讚讬谉 is by all four, 讜讻砖讛讝讬拽, when the damage was done, 讞讘 讛诪讝讬拽, so the one that caused the damage is responsible 诇砖诇诐, to pay 转砖诇讜诪讬 谞讝拽, the payment for this damage. And he has to pay 讘诪讬讟讘 讛讗专抓. If he doesn't pay with money, and he wants to pay with property, he has to pay with the best of the property. And as the 讙诪专讗 explains, we have three kinds of property, three categories of land, which are referred to as 注讬讚讬转, 讘讬谞讜谞讬转 and 讝讬讘讜专讬转. 注讬讚讬转 is the best, 讘讬谞讜谞讬转 is the middle, the average, and 讝讬讘讜专讬转 are the worst. And the
讚讬谉 is, if you pay for damage with property, you must pay with the 注讬讚讬转, with the best property. Now one might ask in the 诪砖谞讛, why is it that when the 诪砖谞讛 says that there is a 讞讜诪专讗 in 砖讜专 over 诪讘注讛, and in 诪讘注讛 over 砖讜专, the 诪砖谞讛 does not mention what is the 讞讜诪专讗? And the 讙诪专讗 later on will have to explain that. While when the 诪砖谞讛 says that there is a 讞讜诪专讗 in 砖讜专 and 诪讘注讛 over 讗砖, the 诪砖谞讛 says what the 讞讜诪专讗 is, that the 讞讜诪专讗 is that these two have a 专讜讞 讞讬讬诐 and 讗砖 doesn't. And the same when the 诪砖谞讛 says that the three, 砖讜专 and 诪讘注讛 and 讗砖 have a 讞讜诪专讗 over 讘讜专, the 诪砖谞讛 does mention what the 讞讜诪专讗 is, that these three is 讚专讻谉 诇讬诇讱 讜诇讛讝讬拽, they go, while the 讘讜专 does not go. But 转讜住驻讜转 says the reason why the 诪砖谞讛 doesn't mention the 讞讜诪专讗 in the first is because when we want to find a 讞讜诪专讗 in one over the other, so then it is easy to find. You just think a little bit and you will see the difference between one and the other. But when we want to find a 讞讜诪专讗 in two over one, in other words we have to find a common point which is in two over one, then that is harder, especially when it's three over one. So therefore, when it comes to the 讞讜诪专讗 of 砖讜专 and 诪讘注讛 over 讗砖, and the 讞讜诪专讗 of 砖讜专, 诪讘注讛 and 讗砖 over 讘讜专, the 诪砖谞讛 feels that it has to say it outright, because otherwise maybe we wouldn't understand which is the 讞讜诪专讗. Then
there's another question that is very obvious here. When it speaks about 砖讜专 and 诪讘注讛, the 诪砖谞讛 says it both ways. First the 诪砖谞讛 says let us say just 砖讜专 and not 诪讘注讛, and the 诪砖谞讛 says that it couldn't because 砖讜专 has a 讞讜诪专讗. But then right away the question comes up, but then let us say just 诪讘注讛 and not 砖讜专, and we would understand ourselves with a 拽诇 讜讞讜诪专. If 诪讘注讛 which doesn't have the 讞讜诪专讗 you are 讞讬讬讘, certainly 砖讜专 which does have the 讞讜诪专讗. And therefore the 诪砖谞讛 has to say that there is a 讞讜诪专讗 in 诪讘注讛 over 砖讜专 too, and therefore if it would just say 诪讘注讛 we wouldn't know 砖讜专. Why didn't the 诪砖谞讛 do that later on? When the 诪砖谞讛 said there is a 讞讜诪专讗 in 砖讜专 and 诪讘注讛 over 讗砖, and therefore it has to say 讗砖, and it wouldn't be enough if it would just say 砖讜专 讜诪讘注讛, why doesn't the 诪砖谞讛 go back again and say: Now let it say just 讗砖, and since 讗砖 doesn't have the 讞讜诪专讗, and nevertheless you are 讞讬讬讘, we would understand ourselves that 砖讜专 and 诪讘注讛 which do have the 讞讜诪专讗, definitely you're 讞讬讬讘. And the 诪砖谞讛 doesn't do that. And 转讜住驻讜转 says, and the same we find in other 专讗砖讜谞讬诐, that the reason is because there is no 讞讜诪专讗 that we find in 讗砖 over 砖讜专 讜诪讘注讛. But the question is in that case, so why doesn't it say just 讗砖? But there are a lot of details, complicated details to answer this question. But the main point is that later on in the 讙诪专讗 we find that the truth is that if the 转讜专讛 would just write 讘讜专 and one of the others, we would automatically have learned them all out. And the 讙诪专讗 later on goes into the details of how it is. And the reason the 讙诪专讗 says the 转讜专讛 does mention them all four outright is because of the separate different 讚讬谞讬诐 that we find in each one of the categories. So therefore the 转讜专讛 couldn't rely on just writing two and we would know the rest. We might have known the general 讚讬谉 that you are obligated to pay in the other categories of damage too, but since there are different 讚讬谞讬诐 in each category, the 转讜专讛 has to write them outright. And because of that, really, all this that the 诪砖谞讛 says, the different 讞讜诪专讜转 we find in 砖讜专 over 诪讘注讛 and 诪讘注讛 over 砖讜专 and the others over the others, it is really not needed. Because 住讜祝 讻诇 住讜祝, even after all that, the 转讜专讛 still could have written just 讘讜专 and one more, and the reason it doesn't is not because of the 讞讜诪专讜转, but because of the different 讚讬谞讬诐 that apply to each category. So really, when the 诪砖谞讛 says all this, it is really not needed. And the only reason 转讜住驻讜转 says the 诪砖谞讛 says it is 诇讛讙讚讬诇 转讜专讛 讜诇讛讗讚讬专讛, in order for us to learn more 转讜专讛, to get an understanding in the 转讜专讛 more, to have more details in the studying of 转讜专讛, but in truth, after all this, we still have to come on to a different answer why the 转讜专讛 has to mention them all four. And therefore, in the case here, where the 诪砖谞讛 did not find a reason, a 讞讜诪专讗 in 讗砖 over the others, the 诪砖谞讛 did not mention it, because there is no 讞讜诪专讗 in 讗砖 over 砖讜专 讜诪讘注讛, but nevertheless, the 诪砖谞讛 did go through the different 讞讜诪专讜转 that we find in some over the others because of 诇讛讙讚讬诇 转讜专讛 讜诇讛讗讚讬专讛.
There is another obvious question here in the 诪砖谞讛. What is the reason for the order of the four 诪讝讬拽讬谉: 砖讜专, then 讘讜专, then 诪讘注讛 and 讛讘注专? So 专砖状讬 says that they are written here according to the 住讚专 the way they are written in the 驻专砖讛. Because in the 驻专砖讛 we find the first speaks about 砖讜专, then the next 驻专砖讛 about 讘讜专, then 诪讘注讛, and then 讛讘注专. And 转讜住驻讜转 goes more into detail in explaining that according to the 诪讗谉 讚讗诪专, the one that holds that 砖讜专 is 专讙诇, this order doesn't seem to fit according to the 驻专砖讛, because the 驻专砖讛 of 专讙诇, which is learned out from 讜砖诇讞 讗转 讘注讬专讛 讜讘讬注专 讘砖讚讛 讗讞专, comes after the 驻专砖讛 of 讘讜专. But 转讜住驻讜转 says, but nevertheless, since we do find a 讚讬谉 concerning 砖讜专 before 讘讜专, as I mentioned in the beginning of the 砖讬注讜专, that the 转讜专讛 speaks about a 砖讜专 goring and killing a person before the 转讜专讛 speaks about 讘讜专, so even though the 砖讜专 of the 诪砖谞讛, the word 砖讜专 of the 诪砖谞讛 refers to 专讙诇, which says after 讘讜专, but since the 转讜专讛 does mention the general category of an ox goring before the 讚讬谉 of 讘讜专, therefore the 诪砖谞讛 mentions it first. Then 转讜住驻讜转 asks: what about 诪讘注讛? According to the one that holds that 诪讘注讛 means 讗讚诐, that is not mentioned till later on in 驻专砖转 讗诪讜专. So why did the 诪砖谞讛 put 诪讘注讛 before 讛讘注专? And one of the 转讬专讜爪讬诐 转讜住驻讜转 gives is that since it is in a in different 驻专砖讬讜转 altogether, it's much further away, it does not have to be written in the 诪砖谞讛 in the order of the 驻专砖讛. When something when there are a few things in the same 驻专砖讛, so then the 诪砖谞讛 mentions all the things of the same 驻专砖讛 in the order the way they are mentioned in the 驻专砖讛, but something that is in a different 驻专砖讛 altogether doesn't have to fit to the order of the way things come, and therefore the 诪砖谞讛 put it in a different order. And that is the order of the 诪砖谞讛 later on, that the way the 诪砖谞讛 says later on the 诇讗 讛专讬 讝讛, so there 诪讘注讛 comes before 讛讘注专, so therefore the 诪砖谞讛 also puts in 诪讘注讛 before 讛讘注专. The
reason why the 诪砖谞讛 says 诇讗 讛专讬 讛砖讜专 讻讛专讬 讛诪讘注讛, that when the 诪砖谞讛 starts with the question why the 转讜专讛 has to write them all, and the 诪砖谞讛 starts by saying that if it would say 砖讜专, we would not have known 诪讘注讛, so the 专砖状讬 asks, why did the 诪砖谞讛 mention 诪讘注讛? Right after 砖讜专 in the 诪砖谞讛 comes 讘讜专. So the first thing the 诪砖谞讛 should have said, 诇讗 讛专讬 讛砖讜专 讻讛专讬 讛讘讜专, that if it would say 砖讜专, we would not know 讘讜专, since 讘讜专 is the second. Why did the 诪砖谞讛 skip 讘讜专 and jump directly to 诪讘注讛 and say that if it wouldn't say 砖讜专, we wouldn't know 诪讘注讛? It should have said 诇讗 讛专讬 讛砖讜专 讻讛专讬 讛讘讜专. And 专砖状讬 says that the reason for that is because if the 诪砖谞讛 would say that, so then after the 诪砖谞讛 would explain that we need them both, then we would have to go on and say, why can't it say just the both and not the third? We would have to say that 诇讗 讛专讬 讛砖讜专 讜讛讘讜专 讻讛专讬 讛诪讘注讛, that there is a 讞讜诪专讗 in 砖讜专 and 讘讜专, which are the first two, over 诪讘注讛. And we wouldn't be able to say that these two have a 讞讜诪专讗 of 专讜讞 讞讬讬诐, being that 讘讜专 is not a 专讜讞 讞讬讬诐. And therefore, in order to find a 讞讜诪专讗 in these two over the first two over the third, the 诪砖谞讛 had to mention 砖讜专 and 诪讘注讛, and then you're able to find a 讞讜诪专讗, which is 讬砖 讘讜 专讜讞 讞讬讬诐 over the third, over 讘讜专. While if the 诪砖谞讛 would have started with 砖讜专 讜讘讜专, then we wouldn't be able to say this 讞讜诪专讗 of 专讜讞 讞讬讬诐 in 砖讜专 讜讘讜专 over the third, which would have been 诪讘注讛. Another reason 专砖状讬 gives is that the 诪砖谞讛 is trying to tell us a 专讘讜转讗, a 讞讬讚讜砖, that even though 砖讜专 and 诪讘注讛 both have a 讞讜诪专讗 of 专讜讞 讞讬讬诐, nevertheless, we wouldn't have known one from the other. If the 诪砖谞讛 would start by saying that we cannot learn out 砖讜专 from 讘讜专, or 讘讜专 from 砖讜专, it wouldn't be such a big 讞讬讚讜砖, because they're two separate categories. 砖讜专 is something which is alive, and 讘讜专 is something which has no life. But the 诪砖谞讛 is trying to tell us that even though 砖讜专 and 诪讘注讛 both have a 专讜讞 讞讬讬诐, nevertheless, the 转讜专讛 must tell us both, because if it would just say one, we wouldn't know the other because of the 讞讜诪专讗 that which each one of these two has. And now we'll continue with the 讙诪专讗: 诪讚拽转谞讬 讗讘讜转 诪讻诇诇 讚讗讬讻讗 转讜诇讚讜转, since you called them 讗讘讜转, which means fathers, that shows that there are children. If there wouldn't be any derivatives from these categories, you couldn't call them 讗讘讜转. A father means that he has a child. So since the 诪砖谞讛 refers to these four that they are fathers, which means they are general categories, obviously they are there are other kinds of damages which would be derived and they would be considered 转讜诇讚讜转, children of these categories. So before the 讙诪专讗 even goes in to explain which are the 转讜诇讚讜转 of these 讗讘讜转, the 讙诪专讗 has a general question: 转讜诇讚讜转讬讛谉 讻讬讜爪讗 讘讛谉 讗讜 诇讗讜 讻讬讜爪讗 讘讛谉? The 转讜诇讚讜转 that will be derived from these 讗讘讜转, will they be like the 讗讘讜转 or not, which means will they have the same 讚讬谉 like the 讗讘讜转? And the 讙诪专讗 explains why there is a question, because we find other places in 砖状住 where we also have 讗讘讜转 and 转讜诇讚讜转. And in some places the 转讜诇讚讜转 have the same 讚讬谉 as the 讗讘讜转. In some places the 转讜诇讚讜转 do not have the same 讚讬谉 as the 讗讘讜转. And therefore the 讙诪专讗 wants to know what about the 转讜诇讚讜转 of the 讗讘讜转 谞讝讬拽讬谉? And it says: 讙讘讬 砖讘转 转谞谉, concerning 砖讘转 we learned, 讗讘讜转 诪诇讗讻讜转 讗专讘注讬诐 讞住专 讗讞转. There are forty minus one, which means thirty-nine 讗讘讜转 诪诇讗讻讜转, thirty-nine 讗讘讜转 categories of 诪诇讗讻讜转 that you're not allowed to do on 砖讘转. And there we have the same 讚讬讜拽: 讗讘讜转 诪讻诇诇 讚讗讬讻讗 转讜诇讚讜转, that since we call them 讗讘讜转, that shows there are 转讜诇讚讜转, which means there are other 诪诇讗讻讜转 which are derived from these thirty-nine categories. And over there the 讚讬谉 is: 转讜诇讚讜转讬讛谉 讻讬讜爪讗 讘讛谉, that the 转讜诇讚讜转 have the same 讚讬谉 as the fathers, as the 讗讘讜转. In other words, 诇讗 砖谞讗 讗讘 讞讟讗转 讜诇讗 砖谞讗 转讜诇讚讛 讞讟讗转. There's no difference whether you do an 讗讘, you're 讞讬讬讘 a 讞讟讗转, or if you do a 转讜诇讚讛 you're 讞讬讬讘 a 讞讟讗转. The 讚讬谉 by 砖讘转 is that if you do a 诪诇讗讻讛 of 砖讘转, and you do it unintentionally, you do it 讘砖讜讙讙, you have to bring a 拽专讘谉 讞讟讗转. If you do it 讘诪讝讬讚, then if there are witnesses and you are warned, you would get death penalty, you get killed. So the 讚讬谉 is that whether you do an 讗讘 of the 诪诇讗讻讜转, if you do it unintentionally you bring a 讞讟讗转, the same 讚讬谉 applies to a 转讜诇讚讛, if you do a 转讜诇讚讛 unintentionally you bring a 讞讟讗转. And the same thing: 诇讗 砖谞讗 讗讘 住拽讬诇讛 讜诇讗 砖谞讗 转讜诇讚讛 住拽讬诇讛. Makes no difference whether you do an 讗讘 intentionally you get killed, the same applies to a 转讜诇讚讛, if you do it intentionally you get killed. So here we see that the 转讜诇讚讜转 have the same 讚讬谉 as the 讗讘讜转. But then the 讙诪专讗 asks: 讜诪讗讬 讗讬讻讗 讘讬谉 讗讘 诇转讜诇讚讛? So what is the difference between an 讗讘 and a 转讜诇讚讛? Why is this called an 讗讘 and this called a 转讜诇讚讛 if they have the same 讚讬谉? And the 讙诪专讗 says: 谞驻拽讗 诪讬谞讛, the difference would be, 讚讗讬 注讘讬讚 砖转讬 讗讘讜转 讘讛讚讬 讛讚讚讬, if a person would do two 讗讘讜转 together, for instance if he would cook on 砖讘转 and make a fire, which are two 讗讘讜转, 讗讬 谞诪讬 砖转讬 转讜诇讚讜转 讘讛讚讬 讛讚讚讬, if he would do, or if he would do two 转讜诇讚讜转 together, 诪讞讬讬讘 讗讻诇 讞讚讗 讜讞讚讗, he would be 讞讬讬讘 for every one. If he would do two separate 转讜诇讚讜转 from two separate 讗讘讜转, then he would be 讞讬讬讘 for each one a 拽专讘谉 讞讟讗转. 讚讗讬 注讘讬讚 讗讘 讜转讜诇讚讛 讚讬讚讬讛, but if he would do an 讗讘 and its own 转讜诇讚讛, he would do the principal 诪诇讗讻讛 and he would do also at the same time another 诪诇讗讻讛 which is in the same category, which is a 转讜诇讚讛 of that 讗讘, 诇讗 诪讞讬讬讘 讗诇讗 讞讚讗, then he'd only be 讞讬讬讘 one. So here we see a difference between an 讗讘 and a 转讜诇讚讛. If that 转讜诇讚讛 would not be considered a 转讜诇讚讛 of this 讗讘, but if that 转讜诇讚讛 would be considered as a separate 讗讘, so then he would be 讞讬讬讘 two. And therefore we call it a 转讜诇讚讛, that if he does that 转讜诇讚讛 with its own 讗讘, you are only 讞讬讬讘 one. And the 讙诪专讗 asks: 讜诇专讘讬 讗诇讬注讝专 讚诪讞讬讬讘 讗转讜诇讚讛 讘诪拽讜诐 讗讘, according to 专讘讬 讗诇讬注讝专 who holds that if you do a 转讜诇讚讛 together with its own 讗讘, you are 讞讬讬讘 for both, 讗诪讗讬 拽专讬 诇讬讛 讗讘 讜讗诪讗讬 拽专讬 诇讬讛 转讜诇讚讛? So according to him, why is one 诪诇讗讻讛 called an 讗讘 and why is another one called a 转讜诇讚讛? Even if you would do the 讗讘 with its 转讜诇讚讛 you would be 讞讬讬讘 two. In other words, the 转讜诇讚讛 would be considered like a separate thing altogether. So why call it a 转讜诇讚讛? And the 讙诪专讗 answers: 讛讗 讚讛讜讛 讘诪砖讻谉 讞砖讬讘讗 拽专讬 诇讬讛 讗讘. Whatever was in the 诪砖讻谉 important is called an 讗讘. 讛讗 讚诇讗 讛讜讛 讘诪砖讻谉 讞砖讬讘讗 拽专讬 诇讬讛 转讜诇讚讛. Whatever was not considered a 讞砖讜讘 an important 诪诇讗讻讛 in the 诪砖讻谉 is called a 转讜诇讚讛. Because as we know, the 39 诪诇讗讻讜转 are learned out from the 诪砖讻谉. The 转讜专讛 just says 诇讗 转注砖讛 讻诇 诪诇讗讻讛, like you're not allowed to do a 诪诇讗讻讛 on 砖讘转. You're not allowed to do a work. Now, what is considered work, the 转讜专讛 doesn't say. But since the 转讜专讛 tells us the 讚讬谉 of 砖讘转 very close to the 讚讬谞讬诐 of the 诪砖讻谉, so we learn out that whatever was considered a 诪诇讗讻讛 in the 诪砖讻谉 is considered a 诪诇讗讻讛 concerning 砖讘转. And that's what 专讘讬 讗诇注讝专 is saying, that any 诪诇讗讻讛 that was considered an important 诪诇讗讻讛 by the making of the 诪砖讻谉 is called an 讗讘. Whatever was not considered an important 诪诇讗讻讛 by the making of the 诪砖讻谉 is considered a 转讜诇讚讛. And therefore, we call one 讗讘 and one 转讜诇讚讛 even though the 转讜诇讚讛 has its own 讚讬谉 that even if you do it together with its 讗讘, you are 讞讬讬讘. But one thing we do see from all this, that a 转讜诇讚讛 has the same 讚讬谉 as an 讗讘, which means 转讜诇讚讜转讬讛谉 讻讬讜爪讗 讘讛谉. But 讙讘讬 讟讜诪讗讛 转谞谉, concerning the 讚讬谉 of 讟讜诪讗讛 of impurity, it says 讗讘讜转 讛讟讜诪讗讜转. We learn in the 诪砖谞讛 that we have 讗讘讜转 讛讟讜诪讗讜转, principal categories of 讟讜诪讗讛, which is a 砖专抓, certain type of reptiles, there are 砖诪讜谞讛 砖专爪讬诐, eight kinds of 砖专爪讬诐 which if you touch them when they're dead, then you become 讟诪讗, and you become an 讗讘 讛讟讜诪讗讛, you have a 讚讬谉 of a father of 讟讜诪讗讛 we could call it, 讜砖讻讘转 讝专注, and the semen that comes out of a person is also considered 讗讘 讛讟讜诪讗讛, 讜讟诪讗 诪转 or a person who touched a dead body, so that person is also an 讗讘 讛讟讜诪讗讛. And then we have 转讜诇讚讜转. Anything that this 讗讘, this person who became an 讗讘 will touch, will be considered a 转讜诇讚讛, it will be considered a child, a derivative of the original 讟讜诪讗讛. So there the 讚讬谉 is 转讜诇讚讜转讬讛谉 诇讗讜 讻讬讜爪讗 讘讛谉, that the 转讜诇讚讜转 of the 讟讜诪讗讛 do not have the same 讚讬谉 as the 讗讘讜转. 讚讗讬诇讜 讗讘, because some, a person who is an 讗讘 讛讟讜诪讗讛, 诪讟诪讗 讗讚诐 讜讻诇讬诐, if he will touch another person, or he will touch a vessel, he will make that 讟诪讗. 讜讗讬诇讜 转讜诇讚讜转, but a 转讜诇讚讛, 讗讜讻诇 讜诪砖拽讛 诪讟诪讗, it could only make 讟诪讗 food or liquid, 讗讚诐 讜讻诇讬诐 诇讗 诪讟诪讗, but if a 转讜诇讚讛, which is a derivative of the 讗讘, if that will touch a person, or touch a vessel, will not make it 讟诪讗. So here we see that we also have 讗讘讜转 and 转讜诇讚讜转, and nevertheless, the 转讜诇讚讜转 have a different 讚讬谉 than the 讗讘讜转. So the question is, 讛讻讗 诪讗讬? Here, what is the 讚讬谉 concerning 讗讘讜转 and 转讜诇讚讜转 of 谞讝讬拽讬谉? What is the 讚讬谉? Are the 转讜诇讚讜转 of the 谞讝讬拽讬谉, those kinds of damages that are caused by a different way, not one of these four, but they are 转讜诇讚讜转 of these four, would they have the same 讚讬谉 as the 讗讘讜转? We find some which have the same 讚讬谉 as the 讗讘讜转, and we find some which do not have the same 讚讬谉 as the 讗讘讜转. And at the end, the 讙诪专讗 will come out that there is only one case of a 转讜诇讚讛 which does not have the same 讚讬谉 as the 讗讘. But the rest of the 转讜诇讚讜转 of 谞讝讬拽讬谉 have the exact same 讚讬谉 as their 讗讘. And now the 讙诪专讗 is going to go into trying to figure out which ones are the ones that do not have the same 讚讬谉 as the 讗讘. And the 讙诪专讗 starts: 转谞讜 专讘谞谉, the 专讘谞谉 learned: 讙' 讗讘讜转 谞讗诪专讜 讘砖讜专, we find concerning an ox that it's in the ox itself we find three categories of 谞讝讬拽讬谉: 讛拽专谉, the horn, 讜讛砖谉, and the tooth, 讜讛专讙诇, and the foot. And the 讙诪专讗 goes to explain, where do we see in the 转讜专讛 these different categories? 拽专谉 诪谞诇谉? Where do we know that there is a kind of damage that is caused through a 拽专谉, through a horn? 讚转谞讜 专讘谞谉, because the 专讘谞谉 learned, it says in the 转讜专讛 讻讬 讬讙讞, if an ox will gore, and we know that 讗讬谉 谞讙讬讞讛 讗诇讗 讘拽专谉, that goring, whenever it says in the 转讜专讛 the expression 谞讙讬讞讛, which means goring, only means if it was done through a horn. So therefore, since the 转讜专讛 tells us that if a 砖讜专 was 谞讜讙讞, gored, you have to pay, so here we see that if the damage was done through a horn, you have to pay. But how do we know that when the 转讜专讛 says 讬讙讞, 谞讙讬讞讛, goring, it means through a horn? So the 讙诪专讗 brings a 驻住讜拽, 砖谞讗诪专, it says in 转谞''讱, in 诪诇讻讬诐 it says, 讜讬注砖 诇讜 爪讚拽讬讛 讘谉 讻谞注谞讛 拽专谞讬 讘专讝诇, that 爪讚拽讬讛 讘谉 讻谞注谞讛 made for him metal horns, 讜讬讗诪专, and he said, 讻讛 讗诪专 讛', this is what 讛' said, 讘讗诇讛 转谞讙讞 讗转 讗专诐 讜讙讜诪专, with these you you are going to gore 讗专诐. So we see there that the 转讜专讛 uses the 诇砖讜谉 转谞讙讞, you will gore, and it says clearly it will be done through 拽专谞讬 讘专讝诇, through metal horns. So here we see that 谞讙讬讞讛, whenever it says the expression 谞讙讬讞讛, it means through a horn. 讜讗讜诪专, and there's another 驻住讜拽 that will also prove that whenever it says 谞讙讬讞讛, it means with a horn, because the 驻住讜拽 says: 讘讻讜专 砖讜专讜 讛讚专 诇讜, 拽专谞讬 专讗诐 拽专谞讬讜 讘讛诐 注诪讬诐 讬谞讙讞. It's a 驻住讜拽 in 讘专讻讛, it is the 讘专讻讛 given by 诪砖讛 专讘讬谞讜 to 砖讘讟 讬讜住祝, and he says that 讘讻讜专 砖讜专讜 讛讚专 诇讜, which means that it was given to him the strength of an ox, to 讬讜住祝, who was the king like a 讘讻讜专, 讜拽专谞讬 专讗诐 拽专谞讬讜, and nevertheless his horns look like the horns of a 专讗诐, and with these horns he is going to gore the different nations. So here too we see that the 转讜专讛 uses the expression 讬谞讙讞, goring, and it says with what will he gore? With 拽专谞讬 专讗诐 拽专谞讬讜, with the horns. Then the 讙诪专讗 asks: 诪讗讬 讜讗讜诪专? Why do we have to have that second 驻住讜拽? Why isn't the first 专讗讬讛, the first proof from the first 驻住讜拽 enough? But the 讙诪专讗 answers: 讜讻讬 转讬诪讗, because I would have thought 讚讘专讬 转讜专讛 诪讚讘专讬 拽讘诇讛 诇讗 讬诇驻讬谞谉, that we cannot learn out the words of 转讜专讛 from the words of 谞讘讬讗讬诐. 谞讘讬讗讬诐 are referred to as 讚讘专讬 拽讘诇讛, and we have a rule that we cannot learn out any 讚讬谞讬诐 from the words of the 谞讘讬讗讬诐. And therefore, here too we would think that how can we learn out that when the 转讜专讛 says 讻讬 讬讙讞 it means with a horn, because in 转谞状讱, by the 谞讘讬讗讬诐 we find that they use an expression of 谞讙讬讞讛 and it meant through a horn? So therefore 转讗 砖诪注, therefore we have to come and bring the other 驻住讜拽, 讘讻讜专 砖讜专讜 讛讚专 诇讜, and in that 驻住讜拽, which is a 驻住讜拽 in 转讜专讛, we also see that we use the term 谞讙讬讞讛 for a horn. Then the 讙诪专讗 asks: 讜讛讗 诪讬诇讬祝 讛讜讗? Is this something that you're learning out? 讙讬诇讜讬 诪讬诇转讗 讘注诇诪讗 讛讜讗, it is only revealing something, 讚谞讙讬讞讛 讘拽专谉 讛讜讗, that 谞讙讬讞讛 means with a horn. In other words, this 讚讬谉 that you cannot learn out anything from 讚讘专讬 拽讘诇讛, from 谞讘讬讗讬诐, is only if we're going to learn out a 讚讬谉. But here we're not learning out a 讚讬谉, we're just learning out the translation of the word. And that you could learn out from 讚讘专讬 拽讘诇讛, from 谞讘讬讗讬诐. So we cannot say the reason why the first 驻住讜拽 was not sufficient because it's 讚讘专讬 拽讘诇讛, because that would have been sufficient. And therefore the 讙诪专讗 answers: 讗诇讗, but the reason why we need a second 驻住讜拽 is because 诪讛讜 讚转讬诪讗, I would think, if we'd only have the first 驻住讜拽, I would think 讻讬 驻诇讬讙 专讞诪谞讗 讘讬谉 转诐 诇诪讜注讚, when did the 转讜专讛 make a difference between 转诐 and a 诪讜注讚, that a 转诐 pays half of the 谞讝拽, and a 诪讜注讚 pays 谞讝拽 砖诇诐, the complete 谞讝拽? 讛谞讬 诪讬诇讬 讘转诇讜砖讛, that's only if the horn was not connected, not connected to the animal. 讗讘诇 讘诪讞讜讘专转, but if the horn was connected, 讗讬诪讗, I would think, 讻讜诇讛 诪讜注讚转 讛讬讗, then it is always considered a 诪讜注讚, and you have to pay the complete 谞讝拽. 转讗 砖诪注, therefore we have to have the second 驻住讜拽, 讘讻讜专 砖讜专讜 讛讚专 诇讜 讜讙讜诪专, and from that 驻住讜拽 we know that even if the horn is connected, there is still a 讚讬谉 of 拽专谉 that you only pay 讞爪讬 谞讝拽 while he's a 转诐. In other words, like this: when the 转讜专讛 says 讻讬 讬讙讞, the 转讜专讛 continues saying that when the animal gores, then the 讚讬谉 is that if it happened the first few times you only pay half of the 谞讝拽, if it happened later on you pay 谞讝拽 砖诇诐. Now if we would learn out that this 谞讙讬讞讛 means with a horn from the first 驻住讜拽 in 转谞状讱, there it speaks about 拽专谞讬 讘专讝诇, which means a metal horn, so I would think that the 讻讬 讬讙讞 that the 转讜专讛 speaks about the 砖讜专 is also in a
similar way, which means that if the ox took a horn in its mouth and gored and damaged, then the whole 驻专砖讛 applies. And what does it say in the 驻专砖讛? That if it happened the first few times you pay 讞爪讬 谞讝拽, half of the 谞讝拽, if it happened as a 诪讜注讚, you pay 谞讝拽 砖诇诐. So we would think that this whole 讚讬谉 that makes a difference between 讞爪讬 谞讝拽 and 谞讝拽 砖诇诐 is only if it was done through a 谞讙讬讞讛 with a 拽专谉 that was 转诇讜砖讛, was not connected, just like the 谞讙讬讞讛 that the 转讜专讛 refers to in the 谞讘讬讗讬诐. But if it was done through a horn which is connected to the head, since we wouldn't feel that that's what the 驻专砖讛 speaks about, we wouldn't know that in that case too there is a difference between 转诐 and 诪讜注讚. And what would we say? That if it was done by the horn that's connected to the ox, you always pay 谞讝拽 砖诇诐, the complete damage. So therefore we have to have the second 驻住讜拽, where that there the 转讜专讛 mentions the horn that is connected to the ox, and we say that from there we know that when it says 讻讬 讬讙讞 it means with a horn. So obviously the 驻专砖讛 that deals with the 讻讬 讬讙讞 speaks also about a horn that is connected to the head, so we know that even if it was a horn connected to the head, the 讚讬谞讬诐 of the 驻专砖讛 apply, and then too there is a difference between a 转诐 and a 诪讜注讚, that if it's a 转诐 it pays half of the 谞讝拽, and if it's a 诪讜注讚 you pay 谞讝拽 砖诇诐. Then the
讙诪专讗 continues: 转讜诇讚讛 讚拽专谉 诪讗讬 讛讬讗? What are the 转讜诇讚讜转 of 拽专谉? We said before that all the 讗讘讜转 谞讝讬拽讬谉 have 转讜诇讚讜转, have derivatives. Now what 讚讬谉, what kind of damage do we derive from 拽专谉? The 讙诪专讗 says: 谞讙讬驻讛, which means collision, 谞砖讬讻讛, biting, 专讘讬爪讛, laying down if it lays down on something with force and breaks it, 讜讘注讬讟讛 if it kicks. All these type of damages are all in the category of 拽专谉, they are 转讜诇讚讜转 of 拽专谉. But the 讙诪专讗 asks: 诪讗讬 砖谞讗 谞讙讬讞讛 讚拽专讬 诇讬讛 讗讘? Why do we call 谞讙讬讞讛, when you gore with the horn, we say that's the 讗讘? Because 讚讻转讬讘 in the 转讜专讛 it says 讻讬 讬讙讞. And as we said in the beginning, that if it's mentioned specifically in the 转讜专讛, that is considered an 讗讘. 谞讙讬驻讛 谞诪讬 讻转讬讘. The 谞讙讬驻讛, which is the collision, also says clearly in the 转讜专讛. The 转讜专讛 says in 诪砖驻讟讬诐: 讻讬 讬讙讜祝, if it says if the ox will collide into another ox, so the 讚讬谉 is you have to pay. So we see the 转讜专讛 specifically speaks about 谞讙讬驻讛. So why did we say before that 谞讙讬驻讛 is only a 转讜诇讚讛 of 谞讙讬讞讛, of 拽专谉? So the 讙诪专讗 answers: 讛讗讬 谞讙讬驻讛 谞讙讬讞讛 讛讬讗, that in that 驻住讜拽 where the 转讜专讛 says 讻讬 讬讙讜祝, it does not mean it will collide with its body, but it means it will do it with its horn. So really 谞讙讬驻讛 over there is not the 谞讙讬驻讛 what we are talking about as a 转讜诇讚讛. When we say 谞讙讬驻讛 is a 转讜诇讚讛, that's if it collides with the body. When the 转讜专讛 says 讻讬 讬讙讜祝, if an ox will make 谞讙讬驻讛 into another ox you have to pay, that really means 谞讙讬讞讛 done with the horn. How do we know that? 讚转谞讬讗, because we learn in a 讘专讬讬转讗: 驻转讞 讘谞讙讬驻讛 讜住讬讬诐 讘谞讙讬讞讛. That same 驻住讜拽 starts using with, using the word 谞讙讬驻讛, and finishes with using the word 谞讙讬讞讛. This refers to the 驻住讜拽 in 诪砖驻讟讬诐 讻状讗, 驻住讜拽 诇状讛 and 诇状讜. There the 转讜专讛 says: 讜讻讬 讬讙祝 砖讜专 讗讬砖 讗转 砖讜专 专注讛讜 讜诪转, if an ox belonging to a person will collide into an ox that belongs to his friend and it will die, so the 驻住讜拽 says: 讜诪讻专讜 讗转 讛砖讜专 讛讞讬, you have to sell the live one, etcetera. And the next 驻住讜拽 starts: 讗讜 谞讜讚注 讻讬 砖讜专 谞讙讞 讛讜讗, if it would be known that this is an ox that gores, 诪转诪讜诇 砖诇砖讜诐, from the day before and the day even before that, so then you have to pay. But we see here that the 转讜专讛 starts off by saying 讜讻讬 讬讙讜祝 砖讜专 讗讬砖 讗转 砖讜专 专注讛讜, so we're talking about 谞讙讬驻讛, and the next 驻住讜拽 says, but if it would be known that he is a 砖讜专 谞讙讞. Now, if 谞讙讬驻讛 here would mean the regular 谞讙讬驻讛, that it pushes with the body, it collides with the body, then the 转讜专讛 should have continued: 讗讜 谞讜讚注 讻讬 砖讜专 谞讙祝 讛讜讗, the same expression as in the beginning. But that's not what the 转讜专讛 does. The 转讜专讛 says: 讗讜 谞讜讚注 讻讬 砖讜专 谞讙讞 讛讜讗. So this 转讜专讛 starts with the word 谞讙讬驻讛 and finishes with the word 谞讙讬讞讛. So why is that? 诇讜诪专 诇讱, to tell you: 讝讜 讛讬讗 谞讙讬驻讛, 讝讜 讛讬讗 谞讙讬讞讛, that 谞讙讬驻讛 and 谞讙讬讞讛 are the same thing, that here when the 转讜专讛 uses the term 谞讙讬驻讛, it is the same as 谞讙讬讞讛, really it means goring with the horn. But then the 讙诪专讗 asks: 诪讗讬 砖谞讗 讙讘讬 讗讚诐 讚讻转讬讘 讻讬 讬讙讞? What is the difference, why, when the 转讜专讛 speaks about an animal, an ox, goring a person, the 转讜专讛 uses the term 讻讬 讬讙讞? And that is in 驻住讜拽 讻状讞, it says: 讜讻讬 讬讙讞 砖讜专 讗转 讗讬砖 讗讜 讗转 讗砖讛 讜诪转, if an ox will gore a man or a woman and he will die, so there the 转讜专讛 uses the word 讻讬 讬讙讞. 讜诪讗讬 砖谞讗, what is the difference, 讙讘讬 讘讛诪讛 讚讻转讬讘 讻讬 讬讙讜祝? Why is it when the 转讜专讛 speaks about an ox goring an animal, it uses the term 讻讬 讬讙讜祝? Because this 驻住讜拽, 讻讬 讬讙讜祝, speaks about an ox goring another ox. So why does the 转讜专讛 use here the expression 讻讬 讬讙讜祝? And the
讙诪专讗 answers: 讗讚诐 讚讗讬转 诇讬讛 诪讝诇讗, 讻转讬讘 讻讬 讬讙讞. A person that has a 诪讝诇, which could mean either a 诪讝诇, a 诪诇讗讱 which is in control of the person, or a 诪讝诇 means that a person has 讚注转, has 砖讻诇, to watch himself, but whatever it should mean, a person has that, so therefore it says 讻讬 讬讙讞, because the word 讻讬 讬讙讞 has meaning, means more that it was done with a strong intention of the animal. So by a person who is able to watch himself, or there is a 诪诇讗讱, a 诪讝诇 that's watching over him, so there, in order for the ox to gore the person, it has to have a stronger effort, so therefore the 转讜专讛 uses the term 讻讬 讬讙讞. But 讘讛诪讛 讚诇讬转 诇讛 诪讝诇讗, a 讘讛诪讛 has no 诪讝诇, so therefore 讻转讬讘 讻讬 讬讙讜祝. There it uses the term 讻讬 讬讙讜祝, because 讬讙讜祝 shows less effort on the side of the ox to gore, because an animal cannot watch itself, or the 诪讝诇 does not watch over it, and therefore it takes less effort in the ox to damage the other ox, to gore the other ox, therefore it uses a lighter term. But the purpose of that is, what difference does it make to us? Why does the 转讜专讛 have to tell us that, that it's easier for an ox to gore another ox than it is for an ox to gore a person.
That when a an ox is it becomes a 诪讜注讚 in goring a person, automatically it is considered an a 诪讜注讚 in goring a 讘讛诪讛. But if it's a 诪讜注讚 in goring a 讘讛诪讛, it doesn't necessarily mean it's a 诪讜注讚 in goring an 讗讚诐. Which means as follows: a 诪讜注讚, as we said before, means an ox that did it three times. And the 讚讬谉 is that if a an ox became a 诪讜注讚 in goring a specific thing, so we consider this ox a 诪讜注讚 only concerning that that it became a 诪讜注讚 in. But if it will gore something else that it didn't gore before, so concerning that something else, it will be considered a 转诐. But it's self-understood that that is only if the other thing it will gore is something that is harder for the animal to do than the previous ones. But if it will gore later on something that is lighter for it to do, and it became a 诪讜注讚 for the harder one, so then automatically it is a 诪讜注讚 for the lighter one. And that's what the 转讜专讛 is trying to tell us. It is harder for an animal to gore a person than to gore an animal. And therefore, if an animal gored a person three times, it became a 诪讜注讚 for the person, and therefore, if it'll gore a fourth time a person, it'll be considered a 诪讜注讚. So the 转讜专讛 is telling us that even if the fourth time it will gore an animal, it'll also be considered a 诪讜注讚. Because even though it didn't gore an animal before, but since it gored a person, which is harder, it definitely is a 诪讜注讚 for the animal, which is easier. On the other hand, if it became a 诪讜注讚 to goring an animal three times, and then it will gore a person, it will not have a 讚讬谉 of a 诪讜注讚, because it is harder to gore a person, so therefore it did not become a 诪讜注讚 for the person. And that's what the 转讜专讛 is trying to tell us. By the 转讜专讛 saying that it's harder to gore a person than an animal, because the 转讜专讛 uses the word 讻讬 讬讙讞 by a person and by an animal the word 讻讬 讬讙讜祝, it's to teach us that if an animal becomes a 诪讜注讚 for a 讗讚诐, it automatically is a 诪讜注讚 for a 讘讛诪讛. If it becomes a 诪讜注讚 for a 讘讛诪讛, it doesn't automatically become a 诪讜注讚 for an 讗讚诐. Then the 讙诪专讗 continues, 谞砖讬讻讛 转讜诇讚讛 讚砖谉 讛讬讗.
One of the 转讜诇讚讜转 you mentioned of 拽专谉 was biting, shouldn't biting be a 转讜诇讚讛 of tooth because you bite with your teeth? And the 讙诪专讗 answers, 诇讗, no. 砖谉 讬砖 讛谞讗讛 诇讛讬讝拽讗, the category of 砖谉 is when it does a damage that it has benefit from. 讛讗, but this one, when it bites, 讗讬谉 讛谞讗讛 诇讛讬讝拽讗, it has no benefit from its damage. In other words, 砖谉 is when it eats something. 谞砖讬讻讛, that is a 转讜诇讚讛 of 拽专谉, is when it bites something and doesn't eat it, so there is no pleasure it gains, and therefore it is a 转讜诇讚讛 of 拽专谉. Then the 讙诪专讗 continues, we mentioned among the 转讜诇讚讜转 of 拽专谉, 专讘讬爪讛 讜讘注讬讟讛, if it lays down or if it kicks, so the 讙诪专讗 asks, 转讜诇讚讛 讚专讙诇 讛讬讗, shouldn't it be a 转讜诇讚讛 of 专讙诇 because the damage caused through laying down or through kicking is with the foot? And the 讙诪专讗 says, 诇讗, no. 专讙诇, the characteristic of the category of 专讙诇 is 讛讝讬拽讗 诪爪讜讬, it's a damage that is common, because when a animal walks, it'll break anything that's under its foot, so that is a common thing. But 讛谞讬, these, the damage that is caused through laying down with force or that is caused through kicking, 讗讬谉 讛讝讬拽讗 诪爪讜讬, it is not a common damage, and therefore it cannot be included in the category of 专讙诇. But it is included in the category of 拽专谉, because as we said before, the category of 拽专谉 is 讻讜讜谞转讜 诇讛讝讬拽, if it does anything that intentions it's is to be 诪讝讬拽. And the same here, when it lays down on something or when it kicks something, it intends to be 诪讝讬拽, and therefore it is in the category of 拽专谉. So now the 讙诪专讗
asks, 讗诇讗 转讜诇讚讜转讬讛谉 诇讗讜 讻讬讜爪讗 讘讛谉 讚讗诪专 专讘 驻驻讗 讗讛讬讬, what 专讘 驻驻讗 said, that there are certain 转讜诇讚讜转 of certain 讗讘讜转 which do not have the same 讚讬谉 as the 讗讘, concerning which 转讜诇讚讜转 of which 讗讘讜转 did he mean? 讗讬诇讬诪讗 讗讛谞讬, if you're going to say on these, the 转讜诇讚讜转 of 拽专谉 that we have just mentioned, those are the ones that do not have the same 讚讬谉 as 拽专谉, so the 讙诪专讗 says it couldn't be, because 诪讗讬 砖谞讗, what is the difference between these and 拽专谉? Why should there be a difference between the 转讜诇讚讜转 of 拽专谉 and 拽专谉 itself? In other words, they are exactly like their 讗讘, and therefore there is no reason why they should be different. 拽专谉, 诪讗讬 砖谞讗 拽专谉, why should 拽专谉 be different? 讚讻讜讜谞转讜 诇讛讝讬拽, the characteristic of 拽专谉 is that you have a 讻讜讜谞讛 to be 诪讝讬拽, the animal intends to cause the damage. And also 诪诪讜谞讱, it is your 诪诪讜谉, since it belongs to you, that's why you are responsible to pay. 讜砖诪讬专转讜 注诇讬讱, and you are obligated to watch it, it's under your control, and therefore you should watch it. And that is the reason why there is a 讚讬谉 that you must pay for their damage. 讛谞讬 谞诪讬, these 转讜诇讚讜转 of 拽专谉, also 讻讜讜谞转谉 诇讛讝讬拽, they are done in a way that animal intends to be 诪讝讬拽, 讜诪诪讜谞讱, and they are your money, they belong to you, 讜砖诪讬专转谉 注诇讬讱, and you are obligated to watch them. And therefore, you should be obligated to pay the same way you are obligated to pay for 拽专谉. So there is no reason to think that the 转讜诇讚讜转 of 拽专谉 should have a different 讚讬谉 than the 拽专谉 itself. So therefore, it makes no sense to say that when 专讘 驻驻讗 said that certain 转讜诇讚讜转 do not have the same 讚讬谉 as the 讗讘讜转, he referred to the 转讜诇讚讜转 of 拽专谉. And therefore, we're back to the question that which 转讜诇讚讜转 did 专讘 驻驻讗 mean when he said that they do not have the same 讚讬谉 as the 讗讘讜转?
One interesting thing to bring out here is concerning the 诪砖谞讛. The 诪砖谞讛 was looking for a reason why the 驻住讜拽 had to mention all the different 讗讘讜转, why wouldn't it have been enough if it would mention one and we would learn out the other ones from this one? We would say that just like this one, if you cause a damage, you are 讞讬讬讘 to pay, so if you cause a damage any other way, you'd also be 讞讬讬讘 to pay. But the question is, we know 讗讬谉 注讜谞砖讬谉 诪谉 讛讚讬谉, that you cannot punish a person based on a 讚讬谉, which meant on a 拽诇 讜讞讜诪专. For instance, if the 转讜专讛 says something and if you do a certain 注讘讬专讛, you will get punished, now we cannot use that as a source to punish somebody for doing a worse 注讘讬专讛. Even though 注诇 驻讬 砖讻诇 it would make sense to say that if for this smaller 注讘讬专讛 the punishment is so-and-so, if you do the same 注讘讬专讛, but in a much stricter form, you certainly should be 讞讬讬讘. Nevertheless, the 讚讬谉 is that 讗讬谉 注讜谞砖讬谉 诪谉 讛讚讬谉. You cannot punish based on a 讚讬谉, on a 拽诇 讜讞讜诪专, or any other 诇讬诪讜讚 that we would learn out. So according to that, what is the question of the 诪砖谞讛? How could the 诪砖谞讛 say that if the 转讜专讛 would just say the 讚讬谉 by one of the 讗讘讜转, we would know the rest, we would learn it out with a 诇讬诪讜讚 from the first one. But since 讗讬谉 注讜谞砖讬谉 诪谉 讛讚讬谉, you cannot learn out a punishment from a 诇讬诪讜讚, from a 讚讬谉. So we would not have learned out from the one that the 转讜专讛 would say, and therefore the 转讜专讛 has to say all of them. So what is the question of the 诪砖谞讛? So 转讜住驻讜转 says, from here we see that when it comes to 诪诪讜谉, 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉. That if it's a question of money, not other kind of punishment, but it's a question of paying money, so this rule of 讗讬谉 注讜谞砖讬谉 诪谉 讛讚讬谉 does not apply. And therefore, if the 转讜专讛 would say it concerning one 讚讬谉, concerning one of the 讗讘讜转, we would on our own learn it out concerning the other 讗讘讜转, and we would make him pay even if he would do the damage in another way, because we do say 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉. But 转讜住驻讜转 brings that it seems that this is a 诪讞诇讜拽转 between our 讙诪专讗 and the 诪讻讬诇转讗, because in the 诪讻讬诇转讗 we find that the 诪讻讬诇转讗 says clearly 讗讬谉 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉. And this is a 诪讻讬诇转讗 where it says concerning the 驻住讜拽 that we quoted in the beginning, concerning 讘讜专. It says in the 转讜专讛: 讻讬 讬驻转讞 讗讬砖 讘讜专 讗讜 讻讬 讬讻专讛 讗讬砖 讘讜专, if a person will open a 讘讜专, or if a person will dig a 讘讜专, and someone will fall in, an ox or a donkey, then you have to pay. So the 诪讻讬诇转讗 asks the question: why does the 转讜专讛 have to mention both opening a 讘讜专 or digging a 讘讜专? If the 转讜专讛 would just say if you open a 讘讜专, you're 讞讬讬讘, certainly if you actually were the one that dug the 讘讜专! So why does the 转讜专讛 have to tell us both? And the
诪讻讬诇转讗 answers: 诇诇诪讚讱 砖讗讬谉 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉, to teach us that you cannot punish even money based on a 讚讬谉, on a 拽诇 讜讞讜诪专. And therefore, if the 转讜专讛 would just say that you are 讞讬讬讘 for opening a 讘讜专, even though 注诇 驻讬 砖讻诇 it makes sense that certainly you should be 讞讬讬讘 if you dug the 讘讜专, still we wouldn't make the person 讞讬讬讘, because 讗讬谉 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉. So here we see that the 诪讻讬诇转讗 argues with our 诪砖谞讛. From our 诪砖谞讛 we see that 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉, while in the 诪讻讬诇转讗 we see that 讗讬谉 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉. And 转讜住驻讜转 goes ahead even further and says that concerning the same question the 诪讻讬诇转讗 asks and proved from there that 讗讬谉 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉, we find later on by us in the 讙诪专讗 that the 讙诪专讗 gives a different answer to that question. The 讙诪专讗 also asks the question: why does the 驻住讜拽 have to say 讻讬 讬驻转讞 and 讻讬 讬讻专讛? Wouldn't it be enough if the 转讜专讛 would say just 讻讬 讬驻转讞? And one of the answers given in the 讙诪专讗 is to teach us 诇讛讘讬讗 讛讻讜专讛 讗讞专 讛讻讜专讛, that is the first person dug, but he didn't dig it deep enough that the person who fell in should be able to get killed, and then the second person came and made another 讗诪讛 or dug it more, and through the 诪注砖讬诐 of the second person it became a 讘讜专 that could cause the damage or could have the person die, so then the second one is the one that's 讞讬讬讘, not the first. So we see that the 讙诪专讗 gave a different answer to the question than the 诪讻讬诇转讗, so this fits to what 转讜住驻讜转 said that our 讙诪专讗 does not hold of this 讻诇诇 讗讬谉 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉 like the 诪讻讬诇转讗, but our 讙诪专讗 and also our 诪砖谞讛 hold that 注讜谞砖讬谉 诪诪讜谉 诪谉 讛讚讬谉.
