Jewish Audio on Chabad.org. Today's ืฉื™ืขื•ืจ will be in ืžืกื›ืชื ื‘ื‘ื ืงืžื ื“ืฃ ื“, but we will start on ื“ืฃ ื’ ืขืžื•ื“ ื‘, 16 lines from the bottom of the ืขืžื•ื“, by the two dots, where the ื’ืžืจื quotes some of the words from the ืžืฉื ื”. The ื’ืžืจื quotes, ื”ืžื‘ืขื” ื•ื”ื”ื‘ืขืจ ื•ื›ื•ืœื™. The ื’ืžืจื quotes the last two ืื‘ื•ืช that were mentioned in the ืžืฉื ื”. One is ืžื‘ืขื”, and the other one is ื”ื‘ืขืจ. And the ื’ืžืจื says, ืžืื™ ืžื‘ืขื”? What does ืžื‘ืขื” mean? ืจื‘ ืืžืจ: ืžื‘ืขื” ื–ื” ืื“ื. ืจื‘ says ืžื‘ืขื” means a person, when a person himself causes damage. ื•ืฉืžื•ืืœ ืืžืจ: ืžื‘ืขื” ื–ื” ื”ืฉืŸ, that ืžื‘ืขื” refers to the tooth, that when an animal causes damage through eating through its tooth, that's the ืื‘ of ืžื‘ืขื”. The ื’ืžืจื explains: ืจื‘ ืืžืจ ืžื‘ืขื” ื–ื” ืื“ื, ืจื‘ says that ืžื‘ืขื” means the person, quotes a ืคืกื•ืง where the ืคืกื•ืง seems to indicate that this expression refers to a

Ravโ€™s Proof Using the Verse of the Watchman

person, ื“ื›ืชื™ื‘, because the ืคืกื•ืง says: ืืžืจ ืฉื•ืžืจ, the watchman said, ืืชื ื‘ื•ืงืจ ื•ื’ื ืœื™ืœื”, the morning came and also the night, ืื ืชื‘ืขื™ื•ืŸ ื‘ืขื™ื•, if you will ask your asking. And this refers to ื”ืฉื, he is referred to as the ืฉื•ืžืจ, and the ืฉื•ืžืจ, ื”ืฉื said, that the morning will come, which means there will be light for the ืฆื“ื™ืงื™ื, there will also be darkness for the ืจืฉืขื™ื, ืื ืชื‘ืขื™ื•ืŸ ื‘ืขื™ื•, which means if you will ask for ืžื—ื™ืœื”, for forgiveness, if you will do ืชืฉื•ื‘ื”. So here we see that the ืชื•ืจื” refers to a person, a person who is returning, who is doing ืชืฉื•ื‘ื”, and we use the expression ืื ืชื‘ืขื™ื•ืŸ ื‘ืขื™ื•, which is from the same root as the word ืžื‘ืขื”, and therefore ืจื‘ says that when the ืžืฉื ื” uses the word ืžื‘ืขื”, that it refers to a person. ื•ืฉืžื•ืืœ ืืžืจ, and ืฉืžื•ืืœ says ืžื‘ืขื” ื–ื” ื”ืฉืŸ, that ืžื‘ืขื” refers to the tooth, ื“ื›ืชื™ื‘, because there is a ืคืกื•ืง that says, ืื™ืš ื ื—ืคืฉื• ืขืฉื•, how is ืขืฉื• searched out, ื ื‘ืขื• ืžืฆืคื•ื ื™ื•, how are his hidden places sought out. So here we see the ืคืกื•ืง, that it uses the word ื ื‘ืขื•, which is from the same ืฉื•ืจืฉ, from the same root as ืžื‘ืขื”, and from this ืคืกื•ืง he wants to prove that ืžื‘ืขื” means the tooth. The

Gemara Asks for the Meaning of the Proof

ื’ืžืจื asks, ืžืื™ ืžืฉืžืข? How is it ืžืฉืžืข? How does this ืคืกื•ืง prove that ืžื‘ืขื” means the tooth? So the ื’ืžืจื says, ื›ื“ืžืชืจื’ื ืจื‘ ื™ื•ืกืฃ, like ืจื‘ ื™ื•ืกืฃ explained, translated, that the ืคืกื•ืง means, ืื™ื›ื“ื™ืŸ ืืชื‘ืœื™ืฉ ืขืฉื•, how was ืขืฉื• ransacked, ืืชื’ืœื™ื™ืŸ ืžื˜ืžืจื•ื”ื™, how were his hidden treasures exposed. So we see that ืจื‘ ื™ื•ืกืฃ translated the word ื ื‘ืขื• with the word ืืชื’ืœื™ื™ืŸ, which means revealed, and therefore refers to tooth, because a tooth is sometimes revealed and sometimes hidden, and therefore the ืžืฉื ื”, when it says the word ืžื‘ืขื”, which means revealed, refers to the tooth. The ื’ืžืจื asks now, ื•ืจื‘ ืžืื™ ื˜ืขืžื ืœื ืืžืจ ื›ืฉืžื•ืืœ? Why didn't ืจื‘ say like ืฉืžื•ืืœ? Why does ืจื‘ feel that ืžื‘ืขื” is ืื“ื, why doesn't he learn like ืฉืžื•ืืœ that ืžื‘ืขื” is ืฉืŸ? ืืžืจ ืœืš, the ื’ืžืจื says he will answer you, ืžื™ ืงืชื ื™ ื ื™ื‘ืข? Does the ืžืฉื ื” say ื ื™ื‘ืข? If the reason it's called tooth is because the word ืžื‘ืขื” comes from the word revealed, so it should have said ื ื™ื‘ืข, which means it is revealed, the tooth is revealed. The ืžืฉื ื” uses the term ืžื‘ืขื”, which means it makes something revealed. It should have said ื ื™ื‘ืข, which means it is itself revealed, and since it does not use the term ื ื™ื‘ืข, obviously ืจื‘ says it does not mean tooth. ื•ืฉืžื•ืืœ ืžืื™ ื˜ืขืžื ืœื ืืžืจ ื›ืจื‘? Why doesn't ืฉืžื•ืืœ learn like ืจื‘, that ืžื‘ืขื” means ืื“ื? ืืžืจ ืœืš, the ื’ืžืจื says ืฉืžื•ืืœ will tell you, ืžื™ ืงืชื ื™ ื‘ืขื™ื? Does it say in the ืžืฉื ื” the expression ื‘ืขื™ื? If we say that the reason it refers to ืื“ื is because of the ืคืกื•ืง that ืจื‘ quoted, which means the person who asks for forgiveness, so the ืžืฉื ื” should have used the ืœืฉื•ืŸ ื‘ืขื™ื, the asker. ืœืคื•ืขืœ the ืžืฉื ื” says ืžื‘ืขื”, so then this does not fit to the meaning of ืื“ื, and therefore ืฉืžื•ืืœ does not learn like ืจื‘. So now the ื’ืžืจื asks, ืžื™ื“ื™ ื“ื”ื•ื” ืงืจืื™ ืœื ื›ืžืจ ื“ื™ื™ืงื™ ื•ืœื ื›ืžืจ ื“ื™ื™ืงื™, the ืคืกื•ืง the ืคืกื•ืงื™ื themselves are not ืžื“ื•ื™ืง, do not fit exactly, not like one, not like the other. There is a question on the ืคืฉื˜ of ืจื‘ the way he learns out from the ืคืกื•ืง, there is a question on the ืคืฉื˜ of ืฉืžื•ืืœ the way he learns out from the ืคืกื•ืง. So if so, we're back to the question, ืจื‘ ืžืื™ ื˜ืขืžื ืœื ืืžืจ ื›ืฉืžื•ืืœ? Why doesn't ืจื‘ learn like ืฉืžื•ืืœ? We can't say it's only based on the ืคืกื•ืงื™ื, because even the way ืจื‘ learns, it is not a hundred percent understood, the proof from the ืคืกื•ืง is not a hundred percent, so there must be another reason why ืจื‘ does not want to learn like ืฉืžื•ืืœ. And so too, the ื’ืžืจื later on will ask, what is the reason why ืฉืžื•ืืœ doesn't learn like ืจื‘, because also we can't say the reason is only because of the ืคืกื•ืง, because ืฉืžื•ืืœ's ืคืกื•ืง itself is also not ืžื“ื•ื™ืง. So therefore, there must be another reason. But at this

Why Rav Doesnโ€™t Follow ืฉืžื•ืืœโ€™s Interpretation

point, the ื’ืžืจื is asking, why doesn't ืจื‘ learn like ืฉืžื•ืืœ that ืžื‘ืขื” means ืฉืŸ? The ื’ืžืจื answers, because ืชื ื™ ืฉื•ืจ, the ืžืฉื ื” learned ืฉื•ืจ, the first of the four ืื‘ื•ืช in the ืžืฉื ื” is ืฉื•ืจ. So that means ื•ื›ืœ ืžื™ืœื™ ื“ืฉื•ืจ, all of all things of ืฉื•ืจ. How can you say that ืžื‘ืขื” means ืฉืŸ, when it says ืฉื•ืจ, an ox, so an ox includes all three ืื‘ื•ืช that are connected to the ox, which are ืงืจืŸ, ืฉืŸ, ื•ืจื’ืœ? And therefore, the ืžืฉื ื” already mentioned ืฉืŸ, so we cannot say that ืžื‘ืขื” means ืฉืŸ. So the ื’ืžืจื asks, ื•ืœืฉืžื•ืืœ, so according to ืฉืžื•ืืœ now according to him too, ื”ื ืชื ื™ ืœื™ื” ืฉื•ืจ, doesn't it say ืฉื•ืจ? How can ืฉืžื•ืืœ say that ืžื‘ืขื” means ืฉืŸ when it already says ืฉื•ืจ, which automatically includes ืฉืŸ? ืืžืจ ืจื‘ ื™ื”ื•ื“ื”, so ืจื‘ ื™ื”ื•ื“ื” answers, according to ืฉืžื•ืืœ the ืคืฉื˜ is as follows: ืชื ื™ ืฉื•ืจ ืœืงืจื ื•, ืฉื•ืจ is for its horn. In other words, when the ืžืฉื ื” says ืฉื•ืจ, at this point the ื’ืžืจื feels it means ืงืจืŸ. ื•ืžื‘ืขื” ืœืฉื™ื ื•, and when it says ืžื‘ืขื”, that means ืฉืŸ. And the ื’ืžืจื will later ask, what about ืจื’ืœ? But at this point the ื’ืžืจื feels that ืฉื•ืจ according to ืฉืžื•ืืœ means ืงืจืŸ, and therefore ืžื‘ืขื” would mean ืฉืŸ. But now we will have to see whether this fits to the continuation of the ืžืฉื ื”. Because right after the ืžืฉื ื” mentions all four ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, the

Comparison of ืฉื•ืจ and ืžื‘ืขื” in the Mishnah

ืžืฉื ื” says, ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื”, that ืฉื•ืจ is not like ืžื‘ืขื”. In other words, there is a ื—ื•ืžืจื in ืฉื•ืจ which we do not have in ืžื‘ืขื”. There is a reason why ืฉื•ืจ should be ื—ื™ื™ื‘ that we do not find in ืžื‘ืขื”. And then it says, ื•ืœื ื”ืจื™ ื”ืžื‘ืขื” ื›ื”ืจื™ ื”ืฉื•ืจ, there is a ื—ื•ืžืจื in ืžื‘ืขื” over ืฉื•ืจ. In other words, there is a reason why ืžื‘ืขื” should be ื—ื™ื™ื‘ and ืฉื•ืจ not. And as we explained when we learned the ืžืฉื ื”, that the ืžืฉื ื” is here trying to tell us why the ืคืกื•ืง has to tell us both, why the ืคืกื•ืง has to mention ืฉื•ืจ and ืžื‘ืขื”, why wouldn't it have been enough if the ืชื•ืจื” would just say one and we would ourselves understand the other? And the ืžืฉื ื” is trying to answer that it couldn't say just ืฉื•ืจ, because then we would not have known ืžื‘ืขื”. We would say that, you know why ืฉื•ืจ is ื—ื™ื™ื‘? Because of its ื—ื•ืžืจื, because of its special reason, that's why it's ื—ื™ื™ื‘. But ืžื‘ืขื” that doesn't have that reason, maybe is not ื—ื™ื™ื‘. Therefore the ืžืฉื ื”, the ืคืกื•ืง has to tell us specifically ืžื‘ืขื”. And the same if the ืชื•ืจื” would just say ืžื‘ืขื”, we would not have known ืฉื•ืจ. We would think that the reason why you're ื—ื™ื™ื‘ for ืžื‘ืขื” is because of its reason, but ืฉื•ืจ that doesn't have that reason, you are not ื—ื™ื™ื‘. And therefore the ืชื•ืจื” has to say ืฉื•ืจ, too. In other words, these are reasons why the ืชื•ืจื” has to say ืฉื•ืจ and ืžื‘ืขื”. Now, according to ืฉืžื•ืืœ that says that ืฉื•ืจ means ืงืจืŸ and ืžื‘ืขื” means ืฉืŸ, how can we explain the ืžืฉื ื”? What would the ืžืฉื ื” mean? What is the ื—ื•ืžืจื in ืงืจืŸ over ืฉืŸ, and what is the ื—ื•ืžืจื in ืฉืŸ over ืงืจืŸ? And the ื’ืžืจื goes on to explain that. ื”ื›ื™ ืงืืžืจ, this is what the ืžืฉื ื” would mean: ืœื ืจืื™ ื”ืงืจืŸ, ืงืจืŸ is not the same as ืฉืŸ, which means there is a ื—ื•ืžืจื in ืงืจืŸ, there is a reason in ืงืจืŸ why it should be ื—ื™ื™ื‘, because ืฉืื™ืŸ ื”ื ืื” ืœื”ื™ื–ืงื•, there is no ื”ื ืื” to the ื”ื™ื–ืง. When the animal gores with its horn, it has no benefit from this goring. And therefore, at this point, the ื’ืžืจื felt this should be a reason why it should be ื—ื™ื™ื‘. So this is not ื›ืจืื™ ื”ืฉืŸ, like ืฉืŸ, ืฉื™ืฉ ื”ื ืื” ืœื”ื™ื–ืงื•. ืฉืŸ, when it eats, it does have pleasure, it does have benefit from its ื”ื™ื–ืง, from its damage. So the ื’ืžืจื felt this should be a reason why ืฉืŸ should not be ื—ื™ื™ื‘. And that's what the ืžืฉื ื” means, that if the ืชื•ืจื” would just write ืฉื•ืจ, which means ืงืจืŸ at this point, we would not have known ืฉืŸ, because ืงืจืŸ has a reason to be ื—ื™ื™ื‘, which ืฉืŸ doesn't, and the reason is, the way the ื’ืžืจื feels at this point is the fact that there is no benefit in the damage that the ืงืจืŸ does, while by ืฉืŸ there is a benefit. And then when the ืžืฉื ื” continues that there is a ื—ื•ืžืจื in ืฉืŸ over ืงืจืŸ, in ืžื‘ืขื” over ืฉื•ืจ, which at this point is ืฉืŸ over ืงืจืŸ, and therefore if the ืชื•ืจื” would just say ืฉืŸ we would not know ืงืจืŸ, so the ื’ืžืจื explains, what is that? ื“ืœื ืจืื™ ื”ืฉืŸ, and ืฉืŸ is not the same as ืงืจืŸ, which means there is a ื—ื•ืžืจื in ืฉืŸ, ืฉืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง. When the animal damages through the tooth, it doesn't have intention to damage. And at this point the ื’ืžืจื feels this is a reason why it should be ื—ื™ื™ื‘. So this is different, not the same, ื›ืจืื™ ื”ืงืจืŸ, like ืงืจืŸ, ืฉื›ื•ื•ื ืชื• ืœื”ื–ื™ืง. When an animal damages through the horn, it intends to damage. And therefore the ื’ืžืจื feels that ืงืจืŸ might not be ื—ื™ื™ื‘. And therefore if the ืชื•ืจื” would only write ืฉืŸ and not write ืงืจืŸ, we would not have known ืงืจืŸ. We would think only ืฉืŸ is ื—ื™ื™ื‘ because of its reason, which is at this point because it has no ื›ื•ื•ื ื” to be ืžื–ื™ืง, while ืงืจืŸ should be ืคื˜ื•ืจ because it does have ื›ื•ื•ื ื” to be ืžื–ื™ืง. The truth is we do have to understand What was the reasoning of the ื’ืžืจื? Why did the ื’ืžืจื think that if it has no pleasure in its damage it is more reason why you should have to pay for the damage? And also if it has no intentions to be ืžื–ื™ืง there should be more reason you should have to pay? It would seem just opposite, as the ื’ืžืจื will really ask later on, because it makes more sense to say that if it has pleasure from its damage you certainly should have to pay. If it intends to damage, you certainly should have to pay. But here the ื’ืžืจื seems to be thinking just opposite. So ืชื•ืกืคื•ืช gives a ืกื‘ืจื in this ื”ื•ื” ืืžื™ื ื of the ื’ืžืจื too, because ืชื•ืกืคื•ืช says the

ืชื•ืกืคื•ืชโ€™s Reasoning About Watching Difficulty

ื’ืžืจื thought that it all depends on how hard it was for the person to watch it. The harder it is for the person to watch it, the more reason you should not have to pay. The easier it is for the person to watch it, that is a more a greater reason why you should have to pay. And therefore the ื’ืžืจื thought that by ืงืจืŸ, since it doesn't have any pleasure from its damage, therefore it's easier to watch it. When the animal has pleasure, the animal is hungry and it gains by its damage, so it's much harder to watch it, because the animal wants to do it because it wants to eat. But ืงืจืŸ, which does not have any pleasure, so therefore the ื’ืžืจื thought it's much easier to watch it, and since you didn't watch it, therefore you are obligated to pay. And then the same would apply to the ืกื‘ืจื of ื›ื•ื•ื ื” ืœื”ื–ื™ืง. If the animal intends to be ืžื–ื™ืง, then it's harder for the owner to watch it because it wants to be ืžื–ื™ืง, and therefore there is a reason you should be ืคื˜ื•ืจ. On the other hand, if it has no ื›ื•ื•ื ื” to be ืžื–ื™ืง, it doesn't have intentions to be ืžื–ื™ืง, so then it is easier for the owner to watch it, and therefore the ื’ืžืจื thought that that should be a reason why you should be ื—ื™ื™ื‘ if you didn't watch it, because it was easier for you. But now the

The ืงืœ ื•ื—ื•ืžืจ Contradiction Raised

ื’ืžืจื will continue and ask, ื•ืœืื• ืงืœ ื•ื—ื•ืžืจ ื”ื•ื, isn't it a ืงืœ ื•ื—ื•ืžืจ? Isn't it an opposite ืกื‘ืจื? For you're trying to say that ืฉืŸ should be ื—ื™ื™ื‘ because it doesn't have intentions to be ืžื–ื™ืง, while ืงืจืŸ should not be ื—ื™ื™ื‘ because it does have ื›ื•ื•ื ื” to be ืžื–ื™ืง, so the ื’ืžืจื asks, isn't it a ืงืœ ื•ื—ื•ืžืจ? ื•ืžื” ืฉืŸ, if ืฉืŸ, ืฉืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, which has no intentions to be ืžื–ื™ืง, ื—ื™ื™ื‘, we say you are ื—ื™ื™ื‘, ืงืจืŸ ืฉื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, ืงืจืŸ, which does have intentions to be ืžื–ื™ืง, ืœื ื›ืœ ืฉื›ืŸ, shouldn't it certainly be ื—ื™ื™ื‘? In other words, the ื’ืžืจื does not accept at this point the ืกื‘ืจื that ืชื•ืกืคื•ืช said, that it all depends in how much the person was able to watch it, but it depends on the characteristic of the damage itself. And therefore the ื’ืžืจื feels that if the damage was done in such a way that the animal had intentions to be ืžื–ื™ืง, that is definitely more reason why you should be ื—ื™ื™ื‘. And therefore the ื’ืžืจื asks, how can you say that if it would just say ืฉืŸ, we would not know ืงืจืŸ because we would think only ืฉืŸ is ื—ื™ื™ื‘ because it has no intentions to be ืžื–ื™ืง, while ืงืจืŸ does have intentions, should be ืคื˜ื•ืจ? The ื’ืžืจื says just opposite: if it would just say ืฉืŸ, that you are ื—ื™ื™ื‘ even if it has no intentions to be ืžื–ื™ืง, we would know definitely you are ื—ื™ื™ื‘ for ืงืจืŸ because it does have intentions to be ืžื–ื™ืง. And as ืจืฉืดื™ says, the same ืงืฉื™ื applies to the first part of the ื’ืžืจื here. When the ื’ืžืจื gave the reason why if the ืชื•ืจื” would just say ืงืจืŸ we would not have known ืฉืŸ, and the reason was because ืงืจืŸ has a reason to be ื—ื™ื™ื‘, and that is because it has no pleasure to be ืžื–ื™ืง, so the same ืงืฉื™ื the ื’ืžืจื asks here applies for that too: that how can we say that? It's just opposite. If ืงืจืŸ, which there is no pleasure in the ื”ื™ื–ืง, we say you are ื—ื™ื™ื‘, ืฉืŸ, where there is pleasure to the ื”ื™ื–ืง, you certainly should be ื—ื™ื™ื‘. And that's the ื’ืžืจื's ืงืฉื™ื here: how can you explain the ืžืฉื ื” this way when it's just opposite? And ืจืฉืดื™ asks that ืœื›ืื•ืจื” we could have answered very simple: that what he meant was just opposite. When he said that ืงืจืŸ is not like ืฉืŸ, ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื”, so till now we were saying that the first of the two that's mentioned is the one that has the ื—ื•ืžืจื, the second one is the one that doesn't have the ื—ื•ืžืจื. In other words, when we said that ืฉื•ืจ, which is ืงืจืŸ, is not like ืžื‘ืขื”, which is ืฉืŸ, we meant to say that if the ืชื•ืจื” would have just written ืฉื•ืจ, we would not have known ืฉืŸ. Which means that the first one is the one that should have said, the second one mentioned is the one that could have been learned out. And the ืžืฉื ื” tells us that the first one couldn't have been enough because the first one has a ื—ื•ืžืจื. And the ื—ื•ืžืจื was, as we said before, ืงืจืŸ has the ื—ื•ืžืจื of ืื™ืŸ ื”ื ืื” ืœื”ื™ื–ืงื•, it has no pleasure from its ื”ื™ื–ืง, and ืฉืŸ has the ื—ื•ืžืจื that it has no ื›ื•ื•ื ื” to be ืžื–ื™ืง. And that's why we ask the ืงืฉื™ื that it should be just opposite. So

Rashiโ€™s Clarification of Rabbi Yehudaโ€™s View

ืจืฉืดื™ says maybe that's not what ืจื‘ื™ ื™ื”ื•ื“ื” meant. ืจื‘ื™ ื™ื”ื•ื“ื” learned ืคืฉื˜ in the ืžืฉื ื” just opposite. He learns that when the ืžืฉื ื” says, ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื”, that ืฉื•ืจ is not like ืžื‘ืขื”, he meant to say that why didn't the ืชื•ืจื” just say ืžื‘ืขื” and not ืฉื•ืจ, and we would have learned out ืฉื•ืจ from ืžื‘ืขื”? And when he explained that ืฉื•ืจ, which is ืงืจืŸ, has the characteristic of ืื™ืŸ ื”ื ืื” ืœื”ื™ื–ืงื•, which is not like ืฉืŸ, which has ื”ื ืื” ืœื”ื™ื–ืงื•, he meant to use it as a ืงื•ืœื, not as a ื—ื•ืžืจื. He meant to explain why couldn't we learn out ืงืจืŸ from ืฉืŸ, why couldn't the ืชื•ืจื” just write ืฉืŸ, because ืงืจืŸ has a ืงื•ืœื. We would not have known ืงืจืŸ because ืงืจืŸ has no ื”ื ืื” ืœื”ื–ื™ืงื•. And the same thing with the second half, when he said that ืฉืŸ is not like ืงืจืŸ, because ืฉืŸ ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, has no intention to be ืžื–ื™ืง, and ืงืจืŸ does have, he didn't mean that this is a reason why we could not learn out ืงืจืŸ from ืฉืŸ, he meant just the opposite. This is a reason why we could not learn out ืฉืŸ from ืงืจืŸ. Because ืฉืŸ has a ืงื•ืœื that ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, and ืงืจืŸ has a ื—ื•ืžืจื of ื™ืฉ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, and therefore if it would just say ืงืจืŸ, we would not know ืฉืŸ from it, because ืฉืŸ is not as strict as ืงืจืŸ, because ืฉืŸ ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง. And if we would say that, the ื’ืžืจื's ืงืฉื™ื would fall off. And ืจืฉืดื™ explains, we couldn't learn that, because this is not the ื“ืจืš of the ืฉืดืก, the ื“ืจืš of the ื’ืžืจื. The ื“ืจืš is that whenever we say the expression ืœื ื”ืจื™ ื–ื” ื›ื”ืจื™ ื–ื”, we always mean that the first one should have said, and we would learn out the second one from the first. Especially by us in the ืžืฉื ื” we see it very clearly, because in the second part of the ืžืฉื ื”, where the ืžืฉื ื” says why it wouldn't be enough if it would just say ืฉื•ืจ and ืžื‘ืขื”, and we would be able to learn out ืืฉ from it, and the ืžืฉื ื” says the reason is because ืœื ื–ื” ื•ื–ื” ืฉื™ืฉ ื‘ื• ืจื•ื— ื—ื™ื™ื ื›ื”ืจื™ ื”ืืฉ ืฉืื™ืŸ ื‘ื• ืจื•ื— ื—ื™ื™ื. So we see clearly that the ืžืฉื ื” uses the ื—ื•ืžืจื in the first part, and the ืงื•ืœื in the second. So therefore, in the beginning of the ืžืฉื ื”, probably the ืคืฉื˜ is the same. That when it says ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื”, it means that ืฉื•ืจ has a ื—ื•ืžืจื over ืžื‘ืขื”. ืœื ื”ืจื™ ื”ืžื‘ืขื” ื›ื”ืจื™ ื”ืฉื•ืจ means that ืžื‘ืขื” has a ื—ื•ืžืจื over ืฉื•ืจ. So when ืจื‘ ื™ื”ื•ื“ื” explained that ืœื ื”ืจื™ ื”ืงืจืŸ ื›ื”ืจื™ ื”ืฉืŸ, that ืงืจืŸ is ืื™ืŸ ื”ื ืื” ืœื”ื–ื™ืงื” and ืฉืŸ is ื”ื ืื” ืœื”ื–ื™ืงื”, and ืœื ื”ืจื™ ื”ืฉืŸ ื›ื”ืจื™ ื”ืงืจืŸ, that ืฉืŸ is ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง and ืงืจืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, he definitely meant that the first one was the ื—ื•ืžืจื, and the second one is the ืงื•ืœื. And that's why the ื’ืžืจื has a ืงืฉื™ื that it really should be just the opposite. That the idea of ืงืจืŸ not having ื”ื ืื” ืœื”ื–ื™ืงื” is not a ื—ื•ืžืจื. So if the ืชื•ืจื” would just write ืงืจืŸ, and we would say that if you're ื—ื™ื™ื‘ by ืงืจืŸ, which doesn't have ื”ื ืื” ืœื”ื–ื™ืงื”, we would know ourselves definitely you're ื—ื™ื™ื‘ by ืฉืŸ, which has ื”ื ืื” ืœื”ื–ื™ืงื”. And the same in the second part, if the ืชื•ืจื” would just write ืฉืŸ, and say you're ื—ื™ื™ื‘ even though ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, we would know definitely that by ืงืจืŸ, which is ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, you are definitely ื—ื™ื™ื‘. And that was the ื’ืžืจื's ืงืฉื™ื: that how can you say that if it would say just ืฉืŸ we would not know ืงืจืŸ because of ืฉืŸ ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, really it should be just the opposite. And the ื’ืžืจื answers: ืื™ืฆื˜ืจื™ืš, we do need to tell us. In other words, it's possible that something which is ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง and nevertheless you should be ืคื˜ื•ืจ. So the ืงืœ ื•ื—ื•ืžืจ that we just made, that if it's ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง you certainly should be ื—ื™ื™ื‘, is not really true, because we do find a case where ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง is still a reason to be ืคื˜ื•ืจ. Because ืกืœืงื ื“ืขืชืš ืืžื™ื ื, I would think, ืžื™ื“ื™ ื“ื”ื•ื” ืืขื‘ื“ ื•ืืžื”, so just like the ื“ื™ืŸ of an ืขื‘ื“ or an ืืžื”, a slave or a woman slave, a ื’ื•ื™ื™ืฉืขืจ ืขื‘ื“ or a ื’ื•ื™ื™ืฉืขืจ ืืžื”, that the ื“ื™ืŸ is: ืขื‘ื“ ื•ืืžื”, isn't the ื“ื™ืŸ by ืขื‘ื“ ื•ืืžื”, ืœืื• ืืฃ ืขืœ ื’ื‘ ื“ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, even though they intend to be ืžื–ื™ืง, if a person's ืขื‘ื“, a person's ื’ื•ื™ื™ืฉืขืจ ืขื‘ื“, would go and be ืžื–ื™ืง someone's property, for then, for instance, he would put someone's house on fire. So he has ื›ื•ื•ื ื” to be ืžื–ื™ืง, he did it intentionally, and nevertheless ืืคื™ืœื• ื”ื›ื™ ืคื˜ื™ืจื, still the owner is ืคื˜ื•ืจ. So we would say ื”ื›ื ื ืžื™ here too ืœื ืฉื ื there is no difference. We

Example of ืขื‘ื“ and ืืžื” and Liability

see that there is a possibility for something that belongs to you that intends to be ืžื–ื™ืง and still you are ืคื˜ื•ืจ. So we would think here too, that in the case of ืงืจืŸ that ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง and still you should be ืคื˜ื•ืจ. So we couldn't make the ืงืœ ื•ื—ื•ืžืจ that ืžื” ื“ื›ืืŸ ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง you are ื—ื™ื™ื‘, certainly if ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, because here we see something ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, your ืขื‘ื“ and ืืžื”, and still the ื“ื™ืŸ is you are ืคื˜ื•ืจ. Where do we see that you are ืคื˜ื•ืจ? So ืจืฉืดื™ quotes the ื’ืžืจื later on in ื“ืฃ ืคืดื–, where it says ื”ืขื‘ื“ ื•ื”ืืฉื” ืคื’ื™ืขืชืŸ ืจืขื”, that an ืขื‘ื“ or a woman, if you meet up with them it's very bad, because ื”ื—ื•ื‘ืœ ื‘ื”ื ื—ื™ื™ื‘, if somebody does damage to them you are ื—ื™ื™ื‘, ื•ื”ื ืฉื—ื‘ืœื• ื‘ืื—ืจื™ื ืคื˜ื•ืจื™ืŸ, if they cause damage to others they are ืคื˜ื•ืจ. And so is their master ืคื˜ื•ืจ. So there we see that if an ืขื‘ื“ causes damage, even though ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, still the owner is ืคื˜ื•ืจ. ืชื•ืกืคื•ืช on the other hand says it doesn't mean the ื’ืžืจื in ื”ื—ื•ื‘ืœ later on, but it's ืœื›ืชื—ื™ืœื” he says, refers to the ืžืฉื ื” which is in the end of ืžืกื›ืช ื™ื“ื™ื, where it says clearly there that if an ืขื‘ื“ or an ืืžื” are ืžื–ื™ืง, the owner is ืคื˜ื•ืจ. So the ื’ืžืจื says: ืืžืจ ืจื‘ ืืฉื™, so ืจื‘ ืืฉื™ said, how can you compare ืขื‘ื“ ื•ืืžื” to the case here? How can you use the ืขื‘ื“ ื•ืืžื” as a ืจืื™ื” that it's possible to have ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง and still be ืคื˜ื•ืจ, and you want to use that as a ืจืื™ื” to the ื“ื™ืŸ of ืงืจืŸ, that maybe ืงืจืŸ, which is ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, you're also ืคื˜ื•ืจ? ืื˜ื• ืขื‘ื“ ื•ืืžื” ืœืื• ื˜ืขืžื ืจื‘ื” ืื™ืช ื‘ื”ื•? Doesn't ืขื‘ื“ ื•ืืžื” have a very special reason? The reason given why you are ืคื˜ื•ืจ: ืฉืžื ื™ืงื ื™ื˜ื ื• ืจื‘ื•, his master might get him angry, ื•ื™ืœืš, he will go, ื•ื™ื“ืœื™ืง ื’ื“ื™ืฉื• ืฉืœ ื—ื‘ื™ืจื•, and he is going to put on fire the crop of of his friend, ื•ื ืžืฆื ื–ื” ืžื—ื™ื™ื‘ ืืช ืจื‘ื• ืžืื” ืžื ื” ื‘ื›ืœ ื™ื•ื, so this ืขื‘ื“ will have his master pay a hundred ืžื ื” every day, because if the ื“ื™ืŸ will be that when an ืขื‘ื“ causes damage, his master has to pay, anytime the ืขื‘ื“ will get angry at his master, he's going to go and cause some damage and have his master pay a lot of money. So that is the

Comparing ืขื‘ื“ Damage Exemption to ืงืจืŸ Liability

reason why the ื—ื›ืžื™ื said that when an ืขื‘ื“ causes damage, the owner is ืคื˜ื•ืจ. So how can you use that as a comparison to the ื“ื™ืŸ of ืงืจืŸ, that there too ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง you should be ืคื˜ื•ืจ? Here, in spite of ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง you are ืคื˜ื•ืจ, because of this reason that he might cause his master to pay a lot of money. But normally, the idea of ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง is a reason to be ื—ื™ื™ื‘. So therefore, the question comes back, how can we say that ืงืจืŸ, since ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, therefore we would think that you should be ืคื˜ื•ืจ? It's just the opposite. If we would know that by ืฉืŸ, which ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, you are ื—ื™ื™ื‘, we would definitely know that ืงืจืŸ, which is ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, you are certainly ื—ื™ื™ื‘. So therefore we cannot say that when the ืžืฉื ื” says ืœื ื”ืจื™ ื”ืžื‘ืขื” ื›ื”ืจื™ ื”ืฉื•ืจ, it means that ืฉืŸ has a ื—ื•ืžืจื of ืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, and if it would say that, we would not know ืงืจืŸ, which is ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, because it's just the opposite. Therefore, the ื’ืžืจื says, ืืœื ืคืจื™ืš ื”ื›ื, but ask this way, in other words, explain the ืžืฉื ื” differently, just the opposite. That the first part of the ืžืฉื ื”, where the ืžืฉื ื” says ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื”, which means, as we're holding now, that ืœื ื”ืจื™ ื”ืงืจืŸ ื›ื”ืจื™ ื”ืฉืŸ, it means to say ืœื ืจืื™ ื”ืงืจืŸ, ืงืจืŸ is not the same, in other words there is a ื—ื•ืžืจื in ืงืจืŸ, and what is the ื—ื•ืžืจื in ืงืจืŸ? ืฉื›ื•ื•ื ืชื• ืœื”ื–ื™ืง, that ืงืจืŸ has intentions to be ืžื–ื™ืง, that's the ื—ื•ืžืจื. So if the ืชื•ืจื” would just say ืงืจืŸ, we would not know ืฉืŸ, because it's not ื›ืจืื™ ื”ืฉืŸ, it's not like ืฉืŸ ืฉืื™ืŸ ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง. ืฉืŸ does not have that ื—ื•ืžืจื of ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง because by ืฉืŸ it doesn't intend to be ืžื–ื™ืง, so we would not know that you are ื—ื™ื™ื‘ for ืฉืŸ too, because the idea of ื›ื•ื•ื ืชื• ืœื”ื–ื™ืง is a ื—ื•ืžืจื. So if the ืชื•ืจื” would just say ืงืจืŸ, we would not have known ืฉืŸ. And ืœื ืจืื™ ื”ืฉืŸ ืฉื™ืฉ ื”ื ืื” ืœื”ื–ื™ืงื• ื›ืจืื™ ื”ืงืจืŸ ืฉืื™ืŸ ื”ื ืื” ืœื”ื–ื™ืงื•, and if the ืชื•ืจื” would just say ืฉืŸ, we would not know ืงืจืŸ, because ืฉืŸ is not like ืงืจืŸ, there is a ื—ื•ืžืจื in ืฉืŸ over ืงืจืŸ. What is the ื—ื•ืžืจื? That ืฉืŸ has a reason to be ื—ื™ื™ื‘ because ื”ื ืื” ืœื”ื–ื™ืงื•, there is pleasure to its damage, while ืงืจืŸ does not have pleasure to its damage, and therefore if the ืชื•ืจื” would just say ืฉืŸ, we would not know ืงืจืŸ. So now we're using just the opposite ืกื‘ืจื•ืช than we said before. And this is the way ืฉืžื•ืืœ is going to explain the ืžืฉื ื”, that ืฉื•ืจ means ืงืจืŸ, ืžื‘ืขื” means ืฉืŸ, and when the ืžืฉื ื” says ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื” ื•ืœื ื”ืจื™ ื”ืžื‘ืขื” ื›ื”ืจื™ ื”ืฉื•ืจ, it means as we just explained before. But the ื’ืžืจื asks according to that, ื•ืจื’ืœ ืžืื™, what's with ืจื’ืœ? Why doesn't he mention ืจื’ืœ? ืฉื™ื™ืจื™ื”, did he leave it over? Why should he leave out ืจื’ืœ? If he mentions ืงืจืŸ, and he mentions ืฉืŸ, what about ืจื’ืœ? And the ื’ืžืจื answers, ื›ืฉื”ื–ื™ืง ื—ื‘ ื”ืžื–ื™ืง ืœืืชื•ื™ื™ ืจื’ืœ, that when at the end of the ืžืฉื ื” where it says that when it causes damage the ืžื–ื™ืง is ื—ื™ื™ื‘ to pay, which are really extra words, that comes to include something else, that there is another category of damage which was not mentioned yet, and that is included by these extra words, so that refers to ืจื’ืœ. And as ืชื•ืกืคื•ืช explains, this does not refer to the words of our first ืžืฉื ื”, where it said at the end of the ืžืฉื ื” ื›ืฉื”ื–ื™ืง ื—ื‘ ื”ืžื–ื™ืง, but it refers to the ืžืฉื ื” later on, where the ืžืฉื ื” again repeats the words ื›ืฉื”ื–ื™ืง ื—ื‘ ื”ืžื–ื™ืง, and those are extra, so that's what ืฉืžื•ืืœ says, those words come to add ืจื’ืœ. Then the ื’ืžืจื asks, ื•ืœื™ืชื ื™ ื‘ื”ื“ื™ื, but why doesn't he learn it outright? Why, the others are mentioned clearly in the ืžืฉื ื”, but the ืจื’ืœ is only included through an additional extra words? So therefore, the ื’ืžืจื changed its mind. ืืœื ืืžืจ ืจื‘ื, therefore ืจื‘ื said, it's not the way we said before, but according to ืฉืžื•ืืœ, ืชื ื ืฉื•ืจ ืœืจื’ืœื• ื•ืžื‘ืขื” ืœืฉื™ื ื•. It's not as we said before that ืฉื•ืจ means ืงืจืŸ and ืžื‘ืขื” means ืฉืŸ, but ืฉื•ืจ means ืจื’ืœ and ืžื‘ืขื” stays that it means ืฉืŸ. But the same question will come up, so what happened to ืงืจืŸ? The ื’ืžืจื will explain that soon. ื•ื”ื›ื™ ืงืืžืจ, and this is what the ืžืฉื ื” means. Now that we know that ืฉื•ืจ means ืจื’ืœ and ืžื‘ืขื” means ืฉืŸ, so we have to explain the ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื” ื•ืœื ื”ืจื™ ื”ืžื‘ืขื” ื›ื”ืจื™ ื”ืฉื•ืจ, in other words there is a ื—ื•ืžืจื in ืฉื•ืจ over ืžื‘ืขื” and ืžื‘ืขื” over ืฉื•ืจ, we have to explain it according to the way we're learning now. We have to find what is the ื—ื•ืžืจื in ืจื’ืœ over ืฉืŸ, because now we're saying that ืฉื•ืจ means ืจื’ืœ, and we have to find a ื—ื•ืžืจื in ืฉืŸ over ืจื’ืœ. And the ื’ืžืจื explains ื•ื”ื›ื™ ืงืืžืจ, this is what the ืžืฉื ื” means: ืœื ืจืื™ ื”ืจื’ืœ ืฉื”ื–ื™ืงื” ืžืฆื•ื™ ื›ืจืื™ ื”ืฉืŸ ืฉืื™ืŸ ื”ื–ื™ืงื” ืžืฆื•ื™, that ืจื’ืœ is not the same as ืฉืŸ. ืจื’ืœ has a ื—ื•ืžืจื over ืฉืŸ. What is the ื—ื•ืžืจื? ืฉื”ื–ื™ืงื” ืžืฆื•ื™, that its damage is common. Whenever it walks, it could cause a damage. While ืฉืŸ is not a common damage. And therefore, if the ืชื•ืจื” would just write ืจื’ืœ, we would not know automatically that ืฉืŸ is also ื—ื™ื™ื‘. We would think only ืจื’ืœ is ื—ื™ื™ื‘ because of this ื—ื•ืžืจื, while ืฉืŸ that doesn't have that it's common that it would be ืคื˜ื•ืจ. And ืฉืŸ is not like ืจื’ืœ. In other words, there's a ื—ื•ืžืจื in ืฉืŸ over ืจื’ืœ, and that ื—ื•ืžืจื is that ืฉืŸ, there is pleasure towards damage, while by ืจื’ืœ there is no pleasure towards damage. And therefore, if the ืชื•ืจื” would just write ืฉืŸ, we would think only ืฉืŸ is ื—ื™ื™ื‘ because of this ื—ื•ืžืจื, while ืจื’ืœ would not be ื—ื™ื™ื‘. And now the ื’ืžืจื asks to ืงืจืŸ, what about ืงืจืŸ, ืžืื™, what's with that ืฉื™ื™ืจื™ื” he left it over, why should he leave over ืงืจืŸ? If he mentions ืจื’ืœ and mentions ืฉืŸ, why doesn't he speak about ืงืจืŸ? And the ื’ืžืจื answers, ื›ืฉื”ื–ื™ืง ื—ื‘ ื”ืžื–ื™ืง, ืœืืชื•ื™ื™ ืงืจืŸ. The same answer as before, that the extra words later in the ืžืฉื ื” where it says that when the damage happened, the ืžื–ื™ืง is ื—ื™ื™ื‘ to pay, those are extra words that comes to include another category of damage, and that comes to include ืงืจืŸ. So the

Why ืจื’ืœ Is Implicit Through Extra Mishnah Words

ื’ืžืจื asks, ื•ืœื™ืชื ื™ ื‘ื”ื“ื™ื, why doesn't he mention it outright? Why ืจื’ืœ and ืฉืŸ he mentions specifically, and ืงืจืŸ he only includes through extra words? And the ื’ืžืจื gives a reason, ื“ืžื•ืขื“ื™ืŸ ืžืชื—ืœืชืŸ ืงื ืžื™ื™ืจื™, ื•ืชืžื™ืŸ ื“ืœื‘ืกื•ืฃ ืžื•ืขื“ื™ืŸ ืœื ืงื ืžื™ื™ืจื™. He only talks about those things which are ืžื•ืขื“ื™ืŸ from the beginning. And as we explained, a ืžื•ืขื“ means when you are ื—ื™ื™ื‘ to pay the complete ื ื–ืง. A ืชื is when you are ื—ื™ื™ื‘ to pay only half a ื ื–ืง. Now this difference between a ืชื and a ืžื•ืขื“, that the first few times you are only a ืชื and you pay half a ื ื–ืง, and later on you pay ื ื–ืง ืฉืœื, that is only by ืงืจืŸ. By the other kinds of damages, even on the first time you pay the complete ื ื–ืง. Only by ืงืจืŸ there is a difference between ืชื and ืžื•ืขื“. And therefore the ืžืฉื ื” doesn't mention ืงืจืŸ specifically, because the ืžืฉื ื” only talks about such damages which from the beginning you are a ืžื•ืขื“. But a damage that you start off with being a ืชื and at the end you turn into a ืžื•ืขื“, that it doesn't talk about. Now the ื’ืžืจื continues, ื•ืฉืžื•ืืœ ืžืื™ ื˜ืขืžื ืœื ืืžืจ ื›ืจื‘? Why doesn't ืฉืžื•ืืœ learn like ืจื‘? Why does ืฉืžื•ืืœ learn that ืžื‘ืขื” means ืฉืŸ, why doesn't he want to learn that ืžื‘ืขื” could mean ืื“ื? The ื’ืžืจื answers, ืืžืจ ืœืš, he will tell you, ืื™ ืกืœืงื ื“ืขืชืš ืื“ื, if you would think that ืžื‘ืขื” means ืื“ื, ื”ื ืงืชื ื™ ืกื™ืคื, didn't we learn that in the ืกื™ืคื, later on in the ืžืฉื ื” it says ืฉื•ืจ ื”ืžื•ืขื“ ื•ืฉื•ืจ ื”ืžื–ื™ืง ื‘ืจืฉื•ืช ื”ื ื™ื–ืง ื•ื”ืื“ื? This refers to the ืžืฉื ื” on ื“ืฃ ื˜ืดื• ืขืžื•ื“ ื‘ืณ. There the ืžืฉื ื” mentions which things are considered ืžื•ืขื“ื™ืŸ and which things are considered ืชืžื™ืŸ. So amongst the ืžื•ืขื“ื™ืŸ he mentions that a ืฉื•ืจ ื”ืžื•ืขื“, a ืฉื•ืจ, even by ืงืจืŸ, but after it turned into a ืžื•ืขื“, then it has a ื“ื™ืŸ of a ืžื•ืขื“ and you pay ื ื–ืง ืฉืœื. Or even a ืฉื•ืจ ืชื, if he did the damage in the ืจืฉื•ืช of the ื ื™ื–ืง, in the property of the one that got the damage, then even though he's a ืชื he pays ื ื–ืง ืฉืœื. ื•ื”ืื“ื, or if a person causes damage, he pays ื ื–ืง ืฉืœื. So that's what ืฉืžื•ืืœ says, that how can you say that ืžื‘ืขื” of our ืžืฉื ื” means ืื“ื, when in the ืžืฉื ื” later on he mentions ืื“ื? So since he mentions ืื“ื there, obviously he doesn't mean ืื“ื in the first ืžืฉื ื”. So the ื’ืžืจื asks, ื•ืœื™ืชื ื™ ื‘ืจื™ืฉื. Okay, we see that he says ืื“ื later, but why doesn't he mention it in the first ืžืฉื ื”? The ื’ืžืจื answers, ื‘ื ื™ื–ืงื™ ืžืžื•ื ื• ืงื ืžื™ื™ืจื™, ื‘ื ื™ื–ืงื™ ื’ื•ืคื• ืœื ืงื ืžื™ื™ืจื™. The first ืžืฉื ื” only talks about the damages that were caused through a person's property, through something that belongs to him. But the ื ื–ืง that came through himself, that the ืžืฉื ื” doesn't talk about. Now the ื’ืžืจื asks, ื•ืจื‘ ื ืžื™ ื”ื ืงืชื ื™ ืื“ื ื‘ืกื™ืคื? Now we have a ืงืฉื™ื on ืจื‘. How can ืจื‘ say that ืžื‘ืขื” means ืื“ื? Doesn't the ืžืฉื ื” in the ืกื™ืคื, in the later ืžืฉื ื” mention ืื“ื already? ืืžืจ ืœืš ืจื‘, so ืจื‘ will answer, ื”ื”ื•ื ืœืžื™ื—ืฉื‘ื™ื” ื‘ื”ื“ื™ ืžื•ืขื“ื™ืŸ ื”ื•ื ื“ืืชื. There, the ืžืฉื ื” doesn't mean to tell us that there is such an ืื‘, such a category of damage called ืื“ื. There he just wants to mention that ืื“ื has a ื“ื™ืŸ of a ืžื•ืขื“, he wants to mention him amongst the ืžื•ืขื“ื™ืŸ. In other words, the first ืžืฉื ื” is the one that tells us the different categories of ื ื–ืง, so it mentions ืื“ื as one of the categories. The second ืžืฉื ื” is just telling us certain ื“ื™ื ื™ื about these things, so it mentions that ืื“ื is also a ื“ื™ืŸ of a ืžื•ืขื“, but that is not the place where the ืžืฉื ื” tells us about ืื“ื. Then the ื’ืžืจื asks, ื•ืžืื™ ืœื ื”ืจื™, according to ืจื‘ that says that ืžื‘ืขื” means ืื“ื, so when the ืžืฉื ื” says ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื” ื•ืœื ื”ืจื™ ื”ืžื‘ืขื” ื›ื”ืจื™ ื”ืฉื•ืจ, so it means that ืฉื•ืจ, which includes all three as ืจื‘ said, ืงืจืŸ, ืฉืŸ, ื•ืจื’ืœ, have a ื—ื•ืžืจื over ืžื‘ืขื” which is ืื“ื, and ืื“ื has a ื—ื•ืžืจื over all three of ืฉื•ืจ. Now what does that mean? Which ื—ื•ืžืจื do we find in ืฉื•ืจ, in ืงืจืŸ, ืฉืŸ, ื•ืจื’ืœ over the ื“ื™ืŸ of a person who is ืžื–ื™ืง, and which ื—ื•ืžืจื do we find in the ื ื–ืง that is done through a person over the ื ื–ืง which is done through an animal? And the ื’ืžืจื says, ื”ื›ื ืงืืžืจ, this is what the ืžืฉื ื” means: ืœื ื”ืจื™ ื”ืฉื•ืจ ืฉืžืฉืœื ืืช ื”ื›ื•ืคืจ ื›ื”ืจื™ ื”ืื“ื ืฉืื™ืŸ ืžืฉืœื ืืช ื”ื›ื•ืคืจ. ืฉื•ืจ has a ื—ื•ืžืจื that you pay ื›ื•ืคืจ. The ื“ื™ืŸ is that if a ืฉื•ืจ killed a person, if an ox killed a person, so then the owner of the ox has to pay ื›ื•ืคืจ, has to pay a certain amount of money. And we find in the ื’ืžืจื a ืžื—ืœื•ืงืช as how much he has to pay, whether it is ื“ืžื™ ืžื–ื™ืง or ื“ืžื™ ื ื™ื–ืง, whether it is the amount of money that the owner of the ืžื–ื™ืง, of the ox that killed, how much he is worth, or how much the person who died is worth. But whatever it is, there is a certain amount of money that you have to pay if the ox killed a person. While if a person kills a person, if ืื“ื kills a person, then there is no money that you have to pay, or the person will be punished by death penalty if he did it ื‘ืžื–ื™ื“, if he did it ื‘ืฉื•ื’ื’ then he will have to go to ื’ืœื•ืช, but whatever it is, there is no ื“ื™ืŸ of ื›ื•ืคืจ. And that's what the ืžืฉื ื” means: there is a ื—ื•ืžืจื in ืฉื•ืจ over ืื“ื that ืฉื•ืจ pays ื›ื•ืคืจ, while ืื“ื does not pay ื›ื•ืคืจ. And then, ืœื ื”ืจื™ ื”ืื“ื ืฉื—ื™ื™ื‘ ื‘ืืจื‘ืขื” ื“ื‘ืจื™ื ื›ื”ืจื™ ื”ืฉื•ืจ ืฉืื™ืŸ ื‘ื• ืืจื‘ืขื” ื“ื‘ืจื™ื. And then there is a ื—ื•ืžืจื in ืื“ื over ืฉื•ืจ, that if a person damages somebody else, he has to pay four things, which really means he have to pay five things, but one of the five a ืฉื•ืจ also pays, so the ื—ื•ืžืจื an ืื“ื has over ืฉื•ืจ that there are four additional things that a person has to pay if he damaged himself over if his ืฉื•ืจ damaged. And those four things are ืฆืขืจ, ืจื™ืคื•ื™, ืฉื‘ืช, and ื‘ื•ืฉืช. ืฆืขืจ means the pain he had, ืจื™ืคื•ื™ are the doctor bills, ืฉื‘ืช is the fact that he wasn't able to work, and ื‘ื•ืฉืช are the embarrassment. How do you measure them? So ืจืฉืดื™ explains in ืขืžื•ื“ ื‘ืณ, ืฆืขืจ is if, for instance, a person cut off someone else's hand, so you would have to estimate how much would a person be willing to give that he should be cut off through a way that it'll hurt less, it'll be done through medicine rather than to be cut off, and that is the amount of money which the ืฆืขืจ is worth. ืจื™ืคื•ื™ are the bills, the ืฉื‘ืช is the amount of loss he had as far as work is concerned, and ื‘ื•ืฉืช is how much embarrassment he had, you have to estimate and the ื’ืžืจื later on will explain how much that is. So these are four things a person has to pay if he causes someone else's damage, while if his ืฉื•ืจ, his ox damaged somebody, he did not have to pay these four. And this is what the ืžืฉื ื” meant, that there is a ื—ื•ืžืจื in ืื“ื over ืฉื•ืจ, that the ืื“ื pays ืืจื‘ืขื” ื“ื‘ืจื™ื, these four extra things, and the ืฉื•ืจ doesn't. There is a fifth thing which is ื ื–ืง, the actual damage, but that the ื’ืžืจื doesn't mention because that a ืฉื•ืจ also pays. So the ื’ืžืจื just mentions the four which an ืื“ื has that a ืฉื•ืจ does not have. The ื’ืžืจื asks: How can you say that? In the ืžืฉื ื” it continues and it says, ื”ืฆื“ ื”ืฉื•ื” ืฉื‘ื”ืŸ ืฉื“ืจื›ืŸ ืœื”ื–ื™ืง, that the equal point, the common point amongst all the four ืื‘ื•ืช ื ื–ื™ืงื™ืŸ is that they have a ื“ืจืš, it is common for them to be ืžื–ื™ืง. ื•ื›ื™ ืฉื•ืจ ื“ืจื›ื• ืœื”ื–ื™ืง? Is a ืฉื•ืจ a ื“ืจืš to be ืžื–ื™ืง? According to ืฉืžื•ืืœ that learns that ืฉื•ืจ means, as we said before, ืจื’ืœ, so that's true. The ื“ืจืš of a ืจื’ืœ is to be to be ืžื–ื™ืง like we said before that ื”ื™ื–ืงื• ืžืฆื•ื™, it is common to be ืžื–ื™ืง. It is definitely the ื“ืจืš of a ืจื’ืœ to be ืžื–ื™ืง. But now according to ืจื‘ that he says that ืฉื•ืจ includes all three, it also includes ืงืจืŸ, and we said that by ืงืจืŸ, if it wasn't a ืžื•ืขื“ yet, the first few times, you only pay ื—ืฆื™ ื ื–ืง. The reason is because that is not common and we can't expect the person to watch the animal in the beginning because you don't expect the animal to do it. So how can the ืžืฉื ื” say that all four ื ื–ื™ืงื™ืŸ, including ืฉื•ืจ, which includes ืงืจืŸ, is ื“ืจื›ืŸ ืœื”ื–ื™ืง when the truth is by a ืฉื•ืจ it is not ื“ืจื›ื• ืœื”ื–ื™ืง? So the ื’ืžืจื answers: ื‘ืžื•ืขื“. That even by ืงืจืŸ it is also the ื“ืจืš to be ืžื–ื™ืง when he becomes a ืžื•ืขื“. And that's what the ืžืฉื ื” means that all of them ื“ืจื›ืŸ ืœื”ื–ื™ืง, including ืงืจืŸ, because ืงืจืŸ also has one type of ืงืจืŸ which is ื“ืจื›ื• ืœื”ื–ื™ืง. And the ื’ืžืจื asks: ื•ืžื•ืขื“ ื“ืจื›ื• ืœื”ื–ื™ืง? Is it true that when the ืฉื•ืจ becomes a ืžื•ืขื“, after he does it a few times, it becomes his ื“ืจืš, his way to be ืžื–ื™ืง? And the ื’ืžืจื answers, yes, ื›ื™ื•ืŸ ื“ืื™ื™ืขื“ ืื•ืจื—ื™ื” ื”ื•ื, since he became a ืžื•ืขื“, yes this became his ื“ืจืš that he is ืžื–ื™ืง. Then the ื’ืžืจื continues: ืื“ื ื“ืจื›ื• ืœื”ื–ื™ืง? One of the four is ืžื‘ืขื”, and ืจื‘ holds ืžื‘ืขื” is ืื“ื as we said. Now how can the ืžืฉื ื” say that all four their ื“ืจืš is to be ืžื–ื™ืง, if one of the four is ืื“ื, is it the ื“ืจืš of a person to be ืžื–ื™ืง? And the ื’ืžืจื says, yes, ื‘ื™ืฉืŸ, if he is asleep. So the ื’ืžืจื says: ื™ืฉืŸ ื“ืจื›ื• ืœื”ื–ื™ืง? And when a person is asleep it is his ื“ืจืš to be ืžื–ื™ืง to cause damage? And the ื’ืžืจื answers: ื›ื™ื•ืŸ ื“ื›ื™ื™ืฃ ื•ืคืฉื™ื˜, since he stretches out and pulls back, ืื•ืจื—ื™ื” ื”ื•ื, it is the ื“ืจืš. And as ืชื•ืกืคื•ืช brings from ื™ืจื•ืฉืœืžื™ this only means if he laid himself down next to the ื›ืœื™ื that he damaged or next to the person that he damaged. But that is clear that if a person lays down and there is nothing next to him and then someone else puts down ื›ืœื™ื and he damages it, he wouldn't be ื—ื™ื™ื‘ because when he lay down there was nothing there. But if he lays down next to ื›ืœื™ื and goes to sleep, it is ื“ืจื›ื• ืœื”ื–ื™ืง, it is the ื“ืจืš that he's ืžื–ื™ืง. Then the ื’ืžืจื continued to ask a ืงืฉื™ื on ืจื‘: It said in the ืžืฉื ื” ื•ืฉืžื™ืจืชืŸ ืขืœื™ืš, one of the common points of all the four ื ื–ื™ืงื™ืŸ was that its ืฉืžื™ืจื” is upon you, in other words you are obligated to watch it. Now if one of the four is ืื“ื, ืื“ื ืฉืžื™ืจืช ื’ื•ืคื• ืขืœื™ื• ื”ื•ื, by a person it's not the ืคืฉื˜ that you have to watch it. By a person the expression should have been the ืฉืžื™ืจื” of his ื’ื•ืฃ is upon himself that he has to watch himself. But the way the ืžืฉื ื” puts it is that you have to watch it. So how can it refer to ืื“ื? So the ื’ืžืจื answers: ื•ืœื˜ืขืžื™ืš, and according to you, in other words if you do not want to accept my opinion and you will not say that the word ืžื‘ืขื” in the ืžืฉื ื” means ืื“ื, you think everything will be straight? It still won't be good because ื”ื ื“ืชื ื™ ื›ื ื, ื›ื ื learned, ื›ื ื is the name of a person and he learned, ืืจื‘ืขื” ืื‘ื•ืช ื ื–ื™ืงื™ืŸ ื ื–ื™ืงื™ืŸ, he also mentioned the four ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, ื•ืื“ื ืื—ื“ ืžื”ืŸ, and he mentioned clearly ืื“ื is one of them. There there is no question what he meant because he said the word ืื“ื. And he also mentioned the word ืฉืžื™ืจืชืŸ ืขืœื™ืš, that its ืฉืžื™ืจื” is upon you. So there you could have the same question: ืื“ื ืฉืžื™ืจืช ื’ื•ืคื• ืขืœื™ื• ื”ื•ื, isn't by a person the ืฉืžื™ืจื” of himself upon himself? How could you say ืฉืžื™ืจืชืŸ ืขืœื™ืš? So really he is saying, it's not a ืงื•ืฉื™ื on me, it's a ืงื•ืฉื™ื on everybody. But on me it would be a ืงื•ืฉื™ื only the way I learn ืคืฉื˜ in the ืžืฉื ื”. But according to everybody, it's a ืงื•ืฉื™ื on ืงืจื ื. So what will everybody answer in what ืงืจื ื said? ืืœื you must say, ื›ื“ืืžืจ ืœื™ื” ืจื‘ ืื‘ื”ื• ืœืชื ื, but you must say, the ืคืฉื˜ is like ืจื‘ ืื‘ื”ื• said to the ืชื ื, to the one that taught, that was learning. He said, ืชื ื™ ืื“ื ืฉืžื™ืจืช ื’ื•ืคื• ืขืœื™ื•, that when it speaks about a person, you have to learn, you have to explain, that concerning the person, it means ืฉืžื™ืจืช ื’ื•ืคื• ืขืœื™ื•. In other words, even though the general expression is ืฉืžื™ืจืชืŸ ืขืœื™ืš, that the obligation of watching it is upon you, but when it means by a person, is that you have to watch yourself. So just like we're going to answer that in ืงืจื ื's words, and that answer will have to go according to everybody, ื”ื›ื ื ืžื™, so too in the ืžืฉื ื”, ืชื ื™ ืื“ื ืฉืžื™ืจืช ื’ื•ืคื• ืขืœื™ื•. Learn that in the ืžืฉื ื”, when it says ืฉืžื™ืจืชืŸ ืขืœื™ืš, so when it speaks about the person, there it means that the ืฉืžื™ืจื” of the person is upon himself. In other words, what he's trying to say, that we cannot ask a ืงื•ืฉื™ื from the word ืฉืžื™ืจืชืŸ ืขืœื™ืš, because even though the literal translation would be that its ืฉืžื™ืจื” is upon you, but if we speak about ืื“ื specifically, it would mean that he has to watch himself. And the ื’ืžืจื continues, ืžืชืงื™ืฃ ืœื” ืจื‘ ืžืจื™, ืจื‘ ืžืจื™ asked a question, ื•ืื™ืžื let us say, ืžื‘ืขื” ื–ื” ื”ืžื™ื, that ืžื‘ืขื” means water, if they caused damage to somebody through water. Now, what is the connection between ืžื™ื and ืžื‘ืขื”? ื›ื“ื›ืชื™ื‘ because there is a ืคืกื•ืง that says, ื›ืงื“ื•ื— ืืฉ ื”ืžืกื™ื ืžื™ื ืชื‘ืขื” ืืฉ. Just like fire melts certain things, as ืจืฉืดื™ says, for instance, tar or wax or anything else, the same, and ืžื™ื ืชื‘ืขื” ืืฉ, and water is bubbled through fire, so too ื”ืฉื says He will show, when He will destroy the enemies He will show His great Name. But in the meantime we see that the ืคืกื•ืง uses the word ืžื™ื ืชื‘ืขื” ืืฉ, that the word ืชื‘ืขื” refers to ืžื™ื, so ืžืžื™ืœื the question is maybe when it says in the ืžืฉื ื” ืžื‘ืขื”, which is from the same root as ืชื‘ืขื”, maybe it refers to the ืžื™ื, if a person caused damage through water. And the ื’ืžืจื answers, ืžื™ ื›ืชื™ื‘ ืžื™ื ื ื™ื‘ืขื•? ืชื‘ืขื” ืืฉ ื›ืชื™ื‘. Does it say ืžื™ื ื ื™ื‘ืขื•? It says ืชื‘ืขื” ืืฉ. If the word ืชื‘ืขื” would refer to the water, since ืžื™ื is ืœืฉื•ืŸ ืจื‘ื™ื, it's plural, so it should have said ืžื™ื ื ื™ื‘ืขื•, the water will bubble, they will bubble. But since it says ืชื‘ืขื” ืืฉ, ืชื‘ืขื”, which means it will make bubbles, so really the word ืชื‘ืขื” refers to the fire, that the fire will make bubble the water. So we cannot say that ืžื‘ืขื” means ืžื™ื, because we do not find the word ืžื‘ืขื” should refer to water, because in this ืคืกื•ืง, the word ืชื‘ืขื” does not apply to the water, but it applies to the fire. Then the ื’ืžืจื asks, ืžืชืงื™ืฃ ืœื” ืจื‘ ื–ื‘ื™ื“, so ืจื‘ ื–ื‘ื™ื“ asked a ืงื•ืฉื™ื, ื•ืื™ืžื so let us say ืžื‘ืขื” ื–ื• ื”ืืฉ, that ืžื‘ืขื” means fire, ื“ื”ื ื›ืชื™ื‘ ืชื‘ืขื” ืืฉ, ื•ื“ื›ืชื™ื‘ because as we just said the word ืชื‘ืขื” applies to the ืืฉ, to the fire, so ืžืžื™ืœื we find ืžื‘ืขื” meaning ืืฉ. So when it says in the ืžืฉื ื” ืžื‘ืขื”, it means ืืฉ. So the ื’ืžืจื asks, ืื™ ื”ื›ื™ if so, ืžืื™ ื”ืžื‘ืขื” ื•ื”ื”ื‘ืขืจ? What's the ืคืฉื˜ in the ืžืฉื ื” when it says ื”ืžื‘ืขื” ื•ื”ื”ื‘ืขืจ? ื”ื‘ืขืจ definitely means the fire. So when it says in the ืžืฉื ื” ื”ืžื‘ืขื” ื•ื”ื”ื‘ืขืจ, so definitely ืžื‘ืขื” does not mean fire, because the next word ื”ื‘ืขืจ means the fire. So how can we say that ืžื‘ืขื” means fire? ื•ื›ื™ ืชื™ืžื and if you will tell me, ืคื™ืจื•ืฉื ืงืžืคืจืฉ, that really he's explaining himself, ืžื‘ืขื” means fire, but since people wouldn't understand what it means, so he says ื•ื”ื”ื‘ืขืจ, and what did I mean with ืžื‘ืขื”? I meant fire. So really ืžื‘ืขื” does mean fire and ื”ื‘ืขืจ is only the explanation. But we couldn't say that, ืื™ ื”ื›ื™ if so, ืืจื‘ืขื”? How could the ืžืฉื ื” say that there are four ืื‘ื•ืช ื ื–ื™ืงื™ืŸ? ืชืœืชื ื”ื•ื•! There are only three! Because it says ืฉื•ืจ and ื‘ื•ืจ, that's two, ื”ืžื‘ืขื” ื•ื”ื”ื‘ืขืจ are really one, because we're just saying now ืžื‘ืขื” means fire and ื”ื‘ืขืจ is the explanation. So therefore we cannot say that the word ืžื‘ืขื” means fire, because in the ืžืฉื ื” it says there are four ืื‘ื•ืช ื ื–ื™ืงื™ืŸ. ื•ื›ื™ ืชื™ืžื and if you're going to tell me and try to answer, ืชื ื ืฉื•ืจ ื“ืื™ืช ื‘ื™ื” ืชืจืชื™, that really there are four, because the word ืฉื•ืจ would include two. ืฉื•ืจ might mean ืฉืŸ and ืจื’ืœ. And ืงืจืŸ, as we said before, would not be mentioned

Meaning of ืžื‘ืขื” and its relation to fire

because the ืžืฉื ื” only talks about such things which are ืžื•ืขื“ from the beginning, but ืงืจืŸ is a ืชื in the beginning, so ืงืจืŸ is not mentioned. So maybe ืฉื•ืจ means two, it means ืฉืŸ and ืจื’ืœ, then we have ื‘ื•ืจ, ืžื‘ืขื” and ื”ื‘ืขืจ really mean the same. So we would have four. So we're back to the question, maybe ืžื‘ืขื” means fire. The ื’ืžืจื says, ืื™ ื”ื›ื™ if so, when the ืžืฉื ื” continues and says, ืœื ื–ื” ื•ื–ื” ืฉื™ืฉ ื‘ื”ืŸ ืจื•ื— ื—ื™ื™ื, that there is a ื—ื•ืžืจื in ืฉื•ืจ and ืžื‘ืขื”, that it has a ืจื•ื— ื—ื™ื™ื, ืืฉ ืžืื™ ืจื•ื— ื—ื™ื™ื ืื™ืช ื‘ื™ื”? What kind of life is there in ืืฉ? If we're going to say that ืžื‘ืขื” means fire, and the ืžืฉื ื” says that ืฉื•ืจ and ืžื‘ืขื” have a ืจื•ื— ื—ื™ื™ื, have a life, now if ืžื‘ืขื” means fire, now what kind of life does it have? So we couldn't say that ืžื‘ืขื” means fire. ื•ืชื•, and also, ืžืื™ ืงื ืจืžื™ ื”ืืฉ? It says clearly in the ืžืฉื ื” that there is a ื—ื•ืžืจื in ืฉื•ืจ and ืžื‘ืขื” over ืืฉ. Now if ืžื‘ืขื” means ืืฉ, it wouldn't make sense. What do we mean that there is a ื—ื•ืžืจื in ืžื‘ืขื” over ืืฉ, when really they're the same? So all that proves that ืžื‘ืขื” couldn't be fire. So then what does ืžื‘ืขื” mean? As we said before, according to ืฉืžื•ืืœ, ืžื‘ืขื” means ืฉืŸ, and according to ืจื‘, as we said before, ืžื‘ืขื” would mean ืื“ื. Then the ื’ืžืจื continues:

Rav Oshaya introduces the 13 categories of damages

ืชื ื™ ืจื‘ ืื•ืฉืขื™ื, ืจื‘ ืื•ืฉืขื™ื learned, ืฉืœืฉื” ืขืฉืจ ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, there are thirteen ืื‘ื•ืช ื ื–ื™ืงื™ืŸ, thirteen principal kinds of ื ื–ื™ืงื™ืŸ that a person would be obligated to pay for. So he says, ืฉื•ืžืจ ื—ื ื, if a person watches something for somebody for free, without getting paid, and then the object is lost or spoiled, so there is a case where the person who watched would have to pay. ื•ื”ืฉื•ืืœ, if you borrow something from somebody, and then it's not there, it got spoiled or lost, you would have to pay. ื ื•ืฉื ืฉื›ืจ is if you watch something for somebody and you do get paid for it, so here too, if something happened to it, you must pay. ื•ื”ืฉื•ื›ืจ, or if you rent something from somebody, you also must pay. These four are considered the ืืจื‘ืขื” ืฉื•ืžืจื™ื, the four ืฉื•ืžืจื™ื, and there is a difference in the ื“ื™ื ื™ื concerning these four ืฉื•ืžืจื™ื. The ื“ื™ืŸ is that a ืฉื•ืžืจ ื—ื ื, a person who watches for free, in most cases, he is ืคื˜ื•ืจ from paying if something happens to the object. The only time he is ื—ื™ื™ื‘ to pay is if he is ืคื•ืฉืข, if it got spoiled or lost through his negligence, then he has to pay. The ืฉื•ืืœ is the one that has to pay under all circumstances, in most cases. If it got stolen or lost, he has to pay, even if it happened through an ืื•ื ืก, through force, which means under abnormal circumstances, he still has to pay. Then the ื ื•ืฉื ืฉื›ืจ, which is the one that watches and he gets paid for his watching, he has to pay for regular ื’ื ื™ื‘ื” ื•ืื‘ื™ื“ื”, if it got stolen or lost, he has to pay, certainly if it was through his negligence. The only time he would be ืคื˜ื•ืจ is if it happened ื‘ืื•ื ืก, by force. And the ืฉื•ื›ืจ, the one that rents, has the same ื“ื™ืŸ as the ื ื•ืฉื ืฉื›ืจ. But whatever it may be, in every one of these four cases, there is a possibility for the ืฉื•ืžืจ, for the person who took it, to have to pay. So these are the first four cases that ืจื‘ ืื•ืฉืขื™ื says that a person is obligated to pay, so these are the first four of the thirteen ืื‘ื•ืช ื ื–ื™ืงื™ืŸ. Then he

Additional nine damages completing the thirteen

mentions ื ื–ืง, whenever you cause any damage to somebody, you must pay for the damage. ืฆืขืจ, along with that, as we said before, you must pay for the suffering, for the pain that the person has. ื•ืจื™ืคื•ื™, you must pay for the person's cure, you must pay the doctor bills. ืฉื‘ืช, you must pay for the person's lack of work because he couldn't work through your damage. ื•ื‘ื•ืฉืช, you must pay for the embarrassment you caused him. So here we have nine already, ื•ืืจื‘ืขื” ื“ืžืชื ื™ืชื™ืŸ, and also the four of the ืžืฉื ื”: ื”ืฉื•ืจ ื•ื”ื‘ื•ืจ ื•ื”ืžื‘ืขื” ื•ื”ื”ื‘ืขืจ, so together, ื”ืจื™ ืชืœื™ืกืจ, we have thirteen. Then the ื’ืžืจื asks: ื•ืชื ื ื“ื™ื“ืŸ, and in our ืชื ื, the ืชื ื of our ืžืฉื ื”, ืžืื™ ื˜ืขืžื ืœื ืชื ื™ ื”ื ื™? Why doesn't he mention these nine? Why does he only mention the four he does? Why doesn't he mention the other nine? And the ื’ืžืจื explains: ื‘ืฉืœืžื ืœืฉืžื•ืืœ, well, we understand according to ืฉืžื•ืืœ, ืฉืžื•ืืœ that holds that ืฉื•ืจ means ืจื’ืœ, and ืžื‘ืขื” means ืฉืŸ, so we understand why he doesn't mention the rest, because ื‘ื ื™ื–ืงื™ ืžืžื•ื ื• ืงืžื™ื™ืจื™, ื‘ื ื™ื–ืงื™ ื’ื•ืคื• ืœื ืงืžื™ื™ืจื™. The ืžืฉื ื” is only talking about the damages caused through one's property, through something that belongs to a person, but not through the damage that the person himself caused. And all nine that ืจื‘ ืื•ืฉืขื™ื adds are all damages caused through the person himself, whether he was a ืฉื•ืžืจ, or the ื ื–ืง, ืฆืขืจ, ืจื™ืคื•ื™, ืฉื‘ืช, and ื‘ื•ืฉืช that he has to pay. But those are all things that you have to pay if you yourself caused the damage. And since our ืžืฉื ื” only talks about damage that something that belongs to you caused, so therefore, the ืžืฉื ื” does not mention those nine. ืืœื ืœืจื‘, but according to ืจื‘, that he learns that ืžื‘ืขื” means ืื“ื, so the ืžืฉื ื” also talks about the damage caused through the person himself, ืœื™ืชื ื™, let our ืžืฉื ื”, the ืชื ื of our ืžืฉื ื”, also learn the nine of ืจื‘ ืื•ืฉืขื™ื. And the

Ravโ€™s view: ืžื‘ืขื” as ืื“ื covering all damages

ื’ืžืจื answers: ืชื ื™ ืื“ื ื•ื›ืœ ืžื™ืœื™ ื“ืื“ื. Since it says ืžื‘ืขื”, and ืžื‘ืขื” means ืื“ื, so that includes already everything that an ืื“ื would be responsible to pay for, and therefore he doesn't have to mention those nine, because all those nine are included in the one word of ืžื‘ืขื”, which means ืื“ื, because these are all obligations of the person when he damages. Then the ื’ืžืจื asks: ื•ืœืจื‘ ืื•ืฉืขื™ื ื ืžื™, so according to ืจื‘ ืื•ืฉืขื™ื too, ื”ื ืชื ื ืœื™ื” ืื“ื, didn't he learn ืื“ื? Since ืจื‘ ืื•ืฉืขื™ื also learns the four of the ืžืฉื ื”, and one of them is ืžื‘ืขื”, and according to ืจื‘, ืžื‘ืขื” means ืื“ื, so since ืจื‘ ืื•ืฉืขื™ื learns ืื“ื too, why does he learn all the other nine? Why aren't they included in the one word of ืื“ื? And the ื’ืžืจื answers: ืชืจื™ ื’ื•ื•ื ื™ ืื“ื. ืจื‘ ืื•ืฉืขื™ื wants to write two categories of ืื“ื. ืชื ื ืื“ื ื“ืื–ื™ืง ืื“ื, ื•ืชื ื ืื“ื ื“ืื–ื™ืง ืฉื•ืจ. He wants to separate the ืื“ื, the person, when he damages another person, or a person when he damages an ox. In other words, you could have a person damage someone's property, and you could have a person damage another person. So the ืื“ื that's included in the ืžืฉื ื” in the word ืžื‘ืขื”, according to ืจื‘ ืื•ืฉืขื™ื only refers to a person when he damages someone's property. And therefore, he adds all the others, like ืฆืขืจ, ืจื™ืคื•ื™, ืฉื‘ืช and ื‘ื•ืฉืช, because those are only when the person damages another person. And that's why he mentions them separately. The reason why we say that the ืื“ื of the ืžืฉื ื” would refer to a person when he damages someone's property, since the ืžืฉื ื” doesn't say that, the ืžืฉื ื” just says ืžื‘ืขื”, which means ืื“ื. Now why would ืจื‘ ืื•ืฉืขื™ื say that that ืื“ื means when he damages someone's property rather than damage another person? So ืจืฉ"ื™ says because since ืžื‘ืขื” stands right next to ื‘ื•ืจ, it says ื”ืฉื•ืจ ื•ื”ื‘ื•ืจ ื•ื”ืžื‘ืขื”, so we would learn out from ื‘ื•ืจ to ืžื‘ืขื”. ื‘ื•ืจ definitely only speaks about the damage that was caused to someone's property, not to another person. Because as ืจืฉ"ื™ says, the ื“ื™ืŸ is that we learn out from a ืคืกื•ืง that if a person falls into a pit that someone made, the one that made the pit is ืคื˜ื•ืจ from paying. So since ื‘ื•ืจ definitely does not refer to the damage caused to a person, because if it was caused to a person he would be ืคื˜ื•ืจ, so too the ืžื‘ืขื” which stands right next to ื‘ื•ืจ, which means ืื“ื, would also refer only to the damage caused to someone's property and not to a person. And that's what ืจื‘ ืื•ืฉืขื™ื says, that the ืžื‘ืขื”, which is one of the four, refers to an ืื“ื ื“ืื–ื™ืง ืฉื•ืจ, an ืื“ื that damaged a ืฉื•ืจ or other person's property. But the ืื“ื that I am adding, those things of ืื“ื, those are the damages that a person caused to another person. But then the ื’ืžืจื asks, ืื™ ื”ื›ื™, if so, ืฉื•ืจ ื ืžื™, concerning ืฉื•ืจ too, ืœื™ืชื ื™ ืชืจื™ ื’ื•ื•ื ื™ ืฉื•ืจ. Why doesn't it say two kinds of ืฉื•ืจ? Why doesn't he divide it into two? ืœื™ืชื ื™ ืฉื•ืจ ื“ืื–ื™ืง ืฉื•ืจ, ื•ืœื™ืชื ื™ ืฉื•ืจ ื“ืื–ื™ืง ืื“ื. Let it speak specifically about a ืฉื•ืจ that caused damage to another ืฉื•ืจ, and about a ืฉื•ืจ that caused damage to a person. Why doesn't he divide that into two categories, too? Just like we said ืจื‘ ืื•ืฉืขื™ื wants to divide the ื”ื™ื–ืง a person causes into two: the ื”ื™ื–ืง a person causes to a ืฉื•ืจ and the ื”ื™ื–ืง a person causes to a person. And the ื’ืžืจื answers: ื”ื ืžืื™, what kind of comparison is it? ื‘ืฉืœืžื ืื“ื ื“ืื–ื™ืง ืฉื•ืจ, ืžื™ืœื if we're going to divide concerning the ืื“ื, so there is a difference between the ืื“ื when he damages someone else's property, or when he damages another person. Because when he damages another person's property, like he damages someone's ืฉื•ืจ, ื ื–ืง ื”ื•ื ื“ืžืฉืœื, all he pays is ื ื–ืง. All he pays is for the damage. But ืื“ื ื“ืื–ื™ืง ืื“ื, when a person causes damage to another person, ืžืฉืœื ืืจื‘ืขื” ื“ื‘ืจื™ื, he pays all four things, as we mentioned before: ืฆืขืจ, ืจื™ืคื•ื™, ืฉื‘ืช and ื‘ื•ืฉืช. ืืœื ืฉื•ืจ, but when we talk about the damage a ืฉื•ืจ caused, ืžื” ืœื™ ืฉื•ืจ ื“ืื–ื™ืง ืฉื•ืจ, ืžื” ืœื™ ืฉื•ืจ ื“ืื–ื™ืง ืื“ื, what difference is it whether the ืฉื•ืจ caused damage to another ืฉื•ืจ, or whether the ืฉื•ืจ caused damage to a person? ืื™ื“ื™ ื•ืื™ื“ื™, in both cases, ื ื–ืง ื”ื•ื ื“ืžืฉืœื. All he pays is ื ื–ืง. All the owner of this ืฉื•ืจ that was ืžื–ื™ืง pays is ื ื–ืง. And therefore, there is no reason for ืจื‘ ืื•ืฉืขื™ื to divide it into two categories. But then the ื’ืžืจื asks: ื•ื”ื ืฉื•ืžืจ ื—ื ื ื•ื”ืฉื•ืืœ ื ื•ืฉื ืฉื›ืจ ื•ื”ืฉื•ื›ืจ, ื“ืื“ื ื“ืื–ื™ืง ืฉื•ืจ ื”ื•ื, ื•ืงืชื ื™? We said before that the reason ืจื‘ ืื•ืฉืขื™ื adds these nine, because the ืžื‘ืขื” of the ืžืฉื ื”, the ืื“ื of the ืžืฉื ื”, only refers to a person when he was ืžื–ื™ืง a ืฉื•ืจ, when he was ืžื–ื™ืง someone's property. And therefore, he wants to add the case where a person damages another person. But the ื’ืžืจื says that is not true. That would only be good concerning ืฆืขืจ, ืจื™ืคื•ื™, ืฉื‘ืช and ื‘ื•ืฉืช, he says. But ืจื‘ ืื•ืฉืขื™ื also added the four ืฉื•ืžืจื™ื. He added the ืฉื•ืžืจ ื—ื ื and the ืฉื•ืืœ, the ื ื•ืฉื ืฉื›ืจ and the ืฉื•ื›ืจ. And these are cases ื“ืื“ื ื“ืื–ื™ืง ืฉื•ืจ ื”ื•ื. What kind of damage did the ืฉื•ืืœ or the ืฉื•ืžืจ do? He lost the object that belonged to his friend, so it was a damage caused to an object, and still ืงืชื ื™, he still says it. How can we say that ืจื‘ ืื•ืฉืขื™ื only adds the case of ืื“ื ื“ืื–ื™ืง ืื“ื, when we see he adds also these four ืฉื•ืžืจื™ื, which are cases of ืื“ื ื“ืื–ื™ืง ืฉื•ืจ? And the ื’ืžืจื answers that there's another reason why he adds these. ืชื ื™ ื”ื™ื–ืงื ื“ื‘ื™ื“ื™ื, he wants to learn a damage that was caused through the hands of the person, ื•ืงืชื ื™ ื”ื™ื–ืงื ื“ืžืžื™ืœื, and he also wants to learn separately a case of damage that was done automatically, by the way, not directly, but indirectly. In other words, even though he says that the word ืžื‘ืขื”, which means ืื“ื, refers to ืื“ื ื“ืื–ื™ืง ืฉื•ืจ, refers to a person that caused damage to someone else's property, nevertheless he adds these four because that is only concerning the damage that was caused ื‘ื™ื“ื™ื, when a person actually walks over to somebody else's property and damages it with his hands. For instance, he walks over to his ox, and he kills his ox or hurts his ox. But he also wants to add the case where the person caused damage to somebody not direct, but indirect. And this is the case of the four ืฉื•ืžืจื™ื. These four ืฉื•ืžืจื™ื, he didn't damage someone else's property, he was responsible to watch it, and he didn't watch it properly, and therefore he has to pay. So therefore he makes it into a special category, because he wants to divide even ืื“ื ื“ืื–ื™ืง ืฉื•ืจ, the case where a person caused damage to someone else's property, he also wants to divide into two categories: the category whether he did it ื‘ื™ื“ื™ื™ื, or when he did it indirectly as the case of the four ืฉื•ืžืจื™ื. But one might ask a question. Now that the ื’ืžืจื said that ืจื‘ื™ ืื•ืฉืขื™ื wants to divide ืื“ื into two categories: ืื“ื ื“ืื–ื™ืง ืฉื•ืจ and ืื“ื ื“ืื–ื™ืง ืื“ื, an ืื“ื that was ืžื–ื™ืง someone's property and an ืื“ื that was ืžื–ื™ืง another person, so it seems to be saying that ืจื‘ื™ ืื•ืฉืขื™ื likes to divide everything into more categories. So

Why ืฉื•ืจ isnโ€™t split into ืงืจืŸ, ืฉืŸ, ืจื’ืœ

ืชื•ืกืคื•ืช asks a question: so why then doesn't he divide ืฉื•ืจ into the three categories? Why doesn't he specify ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ? Since there are three ืื‘ื•ืช in ืฉื•ืจ itself, and ืจื‘ื™ ืื•ืฉืขื™ื is the one that tries to divide everything into more categories, so then why doesn't he divide ืฉื•ืจ too into ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ? And ืชื•ืกืคื•ืช answers that ืจื‘ื™ ืื•ืฉืขื™ื would rather not do that because he didn't want to change from the ืชื ื of the ืžืฉื ื”. Since the ืชื ื of the ืžืฉื ื” only writes the word ืฉื•ืจ, and doesn't specify ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ, so ืจื‘ื™ ืื•ืฉืขื™ื too doesn't want to change, and also wants to write ืฉื•ืจ, and not specifically ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ. But as the ืžืคืจืฉื™ื ask here, we don't understand what ืชื•ืกืคื•ืช answers, because concerning ืื“ื we have the same thing: the ืชื ื of the ืžืฉื ื” does not divide ืื“ื into separate categories. He doesn't divide it into ืื“ื ื“ืื–ื™ืง ืฉื•ืจ and ืื“ื ื“ืื–ื™ืง ืื“ื, even though, and nevertheless, ืจื‘ื™ ืื•ืฉืขื™ื does divide it. So we see that ืจื‘ื™ ืื•ืฉืขื™ื does not care to change from the ืœืฉื•ืŸ of the ืชื ื of the ืžืฉื ื”. So then why does ืชื•ืกืคื•ืช say that when it comes to ืฉื•ืจ, he does not want to change the ืœืฉื•ืŸ and he would rather not write ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ, because the ืชื ื of the ืžืฉื ื” does not write ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ either? So the ืžื”ืจืดื answers that there is a difference. Concerning ืื“ื, ืจื‘ื™ ืื•ืฉืขื™ื did not have to change the expression of the ืชื ื in order to divide it into more categories. He could still stick with the word ืžื‘ืขื” as the ืชื ื of the ืžืฉื ื”, and then in order to divide it into more categories, all he has to do is add more cases. He would use the same word of the ืžืฉื ื”, but the ืชื ื of the ืžืฉื ื” would mean with that word all conditions, all cases of ืื“ื, while ืจื‘ื™ ืื•ืฉืขื™ื using the same word as the ืชื ื of the ืžืฉื ื” would only mean the ืื“ื ื“ืื–ื™ืง ืฉื•ืจ. But when it comes to ืฉื•ืจ, if ืจื‘ื™ ืื•ืฉืขื™ื would want to divide it into separate categories and and divide it into ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ, he would have to change the expression of the ืžืฉื ื”. He couldn't write the word of the ืžืฉื ื” which means ืฉื•ืจ, he would have to change and write ืงืจืŸ, ืฉืŸ ื•ืจื’ืœ. That's what ืจื‘ื™ ืื•ืฉืขื™ื doesn't want to do, and therefore, when it comes to change the ืœืฉื•ืŸ of the ืžืฉื ื”, he'd rather stick to the ืชื ื and stick to the ืœืฉื•ืŸ of the ืžืฉื ื” and include all three in one word of ืฉื•ืจ. But where he does not have to change the ืœืฉื•ืŸ of the ืžืฉื ื”, and nevertheless he could divide it into more categories, that's where he does it. And therefore, by ืื“ื, he stays with the word ืžื‘ืขื” which means ืื“ื, and just adds on it the case of ืื“ื ื“ืื–ื™ืง ืื“ื, or the case of ืื“ื ื“ืื–ื™ืง ืฉื•ืจ, but in a case of a ื‘ื“ืจืš ืžืžื™ืœื not ื‘ื™ื“ื™ื™ื. There's one more thing interesting to note concerning the ื’ืžืจื we learned previously.

Chomerah in ืฉื•ืจ vs ืื“ื and karet considerations

When the ื’ืžืจื says that there is a ื—ื•ืžืจื in ืฉื•ืจ over ืื“ื, that ืฉื•ืจ pays ื›ื•ืคืจ while ืื“ื doesn't, that if an ox killed a person then the owner of the ox has to pay ื›ื•ืคืจ, while if a person killed a person you don't pay ื›ื•ืคืจ, and the ื’ืžืจื used that as a ื—ื•ืžืจื in ืฉื•ืจ over ืื“ื, so ืชื•ืกืคื•ืช asks a ืงืฉื™ื: what kind of ื—ื•ืžืจื is that? The reason ืชื•ืกืคื•ืช says why a person does not pay ื›ื•ืคืจ is not because there is a ืงื•ืœื in the ื“ื™ืŸ of ืื“ื, but because since the person will get killed for the act that he did, for killing the other person, we say ืงื ืœื™ื” ื‘ื“ืจื‘ื” ืžื™ื ื™ื”. There is a ื“ื™ืŸ that if a person is ื—ื™ื™ื‘ two punishments, one a stronger one and one a weaker one, for instance, he is ื—ื™ื™ื‘ ืžื™ืชื” for an act that he did, but at the same time he the same act brings about an obligation of money, so the ื“ื™ืŸ is that we say ืงื ืœื™ื” ื‘ื“ืจื‘ื” ืžื™ื ื™ื”. We only give him the stricter one, where we only kill him, and we would not make him pay, because the one that is lighter is automatically included in the one that is stronger. So here, too, when somebody kills somebody else you are ืคื˜ื•ืจ from ื›ื•ืคืจ, it is not because there is a ืงื•ืœื in the ื“ื™ืŸ of the person killing somebody, but it is because of ืงื ืœื™ื” ื‘ื“ืจื‘ื” ืžื™ื ื™ื”, because he will get killed for his act, so therefore we do not make him pay, because that payment is, so to speak, included in the other thing that he gets which is the ืžื™ืชื”. So in that case ืชื•ืกืคื•ืช asks, how could the ื’ืžืจื use this ื“ื™ืŸ that an ืื“ื is ืคื˜ื•ืจ from ื›ื•ืคืจ as a ืงื•ืœื in ืื“ื and as a ื—ื•ืžืจื in ืฉื•ืจ over ืื“ื? And ืชื•ืกืคื•ืช answers in the first ืชื™ืจื•ืฅ, the ืจื™ื‘ืดื answers that since the same ื“ื™ืŸ would apply also in a case of ืฉื•ื’ื’, as ืชื ื ื“ื‘ื™ ื—ื–ืงื™ื” says. In other words, when a person person kills somebody else ื‘ืฉื•ื’ื’, he does not get killed for it, and nevertheless he would be ืคื˜ื•ืจ from ื›ื•ืคืจ. So here, we see that the fact that he is ืคื˜ื•ืจ from ื›ื•ืคืจ is a ืงื•ืœื, because we do not give him the stricter punishment, because for killing somebody ื‘ืฉื•ื’ื’, you are not ื—ื™ื™ื‘ ืžื™ืชื”, and nevertheless, you are ืคื˜ื•ืจ from ื›ื•ืคืจ, so therefore we could use this as a ืงื•ืœื in the ื“ื™ืŸ of ืื“ื. But then the ืจืดื™ says in ืชื•ืกืคื•ืช, that this is no question to begin with, and he proves with all kinds of ืจืื™ื•ืช, that the reason an ืื“ื is ืคื˜ื•ืจ from ื›ื•ืคืจ is not because of ืงื ืœื™ื” ื‘ื“ืจื‘ื” ืžื™ื ื™ื”. In other words, if it would only be because of ืงื ืœื™ื” ื‘ื“ืจื‘ื” ืžื™ื ื™ื”, he probably would be ื—ื™ื™ื‘ to pay ื›ื•ืคืจ. And the reason he is ืคื˜ื•ืจ from ื›ื•ืคืจ is because he is essentially ืคื˜ื•ืจ from ื›ื•ืคืจ. And therefore, the ื’ืžืจื could use this as a ืงื•ืœื in ืื“ื ืœื’ื‘ื™ ืฉื•ืจ, because an ืื“ื is essentially ืคื˜ื•ืจ from ื›ื•ืคืจ, while a ืฉื•ืจ is ื—ื™ื™ื‘ ื‘ื›ื•ืคืจ, so therefore we see a ื—ื•ืžืจื in ืฉื•ืจ over ืื“ื, and therefore the ื’ืžืจื could use this as an explanation in ืคืฉื˜ of the ืžืฉื ื”, ืœื ื”ืจื™ ื”ืฉื•ืจ ื›ื”ืจื™ ื”ืžื‘ืขื”, according to ืจื‘ that ืžื‘ืขื” is ืื“ื, that there is a ื—ื•ืžืจื in ืฉื•ืจ over ืžื‘ืขื”, that ืฉื•ืจ has to pay ื›ื•ืคืจ, while an ืื“ื does not have to pay ื›ื•ืคืจ.
