Today's ืฉืืขืืจ will be in ืืกืืช ืืื ืงืื ืืฃ ื, we will start on ืืฃ ื ืขืืื ื, seven lines from the bottom of the ืขืืื. And the ืืืจื here is in the middle of explaining the ืืจืืืชื where we had the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื. And the ืืืจื quotes from the ืืจืืืชื. It said in the ืืจืืืชื: ืจืื ืขืงืืื ืืืืจ, ืจืื ืขืงืืื said, ืื ืื ืืืชืื, the ืคืกืืง doesn't come, ืืื, but, ืืืืืช ืื ืืงืื ืื ืืขืืืืช, to tell us that when you come to collect money for the damage that someone caused to you, you collect from the ืขืืืืช, from the best of his fields. And as the ืืืจื explained before, the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื is whether you estimate the ืขืืืืช by the ืืืืง or by the ื ืืืง. In other words, if the ืืืืง has two types of fields, he has ืขืืืืช, good fields, and he has ืืืืืจืืช, bad fields, but his ืืืืืจืืช are worth as much as the best of the ื ืืืง, can he give his ืืืืืจืืช, being that as far as the ื ืืืง is concerned it is ืขืืืืช, or must he give his ืขืืืืช? And that was the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื. ืจืื ืืฉืืขืื learns ืืื ืืืง ืฉืืื ื, that you're able to give your ืืืืืจืืช because we judge it as of the ื ืืืง, and therefore since by the ื ืืืง it is ืขืืืืช, you could give him his ืขืืืืช, which means your ืืืืืจืืช, and ืจืื ืขืงืืื holds that the ืชืืจื comes to tell us that you must give your ืขืืืืช, the ืืืืง's ืขืืืืช, and therefore he cannot give him his ืืืืืจืืช even though it is worth as much as the ืขืืืืช of the ื ืืืง, he must give him his ืขืืืืช. But then
ืจืื ืขืงืืื added the words: ืืงื ืืืืืจ ืืืงืืฉ, and this is a ืงื ืืืืืจ when it comes to paying ืืงืืฉ, paying money to ืืงืืฉ, then you certainly have to give ืขืืืืช. And the ืืืจื asks: ืืื ืงื ืืืืืจ ืืืงืืฉ? What does ืจืื ืขืงืืื mean with these words that it's a ืงื ืืืืืจ that ืืงืืฉ you certainly have to give the ืขืืืืช of the ืืืืง? ืืืืืื, if we're going to say he means very simple, ืื ืื ืชืืจื ืืืื ืืชืืจื ืืืงืืฉ, that if an ox of ours, which means an ox of an ordinary person, gored and damaged an ox of ืืงืืฉ, so when the person has to pay to ืืงืืฉ, you also have to pay ืขืืืืช, and that is the ืงื ืืืืืจ he had in mind, that ืื ืืื when you have to pay for the damage that you caused to an ordinary person you must pay from ืขืืืืช, certainly if you caused the damage to ืืงืืฉ you certainly have to pay of ืขืืืืช. That couldn't be, because ืฉืืจ ืจืขืื ืืืจ ืจืืื ื, the ืชืืจื, when it says that you have to pay for the damage that was caused by the goring of your ox, says ืืคืืจืืฉ in the ืชืืจื that if an ox of a person will gore the ox of his friend, then you have to pay. So we ืืจืฉ'ื, ืืื ืฉืืจ ืฉื ืืงืืฉ, not if it gores an ox of ืืงืืฉ. In other words, from this ืคืกืืง we learn out that whenever you cause damage to ืืงืืฉ you are ืคืืืจ completely. The whole ืืื of ืืืื ื ืืงืื, of responsibility to pay for a ื ืืง, is only if it happened to a ืืืืื, to an ordinary person. But if it happened to ืืงืืฉ, you don't have to pay at all. So we can't say that this is what ืจืื ืขืงืืื meant when he said that ืงื ืืืืืจ ืืืงืืฉ, that certainly you have to pay ืขืืืืช when it's ืืงืืฉ, because when you damage ืืงืืฉ you are ืคืืืจ completely. And even though the ืคืกืืง the ืืืจื brings to show that if you damage ืืงืืฉ you are ืคืืืจ completely is the ืคืกืืง ืฉืืจ ืจืขืื, which speaks about ืงืจื, that if one's ox gored an ox of ืืงืืฉ you are ืคืืืจ, but the ืชืืจื does not tell us that you are ืคืืืจ if the damage happened some other way, but ืจืฉ''ื says that the same ืืื applies to all types of ื ืืงืื. And
ืชืืกืคืืช goes into details to tell us how we know that anyway you damage ืืงืืฉ you are ืคืืืจ. And then ืจืฉ''ื says a different ืคืฉื: that the ืืืจื couldn't have mentioned the case of ืฉื, for instance, that an ox of a ืืืืื, an ox of an ordinary person, ate from the field of ืืงืืฉ, and you are ืืืื to pay for that, and then maybe the ืืื would be that even though the damage was done to ืืงืืฉ you still are ืืืื to pay, so ืจืฉ''ื says there is no case possible for an animal of a ืืืืื to eat from a field of ืืงืืฉ. Because he says, what kind of field is it? Is it a field which is called ืฉืื ืืจื, a field that was given to ืืงืืฉ under the category of ืืจื, so the ืืื is that the ืืจื goes to the ืืื ืื, and it doesn't go to ืืงืืฉ. So it becomes property of the ืืื ืื, but it's not holy property. It is not ืืงืืฉ. It is personal property of the ืืื ืื, and has the same ืืื of ืืืืื. So ืจืื ืขืงืืื couldn't have meant that when he said ืงื ืืืืืจ ืืืงืืฉ. It also can't mean, ืจืฉ''ื says, that if an animal ate from the field that was given to ืืงืืฉ to ืืืง ืืืืช, let's say someone donated a field that the worth, the value of that field, should be used for ืืืง ืืืืช, for fixing the upkeep of the ืืืช ืืืงืืฉ, and that would be considered a field of ืืงืืฉ. So ืจืฉ"ื says that that usually wouldn't happen, because it doesn't last long under the ownership of ืืงืืฉ, because or the owner himself, the one that donated it to ืืงืืฉ, would redeem it right away, or someone else would redeem it, and the ืืื would be if someone else redeems it, not the owner himself, then by ืืืื it goes back to the ืืื ืื. So it is hard to find a case where an animal should eat from a field of ืืงืืฉ, a field that belongs to ืืืง ืืืืช. And if we're going to say it did happen, after it was donated to ืืืง ืืืืช, before anyone had a chance to redeem it, so ืจืฉ"ื says, then also we wouldn't be ืืืื because the ืืื is that ืืื ืืขืืื ืืงืจืงืขืืช, that there is no ืืื of ืืขืืื. ืืขืืื which means that when you have, use pleasure from anything belongs to ืืงืืฉ, you are ืืืขื ืืืงืืฉ. But if it's ืงืจืงืข, if it is property, real estate, then there is no ืืื ืืขืืื, and so, too, anything which is ืืืืืจ ืืงืจืงืข, anything which is connected to the ground. So if an animal ate the fruit of the field, which is connected to the ground, so it wouldn't have a ืืื of ืืขืืื. So then this the ืืืจื couldn't mention either. And therefore, the
ืืืจื only mentions the case of a ืฉืืจ, an ox of an ordinary person that gored an ox of ืืงืืฉ, and that's what the ืืืจื thought ืจืื ืขืงืืื meant when he said ืงื ืืืืืจ ืืืงืืฉ, that when you have to pay to ืืงืืฉ, you have to pay with ืขืืืืช, and the ืืืจื says that couldn't be, because we learn out from the ืคืกืืง ืฉืืจ ืจืขืื, that if your animal gores an animal of ืืงืืฉ, you are ืคืืืจ ืืืื. So we're back to the question, what did ืจืื ืขืงืืื mean when he said ืงื ืืืืืจ ืืืงืืฉ? The ืืืจื says, ืืื so we must say, ืืืืืจ, it refers to a case of a person who says, ืืจื ืขืื ืื ื ืืืืง ืืืืช, I take upon myself to give a ืื ื to ืืืง ืืืืช, to ืืงืืฉ. So the ืืื would be ืืืชื ืืืืจ, the ืืืื, the treasurer of ืืงืืฉ would come, ืืฉืงืื ืืขืืืืช, he would take from the ืขืืืืช, that when it comes to pay that donation that he promised to give, he must give from the ืขืืืืช, from the best of his property. Maybe that's what ืจืื ืขืงืืื meant, ืงื ืืืืืจ ืืืงืืฉ, that ืื ืืฉ, when you damage a ืืืืื, an ordinary person, and you come to pay for the damage, you must pay from the ืขืืืืช, certainly if you promise to give money to ืืงืืฉ, you certainly have to give from the ืขืืืืช. So the ืืืจื says that couldn't be, because ืื ืืื ืืื ืืขื ืืื, let him be not more than a ืืขื ืืื. All it is is that he owes money to ืืงืืฉ, so he has the same ืืื like a regular case of a person who owes money to somebody. And the ืืื is ืืืขื ืืื ืืืื ืื ืืช, that when a ืืขื ืืื comes to collect, if the person who is owed the money comes to collect his ืืื, his loan, the ืืื is ืืืื ืื ืืช, that he only could collect ืืืื ืื ืืช. Because, as the rule is that there are three categories. Usually, we know that there are three types of fields: ืขืืืืช, which is the best, ืืื ืื ืืช, which is the middle, the average, and ืืืืืจืืช, which is the worst, the bad quality of fields. And the ืืื is like this: that when you come to collect ื ืืงืื, collect money for damage that someone caused, so then you collect ืืขืืืืช, he has to pay from the best of the fields. When you come to collect a ืืื, if a lender comes to collect from the borrower, so he gets ืืื ืื ืืช. He collects from the average, the middle kind. A woman who comes to collect her ืืชืืื, the ืืชืืื that was written by her husband, where it says that if he dies or if he will divorce her, he will have to give her ืืืชืื ืืื, so when she comes to collect her ืืชืืื, she gets from ืืืืืจืืช, from the worst. And this is what the ืืืจื says here: that we cannot say that what did ืจืื ืขืงืืื mean that ืืงืืฉ collects from ืขืืืืช is a case if somebody promised to give money to ืืงืืฉ, so later he has to pay that promise through ืขืืืืช, because why should he be better than a ืืขื ืืื? And the ืืื by a ืืขื ืืื is that he collects from ืืื ืื ืืช, so why shouldn't ืืงืืฉ also collect from ืืื ืื ืืช? ืืื ืชืืื, ah, you might say, ืกืืจ ืจืื ืขืงืืื, that ืจืื ืขืงืืื holds ืื ืืขื ืืื ื ืื ืืขืืืืช, that every ืืขื ืืื also collects from ืขืืืืช, because there is an opinion that says that a ืืขื ืืื collects from ืขืืืืช, not from ืืื ืื ืืช, from the best, not from the middle kind. So maybe that's what ืจืื ืขืงืืื holds, and that's what he meant, ืงื ืืืืืจ ืืืงืืฉ. So just like a regular ืืขื ืืื, when he comes to collect, he collects from the ืขืืืืช, according to ืจืื ืขืงืืื, so too when ืืงืืฉ comes to collect the promise that this person promised to give to ืืงืืฉ, he would also collect from the ืขืืืืช. So the ืืืจื says we can't say that, because ืืืื ืืืืคืจื. When we want to learn out that ืืงืืฉ collects from ืขืืืืช, the same as a ืืขื ืืื, we want to learn it out from the ืืื of ืืขื ืืื, we could ืืืื ืืืืคืจื, we could schlog up, we could ask a question and disprove the ืจืืื, because we could say, ืื ืืืขื ืืื, you know why a ืืขื ืืื has this ืืืืจื that he could collect from ืขืืืืช? ืฉืื ืืคื ืืื ืื ืืงืื, that his ืื is strong, his power is strong when it comes to ื ืืงืื. A ืืขื ืืื, an ordinary person, if he would have to collect from ื ืืงืื, if he would have to collect not a loan, but that same person would have to collect for a damage that someone caused to him, he would collect from ืขืืืืช. He would collect the money, because if you damage somebody, you have to pay, so he would have collected it, Plus he would collect it from ืขืืืืช. So we're able to say that you know why this ืืขื ืืื collects from ืขืืืืช when he comes to collect his loan? Because this person has a ืืืืจื, the ืืืืจื is that by ื ืืงืื he would have also collected, and also would have collected from ืขืืืืช. ืชืืืจ ืืืงืืฉ, but say ืืืงืืฉ, ืฉืืืจืข ืืืื ืื ืืงืื, that the ืื of ืืงืืฉ, the power of ืืงืืฉ when it comes to ื ืืงืื is weakened, because, as we said before, that if somebody was ืืืืง ืืงืืฉ, you don't pay at all. So ืืงืืฉ has a ืงืืื. ืืงืืฉ in one way, ืืืื collecting money, is weaker than a ืืืืื, than a regular person. So how can we learn out from a ืืืืื ืืขื ืืื, from an ordinary ืืขื ืืื, that just like he collects his loan from ืขืืืืช, so, too, when ืืงืืฉ comes to collect the money owed to ืืงืืฉ, he'll also collect from ืขืืืืช? We could say, "No, you can't learn out ืืงืืฉ from ืืืืื. ืืืืื could collect from ืขืืืืช because we see by ื ืืงืื, you also collect, and you collect from ืขืืืืช, while ืืงืืฉ, when it comes to ื ืืงืื, it wouldn't collect at all, that shows that when it comes to collecting money, ืืงืืฉ has a ืงืืื, ืืงืืฉ is weaker. So maybe ืืงืืฉ will be weaker concerning a loan also, that the money that is owed to ืืงืืฉ, you do not take from ืขืืืืช, but you take from ืืื ืื ืืช." So how can ืจืื ืขืงืืื learn out that ืืงืืฉ collects the promise, the donation that the person promised, ืืงืืฉ would collect that from the ืขืืืืช, and we want to learn that out from a regular ืืขื ืืื, when a regular ืืขื ืืื has a ืืืืจื over ืืงืืฉ? So we cannot learn out the ืืื of ืืงืืฉ. So now that we said that we cannot learn out the ืืื of ืืงืืฉ, that if someone promises money to ืืงืืฉ he must give the ืขืืืืช, so this is not what ืจืื ืขืงืืื meant, so we're back to the question: What did ืจืื ืขืงืืื mean when he said, "ืงื ืืืืืจ ืืืงืืฉ, that when you have to pay ืืงืืฉ, you certainly have to pay from ืขืืืืช of the ืืืืง"? The ืืืจื answers, ืืขืืื, the truth is I'll tell you that the case is, as we said before, ืื ืื ืชืืจื ืืืื ืืชืืจื ืืืงืืฉ, that an ox of ours, which means an ox of an ordinary person, gored an ox of ืืงืืฉ, and that's what ืจืื ืขืงืืื meant, that when you have to pay for that ืืืืง, you must pay from ืขืืืืช of the ืืืืง. ืืืงื ืงืฉืื ืื, ืืื, we asked a ืงืฉืื, ืฉืืจ ืจืขืื ืืืจ ืจืืื ื ืืื ืฉืืจ ืฉื ืืงืืฉ, that the ืชืืจื tells us that only if you gore a ืฉืืจ of your friend, that's when you are obligated to pay, but if your ox gored an ox of ืืงืืฉ, you are completely ืคืืืจ, so how could we say that ืจืื ืขืงืืื meant, when he said, "ืงื ืืืืืจ ืืืงืืฉ", it refers to this case? So we'll answer you, ืจืื ืขืงืืื ืกืืจ ืื ืืจืื ืฉืืขืื ืื ืื ืกืื. ืจืื ืขืงืืื holds like ืจืื ืฉืืขืื ืื ืื ืกืื. In other words, this whole ืืื that we said, that if your ox gores an ox of ืืงืืฉ, you are completely ืคืืืจ, ืจืื ืขืงืืื doesn't hold that way. ืจืื ืขืงืืื holds differently. He holds like ืจืื ืฉืืขืื ืื ืื ืกืื. What does ืจืื ืฉืืขืื ืื ืื ืกืื hold? ืืชื ืื, because we learn in a ืืจืืืชื, ืจืื ืฉืืขืื ืื ืื ืกืื ืืืืจ, ืจืื ืฉืืขืื ืื ืื ืกืื says, ืฉืืจ ืฉื ืืงืืฉ ืฉื ืื ืฉืืจ ืฉื ืืืืื, if a ืฉืืจ of ืืงืืฉ gored a ืฉืืจ, an ox of ืืืืื, an ox belonging to an ordinary person, ืคืืืจ, ืืงืืฉ is ืคืืืจ from paying. But on the other hand, if ืฉืืจ ืฉื ืืืืื ืฉื ืื ืฉืืจ ืฉื ืืงืืฉ, that if a ืฉืืจ of an ordinary person gored a ืฉืืจ of ืืงืืฉ, so ืืื ืชื ืืื ืืืขื ืืฉืื ื ืืง ืฉืื. So whether that ox was a ืชื, it was his first or second or maybe third time that he did it, which in an ordinary case, if this happened, you would only pay ืืฆื ื ืืง, half of the ื ืืง, that's the ืืื, that a ืชื the ืชืืจื says only pays half of the ื ืืง. Only after he turns into a ืืืขื he pays ื ืืง ืฉืื. But if your ox gored an ox of ืืงืืฉ, so whether your ox was a ืชื, ืืื ืืืขื, or your ox was a ืืืขื already, ืืฉืื ื ืืง ืฉืื, you pay the complete ื ืืง. And as ืจืฉืดื explains, that ืจืื ืฉืืขืื ืื ืื ืกืื learns the ืคืฉื in the ืคืกืืง different than we said before. He also learns that the ืชืืจื says ืฉืืจ ืจืขืื, that if your ox gored an ox of your friend, that's when the ืืื ืื of the ืคืกืืง applies, but he explains it differently. He says what the ืชืืจื means to say is that only if you gore an ox of your friend, which means an ox of an ordinary person, that's when there is a difference between ืชื and ืืืขื, that a ืชื would have to pay ืืฆื ื ืืง, half of the ื ืืง, and a ืืืขื would pay the complete ื ืืง, ื ืืง ืฉืื. But if you gored an ox of ืืงืืฉ, then this ืืื doesn't apply, but you always pay ื ืืง ืฉืื. And this is the ืืืืืงืช between ืจืื ืฉืืขืื ืื ืื ืกืื and the ืืืืื, how we ืืจืฉื the ืืจืฉ of ืฉืืจ ืจืขืื ืืื ืฉืืจ ืฉื ืืงืืฉ. The ืืืืื, they ืืจืฉื ืฉืืจ ืจืขืื ืืื ืฉืืจ ืฉื ืืงืืฉ that only by ืฉืืจ ืจืขืื, only if your ox gores an ordinary ox, you pay for the ื ืืง, but if it happened to ืืงืืฉ, then you don't pay at all. While ืจืื ืฉืืขืื ืื ืื ืกืื ืืจืฉื 'ืก it just the opposite way, that only if your ox gored an ordinary ox, that's when if it is a ืชื you pay ืืฆื ื ืืง, you pay only half. But if it happened to an ox of ืืงืืฉ, then you pay always ื ืืง ืฉืื, even if it was a ืชื. So if ืจืื ืขืงืืื holds like ืจืื ืฉืืขืื ืื ืื ืกืื, then we understand what he meant when he said ืงื ืืืืืจ ืืืงืืฉ. Since he holds that if your ox gores an ox of ืืงืืฉ you do have to pay, so what he said was that if when it happens to an ordinary ox you must pay from ืขืืืืช of the ืืืืง, so if your ox gored an ox of ืืงืืฉ where you also have to pay, you certainly have to pay of ืขืืืืช of the ืืืืง because ืืงืืฉ is always stricter than ืืืืื. And if by ืืืืื we are that strict that you have to pay from ืขืืืืช of the ืืืืง, we are certainly that strict if it happened to a ืฉืืจ of ืืงืืฉ that you certainly have to pay from ืขืืืืช of the ืืืืง. Then the ืืืจื asks: ืื ืืื, if so, that we just said that ืจืื ืขืงืืื holds like ืจืื ืฉืืขืื ืื ื ื ืก that you are ืืืื to pay if you gored an ox of ืืงืืฉ, so ืจืื ืืฉืืขืื ืืจืื ืขืงืืื, when we explained before the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื, ืืื, how do we know ืืืขืืืืช ืื ืืืง ืืืืืืจืืช ืืืืืง ืคืืืื, that their ืืืืืงืช is in a case, as we said before, where the ืืืืง has ืืืืืจืืช, and his ืืืืืจืืช is worth as much as the ืขืืืืช of the ื ืืืง, and the ืืืืืงืช is whether he is able to give his ืืืืืจืืช being that this is the ืขืืืืช of the ื ืืืง, or must he give the ืขืืืืช of himself, that is their ืืืืืงืช, ืืืืื, maybe, ืืืืื ืขืืื ืืื ืืืง ืฉืืื ื, maybe everyone agrees, ืจืื ืขืงืืื and ืจืื ืืฉืืขืื, they both hold that you have to give the ืขืืืืช of the ื ืืืง. In other words, if you have ืืืืืจืืช which is worth as much as the ืขืืืืช of the ื ืืืง, you could give your ืืืืืจืืช, maybe they both hold that way. ืืืื, and here, ืืคืืืืชื ืืจืื ืฉืืขืื ืื ื ื ืก ืืจืื ื ืงืืืคืืื, the ืืืืืงืช between them is the same ืืืืืงืช as ืจืื ืฉืืขืื ืื ื ื ืก and the ืจืื ื. ืจืื ืขืงืืื ืกืืจ, and ืจืื ืขืงืืื would hold ืืจืื ืฉืืขืื ืื ื ื ืก, like ืจืื ืฉืืขืื ืื ื ื ืก, that if you damage ืืงืืฉ you still must pay, ืืจืื ืืฉืืขืื ืกืืจ ืืจืื ื, and ืจืื ืืฉืืขืื will hold like the ืจืื ื, he will hold that when you gored an ox of ืืงืืฉ you are ืคืืืจ. In other words, if we look back at the ืืจืืืชื, the ืืจืืืชื did not say clearly what the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื is. And that's why the ืืืจื before had a whole discussion till finally we came to the decision that this was their ืืืืืงืช. Because in the ืืจืืืชื itself all it says is that ืจืื ืืฉืืขืื says that you have to give ืืืื ืืจืื ืฉื ื ืืืง, and ืจืื ืขืงืืื says that the ืชืืจื only came to tell us that you have to give ืื ืืขืืืืช, and ืงื ืืืืืจ ืืืงืืฉ, that's all he said. So before we explained that the ืืืืืงืช was that ืจืื ืืฉืืขืื holds that you have to give the ืืืื of the ื ืืืง, and you don't have to give your best, and ืจืื ืขืงืืื holds that you have to give the best of the ืืืืง. Even though in the ืืจืืืชื it doesn't say clearly that ืจืื ืขืงืืื said you have to give of the ืืืืง, all it says is ืจืื ืขืงืืื said ืื ืื ืืืชืื ืืื ืืืืืช ืื ืืงืื ืื ืืขืืืืช, that the ืชืืจื tells us that you have to pay for ื ืืงืื from ืขืืืืช, but it doesn't say it means the ืขืืืืช of the ืืืืง. We just explained that way the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื, because otherwise we wouldn't know what the ืืืืืงืช is. But now the ืืืจื says, since we just said that ืจืื ืขืงืืื holds like ืจืื ืฉืืขืื ืื ื ื ืก, so maybe the ืืืืืงืช between them is not concerning whether you have to give the ืขืืืืช of the ื ืืืง or the ืขืืืืช of the ืืืืง. Maybe the whole ืืืืืงืช is only in the last words of ืจืื ืขืงืืื, because after ืจืื ืขืงืืื says ืื ืื ืืืชืื ืืื ืืืืืช ืื ืืงืื ืื ืืขืืืืช, that the ืชืืจื only came to tell us that you pay ื ืืงืื from ืขืืืืช, he adds the words ืืงื ืืืืืจ ืืืงืืฉ, that certainly the same ืืื applies to ืืงืืฉ. So maybe this is the whole ืืืืืงืช. They both hold that you give ืืืื, the ืขืืืืช of the ื ืืืง, as ืจืื ืืฉืืขืื said that you have to give from the ื ืืืง, and when ืจืื ืขืงืืื came to argue, he didn't come to argue that you have to give from the ืืืืง, because he did not mention in his words the ืืืืง, he came to argue only with the words ืงื ืืืืืจ ืืืงืืฉ, that certainly the same ืืื applies to ืืงืืฉ. In other words, ืจืื ืืฉืืขืื would hold that you only have to pay ืื ืืขืืืืช when you damaged an ordinary ืฉืืจ, but when you damage ืืงืืฉ you are ืคืืืจ. And ืจืื ืขืงืืื comes and says no, that ืงื ืืืืืจ ืืืงืืฉ, that certainly if you damage ืืงืืฉ you certainly have to pay, and you have to pay ืื ืืขืืืืช. Because when ืจืื ืขืงืืื heard what ืจืื ืืฉืืขืื said, and he understood from ืจืื ืืฉืืขืื's words that he's only dealing with the damage done to ืืืืื, so he understood from ืจืื ืืฉืืขืื that ืจืื ืืฉืืขืื holds that by ืืงืืฉ you are ืคืืืจ, so ืจืื ืขืงืืื came to say no, that the ืชืืจื comes to tell us that you have to collect ืื ืืขืืืืช, ืงื ืืืืืจ ืืืงืืฉ and certainly by ืืงืืฉ. And that's what the ืืืจื asks here: How do we know that the ืืืืืงืช between ืจืื ืขืงืืื and ืจืื ืืฉืืขืื is whether you have to pay the ืขืืืืช based on the ืืืืง or based on the ื ืืืง, maybe the only ืืืืืงืช between them is whether we say ืงื ืืืืืจ ืืืงืืฉ or not, whether when you damage ืืงืืฉ do you have to pay or you don't have to pay? And the ืืืจื answers: ืื ืื, if so, this would be the only ืืืืืงืช, ืืื ืื ืื ืืืชืื, what does ืจืื ืขืงืืื mean with the words ืื ืื ืืืชืื ืืื ืืืืืช ืื ืืงืื ืื ืืขืืืืช? If this would be the only ืืืืืงืช, ืจืื ืขืงืืื should should have just said ืงื ืืืืืจ ืืืงืืฉ. After ืจืื ืืฉืืขืื made his statement that you have to pay the ืขืืืืช of the ื ืืืง, so ืจืื ืขืงืืื should have
said ืงื ืืืืืจ ืืืงืืฉ, that certainly ืืืงืืฉ. In other words, you are only saying it ืืืืืื, I'm telling you that it's ืืืงืืฉ also. But that's not what ืจืื ืขืงืืื did. ืจืื ืขืงืืื started off his argument by saying the ืชืืจื only comes to tell us that you collect for ื ืืงืื from ืขืืืืช. So it comes out that this itself is part of the ืืืืืงืช. As if he's telling to ืจืื ืืฉืืขืื, you said something concerning the ืขืืืืช, I'm telling you that the ืชืืจื only came to tell us that you collect ื ืืงืื ืื ืขืืืืช. What did he mean? So therefore we say he meant that he also argues in what type of ืขืืืืช you have to give. So since ืจืื ืืฉืืขืื said that you have to give the ืขืืืืช of the ื ืืืง, so we understand that ืจืื ืขืงืืื argues and he says you have to give the ืขืืืืช of the ืืืืง. ืืขืื, another ืจืืื that we can't say the only ืืืืืงืช is concerning whether you have to pay for ืืงืืฉ or not, but as far as what kind of ืขืืืืช you have to pay normally they both hold that you pay from the ื ืืืง. ืืื ืงื ืืืืืจ ืืืงืืฉ, what did ืจืื ืขืงืืื mean with the words ืงื ืืืืืจ ืืืงืืฉ, that certainly ืืืงืืฉ? And the
way ืจืฉืดื explains this ืงืฉืื, the ืคืฉื is as follows: now we're saying that ืจืื ืขืงืืื also holds that you have to give ืขืืืืช ืื ืืืง, which is a ืงืืื ืืืื if he would hold that you have to give ืขืืืืช ืืืืืง. So the question of the ืืืจื is, how can we say then ืงื ืืืืืจ ืืืงืืฉ, that certainly this ืืื applies to ืืงืืฉ? The concept of a ืงื ืืืืืจ is that when we find in an easier case a ืืืืจื, so we say that certainly in the stricter case we certainly must have that ืืืืจื. Now here ืจืื ืขืงืืื is saying a ืงืืื, not a ืืืืจื. ืจืื ืขืงืืื is saying, like ืจืื ืืฉืืขืื, that when you pay ืขืืืืช, you don't have to pay ืขืืืืช of the ืืืืง, it's enough if you pay ืขืืืืช of the ื ืืืง. So ืจืื ืขืงืืื is telling us a ืงืืื. So how can he continue and say that certainly this would apply to ืืงืืฉ too? Certainly this ืงืืื, so to speak, would apply to ืืงืืฉ. When the truth is that since ืืงืืฉ is stricter, maybe by ืืงืืฉ it's different, maybe by ืืงืืฉ you have to pay the ืขืืืืช of the ืืืืง. And that's the ืืืจื's ืงืฉืื, how can you say ืงื ืืืืืจ ืืืงืืฉ if you're gonna say that both hold that you pay the ืขืืืืช of the ื ืืืง? ืืขืื, another ืงืฉืื, another ืจืืื that we must say that the ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื is also what kind of ืขืืืืช you normally have to pay, because ืืืืจ ืจื ืืฉื, ืจื ืืฉื said, ืชื ืื ืืืืื, we learn ืืคืืจืืฉ in a ืืจืืืชื, the ืืจืืืชื quotes the ืคืกืืง ืืืื ืฉืืื ืืืืื ืืจืื ืืฉืื, the best of your fields and the best of his vineyard he must pay, so the ืืจืืืชื explains it, ืืืื ืฉืืื ืฉื ื ืืืง ืืืืื ืืจืื ืฉื ื ืืืง, ืืืจื ืจืื ืืฉืืขืื, that ืจืื ืืฉืืขืื holds it means that you have to give the best of your, of his field and the best of the vineyard of the ื ืืืง. ืจืื ืขืงืืื ืืืืจ, ืจืื ืขืงืืื says, ืืืื ืฉืืื ืฉื ืืืืง ืืืืื ืืจืื ืฉื ืืืืง, that what the ืชืืจื means you give the best of the field of the ืืืืง and the best of the vineyard of the ืืืืง. So we see clearly that there is a ืืืืืงืช between ืจืื ืืฉืืขืื and ืจืื ืขืงืืื what kind of ืขืืืืช you have to pay. And therefore we cannot say ืคืฉื in the ืืจืืืชื that we brought before that the ืืืืืงืช is only concerning ืืงืืฉ, but concerning what type of ืขืืืืช you have to give they both hold you give ืขืืืืช of the ื ืืืง, when we have ืืคืืจืืฉ a ืืจืืืชื where it says that there is a ืืืืืงืช whether you have to give ืขืืืืช ืื ืืืง or ืขืืืืช ืืืืืง. Then the ืืืจื continues,
ืจืื ืืื ืืืื ืืจืื, ืืืื asked a ืงืฉืื to ืจืื, ืืชืื, one ืคืกืืง it says ืืืื ืฉืืื ืืืืื ืืจืื ืืฉืื, that you have to pay the best of his fields and the best of his vineyard. So it comes out ืืืื ืืื, only the best you could pay, ืืืื ืืืจืื ื ืื, other things you can't, you have to only give the best. ืืืชื ืื, but we learn in a ืืจืืืชื, the ืคืกืืง says ืืฉืื, this is the ืคืกืืง that says ืืขื ืืืืจ ืืฉืื ืืกืฃ ืืฉืื ืืืขืืื, that if a person digs a ืืืจ a pit and causes damage, so the owner of the pit must pay money, he must return that to its owner. So the word ืืฉืื is extra. The ืคืกืืง could have said ืืขื ืืืืจ ืืฉืื ืืกืฃ ืืืขืืื, that the owner of the pit should pay ืืกืฃ to its owner, to the owner of the thing he caused a damage to. Why does the ืคืกืืง add the word ืืฉืื? So ืืจืืืช, this comes to include, to add ืฉืื ืืกืฃ, that you could pay not only money, you could pay things which are worth money. ืืืคืืื ืกืืืื, even bran, even though this is something very cheap, but as long as you give enough that will equal the amount that you have to pay for the damage, you could even pay with ืกืืืื, with bran. So this comes out to be a contradiction, because in the ืคืกืืง before we mentioned it says ืืืื, that you must give the best, and now we're saying you could give anything, even ืกืืืื. And he answered, ืื ืงืฉืื, there is no ืงืฉืื. ืืื ืืืขืชื, one ืคืกืืง is if you pay willingly, on your own ืืขืช, ืืื And the other ืคืกืืง is ืืขื ืืจืื if you pay by force. If you are pulled to ืืืช ืืื and ืืืช ืืื forces you to pay, so since you caused the person to go through the trouble of getting you to ืืืช ืืื, etcetera, so then you have to pay the best. But if you pay on your own, then you can pay anything, even ืกืืืื.
ืืืจ ืขืืื ืืจืื ืืจืื ืขืืืื, and ืขืืื the son of ืจืื ืขืืืื said: ืืืืงื ื ืื, we could also be ืืืืืง, we could also prove this ืคืฉื from the words of the ืคืกืืง itself. ืืืชืื, because it says in the ืคืกืืง, ืืฉืื, he should pay, and that means ืืขื ืืจืื, by force. The ืคืกืืง says ืืืื ืฉืืื, ืืืื ืืจืื ืืฉืื, that the best of his fields he should pay, and he feels that the word he should pay means that if he is forced to pay. So here we see that the ืคืกืืง where it says that you give ืืืื, is if you are forced to pay, and the ืคืกืืง where we learn out that you could give even ืกืืืื, that is if you pay willingly. ืืืจ ืืื ืืืื, so ืืืื said to him, ืื ืืชืื ืืฉืืื, does the ืคืกืืง say ืืฉืืื, he should be paid? If the ืชืืจื would say that, then it would mean by force, he is paid. In other words, the person does not want to pay, but nevertheless, the person gets paid because they force him to pay. ืืคืืขื ืืฉืื ืืชืื, in the ืคืกืืง it says ืืืื ืฉืืื ืืืืื ืืจืื ืืฉืื, he should pay, which is ืืืขืชื ืืฉืืข, which is ืืฉืืข that he's paying on his own will and his own ืืขืช. So how can you tell me that the ืคืกืืง where it says ืืืื is speaking about ืืขื ืืจืื, if he's forced to pay, when it says ืืฉืื, which is ืืฉืืข he pays willingly? So we're back to the question, there is a contradiction. In one ืคืกืืง it says that you have to pay ืืืื, the best, and in one ืคืกืืง it says that you're able to give even ืกืืืื. ืืื ืืืจ ืืืื, so therefore ืืืื answered, ืืืืจ, the only way we could answer this contradiction is if we're going to use the same logic as my ืจืื used. Because ืจืื, who was the ืจืื of ืืืื, had explained ืคืฉื in a different ืืจืืืชื, and if we're going to use the same logic he used there, we're going to be able to answer this contradiction too. ืืชื ืื, because we learn in a ืืจืืืชื: ืืจื ืฉืืื ืื ืืชืื, ืฉืืืช ืืืจืืื, if a person had houses, or fields and vineyards, ืืืื ื ืืืฆื ืืืืืจื, and he can't find to sell them, ืืืืืืื ืืืชื ืืขืฉืจ ืขื ื ืขื ืืืฆื, we could feed him ืืขืฉืจ ืขื ื up to half. The ืืื is that when a person doesn't own ืืืชืืื ืืื, 200 ืืื, he is considered an ืขื ื, he is considered a poor man, and he is able to collect everything that is given to poor people. He could collect ืฆืืงื, he could collect ืืขืฉืจ ืขื ื, he could collect ืืงื, ืฉืืื, ืคืื, all the things which are given to ืขื ืืื. And here we're talking about a person who owns houses, fields, vineyards, which are worth normally ืืืชืืื ืืื, 200 ืืื. If he would be able to sell them for their normal price, he wouldn't be considered an ืขื ื, and he can't collect anything. And as ืชืืกืคืืช says, we're not talking about the house he lives in, because we don't make a person sell that house, but he has extra homes, he has extra fields, extra vineyards, which could be worth ืืืชืืื ืืื. But ืืคืืขื, it's a case where he cannot get and sell them for the price, and therefore, at this point, he is an ืขื ื. So what we say is that we only could give him the ืืชื ืืช ืขื ืืื, the ืฆืืงื or whatever it is, up to a hundred ืืื, because we assume that even though he can't sell his property for regular price, but it will not become cheaper more than half. So if it's normally worth 200, so at least for a hundred ืืื, he could sell it. So therefore, we assume that he owns a hundred ืืื, so we could give him another hundred ืืื, and that will make that he will have ืืืชืืื ืืื. Now, this is a very big ืืืืืฉ, because normally the ืืื is that when a person doesn't have ืืืชืืื ืืื, he's allowed to take at one time as much as they give him. In other words, even if he has a hundred and ninety nine ืืื, all he is missing to ืืืชืืื ืืื, to 200 ืืื, is one ืืื. So if you give him one ืืื, that's it, he now has ืืืชืืื ืืื, he can't collect anymore. On the other hand, if someone will give him at the same time a thousand ืืื, since it's all given together while he still doesn't have 200 ืืื, then he could take all thousand. But what the ืืจืืืชื is telling us here is that this person who really owns ืืืชืืื ืืื, 200 ืืื, because his field really is worth 200 ืืื, so really maybe he shouldn't be able to collect at all, but since he cannot sell it for its price, so all we're able to give him is a hundred ืืื worth of ืืชื ืืช ืขื ืืื, and we do not apply to him this ืืื that as long as he doesn't have ืืืชืืื ืืื, he could take even a thousand. This person could only take 100. But the ืืืจื is going to ask, ืืืื ืื ืืจ, so the ืจืื, which refers to ืจืื, thought into this and wondered: what is the reason behind this ืืื? ืืืื ืืื, what is the case talking about? ืื ืืืื ืืจืขื ืืืืื ืขืืื, if everyone's field, all real estate became cheap, ืืืืืื ื ืื ืื ืืืืืืื, and his also became cheap along with them, ืืคืืื ืืืื ื ืื ืืคืืื ืืื, we should be able to give him even more, since everyone's became cheap, so this is now the price of the real estate. So if he could sell his, let's say, for a 100, so that means that he doesn't own more than a 100 because this is the price of the fields, because everyone's became cheaper. So why can't we give him more? Why shouldn't we apply to him this ืืื that along as long as he doesn't have 200, we could even give him a 1,000? Because this person doesn't own 200, because this is the price now of the field. ืืื ืืื ืืืืื ืขืืื ื ืื, because everyone else is cheap, too. So this is the price. So he should be able to take even a 1,000 if you give it to him at once. ืืื, you're going to tell me ืืืืงืืจ ืืจืขื ืืืืื ืขืืื, that really everyone else's fields are expensive. They did not become cheaper. ืืืืืื, just his, ืืืืื ืืขืืื ืื ืคืืง ืืืืื, since he's going in and out looking for money, ืื ืืจืขืื, so then that's why his fields, because of what he is doing, because he is trying to sell, that's why it became cheap. People know that he's desperate to sell, so they're not ready to give him the full price because they know he will have to sell it for cheaper. If that is the reason, ืืคืืื ืคืืจืชื ื ืื ืื ืืคืืื ืืื, even a little bit we shouldn't give him, because it is his fault that the field is cheaper. So really, the field is worth its full price now because everyone else's didn't become cheaper. So it is worth 200 ืืื. In other words, this person owns 200 ืืื. If he owns 200 ืืื, we shouldn't be able to give him anything. So why does the ืืจืืืชื say that we could give him up to a 100, up to half? ืืืจ ืืจ, ืื, so ืจืื explained ืคืฉื in this ืืจืืืชื: ืื ืฆืจืืื, that we don't have to tell us that the ืืจืืืชื is in a case ืืืืืื ื ืืกื ืืงืจื ืืจืขื. In the days of ื ืืกื, a field is more expensive. ืืืืืื ืชืฉืจื ืืื ืืจืขื. In the days of ืชืฉืจื, a field is cheaper. And the reason is, because if you buy a field in ื ืืกื, you're still able to plow and plant and still get a crop for that year. While if you buy a field in ืชืฉืจื, you'll have to wait for the next year. So you'll lose out a crop of a year, and therefore, in the month of ืชืฉืจื, fields are cheaper. ืืืืื ืขืืื, everybody, ื ืืจื ืขื ื ืืกื ืืืืื ื. They wait till ื ืืกื to sell. If someone wants to sell his field, he'll wait till ื ืืกื, so he'll sell it for more money. ืืืื, but this person, ืืืืื ืืืืฆืืจืืื ืืื ืืืื, since he needs money, ืืืื ืื ืืืฉืชื, he will have to sell with the price that it's worth now. So really, if we look at it, we could look at it from both ways. On one hand, we could say that he does own 200 ืืื, because really, all he'll have to do is just wait a little bit and he'll be able to get the full price for his field, which is 200 ืืื. On the other hand, since he doesn't have any money now, and he has to sell now, and now he won't get ืืืชืืื ืืื for it, 200 ืืื for it, so we could look at it as if he doesn't own ืืืชืืื ืืื. So therefore we say, ืขื ืคืืื ืืืจืื ืืืืื, up to half it becomes cheaper. In the lowest it could go in the month of ืชืฉืจื is up to half. ืืคื ืืื ืืืจืื ืืืืื, more than that, it will not become cheaper. And therefore we say that since he'll have to sell now, and it becomes cheaper up to half, so he'll only get a 100 for it. So therefore, we could add another 100 so he will get 200. On the other hand, to say that he should be able to collect even a 1,000 because he doesn't own 200, and as we said before, as long as you don't own 200 you could collect at once even a 1,000, to him, it doesn't apply, because really, he does own 200, because his field essentially is worth 200 if he'll only wait till ื ืืกื. So therefore we make a compromise, and we say that we could give him now, because now he will have to sell it for a 100, but we only could give him up to making him own 200, because essentially he already owns 200. So now that we see that there is such a concept of fields being worth more in the month of ื ืืกื and less in the month of ืชืฉืจื, so we could apply that same ืกืืจื to answer the contradiction between the two ืคืกืืงืื that we had before. And the
ืืืจื says like this: ืืืื ื ืื, so here too, ืืื ื ืืงืื, by the ืืื of ื ืืงืื, as we said, ืืื ืื ืืขืืืืช, the ืืื is normally that you have to give ืขืืืืช, you have to give your best. And that's what we learned out from the ืคืกืืง, ืืืื ืฉืืื ืืืืื ืืจืื ืืฉืื, you have to give the best fields. ืื, we said there's another ืคืกืืง that says, ืืฉืื ืืจืืืช ืืคืืื ืกืืืื, that you could give even ืกืืืื. So the ืคืฉื is like this: ืื ืืืจ ืืื ืืืื, if the ื ืืืง, the one that is getting paid, says to the ืืืืง, ืื ืื ืืื ืื ืืช ืืคื ืคืืจืชื, I'd rather take ืืื ืื ืืช, you have to give me the best, I'll do you a favor, I'll take ืืื ืื ืืช, I'll take the middle type of field. And the reason he wants to do it, for instance, is if the ื ืืืง owns a field right next to the ืืื ืื ืืช of the ืืืืง. So it's worth for him to take the ืืื ืื ืืช, even though it's not such a good field. So he says to him, "I'd rather you give me ืืื ืื ืืช and give me a little bigger piece, because for the same amount of money, if you give ืืื ืื ืืช, you have to give more of it than if you give ืขืืืืช." So let's say he says to him, "Give me ืืื ืื ืืช, ืืคื ืคืืจืชื, a little bit bigger." ืืืจ ืืื, so he could say to him, "ืื ืฉืงืืช ืืืื ื ืฉืงืื ืืืืฉืชื. If you're going to take as your ืืื, which is ืขืืืืช, take as it is worth now." In other words, we're talking in a case where the ื ืืืง came to collect his money in the month of ืชืฉืจื, and in the month of ืชืฉืจื fields are cheaper, so in the month of ืชืฉืจื he will collect a bigger piece of field for the same amount of money. But he says, "I would rather not take the ืขืืืืช, I'd rather take ืืื ืื ืืช." So he is able to answer him, "If you're going to take ืขืืืืช, take on the price it's worth now, ืืื ืื, but if not, if you want to go different than your ืืื, you want me to give you ืืื ืื ืืช, then ืฉืงืื ืืืืงืจื ืืืงืืื, take according to the price, the more expensive price that will be later, that will be in the month of ื ืืกื." And that's what the ืคืกืืง meant, that it's up to the ืืืืง if he wants, he could give ืืคืืื ืกืืืื, could give even bran. So according to this ืคืฉื, it doesn't mean that he could actually give him bran, it means that he it's up to him not to give him the worse thing, not to give him the worse field. As we say now, that if he wants a worse piece of property, and it's up to the ืืืืง to tell him, "I don't want to give it to you unless you will take it on the price it will be later." And this is the answer to the contradiction, that if you give ืืืื, then you have to give right away, and you can't tell him, "I will charge you based on the price of later." You have to give it to him at the price of now, because that's the ืืื, you must give ืขืืืืช, and since this is the price now, you must give it to him based on the price now. If he wants something worse, and that's what we mean with ืกืืืื, a worse quality of field, then it is up to the ืืืืง, and the ืืืืง could say, "If you want the ืืื ืื ืืช, then I could give it to you based on the price of later." But one might ask, why did ืืืื have to go through this whole thing to answer the contradiction this way? Why could he answer it very simple? Could have said that when the ืคืกืืง says, ืืืื ืฉืืื ืืืืื ืืจืื ืืฉืื, you have to give ืขืืืืช, that's normal circumstances. When he's ready to take ืขืืืืช, you must give him ืขืืืืช. And the other ืคืกืืง comes to tell us that if the ื ืืืง wants a worse quality of field, then you have to give him that field. That's what the second ืคืกืืง says, that ืืคืืื ืกืืืื, that you have to give him even ืกืืืื, that if the ื ืืืง wants ืืื ืื ืืช, you have to give him ืืื ืื ืืช, and that would answer the contradiction very easily. So ืจืฉืดื says that couldn't be, because if that what the ืคืกืืง would have meant, we wouldn't need a ืคืกืืง for that, because if the ื ืืืง has a right to ask for ืขืืืืช, certainly he has a right to ask for ืืื ืื ืืช, and you would have to give it to him. So the ืคืกืืง wouldn't have to tell us that if he wants ืืื ืื ืืช, then you give him ืืื ืื ืืช. So what does the ืคืกืืง tell us? That if he wants ืืื ืื ืืช, you have a right to tell him, "I'll give it to you based on the price of later." Concerning the
ืืจืืืชื that we brought before, ืืจื ืฉืืื ืื ืืชืื ืฉืืืช ืืืจืืื ืืืื ื ืืืฆื ืืืืืจื ืืืืืืื ืืืชื ืืขืฉืจ ืขื ื ืขื ืืืฆื, ืจืฉืดื tells us another ืคืฉื. The ืคืฉื before was that we're talking about a person who has fields which are worth exactly 200, and the problem is that he cannot sell them for the 200, and therefore he is considered an ืขื ื. And what the ืืจืืืชื said, that we could only give him a hundred ืืื worth of ืืขืฉืจ ืขื ื or of any ืืชื ืืช ืขื ืืื. But then ืจืฉืดื says there's another ืคืฉื, that we're talking about a person who is not an ืขื ื, and these fields, this property could be worth much more, could be worth up thousands. But the ืืจืืืชื is telling us, if there's a person that has no cash, he only has property, but if he's going to sell his property, he's going to have to lose money, because if he'll sell it now to get cash, there will be a loss, he can't sell them for its full price. And the ืืจืืืชื says that since this person can't sell his property for full price, so even though if he'll sell it, he will get much more than 200, could be his property is worth 10,000, and when he sells it, he will get 5,000 for it, we do not tell him, "Sell your property on a loss," but we say, till you're able to sell your property for its full price, in the meantime, since you don't have any cash, you are considered like an ืขื ื, like a poor person, and you are able to collect ืืขืฉืจ ืขื ื. But we only say that if he's able to sell it for less than half its price, then we tell him, "Do not sell it, because the loss will be too big." But if he is going to sell it and he's going to get more than half of its price, then we tell him, "Sell it and you cannot collect ืืขืฉืจ ืขื ื." And that's what the ืืืจื asked. The ืืืจื's ืงืฉืื was, what is it talking about? If everyone else's became cheaper and so did his, then the question is, even if he could sell it for more than half, he should also be able to collect, because really it's not his fault that he's going to have a loss. So since it's It's not his fault for the loss, so why should we make him take the loss? So the ืืืจื's ืงืฉืื is, why did we say that if he's able to sell it for more than half
its value, he can't collect ืืขืฉืจ ืขื ื? He should collect ืืขืฉืจ ืขื ื as long as he can't sell it for its full price. Because the reason he's going to have a loss is not his fault. On the other hand, if we're going to say that everyone else's is worth full price, his is worth less because he is looking for money, so it's his fault that he is going to have a loss, so the ืืื should be, the ืืืจื asks, that even if he is able to sell it for less than its half price, he also shouldn't be able to collect. Because essentially his property is not worth less. His property is worth its full price. The reason he will not get its full price is because of his own fault. So why should we give him ืืขืฉืจ ืขื ื when it's his own fault that he is going to have a loss? So the ืืื should be he should sell his property for whatever price he will get, and since when he will get it, he will definitely have more than ืืืชืื ืืื, he will use that for his food. Why is the ืืื that if he sells it for less than half its value, he is able to collect ืืขืฉืจ ืขื ื and we tell him to not take a loss? And the ืืืจื answered that we are talking in a case where it is worth its full price, the
only thing is it's in the month of ืชืฉืจื, when everyone else's is worth less, but if he's going to wait a little bit till the month of ื ืืกื, he will get its full price, but he can't. So therefore we say, if he's able to sell it up to half its price, so we tell him sell it, and you cannot collect ืืขืฉืจ ืขื ื. Because this is really the common thing, this is the value of your property now. So sell it for that price, even though there will be a loss, but this is the value of your property. And if he'll sell it, he'll get more than 200, because even half its price is worth more than 200, and therefore he cannot collect ืืขืฉืจ ืขื ื. If he's going to have to take a loss more than half, so that is not a normal thing, because that is not a ืืจื for it to go down that much, so then we tell him, do not sell it, and you could collect ืืขืฉืจ ืขื ื till you're able to get half its price. And then the ืืืจื used the same concept to answer the contradiction between the two ืคืกืืงืื, that the ืคืกืืง ืืืื, as we said before, refers to the general ืืื that you must give ืขืืืืช, and the ืคืกืืง ืืฉืื ืืจืืืช ืฉืื ืืกืฃ comes to tell us, as we learned according to the other ืคืฉื, that if he wants ืืื ืื ืืช, then the ืืืืง is able to tell him that if you take ืืื ืื ืืช, not like your ืืื is, I could charge you based on the price that it'll be worth in the month of ื ืืกื. Then the ืืืจื says, ืืชืื ืจื ืืื ืืจ ืืขืงื. ืจื ืืื ืืจ ืืขืงื
asked a ืงืฉืื, ืื ืื, if you're going to say that ืคืฉื, that if he wants ืืื ืื ืืช in the month of ืชืฉืจื, he could tell him, "I will give it to you based on the price of ื ืืกื," which means you will get a smaller piece, because in the month of ื ืืกื it's going to be worth more, ืื ืื ืืืจืขืช ืืืื ืฉื ื ืืืงืื ืืฆื ืืื ืื ืืช ืืืืืืจืืช, that means that you weakened the power of a ื ืืืง concerning ืืื ืื ืืช and ืืืืืจืืช. ืืจืืื ื ืืืจ, the ืชืืจื says, ืืืืื, that you have to give him even from the best, ืืืช ืืืจืช, and you're saying, ืืืื ืื ืืช ืืืืืืจืืช ื ืื ืื, that even from ืืื ืื ืืช and ืืืืืจืืช you can't give him. Because as you said, that if he wants ืืื ืื ืืช, and the same thing would be if he wants ืืืืืจืืช, you're able to charge him more. So you're weakening his ืื concerning collecting ืืื ืื ืืช and ืืืืืจืืช, but it should be just the opposite. When the ืชืืจื said that a ื ืืืงืื collects from ืขืืืืช, it means even from ืขืืืืช. Certainly he could collect from ืืื ืื ืืช and ืืืืืจืืช. And what you're saying is that if he wants to collect from ืืื ืื ืืช or ืืืืืจืืช, you could charge him more for it. ืืื ืืืจ ืจื ืืื ืืจ ืืขืงื, so ืจื ืืื ืืจ ืืขืงื said, ืื ืืืื ืืืืืจ, if you do want to compare ืจืื's case, this idea of fields being worth more in ื ืืกื than in ืชืฉืจื, if you want to use that concept concerning a certain ืืื, you can't use it concerning ื ืืืงืื as we said before, because you would be spoiling their ืื in ืืื ืื ืืช and ืืืืืจืืช. You could use it, you could compare it ืืืขื ืืื, to a case of a ืืขื ืืื. ืืืืื ื ืื, to that you could compare it. What does it mean? ืืขื ืืื ืืื ืื ืืืื ืื ืืช. The ืืื by a ืืขื ืืื is, as we said before, that he collects from the middle kinds of fields, the ืืื ืื ืืช. ืืื ืืืจ ืืื, if he says to him, ืืื ืื ืืืืืจืืช ืืคื ืคืืจืชื, "Give me a little bit more, but of ืืืืืจืืช. I'd rather take ืืืืืจืืช than ืืื ืื ืืช." So in this case, ืืืจ ืืื, the borrower could say to him, ืื ืฉืงืืช ืื ืืื ื ืฉืงืื ืืืืฉืชื. If you'll take as your ืืื, you will take the ืืื ืื ืืช, then I have to give it to you based on the price it's worth now. In other words, they're talking in the month of ืชืฉืจื, when fields are cheaper. So he says to him, "If you will take according to your ืืื ืืื ืื ืืช, take it based on the price of now. ืืื ืื, if not, if you want to take ืืืืืจืืช, ืฉืงืื ืื ืืืงืจื ืืืงืื. Take it based on the price, the more expensive price of later. Since I don't have to give you the ืืืืืจืืช, I should give you really ืืื ืื ืืช, you want ืืืืืจืืช, I could give it to you based on the more expensive price of later. And here, ืชืืกืคืืช says, the ืืืจื couldn't ask that we're spoiling the ืื of a ืืขื ืืื, ืขื ืคื ืืื he should get ืืื ืื ืืช, so certainly he could get ืืืืืจืืช. So how could we tell him that we do not want to give him ืืืืืจืืช of the price of now? So ืชืืกืคืืช says such a ืงืฉืื we couldn't ask, because a ืืขื ืืื doesn't really have a strong ืื, because his whole ืืื that a ืืขื ืืื gets ืืื ืื ืืช is only ืืืจืื ื. ืืืืืจืืืชื he should really get ืืืืืจืืช. By ื ืืืงืื, the ืืื that he gets ืขืืืืช is a ืืื from the ืชืืจื. Says, "ืืืื ืฉืืื ืืืืื ืืจืื." So there is a special ืื the ืชืืจื gave him. So the ืืืจื had a good ืงืฉืื before, that if the ืชืืจื gave him the ืื by ืขืืืืช, certainly he has the ืื to collect from ืืื ืื ืืช and ืืืืืจืืช. But by a ืืขื ืืื, the ืืืจื couldn't ask that if he has a ืื for ืืื ืื ืืช, certainly he has a ืื for ืืืืืจืืช, because he really doesn't have a ืื for ืืื ืื ืืช. It's only a ืืื ืืจืื ื that he collects from ืืื ืื ืืช, and therefore the ืืืจื couldn't ask such a ืงืฉืื. But ืืชืงืืฃ ืื ืจื ืืื ืืจืื ืืจื ืืืงื, but ืจื ืืื ืืจืื ืืจื ืืืงื asked a different ืงืฉืื: ืื ืื, if so, ื ืขืืช ืืืช ืืคื ื ืืืื, you will close the door for borrowers. People won't be able to borrow. ืืืืจ ืืื, he will tell him, ืืืื ืืื ืื ืืืื, ืืื ืฉืงืืื ื ืื ืืืฉืชื. If I would have money now, I would've been able to take the ืืืืืจืืช as it's worth now. In other words, if I wouldn't lend you the money, I would have money now. If I would have money now, I could buy any field. So I could buy ืืืืืจืืช now based on the price it's worth now. ืืฉืชื ืืืืื ืืื, now that my money is by you because I lend you money, ืืฉืงืื, I have to take, ืืืืงืจื ืืืงืืื? Now that I want to take ืืืืืจืืช, you'll give it to me based on the expensive price of later? So if a person will know that if he wants to collect ืืืืืจืืช, he'll have to lose out on the deal, people won't lend any money, because by lending money, they lose, as we just said. If he would not have lent him the money, he would've been able to buy the same ืืืืืจืืช for a cheaper price. So by making this ืืื, people will not want to lend money, so we're going to close the doors for people to borrow money. ืืื ืืืจ ืจื ืืื ืืจืื ืืจื ืืืงื, so therefore, ืจื ืืื the son of ืจื ืืืงื said, ืื ืืืื ืืืืืจ, if you do want to use that logic of ืจืื, the case of ืจืื, of a field being more expensive in ื ืืกื and less expensive in ืชืฉืจื, if you do want to use that, you could compare it ืืืชืืืช ืืฉื ืืืืื ื. You could compare it, you could use it, for the case of a ืืชืืื, because ืืืชืืืช ืืฉื ืืื ื ืืืืืืจืืช, because the ืืื of a ืืชืืื is ืืืืืจืืช. When a woman comes to collect her ืืชืืื, she gets only ืืืืืจืืช. ืืื ืืืจื ืืื ืืืื, so if she says to him, ืืื ืื ืืื ืื ืืช ืืืฆืืจ ืคืืจืชื, give me a better kind of field, a little bit less, but I'd rather have ืืื ืื ืืช, a little bit less, than ืืืืืจืืช, a little bit more, and ืขื ืคื ืืื, she can't collect from the ืืื ืื ืืช, so it's really up to him whether he wants to give it to her or not, so here, ืืืจ ืื, he could say to her, ืื ืฉืงืืช ืืืื ื, ืฉืงืื ืื ืืืฉืชื, if you want to take as your ืืื, which is ืืืืืจืืช, take on the price of now, ืืื ืื, if not, if you want to take a better quality field, ืฉืงืื, take, ืืืืงืจื ืืืงืืื, based on the more expensive price of later, since I do not have to give it to you, you have no right to ask for that field. So if I do want to give it to you, I'm able to charge you based on the more expensive price of later. And as ืชืืกืคืืช says, the ืืืจื really could have said the same thing concerning a ืืขื ืืื, that if a ืืขื ืืื, who's supposed to take from ืืื ืื ืืช, says, "I'd rather take from ืขืืืืช," so he's able to tell him, "Since I don't have to give you ืขืืืืช, if you want, take it based on the more expensive price of later." But since the ืืืจื started off with the ื ืืืงืื, which collects ืขืืืืช, and then we went to the case of ืืขื ืืื that collects ืืื ืื ืืช, and we asked a question on that, so we continue and we bring the case of a ืืชืืื, which is ืืืืืจืืช. But the idea is the same: that as long as you want to collect with a better quality field than you're supposed to get, the one that's giving it to you is able to give it to you based on the more expensive price of later. But after all this, it comes out that the question is still not answered. We tried to answer the contradiction between the two ืคืกืืงืื by using the idea of ืจืื concerning the fields that are worth more in the month of ื ืืกื and less in the month of ืชืฉืจื, but the ืืืจื said that couldn't be, because we would be spoiling the power of ื ืืืงืื concerning ืืื ืื ืืช and ืืืืืจืืช, and therefore the ืืืจื said that we can't accept that ืชืืจืืฅ, just that in the meantime, the ืืืจื said that where can we use the idea of ืจืื? Concerning, first we thought a ืืขื ืืื, and then we came to the decision that it could be used for ืืชืืื. But as far as the question is concerned, the question is not answered. That's what the ืืืจื asks now: ืืื ืืงืื ืงืฉืื, but still, we have the ืงืฉืื, what is the answer to that contradiction, that in one ืคืกืืง it says that you have to give ืืืื, and the other ืคืกืืง says that you could give even ืกืืืื?
ืืืจ ืจืื, so ืจืื said, the ืคืฉื is like ืื ืืืืื ืืื ืืืืื basically. Anything that you give, you have to give the best. In other words, if you give a field, you have to give the best field. If you give ืกืืืื, you have to give the best ืกืืืื. You could give whatever you want. You could give or a field or ืฉืื ืืกืฃ, things which are worth money, even ืกืืืื you could give, but whatever you give, you have to give ืืืื. That's what the ืคืกืืง ืืืื means. But the ืืืจื asks, ืืื ืืืื ืฉืืื ืืชืื, doesn't it say that you give the best of your field? So how can you say that whatever you give you give the best, when the ืชืืจื only says you give the best of the field? If the ืชืืจื would mean that whatever you give you give the best, the ืชืืจื should have said ืืืื and not mention the word ืฉืืื, and we would know that you have to give the best. ืืื, so the real ืชืืจืฅ would be ืื ืืชื ืจื ืคืคื ืืจื ืืื ื ืืจืื ืืจื ืืืืฉืข ืืื ืจื, when ืจื ืคืคื and ืจื ืืื ื ืืจืื ืืจื ืืืืฉืข came from ืจื, ืคืืจืฉืื, they explained it. They answered the question and they said that ืื ืืืื ืืืื ืืื, everything is called ืืืื. Everything but a field, whatever ืืืืืืื you give, is always considered ืืืื, is always considered good, because ืืื ืื ืืืืื ืืื, if you can't sell it here, ืืืืื ืืืชื ืืืจืืชื, you can sell it in a different city. So every object, even ืกืืืื, is considered ืืืื. ืืืจ ืืืจืขื, except a field, ืืืืช ืื ืืืืื, by a field you must give the best and you cannot give a bad field, ืื ืืืื ืืืืงืคืฆื ืขืื ืืืื ื, in order that customers should jump on it. By a field, you can't say that every field is good, because a field if it's not a good field and you can't sell it here, you can't take it with you someplace else and say, "I'll find a customer someplace else." And therefore, by a field you must give the best, but other objects, whatever you give is considered the best. And that answers the contradiction: The ืคืกืืง ืืืงืข says that by a field you must give the best, and nevertheless you could give if you want any other object, including ืกืืืื, because every other object is equal to the best of the field, because if you can't sell it here, you could sell it in another place. It is important to know that concerning the ืืจืืืชื that we learned before of the person who has property and he can't find to sell them for its real price, and therefore there's a question whether he could collect ืืขืฉืจ ืขื ื or not, and we mentioned two ืคืฉืืื of ืจืฉืดื, ืชืืกืคืืช brings a few more ืคืฉืืื, and we will mention one more of the ืคืฉืืื that ืชืืกืคืืช says, and that is the ืคืฉื of the ืจืืดืฃ. The ืจืืดืฃ has a different ืืืจืกื here in the ืืืจื than we have. Generally speaking, the ืคืฉื of the ืจืืดืฃ is similar to the second ืคืฉื of ืจืฉืดื, but just the ืืืจื's ืงืฉืื according to the ืจืืดืฃ will be different than the way ืจืฉืดื learns. According to the ืจืืดืฃ, the ืคืฉื here too is that a person has many, many fields which altogether are worth much more than 200. The only thing is he can't sell them for its full price and he doesn't have any cash now to buy food for. And what the ืืจืืืชื says is, as according to the second ืคืฉื of ืจืฉืดื, that if he's able to sell them up to half of the worth, then we say that you cannot collect ืืขืฉืจ ืขื ื. If he's able to sell them for less than half of its worth, then we say he could collect ืืขืฉืจ ืขื ื. But the ืืืจื's ืงืฉืื will be different than the way ืจืฉืดื explained. The way we have the ืืืจืกื in our ืืืจื, the way ืจืฉืดื learns, the ืืืจื's ืงืฉืื was that if everyone else's is cheap too, then the ืืืจื says that even if he could sell it for more than half, we still should give him, because it's not his fault that he can't get its full price. So then, we don't want him to lose any money. So as long as he cannot sell it for its full price, the ืืืจื feels he should get ืืขืฉืจ ืขื ื. Why should he lose even one dollar? On the other hand, if everyone else's didn't become cheaper and only his is cheaper because people see he's desperate for money, so they know they're going to be able to get it for less than its price, and therefore they don't want to give him the full price. If so, the ืืืจื asks, even if he's able to sell it for less than half of its price, he still shouldn't collect, because it's his fault that he's not able to get its full price, and therefore why should we give him ืืขืฉืจ ืขื ื when he himself is the reason why he can't sell it? And when he will sell it for less than half of its price, it will be worth 200, because it's worth much, much more. So the ืืืจื's ืงืฉืื is we shouldn't give him even if he's able to sell it for less than half of its price. But the ืจืืดืฃ learns that the ืงืฉืื in the ืืืจื is just the opposite. The ืืืจื's ืงืฉืื is like this: If everyone else's is also cheap and so is his, then why should he collect ืืขืฉืจ ืขื ื even if he could sell it for less than half? Because if everyone else's is cheap too, then this is the price of the property now. So it's not called a loss; this is how much it's worth. And since it's worth more than 200, so we say let him sell it for whatever he will get, even though it is less than half than what he could have gotten a time before, but now this is the price. So let him sell it for whatever he will get. And since when he sells it, he will get more than 200, he shouldn't be able to collect even if it's half than its original price. And the other hand the ืืืจื asks, if everyone else's didn't go down, it's only his that went down because he is looking for money, here the ืืืจื feels that even if he could get more than half of its price, he still should be able to collect. Because really the property is worth its full price, as we see that others are still worth the full price. So just because he is looking for money, that's why we should make him lose? So therefore the ืืืจื feels that even if he could sell it for more than half, he still shouldn't have to sell it, and we should give him ืืขืฉืจ ืขื ื. Which this logic is complete opposite the way the logic is according to ืจืฉืดื's ืคืฉื. But the ืชืืจืืฅ of the ืืืจื is the same according to all ืคืฉืืื. Another thing which is ืืืื to mention is a ืงืฉืื that ืชืืกืคืืช has. The ืืืจื says that a case is that the fields are worth more in ื ืืกื and less in ืชืฉืจื. So ืชืืกืคืืช asks that concerning fields, ืจืฉืดื gives a good explanation, because in the month of ื ืืกื, if you buy a field then you're still able to get the crop from that year, while if you buy it in the month of ืชืฉืจื, you will lose the crop of that year, and therefore it is cheaper in the month of ืชืฉืจื than in the month of ื ืืกื. But in the ืืจืืืชื, we have a few things mentioned. It says ืืชืื ืฉืืืช ืืืจืืื, houses and fields and vineyards. What would be the reason concerning houses that in the month of ื ืืกื it should be worth more than in the month of ืชืฉืจื? And ืชืืกืคืืช answers that people rent homes during the month of ื ืืกื, so it is the season for people to rent. And it's self-understood that when you sell a house during the season when it's easier to rent it, it is more expensive than when you sell it in a time when you will not be able to rent it. And therefore even concerning ืืชืื, concerning houses, we could say that in the month of ื ืืกื it is more expensive than during the month of ืชืฉืจื.
