Today's 砖讬注讜专 will be in 诪住讻转 讘讘讗 拽诪讗 讚祝 讟, and we will start nine lines from the bottom of 讚祝 讞 注诪讜讚 讘. 讙诪专讗 says: 讗诪专 讗讘讬讬, 讗讘讬讬 said, 专讗讜讘谉 砖诪讻专 砖讚讛 诇砖诪注讜谉 讘讗讞专讬讜转, if 专讗讜讘谉 sold a field to 砖诪注讜谉 with a warranty, with 讗讞专讬讜转, in other words, he was saying that if any 讘注诇 讞讜讘 of mine, any creditor of mine, will come and take away the field for the 讞讜讘, I am responsible to pay you back for that. 讜讗转讗 讘注诇 讞讜讘 讚专讗讜讘谉, and then the 讘注诇 讞讜讘 of 专讗讜讘谉 came, 讜讟专祝 诪砖诪注讜谉, and he took it away from 砖诪注讜谉. 讚讬谞讗 讛讜讗, the 讚讬谉 is, 讚讗讝讬诇 专讗讜讘谉, 专讗讜讘谉 is allowed to go, 讜诪砖转注讬 讚讬谞讗 讘讛讚讬讛, and allowed to have a 讚讬谉 转讜专讛 with the 讘注诇 讞讜讘, he's allowed to have the dispute with the 讘注诇 讞讜讘. 讜诇讗 诪爪讬 讗诪专 诇讬讛, the 讘注诇 讞讜讘 cannot say to 专讗讜讘谉: 诇讗讜 讘注诇 讚讘专讬诐 讚讬讚讬 讗转, you are not the one that is in dispute with me, even though 专讗讜讘谉 was the one that owed him the money, but he says, now that you sold the field, now the field is in 砖诪注讜谉's hands, I took it away from 砖诪注讜谉, if anybody has anything to say, it should be 砖诪注讜谉, but I have nothing to do with you, 专讗讜讘谉. So he can't say that, 讚讗诪专 诇讬讛, because 专讗讜讘谉 could say to him, 讗讬 诪驻拽转 诪讬谞讬讛, if you will take it away from him, 注诇讬 讛讚专, he will come back to me. And since he will come back to me, then I am responsible, and therefore, I am able to have the 讚讬谉 转讜专讛 with you.
讜讗讬讻讗 讚讗诪专讬, some say, 讗驻讬诇讜 砖诇讗 讘讗讞专讬讜转 谞诪讬, that even if he sold the field to 砖诪注讜谉 without a warranty, still 专讗讜讘谉 is able to have the 讚讬谉 转讜专讛 with the 讘注诇 讞讜讘, even though he cannot say to the 讘注诇 讞讜讘 that if you take away the field from 砖诪注讜谉 he will come to me, because he is not responsible, but nevertheless, 讚讗诪专 诇讬讛, he could say to him, 诇讗 谞讬讞讗 诇讬, I do not want, 讚转讛讜讬 诇讬讛 诇砖诪注讜谉 转专注讜诪转讗 注诇讬, that 砖诪注讜谉 should be angry at me. So if you manage to take away the field from 砖诪注讜谉, 砖诪注讜谉 will be upset with me, I don't want that, and therefore, I want to have the 讚讬谉 转讜专讛 with you. And obviously we're talking here in a case where 专讗讜讘谉 has something to say more than 砖诪注讜谉, and therefore 专讗讜讘谉 feels that if he will have the 讚讬谉 转讜专讛, he will win, and therefore, he wants to have the 讚讬谉 转讜专讛, and the 讚讬谉 is that he is allowed to have the 讚讬谉 转讜专讛 with the 讘注诇 讞讜讘 instead of 砖诪注讜谉. But 转讜住驻讜转 asks: what is this case? Because whatever 专讗讜讘谉 is able to 讟注谞讛, 砖诪注讜谉 is able to 讟注谞讛, and even if 砖诪注讜谉 will not 讟注谞讛 that, but we, the 讘讬转 讚讬谉, will 讟注谞讛 it for him. So what does 专讗讜讘谉 gain by having the 讚讬谉 转讜专讛 with the 讘注诇 讞讜讘 instead of 砖诪注讜谉? And we cannot say, 转讜住驻讜转 says, that it's a case, for instance, where the 注讚讜转 that 砖诪注讜谉 has are relatives to 砖诪注讜谉, and not relatives to 专讗讜讘谉, and therefore 专讗讜讘谉 wants to be the one so he could bring the 注讚讜转, because the truth is that in this case, even 专讗讜讘谉 couldn't bring the 注讚讜转, because if the 注讚讜转 are relatives to any of the people involved, they are 驻住讜诇 注讚讜转. So 转讜住驻讜转 asks: what does 专讗讜讘谉 gain by 讟注谞讛'谉? 转讜住驻讜转 says, for instance, it's 谞讜讙注 to 专讗讬讛 讗讞专讜谞讛. For instance, if someone says, "I do not have any proof," and later on he comes and he says, "I do have proof," we cannot accept it. So this is a case where 砖诪注讜谉 already had said, "I don't have proof," and later they found proof, so if 砖诪注讜谉 has the 讚讬谉 转讜专讛, he cannot bring that proof, but if 专讗讜讘谉 has the 讚讬谉 转讜专讛, he could bring the proof. Or 转讜住驻讜转 gives another answer, a very practical answer, that let's say that the 讘注诇 讞讜讘 said he's only going to have the 讚讬谉 转讜专讛 in the 讘讬转 讚讬谉 讛讙讚讜诇, and the 讚讬谉 is that we must listen to him and go to the 讘讬转 讚讬谉 讛讙讚讜诇 to have the 讚讬谉 转讜专讛, and 砖诪注讜谉 is not able, for whatever reason, to go, but 专讗讜讘谉 is able to go. So if the 讘注诇 讞讜讘 would have a right to say to 专讗讜讘谉, "诇讗讜 讘注诇 讚讘专讬诐 讚讬讚讬 讗转, that I have nothing to do with you," then the 讚讬谉 转讜专讛 would be 讘讟诇, but if we say that 专讗讜讘谉 is able to have the 讚讬谉 转讜专讛, then he is able to go to 讘讬转 讚讬谉 讛讙讚讜诇 and have the 讚讬谉 转讜专讛. And the 讙诪专讗 continues: 讜讗诪专 讗讘讬讬, and also did 讗讘讬讬 say, 专讗讜讘谉 砖诪讻专 砖讚讛 诇砖诪注讜谉 砖诇讗 讘讗讞专讬讜转, if 专讗讜讘谉 sold a field to 砖诪注讜谉 without 讗讞专讬讜转, without a warranty, 讜讬爪讗讜 注诇讬讛 注住讬拽讬谉, and then some people came to argue, to claim that the field didn't originally belong to 专讗讜讘谉 and 专讗讜讘谉 had no right to sell it to 砖诪注讜谉, so 注讚 砖诇讗 讛讞讝讬拽 讘讛, as long as 砖诪注讜谉 did not make a 讞讝拽讛, did not acquire ownership over the field, 讬讻讜诇 诇讞讝讜专 讘讜, he could have 讞专讟讛, he could change his mind, and the whole deal is nullified and it goes back to 专讗讜讘谉. But 诪砖讛讞讝讬拽 讘讛, after he made the 讞讝拽讛, he already acquired the field, 讗讬谉 讬讻讜诇 诇讞讝讜专 讘讜, he cannot have 讞专讟讛. 诪讗讬 讟注诪讗, what is the reason? 讚讗诪专 诇讬讛, 专讗讜讘谉 could say to 砖诪注讜谉, 讞讬讬转讗 讚拽讟专讬, a bag full of knots, 住讘专转 讜拽讘诇转, you accepted it and you bought it, you bought it 诇讻转讞讬诇讛 at a risk, you bought it without 讗讞专讬讜转. So now when you find out that it might be taken away from you, too bad, it's as if you bought a bag full of knots, in the old times they used to sell bags that you would pay a certain price, and it was a risk. It could be that you will get your money's worth or more than your money's worth, or could be it's a bag full of knots and there's nothing in there. So he says, since you bought it without 讗讞专讬讜转, you accepted whatever you will get, and since you already made the 讞讝拽讛, so it's yours, too bad, you have to keep it. And then the 讙诪专讗 asks: 诪讗讬诪转 讛讜讛 讞讝拽讛? When is it considered that he made a 讞讝拽讛 and he acquired ownership? And the 讙诪专讗 says: 诪讻讬 讚讬讬砖 讗诪爪专讬, as soon as he steps onto the border, he walks onto the field, then the field becomes his. But this was said 讜讚讜拽讗 砖诇讗 讘讗讞专讬讜转. This was only if he bought the field without 讗讞专讬讜转, without a warranty. 讗讘诇 讘讗讞专讬讜转 诇讗, but if he bought the field with 讗讞专讬讜转 that the seller, 专讗讜讘谉, is responsible if it'll be taken away from him, 诇讗, then this doesn't apply and he could have 讞专讟讛. Because he could say that what'll happen if they do take it away from me? Anyway I will come back to you, and you will have to pay me back for the field. So why wait for then? I want to have 讞专讟讛 right now as soon as he heard that there are 诪注专注专讬诐, people who want to take it away. And the 讚讬谉 is that he could have 讞专讟讛, and 专讗讜讘谉 has to give him back his money. 讜讗讬讻讗 讚讗诪专讬, some say 讗驻讬诇讜 讘讗讞专讬讜转 谞诪讬, that even if he sold it with 讗讞专讬讜转, with a warranty, he still can't change his mind after he made the 讞讝拽讛. If they will take it away from him, then he will be able to come to him and say, "You sold it to me with 讗讞专讬讜转, now they took it away, pay me for it." But as long as they didn't take it away, he cannot change his mind if he made the 讞讝拽讛 already. 讚讗诪专 诇讬讛, because 专讗讜讘谉 could say to him: 讗讞讜讬 讟讬专驻讱, show me the document that says that they took it away from you, 讜讗砖诇诐 诇讱, I will pay you, because I took 讗讞专讬讜转. But as long as you cannot show me that document, which means as long as they didn't take it away from you, you cannot change your mind. This is the way 专砖状讬 learns the 驻砖讟 in this 讙诪专讗, that when the 讙诪专讗 says that it depends whether he made a 讞讝拽讛 or not, this 讞讝拽讛 is a 拽谞讬谉. This is the act of acquisition, the way the person acquires the field. And what the 讙诪专讗 is saying is that if he didn't acquire yet, then he could change his mind. If he already acquired it, it became his, so then he cannot change his mind. And the 讙诪专讗's 拽砖讬讗 was, what makes the person have a 讞讝拽讛? And the 讙诪专讗 answered, when you step on the borders. But 转讜住驻讜转 asks a few 拽砖讬讜转. One 拽砖讬讗 is that if the 讞讝拽讛 here means the way he acquired the field, why did the 讙诪专讗 pick 讞讝拽讛? There are three ways a person is able to be 拽讜谞讛 a field: there's 讻住祝, 砖讟专, 讜讞讝拽讛. So why did the 讙诪专讗 pick 讞讝拽讛? The 讙诪专讗 could have picked 讻住祝, which is through paying money, or through giving a document. Why did the 讙诪专讗 pick 讞讝拽讛? Another question 转讜住驻讜转 asks is, why does the 讙诪专讗 ask here, when does it become a 讞讝拽讛? There's a 讘驻讬专讜砖注 诪砖谞讛 in 讘讘讗 讘转专讗 that says what is considered a 讞讝拽讛 by 拽专拽注 when you buy property. It says there 谞注诇, 驻专抓, 讜讙讚专. If you close the gate, or you break open the gate, or you put up a gate, that is a 讞讝拽讛. So why all of a sudden here did the 讙诪专讗 remind itself to ask, what is a 讞讝拽讛? Another question: why does the 讙诪专讗 ask that here? There are so many places in 讙诪专讗 where the 讙诪专讗 mentions 讞讝拽讛 concerning buying property, and the 讙诪专讗 doesn't ask what a 讞讝拽讛 is. Another question is that what is the answer of the 讙诪专讗? The answer is that the 讞讝拽讛 is when you step on the property, this doesn't fit to what the 诪砖谞讛 says in 讘讘讗 讘转专讗. There it seems that 讞讝拽讛 you have to do something more than just stepping onto the field. And therefore 转讜住驻讜转 learns that here, in both cases, whether he made a 讞讝拽讛 or not, we're talking that he was 拽讜谞讛, it's his already. But when the 讙诪专讗 says that if he didn't make a 讞讝拽讛, he still could change his mind, it doesn't mean a 讞讝拽讛 of 拽谞讬谉. It means a different type of 讞讝拽讛, that as long as he didn't do that, he could still change his mind. And that's what the 讙诪专讗 asks: what kind of 讞讝拽讛 do we mean here that even though he was 拽讜谞讛 it, but as long as he didn't make this 讞讝拽讛, he could still change his mind? And the 讙诪专讗 answers, by walking onto the field. That if he didn't step onto the field, that even though it became his already, but the 拽谞讬谉 is not complete yet, and therefore he could still change his mind. But after he made the 讞讝拽讛, which means he already stepped into the field, then he cannot change his mind. But 转讜住驻讜转 says that this is all only if he didn't pay any money yet, and 转讜住驻讜转 brings a 专讗讬讛 to that. Then the 讙诪专讗 continues: 专讘 讛讜谞讗 讗诪专, 专讘 讛讜谞讗 says, and as 专砖状讬 explains, this goes back to the question that the 讙诪专讗 asked before. 讗讘讬讬 had asked a 住转讬专讛, there's a contradiction between two 驻住讜拽讬诐: one 驻住讜拽 says 诪讬讟讘 砖讚讛讜 讜诪讬讟讘 讻专诪讜 讬砖诇诐, that you must pay the best of your field or the best of your vineyard, and the other 驻住讜拽 says 讬砖讬讘, and the 讙诪专讗 learns out from that word 讬砖讬讘 that you could pay even 砖讜讛 讻住祝, even objects which are worth money, and more than that, even 住讜讘讬谉, even bran, objects which are worth very little money, you could pay that as long as you give enough that will make up the amount of money that you owe. And this is what 专讘 讛讜谞讗 is going to answer. 专讘 讛讜谞讗 is saying: 讗讜 讻住祝 讗讜 诪讬讟讘, that a person is able to pay or money or the best of his field. And the 讙诪专讗 still didn't explain how this answers the 住转讬专讛 that we had before, but as 转讜住驻讜转 says says, according to 专砖"讬, that before 专讘 讛讜谞讗 had a chance to explain himself and to say how he answers the 住转讬专讛, the 讙诪专讗 right away in middle asked a question. 讗讬转讬讘讬讛 专讘 谞讞诪谉 诇专讘 讛讜谞讗, 专讘 谞讞诪谉 asked a question of 专讘 讛讜谞讗, 讬砖讬讘, we have the 驻住讜拽 where it says 讬砖讬讘 诇专讘讜转 砖讜讛 讻住祝 讜讗驻讬诇讜 住讜讘讬谉, it comes to include even 砖讜讛 讻住祝, even 住讜讘讬谉. So how could you say that you have to give or 讻住祝 or 诪讬讟讘, when we learn out from the 驻住讜拽 讬砖讬讘 that you could also give even 砖讜讛 讻住祝, even 住讜讘讬谉? And he answered, 讛讻讗 讘诪讗讬 注住拽讬谞谉, here we're talking in a case 讘讚诇讬转 诇讬讛, when he doesn't have. 诇讻转讞讬诇讛 you must give or 讻住祝 or 诪讬讟讘, if you don't have, then you could give even 砖讜讛 讻住祝, even 住讜讘讬谉. The 讙诪专讗 asks, 讗讬 讚诇讬转 诇讬讛 驻砖讬讟讗, if he doesn't have, it's very simple, what do we expect? If he doesn't have anything else, let him give what he has. Why do we need the 驻住讜拽 to tell us that if he doesn't have, he's able to give 砖讜讛 讻住祝, even 住讜讘讬谉? And the 讙诪专讗 answers, 诪讛讜 讚转讬诪讗, I would have thought, 讗诪专讬谞谉 诇讬讛, we tell him, 讝讬诇 讟专讞 讝讘讬谉, go, bother yourself and sell the 砖讜讛 讻住祝 you have, or sell the 住讜讘讬谉 that you have, 讜讗讬讬转讬 诇讬讛 讻住祝, and bring him 讻住祝, bring him actually money, 拽讗 诪砖诪注 诇谉, therefore the 驻住讜拽 tells us that we don't say that, and if he only has 砖讜讛 讻住祝, he only has 住讜讘讬谉, he's able to pay with that. So it comes out that the answer to the contradiction between the two 驻住讜拽讬诐 is that one 驻住讜拽 is speaking in a case where he has, so if he has, he must give 诪讬讟讘 or at least 讻住祝, money, and the other 驻住讜拽, where it says that he doesn't have to give 诪讬讟讘, he could give anything, even 住讜讘讬谉, that is in the case where he doesn't have. That's the way 专砖"讬 learns 驻砖讟 in this 讙诪专讗. But 转讜住驻讜转 learns that this 讙诪专讗 is not to answer the question that we asked before, but this goes back to the 诪砖谞讛. In the 诪砖谞讛 it said that a 诪讝讬拽 is supposed to pay 诪讬讟讘 when you pay for the damage you caused, you're supposed to pay from the best of your property. So that's where 专讘 讛讜谞讗 comes in and he says that it's 诇讗讜 讚讜拽讗 诪讬讟讘, you don't have to pay only the best of your property, if you want, you could pay 讻住祝, you could pay money also. And then the 讙诪专讗 asked a separate question: How can you say that you have to pay or 讻住祝, or money, or 诪讬讟讘, when the 驻住讜拽 says 讬砖讬讘 诇专讘讜转 砖讜讛 讻住祝, it comes to include even 砖讜讛 讻住祝, even 住讜讘讬谉? And the 讙诪专讗 answered a 转讬专讜抓 that that's in the case where you don't have. And 转讜住驻讜转 adds that it comes out that this 讙诪专讗, 专讘 讛讜谞讗 argues with what 专讘 驻驻讗 and 专讘 讛讜谞讗 讘专讬讛 讚专讘 讬讛讜砖注 said earlier, because we learned earlier in the 讙诪专讗 that 专讘 驻驻讗 and 专讘 讛讜谞讗 讘专讬讛 讚专讘 讬讛讜砖注, when they answered the question of the 住转讬专讛 between the 驻住讜拽 where it says 诪讬讟讘 and the 驻住讜拽 where it says that we are 诪专讘讛, we include 砖讜讛 讻住祝, even 住讜讘讬谉, so they answered that 讻诇 诪讬诇讬 诪讬讟讘 讛讜讗, that any object is considered 诪讬讟讘, because if you can't sell it here, you will sell it some place else. Here, in this 讙诪专讗, it seems that the 讙诪专讗 holds that 砖讜讛 讻住祝 is not like 诪讬讟讘, because as we say here, that only if you don't have any 诪讬讟讘, that's when you give 砖讜讛 讻住祝, you could give even 住讜讘讬谉. So the 专讬"祝 says that this 讙诪专讗 here, 专讘 讛讜谞讗 argues with 专讘 驻驻讗 and 专讘 讛讜谞讗 讘专讬讛 讚专讘 讬讛讜砖注, and he actually 驻住拽谞'住 like 专讘 驻驻讗 and 专讘 讛讜谞讗 讘专讬讛 讚专讘 讬讛讜砖注, and therefore he holds that you could give 诇讻转讞讬诇讛 住讜讘讬谉, you do not have to give 诪讬讟讘. But 转讜住驻讜转 brings that 专讘讬谞讜 转诐 doesn't hold that way, but 专讘讬谞讜 转诐 says that there are three 讚讬谞讬诐, he makes three categories. He says that when it comes to 谞讝讬拽讬谉, when it comes to pay for the damages, then you pay or 讻住祝, if you have money, or 诪讬讟讘, or the best of your fields. If you do not have that, then you could give anything else, even 住讜讘讬谉. By a 讘注诇 讞讜讘, the 讚讬谉 is that if you have money, then you must pay for the loan with money, but if he doesn't have money, then you could give other things, and you cannot say to the person, "Go and sell your objects and bring money to the 讘注诇 讞讜讘," we are not 诪讟专讬讞 him to do that. But when it comes to pay a worker, then you have to pay with money, and if you don't have money, then we're able to tell to the 讘注诇 讛讘讬转, the one that hired the worker, "Go, sell whatever you have, and bring money to pay for your worker." And the 讙诪专讗 continues: 讗诪专 专讘 讗住讬, 专讘 讗住讬 said: 讻住驻讬诐 讛专讬 讛谉 讻拽专拽注, money has the same 讚讬谉 as property, as 拽专拽注. And the 讙诪专讗 asks: 诇诪讗讬 讛诇讻转讗, concerning which 讛诇讻讛 did 专讘 讗住讬 say that? 讗讬诇讬诪讗, if you're going to say 诇注谞讬谉 诪讬讟讘, concerning 诪讬讟讘, that when you have to pay for 谞讝讬拽讬谉, you're able to pay with money because it has the same 讚讬谉 as 诪讬讟讘 of 拽专拽注, as the same 讚讬谉 as good property, 讛讬讬谞讜 讚专讘 讛讜谞讗, so then he said the same thing as 专讘 讛讜谞讗. Didn't we learn before that 专讘 讛讜谞讗 said that? That you could pay or with 讻住祝 or with 诪讬讟讘, that money is like 诪讬讟讘. So then why did the 讙诪专讗 say it as if 专讘 讗住讬 said a new 讚讬谉? The 讙诪专讗 should have said, 讜讻谉 讗诪专 专讘 讗住讬, that 专讘 讗住讬, too, said the same thing as 专讘 讛讜谞讗. But from the 诇砖讜谉 of the 讙诪专讗 is 诪砖诪注 that it's a new thing. 讗诇讗, so therefore you must say that it's concerning a different 讚讬谉, concerning 诇砖谞讬 讗讞讬诐 砖讞诇拽讜, two brothers that divided their inheritance, 讜谞讟诇 讗讞讚 拽专拽注 讜讗讞讚 讻住驻讬诐, and one of them took 拽专拽注, and one of them took 讜讘讗 讘注诇 讞讜讘 讜谞讟诇 拽专拽注, and then a 讘注诇 讞讜讘, a person that the father owed money to, came, and he took away the 拽专拽注 from the brother who took the 拽专拽注. So the 讚讬谉 is 讚讗讝讬诇 讛讗讬, that this brother whose 拽专拽注 was taken away is able to come, 讜砖拽讬诇, and he could take 驻诇讙讗 讘讻住驻讬诐 讘讛讚讬讛, half of the money that the other brother took. And that's what 专讘 讗住讬 meant, that money is like 拽专拽注, that since he took away his 拽专拽注, so then he is able to go and take half of the money that the other brother inherited. So the 讙诪专讗 asks, 驻砖讬讟讗, that is very simple. 讛讗讬 讘专讗 讜讛讗讬 诇讗讜 讘专讗? What would we think? That this one, the one that took the 拽专拽注, he is considered a son and he is responsible to pay for the loan of his father, and the other one is not considered a son? Why should we even have a 讛讜讛 讗诪讬谞讗 to think that he shouldn't be able to go to the other brother and take half of the money? Why should he have to pay for the loan and not his brother? So it couldn't be that this is what 专讘 讗住讬 meant. 讗讬讻讗 讚讗诪专讬, some say the question was asked just the opposite, 讗讚专讘讛, on the contrary, in the other side, 诇讗讬讚讱 讙讬住讗, to the other side. 讚讗诪专 诇讬讛, that the truth should be that he should not be able to come and take away from the 讻住驻讬诐 that his brother took, because he could say to him, the one that took the money could say to his brother, 诇讛讻讬 砖拽诇讬 讻住驻讬诐, therefore I took money. This is the reason why you allowed me to take money, because when I took money, I took a bigger risk. 讚讗讬 诪讙谞讘讬, if it'll be stolen, 诇讗 诪砖转诇诪讬 诪讬谞讱, I will not go and get paid from you. 讜诇讛讻讬 砖拽诇转 讗专注讗, and therefore you took the field, that you took a bigger risk. 讚讗讬 诪讟专驻讗, if it'll be taken away by the 讘注诇 讞讜讘, 诇讗 诪砖转诇诐 诇讱 诪讬讚讬 诪讬谞讗讬, you will not take anything from me. We each one took a risk, and therefore I do not have to pay you. So if we learn this way, then again we couldn't say that 专讘 讗住讬 meant this, because this 讚讬谉 is not true. The 讚讬谉 is not that he should be able to take away half of the other person's money, his brother's money, because he says that that was your risk that you took. So therefore the question is back: What did 专讘 讗住讬 mean when he said that money is like 拽专拽注? 讗诇讗, so we must say it's for a different 讚讬谉. 讚砖谞讬 讗讞讬谉 砖讞诇拽讜, two brothers that divided the inheritance, they inherited property and they divided it equally. 讜讘讗 讘注诇 讞讜讘, and a 讘注诇 讞讜讘 came, 讜谞讟诇 讞诇拽讜 砖诇 讗讞讚 诪讛谉, and he took away the 讞诇拽, the part of one of the two brothers. So the 讚讬谉 is that the other brother is supposed to give him half of his property. But 专讘 讗住讬 said that money is like 拽专拽注, that it doesn't mean that he has to give him half of his 拽专拽注 that he inherited, but he's able to give him his half with money, he could pay him with money. And that's what 专讘 讗住讬 meant, that 讻住驻讬诐 讛专讬 讛谉 讻拽专拽注, that when the second brother will have to pay back the other brother for the property that was taken away by the 讘注诇 讞讜讘, he could pay him with money and he doesn't have to give him half of the 拽专拽注. But the 讙诪专讗 asks, 讜讛讗 讗诪专讜讛 讚专讘 讗住讬 讞讚讗 讝讬诪谞讗, didn't 专讘 讗住讬 say the same 讚讬谉 another time? 讚讗讬转诪专, because we learned, 讛讗讞讬谉 砖讞诇拽讜, if brothers divided the inheritance, 讜讘讗 讘注诇 讞讜讘, and the 讘注诇 讞讜讘 came, 讜谞讟诇 讞诇拽讜 砖诇 讗讞讚 诪讛谉, and he took away the 讞诇拽 of one of them, so we find a 诪讞诇讜拽转. 专讘 讗诪专, 专讘 says, 讘讟诇讛 诪讞诇讜拽转, the whole division that they made before is 讘讟诇, is void, and what they have to do is, they have to take the part that was taken by the other brother, they take it back, and that is divided equally. The whole division that they made before that one brother took half and the other brother took the other half is void because the 讘注诇 讞讜讘 took it away, and therefore we re-divide whatever is left over. 讜砖诪讜讗诇 讗诪专, but 砖诪讜讗诇 says, 讜讬转专, he lost it, that the one brother that his property was taken away, he lost out, and the other brother doesn't have to give him anything. 讜专讘 讗住讬 讗诪专, but 专讘 讗住讬 says, 谞讜讟诇 专讘讬注 讘拽专拽注 讜专讘讬注 讘诪注讜转, that the brother who lost the property takes from his other brother a quarter, a quarter of what's left over. And that quarter that his brother is supposed to give him, he could give him or in 拽专拽注, or in property, or he could give him in money. And 专砖状讬 explains that when the 讙诪专讗 says here 专讘讬注 讘拽专拽注 讜专讘讬注 讘诪注讜转, that he gives him a quarter in property and a quarter in money, it doesn't mean and, it means or, that he
has to give him a quarter, and the 讙诪专讗 will explain why, but he gives him a quarter or in 拽专拽注, or if he wants, he gives him a quarter in money. So here we see that 专讘 讗住讬 already said this 讚讬谉, that when the brother has to pay back his brother in the money that was taken away by the 讘注诇 讞讜讘, he could give him or 拽专拽注, or he could give him 诪注讜转. And the 讙诪专讗 will explain the 诪讞诇讜拽转 between 专讘 and 砖诪讜讗诇 and 专讘 讗住讬. 专讘 讗诪专 讘讟诇讛 诪讞诇讜拽转, 专讘 says that the whole division is 讘讟诇 and you have to re-divide whatever is left over, 拽住讘专, because he holds 讗讞讬诐 砖讞诇拽讜 讻讬讜专砖讬诐 讛讜讜, that brothers that inherited, and they divide their inheritance, they still remain in the category of 讬讜专砖讬诐, in the category of heirs that inherited. And therefore, if the 讘注诇 讞讜讘 comes and takes away the 拽专拽注 from one of them, so then they are all responsible to pay to that 讘注诇 讞讜讘. Therefore, what we do is we re-divide the property that's left over. 砖诪讜讗诇 讗诪专, but 砖诪讜讗诇 says 讜讬转专, that the one that his property was taken away loses, because 拽住讘专 he holds 讗讞讬诐 砖讞诇拽讜 诇拽讜讞讜转, that brothers that divide, they turn into buyers. It's as if each one bought from the other. And 讜讻诇拽讜讞 砖诇讗 讘讗讞专讬讜转, and it's like a person who buys without a warranty. When they divide a property, each one is like a buyer without a warranty, and therefore, if one of them loses his property because the 讘注诇 讞讜讘 took it away, the other one is not responsible to pay him, because it is like he bought it without a warranty. And therefore he says that the other brother doesn't have to pay him back.
讜专讘 讗住讬 讗诪专, but 专讘 讗住讬 says, 谞讜讟诇 专讘讬注 讘拽专拽注 讜专讘讬注 讘诪注讜转. 专讘 讗住讬 says he takes a quarter, or a quarter in 拽专拽注 if he wants to give him, or if he wants, he could give him money. The reason for 专讘 讗住讬 is 诪住驻拽讗 诇讬讛, he has a 住驻拽. He has a doubt, he doesn't know the 讚讬谉. 讗讬 讻讬讜专砖讬诐 讚诪讜, are they considered like 讬讜专砖讬诐, and therefore you would have to re-divide the 拽专拽注? 讗讜 讻诇拽讜讞讜转 讚诪讜, or they have a 讚讬谉 like 诇拽讜讞讜转, like 砖诪讜讗诇 says, and then he doesn't have to pay anything? 讛诇讻讱, therefore, 谞讜讟诇 专讘讬注 讘拽专拽注 讜专讘讬注 讘诪注讜转, therefore, he takes a quarter, and that he could give him or 拽专拽注 or 诪注讜转. Because since it's a 住驻拽 whether the other brother is responsible to pay him back for his loss, and the 讚讬谉 is that 诪诪讜谉 讛诪讜讟诇 讘住驻拽 讞讜诇拽讬谉, when you have money that there is a 住驻拽 whether you have to pay or not, so you divide it. So here too, since there's a 住驻拽 whether he has to give him half of what is left over, so that half, which is in doubt, you divide into half. So you give him a quarter, and a quarter he doesn't give him. And that quarter that he has to give him, he could give him with 拽专拽注, or if he wants, he could give him with money. So
here we see that 专讘 讗住讬 already said at another time that when you have to pay back your brother because the 讘注诇 讞讜讘 took away his property, you have a 讘专讬专讛, a choice to give him or 拽专拽注 or 诪注讜转, they have the same 讚讬谉. So how can we say that when 专讘 讗住讬 said 讻住驻讬诐 讛专讬 讛谉 讻拽专拽注, that money is like 拽专拽注, he meant it concerning this 讚讬谉? Because this 讚讬谉 he already said a different time, so obviously, he meant something else. So the question remains, what did 专讘 讗住讬 mean when he said that money is like 拽专拽注? 讗诇讗, so the 讙诪专讗 says, but 诪讗讬 讛专讬 讛谉 讻拽专拽注? What did 专讘 讗住讬 mean that money is like 拽专拽注? 诇注谞讬讬谉 诪讬讟讘, 讟讗拽注 concerning the payment that you have to pay for 谞讝讬拽讬谉. So the 讚讬谉 is you have to pay with 诪讬讟讘, with the best of your fields, so that's what he meant, that when you want, you could give 讻住驻讬诐 has the same 讚讬谉 as 诪讬讟讘. All right, the question we asked, 讗讬 讛讻讬 讛讬讬谞讜 讚专讘 讛讜谞讗, that it's the same 讚讬谉 like 专讘 讛讜谞讗, so why did the 讙诪专讗 say that 专讘 讗住讬 said it as a new 讚讬谉? The 讙诪专讗 should have said that 专讘 讗住讬 also said the same thing as 专讘 讛讜谞讗. 讗讬诪讗, 讟讗拽注 say 讜讻谉 讗诪专 专讘 讗住讬. That's really how it's supposed to say. It really was a mistake, it shouldn't have said 讗诪专 专讘 讗住讬 讻住驻讬诐 讛专讬 讛谉 讻拽专拽注, which would sound like a new 讚讬谉, but the 讙诪专讗 should have said 讜讻谉 讗诪专 专讘 讗住讬, that 专讘 讗住讬, too, said the same thing as 专讘 讛讜谞讗 said. This is one 驻砖讟 in 专砖状讬. There's another 驻砖讟 that 专砖状讬 says in the 诪讞诇讜拽转 between 专讘 讜砖诪讜讗诇 讜专讘 讗住讬, that when 专讘 讗住讬 said that 谞讜讟诇 专讘讬注 讘拽专拽注 讜专讘讬注 讘诪注讜转, that you take, it actually means that you take a quarter of 拽专拽注 and a quarter in money. It's not like the 驻砖讟 that we said before that you only take a quarter according to 专讘 讗住讬, but that quarter could be or in 拽专拽注 or in money, but the second 驻砖讟 in 专砖状讬 is that 专讘 讗住讬 said that he takes a quarter in 拽专拽注 and a quarter in money. And according to this 驻砖讟, the explanation of the 讙诪专讗 would be as follows: that 专讘 讗住讬 has a 住驻拽 whether he has a 讚讬谉 like 讬讜专砖讬诐, or the brothers who divided have a 讚讬谉 like 诇拽讜讞讜转, like buyers. But, as 专砖状讬 says, like 诇拽讜讞讜转 讘讗讞专讬讜转, like people who bought with 讗讞专讬讜转, with a warranty. So according to both sides, whether they have a 讚讬谉 like 讬讜专砖讬诐 or like 诇拽讜讞讜转, he is responsible to pay. Because even if he has a 讚讬谉 like 诇拽讜讞讜转, you still have to pay because it's 诇拽讜讞讜转 with 讗讞专讬讜转, it's like if you bought it with a warranty. So therefore, he definitely has to give half of what is left over. But that half, there is a 住驻拽 of how do you give it. There's a 住驻拽 that it has a 讚讬谉 like 讬讜专砖讬诐, and therefore you would have to give half of the property that's left over, or maybe it has a 讚讬谉 like 诇拽讜讞讜转, and the reason you have to give is because you are responsible because it's like 讘讗讞专讬讜转, so then you are able to give money. Since we don't know why he has to give the half, whether it is because he has a 讚讬谉 like a 讬讜专砖, or a 讚讬谉 like a 诇讜拽讞, therefore you split that in half. Half of the half, which is a quarter, you pay like a 讬讜专砖, which means you give him the 拽专拽注, because if they would be like 讬讜专砖讬诐, you would have to give part of the 拽专拽注. And the other quarter, which is the other half of the half, we give with money, because maybe he has a 讚讬谉 like a 诇讜拽讞 讘讗讞专讬讜转, and then you would have to pay back with money, so that half he gives with money. And that's what the 讙诪专讗 thought that 专讘 讗住讬 meant when he said 讻住驻讬诐 讛专讬 讛谉 讻拽专拽注, and the 诪住拽谞讗 of the 讙诪专讗 is that that's not what he meant, what he meant was concerning 诪讬讟讘, and the 讙诪专讗 really should have said, 讜讻谉 讗诪专 专讘 讗住讬. Then the 讙诪专讗 continues,
讗诪专 专' 讝讬专讗 讗诪专 专讘 讛讜谞讗, 专' 讝讬专讗 said in the name of 专讘 讛讜谞讗, 讘诪爪讜讛 注讚 砖诇讬砖, when it comes to do a 诪爪讜讛, you have to spend up to a third. And the 讙诪专讗 will explain what that means, 诪讗讬 砖诇讬砖, what do we mean when we say that you spend up to a third? 讗讬诇讬诪讗, if you'll say 砖诇讬砖 讘讬转讜, you have to spend a third of your house, that means a third of your possessions, that up to a third of your possessions you must give away when it comes to do a 诪爪讜讛. If it costs that much, you still must spend that money, up to a third of your possessions. But the 讙诪专讗 asks, if so, 讗诇讗 诪注转讛, 讗讬 讗讬转专诪讜 诇讬讛 转诇转讗 诪爪讜转讗, if it comes out that he happens to have three 诪爪讜转 at a time to do, 诇讬转讬讘 诇讻讜诇讬讛 讘讬转讬讛? What, does it mean he has to give away his whole house, all his possessions? If for one 诪爪讜讛 you have to pay a third of your possession, then for three 诪爪讜转, you would have to give away all your possessions. Now that is impossible. 讗诇讗 讗诪专 专' 讝讬专讗, so therefore 专' 讝讬专讗 said the 驻砖讟 was, 讘讛讬讚讜专 诪爪讜讛 注讚 砖诇讬砖 讘诪爪讜讛, when it comes to do a 讛讬讚讜专 诪爪讜讛, it has to be up to a third of the 诪爪讜讛. And we have two 驻砖讟讬诐 in this 讙诪专讗. 专砖"讬 learns the 驻砖讟 that when a person has a choice to buy a 诪爪讜讛, and then he has a choice that the same thing he could buy a nicer one, because the 讚讬谉 is that a person has to do the 诪爪讜转 nice, as 专砖"讬 quotes from the 讙诪专讗 in 砖讘转 讚祝 拽诇"讙, says in the 驻住讜拽, 讝讛 讗诇讬 讜讗谞讜讛讜, this is my God and I will beautify Him, so we learn out from that 驻住讜拽, 讛转谞讗讛 诇驻谞讬讜 讘诪爪讜转, you have to make yourself nice in front of 讛砖诐 with 诪爪讜转. And the 讙诪专讗 says there, 注砖讛 诇讱 住驻专 转讜专讛 谞讗讛, make yourself a nice 住驻专 转讜专讛, 诇讜诇讘 谞讗讛, a nice 诇讜诇讘, 讟诇讬转 谞讗讛, a nice 讟诇讬转, 爪讬爪讬转 谞讗讛, nice 爪讬爪讬转. So if a person has a choice to buy regular 住驻专 转讜专讛, and then to buy a nicer 住驻专 转讜专讛 which will cost more, so how much more is he obligated to spend for the nicer 诪爪讜讛? So that's what the 讙诪专讗 says, up to a third. If the nicer 诪爪讜讛 costs up to a third more than the 诪爪讜讛 itself, then you should buy the nicer 诪爪讜讛. If it costs more than a third more, then you don't have to buy the nicer 诪爪讜讛. That's 专砖"讬's 驻砖讟. 转讜住驻讜转 learns that we're talking about a different case. For instance, if a person is able to buy two 讗转专讜讙讬诐, a small 讗转专讜讙 which has the 砖讬注讜专, because the 砖讬注讜专 of an 讗转专讜讙 is 讻讗讙讜讝, the size of a nut, so he has an 讗转专讜讙 that he could buy that has the minimum 砖讬注讜专, but then he could buy a bigger 讗转专讜讙. So the 讙诪专讗 is saying that if the bigger 讗转专讜讙 is bigger with a third than the small one, then he should buy the bigger one. Then the 讙诪专讗 says,
讘注讬 专讘 讗砖讬, 专讘 讗砖讬 asked a 砖讗诇讛, 讗讬讘注讬讗: 砖诇讬砖 诪诇讙讬讜 讗讜 砖诇讬砖 诪诇讘专? When we say that for a 讛讬讚讜专 诪爪讜讛 you have to spend a 砖诇讬砖, is it 诪诇讙讬讜, from the inside, or a 砖诇讬砖 诪诇讘专, from the outside? Because whenever we have a certain percentage, there are two ways to measure that percentage. You could say it's from the inside, or we could measure the percentage from the outside. For instance, if we have four, and we want to have a quarter of four, so then one is a quarter of four. But that is if we consider it a quarter from the inside, from what we have already, so one is a quarter of what we have. 诪诇讘专 would mean that after we add the extra one, that extra percentage, then it'll be a quarter of the whole thing after we have it. If we look at it that way, then when we add one to four, we really have a fifth, because after we add one to four we have five. So now, of five, the one that we added is a fifth. That's the 讙诪专讗's continue with the 诪砖谞讛. 诪砖谞讛 says, 讻诇 砖讞讘转讬 讘砖诪讬专转讜, anything that I am obligated to watch it, 讛讻砖专转讬 讗转 谞讝拽讜. If it damaged, so then I am the one that caused the damage, and therefore I am obligated to pay. This is one 驻砖讟 in 专砖"讬 concerning the meaning of the words 讛讻砖专转讬, that I caused, I prepared the damage, and therefore I am obligated to pay. Another 驻砖讟 专砖"讬 says that the words 讛讻砖专转讬 means that I am obligated to fix that damage. Then the 诪砖谞讛 continues, 讛讻砖专转讬 诪拽爪转 谞讝拽讜, there's a possibility for a case that I prepared, I caused only part of the 谞讝拽, and as 专砖"讬 says Here, the word 讛讻砖专转讬 definitely means prepared. There is a possibility that I prepared only part of the damage, and nevertheless, 讞讘转讬 讘转砖诇讜诪讬 谞讝拽讜, I have to pay for the payment of the 谞讝拽, 讻讛讻砖专 讻诇 谞讝拽讜, as if I would have prepared the whole 谞讝拽. And as the 讙诪专讗 will explain later on, there are certain cases that a person should only be a cause for part of the 谞讝拽, and nevertheless, he is responsible as if he caused the whole 谞讝拽. Then the 诪砖谞讛 continues, when do you have to pay for 谞讝拽? That if you damaged 谞讻住讬诐 砖讗讬谉 讘讛谉 诪注讬诇讛, property that there is no 讚讬谉 诪注讬诇讛. 诪注讬诇讛 means that when a person has use or pleasure from property that belongs to 讛拽讚砖, he is called a 诪讜注诇 讘讛拽讚砖. And the 诪砖谞讛 says that the only time you are 讞讬讬讘 to pay for damage if the damage was caused to such property that there is no 讚讬谉 诪注讬诇讛, which means property that does not belong to 讛拽讚砖. 谞讻住讬诐 砖讛谉 讘谞讬 讘专讬转, it has to be property that belongs to a 讬讬讚. 谞讻住讬诐 讛诪讬讜讞讚讬诐, property that is set aside to a specific person, which means there is an owner of the property. But if property that is 讛驻拽专, that doesn't belong to anybody, you are not responsible to pay, and the 讙诪专讗 will explain later on what it means. 讜讘讻诇 诪拽讜诐, and anywhere the damage was done, you're responsible to pay, 讞讜抓, except, 诪专砖讜转 讛诪讬讜讞讚转 诇诪讝讬拽, if the damage was done in a 专砖讜转, in a place that belongs specifically to the 诪讝讬拽, because then we could say to the 谞讬讝拽, "What were you doing in the 专砖讜转 of the 诪讝讬拽 that you got hurt?" The 诪讝讬拽 is not responsible if the 谞讬讝拽 came into his 专砖讜转 and he got hurt. Who allowed him to come in? And therefore, the 诪讝讬拽 would be 驻讟讜专. And also, you are 驻讟讜专 if it happened in 专砖讜转 讛谞讬讝拽 讜讛诪讝讬拽, in the 专砖讜转 of the 谞讬讝拽 and the 诪讝讬拽 together, and the 讙诪专讗 will explain later on what kind of 专砖讜转 that is. So in all these cases, 讻砖讛讝讬拽, when he caused the damage, 讞讘 讛诪讝讬拽 诇砖诇诐, so the 诪讝讬拽 is obligated to pay 转砖诇讜诪讬 谞讝拽, the payment for the damage, 讘诪讬讟讘 讛讗专抓, with the best of the land, as we said before, that you must pay with 注讬讚讬转. The 讙诪专讗 continues to explain the 诪砖谞讛:
转谞讜 专讘谞谉, the 专讘谞谉 learned: 讻诇 砖讞讘转讬 讘砖诪讬专转讜 讛讻砖专转讬 讗转 谞讝拽讜, we're saying that whenever I am obligated to watch it, then if it caused damage, I am responsible to pay for the damage, I am the one that prepared the damage and I have to pay for it. 讻讬爪讚? What do we mean? What case is this coming to include? He says, for instance, 砖讜专 讜讘讜专 砖诪住专谉 诇讞专砖 砖讜讟讛 讜拽讟谉, if a person gave over an ox or gave over a pit to be watched by a 讞专砖, 砖讜讟讛, 讜拽讟谉. A 讞专砖 is a person who is a deaf-mute, a 砖讜讟讛 is an insane person, a 拽讟谉 is a child. So if you gave over your ox or your pit to be watched by any of these three, 讜讛讝讬拽讜, and then they damaged, the ox damaged or the 讘讜专, the pit caused damage, 讞讬讬讘 诇砖诇诐, you are obligated to pay, because since you had to watch it and you gave it over to be watched by people who are not responsible, so therefore you are responsible to pay for that damage. But this 讚讬谉 only applies if you gave over to watch to these three a 砖讜专, an ox, or your 讘讜专, your pit. 诪讛 砖讗讬谉 讻谉 讘讗砖, but if you gave over your fire, then the 讚讬谉 would be different. And the 讙诪专讗 will explain what this is all about. 讘诪讗讬 注住拽讬谞谉? the 讙诪专讗 asks. What are we talking about? What kind of case is this that we say that if it happened by a 砖讜专 and a 讘讜专 you would be 讞讬讬讘, if it happened by 讗砖, by fire, you would be 驻讟讜专? 讗讬诇讬诪讗, if you will tell me, 讘砖讜专 拽砖讜专 讜讘讜专 诪讻讜住讛, that when we said that if you gave over your ox or your 讘讜专 to the 讞专砖, 砖讜讟讛, 讜拽讟谉 you're 讞讬讬讘, it means even if you gave over a tied 砖讜专, a 砖讜专 that was tied up, and it was safe, and you gave over a 讘讜专 which was covered, and it was safe, and nevertheless, since you gave it over to the 讞专砖, 砖讜讟讛, 讜拽讟谉 to watch, and it caused damage, you are 讞讬讬讘, so then 讚讻讜讜转讛 讙讘讬 讗砖, so if we want to find a similar case by 讗砖, because we're saying that 讗砖 in the same kind of case would be 驻讟讜专, now which case of fire would be similar to the case of a 砖讜专 拽砖讜专 讜讘讜专 诪讻讜住讛, of a tied ox and a covered pit? It must mean 讙讞诇转, that you gave over to a 讞专砖, 砖讜讟讛, 讜拽讟谉 to watch a coal. A coal, if you leave it, it won't cause any damage. 讗砖 砖诇讛讘转, a flame which is burning, then automatically it will cause fire. But a 讙讞诇转, which is a coal, unless you blow at it and you make the fire come out, it will not cause any damage. So if we're saying that the case of 砖讜专 and 讘讜专 that we said you are 讞讬讬讘 is even if the 砖讜专 was tied, and the 讘讜专 was covered, and nevertheless, since you gave it over to watch to a 讞专砖 砖讜讟讛 讜拽讟谉 you are 讞讬讬讘, and we said that 讗砖 in a similar case would be 驻讟讜专, obviously it means that you gave over to a 讞专砖 砖讜讟讛 讜拽讟谉 a 讙讞诇转, a fire which was in the coal, but not an open flame. And there we say the 讚讬谉 is that you are 驻讟讜专. Now the
question is, 诪讗讬 砖谞讗 讛讻讗 讜诪讗讬 砖谞讗 讛讻讗? What is the difference here, and what is the difference there? Why is the 讚讬谉 that in the case of the ox and the pit you are 讞讬讬讘, even if the ox was tied and the 讘讜专 was covered, and the case of the fire, being that it was a 讙讞诇转, since it was only a coal and not a flame, you are 驻讟讜专? So we can't say that that's what we meant. 讗诇讗, so therefore we must say, 讘砖讜专 诪讜转专 讜讘讜专 诪讙讜诇讛, that when we said that by giving over the 砖讜专 or the 讘讜专 to the 讞专砖 砖讜讟讛 讜拽讟谉 you are 讞讬讬讘, it means that you gave him over an untied ox, and you gave him over an open pit. And that's why you are 讞讬讬讘. 讜讚讻讜讜转讛 讙讘讬 讗砖, so if we're gonna find a similar case by the 讗砖, where we said you are 驻讟讜专, it would mean a 砖诇讛讘转, that if you gave him over a flame, because a flame, if you just let it, is going to cause damage, similar to an ox that's untied or a pit that's uncovered, that they will automatically cause damage. So here the 讚讬谉 would be that if you gave over an untied ox and an uncovered pit to a 讞专砖 砖讜讟讛 讜拽讟谉 to watch, you are 讞讬讬讘 if it caused damage, while if you gave him over a flame, which is similar to the untied ox and the uncovered pit, over there you would be 驻讟讜专. So the question is, 诪讛 砖讗讬谉 讻谉 讘讗砖 讚驻讟讜专, so it will come out that by 讗砖, by fire, it's not like the case of 砖讜专 and 讘讜专, and over there you would be 驻讟讜专, but why? This refers to a 诪砖谞讛 later on in 驻专拽 讛讻讜谞住. There the 诪砖谞讛 says, 讛砖讜诇讞 讛讘注专讛 讘讬讚 讞专砖 砖讜讟讛 讜拽讟谉, 驻讟讜专 诪讚讬谞讬 讗讚诐. If someone sent a fire in the hands of a 讞专砖 砖讜讟讛 讜拽讟谉, the one that sent that 讞专砖 砖讜讟讛 讜拽讟谉 with the fire is 驻讟讜专. And the 讙诪专讗 there says that there's a 诪讞诇讜拽转 between 专讘讬 讬讜讞谞谉 and 专讬砖 诇拽讬砖 what the 驻砖讟 in that 诪砖谞讛 is. 专讬砖 诇拽讬砖 says that that 诪砖谞讛 that says that you are 驻讟讜专 only speaks in a case where you gave the 讞专砖 砖讜讟讛 讜拽讟谉 a 讙讞诇转, a coal. And the 拽讟谉 himself 讜诇讬讘讛, he blew at it, and he brought the fire out, and therefore you are 驻讟讜专. 讗讘诇 砖诇讛讘转 讞讬讬讘, but if you would give to the 讞专砖 砖讜讟讛 讜拽讟谉 a real flame, and then it caused damage, you are 讞讬讬讘. But 专讘讬 讬讜讞谞谉 learns there that even if you gave over a flame to the hands of the 讞专砖 砖讜讟讛 讜拽讟谉, you are also 驻讟讜专. And this is what the 讙诪专讗 asks here: that how can you say that if you gave over a flame to the 讞专砖 砖讜讟讛 讜拽讟谉 you are 驻讟讜专, as we said before, 诪讛 砖讗讬谉 讻谉 讘讗砖 讚驻讟讜专, that by 讗砖 you are 驻讟讜专, but didn't 专讬砖 诇拽讬砖 say that this whole 讚讬谉 that the 诪砖谞讛 over there says that you are 驻讟讜专 if you give a fire to a 讞专砖 砖讜讟讛 讜拽讟谉 is only if you give him a coal? 讗讘诇 砖诇讛讘转 讞讬讬讘, but if you give him a flame you are 讞讬讬讘, 诪讗讬 讟注诪讗, what is the reason? 讚讛讗 讘专讬 讛讬讝拽讗, the 讛讬讝拽, the damage that it will cause is very clear. So again we can't say that the difference between 讗砖 and 砖讜专 and 讘讜专 is in a case where you gave him an untied 砖讜专 and an uncovered 讘讜专, and that's when you are 讞讬讬讘, but by 讗砖, even if you gave him a flame, you are also 驻讟讜专, when 专讬砖 诇拽讬砖 says that if you give him a flame you are 讞讬讬讘. And the 讙诪专讗 answers: 诇注讜诇诐, 讘讗诪转 I could say, 讘砖讜专 拽砖讜专 讜讘讜专 诪讻讜住讛, that when we said you are 讞讬讬讘 by the 砖讜专 or 讘讜专, that's even if you gave him a tied ox and a covered pit. 讜讚讻讜讜转讛 讙讘讬 讗砖, and similar to that, when we said that by 讗砖 you are 驻讟讜专, it 讟讗拽注 means 讙讞诇转, that you gave him a coal, and the 讚讬谉 is that you are 驻讟讜专. 讜讚拽讗诪专转, and the question that you asked, 诪讗讬 砖谞讗 讛讻讗 讜诪讗讬 砖谞讗 讛讻讗, what is the difference here and there? Why by the case of the ox and the pit you are 讞讬讬讘, and in the case of the coal you are 驻讟讜专? The 讙诪专讗 says, I'll explain you why: because 砖讜专 讚专讻讬讛 诇谞转讜拽讬, the 砖讜专, the ox, its 讚专讱 is to move around and tear itself out. So even if you gave him a tied 砖讜专, you should have assumed that eventually the 砖讜专 will untie itself and cause damage. 讘讜专 讚专讻讬讛 诇谞转讜专讬, a pit, its 讚专讱 is to get opened up, because people step over it, so the 讚专讱 of it is to get opened up. So when you gave the 讞专砖 砖讜讟讛 讜拽讟谉 the 讘讜专 to watch, you should have expected it eventually to get opened up and cause damage, and that's why you are 讞讬讬讘. But 讙讞诇转, by the coal, 讻诪讛 讚砖讘讬拽 诇讬讛 注诪讜诪讬 诪注诪讬 讜讗讝诇讗, the more you leave it, the more it gets extinguished. So by the case of the coal, when you gave it over to the hands of the 讞专砖 砖讜讟讛 讜拽讟谉, you shouldn't have expected it to cause damage, because It should have gone out, it should have extinguished itself, and therefore in a case like that, you are 驻讟讜专. That's only according to 专讬砖 诇拽讬砖. He says in the 诪砖谞讛 in 讛讻讜谞住, that where it says that if you send a fire in the hand of a 讞专砖 砖讜讟讛 讜拽讟谉 you are 驻讟讜专 讘讚讬谞讬 讗讚诐, also means if you gave him over a flame. So 讚讻讜讜转讛 讛讻讗, so similar to that here, when we said that if the
same thing happens by a 砖讜专 and a 讘讜专 you are 讞讬讬讘, it must mean 讚砖讜专 诪讜转专 讜讘讜专 诪讙讜诇讛. If you give him over an untied ox and an uncovered 讘讜专, that's where you are 讞讬讬讘. And this is what 专讘讬 讬讜讞谞谉 would learn, that if you give him over an untied ox and an uncovered 讘讜专, you are 讞讬讬讘, and if you give him over an open flame, you are 驻讟讜专, the question will be 诪讗讬 砖谞讗 讛讻讗 讜诪讗讬 砖谞讗 讛讻讗, according to him, what is the difference here and what is the difference there? Why by the case of the 砖讜专 and the 讘讜专 you're 讞讬讬讘, and the case of the 砖诇讛讘转, of the flame, you are 驻讟讜专? And the 讙诪专讗 answers, 讛转诐, over there, 爪讘转讗 讚讞专砖 拽讗 讙专讬诐. By the case of the fire, the holding of the 讞专砖 and 砖讜讟讛 讜拽讟谉 is what caused the damage. How did the flame cause the damage? The 讞专砖 砖讜讟讛 讜拽讟谉 took the flame, took it some place, and caused a fire. So there, the 讞专砖's holding on to the 砖诇讛讘转, to the flame, caused the fire, and therefore, this makes the one that gave him the fire 驻讟讜专, because the fire was not caused through the one that gave it to him, it was directly caused through the 讞专砖. But 讛讻讗, but here, in the case of the ox, in the case of the 讘讜专, 诇讗讜 爪讘转讗 讚讞专砖 拽讗 讙专讬诐. It's not the holding on of the 讞专砖 that caused the damage. When he gave him over the untied ox and the uncovered pit, and then it caused damage, it wasn't that the 讞专砖 was the one directly that caused the damage. It's just that the 讞专砖 couldn't watch it, and therefore it caused damage by itself. So the 砖讜专 itself caused the damage, and the 讘讜专 itself caused the damage. And since the first person, he was the one that's supposed to watch it and he didn't, he is responsible to pay for it.
专砖''讬 also says another 驻砖讟 in the meaning of the word 爪讘转讗, not holding on, but 爪讘转讗 专砖''讬 says could mean the connection. That the connection between the 讞专砖 and the fire, that caused the damage, while by the case of the 砖讜专 and the 讘讜专, there was no connection between the 讞专砖 and the 砖讜专 or the 讘讜专, and therefore, the person who gave it to him, he is responsible. This is the way 专砖''讬 learns 驻砖讟 in this 讙诪专讗. 转讜住驻讜转 learns a little bit different. When the 讙诪专讗 answers concerning 专讬砖 诇拽讬砖, that he says that it's talking in a case where the 砖讜专 was tied and the 讘讜专 was covered, and nevertheless you're 讞讬讬讘, so the 讙诪专讗 says because 砖讜专 注讘讬讚 诇谞转讜拽讬 讜讘讜专 注讘讬讚 诇谞转讜专讬, because the 砖讜专 will eventually untie itself, and the 讘讜专 will eventually open up, and that's why the one that gave it to the 讞专砖 砖讜讟讛 讜拽讟谉 is 讞讬讬讘, while by the case of the 讙讞诇转, the case of the coal, as long as he will leave it it will go out, it will extinguish itself, and therefore the one that gave it to him is 驻讟讜专, so 转讜住驻讜转 learns different than 专砖''讬. 专砖''讬, as we said, learns that the 砖讜专 by himself will eventually get untied, that's what the 讙诪专讗 means, the 讘讜专 itself will eventually uncover, while the 讙讞诇转, on the contrary, if you leave it by itself, it'll get extinguished. But 转讜住驻讜转 asks a 拽砖讬讗 on 专砖''讬, he says how could 专砖''讬 learn that way, that obviously we're talking here in a case where the 砖讜专 was tied properly, and the 讘讜专 was covered properly. Now, if it was
covered properly and it was tied properly, why should we say that eventually it's going to get untied and uncovered? This is called a 砖诪讬专讛 诪注讜诇讛, this is a complete 砖诪讬专讛. So why should the 讙诪专讗 say that the person who tied the 砖讜专 properly and the person who covered the 讘讜专 properly should be 讞讬讬讘 what happened later because it'll eventually get untied and uncovered? Why should it get untied and uncovered if it was tied properly? And if it was tied not properly, and that's why it will get untied, or it was covered not properly, then 诇讻转讞讬诇讛 he didn't make a proper 砖诪讬专讛. And therefore 转讜住驻讜转 learns different. 转讜住驻讜转 learns that really he covered it properly and he tied it properly, and when the 讙诪专讗 says that it will eventually get untied and eventually get uncovered, it doesn't mean by itself. It means because you gave it over to the 讞专砖 砖讜讟讛 讜拽讟谉. The 讞专砖 砖讜讟讛 讜拽讟谉 will play around with the knots of the 砖讜专, will play around with the covering of the 讘讜专, and eventually he will be able to untie the 砖讜专, and he will be able to uncover the 讘讜专. And that's what the 讙诪专讗 means: when you give over a 砖讜专 and a 讘讜专 that's tied and covered to a 讞专砖 砖讜讟讛 讜拽讟谉, you are 讞讬讬讘 because you should have understood that eventually the 讞专砖 砖讜讟讛 讜拽讟谉 is going to untie the 砖讜专, the 讞专砖 砖讜讟讛 讜拽讟谉 is going to uncover the 讘讜专, and therefore you are 讞讬讬讘. But
when it speaks of a 讙讞诇转, it is not the custom, so to speak, of a 讞专砖 砖讜讟讛 讜拽讟谉 to blow at a 讙讞诇转 and have the flame come out, and therefore when you give over the 讙讞诇转 to the 讞专砖 砖讜讟讛 讜拽讟谉, you could expect it to get extinguished. And therefore, if the 讞专砖 砖讜讟讛 讜拽讟谉 did blow it and it did cause damage, you are not responsible. And concerning 专' 讬讜讞谞谉, 转讜住驻讜转 explains the 住讘专讗 of 专' 讬讜讞谞谉, why 专' 讬讜讞谞谉 holds that if the 砖讜专 was untied and the 讘讜专 was uncovered, that's when we say that you are 讞讬讬讘. But if the 砖讜专 would have been tied, and the 讘讜专 would be covered, according to 专' 讬讜讞谞谉 you would be 驻讟讜专, because 专' 讬讜讞谞谉 holds that a 拽讟谉, a 讞专砖 砖讜讟讛 讜拽讟谉, also watches it, and doesn't untie it, and doesn't uncover it. And this is the 诪讞诇讜拽转 between 专' 讬讜讞谞谉 and 专讬砖 诇拽讬砖. According to 专讬砖 诇拽讬砖, we have to assume that not only doesn't a 讞专砖 砖讜讟讛 讜拽讟谉 watch it, but on the contrary, they even help the damage. And even if it's tied, even if it's covered, the 讞专砖 砖讜讟讛 讜拽讟谉 will untie it and uncover it. And therefore, you are 讞讬讬讘 even if you gave it to him when it was tied and covered. But 专' 讬讜讞谞谉 holds on the opposite, that the 讞专砖 砖讜讟讛 讜拽讟谉 doesn't help to damage, contrary, it even watches a little bit, and therefore if it was tied and it was covered, you are definitely 驻讟讜专 because you don't expect the 讞专砖 砖讜讟讛 讜拽讟谉 to help the damage, and to untie it, and uncover it. But if it was untied and it was uncovered, that's when you are 讞讬讬讘. Because even though that the 讞专砖 砖讜讟讛 讜拽讟谉 watches it a little bit, but not enough to be sure that it'll be safe, and therefore if you gave it over to the 讞专砖 砖讜讟讛 讜拽讟谉 untied and uncovered, you are 讞讬讬讘. But in the case of the 砖诇讛讘转, as the 讙诪专讗 says, the reason you are 驻讟讜专 is because it wasn't certain that the 讞专砖 did cause it. And 转讜住驻讜转 says this answers the question on 专' 讬讜讞谞谉. 诇讻讗讜专讛, we could ask a 拽砖讬讗 on 专' 讬讜讞谞谉, according to 专' 讬讜讞谞谉 that it's speaking in a case where the 砖讜专 was untied, and the 讘讜专 was uncovered, why do we have to mention that we gave it over to a 讞专砖 砖讜讟讛 讜拽讟谉? What does the 讞专砖 砖讜讟讛 讜拽讟谉 have to do here? If a person leaves a 砖讜专 untied and a 讘讜专 uncovered, you are 讞讬讬讘. What does the 讞专砖 砖讜讟讛 讜拽讟谉 have to do here? Why does the 讘专讬讬转讗 have to mention the fact that it was given to a 讞专砖 砖讜讟讛 讜拽讟谉? But
转讜住驻讜转 says according to what it said before, it's understood, because we would think that since you gave it to the 讞专砖 砖讜讟讛 讜拽讟谉, who watches it a little bit, it should be considered as if you gave it over to a responsible person to watch, and therefore we might think you're 驻讟讜专. And the 讞讬讚讜砖 that since he doesn't watch it enough, therefore the 讚讬谉 is that you are 讞讬讬讘. Concerning what we learned earlier in the 讚祝, that the 讙诪专讗 quoted 专讘 讗住讬 where he said that 讻住驻讬诐 讛专讬 讛谉 讻拽专拽注, that money is like 拽专拽注, and the 讙诪专讗 wanted to know concerning which 讚讬谉 he meant it. And at one point the 讙诪专讗 thought that it's in a case where two brothers divided their inheritance. One brother took 拽专拽注, and one brother took money. And then the 讘注诇 讞讜讘 came and took away the 拽专拽注 from the first brother. So what 专讘 讗住讬 said was that other brother who took the 讻住驻讬诐 has to pay him back half. And the 讙诪专讗 said this couldn't be, because this is 驻砖讬讟讗. 专讘 讗住讬 couldn't have meant it, because this is very simple, and the 讙诪专讗 expresses itself, 讛讗讬 讘专讬讛 讜讛讗讬 诇讗讜 讘专讬讛? Why should we think that he shouldn't have to give him half of the money? He is a son and he is not a son? Only the one that took the 拽专拽注, he is responsible to pay for the 讞讜讘, and not the other brother? Definitely, they're both responsible. So it's very simple that the other brother has to give him back half of his money. But
转讜住驻讜转 asks a 拽砖讬讗, how does the 讙诪专讗 know with such a 驻砖讬讟讜转 that the other brother has to pay him back half of the money? Didn't the 讙诪专讗 later bring a 诪讞诇讜拽转 between 专讘 and 砖诪讜讗诇, and 专讘 讗住讬, when two brothers divided inheritance of property, and the 讘注诇 讞讜讘 came and took away the property from one of them. So 专讘 says the whole 诪讞诇讜拽转 is 讘讟诇, the whole division is 讘讟诇, and you have to redivide whatever is left over. But 砖诪讜讗诇 says, too bad, the one that was taken away from, he loses on the deal. So we see there is a 住讘专讗 to say that one brother is responsible to pay, and the other one not. So how could the 讙诪专讗 here ask with such a 驻砖讬讟讜转 that we cannot say that this is what 专讘 讗住讬 meant, that the one that took the money has to pay half to the other brother, because they're both responsible to pay for the 讞讜讘? It is not so 驻砖讜讟. We see that 砖诪讜讗诇 doesn't learn that way. 砖诪讜讗诇 learns that when you take away the 拽专拽注 from one, the other brother doesn't have to give half of his 拽专拽注 to the first brother. And 转讜住驻讜转 says that we can't compare the two cases. In the
case of 砖诪讜讗诇, were both took 拽专拽注, and everyone knows that the 拽专拽注 is 诪砖讜注讘讚 to the 讘注诇 讞讜讘. When children inherit 拽专拽注, property, from their father, the 拽专拽注 is 诪砖讜注讘讚 to the 讘注诇 讞讜讘. So each one knows that there is a possibility for the 讘注诇 讞讜讘 to come to any of the two to take away his 拽专拽注 for the 讞讜讘. So when they divided the 拽专拽注, they had in mind knowing that the 讘注诇 讞讜讘 could come to any of the two. So each one, so to speak, took a chance hoping that he wouldn't come to him. So it's as if they made up 诇讻转讞讬诇讛 that if he does come to you, too bad, then you lose. If he comes to me, then I because they knew that it's possible he will come to any of the two. Here we're talking in a case where one took 拽专拽注 and one took 讻住祝. And the 讚讬谉 is that 诪讟诇讟诇讬 讚讬转诪讬 诇讗 诪砖转注讘讚讬 诇讘注诇 讞讜讘, that when the 讬转讜诪讬诐 the 讬讜专砖讬诐 inherit 诪讟诇讟诇讬谉 unmovable objects, including money, the money is not 诪砖讜注讘讚 to the 讘注诇 讞讜讘. Only 拽专拽注 is 诪砖讜注讘讚 to the 讘注诇 讞讜讘. So, when they divided and one took 拽专拽注 and one took 讻住祝, they 诇讻转讞讬诇讛 both knew that when the 讘注诇 讞讜讘 will come, he'll only be able to come to the one that has 拽专拽注. So, it makes no sense to say that the one that took the 拽专拽注 took it on condition knowing that he will be definitely the one that will be taken away from. Why should he do such a thing? So therefore, here we have to assume that when they divided it, it was on condition that if the 讘注诇 讞讜讘 will take away the 拽专拽注 from the one that took the 拽专拽注, the other one will have to pay him back half of the 讻住祝. In the case where they both took 拽专拽注, so there is an equal risk for both, so each one hoped that he will not be the one that the 讘注诇 讞讜讘 will take it from, and because of that, they made as if they made up their mind that whoever will lose will lose. But in a case where we know for sure that only one of the two is the one that's able to lose, so why should he take the 拽专拽注 and be sure that he could lose it? Therefore, here we must say that it's as if they made a condition that if the 讘注诇 讞讜讘 will take away the 拽专拽注, then the one that has the 讻住祝 will pay him back half. Then 转讜住驻讜转 asks another 拽讜砖讬讗, on that part of the 讙诪专讗 where it said that if two brothers divided 拽专拽注 and then the 讘注诇 讞讜讘 came and took away the 讞诇拽 of one of them, so we find a 诪讞诇讜拽转 between 专讘 and 砖诪讜讗诇 and 专讘 讗住讬. So, 转讜住驻讜转 asks how is it possible 讘讻诇诇 that the 讘注诇 讞讜讘 should take away the part of one of them, aren't they both equally responsible to pay for the 讞讜讘 of their father? So, the 讚讬谉 should be that 诇讻转讞讬诇讛 he shouldn't be able to take away the 讞诇拽 of one of them. And 转讜住驻讜转 answers that it could be speaking in a case where this part was made an 讗驻讜转讬拽讬. 讗驻讜转讬拽讬 means that in addition to a regular 砖注讘讜讚, that if 专讗讜讘谉 owes 砖诪注讜谉 money, so then all the property of 专讗讜讘谉 is 诪砖讜注讘讚 to 砖诪注讜谉. But in addition to that, sometimes 专讗讜讘谉 could say to 砖诪注讜谉, 讗驻讜转讬拽讬 means 讗驻讬 转讛讗 拽讗讬, on a specific piece of property that this specific property is 诪砖讜注讘讚 specifically to your 讞讜讘. Now, if he does that, then when a 讘注诇 讞讜讘 comes to claim his money, he takes away that piece of property which became an 讗驻讜转讬拽讬. And that's what the 讙诪专讗 means. If two brothers divided 拽专拽注, and one of the two parts of the 拽专拽注 was the 讗驻讜转讬拽讬 to the 讘注诇 讞讜讘. So, when the 讘注诇 讞讜讘 comes, he takes away that 拽专拽注. And that's where we have the 诪讞诇讜拽转 between 专讘 and 砖诪讜讗诇 and 专讘 讗住讬, whether the other brother has to pay him back or not. And then 转讜住驻讜转 asks another 拽讜砖讬讗. 专讘 said that in a case like that 讘讟诇讛 诪讞诇讜拽转, the whole division is 讘讟诇, and you would have to take the 拽专拽注 that's in the hands of the other brother and you redivide it equally now. So, it comes out from this 讙诪专讗, 转讜住驻讜转 says, that if the other brother says, "I want to pay you with money, instead of taking the 拽专拽注 and dividing it again, I want to pay you half of the value of the 拽专拽注 instead of you taking away half of the 拽专拽注," he can't do that. That's what he says 讘讟诇讛 诪讞诇讜拽转, the whole division is 讘讟诇, and he can't pay him money. So, 转讜住驻讜转 asks why is that different than what 专讘 讗住讬 says? We said that 专讘 讗住讬 holds you have to give him 专讘讬注 讘拽专拽注 专讘讬注 讘诪注讜转, a quarter in 拽专拽注 or a quarter with money, that that quarter that you have to pay him, if you want you could pay him with 拽专拽注, and if you want you could pay him with money. And the reason 专讘 讗住讬 said that you have to pay him 讘讻诇诇 a quarter was because 专讘 讗住讬 had a 住驻拽. Maybe the 讛诇讻讛 is like 专讘, and you do owe the money. Maybe the 讛诇讻讛 is like 砖诪讜讗诇, and you don't. And therefore, you divide it in half as we said before. But that half that you do have to give, which is because maybe the 讛诇讻讛 is like 专讘, he said you could give or 拽专拽注 or money. So, why is it that 专讘 讗住讬 holds that the part that you do have to give, you're allowed to pay money, while 专讘, when he says that you do have to give, he says that you cannot pay money, but you must divide the 拽专拽注? What is the reason of 专讘? And 转讜住驻讜转 says that the reason of 专讘 讗住讬, why he holds that you could pay with money, because he says that the brother could say to his other brother, that if the 讘注诇 讞讜讘 would have come to me, I would have paid him, because you could pay the 讘注诇 讞讜讘 with money, that is clear. That even though the reason he comes is because the 拽专拽注 is 诪砖讜注讘讚 to him, but if you want to pay him money you're allowed to. So, he could say, "Had he come to me, I would pay him with money, so therefore, I don't have to give you 拽专拽注, I could give you also money." But 专讘 doesn't hold of that 住讘专讗, he says we don't look at what he could have done to the 讘注诇 讞讜讘. And therefore, 专讘 says, 讘讟诇讛 诪讞诇讜拽转, the whole division is 讘讟诇 and you have to redo it. And 转讜住驻讜转 explains that even though we said before that here it's a case where there was an 讗驻讜转讬拽讬, that this 拽专拽注 that he took was set aside 诇讻转讞讬诇讛 to be 诪砖讜注讘讚 to the loan, so how can 专讘 讗住讬 say that the brother 讟注谞'住 that I would have paid the 讘注诇 讞讜讘 money? But 转讜住驻讜转 says it's in a case of an 讗驻讜转讬拽讬 that you could pay him money.
There are two types of an 讗驻讜转讬拽讬. There are a certain kind of 讗驻讜转讬拽讬 that if the 讘注诇 讞讜讘 comes, you cannot send him away by paying him money, but he takes the 拽专拽注 诇讻转讞讬诇讛, and there is another kind of an 讗驻讜转讬拽讬 that if you want to pay him money, you could pay him money. If you don't pay him money, that's when he takes this 拽专拽注.
