Intro and Starting Point of the Lecture

Today's 砖讬注讜专 will be 诪住讻转 讘讘讗 拽诪讗 讚祝 讬状讚, but we will start seven lines from the bottom of 讚祝 讬状讙 注诪讜讚 讘壮. The 讙诪专讗 starts 讗诪专 诪专, we learned in the 讘专讬讬转讗 before. The 讙诪专讗 is going to explain the 讘专讬讬转讗 that was mentioned before. Before, we mentioned the 讘专讬讬转讗 in order to explain what the words 讻砖讛讝讬拽 讞讘 讛诪讝讬拽 come to add, and now the 讙诪专讗 will explain the 驻砖讟 in that 讘专讬讬转讗. We learned in the 讘专讬讬转讗: 讻砖讛讝讬拽 讞讘 讛诪讝讬拽 - by using the words 讻砖讛讝讬拽 讞讘 讛诪讝讬拽, that when you cause damage the 诪讝讬拽 is obligated to pay, 诇讛讘讬讗 - that comes to include, comes to add, 砖讜诪专 讞谞诐 讜讛砖讜讗诇 谞讜砖讗 砖讻专 讜讛砖讜讻专. That if a 砖讜诪专 讞谞诐, a person who watches for somebody else for free, or a person who borrows from somebody else, or a person who watches for somebody else but for money, or a person who rents from somebody else. So the 讘专讬讬转讗 says that if the 讘讛诪讛 caused damage while it was in the 专砖讜转 of one of these 砖讜诪专讬诐, so if the 讘讛诪讛 was a 转诐, then you pay 讞爪讬 谞讝拽, if the 讘讛诪讛 was a 诪讜注讚, then you pay 谞讝拽 砖诇诐, the complete 谞讝拽. And the

Gemara Raises Question About the Case

讙诪专讗 asks: 讛讬讻讬 讚诪讬? What is this case talking about? 讗讬诇讬诪讗, if you're going to say, 讚讗讝拽讬讛 转讜专讗 讚诪砖讗讬诇 诇转讜专讗 讚砖讜讗诇, that the ox that belongs to the 诪砖讗讬诇, that belongs to the owner, caused damage to the ox of the 砖讜讗诇, of the one that borrowed, that what the 讘专讬讬转讗 says that if this animal that was in the possession of the 砖讜诪专 caused damage, then you are 讞讬讬讘 to pay 讞爪讬 谞讝拽 for a 转诐 and 谞讝拽 砖诇诐 for a 诪讜注讚. So if it would mean that the 砖讜专 that he was watching caused damage to his own 砖讜专, and the 讘专讬讬转讗 is telling us that the 诪砖讗讬诇, the owner of the 砖讜专, has to pay to the 砖讜讗诇, to the 砖讜诪专, half of the 谞讝拽 for 转诐 and 谞讝拽 砖诇诐 for a 诪讜注讚, why should be the 讚讬谉 so? 诇讬诪讗 诇讬讛, why doesn't the 诪砖讗讬诇, the owner of the ox, say to this 砖讜讗诇: 讗讬诇讜 讗讝讬拽 讘注诇诪讗 讘注讬转 诇砖诇讜诪讬 讗转? If my ox, while it's in your possession, would have caused damage to somebody else, you would have to pay for that because you are responsible to watch my ox. 讛砖转讗 讚讗讝拽讬讛 诇转讜专讗 讚讬讚讱, now that it caused damage to your ox, 讘注讬谞讗 诇砖诇讜诪讬, I have to pay? It makes no sense that the 诪砖讗讬诇 should have to pay for the damage his ox did while it was in possession of the 砖讜诪专 when the 砖讜诪专 is obligated to watch it! 讗诇讗, so therefore we must say, 讚讗讝拽讬讛 转讜专讗 讚砖讜讗诇 诇转讜专讗 讚诪砖讗讬诇. That what happened was just the opposite: that his own 砖讜专, the 砖讜专 that belongs to the 砖讜诪专, to the watchman, to the 砖讜讗诇, to the borrower, caused damage to the 砖讜专 of the owner, of the 诪砖讗讬诇, of the one that gave him to watch. And that's what the 讘专讬讬转讗 says: that the watchman is obligated to pay to the owner of the other ox, if it was a 转诐 - 讞爪讬 谞讝拽, and if it was a 诪讜注讚 - 谞讝拽 砖诇诐. Why should be the 讚讬谉 so? 诇讬诪讗 诇讬讛, let the 诪砖讗讬诇, the owner of the ox, say to the watchman: 讗讬诇讜 讗讬讝讬拽 诪注诇诪讗, if my ox would have got damaged from something else, from an ox of the outside, 讘注讬转 诇砖诇讜诪讬 讻讜诇讬 转讜专讗, you would have to pay for the complete ox of mine. Because the 讚讬谉 is that a 砖讜讗诇 is 讞讬讬讘 讘讗讜谞住讬谉. If someone borrows an object, even if it was lost or damaged 讘讗讜谞住, by force, the 砖讜讗诇 is 讞讬讬讘 to pay for that. So if the ox of the 诪砖讗讬诇 would have been damaged from the outside, then the 砖讜讗诇 would be responsible to pay to the 诪砖讗讬诇 for the whole ox. 讛砖转讗 讚讗讝拽讬讛 转讜专讗 讚讬讚讱, now that your ox caused damage to mine, 驻诇讙讗 谞讬讝拽讗 讚诪砖诇诪转 诇讬? All you're going to pay me is a 讞爪讬 谞讝拽? Because the 讘专讬讬转讗 says that if it was a 转诐, he only pays half a 谞讝拽. And according to this it would mean that the 砖讜讗诇, the borrower, has to pay to the 诪砖讗讬诇, to the lender, only half a 谞讝拽 if it was a 转诐, if his own ox, the borrower's ox, caused damage to the lender's ox. But why should it be so? Since the borrower is responsible for whatever, anything that happens to the ox of the lender, so even if something happened through his own ox, he still should have to pay always for the complete damage, for the complete ox! So how could the 讘专讬讬转讗 say that he only pays 讞爪讬 谞讝拽? So the question is back: What is the case of the 讘专讬讬转讗?

Gemara Provides Resolution of the Liability

So the 讙诪专讗 says: 诇注讜诇诐, the truth is, 讚讗讝拽讬讛 转讜专讗 讚诪砖讗讬诇 诇转讜专讗 讚砖讜讗诇, that the ox of the lender caused damage to the ox of the borrower. And the question that we asked before is, why should the 诪砖讗讬诇, the lender, have to pay the borrower for the damage? Why doesn't he say to him: If my ox, while it's in your possession, would have caused damage to somebody else, you would have been responsible to pay because You are the 砖讜诪专, you had to watch it. So now that my ox caused damage to your ox, I should pay you? The 讙诪专讗 says, 讛讻讗 讘诪讗讬 注住拽讬谞谉, here we're talking in a case 砖拽讬讘诇 注诇讬讜 砖诪讬专转 讙讜驻讜 讜诇讗 拽讬讘诇 注诇讬讜 砖诪讬专转 谞讝拽讬讜, that this watchman accepted upon himself to watch the ox, that nothing should happen to the ox, but he didn't accept upon himself to watch it that it should not cause any damage to others. And therefore, if this ox would have caused damage to something on the outside, he would have not been responsible to pay because he didn't accept that 砖诪讬专讛 upon himself. So therefore, too, if this ox caused damage to his own ox, he also expects the 诪砖讗讬诇, the lender, to pay for it because he is not responsible to watch it from causing any damage to the outside. And the reason the 讙诪专讗 gives this answer and not just the opposite, 诇讻讗讜专讛, the 讙诪专讗 could have answered that 讘讗诪转, this is a case that the ox of the 砖讜讗诇, of the borrower, caused damage to the ox of the lender. And 讗讬讬, the question was that we asked before, why does he only have to pay 讞爪讬 谞讝拽? We could say that he accepted only the 砖诪讬专讛 of the 谞讝拽讬诐, he accepted upon himself only to watch that it should not cause damage to the outside, but he didn't accept upon himself to watch the ox itself. And therefore, if the ox was damaged by his ox, he is not responsible, he only has to pay like a regular 诪讝讬拽. So therefore, if it's a 转诐, he only pays 讞爪讬 谞讝拽. And 转讜住驻讜转 says the 讙诪专讗 didn't say that because that is not common. It is not common for a person to accept upon himself to watch something that it shouldn't cause damage to others, but not to accept upon himself to watch the thing itself, it shouldn't get damaged. On the other hand, the example the 讙诪专讗 gives is a common example, that a person could accept upon himself to watch something that nothing should happen to it, but not to accept upon himself that it should not cause damage to

Night versus Day Damage and Unforced Loss

others. But then the 讙诪专讗 asks, 讗讬 讛讻讬, if so, 讗讬诪讗 住讬驻讗, look into the 住讬驻讗, the end of the 讘专讬讬转讗. It says there, 谞驻专爪讛 讘诇讬诇讛, if it broke the wall at night, 讗讜 砖驻专爪讜讛 诇讬住讟讬诐, or if robbers broke the wall, 讜讬爪转讛, and it went out, 讜讛讝讬拽讛, and it caused damage to others, 驻讟讜专, you are 驻讟讜专, because this is called an 讗讜谞住 and he is 驻讟讜专 from an 讗讜谞住. But the question is, 讛讗 讘讬讜诐, 讞讬讬讘. It comes out that only if it happened at night, when it's a real 讗讜谞住, that's when we say that the 砖讜诪专 is 驻讟讜专. But if that would have happened during the day, the 砖讜诪专 would be 讞讬讬讘. 讛讗 诇讗 拽讬讘诇 注诇讬讜 砖诪讬专转 谞讝拽讬讜! But didn't we say that we're talking here in a case where he did not accept upon himself the responsibility to watch it from causing damage to others? And in that case, why would be the 讚讬谉 that if it went out during the day and it caused damage to others, he is 讞讬讬讘? And the 讙诪专讗 answers, 讛讻讬 拽讗诪专, this is what he means: 讗诐 拽讬讘诇 注诇讬讜 砖诪讬专转 谞讝拽讬讜, 讞讬讬讘. There's like a piece missing in the 讘专讬讬转讗. After the 讘专讬讬转讗 says that if it caused damage, so for a 转诐 you pay 讞爪讬 谞讝拽, and for a 诪讜注讚 you pay 谞讝拽 砖诇诐, and we explained that that is talking in a case where he accepted upon himself to watch it, but not to watch it that it shouldn't cause damage to others, so then the 讘专讬讬转讗 really has another piece there. It continues that 讗诐 拽讬讘诇 注诇讬讜 砖诪讬专转 谞讝拽讬讜, that if he did accept upon himself to watch it that it shouldn't cause damage to others, 讞讬讬讘, you are 讞讬讬讘. And that's where the 讘专讬讬转讗 continues that if 谞驻专爪讛 讘诇讬诇讛 讗讜 砖驻专爪讜讛 诇讬住讟讬诐, if it broke at night or robbers broke it, 讜讬爪转讛, and it went out, 讜讛讝讬拽讛, and it caused damage, 驻讟讜专, it's 驻讟讜专. Only during the day you're 讞讬讬讘 because you are responsible to watch it, therefore you are 讞讬讬讘 for the 谞讝拽讬谉 that it did if you accepted upon himself the 砖诪讬专转 谞讝拽讬讜 to watch it from causing damage. But if it happened at night with 讘讗讜谞住, then you are 驻讟讜专. Now, one might ask a question, according to the 驻砖讟 in the 讙诪专讗 that the person accepted upon himself to watch it from being damaged, but not to watch it from causing damage to others, and therefore the 讚讬谉 is that in the case where the ox of the lender caused damage to the ox of the borrower, he pays 讞爪讬 谞讝拽 for a 转诐 and 谞讝拽 砖诇诐 for a 诪讜注讚, what is the 讞讬讚讜砖? Isn't that very simple? It's 驻砖讬讟讗. Since he did not accept upon himself to watch it from causing damage to others, so if it would have caused damage to others, the lender would have to pay because he is not responsible, so the owner of the ox would be responsible. So it's simple that the same thing applies if that same ox caused damage to his ox, that the 诪砖讗讬诇 should have to pay him, because why should he be different than others? If it would cause damage to others, the owner of the ox, the 诪砖讗讬诇, would have to pay, so why shouldn't he have to pay him too? And 转讜住驻讜转 answers that I would think that even when a person does not accept upon himself to watch it from causing damage to others, but that is only concerning others, but concerning himself he is obligated to watch it, and therefore if that ox caused damage to his own ox, the owner of the first ox should be 驻讟讜专. And the 讞讬讚讜砖 of the 讘专讬讬转讗 is that nevertheless he is 讞讬讬讘, but the 讚讬谉 is like a regular 讞讬讜讘. If it's a 转诐, you're 讞讬讬讘 讞爪讬 谞讝拽, if it's it's a 诪讜注讚 you're 讞讬讬讘 谞讝拽

Dispute Over Damage in a Shared Yard

砖诇诐. And now the 讙诪专讗 goes back to the 诪讞诇讜拽转 we had before concerning 讞爪专 讛砖讜转驻讬谉. The 讙诪专讗 before mentioned that when you have a 讞爪专 讛砖讜转驻讬谉, a yard that belongs to two people, and the 砖讜专 of one of the two partners caused damage to the other partner through 砖谉 讜专讙诇, through eating his fruit or through stepping on his things, there was a 诪讞诇讜拽转 whether you are 讞讬讬讘 or not. Since the 讚讬谉 is by 砖谉 讜专讙诇 that you are only 讞讬讬讘 if the damage was done in the 专砖讜转 of the 谞讬讝拽, as we learn out from the 驻住讜拽 讜讘注专 讘砖讚讛 讗讞专, that only if you cause damage in the field of the other you are 讞讬讬讘 for 砖谉 讜专讙诇, so the question is a 讞爪专 讛砖讜转驻讬谉, is that considered 砖讚讛 讗讞专 or not? Since you also have a right to go into that part of the 讞爪专, since your ox also had a right to go in, so there's a question whether you are responsible to pay if your ox caused damage through 砖谉 讜专讙诇. So the 讙诪专讗 before said that 专讘 讞住讚讗 learned that you are 讞讬讬讘 砖谉 讜专讙诇, and 专讘讬 讗诇注讝专 said that you are 驻讟讜专 from 砖谉 讜专讙诇 in the 讞爪专

Gemara Challenges Rabbi Elazar's Position

讛砖讜转驻讬谉. So now the 讙诪专讗 asks a 拽砖讬讗, 讗讬谞讬, is it not so? How could 专讘讬 讗诇注讝专 say that you are 驻讟讜专 from 砖谉 讜专讙诇 in the 讞爪专 讛砖讜转驻讬谉, 讜讛转谞讬 专讘 讬讜住祝, didn't 专讘 讬讜住祝 teach us a 讘专讬讬转讗 where it says 讞爪专 讛砖讜转驻讬谉 讜讛驻讜谞讚拽, if you have a 讞爪专 of partners or a 驻讜谞讚拽, an inn, where you have many people, many guests coming and staying there, 讞讬讬讘 注诇 讛砖谉 讜注诇 讛专讙诇, you are 讞讬讬讘 for 砖谉 讜专讙诇. It is not like a 专砖讜转 讛专讘讬诐. The 讚讬谉 is that 砖谉 讜专讙诇 is 驻讟讜专 in the 专砖讜转 讛专讘讬诐, but by an inn or a 讞爪专 讛砖讜转驻讬谉 it is not like a 专砖讜转 讛专讘讬诐 since it is 诪讬讜讞讚, it is specifically for the people who stay there, so then it is considered a 砖讚讛 讗讞专, and therefore if your animal causes damage through 砖谉 讜专讙诇 in a 讞爪专 讛砖讜转驻讬谉 or in an inn, you are 讞讬讬讘. So 转讬讜讘转讗 讚专讘讬 讗诇注讝专, isn't this a 拽砖讬讗 on 专讘讬 讗诇注讝专? And the 讙诪专讗 says 讗诪专 诇讱 专讘讬 讗诇注讝专, 专讘讬 讗诇注讝专 would answer, 讜转住讘专讗, what do you think? 诪转谞讬转讗 诪讬 诇讗 驻诇讬讙讬? Isn't there a 诪讞诇讜拽转 in 讘专讬讬转讜转? In other words, what he's saying is that it's true that this 讘专讬讬转讗 that 专讘 讬讜住祝 taught tells us that you are 讞讬讬讘 for 砖谉 讜专讙诇 in 讞爪专 讛砖讜转驻讬谉, but I have another 讘专讬讬转讗 where it says that you are 驻讟讜专 for 讞爪专 讛砖讜转驻讬谉, and I follow that 讘专讬讬转讗. Anything which is the 专砖讜转, which is the domain of the 谞讬讝拽 and not of the 诪讝讬拽, then you are 讞讬讬讘 in everything, which means you are 讞讬讬讘 for 砖谉 讜专讙诇 because it's a 讞爪专 讛谞讬讝拽, you are 讞讬讬讘 for 拽专谉, you are 讞讬讬讘 for all damages. And 专砖状讬 brings here that the 讙诪专讗 later on will say that not only are you 讞讬讬讘 for every 讗讘, any type of damage, but even more than that, since it's a 讞爪专 讛谞讬讝拽, you are even 讞讬讬讘 for 拽专谉 转诐 谞讝拽 砖诇诐. Normally we know that if it's 拽专谉 and it's a 转诐, you are 讞讬讬讘 only 讞爪讬 谞讝拽, but that's only if it was done in the 专砖讜转 讛专讘讬诐. But if it was done through 拽专谉 in the 讞爪专 讛谞讬讝拽, in the yard of the one the damage was caused to, then even a 拽专谉 转诐 pays 谞讝拽 砖诇诐, as the 讙诪专讗 will explain later that this is the opinion of 专讘讬 讟专驻讜谉. The second rule is 诇诪讝讬拽 讜诇讗 诇谞讬讝拽, if it was the 专砖讜转, the domain of the 诪讝讬拽 and not of the 谞讬讝拽, 驻讟讜专 诪讻诇, he is 驻讟讜专 from everything, because he could always say to the 谞讬讝拽, "What did your property do in my 专砖讜转?" Since the damage was caused in my 专砖讜转, you had no right to come into my 专砖讜转 to begin with, and therefore you're 驻讟讜专. 诇讝讛 讜诇讝讛, if it was a 专砖讜转 that belonged to both, to the 诪讝讬拽 and to the 谞讬讝拽, 讻讙讜谉 讞爪专 讛砖讜转驻讬谉, for instance a yard that belonged to two partners, 讜讛讘拽注讛, or a valley, 驻讟讜专 讘讜 注诇 讛砖谉 讜注诇 讛专讙诇. So for 砖谉 and 专讙诇 you are 驻讟讜专, because in 讞爪专 讛砖讜转驻讬谉, this 讘专讬讬转讗 holds you're 驻讟讜专 for 砖谉 讜专讙诇. But 注诇 讛谞讙讬讞讛 讜注诇 讛谞讙讬驻讛, for goring and for pushing, 讜注诇 讛谞砖讬讻讛, and for biting, 讜注诇 讛专讘讬爪讛, and for laying down, 讜注诇 讛讘注讬讟讛, and for kicking, all these 转讜诇讚讜转 of 拽专谉, so the 讚讬谉 would be 转诐 诪砖诇诐 讞爪讬 谞讝拽, a 转诐 would pay half a 谞讝拽, 讜诪讜注讚 诪砖诇诐 谞讝拽 砖诇诐, and a 诪讜注讚 would pay complete 谞讝拽. Because since this is considered like a 专砖讜转 讛专讘讬诐, as we see that for 砖谉 and 专讙诇 you're completely 驻讟讜专, in a 专砖讜转 讛专讘讬诐 the 讚讬谉 is that 拽专谉, a 转诐 pays 讞爪讬 谞讝拽 and a 诪讜注讚 pays 谞讝拽 砖诇诐. Then the fourth rule is that 诇讗 诇讝讛 讜诇讗 诇讝讛, if it was a 专砖讜转 that did not belong to this one, not to the 诪讝讬拽, and it didn't belong to this one, not to the 谞讬讝拽, 讻讙讜谉, for instance, 讞爪专 砖讗讬谞讛 砖诇 砖谞讬讛诐, a 讞爪专, a yard that did not belong to any of them, and as 专砖状讬 brings here, the 讙诪专讗 will explain it means it did not belong to both, but it did belong to one, to the 谞讬讝拽, So if it's a yard that belonged to the 谞讬讝拽, so the 讚讬谉 is that 讞讬讬讘讬谉 讘讜 注诇 讛砖谉 讜注诇 讛专讙诇. So for 砖谉 讜专讙诇 you are 讞讬讬讘 because it was the 专砖讜转 of the 谞讬讝拽, as we just said. And in the 专砖讜转 of the 谞讬讝拽, you're 讞讬讬讘 for 砖谉 讜专讙诇. But 注诇 讛谞讙讬讞讛 讜注诇 讛谞砖讬讻讛 讜注诇 讛谞讙讬驻讛 讜注诇 讛专讘讬爪讛 讜注诇 讛讘注讬讟讛, for all these, which are 拽专谉, so 转诐 诪砖诇诐 讞爪讬 谞讝拽, a 转诐 would have to pay half of the 谞讝拽, and a 诪讜注讚 诪砖诇诐 谞讝拽 砖诇诐, and a 诪讜注讚 would pay complete 谞讝拽. And the 讙诪专讗 later on will ask that if we're going to say that this means the 讞爪专 讛谞讬讝拽, so in the beginning of the 讘专讬讬转讗 we said that a 讞爪专 讛谞讬讝拽, even a 转诐 of 拽专谉, pays the complete 谞讝拽. And now we're saying that this is a 讞爪专 讛谞讬讝拽 because, as we just said before, 诇讗 诇讝讛 讜诇讗 诇讝讛, when the 讘专讬讬转讗 says it doesn't belong to this one and not to this one, it means not to both, but only to one, to the 谞讬讝拽, and nevertheless the 讚讬谉 is that a 转诐 for 拽专谉 pays 讞爪讬 谞讝拽. So it's a contradiction in the 讘专讬讬转讜转, and the 讙诪专讗 will ask that later. But here we have the complete 讘专讬讬转讗, and the 讙诪专讗 says 拽转谞讬 诪讬讛转, so at least we see in this 讘专讬讬转讗 that one of the cases was 讞爪专 讛砖讜转驻讬谉 讜讛讘拽注讛, that if it's a yard of partners or the valley, 驻讟讜专 讘讜 注诇 讛砖谉 讜注诇 讛专讙诇, you are 驻讟讜专 for 砖谉 讜专讙诇. So this is the 讘专讬讬转讗 that 专' 讗诇注讝专 brought to show us that we have a 讘专讬讬转讗 that says that in 讞爪专 讛砖讜转驻讬谉 you are 驻讟讜专 for 砖谉 讜专讙诇. Then the 讙诪专讗 asks: 拽砖讬讬谉 讗讛讚讚讬, but after all, there is a contradiction between these two 讘专讬讬转讜转. The 讘专讬讬转讗 that 专讘 讬讜住祝 taught us says that 讞爪专 讛砖讜转驻讬谉 and the 驻讜谞讚拽, the inn, you are 讞讬讬讘 for 砖谉 讜专讙诇, and in this 讘专讬讬转讗 it says that in the 讞爪专 讛砖讜转驻讬谉 and the 讘拽注讛 you are 驻讟讜专 for 砖谉 讜专讙诇. And the 讙诪专讗 answers like this: 讻讬 转谞讬讗 讛讛讬讗, that this 讘专讬讬转讗 where it says that you are 驻讟讜专 for 砖谉 讜专讙诇 in 讞爪专 讛砖讜转驻讬谉, that's 讘讞爪专 诪讬讜讞讚转 诇讝讛 讜诇讝讛 讘讬谉 诇驻讬专讜转 讘讬谉 诇砖讜讜专讬诐. It was a real yard of partners that both of the partners, the 诪讝讬拽 and the 谞讬讝拽, had a right to bring into that yard their oxen and they had a right to bring in their fruit. And therefore, it's 诪诪砖 a 讞爪专 讛砖讜转驻讬谉. So the 讚讬谉 is that in 讞爪专 讛砖讜转驻讬谉 you are 驻讟讜专 from 砖谉 讜专讙诇. But 讛讛讬讗 讚专讘 讬讜住祝, that 讘专讬讬转讗 that 专讘 讬讜住祝 brought where it says that 讞爪专 讛砖讜转驻讬谉 you are 讞讬讬讘 for 砖谉 讜专讙诇, that's 讘讞爪专 诪讬讜讞讚转 诇驻讬专讜转, that for 驻讬专讜转, for fruit, it was a yard that both had a right to put their fruit in, 讜讗讬谞讛 诪讬讜讞讚转 诇砖讜讜专讬诐, but not both had a right to bring their oxen in. Just the 谞讬讝拽 had a right to bring his oxen, but the 诪讝讬拽 had no right to bring his oxen. So he wasn't a complete partner. He was only a partner that he was allowed to put his fruit in. Both had a right to put their fruit in, but not both had a right to put in their oxen. The 诪讝讬拽 had no right to put in the ox. And therefore, 讚诇讙讘讬 砖谉 讛讜讬讗 诇讛 讞爪专 讛谞讬讝拽. So 诇讙讘讬 the 讚讬谉 of 砖谉, it is considered a yard of the 谞讬讝拽, because only the 谞讬讝拽 had a right to bring in his oxen. The 诪讝讬拽 had no right to bring in his ox. So the question is: What was the ox doing in this field, that he should be able to eat up the 驻讬专讜转 of the 谞讬讝拽? He had no right to go in. And therefore, since he had no right to bring in his ox, so this 讘专讬讬转讗 says that in 讞爪专 讛砖讜转驻讬谉 you are 讞讬讬讘 for 砖谉 讜专讙诇, because 诇讙讘讬 the ox going in and eating the fruit, it is not really a 讞爪专 讛砖讜转驻讬谉. It is not really a yard of partners, because the 诪讝讬拽 had no right to bring his ox in. And the 讙诪专讗 says 讚讬拽讗 谞诪讬, we could even prove from a 讚讬讜拽 of both 讘专讬讬转讜转 that one 讘专讬讬转讗 is a complete partnership and one 讘专讬讬转讗 is not, from the words of the 讘专讬讬转讗. 讚拽转谞讬 讛讻讗, because in the 讘专讬讬转讗 of 专讘 讬讜住祝 it says 讚讜诪讬讗 讚驻讜谞讚拽. It says the 讞爪专 of the 砖讜转驻讬谉 and the inn. So it tells us that what kind of yard of 砖讜转驻讬谉 are we talking about? Similar to the inn. And we know that in an inn you cannot bring in an ox, because the guests are there and they bring in their merchandise and it's obvious that you cannot bring in an ox. So that tells us that the 讘专讬讬转讗 of 专讘 讬讜住祝 is in a case where you could not bring in the ox. 讜拽转谞讬 讛转诐, and in the other 讘专讬讬转讗 where it says you are 驻讟讜专 for 砖谉 讜专讙诇, it says 讚讜诪讬讗 讚讘拽注讛. It takes an example of 讞爪专 讛砖讜转驻讬谉 and a valley. In a valley you do bring in an ox. 砖诪注 诪讬谞讛, so that tells us that that is the difference between these two 讘专讬讬转讜转. 诪转讬讘 专讘 讝讬专讗, but then 专讘 讝讬专讗 asked a 拽讜砖讬讗: 讻讬讜谉 讚诪讬讜讞讚转 诇驻讬专讜转, we said that in the 讘专讬讬转讗 of 专讘 讬讜住祝 it's a case where both had a right to bring in the fruit. It's just that the 诪讝讬拽 had no right to bring in his ox, that's why you're 讞讬讬讘. But nevertheless, 专讘 讝讬专讗 asked, since they both had a right to bring in the fruit, 讛讗 讘注讬谞谉 讜讘注专 讘砖讚讛 讗讞专 讜诇讬讻讗. Don't we need, in order to be 讞讬讬讘 for 砖谉 讜专讙诇, that it has to be considered someone else's field? But since the 诪讝讬拽 also had a right to bring in his fruit, 诇讻讗讜专讛 it should not be considered someone else's field, the field of the 谞讬讝拽, since the 诪讝讬拽 had the same right concerning the fruit as the 谞讬讝拽. 讗诪专 诇讬讛 讗讘讬讬, so 讗讘讬讬 said to him, 讻讬讜谉 讚讗讬谞诐 诪讬讜讞讚转 诇砖讜讜专讬诐, since it is not for oxen a 砖讜转驻讜转, in other words the 诪讝讬拽 had no right to bring in his ox, 砖讚讛 讗讞专 拽专讬谞谉 讘讬讛, so it is considered someone else's field, because we look at the 诪讝讬拽, and since the 诪讝讬拽, the ox, had no right to come in, it is considered the field of the 谞讬讝拽 concerning 砖谉 讜专讙诇. 讗诪专 诇讬讛 专讘 讗讞讗 诪讚驻转讬 诇专讘讬谞讗, so 专讘 讗讞讗 诪讚驻转讬 said to 专讘讬谞讗, 诇讬诪讗, let us say, 诪讬讚讬 讚诪转谞讬转讗 诇讗 驻诇讬讙讬, since the 讘专讬讬转讜转 don't argue, we found a way to show that there is no 诪讞诇讜拽转 in the 讘专讬讬转讜转, but each 讘专讬讬转讗 speaking in a different case, 讗诪讜专讗讬 谞诪讬 诇讗 驻诇讬讙讬, maybe the 讗诪讜专讗讬诐 are also not arguing? We said before that there was a 诪讞诇讜拽转 between 专讘 讞住讚讗 and 专讘讬 讗诇注讝专, that 专讘 讞住讚讗 said that you are 讞讬讬讘 for 砖谉 讜专讙诇 in 讞爪专 讛砖讜转驻讬谉, and 专讘讬

Different rulings on exemption vs liability in partnership cases

讗诇注讝专 said you are 驻讟讜专, maybe they too are not arguing? Maybe one is speaking in a case when there is a complete 砖讜转驻讜转 for the oxen and for the fruit, and that's why he says that you are 驻讟讜专, and the one that says that you are 讞讬讬讘 is speaking in a case where they only had a right both to bring in the fruit, but the 诪讝讬拽 had no right to bring in his ox. 讗诪专 诇讬讛, so he said to him, 讗讬谉, yes, you are right, it's possible that really they are not arguing and they're talking about two different cases. 讜讗诐 转诪爪讬 诇讜诪专 驻诇讬讙讬, but if you do want to say that they are arguing, the 诪讞诇讜拽转 is 讘拽讜砖讬讗 讚专讘讬 讝讬专讗, it is concerning the 拽砖讬讗 that 专讘讬 讝讬专讗 asked, 讜讘驻讬专讜拽讗 讚讗讘讬讬 驻诇讬讙讬, and the answer of 讗讘讬讬, that's their 诪讞诇讜拽转, that what would be their 诪讞诇讜拽转, whether we accept the 拽砖讬讗 of 专讘讬 讝讬专讗 or whether we accept the 转讬专抓 of 讗讘讬讬. As we as we said before that in the case where they both have a right to bring in their fruit, and the 诪讝讬拽 has no right to bring in his ox, so 专讘讬 讝讬专讗 asked a 拽砖讬讗 why still should be the 讚讬谉 that you are 讞讬讬讘, after all it is not considered 砖讚讛 讗讞专, since the 诪讝讬拽 also had a right to bring in his fruit, it should not be considered the 专砖讜转 of the 谞讬讝拽. And 讗讘讬讬 answered that nevertheless, since the 诪讝讬拽 had no right to bring in his ox, it is considered the 专砖讜转 of the 谞讬讝拽. So this is the 诪讞诇讜拽转 between 专讘 讞住讚讗 and 专讘讬 讗诇注讝专, whether we accept the 拽砖讬讗 of 专讘讬 讝讬专讗 or we accept the 转讬专抓 of 讗讘讬讬, which means that the 诪讞诇讜拽转 between 专讘 讞住讚讗 and 专讘讬 讗诇注讝专 is in a case where they are partners in the fruit, that they both have a right to bring in their fruit, but the 诪讝讬拽 has no right to bring in his ox. And the 诪讞诇讜拽转 between 专讘 讞住讚讗 and 专讘讬 讗诇注讝专 is that 专讘 讞住讚讗 who says 讞讬讬讘, because he holds like the 转讬专抓 of 讗讘讬讬, that this is considered the 讞爪专 讛谞讬讝拽, and 专讘讬 讗诇注讝专 who says that you are 驻讟讜专, cuz he holds like the 拽砖讬讗 of 专讘讬 讝讬专讗, that it is not considered 讘砖讚讛 讗讞专, because after all it is a partnership and the 诪讝讬拽 has a right to put in his fruit, so it's not considered 讘砖讚讛 讗讞专, and therefore he holds that you are 驻讟讜专. Then the 讙诪专讗 continues, 讙讜驻讗, now we will explain the 讙讜祝 of the 讘专讬讬转讗 that we brought before. The first thing was that 讻诇 砖讛讜讗 专砖讜转 诇谞讬讝拽 讜诇讗 诇诪讝讬拽, if it's 专砖讜转 for the 谞讬讝拽 and not for the 诪讝讬拽, 讞讬讬讘 讘讻诇, you're 讞讬讬讘 for everything. And the 讙诪专讗 is 诪讚讬讬拽, 注诇 讛讻诇 诇讗 拽转谞讬, it doesn't say you're 讞讬讬讘 for everything, 讗诇讗 讞讬讬讘 讘讻诇, you're 讞讬讬讘 in everything. If it would say that you are 讞讬讬讘 on everything, it would mean for any type of 谞讝拽 that was done you are 讞讬讬讘, for 砖谉 and 专讙诇 and 拽专谉, etc. Since he says you're 讞讬讬讘 for everything, it means you are 讞讬讬讘 for all the damage that's done, 讘讻讜诇讬 谞讝拽, in the complete 谞讝拽. So it's as if the 讘专讬讬转讗 is telling us that for whatever damage was done you are always 讞讬讬讘 to pay the full damage. And normally we know that a 转诐 of a 拽专谉 is 讞讬讬讘 only 讞爪讬 谞讝拽, and here the 讘专讬讬转讗 is saying that if it was a 专砖讜转 only of the 谞讬讝拽, not of the 诪讝讬拽, you are always 讞讬讬讘 to pay 谞讝拽 砖诇诐 even if it was a 转诐 of 拽专谉. And the question is 诪谞讬, who says that, who is that 诪讗谉 讚讗诪专 that holds

Rabbi Tarphon on full liability for a tame horn

that way? And the 讙诪专讗 answers, 专讘讬 讟专驻讜谉 讛讬讗, this is 专讘讬 讟专驻讜谉, 讚讗诪专, that he says, 诪砖讜谞讛 拽专谉 讘讞爪专 讛谞讬讝拽, if 拽专谉, which was a 转诐, caused damage in the yard of the 谞讬讝拽, 谞讝拽 砖诇诐 诪砖诇诐, you pay the complete 谞讝拽. And the reason here he refers to 拽专谉 转诐 with the word 诪砖讜谞讛, because 诪砖讜谞讛 means different, and that is different, because as long as it didn't become a 诪讜注讚, its 讚专讱 is not to cause damage through 拽专谉, and since it did cause damage through 拽专谉 the first or second or third time, it is still a change in the nature of this animal, that's why he refers to it as 诪砖讜谞讛. But he what he says is that if it was a 拽专谉 转诐 in the 专砖讜转 of the 谞讬讝拽, then you do pay complete 谞讝拽. If it was done in the 专砖讜转 讛专讘讬诐, then you pay 讞爪讬 谞讝拽 for a 转诐 by 拽专谉, but if it was in the 专砖讜转 of the 谞讬讝拽, you pay the complete 谞讝拽. So this 讘专讬讬转讗 goes according to 专讘讬 讟专驻讜谉. Then the 讙诪专讗 asks, 讗讬诪讗 住讬驻讗, let's say the 住讬驻讗, look into the end of the 讘专讬讬转讗, there it says, 诇讗 诇讝讛 讜诇讗 诇讝讛, if it was a 专砖讜转 not to him and not to him, not of the 诪讝讬拽 and not of the 谞讬讝拽, 讻讙讜谉 讞爪专 砖讗讬谞讛 砖诇 砖谞讬讛诐, a yard which is not of both, 讞讬讬讘 讘讛 注诇 讛砖谉 讜注诇 讛专讙诇, you are 讞讬讬讘 for 砖谉 讜专讙诇. And let's see what this 讘专讬讬转讗 means. 诪讗讬 诇讗 诇讝讛 讜诇讗 诇讝讛? What does the 讘专讬讬转讗 mean that this was the yard that didn't belong not to the 诪讝讬拽 and not to the 谞讬讝拽? 讗讬诇讬诪讗 if we're going to say 诇讗 诇讝讛 讜诇讗 诇讝讛 讻诇诇, that it doesn't belong not to the 诪讝讬拽 and not to the 谞讬讝拽 at all, 讗诇讗 讚讗讞专, but to a third party, and what the 讘专讬讬转讗 is telling us that if, let's say, 专讗讜讘谉's ox caused damage to 砖诪注讜谉's ox in the domain of 诇讜讬, and that's what the 讘专讬讬转讗 says that you are 讞讬讬讘 for 砖谉 讜专讙诇, how can that be? 讜讛讗 讘注讬谞谉 讜讘注专 讘砖讚讛 讗讞专 讜诇讬讻讗, don't we need that a 砖谉 and 专讙诇 is only 讞讬讬讘 if it causes damage in the 专砖讜转 of the 谞讬讝拽? But if it causes damage in the 专砖讜转 of somebody else, then you are 驻讟讜专, this is not considered 讜讘注专 讘砖讚讛 讗讞专. So you cannot say that the 讘专讬讬转讗 meant that it caused damage in a 专砖讜转 which was not of the 诪讝讬拽 and not of the 谞讬讝拽. 讗诇讗 驻砖讬讟讗, so then then we must say for sure it's simple, that 诇讗 诇讝讛 讜诇讗 诇讝讛, 讗诇讗 讚讞讚. It means that it's not both, not his and his, but only of one. Now this one means that it's the 专砖讜转 of the 谞讬讝拽. And therefore it says that if it happened through 砖谉 讜专讙诇, you are 讞讬讬讘, because as we know in the 专砖讜转 讛谞讬讝拽 you are 讞讬讬讘 for 砖谉 讜专讙诇. But if so, 拽转谞讬 住讬驻讗, it says there further in the 住讬驻讗, that in the same case, 转诐 诪砖诇诐 讞爪讬 谞讝拽, 讜诪讜注讚 诪砖诇诐 谞讝拽 砖诇诐, that a 转诐 pays half of the 谞讝拽 and a 诪讜注讚 pays complete 谞讝拽. So what the 讘专讬讬转讗 is telling us that if the 谞讝拽 was done in the 专砖讜转 讛谞讬讝拽, still 拽专谉 转诐 pays half of the 谞讝拽. So this 讗转讬讗 诇专讘谞谉, this comes out according to the 专讘谞谉, 讚讗诪专讬 that they say 诪砖讜谞讛 拽专谉 讘讞爪专 讛谞讬讝拽, that if 拽专谉, which was 转诐, caused damage in the 专砖讜转 of the 谞讬讝拽, 讞爪讬 谞讝拽 讛讜讗 讚诪砖诇诐, you still pay half a 谞讝拽, even if it was done in the 专砖讜转 of the 谞讬讝拽, because that's what the 讘专讬讬转讗 is telling us, the 讘专讬讬转讗 is telling us that if it was a 专砖讜转 that didn't belong to both, and as we established, it means it belonged only to the 谞讬讝拽, so you're 讞讬讬讘 for 砖谉 讜专讙诇, and for 拽专谉, 转诐 pays 讞爪讬 谞讝拽, and a 诪讜注讚 谞讝拽 砖诇诐, so the 讘专讬讬转讗 is saying that 转诐 拽专谉 in the 讞爪专 of the 谞讬讝拽 still pays 讞爪讬 谞讝拽. That fits according to the 专讘谞谉 that hold that 诪砖讜谞讛 拽专谉 讘讞爪专 讛谞讬讝拽 讞爪讬 谞讝拽 讛讜讗 讚诪砖诇诐, that a 拽专谉 转诐 even in the 专砖讜转 of the 谞讬讝拽 pays 讞爪讬 谞讝拽. So it comes out 专讬砖讗 专讘讬 讟专驻讜谉 讜住讬驻讗 专讘谞谉, that the beginning of the 讘专讬讬转讗 seemed to be saying that 拽专谉 转诐 in the 专砖讜转 of the 谞讬讝拽 pays 谞讝拽 砖诇诐, that fits according to 专讘讬 讟专驻讜谉, and the 住讬驻讗 of the 讘专讬讬转讗 seems to fit only according to the 专讘谞谉. And the 讙诪专讗 answers, 讗讬谉, yes. 讚讛讗 讗诪专 诇讬讛 砖诪讜讗诇 诇专讘 讬讛讜讚讛, as 砖诪讜讗诇 said to 专讘 讬讛讜讚讛: 砖讬谞谞讗, smart person, sharp person, 砖讘讜拽 诪转谞讬转讬谉, leave over the 诪砖谞讛, don't try to go deeper into the 诪砖谞讛, 讜转讗 讘转专讗讬, and follow me, that 专讬砖讗 专讘讬 讟专驻讜谉 讜住讬驻讗 专讘谞谉, that the 专讬砖讗 is 专讘讬 讟专驻讜谉 and the end, the 住讬驻讗 is 专讘谞谉. This was referring to a 诪砖谞讛 later on where we had the same problem, that it seemed like the 专讬砖讗 was only according to 专讘讬 讟专驻讜谉 and the 住讬驻讗 went according to the 专讘谞谉, and we had the same question, and there 砖诪讜讗诇 said to 专讘 讬讛讜讚讛, don't try to explain the 诪砖谞讛, don't look deeper, try to explain it some other way, do as I do: say that the 专讬砖讗 is 讟讗拽注 专讘讬 讟专驻讜谉, 讜住讬驻讗 专讘谞谉, that it's possible for the same 诪砖谞讛 that part of the 诪砖谞讛 should go according to one 诪讗谉 讚讗诪专 and part of the 诪砖谞讛 according to the other 诪讗谉 讚讗诪专. So the same thing we'll do with this 讘专讬讬转讗, that the 专讬砖讗 of the 讘专讬讬转讗 goes according to 专讘讬 讟专驻讜谉, and the 住讬驻讗 of the 讘专讬讬转讗 goes according to 专讘谞谉. But 专讘讬谞讗 诪砖诪讬讛 讚专讘讗 讗诪专, 专讘讬谞讗 in the name of 专讘讗 says that 讻讜诇讛 专讘讬 讟专驻讜谉, 讘讗诪转 the whole 讘专讬讬转讗 goes according to 专讘讬 讟专驻讜谉. So the 专讬砖讗 of the 讘专讬讬转讗 makes sense, that if it's in the 讞爪专 of the 谞讬讝拽, you pay 讘讻讜诇讬讛, even 拽专谉 转诐 will pay 谞讝拽 砖诇诐. The question was in the 住讬驻讗, where it said that if it was a 讞爪专 not for him and not for him, and we established it means for only of one, of the 谞讬讝拽, nevertheless 转诐 pays 讞爪讬 谞讝拽. So he says, 讜诪讗讬 诇讗 诇讝讛 讜诇讗 诇讝讛? What did when it comes to 拽专谉 it has the same 讚讬谉 as a 专砖讜转 讛专讘讬诐, and therefore even 专讘讬 讟专驻讜谉 would admit that a 转诐 would only pay 讞爪讬 谞讝拽 because it is considered a 专砖讜转 讛专讘讬诐, because they both had a right to bring in his ox. But concerning 砖谉, it is still considered 讞爪专 讛谞讬讝拽, and that's why you are 讞讬讬讘 for

The three rules of Rabbi Shimon ben Elazar

砖谉. And then the 讙诪专讗 asks, 讗讬 讛讻讬, if so, 讗专讘注讛? How does he say that there are four 讻诇诇讬诐 that 专讘讬 砖诪注讜谉 讘谉 讗诇注讝专 said? 砖诇砖讛 讛讜讜, they are only three. And as 转讜住驻讜转 explains that 诪诪讬诇讗 as we said before that the 专讬砖讗 was 专讘讬 讟专驻讜谉 and the 住讬驻讗 was 专讘谞谉, so you have to tell us the 住讬驻讗 as a separate 讚讬谉 to tell us the opinion of the 专讘谞谉. But according to the way we're saying now now that the 住讬驻讗 also goes according to 专讘讬 讟专驻讜谉, but the case is that it was a 砖讜转驻讜转 concerning 砖讜讜专讬诐, and it was only 讞爪专 讛谞讬讝拽 concerning 驻讬专讜转, so that is understood already from the previous three cases, that is nothing new, that 拽专谉 pays 讞爪讬 谞讝拽 in 专砖讜转 讛专讘讬诐, we know that from the cases before, that 砖谉 is 讞讬讬讘 in the 专砖讜转 讛谞讬讝拽, we know that from before, so this case is a complete extra case, so how can he say that it is four 讻诇诇讬诐 that 专讘讬 砖诪注讜谉 讘谉 讗诇注讝专 told us? 讗诪专 专讘 谞讞诪谉 讘专 讬爪讞拽, so 专讘 谞讞诪谉 讘专 讬爪讞拽 said that what he meant was, 砖诇讜砖讛 讻诇诇讜转, there are three rules, but 讘讗专讘注 诪拽讜诪讜转, those three rules could apply to four places, to four different domains. And as 专砖''讬 explains, which are the three rules? That in the 专砖讜转 of the 谞讬讝拽, you're 讞讬讬讘 in everything, even a 拽专谉 转诐 pays 谞讝拽 砖诇诐. In the 专砖讜转 of the 诪讝讬拽, you're 驻讟讜专 from everything. In the 专砖讜转 of the 砖讜转驻讬诐, so you're 讞讬讬讘 讞爪讬 谞讝拽 by 拽专谉, and you're 驻讟讜专 from 砖谉 讜专讙诇. But these three rules could apply to four places, because you do have a 讞爪专 讛砖讜转驻讬诐 where you would be 讞讬讬讘 for 砖谉 讜专讙诇, and there would be a 讞爪讬 谞讝拽 for 拽专谉 转诐, and that is, as we said before, if it was only for the 谞讬讝拽 for 驻讬专讜转, and for both for 砖讜讜专讬诐. In this last 转讬专讜抓 that we just learned in the 讙诪专讗, that the whole 讘专讬讬转讗 goes according to 专讘讬 讟专驻讜谉, and the 讙诪专讗 said that what did the 讘专讬讬转讗 mean, 诇讗 诇讝讛 讜诇讗 诇讝讛 讗诇讗 讚讞讚, that the 专砖讜转 didn't belong to any but to one, but just to the 谞讬讝拽, so the 讙诪专讗 explained that 驻讬专讜转, only the 谞讬讝拽 could bring in, but the 砖讜讜专讬诐 they both could bring in, so the 专讘讬谞讜 转诐 in 转讜住驻讜转 has a different 讙讬专住讗. His 讙讬专住讗 is that only one could bring in the 驻讬专讜转, that is the 谞讬讝拽, and nobody, none of them, not the 诪讝讬拽 and not the 谞讬讝拽, could bring in the ox. And that's the reason why 诇讙讘讬 拽专谉 it is considered a 专砖讜转 讛专讘讬诐, because they both had no right to come there, and 诇讙讘讬 砖谉 it is considered the 专砖讜转 讛谞讬讝拽, because the 谞讬讝拽 had a right to bring in the 驻讬专讜转. And the reason he learns that way, because he says if they both had a right to bring in the ox, so then why 诇讙讘讬 砖谉 is it considered the 专砖讜转 讛谞讬讝拽? Even though the 谞讬讝拽 was the only one that had a right to bring in the 驻讬专讜转, but nevertheless, since the 诪讝讬拽 also had a right to bring in his ox, so why should we consider it 诇讙讘讬 the damage that the ox caused to the 驻讬专讜转, the 专砖讜转 讛谞讬讝拽? Therefore, he learns that it's the case where both had no right to bring in the ox, and that's why it's considered 诇讙讘讬 砖谉 a 讞爪专 讛谞讬讝拽, because the 谞讬讝拽 had a right to bring in the 驻讬专讜转, and the 诪讝讬拽 had no right to bring in his ox, neither did the 谞讬讝拽, but neither did the 诪讝讬拽, and therefore it is considered that it is the 专砖讜转 of the 谞讬讝拽 诇讙讘讬 砖谉, and 诇讙讘讬 拽专谉 it's called a 专砖讜转 讛专讘讬诐. And the reason the 讙诪专讗 doesn't want to say like we said before, that it's in a case where they both had a right for the 驻讬专讜转, and they did not have a right for the 砖讜讜专讬诐, the 诪讝讬拽 could not bring in the 砖讜专, because then it would be not like 专讘 讝讬专讗, because according to 专讘 讝讬专讗, this is considered not the 专砖讜转 讛谞讬讝拽, and you should be 驻讟讜专, and here we're trying to say that you're 讞讬讬讘 for

Tosafot Commentary on Watchman's Acceptance

砖谉 讜专讙诇. And also 转讜住驻讜转 says, because the 诇砖讜谉 of the 讘专讬讬转讗 is not 诪砖诪注 that way. And now we will continue with the 诪砖谞讛. The 诪砖谞讛 says, 砖讜诐 讻住祝, when 讘讬转 讚讬谉 evaluates the damage, it should be evaluated by its money's worth, but when you pay, 砖讜讛 讻住祝, you're allowed to pay an object which is worth money, you don't have to pay money itself. And it has to be done 讘驻谞讬 讘讬转 讚讬谉, in front of 讘讬转 讚讬谉, 讜注诇 驻讬 注讚讬诐, and it has to be done according to witnesses who are 讘谞讬 讞讜专讬谉, free people, not 注讘讚讬诐, not slaves, meaning not 注讘讚讬诐 讻谞注谞讬诐, not 讙讜讬讬砖注 slaves, and they have to be 注讚讬诐 that are 讘谞讬 讘专讬转, that are 讬讬讚谉. 讜讛谞砖讬诐 讘讻诇诇 讛谞讝拽, women are also included in the damage. 讜讛谞讬讝拽 讜讛诪讝讬拽 讘转砖诇讜诪讬谉, there is a possibility that the 谞讬讝拽 and the 诪讝讬拽 both should have to take part in the payment for the 谞讝拽. And as 专砖''讬 says, the 讙诪专讗 will explain what this whole 诪砖谞讛 means. The 讙诪专讗 starts off by saying, 诪讗讬 砖讜诐 讻住祝? What did the 诪砖谞讛 mean when it said that when you evaluate, you have to evaluate it by its money's worth? 讗诪专 专讘 讬讛讜讚讛, so 专讘 讬讛讜讚讛 said, 砖讜诐 讝讛, that this evaluation that you do to the damage, 诇讗 讬讛讗 讗诇讗 讘讻住祝, should only be with its money. What does that mean? What is the 讞讬讚讜砖 that when you evaluate, it should be for its money's worth? 转谞讬谞讗 诇讛讗 讚转谞讜 专讘谞谉, the 诪砖谞讛 is really teaching us the 讚讬谉 that we learned in the 讘专讬讬转讗. It says in the 讘专讬讬转讗, 驻专讛 砖讛讝讬拽讛 讟诇讬转, if a 驻专讛, a cow, caused damage to a garment, 讜讟诇讬转 砖讛讝讬拽讛 驻专讛, and that garment caused damage to the cow, 讗讬谉 讗讜诪专讬诐, we do not say, 转爪讗 驻专讛 讘讟诇讬转 讜讟诇讬转 讘驻专讛, let the damage done to the cow be set off by the damage done to the 讟诇讬转, and the damage done to the 讟诇讬转 should be set off by the damage done to the cow, and as 专砖状讬 says, this would mean that he takes the cow that caused the damage to his 讟诇讬转, and you don't evaluate to see how much the damage was to the 讟诇讬转 and how much the damage was to the cow. But all he would do is take the cow, and that would be it. So you don't say that, 讗诇讗 砖诪讬谉 讗讜转讜 讘讚诪讬诐, you evaluate in money. You see what was the damage done to the cow, how much was the damage done to the 讟诇讬转. And whatever the difference is, so that person has to pay that difference to the other person. But that's what the 诪砖谞讛 means when it says 砖讜诐 讻住祝, that when you evaluate a damage, you have to evaluate exactly how much the damage is worth, and that's how much

Shaveh Kesef: paying with property and its implications

you pay. Then the 诪砖谞讛 said 砖讜讛 讻住祝, that you pay with property which is worth money. 讚转谞讜 专讘谞谉, because they learned in the 讘专讬讬转讗, 砖讜讛 讻住祝, that when we say that you have to pay 砖讜讛 讻住祝, 诪诇诪讚, that teaches us, 砖讗讬谉 讘讬转 讚讬谉 谞讝拽拽讬谉, that 讘讬转 讚讬谉 will not get involved and make the 诪讝讬拽 pay, 讗诇讗 诇谞讻住讬诐 砖讬砖 诇讛诐 讗讞专讬讜转, only if the 诪讝讬拽 has property which is guaranteed, which means real estate property. That's the only time that the 讘讬转 讚讬谉 will get involved to make the 诪讝讬拽 pay. And the 讙诪专讗 will explain soon how the words 砖讜讛 讻住祝 mean that only if there is property, that's when the 讘讬转 讚讬谉 will get involved. 讘讬转 讚讬谉 would make him collect from it. 诇讻转讞讬诇讛, 讘讬转 讚讬谉 would not make the 诪讝讬拽 pay unless he has 拽专拽注. But if the 谞讬讝拽 happened to grab 诪讟诇讟诇讬谉, then 讘讬转 讚讬谉 will allow him to keep it. Now the 讙诪专讗 explains, 讗诪专 诪专, we just learned 砖讜讛 讻住祝, that the words 砖讜讛 讻住祝, 诪诇诪讚, teach us 砖讗讬谉 讘讬转 讚讬谉 谞讝拽拽讬谉 讗诇讗 诇谞讻住讬诐 砖讬砖 诇讛诐 讗讞专讬讜转, that 讘讬转 讚讬谉 will not get involved unless the 诪讝讬拽 has property, real estate property. 诪讗讬 诪砖诪注? How do the words 砖讜讛 讻住祝 show that it is only if there is 拽专拽注 involved? 讗诪专 专讘讛 讘专 注讜诇讗, 专讘讛 讘专 注讜诇讗 said that the words 砖讜讛 讻住祝 means 讚讘专 讛砖讜讛 讻诇 讻住祝, something which is worth all the money. 诪讗讬 谞讬讛讜? What is that? 讚讘专 砖讗讬谉 诇讜 讗讜谞讗讛, something which you cannot cheat. Because like this, the 讚讬谉 is if you sell something to somebody and you overprice it with a sixth, so then the deal is off, and you have to give back the money. But by 拽专拽注 the 讚讬谉 is that even if you sell it more than a sixth, still the deal is good and it's not 讘讟诇, because 拽专拽注 讗讬谉 诇讜 讗讜谞讗讛, there is no such thing as cheating in 拽专拽注 because whatever you pay for it, it's worth. The truth is 转讜住驻讜转 does say that if you overprice with more than half, so then the deal is 讘讟诇. But what the 讙诪专讗 means that it's worth all the money, it means more than other 诪讟诇讟诇讬谉. Because by 诪讟诇讟诇讬谉 we say that if you overprice with a sixth, already the deal is 讘讟诇, but by 拽专拽注, even if you overprice with a sixth and even more, still the deal is not 讘讟诇. So that's what the words 砖讜讛 讻住祝 mean, something which is worth all the money, and that means 谞讻住讬诐 砖讬砖 诇讛诐 讗讞专讬讜转, that is real estate

property. But then the 讙诪专讗 asks, 注讘讚讬诐 讜砖讟专讜转 谞诪讬 讗讬谉 诇讛诐 讗讜谞讗讛, that slaves and documents also don't have 讗讜谞讗讛. The 讚讬谉 is that when you sell a slave and you overprice him more than a sixth, also the deal is not 讘讟诇, just like 拽专拽注. And also 砖讟专讜转, if you sell a document and you price it more than it really is worth, still it is not 讘讟诇. 讗诇讗 讗诪专 专讘讛 讘专 注讜诇讗, 专讘讛 讘专 注讜诇讗 said that how does the words 砖讜讛 讻住祝 indicate 拽专拽注? Because 讚讘专 讛谞拽谞讛 讘讻住祝, it means something that you are 拽讜谞讛, you acquire with 讻住祝, with money. Because the 讚讬谉 is that when you want to be 拽讜谞讛 拽专拽注, you are 拽讜谞讛 it through 讻住祝, 砖讟专, 讜讞讝拽讛, or through paying the money or through making a 讞讝拽讛 on it, or through a 砖讟专. While 诪讟诇讟诇讬谉 you're 拽讜谞讛 through 诪砖讬讻讛, through pulling it, and 拽专拽注 you are 拽讜谞讛 through 讻住祝. So that's what 砖讜讛 讻住祝 means, something that you are 拽讜谞讛 through 讻住祝. But then the 讙诪专讗 asks, 注讘讚讬诐 讜砖讟专讜转 谞诪讬 谞拽谞讬 讘讻住祝. An 注讘讚, when you want to acquire an 注讘讚 讻谞注谞讬, a 讙讜讬讬砖注 注讘讚, you also are able to acquire him through 讻住祝. So how can we say it means only 拽专拽注? And 砖讟专讜转, also, if you want to acquire a 砖讟专, you could acquire it through 讻住祝. So 专砖状讬 says he doesn't know where the source to this 讚讬谉 is that you're able to be 拽讜谞讛 a 砖讟专 through 讻住祝. 转讜住驻讜转 讟讗拽注 says that you are not 讙讜专住 in the 讙诪专讗 the words 砖讟专讜转. The 讙诪专讗's 拽讜砖讬讗 is only 注讘讚讬诐 谞诪讬 谞拽谞讬 讘讻住祝, that 注讘讚讬诐 you can be 拽讜谞讛 through 讻住祝, and the 讙诪专讗 does not mention 砖讟专讜转. But 专砖状讬 did have the 讙讬专住讗 in the 讙诪专讗 that 砖讟专讜转 you 拽讜谞讛 讘讻住祝, therefore 专砖状讬 writes he doesn't know the source for this. But the 拽讜砖讬讗 of the 讙诪专讗 is, how can you say 砖讜讛 讻住祝 means 拽专拽注 because you are 拽讜谞讛 拽专拽注 through 讻住祝, well not only 拽专拽注 you are 拽讜谞讛 through 讻住祝, also 注讘讚讬诐 and 砖讟专讜转. 讗诇讗 讗诪专 专讘 讗砖讬, therefore 专讘 讗砖讬 said that how does 砖讜讛 讻住祝 indicate 拽专拽注? 砖讜讛 讻住祝 讜诇讗 讻住祝, something which is worth money and not money itself. 讜讛谞讬 讻讜诇讛讜, and all these, all the 诪讟诇讟诇讬谉, 讻住祝 谞讬谞讛讜, are 讻住祝 itself, it's money itself. Like the 讙诪专讗 said before, that 诪讟诇讟诇讬谉 is always money, because if you can't sell it here, you could take it with you someplace else and sell it someplace else. 拽专拽注, if you can't sell it here, you're stuck, you can't pick it up and take it someplace else. So therefore 拽专拽注 is considered 砖讜讛 讻住祝, it's worth money, but all the other 诪讟诇讟诇讬谉 is considered 讻住祝 itself. And that's how we know that 砖讜讛 讻住祝 means 拽专拽注, because that is the only thing that is worth 讻住祝 and not 讻住祝 itself.

Rabbi Yehuda bar 岣nna questions Shaveh Kesef

And then the 讙诪专讗 says, 讗诪专 诇讬讛 专讘 讬讛讜讚讛 讘专 讞讬谞谞讗 诇专讘 讛讜谞讗 讘专讬讛 讚专讘 讬讛讜砖注, 专讘 讬讛讜讚讛 讘专 讞讬谞谞讗 asked a question to 专讘 讛讜谞讗 讘专讬讛 讚专讘 讬讛讜砖注: 转谞讬讗, we learn in this 讘专讬讬转讗: 砖讜讛 讻住祝 诪诇诪讚 砖讗讬谉 讘讬转 讚讬谉 谞讝拽拽讬谉 讗诇讗 诇谞讻住讬诐 砖讬砖 诇讛诐 讗讞专讬讜转, that the word 砖讜讛 讻住祝 teaches us that the 讘讬转 讚讬谉 would only get involved to collect for the damage if the 诪讝讬拽 has real estate, has 拽专拽注. Otherwise, it seems he is not obligated to pay. 讜讛转谞讬讗, didn't we learn, 讬砖讬讘, that from the word 讬砖讬讘 that the 转讜专讛 says by the payment of damage, 诇专讘讜转 砖讜讛 讻住祝, that teaches us that you could pay with anything which is worth money, 讜讗驻讬诇讜 住讜讘讬谉, even with bran. So how can we say here that you only are able to pay with 拽专拽注? And the 讙诪专讗 answers: 讛讻讗 讘诪讗讬 注住拽讬谞谉, that here we're talking in a case 讘讬转诪讬, by 讬转讜诪讬诐, that the 诪讝讬拽 himself died. And now we're dealing with his 讬转讜诪讬诐, with the orphans, those that inherited his property. The 讚讬谉 is that 诪讟诇讟诇讬 讚讬转诪讬 诇讘注诇 讞讜讘 诇讗 诪砖转注讘讚讬, that if the 讬转讜诪讬诐 inherit 诪讟诇讟诇讬谉, that is not 诪砖讜注讘讚 to any of the claims against the father. If they inherit 拽专拽注, so then all the 拽专拽注讜转 are 诪砖讜注讘讚 to any claims against the father. So in the case of a 诪讝讬拽, if the father was responsible to pay for a 讛讬讝拽, and the 讬转讜诪讬诐 inherited 拽专拽注, so then this 拽专拽注 is 诪砖讜注讘讚 to the 谞讬讝拽. So that's what the 讘专讬讬转讗 means, that the 讘讬转 讚讬谉 would only get involved if there is 拽专拽注. But if they only inherited 诪讟诇讟诇讬谉, then the 讘讬转 讚讬谉 will not get involved, because the 诪讟诇讟诇讬谉 of the 讬转讜诪讬诐 which they inherited from their father is not 诪砖讜注讘讚 to the 谞讬讝拽. But then the 讙诪专讗 asks: 讗讬 讘讬转诪讬, if you're going to tell me that we're talking in the case of 讬转讜诪讬诐, 讗讬诪讗 住讬驻讗, say the 住讬驻讗, look into the end of the 讘专讬讬转讗. It says there: 讗诐 拽讚诐 谞讬讝拽 讜转驻住 诪讟诇讟诇讬谉, if the 谞讬讝拽 went along and grabbed some 诪讟诇讟诇讬谉, then 讘讬转 讚讬谉 讙讜讘讬谉 诇讜 诪讛谉, 讘讬转 讚讬谉 will allow him to keep it, will have him collect

When Nizak Grabs Movables Before Father鈥檚 Death

from the 诪讟诇讟诇讬谉. But 讗讬 讘讬转诪讬, if we're talking in a case of 讬转讜诪讬诐, 讗诪讗讬 讘讬转 讚讬谉 讙讜讘讬谉 诇讜 诪讛谉? Why should 讘讬转 讚讬谉 make the 谞讬讝拽 collect from the 诪讟诇讟诇讬谉 if the 讚讬谉 is that the 诪讟诇讟诇讬谉 of the 讬转讜诪讬诐 are not 诪砖讜注讘讚 to any of the 讞讜讘讜转, to any of the claims? So why if the 谞讬讝拽 grabbed 诪讟诇讟诇讬谉, we will allow him to keep it? The 讙诪专讗 answers: 讻讚讗诪专 专讘讗 讗诪专 专讘 谞讞诪谉, just like 专讘讗 said in the name of 专讘 谞讞诪谉 concerning a different 讚讬谉, 砖转驻住 诪讞讬讬诐, that it's speaking in a case that he grabbed onto it while the father was still alive, 讛讻讗 谞诪讬, here too we could say 砖转驻住 诪讞讬讬诐, it's speaking in a case that he grabbed onto it while the father was still alive. So therefore, this 诪讟诇讟诇讬谉 that the 谞讬讝拽 grabbed, took while the father was still alive, and later came to 讘讬转 讚讬谉 claiming the money, so the 讘讬转 讚讬谉 will allow him to keep those 诪讟诇讟诇讬谉. But if he did not grab any 诪讟诇讟诇讬谉 while the father was alive, so then if the 讬转讜诪讬诐 inherited 诪讟诇讟诇讬谉, then we will not make them pay to the 谞讬讝拽. But if they have 拽专拽注, then the 讘讬转 讚讬谉 will make them pay with the 拽专拽注 to the 谞讬讝拽, because the 拽专拽注 is 诪砖讜注讘讚 to this 讞讜讘. Then the 讙诪专讗 continues, it said in the 诪砖谞讛: 讘驻谞讬 讘讬转 讚讬谉, that this should all be done in front of a 讘讬转 讚讬谉. So what does it mean? 驻专讟, comes to exclude, 诇诪讜讻专 谞讻住讬讜, if someone sells his property, 讜讗讞专 讻讱 讛讜诇讱 诇讘讬转 讚讬谉, then he comes to 讘讬转 讚讬谉, and he doesn't have any property. So then 讘讬转 讚讬谉 will not have the 谞讬讝拽 collect from the 诪讝讬拽, because the 诪讝讬拽 doesn't have anything. And the way it seems to be saying is that we will not allow the 谞讬讝拽 to go to the 诇拽讜讞讜转, to those that bought his property and to take from them, but we will tell the 谞讬讝拽 that he

Selling Property Before Court: Can Nizak Collect?

cannot collect. So the 讙诪专讗 asks: 砖诪注 诪讬谞讛, are you trying to tell us that 诇讜讛, if a person borrowed money, 讜诪讻专 谞讻住讬讜, and he sold his property, 讜讗讞专 讻讱 讘讗 诇讘讬转 讚讬谉, then he comes to 讘讬转 讚讬谉, 讗讬谉 讘讬转 讚讬谉 讙讜讘讬谉 诇讜 诪讛诐, 讘讬转 讚讬谉 will not have him collect? That is not true. The 讚讬谉 is that if a person borrows money and has 拽专拽注, so his 拽专拽注 is 诪砖讜注讘讚 to this loan. So even if he sells his 拽专拽注, when the 诪诇讜讛, the lender, will come and want to collect his 讞讜讘, he He will be able to go to the 诇拽讜讞讜转 and collect, he will be able to go to those who bought the property, and he will collect from them. But what you're saying here is that if a person sells his 谞讻住讬诐, and then comes to 讘讬转 讚讬谉, 讘讬转 讚讬谉 will not have him collect. That 讚讬谉 is not true. 讗诇讗, therefore the 讙诪专讗 says, what it said in the 诪砖谞讛 讘驻谞讬 讘讬转 讚讬谉, it meant 驻专讟 诇讘讬转 讚讬谉 讛讚讬讜讟讜转. It has to be in the 讘讬转 讚讬谉 which are experts. But if the 讘讬转 讚讬谉 are not experts, a 讘讬转 讚讬谉 讛讚讬讜讟讜转, it's a 讘讬转 讚讬谉 of laymen, then you cannot collect from the 谞讝讬拽讬谉, because the 讚讬谉 is that in order to collect 拽谞住, to collect a fine, only a 讘讬转 讚讬谉 that has 住诪讬讻讛 讗讬砖 诪驻讬 讗讬砖 注讚 诪砖讛 专讘讬谞讜, that has the proper 住诪讬讻讛 as it used to be given in the time of the 转谞讗讬诐, only that type of 讘讬转 讚讬谉 could make a person collect from 拽谞住. And that's what the 诪砖谞讛 is saying here, that when would we have the 谞讬讝拽 collect the 讛讬讝拽, collect the money for the 讛讬讝拽, only if the 讘讬转 讚讬谉 was a 讘讬转 讚讬谉 that had 住诪讬讻讛, because otherwise they couldn't collect 拽谞住. And since one of the 谞讝讬拽讬谉 is 拽谞住, because the 讛诇讻讛 is that 驻诇讙讗 谞讬讝拽讗 拽谞住讗, that when a 转诐, for 拽专谉, pays 讞爪讬 谞讝拽, that is 拽谞住, so in that case, you can't collect unless you have a 讘讬转 讚讬谉 诪讜诪讞讬诐, a 讘讬转 讚讬谉

Tosafot on Missing Keren in the Mishnah

that has 住诪讬讻讛. And 转讜住驻讜转 says that even though according to one 诪讗谉 讚讗诪专, 拽专谉 is not even mentioned in the 诪砖谞讛, according to 砖诪讜讗诇, 砖讜专 means 专讙诇, and 诪讘注讛 means 砖谉, and 拽专谉 is not mentioned. So how can we say that the 诪砖谞讛 is telling us that you have to have a 讘讬转 讚讬谉 with 住诪讬讻讛, because otherwise you can't collect the 拽谞住, when the 诪砖谞讛 is not even talking about 拽谞住, because the only 拽谞住 is 拽专谉 转诐, when you pay 讞爪讬 谞讝拽, and the 诪砖谞讛 doesn't even mention 拽专谉 at all? So 转讜住驻讜转 says that even though the 诪砖谞讛 doesn't mention 拽专谉, but nevertheless, the 诪砖谞讛 is 诪专诪讝 here, the 诪砖谞讛 hints to us, that when you pay for 谞讝拽, there is a kind of 谞讝拽 that you cannot pay unless the 讘讬转 讚讬谉 has 住诪讬讻讛. And even if that is not actually mentioned in the 诪砖谞讛, because 拽专谉 is not mentioned according to 砖诪讜讗诇, but nevertheless it is a 谞讝拽 that could be hinted concerning its payment in the 诪砖谞讛. Then the 讙诪专讗 continues, it said in the 诪砖谞讛: 注诇 驻讬 注讚讬诐, that you only pay if there were witnesses, 驻专讟, this comes to exclude: 诇诪讜讚讛 讘拽谞住 讜讗讞专 讻讱 讘讗讜 注讚讬诐 砖讛讜讗 驻讟讜专, that if it was the case of 拽谞住, and as we said, there is a case of 拽谞住 concerning 谞讝讬拽讬谉, that is if you pay 讞爪讬 谞讝拽 for 拽专谉 转诐. So if the person is 诪讜讚讛 himself concerning the 拽谞住, and then witnesses came to say that his ox gored and caused damage, but the 讚讬谉 is that he's 驻讟讜专, because the 讻诇诇 is that 诪讜讚讛 讘拽谞住 驻讟讜专. If someone is obligated to pay a fine for something that he did, which is only a fine and not 诪诪讜谉, only 拽谞住, so then the 讚讬谉 is that if he himself is 诪讜讚讛 that he did it, he is 驻讟讜专 from paying the 拽谞住. And then there's another 讚讬谉, according to one 诪讗谉 讚讗诪专, that not only if he is 诪讜讚讛 in the 拽谞住 he is 驻讟讜专, but even if later on witnesses came and said, testified that he did the thing, nevertheless, since he admitted first, he is 驻讟讜专. And that is what the 诪砖谞讛 is trying to tell us with the words 注诇 驻讬 注讚讬诐, that when are you 讞讬讬讘 in the case of 拽谞住? Only if witnesses came to say that you did the thing. But if you admitted yourself, even if witnesses came later, still you are 驻讟讜专. And the 讙诪专讗 asks: 讛讗 谞讬讞讗, this is only good 诇诪讗谉 讚讗诪专, according to the one that holds: 诪讜讚讛 讘拽谞住 讜讗讞专 讻讱 讘讗讜 注讚讬诐 驻讟讜专, that if a person admits himself concerning something that you are 讞讬讬讘 a fine for, and then 注讚讬诐 came, you are still 驻讟讜专. So then we understand what the 诪砖谞讛 is trying to tell us. But according to the 诪讗谉 讚讗诪专 that says that if you admit yourself first, but then 注讚讬诐 came, you are 讞讬讬讘 because of the 注讚讬诐 that came later, so according to that 诪讗谉 讚讗诪专, what is the 诪砖谞讛 trying to exclude with the words 注诇 驻讬 注讚讬诐? We cannot say, as 转讜住驻讜转 explains, that the 诪砖谞讛 is trying to tell us that you are 驻讟讜专 in a case where the person himself admitted and 注讚讬诐 did not come later, in a regular case of 诪讜讚讛 讘拽谞住, because that is 讘驻讬专讜砖 a 诪砖谞讛 later on in 驻专拽 诪专讜讘讛, that 注诇 驻讬 注爪诪讜 驻讟讜专, that if a person admits himself in something which is 拽谞住, he is 驻讟讜专. So we can't say that this is what the 诪砖谞讛 is trying to tell us here. So obviously the 诪砖谞讛 is trying to tell us here that you are 驻讟讜专 even if after you were 诪讜讚讛, 注讚讬诐 came. But according to the 诪讗谉 讚讗诪专 that holds that 诪讜讚讛 讘拽谞住 讜讗讞专 讻讱 讘讗讜 注讚讬诐, you are 讞讬讬讘, not 驻讟讜专, what can we say does the 诪砖谞讛 mean with the words 注诇 驻讬 注讚讬诐? What is the 讞讬讚讜砖 with the words 注诇 驻讬 注讚讬诐? And the 讙诪专讗 answers: 住讬驻讗 讗讬爪讟专讬讻讗 诇讬讛. Really, there is no 讞讬讚讜砖 in the words 注诇 驻讬 注讚讬诐, and the reason the 诪砖谞讛 says 注诇 驻讬 注讚讬诐 is because it wants to tell us the 住讬驻讗, the few words he says after 注诇 驻讬 注讚讬诐. He's trying to tell us which kind of 注讚讬诐 you must have, that you must have 讘谞讬 讞讜专讬谉, free people, 讜讘谞讬 讘专讬转, and people who are in the 讘专讬转 of 讬讬讚谉, which means you must have 讬讬讚谉. So that's why he says the words 注诇 驻讬 注讚讬诐, because this is really only an introduction to the other two words of 讘谞讬 讞讜专讬谉 and 讘谞讬 讘专讬转. What did he try to tell us with these words? 讘谞讬 讞讜专讬谉, when he says that they have to be free people, 诇诪注讜讟讬 注讘讚讬诐, that comes to exclude 注讘讚讬诐. 注讘讚讬诐 讻谞注谞讬诐, 讙讜讬讬砖注 slaves, that they are not 讻砖专 to be 注讚讜转. 讘谞讬 讘专讬转, the words 讘谞讬 讘专讬转, 诇诪注讜讟讬 注讜讘讚讬 讻讜讻讘讬诐, comes to exclude 讙讜讬诐. 讜爪专讬讻讗, and the 诪砖谞讛 has to exclude both, because if the 诪砖谞讛 would only exclude one, we wouldn't automatically know the other. Because I would say 讚讗讬 讗砖诪注讬谞谉 注讘讚, if the 诪砖谞讛 would only let us know that an 注讘讚 is 驻住讜诇 for 注讚讜转, I would say 诪砖讜诐 讚讗讬谉 诇讜 讬讞住, because an 注讘讚 has no ancestors. He is not considered the son of his father, as 专砖状讬 brings that the 讙诪专讗 learns it out from the 驻住讜拽 注诐 讛讞诪讜专, when 讗讘专讛诐 讗讘讬谞讜 said to his 注讘讚, "Stay here with the donkey," so instead of reading it 注诐 讛讞诪讜专, we should read it 注诐 讛讞诪讜专, the nation of the donkey, a nation which is similar to a donkey. Just like an animal, a donkey, has no 讬讞讜住, so too an 注讘讚 has no 讬讞讜住. So I would say that's why he's 驻住讜诇 诇注讚讜转. 讗讘诇 谞讻专讬, but a 讙讜讬 讚讗讬转 诇讬讛 讬讞讜住, he does have 讬讞讜住, as 专砖状讬 brings a 驻住讜拽 in 转谞状讱 where we are 诪讬讬讞住 a 讙讜讬 to his father, 讗讬诪讗 诇讗, I would think he is not included in this 讚讬谉, and he would be 讻砖专 诇注讚讜转. Therefore, the 诪砖谞讛 has to tell us that a 讙讜讬 is 驻住讜诇 诇注讚讜转. 讜讗讬 讗砖诪注讬谞谉 谞讻专讬, if the 诪砖谞讛 would just let us know that a 讙讜讬 is 驻住讜诇 诇注讚讜转, I would think 诪砖讜诐 讚诇讗 砖讬讬讱 讘诪爪讜转, because he is not connected to 诪爪讜转 at all, that's why he's 驻住讜诇. 讗讘诇 注讘讚 讚砖讬讬讱 讘诪爪讜转, but an 注讘讚, which is connected to 诪爪讜转, because we know that an 注讘讚 讻谞注谞讬 is obligated to perform the 诪爪讜转 that a woman is obligated, all 诪爪讜转 诇讗 转注砖讛 and all 诪爪讜转 注砖讛 砖诇讗 讛讝诪谉 讙专诪讗, so I would think 讗讬诪讗 诇讗 that an 注讘讚 is not included in this 讗讬住讜专 of being 讻砖专 诇注讚讜转. Therefore, 爪专讬讻讗, we have to have the 诪砖谞讛 to tell us also that an 注讘讚 is also 驻住讜诇 诇注讚讜转. So that's why the 诪砖谞讛 has to tell

Women Included in Monetary and Penalty Laws

us both. Then the 讙诪专讗 continues, it said in the 诪砖谞讛, 讜讛谞砖讬诐 讘讻诇诇 讛谞讝拽, women are also included in 讘谞讝拽, whatever the 讚讬谉 concerning 谞讝拽 would be by a man, the same 讚讬谉 would apply to a woman. So the 讙诪专讗 asks, 诪谞讗 讛谞讬 诪讬诇讬, how do we know that? 讗诪专 专讘 讬讛讜讚讛 讗诪专 专讘, so 专讘 讬讛讜讚讛 said in the name of 专讘, 讜讻谉 转谞讗 讚讘讬 专讘讬 讬砖诪注讗诇, that's how they also learned in the 讬砖讬讘讛 of 专讘讬 讬砖诪注讗诇, 讗诪专 拽专讗, because the 驻住讜拽 says, 讗讬砖 讗讜 讗砖讛, a man or a woman, 讻讬 讬注砖讜 诪讻诇 讞讟讗转, if he will do any of the sins, so 讛砖讜讛 讛讻转讜讘 讗砖讛 诇讗讬砖, the 转讜专讛 compared a woman to a man 诇讻诇 注讜谞砖讬谉 砖讘转讜专讛, concerning all punishments of the 转讜专讛. So we see that wherever there's a 讚讬谉 of punishment on the man, and he's forbidden to do something, and he will be punished if he will not do it, so too a woman is not allowed to do it and will be punished if she will do it. 讚讘讬 专讘 讗诇注讝专 转谞讬, the 讬砖讬讘讛 of 专讘 讗诇注讝专 they learned, the 驻住讜拽 says in the beginning of 驻专砖转 诪砖驻讟讬诐, 讜讗诇讛 讛诪砖驻讟讬诐 讗砖专 转砖讬诐 诇驻谞讬讛诐, these are the 讚讬谞讬诐 that you should put in front of them, and this is an introduction to all the 讚讬谞讬 诪诪讜谞讜转, all the monetary 讚讬谞讬诐 that the 转讜专讛 tells us. So since it starts off by saying these are the 讚讬谞讬诐 that you should put in front of them, them meaning everybody, 讛砖讜讛 讛讻转讜讘 讗砖讛 诇讗讬砖, so the 转讜专讛 compared a woman to a man 诇讻诇 讚讬谞讬诐 砖讘转讜专讛, concerning all monetary 讚讬谞讬诐 in the 转讜专讛. 讚讘讬 讞讝拽讬讛 讜讚讘讬 专讘讬 讬讜住讬 讛讙诇讬诇讬 转谞讬, the 讬砖讬讘讛 of 讞讝拽讬讛 and 专讘讬 讬讜住讬 讛讙诇讬诇讬 learned, 讗诪专 拽专讗, the 驻住讜拽 says 讜讛诪讬转 讗讬砖 讗讜 讗砖讛, that if an ox gores and kills a man or a woman, so the 转讜专讛 says that the owner of the ox is obligated to pay 讻讜驻专. So here, since the 转讜专讛 says a man or a woman, 讛砖讜讛 讛讻转讜讘 讗砖讛 诇讗讬砖, so the 转讜专讛 compared a woman to a man 诇讻诇 诪讬转讜转 砖讘转讜专讛, concerning all deaths of the 转讜专讛. Whatever the 讚讬谉 would be when you kill a man, the same 讚讬谉 would apply if a woman is killed. And the 讙诪专讗 says 爪专讬讻讗, we must have all three 驻住讜拽讬诐. If we would have one of the three, we would not automatically know that the same 讚讬谉 applies to the other. Because 讚讗讬 讗砖诪注讬谞谉 拽诪讬讬转讗, if it would only tell us the first one, if we would only know that the 转讜专讛 compared a woman to a man concerning all the punishments of the 转讜专讛, I would think 讛转诐 over there, 讛讜讗 讚讞住 专讞诪谞讗 注诇讛, that's where the 转讜专讛 had 专讞诪谞讜转 on her and said she will get punished like a man, 讻讬 讛讬讻讬 讚转讛讜讬 诇讛 讻驻专讛, in order for her to have a 讻驻专讛, since this will cause 讛砖诐 to forgive her, so the 讗讜讬讘注专砖讟注专 wanted a woman to be forgiven, too. That's why He said that she is like a man in this 讚讬谉. 讗讘诇 讚讬谞讬谉, but when it comes to monetary 讚讬谞讬诐, I would think that only 讗讬砖, a man, 讚讘专 诪砖讗 讜诪转谉, that he is a person who does business, 讗讬谉, he is included in the 讚讬谞讬诐 of 讚讬谞讬 诪诪讜谞讜转. 讗砖讛, but a woman, 诇讗, a woman not, since a woman is not usually a business person, therefore all these 讚讬谞讬 诪诪讜谞讜转 do not apply to a woman. Therefore, the 转讜专讛 has to tell us also that the 讚讬谞讬诐 of 讚讬谞讬 诪诪讜谞讜转 apply to a woman, too. 讜讗讬 讗砖诪注讬谞谉 讚讬谞讬诐, and if the 转讜专讛 would just tell us that she is included in all the 讚讬谞讬 诪诪讜谞讜转, I would think 讻讬 讛讬讻讬 讚转讬讛讜讬 诇讛 讞讬讜转讗, in order for her to make a living, because if she would not be included into the 讚讬谞讬 诪诪讜谞讜转, no one would want to do business with her, because people could steal from her, she could steal from others, so you couldn't do business with her. Therefore, she wouldn't be able to make a living, so the 转讜专讛 said that she is included into the 讚讬谞讬诐. 讗讘诇 讻驻专讛, but when it comes to a 讻驻专讛, which is the first 驻住讜拽, I would think 讗讬砖, a man, 讚讘专 诪爪讜讛, that he is person who has to do all the 诪爪讜转, 讗讬谉, he is included in the 注讜谞砖讬谉 of the 转讜专讛, in the punishments of the 转讜专讛. 讗砖讛, but a woman, 讚诇讗讜 讘转 诪爪讜讛, she is not usually included in the 诪爪讜转, 诇讗, she is not included in the 注讜谞砖讬谉. So I wouldn't know that a woman is also included in the 注讜谞砖讬谉 of the 转讜专讛. 讜讗讬 讗砖诪注讬谞谉 讛谞讬 转专转讬, if the 转讜专讛 would just tell us these two, concerning the 注讜谞砖讬谉, that a woman is like a man, and concerning all the monetary 讚讬谞讬诐, that she's like a man, I would think 讛讻讗 诪砖讜诐 讻驻专讛, 讜讛讻讗 诪砖讜诐 讞讬讜转讗. Here, in the case of the 注讜谞砖讬谉, she is included because 讛砖诐 wants her to get a 讻驻专讛. In the case of the monetary 讚讬谞讬诐, she's included in order for her to make a living. 讗讘诇 注谞讬谉 拽讟诇讗, but in the case of death, when she is killed, I would maybe think she is not included. Not the same 讚讬谉 that applies if someone kills a man would be if someone kills a woman, because I would say 讗讬砖, a man, 讚讘专 诪爪讜讛, that he is included in the 诪爪讜转, so there 诇砖诇诐 讻讜驻专, there, the one that caused his death has to pay 讻讜驻专, but 讗砖讛, a woman that is not included in so many 诪爪讜转, 诇讗, I would not know, I would think that if someone kills her doesn't have to pay 讻讜驻专. So therefore, the 转讜专讛 has to tell us that she is included in the 讚讬谉 of 诪讬转讛, that if an ox kills her, the owner of the ox has to pay 讻讜驻专, even if it was a woman. 讜讗讬 讗砖诪注讬谞谉 讻讜驻专, and if the 转讜专讛 would just tell us the 讚讬谉 of 讻讜驻专, that a person is supposed to pay 讻讜驻专 if his ox killed a woman, I would think 诪砖讜诐 讚讗讬讻讗 讗讬讘讜讚 谞砖诪讛, because after all, there was a loss of a 谞砖诪讛. A person got killed, which is such a strict thing, therefore the 讚讬谉 is that a woman is like a man, and the owner of the ox has to pay 讻讜驻专. 讗讘诇 讛谞讬 转专转讬, but these two, the case of the 注讜谞砖讬谉 and the case of the 讚讬谞讬 诪诪讜谞讜转, I would think 讚诇讬讻讗 讗讬讘讜讚 谞砖诪讛, since there is no loss of a 谞砖诪讛, it's not as strict as a person being killed, 讗讬诪讗 诇讗, I would think no, I would think that a woman is not like a man concerning 注讜谞砖讬谉 and concerning monetary 讚讬谞讬诐. Therefore 爪专讬讻讗, therefore, we have to have all three 驻住讜拽讬诐. And now that we have all three 驻住讜拽讬诐, we know that a woman is equal to a man in all these things, 住讬讬 in the 注讜谞砖讬谉 of the 转讜专讛, 住讬讬 in 讚讬谞讬 诪诪讜谞讜转 of the 转讜专讛, and also in the 讚讬谞讬 诪讬转讜转, that if she is killed, it is the same as if a man would be killed.
