Jewish audio on chabad.org. Today's ืฉื™ืขื•ืจ is going to be ืžืกื›ืช ื’ื™ื˜ื™ืŸ ื“ืฃ ืœืดื‘ ืขืžื•ื“ ืืณ from the beginning of the fourth ืคืจืง. This ืžืฉื ื” and the ื’ืžืจื afterwards deals mainly with the ื“ื™ืŸ of ื‘ื™ื˜ื•ืœ ื”ื’ื˜, when a person wants to cancel a ื’ื˜. And this refers to the case when a person sent a ื’ื˜ to his wife through a ืฉืœื™ื—. Because the ื“ื™ืŸ is that not only is a person able to give a ื’ื˜ himself to his wife, but if he wants to send it through an agent, through a ืฉืœื™ื—, he is allowed to do so. As the ื’ืžืจื learns it out in ืงื™ื“ื•ืฉื™ืŸ from different ืคืกื•ืงื™ื, that ืฉืœื•ื—ื• ืฉืœ ืื“ื ื›ืžื•ืชื•, that the ืฉืœื™ื—, the messenger, the agent of a person has the same ื“ื™ืŸ as the person himself. And if a person wants to send a ื’ื˜ to his wife through a ืฉืœื™ื—, he may do so. And this ืžืฉื ื” deals with a case that a person who sent a ื’ื˜ to his wife through a ืฉืœื™ื— wants to be ืžื‘ื˜ืœ it, wants to cancel this ื’ื˜. And the ืžืฉื ื” starts,

Canceling a Get via a Messenger โ€“ Meeting the Shliแธฅแธฅ

ื”ืฉื•ืœื— ื’ื˜ ืœืืฉืชื•, if someone sends a ื’ื˜ to his wife through a ืฉืœื™ื—, ื•ื”ื’ื™ืข ื‘ืฉืœื™ื—, and he met up with the ืฉืœื™ื—, with the agent, ืื• ืฉืฉืœื— ืื—ืจื™ื• ืฉืœื™ื—, or he sent another ืฉืœื™ื— to meet up with the first ืฉืœื™ื— who has the ื’ื˜, ื•ืืžืจ ืœื•, and he said to that ืฉืœื™ื—, ื’ื˜ ืฉื ืชืชื™ ืœืš ื‘ื˜ืœ ื”ื•ื, the ื’ื˜ that I gave you is cancelled, so the ื“ื™ืŸ is ื”ืจื™ ื–ื” ื‘ื˜ืœ, that that ื’ื˜ is cancelled, and the ืฉืœื™ื— cannot give that ื’ื˜ to this man's wife. And if the ืฉืœื™ื— does give that ื’ื˜ to this man's wife, the woman is not divorced, she remains an ืืฉืช ืื™ืฉ, a married woman as before, because he was ืžื‘ื˜ืœ the ื’ื˜. ืงื“ื ืืฆืœ ืืฉืชื•, if the husband did not meet up with the ืฉืœื™ื— that he sent with the ื’ื˜, but he came to the wife herself, ืื• ืฉืฉืœื— ืืฆืœื” ืฉืœื™ื—, or he sent a ืฉืœื™ื— to his wife directly, ื•ืืžืจ ืœื”, and he said to her, ื’ื˜ ืฉืฉืœื—ืชื™ ืœืš ื‘ื˜ืœ ื”ื•ื, the ื’ื˜ that I sent you is ื‘ื˜ืœ, ื”ืจื™ ื–ื” ื‘ื˜ืœ, so that ื’ื˜ is ื‘ื˜ืœ. So later on, if the ืฉืœื™ื— will give the ื’ื˜ to his wife, that ื’ื˜ is ื‘ื˜ืœ and the woman is not divorced, she remains an ืืฉืช ืื™ืฉ. But ืื ืžืฉื”ื’ื™ืข ื’ื˜ ืœื™ื“ื”, if this happened after the ื’ื˜ already reached to her hand, in other words, the husband sent a ืฉืœื™ื— to the ืฉืœื™ื— that he sent before to give the ื’ื˜, but he did not reach that ืฉืœื™ื— till after the ืฉืœื™ื— already gave the ื’ื˜ to the wife, or in the case where the husband came directly to the wife, but he only came to her after she already got the ื’ื˜, in all these cases, ืฉื•ื‘ ืื™ื ื• ื™ื›ื•ืœ ืœื‘ื˜ืœื•, he cannot be ืžื‘ื˜ืœ it. Since she already received the ื’ื˜, she is already divorced, so now the husband cannot be ืžื‘ื˜ืœ the ื’ื˜ anymore. Then the ืžืฉื ื” continues, ื‘ืจืืฉื•ื ื”, in the beginning, ื”ื™ื” ืขื•ืฉื” ื‘ื™ืช ื“ื™ืŸ ื‘ืžืงื•ื ืื—ืจ ื•ืžื‘ื˜ืœื•, that when a person wanted to be ืžื‘ื˜ืœ a ื’ื˜ that he sent with a ืฉืœื™ื—, he did not have to catch up to the ืฉืœื™ื— and be ืžื‘ื˜ืœ it to the ืฉืœื™ื—, or come to his wife and be ืžื‘ื˜ืœ it by her, but what he was able to do was to gather together a ื‘ื™ืช ื“ื™ืŸ in another place, not in the place of the ืฉืœื™ื— or the place of his wife. Wherever he himself was, he was able to get together a ื‘ื™ืช ื“ื™ืŸ, which means get together three people, or two people according to the two opinions in the ื’ืžืจื later on, and he would be ืžื‘ื˜ืœ it in front of those people, and that would be sufficient that the ื’ื˜ that the ืฉืœื™ื— has is ื‘ื˜ืœ. And then when the ืฉืœื™ื— would give the ื’ื˜ to the wife, he would be giving a ื’ื˜ ื‘ื˜ืœ and the wife would not be divorced.

Rabbeinu Gamlielโ€™s Objection โ€“ World-Fixing Concern

ื”ืชืงื™ืŸ ืจื‘ืŸ ื’ืžืœื™ืืœ ื”ื–ืงืŸ, ืจื‘ืŸ ื’ืžืœื™ืืœ ื”ื–ืงืŸ was ืžืชืงืŸ ืฉืœื ื™ื”ื• ืขื•ืฉื™ืŸ ื›ืŸ, that they should not do that. And the reason for that is ืžืคื ื™ ืชื™ืงื•ืŸ ื”ืขื•ืœื, for a ืชืงื ื” of the world, because she will not know that the ื’ื˜ is ื‘ื˜ืœ because he was ืžื‘ื˜ืœ the ื’ื˜ in his own place, so she will think that the ื’ื˜ that she received is a good ื’ื˜, and she will go and remarry based on this ื’ื˜, and the truth is that this ื’ื˜ is not a good ื’ื˜, and she is not allowed to remarry, she is an ืืฉืช ืื™ืฉ as before. And therefore ืจื‘ืŸ ื’ืžืœื™ืืœ ื”ื–ืงืŸ was ืžืชืงืŸ that you should not make a ื‘ื™ืช ื“ื™ืŸ in your own place to be ืžื‘ื˜ืœ the ื’ื˜, but the only way you are able to be ืžื‘ื˜ืœ a ื’ื˜ is or by reaching the ืฉืœื™ื—, or by reaching the wife before she received the ื’ื˜. Now, we will learn the ื’ืžืจื that explains the ืžืฉื ื”. ื”ื’ื™ืขื• ืœื ืงืชื ื™ ืืœื ื”ื’ื™ืข. The ื’ืžืจื refers to the first few words of the ืžืฉื ื”. The ืžืฉื ื” said that if someone sends a ื’ื˜ to his wife ื•ื”ื’ื™ืข ื‘ืฉืœื™ื—, and he met up with the ืฉืœื™ื— and told him, "The ื’ื˜ that I gave you is ื‘ื˜ืœ," so the ื“ื™ืŸ is that it's ื‘ื˜ืœ. So the ืœืฉื•ืŸ of the ืžืฉื ื” is ื•ื”ื’ื™ืข ื‘ืฉืœื™ื—, he met up with the ืฉืœื™ื—. The ืœืฉื•ืŸ is not ื”ื’ื™ืขื•, which would mean he reached him. And the difference is that ื”ื’ื™ืขื• would mean that he tried to get him, he chased him, till finally he reached him. But the word ื”ื’ื™ืข means ื•ืืคื™ืœื• ืžืžื™ืœื, ืืคื™ืœื• by itself automatically. In other words, he didn't try to reach the ืฉืœื™ื—, he just happened by chance to meet up with the ืฉืœื™ื—, and he told the ืฉืœื™ื— that the ื’ื˜ is ื‘ื˜ืœ. And still, the ืžืฉื ื” tells us that even though he did not try to reach the ืฉืœื™ื— to be ืžื‘ื˜ืœ the ื’ื˜, but he just happened by chance to meet up with the ืฉืœื™ื— and he was ืžื‘ื˜ืœ it, still the ื“ื™ืŸ is that the ื’ื˜ is ื‘ื˜ืœ. And the ื—ื™ื“ื•ืฉ is that ื•ืœื ืืžืจื™ื ืŸ, we do not say ืœืฆืขืจื” ื”ื•ื ื“ืงื ืžื›ื•ื•ืŸ, that he was only interested in being ืžืฆืขืจ her, in annoying her. Because there is a ืกื‘ืจื to say that since he did not try to reach the ืฉืœื™ื—, he really is not interested in being ืžื‘ื˜ืœ the ื’ื˜. It's only that since he happened to meet the ืฉืœื™ื— on the way, so he decided, "Let me say that the ื’ื˜ is ื‘ื˜ืœ," not really meaning it, in order for the wife to think that she is not divorced, so he will annoy her for a few months, and later on, in a few months from now, he will give her the ื’ื˜. But in the meantime, let her think that she's not going to get the ื’ื˜. But in essence, he did not mean that the ื’ื˜ should be ื‘ื˜ืœ, he just meant to be ืžืฆืขืจ her. So we would think that because of that, the ื’ื˜ is not ื‘ื˜ืœ, that when the person, the husband, met up with the ืฉืœื™ื— by chance and was ืžื‘ื˜ืœ the ื’ื˜, we do not accept his ื‘ื™ื˜ื•ืœ, and the ื’ื˜ remains a ื›ืฉืจ ื’ื˜. So therefore, the ืžืฉื ื” tells us that even if just ื”ื’ื™ืข ื‘ืฉืœื™ื—, he just met up with the ืฉืœื™ื—, still we accept his ื‘ื™ื˜ื•ืœ and the ื’ื˜ is not a good ื’ื˜. Then, the ื’ืžืจื continues, it said in the ืžืฉื ื”, ืื• ืฉืฉืœื— ืื—ืจื™ื• ืฉืœื™ื—, or if the husband sent a ืฉืœื™ื— to the first ืฉืœื™ื— to tell him that the ื’ื˜ is ื‘ื˜ืœ, so then the ื“ื™ืŸ is that the ื’ื˜ is ื‘ื˜ืœ. So the ื’ืžืจื asks, ืœืžื” ืœื™? Why does the ืžืฉื ื” have to tell us that, since we have a ื›ืœืœ that ืฉืœื•ื—ื• ืฉืœ ืื“ื ื›ืžื•ืชื•, that the ืฉืœื™ื— of a person has the same ื“ื™ืŸ as the person himself? So here, too, just like the husband himself has a right to be ืžื‘ื˜ืœ the ื’ื˜ in the hands of the ืฉืœื™ื—, so it's self-understood that the husband has a right to send a ืฉืœื™ื— to the ืฉืœื™ื— to be ืžื‘ื˜ืœ the ื’ื˜. So why does the ืžืฉื ื” have to tell us that if he sent a ืฉืœื™ื— to the first ืฉืœื™ื—, it is also good enough, and the ื’ื˜ is ื‘ื˜ืœ? And the ื’ืžืจื answers, ืžื”ื• ื“ืชื™ืžื, I would think, ืœื ืืœื™ืžื ืฉืœื™ื—ื•ืชื™ื” ื“ื‘ืชืจื ืžืฉืœื™ื—ื•ืชื™ื” ื“ืงืžื, that the ืฉืœื™ื—ื•ืช, the mission of the second one, is not stronger than the ืฉืœื™ื—ื•ืช of the first, ื“ืœื‘ื˜ืœื™ื”, in order for him to be ืžื‘ื˜ืœ it, for him to cancel it out, because the first one, what right does he have to give the ื’ื˜? Because of the ื“ื™ืŸ of ืฉืœื™ื—ื•ืช. Since he is a ืฉืœื™ื— of the husband, so ืžืฆื“ the ื“ื™ืŸ of ืฉืœื™ื—ื•ืช, he has a right to give the ื’ื˜ instead of the husband. What right does the second ืฉืœื™ื— have to come to the first ืฉืœื™ื— and tell him that the ื’ื˜ is ื‘ื˜ืœ? Also because the ื“ื™ืŸ of ืฉืœื™ื—ื•ืช, that ืฉืœื•ื—ื• ืฉืœ ืื“ื ื›ืžื•ืชื•. So we would think that since both of them are equal, both have the same power of ืฉืœื™ื—ื•ืช, so why should we say that this power of the second one is stronger than the power of the first, and the second has a right to cancel out the first? ืงื ืžืฉืžืข ืœืŸ, so the ืžืฉื ื” tells us no, that even if he sent a ืฉืœื™ื— to the first ืฉืœื™ื—, it is sufficient, and the ื’ื˜ is ื‘ื˜ืœ. Then, the ื’ืžืจื continues, it said in the ืžืฉื ื”,

Canceling a Get Directly to the Wife

ืงื“ื ื”ื•ื ืืฆืœ ืืฉืชื•, that if the husband himself came to the wife herself, and he told her that, "The ื’ื˜ that I sent with the ืฉืœื™ื— should be ื‘ื˜ืœ," so then the ื’ื˜ is ื‘ื˜ืœ. And the ื’ืžืจื asks, ืœืžื” ืœื™? Why does the ืžืฉื ื” have to tell us that? Isn't it self-understood that if he comes to the wife herself, definitely he is able to be ืžื‘ื˜ืœ the ื’ื˜? And the ื’ืžืจื answers, ืžื”ื• ื“ืชื™ืžื, I would think, ื›ื™ ืœื ืืžืจื™ื ืŸ ืœืฆืขืจื” ืงื ืžื›ื•ื•ืŸ, when don't we assume that only he meant to annoy her? ื”ื ื™ ืžื™ืœื™ ืœืฉืœื™ื—, that's only if he reaches the ืฉืœื™ื— and he tells the ืฉืœื™ื— the ื’ื˜ is ื‘ื˜ืœ. ืื‘ืœ ืœื“ื™ื“ื”, but if he goes to her and he tells her directly the ื’ื˜ is ื‘ื˜ืœ, ื•ื“ืื™, for sure, ืœืฆืขืจื” ืงื ืžื›ื•ื•ืŸ, he only means to annoy her. In other words, when he says said before that there is a ืกื‘ืจื to say that maybe he does not mean to be ืžื‘ื˜ืœ the ื’ื˜. He only means to annoy her. And the ื’ืžืจื said, no, we don't accept that ืกื‘ืจื, and we say, for sure, he meant what he said, and the ื’ื˜ is ื‘ื˜ืœ. The ื’ืžืจื now says, maybe, when don't we accept that ืกื‘ืจื? That he only meant to annoy her? When he met up with the ืฉืœื™ื—, and he told the ืฉืœื™ื— that the ื’ื˜ is ื‘ื˜ืœ. But if he goes to his wife directly, here there is more ืกื‘ืจื to say that probably he only means to annoy her. Otherwise he wouldn't come to her to be ืžื‘ื˜ืœ the ื’ื˜. And therefore we might think that in the case where he came to his wife directly and told her that the ื’ื˜ is ื‘ื˜ืœ, we do not accept his words, because he only probably meant to annoy her, and the ื’ื˜ should remain a good ื’ื˜. ืงื ืžืฉืžืข ืœืŸ, so the ืžืฉื ื” tells us, no, that if he came to his wife herself, still we say that he meant what he said, and the ื’ื˜ is ื‘ื˜ืœ, and she is not divorced. Then we continue ืคืฉื˜ in the ืžืฉื ื”. It says in the ืžืฉื ื”, ืื• ืฉืฉืœื— ืืฆืœื” ืฉืœื™ื—, or if the husband sent a ืฉืœื™ื— to his wife to say that the ื’ื˜ is ื‘ื˜ืœ, so the ื“ื™ืŸ is the ื’ื˜ is ื‘ื˜ืœ. So the ื’ืžืจื asks, ืœืžื” ืœื™? Why does the ืžืฉื ื” have to tell us that? Since you told me that the husband himself, if he comes to his wife and tells her the ื’ื˜ is ื‘ื˜ืœ, the ื’ื˜ is ื‘ื˜ืœ, so we understand ourselves that the same ื“ื™ืŸ would be if he sent a ืฉืœื™ื— to his wife, because the ื›ืœืœ is that ืฉืœื•ื—ื• ืฉืœ ืื“ื ื›ืžื•ืชื•. So just like the husband himself has the right to be ืžื‘ื˜ืœ the ื’ื˜ by coming to his wife, so too we understand ourselves he has a right to send a ืฉืœื™ื— to his wife to be ืžื‘ื˜ืœ the ื’ื˜. So why does the ืžืฉื ื” have to tell us that? And the ื’ืžืจื answers, ืžื”ื• ื“ืชื™ืžื, I would think, ืื™ื”ื• ื”ื•ื ื“ืœื ื˜ืจื—, he himself would not trouble himself ืื“ืขืชื ืœืฆืขื•ืจื”, only to be ืžืฆืขืจ her, only to annoy her. He himself would not go out of his way to reach his wife just to annoy her. ืื‘ืœ ืฉืœื™ื—, but if he sends a ืฉืœื™ื—, ื“ืœื ืื™ื›ืคืช ืœื™ื” ื›ื™ ื˜ืจื—, here we could say he doesn't mind if someone else, if the ืฉืœื™ื—, will go through a trouble. So here ื•ื“ืื™ ืœืฆืขื•ืจื” ืงื ืžื›ื•ื™ืŸ, here certainly he only means to annoy her. In other words, when we said before that we do not assume that he meant to annoy her, but we say he probably meant what he said, is only when he himself comes to his wife. We don't assume that he's going to go through the trouble of finding his wife just to annoy her. So therefore, since he found her, he went through this trouble, probably he really meant what he said to be ืžื‘ื˜ืœ the ื’ื˜. But if he sends a ืฉืœื™ื— to his wife, here he doesn't go through any trouble. It's only the ืฉืœื™ื— that's going through the trouble. So what does he care if the ืฉืœื™ื— will go through the trouble of finding his wife? So here there's a stronger ืกื‘ืจื to say that probably he did not mean what he said, but the reason he sent a ืฉืœื™ื— was just to be ืžืฆืขืจ her. So therefore I would think that if the husband sends a ืฉืœื™ื— to his wife to be ืžื‘ื˜ืœ the ื’ื˜, we do not accept the ื‘ื™ื˜ื•ืœ, and the ื’ื˜ remains a ื›ืฉืจ ื’ื˜. ืงื ืžืฉืžืข ืœืŸ, so therefore the ืžืฉื ื” has to tell us, no, that even if he sent a ืฉืœื™ื— to his wife, we also accept his words, and the ื’ื˜ is ื‘ื˜ืœ. Then the ื’ืžืจื continues. It said in the ืžืฉื ื”,

Attempting Cancellation After the Get Has Arrived

ืื ืžืฉื”ื’ื™ืข ื’ื˜ ืœื™ื“ื”, if all this happened after the ื’ื˜ already reached her hand, ืื™ื ื• ื™ื›ื•ืœ ืœื‘ื˜ืœื•, he cannot be ืžื‘ื˜ืœ. And the ื’ืžืจื asks, ืคืฉื™ื˜ื, it's very simple. Why does the ืžืฉื ื” have to tell us that? It's self-understood that since she got the ื’ื˜ already, so she is already divorced, so how could we even think that the husband should be able to be ืžื‘ื˜ืœ the ื’ื˜ after she was already divorced? And the ื’ืžืจื answers, ืœื, ืฆืจื™ื›ื, it does have to tell us. Because of a certain case, the ืžืฉื ื” has to tell us this ื“ื™ืŸ. Because in a case ื“ืžื”ื“ืจ ืขืœื™ื” ืžืขื™ืงืจื ืœื‘ื™ื˜ื•ืœื™ื”, in a case where he tried to be ืžื‘ื˜ืœ it before, he was involved in trying to be ืžื‘ื˜ืœ it before the ื’ื˜ reached her hand. So ืžื”ื• ื“ืชื™ืžื, I would think, ืื™ื’ืœืื™ ืžื™ืœืชื ืœืžืคืจืข, that this reveals for before, this reveals retroactive ื“ื‘ื˜ื•ืœื™ ื‘ื˜ืœื™ื”, that he really was ืžื‘ื˜ืœ it. Even though, in fact, he didn't reach the ืฉืœื™ื— or his wife to be ืžื‘ื˜ืœ it until after she got the ื’ื˜, but he tried to reach her or he tried to reach the ืฉืœื™ื— before. So now that he did reach her and he did say the ื’ื˜ is ื‘ื˜ืœ, this should prove that what he did before when he was trying to reach them was also in order to be ืžื‘ื˜ืœ. And therefore we would think that we would say that we accept his act of before, and it's as if he was ืžื‘ื˜ืœ the ื’ื˜ before the ื’ื˜ reached her hand. So ืงื ืžืฉืžืข ืœืŸ, so the ืžืฉื ื” has to tell us, no, that since in fact he was ืžื‘ื˜ืœ it only after the ื’ื˜ reached the hand of his wife, so we do not accept his ื‘ื™ื˜ื•ืœ, because the ื‘ื™ื˜ื•ืœ was too late, and the ื’ื˜ remains a ื›ืฉืจ ื’ื˜. Now the ื’ืžืจื will go into the different expressions a person may use in order to be ืžื‘ื˜ืœ a ื’ื˜. And the ื›ืœืœ is as follows: We are talking here about a ื’ื˜ which is written ื›ื“ืช ื•ื›ื“ื™ืŸ. It was written with all the ื”ืœื›ื•ืช, it is a ื›ืฉืจ ื’ื˜. It's just that the husband wants to be ืžื‘ื˜ืœ it, it should not be given to his wife. So therefore the only expressions that are valid is if the husband uses a ืœืฉื•ืŸ that shows that he is trying to be ืžื‘ื˜ืœ the ื’ื˜ from now on, that he doesn't want the ื’ื˜, which is a ื›ืฉืจ ื’ื˜, but he does not want it to be given now to his wife. But if he will use a ืœืฉื•ืŸ, an expression, that will seem to be saying that the ื’ื˜ from before was not a good ื’ื˜, that expression is not valid, we would not accept his words, because it would not be true. If he would be saying the ื’ื˜ is not ื›ืฉืจ, that is not true because the ื’ื˜ is ื›ืฉืจ. So therefore the only expression we would accept is an expression that shows that even though the ื’ื˜ is ื›ืฉืจ, he wants it not to be good from now on. But an expression that would seem to be saying that it's not good from before, such an expression would not be valid, and we would not accept his words, and the ื’ื˜ would remain a good ื’ื˜. And now we will learn the ื’ืžืจื inside.

Valid Language for Get Cancellation โ€“ โ€œBatel Huโ€ and Others

ืชื ื• ืจื‘ื ืŸ, the ืจื‘ื ืŸ learned, we learn in the ื‘ืจื™ื™ืชื, that if the husband uses the ืœืฉื•ืŸ, ื‘ื˜ืœ ื”ื•ื, it is ื‘ื˜ืœ, it is canceled, or he uses the ืœืฉื•ืŸ, ืื™ ืืคืฉื™ ื‘ื•, I don't want it, ื“ื‘ืจื™ื• ืงื™ื™ืžื™ืŸ, his words stand, we accept his words. But if he would use the expression ืคืกื•ืœ ื”ื•ื, it is ืคืกื•ืœ, or ืื™ื ื• ื’ื˜, it is not a ื’ื˜, ืœื ืืžืจ ื›ืœื•ื, he didn't say anything, we do not accept his words. And the reason for that is because the last two expressions do not mean that he is being ืžื‘ื˜ืœ it ืžื›ืืŸ ื•ืœื”ื‘ื, from now and on, but he means what it seems to be saying is that the ื’ื˜ from before was no good. When he says ืคืกื•ืœ ื”ื•ื, it is ืคืกื•ืœ, it's like making a statement that this ื’ื˜ is not a ื›ืฉืจ ื’ื˜. Or when he says ืื™ื ื• ื’ื˜, it is not a ื’ื˜, it's as if he's making a statement that the ื’ื˜ is not a ื’ื˜, but not that he is saying the ื’ื˜ shall not be a good ื’ื˜. And therefore, when he uses any of these two expressions, ืœื ืืžืจ ื›ืœื•ื, he didn't say anything, we do not accept his words. And the ื’ืžืจื asks, ืœืžื™ืžืจื, let us say, ื“ื‘ื˜ืœ, that the expression ื‘ื˜ืœ, ืœื™ืฉื ื ื“ืœื™ื‘ื˜ืœ ืžืฉืžืข, is ืžืฉืžืข a ืœืฉื•ืŸ that it should be ื‘ื˜ืœ for the future, that's what it seems to be saying. Since the ื‘ืจื™ื™ืชื said that if he uses the term ื‘ื˜ืœ ื”ื•ื, we do accept his words, so obviously that the expression ื‘ื˜ืœ means that it should in the future be ื‘ื˜ืœ, and not in the past that it was ื‘ื˜ืœ. But the ื’ืžืจื asks, how can you say that? ื•ื”ืืžืจ

ืจื‘ื” ื‘ืจ ืื™ื‘ื• ืืžืจ ืจื‘ ืฉืฉืช, didn't ืจื‘ื” ื‘ืจ ืื™ื‘ื• say in the name of ืจื‘ ืฉืฉืช, ื•ืืžืจื™ ืœื”, and others say, ืืžืจ ืจื‘ื” ื‘ืจ ืื‘ื•ื”, that ืจื‘ื” ื‘ืจ ืื‘ื•ื” was the one that said that, that ืžืงื‘ืœ ืžืชื ื”, that a person who receives a present, ืฉืืžืจ, that he said, ืœืื—ืจ ืฉื‘ืืช ืžืชื ื” ืœื™ื“ื•, after he received the present, he said that ืžืชื ื” ื–ื• ืžื‘ื•ื˜ืœืช ื”ื™ื, this ืžืชื ื” should be ืžื‘ื•ื˜ืœ, or he says this ืžืชื ื”, this present, ืชื‘ื˜ืœ, should be ื‘ื˜ืœ, or he says ืื™ ืืคืฉื™ ื‘ื”, I don't want it, ืœื ืืžืจ ื›ืœื•ื, he didn't say anything. But if he says ื‘ื˜ืœื” ื”ื™ื, it is ื‘ื˜ืœ, or he says ืื™ื ื” ืžืชื ื”, it is not a ืžืชื ื”, ื“ื‘ืจื™ื• ืงื™ื™ืžื™ืŸ, his words do stand, we do accept his words. In the case of a ืžืชื ื”, it is just the opposite of the case of ื’ื˜. In the case of ื’ื˜ we said that the only expression that is valid if the expression says that the ื’ื˜ should not in the future be good. But if he uses an expression that the ื’ื˜ is not good from before, such an expression is not valid. In the case of a present it is just the opposite. When a person receives a present and he makes a ืงื ื™ืŸ on it, he does the act of acquisition and the present become his, now there is nothing that he could do to nullify that acceptance of the present. The only thing he could do is that he could give it away, he could be ืžืคืงื™ืจ it, but the present is his at this moment. So if he says after he received the present that the present shall not be a present, then his words are not valid, and it does not go back to the giver because it's his already and there's nothing he could do about it. On the other hand, if he says that the present was never a present from before, he never received it as a present, so here his words are valid because the ื›ืœืœ is that ื”ื•ื“ืืช ื‘ืขืœ ื“ื™ืŸ ื›ืžืื” ืขื“ื™ื ื“ืžื™, that when a person himself admits in monetary things that certain things or certain money is not his, Then we believe his words, we accept his words, more than we would accept the words of a hundred witnesses. So therefore, if someone says that this present was never given to me, he himself is admitting that he never received it. And since ื”ื•ื“ืืช ื‘ืขืœ ื“ื™ืŸ ื›ืžืื” ืขื“ื™ื ื“ืžื™, we accept his words, and we say he never received the present, and then automatically it goes back to the one that gave it. But if he says that even though I took the present, and it's mine, I from now on want the present should not be a present, that's not valid, and would not go back to the giver. And that's what ืจื‘ื ื‘ืจ ืื‘ื•ื” or ืจื‘ื” ื‘ืจ ืื‘ื•ื” was saying, that if he received the present, and after he got the present he said that this present should be ืžื‘ื•ื˜ืœืช ื”ื™ื, or ืชื‘ื˜ืœ, or ืื™ ืืคืฉื™ ื‘ื”, doesn't mean anything. Because these are expressions that show that he does not want the present should be a present from now on, and that he cannot do. But if he says ื‘ื˜ืœื” ื”ื™ื, or ืื™ื ื” ืžืชื ื”, so in this case ื“ื‘ืจื™ื• ืงื™ื™ืžื™ืŸ, we accept his words, because these are terms that express the fact that it was never a ืžืชื ื” from the beginning, from before. But the ื’ืžืจื says,

Dual Meaning of โ€œBatelโ€ โ€“ Past vs. Future Cancellation

ืืœืžื we see, ื‘ื˜ืœ ืžืขื™ืงืจื ืžืฉืžืข, that if he used the term ื‘ื˜ืœ, it means from before, not for the future that it shall be ื‘ื˜ืœ, but it means that it is ื‘ื˜ืœ from before. So it's a ืงืฉื™ื to the ื‘ืจื™ื™ืชื that we said before: that if he uses the term ื‘ื˜ืœ ื”ื•ื, we say the ื’ื˜ is ื‘ื˜ืœ. And since we say this ื“ื™ืŸ in the case of ื’ื˜, it means that the expression ื‘ื˜ืœ ื”ื•ื is for the future. And in the case of ืžืชื ื”, we said that ื‘ื˜ืœื” ื”ื™ื is also valid, so obviously it means for the past, that it was never a ืžืชื ื”, it was ื‘ื˜ืœ from before. And even though before we used the ืœืฉื•ืŸ ื‘ื˜ืœ ื”ื•ื, and now we're using the ืœืฉื•ืŸ ื‘ื˜ืœื” ื”ื™ื, it's really the same thing. The only difference is that by the case of ื’ื˜, since it's ืœืฉื•ืŸ ื–ื›ืจ, so therefore we use a ืœืฉื•ืŸ ื–ื›ืจ, ื‘ื˜ืœ ื”ื•ื. In the case of ืžืชื ื”, since ืžืชื ื” is ืœืฉื•ืŸ ื ืงื‘ื”, so we use the ืœืฉื•ืŸ ื‘ื˜ืœื” ื”ื™ื. But really, ื‘ื˜ืœื” ื”ื™ื and ื‘ื˜ืœ ื”ื•ื have the exact same meaning. And that's why the ื’ืžืจื asks that how could the ื‘ืจื™ื™ืชื say that if you use the ืœืฉื•ืŸ ื‘ื˜ืœ ื”ื•ื by ื’ื˜ it is valid, since we know that if you use the ืœืฉื•ืŸ ื‘ื˜ืœื” ื”ื™ื by ืžืชื ื” it is also valid, and that shows that the expression ื‘ื˜ืœ means for before, not for the future. And the ื’ืžืจื answers, ืืžืจ ืื‘ื™ื™, ืื‘ื™ื™ says, ื‘ื˜ืœ ืฉืชื™ ืœืฉื•ื ื•ืช ืžืฉืžืข, that ื‘ื˜ืœ is ืžืฉืžืข, has the meaning of two expressions: ืžืฉืžืข ื“ื‘ื˜ืœ ื•ืžืฉืžืข ื“ืœื™ื‘ื˜ืœ. It could mean that it was ื‘ื˜ืœ, it is ื‘ื˜ืœ from before, and it could mean that it should be ื‘ื˜ืœ. It has both meanings. And therefore, ื’ื‘ื™ ื’ื˜, in the

Interpreting "ื‘ื˜ืœ ื”ื•ื" for Gittin and Gifts

case of ื’ื˜, ืœื™ืฉื ื ื“ืžื”ื ื™ ื‘ื™ื” ืงืืžืจ. We assume that when a person is interested in being ืžื‘ื˜ืœ a ื’ื˜, and he uses the ืœืฉื•ืŸ ื‘ื˜ืœ ื”ื•ื, he probably meant to use this expression in a way that it should be valid. And since ื‘ื˜ืœ ื”ื•ื could mean for the future, and he is interested in being ืžื‘ื˜ืœ the ื’ื˜, so we assume he probably meant it in a way that it should be valid. And therefore we say what he meant was that it should be ื‘ื˜ืœ in the future. ื’ื‘ื™ ืžืชื ื”, in the case of the present, ืœื™ืฉื ื ื“ืžื”ื ื™ ื‘ื” ืงืืžืจ. We assume that he meant the word ื‘ื˜ืœ in a way that it helps in the case of ืžืชื ื”. And since in the case of ืžืชื ื” the only way that ื‘ื™ื˜ื•ืœ would help if it means for the past, so we assume that that's probably what he meant, he meant for the past. Since the word could mean the past and mean the future, so in each case we translate it, we interpret it that he meant it the way that it would help in that case. Then the ื’ืžืจื continues, ืืžืจ ืื‘ื™ื™, ืื‘ื™ื™ says, ื ืงื˜ื™ื ืŸ, we accept, in other words, we know the ื”ืœื›ื” that ืฉืœื™ื— ืžืชื ื” ื”ืจื™ ื”ื•ื ื›ืฉืœื™ื— ื”ื’ื˜, that if you send a ืฉืœื™ื— with a present to somebody, it has the same ื“ื™ืŸ as if you send a ืฉืœื™ื— with a ื’ื˜. Just like when you send a ืฉืœื™ื— with a ื’ื˜ you have a right to be ืžื‘ื˜ืœ the ื’ื˜, and then the ืฉืœื™ื— is not allowed to give the ื’ื˜ to the wife, the same way with a ืžืชื ื”, that if you send a ืฉืœื™ื— with a present to somebody, the giver of the present, the ืžืฉืœื—, the sender, has a right to be ืžื‘ื˜ืœ the ืฉืœื™ื—, and the ืฉืœื™ื— is then not allowed to give the present. And the ื’ืžืจื says ื ืคืงื ืžื™ื ื”, the difference that will come out from this ื“ื™ืŸ, which ื“ื™ืŸ will be an outcome of this ื›ืœืœ that a ืฉืœื™ื— ืžืชื ื” has the same ื“ื™ืŸ of a ืฉืœื™ื— ื”ื’ื˜? ืœื”ื•ืœืš ืœืื• ื›ื–ื›ื™ ื“ืžื™, concerning the ื“ื™ืŸ that ื”ื•ืœืš is not like ื–ื›ื™. And this refers to a ื›ืœืœ that we have that ื–ื›ื™ืŸ ืœืื“ื ืฉืœื ื‘ืคื ื™ื•, that you could be ืžื–ื›ื” somebody something without the person being there. In other words, the

Acquisition Through a Messenger: Kinyan Rules

rule is, the ื›ืœืœ is generally, that a person does not acquire acquire something, until he makes a ืงื ื™ืŸ on the object or the thing, whatever it is, that he wants to acquire. Then the ื“ื™ืŸ is that the person himself does not have to make the ืงื ื™ืŸ, he is allowed to send a ืฉืœื™ื—, and when the ืฉืœื™ื— makes the ืงื ื™ืŸ, then automatically at that moment the person who sent the ืฉืœื™ื— becomes the owner of the object, because we say ืฉืœื•ื—ื• ืฉืœ ืื“ื ื›ืžื•ืชื•. And therefore, the moment the ืฉืœื™ื— makes the ืงื ื™ืŸ, the ืžืฉืœื— becomes the owner of that object. Then there is another ื“ื™ืŸ, that if a person wants to give something to somebody else, for instance, if ืจืื•ื‘ืŸ wants to give something to ืฉืžืขื•ืŸ, and it is for the benefit of ืฉืžืขื•ืŸ to receive that thing, that object, so then you can make ืฉืžืขื•ืŸ the owner of that object without even ืฉืžืขื•ืŸ knowing about it. What ืจืื•ื‘ืŸ would have to do, he would have to give the object to a ืฉืœื™ื—, to a person, and tell the person, you be ื–ื•ื›ื” for ืฉืžืขื•ืŸ. And the moment this ืฉืœื™ื— makes the ืงื ื™ืŸ, the act of acquisition on that object, that moment this object belongs to ืฉืžืขื•ืŸ even though ืฉืžืขื•ืŸ doesn't even know about it, and ืฉืžืขื•ืŸ never appointed a ืฉืœื™ื— to make the ืงื ื™ืŸ for him. But ืจืื•ื‘ืŸ has a right to be ืžื–ื›ื” for ืฉืžืขื•ืŸ an object if it is a ื–ื›ื•ืช for him, if it is for his benefit. If it is not for his benefit, then the ื“ื™ืŸ is that you cannot make him the owner of the object until he knows about it, or he makes a ืฉืœื™ื—, etc. But in the case of a ื–ื›ื•ืช, you are allowed to be ืžื–ื›ื” something for someone else without even him knowing about it. But in order to do that, you would have to tell the ืฉืœื™ื—, be ื–ื•ื›ื” for ืฉืžืขื•ืŸ, which means you make the ืงื ื™ืŸ for ืฉืžืขื•ืŸ. But let's say the ืจืื•ื‘ืŸ who is giving the object to ืฉืžืขื•ืŸ does not say to the ืฉืœื™ื—, be ื–ื•ื›ื” for ืฉืžืขื•ืŸ, he says take it to ืฉืžืขื•ืŸ. So here the ืฉืืœื” in ื’ืžืจื is, when he says ื”ื•ืœืš, take it to ืฉืžืขื•ืŸ, is it as if he said be ื–ื•ื›ื” for ืฉืžืขื•ืŸ, and then as soon as the ืฉืœื™ื— takes it, automatically ืฉืžืขื•ืŸ is the owner of that object? Or do we say since he did not use the term be ื–ื•ื›ื” for him, he just used the term take it to him, so as long as it didn't get to ืฉืžืขื•ืŸ, so then ืฉืžืขื•ืŸ is not the owner of the object? And this is

ื”ื•ืœืš vs ื–ื›ื™: Ownership Transfer Nuances

what the ื’ืžืจื is saying here, that when ืื‘ื™ื™ said that the ื“ื™ืŸ is that you're allowed to be ืžื‘ื˜ืœ a ืฉืœื™ื— of a ืžืชื ื”, just like you're allowed to be ืžื‘ื˜ืœ a ืฉืœื™ื— of a ื’ื˜, that proves that ื”ื•ืœืš ืœืื• ื›ื–ื›ื™ ื“ืžื™, that when you say to a ืฉืœื™ื—, take this present to ืฉืžืขื•ืŸ, this is not as if you said be ื–ื•ื›ื” for ืฉืžืขื•ืŸ. Because if ื”ื•ืœืš would be like ื–ื›ื™, so as soon as ืจืื•ื‘ืŸ says to the ืฉืœื™ื—, take this object to ืฉืžืขื•ืŸ, so automatically it belongs to ืฉืžืขื•ืŸ already, because when the ืฉืœื™ื— made the ืงื ื™ืŸ, it is as if he is the ืฉืœื™ื— of ืฉืžืขื•ืŸ, and it belongs to ืฉืžืขื•ืŸ. And now how could ืจืื•ื‘ืŸ, the sender of the ืžืชื ื”, have ื—ืจื˜ื”, change his mind, and be ืžื‘ื˜ืœ that ืžืชื ื”? And since ืื‘ื™ื™ said that you are allowed to be ืžื‘ื˜ืœ a ืžืชื ื” when you send it with a ืฉืœื™ื—, obviously that when you gave it to the ืฉืœื™ื—, it didn't become ืฉืžืขื•ืŸ's yet, and therefore you're able to be ืžื‘ื˜ืœ it. So that proves that ื”ื•ืœืš ืœืื• ื›ื–ื›ื™ ื“ืžื™, ื”ื•ืœืš is not like ื–ื›ื™. Because if he would say ื–ื›ื™, if he would give it to the ืฉืœื™ื— and say be ื–ื•ื›ื” for ืฉืžืขื•ืŸ, then ื˜ืืงืข ืจืื•ื‘ืŸ, the sender, would not be able to be ืžื‘ื˜ืœ it. But since he did not say ื–ื›ื™, he said ื”ื•ืœืš, so ืฉืžืขื•ืŸ is not ื–ื•ื›ื” yet, not ืงื•ื ื” yet, and therefore ืจืื•ื‘ืŸ is allowed to be ืžื‘ื˜ืœ it. And the ื’ืžืจื continues,

Rabbinic Debate on ื‘ื™ื˜ื•ืœ Expressions (Ravina & Rav Nahman)

ืจื‘ื™ื ื ืืฉื›ื—ื™ื” ืœืจื‘ ื ื—ืžืŸ ื‘ืจ ื™ืฆื—ืง, ืจื‘ื™ื ื found ืจื‘ ื ื—ืžืŸ ื‘ืจ ื™ืฆื—ืง, ื“ืชืœื™ ื•ืงืื™, he was hanging on to ื‘ืขื™ื‘ืจื ื“ื“ืฉื, on to the hinge of the door, ื•ืงืžื™ื‘ืขื™ื ืœื™ื”, and while he was doing that, he asked him a question. ื‘ื˜ืœ ืžื”ื•? What would be the ื“ื™ืŸ if the husband uses the expression ื‘ื˜ืœ? He didn't say ื‘ื˜ืœ ื”ื•ื, because when we say ื‘ื˜ืœ ื”ื•ื, it said in the ืžืฉื ื” and the ื‘ืจื™ื™ืชื that that is valid. The ืฉืืœื” is if he just And the reason is as we said before, because when he says it should not help, it should not release, it should not let go, etc., so it's a ืœืฉื•ืŸ of ืœื”ื‘ื, a ืœืฉื•ืŸ for the future, and we said before if you use a ืœืฉื•ืŸ for the future, it's valid. But if he says it does not release, or it does not help, or it does not let go, or it does not divorce, etc., so he's not saying what it should do for the future, he is stating a fact that this ื’ื˜ does not help, this ื’ื˜ does not release, etc. So in a case like that, his words are not valid, because it is a ืœืฉื•ืŸ of the past. And we said before that when the husband uses a ืœืฉื•ืŸ of ืœืžืคืจืข, a ืœืฉื•ืŸ of the past, in the case of ื‘ื™ื˜ื•ืœ ื”ื’ื˜, his words are not valid. Then the ื’ืžืจื continues, ืื™ื‘ืขื™ื ืœื”ื•, they ask ื ื™ื‘ืขื™ They ask the question:

The "ื”ืจื™ ื”ื•ื ื—ืจืก" Expression in Gittin Cancellation

What would be if he uses the term ื”ืจื™ ื”ื•ื ื—ืจืก? It is ื—ืจืก, it is pottery. ืžื”ื•, what is the ื“ื™ืŸ? ืืžืจ ืœื™ื” ืจื‘ื™ื ื ืœืจื‘ ืื—ื ื‘ืจื™ื” ื“ืจื‘ื, ืจื‘ื™ื ื said to ืจื‘ ืื—ื, the son of ืจื‘ื, ื•ืืžืจื™ ืœื”, and others say, ืจื‘ ืื—ื ื‘ืจื™ื” ื“ืจื‘ื ืœืจื‘ ืืฉื™, that ืจื‘ ืื—ื, the son of ืจื‘ื, said to ืจื‘ ืืฉื™: ืžืื™ ืฉื ื, why should this be different ืžื”ืจื™ ื”ื•ื ื”ืงื“ืฉ, ื”ืจื™ ื”ื•ื ื”ืคืงืจ? From when a person uses the term: this shall be ื”ืงื“ืฉ or this should be ื”ืคืงืจ. We find many times in the ื’ืžืจื that when a person wants to be ืžืงื“ื™ืฉ something, when a person wants to give away an object that he owns, he wants to give it away to ื”ืงื“ืฉ, he wants to give it away to the fund that the ื‘ื™ืช ื”ืžืงื“ืฉ had for ื‘ื“ืง ื”ื‘ื™ืช, for the fixing of the ื‘ื™ืช ื”ืžืงื“ืฉ, etc., which was ื”ืงื“ืฉ. So if he uses the term ื”ืจื™ ื”ื•ื ื”ืงื“ืฉ, this shall be ื”ืงื“ืฉ, then that is valid and the object that he said it about becomes ื”ืงื“ืฉ, now belongs to the ื‘ื™ืช ื”ืžืงื“ืฉ, belongs to ื”ืงื“ืฉ. Or if a person wants to be ืžืคืงื™ืจ something, wants to drop his ownership over something, so when he says, ื”ืจื™ ื”ื•ื ื”ืคืงืจ, let this be ื”ืคืงืจ, so then the object becomes ื”ืคืงืจ. And over there, too, we understand that the only expression that would be valid if it's an expression that is for the future. Because he is talking about an object that belongs to him, an object that does not belong to ื”ืงื“ืฉ. What he wants to do is make it ื”ืงื“ืฉ from now, that now this object that till now belonged to him should become ื”ืงื“ืฉ. And the same in the case of ื”ืคืงืจ: the object belongs to him. He now wants to be ืžืคืงื™ืจ it ืžื›ืืŸ ื•ืœื”ื‘ื, from now and on. So the only expression that would help is an expression that means from now on. So it comes out that the expressions that should be used by ื”ืงื“ืฉ or by ื”ืคืงืจ have the same ื“ื™ืŸ as the expressions that should be used by ื‘ื™ื˜ื•ืœ ื”ื’ื˜. So therefore, just like by ื”ืงื“ืฉ and ื”ืคืงืจ, we see that if he used the expression ื”ืจื™ ื”ื•ื ื”ืงื“ืฉ or ื”ืจื™ ื”ื•ื ื”ืคืงืจ it is valid, so why shouldn't the expression ื”ืจื™ ื”ื•ื ื—ืจืก by the case of ื‘ื™ื˜ื•ืœ ื”ื’ื˜ also be valid? And that so he ืคืกืงื 'ื˜ that the ื“ื™ืŸ is that ื”ืจื™ ื”ื•ื ื—ืจืก is valid. Then the ื’ืžืจื continues with a ืฉืืœื”, with a question: ื—ื•ื–ืจ ื•ืžื’ืจืฉ ื‘ื• ืื• ืื™ื ื•

Can a Cancelled Gittah Be Used Again?

ื—ื•ื–ืจ ื•ืžื’ืจืฉ ื‘ื•? After the husband was ืžื‘ื˜ืœ the ื’ื˜, can he now use the same ื’ื˜ to divorce with it or can he not use the ื’ื˜ to divorce with it? In other words, the ืฉืืœื” is that when the husband is ืžื‘ื˜ืœ the ื’ื˜, does that mean that he is ืžื‘ื˜ืœ the ื’ื˜, that the ื’ื˜ itself, the ืฉื˜ืจ ื”ื’ื˜, the document itself is ื‘ื˜ืœ, is not valid anymore and it cannot be used anymore? Or is the ืคืฉื˜ that he is just ืžื‘ื˜ืœ the ืฉืœื™ื—ื•ืช, the ืฉืœื™ื—ื•ืช, the mission of the ืฉืœื™ื— is not valid anymore? The appointment that the ืžืฉืœื— appointed the ืฉืœื™ื— to do the ืฉืœื™ื—ื•ืช for him is ื‘ื˜ืœ. And since the ืฉืœื™ื— is not a ืฉืœื™ื— anymore, he has no right to give the ื’ื˜. But it has no effect on the document itself, on the ื’ื˜ itself. And therefore, if the husband decides now that he does want to divorce her, he is allowed to use the same ื’ื˜ to divorce her. And now he would just have to give it himself or appoint another ืฉืœื™ื—, or even to appoint the same ืฉืœื™ื—, but he have to re-appoint him again because the ืฉืœื™ื—ื•ืช that he appointed him before was ื‘ื˜ืœ. And that is the ืฉืืœื” of the ื’ืžืจื: Can he use the ื’ื˜ to divorce with it again or can he not use the ื’ื˜ to divorce with him again because not only the ืฉืœื™ื—ื•ืช is ื‘ื˜ืœ, but the ื’ื˜, too, is ื‘ื˜ืœ? And the ื’ืžืจื says, ืจื‘ ื ื—ืžืŸ ืืžืจ, ืจื‘ ื ื—ืžืŸ says, ื—ื•ื–ืจ ื•ืžื’ืจืฉ ื‘ื•, that he is allowed to use it now to divorce with it. ืจื‘ ืฉืฉืช ืืžืจ, but ืจื‘ ืฉืฉืช says, ืื™ื ื• ื—ื•ื–ืจ ื•ืžื’ืจืฉ ื‘ื•, that he's not allowed to use it to divorce with it. Because ืจื‘ ื ื—ืžืŸ holds that when you're ืžื‘ื˜ืœ the ื’ื˜ you're only ืžื‘ื˜ืœ the ืฉืœื™ื—ื•ืช, and therefore the ื’ื˜ remains a ื›ืฉืจ ื’ื˜. But ืจื‘ ืฉืฉืช holds that when you're ืžื‘ื˜ืœ the ื’ื˜, you're actually ืžื‘ื˜ืœ the ื’ื˜ itself, the document itself, and therefore you're not allowed to use it now. The ื’ืžืจื says, ื•ื”ืœื›ืชื ื›ื•ื•ืชื™ื” ื“ืจื‘ ื ื—ืžืŸ. The ื”ืœื›ื” is like ืจื‘ ื ื—ืžืŸ, that you are allowed to use the ื’ื˜ again because the ื’ื˜, the document, is not ื‘ื˜ืœ. The ื’ืžืจื asks a ืงืฉื™ื: ืื™ื ื™, it is not so? ื•ื”ื ืงื™ื™ืžื ืœืŸ, don't we ืคืกืงืŸ the ื“ื™ืŸ, ื”ืœื›ืชื ื›ื•ื•ืชื™ื” ื“ืจื‘ื™ ื™ื•ื—ื ืŸ, the ื”ืœื›ื” is like ืจื‘ื™ ื™ื•ื—ื ืŸ, ื“ืืžืจ, that he says ื—ื•ื–ืจืช, that she's allowed to change her mind? This is concerning a case where a person gives a woman money or ืฉื•ื” ื›ืกืฃ, an object which is worth money, in order to be ืžืงื“ืฉ her, and he says to her that you should be ืžืงื•ื“ืฉ to me, you should become my wife, after thirty days. He gives her the ืงื™ื“ื•ืฉื™ืŸ now, but he says that the ืงื™ื“ื•ืฉื™ืŸ should be ื—ืœ, the ืงื™ื“ื•ืฉื™ืŸ should take effect, only after thirty days. And there is a ืฉืืœื” whether within these 30 days she is allowed to have ื—ืจื˜ื”, she's allowed to change her mind. And ืจื‘ื™ ื™ื•ื—ื ืŸ says she is allowed to change her mind. And that's what we ืคืกืงืŸ, that the woman is allowed to change her mind within the 30 days. And what happens? The ืงื™ื“ื•ืฉื™ืŸ is not ื—ืœ, the ืงื™ื“ื•ืฉื™ืŸ takes no effect. And she must give the money back, and she is not ืžืงื•ื“ืฉืช, she is not a married woman. So we see from there that as long as the ืงื™ื“ื•ืฉื™ืŸ was not ื—ืœ, and you have ื—ืจื˜ื”, you change your mind from the ืงื™ื“ื•ืฉื™ืŸ, this is ืžื‘ื˜ืœ the whole ืงื™ื“ื•ืฉื™ืŸ, this cancels out the whole ืงื™ื“ื•ืฉื™ืŸ. So the same thing should be here, that when he is ืžื‘ื˜ืœ before the ื’ื˜ is ื—ืœ, he is ืžื‘ื˜ืœ the ื’ื˜, so the ื“ื™ืŸ should be that the whole ื’ื˜ should be ื‘ื˜ืœ, and you should not be able to use the ื’ื˜ again. So how can we say here that the ื”ืœื›ื” is like ืจื‘ ื ื—ืžืŸ, that you are allowed to use the ื’ื˜ again, when concerning the other ื“ื™ืŸ by the case of the ืงื™ื“ื•ืฉื™ืŸ, we say the ื”ืœื›ื” is like ืจื‘ื™ ื™ื•ื—ื ืŸ, that when you have ื—ืจื˜ื”, so then the whole ืงื™ื“ื•ืฉื™ืŸ is ื‘ื˜ืœ? So it seems to be a contradiction. The ื’ืžืจื answers, ื”ื›ื™ ื”ืฉืชื, what kind of comparison is it? ื”ืชื, over there in the case of ืงื™ื“ื•ืฉื™ืŸ, ื“ื™ื‘ื•ืจ ื•ื“ื™ื‘ื•ืจ ื”ื•ื, it's only words against words. Because what made the ืงื™ื“ื•ืฉื™ืŸ good in the beginning? Because she accepted the ืงื™ื“ื•ืฉื™ืŸ, she said she's ready to accept the ืงื™ื“ื•ืฉื™ืŸ. What is going to cancel the ืงื™ื“ื•ืฉื™ืŸ now? Again, her words, by her saying that she does not want the ืงื™ื“ื•ืฉื™ืŸ. So it's words, the second set of words, against the first set of words. So the ื›ืœืœ is ืืชื™ ื“ื™ื‘ื•ืจ ื•ืžื‘ื˜ืœ ื“ื™ื‘ื•ืจ, so the second words, the second statement, is ืžื‘ื˜ืœ, cancel out, the first statement. So therefore we say that the words of ืงื™ื“ื•ืฉื™ืŸ from before are ื‘ื˜ืœ, and the ืงื™ื“ื•ืฉื™ืŸ is no ืงื™ื“ื•ืฉื™ืŸ. But it has no effect on the money itself. The money now can be used by the man again to be ืžืงื“ืฉ a woman, because the money doesn't lose its ื“ื™ืŸ of ืงื™ื“ื•ืฉื™ืŸ, it's only the ื—ืœื•ืช ืงื™ื“ื•ืฉื™ืŸ, the effect of the ืงื™ื“ื•ืฉื™ืŸ that came through her acceptance of the ืงื™ื“ื•ืฉื™ืŸ is ื‘ื˜ืœ, because she said later on in her words that she does not want the ืงื™ื“ื•ืฉื™ืŸ. But ื”ื›ื, here in the case of ื’ื˜, ื ื”ื™, ื˜ืืงืข, even though ื“ื‘ื˜ืœื™ื” ืœืฉืœื™ื—ื•ืชื™ื” ื“ืฉืœื™ื—, that the husband was ืžื‘ื˜ืœ the ืฉืœื™ื—ื•ืช, the mission of the ืฉืœื™ื—, before he appointed him as a ืฉืœื™ื—. How did he appoint him as a ืฉืœื™ื—? Through words, through saying he should be the ืฉืœื™ื—. So now when he has ื—ืจื˜ื”, when he changes his mind, and he is ืžื‘ื˜ืœ the ืฉืœื™ื—, so his words that he says now cancel out the words of before when he appointed him as a ืฉืœื™ื—. Because for the same reason as we said before, ื“ื™ื‘ื•ืจ could be ืžื‘ื˜ืœ ื“ื™ื‘ื•ืจ. So therefore he could be ืžื‘ื˜ืœ the ืฉืœื™ื—ื•ืช of the ืฉืœื™ื—. But ื’ื™ื˜ื ื’ื•ืคื™ื”, the ื’ื˜ itself, ืžื™ ืงื ื‘ื˜ื™ืœ, could he be ืžื‘ื˜ืœ? The ื’ื˜ itself, which was a ืžืขืฉื”, it was written, it was done. So something that is a ืžืขืฉื”, ื“ื™ื‘ื•ืจ, words, cannot be ืžื‘ื˜ืœ a ืžืขืฉื”. So the husband cannot be ืžื‘ื˜ืœ the ื’ื˜ itself. And that's why ืจื‘ ื ื—ืžืŸ says, ื—ื•ื–ืจ ื•ืžื’ืจืฉ ื‘ื•, that he could divorce with it again, even though in the case of ืงื™ื“ื•ืฉื™ืŸ we ืคืกืงืŸ that when she has ื—ืจื˜ื” from the ืงื™ื“ื•ืฉื™ืŸ before it is ื—ืœ, the whole ืงื™ื“ื•ืฉื™ืŸ is ื‘ื˜ืœ, and there it is because there is no ืžืขืฉื” involved, while here there is a ื’ื˜, and the ื’ื˜ itself cannot become ื‘ื˜ืœ. Now the ื’ืžืจื goes back to the ืžืฉื ื” to explain the other parts of the ืžืฉื ื”. It said in the ืžืฉื ื”,

Forming a Beit Din Elsewhere to Cancel the Get

ื‘ืจืืฉื•ื ื” ื”ื™ื” ืขื•ืฉื”, in the beginning, a person would make a ื‘ื™ืช ื“ื™ืŸ in his own place and be ืžื‘ื˜ืœ the ื’ื˜ in front of the ื‘ื™ืช ื“ื™ืŸ. And he didn't have to reach the ืฉืœื™ื— or reach his wife. And ืจื‘ืŸ ื’ืžืœื™ืืœ ื”ื–ืงืŸ was ืžืชืงืŸ not to do that anymore, and the only way you could be ืžื‘ื˜ืœ a ื’ื˜ after the ืชืงื ื” of ืจื‘ืŸ ื’ืžืœื™ืืœ was only if you reach the ืฉืœื™ื— or you reach the wife. And the ื’ืžืจื says, ืื™ืชืžืจ, we learned, ื‘ืคื ื™ ื›ืžื” ื”ื•ื ืžื‘ื˜ืœื•, in front of how many was he able to be ืžื‘ื˜ืœ? When it said in the ืžืฉื ื” that originally the ื“ื™ืŸ was that you were allowed to be ืžื‘ื˜ืœ in front of a ื‘ื™ืช ื“ื™ืŸ, so the ื’ืžืจื's ืฉืืœื” is, what does that ื‘ื™ืช ื“ื™ืŸ mean? How many people? So ืจื‘ ื ื—ืžืŸ ืืžืจ, ืจื‘ ื ื—ืžืŸ says, ื‘ืคื ื™ ื‘', it was sufficient to do it in front of two people. ืจื‘ ืฉืฉืช ืืžืจ, ืจื‘ ืฉืฉืช said, ื‘ืคื ื™ ื’', that it had to be done in front of three people. And the ื’ืžืจื explains: ืจื‘ ืฉืฉืช ืืžืจ ื‘ืคื ื™ ื’', ืจื‘ ืฉืฉืช says it has to be in front of three. Where does he take that from? Very simple. ื‘ื™ืช ื“ื™ืŸ ืชื ืŸ, it says in the ืžืฉื ื” that he would do it in front of a ื‘ื™ืช ื“ื™ืŸ, and we all know a ื‘ื™ืช ื“ื™ืŸ is three people. But ืจื‘ ื ื—ืžืŸ ืืžืจ ื‘ืคื ื™ ื‘', ืจื‘ ื ื—ืžืŸ says it could be done in front of two people. ืื™, it says in the ืžืฉื ื” ื‘ื™ืช ื“ื™ืŸ, so he says, ืœื‘ื™ ืชืจื™ ื ืžื™ ื‘ื™ืช ื“ื™ืŸ ืงืจื• ืœื”ื•. Two people can only can also be called a ื‘ื™ืช ื“ื™ืŸ. And therefore, when it said in the ืžืฉื ื” that it was done in front of a ื‘ื™ืช ื“ื™ืŸ, it means in front of two people. The ื’ืžืจื says, ืืžืจ ืจื‘ ื ื—ืžืŸ, ืจื‘ ื ื—ืžืŸ said, ืžื ื ืืžื™ื ื ืœื”, where do I take this from? Where do I take this concept? that two people can also be called a ื‘ื™ืช ื“ื™ืŸ. Usually we know that three people make up a ื‘ื™ืช ื“ื™ืŸ. So ืจื‘ ื ื—ืžืŸ is trying to bring a ืจืื™ื” that two people can also be called a ื‘ื™ืช ื“ื™ืŸ. And he brings a ืจืื™ื” from a ืžืฉื ื”. And this is a ืžืฉื ื” concerning the ื“ื™ืŸ of ืคืจื•ื–ื‘ื•ืœ. ืคืจื•ื–ื‘ื•ืœ is a document that is written in connection with ืฉืžื™ื˜ื”, because the ื“ื™ืŸ is that when ืฉืžื™ื˜ื”, the seventh year, comes around, it is ืžืฉืžื˜ all the ื—ื•ื‘ื•ืช. This drops all the loans, that any loan that is owed by anybody, he does not have to pay. And then the ื“ื™ืŸ is that the ืžืœื•ื”, the one that is owed the money, the lender, is not allowed to claim the money, is not allowed to ask for the money. So it says in the ื’ืžืจื that ื”ืœืœ ื”ื–ืงืŸ saw that because of this ื“ื™ืŸ, people would not lend any money when it came close to ืฉืžื™ื˜ื”, because they were afraid that they would not pay up before ืฉืžื™ื˜ื”, and ืฉืžื™ื˜ื” would come and they would lose the money. And by not lending money before ืฉืžื™ื˜ื”, they were ืขื•ื‘ืจ on the ืคืกื•ืง where it says that a person must open his hand, lend money if he is able to. So ื”ืœืœ ื”ื–ืงืŸ saw that people were ืขื•ื‘ืจ on that ืขื‘ื™ืจื”, so he made a ืชืงื ื” that would help the person that he should be able to collect his money even after ืฉืžื™ื˜ื”. And he did this by making the ืชืงื ื” of ืคืจื•ื–ื‘ื•ืœ, which means that the ืžืœื•ื”, the lender, would write a ืฉื˜ืจ, would write a document, and in the document it would say that all the ื—ื•ื‘ื•ืช that he has, all the loans that are owed to him, he gives over to ื‘ื™ืช ื“ื™ืŸ, that the ื‘ื™ืช ื“ื™ืŸ should be the ones to collect the ื—ื•ื‘ื•ืช, not him. And the

ืคืจื•ื–ื‘ื•ืœ: Overcoming Shemitah Loan Restrictions

ื“ื™ืŸ is that only ื—ื•ื‘ื•ืช, loans that are owed to a private person, the ื“ื™ืŸ of ืฉืžื™ื˜ื” applies that you're not allowed to claim those ื—ื•ื‘ื•ืช. But if the ื‘ื™ืช ื“ื™ืŸ are the ones that are going to claim the ื—ื•ื‘ื•ืช, by them the ื“ื™ืŸ of ืฉืžื™ื˜ื” does not apply, they're allowed to do that. So what ื”ืœืœ was ืžืชืงืŸ was that you would write a ืฉื˜ืจ that you give over to the ื‘ื™ืช ื“ื™ืŸ all your ื—ื•ื‘ื•ืช, that they should collect it whenever they want. So when the ืžืœื•ื” would come later on to the ืœื•ื” with this ืฉื˜ืจ, and the ืœื•ื” would answer that I don't have to pay you because ืฉืžื™ื˜ื” passed, the ืžืœื•ื” would show him the ืฉื˜ืจ. In the ืฉื˜ืจ it says that the loan was given over to the ื‘ื™ืช ื“ื™ืŸ, and ืฉืžื™ื˜ื” is not ืžืฉืžื˜, and he still owes him the money. So we learn in the ืžืฉื ื”, ื“ืชื ืŸ, it says in the ืžืฉื ื” in ืฉื‘ื™ืขื™ืช, that what would say in the ืคืจื•ื–ื‘ื•ืœ, the ืœืฉื•ืŸ of the ืคืจื•ื–ื‘ื•ืœ was, ืžื•ืกืจื ื™ ืœืคื ื™ื›ื, I give over to you, ืคืœื•ื ื™ ื•ืคืœื•ื ื™ ื”ื“ื™ื™ื ื™ื, so and so and so and so, the judges, ืฉื‘ืžืงื•ื ืคืœื•ื ื™, that are in this specific place, I give over to you all my loans. And here we see that the ื“ื™ืŸ is that you have to give it over to ื“ื™ื™ื ื™ื, to judges, to a ื‘ื™ืช ื“ื™ืŸ, and nevertheless, the ืœืฉื•ืŸ of the ืžืฉื ื” is ืคืœื•ื ื™ ื•ืคืœื•ื ื™, two people: one person, ืคืœื•ื ื™, and another person. So here we see that even though there are only two people here, nevertheless, we call them ื“ื™ื™ื ื™ื, and this also makes up a ื‘ื™ืช ื“ื™ืŸ. So ืจื‘ ื ื—ืžืŸ says that from here I take my ื›ืœืœ that two people can also be called a ื‘ื™ืช ื“ื™ืŸ. So the ืงื•ืฉื™ื now in the ื’ืžืจื is, ื•ืจื‘ ืฉืฉืช, what would ืจื‘ ืฉืฉืช do? ืจื‘ ืฉืฉืช says it means three because it says in the ืžืฉื ื” ื‘ื™ืช ื“ื™ืŸ, but don't we see from that ืžืฉื ื” that two people are also called a ื‘ื™ืช ื“ื™ืŸ? And he answers, ืื˜ื• ืชื ื ื›ื™ ืจื•ื›ืœื, is the ืชื ื like a peddler, ืœื™ื—ืฉื™ื‘ ื•ืœื™ื–ื™ืœ, that he should mention, go on and mention everything? A peddler, whatever he has, he shows, and he says I have this, and I have that, and I have that, he mentions everything he has. The ืชื ื is not like a peddler. The ืชื ื does not have to say ืคืœื•ื ื™ ื•ืคืœื•ื ื™ ื•ืคืœื•ื ื™ to make sure that we understand it means three. He just said ืคืœื•ื ื™ ื•ืคืœื•ื ื™, he only mentioned two, but really he means three, because everyone knows a ื‘ื™ืช ื“ื™ืŸ is made up of three, so he doesn't have to tell us that. So he just mentioned ืคืœื•ื ื™ ื•ืคืœื•ื ื™ for us to get the idea, but really what he meant was ืคืœื•ื ื™ ื•ืคืœื•ื ื™ ื•ืคืœื•ื ื™, that they have to have three people. Then ืจื‘ ื ื—ืžืŸ continued, ืืžืจ ืจื‘ ื ื—ืžืŸ, ืจื‘ ื ื—ืžืŸ said, ืžื ื ืืžื™ื ื ืœื”, where do I take it from? I have another ืจืื™ื” that two people can be called a ื‘ื™ืช ื“ื™ืŸ concerning the same ื“ื™ืŸ of ืคืจื•ื–ื‘ื•ืœ. ื“ืชื ืŸ, we learn in the ืžืฉื ื” in ืฉื‘ื™ืขื™ืช, ื”ื“ื™ื™ื ื™ื ื—ื•ืชืžื™ืŸ ืœืžื˜ื” ืื• ื”ืขื“ื™ื, that when they write this ืฉื˜ืจ, this document, this ืคืจื•ื–ื‘ื•ืœ, and when it comes to sign, or the ื“ื™ื™ื ื™ื will

Who May Sign the Document: Judges or Witnesses

sign, the judges will sign, or the witnesses, the ืขื“ื™ื will sign. So here we see that the ืžืฉื ื” compares the witnesses to the ื“ื™ื™ื ื™ื, either of them could sign. ืžืื™ ืœืื•, don't you think, ื“ื™ื™ื ื™ื ื“ื•ืžื™ื ื“ืขื“ื™ื, that the ื“ื™ื™ื ื™ื are similar to the ืขื“ื™ื, since the ืžืฉื ื” says that the ื“ื™ื™ื ื™ื or the ืขื“ื™ื could sign, it puts them together on one line, so that shows that the ื“ื™ื™ื ื™ื are like the ืขื“ื™ื. ืžื” ืขื“ื™ื ืฉื ื™ื, just like the ืขื“ื™ื, the witnesses are only two, ืืฃ ื“ื™ื™ื ื™ื ื“ื™ื™ื ื™ื ื ืžื™ ืฉื ื™ื, the ื“ื™ื™ื ื™ื are also only two. So from here I take this ื“ื™ืŸ, that two people can be called a ื‘ื™ืช ื“ื™ืŸ. But ืจื‘ ืฉืฉืช, what would ืจื‘ ืฉืฉืช do to answer this question? Doesn't it seem to prove that ื“ื™ื™ื ื™ื are two because it says ื“ื™ื™ื ื™ื together with ืขื“ื™ื? So he says, ืžื™ื“ื™ ืื™ืจื™ื? Who compares it? Who forces us to say that they're both the same? ื”ื ื›ื“ืื™ืชื ื•ื”ื ื›ื“ืื™ืชื. This has its own ื“ื™ืŸ, and this has its own ื“ื™ืŸ. Because the ืžืฉื ื” says that the ื“ื™ื™ื ื™ื or the ืขื“ื™ื sign under the document, it doesn't mean that the ื“ื™ื™ื ื™ื are the same amount as the ืขื“ื™ื. If the ื“ื™ื™ื ื™ื sign, it's three, because the ื“ื™ื™ื ื™ื are three. If the ืขื“ื™ื sign, it's two. But it's no proof that the ื“ื™ื™ื ื™ื are like the ืขื“ื™ื, that just like the ืขื“ื™ื are two, the ื“ื™ื™ื ื™ื are two. Then the

Document Language vs. Signature: Judges or Witnesses

ื’ืžืจื goes to explain that ืžืฉื ื” that we just mentioned: ืœืžื” ืœื™ ืœืžื™ืชื ื™ ื“ื™ื™ื ื™ื, ืœืžื” ืœื™ ืœืžื™ืชื ื™ ืขื“ื™ื? Why does the ืžืฉื ื” have to tell us that either the ื“ื™ื™ื ื™ื or the ืขื“ื™ื are able to sign? It's self-understood. If the ืขื“ื™ื sign, then certainly it's good. That is the ื“ื™ืŸ of a ืฉื˜ืจ, that two ืขื“ื™ื, two witnesses sign a ืฉื˜ืจ, and that's a ื›ืฉืจ ืฉื˜ืจ. The same would apply if ื“ื™ื™ื ื™ื sign, if the judges sign, so it's also good. Because the ื“ื™ื™ื ื™ื are the ones that take care of the ืคืจื•ื–ื‘ื•ืœ. So if the ื“ื™ื™ื ื™ื themselves sign that we were the ื“ื™ื™ื ื™ื that took the ื—ื•ื‘ื•ืช of this person, so that certainly is good. So why does the ืžืฉื ื” have to tell us that whether the ื“ื™ื™ื ื™ื or the ืขื“ื™ื sign, it is valid? The ื’ืžืจื answers: ื”ื ืงื ืžืฉืžืข ืœืŸ, this comes to teach us a ื“ื™ืŸ, ื“ืœื ืฉื ื ื›ืชื‘ ื‘ืœืฉื•ืŸ ื“ื™ื™ื ื™ื, it makes no difference whether it was written in the expression, in the ืœืฉื•ืŸ of judges, of ื“ื™ื™ื ื™ื, ื•ื—ืชืžื™ ืขื“ื™ื, but ืขื“ื™ื were signed, ื•ืœื ืฉื ื ื›ืชื‘ ื‘ืœืฉื•ืŸ ืขื“ื™ื ื•ื—ืชืžื™ ื“ื™ื™ื ื™ื, and it makes no difference if it was written ื‘ืœืฉื•ืŸ of ืขื“ื™ื, and the ื“ื™ื™ื ื™ื signed. Because it's understood that when ื“ื™ื™ื ื™ื write a ืฉื˜ืจ, they write it in a form of ื“ื™ื™ื ื™ื. In other words, they would write that we, the judges, were sitting and this person came to us and gave us over all his ื—ื•ื‘ื•ืช. That is a ืœืฉื•ืŸ of ื“ื™ื™ื ื™ื. And then they would sign with the names of the ื“ื™ื™ื ื™ื, and each one would write his name and add at the end of his name, ื“ื™ื™ืŸ. If the ืฉื˜ืจ would be written by ืขื“ื•ืช, then they would write it differently. They would write that we, the ืขื“ื•ืช, testify that we saw this and this man come to the ื“ื™ื™ื ื™ื and gave over his ื—ื•ื‘ื•ืช to the ื“ื™ื™ื ื™ื, and they would sign their names and write the word ืขื“ after each name. But what would be if the ืœืฉื•ืŸ of the ืฉื˜ืจ, the ืœืฉื•ืŸ of the ืคืจื•ื–ื‘ื•ืœ, was written in a ืœืฉื•ืŸ of ื“ื™ื™ื ื™ื? It started off by saying we, the ื“ื™ื™ื ื™ื, sat together and this person came to us and gave us his ื—ื•ื‘ื•ืช. And at the end, when it came to the signatures, it wasn't signed by the ื“ื™ื™ื ื™ื, it was signed by the witnesses. Or the opposite, if it was a ืฉื˜ืจ written in the ืœืฉื•ืŸ of witnesses: We saw how this and this person came to the ื‘ื™ืช ื“ื™ืŸ and gave over his ื—ื•ื‘ื•ืช, and then it would be signed not by the witnesses, it would be signed by the three ื“ื™ื™ื ื™ื. So we would think it's not ื›ืฉืจ, because this doesn't coincide. The ืœืฉื•ืŸ of the ืฉื˜ืจ that's written for ื“ื™ื™ื ื™ื should be signed by ื“ื™ื™ื ื™ื. The ืœืฉื•ืŸ of the ืฉื˜ืจ written by ืขื“ื•ืช should be signed by the ืขื“ื•ืช. And that's the ื—ื™ื“ื•ืฉ of the ืžืฉื ื”. When the ืžืฉื ื” says that whether the ืขื“ื•ืช or the ื“ื™ื™ื ื™ื sign, it's okay, it comes to tell us that it makes no difference in which ืœืฉื•ืŸ the ืฉื˜ืจ was written, anybody who signs is okay. Whether it was written in the ืœืฉื•ืŸ of ื“ื™ื™ื ื™ื and the ืขื“ื™ื signed, or it was written in ืœืฉื•ืŸ of ืขื“ื•ืช and the ื“ื™ื™ื ื™ื signed, it is a ื›ืฉืจ ืฉื˜ืจ. Now we will go back to the beginning of the ื’ืžืจื, because there are a few important points to make.

Intent to Cancel a Gittah: When Is It Effective?

Earlier in the ื’ืžืจื, what we learned, that the ืžืฉื ื” teaches us that even if the husband tried to be ืžื‘ื˜ืœ the ื’ื˜ before, but didn't manage to do it till after the ื’ื˜ was given to his wife, so the ื’ืžืจื says that the ืžืฉื ื” tells us that we do not say ืื™ื’ืœืื™ ืžื™ืœืชื ืœืžืคืจืข, that this proves from before that he really was ืžื‘ื˜ืœ it before it got to her. But we say that the ื‘ื™ื˜ื•ืœ came after it got to her, and that ื‘ื™ื˜ื•ืœ is not valid. So ืชื•ืกืคื•ืช asks a ืงืฉื™ื, that this seems to contradict the ื’ืžืจื on ื“ืฃ ืœืดื“. Later on in the ื’ืžืจื on ื“ืฃ ืœืดื“, we find a ืžื—ืœื•ืงืช between ืื‘ื™ื™ and ืจื‘ื concerning the ื“ื™ืŸ of ื’ื™ืœื•ื™ ื“ืขืชื ื‘ื’ื™ื˜ื. That means that when somebody is ืžื’ืœื” ื“ืขืช, reveals his intentions in order to be ืžื‘ื˜ืœ a ื’ื˜, so then the ืฉืืœื” is, is that as if he was ืžื‘ื˜ืœ it or not? For instance, the story in the ื’ืžืจื is that somebody sent a ืฉืœื™ื— with a ื’ื˜ to his wife. And when he came to his wife, his wife said leave now and come back tomorrow. So the ืฉืœื™ื— did not give her the ื’ื˜, came back to the husband, and he said to the husband, you know she told me to come back tomorrow so I didn't give it to her. So the husband said, ื‘ืจื•ืš ื”ื˜ื•ื‘ ื•ื”ืžื˜ื™ื‘, thank God that you didn't give it. So the ืฉืืœื” in the ื’ืžืจื there is, is this considered that he was ืžื‘ื˜ืœ the ื’ื˜ or not? Because he did not actually use an expression of ื‘ื™ื˜ื•ืœ ื”ื’ื˜, he just expressed his intention that he is happy that the ื’ื˜ was not given. So ืื‘ื™ื™ says that ื’ื™ืœื•ื™ ื“ืขืชื ื‘ื’ื™ื˜ื ืœืื• ืžื™ืœืชื ื”ื™ื, that this does not mean anything, even though he said something and he did something which would be showing that he wants to be ืžื‘ื˜ืœ, but as long as he actually was not ืžื‘ื˜ืœ the ื’ื˜, the ื’ื˜ is not ื‘ื˜ืœ. But ืจื‘ื says that ื’ื™ืœื•ื™ ื“ืขืชื ื‘ื’ื™ื˜ื ืžื™ืœืชื ื”ื™ื, and that is enough and the ื’ื˜ is ื‘ื˜ืœ. Since we ืคืกืงืŸ like ืจื‘ื, so the ื“ื™ืŸ is that ื’ื™ืœื•ื™ ื“ืขืชื ื‘ื’ื™ื˜ื ืžื™ืœืชื ื”ื™ื, that if you're just ืžื’ืœื” ื“ืขืช for ื‘ื™ื˜ื•ืœ ื”ื’ื˜, that is sufficient and the ื’ื˜ is ื‘ื˜ืœ. So that seems to contradict our ื’ืžืจื here. Our ื’ืžืจื here says that if the husband tried to be ืžื‘ื˜ืœ before, we do not accept the ื‘ื™ื˜ื•ืœ. And over there ืจื‘ื says that if a person is not ืžื‘ื˜ืœ it, but just shows that he's trying to be ืžื‘ื˜ืœ it, that is sufficient and the ื’ื˜ is ื‘ื˜ืœ. And

Tosafot on Retroactive vs. Immediate Intent

ืชื•ืกืคื•ืช says that there is a big difference between these two cases. The case here, where the person wanted to be ืžื‘ื˜ืœ the ื’ื˜ and didn't manage to do it, for instance, he chased the ืฉืœื™ื— trying to be ืžื‘ื˜ืœ the ื’ื˜, but didn't get to him till after the ืฉืœื™ื— gave the ื’ื˜ to his wife. In a case like that, when he chased the ืฉืœื™ื—, we did not know what he had in mind. It's only after he was ืžื‘ื˜ืœ the ื’ื˜, after she got the ื’ื˜, when we found out what he had in mind when he chased the ืฉืœื™ื—. Because while he was chasing the ืฉืœื™ื—, as far as we're concerned, maybe he was trying to tell him, "Go ahead, give it to her faster, I want to get finished with it as fast as possible." There is no ืจืื™ื” from the act that he was doing that he wants to be ืžื‘ื˜ืœ the ื’ื˜. So that is not considered ื’ื™ืœื•ื™ ื“ืขืช ื‘ื’ื™ื˜ื. He is not revealing his mind that he wants to be ืžื‘ื˜ืœ it. The only reason we should think maybe it is ื‘ื™ื˜ื•ืœ, because of what he did later. And that's what the ืžืฉื ื” tells us, that we do not say ืื’ืœืื™ ืžื™ืœืชื ืœืžืคืจืข, that later the ื‘ื™ื˜ื•ืœ should help retroactive for what he did before. But in the case of ืจื‘ื, when he was ืžื’ืœื” ื“ืขืช, when he showed that he wants to be ืžื‘ื˜ืœ the ื’ื˜, which was before she got the ื’ื˜, we understood ื‘ืฉืขืช ืžืขืฉื”. At the moment he did it, we understood what he meant. So it's not that later on it proves what he had in mind before, but ื‘ืฉืขืช he tried to be ืžื‘ื˜ืœ the ื’ื˜, even though he didn't do it technically, he wasn't ืžื‘ื˜ืœ the ื’ื˜, but he did something that we at that moment understand that he wants to be ืžื‘ื˜ืœ the ื’ื˜. And therefore, if we hold ื’ื™ืœื•ื™ ื“ืขืชื ื‘ื’ื™ื˜ื ืžื™ืœืชื ื”ื™ื, that ื’ื™ืœื•ื™ ื“ืขืช is enough, so it's as if he was ืžื‘ื˜ืœ the ื’ื˜ then. But in the case of our ื’ืžืจื, where ื‘ืฉืขืช ืžืขืฉื”, even though he had in mind to be ืžื‘ื˜ืœ it, but we did not know about it till later, so that is not acceptable, because the ื›ืœืœ is that ื“ื‘ืจื™ื ืฉื‘ืœื‘ ืื™ื ื ื“ื‘ืจื™ื. Things that a person has in mind, words that he has in mind, but is not clear, we do not see it, we do not know it, ืื™ื ื ื“ื‘ืจื™ื, they're not considered words. So even if later on he says that, "I had in mind before to be ืžื‘ื˜ืœ it," and even if we would believe him, and we would say, "You're right, you ื˜ืืงืข had that in mind, we trust you," but since at that moment it was only ื“ื‘ืจื™ื ืฉื‘ืœื‘, they were only words of the mind, of the heart, they are not sufficient to be ืžื‘ื˜ืœ. And therefore in a case like that it is not ื‘ื˜ืœ. But in the case of ืจื‘ื it is not ื“ื‘ืจื™ื ืฉื‘ืœื‘, these are not words of the heart, of the mind, because we could see what he has in mind, because we see that he said for instance, "ื‘ืจื•ืš ื”ื˜ื•ื‘ ื•ื”ืžื˜ื™ื‘," so we know what he had in mind. And therefore in a case like that ืจื‘ื says ื’ื™ืœื•ื™ ื“ืขืชื ื‘ื’ื™ื˜ื is ืžื™ืœืชื ื”ื™ื, and it is a ื’ื˜ ื‘ื˜ืœ.

Rav Nachman vs. Rav Sheshet: Reusing a Gittah

Another important thing in the ื’ืžืจื here is concerning the ืžื—ืœื•ืงืช between ืจื‘ ื ื—ืžืŸ and ืจื‘ ืฉืฉืช, that ืจื‘ ื ื—ืžืŸ says that you're allowed to use the ื’ื˜ to divorce with it again, while ืจื‘ ืฉืฉืช says that you're not allowed to use this ื’ื˜ to divorce with it again. And the ื’ืžืจื said that why is this different than the case of ืงื™ื“ื•ืฉื™ืŸ? Because in the case of ืงื™ื“ื•ืฉื™ืŸ it is ื“ื™ื‘ื•ืจ ื•ื“ื™ื‘ื•ืจ, it is her second statement that is canceling out her first statement. But here it is not ื“ื™ื‘ื•ืจ ื•ื“ื™ื‘ื•ืจ, here it's not words against words. It is when the person is ืžื‘ื˜ืœ, his words could only help the first words, which was the appointment of the ืฉืœื™ื—, but he cannot be ืžื‘ื˜ืœ the ื’ื˜. And it seems like the ืคืฉื˜ is because the ื’ื˜ is not ื“ื™ื‘ื•ืจ, the ื’ื˜ is ืžืขืฉื”, the ื’ื˜ was done already. So the words of the husband cannot be ืžื‘ื˜ืœ the ืžืขืฉื” of the ื’ื˜. But ืชื•ืกืคื•ืช brings in that this is only according to the ื’ื™ืจืกื in our ื’ืžืจื. But the same ื’ืžืจื is in ืงื™ื“ื•ืฉื™ืŸ, and over there we have a different ื’ื™ืจืกื. And according to that ื’ื™ืจืกื it seems that not the ืคืฉื˜ that the husband cannot be ืžื‘ื˜ืœ the ื’ื˜, it is only that we do not assume that's what he meant. But if the husband would say clearly that he is intending to be ืžื‘ื˜ืœ the ื’ื˜, the ื’ื˜ would be ื‘ื˜ืœ, and we do not consider the ื’ื˜ ืžืขืฉื”. Because the ื’ืžืจื in ืงื™ื“ื•ืฉื™ืŸ says, not the way we have in our ื’ืžืจื, ื ื”ื™ ื“ื‘ื˜ืœื™ื” ืœืฉืœื™ื—ื•ืชื™ื” ื“ืฉืœื™ื—, ื’ื™ื˜ื ื’ื•ืคื™ื” ืžื™ ืงื ื‘ื˜ื™ืœ? The ื’ืžืจื there says it a little bit different: ื ื”ื™ ื“ื‘ื˜ืœื™ื” ืžืชื•ืจืช ืฉืœื™ื—ื•ืช, even though he was ืžื‘ื˜ืœ him from the ื“ื™ืŸ of ืฉืœื™ื—ื•ืช, ืžืชื•ืจืช ื’ื˜ ืœื ื‘ื˜ืœื™ื”, but from the ื“ื™ืŸ of ื’ื˜ he was not ืžื‘ื˜ืœ it. So from the way the ื’ืžืจื's ื’ื™ืจืกื is there, what it's saying is that even though the husband was ืžื‘ื˜ืœ him from ืฉืœื™ื—ื•ืช, the husband was not ืžื‘ื˜ืœ the ื’ื˜. So it seems to be saying that the reason the ื’ื˜ is not ื‘ื˜ืœ because the husband was not ืžื‘ื˜ืœ the ื’ื˜. But if the husband would clearly be ืžื‘ื˜ืœ the ื’ื˜, then the ื’ื˜ would be ื‘ื˜ืœ. While from our ื’ืžืจื it seems that even if the husband would clearly be ืžื‘ื˜ืœ the ื’ื˜, the ื’ื˜ would not be ื‘ื˜ืœ. Because the ื’ืžืจื uses the ืœืฉื•ืŸ, ื’ื™ื˜ื ื’ื•ืคื™ื” ืžื™ ืงื ื‘ื˜ื™ืœ? The ื’ื˜ itself, could it become ื‘ื˜ืœ? So as if the ื’ืžืจื is saying that the ื’ื˜ itself cannot become ื‘ื˜ืœ. And the reason for that is because the ื’ื˜ is considered ืžืขืฉื”, while from the ื’ืžืจื over there it seems that the whole reason is, ืžื™ ืงื ื‘ื˜ืœื™ื”, is he ืžื‘ื˜ืœ it? In other words, but if he would have been ืžื‘ื˜ืœ the ื’ื˜, the ื’ื˜ would have been ื‘ื˜ืœ.
