The 讙诪专讗 here is discussing the 讚讬谉 of the 诪砖谞讛 that if someone sells his 注讘讚 讻谞注谞讬 to a 讙讜讬 and then he runs away from the 讙讜讬, automatically that 注讘讚 becomes a 讘谉 讞讜专讬谉, becomes free. Here the 讙诪专讗 says, 转谞讜 专讘谞谉, the 专讘谞谉 learned, 讙讘讗讜 讘讞讜讘讜, if the 讙讜讬 collected the 注讘讚 讻谞注谞讬 of the 讬讬讚 for a debt that the 讬讬讚 owed to the 讙讜讬, 讗讜 砖诇拽讞讜 住讬拽专讬拽讜谉, or if 住讬拽专讬拽讜谉 took away an 注讘讚 讻谞注谞讬 from a 讬讬讚, 住讬拽专讬拽讜谉 were those people that would want to kill 讬讬讚谉, but a 讬讬讚, if he would give them something of value, then the 住讬拽专讬拽讜谉 would spare his life. So what happened is that the 住讬拽专讬拽讜谉 wanted to kill a 讬讬讚, and in order to save his life, he gave away to the 住讬拽专讬拽讜谉 his 注讘讚 讻谞注谞讬, 诇讗 讬爪讗 诇讞讬专讜转. In a case like that, if the 注讘讚 讻谞注谞讬 runs away from his 讙讜讬讬砖注 new master, he does not go out free, because he did not really sell him to the 讙讜讬 willingly, it was done by force. And the
讙诪专讗 asks, 讜讘讞讜讘讜 诇讗, and will you tell me that if the 讙讜讬 collects him for a debt that he owes him, it is not considered as if he sold him to the 讙讜讬? 讜专诪讬谞讛讜, I will ask you a 拽砖讬讗, we learned, 讛专讬 砖讗谞住讜 讘讬转 讛诪诇讱 讙讜专谞讜, if the officers of the king forced a 讬讬讚 to give up his 讙讜专谉, to give up his grain from his threshing field to the king, 讜讗诐 讘讞讜讘讜, if the reason they forced him to give it up was because he owed money to the 讘讬转 讛诪诇讱, 讞讬讬讘 诇注砖专, he must take off 诪注砖专, a tenth, from that crop that was taken away by the 讘讬转 讛诪诇讱, because we consider it as if he sold that 讙讜专谉 to the 讘讬转 讛诪诇讱. And the 讚讬谉 is that when you sell any of your crop, you must take off 诪注砖专. 讗诐 讘讗谞驻专讗讬, 驻讟讜专. If it was taken away just 讘讗谞驻专讗讬, 讗谞驻专讗讬 are those that just wanted to take it away by force, they caused 讬讬讚谉 to lose their property, and as 专砖"讬 explains later on on 讚祝 诪"讝 注诪讜讚 讘', they were not people who threatened the life of the 讬讬讚谉, but nevertheless they would take away belongings of the 讬讬讚谉. So if they took away the 讙讜专谉 for the 讘讬转 讛诪诇讱 just by force without him owing anything to the 讘讬转 讛诪诇讱, then 驻讟讜专 诪诇注砖专, then he is 驻讟讜专 from taking off 诪注砖专. So we see from here that if the king took it away for the 讞讜讘, it is considered as if he sold it to the king and he has to take off 诪注砖专. So how come by the case of 注讘讚, if a 讙讜讬 took away the 注讘讚 as payment for the loan, we don't consider it as if he sold the 注讘讚 to the 讙讜讬 and he does not go out free? And the 讙诪专讗 answers, 砖讗谞讬 讛转诐, there it's different, in the case of 诪注砖专 it's different, because 讚拽讗 诪讬转讛谞讬 诇讬讛, because he gains. Since this was taken away for payment of his loan, so now he gains that he doesn't owe the money anymore, so therefore it's considered as if he sold it. And by 诪注砖专 the 讚讬谉 is that if you sell your 讙讜专谉, then it is 驻讟讜专 from 诪注砖专. But by the case of 注讘讚, it is only a 拽谞住 that the 讞讻诪讬诐 fined the person for selling his 注讘讚 to a 讙讜讬. In a case where he actually didn't sell him, but it was taken away for the 讞讜讘, the 讞讻诪讬诐 did not fine him that his 注讘讚 should go out free. Then the 讙诪专讗 says,
转讗 砖诪注, come here, I will ask you a 拽砖讬讗. 讚讗诪专 专讘, 专讘 says, 讛诪讜讻专 注讘讚讜 诇驻专讛谞讙 注讻讜"诐, if a person sells his 注讘讚 讻谞注谞讬 to a 讙讜讬讬砖注 驻专讛谞讙, 驻专讛谞讙 专砖"讬 explains was a person who was an informer, he would go and 诪住讜专 the 讬讬讚谉, and the 讬讬讚 would have to pay him blackmail money, so the 讬讬讚 sold his 注讘讚 to this 驻专讛谞讙, so then 讬爪讗 诇讞讬专讜转, he does go out free. So even though he was forced to do it, he didn't sell him willingly, nevertheless since he did sell him to the 讙讜讬, he does go out free. So how come before we said that if the 讙讜讬 collects him for his 讞讜讘, or if the 住讬拽专讬拽讜谉 take him, so then he does not go out free? And the 讙诪专讗 answers, 讛转诐 讛讜讛 诇讬讛 诇驻讬讜住讬 讜诇讗 驻讬讬住, in the case of the 驻专讛谞讙, he should have persuaded him to take something else, and since he didn't do it and he gave him the 注讘讚, so we consider it as if he willingly gave away the 注讘讚. But in the case of the 讞讜讘 where the 讙讜讬 took him as a 讞讜讘, or if the 住讬拽专讬拽讜谉 took the 注讘讚, he couldn't have persuaded him to take anything else, so that we consider as if he was given away by force and there is no fine and he does not go out free. Then the 讙诪专讗 continues, 讙讜驻讗, now we will discuss the 讙讜祝, the saying, the statement itself that was mentioned before. We said before, 讗诪专 专讘, 专讘 said, 讛诪讜讻专 注讘讚讜 诇驻专讛谞讙 注讻讜"诐, if a person sells his 注讘讚 讻谞注谞讬 to a 讙讜讬讬砖注 驻专讛谞讙, 讬爪讗 诇讞讬专讜转, he automatically goes out free. And the 讙诪专讗 asks, 诪讗讬 讛讜讛 诇讬讛 诇诪注讘讚, what should he have done? Wasn't he taken away by force? And the 讙诪专讗 says, no, 讛讜讛 诇讬讛 诇驻讬讜住讬 讜诇讗 驻讬讬住, he should have persuaded him to take something else, and since he didn't, so it's as if he gave him away willingly and therefore he goes out free. And the 讙诪专讗 continues,
讘注讬 专讘讬 讬专诪讬讛, 专讘讬 讬专诪讬讛 asked a 讘注讬讗, asked a question, 诪讻专讜 诇砖诇砖讬诐 讬讜诐 诪讛讜? What is the 讚讬谉 if a 讗讬讚 sells his 注讘讚 讻谞注谞讬 to a 讙讜讬 just for 30 days? He doesn't sell him for permanent, he just sells him for 30 days, does he go out free, or doesn't he? And the 讙诪专讗 says, 转讗 砖诪注, come here, I'll answer your question. 讚讗诪专 专讘, 专讘 said, 讛诪讜讻专 注讘讚讜 诇驻专讛谞讙 注讜讘讚讬 讻讜讻讘讬诐 讬爪讗 诇讞讬专讜转. If you sell your 注讘讚 to a 驻专讛谞讙 a 讙讜讬, he goes out free. And at this point, the 讙诪专讗 felt that the 驻专讛谞讙 wouldn't take away the 注讘讚 completely. He would just take him to him to work for him. And when he would work for him the amount of money that he wanted the 讗讬讚 to give him, then he would send the 注讘讚 back to his owner. So, we see from here that even though the 注讘讚 will come back to the 讗讬讚, but since for the time being he was sold to a 讙讜讬, he goes out free. So, that answers 专讘讬 讬专诪讬讛's question that if you sell your 注讘讚 for 30 days to a 讙讜讬, he does go out free. And the 讙诪专讗 says, it's no 专讗讬讛, 讛转诐 there 讘驻专讛谞讙 注讜讘讚讬 讻讜讻讘讬诐 砖讗讬谞讜 诪讞讝专转. There it's speaking in a case where he sold him to a 驻专讛谞讙 a 讙讜讬, and he will not give him back. He didn't just take him to work for him for a certain amount of time, but the 驻专讛谞讙 took away the 注讘讚 completely that it becomes his. So, therefore, we have a 专讗讬讛 what would be the 讚讬谉 if you sell your 注讘讚 to a 讙讜讬 just for 30 days? Then the 讙诪专讗 asks another 砖讗诇讛:
诪讻专讜 讞讜抓 诪诪诇讗讻转讜 诪讛讜? The whole reason why the 讞讻诪讬诐 consend a person if he sells his 注讘讚 to a 讙讜讬 is because since the 注讘讚 is 诪讞讜讬讬讘 讘诪爪讜转, he's obligated to do the 诪爪讜转 like a woman, and by selling him to the 讙讜讬, he will not be able to keep the 诪爪讜转. That's why the 讞讻诪讬诐 made a 拽谞住 that he goes out free. Now, what would be if he sold him to the 讙讜讬, but except his work that he doesn't have to work for the 讙讜讬. And the reason the 讙讜讬 bought him was so the children that this 注讘讚 will have will belong to that 讙讜讬. So, in this case, you did not stop him from doing 诪爪讜转 because he doesn't work for the 讙讜讬 anyway. 诪讛讜? What is the 讚讬谉? Did the 讞讻诪讬诐 consend him or not? Does he go out free or not? Or if he sold him 讞讜抓 诪谉 讛诪爪讜转, he sold him to the 讙讜讬, but he said clearly except the 诪爪讜转, meaning that the 讙讜讬 will not stop him from doing the 诪爪讜转. 诪讛讜? What is the 讚讬谉? 讞讜抓 诪砖讘转讜转 讜讬诪讬诐 讟讜讘讬诐 诪讛讜? Or if he said, "I'm selling him for the work, but he shouldn't work 砖讘转讜转 and 讬诪讬诐 讟讜讘讬诐," so he will not transgress any 诪爪讜转. He will not do any 注讘讬专讜转. What is the 讚讬谉 there? 诇讙专 转讜砖讘, if you sold him to a 讙专 转讜砖讘. A 讙专 转讜砖讘 was a 讙讜讬 that was allowed to live in 讗专抓 讬砖专讗诇 because he accepted upon himself not to worship 注讘讜讚讛 讝专讛 and to keep all the seven 诪爪讜转 that the 讙讜讬讬诐 are obligated to keep. So, he's still a 讙讜讬, but he's considered a 讙专 转讜砖讘. So, what is the 讚讬谉 if you sell your 注讘讚 to a 讙专 转讜砖讘, does he go out free or not? 诇讬砖专讗诇 诪讜诪专, to an 讬砖专讗诇 a 诪讜诪专, a 讗讬讚 who worships 注讘讜讚讛 讝专讛, what is the 讚讬谉? 诇讻讜转讬 诪讛讜? What is the 讚讬谉 if you sell him to a 讻讜转讬? The 讻讜转讬讬诐 were people who kept some of the 诪爪讜转, and some of the 诪爪讜转 they didn't keep. And there is really a 诪讞诇讜拽转 in the 讙诪专讗 whether they were real 讙专讬诐, they were real converts and they had a 讚讬谉 of 讗讬讚谉, or they were 讙讬专讬 讗专讬讜转. They only converted because they were afraid at a certain point from lions and the way they saved their lives was by converting to 讗讬讚讬砖拽讬讬讟, but really they weren't 讙讬专讬 爪讚拽. They weren't true converts. But anyway, the 讙诪专讗 砖讗诇讛 here is: If you sell your 注讘讚 to a 讻讜转讬, does he go out free or not? And the 讙诪专讗 says, 驻砖讜讟 诪讬讛讗 讞讚讗, at least one we could answer from the 讘专讬讬转讗 that the 讙诪专讗 is going to bring. We learn in a 讘专讬讬转讗, 讙专 转讜砖讘 讛专讬 讛讜讗 讻注讜讘讚 讻讜讻讘讬诐, that a 讙专 转讜砖讘 has the same 讚讬谉 like a 讙讜讬. So, one of our questions before was if you sell your 注讘讚 to a 讙专 转讜砖讘, what is the 讚讬谉? So, here we see clearly that if you sell your 注讘讚 to a 讙专 转讜砖讘, it has the same 讚讬谉 as if you sold him to a 讙讜讬. But if you sold him to a 讻讜转讬 or 讬砖专讗诇 诪讜诪专, so then, 讗诪专讬 诇讛 讻注讜讘讚 讻讜讻讘讬诐, some say it has the same 讚讬谉 as if you sold him to a 讙讜讬, and he does go out free. 讜讗诪专讬 诇讛, and others say, 讻讬砖专讗诇, it has the same 讚讬谉 as if you would sell him to a 讗讬讚, and he does not go out free. Then the 讙诪专讗 continues,
讘注讜 诪讬谞讬讛 诪专讘 讗诪讬, there was a 讘注讬讗, a question asked from 专讘 讗诪讬: 注讘讚 砖讛驻讬诇 注爪诪讜 诇讙讬讬住讜转, an 注讘讚 that let himself be captured by bandits 讜讗讬谉 专讘讜 讬讻讜诇 诇讛讜爪讬讗讜, and his master cannot take him out from there, cannot get him free from there, 诇讗 讘讚讬谞讬 讬砖专讗诇 讜诇讗 讘讚讬谞讬 注讜讘讚讬 讻讜讻讘讬诐, not according to the Jewish 讚讬谞讬诐, not through the Jewish courts, and not through the legal goyishe courts, 诪讛讜 砖讬讟讜诇 讚诪讬讜? What is the 讚讬谉, can he take money for him? If he is offered money for that 注讘讚, is he allowed to take the money for that 注讘讚? Look into your notes. Look into the things that you learned and find the answer to this question. 谞驻拽, he went out, 讚拽, he looked into it, 讜讗砖讻讞, and he found the answer. 讚转谞讬讗, we learned in a 讘专讬讬转讗, 讛诪讜讻专 讘讬转讜 诇注讜讘讚讬 讻讜讻讘讬诐, if someone sells his house to a 讙讜讬, and this is in 讗专抓 讬砖专讗诇, because the 讚讬谉 is that in 讗专抓 讬砖专讗诇 you are not allowed to sell a house to a 讙讜讬, because there's a 驻住讜拽 that says 诇讗 转讞谞诐, and it means do not give them a 讞谞讬讛 讘拽专拽注, do not give a 讙讜讬 an inheritance of land in 讗专抓 讬砖专讗诇. So a 讗讬讚 is not allowed to give or sell a land to a 讙讜讬 in 讗专抓 讬砖专讗诇. If a 讗讬讚 did do it, 讚诪讬讜 讗住讜专讬谉, the money he gets for it is 讗住讜专, he is forbidden to use that money. 讗讘诇 注讜讘讚 讻讜讻讘讬诐 砖讗谞住 讘讬转讜 砖诇 讬砖专讗诇, but if a 讙讜讬 forced the 讗讬讚 out of his house and took over the 讗讬讚's house in 讗专抓 讬砖专讗诇, 讜讗讬谉 讘注诇讬讜 讬讻讜诇 诇讛讜爪讬讗讜, and the master, the original owner, cannot get it out of the 讙讜讬, 诇讗 讘讚讬谞讬 讬砖专讗诇 讜诇讗 讘讚讬谞讬 注讜讘讚讬 讻讜讻讘讬诐, not through the Jewish courts and not through the 讙讜讬讬讗讬砖注 courts, 诪讜转专 诇讬讟讜诇 讗转 讚诪讬讜, then he's allowed to take the money for that house, 讜讻讜转讘 讜诪注诇讛 讘注专讻讗讜转 砖诇讛谉, and he's even allowed to have a document written up in the 讙讜讬讬讗讬砖注 courts. Even though normally you shouldn't go to the 讙讜讬讬讗讬砖注 courts, but in this case, in order to secure his money, he's allowed to go and have a document, a deed, written in the 讙讜讬讬讗讬砖注 courts, 诪驻谞讬 砖讛讜讗 讻诪爪讬诇 诪讬讚诐, because this is only as if he is saving the money from the hands of the 讙讜讬诐. Since he can't get the house back anyway, so at least let him get get the money back. So we see from there that in a case where normally if you sell it you can't use the money, nevertheless if it's not your fault and you can't get it back, you are allowed to take the money for it. So the same thing with the 注讘讚, that if the 注讘讚 was taken away by bandits and you can't get it out, so then you are allowed to take the money for that 注讘讚. And the 讙诪专讗 says, no, 讜讚讬诇诪讗 maybe 讛谞讬 诪讬诇讬 讘讬转, maybe this is only said in the case of a house, 讚讻讬讜讜谉 讚诇讗 住讙讬 诇讬讛 讘诇讗 讘讬转, since it is impossible for a person to be without a house, 诇讗 讗转讬 诇讝讘讜谞讬讛, he will not sell it. In other words, the reason the 讙诪专讗 thought why maybe the 讞讻诪讬诐 would say that you're not allowed to take the money for the house even though the house was taken away by force, was because if the 讞讻诪讬诐 would allow to take the money in this case, other people would learn from this case and they would think that you're 诇讻转讞讬诇讛 allowed to sell a house to a 讙讜讬 in 讗专抓 讬砖专讗诇. So therefore, we thought the 讞讻诪讬诐 said that even if it was taken by force you cannot take the money, so nobody will sell their houses to a 讙讜讬. So that's why we understand that the 讚讬谉 in this case is not so. The 讚讬谉 is that you are allowed to take the money because by a house it is a far-fetched 讙讝讬专讛, because people need houses. So it's hard to say that a person will because of this 讚讬谉 also sell their house to a 讙讜讬, because it is not common for a person to sell a house because a person must have a house. 讗讘诇 注讘讚, but by the case of an 注讘讚, 讚住讙讬 诇讬讛 讘诇讗 注讘讚, it is possible for a person to be without an 注讘讚, so 讗转讬 诇讝讘讜谞讬讛, so then he might come to sell it. If we're going to say that in the case where the 注讘讚 fell into the hands of bandits and you can't take him out, the 讚讬谉 is you're allowed to take the money, so other people will think that you're 诇讻转讞讬诇讛 allowed to sell an 注讘讚 to a 讙讜讬. And therefore the 讞讻诪讬诐 maybe did make a 讙讝讬专讛. 讗讜 诇讗, or maybe no, that the 讞讻诪讬诐 even in the case of 注讘讚 didn't make a 讙讝讬专讛. In other words, we have no 专讗讬讛 from 讘讬转, because by the case of a house there is more 住讘专讗 for the 讞讻诪讬诐 not to make a 讙讝讬专讛 and therefore they said that you're allowed to take the money, and maybe by an 注讘讚 the 讞讻诪讬诐 did make a 讙讝讬专讛 or maybe not. So we still have no 专讗讬讛, what will be the 讚讬谉 in this case. 砖诇讞 诇讛讜 专讘 讗诪讬, so 专讘 讗诪讬 sent them the answer: 诪讬谞讬 讗诪讬 讘专 谞转谉 转讜专讛 讬讜爪讗讛 诇讻诇 讬砖专讗诇, from me, 讗诪讬 讘专 谞转谉, the 转讜专讛, the 讛诇讻讛 will go out to all the 讗讬讚谉. And what is the 讛诇讻讛? 注讘讚 砖讛驻讬诇 注爪诪讜 诇讙讬讬住讜转, that an 注讘讚 that let himself be captured by bandits, 讜讗讬谉 专讘讜 讬讻讜诇 诇讛讜爪讬讗讜, and his master cannot get him out from there, 诇讗 讘讚讬谞讬 讬砖专讗诇 讜诇讗 讘讚讬谞讬 注讜讘讚讬 讻讜讻讘讬诐, not through the Jewish 讚讬谞讬诐 and not through the 讙讜讬讬讗讬砖注 讚讬谞讬诐, the 讚讬谉 is 诪讜转专 诇讬讟讜诇 讗转 讚诪讬讜, he's allowed to take the money for that 注讘讚 if he is offered, 讜讻讜转讘, and he's allowed to write, 讜诪注诇讛 讘注专讻讗讜转 砖诇 注讜讘讚讬 讻讜讻讘讬诐, and bring it up in the 讙讜讬讬讗讬砖注 courts, he's allowed to have a document, a deed, written even in the 讙讜讬讬讗讬砖注 courts, and take the money for it, 诪驻谞讬 砖讛讜讗 讻诪爪讬诇 诪讬讚诐, because this is as if he's saving the money. Because if he wouldn't do that, the 注讘讚 would anyway stay in the hands of the 讙讜讬诐, so he might as well save the money for the 讗讬讚, and therefore he's allowed to take the money, and not only allowed to take the money, he's even allowed to have a document written up in the courts of the 讙讜讬诐. Then the 讙诪专讗 continues,
讗诪专 专讘讬 讬讛讜砖注 讘谉 诇讜讬, 专讘讬 讬讛讜砖注 讘谉 诇讜讬 said, 讛诪讜讻专 注讘讚讜 诇注讜讘讚讬 讻讜讻讘讬诐, if a person sells his 注讘讚 to a 讙讜讬, 拽讜谞住讬谉 讗讜转讜 注讚 诪讗讛 讘讚诪讬讜, they 拽谞住 him, and the 讞讻诪讬诐 fine him that he's supposed to buy him back, redeem him, even up to a hundred times his value. And the 讙诪专讗 asks a question: 讚讜讜拽讗 讗讜 诇讗讜 讚讜讜拽讗, when we say that he has to buy him back even up to a hundred times his value, is it 讚讜讜拽讗 that even that much you must pay for the 注讘讚, or it's 诇讗讜 讚讜讜拽讗? It's just an exaggeration, but what it means is that you must buy him back even if it's more than his value, but it doesn't really mean a hundred times his value. The 讙诪专讗 says 转讗 砖诪注, come here, I'll answer your question. 讗诪专 专讬砖 诇拽讬砖, 专讬砖 诇拽讬砖 said, 讛诪讜讻专 讘讛诪讛 讙住讛 诇注讜讘讚 讻讜讻讘讬诐, if someone sells a big animal, for instance an ox or similar to an ox, to a 讙讜讬, 拽讜谞住讬谉 讗讜转讜, the 讞讻诪讬诐 fined him, 注讚 注砖专讛 讘讚诪讬讛, up to ten times its value, that he must buy it back from the 讙讜讬 even if he has to pay ten times its value. Because the 讚讬谉 is that you're not allowed to sell a 讘讛诪讛 讙住讛, an ox etc., to a 讙讜讬. And the reason for that is because we're afraid that the 讙讜讬 will work with that 讘讛诪讛 on 砖讘转. And even though the 讘讛诪讛 that is sold to a 讙讜讬 is his, and that 讘讛诪讛 is allowed to do work on 砖讘转, it is only a 讬讬讚's 讘讛诪讛 that is not allowed to work on 砖讘转, but still the 讞讻诪讬诐 made a 讙讝讬专讛, as the 讙诪专讗 explains in 注讘讜讚讛 讝专讛 讚祝 讟讜, that we're afraid if we're going to allow a 讬讬讚 to sell a 讘讛诪讛 讙住讛 to a 讙讜讬, another 讬讬讚 is going to lend it to him, another 讬讬讚 is going to rent it to him, or sometimes even when the 讙讜讬 is going to want to buy the 讘讛诪讛, he might want to test it first, take it for a test drive first, and he might do that on 砖讘转 while it still belongs to the 讬讬讚, and that is not allowed. And because of that the 讞讻诪讬诐 said you're not even allowed to sell a 讘讛诪讛 讙住讛 to a 讙讜讬. And this is the 讚讬谉 here, that if you sell a 讘讛诪讛 讙住讛 to a 讙讜讬, the 讞讻诪讬诐 said that you must buy it back even to pay up to ten times its value. But what do we see here? That the 讚讬谉 is only up to ten times its value. So that proves that when we said before, that if you sell an 注讘讚 to a 讙讜讬, you must buy him back even up to a hundred times his value, that was really an exaggeration. Really it is only up to ten times its value. And the
讙诪专讗 says no, what's the comparison? 讜讚讬诇诪讗 砖讗谞讬 注讘讚, maybe an 注讘讚 is different, 讚讻诇 讬讜诪讗 讜讬讜诪讗 诪驻拽注 诇讬讛 诪谉 诪爪讜转, that every day he took him out of the 诪爪讜转. By the case of the 讘讛诪讛, he did an 注讘讬专讛 once, he sold this 讘讛诪讛 to the 讙讜讬 when he wasn't allowed, so the 讞讻诪讬诐 fined him only to buy it back up to ten times its value. But by the 注讘讚, since the 注讘讬专讛 is much greater, because constantly you have made him not do any 诪爪讜转, so therefore maybe here the 讞讻诪讬诐 made a stronger fine, that you must buy him back even up to a hundred times his value. 讗讬讻讗 讚讗诪专讬, others say that this statement was different: 讗诪专 专讘讬 讬讛讜砖注 讘谉 诇讜讬, 专讘讬 讬讛讜砖注 讘谉 诇讜讬 said, 讛诪讜讻专 注讘讚讜 诇注讜讘讚 讻讜讻讘讬诐, someone sells his 注讘讚 to a 讙讜讬, 拽讜谞住讬谉 讗讜转讜 注讚 注砖专讛 讘讚诪讬讜, the 讞讻诪讬诐 fined him up to ten times its value, that he must buy it back even if he has to pay up to ten times its value. And here the 讙诪专讗 asks, 讚讜讜拽讗 讗讜 诇讗讜 讚讜讜拽讗, is this ten times 讚讜讜拽讗, only up to ten times and not more, or not, or really it's only an example that we mentioned, that 专讘讬 讬讛讜砖注 讘谉 诇讜讬 mentioned, and really what it is that you have to buy him even for much more than ten times value? The 讙诪专讗 says 转讗 砖诪注, come here, I will answer your question: 讚讗诪专 专讬砖 诇拽讬砖, 专讬砖 诇拽讬砖 said, 讛诪讜讻专 讘讛诪讛 讙住讛 诇注讜讘讚 讻讜讻讘讬诐, if someone sells a 讘讛诪讛 讙住讛 to a 讙讜讬, 拽讜谞住讬谉 讗讜转讜 注讚 诪讗讛 讘讚诪讬讛, you fine him up to a hundred times its value. This was the 讙讬专住讗 according to this 诇砖讜谉 in the 讙诪专讗. So we see from here that by the case of the 讘讛诪讛 讙住讛, they fined him up to a hundred times its value. That proves that when we said by the case of the 注讘讚 that he only buys him back up to ten times its value, it is not 讚讜讜拽讗, it is just an example, but really it is even much more. Really the 讚讬谉 is that up to a hundred times its value you must buy him back. And the 讙诪专讗 says it's no 专讗讬讛 from the case of the 讘讛诪讛 to the case of the 注讘讚, because 砖讗谞讬 注讘讚, 注讘讚 is different, 讚诇讗 讛讚专 诇讬讛, the 注讘讚 will not go back to him, because the 讚讬谉 is even after he will redeem him from the 讙讜讬, we said before 讬爪讗 诇讞讬专讜转, the 注讘讚 will go out free. So the owner of the 注讘讚 will not keep the 注讘讚, so therefore maybe the 讞讻诪讬诐 didn't fine him that much, that he should have to buy him back for a hundred times his value, but only up to ten times his value, because even when he redeems him, he's not going to keep him. But by the case of the 讘讛诪讛, since when he will buy the 讘讛诪讛 back from the 讙讜讬, he will keep the 讘讛诪讛, so maybe here the 讞讻诪讬诐 fined him even more, that he has to buy him back even if it's a hundred times its value. But the 讙诪专讗 asks a 拽砖讬讗 on that, 讗诇讗 讘讛诪讛, but by 讘讛诪讛 you're telling me, 讟注诪讗 诪讗讬, what is the reason why we say we fined him up to a hundred times its value? 诪砖讜诐 讚讛讚专讗 诇讬讛, because he will get it back, 诇讬谞拽讟讬讛 讘讞讚, so let him just be 拽谞住, be fined with one more. The difference between 注讘讚 and 讘讛诪讛 is that by the 注讘讚 he's not going to keep the 注讘讚, by 讘讛诪讛 he will keep the 讘讛诪讛, so he should be fined that by the 讘讛诪讛 he should have to pay with one more than by the 注讘讚, because by the 讘讛诪讛 he will get the 讘讛诪讛
itself, so he will get with one time the value of the 讘讛诪讛 to himself. So therefore what should be the 讚讬谉? That he should be fined only that, not should he have to pay ten times its value. value, whether it should be eleven times its value. Because here, that extra one time will go back to him is not really a loss, because he will get the 讘讛诪讛 back. But not a hundred times its value. You can't give me a reason why here it's a hundred times the value, because he will get the 讘讛诪讛 back, which is only once its value. And the 讙诪专讗 answers a different 转讬专讜抓: 讗诇讗 注讘讚 诪讬诇转讗 讚诇讗 砖讻讬讞讗. The case of 注讘讚, that a 讗讬讚 should sell an 注讘讚 to a 讙讜讬, is a case which is not common. 讜诪讬诇转讗 讚诇讗 砖讻讬讞讗 诇讗 讙讝专讜 讘讛 专讘谞谉. And in a case which is not common, the 讞讻诪讬诐 did not make any 讙讝讬专讜转. And therefore, even though in this case they did make a 讙讝讬专讛, but they didn't make the 讙讝讬专讛 that strict. So in the case of a 讘讛诪讛, where it's very common to sell a 讘讛诪讛 to a 讙讜讬, so the 讞讻诪讬诐 were much stricter, and they said, you have to buy it back even if it costs you a hundred times its value. But in the case of an 注讘讚, since it's not common, they weren't strict in their decree, in their 讙讝讬专讛, and they said, only up to ten times its value you must buy it back, but if it's more than that, you don't have to buy him back. This is the way 专砖状讬 learns the 驻砖讟 in this 讙诪专讗. 转讜住驻讜转 learns the 驻砖讟 in this 讙诪专讗 a little bit differently, concerning the first 诇砖讜谉 of the 讙诪专讗, where 专讘讬 讬讛讜砖注 讘谉 诇讜讬 said that by the case of an 注讘讚, you must buy him back a hundred times its value. And the 讙诪专讗 asked whether it's 讚讜拽讗 or 诇讗讜 讚讜拽讗. So according to 专砖状讬, as we said before, the 驻砖讟 is that the 讙诪专讗 砖讗诇讛 is, is a hundred exactly, or really it doesn't mean a hundred, it means less? And the 讙诪专讗 brought a proof from the case of the 讘讛诪讛 that you only buy him back up to ten times its value, and that proved that it doesn't really mean a hundred, it only means ten. But in the
second 诇砖讜谉 of the 讙诪专讗, where 专讘讬 讬讛讜砖注 讘谉 诇讜讬 had said that if you sell your 注讘讚 you must buy him back for ten times his value, and there the 讙诪专讗 also asked, is it 讚讜拽讗 or 诇讗讜 讚讜拽讗? There 专砖状讬 learned that the 砖讗诇讛 of the 讙诪专讗 was that's ten 讚讜拽讗, or maybe it is more than ten. And the 讙诪专讗 brought a 专讗讬讛 from the case of a 讘讛诪讛 that it's more than ten, because over there we see it's up to a hundred. But 转讜住驻讜转 learns the 驻砖讟 in that 讙诪专讗 different. 转讜住驻讜转 learns that also in the first 诇砖讜谉 of the 讙诪专讗, when 专讘讬 讬讛讜砖注 讘谉 诇讜讬 said that you have to buy him back for a hundred times his value, and the 讙诪专讗 asked, 讚讜拽讗 or 诇讗讜 讚讜拽讗, the 拽砖讬讗 was also: is a hundred 讚讜拽讗, only a hundred, or maybe it is more than a hundred? And to that the 讙诪专讗 brought a 专讗讬讛 from the case of 讘讛诪讛, that it says you only buy it back for ten times its value. So we see that it's 诇讗讜 讚讜拽讗, because when it says there ten times its value, definitely does not mean only ten times, because we see here in the case of 注讘讚 that you had to pay a hundred times its value. So we see where the 讙诪专讗 gives an amount, it doesn't mean 讚讜拽讗 that amount, it could mean more. 讜诪诪讬诇讗 by the case of 注讘讚 where it says a hundred times its value, it is 诇讗讜 讚讜拽讗, maybe it could mean more. In other words, 转讜住驻讜转 learns in the first 诇砖讜谉 of the 讙诪专讗 where the 讙诪专讗 asks 讚讜拽讗 or 诇讗讜 讚讜拽讗, the 砖讗诇讛 is also, is it more or is it exactly? Not like 专砖状讬 who learns in the first 诇砖讜谉 that the 讙诪专讗 砖讗诇讛 was, is it a hundred 讚讜拽讗, or is it maybe less? And now we'll continue with the 讙诪专讗:
讘注讜 诪讬谞讬讛 讚专讘讬 讬专诪讬讛 诪专讘讬 讗讘讗, 专讘讬 讬专诪讬讛 asked in a 讘注讬讗, a 砖讗诇讛 from 专讘讬 讗讘讗: 诪讻专 注讘讚讜 讜诪转, a 讗讬讚 sold his 注讘讚 讻谞注谞讬 to a 讙讜讬 and he died, 诪讛讜 砖讬拽谞住讜 讗转 讘谞讜 讗讞专讬讜, what is the 讚讬谉, did the 讞讻诪讬诐 拽谞住'谉, fine his son after him? If he himself would be alive, the 讞讻诪讬诐 would force him to buy that 注讘讚 back. But since he died, and now his son inherited all his possessions, did the 讞讻诪讬诐 force the son too, that he should also buy him back? And there was a similar question asked, and it would seem that whatever the answer to that similar question would be, would apply here too. And that similar question is concerning a 讻讛谉 who made a 诪讜诐 in a 讘讻讜专. A 讘讻讜专 is a firstborn 讘讛诪讛, and the 讚讬谉 is that that must be given to the 讻讛谉, and that 讘讛诪讛 is a 拽专讘谉. That 讘讻讜专 turns into 拽讚砖讬诐, is a 拽专讘谉. If that 讘讻讜专 gets a 诪讜诐, gets a blemish, so the 讚讬谉 is then you're allowed to 砖讞讟 that 讘讛诪讛, and it's allowed to be eaten as 讞讜诇讬谉. The 讚讬谉 is also that you are not allowed to make a 诪讜诐 in a 讘讻讜专. There's a 驻住讜拽 that says 讻诇 诪讜诐 诇讗 讬讛讬讛 讘讜, that no 诪讜诐 should be in it, and from here we learn out that you are not allowed to make a 诪讜诐 in a 讘讻讜专. You're not allowed to mutilate that 讘讻讜专. Now the 讚讬谉 is that if a 讻讛谉 did mutilate, did cause a 诪讜诐 in the 讘讻讜专, so the 讞讻诪讬诐 拽谞住'谉 him that that 讘讻讜专 could never be slaughtered, could never be geschacht, and never be eaten. And there was a 砖讗诇讛 in 讙诪专讗 in 讘讻讜专讜转, what would be if a 讻讛谉 caused a 诪讜诐 in the 讘讻讜专, and then he died? Does the 拽谞住 that the 讞讻诪讬诐 put on this 讘讻讜专 apply to the son that inherits the possessions of his father, too? In other words, is the son allowed to 砖讞讟 that 讘讻讜专 that has the 诪讜诐, or not? And it would seem that whatever the answer to that question would be, would apply to our case, too, in the case where the father sold the 注讘讚 讻谞注谞讬 to a 讙讜讬, and then died, whether the 拽谞住 applies to the son or not. But the 讙诪专讗 continues and says: 讗诐 转诪爪讬 诇讜诪专, if you're going to want to tell me and 驻住拽'谉 the 讚讬谉, that if 爪专诐 讗讜讝谉 讘讻讜专 讜诪转, that if a person split the ear of the 讘讻讜专, and that is just an example of a 诪讜诐, and he died, 拽谞住讜 讘谞讜 讗讞专讬讜, they did make the 拽谞住 for the son, so I would think the same thing would be in the case of the 注讘讚, that they did 拽谞住 the son that he should have to redeem the 注讘讚, I could say no, there is no proof from there. 诪砖讜诐 讚讗讬住讜专讗 讚讗讜专讬讬转讗. Over there, making a 诪讜诐 in a 讘讻讜专 is a 讗讬住讜专 讚讗讜专讬讬转讗, and therefore the 讞讻诪讬诐 were stricter in the 拽谞住, and they applied it to the son too. 讗讘诇 讛讻讗, but in this case where he sold the 注讘讚, 讗讬住讜专讗 讚专讘谞谉, that is only 讗讬住讜专 讚专讘谞谉, and therefore maybe here the 讞讻诪讬诐 did not apply this 拽谞住 to the son. There is another place where there was a similar question asked, and we might think that whatever the 驻住拽 讚讬谉 will be there will be here too. There is a 讚讬谉 that you are not allowed to do a 诪诇讗讻讛 on 讞讜诇 讛诪讜注讚, on the days between the first day 讬讜诐 讟讜讘 and the last day 讬讜诐 讟讜讘 on 驻住讞 and on 住讜讻讜转. On the other hand, there is a 讚讬谉 that certain 诪诇讗讻讜转 under certain circumstances you are allowed to do. For instance, a 讚讘专 讛讗讘讚. If it is something that if you will not do the 诪诇讗讻讛, the work, it'll get spoiled, then you are allowed to do it on 讞讜诇 讛诪讜注讚. There is also another 讚讬谉 that you are not allowed to start the 诪诇讗讻讛 before 讬讜诐 讟讜讘 knowing that you will have to stop in the middle when 讬讜诐 讟讜讘 will come, and then when 讞讜诇 讛诪讜注讚 will come, it'll be a 讚讘专 讛讗讘讚. If this was a case that you were able not to start it at all and leave it for after 讬讜诐 讟讜讘, or a case that you were able to finish it before 讬讜诐 讟讜讘. What would be the 讚讬谉 if a person didn't listen to this 讚讬谉, and he started the 诪诇讗讻讛 before 讬讜诐 讟讜讘, even though he was able to leave it for after 讬讜诐 讟讜讘, and when 讬讜诐 讟讜讘 came he had to stop, and when 讞讜诇 讛诪讜注讚 came it became a 讚讘专 讛讗讘讚, so the 讞讻诪讬诐 made a 拽谞住 that he is not allowed to finish that 诪诇讗讻讛? And even though it'll get spoiled, the 讞讻诪讬诐 said let it get spoiled, because it was his own fault, he didn't have to start it before 讬讜诐 讟讜讘. And the 讙诪专讗 in 诪讜注讚 拽讟谉 has a 砖讗诇讛, what would be if a person started a 诪诇讗讻讛 before 讬讜诐 讟讜讘 when he didn't really have to, and when 讬讜诐 讟讜讘 came he left he stopped the 诪诇讗讻讛, and then he died, and when 讞讜诇 讛诪讜注讚 came it was a 讚讘专 讛讗讘讚? So if he himself would be alive, he definitely wouldn't be able to finish it because the 讞讻诪讬诐 拽谞住ed him. But in this case where he died, and now it belongs to his son, did the 讞讻诪讬诐 拽谞住 his son, that his son also cannot finish the 诪诇讗讻讛, or since his son didn't do anything wrong, his son is allowed to finish it because 诇讙讘讬 his son it is considered a 讚讘专 讛讗讘讚? And it would seem that whatever the answer would be to that question would apply to our case too, to the case of a person selling an 注讘讚 讻谞注谞讬 to a 讙讜讬 and then dying, whether his son is 拽谞住ed to redeem the 注讘讚 or not. But the 讙诪专讗 says,
讗诐 转诪爪讬 诇讜诪专, if you're gonna tell me that by the case of 讻讬讜讜谉 诪诇讗讻转讜 讘诪讜注讚, that he was 诪讻讜讜谉 exactly his 诪诇讗讻讛 on 讬讜诐 讟讜讘, that it should come out that on 讞讜诇 讛诪讜注讚 it should be a 讚讘专 讛讗讘讚, 讜诪转, and he died, 诇讗 拽谞住讜 讘谞讜 讗讞专讬讜, they did not 拽谞住 his son, so I would think if the 讚讬谉 over there is that the 拽谞住 does not apply to the son, the same 讚讬谉 would be in our case that the 拽谞住 would not apply to the son, so we could say no, it's no comparison. Over there maybe 诪砖讜诐 讚诇讗 注讘讚 讗讬住讜专讗. The son didn't do any 注讘讬专讛, so there is no reason to 拽谞住 him. The whole 拽谞住 came because the person did an 注讘讬专讛, the 讞讻诪讬诐 said do not start the 诪诇讗讻讛 in a way that you know that it'll become a 讚讘专 讛讗讘讚 on 讞讜诇 讛诪讜注讚, and the person didn't listen to the 讞讻诪讬诐, so he did an 注讘讬专讛, that's why they 拽谞住ed him. But a son who didn't do any 注讘讬专讛, there is no reason to 拽谞住 the son. But 讛讻讗 诪讗讬, what is the 讚讬谉 here, in other words in the case of 注讘讚, it still is a question, because maybe 诇讚讬讚讬讛 拽谞住讜 专讘谞谉, maybe the 拽谞住 was similar to there, it's a 拽谞住 on the person. The person who sold the 注讘讚 to the 讙讜讬, the 拽谞住 is on him, so therefore 讜讛讗 诇讬转讗, he is not around anymore, and the son doesn't get the 拽谞住. 讗讜 讚讬诇诪讗, or maybe 诇诪诪讜谞讬讛 拽谞住讜 专讘谞谉, that the 讞讻诪讬诐 did not 拽谞住 the person, that he must redeem the 注讘讚 that he sold, but it's his money that they 拽谞住ed, that he must spend the money to redeem the 注讘讚. And the money, 讜讛讗 讗讬转讬讛, the money is still here. Since the son inherited the money, so if the 讚讬谉 that you must inherit doesn't apply to the person, it applies to the money of the person, so now the money of the person is still around because the son inherited that money, so maybe the son also must redeem the 注讘讚 from the 讙讜讬. 讗诪专 诇讬讛, so he said to him, 转谞讬转讜讛, we learned it in the 诪砖谞讛. I can answer you this question from a different 讚讬谉 that we learned in the 诪砖谞讛. We learned in the 诪砖谞讛 in 砖讘讬注讬转: 砖讚讛 砖谞转拽讜爪讛 讘砖讘讬注讬转, a field that the thorns were cleared away during 砖诪讬讟讛, 转讝专注 诇诪讜爪讗讬 砖讘讬注讬转, can be planted immediately after 砖诪讬讟讛. Because the 讚讬谉 is on the 砖诪讬讟讛 year, on the seventh year you're
not allowed to work in the fields. If a person did do 诪诇讗讻讛 in the field during 砖诪讬讟讛, the 讞讻诪讬诐 made a 拽谞住 that he cannot work in that field even 诪讜爪讗讬 砖讘讬注讬转, even after 砖诪讬讟讛. But the 诪砖谞讛 says here that if the only work that was done that the thorns were cleared away in order to make the field nice, since it is only a 诪诇讗讻讛 which is 讗住讜专 on 砖诪讬讟讛 诪讚专讘谞谉, the 讞讻诪讬诐 did not put this 拽谞住 on this case, and you are allowed to plant this field after 砖诪讬讟讛. But if 谞转讟讬讬讘讛, if he manured it, he actually brought
