And here the ืืืจื is in the middle of discussing the ืคืฉื in the ืืฉื ื. The ืืฉื ื said that if an ืขืื ืื ืขื ื was captured by ืืืื and was redeemed by a ืืื, so there's a ืืืืืงืช between the ืืืืื and ืจืื ืฉืืขืื ืื ืืืืืื. The ืืืืื hold that if he was redeemed in order to be an ืขืื, then he continues being an ืขืื. If he was redeemed in order to be a ืื ืืืจืื, a free person, then he does not continue working as an ืขืื. But ืจืื ืฉืืขืื ืื ืืืืืื says that in both cases, he continues being an ืขืื. And ืคืฉื in this ืืฉื ื, the ืืืจื brought a ืืืืืงืช between ืืืื and ืจืื. ืืืื learns that the ืืฉื ื is talking in a case ืืคื ื ืืืืฉ, that the first owner was not ืืืืืฉ himself, did not give up hope of finding his ืขืื, and therefore, he still remains the real owner of the ืขืื. And the ืคืฉื in the ืืฉื ื is as follows: that if the person redeemed him in order to remain an ืขืื, then he goes back to his original owner, and continues being an ืขืื for him, because his owner was not ืืืืืฉ yet, so he still belongs to him. But if he was redeemed in order to become a ืื ืืืจืื, so then, even though he still belongs to the original owner, nevertheless, the ืืืืื say he goes out free, because if not, people would hold themselves back and would not redeem slaves. So in order to prevent this, so the ืืืืื said that even though it was before ืืืืฉ, nevertheless, he does not go back as an ืขืื. But ืจืื ืฉืืขืื ืื ืืืืืื, he is not afraid of that, because he holds that there is a ืืฆืื of ืคืืืื ืฉืืืืื to redeem an ืขืื ืื ืขื ื, so he's not afraid that people will not redeem him, so therefore, he says that even if it was redeemed in order to be a ืื ืืืจืื, he still goes back to his original owner, because after all, it was before ืืืืฉ, he still belongs to him. This is the way ืืืื explained the ืืฉื ื. But
ืจืื explained the ืืฉื ื that the ืืฉื ื is talking in a case of ืืืืจ ืืืืฉ, that the original owner was ืืืืืฉ himself, and therefore the ืขืื does not belong to him anymore. And this is the ืคืฉื in the ืืฉื ื: that if he was redeemed in order to be an ืขืื, then he remains an ืขืื, but to the second owner, to the person who redeemed him, not to the original owner, because he was ืืืืืฉ already. So since the second owner redeemed him in order to be an ืขืื, so it's like the second owner bought an ืขืื ืื ืขื ื for himself, so he stays as an ืขืื to him. But if he was redeemed in order to be a ืื ืืืจืื, then he doesn't work for anybody. He does not work for the first owner, because after all, he was ืืืืืฉ, so he doesn't belong to him. He does not work for the second owner, because the second owner redeemed him to be a ืื ืืืจืื, so he has no right to keep him as an ืขืื. But ืจืื ืฉืืขืื ืื ืืืืืื says that even if he was redeemed as a ืื ืืืจืื, he still stays as an ืขืื, and he gives the reason: because if not, whenever an ืขืื decides that he doesn't like his master, he's going to let himself be captured by ืืืื, and then, when he will be redeemed, he will be free. So in order to prevent that, ืจืื ืฉืืขืื ืื ืืืืืื holds that in all cases, he remains an ืขืื, and goes back to his first master. And now the
ืืืจื is going to ask a ืงืฉืื on the ืคืฉื of ืจืื in the ืืฉื ื. And the ืืืจื says, ืืืจืื, and according to ืจืื, ืืืืจ, that he said ืืืืจ ืืืืฉ, that the ืืฉื ื is in the case of after ืืืืฉ, ืืืจืื ืฉื ื, and when the ืืฉื ื says that if he was redeemed to be an ืขืื, he stays as an ืขืื to his second master, the ืฉืืื is, ืืจืื ืฉื ื, ืืืื ืงื ื ืืื? ืืฉืืืื? His second master, from whom was he ืงืื ื him? From the robbers! ืฉืืืื ืืืคืืืื ืื ืงื ื ืืื? The ืฉืืืื themselves, the robber themselves, are they ืงืื ื this ืขืื? Since they took the ืขืื away from the original owner, are they ืงืื ื the ืขืื in order to be able to say that the one that bought it from them, he is ืงืื ื the ืขืื? And the ืืืจื answers, ืืื, yes, ืงื ื ืืื ืืืขืฉื ืืืื, that those ืืืื that captured this ืขืื, are ืงืื ื the ืขืื, at least for his work, that whatever profit his work brings in, goes to them. And now, the ืืื that redeemed the ืขืื from those ืืืื, he is ืงืื ื the ืขืื, too. And as ืจืฉืดื explains, By paying the money when he redeemed the ืขืื, he gets the ืืขืฉื ืืืื of the ืขืื, just like those ืืืื owned the ืืขืฉื ืืืื, the labor of the ืขืื, so now the ืืื who bought it from them, so by him paying the money, he takes over the ownership over the ืืขืฉื ืืืื, and concerning the ืืืฃ of the ืขืื, so ืจืฉืดื says, when he makes the ืขืื go through the process of ืืืื and ืืืืื, that he has to circumcise himself, and he has to go to the ืืงืื, through that, he is ืงืื ื the ืขืื ืืืืคื. And then ืจืฉืดื continues, that even if the original owner already had this ืขืื go through the process of ืืืื ืืืืืื, still, the ืืืื who captured the ืขืื, are ืงืื ื the ืขืื ืืืขืฉื ืืืื. And then this ืืื who redeemed this ืขืื from the ืืืื, takes over the ownership of ืืขืฉื ืืืื. So therefore, this ืขืื now belongs to the second ืืื who redeemed him. And the ืืืจื says, ืืืจ ืจืืฉ ืืงืืฉ, because ืจืืฉ ืืงืืฉ said, ืื ืืื ืืขืืื ืืืืืื ืฉืงื ื ืืช ืขืืื ืืืืืื ืืืขืฉื ืืืื, how do we know that one ืืื is able to be ืงืื ื another ืืื for his ืืขืฉื ืืืื, that whatever profit his labor will bring in will go to the other ืืื that was ืงืื ื him, ืฉื ืืืจ, because it says a ืคืกืืง in ืืืงืจื ืืดื, ืืื ืืื ื ืืชืืฉืืื ืืืจืื ืขืืื ืืื ืชืงื ื, that from the peoples who live amongst you, from them you should buy an ืขืื and a ืฉืคืื. And as ืจืฉืดื explains, this is an extra ืคืกืืง, because there is a ืคืกืืง before that says, ืืื ืชืงื ื ืขืื ืืืื, that from them, from the ืืืื, you are allowed to buy a slave or a maid. So why does the ืชืืจื have to say another ืคืกืืง, ืืื ืืื ื ืืชืืฉืืื ืืืจืื ืขืืื ืืื ืชืงื ื, that from those ืืืื that live amongst you, from them you are allowed to buy a slave? So that is to teach us that ืืชื ืงืื ืื ืืื, that you are allowed to buy from them, a ืืื is allowed to buy an ืขืื a ืืื, ืืื ืื ืงืื ืื ืืื, but the ืืืื, they are not allowed to buy a ืืื as an ืขืื, ืืื ืื ืงืื ืื ืื ืืื, and also that they themselves cannot buy one from another, that a ืืื cannot be ืงืื ื another ืืื. And he continued saying, ืืืื, you might think, ืื ืืงื ื ืื ืืช ืื, that they cannot buy one from each other, that a ืืื cannot buy a ืืื. And the ืืืจื stops him right there, ืืืื ืื ืืงื ื ืื ืืช ืื, how could you ask that we might think that a ืืื cannot buy another ืืื? ืื ืืืจืช, you just said a minute ago, ืืื ืื ืงืื ืื ืื ืืื, that they ืืืงืข cannot be ืงืื ื one from another. So how can you now look for a ืจืืื that you could be ืงืื ื one from another, when you just gave a statement before that a ืืื cannot be ืงืื ื another ืืื? And the ืืืจื says ืืื ืงืืืจ, this is what he meant, that when he said before that one cannot buy from another, ืืื ืื ืงืื ืื ืื ืืื ืืืืคื, that a ืืื cannot be ืงืื ื another ืืื for his ืืืฃ, that a ืืื cannot be ืงืื ื the ืืืฃ of a ืืื, that the person, the ืืื himself, should belong to the other ืืื. And then he continued, ืืืื ืื ืืงื ื ืื ืืช ืื ืืืขืฉื ืืืื, so you might think that a ืืื cannot be ืงืื ื another ืืื even for ืืขืฉื ืืืื, even just for the benefit that his labor brings? So he says, ืืืจื ืงื ืืืืืจ, I'll tell you a ืงื ืืืืืจ: if ืขืืืดื ืืฉืจืื ืงืื ื, if a ืืื is able to be ืงืื ื a ืืื for his ืืขืฉื ืืืื, as ืจืฉืดื brings the ืคืกืืง in ืืืงืจื ืืดื, where it says that if a ืืื will not have enough money and he will sell himself to a ืืื, the ืืืืจื, the sale is valid, so we see that a ืืื is able to be ืงืื ื a ืืื for his ืืขืฉื ืืืื, ื ืขืืื ืืืืืื ืขืืื ืืืืืื ืื ืื ืฉืื, so certainly that a ืืื is able to be ืงืื ื another ืืื ืืืขืฉื ืืืื. So this is an answer to the question we had before, that the second ืืื who redeemed this ืขืื, we said before, was ืงืื ื him from those ืืืื who captured the ืขืื, and our ืฉืืื was, were those ืืืื themselves able to be ืงืื ื this ืขืื? And this we see here now, that a ืืื is able to be ืงืื ื another ืืื ืืืขืฉื ืืืื. And then the ืืืจื asks, ืืืืื, maybe let's say, ืื ื ืืืื ืืืกืฃ, that is only if the ืืื buys the other ืืื with money, ืืื ืืืืงื, but if he wants to be ืงืื ื the other ืืื through ืืืงื, ืื, he cannot. And the reason we think so is, as ืจืฉืดื explains, because how do we know that a ืืื could be ืงืื ื another ืืื? Because we learn it out from the ืืื that a ืืื could be ืงืื ื a ืืื. Concerning a ืืื being ืงืื ื a ืืื, the ืชืืจื says ืืคืืจืืฉ, ืืืกืฃ ืืงื ืชื, that if he buys him with money, he is ืงืื ื the ืืื. So if we learn out that a ืืื could be ืงืื ื a ืืื from the ืืื that a ืืื could be ืงืื ื So it should be similar. So just like the case where a ืืื is ืงืื ื a ืืื is only through ืืกืฃ, so we think maybe also when a ืืื is ืงืื ื another ืืื is also only if he is ืงืื ื him through ืืกืฃ, but not if he made a ืงื ืื of ืืืงื. Concerning this ืงื ืื of ืืืงื that the ืืืจื here refers to, there's a ืืืืืงืช between ืจืฉืดื and ืชืืกืคืืช. ืจืฉืดื learns that this ืืืงื is the same ืืืงื as we find that a ืืื is ืงืื ื an ืขืื ืื ืขื ื. Because the ืืื is that a ืืื could be ืงืื ื an ืขืื ืื ืขื ื, a ืืืืืฉืข ืขืื, through ืืืงื. And that is a ืืืงื that he makes him do a job that is fit for an ืขืื. For instance, he makes him dress him, he makes him put him on his shoes, he makes the ืขืื wash him around. That is a ืืืงื that a ืืฉืจืื is ืงืื ื an ืขืื ืื ืขื ื. So when the ืืืจื here asks that maybe when a ืืื would make ืืืงื to another ืืื he would not be ืงืื ื him, the ืืืจื refers to this same type of ืืืงื. That if a ืืืงื that the ืืื would make the other ืืื dress him or wash him or tie his shoes, etc., so then maybe he is not ืงืื ื him. And the ืืืจื's ืงืฉืื here is that in this case, when the ืืืื captured the ืขืื, they did not pay money for the ืขืื. So in which way were they ืงืื ื the ืขืื? That after they captured him, they made him do jobs that are fit for an ืขืื. And that is the ืืืจื's ืฉืืื, that maybe when the ืืื makes a ืืืงื on another ืืื he is not ืงืื ื the other ืืื. And therefore in the case of our ืืฉื ื, where the ืฉืืื, those ืืืื that captured this ืขืื did not pay money for him, so the only way they're able to be ืงืื ื him is through the ืงื ืื of ืืืงื. And then in turn, when the ืืื redeemed him from the ืืืื, so he is ืงืื ื the same thing as they were ืงืื ื. But if we're going to say that the only way a ืืื could be ืงืื ื a ืืื is through ืืกืฃ, so in this case where they did not pay ืืกืฃ, they should not be ืงืื ื this ืขืื. And then in turn, when the ืืื redeemed him from those robbers, he also should not be ืงืื ื, because they ืืืชืืืื were not the owners, so he cannot be an owner because he bought him from somebody who was not an owner. But ืชืืกืคืืช learns that when the ืืืจื here refers to ืืืงื, it does not mean this type of ืืืงื, but it means a ืืืงื of ืืืืืฉ, the ืืืงื that is done through conquering. There is a ืงื ืื called ืืืืืฉ, that when they conquer something, that itself is sufficient to be ืงืื ื. And that's what happened here in this case of the ืฉืืื, that how were they ืงืื ื this ืขืื? That they conquered him, they captured him, and that itself is a ืงื ืื. And the ืืืจื's ืฉืืื is that maybe when is a ืืื ืงืื ื another ืืื only if he buys him for money, but if he just conquers him, the ืงื ืื ืืืงื of ืืืืืฉ is not sufficient. And therefore in this case, if the ืืืื themselves were not ืงืื ื this ืขืื, so the ืืื who redeemed the ืขืื from the ืืืื also cannot be ืงืื ื. And the ืืืจื answers that we have a proof that a ืืื could be ืงืื ื another ืืื through ืืืงื, because ืืืจ ืจื ืคืคื, ืจื ืคืคื said, ืขืืื ืืืืื ืืืจื ืืกืืืื, that ืขืืื ืืืืื became ืืืืจ, became pure through ืกืืืื. Because like this, ืืฉื said that the ืืืื were not allowed to conquer any land from ืขืืื or from ืืืื. As the ืคืกืืง says in ืืืจืื, ืื ืชืฆืจ ืืช ืืืื, and concerning ืขืืื it says ืื ืชืฆืืจื. And nevertheless we find that the Jews conquered certain lands that belonged to ืืืื and to ืขืืื. Concerning ืืืื we see that they conquered the city called ืืฉืืื, and ืืฉืืื originally belonged to ืืืื. Concerning ืขืืื we see, we find in ืชื ืดื, in ืฉืืคืืื, that when ืืคืชื was going to have a war with ืขืืื, ืขืืื sent a message to ืืคืชื saying that the reason we want to fight is because the Jews when they came out of ืืฆืจืื took away part of our land. And the truth was that the ืืืื did take part of the land of ืืืื and part of the land of ืขืืื. And the reason they were allowed to do that because they didn't take the land directly from ืขืืื and ืืืื. First, ืกืืืื had conquered some of the land from ืขืืื and some of the land from ืืืื, so then it belonged to ืกืืืื, it was extended to the territory of ืกืืืื. So now when the Jews conquered ืกืืืื, they were also allowed to conquer that land that originally belonged to ืขืืื and to ืืืื. So from here we see that a ืืื could be ืงืื ื from another ืืื with ืืืงื. Because if there would be no ืงื ืื of ืืืงื, then how were the ืืืื allowed to conquer those parts that belonged originally to ืขืืื and ืืืื? And even though ืกืืืื had conquered it in between, but how was ืกืืืื ืงืื ื those lands? Through ืืืงื. And if ืืืงื by a ืืื is not ืงืื ื, that means that ืกืืืื was not ืงืื ื those lands. So they still belonged to ืขืืื and ืืืื. So how were the ืืืื allowed to conquer those lands? And since we see that ืขืืื ืืืืื ืืืจื ืืกืืืื ืกืืืื, that because ืกืืืื conquered them and they belonged to him, the ืืืื were in turn allowed to conquer it, that shows that ืกืืืื was ืงืื ื those lands that he conquered from ืขืืื ืืืืื. So that shows that a ืืื is ืงืื ื from another ืืื ืืืืงื. And even though this is only a proof concerning being ืงืื ื land with ืืืงื, but we know that whatever we find concerning land also applies concerning ืขืืืื. Because ืขืืืื ืืืงืฉื ืืงืจืงืขืืช, ืขืืืื are compared to ืงืจืงืขืืช. So if we see that a ืืื is able to be ืงืื ื a ืงืจืงืข with ืืืงื, so that also proves that a ืืื is able to be ืงืื ื an ืขืื through ืืืงื. And therefore in our ืืืจื, too, those ืฉืืืื that captured this ืขืื were ืงืื ื him through ืืืงื, so then the ืืื that redeemed him from those ืืืื was also ืงืื ื them. But then the ืืืจื asks: ืืฉืืื ืขืืื ืืืืืื ืขืืื ืืืืืื, we only now have a proof that a ืืื could be ืงืื ื another ืืื through ืืืงื, as we see in the case of ืขืืื ืืืืื that they were ืงืื ื the lands from another ืืื ืืืืงื. ืขืืื ืืืืืื ืืฉืจืื ืื ืื? How do we know that a ืืื could also be ืงืื ื a ืืื through ืืืงื? And in this case it happens to be a ืืื, because this ืขืื that these ืืืื captured was an ืขืื ืื ืขื ื that belonged to a ืืื. And the ืืื is that an ืขืื ืื ืขื ื belongs to a ืืื is ืืืื ืืืฆืืช ืืืืฉื. He's obligated to do certain ืืฆืืช, those ืืฆืืช that women are obligated to do, so he's considered partially a ืืื. So we have to have a ืจืืื that a ืืื could also be ืงืื ื a ืืื with ืืืงื. Because, and the ืืืจื says we have a ืจืืื for that, ืืืชืื, because there's a ืคืกืืง in ืืืืืจ that says, ืืืฉื ืืื ื ืฉืื, that there was a certain war that the ืืืื had, and the ืืืื captured a captive, the ืชืืจื says, from the ืืืื. So that shows that when the ืืืื captured the ืืื, we consider him a captive. So that shows that the ืืืื were ืงืื ื that ืืื. So here we see that ืืืื are also able to be ืงืื ื a ืืื with ืืืงื. Then the ืืืจื continues: ืืืจ ืจื ืฉืืขืื ืืจ ืืื, ืจื ืฉืืขืื ืืจ ืืื said, ืืืจ ืจืื ืืืื ื, in the name of ืจืื ืืืื ื: ืขืื ืฉืืจื ืืืืช ืืืกืืจืื, a ืขืื that ran away from jail, ืืฆื ืืืืจืืช, he automatically goes out free. ืืื ืขืื, and more than that, ืืื ืฉืืืคืื ืืช ืจืื, but we force his master, ืืืืชื ืื ืื ืฉืืจืืจ, and he must write for him a ืื ืฉืืจืืจ. A ืื ืฉืืจืืจ is the document that frees the slave. So if he was in jail and he ran out, he doesn't work anymore, and we force his master to give him this ืื ืฉืืจืืจ and free him. And when a ืขืื becomes free, he becomes a complete Jew. The ืืืจื asks a ืฉืืื: ืชื ื, we learn in our ืืฉื ื: ืจืื ืฉืืขืื ืื ืืืืืื ืืืืจ, ืืื ืื ืืืื ืื ืืฉืชืขืื. This is the case where an ืขืื was captured by ืืืื. So ืจืื ืฉืืขืื ืื ืืืืืื says that in whichever way he was redeemed, he stays an ืขืื. ืืืืจ ืจืื ืืจ ืืจ ืื ื ืืืจ ืจืื ืืืื ื, and ืจืื ืืจ ืืจ ืื ื said in the name of ืจืื ืืืื ื: ืื ืืงืื ืฉืฉื ื ืจืื ืฉืืขืื ืื ืืืืืื ืืืฉื ืชื ื, that wherever ืจืื ืฉืืขืื ืื ืืืืืื's opinion is mentioned in the ืืฉื ื, ืืืื ืืืืชื, the ืืืื is like him, ืืืฅ ืืขืจื, ืืฆืืื, ืืจืืื ืืืจืื ื, except in three cases in ืฉ"ืก. One is a case in ืืื ืืชืจื ืืฃ ืงืข"ื ืขืืื ื'. The other one is a case in the ืืืจื ืืืืื later on on ืืฃ ืข"ื ืขืืื ื'. And the other one is in ืกื ืืืจืื ืืฃ ื"ื ืขืืื ื'. But every other place in ืฉ"ืก the ืืืื is like ืจืื ืฉืืขืื ืื ืืืืืื. So we must say that our ืืฉื ื, too, the ืืืื is like ืจืื ืฉืืขืื ืื ืืืืืื. So it seems like a contradiction, because here ืจืื ืืืื ื says that if an ืขืื ran away from the ืืืช ืืืกืืจืื, he goes out free, while in our ืืฉื ื, which is a similar case, that he was captured by ืืืื, which is like being in jail, and he was redeemed, the ืืืื is like ืจืื ืฉืืขืื ืื ืืืืืื that he stays an ืขืื. So it seems like a ืกืชืืจื, a contradiction within the words of ืจืื ืืืื ื himself, because ืจืื ืืืื ื was the one that said that if an ืขืื runs away from the jail, he is free, and the same ืจืื ืืืื ื said that the ืืืื in the whole ืฉ"ืก is like ืจืื ืฉืืขืื ืื ืืืืืื, which means that in our ืืฉื ื the ืืืื is like him, too, that he does stay an ืขืื. And the ืืืจื explains: ืืฉืืื ืืืืื, ืืืื according to ืืืื, who explained before that the ืืฉื ื is talking in a case of before ืืืืฉ, so we could answer this contradiction: ืืืงื ืื ืืื ืืคื ื ืืืืฉ ืืืื ืืืืจ ืืืืฉ. He will say that the ืืฉื ื is talking before ืืืืฉ, and that's why he stays as an ืขืื, and the words of ืจืื ืืืื ื is a case of ืืืืจ ืืืืฉ. That when ืจืื ืืืื ื said that an ืขืื that ran away from jail is automatically free, that is in the case that the owner was ืืชืืืืฉ himself and therefore is free. ืืื ืืจืื ืืืืจ ืืืืจ ืืืืฉ, but according to ืจืื who says that our ืืฉื ื is also talking in a case of ืืืจ ืืืืฉ, and nevertheless ืจื ืฉืืขืื ืื ืืืืืื says that he remains an ืขืื. So ืงืฉืื ืืจืื ืืืื ื ืืืจืื ืืืื ื, so there's a ืงืฉืื, a ืกืชืืจื, in the words of ืจืื ืืืื ื against the words of ืจืื ืืืื ื. In our ืืฉื ื he ืคืกืงื 'ืก that he remains an ืขืื, and there he says that if an ืขืื runs away from jail he is free. And the ืืืจื answers, ืืืจ ืื ืจืื, ืจืื will answer you. ืืขืื ืืื, what was the reason in the case of the ืืฉื ื? Why ืจื ืฉืืขืื ืื ืืืืืื said that he remains an ืขืื, even though it was after ืืืืฉ, so he shouldn't go back to his original owner? The only reason ืจื ืฉืืขืื ืื ืืืืืื said he does go is ืืฉืื ืืืืงืื, because of the ืืื of ืืืงืื, that we're afraid that ืขืืืื will let themselves be captured in order to be freed. So in that case, ืืืจื ืฉืื ื, if an ืขืื ran away from jail, he is different. In his case, we do not make that ืืืืจื. Because ืืฉืชื ืืืืงืืืื ืืกืจ ื ืคืฉืื, at sea this person was ready to give up his life in order to run away from his captors, because he knew that if he would be caught by them they definitely would kill him, and he so much didn't want to be in their hands that he was ready to risk his life in order to free himself from them. ืืคืืื ืืคืื ื ืคืฉืื ืืืืกื? So are we afraid that he himself is going to throw himself into the hands of the captors? So therefore, in a case where we do not have this ืกืืจื of ืืืงืื that we're afraid that he's going to let himself be caught, over there the ืืื stays as it was originally, that since it's ืืืืจ ืืืืฉ, he is not an ืขืื anymore. Then the ืืืจื continues with a story: ืืืชื ืืืจ ืฉืืืื, the maid, the ืืืืืฉืข maid, which is a ืฉืคืื ืื ืขื ืืช, which has the same ืืื as an ืขืื ืื ืขื ื, she belonged to ืฉืืืื. ืืฉืชืืื, she was captured. ืคืจืงืื, people redeemed her, ืืฉืื ืืืชื, in order to remain a maid, a slave. ืืฉืืจืื ืืื, and they sent her back to ืฉืืืื. ืืฉืืื ืืื, and they sent along the message that ืื ื ืืจืื ืฉืืขืื ืื ืืืืืื ืกืืืจื ืื, we hold like ืจืื ืฉืืขืื ืื ืืืืืื that whichever way she was redeemed, she remains a slave, and therefore take her. And they continued, ืืช, you, ืื ื ืื ืืจืื ื ืกืืืจื ืื, even if you hold like the ืจืื ื, not like ืจืื ืฉืืขืื ืื ืืืืืื, ืื ื ืืฉืื ืืืชื ืคืจืงืื ื ืื, still you could keep her because when we redeemed her we had in mind that she should remain a slave, and even the ืจืื ื agreed that if you redeemed the slave in order to remain a slave, he does remain a slave. But really the
ืืืจื says ืฉืืืื did not have a right to take her, because ืืืื ืื ืกืืืจ, because they thought, ืืคื ื ืืืืฉ ืืื, that this was a case before ืืืืฉ, that ืฉืืืื hadn't given up hope yet. ืืื ืืื, it wasn't true, because ืืืืจ ืืืืฉ ืืื, it was already after ืฉืืืื gave up hope, and therefore ืฉืืืื had no right to take her back. ืืฉืืืื, and therefore ืฉืืืื, ืื ืืืืขืื ืืืืฉืชืขืืืื ืื ืืืฉืชืขืื ืื, not only did he have her work as a slave, ืืื ืืืื ืืืืจืืชื ื ืื ืื ืืฆืจืื, he also didn't even require that she should get a ืฉืืจ ืฉืืืจืืจ. Because ืฉืืืื ืืืขืืื, ืฉืืืื goes according to his own opinion, ืืืืจ ืฉืืืื, because ืฉืืืื said, ืืืคืงืืจ ืขืืื, if someone gives up ownership of his ืขืื, ืืฆื ืืืืจืืช, automatically the ืขืื becomes free, ืืืื ื ืฆืจืื ืื ืฉืืืจืืจ, he doesn't even need a ืื ืฉืืืจืืจ, as normally when you own an ืขืื, if you want to free him you give him a ืฉืืจ ืฉืืืจืืจ, but in this case where you give up your ownership of the ืขืื, you don't even have to give him a ืื ืฉืืืจืืจ. ืฉื ืืืจ, because the ืคืกืืง says, ืืื ืขืื ืืืฉ ืืงื ืช ืืกืฃ, that an ืขืื of a man that was bought with money, so when the ืคืกืืง says ืขืื ืืืฉ, the ืขืื of a man, what does the ืคืกืืง mean with that? ืขืื ืืืฉ ืืื ืขืื ืืฉื? An ืขืื of a man and not an ืขืื of a woman? As if a woman cannot own an ืขืื, it is not true, a woman could also own an ืขืื. So what does the ืชืืจื mean with the words ืขืื ืืืฉ? ืืื, it means ืขืื ืฉืืฉ ืื ืจืฉืืช ืจืื ืขืืื, an ืขืื that has a man over him, has the ownership of his master over him, ืงืจืื ืขืื, he is called an ืขืื. But ืฉืืื ืื ืจืฉืืช ืจืื ืขืืื, but if an ืขืื does not have the ownership of his master over him, ืืื ืงืจืื ืขืื, he is not called an ืขืื. And therefore ืฉืืืื says, if a person is ืืคืงืืจ his ืขืื, so his ืขืื does not have the ownership of his master over him, he is not called an ืขืื, and he does not need a ืื ืฉืืืจืืจ. And just as the ืืื is when you're ืืคืงืืจ your ืขืื, the same thing is if you are ืืชืืืืฉ from your ืขืื, if you give up hope from your ืขืื, because ืืืืฉ is equivalent to ืืคืงืจ. And therefore, in this case where ืฉืืืื was already ืืชืืืืฉ ืืืืืฉ from that ืฉืคืื, he did not require her to get a ืื ืฉืืจืืจ. The ืืืจื continues, ืืืชืื ืืจื ืืื ืืจ ืืืืจื ืืฉืชืืื, the
female slave of ืจื ืืื ืืจ ืืืืจื was captured, ืคืจืงื ืืืื ืชืจืืืืื ืืฉืื ืืืชืชื, so a certain ืืื from ืชืจืืื redeemed her to be his wife. ืฉืืจื ืืื ืืืืืื, so they sent a message to ืจื ืืื ืืจ ืืืืจื, that ืื ืืื ืขืืืืื, if you would like to do a good thing, ืฉืืจ ืื ืืืื ืืืืจืืชื, send her a ืฉืืจ ืฉืืจืืจ. And the ืืืจื says, ืืืื ืืื, what was the case there? What did they think they would accomplish if he would send her a ืฉืืจ ืฉืืจืืจ? ืื ืืืฆื ืคืจืงื ืื, if they were able to redeem her from that ืชืจืืื, if that ืืื, that ืชืจืืื, was willing to sell her if they would pay the money for her, ืืื ืื ืืืื ืืืืจืืชื, why did they want she should get a ืฉืืจ ืฉืืจืืจ? Let them just pay the money and redeem her and give her back to ืจื ืืื ืืจ ืืืืจื. ืื ืืื ืืฆื ืคืจืงื ืื, if they could not redeem her, in other words, that ืืื was not willing to sell her back, so ืื ืฉืืจ ืื ืืืื ืืืืจืืชื ืืื ืืื, so what would they have gained if she, he would have sent her a ืฉืืจ ืฉืืจืืจ? The ืืื wouldn't give her up anyway. And the ืืืจื answers, ืืขืืื really ืืืฆื ืคืจืงื ืื, they were able to redeem her. Ah, you ask, if so, let them redeem her, why did they want him to send her a ืฉืืจ ืฉืืจืืจ? But the ืืืจื says, ืืืืื ืืืฉืืจ ืื ืืืื ืืืืจืืชื, if he would send her a ืฉืืจ ืฉืืจืืจ, ืืืืจื ืืืืจื ืืืืื, the people would get together, ืืคืจืงื ืื, they would redeem her. Like this, it was harder for them to collect the money to redeem her since she was a ืฉืคืื ืื ืขื ืืช. But if he would send her a ืฉืืจ ืฉืืจืืจ, she would become a regular ืืช ืืืจืื, a regular Jewish woman, it would be easier to get the people together and redeem her. ืืืืขืืช ืืืื, the ืืืจื says, if you want, I could give you a different explanation: ืืขืืื ืืื ืืฆื ืคืจืงื ืื, that really they were not able to redeem her. So if so, you ask, so what would they gain if he would send a ืฉืืจ ืฉืืจืืจ, the ืืื was not willing to give her up anyway. But ืืืืื ืืืฉืืจ ืื ืืืื ืืืืจืืชื, as soon as he would send her a ืฉืืจ ืฉืืจืืจ, ืืืืื ืืืคืื, she would become disgusting in the eyes of the ืืื, ืืืคืจืง ืื, then he would change his mind and would allow them to redeem her. Because when he would send her the ืฉืืจ ืฉืืจืืจ, the ืืื would find out that she used to be a ืฉืคืื of a Jew, so that would make her disgusting in the eyes of the ืืื, and then he would allow the ืืืื to redeem her. But the ืืืจื asks, ืืืืืจ ืืจ, don't we know that ืืืืื ืืื ืืืืชื ืฉื ืืฉืจืื ืืืชืจ ืื ืฉืืชืืื, that even the animals of the ืืืื are more beloved to the ืืืื than their own wives? So how could you say here that when the ืืื would find out that she used to belong to a ืืื, she would be disgusting to him, when we say here that they like even the animals of the ืืืื more than their own wives? Certainly, they would like the ืฉืคืื of a ืืื. And the ืืืจื answers, ืื ื ืืืื ืืฆื ืขื, that is only quietly. Truthfully, a ืืื would like the ืืืื of a ืืื more than his own wife and, certainly, the ืฉืคืื of a ืืื. ืืื ืืคืจืืกืื, but in public, officially, ืืืื ืืื ืืืืชื, it is disgusting for a ืืื to be with a Jewish ืฉืคืื. Then the ืืืจื continues, ืืืื ืืืชื, there was this female slave, ืืืืื ืืคืืืืืืชื, that she was in the city of ืคืืืืืืชื, ืืืื ืงื ืืขืืื ืื ืืื ืฉื ืืืืกืืจื, that men would do ืขืืืจืืช with her. She was the source of immorality for certain men. ืืืจ ืืืื, so ืืืื said, ืื ืืื ืืืืจ ืจื ืืืืื ืืืจ ืฉืืืื, if not for what ืจื ืืืืื said in the name of ืฉืืืื, ืื ืืืฉืืจืจ ืขืืื ืขืืืจ ืืขืฉื, that anybody who frees his ืืืืืฉืข slave is ืขืืืจ on an ืขืฉื, transgresses a positive commandment, if not for that, ืืื ืืคืื ื ืืื ืืืจื, I would force her master, ืืืชื ืื ืืืื ืืืืจืืชื, that he should write for her a ืฉืืจ ืฉืืจืืจ. Since because she was a ืฉืคืื and was not married to a man, so the people did ืขืืืจืืช with her, so ืืืื said that if not for the ืขืืืจื of freeing a slave, I would force her master to free her. ืจืืื ื ืืืจ, but ืจืืื ื said, ืื ืื ืืืื ืจื ืืืืื, in a case like this, ืจื ืืืืื would be ืืืื that you are allowed to free her, ืืฉืื ืืืืชื ืืืืกืืจื, because of a reason of ืืืกืืจ. When did ืจื ืืืืื say that you're ืขืืืจ an ืขืฉื if you free your slave? Only if no ืืืกืืจ is involved. But in this case, the reason you wanted her to be free is so people shouldn't do any ืขืืืจืืช with her, in a case like this, ืจื ืืืืื would admit that you are allowed to free your slave. Now the ืืืจื asks, ืืืืื, and ืืืื himself, ืืฉืื ืืืกืืจื ืื, does he not hold to, if she was free, she couldn't marry A regular ืื ืืืจืื, a regular Jew, because of her half that she was a ืฉืคืื. So therefore, they forced her master to free her, and now she was able to marry a regular Jew, a regular ืืช ืืืจืื. ืืืืจ ืจื ื ืืื ืืจ ืืฆืืง, and then ืจื ื ืืื ืืจ ืืฆืืง said that the reason they freed her was not just for her to be able to marry, because the truth is a woman is not obligated for the ืืฆืื of ืคืจื ืืจืื. She's not obligated in the ืืฆืื of having children. So therefore, this reason that she should be able to marry was not sufficient that we should force her master to free her. But what was the reason? Because ืื ืื ืืคืงืจ ื ืืื ืื. Since she was not able to marry anybody, so people would do ืขืืืจืืช with her. So because of that, they were able to force her master to free her. So the ืืืจื ืฉืืื is, why did ืืืื think in his case that there, too, people were doing ืขืืืจืืช with her, it wasn't sufficient that you should be allowed to force her master to free her? And the ืืืจื answers, ืืื ืืฉืชื? What kind of comparison is it? ืืชื, there, in the story of ืจื ืื ืื ื ืืจ ืงืืื ื, ืื ืืขืื ืืืื ืืื ืืื ืืืจืื ืืืื. Since she was a half a ืฉืคืื, half a ืืช ืืืจืื, she couldn't marry not an ืขืื, not a ืื ืืืจืื. So therefore, people were doing ืขืืืจืืช with her, and there was no choice but to free her. ืืื, but in my case, here, ืืคืฉืจ ืืืืืื ืื ืืขืืื, her master could be ืืืืื her, could give her his ืขืื as a husband, ืืืื ืืจ ืื, and he will watch her. So here there is another way of making sure that people will not do ืขืืืจืืช with her by marrying her off to an ืขืื, and therefore ืืืื felt that in his case he had no right to force her master to free her. And the ืืืจื continues, ืืืคื. Now we're going to discuss the ืืืฃ of that ืืื that we mentioned before: ืืืจ ืจื ืืืืื ืืืจ ืฉืืืื, ืจื ืืืืื said in the name of ืฉืืืื, ืื ืืืฉืืจืจ ืขืืื, whoever frees his ืขืื, ืขืืืจ ืืขืฉื, is ืขืืืจ on an ืขืฉื. Which ืขืฉื? ืฉื ืืืจ, it says in the ืชืืจื in ืืืงืจื, ืืขืืื ืืื ืชืขืืืื, "Forever you should have them work." So if you free your slave, then you stop them from being your ืขืื, so you're ืขืืืจ on this ืขืฉื. And the ืืืจื continues, ืืืชืืื, I'll ask you a ืงืฉืื, ืืขืฉื ืืจืื ืืืืขืืจ, there's a story with ืจืื ืืืืขืืจ, ืฉื ืื ืก ืืืืช ืืื ืกืช, he entered the ืฉืื to ืืืืืขื, ืืื ืืฆื ืขืฉืจื, and he couldn't find a ืื ืื, there were no ten there, ืืฉืืจืจ ืขืืื, so he freed his slave, ืืืฉืืืื ืืขืฉืจื, and with him he had a ืื ืื. So we see that you are allowed to free your slave. And the ืืืจื answers, ืืฆืื ืฉืื ื. For the sake of a ืืฆืื is different, and since the reason he freed his slave was in order to have a ืื ืื, so that is different, that you are allowed to do. And the ืืืจื continues,
ืชื ื ืจืื ื, the ืจืื ื learned, the ืคืกืืง says, ืืขืืื ืืื ืชืขืืืื, "Forever you should work with them." ืจืฉืืช, that is only optional. ืืืจื ืจืื ืืฉืืขืื, ืจืื ืืฉืืขืื holds that way, that it is not a ืืฆืื, a ืืืื, that you must have them work forever, but the ืชืืจื is telling you that you're allowed to work with them, because we would think since the ืชืืจื says previously that any person that belongs to one of the seven nations, ืื ืชืืื ืื ื ืฉืื, you're not allowed to let any one of them live, so we would think that if a ืืื from another nation, not one of the seven, had a child with a woman who is one of the seven ืืืืืช, so we would think that their child should be ืืกืืจ to live, so therefore the ืคืกืืง tells us no, that you could have an ืขืื that his mother is one of the ืฉืืข ืืืืืช if his father is not. But ืจืื ืขืงืืื ืืืืจ, ืจืื ืขืงืืื says ืืืื, that this ืคืกืืง is a ืืืื, an obligation, that you must have your ืขืืืื work forever. But the ืืืจื asks a ืฉืืื based on that, ืืืืืื ืจืื ืืืืขืืจ ืกืืจ ืื ืืืื ืืืืจ ืจืฉืืช? So maybe ืจืื ืืืืขืืจ holds like the ืืื ืืืืจ that says that it is only optional? We asked the ืงืฉืื before from the story of ืจืื ืืืขืืจ that he freed his slave in order to be ืืฉืืื the ืื ืื, and we answered that the reason he was allowed to do that because ืืฆืื is different. Why couldn't we answer very simple, that he holds there is no ืขืืืจื in freeing the slave? Maybe he holds like ืจืื ืืฉืืขืื that the ืคืกืืง ืืขืืื ืืื ืชืขืืืื is only a ืจืฉืืช and you're allowed to free your slave? And the ืืืจื says, ืื ืกืืงื ืืขืชื. We don't even have a ืืื ืืืื ื that that should be the ืคืฉื, because ืชื ืื ืืืืื, we learned ืืคืืจืืฉ in a ืืจืืืชื, ืจืื ืืืืขืืจ ืืืืจ that ืจืื ืืืืขืืจ says ืืืื, that it is an obligation, that when the ืคืกืืง says ืืขืืื ืืื ืชืขืืืื, it is a must that you are not allowed to free your slave. The ืืืจื continues,
ืืืจ ืจืื, ืจืื said, ืืื ื ืชืืช ืืืื, because of these three things, because of these three offenses, ื ืืชื ืืขืื ืืชืื ืื ืืกืืื. So people lose their possessions, people become poor. One thing is ืืืคืงื ืขืืืืื ืืืืจืืชื, they free their slaves. The second thing ืืืกืืืจื ื ืืกืืืื ืืฉืืชื, and they inspect their fields on ืฉืืช to see what they have to fix after ืฉืืช, which they shouldn't really be doing. ืืืงืืขื ืกืขืืืชืืืื ืืฉืืชื and also for having their main meal on ืฉืืช ืืขืืื ืื ืืืจืฉื, ืฉืืช afternoon at a time when in the ืืฉืืื the ืฉืืขืืจ is being given and they sit home and partake in their meal. ืืืืจ ืจืื ืืืื ืืจ ืืื ืืืจ ืจืื ืืืื ื, because ืจืื ืืืื ืืจ ืืื said in the name of ืจืื ืืืื ื, ืฉืชื ืืฉืคืืืช ืืื ืืืจืืฉืืื, there were two families in ืืจืืฉืืื. ืืืช ืงืืขื ืกืขืืืชื ืืฉืืช, one used to have their main meal on ืฉืืช, ืืืืช ืงืืขื ืกืขืืืชื ืืขืจื ืฉืืช, and one used to have their main meal on Friday night, ืืฉืชืืื ื ืขืงืจื, and both of them became extinct, because both of them were doing wrong. The one that had their main meal on ืฉืืช, it was wrong because it was in the time of the ืฉืืขืืจ. The one that had their main meal on Friday night was also wrong because the main meal is supposed to be eaten on ืฉืืช afternoon. They really did it because they didn't want to have their main meal on ืฉืืช afternoon, not to take away the time from the ืฉืืขืืจ. But nevertheless, it was wrong because the main meal has to be ืฉืืช afternoon, not Friday night. There's another ืคืฉื in this ืืืจื, as ืจืฉืดื brings, that when the ืืืจื says that the second family had their main meal ืขืจื ืฉืืช, it does not mean Friday night as we said before, but it means simply on ืขืจื ืฉืืช on Friday. But ืจืฉืดื says it is hard to say that this is the ืคืฉื in the ืืืจื, because the ืืืจื here does not bring things which are actually ืืกืืจ, just things which are not proper to do. And to eat a main meal ืขืจื ืฉืืช afternoon is really ืืกืืจ, because the ืืื is that you have to go into ืฉืืช while you're hungry in order to eat the ืฉืืช meal with appetite. So if you eat a main meal on ืฉืืช afternoon, you won't be hungry Friday night, so therefore it is an ืืืกืืจ. So therefore ืจืฉืดื says, the ืืืจื here probably does not mean ืขืจื ืฉืืช Friday, but it means Friday night. And then the ืืืจื continues, ืืืจ ืจืื ืืืจ ืจื, ืจืื said in the name of ืจื, ืืืงืืืฉ ืขืืื, if someone makes his ืขืื ืืงืืฉ, he says let my ืขืื be ืืงืืฉ, ืืฆื ืืืืจืืช, he automatically goes out free. ืืื ืืขืื, what is the reason? ืืืคืื ืื ืงืืืฉ ืืืื ืื ืงืืืจ. ืืืื, when somebody is ืืงืืืฉ something, there are three possibilities. One possibility is when you are ืืงืืืฉ ืงืืืฉืช ืืืืฃ. When you are ืืงืืืฉ an object which in it in itself can be used on the ืืืื as a ืงืจืื. So that object becomes holy and it is ืงืืืฉืช ืืืืฃ, that the ืืืฃ itself, the object itself, is used for ืืงืืฉ, is used for a ืงืจืื on the ืืืื. But then let's say somebody is ืืงืืืฉ an object that cannot be used on the ืืืื. For instance, if he is ืืงืืืฉ a non-kosher animal, a ืืืื ืืืื, or if he is ืืงืืืฉ ืงืจืงืข, if he is ืืงืืืฉ land, or any other object that cannot be used on the ืืืื, so there the ืืื is it becomes ืงืืืฉืช ืืืื. That means that the object itself belongs to ืืงืืฉ, it is ืืงืืฉ, but what will ืืงืืฉ do with it? ืืงืืฉ will sell it and the money ืืงืืฉ gets for that object will be used for ืืืง ืืืืช, for fixing of the ืืืช ืืืงืืฉ. Then there is a third possibility. When a person would say, ืืื ืืคืฅ ืื ืขืื, that I take it upon myself to give to ืืงืืฉ the worth of that object. So this ืืงืืฉ has no effect whatsoever on the object, because he never said that the object itself should belong to ืืงืืฉ. All he said was that he takes upon himself to give to ืืงืืฉ the worth of that object. So in a case like that, the ืืืช ืืื would have to evaluate how much that object is worth and this person is ืืืืืื to give to ืืงืืฉ the worth of that object. Now in a case where he is ืืงืืืฉ his ืขืื, let's see what this could mean. So the ืืืจื says, ืืืคืื ืื ืงืืืฉ, to say that he meant ืงืืืฉืช ืืืืฃ, that is impossible, because that is ืฉืืื only by something that could be used on the ืืืื. By an ืขืื that is impossible, so it can't mean ืงืืืฉืช ืืืืฃ. Let it mean that he accepted it upon himself that he will give to ืืงืืฉ the worth of the ืขืื? We can't say that either because ืืืื ืื ืงืืืจ, he did not say that he accepts upon himself the ืืืื, the worth of that ืขืื. So therefore, if he didn't say it, he probably didn't mean it. So therefore, what did he mean? ืืืืื ืขื ืงืืืฉ ืงืืืจ. So what he meant was that this ืขืื should become part of ืขื ืงืืืฉ, of the holy nation, should become part of the Jewish nation. And therefore ืจื says that if you're ืืงืืืฉ your ืขืื, what you mean is that you're freeing him and you make him become a ืื ืืืจืื, a regular free person and automatically he becomes a regular Jew. The only question we could ask, maybe he meant the other possibility? Maybe he meant that he is ืืงืืืฉ the ืขืื ืงืืืฉืช ืืืื, that the ืขืื should belong to ืืงืืฉ and ืืงืืฉ should sell the ืขืื, and the money should go to ืืืง ืืืืช. So ืจืฉืดื here, and a little bit later, in more detail explains that in this case we cannot say that. When do we say that if a person is ืืงืืืฉ an object that cannot be used for ืงืืืฉืช ืืืืฃ, that that means that it should become ืงืืืฉืช ืืืื? Only where there is no other choice. If it can definitely not mean ืงืืืฉืช ืืืืฃ, in no way, so therefore we say when he was ืืงืืืฉ him, probably it meant ืงืืืฉืช ืืืื. But in a case where there is some way that we could say he meant ืงืืืฉืช ืืืืฃ, so there we do not say he meant ืงืืืฉืช ืืืื. And this is what ืจื holds. Since in the case of an ืขืื, there is some way to say he meant ืงืืืฉืช ืืืืฃ, not a ืงืืืฉืช ืืืืฃ of a ืงืจืื, but a ืงืืืฉืช ืืืืฃ of becoming part of the ืขื ืงืืืฉ, which is also a ืงืืืฉืช ืืืืฃ, that his ืืืฃ becomes holy, he becomes part of the Jewish nation. So since we can interpret his words somehow that he meant ืงืืืฉืช ืืืืฃ, so therefore we cannot say that he meant ืงืืืฉืช ืืืื. And that is what ืจื is saying: ืงืืืฉืช ืืืืฃ of a ืงืจืื it cannot mean. To say he meant ืืืื ืขืื, that I take upon myself to pay the amount of money that the ืขืื is worth, he also did not say, because he said that the ืขืื itself should be ืงืืืฉ. To say that he meant that the ืขืื should become ืงืืืฉืช ืืืื, we cannot say here either, because in somehow there is a connection here to ืงืืืฉืช ืืืืฃ. So therefore what we do say he meant, that the ืขืื should be ืงืืืฉ in that type of ืงืืืฉืช ืืืืฃ, and that means that the ืขืื should become a ืื ืืืจืื, should become part of ืขื ืงืืืฉ. ืืจื ืืืกืฃ ืืืจ ืจื, ืจื ืืืกืฃ said in the name of ืจื,
ืืืคืงืืจ ืขืืื, if someone makes his ืขืื ืืคืงืจ, he gives up his ownership of the ืขืื, ืืฆื ืืืืจืืช, so the ืขืื goes out free. And ืจื ืืืกืฃ did not give over in the name of ืจื concerning if he's ืืงืืืฉ the ืขืื, but only concerning if he's ืืคืงืืจ the ืขืื. And the ืืืจื explains: ืืื ืืืืจ ืืงืืืฉ, the one that said in the name of ืจื that if you are ืืงืืืฉ your ืขืื, he goes out free, ืื ืฉืื ืืคืงืืจ, certainly if you are ืืคืงืืจ your ืขืื. Because in the case where you are ืืคืงืืจ your ืขืื, there is more ืกืืจื to say that he meant to free him than if you are ืืงืืืฉ your ืขืื. Because when you are ืืงืืืฉ your ืขืื, he actually didn't say he should go out free, we just interpreted that that's what he meant. But in the case where he's ืืคืงืืจ his ืขืื, so he definitely is saying he's giving up his ownership. So there there is more ืกืืจื to say that he goes out free. So the one that said that ืจื said this ืืื by ืืงืืืฉ his ืขืื, certainly he holds that in the case where he is ืืคืงืืจ his ืขืื, he also goes out free. ืืื ืืืืจ ืืคืงืืจ, the one that said that ืจื said this ืืื in the case of being ืืคืงืืจ a ืขืื, ืืื ืืงืืืฉ ืื. But that doesn't mean that he holds when you're ืืงืืืฉ the ืขืื he also goes out free. Because ืืืืื maybe ืืืื ืงืืืจ, maybe he holds that when he was ืืงืืืฉ him, what he really meant was that he takes upon himself to give to ืืงืืฉ the worth of that ืขืื. The ืืืจื continues,
ืืืืขืื ืืื, in the ืืฉืืื they ask a question, they ask an ืืืืขืื, ืฆืจืื ืื ืฉืืจืืจ ืื ืื ืฆืจืื? In these two cases that ืจื said, that if you are ืืคืงืืจ your ืขืื or if you are ืืงืืืฉ your ืขืื he goes out free, does he still need a ืื ืฉืืจืืจ or not? And the ืืืจื says ืชื ืฉืืข, come and hear, I will bring you an answer, ืืืืจ ืจื ืืืื ืืจ ืืืื ืืืจ ืจื, ืจื ืืืื ืืจ ืืืื said in the name of ืจื, ืืื ืื ืืืื ืื ืืฆื ืืืืจืืช, that in the case of ืืงืืืฉ and in the case of ืืคืงืืจ he goes out free, ืืฆืจืื ืื ืฉืืจืืจ, but he does need a ืื ืฉืืจืืจ. And as we can see, ืจื argues on ืฉืืืื, because in ืขืืื ื we learned that ืฉืืืื says if you're ืืคืงืืจ your ืขืื, he goes out free and does not need a ืื ืฉืืจืืจ. But here we see that ืจื holds that if you're ืืคืงืืจ your ืขืื, he goes out free, and he does need a ืื ืฉืืจืืจ. Then the ืืืจื continues, ืืืจ ืจืื, ืจืื said, ืืืืชืืื ื ืืฉืืขืชืื, and we could ask a ืงืืฉืื on our own ืืื. ืจืื was the one that gave over in the name of ืจื before, that if you are ืืงืืืฉ your ืขืื, he goes out free. So
ืจืื says, but I have a ืงืืฉืื on that ืืื from a ืืจืืืชื. Because we learn in a ืืจืืืชื, ืืืงืืืฉ ื ืืกืื, if someone is ืืงืืืฉ his property, ืืืื ืืื ืขืืืื, and amongst those things that he was ืืงืืืฉ, there were ืขืืืื, ืืื ืืืืืจืื ืจืฉืืื ืืืืฆืืื ืืืืจืืช, the treasurers of ืืงืืฉ have no right to free the ืขืืืื, ืืื ืืืืจืื ืืืชื ืืืืจืื, but they are allowed to sell them to others, ืืืืจืื ืืืฆืืืื ืืืชื ืืืืจืืช, and the others, if they want, they are able to free these ืขืืืื. ืจืื ืืืืจ, but ืจืื says, ืืืืจ ืื ื, I say, ืืื ื ืืชื ืืื ืขืฆืื, the ืขืื himself can pay his own money, ืืืฆื, and he can go out. Because as the ืืืจื explains later in ืืฃ ืื ืขืืื ื, ืจืื holds that an ืขืื ืื ืขื ื could go out free by buying his freedom, by paying to his master the amount of money that he is worth, and that's how he goes out free. So in this case ืจืื says he is also able to give his own money and go out free. But in this case it's not because he is able to be freed through the ืืืืจืื, through the treasurers of ืืงืืฉ, because as we said before, that the treasurers treasurers of ืืงืืฉ have no right to free them, but it is as ืจืื says, ืืคื ื ืฉืืื ืืืืืจื ืื, because it is as if the treasurer of ืืงืืฉ is selling the ืขืื to himself. Just like we said before that the treasurers of ืืงืืฉ have a right to sell them to others, so they also have a right to sell them to themselves. So therefore, if the ืขืื has his own money, he's able to buy himself off from the treasurers of ืืงืืฉ. But one might ask, how does an ืขืื have his own money? Don't we have a ืืื,
ืื ืื ืฉืงื ื ืขืื ืงื ื ืจืื, that whatever an ืขืื ืื ืขื ื owns belongs to his master? So how can we say if he pays his own money, he's able to buy his freedom? But the ืคืฉื is that even though most cases we say that, but there is a possibility for an ืขืื to own his own money. And that is in the case where someone gives him money ืขื ืื ืช ืฉืืื ืืจืื ืจืฉืืช ืื, that someone gives him money on condition that his master should have no control, no ownership over that money. So that money actually belongs to the ืขืื himself. So in this case, ืจืื says that if the ืขืื happens to have such money, he's able to pay for himself and buy himself off from the treasurers of ืืงืืฉ. But one thing we do see from this ืืจืืืชื that if someone is ืืงืืืฉ an ืขืื, the ืขืื belongs to ืืงืืฉ. And this seems to contradict what ืจืื said in the name of ืจื before, that if someone is ืืงืืืฉ his ืขืื, he goes out free. And the ืืืจื answers, ืืชื ืืชืื ืงืจืืืช ืขืืื ืืจื? Are you asking me a ืงืืฉืื from a ืืจืืืชื on ืจื? ืจื ืชื ื ืืื ืืคืืื. ืจื is a ืชื ื himself, and he's able to argue on a ืืฉื ื or on a ืืจืืืชื. But the truth is that a ืชืืจืืฅ like this the ืืืจื only gives whenever we have no other ืชืืจืืฅ. But if the ืืืจื has another ืชืืจืืฅ, the ืืืจื usually does not like to give this ืชืืจืืฅ that ืจื argues on a ืืฉื ื or on a ืืจืืืชื. Then the
ืืืจื continues, ืชื ืฉืืข, come hear. I'll ask you another ืงืืฉืื on this ืืื of ืจื. There's a ืืจืืืชื that quotes the ืคืกืืง in ืืืงืจื in ืืืืงืืชื, ื"ื, it says, ืื ืื ืืจื ืืื' ืืืื. The actual ืคืกืืง is: ืื ืื ืืจื ืืฉืจ ืืืจื ืืืฉ ืื' ืืื ืืฉืจ ืื ืืืื ืืืืื ืืืฉืื ืืืืืชื, that if a person will be ืืืจืื, which is another form of ืืงืืฉ, and the ืคืกืืง says if he will ืืืจืื from whatever he owns, whether it is an ืืื or a ืืืื or whatever it is, whether it is a person that he owns or an animal that he owns, so the ืชืืจื continues that that actually becomes holy, it becomes ืืจื. Now, when the ืคืกืืง says that if a person is ืืืจืื from an ืืื, a person that he owns, what does that mean? The ืืจืืืชื says, ืืื ืขืืืื ืืฉืคืืืชืื ืืื ืขื ืื. This refers to the ืขืืืื and the ืฉืคืืืช, the male or female slaves that a person might own, so he is able to be ืืงืืืฉ them. So we see from this ืคืกืืง that a person is able to be ืืงืืืฉ his ืขืื. So the ืงืืฉืื is on ืจื: how could ืจื say that if you're ืืงืืืฉ your ืขืื, he automatically goes out free, when here we see that you're allowed to be ืืงืืืฉ your ืขืื? And ืื, let's answer that ืจื is a ืชื ื and he argues. But that we could only answer if we have a ืงืืฉืื from a ืืจืืืชื. But here, this is a ืืจืฉื on the ืคืกืืง. So it is if the ืคืกืืง tells us that a person is able to be ืืงืืืฉ his ืขืื, so what will ืจื do with this ืคืกืืง? And the ืืืจื answers, ืืื ืืืื ืขืกืงืื ื, that this is talking in a case ืืืืจ, where he said, ืืืื, that he takes upon himself the worth of the ืขืื. Because the reason we gave before why ืจื said that if he's ืืงืืืฉ his ืขืื we do not assume he meant that he takes upon himself to give to ืืงืืฉ the worth of the ืขืื, because if that's what he would have meant, he would have said that. So this ืคืกืืง is telling us that if he did say it, if he said clearly that I take upon myself to give to ืืงืืฉ the ืืืื, the worth of the ืขืื, then he is ืืืื to give that money to ืืงืืฉ. Then the ืืืจื continues, ืื ืืื, if so, ืืืื ื ืื ืืืืจ ืืืื. Why couldn't we answer the same ืชืืจืืฅ on the ืืจืืืชื before? Why did we have to answer before on the ืงืืฉืื we asked previously that ืจื argues on that ืืจืืืชื? Why couldn't we answer that in that ืืจืืืชื where it says that if you're ืืงืืืฉ your ื ืืกืื, and amongst them you have ืขืืืื, so then it is ืืงืืฉ, maybe that ืืจืืืชื means where he said ืืคืืจืืฉ that I take upon myself to give to ืืงืืฉ the worth of my ืขืืืื? So the ืืืจื says, ืื ืืื, if so, if the ืืจืืืชื would mean that, ืืื ืืืืืจืื ืจืฉืืื ืืืืฆืืื ืืืืจืืช, the ืืจืืืชื says that the ืืืืื, the treasurers of ืืงืืฉ, have no right to free the slaves, ืืืืจืื ืืื ืขืืืืชืืืื? What are the ืืืืจืื, the treasurers, doing here? In other words, what kind of connection do they have to the treasurers of ืืงืืฉ? Since he wasn't ืืงืืืฉ the ืขืืืื, he just accepted upon himself like a ื ืืจ to give to ืืงืืฉ the worth of the ืขืืืื, so why would we even think that the ืืืืจืื, the treasurers of ืืงืืฉ, have a right to sell these to free these ืขืืืื? These ืขืืืื do not belong to ืืงืืฉ at all! ืืชื, more than that, the ืืจืืืชื continues and says, ืืื ืืืืจืื ืืืชื ืืืืจืื, but the ืืืืจืื have a right to sell them to others, ืืืืจืื ืืืฆืืืื ืืืชื ืืืืจืืช, and others could free them if they want, ืืืจืื ืืื ืขืืืืชืืืื? What do others do here? How can the ืืืืจืื of ืืงืืฉ sell them to others if they do not belong to ืืงืืฉ to begin with, because he never was ืืงืืืฉ the ืขืืืื? He just took upon himself a ื ืืจ to give to ืืงืืฉ the worth of the ืขืืืื. ืืขืื more than that, ืจืื ืืืืจ, the ืืจืืืชื continues that ืจืื says, ืืืืจ ืื ื ืืฃ ืืื ื ืืชื ืืื ืขืฆืื ืืืืฆื, that the ืขืื himself is allowed to give his own money and go out free, ืืคื ื ืฉืืื ืืืืืจ ืื, because it's like the ืืืืจ of ืืงืืฉ is selling the ืขืื to himself. ืืื ืืืื, if this is a ืืจืืืชื where the case is that that person took upon himself to give to ืืงืืฉ the ืืืื, the worth of the ืขืืืื, ืืื ืืคื ื ืฉืืื ืืืืืจ ืื? What does the ืืจืืืชื mean that if the ืขืื gives his money to the treasurer of ืืงืืฉ, it's as if the ืืงืืฉ sold the ืขืื to himself? What kind of right does the ืืงืืฉ have to sell the ืขืื to himself? These ืขืืืื do not belong to ืืงืืฉ at all. And therefore we must say that the ืืจืืืชื is not talking in a case that he took upon himself the ืืืื. ืืื ืืื, the ืืจืืืชื is only in a case where he actually said he is ืืงืืืฉ his ืขืื. And the ืืจืืืชื learns that if you're ืืงืืืฉ your ืขืื, the ืขืื becomes ืงืืืฉืช ืืืื. And this is different than what ืจื said, that if you're ืืงืืืฉ your ืขืื, it cannot be ืงืืืฉืช ืืืื, and what that means is that he becomes free, becomes a part of ืขื ืงืืืฉ. So we have a ืกืชืืจื between the ืืจืืืชื and ืจื, and the only answer the ืืืจื could give is that ืจื ืชื ื ืืื ืืคืืื, that ืจื argues on that ืืจืืืชื. Going back a little bit in the ืืืจื, where the ืืืจื gave three reasons why certain rich people would become poor.
One reason was that they would free their ืืืืืฉืข ืขืืืื. The other reason was that they used to look on ืฉืืช what work has to be done in their fields after ืฉืืช. And the third reason was that they used to set up their main meal on ืฉืืช afternoon when the ืืื would learn the ืชืืจื in the ืืืช ืืืืจืฉ. So the ืืืจืฉ"ื gives the reason why these three things are a cause for a person to become poor. Concerning the first thing, he says, because when you free your ืขืื, you drop some of your property against the ืชืืจื, so then the punishment for that is that you lose your property completely. So since he freed his ืขืื and was ืขืืืจ on an ืขืฉื, so ืืฉื punishes him that he would lose his property completely. And the second thing, for those people who used to go on ืฉืืช and look into their property to see what has to be done, so the ืืืจืฉ"ื also explains, because the ืืืจื says in ืฉืืช ืืฃ ืง"ื , there was a story with a ืืกืื that on ืฉืืช he once passed by his field and he saw a fence that was broken, and it just entered his mind that after ืฉืืช he has to fix it. And just because of that, he made up his mind later not to do it at all, because on ืฉืืช he thought about his business, which he really shouldn't have. And because of that, ืืฉื made a miracle and his work was done by itself. So we see from there that when a person does not think about his work on ืฉืืช, that is a cause for a ืืจืื and ืืฆืืื to come into his property. So these people who did think about their work on ืฉืืช was a reason to take away the ืืฆืืื, to take away the ืืจืื in their property, and therefore this was a cause for them to lose their property. And concerning the third thing, which is those people that used to establish their meal on ืฉืืช in the time when they really should have been in the ืืืช ืืืืจืฉ learning ืชืืจื from the ืืื, so the ืืืจืฉ"ื says that the ืืืจื says in ืืจืืืช that the ืืกืืืื ืืจืืฉืื ืื, the first ืืกืืืื, they used to make ืชืืจืชื ืงืืข, they used to make their ืชืืจื permanent. And the ืืืจื explains, so what used to happen to their ืืืืื? What would happen to their work that they had to do in order to earn a livelihood? So the ืืืจื says that ืืืืืชื ืืชืืจืืช, their work would get blessed, there would be a special ืืฆืืื in their work because they would make their ืชืืจื a ืงืืข, they would make their ืชืืจื in a ืงืืืขืืช, in a strong, established way. So we see from there that when a person makes his ืชืืจื ืงืืข, this is a reason to have a ืืจืื in the person's property, in the person's work. So in this case, these people who would do just the opposite, that in the time when they should have been in the ืืืช ืืืืจืฉ learning, they would make their ืกืขืืื, their meal a ืงืืข, that should be the established, permanent thing, so that was a reason to take away their ืืจืื from their ืืืืื, from their work, and therefore this was a cause for them to lose their money, to become poor.
ืงืืืฉืช ืืืืฃ, and that means to free him, to put him in the ืขื ืงืืืฉ, to put him into the holy nation. So therefore, when a person says, "I am ืืงืืืฉ my ืขืื ืืืืื," which means for ืืืง ืืืืช, automatically he becomes free anyway, because since there is a ืืืจ of ืงืืืฉื similar to ืงืืืฉืช ืืืืฃ by an ืขืื, so therefore ืจืฉ"ื says the ืืืจื here couldn't have answered that the ืืจืืืชื is talking in a case where he said, "I am ืืงืืืฉ the ืขืื ืืืืื," and that's the case where the ืืืืจ of ืืงืืฉ has a right to sell him, etc., because his ืืืื belong to ืืืง ืืืืช, because there is no such thing, because as soon as he says, "I am ืืงืืืฉ the ืขืื," automatically he becomes ืขื ืงืืืฉ, and he goes out free. So, therefore, the only way we could have said that the ืืจืืืชื is talking about is where he says, "ืืื ืขืื ืขืื", that the worth of the ืขืื I take upon myself to give. But that the ืืืจื said couldn't be because of all the different expressions in the ืืฉื ื. So the only thing we're able to say is that there is an argument between ืจื and that ืืจืืืชื.
