Opening: Scope of today's shiur on Gittin 59

Jewish audio on Chabad.org. Today's ืฉื™ืขื•ืจ will be in ืžืกื›ืช ื’ื™ื˜ื™ืŸ ื“ืฃ ืœ"ื˜, but we will start on ื“ืฃ ืœ"ื— ืขืžื•ื“ ื‘', two lines from the bottom of the ืขืžื•ื“. And the ื’ืžืจื here is still in middle of the discussion concerning what ืจื‘ said, that if someone is ืžืงื“ื™ืฉ his ืขื‘ื“, he goes out free, and he gives the reason that really, as ืจืฉ"ื™ explains, that there are three possibilities for what a person could mean when he is ืžืงื“ื™ืฉ something. Sometimes a thing can become ืงื“ื•ืฉืช ื”ื’ื•ืฃ, that if it is something that can be used as a ืงืจื‘ืŸ on the ืžื–ื‘ื—, so then the object itself becomes ืงื“ื•ืฉ, becomes holy, and must be used as a ืงืจื‘ืŸ. Then there is a possibility of saying that I accept upon myself the worth of a certain object. So then the object itself has nothing to do to the ืงื“ื•ืฉื”, but the person is just obligated to give to ื”ืงื“ืฉ the amount of money that that object is worth. Then there is a third possibility, that a person could be ืžืงื“ื™ืฉ an object, but the object itself cannot be brought as a ืงืจื‘ืŸ on the ืžื–ื‘ื—, but what he meant was that this object should belong to ื”ืงื“ืฉ, to ื‘ื“ืง ื”ื‘ื™ืช, and ื”ืงื“ืฉ would sell that object, and the money ื”ืงื“ืฉ would get for that object would be used for ื‘ื“ืง ื”ื‘ื™ืช, for the fixing of the ื‘ื™ืช ื”ืžืงื“ืฉ. Now, in the case of a person being ืžืงื“ื™ืฉ an ืขื‘ื“, all three possibilities don't apply. The first possibility, that the ืขื‘ื“ himself should become ืงื“ื•ืฉ and should be used as a ืงืจื‘ืŸ, definitely does not apply. The other possibility, that he meant that he takes it upon himself to give to ื”ืงื“ืฉ the amount of money that the ืขื‘ื“ is worth, doesn't apply here either, ืจื‘ said, because if that's what he meant, he would have said that. He would have said, "ื“ืžื™ ื”ืขื‘ื“ ืขืœื™," the worth, the money of the ืขื‘ื“ is upon me. And since he didn't say that, obviously this is not what he meant. The third possibility, that maybe he meant that the ืขื‘ื“ should become holy and belong to ื”ืงื“ืฉ, that ื”ืงื“ืฉ should have to sell him and use the money for ื‘ื“ืง ื”ื‘ื™ืช, doesn't apply here either. Because as ืจืฉ"ื™ explained before, that we only say in a case where the object is something that cannot become ืงื“ื•ืฉืช ื”ื’ื•ืฃ. So then we say the ืงื“ื•ืฉื” that he meant was ืงื“ื•ืฉืช ื“ืžื™ื. For instance, if someone is ืžืงื“ื™ืฉ ืงืจืงืข or someone is ืžืงื“ื™ืฉ a ื‘ื”ืžื” ื˜ืžืื”, if someone said that a piece of land should be ื”ืงื“ืฉ, a ื‘ื”ืžื” ื˜ืžืื”, a non-kosher animal, should be ื”ืงื“ืฉ. So there is no way we could apply ืงื“ื•ืฉืช ื”ื’ื•ืฃ to this object. There's no way that this object could have any ืงื“ื•ืฉื” in the body itself. So therefore we say, what kind of ืงื“ื•ืฉื” will fall upon this object? Only this type of ืงื“ื•ืฉื”, that it belongs to ื”ืงื“ืฉ, and ื”ืงื“ืฉ will sell it, and the money will be used for ื‘ื“ืง ื”ื‘ื™ืช. But let's say if someone is ืžืงื“ื™ืฉ ืชืžื™ืžื™ื ืœื‘ื“ืง ื”ื‘ื™ืช, if someone is ืžืงื“ื™ืฉ an animal that is fit for a ืงืจื‘ืŸ for ื‘ื“ืง ื”ื‘ื™ืช, so then automatically that animal has to be used as a ืงืจื‘ืŸ. Even if the person said clearly that, "I'm only ืžืงื“ื™ืฉ it for ื‘ื“ืง ื”ื‘ื™ืช," since it's an object that can be used for a ืงืจื‘ืŸ, and he used the ืœืฉื•ืŸ ื”ืงื“ืฉ on that object, automatically that object has to be used as a ืงืจื‘ืŸ. And the same here, too. Since there is a possibility of ืงื“ื•ืฉืช ื”ื’ื•ืฃ, a certain type of ืงื“ื•ืฉืช ื”ื’ื•ืฃ on this ืขื‘ื“, and that is that this ืขื‘ื“ should become part of ืขื ืงื“ื•ืฉ, part of the Jewish nation, of the holy nation, so then there is no such thing as being ืžืงื“ื™ืฉ it ืœื“ืžื™ื, that it should become ืงื“ื•ืฉ and belong to ื”ืงื“ืฉ only for its value to be sold. And therefore ืจื‘ said that if someone is ืžืงื“ื™ืฉ an ืขื‘ื“, there is no other choice but to say that what he meant was that he should become part of ืขื ืงื“ื•ืฉ, part of the Jewish nation, and automatically ื™ืฆื ืœื—ื™ืจื•ืช, he goes out free. And now we will learn the ื’ืžืจื where the ื’ืžืจื asks a ืงืฉื™ื on ืจื‘. The ื’ืžืจื says, "ืชื ืฉืžืข," come here, we learned in a ื‘ืจื™ื™ืชื: "ื”ืžืงื“ื™ืฉ ืขื‘ื“ื•," if someone is ืžืงื“ื™ืฉ his ืขื‘ื“, "ืขื•ืฉื” ื•ืื•ื›ืœ," he works and he supports himself, he eats from the money that he earns, "ืฉืœื ื”ื™ืงื“ื™ืฉ ืืœื ื“ืžื™ื•," because when he was ืžืงื“ื™ืฉ him, he was only ืžืงื“ื™ืฉ him for his ื“ืžื™ื, for his worth. Because we would think that since his master was ืžืงื“ื™ืฉ him, he belongs to ื”ืงื“ืฉ, so any money he earns should belong to ื”ืงื“ืฉ. And if he would use the money he earns, he would be ืžื•ืขืœ ื‘ื”ืงื“ืฉ, he would be having benefit of something that belongs to ื”ืงื“ืฉ ืฉืœื ื›ื“ื™ืŸ. So the ื‘ืจื™ื™ืชื tells us, "No, he's allowed to use his money to support himself, because the money is not ื”ืงื“ืฉ. He only belongs to ื”ืงื“ืฉ for ื“ืžื™ื." And as ืจืฉ"ื™ explains, what the ื’ืžืจื thought the ืคืฉื˜ in the ื‘ืจื™ื™ืชื was, that when the master was ืžืงื“ื™ืฉ him, the ืขื‘ื“ actually belongs to ื”ืงื“ืฉ, but only ืœื“ืžื™ื•. He belongs to ื”ืงื“ืฉ that ื”ืงื“ืฉ will sell him, and the money that ื”ืงื“ืฉ will get for him will belong to ื‘ื“ืง ื”ื‘ื™ืช. But in the meantime, we see that this is a ืกืชื™ืจื”, a contradiction to what ืจื‘ said. Because ืจื‘ said if someone is ืžืงื“ื™ืฉ his ืขื‘ื“, we cannot assume that he was ืžืงื“ื™ืฉ him ืœื“ืžื™ื•, that he was ืžืงื“ื™ืฉ him that he belongs to ื”ืงื“ืฉ only for his value that ื”ืงื“ืฉ should sell him, because as we said before, in this case, we do not say that you could be ืžืงื“ื™ืฉ ืœื“ืžื™ื•. And what did he mean? That he should become part of ืขื ืงื“ื•ืฉ, he should become free. And in this ื‘ืจื™ื™ืชื we see that when someone is ืžืงื“ื™ืฉ his ืขื‘ื“, we do say that he was ืžืงื“ื™ืฉ him ืœื“ืžื™ื•, that he belongs to ื”ืงื“ืฉ for his value, that first ื”ืงื“ืฉ will sell him and use the money for ื‘ื“ืง ื”ื‘ื™ืช. And the ื’ืžืจื answers, ื”ื ืžื ื™ ืจื‘ื™ ืžืื™ืจ ื”ื™ื, that this ื‘ืจื™ื™ืชื goes according to ืจื‘ื™ ืžืื™ืจ. ื“ืืžืจ, that ืจื‘ื™ ืžืื™ืจ says, ืื™ืŸ ืื“ื ืžื•ืฆื™ื ื“ื‘ืจื™ื• ืœื‘ื˜ืœื”, that a person does not use words in vain. That when a person says something, and if we take his words literally, it has no meaning, so what we have to do is we have to interpret it in such a way that it should have meaning. And ืจื‘ื™ ืžืื™ืจ said this in ื’ืžืจื ืขืจื›ื™ืŸ ื“ืฃ ื”ืณ concerning the ื“ื™ืŸ of ืขืจื›ื™ืŸ. The ื“ื™ืŸ of ืขืจื›ื™ืŸ is that when a person says, ืขืจื›ื™ ืขืœื™, I take upon myself to give to ื”ืงื“ืฉ the ืขืจืš that I am worth, or ืขืจื›ื• ืขืœื™, the ืขืจืš, the worth of another person, or he says ืขืจื›ืš ืขืœื™, he says to a person, your ืขืจืš, your worth I take upon myself to give to ื”ืงื“ืฉ. So it depends what ืœืฉื•ืŸ, what expression he used. If he uses the ืœืฉื•ืŸ ื“ืžื™ ืขืœื™, my money, my worth is upon me, or your worth is upon me, so then he has to pay the worth of the person that he took his value upon himself. The ื‘ื™ืช ื“ื™ืŸ would evaluate how much he is worth or how much the other person is worth, meaning how much he would be worth to be sold as a slave in the market, and that's how much he has to give to ื”ืงื“ืฉ. But if he uses the term ืขืจืš, ืขืจื›ื™ ืขืœื™, ืขืจื›ืš ืขืœื™, ืขืจื›ื• ืขืœื™, so then the ืชื•ืจื” has set up a fixed amount of money based on the age of the person of whose ืขืจืš he accepted upon himself. For instance, if that person is in the age between a month and five years, so then he has to pay five ืฉืงืœื™ื if it's a male, and three ืฉืงืœื™ื if it's a female. If he is between five and twenty, so then if it's a male, it's twenty ืฉืงืœื™ื, if it's a female, it's ten ืฉืงืœื™ื. If he is between twenty and sixty, so then if it's a male, it's fifty ืฉืงืœื™ื, if it's a female, then it's thirty ืฉืงืœื™ื. If the child is under a month, under a ื—ื•ื“ืฉ, so then there is no ื“ื™ืŸ of ืขืจื›ื™ืŸ. So the case is if a person says: I take upon myself the ืขืจืš of that child that's under a ื—ื•ื“ืฉ, under a month old. So the ื—ื›ืžื™ื hold that since there is no ืขืจืš for a child under a month, so then these words don't mean anything and he is ืคื˜ื•ืจ from giving any money to ื”ืงื“ืฉ. But ืจื‘ื™ ืžืื™ืจ says, since a person does not say something for no reason, so if we take his words literally, they will not mean anything, so we must interpret it and say that probably what he meant was not that he takes upon himself the ืขืจืš of that child, but he takes upon himself the ื“ืžื™ื of that child, the value of that child. And therefore, the ื‘ื™ืช ื“ื™ืŸ would have to evaluate how much that child is worth, and he would be obligated to pay the value of that child. And our ื’ืžืจื here wants to say that our ื‘ืจื™ื™ืชื also goes according to ืจื‘ื™ ืžืื™ืจ and follows the same ืกื‘ืจื. In other words, that everyone really holds that when somebody is ืžืงื“ื™ืฉ an ืขื‘ื“, the ืขื‘ื“ cannot be ืงื“ื•ืฉ ืœื“ืžื™ื•. There is no such thing as having the ืขื‘ื“ belong to ื”ืงื“ืฉ, becoming ื”ืงื“ืฉ, that ื”ืงื“ืฉ will sell him and use the money for ื‘ื“ืง ื”ื‘ื™ืช. So what do we say did he mean when he was ืžืงื“ื™ืฉ his ืขื‘ื“? So ืจื‘ื™ ืžืื™ืจ says, since we have to interpret his words in a way it should have some meaning, so ืจื‘ื™ ืžืื™ืจ interprets it and says that it's as if he said: I accept upon myself the value of this ืขื‘ื“. And this statement has no effect on the ืขื‘ื“ at all, the ืขื‘ื“ is not ื”ืงื“ืฉ at all, but the person who was ืžืงื“ื™ืฉ the ืขื‘ื“ is now obligated to give to ื”ืงื“ืฉ the money that this ืขื‘ื“ is worth. And this is what the ื‘ืจื™ื™ืชื meant when it said, ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื•, that when he was ืžืงื“ื™ืฉ his ืขื‘ื“, he was only ืžืงื“ื™ืฉ the value of the ืขื‘ื“, meaning that he took upon himself to give to ื”ืงื“ืฉ the value of this ืขื‘ื“. The ื’ืžืจื continues, ื”ื›ื ื ืžื™ ืžืกืชื‘ืจื, it is also a ืกื‘ืจื to say that this is the ืคืฉื˜ in the ื‘ืจื™ื™ืชื. It's done this way because it says at the end of the ื‘ืจื™ื™ืชื, ื•ื›ืŸ ื”ื•ื ืฉื”ืงื“ื™ืฉ ืขืฆืžื•, the same is if a person is ืžืงื“ื™ืฉ himself ืขื•ืฉื”, he is allowed to work, ื•ืื•ื›ืœ, and would support himself with the money that he earned. And even though he was ืžืงื“ื™ืฉ himself, still we don't say the money that he earned goes to ื”ืงื“ืฉ, ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื•, the same reason as we gave before, because he is ืžืงื“ื™ืฉ only the value. The ื’ืžืจื explains: ืื™ ืืžืจืช ื‘ืฉืœืžื, if you're going to explain this ื‘ืจื™ื™ืชื that it goes according to ืจื‘ื™ ืžืื™ืจ, and when the ื‘ืจื™ื™ืชื says ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื• means that we say that he accepted upon himself to pay to ื”ืงื“ืฉ the value of his ืขื‘ื“, ืฉืคื™ืจ. So we understand how the ื‘ืจื™ื™ืชื can say that also concerning himself, that when he was ืžืงื“ื™ืฉ himself, so what he meant was that he takes upon himself to give ื”ืงื“ืฉ the value of himself. And the reason we say that's what he means is because ืจื‘ื™ ืžืื™ืจ holds that a person is not ืžื•ืฆื™ื ื“ื‘ืจื™ื• ืœื‘ื˜ืœื”. So since we cannot say anything else when he says, "I am ืžืงื“ื™ืฉ myself," the only thing that he could mean is that he takes upon himself to give to ื”ืงื“ืฉ the value of himself. ืืœื ืื™ ืืžืจืช ืจื‘ื ืŸ ื”ื™ื, but if you're going to tell me no, that it does not go according to ืจื‘ื™ ืžืื™ืจ, but it goes according to the ืจื‘ื ืŸ, and the ืคืฉื˜ in the words of the ื‘ืจื™ื™ืชื ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื• means as we thought before, that when he is ืžืงื“ื™ืฉ his ืขื‘ื“, his ืขื‘ื“ actually belongs to ื”ืงื“ืฉ, and ื”ืงื“ืฉ will sell him and the money will go to ื”ืงื“ืฉ. So ื‘ืฉืœืžื ืขื‘ื“ื• ืœื“ืžื™ ืงืื™, so we can understand how the ื‘ืจื™ื™ืชื can say that concerning his ืขื‘ื“, because an ืขื‘ื“ is something that belongs to somebody, so we can understand that he should belong to ื”ืงื“ืฉ, and ื”ืงื“ืฉ will sell him, and ื”ืงื“ืฉ will take the money. ืืœื ืื™ื”ื•, but he, ืœื“ืžื™ ืงืื™? Does he stand for money? In other words, does he belong to anybody? So if we say that the words ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื• means that he belongs to ื”ืงื“ืฉ ืœื“ืžื™ื•, so the same thing would have to be in the ืกื™ืคื too, that when it speaks about himself, we should also say the ืคืฉื˜ is ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื•, that he belongs to ื”ืงื“ืฉ ืœื“ืžื™ื•, and that is impossible to say. A person does not belong to ื”ืงื“ืฉ, and ื”ืงื“ืฉ cannot sell him. So therefore we must say that what does the ื‘ืจื™ื™ืชื mean when it says ืฉืœื ื”ืงื“ื™ืฉ ืืœื ื“ืžื™ื•, that we assume that he accepted upon himself to give to ื”ืงื“ืฉ the value of the ืขื‘ื“. And the same thing with the ืกื™ืคื, that he accepted upon himself to give to ื”ืงื“ืฉ the value of himself. And the reason for that is because it goes according to ืจื‘ื™ ืžืื™ืจ, that a person is not ืžื•ืฆื™ื ื“ื‘ืจื™ื• ืœื‘ื˜ืœื”, and therefore we say when he was ืžืงื“ื™ืฉ his ืขื‘ื“, that this is what he meant. Then the ื’ืžืจื continues: ืœื™ืžื ื›ืชื ืื™, can I say that this ื“ื™ืŸ, when a person is ืžืงื“ื™ืฉ an ืขื‘ื“, whether he goes out free or he belongs to ื”ืงื“ืฉ, is a ืžื—ืœื•ืงืช between ืชื ืื™ื? We learned: ื”ืžืงื“ื™ืฉ ืขื‘ื“ื•, someone who is ืžืงื“ื™ืฉ his ืขื‘ื“, ืื™ืŸ ืžื•ืขืœื™ืŸ ื‘ื•. The ืชื ื ืงืžื says you are not ืžื•ืขืœ, if you have ื”ื ืื” from that ืขื‘ื“, it is not considered that you are ืžื•ืขืœ ื‘ื”ืงื“ืฉ, that you have benefit of ื”ืงื“ืฉ ืฉืœื ื›ื“ื™ืŸ. But ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ ืื•ืžืจ, ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ says, ืžื•ืขืœื™ืŸ ื‘ืฉืขืจื•, that you have, if you have benefit from his hair, then you are ืžื•ืขืœ in the hair. So ืžืื™ ืœืื•, don't you think ื‘ื”ื ืงืžื™ืคืœื’ื™, that this is their ืžื—ืœื•ืงืช: ื“ืžืจ ืกื‘ืจ ืงื“ื•ืฉ, ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ who says that you are ืžื•ืขืœ in his hair, it is because he holds that when someone is ืžืงื“ื™ืฉ an ืขื‘ื“, the ืขื‘ื“ becomes ืงื“ื•ืฉ, and therefore you are ืžื•ืขืœ if you have benefit of the ืขื‘ื“. ื•ืžืจ ืกื‘ืจ, and the other one, the ืชื ื ืงืžื, that says that you are not ืžื•ืขืœ in the ืขื‘ื“, because he holds ืœื ืงื“ื•ืฉ, that when you're ืžืงื“ื™ืฉ your ืขื‘ื“, he doesn't become ืงื“ื•ืฉ. And the ื’ืžืจื says: ื•ืชืกื‘ืจื? How can you think so? How can you explain this ืžื—ืœื•ืงืช that way? ื”ืื™ ืžื•ืขืœื™ืŸ ื‘ื• ื•ืื™ืŸ ืžื•ืขืœื™ืŸ ื‘ื•, why does the ื‘ืจื™ื™ืชื say the ืžื—ืœื•ืงืช is whether you are ืžื•ืขืœ if you have ื”ื ืื” from this ืขื‘ื“, or you are not ืžื•ืขืœ? It should have said ื”ืื™ ืงื“ื•ืฉ ื•ืื™ื ื• ืงื“ื•ืฉ ืžื™ื‘ืขื™ ืœื™ื”! It should have said in the ื‘ืจื™ื™ืชื: the ืชื ื ืงืžื holds he is not ืงื“ื•ืฉ, and ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ holds he is ืงื“ื•ืฉ, if the whole ืžื—ืœื•ืงืช is based whether he is ืงื“ื•ืฉ or not. ืืœื, therefore we must say, ื“ื›ื•ืœื™ ืขืœืžื ืงื“ื•ืฉ, no, everyone holds that when you're ืžืงื“ื™ืฉ your ืขื‘ื“, the ืขื‘ื“ is ืงื“ื•ืฉ. ื•ื”ื›ื ื‘ื”ื ืงืžื™ืคืœื’ื™, and here the ืžื—ืœื•ืงืช is in something else: ืžืจ ืกื‘ืจ ืขื‘ื“ื™ ื›ืžืงืจืงืขื™ ื“ืžื™, that one holds that ืขื‘ื“ื™ื have the same ื“ื™ืŸ as ืงืจืงืข, as land. And just like there's a ื“ื™ืŸ that ืื™ืŸ ืžืขื™ืœื” ื‘ืงืจืงืขื•ืช, that if a person has ื”ื ืื” from land that belongs to ื”ืงื“ืฉ, he is not ืขื•ื‘ืจ on the ืื™ืกื•ืจ of ืžืขื™ืœื”, even though it is ืืกื•ืจ to have ื”ื ืื” from ืงืจืงืข that belongs to ื”ืงื“ืฉ, but there is no ื“ื™ืŸ ืžืขื™ืœื” by ืงืจืงืข of ื”ืงื“ืฉ. The same way, if you have ื”ื ืื”, benefit from an ืขื‘ื“ that belongs to ื”ืงื“ืฉ, there is no ื“ื™ืŸ ืžืขื™ืœื”, because ืขื‘ื“ื™ื have the same ื“ื™ืŸ as ืงืจืงืข. ื•ืžืจ ืกื‘ืจ, and one holds, but ืžื˜ืœื˜ืœื™ ื“ืžื™, that ืขื‘ื“ื™ื have a ื“ื™ืŸ like movable items, not like ืงืจืงืข. And therefore, if you have ื”ื ืื” from an ืขื‘ื“, you are ืขื•ื‘ืจ on the ืื™ืกื•ืจ of ืžืขื™ืœื”. ื’ืžืจื says: ืื™ ื”ื›ื™, if so, ืขื“ ื“ืžื™ืคืœื’ื™ ื‘ืฉืขืจื™ื”, instead of arguing concerning the hair, if you have ื”ื ืื” from his hair, if you are ืžื•ืขืœ or not, ืœื™ืคืœื’ื• ื‘ื’ื•ืคื™ื”, let them have an argument in the ื’ื•ืฃ itself, in the body of the ืขื‘ื“, in any part of the ืขื‘ื“. If you have any ื”ื ืื” from the ืขื‘ื“, whether you are ืžื•ืขืœ or you're not ืžื•ืขืœ. ืืœื, therefore you must say, ื›ื•ืœื™ ืขืœืžื ืขื‘ื“ื™ ื›ืžืงืจืงืขื™ ื“ืžื™, that everyone holds that an ืขื‘ื“ is like ืงืจืงืข. And therefore, if you have ื”ื ืื” from the ืขื‘ื“, you are not ืžื•ืขืœ, because just like you are not ืžื•ืขืœ in ืงืจืงืข, you are not ืžื•ืขืœ in the ืขื‘ื“. The only ืฉืืœื” is: ื•ื”ื›ื ื‘ืฉืขืจ ื”ืขื•ืžื“ ืœื”ื™ื’ื–ื– ืงืžื™ืคืœื’ื™. The ืžื—ืœื•ืงืช is only concerning the hair, concerning hair that are ripe to be cut. And the ืžื—ืœื•ืงืช is that ืžืจ ืกื‘ืจ ื›ื’ื–ื•ื– ื“ืžื™, one holds that anything that is ready to be cut, we consider it as if it was cut already. So therefore, we consider the hair as if as being not part of the ืขื‘ื“, and therefore the hair is not considered like land, and if you have ื”ื ืื” from the hair, you are ืžื•ืขืœ. ื•ืžืจ ืกื‘ืจ, and the other one holds, ืœืื• ื›ื’ื–ื•ื– ื“ืžื™, that even though it's ready to be cut, it's not considered as if it's cut. So the hair is considered as part of the ืขื‘ื“, so just like the ืขื‘ื“ is considered ืงืจืงืข, and you have ื”ื ืื” from the ืขื‘ื“ you are not ืžื•ืขืœ, the same way, if you have ื”ื ืื” from the hair, you are not ืžื•ืขืœ. Then the ื’ืžืจื continues: ืœื™ืžื, let us say, ื”ื ื™ ืชื ืื™ ื›ื”ื ื™ ืชื ืื™, that the ืžื—ืœื•ืงืช between these ืชื ืื™ื is the same ืžื—ืœื•ืงืช as other ืชื ืื™ื. This ืžื—ืœื•ืงืช, whether hair that is ready to be cut, whether we consider it as if it's cut already or not, is really also a ืžื—ืœื•ืงืช of other ืชื ืื™ื. Because ื“ืชื ืŸ, we learned in the ืžืฉื ื”: ืจื‘ื™ ืžืื™ืจ ืื•ืžืจ, ืจื‘ื™ ืžืื™ืจ says, ื™ืฉ ื“ื‘ืจื™ื ืฉื”ืŸ ื›ืงืจืงืข ื•ืื™ื ืŸ ื›ืงืจืงืข. There are things which are like land and not like land. In other words, even though they are really land, but in ื“ื™ืŸ they are not considered like land. ื•ืื™ืŸ ื—ื›ืžื™ื ืžื•ื“ื™ื ืœื•. ื—ื›ืžื™ื do not admit, agree with ืจื‘ื™ ืžืื™ืจ, that these objects that he is referring to don't have a ื“ื™ืŸ of ืงืจืงืข. ื›ื™ืฆื“? For instance, ืขืฉืจ ื’ืคื ื™ื ื˜ืขื•ื ื•ืช ืžืกืจืชื™ ืœืš, someone says to his watchman that I gave you to watch 10 vines which were full of grapes, ื•ื”ืœื” ืื•ืžืจ, and the watchman, the ืฉื•ืžืจ answers, ืื™ื ืŸ ืืœื ื—ืžืฉ, there were only five. ืจื‘ื™ ืžืื™ืจ ืžื—ื™ื™ื‘, ืจื‘ื™ ืžืื™ืจ says that the ืฉื•ืžืจ, the watchman has to swear because he is considered a ืžื•ื“ื” ื‘ืžืงืฆืช. The ื“ื™ืŸ is that when a person admits to part of the ื˜ืขื ื”, so then he has to swear ืžื“ืื•ืจื™ื™ืชื. That is called a ืฉื‘ื•ืขื” of ืžื•ื“ื” ื‘ืžืงืฆืช. On the other hand, there is a ื“ื™ืŸ that when if the argument is over ืงืจืงืข, is over land, then there is no ื“ื™ืŸ of ืฉื‘ื•ืขื”. So in this case, where the argument is over vines that grow from the ground that were full, and he claims that I gave you 10, and he says you only gave me five, so ืจื‘ื™ ืžืื™ืจ says that he has to swear like a regular ืžื•ื“ื” ื‘ืžืงืฆืช, even though the argument is over ืžื—ื•ื‘ืจ ืœืงืจืงืข, over something that is connected to the ground. ื•ื—ื›ืžื™ื ืื•ืžืจื™ื, but the ื—ื›ืžื™ื say, ื›ืœ ื”ืžื—ื•ื‘ืจ ืœืงืจืงืข ื”ืจื™ ื”ื•ื ื›ืงืจืงืข, anything that is connected to the ground is like the ground itself. So just like concerning land itself, there is no ื“ื™ืŸ of a ืฉื‘ื•ืขื”, so the same here, there is no ื“ื™ืŸ of a ืฉื‘ื•ืขื”. ืืžืจ ืจื‘ื™ ื™ื•ืกื™ ื‘ืจื‘ื™ ื—ื ื™ื ื, ืจื‘ื™ ื™ื•ืกื™ ื‘ืจื‘ื™ ื—ื ื™ื ื says, ืขื ื‘ื™ื ื”ืขื•ืžื“ื•ืช ืœื™ื‘ืฆืจ ืื™ื›ื ื‘ื™ื ื™ื™ื”ื•, that the real ืžื—ืœื•ืงืช between them is concerning grapes that are ready to be gathered. ืจื‘ื™ ืžืื™ืจ ืกื‘ืจ, ืจื‘ื™ ืžืื™ืจ holds, ื›ื‘ืฆื•ืจื•ืช ื“ืžื™, that since they are ripe and ready to be gathered, we consider them as if they were gathered. And therefore, even though they are connected to the ground, they don't have a ื“ื™ืŸ of ืงืจืงืข, because we consider them as if they were already taken off the vine. ื•ืจื‘ื ืŸ ืกื‘ืจื™, and the ืจื‘ื ืŸ hold, ืœืื• ื›ื‘ืฆื•ืจื•ืช ื“ืžื™, they are not considered as if they were gathered, so they are considered still ืžื—ื•ื‘ืจ ืœืงืจืงืข, that they are connected to the ground, and therefore they have the same ื“ื™ืŸ as ืงืจืงืข, and therefore, you do not swear in a ื˜ืขื ื” concerning these grapes. So this seems to be the same ืžื—ืœื•ืงืช as we explained before, because before we said the ืžื—ืœื•ืงืช was whether hair that is ready to be cut is considered as if it was cut or not. And the same thing here, grapes that are ready to be gathered off the tree, are they considered as if they were gathered or not? ื’ืžืจื says: ืืคื™ืœื• ืชื™ืžื ืจื‘ื™ ืžืื™ืจ, that ื‘ืืžืช you could say that even ืจื‘ื™ ืžืื™ืจ who holds in the case of grapes that we consider it as if it was taken off the vine, in the case of the hair he would admit that we do not consider it as if it was cut, because ืขื“ ื›ืืŸ ืœื ืงืืžืจ ืจื‘ื™ ืžืื™ืจ, when does ืจื‘ื™ ืžืื™ืจ say his ื“ื™ืŸ? Only ื”ืชื, only there, by ืขื ื‘ื™ื, by the case of the grapes, because ื“ื›ืžื” ื“ืงื™ื™ืžื™ ืžื›ื—ืฉื™ ื›ื—ื™ืฉื™, the longer they stay on the tree, the worse they will get. So therefore, when the time comes for it to be taken off the tree, we consider it as if it was taken off the tree. ืื‘ืœ ื”ื›ื, but here in the case of the hair, ื›ืžื” ื“ืงื™ื™ืžื™ ืืฉื‘ื•ื—ื™ ืžืฉื‘ื—, the longer it stays on the head, the better it gets. So here, we do not consider it as if it was cut. ื”ื’ืžืจื continues, ืกืœื™ืง ืจื‘ ื—ื™ื™ื ื‘ืจ ื™ื•ืกืฃ, when ืจื‘ ื—ื™ื™ื ื‘ืจ ื™ื•ืกืฃ went up to ืืจืฅ ื™ืฉืจืืœ, ืืžืจ ืœื” ืœื”ืื™ ืฉืžืขืชื ื“ืจื‘ ืงืžื™ื” ื“ืจื‘ื™ ื™ื•ื—ื ืŸ, he gave over the ืžื™ืžืจื, the saying of ืจื‘ to ืจื‘ื™ ื™ื•ื—ื ืŸ. And this refers to the saying of ืจื‘ that if someone is ืžืคืงื™ืจ his ืขื‘ื“, gives up his ownership over his ืขื‘ื“, he goes out free. ืืžืจ ืœื™ื”, so ืจื‘ื™ ื™ื•ื—ื ืŸ said to him, ืืžืจ ืจื‘ ื”ื›ื™? Did ืจื‘ really say so? The ื’ืžืจื asks, why was he surprised? ื•ื”ื•ื ืœื ืืžืจ ื”ื›ื™? Doesn't he himself say the same thing? ื•ื”ื ืืžืจ ืขื•ืœื ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, didn't ืขื•ืœื say in the name of ืจื‘ื™ ื™ื•ื—ื ืŸ, ื”ืžืคืงื™ืจ ืขื‘ื“ื• ื™ืฆื ืœื—ื™ืจื•ืช, that if someone is ืžืคืงื™ืจ his ืขื‘ื“ he goes out free, ื•ืฆืจื™ืš ื’ื˜ ืฉื—ืจื•ืจ, but he needs a ื’ื˜ ืฉื—ืจื•ืจ? His master must write to him a ื’ื˜ ืฉื—ืจื•ืจ. But we see he's of the same opinion as ืจื‘, that if you're ืžืคืงื™ืจ your ืขื‘ื“ he goes out free. The ื’ืžืจื answers, ื”ื›ื™ ืงืืžืจ ืœื™ื”, this is what he said to him: ืืžืจ ืจื‘ ื›ื•ื•ืชื™? Did ืจื‘ say like I do? In other words, he was surprised that ืจื‘ is of the same opinion as him. ื•ืื™ื›ื ื“ืืžืจื™, and some say, ืœื ืกื™ื™ืžื•ื” ืงืžื™ื”, that they did not finish the whole statement of ืจื‘. Because as we learned in the ื’ืžืจื before, there were two parts to ืจื‘'s statement: The first part was that ืจื‘ said if someone is ืžืคืงื™ืจ his ืขื‘ื“, he goes out free; then the other part was that he needs a ื’ื˜ ืฉื—ืจื•ืจ, but he still has to have

that ืฉื˜ืจ ืฉื—ืจื•ืจ. So when they told this to ืจื‘ื™ ื™ื•ื—ื ืŸ, they only told him the first part of the statement, and they didn't tell him the other part of the statement. So therefore, when he said to him, ืืžืจ ืœื™ื”, he said to him, ื•ืœื ืืžืจ ืจื‘, did not ืจื‘ say ื•ืฆืจื™ืš ื’ื˜ ืฉื—ืจื•ืจ, that you need a ื’ื˜ ืฉื—ืจื•ืจ? That was his surprise. ื•ืจื‘ื™ ื™ื•ื—ื ืŸ ืœื˜ืขืžื™ื”, why was he surprised of that? Because ืจื‘ื™ ื™ื•ื—ื ืŸ goes along with his own opinion, ื“ืืžืจ ืขื•ืœื ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, ืขื•ืœื said in the name of ืจื‘ื™ ื™ื•ื—ื ืŸ, ื”ืžืคืงื™ืจ ืขื‘ื“ื•, if someone is ืžืคืงื™ืจ his ืขื‘ื“, ื™ืฆื ืœื—ื™ืจื•ืช, he goes out free, ื•ืฆืจื™ืš ื’ื˜ ืฉื—ืจื•ืจ, and he needs a ื’ื˜ ืฉื—ืจื•ืจ. Then the ื’ืžืจื continues, ื’ื•ืคื, now we're going to discuss the ื’ื•ืฃ of the ื“ื™ืŸ that we mentioned before, ื“ืืžืจ ืขื•ืœื ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, ืขื•ืœื said in the name of ืจื‘ื™ ื™ื•ื—ื ืŸ, ื”ืžืคืงื™ืจ ืขื‘ื“ื• ื™ืฆื ืœื—ื™ืจื•ืช, if you're ืžืคืงื™ืจ your ืขื‘ื“ he goes out free, ื•ืฆืจื™ืš ื’ื˜ ืฉื—ืจื•ืจ, and he needs a ื’ื˜ ืฉื—ืจื•ืจ. ืื™ืชื™ื‘ื™ื” ืจื‘ื ืœืขื•ืœื, ืจื‘ื asked a ืงื•ืฉื™ื to ืขื•ืœื: We learned, ื’ืจ ืฉืžืช ื•ื‘ื–ื‘ื–ื• ื™ืฉืจืืœ ื ื›ืกื™ื•, if a ื’ืจ dies and ื™ื™ื“ืŸ grab his property, because a ื’ืจ is the only person that is able not to have ื™ื•ืจืฉื™ื. Normally, every ื™ื™ื“ has ื™ื•ืจืฉื™ื, has people to inherit. If he doesn't have children then he has other relatives. But you always find the next relative that he is the next in line of ื™ืจื•ืฉื”. The only person that it's possible that he doesn't have any ื™ื•ืจืฉื™ื at all is a ื’ืจ. If he does not have children from when after he was ืžื’ื™ื™ืจ, after he converted. Then what happens to his property after he dies? Then it becomes ื”ืคืงืจ automatically, it becomes ownerless because there is no one to ื™ืจืฉ him. So anybody who wants could take it. That's why the ื‘ืจื™ื™ืชื says, if a ื’ืจ dies and ื™ื™ื“ืŸ started grabbing his property, ื•ื”ื™ื• ื‘ื”ืŸ ืขื‘ื“ื™ื, and among this property there were slaves, ืขื‘ื“ื™ื ื›ื ืขื ื™ื, so the ื“ื™ืŸ is that ื‘ื™ืŸ ื’ื“ื•ืœื™ื ื‘ื™ืŸ ืงื˜ื ื™ื, whether they are adults or they are still children, ืงื ื• ืขืฆืžืŸ ื‘ื ื™ ื—ื•ืจื™ืŸ, they are ืงื•ื ื” themselves and they become free. Since we say that they became ื”ืคืงืจ, so the first one that will grab them will be ืงื•ื ื” them, so they are the ones that grabbed themselves first, and they are ืงื•ื ื” themselves and therefore they become free.

Aba Shaulโ€™s View on Adults vs. Children Becoming Free

ืื‘ื ืฉืื•ืœ ืื•ืžืจ, but ืื‘ื ืฉืื•ืœ says, ื’ื“ื•ืœื™ื ืงื ื• ืขืฆืžืŸ ื‘ื ื™ ื—ื•ืจื™ืŸ, that the ื’ื“ื•ืœื™ื, those that are adults, they ื˜ืืงืข are ืงื•ื ื” themselves free and they become free, ืงื˜ื ื™ื, but the children, ื›ืœ ื”ืžื—ื–ื™ืง ื‘ื”ืŸ ื–ื›ื” ื‘ื”ืŸ, anybody who grabs them first is ื–ื•ื›ื”. And the reason is, because a child, a ืงื˜ืŸ, cannot be ืงื•ื ื”, and since these ืงื˜ื ื™ื cannot be ืงื•ื ื” they cannot be ืงื•ื ื” themselves either. So therefore, they remain ื”ืคืงืจ, and the first ื™ื™ื“ that will grab them will be ืงื•ื ื” them. The ืฉืืœื” is, ื•ื›ื™ ืžื™ ื›ืชื‘ ื’ื˜ ืฉื—ืจื•ืจ ืœืืœื•? But who wrote to them a ื’ื˜ ืฉื—ืจื•ืจ? If you hold that an ืขื‘ื“ that becomes ื”ืคืงืจ still needs a ื’ื˜ ืฉื—ืจื•ืจ to become a real ื‘ืŸ ื—ื•ืจื™ืŸ, so these ืขื‘ื“ื™ื here, who wrote them a ื’ื˜ ืฉื—ืจื•ืจ that we should say they become completely ื‘ื ื™ ื—ื•ืจื™ืŸ? It seems like this ืชืœืžื™ื“ ื—ื›ื that asked this question never studied anything in his life, because his question is not a good question at all. ื”ื’ืžืจื asks, ื˜ืขืžื ืžืื™? What is the reason? Why isn't it a good question? ื”ื’ืžืจื answers,

Rav Nachman Links a Slaveโ€™s Freedom to a Wifeโ€™s Divorce

ืืžืจ ืจื‘ ื ื—ืžืŸ, ืจื‘ ื ื—ืžืŸ said, ืงืกื‘ืจ ืขื•ืœื, ืขื•ืœื holds, ืขื‘ื“ื• ื“ื’ืจ ื›ืื™ืฉืชื•, that the ืขื‘ื“ of a ื’ืจ is the same as his wife. ืžื” ืืฉืชื• ืžืฉืชืœื—ื” ื‘ืœื ื’ื˜, just like his wife could be divorced and sent away without a ื’ื˜, that even though if he wants to divorce her while he is alive, he must give her a ื’ื˜. But if he doesn't divorce her and he dies, she becomes free without a ื’ื˜. ืืฃ ืขื‘ื“ื• ืžืฉืชืœื— ื‘ืœื ื’ื˜, the same with the ืขื‘ื“ื™ื of the ื’ืจ, they become free without a ื’ื˜. If he wants to send them away free while he's alive, then he must give them a ื’ื˜ ืฉื—ืจื•ืจ. But if he dies, they become free automatically without a ื’ื˜, just like his wife. And the reason we compare an ืขื‘ื“ to the wife is because, as ืจืฉืดื™ says, we learn it out from a ื’ื–ื™ืจื” ืฉื•ื”, that concerning the ื’ื˜ of a woman, it says in the ืชื•ืจื”, ื•ื›ืชื‘ ืœื” ืกืคืจ ื›ืจื™ืชื•ืช, and he should write to her a ื’ื˜, a ืกืคืจ ื›ืจื™ืชื•ืช. And the ืชื•ืจื” uses the word ืœื”. Concerning freeing an ืขื‘ื“, the ืชื•ืจื” uses the ืœืฉื•ืŸ, ืื• ื—ืคืฉื” ืœื ื ื™ืชืŸ ืœื”, freedom was not given to her. And there the ืชื•ืจื” also uses the ืœืฉื•ืŸ ืœื”. So we learn a ื’ื–ื™ืจื” ืฉื•ื”, ืœื”, ืœื”. The same ื“ื™ืŸ that applies to a woman, to a wife, the same ื“ื™ืŸ applies to an ืขื‘ื“. And that's what he says, just like if the ื’ืจ dies, his wife is free automatically without a ื’ื˜, so the ืขื‘ื“ of the ื’ืจ also becomes free after the ื’ืจ dies. The

Does the Same Rule Apply to Regular Israelite Slaves?

ื’ืžืจื asks, ืื™ ื”ื›ื™, if so, ืืคื™ืœื• ื™ืฉืจืืœ ื ืžื™, the same should apply to regular ืื™ื“. The ื“ื™ืŸ should have been, that when a person owns ืขื‘ื“ื™ื and he dies, those ืขื‘ื“ื™ื should become free, just like when a person dies, his wife becomes free, his ืขื‘ื“ื™ื should become free, and his children should not inherit the ืขื‘ื“ื™ื. But we know that the ื“ื™ืŸ is, if a person owns ืขื‘ื“ื™ื and he dies, his children inherit the ืขื‘ื“ื™ื. The ื’ืžืจื answers, ืืžืจ ืงืจื, the ืชื•ืจื” says, ื•ื”ืชื ื—ืœืชื ืื•ืชื ืœื‘ื ื™ื›ื ืื—ืจื™ื›ื ืœืจืฉืช ืื—ื•ื–ื”, that you should make your ืขื‘ื“ื™ื inherited to your children as a regular inheritance. So the ืชื•ืจื” tells us clear that the children do inherit ืขื‘ื“ื™ื. But in the case of a ื’ืจ, since he has no children and he has no other people to inherit, he has no ื™ื•ืจืฉื™ื, so there is nobody to inherit. So there's nobody that can inherit, so therefore we say he goes out automatically free, just like his wife. But the ื’ืžืจื asks, ืื™ ื”ื›ื™, if so, ื”ืžืคืงื™ืจ ืขื‘ื“ื• ื•ืžืช, someone is ืžืคืงื™ืจ his ืขื‘ื“ and then he dies, ื ืžื™ the ื“ื™ืŸ should be the same. Since he is ืžืคืงื™ืจ his ืขื‘ื“, his children do not inherit that ืขื‘ื“, and then when the master dies, so then the slave should become free, just like the man's wife becomes free after he dies. ื”ืœืžื”, why did ืืžื™ืžืจ say, ื”ืžืคืงื™ืจ ืขื‘ื“ื• ื•ืžืช, if someone is ืžืคืงื™ืจ his ืขื‘ื“ and dies, ืื•ืชื• ื”ืขื‘ื“ ืื™ืŸ ืœื• ืชืงื ื”, that ืขื‘ื“ has no ืชืงื ื”, nothing can be done for that ืขื‘ื“, and that ืขื‘ื“ cannot marry a ืฉืคื—ื” and cannot marry a regular ื‘ืช ื—ื•ืจื™ืŸ. He cannot marry a ืฉืคื—ื”, because his master was ืžืคืงื™ืจ him, so he is not a hundred percent ืขื‘ื“, so he cannot marry a ืฉืคื—ื”. He cannot marry a ื‘ืช ื—ื•ืจื™ืŸ, since his master did not give him the ืฉื˜ืจ ืฉื—ืจื•ืจ, so he's not a hundred percent ื‘ืช ื‘ืŸ ื—ื•ืจื™ืŸ. The children of this man cannot give him a ืฉื˜ืจ ืฉื—ืจื•ืจ, because they didn't inherit him. When do children inherit an ืขื‘ื“? Only when the ืขื‘ื“ belongs to their father. Then they inherit that ืขื‘ื“. But in this case, the ืขื‘ื“ does not belong to the father. The only thing that he left here is the ืื™ืกื•ืจ, the ื“ื™ืŸ that he is still an ืขื‘ื“, not a ื‘ืŸ ื—ื•ืจื™ืŸ. The children should give this ืขื‘ื“ a ืฉื˜ืจ ืฉื—ืจื•ืจ, they can't either, because they only can give a ืฉื˜ืจ ืฉื—ืจื•ืจ to someone that they own. But here they never owned him, because the ืื™ืกื•ืจ that is left in this ืขื‘ื“ is not inherited by the children. The children only inherit ืžืžื•ืŸ. They could only inherit value. But in this case, the value of the ืขื‘ื“ does not belong to their father, so they cannot inherit the ืขื‘ื“. So they cannot give the ืขื‘ื“ a ืฉื˜ืจ ืฉื—ืจื•ืจ, and there is nobody else that could give the ืขื‘ื“ a ืฉื˜ืจ ืฉื—ืจื•ืจ. So therefore, this ืขื‘ื“ is stuck. He cannot marry a ื‘ืช ื—ื•ืจื™ืŸ and also cannot marry a ืฉืคื—ื”, because his master was ืžืคืงื™ืจ him. But if it would be true what we said before, that an ืขื‘ื“ is like the wife of a person, and the only reason why when the master dies he doesn't become free is because the children inherit him, so in a case where the children don't inherit, he should become free when his master dies. So why did ืืžื™ืžืจ say that if you're ืžืคืงื™ืจ your ืขื‘ื“ and then he dies, then this ืขื‘ื“ doesn't become free automatically? The ื’ืžืจื says, All right, he did. ื‘ืคื™ืจื•ืฉ ืฉืžื™ืข ืœืš, did you hear clearly in the name of ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™? He said clearly the ื”ืœื›ื” is like ืื‘ื ืฉืื•ืœ, ืื• ืžื›ืœืœื ืฉืžื™ืข ืœืš? Or you heard it being learned out from something else that ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™ said? So he

Rabbi Yehoshua ben Leviโ€™s Position on the Need for a Shitar

asked him, ืžืื™ ื›ืœืœื? What kind of ืœื™ืžื•ื“ do you mean? What do you have in mind when you say that maybe I learned it out from a different statement that he said? So he said what he meant. ื“ืืžืจ ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™, because you know that ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™ said, ืืžืจื• ืœืคื ื™ ืจื‘ื™, they said in front of ืจื‘ื™, a person says, ืื•ืžืŸ ื™ืืฉืชื™ ืžืคืœื•ื ื™ ืขื‘ื“ื™, I am ืžืชื™ืืฉ, I give up hope from this and this person, my ืขื‘ื“, and giving up hope is equivalent to being ืžืคืงื™ืจ. ืžื”ื•, what is the ื“ื™ืŸ? ืืžืจ ืœื”ื, so the ืจื‘ื™ said to them, ืื•ืžืจ ืื ื™, I say, ืื™ืŸ ืœื• ืชืงื ื” ืืœื ื‘ืฉื˜ืจ. This ืขื‘ื“ has no ืชืงื ื”, nothing can be done for him, only if he gets a ืฉื˜ืจ ืฉื—ืจื•ืจ. But if he doesn't get a ืฉื˜ืจ ืฉื—ืจื•ืจ, he cannot marry not a ืฉืคื—ื” because, after all, he became ื”ืคืงืจ already, but he also cannot marry a ื‘ืช ื—ื•ืจื™ืŸ because he wasn't freed completely, and the only way he can marry a ื‘ืช ื—ื•ืจื™ืŸ is if he gets a ืฉื˜ืจ ืฉื—ืจื•ืจ. ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, and ืจื‘ื™ ื™ื•ื—ื ืŸ said, ืžืื™ ื˜ืขืžื ื“ืจื‘ื™? What is the reason of ืจื‘ื™? ื’ืžืจ ืœื” ืœื” ืžืื™ืฉื”. He learns out a ื’ื–ื™ืจื” ืฉื•ื” the word ืœื” and the word ืœื” from a woman. ืžื” ืื™ืฉื” ื‘ืฉื˜ืจ, just like a wife, the only way she can be freed from her husband is if she gets a ืฉื˜ืจ which is a ื’ื˜, ืืฃ ืขื‘ื“ ื ืžื™, and ืขื‘ื“ also ื‘ืฉื˜ืจ, the only way he can become free is with a ืฉื˜ืจ. That was the saying of ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™, the way ืจื‘ื™ ื™ื•ื—ื ืŸ explained it. ื•ื“ื™ื™ืงืช ืžื™ื ื”, so we want to be ืžื“ื™ื™ืง from this ืžื™ืžืจื, since we compare it ื›ืื™ืฉื” to a woman, so ืžื” ืื™ืฉื” ืื™ืกื•ืจื ื•ืœื ืžืžื•ื ื, just like the case of an ืื™ืฉื”, when he gives a ื’ื˜ to an ืื™ืฉื”, what he's doing here is he's getting rid of the ืื™ืกื•ืจ that is connected to the marriage, ื•ืœื ืžืžื•ื ื, and there's nothing to do with ืžืžื•ืŸ, with monetary things. ืืฃ ืขื‘ื“ ื ืžื™ ืื™ืกื•ืจื ื•ืœื ืžืžื•ื ื. So also when ืจื‘ื™ compared the ืขื‘ื“ to the ืื™ืฉื”, probably he compared it in the same way. That in which case of an ืขื‘ื“ was ืจื‘ื™ talking about? A case of an ืขื‘ื“ which only is involved in ืื™ืกื•ืจ, not in ืžืžื•ืŸ. Normally, an ืขื‘ื“, when he belongs to a person, there are two things here: there is ืื™ืกื•ืจ and ืžืžื•ืŸ. The fact that he belongs to his master as a piece of property, that is the ืžืžื•ืŸ. Then there is the ืื™ืกื•ืจ part, the fact that he has a ื“ื™ืŸ of an ืขื‘ื“ and doesn't have a ื“ื™ืŸ of a ื‘ืŸ ื—ื•ืจื™ืŸ. So when ืจื‘ื™ compared the ืขื‘ื“ to the ืื™ืฉื”, he probably compared it a 100%, and the ืขื‘ื“ he was talking about was an ืขื‘ื“ that there is only an ืขื ื™ื™ืŸ of ืื™ืกื•ืจ, not the ืขื ื™ื™ืŸ of ืžืžื•ืŸ, and that is only ืฉื™ื™ืš by an ืขื‘ื“ that is a ื’ื“ื•ืœ. Since he is a ื’ื“ื•ืœ, so he is able to be ืงื•ื ื”, so when he became ื”ืคืงืจ, so he was ืงื•ื ื” himself. So as far as ืžืžื•ืŸ, the monetary part of himself, he doesn't belong to his master anymore because his master was ืžืคืงื™ืจ him, and he was ืงื•ื ื” himself. The only thing that's left is that he still is an ืขื‘ื“, not a ื‘ืŸ ื—ื•ืจื™ืŸ, in ื”ืœื›ื”, the ืื™ืกื•ืจ part. And that's where ืจื‘ื™ says that in order to get rid of the ืื™ืกื•ืจ part, you must give him a ืฉื˜ืจ, just like when you want to get rid of the ืื™ืกื•ืจ part of an ืื™ืฉื”, you give her a ืฉื˜ืจ. But ืจื‘ื™ was not talking about a case where the ืขื‘ื“ is still a ืงื˜ืŸ, because in that case there is still ืžืžื•ืŸ involved. Since the ืงื˜ืŸ cannot be ืงื•ื ื” himself, so there is still a monetary thing, a monetary connection between the ืขื‘ื“ and his master, so in that case, ืจื‘ื™ was not talking about. And since ืจื‘ื™ was not talking about that case, in other words, in that case ืจื‘ื™ would not say that without a ืฉื˜ืจ this ืขื‘ื“ has no ืชืงื ื”, ืื“ืจื‘ื”, we would assume that in that case ืจื‘ื™ would hold that this ืขื‘ื“ could still marry a ืฉืคื—ื” because he still remains an ืขื‘ื“. So if we learn that way, it comes out that ืจื‘ื™ ืคืกืงื ื˜ like ืื‘ื ืฉืื•ืœ, that since he is a ืงื˜ืŸ, he is not ืงื•ื ื” himself. And that's what he said, that is this where you take that ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™ ืคืกืงื ื˜ like ืื‘ื ืฉืื•ืœ? From this statement that ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™ repeated in the name of ืจื‘ื™, that from this ื“ื™ืŸ we see that in the case of an ืขื‘ื“ ืงื˜ืŸ, he still remains an ืขื‘ื“, and this fits to what ืื‘ื ืฉืื•ืœ said, that the ืงื˜ื ื™ื are not ืงื•ื ื” themselves free. ื”ื’ืžืจื asks, ื•ืื™ ืžื›ืœืœื ืžืื™? And if this is the case where we learned out the opinion of ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™, that he ืคืกืงื ื˜ like ืื‘ื ืฉืื•ืœ, so what is wrong with that? ืืžืจ ืœื™ื”, so he said to him, if this is if this is your only source to the opinion of ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™, because ืจื‘ื™ compares an ืขื‘ื“ to an ืื™ืฉื”, ืื“ืจื‘ื”, on the contrary, ื“ื™ื™ืง ืžื™ื ื” ืื™ื“ืš ื’ื™ืกื, you could be ืžื“ื™ื™ืง from here to the other side. ืžื” ืืฉื” ื‘ื™ืŸ ื’ื“ื•ืœื” ื‘ื™ืŸ ืงื˜ื ื”, just like the case of a woman, if you want to divorce a wife, so you have to give a ื’ื˜ to a wife whether she is a ื’ื“ื•ืœื” or a ืงื˜ื ื”, ืืฃ ืขื‘ื“ ื ืžื™, the ืขื‘ื“ that ืจื‘ื™ is talking about also is ื‘ื™ืŸ ื’ื“ื•ืœ ื‘ื™ืŸ ืงื˜ืŸ, whether he is a ื’ื“ื•ืœ or a ืงื˜ืŸ. So this ื“ื™ืŸ that ืจื‘ื™ said that without a ืฉื˜ืจ this ืขื‘ื“ has no ืชืงื ื” and cannot marry neither a ืฉืคื—ื” nor a ื‘ืช ื—ื•ืจื™ืŸ, applies to an ืขื‘ื“ ื’ื“ื•ืœ and to an ืขื‘ื“ ืงื˜ืŸ. Because just like the case of an ืืฉื” applies to a ื’ื“ื•ืœื” and a ืงื˜ื ื”, so the case of ืขื‘ื“ also applies to a ื’ื“ื•ืœ and a ืงื˜ืŸ. So in that case we can be ืžื“ื™ื™ืง just the opposite, that ืจื‘ื™ holds that even an ืขื‘ื“ ืงื˜ืŸ, as soon as his master is ืžืชื™ืืฉ from him, automatically he becomes free, and therefore there is a problem that he cannot marry a ืฉืคื—ื” and also he cannot marry a ื‘ืช ื—ื•ืจื™ืŸ. ืืžืจ ืœื™ื”, so he said to him, that it wasn't from this ื“ื™ืŸ that I learned it out, ื‘ืคื™ืจื•ืฉ ืฉืžื™ืข ืœื™, I heard ื‘ืคื™ืจื•ืฉ that ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™ said clearly that he ืคืกืง'ื ืก like ืื‘ื ืฉืื•ืœ. ื•ืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, and ืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื said in the name of ืจื‘ื™ ื™ื•ื—ื ืŸ, ืื™ืŸ ื”ืœื›ื” ื›ืื‘ื ืฉืื•ืœ, the ื”ืœื›ื” is not like ืื‘ื ืฉืื•ืœ. ืืžืจ ืœื™ื” ืจื‘ ื–ื™ืจื ืœืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื, so ืจื‘ ื–ื™ืจื said to ืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื, ื‘ืคื™ืจื•ืฉ ืฉืžื™ืข ืœืš, did you hear clearly that the ื”ืœื›ื” is not like ืื‘ื ืฉืื•ืœ, ืื• ืžื›ืœืœื ืฉืžื™ืข ืœืš, or you learned it out from something else that you heard? And he asked him, ืžืื™ ื›ืœืœื? Which other thing that you suspect I learned it out from? He says, ื“ืืžืจ ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™, because ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœื•ื™ said, and the ื’ืžืจื brings in the same ื“ื™ืŸ that we had before, ื“ืืžืจื• ืœืคื ื™ ืจื‘ื™, they said in front of ืจื‘ื™, someone says ื ืชื™ื™ืืฉืชื™ ืžืคืœื•ื ื™ ืขื‘ื“ื™, "I was ืžืชื™ืืฉ from my ืขื‘ื“ so-and-so," ืžื”ื•? What is the ื“ื™ืŸ? ืืžืจ ืœื”ื, he said to them, ืื•ืžืจ ืื ื™, I say, ืื™ืŸ ืœื• ืชืงื ื” ืืœื ื‘ืฉื˜ืจ, this ืขื‘ื“ has no ืชืงื ื”, he cannot marry a ืฉืคื—ื”, cannot marry a ื‘ืช ื—ื•ืจื™ืŸ until he gets a ืฉื˜ืจ ืฉื™ื—ืจื•ืจ. ื•ืืžืจ ืจื‘ื™ ื™ื•ื—ื ืŸ, and ืจื‘ื™ ื™ื•ื—ื ืŸ said, ืžืื™ ื˜ืขืžื ื“ืจื‘ื™, what is the reason of ืจื‘ื™? Because ื’ืžืจ "ืœื”" "ืœื”" ืžืืฉื”, he learns out a ื’ื–ื™ืจื” ืฉื•ื” from the word "ืœื”" "ืœื”" from ืืฉื”. ืžื” ืืฉื” ื‘ืฉื˜ืจ, just like a woman the only way she becomes free from her husband is through a ืฉื˜ืจ, through a ื’ื˜, ืืฃ ืขื‘ื“ ื ืžื™ ื‘ืฉื˜ืจ, an ืขื‘ื“ also becomes free through a ืฉื˜ืจ, and as long as he doesn't have a ืฉื˜ืจ, he is not 100% free and therefore cannot marry a ื‘ืช ื—ื•ืจื™ืŸ, but he cannot marry a ืฉืคื—ื” either because his master was ืžืชื™ืืฉ from him. And you want to be ืžื“ื™ื™ืง from here that since it's an ืืฉื” we compare it to a woman, so ืžื” ืืฉื” ื‘ื™ืŸ ื’ื“ื•ืœื” ื‘ื™ืŸ ืงื˜ื ื”, just like a woman when she needs a ื’ื˜ is whether she is a ื’ื“ื•ืœื” or a ืงื˜ื ื”, ืืฃ ืขื‘ื“ ื ืžื™, the ืขื‘ื“ that ืจื‘ื™ is talking about is ื‘ื™ืŸ ื’ื“ื•ืœ ื‘ื™ืŸ ืงื˜ืŸ, whether he is a ื’ื“ื•ืœ and a ืงื˜ืŸ. And concerning both of these cases ืจื‘ื™ said that this ืขื‘ื“ has no ืชืงื ื” unless he gets a ืฉื˜ืจ. In other words, he cannot marry a ืฉืคื—ื” until he gets the ืฉื˜ืจ, and then he can marry a ื‘ืช ื—ื•ืจื™ืŸ, but before that he cannot marry a ืฉืคื—ื” because when his master was ืžืชื™ืืฉ from him, automatically freed him and therefore he cannot marry a ืฉืคื—ื”, he also cannot marry a ื‘ืช ื—ื•ืจื™ืŸ because he's not 100% free. But at least we see from here that even an ืขื‘ื“ ืงื˜ืŸ, when his master is ืžืชื™ืืฉ from him, he automatically becomes free, so we see from here the ื”ืœื›ื” is not like ืื‘ื ืฉืื•ืœ. That's what he asked him, is this the case that you learned out from that the ื”ืœื›ื” is not like ืื‘ื ืฉืื•ืœ? So he says to him, ื•ืื™ ืžื›ืœืœื ืžืื™, and if this is where I learned it out from, so what is wrong with that? So he said to him, ืื“ืจื‘ื”, if this is your only source, then on the contrary, ื“ื™ื™ืง ืžื™ื ื” ืœื”ืš ื’ื™ืกื, be ืžื“ื™ื™ืง from here to the other direction, that ืžื” ืืฉื” ืื™ืกื•ืจื ื•ืœื ืžืžื•ื ื, just like the case of a woman, when we say that she needs a ืฉื˜ืจ is only in the case of ืื™ืกื•ืจ, there is no ืžืžื•ืŸ, no monetary connection between the husband and the wife, all he's going to free is the ืื™ืกื•ืจ part. ืืฃ ืขื‘ื“ ื ืžื™, also the ืขื‘ื“ that ืจื‘ื™ was talking about is ืื™ืกื•ืจื ื•ืœื ืžืžื•ื ื, is also only an ืขื‘ื“ that's connected to ืื™ืกื•ืจ, not ืžืžื•ืŸ. But an ืขื‘ื“ that's a ืงื˜ืŸ, maybe ืจื‘ื™ was not talking about him, because there is still some ืžืžื•ืŸ, some money connection between the ืขื‘ื“ and the master. And in a case like that, he wasn't free to begin with, and he's allowed to marry a ืฉืคื—ื”. So if you learn that way, it could come out that ืจื‘ื™ holds like ืื‘ื ืฉืื•ืœ, that an ืขื‘ื“ ืงื˜ืŸ is not ืงื•ื ื” himself and does not become free. That's the ืฉืืœื”, did you hear ื‘ืคื™ืจื•ืฉ that the ื”ืœื›ื” is not like ืื‘ื ืฉืื•ืœ, or did you just learn it out from this case? Because if you learned it out from this case, it is no ืจืื™ื”. ืืžืจ ืœื™ื”, so he said to him, ื‘ืคื™ืจื•ืฉ ืฉืžื™ืข ืœื™, I heard ื‘ืคื™ืจื•ืฉ that the ื”ืœื›ื” is not like ืื‘ื ืฉืื•ืœ. ืืžืจ ืžืจ, we learned before, ืืžืจ ืœื”ื, ืจื‘ื™ said to them, they asked ืจื‘ื™ the question, someone says "I am ืžืชื™ืืฉ from my ืขื‘ื“, what is the ื“ื™ืŸ?" So he said to them, ืื•ืžืจ ืื ื™, I say, ืื™ืŸ ืœื• ืชืงื ื” ืืœื ื‘ืฉื˜ืจ, that he has no ืชืงื ื”, nothing can be done to him unless he gets a ืฉื˜ืจ, but otherwise he cannot marry neither a ืฉืคื—ื” nor a ื‘ืช ื—ื•ืจื™ืŸ. The ื’ืžืจื asks, ื•ื”ืชื ื™ื, but we learned in a ื‘ืจื™ื™ืชื, and this is the ื‘ืจื™ื™ืชื that the ื’ืžืจื brought before, that ืจื‘ื™ ืื•ืžืจ, ืจื‘ื™ says, in the case where somebody is ืžืงื“ื™ืฉ his ื ื›ืกื™ื, and amongst his ื ื›ืกื™ื there are ืขื‘ื“ื™ื, ืชื ื ืงืžื says that the ื’ื–ื‘ืจื™ื of ื”ืงื“ืฉ, the treasurers of ื”ืงื“ืฉ, sell these ืขื‘ื“ื™ื to others, and they are allowed to free these ืขื‘ื“ื™ื. But ืจื‘ื™ said, ืื•ืžืจ ืื ื™, I say, ืืฃ ื”ื•ื ื ื•ืชืŸ ื“ืžื™ ืขืฆืžื• ื•ื™ื•ืฆื, that he is able to give his own money, pay for his own freedom, and he is able to go out, ืžืคื ื™ ืฉื”ื•ื ื›ืžื•ื›ืจ ืœื•, because then it is as if the ื’ื–ื‘ืจื™ื of ื”ืงื“ืฉ sell the ืขื‘ื“ to himself. So just like they are allowed to sell the ืขื‘ื“ to others, and others free them, the same way, the ื’ื–ื‘ืจื™ื are allowed to sell the ืขื‘ื“ื™ื to themselves. So what do we see from there? That ืจื‘ื™ holds that there is another way of an ืขื‘ื“ freeing himself by paying for his freedom. So how could ืจื‘ื™ say here that ืื™ืŸ ืœื• ืชืงื ื” ืืœื ื‘ืฉื˜ืจ, the only way he could marry a ื‘ืช ื—ื•ืจื™ืŸ and become a hundred percent free if he gets a ืฉื˜ืจ ืฉื™ื—ืจื•ืจ, when over there ืจื‘ื™ says that there's another way by paying for his own freedom? The

Resolving the Conflict: Money vs. Document in Slave Emancipation

ื’ืžืจื answers, ื”ื›ื ืงืืžืจ, this is what it means: ืื• ื‘ื›ืกืฃ ืื• ื‘ืฉื˜ืจ. ืจื‘ื™ holds that you could free an ืขื‘ื“ or through ื›ืกืฃ by the ืขื‘ื“ paying for his freedom or ื‘ืฉื˜ืจ by the master giving him a ืฉื˜ืจ ืฉื™ื—ืจื•ืจ. But ื•ื”ืื™, this case, when the master was ืžื™ื™ืืฉ from him, ืคืงืข ืœื™ื” ื›ืกืคื, so the money part left. So by him paying for his own freedom, it won't help, because he is not owned by his master anymore. So in this case, the only way that he could get a hundred percent free is if his master gives him a ืฉื˜ืจ. But in other cases, the ืขื‘ื“ is able to pay for his own freedom. Then the ื’ืžืจื says, ื•ืœืืคื•ืงื™ ืžื”ืื™ ืชื ื. This that ืจื‘ื™ says, that if an ืขื‘ื“ pays for his own freedom, he becomes a hundred percent free, and he's even allowed to marry a ื‘ืช ื—ื•ืจื™ืŸ, comes to reject an opinion of another ืชื ื who holds that even though if you give money, you become free, but still you cannot marry a regular ื‘ืช ื—ื•ืจื™ืŸ. ื“ืชื ื™ื, we learned in a ื‘ืจื™ื™ืชื, ืจื‘ื™ ืฉืžืขื•ืŸ ืื•ืžืจ ืžืฉื•ื ืจื‘ื™ ืขืงื™ื‘ื, ืจื‘ื™ ืฉืžืขื•ืŸ said in the name of ืจื‘ื™ ืขืงื™ื‘ื, ื™ื›ื•ืœ, I would think, ื™ื”ื ื›ืกืฃ ื’ื•ืžืจ ื‘ื” ื›ื“ืจืš ืฉื”ืฉื˜ืจ ื’ื•ืžืจ ื‘ื”, that money should finish off the freedom a hundred percent of a ืฉืคื—ื”, just like ืฉื˜ืจ finishes off a hundred percent of the freedom of a ืฉืคื—ื”. ืชืœืžื•ื“ ืœื•ืžืจ, the ืชื•ืจื” says, ื•ื”ืคื“ื” ืœื ื ืคื“ืชื”. This is a ืคืกื•ืง in ืงื“ื•ืฉื™ื ื™"ื˜, and this is a ืคืจืฉื” that deals with the case of ืฉืคื—ื” ื—ืจื•ืคื”. ืฉืคื—ื” ื—ืจื•ืคื” is a woman that she is a ื—ืฆื™ ืฉืคื—ื” ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ, she's half ืฉืคื—ื” and half free, and she was ืžืงื•ื“ืฉืช, engaged, to an ืขื‘ื“ ืขื‘ืจื™, to a Jewish ืขื‘ื“, and the ื“ื™ืŸ is that an ืขื‘ื“ ืขื‘ืจื™ is allowed to be married to her, because an ืขื‘ื“ ืขื‘ืจื™ has an exception. An ืขื‘ื“ ืขื‘ืจื™ is a regular Jew, and therefore he's allowed to marry a ื‘ืช ื—ื•ืจื™ืŸ, a regular Jewish woman. On the other hand, the ื“ื™ืŸ is that an ืขื‘ื“ ืขื‘ืจื™ is also allowed to marry a ืฉืคื—ื” ื›ื ืขื ื™ืช. So therefore, this woman who is half ืฉืคื—ื” and half ื‘ืช ื—ื•ืจื™ืŸ is allowed to marry an ืขื‘ื“ ืขื‘ืจื™, because he's allowed to marry her because of her ืฉืคื—ื” part, and also because of her ื‘ืช ื—ื•ืจื™ืŸ part. And then, someone else had relations with this woman. So the ืชื•ืจื”

Why the offender avoids death penalty

says that since she was not a hundred percent free, because ื•ื”ืคื“ื” ืœื ื ืคื“ืชื”, she was not ransomed, ืื• ื—ืคืฉื” ืœื ื ืชืŸ ืœื”, or freedom was not given to her, so therefore, the person that did the ืขื‘ื™ืจื” with her would not be punished with ืžื™ืชื”, with death penalty, as a person would be punished when he would have relations with a regular ืืฉืช ืื™ืฉ, with a regular married woman. And the only thing he has to do is he has to bring a ืงืจื‘ืŸ ืืฉื. So from the words ื•ื”ืคื“ื” ืœื ื ืคื“ืชื” ืื• ื—ืคืฉื” ืœื ื ืชืŸ ืœื”, the ืชื•ืจื” says that the reason he doesn't get killed is because she was not ransomed, and or freedom was not given to her, so it would seem that there are two ways she could be free: if she would have been ransomed, or she would have been freed, meaning with a ืฉื˜ืจ, then the man would get ืžื™ืชื”. Because then she would be a regular Jewish woman, and since she was ืžืงื•ื“ืฉ to the ืขื‘ื“ ืขื‘ืจื™, so she would have been a regular ืืฉืช ืื™ืฉ. So from this ืคืกื•ืง, it would seem that this ืฉืคื—ื” ื›ื ืขื ื™ืช is able to be freed or through getting a ืฉื˜ืจ or through paying ransom, through buying her freedom. So it would seem from this ืคืกื•ืง that there are two ways a ืฉืคื—ื” ื›ื ืขื ื™ืช could get free, and the same would apply to ืขื‘ื“ ื›ื ืขื ื™. So I would think that an ืขื‘ื“ ื›ื ืขื ื™ could buy his freedom with money. And that was the ื”ื•ื” ืืžื™ื ื that ืจื‘ื™ ืฉืžืขื•ืŸ in the name of ืจื‘ื™ ืขืงื™ื‘ื said, that you would think that money could make her free just like a ืฉื˜ืจ makes her free. But in the beginning, here the ืชื•ืจื” says ื•ื”ืคื“ื” ืœื ื ืคื“ืชื”, when the ืชื•ืจื” gives the reason why he doesn't get killed is because she was not ransomed and freedom was not given to her. But at the end, when the ืชื•ืจื” finishes off the ืคืกื•ืง, the ืชื•ืจื” says, ื›ื™ ืœื ื—ื•ืคืฉื”, because she was not free. Really, the

Why the Torah mentions ransom if it doesnโ€™t free

ืชื•ืจื” should have said at the end the same two things it says in the beginning. Just like in the beginning it says, ื•ื”ืคื“ื” ืœื ื ืคื“ืชื” ืื• ื—ืคืฉื” ืœื ื ืชืŸ ืœื”, she was not ransomed or freedom was not given to her, the ืชื•ืจื” says, ืœื ื™ื•ืžืชื•, they do not die, the ืชื•ืจื” should should have said for the same two things, because ื›ื™ ืœื ื ืคื“ืชื” ืื• ืœื ื—ื•ืคืฉื”, because she wasn't ransomed or she wasn't freed. But the ืชื•ืจื” does not do that. At the end when the ืชื•ืจื” says that there is no ืžื™ืชื” involved, the ืชื•ืจื” just says ื›ื™ ืœื ื—ื•ืคืฉื”, because she was not freed. What does that tell us? That ืขื•ืจื• ื›ืœ ื”ืคืจืฉื” ื›ื•ืœื” ืœืœื ื—ื•ืคืฉื”. That the whole ืคืจืฉื” finishes, and the key words in this ืคืจืฉื” is ืœื ื—ื•ืคืฉื”, that she was not freed. In other words, that what would have made her ื—ื™ื™ื‘ ืžื™ืชื”, what would have turned her into a regular ื‘ืช ื—ื•ืจื™ืŸ, ื•ืžืžื™ืœื into a regular ืืฉืช ืื™ืฉ, only if she would have got a ืฉื˜ืจ. ืœื•ืžืจ ืœืš, to tell you, ืฉื˜ืจ ื’ื•ืžืจ ื‘ื”, the ืฉื˜ืจ would finish off her freedom, ื•ืื™ืŸ ื”ื›ืกืฃ ื’ื•ืžืจ ื‘ื”, but money would not have finished off her freedom, and if she would have just paid for her freedom 100%, she still would not have been considered a regular ื‘ืช ื—ื•ืจื™ืŸ, and she would not have been considered like a regular ืืฉืช ืื™ืฉ, and there still would not be ืžื™ืชื”. But the question is according to that, so why did the ืชื•ืจื” mention the concept of paying for the freedom, the ransom in the beginning of the ืคืจืฉื”? The ืชื•ืจื” shouldn't have mentioned it at all. If money plays no role in the case of freeing an ืขื‘ื“, and also in the case of freeing a ืฉืคื—ื”, the ืชื•ืจื” shouldn't have mentioned the concept of money at all. So

Rashiโ€™s view: ransom gives partial freedom and ashames

ืจืฉืดื™ explains that it does play a role, that if she paid for her ransom, that is enough to consider her partially at least a free woman, and therefore the man that did the ืขื‘ื™ืจื” with her would have to at least bring an ืืฉื. If she wouldn't have paid ransom for her freedom, then that person wouldn't even have to bring an ืืฉื either, she wouldn't be in the category of a ืฉืคื—ื” ื—ืจื•ืคื”. And that is the reason why the ืชื•ืจื” mentions the ืคื“ื™ื•ืŸ, mentions the ransom, because that is the reason why the person is ื—ื™ื™ื‘ an ืืฉื. If not for that ransom, he wouldn't even be ื—ื™ื™ื‘ an ืืฉื either. He would be ืคื˜ื•ืจ ืœื’ืžืจื™, he'd be ืคื˜ื•ืจ completely. But when the ืชื•ืจื” wants to say why there is no ื—ื™ื•ื‘ ืžื™ืชื”, he's not 100% free, there the ืชื•ืจื” only says ื›ื™ ืœื ื—ื•ืคืฉื”, that she wasn't given a ืฉื˜ืจ, because giving the money would not have made her free 100% anyway. And this is the opinion of ืจื‘ื™ ืฉืžืขื•ืŸ in the name of ืจื‘ื™ ืขืงื™ื‘ื, that money does not make an ืขื‘ื“ free 100%, he should be able to marry a ื‘ืช ื—ื•ืจื™ืŸ, while the ืจื‘ื™ who said that money does make a person free, he argues on this ืชื ื. He argues on ืจื‘ื™ ืฉืžืขื•ืŸ in the name of ืจื‘ื™ ืขืงื™ื‘ื. And the

Gemara debate: Halacha follows Rabbi Shimon or not

ื’ืžืจื continues, ืืžืจ ืจื‘ ืื‘ื ื‘ืจ ื—ืžื ืืžืจ ืจื‘ ื ื—ืžืŸ, ืจื‘ ืื‘ื ื‘ืจ ื—ืžื said in the name of ืจื‘ ื ื—ืžืŸ, ื”ืœื›ื” ื›ืจื‘ื™ ืฉืžืขื•ืŸ, the ื”ืœื›ื” is like ืจื‘ื™ ืฉืžืขื•ืŸ, that an ืขื‘ื“ cannot free himself through money. ื•ืจื‘ ื™ื•ืกืฃ ื‘ืจ ื—ืžื ืืžืจ ืจื‘ ื™ื•ื—ื ืŸ, but ืจื‘ ื™ื•ืกืฃ ื‘ืจ ื—ืžื said in the name of ืจื‘ ื™ื•ื—ื ืŸ, ืื™ืŸ ื”ืœื›ื” ื›ืจื‘ื™ ืฉืžืขื•ืŸ, the ื”ืœื›ื” is not like ืจื‘ื™ ืฉืžืขื•ืŸ. And the ื’ืžืจื tells a story, ืืฉื›ื—ื™ื” ืจื‘ ื ื—ืžืŸ ื‘ืจ ื™ืฆื—ืง ืœืจื‘ื ื‘ืจ ืฉื™ืœืช, ืจื‘ ื ื—ืžืŸ ื‘ืจ ื™ืฆื—ืง found ืจื‘ื ื‘ืจ ืฉื™ืœืช ื“ื”ื•ื” ืงืื™ ืืคื™ืชื—ื ื“ื‘ื™ ืชืคื™ืœื”, they happened to be standing by the door of the ืฉื•ืœ, ืืžืจ ืœื™ื”, and he asked him, ื”ืœื›ื” ืื• ืื™ืŸ ื”ืœื›ื”, is the ื”ืœื›ื” like ืจื‘ื™ ืฉืžืขื•ืŸ or the ื”ืœื›ื” not like ืจื‘ื™ ืฉืžืขื•ืŸ? ืืžืจ ืœื™ื”, he said to him, ืื ื™ ืื•ืžืจ, I say, ืื™ืŸ ื”ืœื›ื”, the ื”ืœื›ื” is not like ืจื‘ื™ ืฉืžืขื•ืŸ, ื•ืจื‘ื ืŸ ื“ืืชื• ืžืžื—ื•ื–ื, but the ืจื‘ื ืŸ that came from ืžื—ื•ื–ื, ืืžืจื™, they said, that ืืžืจ ืจื‘ ื–ื™ืจื ืžืฉืžื™ื” ื“ืจื‘ ื ื—ืžืŸ, that ืจื‘ ื–ื™ืจื said in the name of ืจื‘ ื ื—ืžืŸ, ื”ืœื›ื”, that the ื”ืœื›ื” is like ืจื‘ื™ ืฉืžืขื•ืŸ. ื›ื™ ืืชืื™ ืœืกื•ืจื, but when I came to ืกื•ืจื, ืืฉื›ื—ืชื™ื” ืœืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื™ืŸ, I found ืจื‘ื™ ื—ื™ื™ื ื‘ืจ ืื‘ื™ืŸ, ืืžืจื™ ืœื™ื”, I said to him, ืื™ืžื ืœื™ ืื™ื–ื™, tell me, my friend, ื’ื•ืคื ื“ืขื•ื‘ื“ื ื”ื™ื›ื™ ื”ื•ื”, what was the story, what was the case where ืจื‘ ื ื—ืžืŸ had said that the ื”ืœื›ื” is like ืจื‘ื™ ืฉืžืขื•ืŸ? ืืžืจ ืœื™, he said to me, the story, ื“ื”ื”ื™ื ืืžืชื, there was this female slave, ื“ื”ื•ื” ืžืจื” ืฉื›ื™ื‘ ืžืจืข, her master was sick, ืืชื™ื, she came, ื‘ื›ื™ื” ืงืžื™ื”, she was crying before him, ื•ืืžืจื” ืœื™ื”, she said to him, ืขื“ ืื™ืžืช ืชืฉืชืขื‘ื“ ื•ืชื™ื–ืœ ื”ื”ื™ื ืื™ืชืชื, how long will this woman have to be enslaved and have to work so hard? ืฉืงืœ ื›ื•ืžืชื™ื”, he

The hatโ€‘exchange story and its invalidity

took his hat, ืฉื“ื ื‘ื”, he threw it at her, ื•ืืžืจ ืœื”, he said to her, ื–ื™ืœ ืงื ื™ ื”ื ื•ืงื ื™ ื ืคืฉื™ืš, here take and be ืงื•ื ื” this, and along with that, be ืงื•ื ื” yourself. He wanted to free her through giving to her his hat, because there is a ืงื ื™ืŸ called ืงื ื™ืŸ ื—ืœื™ืคื™ืŸ, that if you give somebody to be ืงื•ื ื” one of your objects, that is a form that the other person is ืงื•ื ื” something. And in this case too, he thought by giving her his hat, and she should be ืงื•ื ื” the hat, this would be a form of her being ืงื•ื ื” herself, and she would become free. ืืชื• ืœืงืžื™ื” ื“ืจื‘ ื ื—ืžืŸ, so they came to ืจื‘ ื ื—ืžืŸ, and they asked him, is this valid or not, is she free or not? ืืžืจ ืœื”ื•, he said to them, ืœื ืขืฉื” ื•ืœื ื›ืœื•ื, he didn't do anything, this is not valid. So, ืžืืŸ ื“ื—ื–ื, whoever saw what happened here, ืกื‘ืจ, thought, why did ืจื‘ ื ื—ืžืŸ say that this was not valid? ืžืฉื•ื ื“ื”ืœื›ื” ื›ืจื‘ื™ ืฉืžืขื•ืŸ, because he thought that ืจื‘ ื ื—ืžืŸ ืคืกืง'ื ืก like ืจื‘ื™ ืฉืžืขื•ืŸ. So, just like ืจื‘ื™ ืฉืžืขื•ืŸ says that an ืขื‘ื“ cannot buy his freedom by paying money, the same way, he cannot become free through ืงื ื™ืŸ ื—ืœื™ืคื™ืŸ, which is a ืงื ื™ืŸ similar to paying money. And if this is so, then this ืฉืคื—ื” would become free as far as working for her master, because even ืจ' ืฉืžืขื•ืŸ agrees, as we said before, that money could buy her freedom concerning the ืฉื™ืขื‘ื•ื“ of working, but she still could not marry a ื‘ืŸ ื—ื•ืจื™ืŸ, because ืจ' ืฉืžืขื•ืŸ holds that money is not ื’ื•ืžืจ, doesn't complete the freedom, and therefore, ืœื’ื‘ื™ that ื“ื™ืŸ, she would still remain a ืฉืคื—ื”. Then the ื’ืžืจื says, ื•ืœื ื”ื™ื, it is not true. In truth, this was not the reason why ืจื‘ ื ื—ืžืŸ said that the act of this man was not valid. ืืœื the reason was, ืžืฉื•ื ื“ื”ื•ื” ืœื™ื” ื›ืœื™ ืฉืœ ืžืงื ื”, because the article that was used in this ืงื ื™ืŸ belonged to the transferor, to the ืžืงื ื”. ื•ื”ื“ื™ืŸ by ืงื ื™ื™ืŸ ื—ืœื™ืคื™ืŸ is that the article that is used must belong to the ืงื•ื ื”, to the transferee. And since in this case it belonged to the ืžืงื ื”, so the ืงื ื™ื™ืŸ ื—ืœื™ืคื™ืŸ was not valid. And therefore, ืจื‘ ื ื—ืžืŸ said that what he did was nothing. And therefore, since it was nothing at all, not only was she not free ืœื’ื‘ื™ marrying a Jewish man, she was not free, not even ืœื’ื‘ื™ the work, because what he did was not valid at all. Therefore, she still remained his ืฉืคื—ื” 100%, and she was still ืžืฉื•ืขื‘ื“ืช to work for him. But one might ask that ืœื›ืื•ืจื”, she should be free here for a different reason. We have a rule that ื“ื‘ืจื™ ืฉื›ื™ื‘ ืžืจืข ื›ื›ืชื•ื‘ื™ื ื•ื›ืžืกื•ืจื™ื ื“ืžื•, that when a ืฉื›ื™ื‘ ืžืจืข, a person who is sick, and he's laying on his deathbed, and he is ืžืฆื•ื”, he commands, he says he wants something to be done, so then that is ื—ืœ, that takes effect even if no ืงื ื™ืŸ was done. It's as if it was written and signed and given over. So in this case, too, her master that wants to free her was laying on his deathbed, so by him just wanting to free her, and saying that he wants to free her should be enough for her to become free. So even though the ืงื ื™ืŸ that he made was not valid, because it was done with the ื›ืœื™ of the ืžืงื ื”, and really it should be done with ื›ืœื™ of the ืงื•ื ื”, but she should be free just because he wanted to free her, and he was a ืฉื›ื™ื‘ ืžืจืข. And ืจืฉืดื™ answers, and ืชื•ืกืคื•ืช points it out, that when do we say ื“ื‘ืจื™ ืฉื›ื™ื‘ ืžืจืข ื›ื›ืชื•ื‘ื™ื ื•ื›ืžืกื•ืจื™ื ื“ืžื•? If he tells his children he wants something to be done, so then we say by just commanding for it to be done is as if it was done. But here, he didn't say he wants something to be done, he himself performed the ืงื ื™ืŸ, and he wanted this to take effect through the ืงื ื™ืŸ that he made. So here, it depends only on the ืงื ื™ืŸ, cuz that's what he had in mind. So if the ืงื ื™ืŸ would be a valid ืงื ื™ืŸ, it would take effect. If the ืงื ื™ืŸ is not a valid ืงื ื™ืŸ, it doesn't take effect. And we can't say here ื“ื‘ืจื™ ืฉื›ื™ื‘ ืžืจืข ื›ื›ืชื•ื‘ื™ื ื•ื›ืžืกื•ืจื™ื ื“ืžื•, because he didn't say it in the form that he wanted it to take effect as a ืฉื›ื™ื‘ ืžืจืข, he wanted it to take effect as a ืงื ื™ืŸ. And ืœืคื•ืขืœ, the ืงื ื™ืŸ here couldn't take effect, because it was the ื›ืœื™ of the ืžืงื ื”. Then we continue with the ื’ืžืจื: ืืžืจ ืจื‘ ืฉืžื•ืืœ ื‘ืจ ืื—ื™ืกื ืื™, ืจื‘ ืฉืžื•ืืœ ื‘ืจ ืื—ื™ืกื ืื™ says, ืืžืจ ืจื‘ ื”ืžื ื•ื ื ืกื‘ื, in the name of ืจื‘ ื”ืžื ื•ื ื ืกื‘ื, ืืžืจ ืจื‘ ื™ืฆื—ืง ื‘ืจ ืืฉื™ืืŸ, in the name of ืจื‘ ื™ืฆื—ืง ื‘ืจ ืืฉื™ืืŸ, ืืžืจ ืจื‘ ื”ื•ื ื, in the name of ืจื‘ ื”ื•ื ื, ืืžืจ ืจื‘ ื”ืžื ื•ื ื, in the name of ืจื‘ ื”ืžื ื•ื ื, that ื”ืœื›ื” ื›ืจื‘ื™ ืฉืžืขื•ืŸ, that the ื”ืœื›ื” is like ืจื‘ื™ ืฉืžืขื•ืŸ. ื’ืžืจื says, ื•ืœื ื”ื™ื, really it is not true, ืื™ืŸ ื”ืœื›ื” ื›ืจื‘ื™ ืฉืžืขื•ืŸ, the ื”ืœื›ื” is not like ืจื‘ื™ ืฉืžืขื•ืŸ. And

Conclusion: Paying ransom fully frees a slave

therefore, if an ืขื‘ื“ pays for his own freedom, he becomes free 100%, and is also allowed to marry a ื‘ืช ื—ื•ืจื™ืŸ.
