And we will start with the words of the 讙诪专讗, 谞诪谞注讜 诪诇讛砖讘讬注. And the 诪砖谞讛 had said that the 讞讻诪讬诐 refrained from making her swear. And this is concerning the 讚讬谉 of 讗讬谉 讗诇诪谞讛 谞驻专注转 诪谞讻住讬 讬转讜诪讬诐 讗诇讗 讘砖讘讜注讛, that when an 讗诇诪谞讛, a widow, comes to collect the 讻转讜讘讛 that her husband owes her, so when she comes to collect from the 谞讻住讬诐, from the property, of the 讬转讜诪讬诐, of the orphans, the 讚讬谉 is that she cannot collect unless she first swears that she did not collect the 讻转讜讘讛 in the lifetime of her husband. But then the 诪砖谞讛 said 谞诪谞注讜 诪诇讛砖讘讬注, the 讞讻诪讬诐 refrained from making her swear. For some reason, the 讞讻诪讬诐 did not want that she should make the 砖讘讜注讛, she should take the oath. And therefore, at that point, a woman, an 讗诇诪谞讛, was not able to collect her 讻转讜讘讛. So then 专讘谉 讙诪诇讬讗诇 讛讝拽谉 was 诪转拽谉 that the 讬转讜诪讬诐 would make her make a 谞讚专 concerning something that they would choose. For instance, they would say that she should make a 谞讚专 not to eat a certain thing or not to have a certain 讛谞讗讛 from something or whatever it is if she collected the 讻转讜讘讛 in the lifetime of her husband. And when she made that 谞讚专, the 讬转讜诪讬诐 would know that she really did not collect the 讻转讜讘讛, because if she would have collected the 讻转讜讘讛, she would be 讗住讜专 to do that thing. And here the 讙诪专讗 goes back to the words 谞诪谞注讜 诪诇讛砖讘讬注, that the 讞讻诪讬诐 refrained from having her swear. And the 讙诪专讗 asks, 诪讗讬 讟注诪讗? What is the reason? Why did the 讞讻诪讬诐 refrain from making this 讗诇诪谞讛 swear?

Rav Kahana鈥檚 Story of the Gold Dinar and Curse

讗讬诇讬诪讗, if you will tell me 诪砖讜诐 讚专讘 讻讛谞讗, that it is because of what 专讘 讻讛谞讗 said, 讚讗诪专 专讘 讻讛谞讗, because 专讘 讻讛谞讗 said, 讜讗诪专讬 诇讛, others say, 讗诪专 专讘 讬讛讜讚讛 讗诪专 专讘, that it was 专讘 讬讛讜讚讛 that said it in the name of 专讘, that 诪注砖讛 讘讗讚诐 讗讞讚, there was a story with a certain person, 讘砖谞讬 讘爪讜专转, it was in a hunger year, 砖讛驻拽讬讚 讚讬谞专 讝讛讘 讗爪诇 讗诇诪谞讛, that he entrusted a golden 讚讬谞专 by a widow, 讜讛谞讬讞转讜 讘讻讚 砖诇 拽诪讞, and she put it into a jar of flour, 讜讗驻转讜 讘驻转, and she forgot about it and baked it later in a bread, 讜谞转谞转讜 诇注谞讬, and later on, she gave that loaf of bread away to a poor man. 诇讬诪讬诐, days later, 讘讗 讘注诇 讛讚讬谞专, the owner of the 讚讬谞专 came, 讜讗诪专 诇讛, and he said to her, 讛讘讬 诇讬 讚讬谞专讬, give me my 讚讬谞专. And being that she forgot that she took the 讚讬谞专, 讗诪专讛 诇讜, she said to him, 讬讛谞讛 住诐 讛诪讜转 讘讗讞讚 诪讘谞讬讛 砖诇 讗讜转讛 讗砖讛 讗诐 谞讛谞讬转讬 诪讚讬谞专讱 讻诇讜诐, that let one of the children of that woman, and she was referring to herself. So what she said was, let one of the my children have benefit of poison if I had any benefit from your 讚讬谞专. This was a 拽诇诇讛 that she cursed herself in the form of a 砖讘讜注讛, that let one of my children die if I had any benefit from your 讚讬谞专. 讗诪专讜, and they said, it was said, that 诇讗 讛讬讜 讬诪讬诐 诪讜注讟讬谉, that not too many days passed, 注讚 砖诪转 讗讞讚 诪讘谞讬讛, till one of her children actually died. Because of the curse that she took upon herself in the form of a 砖讘讜注讛, one of her children died. 讜讻砖砖诪注讜 讞讻诪讬诐 讘讚讘专, when the 讞讻诪讬诐 heard what happened, 讗诪专讜, they said, 诪讛 诪讬 砖谞砖讘注 讘讗诪转 讻讱, that if when someone swears truthfully, this is what happens, 讛谞砖讘注 注诇 砖拽专, if someone sells swears falsely, 注诇 讗讞转 讻诪讛 讜讻诪讛 certainly he could be punished. And the

Gemara鈥檚 Question About the Child鈥檚 Death

讙诪专讗 asks, 诪讗讬 讟注诪讗 讗讬注谞砖讗? Why was she punished, since the way she said her 砖讘讜注讛 was that one of her children should die if she had any benefit from his 讚讬谞专, and the truth was that she did not have any benefit from his 讚讬谞专, because she gave away the 讚讬谞专 to the 注谞讬, to the poor man? So then why did one of her children die? And the 讙诪专讗 answers, 讚讗讬砖转专砖讗 诇讛 诪拽讜诐 讚讬谞专. She gained the place of the 讚讬谞专. Since that 讚讬谞专 took up place in that loaf of bread, so she saved the flour that would have been in the place of the 讚讬谞专. So she did gain a little bit, and therefore, when she said that let one of my ch- children die. If I had any benefit from your 讚讬谞专, she actually did have benefit from the 讚讬谞专, and therefore, one of her children died. So then, if so, the 讙诪专讗 asks, so 诪讗讬 诪讬 砖谞砖讘注 讘讗诪转? So what did the 讞讻诪讬诐 mean when they said that if this is what happens to somebody who swears truthfully, certainly it would happen to someone who swears falsely. But according to this, it wasn't truthfully. When she swore that she did not have any benefit from the 讚讬谞专, it wasn't true, because she did have that little benefit of the place of the 讚讬谞专. And the 讙诪专讗 answers, 讻诪讬 砖谞砖讘注 讘讗诪转. That what the 讞讻诪讬诐 meant was that she was almost like she swore truthfully, because she did not know that she had benefit from the 讚讬谞专, because she forgot that she put it into the jar, and she did not realize that she gave it away to the 注谞讬 and saved herself some flour, so it was 讘砖讜讙讙, unintentionally, so it was almost as if she swore 讘讗诪转. And that's what the 讞讻诪讬诐 meant, that if this happens to somebody who is almost 讘讗诪转, certainly it would happen to somebody who swears 讘砖拽专. And what the 讙诪专讗 is trying to say here is that this would be the reason why the 讞讻诪讬诐 refrained from having the 讗诇诪谞讛 swear in order to collect her 讻转讜讘讛, because we see from this story that when a person swears, it could have terrible consequences. It could cause a lot of harm to the person who swears, and therefore, the 讞讻诪讬诐 refrained from having the 讗诇诪谞讛 swear. The

Why Sages Refrained from Making the Widow Swear

讙诪专讗 asks, 讗讬 诪砖讜诐 讛讗, if it is for this reason, 诪讗讬 讗讬专讬讗 讗诇诪谞讛? Why is 讗诇诪谞讛 different? Why is this 讚讬谉 only concerning an 讗诇诪谞讛 who comes to collect the 讻转讜讘讛 from the 谞讻住讬 讬转讜诪讬诐? That only an 讗诇诪谞讛 the 讞讻诪讬诐 felt that they did not want her to swear. 讗驻讬诇讜 讙专讜砖讛 谞诪讬! The same 讚讬谉 should be also by a 讙专讜砖讛, when a divorcee comes to collect the 讻转讜讘讛 from the property of the 讬转讜诪讬诐. For instance, if her husband divorced her, and before she managed to collect the 讻转讜讘讛 from her husband he died, and now she's going to the 讬转讜诪讬诐 to collect her 讻转讜讘讛, so the 讚讬谉 should be there too, that the 讞讻诪讬诐 should not make her swear, for the same reason. Because 砖讘讜注讛 is a very harsh thing, and therefore, the 讞讻诪讬诐 should have said that a 讙专讜砖讛 who has to collect her 讻转讜讘讛 from the 讬转讜诪讬诐 should not swear.

Rav Zira鈥檚 Statement About Only Widows

讗诇诪讛 讗诪专 专讘 讝讬专讗 讗诪专 砖诪讜讗诇, why did 专讘 讝讬专讗 say in the name of 砖诪讜讗诇, 诇讗 砖谞讜 讗诇讗 讗诇诪谞讛, that what it says in the 诪砖谞讛 that the 讞讻诪讬诐 refrained from making her swear was only by an 讗诇诪谞讛, 讗讘诇 讙专讜砖讛, but if a 讙专讜砖讛, a divorcee, wants to collect from the 谞讻住讬 讬转讜诪讬诐, 诪砖讘讬注讬谉 讗讜转讛, they would make her swear? And if the reason why the 讞讻诪讬诐 refrained from having the 讗诇诪谞讛 swear is because of the strictness of 砖讘讜注讛, so why didn't they refrain from having the 讙专讜砖讛 swear, too? And the 讙诪专讗 answers, 讗诇诪谞讛 砖讗谞讬, 讗诇诪谞讛 is different. 讚讘讛讛讬讗 讛谞讗讛 讚拽讟专讞讗 拽诪讬 讚讬转诪讬, because of this 讛谞讗讛 that she goes through the trouble for the 讬转讜诪讬诐, since her husband died, and she was still married to him, so she stayed with the 讬转讜诪讬诐, and she takes care of them, so she thinks that really she would deserve to be paid. So 讗转讬讗 诇讗讜专讜讬讬 讛讬转专讗, she could justify herself. She could think that let's say she did get the 讻转讜讘讛 paid by her husband while he was alive, and nevertheless, she could feel that she could swear now that she did not get anything, because even if she did get part of the 讻转讜讘讛 paid, she feels she is justified for it because of the trouble she is going through now of helping the 讬转讜诪讬诐. So there is more chance by the case of an 讗诇诪谞讛 that she should justify herself and swear falsely, and then all the consequences would come. But the case of a 讙专讜砖讛, that she was divorced before her husband died, so she has nothing to do with the 讬转讜诪讬诐, so there is no justification to begin with, so there is less chance that she would swear falsely. So therefore, only by the case of an 讗诇诪谞讛 the 讞讻诪讬诐 were afraid that she might swear falsely, they refrained from having her swear. But by the case of a 讙专讜砖讛, where there is less chance, so the 讞讻诪讬诐 said let her swear, and that's how she will collect the 讻转讜讘讛. Then the 讙诪专讗 continues,

House鈥慍ourt vs. Outside Oath Distinction

讗诪专 专讘 讬讛讜讚讛 讗诪专 专讘 讬专诪讬讛 讘专 讗讘讗, 专讘 讬讛讜讚讛 said in the name of 专讘 讬专诪讬讛 讘专 讗讘讗, 讚讛讗 专讘 讜砖诪讜讗诇 讚讗诪专讬 转专讜讜讬讬讛讜, that 专讘 and 砖诪讜讗诇 both say, 诇讗 砖谞讜 讗诇讗 讘讘讬转 讚讬谉, this 讚讬谉 that the 讞讻诪讬诐 refrained from having her swear is only if she would swear in the 讘讬转 讚讬谉, 讗讘诇 讞讜抓 诇讘讬转 讚讬谉 诪砖讘讬注讬谉 讗讜转讛, but outside of the 讘讬转 讚讬谉, they could could make her swear, because a 砖讘讜注讛 in the 讘讬转 讚讬谉 is stricter than a 砖讘讜注讛 outside the 讘讬转 讚讬谉. And as 专砖状讬 explains, that when you swear in the 讘讬转 讚讬谉, you have to hold a 住驻专 转讜专讛 or 转驻讬诇讬谉, and you have to swear by using 讛砖诐's name, or using a 讻讬谞讜讬. But when you swear outside of 讘讬转 讚讬谉, you don't swear by using 讛砖诐's name, you don't have to hold a 住驻专 转讜专讛, etc., and the punishment for swearing false outside of 讘讬转 讚讬谉 is not as great as the punishment for swearing inside of 讘讬转 讚讬谉, and therefore, when the 讞讻诪讬诐 refrained from having her swear because of the strictness of 砖讘讜注讛, that was only inside 讘讬转 讚讬谉. But swearing outside of 讘讬转 讚讬谉, the 讞讻诪讬诐 still allowed. And the 讙诪专讗 asks,

Rav鈥檚 Practice of Not Allowing a Widow to Collect

讗讬谞讬, it is not so, 讜讛讗 专讘 诇讗 诪讙讘讬 讻转讜讘讛 诇讗专诪诇转讗, that the fact was that 专讘 did not have an 讗诇诪谞讛, a widow, collect a 讻转讜讘讛 at all. He did not want her to swear because the 诪砖谞讛 says that 讞讻诪讬诐 refrained from having her swear, and for some reason the 讙诪专讗 will explain later, that he did not want her to make a 谞讚专 as the 转拽谞讛 of 专讘谉 讙诪诇讬讗诇 讛讝拽谉. And therefore, there was no choice but for an 讗诇诪谞讛 not to collect the 讻转讜讘讛 at all. But the 拽砖讬讗 is, if it is true that 专讘 and 砖诪讜讗诇 said that outside of 讘讬转 讚讬谉 you could make her swear, so how come 专讘 did not have an 讗诇诪谞讛 collect the 讻转讜讘讛? Why didn't he make her swear outside of 讘讬转 讚讬谉? If 专讘 himself said that you could do it outside of 讘讬转 讚讬谉, so why did 专讘 himself not have an 讗诇诪谞讛 collect the 讻转讜讘讛? And the 讙诪专讗 says, 拽砖讬讗, this is a good 拽砖讬讗, and this proves that 专讘 never said that outside of 讘讬转 讚讬谉 you're allowed to have her swear. And the 讙诪专讗 says, 讘住讜专讗 诪转谞讜 讛讻讬, this is way this 注谞讬谉 was learned in the 讬砖讬讘讛 in 住讜专讗, that first they said that 专讘 and 砖诪讜讗诇 both hold that you're allowed to have her swear outside of 讘讬转 讚讬谉, and then a 拽砖讬讗 was asked from the fact that 专讘 did not allow an 讗诇诪谞讛 to collect a 讻转讜讘讛, and the end was that we disproved the original statement that 专讘 holds that you're allowed to make her swear outside of 讘讬转 讚讬谉. But 讘谞讛专讚注讗 诪转谞讜 讛讻讬, in 谞讛专讚注讗, the 讬砖讬讘讛 of 谞讛专讚注讗, they 诇讻转讞讬诇讛 learned this whole thing differently. They learned it like this: that 讗诪专 专讘 讬讛讜讚讛 讗诪专 砖诪讜讗诇, 专讘 讬讛讜讚讛 said in the name of 砖诪讜讗诇, 诇讗 砖谞讜 讗诇讗 讘讘讬转 讚讬谉, this 讚讬谉 that an 讗诇诪谞讛 cannot swear was only if she wants to swear in 讘讬转 讚讬谉. 讗讘诇 讞讜抓 诇讘讬转 讚讬谉 诪砖讘讬注讬谉 讗讜转讛, but outside of 讘讬转 讚讬谉 you could make her swear. And 诇讻转讞讬诇讛, the way they learned in 谞讛专讚注讗, it was only said in the name of 砖诪讜讗诇. 讜专讘 讗诪专, but they learned 诇讻转讞讬诇讛 that 专讘 said, 讗驻讬诇讜 讞讜抓 诇讘讬转 讚讬谉 谞诪讬 讗讬谉 诪砖讘讬注讬谉 讗讜转讛, that even outside of 讘讬转 讚讬谉 you don't let her swear. And 专讘 诇讟注诪讬讛, and 专讘 goes along with his own 砖讬讟讛, we see how what 专讘 said fits to what 专讘 himself did, that 专讘 诇讗 诪讙讘讬 讻转讜讘讛 诇讗专诪诇转讗, that 专讘 did not give a 讻转讜讘讛 to an 讗诇诪谞讛, and that is for this reason, because there was no choice. Since to make her swear the 诪砖谞讛 says that the 讞讻诪讬诐 refrained, and 专讘 himself holds that this includes also to have her swear outside of 讘讬转 讚讬谉, so there was no choice but not to have her collect her 讻转讜讘讛. But the 讙诪专讗 asks, 讜诇讬讗讚专讛 讜诇讬讙讘讬讛, why didn't he make her make a 谞讚专 and have her collect the 讻转讜讘讛? The 诪砖谞讛 says that after the 讞讻诪讬诐 refrained from having the 讗诇诪谞讛 swear, 专讘谉 讙诪诇讬讗诇 讛讝拽谉 was 诪转拽谉 that she should make a 谞讚专 whatever the 讬转讜诪讬诐 would want, and that's how she would collect her 讻转讜讘讛. So why didn't 专讘 do that too? To have her make a 谞讚专, and that's how she could collect her 讻转讜讘讛. And the 讙诪专讗 answers, 讘砖谞讬 讚专讘 拽讬诇讬 谞讚专讬, that in the time of 专讘, 谞讚专讬诐 were easy in the eyes of people, that people would be 注讜讘专, would transgress their own 谞讚专讬诐. And therefore in the time of 专讘, he didn't feel you could rely on the 谞讚专 that the woman made, because it could be that she's lying, she really did collect her 讻转讜讘讛, and even though she made a 谞讚专, she doesn't care because at that time people did not really care about 谞讚专讬诐. And therefore, 专讘 had no choice but that an 讗诇诪谞讛 should not collect the 讻转讜讘讛 at all. And the 讙诪专讗 continues, 讛讛讬讗 讚讗转讗讬 诇拽诪讬讛 讚专讘 讛讜谞讗, there was this woman that came to 专讘 讛讜谞讗, she was an 讗诇诪谞讛, and she came to 专讘 讛讜谞讗 because she wanted to collect her 讻转讜讘讛. 讗诪专 诇讛, he said to her, 诪讗讬 讗注讘讬讚 诇讱, what could I do for you, 讚专讘 诇讗 诪讙讘讬 讻转讜讘讛 诇讗专诪诇转讗, that 专讘 would not have an 讗诇诪谞讛 collect her 讻转讜讘讛, so therefore me too, I also will not have you collect your 讻转讜讘讛. 讗诪专讛 诇讬讛, so she said to him, 诪讬讚讬 讚讛讜讛 讟注诪讗, isn't the reason why you do not want to give me my 讻转讜讘讛. 讗诇讗 讚讬诇诪讗 谞拽讬讟谞讗 诪讬讚讬 诪讻转讜讘转讬, it's only because you suspect maybe I already received part of my 讻转讜讘讛. 讞讬 讛砖诐 爪讘讗讜转, live should 讛砖诐 爪讘讗讜转. This is an expression of a 砖讘讜注讛, that she swore, 讗诐 讗讛谞讬转讬 诪讻转讜讘转讬 讻诇讜诐, if I had any benefit from my 讻转讜讘讛. 讗诪专 专讘 讛讜谞讗, so then 专讘 讛讜谞讗 said, 诪讜讚讛 专讘 讘拽讜驻爪转, by a woman who jumps. In other words, if a woman on her own jumps in and makes the 砖讘讜注讛, then we accept the 砖讘讜注讛 and we give her the 讻转讜讘讛. Even though the 讚讬谉 is that we do not make her swear, and therefore 专讘 felt that an 讗诇诪谞讛 cannot collect her 讻转讜讘讛 at all, but if she on her own jumps in, so to speak, and gives a 砖讘讜注讛, we accept her 砖讘讜注讛 and we give her the 讻转讜讘讛. The 讙诪专讗 continues, 讛讛讬讗 讚讗转讗讬 诇拽诪讬讛 讚专讘讛 讘专 专讘 讛讜谞讗, a woman came to 专讘讛 the son of 专讘 讛讜谞讗, and she was an 讗诇诪谞讛 who wanted to collect her 讻转讜讘讛. 讗诪专 诇讛, so 专讘讛 the son of 专讘 讛讜谞讗 said to her, 诪讗讬 讗注讘讬讚 诇讱, what can I do for you? How can I help you? 讚专讘 诇讗 诪讙讘讬 讻转讜讘讛 诇讗专诪诇转讗, that 专讘 would not have an 讗诇诪谞讛 collect her 讻转讜讘讛, 讜讗讘讗 诪专讬, and my father, this is 专讘 讛讜谞讗, also 诇讗 诪讙讘讬 讻转讜讘讛 诇讗专诪诇转讗, also would not have an 讗诇诪谞讛 collect her 讻转讜讘讛. So then how do you expect me to give you your 讻转讜讘讛? 讗诪专讛 诇讬讛, so she said to him, 讛讘讜 诇讬 诪讝讜谞讬, at least give me my 诪讝讜谞讜转, give me my support, because the 讚讬谉 is that when a person dies and leaves over an 讗诇诪谞讛, so one of the conditions of the 讻转讜讘讛 is that she must be supported from the property of the deceased. So she said to him, at least give me my support, give me my 诪讝讜谞讜转. 讗诪专 诇讛, so 专讘讛 讘专 专讘 讛讜谞讗 said to her, 诪讝讜谞讬 谞诪讬 诇讬转 诇讬讱, now you cannot get your support either. Why? She has no 诪讝讜谞讜转, she loses her support, because the whole reason why the 讞讻诪讬诐 were 诪转拽谉 that she should get 诪讝讜谞讜转 from the property of her deceased husband is only because of the 讻讘讜讚 of her husband, because of the honor of her husband since she is his 讗诇诪谞讛. But as soon as she plans to remarry, then she loses her 诪讝讜谞讜转. So when a woman comes to collect her 讻转讜讘讛, this is a sign that she is ready to remarry and she wants the money. Because otherwise, why does she need the money for? She is supported from the 谞讻住讬诐 of her deceased husband, so she doesn't need the money. As soon as she asks for the money of the 讻转讜讘讛, that proves that she's going to remarry. Now if she's going to remarry, she will not be the 讗诇诪谞讛 of that deceased man anymore, because now she will be married to a new man, so right away as soon as she claims her 讻转讜讘讛, she loses the 诪讝讜谞讜转. So this is what he said to her, you cannot collect the 讻转讜讘讛 because 专讘 and my father did not have an 讗诇诪谞讛 collect her 讻转讜讘讛. But since you asked for the 讻转讜讘讛, you cannot get the 诪讝讜谞讜转 either because of what 砖诪讜讗诇 said. 讗诪专讛 诇讬讛, so she said to him, 讗讬驻讻讜 诇讻专住讬讛, let his chair be turned around. It was like a curse that she cursed him. Because 讻讘讬 转专讬 注讘讚讬 诇讬, you're doing to me like both! I get the bad end of both sides! On one hand, you do like 专讘 that you do not give me the 讻转讜讘讛; on the other hand, you do like 砖诪讜讗诇 and you don't give me 诪讝讜谞讜转. But since she cursed him, so 专讘讛 讘专 专讘 讛讜谞讗 was afraid that her curse might come true, so what happened? 讗讬驻讻讜 诇讻专住讬讛 讜转讬专爪讜讛, they turned his chair around and they picked it up again. They wanted that her words should come true, so later on, it shouldn't have any effect. So since the term, the way she cursed him was that his chair should be turned around, what she meant really was that something bad should happen to him, but since those are the words she used, so what they did was they just physically turned his chair around and picked it up. By that, they felt that her words came true already and now no harm will come on 专讘讛 讘专 专讘 讛讜谞讗. The 讙诪专讗 says, 讜讗驻讬诇讜 讛讻讬, and still, 诇讗 讗讬驻专拽 诪讞讜诇砖讗, he didn't escape illness. Later on, he got sick because of the curse that this woman cursed him. Then the 讙诪专讗 continues, 讗诪专 诇讬讛 专讘 讬讛讜讚讛 诇专讘 讬专诪讬讛 讘讬专讗讛, 专讘 讬讛讜讚讛 said to 专讘 讬专诪讬讛 讘讬专讗讛, that if a case of an 讗诇诪谞讛 claiming her 讻转讜讘讛 comes to you, 讗讚专讛 讘讘讬转 讚讬谉, have her make a 谞讚专 in 讘讬转 讚讬谉 and collect her 讻转讜讘讛 like the 转拽谞讛 of 专讘谉 讙诪诇讬讗诇 讛讝拽谉, 讜讗砖讘注讛 讞讜抓 诇讘讬转 讚讬谉, or have her swear outside of 讘讬转 讚讬谉, and then let her collect her 讻转讜讘讛. In other words, he did not hold like 专讘 that said That even outside of 讘讬转 讚讬谉 you're not allowed to make her swear, and he said let it be done, but 讜诇讬住拽 拽诇讗, and let there go out a 拽讜诇, a rumor that this happened, 讜诇讬驻讜诇 讘讗讜讚谞讬, and let the rumor come back to my ears. In other words, let me hear a report. Because 讚讘注讬谞讗 I want 讻讛讬讻讗 讚注讘讬讚 讘诪注砖讛, I want people to know that a 诪注砖讛 was done, that an 讗诇诪谞讛 did collect the 讻转讜讘讛. He wanted to set a precedent that the 讛诇讻讛 is not like 专讘, that an 讗诇诪谞讛 cannot collect the 讻转讜讘讛 because she cannot swear 讞讜抓 诇讘讬转 讚讬谉. He wanted to show that a 诪注砖讛 was done, that an 讗诇诪谞讛 did collect the 讻转讜讘讛 because she swore 讞讜抓 诇讘讬转 讚讬谉. Then the 讙诪专讗 continues, 讙讜驻讗. Now we're going to discuss the 讙讜祝 of the 注谞讬谉 that was mentioned before. Before we mentioned, 讗诪专 专讘 讝讬专讗 讗诪专 砖诪讜讗诇, 专讘 讝讬专讗 said in the name of 砖诪讜讗诇, 诇讗 砖谞讜 讗诇讗 讗诇诪谞讛, that this 讚讬谉 of the 诪砖谞讛 that the 讞讻诪讬诐 refrained from making her swear is only in the 讚讬谉 of an 讗诇诪谞讛, if a widow who collects the 讻转讜讘讛 because her husband died, then the 讞讻诪讬诐 says she should not swear, 讗讘诇 讙专讜砖讛, but if she collects the money because she was a divorcee and then her husband died before she managed to collect the 讻转讜讘讛, and now she has to collect it from the 谞讻住讬 讬转讜诪讬诐, 诪砖讘讬注讬谉 讗讜转讛, they do make her swear. So it comes out that by a 讙专讜砖讛 the old 讚讬谉 of having her swear remains, and the 转拽谞讛 of 专讘谉 讙诪诇讬讗诇 讛讝拽谉 that instead of swearing she would make a 谞讚专 does not apply to a 讙专讜砖讛, to a divorcee. So the 讙诪专讗 asks, 讜讙专讜砖讛 讚讗讚专讛 诇讗, and a 讙专讜砖讛 who would make a 谞讚专 would not be acceptable? The only way she could collect her 讻转讜讘讛 from the 谞讻住讬 讬转讜诪讬诐 is if she swears, but by her making a 谞讚专 it would not be enough? 讜讛讗 砖诇讞讜 诪转诐, but we know that they sent a message from there, meaning from 讗专抓 讬砖专讗诇: 讗讬讱 驻诇讜谞讬转 讘转 驻诇讜谞讬, a woman so-and-so the daughter of so-and-so, 拽讘讬诇转 讙讬讟讛 诪讬讚讛 讚讗讞讗 讘专 讛讚讬讗, how she accepted a 讙讟 from the hands of 讗讞讗 讘专 讛讚讬讗, 讚诪讬转拽专讬 is also known as 讗讬 诪专讬, 讜谞讚专转, and she made a 谞讚专, and what was her 谞讚专? 讜讗住专转 驻讬专讜转 砖讘注讜诇诐 注诇讛, she 讗住专'd upon herself, she forbid upon herself fruits of the world, 讚诇讗 拽讘讬诇转 诪讻转讜讘转讛, that she did not accept from her 讻转讜讘讛, 讗诇讗 讙诇讜驻拽专讗 讗讞讚, just one coat, 讜住驻专 转讛诇讬诐 讗讞讚, and one 住驻专 转讛诇讬诐, 讜住驻专 讗讬讜讘, and a 住驻专 of 讗讬讜讘, 讜诪诪砖诇讜转, and a 住驻专 of 诪砖诇讬, 讘诇讜讗讬诐, they were rotten, they were all used up, 讜砖诪讜诐, and the 讞讻诪讬诐 estimated it, 讘讞诪砖讛 诪谞讛, it is worth five 诪谞讛. So she said that if she accepted more than this from her 讻转讜讘讛, she should be 讗住讜专 to eat the fruits of the world. And that's how the 讞讻诪讬诐 knew that she was saying the truth. And they sent a message to 讞讜抓 诇讗专抓, because the property of her husband was in 讞讜抓 诇讗专抓, so they sent a message: 诇讻砖转讘讗 诇讬讚讻诐, when she will come to you, 讛讙讘讜 讗转 讛砖讗专, have her collect the rest. So

讙专讜砖讛 believed by 谞讚专 vs 砖讘讜注讛

what do we see from here? That even though she was a 讙专讜砖讛, because as they send the message she received a 讙讟 from 讗讞讗 讘专 讛讚讬讗 who was known as 讗讬 诪专讬, and still they said that how did they know that she was saying the truth that she didn't collect anything but the worth of five 诪谞讛 was because she made a 谞讚专. So from here we see that even a 讙专讜砖讛 is also believed by making a 谞讚专, and from what 专讘 讝讬专讗 讗诪专 砖诪讜讗诇 said, it seems that a 讙专讜砖讛 is only believed if she makes a 砖讘讜注讛, but not by making a 谞讚专. 讗诪专 专讘 讗砖讬, so 专讘 讗砖讬 said, 讛讛讜讗 讙讟 讬讘诪讬谉 讛讜讛. The case that was there was a 讙讟 讬讘诪讬谉. The 讚讬谉 is that if a person dies and has no children, so then the brother of the deceased man has to be 诪讬讘诐, has to marry the wife, which means his sister-in-law. If he doesn't want to marry her, then he has to give her 讞诇讬爪讛. But the 讚讬谉 is that the 讻转讜讘讛 that she is supposed to get has to come from the property of her first husband, not from the property of the 讬讘诐. And this was a case where she was a 讬讘诪讛, her 讬讘诐 instead of marrying her, being 诪讬讘诐 her, gave her a 讙讟. And the

讙讟 insufficient to free from 讬讘诐

讚讬谉 is that a 讙讟 is not sufficient for her to be free from her 讬讘诐. If her 讬讘诐 wants to free her, he has to give her 讞诇讬爪讛. The only time the 讬讘诐 could give her a 讙讟 is after he was 诪讬讘诐 her, so then she becomes a regular wife of his. Now if he wants to free her, he gives her a 讙讟. The only thing a 讬讘诐 could accomplish by giving a 讙讟 to his 讬讘诪讛 before he's 诪讬讘诐 her is that because of this 讙讟, she is now 驻住讜诇 for 讬讘讜诐. And this is what happened in this case. She was a woman that her husband died. The brother of her husband gave her a 讙讟, and this is what they meant when they sent a message from 讗专抓 讬砖专讗诇, that this woman received a 讙讟 from 讗讞讗 讘专 讛讚讬讗 who was known as 讗讬讬诪专讬, it wasn't the 讙讟 from her husband, it was the 讙讟 that she received from her 讬讘诐. And because of that, she could not be 诪转讬讘诐 anymore, and she had to get 讞诇讬爪讛 from her 讬讘诐. But the 讻转讜讘讛 she would collect from the property of her deceased husband. So 诇讙讘讬 the 讻转讜讘讛, she is considered an 讗诇诪谞讛, because she is collecting the 讻转讜讘讛 as an 讗诇诪谞讛 for her husband. And therefore in this case, the way the 讞讻诪讬诐 trusted her was because she made a 谞讚专. But

讙专讜砖讛 must swear to collect 讻转讜讘讛

had she been a real 讙专讜砖讛, in other words a case where a woman was divorced from her husband, and then later wants to collect the 讻转讜讘讛 from the property of the 讬转讜诪讬诐, the only way she could collect is if she gives a 砖讘讜注讛, if she swears. This is the way 专砖状讬 learns the 驻砖讟 in the 转讬专讜抓 of the 讙诪专讗, that 讛讛讜讗 讙讟 讬讘诪讬谉 讛讜讛. But 转讜住驻讜转 learns 驻砖讟 differently, because 转讜住驻讜转 asks a 拽砖讬讗 on 专砖状讬. 转讜住驻讜转 asks that the 讚讬谉 is that a 讬讘诪讛 that gets 讞诇讬爪讛 cannot collect the 讻转讜讘讛 from the possessions of her first husband till after the 讞诇讬爪讛 of the 讬讘诐. So according to 专砖状讬, that this was a case that her 讬讘诐 gave her a 讙讟 before he was 诪讬讘诐 her, and then later he was supposed to give her 讞诇讬爪讛 because of that, because with the 讙讟 he 驻住诇 her from 讬讘讜诐. So she could not collect her 讻转讜讘讛 till after the 讞诇讬爪讛 of the 讬讘诐. So the message they should have sent from 讗专抓 讬砖专讗诇 should have been that this woman received 讞诇讬爪讛 from 讗讞讗 讘专 讛讚讬讗, and now she's collecting her 讻转讜讘讛, and etc., etc., etc. Why did they have to mention the 讙讟 at all? Therefore, 转讜住驻讜转 learns that this was a different case altogether. This was a case that her 讬讘诐 was 诪讬讘诐 her, and after he was 诪讬讘诐 her, he decided to divorce her, and he gave her a 讙讟. And this is what the 讙诪专讗 means with 讙讟 讬讘诪讬谉 讛讜讛, it was a regular 讙讟, but a 讙讟 given by the 讬讘诐. The 讚讬谉 is that when a woman gets 讬讘讜诐, and then her 讬讘诐 divorces her, the 讻转讜讘讛 that she collects, she collects from the property of the deceased husband, of the first husband. So in a case like this, even though she is a 讙专讜砖讛 now, she is a divorcee, and she is collecting her 讻转讜讘讛 as a 讙专讜砖讛, nevertheless, being that the money comes from the possessions of her first husband who died, she has a 讚讬谉 of an 讗诇诪谞讛. And the same justification that an 讗诇诪谞讛 might have in order to lie, that even if she collected the 讻转讜讘讛 she could claim that she did not collect because she feels she deserves more money because of the 讟讬专讞讗 that she had with the 讬转讜诪讬诐, this woman has the same justification. Because she lived with the 讬讘诐, so she feels she was 诪讟专讬讞 herself with the 讬讘诐, so she deserves more money. So it's possible that she really collected the 讻转讜讘讛 while her first husband was alive, and nevertheless, now she would lie. So the same 讚讬谉 as the 讙诪专讗 said concerning an 讗诇诪谞讛, that because of this justification the 讞讻诪讬诐 refrained from making her swear, this woman here too, even though at this point she is a 讙专讜砖讛, but being that she collects from her first husband's property, and she has the same justification as a regular 讗诇诪谞讛, the 讚讬谉 would apply to her too, that the 讞讻诪讬诐 would not make her swear. And therefore 转讜住驻讜转 learns, she, the only way the 讞讻诪讬诐 would believe her was through a 谞讚专. And this is what the 讙诪专讗 meant with the words 讙讟 讬讘诪讬谉 讛讜讛, that she was 讟讗拽注 divorced, but it was a 讙讟 that her 讬讘诐 gave her, and because of that, the way the 讞讻诪讬诐 were able to find out that she's saying the truth is through a 谞讚专, not through a 砖讘讜注讛, because she has the same 讚讬谉 of 讗诇诪谞讛. And now the 讙诪专讗 goes back to explain the different words of the 诪砖谞讛. We learn in the 诪砖谞讛: 讛转拽讬谉 专讘谉 讙诪诇讬讗诇 讛讝拽谉, 专讘谉 讙诪诇讬讗诇 讛讝拽谉 was 诪转拽谉, 砖转讛讗 谞讜讚专转 讜讻讜壮, that instead of swearing, the 讗诇诪谞讛 should make a 谞讚专 whatever the 讬转讜诪讬诐 choose. For instance, they should tell her to make a 谞讚专 that if she collected from her 讻转讜讘讛, then she should be 讗住讜专 to eat a certain thing or to do a certain thing, etc. And when she makes the 谞讚专, we know for sure that she would not accept upon herself to 讗住专 herself on that thing, so that proves that probably she didn't collect anything from the 讻转讜讘讛, because if she did collect, then she would automatically become 讗住讜专. And that was a form and has no right to nullify the 谞讚专讬诐 that she made before she married him. And therefore, if she comes to collect the 讻转讜讘讛 while she's not married, so then we're not afraid that later on her husband will nullify the 谞讚专 she will make now, because a husband cannot nullify later the 谞讚专讬诐 that she made before she married him. And then the

Concern about 讞讻诐 nullifying 谞讚专

讙诪专讗 asks, 讜谞讬讞讜砖, let us be afraid, 讚讬诇诪讗 讗讝诇讗 诇讙讘讬 讞讻诐, that she might go to a 讞讻诐, 讜砖专讬 诇讛, and the 讞讻诐 will be 诪转讬专 her 谞讚专, because the 讚讬谉 is that a person is allowed to go to a 讞讻诐 to be 诪转讬专 谞讚专, to nullify the 谞讚专. So therefore, we still should not trust her with the 谞讚专, because maybe she is lying, and she will go to a 讞讻诐 that he should be 诪转讬专 the 谞讚专. And the 讙诪专讗 answers, 拽住讘专, he holds, 爪专讬讱 诇驻专讟 讛谞讚专, that when you go to a 讞讻诐 to be 诪转讬专 the 谞讚专, you have to specify the details of the 谞讚专. In other words, you have to tell the 讞讻诐 the reason why you made the 谞讚专. So therefore, if this woman will come to the 讞讻诐 and tell him that I made a 谞讚专 not to eat a certain thing, and I want to be 诪转讬专 it, the 讞讻诐 will ask her, Why did you make the 谞讚专? And the 讚讬谉 is that you have to specify the reason why you made the 谞讚专, she will tell him, Because I wanted to collect my 讻转讜讘讛, and the 讘讬转 讚讬谉 wouldn't give it to me unless I made a 谞讚专, so the 讞讻诐 will definitely not be 诪转讬专 her 谞讚专. So there is nothing to suspect, and therefore we're allowed to be 诪讗诪讬谉 her. Then the 讙诪专讗 says, 专讘 谞讞诪谉 讗诪专, but 专讘 谞讞诪谉 said, 讗驻讬诇讜 谞讬住转, that even if she remarried, we still could make her make a 谞讚专, and she could collect her 讻转讜讘讛. But the 讙诪专讗 asks, 谞讬住转, if she's married, 讜讚讗讬 诪驻专 诇讛 讘注诇, certainly her husband will nullify the 谞讚专, so how can we trust her with the 谞讚专? And the 讙诪专讗 answers, 讚诪讚专讬谞谉 诇讛 讘专讘讬诐, we'll make her make the 谞讚专 in public. And the 讚讬谉 is that when you make a 谞讚专 in public, it cannot be nullified. And therefore, even if she is remarried, and we're afraid that her husband will nullify her 谞讚专, we'll make her make the 谞讚专 in public, and then her husband can't nullify it, and therefore, even if she's remarried, we could give her the 讻转讜讘讛. 诪专 asks a 拽砖讬讗, 诪讬转讬讘讬, I'll ask you a 拽砖讬讗, we learned in a 讘专讬讬转讗, it says, 谞讬住转, if she remarried, 讙讜讘讛 讻转讜讘转讛, she could still collect her 讻转讜讘讛, 讗诐 谞讚专讛, if she made a 谞讚专. 诪讗讬 诇讗讜, don't you think, 谞讚专讛 讛砖转讗, that she made a 谞讚专 now, that what the 讘专讬讬转讗 means is that if she remarried, she could collect her 讻转讜讘讛 if now she will make a 谞讚专? That means that even after she remarried, she still could make a 谞讚专, and we would trust her 谞讚专 and give her the 讻转讜讘讛. So this is a 专讗讬讛 to 专讘 谞讞诪谉, and it's a 拽砖讬讗 on 专讘 讛讜谞讗 that says that if she remarried, we cannot make her make the 谞讚专. And the 讙诪专讗 answers, 诇讗, no, 讚谞讚专讛 诪注讬拽专讗. What the 讘专讬讬转讗 means is that if she remarried, she could collect the 讻转讜讘讛 if she had made a 谞讚专 before she remarried. In other words, let's say she came before she remarried to collect the 讻转讜讘讛, and we forced her to make a 谞讚专, and before she actually collected it, she remarried, so the 讘专讬讬转讗 tells us that she could still collect the 讻转讜讘讛 even after she married, but it has to be through a 谞讚专 that she made before she remarried. And then the 讙诪专讗 says, 讜讛转谞讬讗, but we learned in another 讘专讬讬转讗, it says clearly, 谞讬住转, if she remarried, 谞讜讚专转, she could make a 谞讚专, 讜讙讜讘讛 讻转讜讘转讛, and could collect the 讻转讜讘讛. So here we see clearly from the 讘专讬讬转讗 that even after she remarried, she could make a 谞讚专 then, because it says 谞讬住转 谞讜讚专转, she could make a 谞讚专. It doesn't say that if she remarried she could collect the 讻转讜讘讛 if she made a 谞讚专 as the previous 讘专讬讬转讗. There you could say it means if she made a 谞讚专 previously, but here it says if she got married, 谞讜讚专转, she can make a 谞讚专, which means now, after she remarried, and collect the 讻转讜讘讛. So we see from here that even after she remarried, she could still make a 谞讚专 and collect her 讻转讜讘讛. And the 讙诪专讗 answers, 转谞讗讬 讛讬讗, this really depends on a 诪讞诇讜拽转, on an argument of 转谞讗讬诐. 讚讗讬讻讗 诇诪讗谉 讚讗诪专, there is an opinion in 转谞讗讬诐 that 谞讚专 砖讛讜讚专 讘专讘讬诐 讬砖 诇讜 讛驻专讛, that a 谞讚专 that was made in public also is able to be nullified, 讜讗讬讻讗 诇诪讗谉 讚讗诪专, and there is an opinion in 转谞讗讬诐, 讗讬谉 诇讜 讛驻专讛, that a 谞讚专 that's made in public cannot be nullified. And this is really the 诪讞诇讜拽转 here, whether after she remarried, if you could tell her to make a 谞讚专 and she collect her 讻转讜讘讛. In the 讘专讬讬转讗 where it says that even after she remarried, she still could make a 谞讚专 and collect her 讻转讜讘讛 is because that 讘专讬讬转讗 holds that a 谞讚专 that's made in public cannot be nullified. So here we have a way of preventing the husband from nullifying the 谞讚专, that if she remarried, we tell her to make the 谞讚专 in public, so now the husband can't nullify it anyway, so she could collect her 讻转讜讘讛 because we trust her 谞讚专. But 专讘 讛讜谞讗 who said that if she remarried, she cannot make a 谞讚专 and collect her 讻转讜讘讛, because he goes according to those 转谞讗讬诐 that say that a 谞讚专 that's made in public still could be nullified, so we have no way of preventing the husband from nullifying her 谞讚专, because even if she'll make the 谞讚专 in public, the husband still could nullify the 谞讚专. Therefore, there is no way of preventing the husband from nullifying the 谞讚专, so if she got married, she cannot make a 谞讚专 and she cannot collect her 讻转讜讘讛. Then the 讙诪专讗 goes on: 讗讬讘注讬讗 诇讛讜, there was a question asked, and this is something that was mentioned before, but now the 讙诪专讗 goes into details. 爪专讬讱 诇驻专讟 讗转 讛谞讚专 讗讜 讗讬谞讜 爪专讬讱? When you come to a 讞讻诐 and you want him to nullify your 谞讚专, must you specify the details, the reasons why you made a 谞讚专, or don't you have to specify the reasons why you make the 谞讚专? 专讘

Rav 谞讞诪谉 on detailing 谞讚专

谞讞诪谉 讗诪专, 专讘 谞讞诪谉 says, 讗讬谞讜 爪专讬讱, you do not have to specify the reasons. But 专讘 驻驻讗 讗诪专, 专讘 驻驻讗 says, 爪专讬讱, you do have to give the reasons why you made the 谞讚专. And the 讙诪专讗 explains it: 专讘 谞讞诪谉 讗诪专 讗讬谞讜 爪专讬讱, 专讘 谞讞诪谉 says you do not have to give the reasons why you made a 谞讚专, because 讚讗讬 讗诪专转 爪专讬讱, because if you're going to say that you do have to give the reasons for the 谞讚专, in other words, the nullification of the 谞讚专 is dependent on the reasons that you give, so 讝讬诪谞讬谉 讚讙讬讬讝 诇讬讛 诇讚讬讘讜专讬讛, sometimes it could happen that the person will cut his words, which means the person will not tell the 讞讻诐 the complete truth, 讜讛讞讻诐 诪讗讬 讚砖诪注 诪驻专, the 讞讻诐 will nullify what he hears. Based on the details he would be given, he would feel that you could nullify the 谞讚专 and he would nullify it. But really, this is only part of the truth. Had he heard the whole truth, he would feel that you're not allowed to nullify the 谞讚专. So therefore, he holds that you don't have to tell the 讞讻诐 the details, so the nullification of the 谞讚专 is not dependent on the details, so there is never possible for the 讞讻诐 to make this mistake. But 专讘 驻驻讗 讗诪专, 专讘 驻驻讗 says, 爪专讬讱, that you do have to tell the 讞讻诐 the details why you made the 谞讚专, 诪砖讜诐 诪讬诇转讗 讚讗讬住讜专讗, because of an 注谞讬谉, of a thing of 讗讬住讜专. It's possible that the reason he made a 谞讚专 was to prevent him, for instance, from doing an 讗讬住讜专. Let's say he made a 谞讚专 that if he's going to eat non-kosher food, then he is obligated to do so and so. And the reason he wants to take off the 谞讚专, not to be obligated to do that certain thing, is because he wants to eat 讞讝讬专. So if the 讞讻诐 will not hear the reasons why he made a 谞讚专, he might nullify this 谞讚专, and that will give the person the opportunity to go and do a 讚讘专 讗讬住讜专, an 注讘讬专讛. And therefore, the 讚讬谉 is that a 讞讻诐, in order to nullify the 谞讚专, must first hear the 驻专讟讬诐, he must hear the reasons why the 谞讚专 was made. Then the 讙诪专讗 continues: 转谞谉, we learn in the 诪砖谞讛 in 讘讻讜专讜转, 讛谞讜砖讗 谞砖讬诐 讘注讘讬专讛, if a 讻讛谉 marries a wife through an 注讘讬专讛, he marries a woman that is prohibited to him, for instance, if a 讻讛谉 marries a 讙专讜砖讛, a divorcee, 驻住讜诇, this 讻讛谉 is 驻住讜诇 from doing the 注讘讜讚讛 in the 讘讬转 讛诪拽讚砖, 注讚 砖讬讚讜专 讛谞讗讛, till he makes a 谞讚专 that he will not have any 讛谞讗讛, any benefits from his wife, which means he will divorce her. So he has to make a 谞讚专 that he is going to divorce his wife. 讜转谞讬 注诇讛, and we learned in a 讘专讬讬转讗 as an explanation to this 诪砖谞讛, that the 诪砖谞讛 does not mean that he has to make a 谞讚专 and then he divorces her and then he's allowed to do the 注讘讜讚讛, but it could be in a different way: 谞讜讚专, he has to make the 谞讚专, 讜注讜讘讚, as soon as he makes the 谞讚专 he could do the 注讘讜讚讛, 讬讜专讚, then he goes down from the 注讘讜讚讛, 讜诪讙专砖, he divorces her later. So the 砖讗诇讛 of the 讙诪专讗 is: 讜讗讬 讗诪专转, if you're going to say 讗讬谞讜 爪专讬讱 诇驻专讟 讗转 讛谞讚专, that when you go to a 讞讻诐 to be 诪转讬专 谞讚专, you don't have to give him the reason why you made the 谞讚专, 诇讬讞讜砖, let us be afraid, 讚讬诇诪讗 讗讝讬诇 诇讙讘讬 讞讻诐, this 讻讛谉 might go to a 讞讻诐 讜砖专讬 诇讬讛, and he will be 诪转讬专 his 谞讚专. If you allow him to do the 注讘讜讚讛 before he actually divorces his wife, as soon as he makes the 谞讚专, but how do we know that he's going to keep his 谞讚专? He might go to a 讞讻诐 and tell the 讞讻诐 that he made a 谞讚专 to divorce his wife, and the 讞讻诐 won't know why he made a 谞讚专, and if the 讚讬谉 is that you don't have to tell the 讞讻诐 why, so the 讞讻诐 won't ask him. The 讞讻诐 will just hear that he made a 谞讚专 to divorce his wife and now he wants to be 诪转讬专 it, the 讞讻诐 will be 诪转讬专 his 谞讚专. So how can we trust this 讻讛谉 to allow him to do the 注讘讜讚讛 by just making a 谞讚专 that he'll divorce his wife? So that proves that when you come to a 讞讻诐 to nullify a 谞讚专, you must give him the reason why you made the 谞讚专. So in this case, there's nothing to be afraid of, because if he's going to go to the 讞讻诐 to nullify the 谞讚专, the 讞讻诐 will ask him, "Why did you make the 谞讚专?" He'll have to tell him, "It's because they wouldn't let me do the 注讘讜讚讛 because I married a 讙专讜砖讛." So certainly the 讞讻诐 will not be 诪转讬专 the 谞讚专. And the 讙诪专讗 answers, 讚诪讚专讬谞谉 诇讬讛 讘专讘讬诐, that we make him make the 谞讚专 in public. And since he makes this in public, this 谞讚专 cannot be nullified, and therefore, it's sufficient that he makes a 谞讚专 that he's going to divorce his wife, he could right away do the 注讘讜讚讛, because we're not afraid that he is going to nullify it through a 讞讻诐. Then the 讙诪专讗 asks, 讛谞讬讞讗, this is only good 诇诪讗谉 讚讗诪专, according to the one that holds 谞讚专 砖讛讜讚专 讘专讘讬诐 讗讬谉 诇讜 讛驻专讛, that a

Public 谞讚专 can/cannot be nullified debate

谞讚专 that's made in public cannot be nullified. So here, we have a way of preventing this 讻讛谉 from nullifying his 谞讚专. 讗诇讗 诇诪讗谉 讚讗诪专, but according to the one that holds 讬砖 诇讜 讛驻专讛, that even if it's made in public, it still could be nullified, 诪讗讬 讗讬讻讗 诇诪讬诪专, what can we say? How can we trust this 讻讛谉 by making a 谞讚专 that he's going to divorce his wife? Even if we're going to do it in public, but if we hold that a 谞讚专 that's done in public still could be nullified, so even a 谞讚专 like that he could nullify. So we're back to the question, how can we trust this 讻讛谉 that he is going to keep his 谞讚专? He might go to a 讞讻诐 to nullify it. And we're back to the proof that this proves that you must tell the 讞讻诐 the reason why you made a 谞讚专, and that's the only way we could prevent him from nullifying the 谞讚专, because the 讞讻诐, when he'll hear the reason, will not nullify it. And the 讙诪专讗 says, no, 讚诪讚专讬谞谉 诇讬讛 注诇 讚注转 专讘讬诐. We make him make the 谞讚专 under the 讚注转 of 专讘讬诐, under the authority of many. We tell him that you should say that you're making the 谞讚专 under the authority, under responsibility of the 专讘讬诐. And 讚讗诪专 讗诪讬诪专, because 讗诪讬诪专 said, 讛诇讻转讗, the 讛诇讻讛 is, 讗驻讬诇讜 诇诪讗谉 讚讗诪专, even according to the one that holds 谞讚专 砖讛讜讚专 讘专讘讬诐 讬砖 诇讜 讛驻专讛, that a 谞讚专 that was made in public can be nullified, but if it was made 注诇 讚注转 专讘讬诐, under the authority, under responsibility of the 专讘讬诐, 讗讬谉 诇讜 讛驻专讛, that cannot be nullified. So this is what we do with this 讻讛谉. We tell the 讻讛谉 that he should make a 谞讚专 注诇 讚注转 专讘讬诐 that he's going to divorce divorce his wife, and then he could continue doing the 注讘讜讚讛, and we're not afraid he's going to go to a 讞讻诐 to be 诪转讬专 it, because a 谞讚专 that was made 注诇 讚注转 专讘讬诐, everyone agrees, cannot be nullified. And the reason for this is, because when you nullify a 谞讚专, the 驻砖讟 is that the 讚注转 of the person who made the 谞讚专 changed, and therefore, you're able to change the 谞讚专, nullify the 谞讚专. But if the 谞讚专 was made 注诇 讚注转 专讘讬诐, so in order to change that 谞讚专, you would have to have the 讚注转 of all the people. And since you can't have the 讚注转 of all the people that the 谞讚专 was made 注诇 讚注转诐, so therefore, there is no way you could nullify the 谞讚专 that was made 注诇 讚注转 专讘讬诐. Then the 讙诪专讗 continues, 讜讛谞讬 诪讬诇讬, when is this 讚讬谉 that a 谞讚专 注诇 讚注转 专讘讬诐 cannot be nullified? Only 诇讚讘专 讛专砖讜转, if the reason you want to nullify it is only a 讚讘专 讛专砖讜转, an optional thing. It is not something that is a 诪爪讜讛. It is not because of a 讞讬讜讘 of an obligation of a 诪爪讜讛 that you want to nullify the 谞讚专, it is only for a 讚讘专 讛专砖讜转. 讗讘诇 诇讚讘专 诪爪讜讛, but if the reason you want to nullify the 谞讚专 is because of a 诪爪讜讛, 讬砖 诇讜 讛驻专讛, there, you could nullify even if it's 注诇 讚注转 专讘讬诐. And the reason for that is also very simple. Since we assume that everyone would agree that for this 诪爪讜讛, the 谞讚专 should not exist. So therefore, even though it was done 注诇 讚注转 专讘讬诐 and normally you cannot nullify it, because how do you know what the 讚注转 of all the people would be? But by the case of a 诪爪讜讛, we assume that everyone would agree that the 诪爪讜讛 should be done, and therefore everyone would agree to be 诪转讬专 this 谞讚专. And the 讙诪专讗 gives an example, 讻讬 讛讛讜讗 诪拽专讬 讚专讚拽讬, there was this 诪诇诪讚 of children, there was this teacher, 讚讗讚专讬讛 专讘 讗讞讗 注诇 讚注转 专讘讬诐, that 专讘 讗讞讗 made him make a 谞讚专 注诇 讚注转 专讘讬诐 that he would never teach children again, 讚讛讜讛 驻砖注 讘讬谞讜拽讬, because he would hit the children too much. So he made him make a 谞讚专 注诇 讚注转 专讘讬诐 that he would never teach children again. 讜讗讛讚专讬讛 专讘讬谞讗, but 专讘讬谞讗 took back the 谞讚专, was 诪转讬专 the 谞讚专. Why? Because 讚诇讗 讗砖转讻讞 讚讚讬讬拽 讻讜讜转讬讛, because they couldn't find anybody else that was a good teacher as him. So in order for the children to have the best teacher, they nullified the 谞讚专 even though it was done 注诇 讚注转 专讘讬诐. And this is

Teaching Children Permits Leniency in Nedar

because to teach children is a 诪爪讜讛, so for the sake of a 诪爪讜讛, you're allowed to be 诪转讬专 even a 谞讚专 that was done 注诇 讚注转 专讘讬诐. Going back to the 讙诪专讗 before, where 专讘 讛讜谞讗 said that if she already remarried, we do not tell her to make a 谞讚专 in order to collect the 讻转讜讘讛, because we're afraid that her husband is going to be 诪转讬专 the 谞讚专, so 转讜住驻讜转 asks an interesting 拽砖讬讗: there is another way to do it to prevent her husband from being 诪转讬专 the 谞讚专. Let's bring a piece of bread, for instance, into the 讘讬转 讚讬谉, and let's tell her, make a 谞讚专 that if you did collect the 讻转讜讘讛 already, you will not eat this piece of bread, and then let's tell her to eat the bread right there in front of us, before she even goes home to her husband. So here, the husband cannot be 诪驻专, because later on when she will come home, she already has eaten the bread that the 谞讚专 was about, and here we will see if she's saying the truth or not. If she is lying, that she really did collect the 讻转讜讘讛, then automatically she is 讗住讜专 to eat this piece of bread, so she will not eat it in front of us. If she will eat it in front of us, that'll be a proof that she really did not collect the 讻转讜讘讛 and she's saying the truth. And

Tosafot on Fear of Long鈥慣erm vs One鈥慣ime Nedar

转讜住驻讜转 answers that 专讘 讛讜谞讗 holds that when is a person very afraid of a 谞讚专? If it's a 谞讚专 that's going to make the person 讗住讜专 on something for a long time. But if it's only a one-time thing, we're afraid that she would go against her 谞讚专. So the only way we could know for sure that she is saying the truth is if we tell her, make a 谞讚专 that for your whole lifetime you will not eat bread, for instance, if you did collect your 讻转讜讘讛 already. So then we know that if she would be lying, she wouldn't do it, because she would not accept upon herself a 谞讚专 for her lifetime. But a 谞讚专 that she would not eat this piece of bread, so here we suspect that maybe she would be lying, and she would once go against her 谞讚专 in order to collect the money of the 讻转讜讘讛 again. Based on this 住讘专讗, 转讜住驻讜转 answers another interesting 拽砖讬讗 in this 讙诪专讗. The 讙诪专讗 asks a 拽砖讬讗, 讜谞讬讞讜砖, let us be afraid, 讚讬诇诪讗 讗讝诇讗 诇讙讘讬 讞讻诐 讜砖专讬, maybe she will go to a 讞讻诐 and the 讞讻诐 will be 诪转讬专 her 谞讚专. When did the 讙诪专讗 ask this 拽砖讬讗? After the 讙诪专讗 quoted 专讘 讛讜谞讗's 讚讬谉 that if she remarried, we do not tell her to make a 谞讚专, because we're afraid that her husband will nullify it. Then the 讙诪专讗 asks, but anyway she could go to a 讞讻诐 to nullify the 谞讚专. 诇讻讗讜专讛, this 拽砖讬讗 has nothing to do with 专讘 讛讜谞讗. This is a 拽砖讬讗 directly on the 诪砖谞讛. When the 诪砖谞讛 says that the way we find out that she's saying the truth by telling her to make a 谞讚专, what kind of proof do we have for her 谞讚专? Maybe when she finishes with the 谞讚专, she's going to go to a 讞讻诐 and he'll be 诪转讬专 the 谞讚专? Why does the 讙诪专讗 ask this 拽砖讬讗 only after 专讘 讛讜谞讗 said his 讚讬谉, that if she remarried, then we're afraid of her husband, so that's when the 讙诪专讗 comes up with the question, let's be afraid a 讞讻诐 will be 诪转讬专? Why didn't the 讙诪专讗 ask the question even before, on the 诪砖谞讛 itself? And based on what 转讜住驻讜转 said before, 转讜住驻讜转 answers this question. Because without 专讘 讛讜谞讗, just the 诪砖谞讛 itself, we have a way to prevent her from going to a 讞讻诐. We'll tell her to make a 谞讚专 on a piece of bread that is right there in front of us, and we'll tell her, say that if you collected from the 讻转讜讘讛, you're not allowed to eat this bread, and let's make her eat that piece of bread. So here we're not afraid she might go to a 讞讻诐 and be 诪转讬专 the 谞讚专, because when she goes to the 讞讻诐, it will be already after she did the 谞讚专. But now that 专讘 讛讜谞讗 said that if she remarried, we do not tell her to make a 谞讚专, because we are afraid of her husband nullifying the 谞讚专. In other words, we see that 专讘 讛讜谞讗 does not feel it's sufficient to tell her to make a 谞讚专 on a piece of bread and tell her to eat it in front of us, because he feels that a one-time thing a person will be 注讜讘专. So now the 讙诪专讗 says, if you, if you feel that way, so we cannot do that, so if so, the question comes up, let us always be afraid afraid maybe she will go to a 讞讻诐 and the 讞讻诐 will be 诪转讬专 her 谞讚专. Another question that 转讜住驻讜转 asks in this 住讜讙讬讗 here, he says, when the 讙诪专讗 feels that she could go to a 讞讻诐 to be 诪转讬专, or she could have her husband be 诪转讬专 the 谞讚专, so 转讜住驻讜转 asks, how is that possible? We have a 讚讬谉 that when a person is 诪讚讬专 讛谞讗讛 诪讞讘讬专讜, if a person makes a 谞讚专 not to have 讛谞讗讛 from his friend, so then he cannot be 诪转讬专 that 谞讚专 unless it is in front of the friend. So here too, since she made the 谞讚专 because of the 讬转讜诪讬诐, so she cannot be 诪转讬专 the 谞讚专 unless it is in front of the 讬转讜诪讬诐. So what is this whole 砖拽诇讗 讜讟专讬讗, the whole discussion in the 讙诪专讗, about her going away and having her husband be 诪转讬专 the 谞讚专, or going to a 讞讻诐 to be 诪转讬专 the 谞讚专, if she cannot be 诪转讬专 the 谞讚专 anyway unless the people who the 谞讚专 was made for are there? So she will have to do it in front of the 讬转讜诪讬诐, and they definitely would not allow it. And 转讜住驻讜转 answers firstly that 讘讚讬注讘讚, if you are 诪转讬专 it not in front of the other person, it is 诪讜驻专. So therefore we're afraid she's going to go and do it, and then 讘讚讬注讘讚 the 谞讚专 will be 诪讜转专. But then 转讜住驻讜转 gives another reason. 转讜住驻讜转 says that that 讚讬谉 would really not apply here. And 转讜住驻讜转 explains it, because what is the reason why when you make a 谞讚专 from your friend, you have to nullify it only in front of your friend? And 转讜住驻讜转 says, in 讬专讜砖诇诪讬 we find two reasons for it. One reason is 诪驻谞讬 讛讘讜砖讛, because they want that the person should be embarrassed in front of that other person that he made the 谞讚专 from. And another reason is 诪驻谞讬 讛讞砖讚, that people shouldn't be 讞讜砖讚 him that he was 注讜讘专 on his 谞讚专. If he will not be 诪转讬专 the 谞讚专 in front of the other person, so no one will know that he was 诪转讬专 his 谞讚专. Later we will see that he is 注讜讘专 on his 谞讚专, people will be 讞讜砖讚 that look, this person is 注讜讘专 on a 谞讚专, and therefore the 讚讬谉 is that he must nullify it in front of the other person. So

Why Standard Nullification Rules Don鈥檛 Apply Here

转讜住驻讜转 says, both of these reasons don't apply here, because here the way the 谞讚专 was made, that only if she did take the money from the 讻转讜讘讛 before, the 谞讚专 is 讞诇. Now who knows whether she took or she didn't? Only she herself knows. And therefore both reasons don't apply here. The reason of 讘讜砖讛 doesn't apply, because even if she will be 诪转讬专 the 谞讚专 in front of the 讬转讜诪讬诐, she still will not be embarrassed, because they don't know whether the 谞讚专 was 讞诇 or not. And the other reason, that we will be 讞讜砖讚 that she went against the 谞讚专, doesn't apply here either, because no one knows whether the 谞讚专 was really 讞诇 or not. And therefore 转讜住驻讜转 says, there could be a whole 砖拽诇讗 讜讟专讬讗 here in the 讙诪专讗 concerning her husband nullifying her 谞讚专, and concerning a 讞讻诐 nullifying her 谞讚专. Another thing that 转讜住驻讜转 asks in this 住讜讙讬讗 is that when the 讙诪专讗 asked a 拽讜砖讬讗 from the 诪砖谞讛 where it says that a 讻讛谉 who married a woman 讘注讘讬专讛 is 驻住讜诇 to do the 注讘讜讚讛 till he makes a 谞讚专 that he will not have 讛谞讗讛 from his wife, and then the 讘专讬讬转讗 on that 诪砖谞讛 said that he makes the 谞讚专 and could continue doing the 注讘讜讚讛, and later he divorces, the 讙诪专讗 asked a 拽讜砖讬讗 from that 讘专讬讬转讗, that how could we trust him by making the 谞讚专, 诇讻讗讜专讛 he could go to a 讞讻诐 to be 诪转讬专, and the 讙诪专讗 wanted to prove that you have to be 诪驻专讟 the 谞讚专. So 转讜住驻讜转 asks, why did the 讙诪专讗 have to bring in that 讘专讬讬转讗? The 讙诪专讗 could have asked the 拽讜砖讬讗 directly from the 诪砖谞讛! It says in the 诪砖谞讛, if a

讻讛谉 must 谞讚专 before 注讘讜讚转 讘讬转 讛诪拽讚砖

讻讛谉 marries a woman 讘注讘讬专讛, he is 驻住讜诇 to do the 注讘讜讚讛 till he makes a 谞讚专 讛谞讗讛. So we see that as soon as he makes the 谞讚专 讛谞讗讛, he could already do the 注讘讜讚讛. So if not for the 讘专讬讬转讗, we would have known it too, so why did the 讙诪专讗 only ask the 拽讜砖讬讗 after we brought the 讘专讬讬转讗? And 转讜住驻讜转 answers that from the 诪砖谞讛 itself, we could have learned that he must wait to do the 注讘讜讚讛 till after he divorces her. What did the 诪砖谞讛 mean, 注讚 砖讬讚讜专 讛谞讗讛? Till he makes a 谞讚专 that he will not marry anymore women that are 讗住讜专 to him in the future. But in the 讘专讬讬转讗, it says clearly that even concerning this woman itself, he makes just the 谞讚专 and then he could do the 注讘讜讚讛. And therefore the 讙诪专讗 asks that how can we trust him that he's going to divorce her when maybe he's going to go to the 讞讻诐 to be 诪转讬专 the 谞讚专? And so from that, the 讙诪专讗 wanted to prove that you don't have to be 诪驻专讟 the 谞讚专.
