Introduction to the shiur on Gittin 33

Jewish audio on Chabad.org. This ืฉื™ืขื•ืจ will be ืžืกื›ืช ื’ื™ื˜ื™ืŸ ื“ืฃ ืžืดื’. We will start on ื“ืฃ ืžืดื‘ ืขืžื•ื“ ื‘ืณ, six lines from the bottom of the ืขืžื•ื“. And the ื’ืžืจื here is still discussing all the different ื“ื™ื ื™ื of an ืขื‘ื“ ื›ื ืขื ื™. And the ื’ืžืจื starts: ืื™ื‘ืขื™ื ืœื”ื•, there was a question asked in the ื™ืฉื™ื‘ื”: ืขื‘ื“ ืฉืžื›ืจื• ืจื‘ื• ืœืงื ืก, an ืขื‘ื“ that his master sold him to someone else just for the ืงื ืก. As we learned before, the ื“ื™ืŸ is that if a ืฉื•ืจ, an ox, gores an ืขื‘ื“ and kills him, so the owner of the ox has to pay a fixed amount of money as fine to the master of the ืขื‘ื“, and that is 30 ืฉืงืœื™ื. And the ืฉืืœื” in the ื’ืžืจื is, if someone sold his ืขื‘ื“ only for the ืงื ืก, he sold the rights of collecting the ืงื ืก if the ืขื‘ื“ will ever be gored by an ox, the question is: ืžื›ื•ืจ ืื• ืื™ื ื• ืžื›ื•ืจ? Is it sold or is it not sold? Does this sale take effect? Since at the moment it's being sold there is no money value at all, because he was not gored yet, so the question is, can he sell the rights now of something that's going to happen later? And really we have an argument between ืจื‘ื™ ืžืื™ืจ and the ืจื‘ื ืŸ, as the ื’ืžืจื will bring soon, whether a person could be ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, whether a person could give away, be ืžืงื ื” to somebody else, something that didn't come to the world yet, something that doesn't exist yet. And the

Rabbi Meir vs Rabbis on selling nonโ€‘existent items

ืžื—ืœื•ืงืช is that ืจื‘ื™ ืžืื™ืจ holds ืื“ื ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, that a person can be ืžืงื ื”, can give away something that still doesn't exist, and the ื—ื›ืžื™ื hold ืื™ืŸ ืื“ื ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, a person cannot give away something that doesn't exist yet. For instance, if someone sells somebody else a ื“ืงืœื ืœืคื™ืจื•ืชื™ื•, which means he sells him a palm tree for the ืคื™ืจื•ืช, he says that the ืคื™ืจื•ืช that are going to grow on this palm tree are sold to you. And even though the ืคื™ืจื•ืช are not there yet, the fruit hadn't grown yet, still ืจื‘ื™ ืžืื™ืจ holds that this sale is valid, and when the fruit grow, that person keeps the fruit. While the ืจื‘ื ืŸ hold that ืื™ืŸ ืื“ื ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, so therefore, since the fruit don't exist yet, so he cannot sell him that fruit. So the ื’ืžืจื's question here is, in the case of the ืขื‘ื“, when he sold the right to collect the fine that will be paid for the ืขื‘ื“, is that sale a sale or not? And the ื’ืžืจื explains that we shouldn't think that the answer to this question would be that it depends on the ืžื—ืœื•ืงืช between ืจื‘ื™ ืžืื™ืจ and the ืจื‘ื ืŸ, that according to ืจื‘ื™ ืžืื™ืจ who holds that a person could sell something that doesn't exist yet, so in this case too, the sale should be a sale, according to the ืจื‘ื ืŸ who hold a person cannot sell something that doesn't exist, so this sale wouldn't be a sale. So the ื’ืžืจื says it is not so: ืชื™ื‘ืขื™ ืœืจื‘ื™ ืžืื™ืจ ืชื™ื‘ืขื™ ืœืจื‘ื ืŸ. The question here is even according to ืจื‘ื™ ืžืื™ืจ, and the question is also according to the ืจื‘ื ืŸ. And the ื’ืžืจื explains why: ืชื™ื‘ืขื™ ืœืจื‘ื™ ืžืื™ืจ, we have a question even according to ืจื‘ื™ ืžืื™ืจ, because ืขื“ ื›ืืŸ ืœื ืงืืžืจ ืจื‘ื™ ืžืื™ืจ ืื“ื ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, where do we find that ืจื‘ื™ ืžืื™ืจ holds that a person can give away something that didn't come into the world yet, ืืœื ื›ื’ื•ืŸ ืคื™ืจื•ืช ื“ืงืœ ื“ืขื‘ื™ื“ื™ ื“ืืชื•, in the case where he sells the fruit of a palm tree, and there he holds that the sale is valid because they will definitely come, even though the fruit is not there yet, but normally, under normal circumstances, the fruit will grow, so therefore he holds that a sale like that is valid. ืื‘ืœ ื”ื›ื, but in this case, ืžื™ ื™ื™ืžืจ ื“ืžื™ื ื’ื—, who says it'll ever come?

Will the fine ever be payable?

Firstly, who says that an ox will ever gore this ืขื‘ื“? ื•ืื ืชืžืฆื™ ืœื•ืžืจ ื“ืžื™ื ื’ื—, and even if an ox will gore this ืขื‘ื“, ืžืžืื™ ื“ืžืฉืœื, how do we know that there will ever be a payment, because ื“ื™ืœืžื ืžื•ื“ื” ื•ืžืคื˜ืจ, maybe the owner of the ox will admit and he will be ืคื˜ื•ืจ, because the ื“ื™ืŸ is that ืžื•ื“ื” ื‘ืงื ืก ืคื˜ื•ืจ, that any payment, any ื—ื™ื•ื‘ ืžืžื•ืŸ, that is under the category of ืงื ืก, of a fine, the ื“ื™ืŸ is that if the person who is obligated to pay that fine, if he admits without ืขื“ื™ื, witnesses, coming to testify that the thing was done, then he is ืคื˜ื•ืจ. The ื“ื™ืŸ of ืงื ืก only applies if two witnesses come and say that a person did so and so, and therefore he has to pay the fine, then he pays the fine. For instance, if someone steals, so the ื“ื™ืŸ by a ื’ื ื‘ is that you have to pay ื›ืคืœ, double. You pay back the principal that you stole, plus you pay double, which is ื›ืคืœ. So the ื“ื™ืŸ is that if the person himself admits that he stole, without witnesses coming, so then he only pays the principal, but the fine, the extra part, he does not pay. And the same applies to the payment of thirty ืฉืงืœื™ื for the ื ื’ื™ื—ื” of an ืขื‘ื“. Since the payment of the thirty ืฉืงืœื™ื is considered a ืงื ืก, a fine, as we see that the ืชื•ืจื” set aside a fixed amount for payment of this ื ื’ื™ื—ื”, of this goring, that shows that it is not payment for the damage, but it is a fine. So this ื“ื™ืŸ, that if you admit on the fine you are ืคื˜ื•ืจ, applies to this ื“ื™ืŸ, too. So if ever a ืฉื•ืจ, an ox, would gore or kill an ืขื‘ื“, and the owner of the ox would admit before the witnesses come, then he would be ืคื˜ื•ืจ from paying that fine. And that's what the ื’ืžืจื says: how do you know that it'll ever come for this fine to be paid? Even if he will be gored by an ox, maybe the owner of the ox will admit and he will be ืคื˜ื•ืจ from paying the fine? So therefore, maybe in a case like this, ืจื‘ื™ ืžืื™ืจ is ืžื•ื“ื” that a person cannot sell something that doesn't exist, and we are not sure even that it'll ever come. And

Applying both opinions to the sale of fine rights

also, ื•ืชื™ื‘ืขื™ ืœืจื‘ื ืŸ, the question is also according to the ืจื‘ื ืŸ who hold that a person cannot be ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, but maybe in this case they would admit that you could sell the rights to collect the fine if it'll ever happen, because ืขื“ ื›ืืŸ ืœื ืงืืžืจื™ ืจื‘ื ืŸ ืื™ืŸ ืื“ื ืžืงื ื” ื“ื‘ืจ ืฉืœื ื‘ื ืœืขื•ืœื, because when do the ืจื‘ื ืŸ say that a person cannot be ืžืงื ื” something that didn't come into the world yet? ืืœื ื›ื’ื•ืŸ ืคื™ืจื•ืช ื“ืงืœ, only in the case of the fruit of the tree, ื“ื”ืฉืชื ืžื™ื”ื ืœื™ืชื ื”ื•, because now when he is making the sale, the fruit isn't there yet, so it's actually not in the world yet. And therefore, they hold you cannot sell that. ืื‘ืœ ื”ื›ื, but in the case of the ืขื‘ื“, ื”ื›ื ืฉื•ืจ ื•ื”ื›ื ืขื‘ื“, the ืฉื•ืจ that might gore him is existing, the ืขื‘ื“ that we're dealing with that might be gored is existing. So maybe in a case like that, even though the act didn't happen yet, and his ื—ื™ื•ื‘, the obligation of payment didn't come yet, but since the objects that are involved here are existing, maybe the ืจื‘ื ืŸ would admit that you could sell and you could give away something that didn't come into the world under such circumstances. And the question is ืžืื™, what is the ื“ื™ืŸ? ืืžืจ ืจื‘ื, so ืจื‘ื said, ืชื ืฉืžืข, come here, I will answer your question.

Rav A introduces the verse ื•ื™ืœื™ื“ ื‘ื™ืช

There's a ืคืกื•ืง that says, ื•ื™ืœื™ื“ ื‘ื™ืช. This is a ืคืกื•ืง in ืคืจืฉืช ืืžื•ืจ, ืคืจืง ื›ืดื‘, ืคืกื•ืง ื™ืดื. Now I'll quote the whole ืคืกื•ืง. The ืคืกื•ืง speaks about the ื“ื™ื ื™ื of ืชืจื•ืžื”, who could eat ืชืจื•ืžื”. So the ืชื•ืจื” says, ื•ื›ื”ืŸ ื›ื™ ื™ืงื ื” ื ืคืฉ ืงื ื™ืŸ ื›ืกืคื•, a ื›ื”ืŸ that will buy a ื ืคืฉ that belongs to him, his property, ื”ื•ื ื™ืื›ืœ ื‘ื•, he could eat. That means that an ืขื‘ื“ of a ื›ื”ืŸ, an ืขื‘ื“ ื›ื ืขื ื™, could eat ืชืจื•ืžื”. Then the ืชื•ืจื” continues, ื•ื™ืœื™ื“ ื‘ื™ืชื•, and those that were born in his house, ื”ื ื™ืื›ืœื• ื‘ืœื—ืžื•, they could eat in his bread. And that means those ืขื‘ื“ื™ื that were born from his ืฉืคื—ื•ืช. That if a ื›ื”ืŸ owned ืฉืคื—ื•ืช, female goyishe slaves, the children that they have are ืขื‘ื“ื™ื, so they also are able to eat from the ืชืจื•ืžื” of the ื›ื”ืŸ. So the ื‘ืจื™ื™ืชื asks: ืžื” ืชืœืžื•ื“ ืœื•ืžืจ? Why does the ืชื•ืจื” have to tell us that the children of the ืฉืคื—ื•ืช of the ื›ื”ืŸ are allowed to eat ืชืจื•ืžื”? Because we would understand it ourselves: ืื ืงื ื™ืŸ ื›ืกืฃ ืื•ื›ืœ, if those that he bought with money, they are able to eat from the ืชืจื•ืžื”, ื™ืœื™ื“ ื‘ื™ืช ืœื ื›ืœ ืฉื›ืŸ? Those that were born in his house, those ืขื‘ื“ื™ื that were born already when the mother belonged to the ื›ื”ืŸ, certainly are able to eat ืชืจื•ืžื”. And the ื‘ืจื™ื™ืชื answers: ืื™ืœื• ื›ืŸ ื”ื™ื™ืชื™ ืื•ืžืจ, if so, if the ืชื•ืจื” wouldn't mention separately that those that are born in the house of the ื›ื”ืŸ could eat ืชืจื•ืžื”, so I would think, ืžื” ืงื ื™ืŸ ื›ืกืฃ ืฉื™ืฉ ื‘ื• ืฉื•ื” ื›ืกืฃ ืื•ื›ืœ, that just like ืงื ื™ืŸ ื›ืกืฃ has a worth of money, has at least the worth of a ืคืจื•ื˜ื”, cuz when you buy an ืขื‘ื“, he definitely has the worth of a ืคืจื•ื˜ื”, because otherwise it's not called ืงื ื™ืŸ ื›ืกืฃ, you're not ืงื•ื ื” anything. In order to be ืงื•ื ื” something, it has to have the value of a ืคืจื•ื˜ื”. So just like ืงื ื™ืŸ ื›ืกืคื• that is mentioned in the ืคืกื•ืง has the worth of a ืคืจื•ื˜ื”, ืืฃ ื™ืœื™ื“ ื‘ื™ืช, so too, the ืขื‘ื“ that was born in the house of the ื›ื”ืŸ, ืฉื™ืฉ ื‘ื• ืฉื•ื” ื›ืกืฃ ืื•ื›ืœ, only if that ืขื‘ื“ happens to be worth a ืคืจื•ื˜ื”, he could eat. ื•ืžื ื™ืŸ, and how would we know, ืฉืืฃ ืขืœ ืคื™ ืฉืื™ื ื• ืฉื•ื” ื›ืœื•ื, that even if that ืขื‘ื“ is not worth anything, he still could eat? Because there is a possibility for an ืขื‘ื“ not to be worth even a ืคืจื•ื˜ื”. If he is sick and there is no use in the ืขื‘ื“, so then he's not even worth a ืคืจื•ื˜ื”. So I would think that when could an ืขื‘ื“ that was born in the house of a ื›ื”ืŸ eat ืชืจื•ืžื”? Only if he is worth at least a ืคืจื•ื˜ื”. But I wouldn't know if he's not worth a ืคืจื•ื˜ื” that he could also eat. Therefore, ืชืœืžื•ื“ ืœื•ืžืจ ื™ืœื™ื“ ื‘ื™ืช, therefore the ืชื•ืจื” tells us separately, ื™ืœื™ื“ ื‘ื™ืช, that an ืขื‘ื“ that is born in the house of a ื›ื”ืŸ could eat ืชืจื•ืžื” to teach us ืžื›ืœ ืžืงื•ื, that in any way, as long as he is born in the house of a ื›ื”ืŸ and he is the ืขื‘ื“ of the ื›ื”ืŸ, whether he is worth a ืคืจื•ื˜ื” or not, he is able to eat ืชืจื•ืžื”. ืขื“ื™ื™ืŸ ืื ื™ ืื•ืžืจ, but still I would think ื™ืœื™ื“ ื‘ื™ืช, ื‘ื™ืŸ ืฉื™ืฉ ื‘ื• ืฉื•ื” ื›ืกืฃ, ื‘ื™ืŸ ืฉืื™ืŸ ื‘ื• ืฉื•ื” ื›ืกืฃ, ืื•ื›ืœ, that this ื™ืœื™ื“ ื‘ื™ืช, this ืขื‘ื“ that was born in the house of the ื›ื”ืŸ, he could eat ืชืจื•ืžื” whether he's worth a ืคืจื•ื˜ื” or not, as we just learned out, because the ืชื•ืจื” puts an extra word, ื•ื™ืœื™ื“ ื‘ื™ืช. But I would think, the one that was bought by the ื›ื”ืŸ, so there the ื“ื™ืŸ should be that if he has a ืฉื•ื” ืคืจื•ื˜ื”, then he could eat ืชืจื•ืžื”, but if he doesn't, he shouldn't eat ืชืจื•ืžื”, because we have no special ืจืื™ื” that the one that was bought by the ื›ื”ืŸ, even if he doesn't have a ืฉื•ื” ืคืจื•ื˜ื” he still could eat, because the word ืงื ื™ืŸ ื›ืกืฃ would be implying that he has to be worth at least a ืคืจื•ื˜ื”. ืชืœืžื•ื“ ืœื•ืžืจ, so we have a ืœื™ืžื•ื“ we learn out from the ืคืกื•ืง, since the ืคืกื•ืง puts together the two words, ืงื ื™ืŸ ื›ืกืคื•, ื•ื™ืœื™ื“ ื‘ื™ืชื•, the one that he bought for his money and the one that was born in his house, so we combine the two and we learn out one from the other and we say, ืžื” ื™ืœื™ื“ ื‘ื™ืช, just like the ื™ืœื™ื“ ื‘ื™ืช, the one that was born in the house of the ื›ื”ืŸ, ืืฃ ืขืœ ืคื™ ืฉืื™ื ื• ืฉื•ื” ื›ืœื•ื ืื•ื›ืœ, even if he's not worth anything, he still could eat, as we learned out before, ืืฃ ืงื ื™ืŸ ื›ืกืคื•, the same applies to the ืขื‘ื“ that he bought for his money, ืืฃ ืขืœ ืคื™ ืฉืื™ื ื• ืฉื•ื” ื›ืœื•ื, even if he's not worth anything, ืื•ื›ืœ, he still could eat. This is the ื‘ืจื™ื™ืชื. And from this ื‘ืจื™ื™ืชื the ื’ืžืจื wants to prove that ื•ืื™ ืกืœืงื ื“ืขืชืš ืขื‘ื“ ืฉืžื›ืจื• ืจื‘ื• ืœืงื ืก ืžื›ื•ืจ, that if you're gonna think that if the master sold his ืขื‘ื“ just for ืงื ืก, just the rights to collect the ืงื ืก, the sale is valid, ืžื™ ืื™ื›ื ืขื‘ื“ื ื“ืœื ืžื–ื“ื‘ืŸ ืœืงื ืกื? Is there such a thing that an ืขื‘ื“ should not be worth a ืคืจื•ื˜ื”, that an ืขื‘ื“ should not be able to be sold for the ืงื ืก? In other words, the ื‘ืจื™ื™ืชื mentions a possibility of an ืขื‘ื“ not being worth a ืคืจื•ื˜ื”. How's that possible? A ืคืจื•ื˜ื” you could always get for the ืขื‘ื“. If he would just sell the ืขื‘ื“ for the ืงื ืก, that if ever a ืฉื•ืจ will gore that ืขื‘ื“ and kill him, the ืงื ืก will go to the buyer, so then there would definitely be a customer that would buy the ืขื‘ื“ for a ืคืจื•ื˜ื”. Everybody would invest a ืคืจื•ื˜ื” that he might on that ืคืจื•ื˜ื” make thirty ืฉืงืœื™ื. So how can there be a possibility of an ืขื‘ื“ not being worth a ืคืจื•ื˜ื”? And since the ื‘ืจื™ื™ืชื does mention that there is an ืขื‘ื“ not worth a ืคืจื•ื˜ื”, that shows that if you would sell the ืขื‘ื“ for the ืงื ืก, the sale would not be valid. And therefore, there could be an ืขื‘ื“ not worth a ืคืจื•ื˜ื”. And the ื’ืžืจื says, ืื™ืŸ, yes, there is a possibility for an ืขื‘ื“ not to be able to be sold for the ืงื ืก. In other words, could be the ื“ื™ืŸ is that if you sell the ืขื‘ื“ for the ืงื ืก, then the sale is valid. Ah, you asked, if so, how can there be a possibility of an ืขื‘ื“ not being worth even a ืคืจื•ื˜ื”? Because there is a possibility of an ืขื‘ื“ that you cannot sell him for the ืงื ืก. ืื™ื›ื ืขื‘ื“ ื˜ืจื™ืคื”. There is an ืขื‘ื“ that is ื˜ืจื™ืคื”. ื˜ืจื™ืคื” means if he is sick with such a sickness that he will die. And the ื“ื™ืŸ is that in a case like that, the owner of the ืฉื•ืจ would be ืคื˜ื•ืจ. If a ืฉื•ืจ gores an ืขื‘ื“ that was ื˜ืจื™ืคื”, so the owner of the ืฉื•ืจ does not have to pay the thirty ืฉืงืœื™ื. So the case of the ื‘ืจื™ื™ืชื where it says that there is a possibility for an ืขื‘ื“ not even to be worth a ืคืจื•ื˜ื” must be in the case where the ืขื‘ื“ was ื˜ืจื™ืคื”, so he himself is not worth anything, to sell him for his ืงื ืก you can't either because there is no ืงื ืก in that case, and that is an ืขื‘ื“ that is not worth a ืคืจื•ื˜ื”. But the

Can a slave be worthless? The case of ื˜ืจื™ืคื”

ื’ืžืจื asks, ื•ื”ื ื—ื–ื™ ืœืžืงื ืงืžื™ื”, even though he is ื˜ืจื™ืคื”, but still you could, he could stand in front of his buyer, he could do some light work. So even though you can't sell him for the ืงื ืก, but till he dies he still could do some light work, at least that's worth a ืคืจื•ื˜ื”, so he could also be sold for a ืคืจื•ื˜ื”. So we're back to the question, how can there be an ืขื‘ื“ not worth a ืคืจื•ื˜ื”? And the ื’ืžืจื answers, ื‘ืžื ื•ื•ืœ ื•ืžื•ื›ื” ืฉื—ื™ืŸ, a disgusting, sick ืขื‘ื“ full of boils, etc. And he is also a ื˜ืจื™ืคื”. So an ืขื‘ื“ like that, he cannot do any work, people don't want him for the work, so therefore they won't pay a ืคืจื•ื˜ื” for his work. They can't pay a ืคืจื•ื˜ื” for the ืงื ืก because since he is ื˜ืจื™ืคื”, there is no ืงื ืก, so an ืขื‘ื“ like that is not worth anything. Then the ื’ืžืจื continues, ืื™ื‘ืขื™ื ืœื”ื•, there was an ืื™ื‘ืขื™ื, a question asked in the ื™ืฉื™ื‘ื”, ืžื™ ืฉื—ืฆื™ื• ืขื‘ื“ ื•ื—ืฆื™ื• ื‘ืŸ ื—ื•ืจื™ืŸ ืฉืงื™ื“ืฉ ื‘ืช ื—ื•ืจื™ืŸ ืžื”ื•? An ืขื‘ื“ who was half ืขื‘ื“ and half free, and he gave ืงื™ื“ื•ืฉื™ืŸ to a ื‘ืช ื—ื•ืจื™ืŸ, to a regular free Jewish woman, ืžื”ื•, what is the ื“ื™ืŸ? Is she ืžืงื•ื“ืฉืช or is she not ืžืงื•ื“ืฉืช? And it would seem that this could be answered very simply. Because we find a ื“ื™ืŸ by ืงื™ื“ื•ืฉื™ืŸ, that if a man says to a woman, you should be ืžืงื•ื“ืฉืช to half of me, so the ื“ื™ืŸ is that she is ืžืงื•ื“ืฉืช. On the other hand, if a man says to a woman, half of you should be ืžืงื•ื“ืฉืช to me, the ื“ื™ืŸ is that she is not ืžืงื•ื“ืฉืช. So we could compare this case here to one of the two cases. If we compare it to the first case, where the man says, "You should be ืžืงื•ื“ืฉืช to half of me," so in this case too, when he is a half ืขื‘ื“ and half ื‘ืŸ ื—ื•ืจื™ืŸ, so when he is ืžืงื“ืฉ the woman, it's as if he is ืžืงื“ืฉ only to half of himself. So just like the ื“ื™ืŸ by ืงื™ื“ื•ืฉื™ืŸ is that if a person says, "You should be ืžืงื•ื“ืฉืช to half of me," she is ืžืงื•ื“ืฉืช, in this case she also should be ืžืงื•ื“ืฉืช, because half of him is a ื‘ืŸ ื—ื•ืจื™ืŸ, so she is ืžืงื•ื“ืฉืช to half of him and that is possible. On the other hand, if we're going to compare it to the second case, so in this case which should be definite that she is not ืžืงื•ื“ืฉืช. Just like over there we say that if he says to a woman, "Half of you should be ืžืงื•ื“ืฉืช to me," she is not ืžืงื•ื“ืฉืช, the same here, that when the ืขื‘ื“ is ืžืงื“ืฉ her to half of him, because he is half ื‘ืŸ ื—ื•ืจื™ืŸ only, the ื“ื™ืŸ should also be he is not ืžืงื•ื“ืฉืช. And that's what the ื’ืžืจื is going to discuss, that we cannot compare this case to both of those cases. And the ื’ืžืจื explains: ืื ืชืžืฆื™ ืœื•ืžืจ, if you're going to tell me and you're going to want to compare this case to the ื“ื™ืŸ of a ื‘ืŸ ื™ืฉืจืืœ ืฉืืžืจ ืœื‘ืช ื™ืฉืจืืœ, a regular Jewish man said to a regular Jewish woman, "ื”ืชืงื“ืฉื™ ืœื—ืฆื™ื™, be ืžืงื•ื“ืฉืช to half of me," ืžืงื•ื“ืฉืช, she is ืžืงื•ื“ืฉืช. So here too, the ื“ื™ืŸ should be that she is ืžืงื•ื“ืฉืช. I could tell you, over there, ื“ื—ื–ื™ื ืœื›ื•ืœื™ื”, she is ืจืื•ื™ื” to be ืžืงื•ื“ืฉืช to him completely. In other words, he could have been ืžืงื“ืฉ her to himself completely. So therefore, when he says, "You should be ืžืงื•ื“ืฉืช to half of me," he didn't mean to say that only half of me should be your husband. What he meant to say was that I want to leave myself the right to marry another wife. But the ืงื™ื“ื•ืฉื™ืŸ that he gave her is 100% ืงื™ื“ื•ืฉื™ืŸ. So therefore, over there we say the ืงื™ื“ื•ืฉื™ืŸ is ืงื™ื“ื•ืฉื™ืŸ. But in this case, ืคื” here ืœื ื—ื–ื™ื ืœื›ื•ืœื™ื”, she is not fit to be married to him completely, since half of him is an ืขื‘ื“. So here, she is not able to be ืžืงื•ื“ืฉืช to him completely. Maybe in a case like that, the ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ. ืื ืชืžืฆื™ ืœื•ืžืจ, if you're going to want to say and compare this to a case of ื‘ืŸ ื™ืฉืจืืœ ื”ืžืงื“ืฉ ื—ืฆื™ ืืฉื”, ืื™ื ื” ืžืงื•ื“ืฉืช, that if a ื™ื™ื“ gives ืงื™ื“ื•ืฉื™ืŸ to half of the woman, she is not ืžืงื•ื“ืฉืช, and you want to say the same thing here, if he gives ืงื™ื“ื•ืฉื™ืŸ to that woman, it is half of him that is being married, because he is only half ื‘ืŸ ื—ื•ืจื™ืŸ, so also the ืงื™ื“ื•ืฉื™ืŸ should not be ืงื™ื“ื•ืฉื™ืŸ. So I could make a difference, the ื’ืžืจื says. Over there, ื“ืฉื™ื™ืจ ื‘ืงื ื™ื™ื ื™ื”, over there when he was ืžืงื“ืฉ half of the woman, he left over half of the ืงื ื™ื™ืŸ. You can't explain him that he meant to say that she should be able to marry another man, that he leaves over the right that she should be able to marry another man, because a woman who is married cannot marry another man. So what must we say? That he actually meant only half of her should be ืžืงื•ื“ืฉืช. So since she is a complete ื‘ืช ื—ื•ืจื™ืŸ, a regular Jewish woman, and he could marry her completely, so when he said, "I'm only marrying half of you," he left out half of the ืงื ื™ื™ืŸ. And that you cannot do, and therefore the ื“ื™ืŸ is that she is not ืžืงื•ื“ืฉืช. But ื•ื”ื, but in this case, ืขื‘ื“ ืœื ืฉื™ื™ืจ ื‘ืงื ื™ื™ื ื™ื”, here he didn't leave anything of the ืงื ื™ื™ืŸ. As much as he was able to give into ืงื™ื“ื•ืฉื™ืŸ, he gave. Since he is only half ื‘ืŸ ื—ื•ืจื™ืŸ, so that half, that complete half of him being a ื‘ืŸ ื—ื•ืจื™ืŸ, he was ืžืงื“ืฉ to her. So maybe in a case like that, the ืงื™ื“ื•ืฉื™ืŸ should be ื—ืœ. When is the ืงื™ื“ื•ืฉื™ืŸ not ื—ืœ? When you could give the ืงื™ื“ื•ืฉื™ืŸ to the complete woman and you don't. But when you're not able to give anymore, so then maybe the ืงื™ื“ื•ืฉื™ืŸ is ื—ืœ. ืžืื™, what is the ื“ื™ืŸ? The ื’ืžืจื says, "ืชื ืฉืžืข, come hear, I'll try to answer your question. We learn in the ื‘ืจื™ื™ืชื, same ื‘ืจื™ื™ืชื that we mentioned in the ื“ืฃ before, ื”ืžื™ืช ืžื™ ืฉื—ืฆื™ื• ืขื‘ื“ ื•ื—ืฆื™ื• ื‘ืŸ ื—ื•ืจื™ืŸ, that if an ox gored and killed the one that was half ืขื‘ื“ and half ื‘ืŸ ื—ื•ืจื™ืŸ, ื ื•ืชืŸ ื—ืฆื™ ืงื ืก ืœืจื‘ื• ื•ื—ืฆื™ ื›ื•ืคืจ ืœื™ื•ืจืฉื™ื•. The ื“ื™ืŸ as we mentioned before is that if a ืฉื•ืจ kills an ืขื‘ื“, you pay ืงื ืก, the 30 ืฉืงืœื™ื. If a ืฉื•ืจ kills a ื‘ืŸ ื—ื•ืจื™ืŸ, then you don't pay ืงื ืก, you pay ื›ื•ืคืจ. ื›ื•ืคืจ is money that this person that died was worth, the value of the person. So here, since he was half ืขื‘ื“ and half ื‘ืŸ ื—ื•ืจื™ืŸ, so the owner of the ืฉื•ืจ has to pay half ืงื ืก and half ื›ื•ืคืจ. And that's what the ื‘ืจื™ื™ืชื says: He pays half ืงื ืก and gives it to his master, and then he pays half ื›ื•ืคืจ, half of his value, and gives it to the ื™ื•ืจืฉื™ื, to the heirs of this ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ. Now the ื’ืžืจื asks, ื•ืื™ ืืžืจืช ืงื™ื“ื•ืฉื™ื• ืœืื• ืงื™ื“ื•ืฉื™ืŸ, if you're going to tell me that when a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ gives ืงื™ื“ื•ืฉื™ืŸ, the ืงื™ื“ื•ืฉื™ืŸ don't take effect, ื™ื•ืจืฉื™ื ืžื ื ืœื™ื”, how does he have heirs? How does he have ื™ื•ืจืฉื™ื? And since the ื‘ืจื™ื™ืชื says you would have to pay half of the ื›ื•ืคืจ to his ื™ื•ืจืฉื™ื, obviously he was able to be married and to have children to have ื™ื•ืจืฉื™ื. So we have an answer to the question that a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ that was ืžืงื“ืฉ a Jewish woman, the ืงื™ื“ื•ืฉื™ืŸ is ืงื™ื“ื•ืฉื™ืŸ.

Rav Adaโ€™s objection and Rav Aโ€™s two answers

ืืžืจ ืจื‘ ืื“ื ื‘ืจ ืื”ื‘ื”, ืจื‘ ืื“ื ื‘ืจ ืื”ื‘ื” said, "No, there's no proof from there. It could be ื›ืฉืขืฉืื• ื˜ืจื™ืคื”, that the case is where the ืฉื•ืจ didn't actually kill this ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ, he just made him into a ื˜ืจื™ืคื”. He hurt him so that he's going to die eventually, and that's why you have to pay. But when it says that you have to pay half of a ื›ื•ืคืจ to the ื™ื•ืจืฉื™ื, ื•ืžืื™ ื™ื•ืจืฉื™ื•? What does it mean if you give to his heirs? It means ื ืคืฉื™ื”, it means himself. It doesn't mean to his heirs, it means you give it to him, because he didn't die yet, and on the other hand you have to pay the money, so you pay half of the ื›ื•ืคืจ to him. But it doesn't mean that he has ื™ื•ืจืฉื™ื, and therefore we have no ืจืื™ื” that the ืงื™ื“ื•ืฉื™ืŸ of a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ is ืงื™ื“ื•ืฉื™ืŸ." ืืžืจ ืจื‘ื, so ืจื‘ื said, "ืฉืชื™ ืชืฉื•ื‘ื•ืช ื‘ื“ื‘ืจ, I have two answers on this, two objections to your ืคืฉื˜. ื—ื“ื, one, ื“ื™ื•ืจืฉื™ื• ืงืชื ื™, it says clearly in the ื‘ืจื™ื™ืชื that you give the ื›ื•ืคืจ to the ื™ื•ืจืฉื™ื, and you're telling me that the ื‘ืจื™ื™ืชื means he gives the ื›ื•ืคืจ to

When is the oxโ€‘ownerโ€™s k'far actually payable?

himself. ื•ืขื•ื“, another reason why you can't say your ืคืฉื˜, ื›ื•ืคืจ ื”ื•ื, since this is ื›ื•ืคืจ, we're dealing here with the ื›ื•ืคืจ that a person has to pay if his ox killed a person, ื•ืืžืจ ืจื™ืฉ ืœืงื™ืฉ, ืจื™ืฉ ืœืงื™ืฉ had said, ื›ื•ืคืจ ืื™ื ื• ืžืฉืชืœื ืืœื ืœืื—ืจ ืžื™ืชื”, that ื›ื•ืคืจ isn't paid until after the person dies. In other words, according to ืจื™ืฉ ืœืงื™ืฉ, if a ืฉื•ืจ gores a person, and the person becomes ื˜ืจื™ืคื” that will eventually die, but he didn't die yet, there is still no obligation of paying ื›ื•ืคืจ. After the person will die, that's when the owner of the ืฉื•ืจ has to pay ื›ื•ืคืจ. So in this case, when you said that whom does he pay? To himself. And the reason is because he made him into a ื˜ืจื™ืคื”, if he made him into a ื˜ืจื™ืคื”, there is no ื›ื•ืคืจ to begin with. But now we're back to the question. So what does the ื‘ืจื™ื™ืชื mean that you have to pay half of the ื›ื•ืคืจ to his ื™ื•ืจืฉื™ื if it is a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ, and he actually died, how does he have ื™ื•ืจืฉื™ื? So

Halfโ€‘slave, halfโ€‘free: validity of kiddushin

again, we're back to the proof that if a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ gives ืงื™ื“ื•ืฉื™ืŸ to a woman, the ืงื™ื“ื•ืฉื™ืŸ is ืงื™ื“ื•ืฉื™ืŸ." ืืœื ืืžืจ ืจื‘ื, so ืจื‘ื said, "No, there is no proof from that ื‘ืจื™ื™ืชื. ืื™ื™, what did the ื‘ืจื™ื™ืชื mean that you give ื›ื•ืคืจ to the ื™ื•ืจืฉื™ื? It means ืจืื•ื™ ืœื™ื˜ื•ืœ ื•ืื™ืŸ ืœื•. It was fit for him to take the ื›ื•ืคืจ, but he doesn't have. Since he died, and he is a half a ื‘ืŸ ื—ื•ืจื™ืŸ, really there is an obligation of payment of ื›ื•ืคืจ here, and who should it really go? To his ื™ื•ืจืฉื™ื. But since he has no ื™ื•ืจืฉื™ื, so there is no ื›ื•ืคืจ. So the owner of the ox who has to give the ื›ื•ืคืจ, but has nobody to give it to, doesn't have to give it. He holds onto it and keeps it. So when the ื‘ืจื™ื™ืชื said that you pay half of the ื›ื•ืคืจ to the ื™ื•ืจืฉื™ื, it doesn't mean actually that you have to give it to the ื™ื•ืจืฉื™ื, he has no ื™ื•ืจืฉื™ื. What it means is, it would be fit to give to his ื™ื•ืจืฉื™ื if he would have had ื™ื•ืจืฉื™ื, but since he doesn't have, you don't give any ื›ื•ืคืจ." Then the ื’ืžืจื continues, ืืžืจ ืจื‘ื, ืจื‘ื said, ื›ืฉื ืฉื”ืžืงื“ืฉ ื—ืฆื™ ืืฉื” ืื™ื ื” ืžืงื•ื“ืฉืช, just like if someone gives ืงื™ื“ื•ืฉื™ืŸ to half of a woman, he says to her, "Half of you should be ืžืงื•ื“ืฉ to me," she is not ืžืงื•ื“ืฉ, ื›ืš ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ ืฉื ืชืงื“ืฉื”, if a woman who was half slave and half ื‘ืช ื—ื•ืจื™ืŸ, half free, and she got ืงื™ื“ื•ืฉื™ืŸ from a regular Jewish man, ืื™ืŸ ืงื™ื“ื•ืฉื™ื” ืงื™ื“ื•ืฉื™ืŸ, her ืงื™ื“ื•ืฉื™ืŸ are not ืงื™ื“ื•ืฉื™ืŸ, because really this is the same case, because she is getting ืงื™ื“ื•ืฉื™ืŸ for half of herself, and we said the ื“ื™ืŸ that if you give ืงื™ื“ื•ืฉื™ืŸ to half of a woman, the ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ. So here too, since she is only half free, so the ืงื™ื“ื•ืฉื™ืŸ would only be to half of her, so the ืงื™ื“ื•ืฉื™ืŸ are not ืงื™ื“ื•ืฉื™ืŸ. ื“ืจืฉ ืจื‘ื” ื‘ืจ ืจื‘ ื”ื•ื ื, ืจื‘ื” ื‘ืจ ืจื‘ ื”ื•ื ื ื“ืจืฉื 'ื“, and he said the same thing, that ื›ืฉื ืฉื”ืžืงื“ืฉ ื—ืฆื™ ืืฉื” ืื™ื ื” ืžืงื•ื“ืฉืช, just like if you give ืงื™ื“ื•ืฉื™ืŸ to half of a woman, she is not ืžืงื•ื“ืฉ, ื›ืš ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ ืฉื ืชืงื“ืฉื” ืื™ื ื” ืžืงื•ื“ืฉืช, the same, if a half ืฉืคื—ื” half ื‘ืช ื—ื•ืจื™ืŸ got ืงื™ื“ื•ืฉื™ืŸ, she is not ืžืงื•ื“ืฉืช. ืืžืจ ืœื™ื” ืจื‘ ื—ืกื“ื, ืจื‘ ื—ืกื“ื said to him, ืžื™ ื“ืžื™? How could you compare the two? ื”ืชื ืฉื™ื™ืจ ื‘ืงื ื™ื™ื ื•. In the case of a regular Jewish woman who got ืงื™ื“ื•ืฉื™ืŸ only for half of her, he left over part of the ืงื ื™ืŸ. Since he was able to be ืžืงื“ืฉ her completely, and he only was ืžืงื“ืฉ half of her, so he left half of the ืงื ื™ืŸ that he should have been ืžืงื“ืฉ, and therefore the ืงื™ื“ื•ืฉื™ืŸ is not ื—ืœ. But ื”ื›ื in this case, in the case of half ืฉืคื—ื” half ื‘ืช ื—ื•ืจื™ืŸ, ืœื ืฉื™ื™ืจ ื‘ืงื ื™ื™ื ื•, he didn't leave anything over. He was ืžืงื“ืฉ of her as much as as possible, because she is only half ื‘ืช ื—ื•ืจื™ืŸ, so only half of her could be ืžืงื•ื“ืฉ, and that half he was ืžืงื“ืฉ. So maybe in this case, the ืงื™ื“ื•ืฉื™ืŸ should be ื—ืœ, since he didn't leave over anything. ื’ืžืจื continues, ื”ื“ืจ ืื•ืงื™ื ืจื‘ื” ื‘ืจ ืจื‘ ื”ื•ื ื ืืžื•ืจื ืขืœื™ื”.

Setting up a translator and the โ€˜stumbling blockโ€™ verse

Later on, when ืจื‘ื” ื‘ืจ ืจื‘ ื”ื•ื ื set up an ืืžื•ืจื, set up a ืžืชื•ืจื’ืžืŸ. In those times when the ื—ื›ืžื™ื used to speak in public, they used to have a ืžืชื•ืจื’ืžืŸ, a person who would repeat what they said in public. So ืจื‘ื” ื‘ืจ ืจื‘ ื”ื•ื ื set up a ืžืชื•ืจื’ืžืŸ, ื•ื“ืจืฉ, and he told him to ื“ืจืฉืŸ, to start his ื“ืจืฉื” with this ืคืกื•ืง: ื•ื”ืžื›ืฉืœื” ื”ื–ืืช ืชื—ืช ื™ื“ืš. This stumbling block is under your hand. And as ืจืฉ''ื™ explains at length, this ืคืกื•ืง refers to the ืชื•ืจื”. So he told him to ื“ืจืฉืŸ that why does the ืคืกื•ืง refer to the ืชื•ืจื” with the term ืžื›ืฉืœื”, a stumbling block? To teach us that ืื™ืŸ ืื“ื ืขื•ืžื“ ืขืœ ื“ื‘ืจื™ ืชื•ืจื”, a person does not stand on the words of ืชื•ืจื”, which means a person cannot be clear in the words of ืชื•ืจื”, ืืœื ืื ื›ืŸ ื ื›ืฉืœ ื‘ื”ืŸ, unless he first stumbled over them. First he made a mistake. After you make a mistake, and then you want to know the truth, the real ืคืฉื˜, so later on, you will have the ื“ื™ืŸ clear. And he meant to say that he too made a mistake in a ื“ื™ืŸ that he said before: that ืืฃ ืขืœ ืคื™ ืฉืืžืจื• ื”ืžืงื“ืฉ ื—ืฆื™ ืืฉื” ืื™ื ื” ืžืงื•ื“ืฉืช, that even though the ื“ื™ืŸ is that if you give ืงื™ื“ื•ืฉื™ืŸ to half of a woman, she is not ืžืงื•ื“ืฉืช, ืื‘ืœ ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ ืฉื ืชืงื“ืฉื”, but if half ืฉืคื—ื”, half ื‘ืช ื—ื•ืจื™ืŸ got ืงื™ื“ื•ืฉื™ืŸ, ืงื™ื“ื•ืฉื™ื” ืงื™ื“ื•ืฉื™ืŸ, the ืงื™ื“ื•ืฉื™ืŸ are ืงื™ื“ื•ืฉื™ืŸ. And this is what he meant to say: before he had said that also by a ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ, the ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ, because he compared it to the case of a person giving ืงื™ื“ื•ืฉื™ืŸ to half a woman. So after he realized this mistake, he said that even though by the case of giving ืงื™ื“ื•ืฉื™ืŸ to half a woman, she is not ืžืงื•ื“ืฉืช, but by ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ she is ืžืงื•ื“ืฉืช. ืžืื™ ื˜ืขืžื, what is the reason? ื”ืชื ืฉื™ื™ืจ ื‘ืงื ื™ื™ื ื™ื”, over there he left over part of the ืงื ื™ืŸ. Since he could have been ืžืงื“ืฉ her completely, and he wasn't, the ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ. ื”ื›ื, but in the case of ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ, ืœื ืฉื™ื™ืจ ื‘ืงื ื™ื™ื ื™ื”, he didn't leave over anything in the ืงื ื™ืŸ, because there wasn't anything more he could have been ืžืงื“ืฉ, and therefore the ืงื™ื“ื•ืฉื™ืŸ is ืงื™ื“ื•ืฉื™ืŸ. ืืžืจ ืจื‘ ืฉืฉืช, ืจื‘ ืฉืฉืช said, ื›ืฉื ืฉื”ืžืงื“ืฉ ื—ืฆื™ ืืฉื” ืื™ื ื” ืžืงื•ื“ืฉืช, just like if you ืžืงื“ืฉ half a woman she is not ืžืงื•ื“ืฉืช, ื›ืš ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ ืฉื ืชืงื“ืฉื” ืื™ืŸ ืงื™ื“ื•ืฉื™ื” ืงื™ื“ื•ืฉื™ืŸ. The same if a half ืฉืคื—ื”, half ื‘ืช ื—ื•ืจื™ืŸ received ืงื™ื“ื•ืฉื™ืŸ, her ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ. In other words, he argues on what the ื’ืžืจื said before. And then he continued saying: ื•ืื ืœื—ืฉืš ืื“ื ืœื•ืžืจ, if someone will whisper into your ear to say, to ask a ืงืฉื™ื on my ื“ื™ืŸ, and will say: ืื™ื–ื• ื”ื™ื ืฉืคื—ื” ื—ืจื•ืคื”? We know, what is a ืฉืคื—ื” ื—ืจื•ืคื”? The ื“ื™ืŸ in the ื—ื•ืžืฉ that if there was a ืฉืคื—ื” ื—ืจื•ืคื”, and somebody had relations with her, the ื“ื™ืŸ is that that person has to bring a ืงืจื‘ืŸ ืืฉื. So it says, what is a ืฉืคื—ื” ื—ืจื•ืคื”? ื–ื• ืฉื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ ื”ืžืื•ืจืกื” ืœืขื‘ื“ ืขื‘ืจื™, a half ืฉืคื—ื”, half ื‘ืช ื—ื•ืจื™ืŸ who was ืžืงื•ื“ืฉ to an ืขื‘ื“ ืขื‘ืจื™. The reason we mention ืขื‘ื“ ืขื‘ืจื™ here is because he is allowed to marry a ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ. Since the ื“ื™ืŸ is that an ืขื‘ื“ ืขื‘ืจื™, a Jewish slave that sold himself to another ื™ื™ื“ for six years, so if he has his own wife and children, his master is allowed to give him a ืฉืคื—ื”, and he is allowed to live with that ืฉืคื—ื”. So the ื“ื™ืŸ of a ืฉืคื—ื” ื—ืจื•ืคื” is if she got ืงื™ื“ื•ืฉื™ืŸ from an ืขื‘ื“ ืขื‘ืจื™, and there was no ืขื‘ื™ืจื” involved, because he could live with her ืžืžื” ื ืคืฉืš. The half of her being free, so since he is Jewish, that half of her is also Jewish, there is no problem. The half of her being a ืฉืคื—ื” is also no problem, since he is an ืขื‘ื“ ืขื‘ืจื™, he is allowed to marry a ืฉืคื—ื”. So if an ืขื‘ื“ ืขื‘ืจื™ gave ืงื™ื“ื•ืฉื™ืŸ to a ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ, she is called a ืฉืคื—ื” ื—ืจื•ืคื”. And that's where the whole ืคืกื•ืง goes on saying that you have to bring a ืงืจื‘ืŸ ืืฉื if anybody had relations with her. But anyway, ืืœืžื, we see from here, ื‘ืช ืื™ืจื•ืกื™ ื”ื™ื, that she is able to receive ืงื™ื“ื•ืฉื™ืŸ. Because we say that she got ืงื™ื“ื•ืฉื™ืŸ from that ืขื‘ื“ ืขื‘ืจื™. So you could ask the question, he said, but how could I say that a ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ cannot receive ืงื™ื“ื•ืฉื™ืŸ, the ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ, here we see that the ืงื™ื“ื•ืฉื™ืŸ is ืงื™ื“ื•ืฉื™ืŸ. So if someone will ask you that question, ืืžื•ืจ ืœื•, tell him, ืงืœื— ืืฆืœ ืจื‘ื™ ื™ืฉืžืขืืœ. Go to ืจื‘ื™ ื™ืฉืžืขืืœ. ืฉื”ื•ื ืื•ืžืจ, ืจื‘ื™ ื™ืฉืžืขืืœ says, ื‘ืฉืคื—ื” ื›ื ืขื ื™ืช ื”ืžืื•ืจืกืช ืœืขื‘ื“ ืขื‘ืจื™. He argues on that what we said before, that a ืฉืคื—ื” ื—ืจื•ืคื” is a ื—ืฆื™ ืฉืคื—ื” ื•ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ. He holds that a ืฉืคื—ื” ื—ืจื•ืคื” is a regular ืฉืคื—ื” ื›ื ืขื ื™ืช, a regular ื’ื•ื™ื™ืฉืข female slave. And the case of a ืฉืคื—ื” ื—ืจื•ืคื” in the ืชื•ืจื” is if she had ืงื™ื“ื•ืฉื™ืŸ from an ืขื‘ื“ ืขื‘ืจื™, and then someone had relations with her, then we have the ื“ื™ืŸ of a ืฉืคื—ื” ื—ืจื•ืคื”. So according to ืจื‘ื™ ื™ืฉืžืขืืœ you could definitely ask a ืงืฉื™ื: ื•ืฉืคื—ื” ื›ื ืขื ื™ืช ื‘ืช ืื™ืจื•ืกื™ ื”ื™ื? Is a ืฉืคื—ื” ื›ื ืขื ื™ืช That was ืžืื•ืจืกืช, that was ืžืงื•ื“ืฉ to an ืขื‘ื“ ืขื‘ืจื™, it means ืžื™ื•ื—ื“ืช. It doesn't mean she actually received ืงื™ื“ื•ืฉื™ืŸ because she can't receive ืงื™ื“ื•ืฉื™ืŸ. It means that she was ืžื™ื•ื—ื“ืช. She was set aside specifically for this ืขื‘ื“ ืขื‘ืจื™. So if so, ื”ื›ื ื ืžื™, here too, when we say that a ืฉืคื—ื” ื—ืจื•ืคื” means a ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ, ืžืื™ ืžืื•ืจืกืช? What did we mean when we said that she was ืžืื•ืจืกืช, ืžืงื•ื“ืฉืช to an ืขื‘ื“ ืขื‘ืจื™? It means ืžื™ื•ื—ื“ืช, not that she actually received ืงื™ื“ื•ืฉื™ืŸ, but she was ืžื™ื•ื—ื“ืช to him. So really the ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ, but since she was set aside for this ืขื‘ื“ ืขื‘ืจื™, that's what the ืชื•ืจื” says that if anybody has relations with her, so then he has to bring an ืืฉื. Then the ื’ืžืจื continues, ืืžืจ ืจื‘ ื—ืกื“ื, ืจื‘ ื—ืกื“ื said, ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ ืฉื ืชืงื“ืฉื” ืœืจืื•ื‘ืŸ, she received ืงื™ื“ื•ืฉื™ืŸ from ืจืื•ื‘ืŸ, ื•ื ืฉืชื—ืจืจื”, and then she was freed, ื•ื—ื–ืจื” ื•ื ืชืงื“ืฉื” ืœืฉืžืขื•ืŸ, then after she was freed she received ืงื™ื“ื•ืฉื™ืŸ from ืจืื•ื‘ืŸ's brother, from ืฉืžืขื•ืŸ, ื•ืžืชื• ืฉื ื™ื”ื, and they both died, the two brothers died, ืžืชื™ื‘ืžืช ืœืœื•ื™, she's able to get ื™ื‘ื•ื from ืœื•ื™. Because the ื“ื™ืŸ is that when a person dies without children, his wife is supposed to get ื™ื‘ื•ื, get married to the husband's brother. If he doesn't want, then he could give her ื—ืœื™ืฆื”. Now there is another ื“ื™ืŸ, that if she is considered a ื™ื‘ืžื” from two brothers, then the third brother does not give her ื™ื‘ื•ื. For instance, if her husband died, and a brother, instead of being ืžื™ื‘ื her, gave her ืžืืžืจ. ืžืืžืจ means this type of ืงื™ื“ื•ืฉื™ืŸ. He said to her, "I will be ืžืงื“ืฉ you, and I will eventually marry you." That ืžืืžืจ is not really marriage, because by the ื“ื™ืŸ of ื™ื‘ื•ื it is not like by a regular woman that when you give her ืงื™ื“ื•ืฉื™ืŸ, that itself turns her into an ืืฉืช ืื™ืฉ, she is already married to this man. By ื™ื‘ื•ื, the only way she becomes an ืืฉืช ืื™ืฉ married to her ื™ื‘ื is actually after the ื—ืชื•ื ื”, after they come home, and after they are together. But just for ืžืืžืจ, which is a type of ืงื™ื“ื•ืฉื™ืŸ, she is not still considered his ื™ื‘ืžื”. So let's say the brother died, and another brother gave her ืžืืžืจ, and then the other brother died. So now she is considered a ื™ื‘ืžื” to the third brother from two brothers. The third brother has to be ืžื™ื‘ื her because of the first brother that died, and also because she was already somehow connected to the second brother, and he also died, so she is a ื™ื‘ืžื” from two brothers for the third brother. The ื“ื™ืŸ is that in a case like that you cannot be ืžื™ื‘ื, because we learn out from a ืคืกื•ืง, the ืคืกื•ืง says, ื•ืžืช ืื—ื“ ืžื”ื, ืชื•ืจื” says if two brothers lived together and one of them died, then the second one should marry the wife of the first brother. So we ื“ืจืฉืŸ from there that ืžื™ ืฉืขืœื™ื” ื–ื™ืงืช ื™ื‘ื ืื—ื“, that you only are ืžื™ื‘ื a woman who has a ื–ื™ืงื”, a connection, from one ื™ื‘ื, one brother, but not a woman who has a connection, a ื™ื‘ื•ื, from two brothers. In the case of our ื’ืžืจื here, where she was originally a ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ, she got ืงื™ื“ื•ืฉื™ืŸ from one brother, and then she was freed and got ืงื™ื“ื•ืฉื™ืŸ from another brother, and then both of them died. So the ื’ืžืจื says here that ืœื•ื™, the third brother, could be ืžื™ื‘ื her. ื•ืื™ืŸ ืื ื™ ืงื•ืจื ื‘ื”, and I do not call her, I do not apply to her this ื“ื™ืŸ of ืืฉืช ืฉื ื™ ืžืชื™ื, that she is the wife of two dead brothers, where the ื“ื™ืŸ is that you cannot be ืžื™ื‘ื. Why not? You would think that she would be considered the wife of two brothers, because now she was the wife of ืจืื•ื‘ืŸ, then she became the wife of ืฉืžืขื•ืŸ, so she is now the wife of two dead brothers. So he says no, because ืžืžื” ื ืคืฉืš: ืื™ ืงื™ื“ื•ืฉื™ ื“ืจืื•ื‘ืŸ ืงื™ื“ื•ืฉื™ืŸ, if the ืงื™ื“ื•ืฉื™ืŸ that the first brother, ืจืื•ื‘ืŸ, gave her were ืงื™ื“ื•ืฉื™ืŸ, ืงื™ื“ื•ืฉื™ ื“ืฉืžืขื•ืŸ ืœืื• ืงื™ื“ื•ืฉื™ืŸ, so the ืงื™ื“ื•ืฉื™ืŸ of ืฉืžืขื•ืŸ are not ืงื™ื“ื•ืฉื™ืŸ, because if you give ืงื™ื“ื•ืฉื™ืŸ to a married woman, that ืงื™ื“ื•ืฉื™ืŸ is not ืงื™ื“ื•ืฉื™ืŸ at all. So here too, if the ืงื™ื“ื•ืฉื™ืŸ of ืจืื•ื‘ืŸ were ืงื™ื“ื•ืฉื™ืŸ, so then when ืฉืžืขื•ืŸ gave her ืงื™ื“ื•ืฉื™ืŸ, those ืงื™ื“ื•ืฉื™ืŸ were not ืงื™ื“ื•ืฉื™ืŸ at all, so she was not married to ืฉืžืขื•ืŸ at all. ื•ืื™ ืงื™ื“ื•ืฉื™ ื“ืฉืžืขื•ืŸ ืงื™ื“ื•ืฉื™ืŸ, and if we're going to say that the real ืงื™ื“ื•ืฉื™ืŸ were the ืงื™ื“ื•ืฉื™ืŸ of ืฉืžืขื•ืŸ, ืงื™ื“ื•ืฉื™ ื“ืจืื•ื‘ืŸ ืœืื• ืงื™ื“ื•ืฉื™ืŸ, so the ืงื™ื“ื•ืฉื™ืŸ of ืจืื•ื‘ืŸ were not ืงื™ื“ื•ืฉื™ืŸ, so she was never married to ืจืื•ื‘ืŸ. So ืžืžื” ื ืคืฉืš, she is the wife of ืœื•ื™'s brother, and only of one of the brothers. And as ืจืฉ"ื™ explains, ืจื‘ ื—ืกื“ื had a ืกืคืง whether the ื”ืœื›ื” is that a ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ can receive ืงื™ื“ื•ืฉื™ืŸ or cannot. Since in the ื’ืžืจื before we had a ืžื—ืœื•ืงืช, ืจื‘ ื—ืกื“ื didn't know what the ื”ืœื›ื” was. And that's what he said: is the ื”ืœื›ื” that a ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ can get ืงื™ื“ื•ืฉื™ืŸ, so then the ืงื™ื“ื•ืฉื™ืŸ that ืจืื•ื‘ืŸ gave her while she was still a ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ were ืงื™ื“ื•ืฉื™ืŸ, so then automatically ืฉืžืขื•ืŸ's ืงื™ื“ื•ืฉื™ืŸ are not ืงื™ื“ื•ืฉื™ืŸ. If the ื”ืœื›ื” is that a ื—ืฆื™ ืฉืคื—ื” ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ cannot get ืงื™ื“ื•ืฉื™ืŸ, so then ืจืื•ื‘ืŸ's ืงื™ื“ื•ืฉื™ืŸ were not ืงื™ื“ื•ืฉื™ืŸ at all, because he gave her the ืงื™ื“ื•ืฉื™ืŸ while she was still a ื—ืฆื™ ืฉืคื—ื” ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ. So then ืฉืžืขื•ืŸ's ืงื™ื“ื•ืฉื™ืŸ are ืงื™ื“ื•ืฉื™ืŸ, so she is the wife of ืฉืžืขื•ืŸ, but she's not the wife of ืจืื•ื‘ืŸ at all, and therefore she could get ื™ื‘ื•ื ืžืžื” ื ืคืฉืš. Then the ื’ืžืจื continues, ืื™ืชืžืจ we learned, ื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ ืฉื ืชืงื“ืฉื” ืœืจืื•ื‘ืŸ, she received ืงื™ื“ื•ืฉื™ืŸ from ืจืื•ื‘ืŸ, ื•ื ืฉืชื—ืจืจื”, and then she became free, ื•ื—ื–ืจื” ื•ื ืชืงื“ืฉื” ืœืฉืžืขื•ืŸ, then she got ืงื™ื“ื•ืฉื™ืŸ from ืฉืžืขื•ืŸ, from another person, not the brother of ืจืื•ื‘ืŸ, but from another person. ืจื‘ ื™ื•ืกืฃ ื‘ืจ ื—ืžื ืืžืจ ืจื‘ ื ื—ืžืŸ, ืจื‘ ื™ื•ืกืฃ ื‘ืจ ื—ืžื said in the name of ืจื‘ ื ื—ืžืŸ, ืคืงืขื• ืงื™ื“ื•ืฉื™ ืจืืฉื•ืŸ. The ืงื™ื“ื•ืฉื™ืŸ of the first are dropped, since she became free after she received the ืงื™ื“ื•ืฉื™ืŸ, so it's like a newborn child. When an ืขื‘ื“ is ื ืฉืชื—ืจืจ, becomes free, he becomes like a new person. So the ืงื™ื“ื•ืฉื™ืŸ that ืจืื•ื‘ืŸ gave her while she was still a little bit a ืฉืคื—ื”, so those ืงื™ื“ื•ืฉื™ืŸ are not ืงื™ื“ื•ืฉื™ืŸ anymore because now she's a new person. ืจื‘ ื–ื™ืจื ืืžืจ ืจื‘ ื ื—ืžืŸ, but ืจื‘ ื–ื™ืจื says in the name of ืจื‘ ื ื—ืžืŸ, ื’ืžืจื• ืงื™ื“ื•ืฉื™ ืจืืฉื•ืŸ, just the opposite. The ืงื™ื“ื•ืฉื™ืŸ of the first are finished. When he gave her ืงื™ื“ื•ืฉื™ืŸ, it only applied to half of her, because she was only half free. Now that she was free completely, so the ืงื™ื“ื•ืฉื™ืŸ are automatically extended to the whole person, and they are finished. Now she is completely an ืืฉืช ืื™ืฉ, she's 100% married. ืืžืจ ืจื‘ ื–ื™ืจื, and ืจื‘ ื–ื™ืจื said, ื›ื•ื•ืชื™ ื“ื™ื“ื™ ืžืกืชื‘ืจื. It sounds logical like I say, because I have a ืจืื™ื” from the ืคืกื•ืง. ื“ื›ืชื™ื‘, the ืชื•ืจื” says in the case of the ืฉืคื—ื” ื—ืจื•ืคื”, ืœื ื™ื•ืžืชื• ื›ื™ ืœื ื—ื•ืคืฉื”, that if someone had relations with this ืฉืคื—ื” ื—ืจื•ืคื”, he should not die, he only has to bring a ืงืจื‘ืŸ ืืฉื. And the ืชื•ืจื” says, why shouldn't they die? Because she really wasn't free. So what do we see from there? ื”ื ื—ื•ืคืฉื”, if she would have been freed, ื™ื•ืžืชื• they would die. And the way he learned the ืคืฉื˜ in the ืคืกื•ืง, that if she would have been freed later on and then someone would have relations with her, that person would die. So he learns out from here that this ืฉืคื—ื” ื—ืจื•ืคื”, who was a half ืฉืคื—ื” half ื‘ืช ื—ื•ืจื™ืŸ that received ืงื™ื“ื•ืฉื™ืŸ from the ืขื‘ื“ ืขื‘ืจื™, and the ืชื•ืจื” says if she would have been freed afterwards, and then someone would have relations with her, that person would die. So we see clearly that a ื—ืฆื™ ืฉืคื—ื” ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ that had ืงื™ื“ื•ืฉื™ืŸ, after she becomes free, the ืงื™ื“ื•ืฉื™ืŸ automatically are stretched and extended that she becomes completely ืงื™ื“ื•ืฉื™ืŸ, and then she's a regular ืืฉืช ืื™ืฉ, and if someone would live with her, he would get killed. So there's a ืจืื™ื” that the ื“ื™ืŸ is that ื’ืžืจื• ืงื™ื“ื•ืฉื™ ืจืืฉื•ืŸ, that the first ืงื™ื“ื•ืฉื™ืŸ are extended and finished. ืืžืจ ืœื™ื” ืื‘ื™ื™, ืื‘ื™ื™ said to him, ื•ืœืชื ื ื“ื‘ื™ ืจื‘ื™ ื™ืฉืžืขืืœ ื“ืืžืจ ื‘ืฉืคื—ื” ื›ื ืขื ื™ืช ื”ืžืื•ืจืกืช ืœืขื‘ื“ ืขื‘ืจื™, and according to ืชื ื ื“ื‘ื™ ืจื‘ื™ ื™ืฉืžืขืืœ who holds that a ืฉืคื—ื” ื—ืจื•ืคื” is not a ื—ืฆื™ ืฉืคื—ื” ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ that was ืžืงื•ื“ืฉืช to an ืขื‘ื“ ืขื‘ืจื™, but it is a regular ืฉืคื—ื” ื›ื ืขื ื™ืช that was ืžืงื•ื“ืฉืช to an ืขื‘ื“ ืขื‘ืจื™, ื”ื›ื ื ืžื™ will you also tell me ื“ื”ื ื—ื•ืคืฉื” ื™ื•ืžืชื•, that the ืชื•ืจื” is telling us that if she was freed afterwards and someone has relations with her, that person would die? According to your ืคืฉื˜, he is saying, that when the ืชื•ืจื” says ื›ื™ ืœื ื—ื•ืคืฉื”, that the reason that they don't die is because she was not free, and you're learning the ืคืฉื˜ that it means that when, as soon as she is freed, even without new ืงื™ื“ื•ืฉื™ืŸ, the old ืงื™ื“ื•ืฉื™ืŸ is extended, so according to ืจื‘ื™ ื™ืฉืžืขืืœ we'll have to learn the ืคืฉื˜ that if she was a ืฉืคื—ื” ื›ื ืขื ื™ืช and had ืงื™ื“ื•ืฉื™ืŸ from an ืขื‘ื“ ืขื‘ืจื™, and later she was freed, automatically she becomes an ืืฉืช ืื™ืฉ? That is impossible, because that is for sure that the ืงื™ื“ื•ืฉื™ืŸ given to a ืฉืคื—ื” ื›ื ืขื ื™ืช is not ืงื™ื“ื•ืฉื™ืŸ at all. No one would ever think that ืงื™ื“ื•ืฉื™ืŸ that was given to a ืฉืคื—ื” ื›ื ืขื ื™ืช, after she is freed automatically becomes regular ืงื™ื“ื•ืฉื™ืŸ. ืืœื ืžืื™ ืื™ืช ืœืš ืœืžื™ืžืจ, so what will you say according to ืจื‘ื™ ื™ืฉืžืขืืœ, that the ืคืฉื˜ in the ืชื•ืจื” is ืฉื—ื•ืคืฉื” ื•ื—ื–ืจื” ื•ื ืชืงื“ืฉื”? When the ืชื•ืจื” says that they don't die because she wasn't freed, it means that if she would have been freed and then received ืงื™ื“ื•ืฉื™ืŸ, then she would have been considered a regular ืืฉืช ืื™ืฉ. And the same is with a ืฉืคื—ื” ื›ื ืขื ื™ืช, that if the ืฉืคื—ื” ื›ื ืขื ื™ืช, according to ืจื‘ื™ ื™ืฉืžืขืืœ, would have been freed and afterwards she would have received ืงื™ื“ื•ืฉื™ืŸ, then she would have been a regular ืืฉืช ืื™ืฉ, because a ืฉืคื—ื” ื›ื ืขื ื™ืช who is freed is a regular Jewish woman. So if she receives ืงื™ื“ื•ืฉื™ืŸ afterwards, then she's an ืืฉืช ืื™ืฉ, and anybody who would have relations with her would be ื—ื™ื™ื‘ ืžื™ืชื”. And the same would be here. ื”ื›ื ื ืžื™, also according to the ืคืฉื˜ that a ืฉืคื—ื” ื—ืจื•ืคื” is a ื—ืฆื™ ืฉืคื—ื” ื—ืฆื™ ื‘ืช ื—ื•ืจื™ืŸ, what does the ืชื•ืจื” mean? ืœื ื™ื•ืžืชื• ื›ื™ ืœื ื—ื•ืคืฉื”, ืฉื—ื•ืคืฉื” ื•ื—ื–ืจื” ื•ื ืชืงื“ืฉื”, that the ืชื•ืจื” is saying the reason they don't die, the reason she's not a regular ืืฉืช ืื™ืฉ because she wasn't freed, but if she would have been freed and then received ืงื™ื“ื•ืฉื™ืŸ, then there would be a ื—ื™ื•ื‘ ืžื™ืชื” because she would have been a regular ืืฉืช ืื™ืฉ. But we have no ืจืื™ื” from here that if the ืงื™ื“ื•ืฉื™ืŸ was given before she was freed 100%, And then she was freed, that automatically she becomes an ืืฉืช ืื™ืฉ. That we don't see from the ืชื•ืจื”. ืืžืจ ืจื‘ ื”ื•ื ื ื‘ืจ ืงื˜ื™ื ื ืืžืจ ืจื‘ ื™ืฆื—ืง, ืจื‘ ื”ื•ื ื ื‘ืจ ืงื˜ื™ื ื said in the name of ืจื‘ ื™ืฆื—ืง, ืžืขืฉื” ื‘ืืฉื” ืื—ืช, there was a story with this one woman, ืฉื—ืฆื™ื” ืฉืคื—ื” ื•ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ, that she was half ืฉืคื—ื” and half ื‘ืช ื—ื•ืจื™ืŸ, ื•ื›ืคื• ืืช ืจื‘ื” ื•ืขืฉืื” ื‘ืช ื—ื•ืจื™ืŸ, and they forced her master, and he made her into a ื‘ืช ื—ื•ืจื™ืŸ, he freed her. And the ื’ืžืจื says: ื›ืžืืŸ, according to which ืžืืŸ ื“ืืžืจ does this go? ื›ืจื‘ื™ ื™ื•ื—ื ืŸ ื‘ืŸ ื‘ืจื•ืงื”, it only could fit according to ืจื‘ื™ ื™ื•ื—ื ืŸ ื‘ืŸ ื‘ืจื•ืงื”. ื“ืืžืจ, he says: ืขืœ ืฉื ื™ื”ื ื”ื•ื ืื•ืžืจ, on both the ืชื•ืจื” says: ื•ื™ื‘ืจืš ืื•ืชื ืืœืงื™ื ื•ื™ืืžืจ ื•ื’ื•ืณ ืคืจื• ื•ืจื‘ื• ื•ืžืœืื• ื•ื’ื•ืณ, that you should multiply and be fruitful and fill up the world. Because like this we know that the ืžืฆื•ื” of ืคืจื™ื” ื•ืจื‘ื™ื”, the ืžืฆื•ื” of multiplying and having children, is only on the man. The woman is not obligated to fulfill this ืžืฆื•ื”. ืจื‘ื™ ื™ื•ื—ื ืŸ ื‘ืŸ ื‘ืจื•ืงื” holds that when the ืชื•ืจื” says that ื”ืฉื said to them ืคืจื• ื•ืจื‘ื•, you should multiply, He said it to both. So a woman is also obligated to fulfill the ืžืฆื•ื” of ืคืจื™ื” ื•ืจื‘ื™ื”. So according to ืจื‘ื™ ื™ื•ื—ื ืŸ ื‘ืŸ ื‘ืจื•ืงื”, just as we said in the ืžืฉื ื” that if a man is a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ, we force his master to free him because otherwise he cannot fulfill the ืžืฆื•ื” of ืคืจื™ื” ื•ืจื‘ื™ื”, because while he's half ืขื‘ื“, half ื‘ืŸ ื—ื•ืจื™ืŸ, he cannot marry not a ืฉืคื—ื” ื›ื ืขื ื™ืช and not a ื‘ืช ื—ื•ืจื™ืŸ, and in order to fulfill the ืžืฆื•ื” we must force his master to free him, so then he'll be able to marry a Jewish woman. So according to ืจื‘ื™ ื™ื•ื—ื ืŸ ื‘ืŸ ื‘ืจื•ืงื”, this also applies to a ื—ืฆื™ื” ืฉืคื—ื” ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ, because by her we have the same problem. Since according to him she is also obligated to fulfill the ืžืฆื•ื” of ืคืจื™ื” ื•ืจื‘ื™ื”, so and she also cannot marry not a Jewish man and not an ืขื‘ื“ because she is a ื—ืฆื™ื” ืฉืคื—ื” ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ. So therefore they forced her master and he freed her. So that's what the ื’ืžืจื says, that that story, that they forced the master of the ื—ืฆื™ื” ืฉืคื—ื” ื—ืฆื™ื” ื‘ืช ื—ื•ืจื™ืŸ to free her was because they held like ืจื‘ื™ ื™ื•ื—ื ืŸ ื‘ืŸ ื‘ืจื•ืงื”. And the ื’ืžืจื says: ืืžืจ ืจื‘ ื ื—ืžืŸ ื‘ืจ ื™ืฆื—ืง, ืจื‘ ื ื—ืžืŸ ื‘ืจ ื™ืฆื—ืง said: ืœื, no, ืžื ื”ื’ ื”ืคืงืจ ื ื”ื’ื• ื‘ื”, they acted

Freeing a Female Slave and the Mishnah Context

with her in a ืžื ื”ื’ of ื”ืคืงืจ. They used her for immoral purposes. Since she wasn't able to be married, she couldn't marry an ืขื‘ื“ and she couldn't marry a ื‘ืŸ ื—ื•ืจื™ืŸ, so she wasn't set aside to any specific man. So many people used her for immoral purposes, and that was a good enough reason for the ื‘ื™ืช ื“ื™ืŸ to force her master to free her. So now she would be able to marry a regular ื‘ืŸ ื—ื•ืจื™ืŸ, so she would be set aside specifically for a single man, so then no one would be able to do any ืขื‘ื™ืจื•ืช with her. And now we'll learn the ืžืฉื ื”. The ืžืฉื ื” says: ื”ืžื•ื›ืจ ืขื‘ื“ื• ืœืขื•ื‘ื“ื™ ื›ื•ื›ื‘ื™ื, if someone sells his ืขื‘ื“ ื›ื ืขื ื™, his gentile slave, to a ื’ื•ื™, ืื• ืœื—ื•ืฆื” ืœืืจืฅ, or to somebody outside of ืืจืฅ ื™ืฉืจืืœ, ื™ืฆื ื‘ืŸ ื—ื•ืจื™ืŸ, he automatically goes out free. And as ืจืฉืดื™ explains it, the case where he sells his ืขื‘ื“ to a ื’ื•ื™, he goes out free, or when he runs away from the ื’ื•ื™, or, even if he doesn't run away from the ื’ื•ื™, the ื“ื™ืŸ is that the ื‘ื™ืช ื“ื™ืŸ would force the one that sold him to the ื’ื•ื™ to redeem him from the ื’ื•ื™, and after he redeems him, the ื‘ื™ืช ื“ื™ืŸ would force him to free him and not work with him. And the reason for that is, since he is an ืขื‘ื“ ื›ื ืขื ื™ of a ืื™ื“, so he is ืžื—ื•ื™ื™ื‘ ื‘ืžืฆื•ืช, certain ืžืฆื•ืช an ืขื‘ื“ ื›ื ืขื ื™ that belongs to a ืื™ื“ has to do, by him selling him to a ื’ื•ื™, he was ืžืคืงื™ืข him from the ืžืฆื•ืช. He stopped him from doing ืžืฆื•ืช because being by the ื’ื•ื™ he will not be able to do the ืžืฆื•ืช. So because of that the ื—ื›ืžื™ื ืงื ืกืณื“ the seller that his ืขื‘ื“ would have to go out free. And the

Selling a Slave Abroad and Its Halachic Consequences

same is with selling an ืขื‘ื“ to ื—ื•ืฆื” ืœืืจืฅ. The ื—ื›ืžื™ื also ืงื ืกืณื“ that as soon as he sells the ืขื‘ื“, automatically he goes out free. And the ื’ืžืจื says: ืชื ื• ืจื‘ื ืŸ, the ืจื‘ื ืŸ learned: ื”ืžื•ื›ืจ ืขื‘ื“ื• ืœืขื•ื‘ื“ื™ ื›ื•ื›ื‘ื™ื ื™ืฆื ืœื—ื™ืจื•ืช, if you sell your ืขื‘ื“ to a ื’ื•ื™ he goes out free, ื•ืฆืจื™ืš ื’ื˜ ืฉื—ืจื•ืจ ืžืจื‘ื• ืจืืฉื•ืŸ, but he still needs a ื’ื˜ ืฉื—ืจื•ืจ, this document that would free him, from his first master. ืืžืจ ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ said: ื‘ืžื” ื“ื‘ืจื™ื ืืžื•ืจื™ื, when is this ื“ื™ืŸ said that he still needs a ื’ื˜ ืฉื—ืจื•ืจ from his first master? ืฉืœื ื›ืชื‘ ืขืœื™ื• ืื•ื ื•, that he didn't write for this ืขื‘ื“ his ืื•ื ื•. ืื•ื ื• is a ืฉื˜ืจ. And the ื’ืžืจื is going to explain soon what kind of ืฉื˜ืจ. ืื‘ืœ ื›ืชื‘ ืขืœื™ื• ืื•ื ื•, but if he did write the ืฉื˜ืจ for this ืขื‘ื“, ื–ื”ื• ืฉื—ืจื•ืจื•, that ืื•ื ื•, that ืฉื˜ืจ itself is the ืฉื˜ืจ ืฉื—ืจื•ืจ, is the document that frees him, and the first master would not have to write another ืฉื˜ืจ ืฉื—ืจื•ืจ. And the ื’ืžืจื asks: ืžืื™ ืื•ื ื•? What is this ืื•ื ื• that we're saying here that if the first master when he sold him to the ื’ื•ื™ wrote this ืื•ื ื•, then he doesn't have to give him a ืฉื˜ืจ ืฉื—ืจื•ืจ later on?

Rav Sheshetโ€™s Formula for the Release Clause

ืืžืจ ืจื‘ ืฉืฉืช, ืจื‘ ืฉืฉืช said: ื“ื›ืชื‘ ืœื™ื” ื”ื›ื™, that he wrote to him this. When he sold him to the ื’ื•ื™ he wrote to him in the document as follows: ืœื›ืฉืชื™ื‘ืจื— ืžืžื ื•, if you will run away from him, ืื™ืŸ ืœื™ ืขืกืง ื‘ืš, I have nothing to do with you. So that itself is the ืฉื˜ืจ ืฉื—ืจื•ืจ, so later on when he runs away from the ื’ื•ื™, he doesn't have to give him another ืฉื˜ืจ ืฉื—ืจื•ืจ. Then the ื’ืžืจื continues, ืชื ื• ืจื‘ื ืŸ, the ืจื‘ื ืŸ learned, ืœื•ื” ืขืœื™ื• ืžืŸ ื”ืขื›ื•ืดื, if a ื™ื™ื“ borrowed money from a ื’ื•ื™ on the security of the ืขื‘ื“, ื›ื™ื•ื•ืŸ ืฉืขืฉื” ืœื• ืขื•ื‘ื“ ื›ื•ื›ื‘ื™ื ื ื™ืžื•ืกื•, as soon as the ื’ื•ื™ did on this ืขื‘ื“ the ื ื™ืžื•ืกื•, his ื ื™ืžื•ืก, ื ื™ืžื•ืก really means his order, his proper thing, ื™ืฆื ืœื—ื™ืจื•ืช, automatically he goes out free. And the ื’ืžืจื asks, ืžืื™ ื ื™ืžื•ืกื•? What does this ื ื™ืžื•ืกื• mean? What kind of thing did the ื’ื•ื™ do to the ืขื‘ื“ that we say as soon as that is done, he automatically goes out free? ืืžืจ ืจื‘ ื”ื•ื ื ื‘ืจ ื™ื”ื•ื“ื”, ืจื‘ ื”ื•ื ื ื‘ืจ ื™ื”ื•ื“ื” answered, ื ืฉื›ื™, it means the collar. As soon as the ื’ื•ื™ puts on that special collar that shows that he is his slave, so then automatically he goes out free. ืžืชื™ื‘ ืจื‘ ืฉืฉืช, ืจื‘ ืฉืฉืช asked a ืงื•ืฉื™ื, we learn in a ื‘ืจื™ื™ืชื, ื•ื”ืืจื™ืกื™ืŸ ื•ื”ื—ื›ื™ืจื™ืก ื•ืืจื™ืกื™ ื‘ืชื™ ืื‘ื•ืช, the ืืจื™ืกื™ืŸ, an ืืจื™ืก of a ื’ื•ื™, and an ืืจื™ืก is a person who works for somebody else on his field, and his payment is a certain percentage of whatever will grow, whether it's 50% or a third or etc. And here we're talking about an ืืจื™ืก of a ื’ื•ื™. He works on the field of a ื’ื•ื™, and his payment would be a certain percentage. Or a ื—ื•ื›ืจ is a person who works for another person and his payment is not a percentage, but a fixed amount of things that will grow. And here we're talking about a ื—ื•ื›ืจ of a ื’ื•ื™. And ืืจื™ืกื™ ื‘ืชื™ ืื‘ื•ืช, that means if you are an ืืจื™ืก of the ื’ื•ื™, but not just from this ื’ื•ื™, but it goes from generation to generation, that this person, this ื™ื™ื“, and his father were workers for that ื’ื•ื™ and his parents before him. Or ืขื•ื‘ื“ ื›ื•ื›ื‘ื™ื ืฉืžืฉื›ืŸ ืฉื“ื”ื• ืœื™ืฉืจืืœ, or a ื’ื•ื™ who gave his field as a ืžืฉื›ื•ืŸ, as collateral to the ื™ื™ื“ on a loan, ืืฃ ืขืœ ืคื™ ืฉืขืฉื” ืœื• ื ื™ืžื•ืก, even though the ื ื™ืžื•ืก was done already, so in all these cases, ืคื˜ื•ืจื™ื ืžืŸ ื”ืžืขืฉืจ, it's ืคื˜ื•ืจ from ืžืขืฉืจ. Because like this, the ื“ื™ืŸ is that any crop that grows in ืืจืฅ ื™ืฉืจืืœ, you're not allowed to eat from that food till after you take off ืžืขืฉืจ. But if the field belongs to a ื’ื•ื™, this ื‘ืจื™ื™ืชื holds that it's ืคื˜ื•ืจ from ืžืขืฉืจ, because this ื‘ืจื™ื™ืชื holds as ืจืฉืดื™ says, ื™ืฉ ืงื ื™ืŸ ืœืขื›ื•ืดื ื‘ืืจืฅ ืœื”ืคืงื™ืข ืžื™ื“ ืžืขืฉืจ, that a ื’ื•ื™ has the power in ืืจืฅ ื™ืฉืจืืœ to ืคื˜ื•ืจ the land from ืžืขืฉืจ. So the land that belongs to a ื’ื•ื™ is ืคื˜ื•ืจ from ืžืขืฉืจ. Now all these cases mentioned in the ื‘ืจื™ื™ืชื, even though there is some connection between the field and a ื™ื™ื“, nevertheless they are ืคื˜ื•ืจ. Even though the ื™ื™ื“ is the ืืจื™ืก on the field, or the ื™ื™ื“ is the ื—ื•ื›ืจ on the field, or the ื™ื™ื“ is not just a plain ืืจื™ืก, but ืืจื™ืก ื‘ืชื™ ืื‘ื•ืช, which means that he is working on the field for generations already, his father worked and they worked for the father of that ื’ื•ื™, that shows a stronger connection between the ื™ื™ื“ and the field, nevertheless it's ืคื˜ื•ืจ from ืžืขืฉืจ. And the same thing with a field that belongs to a ื’ื•ื™ that was given as a ืžืฉื›ื•ืŸ to the ื™ื™ื“, even after the ื ื™ืžื•ืก was done, still the ื‘ืจื™ื™ืชื says that it is ืคื˜ื•ืจ from ืžืขืฉืจ. But the ื’ืžืจื asks, ื•ืื™ ืกืœืงื ื“ืขืชืš ื ืฉื›ื™, if you're going to say that ื ื™ืžื•ืก means the collar for the ืขื‘ื“, ืฉื“ื” ื‘ืช ื ืฉื›ื™ ื”ื™ื? Does a ืฉื“ื”, a field, have this collar? So what does the ื‘ืจื™ื™ืชื mean that even if the ื ื™ืžื•ืก was done to the field, it's still ืคื˜ื•ืจ from ืžืขืฉืจ? So it couldn't mean a collar, so there must be another meaning to this ื ื™ืžื•ืก that we say here. And the ื’ืžืจื answers, ืืœื ืืžืจ ืจื‘ ืฉืฉืช, so ืจื‘ ืฉืฉืช said, what does ื ื™ืžื•ืก mean? ื–ืžืŸ, time. That there was a time written by when the ื’ื•ื™ is supposed to pay up. And this is what the ื‘ืจื™ื™ืชื says: that when the ื’ื•ื™ gave this field as a ืžืฉื›ื•ืŸ to the ื™ื™ื“, so even though he wrote that if he doesn't pay up by a certain time, then the ื™ื™ื“ will be able to keep the field, so that shows a stronger connection between the ื™ื™ื“ and the field, because at a certain time he will be able to keep it, nevertheless, it is still ืคื˜ื•ืจ from ืžืขืฉืจ. And that is also the ืคืฉื˜ of ื ื™ืžื•ืก in the other ื‘ืจื™ื™ืชื, the ื‘ืจื™ื™ืชื of ืขื‘ื“, that when the ื™ื™ื“ borrowed money from the ื’ื•ื™ on the security of the ืขื‘ื“, so the ื‘ืจื™ื™ืชื says that if the ื’ื•ื™ wrote the ื ื™ืžื•ืก, in other words, if there's a time limit by when the ื™ื™ื“ is supposed to pay up, and if he doesn't pay up by then, so then the ืขื‘ื“ belongs to the ื’ื•ื™, so as soon as that time limit is written, automatically the ืขื‘ื“ belongs to the ื’ื•ื™ and the ืขื‘ื“ goes out free. So the ื’ืžืจื asks, ืงืฉื™ื ื–ืžืŸ ืื–ืžืŸ? Doesn't this create a ืงื•ืฉื™ื, a contradiction from the two ื‘ืจื™ื™ืชื•ืช in the ื“ื™ืŸ of time? In the ื‘ืจื™ื™ืชื of ืขื‘ื“, it says that if the time is written, automatically the ืขื‘ื“ belongs to the ื’ื•ื™ and he goes out free. And in the ื‘ืจื™ื™ืชื of ืžืขืฉืจ, it says that even though there was a time limit written, nevertheless the ืฉื“ื” still belongs to the ื’ื•ื™ and it doesn't belong to the ื™ื™ื“ and it's still ืคื˜ื•ืจ from ืžืขืฉืจ. And the ื’ืžืจื answers, ืœื ืงืฉื™ื, there's no ืงื•ืฉื™ื. ื”ื ื“ืžื˜ื ื–ื™ืžื ื™ื”, one is speaking in a case where the time actually came. The case of ืขื‘ื“ where it says that the ืขื‘ื“ goes out free is not only that he wrote a time limit, but the time has come. for the ืื™ื“ to pay and he didn't pay up yet. So then we say that the ืขื‘ื“ belongs to the ื’ื•ื™, and therefore he goes out free. ื”ื ื“ืœื ืžื˜ื ื–ืžื ื™ื”, the ื‘ืจื™ื™ืชื where it says that even though there was written the ืกื ื™ืžื•ืก, still the field belongs to the ื’ื•ื™, that's in the case where the time hasn't come yet. So now, as long as the time didn't come, the field still belongs to the ื’ื•ื™, and therefore it is ืคื˜ื•ืจ from ืžืขืฉืจ. ื’ืžืจื asks, ืืœื ืœื’ื‘ื™ ืขื‘ื“ ื“ืžื˜ื ื–ืžื ื™ื”, ืฆืจื™ื›ื ืœืžื™ืžืจ? By the case of an ืขื‘ื“, does the ื‘ืจื™ื™ืชื have to tell us that if the time came when he was supposed to pay and he didn't pay, that he goes out free? Definitely! Since he wrote in the ืฉื˜ืจ that if by this and this date I don't pay, the ืขื‘ื“ is yours, so as soon as the date comes and he doesn't pay, automatically the ืขื‘ื“ belongs to the ื’ื•ื™. That is very simple, the ื‘ืจื™ื™ืชื doesn't have to tell us that. ืืœื, therefore, the ื’ืžืจื changes the ืคืฉื˜ is, ืื™ื“ื™ ื•ืื™ื“ื™ ื“ืœื ืžื˜ื ื–ืžื ื™ื”, both ื‘ืจื™ื™ืชื•ืช are in a case where the time hasn't come yet. ื•ืœื ืงืฉื™ื, there is no ืงืฉื™ื, there is no contradiction between the two ื‘ืจื™ื™ืชื•ืช. ื”ื ืœื’ื•ืคื™ื”, ื•ื”ื ืœืคื™ืจื. The ื‘ืจื™ื™ืชื about the ืขื‘ื“ is a case of ื’ื•ืคื•, where the ื’ื•ืฃ of the ืขื‘ื“, the body of the ืขื‘ื“, the ืขื‘ื“ himself, will belong to the ื’ื•ื™. ื•ื”ื, and the other one, the ื‘ืจื™ื™ืชื of the ืฉื“ื”, is ืœืคื™ืจื•ืช, only for fruits. In other words, the case of the ืขื‘ื“, the case was that he told him that if I do not pay you by this and this date, then the ืขื‘ื“ himself belongs to you, to the ื’ื•ื™. So even before the time came, he is ืžืฉื•ืขื‘ื“ already to the ื’ื•ื™, and the ื’ื•ื™ makes him work for him. So in a case like that, the ื—ื›ืžื™ื said, since you set a time limit that the ืขื‘ื“ himself will belong to the ื’ื•ื™, so even before the time came, the ื—ื›ืžื™ื made a ืงื ืก, they fined the person, and the ืขื‘ื“ goes out free because he caused him to eventually become an ืขื‘ื“ of a ื’ื•ื™. The case of the field is a ืžืฉื›ื ืชื, not that he said that by the time the the date comes and you don't pay, the field becomes yours. That's not what he said. He said that if the time comes and you don't pay, then all the ืคื™ืจื•ืช that grow on that field will be yours till you will collect all the money that are on the ื—ื•ื‘ from these ืคื™ืจื•ืช. So in a case like that, the field will never become eventually the ืื™ื“'s. And therefore there the ื—ื›ืžื™ื said that the ืคื™ืจื•ืช are still considered ืคื™ืจื•ืช from a field of a ื’ื•ื™, and they are ืคื˜ื•ืจ from ืžืขืฉืจ. ืื™ ื‘ืขื™ืช ืื™ืžื, if you want, the ื’ืžืจื says I could answer different, ื‘ืฉืœื•ื” ืขืœ ืžื ืช ืœืžืฉื›ื ื• ื•ืœื ืžืฉื›ื ื•. It's talking in a case where he borrowed the money, but he didn't make the ืžืฉื›ื•ืŸ then yet, he didn't take it then yet as collateral. They made up a condition that if the time will come and you won't pay, that's when I will come and take it away from you as collateral. And the case is that the time has come, and he didn't pay, but the other person didn't come yet to take him away as collateral. And that is the difference between the two cases. In the case of the field, since ืœืคื•ืขืœ the ืื™ื“ didn't take it away from the ื’ื•ื™ yet, it's still in the hands of the ื’ื•ื™, even though the time for the payment has come, but as long as the ืื™ื“ didn't take it away, it's still considered a field of a ื’ื•ื™, and therefore it is ืคื˜ื•ืจ from ืžืขืฉืจ. But in the case of the ืขื‘ื“, even though the ื’ื•ื™ didn't come to take the ืขื‘ื“ away yet, but since the time has come, and if the ื’ื•ื™ would want, he's able to come and take the ืขื‘ื“ away now, so right away the ื—ื›ืžื™ื made a ืงื ืก that since you did something that could cause this ืขื‘ื“ to become an ืขื‘ื“ of a ื’ื•ื™, ื—ื›ืžื™ื ืงื ืก'ื˜, and he goes out free right away. This is the way ืจืฉืดื™ learns the ืคืฉื˜ in the last ืชื™ืจื•ืฅ of the ื’ืžืจื. ืชื•ืกืคื•ืช learns a little bit different in the last ืชื™ืจื•ืฅ. ืชื•ืกืคื•ืช learns that when the ื’ืžืจื says, ืื™ ื‘ืขื™ืช ืื™ืžื ื‘ืฉืœื•ื” ืขืœ ืžื ืช ืœืžืฉื›ื ื• ื•ืœื ืžืฉื›ื ื•, it goes back to the first ืชื™ืจื•ืฅ. When the ื’ืžืจื answered before that the case of ืขื‘ื“ is speaking in a case where the time has come already for him to pay and he didn't pay, and the case of ืฉื“ื” is in a case where the time hasn't come yet, so the ื’ืžืจื asked a ืงืฉื™ื that if the time has come, what is the ื—ื™ื“ื•ืฉ of the ื‘ืจื™ื™ืชื that he belongs to the ื’ื•ื™ and therefore he goes out free? Definitely, the time has come for him to pay, and he didn't, and the ืขื‘ื“ was the ืžืฉื›ื•ืŸ, so definitely he belongs to the ื’ื•ื™. So what is the ื—ื™ื“ื•ืฉ of the ื‘ืจื™ื™ืชื? And this is what the ื’ืžืจื answers, that there is still a ื—ื™ื“ื•ืฉ, because the ื‘ืจื™ื™ืชื is speaking in a case where even though the time has come for him to pay, but since the ื’ื•ื™ actually didn't come to take him yet, so we might think that he still belongs to the ืื™ื“ and he shouldn't go out free, that's the ื—ื™ื“ื•ืฉ of the ื‘ืจื™ื™ืชื, that since the time has come for him to pay, so now if the ื’ื•ื™ would want, he was able to come and take him, so the ื—ื›ืžื™ื already ืงื ืก'ื˜ the ืื™ื“, and the ืขื‘ื“ goes out free. ืชื•ืกืคื•ืช also asks a ืงืฉื™ื on the ืžืฉื ื” itself. The ื“ื™ืŸ in the ืžืฉื ื” is that if someone sells his ืขื‘ื“ to ื—ื•ืฅ ืœืืจืฅ, he goes out free. So ืชื•ืกืคื•ืช asks a ืงืฉื™ื, what is the case? It can't be that he was forced by his master to leave ืืจืฅ ื™ืฉืจืืœ to ื—ื•ืฅ ืœืืจืฅ, because the ื“ื™ืŸ is in ื›ืชื•ื‘ื•ืช that you cannot force anybody to leave ืืจืฅ ื™ืฉืจืืœ, so the master wasn't able to force him to go out. ืืœื ืžืื™, he went out willingly with his master? The ื’ืžืจื says later on on ื“ืฃ ืžืดื“ ืขืžื•ื“ ื‘ืณ that if the ืขื‘ื“ goes out willingly after the master to ื—ื•ืฅ ืœืืจืฅ, ืื™ื‘ื“ The ืขื‘ื“ loses his ื–ื›ื•ืช of going out free and he remains an ืขื‘ื“. So what is the case of the ืžืฉื ื” where it says that if you sell your ืขื‘ื“ to ื—ื•ืฅ ืœืืจืฅ he goes out free? And ืชื•ืกืคื•ืช answers that this is the case where he sold him while he was still in ืืจืฅ ื™ืฉืจืืœ to somebody that that person would take him to ื—ื•ืฅ ืœืืจืฅ. So the ื“ื™ืŸ is that he goes out free right away because we're afraid that his second master will convince him and he will go out willingly. So because of that we ืงื ืก him right away and he goes out free right away. Going back a little bit earlier in the ื’ืžืจื, where the ื’ืžืจื wanted to prove if a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ is able to be ืžืงื“ืฉ, and the ื’ืžืจื wanted to prove it from the ื‘ืจื™ื™ืชื where it says that you have to pay half of the ื›ื•ืคืจ to his ื™ื•ืจืฉื™ื and the ื’ืžืจื asked, "How is it possible for a ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ to have ื™ื•ืจืฉื™ื if his ืงื™ื“ื•ืฉื™ืŸ are not ืงื™ื“ื•ืฉื™ืŸ?" And that proves that his ืงื™ื“ื•ืฉื™ืŸ are ืงื™ื“ื•ืฉื™ืŸ. So ืชื•ืกืคื•ืช asks a ืงืฉื™ื, what is the connection? It is possible that his ืงื™ื“ื•ืฉื™ืŸ should not be ืงื™ื“ื•ืฉื™ืŸ and still he should have ื™ื•ืจืฉื™ื. If he lives with a woman without ืงื™ื“ื•ืฉื™ืŸ and they have a child, that child is considered his child, and that child is his heir, just like the ื“ื™ืŸ even by a ืžืžื–ืจ, that if somebody lives with somebody who is forbidden to him, ื—ื™ื™ื‘ื™ ื›ืจื™ืชื•ืช, and the ื“ื™ืŸ is that the ืงื™ื“ื•ืฉื™ืŸ are not ืชื•ืคืก, that the man's ืงื™ื“ื•ืฉื™ืŸ to this woman are not valid, and nevertheless if he has a child, even though the child is a ืžืžื–ืจ, but that child is considered his ื™ื•ืจืฉ and that child will inherit everything that he has. So we see that it doesn't have to be ืงื™ื“ื•ืฉื™ืŸ in order for the children to be ื™ื•ืจืฉื™ื. And ืชื•ืกืคื•ืช answers that there is a difference. In the case of a ืžืžื–ืจ where we say that he is considered a ื™ื•ืจืฉ, there, because ื‘ืืžืช this person is ื‘ืจ ืงื™ื“ื•ืฉื™ืŸ. He is able to be ืžืงื“ืฉ. It's only in this specific case that the ืงื™ื“ื•ืฉื™ืŸ are not ืงื™ื“ื•ืฉื™ืŸ because it is ื—ื™ื™ื‘ื™ ื›ืจื™ืชื•ืช. But otherwise he is in the category of ืงื™ื“ื•ืฉื™ืŸ. So in a case like that we say that the child that is born, even in the case where he had no ืงื™ื“ื•ืฉื™ืŸ, that child is called his ื™ื•ืจืฉ. But in the case of ื—ืฆื™ ืขื‘ื“ ื—ืฆื™ ื‘ืŸ ื—ื•ืจื™ืŸ, since there is no possibility of ืงื™ื“ื•ืฉื™ืŸ whatsoever, so here the ื’ืžืจื feels that if there is no ืงื™ื“ื•ืฉื™ืŸ, so then his children are not considered his ื™ื•ืจืฉื™ื. And that's the ื’ืžืจื's ืจืื™ื”. Since it says that you have to pay the half ื›ื•ืคืจ to his ื™ื•ืจืฉื™ื, that's a ืจืื™ื” that probably his ืงื™ื“ื•ืฉื™ืŸ are ืงื™ื“ื•ืฉื™ืŸ.
