Can Wearing Tefillin Prove You're a Free Man?

Part of Gittin: chapter 4 · 58:15

Covers a dispute over whether wearing tefillin can serve as proof of a slave's freedom, a father's will freeing his slave, and the special rules when a minor's guardian frees a slave on his behalf.

Intro to Gemara on Gittin daf 39b

Today's 砖讬注讜专 will be 诪住讻转 讙讬讟讬谉 讚祝 诪壮, but we will start on 讚祝 诇状讟 注诪讜讚 讘壮, two lines from the bottom of the 注诪讜讚, the last two words of the line. We're still here in the middle of the 住讜讙讬讗 of 注讘讚 讻谞注谞讬, different 讚讬谞讬诐 concerning 注讘讚 讻谞注谞讬, and different 讚讬谞讬诐 concerning the 砖讞专讜专, the freedom of an 注讘讚 讻谞注谞讬. And the 讙诪专讗 starts, 讗诪专 专讘 讝讬专讗, 专讘 讝讬专讗 said, 讗诪专 专讘 讞谞讬谞讗 in the name of 专讘 讞谞讬谞讗, 讗诪专 专讘 讗砖讬 in the name of 专讘 讗砖讬, 讗诪专 专讘讬 in the name of 专讘讬: 注讘讚 砖谞砖讗 讘转 讞讜专讬谉 讘驻谞讬 专讘讜, if an 注讘讚 讻谞注谞讬 married a regular Jewish woman in front of his master, 讬爪讗 诇讞讬专讜转, he automatically goes out free. And as 专砖状讬 explains, because if his master wouldn't have freed him before, he wouldn't have allowed him to marry a 讘转 讞讜专讬谉. And since he watched him marry the 讘转 讞讜专讬谉, and didn't protest, that proves that he must have freed him before.

Rabbi Yochanan challenges the proof of freedom

讗诪专 诇讬讛 专讘讬 讬讜讞谞谉, so 专讘讬 讬讜讞谞谉 said to him, 讻诇 讻讱 讬砖 讘讬讚讱? Do you have so much in your hands? In other words, did you really hear this in the name of 专讘讬, when I heard a 讚讬谉 that just shows the opposite? 讜讗谞讬 砖讜谞讛, I learned, 讛讻讜转讘 砖讟专 讗讬专讜住讬谉 诇砖驻讞转讜, if someone writes a 砖讟专 拽讬讚讜砖讬谉 to his 砖驻讞讛, because there are three ways a person is able to be 诪拽讚砖 a woman. One of the three ways is 砖讟专. If he takes a little piece of paper and he writes on it, 讛专讬 讗转 诪拽讜讚砖转 诇讬 讘砖讟专 讝讛, you should be 诪拽讜讚砖 to me with this 砖讟专, that is a form of 拽讬讚讜砖讬谉, and the woman becomes 诪拽讜讚砖转 to him. So if a person writes a 砖讟专 拽讬讚讜砖讬谉 to his 砖驻讞讛, he writes to her, you should be 诪拽讜讚砖 to me with this 砖讟专, so 专讘讬 诪讗讬专 讗讜诪专, 专讘讬 诪讗讬专 says, 诪拽讜讚砖转, that she is 诪拽讜讚砖转. And the reason for that is because if he wouldn't have freed her, he definitely wouldn't have been 诪拽讚砖 her. Since she is a 砖驻讞讛, you're not allowed to marry a 砖驻讞讛. So since he is marrying her, that proves that he must have been 诪砖讞专专 her, he must have freed her before. 讜讞讻诪讬诐 讗讜诪专讬诐, but the 讞讻诪讬诐 say, 讗讬谞讛 诪拽讜讚砖转, that she is not 诪拽讜讚砖. So we see here that the 讞讻诪讬诐, who usually the 讛诇讻讛 is like the 讞讻诪讬诐, hold that even if the master himself wrote a 砖讟专 拽讬讚讜砖讬谉 to his 砖驻讞讛, she is not 诪砖讜讞专专. So certainly the 讚讬谉 would be that if he just saw his 注讘讚 marry a 讘转 讞讜专讬谉, he shouldn't be 诪砖讜讞专专. So how could you say in the name of 专讘讬, that if a person sees his 注讘讚 marry a 讘转 讞讜专讬谉, that proves that he was 诪砖讞专专 her, when the 讞讻诪讬诐 hold that even if he writes a 砖讟专 拽讬讚讜砖讬谉 himself to his 砖驻讞讛, that is no proof that he is 诪砖讞专专 her, and therefore she is not 诪拽讜讚砖转? And the 讙诪专讗 answers, 讻讚讗诪专 专讘讛 讘专 专讘 砖讬诇讗, that we can answer here the same way as 专讘讛 讘专 专讘 砖讬诇讗 answered concerning another 拽砖讬讗. He answered, 讻砖专讘讜 讛谞讬讞 诇讜 转驻讬诇讬谉.

Contradiction concerning tefillin as proof of freedom

Later on in the 讙诪专讗, we have a 住转讬专讛. One place it says that if a master saw his 注讘讚 put on 转驻讬诇讬谉, that proves that he was 诪砖讞专专 him. In another place it says that it does not prove that he was 诪砖讞专专 him. So 专讘讛 讘专 专讘 砖讬诇讗 answered, that in the place where it says that it does prove that his master was 诪砖讞专专 him, is not when his master saw him put on 转驻讬诇讬谉, but when his master himself put the 转驻讬诇讬谉 on him. The same way we could answer here, that when he said in the name of 专讘讬, that if his master saw him marry a 讘转 讞讜专讬谉, that proves that he was 诪砖讞专专 him, is not in a case where his master just saw him marry the 讘转 讞讜专讬谉, but it's a case where his master himself married him off to a 讘转 讞讜专讬谉. And that proves that he must have freed him, because everyone knows that it's an 注讘讬专讛 for an 注讘讚 to marry a 讘转 讞讜专讬谉. So we don't assume that his master would have his 注讘讚 do an 注讘讬专讛, and therefore we assume that definitely he was 诪砖讞专专 him before, and that's why he married him off later to a 讘转 讞讜专讬谉. Then the 讙诪专讗 asks a 拽砖讬讗: 讜诪讬 讗讬讻讗 诪讬讚讬 讚诇注讘讚讬讛 诇讗 诪注讘讬讚 诇讬讛 讗讬住讜专讗, that for his 注讘讚 he wouldn't do an 讗讬住讜专, an 注讘讬专讛, 讜讗讬讛讜 注讘讬讚 讗讬住讜专讗, and he himself would do an 注讘讬专讛? And before, 专讘讬 讬讜讞谞谉 quoted in the name of the 讞讻诪讬诐 that if the master himself writes a 砖讟专 拽讬讚讜砖讬谉 to his 砖驻讞讛, we do not assume that he was 诪砖讞专专 her before, even though it is an 注讘讬专讛 to marry a 砖驻讞讛. So it comes out that in the case where he married off his 注讘讚, we are so sure that he must have freed him before, because otherwise he wouldn't have his 注讘讚 do an 注讘讬专讛. But in the case where he himself would be doing an 注讘讬专讛, because he self is marrying the 砖驻讞讛, there we don't say that this proves that probably he was 诪砖讞专专 her before. In other words, we do assume that he is going to do an 注讘讬专讛. So the question is, where do we find such a thing that for his 注讘讚 we are sure he wouldn't do an 注讘讬专讛, and for himself he would do an 注讘讬专讛? 讗诪专 专讘 谞讞诪谉 讘专 讬爪讞拽, so 专讘 谞讞诪谉 讘专 讬爪讞拽 said, 讛讻讗 讘诪讗讬 注住拽讬谞谉, here it is talking in a case 讚讗诪专 诇讛, he said to her, 爪讗讬 讘讜 讜讛转拽讚砖讬 讘讜. The case where 专讘讬 讬讜讞谞谉 brought the 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐 was not a case where he wrote a 砖讟专 拽讬讚讜砖讬谉 to his 砖驻讞讛 and he wanted to marry her with this 砖讟专 拽讬讚讜砖讬谉, but he wrote to her, 讛专讬 讗转 诪拽讜讚砖转 诇讬, and he told her, "Go out and become 诪拽讜讚砖 with this 砖讟专. Go and marry a 讘谉 讞讜专讬谉 with this 砖讟专, but not that he himself wanted to marry her with this 砖讟专." So the 砖讗诇讛 is, 专讘讬 诪讗讬专 住讘专, 专讘讬 诪讗讬专 holds 讬砖 讘诇砖讜谉 讛讝讛 诇砖讜谉 砖讬讞专讜专, that the 诇砖讜谉 that he wrote to her, 讛专讬 讗转 诪拽讜讚砖转, this is a 诇砖讜谉 of 砖讬讞专讜专. This is also a 诇砖讜谉 of freedom. So when he gave her that 砖讟专 and he told her, "Take this 砖讟专 and go marry with this 砖讟专," so what he meant was that this 砖讟专 should be your 砖讟专, 砖讟专 砖讬讞专讜专. So 专讘讬 诪讗讬专 holds that the word 诪拽讜讚砖转 could mean a 诇砖讜谉 砖讬讞专讜专, because what he meant was, "Here, take this 砖讟专 and with this 砖讟专 you should be 专讗讜讬 to become 诪拽讜讚砖. This 砖讟专 should allow you to become 诪拽讜讚砖." That's what he meant when he wrote 讛专讬 讗转 诪拽讜讚砖转. In other words, he meant you should be free, and when she becomes free she could marry a 讘谉 讞讜专讬谉. So 专讘讬 诪讗讬专 holds that in this 诇砖讜谉 there is a 诇砖讜谉 of 砖讬讞专讜专. But 专讘谞谉 住讘专讬, 专讘谞谉 hold, 讗讬谉 讘诇砖讜谉 讛讝讛 诇砖讜谉 砖讬讞专讜专, that in this 诇砖讜谉 of 拽讬讚讜砖讬谉 there is no 诇砖讜谉 砖讬讞专讜专, and therefore we do not say that she is 诪拽讜讚砖转 to him. She's also not free, because this is not a 诇砖讜谉 砖讬讞专讜专.

Rabbi Yehoshua ben Levi on tefillin and freedom

He goes out free, because his master would not have allowed him to put on 转驻讬诇讬谉 if he wouldn't have been 诪砖讞专专 him, because an 注讘讚 is 驻讟讜专 from putting on 转驻讬诇讬谉. The 讚讬谉 is that an 注讘讚 is 诪讞讜讬讬讘 讘诪爪讜讜转 讻讗讬砖讛. He's 诪讞讜讬讬讘 to do the same 诪爪讜讜转 that a woman is obligated to do, and he's exempt from all the 诪爪讜讜转 a woman is exempt. And the rule is that a woman is exempt from all the 诪爪讜讜转 注砖讛 砖讛讝诪谉 讙专诪讗, all the positive 诪爪讜讜转 that have a time limit. And amongst those is the 诪爪讜讛 of 转驻讬诇讬谉, that a woman is 驻讟讜专 from putting on 转驻讬诇讬谉, and so is an 注讘讚 驻讟讜专 from putting on 转驻讬诇讬谉. So when the master saw his 注讘讚 put on 转驻讬诇讬谉, that proves that he probably freed him before, because if he wouldn't have freed him, he wouldn't have allowed him to put on 转驻讬诇讬谉. The 讙诪专讗 asks a 拽砖讬讗, 诪讬转讬讘讬, I'll ask you a 拽砖讬讗, we learned, 诇讜讛 讛讬诪谞讜 专讘讜, if his master borrowed money from him, 讗讜 砖注砖讗讜 专讘讜 讗驻讜讟专讜驻讜住, or if his master made him the manager, the guardian over his possessions, 讗讜 砖讛谞讬讞 转驻讬诇讬谉 讘驻谞讬 专讘讜, or if the 注讘讚 put on 转驻讬诇讬谉 in front of his master, 讗讜 砖拽专讗 砖诇砖讛 驻住讜拽讬诐 讘讘讬转 讛讻谞住转 讘驻谞讬 专讘讜, or if the 注讘讚 read in the 转讜专讛 three 驻住讜拽讬诐 in shul in front of his master, in all these cases 讛专讬 讝讛 诇讗 讬爪讗 诇讞讬专讜转. This all does not prove that he goes out free. Even though he did things that normally an 注讘讚 does not do, and he did them in front of his master, it still does not prove that his master must have freed him before. So this comes out a 住转讬专讛 to what 专讘讬 讬讛讜砖注 讘谉 诇讜讬 had said, because 专讘讬 讬讛讜砖注 讘谉 诇讜讬 said that if an 注讘讚 puts on 转驻讬诇讬谉 in front of his master, that is a proof that his master must have freed him, and in this 讘专讬讬转讗 we see that if he puts on 转驻讬诇讬谉 讘驻谞讬 专讘讜, the 讚讬谉 is 诇讗 讬爪讗 诇讞讬专讜转, he does not go out free.

Rav Bar Rav Shila explains tefillin placement nuance

讗诪专 专讘讛 讘专 专讘 砖讬诇讗, so 专讘讛 讘专 专讘 砖讬诇讗 said, 讻砖专讘讜 讛谞讬讞 诇讜 转驻讬诇讬谉, that this is the case when his master put him on 转驻讬诇讬谉 himself. When 专讘讬 讬讛讜砖注 讘谉 诇讜讬 said that if an 注讘讚 puts on 转驻讬诇讬谉 in front of his master, he goes out free, that is not just when his master saw him put on 转驻讬诇讬谉, but it's when his master himself put him on the 转驻讬诇讬谉. Then we say that probably he must have freed him before. And as 转讜住驻讜转 explains, it is not because it is an 注讘讬专讛, because the 注讘讚, who's 驻讟讜专 from 转驻讬诇讬谉, would be making a 讘专讻讛 on the 转驻讬诇讬谉, so it would be a 讘专讻讛 诇讘讟诇讛, because he is 驻讟讜专 from 转驻讬诇讬谉, so his 讘专讻讛 would be a 讘专讻讛 诇讘讟诇讛. So 转讜住驻讜转 says that it's not true, because we see that there are many 诪爪讜讜转 注砖讛 砖讛讝诪谉 讙专诪讗, many 诪爪讜讜转 which have a time limit, and women are 驻讟讜专, and nevertheless, when they fulfill those 诪爪讜讜转, if they want to, they make a 讘专讻讛. So we see that when a woman, and the same would apply to an 注讘讚, does a 诪爪讜讛 that she is 驻讟讜专, or the 注讘讚 is 驻讟讜专, they're allowed allowed to make a 讘专讻讛 and it is not considered a 讘专讻讛 诇讘讟诇讛. So when the 讙诪专讗 says here, that when the master put on 转驻讬诇讬谉 on his 注讘讚, that shows that he freed him, is not because we say otherwise he wouldn't have allowed him to make the 讘专讻讛 because it's a 讘专讻讛 诇讘讟诇讛, it's not a 讘专讻讛 诇讘讟诇讛, but what the 讙诪专讗 means is, as 转讜住驻讜转 explains, because it's not common for an 注讘讚 to put on 转驻讬诇讬谉. And therefore we assume that if the master didn't free him before, he wouldn't have put on the 转驻讬诇讬谉 because this is not a 讚讘专 讛专讙讬诇 not a common thing. And therefore we say, if he did put on 转驻讬诇讬谉 on his 注讘讚, that probably 讬爪讗 诇讞讬专讜转, probably he freed him before. Then the 讙诪专讗 continues, 讻讬

Rav Dimi's ruling on a father's will for his slave

讗转讗 专讘 讚讬诪讬, when 专讘 讚讬诪讬 came, 讗诪专 专讘讬 讬讜讞谞谉, he said in the name of 专讘讬 讬讜讞谞谉, 诪讬 砖讗诪专 讘砖注转 诪讬转转讜, if someone said before his death, 驻诇讜谞讬转 砖驻讞转讬 讗诇 讬砖转注讘讚讜 讘讛, that my 砖驻讞讛, my female slave, so-and-so, do not have her work, do not allow her to continue working 诇讗讞专 诪讜转讬, after I die, so the 讚讬谉 is that 讻讜驻讬谉 讗转 讛讬讜专砖讬诐, the 讘讬转 讚讬谉 would force the 讬讜专砖讬诐 讜讻讜转讘讬谉 诇讛 讙讟 砖讞专讜专 and they would have to write for her a 讙讟 砖讞专讜专 and free her because of what the father said. 讗诪专讜 诇驻谞讬讜 专讘 讗诪讬 讜专讘 讗住讬, so 专讘 讗诪讬 and 专讘 讗住讬 said to him, 专讘讬, 讗讬 讗转讛 诪讜讚讛, don't you admit 砖讘谞讬讛 注讘讚讬诐, that her children are 注讘讚讬诐? In other words, when the father said that she should not work, this is not a form of 砖讞专讜专. She didn't become a 诪砖讜讞专专转, a 讘转 讞讜专讬谉, she still remains a 砖驻讞讛, and therefore, her children are definitely 注讘讚讬诐. All he said was that this 砖驻讞讛 should not work. So what we should tell the 讬讜专砖讬诐 is that they're not allowed to have this 砖驻讞讛 work for them, but why should we force the 讬讜专砖讬诐 to free her, and then they lose not only her work, but they also lose the 注讘讚讬诐? If they don't free her, then if she has any children, then they are 注讘讚讬诐 and they belong to the master, to the 讬讜专砖讬诐. But if they free her, they give her a 讙讟 砖讞专讜专, then her children are 讘谞讬 讞讜专讬谉 and they lose the children, too. So why should we force the 讬讜专砖讬诐 to free her? All we should do is tell the 讬讜专砖讬诐, your father said not to work with her, so they shouldn't have her work, but still she should remain a 砖驻讞讛. So the 讙诪专讗 continues that 讻讬 讗转讗 专讘 砖诪讜讗诇 讘专 讬讛讜讚讛, when 专讘 砖诪讜讗诇 讘专 讬讛讜讚讛 came, 讗诪专 专讘讬 讬讜讞谞谉, he gave over in the name of 专讘讬 讬讜讞谞谉 that what 专讘讬 讬讜讞谞谉 said was not as 专讘 讚讬诪讬 had given it over, but it was a different statement that he said. He said like this: that 诪讬 砖讗诪专 讘砖注转 诪讬转转讜, someone said before he died, 驻诇讜谞讬转 砖驻讞转讬, my 砖驻讞讛, so-and-so, 拽讜专转 专讜讞 注砖转讛 诇讬, she satisfied me, she gave me pleasure, 讬注砖讛 诇讛 拽讜专转 专讜讞. So what should be done to her? She should be satisfied, too. A pleasure should be done to her. So the 讚讬谉 is that 讻讜驻讬谉 讗转 讛讬讜专砖讬诐, we force the 讬讜专砖讬诐 讜注讜砖讬谉 诇讛 拽讜专转 专讜讞, and they have to satisfy her. And as 专砖状讬 explains, they have to satisfy her till she says, "I am satisfied." And if she says, "I am not satisfied unless you will free me," so the 讚讬谉 is that they must free her. And the reason is, 诪讗讬 讟注诪讗, what is the reason? The 讙诪专讗 says, 诪爪讜讛 诇拽讬讬诐 讚讘专讬 讛诪转. It's a 诪爪讜讛 to fulfill the words of the deceased. And since he said make sure she is satisfied, so we have to listen to him and make sure she is satisfied even up to freeing her. So this is what 专讘讬 讬讜讞谞谉 said, not as 专讘 讚讬诪讬 gave over in the name of 专讘讬 讬讜讞谞谉 that the case was that the man said before he died, "Do not have my 砖驻讞讛 work," and then we force the 讬讜专砖讬诐 to free her. What he what he said was that "I want my 砖驻讞讛 to be satisfied," so that's when we force the 讬讜专砖讬诐 to free her if she is not satisfied unless she gets freed. Then the 讙诪专讗 continues,

Amemar's view on abandoning ownership of a slave

讗诪专 讗诪讬诪专, 讗诪讬诪专 says, 讛诪驻拽讬专 注讘讚讜, if someone is 诪驻拽讬专 his 注讘讚, gives up ownership over his 注讘讚, 讗讜转讜 注讘讚 讗讬谉 诇讜 转拽谞讛, that 注讘讚 has no 转拽谞讛, there's nothing that could be done for that 注讘讚, not even with a 砖讟专 砖讞专讜专. 诪讗讬 讟注诪讗, what is the reason? Because what could we do for him? 讙讜驻讬讛 诇讗 拽谞讬 诇讬讛, the 讙讜祝 of the 注讘讚 is not 拽谞讜讬 to the master, doesn't belong to the master anymore because the master gave up ownership. So the only thing that's left in this 注讘讚, 讗讬住讜专讗 讛讜讗 讚讗讬讻讗 讙讘讬讛, he only has an 讗讬住讜专 by him, the only fact that he is still an 注讘讚 and he was not given a 砖讟专 砖讞专讜专. 讜讗讬住讜专讗 诇讗 诪爪讬 诪拽谞讬 诇讬讛, just 讗讬住讜专 he cannot be 诪拽谞讛 to himself. So therefore, now he is in between: he is not an 注讘讚 because he was 讛驻拽专, he is not a 讘谉 讞讜专讬谉 because he wasn't given a 砖讟专 砖讞专讜专. On the other hand, to give him a 砖讟专 砖讞专讜专 now he can't either, because since there is only 讗讬住讜专 left here, no 拽谞讬谉 诪诪讜谉, he doesn't belong to his master anymore, so the master is not able to give him a 砖讟专 砖讞专讜专. So therefore, a case like that, 讗讬谉 诇讜 转拽谞讛, he cannot marry a 讘转 讞讜专讬谉 because he's still a little bit an 注讘讚, he cannot marry a 砖驻讞讛 because he is partially a 讘谉 讞讜专讬谉, and he has no 转拽谞讛, nothing could be done for him.

Rav Ashi counters Amemar on slave emancipation

讗诪专 诇讬讛 专讘 讗砖讬 诇讗诪讬诪专, Rav Ashi said to Ameimar, how could you say that? 讜讛讗 讗诪专 注讜诇讗 讗诪专 专讘讬 讬讜讞谞谉, didn't 注讜诇讗 say in the name of 专讘讬 讬讜讞谞谉, 讜专讘 讞讬讬讗 讘专 讗讘讬谉 讗诪专 专讘, and 专讘 讞讬讬讗 讘专 讗讘讬谉 said in the name of 专讘, that 讗讞讚 讝讛 讜讗讞讚 讝讛, in both cases that we learned before, whether the master is 诪拽讚讬砖 his 注讘讚, gives it away for 讛拽讚砖, or the master is 诪驻拽讬专 his 注讘讚, 讬爪讗 诇讞讬专讜转, he goes out free, 讜爪专讬讱 讙讟 砖讞专讜专, and he needs a 讙讟 砖讞专讜专. And what it seems to be saying is that when he gives him a 砖讟专 砖讞专讜专, then he would be 100% free and he would be allowed to marry a 讘转 讞讜专讬谉. 讗诪专 诇讬讛, so he said, no, what they meant was 爪专讬讱, that he needs a 砖讟专 砖讞专讜专, but 讗讬谉 诇讜 转拽谞讛, there is no 转拽谞讛, nothing could be done for him. He still needs a 砖讟专 砖讞专讜专, but a 砖讟专 砖讞专讜专 cannot be given to him because it would not help. So the way Ameimar learns 驻砖讟 in what they said, that he goes out free and needs a 砖讟专 砖讞专讜专, not that he needs and could get, but he needs and it cannot be given to him, and therefore he remains the way he is all his life. 讗讬讻讗 讚讗诪专讬, others said, 讗诪专 讗诪讬诪专, Ameimar said a different thing: 讛诪驻拽讬专 注讘讚讜, if someone is 诪驻拽讬专 his 注讘讚, 讜诪转, and the person who was 诪驻拽讬专 him, the master, died, then he said, 讗讜转讜 讛注讘讚 讗讬谉 诇讜 转拽谞讛. That 注讘讚 has no 转拽谞讛, nothing can be done for him. 诪讗讬 讟注诪讗, what is the reason? 讙讜驻讬讛 诇讗 拽谞讬 诇讬讛. His 讙讜祝 is not 拽谞讜讬 to his master, and therefore, when the master dies, the children of the master did not inherit it either, because the master didn't own it, and the children cannot inherit something that a master didn't own. So since the master gave up the ownership, so the children do not 讬专砖谉, do not inherit the ownership, the monetary part of the ownership. The only thing that was left between the 注讘讚 and his master, 讗讬住讜专讗 讛讜讗 讚讗讬讻讗 讙讘讬讛. There's only a 讗讬住讜专, that 注诇 驻讬 讛诇讻讛 he's still an 注讘讚 and still an 注讘讚 of that master. So now, if the master wouldn't have died, according to this 驻砖讟, the master couldn't could have given him a 砖讟专 砖讞专讜专, even though all he has left is 讗讬住讜专, but if the master would give him a 砖讟专 砖讞专讜专, that would take care of the 讗讬住讜专 too and he would become 100% free. But since the master died, so now what do we expect, that the 讬讜专砖讬诐, they should be the one to give the 砖讟专 砖讞专讜专? That cannot be, because 讗讬住讜专讗 诇讘专讬讛 诇讗 诪讜专讬砖. A person cannot make his children inherit an 讗讬住讜专. Children inherit 诪诪讜谉, things which have value, monetary value, but 讗讬住讜专讬诐, that children do not inherit. So now that he died, his children did not inherit any connection to this 注讘讚, because all that was left was the 讗讬住讜专. So now they cannot give him a 砖讟专 砖讞专讜专. So there is nobody else that can give him a 砖讟专 砖讞专讜专, so therefore, this 注讘讚 has no 转拽谞讛, there's nothing that can be done for him. He cannot marry a 砖驻讞讛 because his master was 诪驻拽讬专 him, he cannot marry a 讘转 讞讜专讬谉 because there's nobody that could give him a 砖讟专 砖讞专讜专, his master died, and the children do not inherit the 讗讬住讜专, and therefore 讗讬谉 诇讜 转拽谞讛. Then the 讙诪专讗 continues, 讗诪专 诇讬讛 专讘 讗砖讬 诇讗诪讬诪专, Rav Ashi said to Ameimar, how could you say that 讚讬谉? 讜讛讗 讻讬 讗转讗 专讘 讚讬诪讬 讗诪专 专讘讬 讬讜讞谞谉, but when 专讘 讚讬诪讬 came, he gave over the 讚讬谉 in the name of 专讘讬 讬讜讞谞谉, and this refers to the 讚讬谉 we mentioned before, that when 专讘 讚讬诪讬 came, he gave over in the name of 专讘讬 讬讜讞谞谉 that if someone says before he dies that I don't want this 砖驻讞讛 of mine to work after I die, so what the 讘讬转 讚讬谉 would do is they would force the children to give her a 讙讟 砖讞专讜专. Isn't that a similar case to here? When the guy says before he dies, I don't want my 砖驻讞讛 to work, so that is giving up the monetary value of the 注讘讚, of this 砖驻讞讛, because when he says I don't want her to work, so it's like he is 诪驻拽讬专 her, it's equivalent to him being 诪驻拽讬专 her, to him giving up the ownership over the 砖驻讞讛, because he said I don't want her to work. And nevertheless, the 讚讬谉 was that we force the children to give her a 讙讟 砖讞专讜专. So we see that even though the master died after he was 诪驻拽讬专 her, the children are still able to give her a 讙讟 砖讞专讜专. So how could you, Ameimar, say that if someone is 诪驻拽讬专 his 注讘讚 and he dies, that this 注讘讚 cannot have a 转拽谞讛 because the children do not 讬专砖谉 the 讗讬住讜专 and they cannot give him a 讙讟 砖讞专讜专? So he answered him, 讚专讘 讚讬诪讬 讟注讜转讗 讛讬讗, that the statement of 专讘 讚讬诪讬 in the name of 专讘讬 讬讜讞谞谉 was a mistake, as we said before that 专讘 讗诪讬 and 专讘 讗住讬 asked a 拽砖讬讗 on that statement, and therefore the 讙诪专讗 讟讗拽注 changed the statement, so that shows that the statement was a mistake. So how could you ask me a 拽砖讬讗 from the statement of 专讘 讚讬诪讬 when we said it was a mistake? 讗诪专 诇讬讛, so he said to him, 诪讗讬 讟注讜转讗, what is the mistake? The reason we said before it was a mistake is because 讚诇讗 讗诪专 讘诇砖讜谉 砖讞专讜专, because we do not assume that when the master said, "I don't want her to work," means that he freed her, because he didn't use a 诇砖讜谉 of 砖讞专讜专, a 诇砖讜谉 that implies that he is freeing her. 讛讗 讗诪专, but if he would have said a 诇砖讜谉 讘诇砖讜谉 砖讞专讜专, a 诇砖讜谉 of freeing, 讛讻讬 谞诪讬, it would be true, we would accept 专讘 讚讬诪讬's statement. The reason why we asked a 拽砖讬讗 on 专讘 讚讬诪讬 was, as the 讙诪专讗 said before, that 讗讬 讗转 诪讜讚讛 砖讘谞讬讛 注讘讚讬诐, that since her children are 注讘讚讬诐, in other words, she was not freed at all, so why should we force the children to free her? And that's why we said that 专讘 讚讬诪讬's statement was wrong. But if he would have used The father would have used a 诇砖讜谉 of freedom, if he would have said clearly, "I am 诪讬讬讗砖 from my 注讘讚," or "I am 诪驻拽讬专 my 注讘讚," the truth would be we would accept 专讘 讚讬诪讬's statement, and we would force the children to free this 注讘讚. So, if so, how could you say that if a person is 诪驻拽讬专 his 注讘讚 and then he dies, we cannot tell the children to give him a 砖讟专 砖讞专讜专, because the children do not 讬专砖谉 the 讗讬住讜专, when over there it seems that the children could give a 砖讟专 砖讞专讜专? When 专讘 砖诪讜讗诇 讘专 讬讛讜讚讛 came, he gave over another statement in the name of 专讘讬 讬讜讞谞谉, different than what 专讘 讚讬诪讬 said. In other words, I hold that 专讘 讚讬诪讬's statement was never true, and not that the 拽砖讬讗 was on 专讘

Rav Dimi vs Rav Yochanan on freeing a slave

讚讬诪讬's statement because, as we said before, because why should we force the children, after all, she still is a 砖驻讞讛? But I hold 讘讻诇诇 that 专讘讬 讬讜讞谞谉 never said that statement, that 讚讬谉, that 专讘 讗诪讬 and 专讘 讗住讬 never asked the 拽砖讬讗 of 讗讬 讗转 诪讜讚讛 砖讘谞讬讛 注讘讚讬诐. I hold 诇讻转讞讬诇讛 that 专讘讬 讬讜讞谞谉 only said the second case, like 专讘 砖诪讜讗诇 讘专 讬讛讜讚讛 said, that if he says, "I want you to satisfy my 砖驻讞讛," then we force him to free her if the only way she is satisfied is by freedom. So according to that, you have no 拽砖讬讗 on me. There is no statement of 专讘讬 讬讜讞谞谉 that says that if a person is 诪驻拽讬专 his 注讘讚 and dies, that the children could give a 砖讟专 砖讞专讜专. Then the 讙诪专讗 continues, 讛讛讜讗 讚住拽专转讗 讚注讘讚讬, there was this whole city of 注讘讚讬诐 讚讗讬讝讚讘谞讜 诇注讻讜"诐, that they were sold to 讙讜讬诐. 讻诇讜 诪专讜讜转讗 讘转专讗讬, then the second masters, the 讙讜讬讬砖注 masters, died. 讗转讜 诇拽诪讬讛 讚专讘讬谞讗, so they came to 专讘讬谞讗, they wanted 专讘讬谞讗 to be 诪转讬专 them to marry a Jewish woman. Since their original Jewish masters sold them, so to if they freed them, and their 讙讜讬讬砖注 masters now died, they came to 专讘讬谞讗 that he should be 诪转讬专 them to marry 讘谞讜转 讞讜专讬谉, regular Jewish women. 讗诪专 诇讛讜, 专讘讬谞讗 said to them, 讝讬诇讜, go, 讗讛讚专讜, look, find, 讗讘谞讬 诪专讜讜转讬讬讻讜 拽诪讗讬, the children of your original masters, 讜讬讻转讘讜 诇讻讜, and they should write for you 讙讬讟讗 讚讞讬专讜转讗, a 砖讟专 砖讞专讜专. In other words, he told them that in order for you to be able to marry Jewish women, you still need a 砖讟专 砖讞专讜专. So therefore, go find the children of your original masters as 讬讜专砖讬诐, and let them write for you 砖讟专 砖讞专讜专.

Debate on whether children can issue a shichur document

讗诪专讜 诇讬讛 专讘谞谉 诇专讘讬谞讗, so the 专讘谞谉 said to 专讘讬谞讗, 讜讛讗 讗诪专 讗诪讬诪专, but didn't 讗诪讬诪专 say, 讛诪驻拽讬专 注讘讚讜 讜诪转, if someone is 诪驻拽讬专 his 注讘讚 and dies, 讗讜转讜 讛注讘讚 讗讬谉 诇讜 转拽谞讛, that 注讘讚 has no 转拽谞讛, in other words, a 砖讟专 砖讞专讜专 wouldn't help, you can't give him a 砖讟专 砖讞专讜专, and this was the exact same case. The original masters sold them to the 讙讜讬诐, that's similar to being 诪驻拽讬专, they gave up their ownership, but they weren't 诪砖讞专专 them. Now, you tell them that they should find the children of their original masters, and they should give them a 讙讟 砖讞专讜专. What did the children of the original masters 讬专砖谉? Only the 讗讬住讜专, and 讗诪讬诪专 said in a case like this, the children cannot give a 砖讟专 砖讞专讜专. 讗诪专 诇讛讜, so he said to them, 讗谞讗 讻专讘 讚讬诪讬 住讘讬专讗 诇讬. I hold like 专讘 讚讬诪讬. And what did 专讘 讚讬诪讬 say? That in the case of a person who says that "I don't want my 砖驻讞讛 to work after I die," so we force the children to give her a 砖讟专 砖讞专讜专, and even though when he said "I don't want my 砖驻讞讛 to work," that is similar to giving up ownership, and nevertheless, if 专讘 讚讬诪讬 said in the name of 专讘讬 讬讜讞谞谉 that the children could give her a 讙讟 砖讞专讜专, and that's the way I hold, and therefore I hold here too, that the children of their original masters could give these 注讘讚讬诐 a 砖讟专 砖讞专讜专, and then they would be able to marry 讘谞讜转 讞讜专讬谉. 讗诪专讜 诇讬讛, so they said to him, 讜讛讗 讚专讘 讚讬诪讬 讟注讜转讗 讛讬讗, isn't 专讘 讚讬诪讬's statement a mistake, as we said before? 讗诪专 诇讛讜, he said to them, 诪讗讬 讟注讜转讗, what is the mistake? What was the reason why we thought it was a mistake? Because 讚诇讗 讗诪专 讘诇砖讜谉 砖讞专讜专, because when the father said, "I don't want her to be 诪砖讜注讘讚, I don't want her to work," that is not a 诇砖讜谉 诇砖讜谉 of freedom. 讛讗 讗诪专讛 讘诇砖讜谉 砖讞专讜专, but if he would have said it in a 诇砖讜谉 which would show that he is 诪砖讞专专 her, 讛讻讗 谞诪讬 would be true, we would accept 专讘 讚讬诪讬's statement, and we would force the children to give her a 讙讟 砖讞专讜专. So that shows that we do not 驻住拽谉 like 讗诪讬诪专, because according to 讗诪讬诪专, in a case like that, even if the father would have used a 诇砖讜谉 砖讞专讜专, still we couldn't have forced the children to give her a 讙讟 砖讞专讜专, because the children's 砖讞专讜专 would not help, according to 讗诪讬诪专. And since we say that the children's 砖讞专讜专 would help, the only reason we don't accept 专讘 讚讬诪讬's statement is because the father did not use a 诇砖讜谉 砖讞专讜专, but otherwise we would accept the 讚讬谉, that we tell the children, the 讬讜专砖讬诐, to give her a 讙讟 砖讞专讜专, so that shows that we don't 驻住拽谉 like 讗诪讬诪专, and we 驻住拽谉 that you could give over the 讗讬住讜专 to the children, and the children's 砖讞专讜专 would help. And the 讙诪专讗 says, 讜讛诇讻转讗 讻专讘讬谞讗. The 讛诇讻讛 is like 专讘讬谞讗, that in a case like that, the children could give a 讙讟 砖讞专讜专. Then the 讙诪专讗 continues,

Half鈥憇lave, half鈥慺ree case and forced emancipation

讛讛讜讗 注讘讚讗, there was this 注讘讚, 讚讘讬 转专讬, he belonged to two people, two partners owned this 注讘讚. 拽诐 讞讚 诪讬谞讬讬讛讜 讜砖讞专专讬讛 诇驻诇讙讬讛. So one of the two partners got up and he freed his half. 讗诪专 讗讬讚讱, so the other partner said, 讛砖转讗, now, 砖诪注讬 讘讬 专讘谞谉, the 专讘谞谉 are going to hear what happened, 讜诪驻住讚讬 诇讬 诪讬谞讗讬, they're going to make me lose this 注讘讚. Because the 讚讬谉 is, as the 诪砖谞讛 says later on 讚祝 诪状讗, that if an 注讘讚 is a 讞爪讬 注讘讚 讜讞爪讬 讘谉 讞讜专讬谉, he's half 注讘讚 and half 讘谉 讞讜专讬谉, so since we have a problem here, that he cannot marry, not a 讘转 讞讜专讬谉 and not a 砖驻讞讛, and the 转讜专讛 wants everyone to marry, so therefore, what is the 讚讬谉? 讻讜驻讬谉 讗转 专讘讜 讜注讜砖讛 讗讜转讜 讘谉 讞讜专讬谉. We force his master and he has to turn him into a 讘谉 讞讜专讬谉, he has to give him a 砖讟专 砖讞专讜专. The only thing is, we force the 注讘讚 to write a 砖讟专 to his master that he owes him the money that he was worth. Since we forced the master to free him, so the master had a loss of the worth of a half of an 注讘讚, so that money is owed to the master by the 注讘讚 himself who was freed. So therefore, the 注讘讚 writes a 砖讟专, and he owes him that money. So this person here, when his partner freed his 讞诇拽, his part, so now the 注讘讚 that he owned was a half a 注讘讚 that belonged to him and half a 讘谉 讞讜专讬谉. So he said, "I'm sure when the 讞讻诪讬诐 will find out what happened, they're going to force me to be 诪砖讞专专 my part, and turn him into a 讘谉 讞讜专讬谉." So what did he do? 讗讝诇, he went, 讗拽谞讬讛 诇讘谞讜 拽讟谉. He was 诪拽谞讛, he gave him away to his son who was still a 拽讟谉, who was still under 讘专 诪爪讜讛. And the 讚讬谉 is that a child under 讘专 诪爪讜讛 can be 拽讜谞讛, can acquire objects. And a 拽讟谉 cannot be forced by 讘讬转 讚讬谉 to do anything. So he thought he's going to give him away to his 拽讟谉, so now the 拽讟谉 is the master, a 拽讟谉 cannot be forced by 讘讬转 讚讬谉, so 讘讬转 讚讬谉 cannot force him to free the 注讘讚, and that's how he's not going to lose that 注讘讚. 砖诇讞讛 专讘 讬讜住祝 讘专讬讛 讚专讘讗 诇拽诪讬讛 讚专讘 驻驻讗. So 专讘 讬讜住祝 讘专讬讛 讚专讘讗 sent this 砖讗诇讛 to 专讘 驻驻讗 asking him what could be done here.

Appointing a guardian to free a slave owned by a minor

砖诇讞 诇讬讛, he sent him back, 讻讗砖专 注砖讛 讻谉 讬注砖讛 诇讜, 讙诪讜诇讜 讬讜砖讘 诇讜 讘专讗砖讜, which means, "as he has done, so it should be done to him; his dealing shall return upon his own head." And this is based on a 驻住讜拽 in 注讜讘讚讬讛, this expression. But what he meant was that there is something that could be done to him, that we should get the 注讘讚 away from him. Because 讗谞谉 拽讬诐 诇谉 讘讬谞讜拽讗 讚诪拽专讘讗 讚注转讬讛 诇讙讘讬 讝讜讝讬. We know that a child is very fond of money, his mind is close to money. So what should we do? 诪讜拽诪讬谞谉 诇讬讛 讗驻讜讟专讜驻讗. Let's appoint a guardian to this 拽讟谉, since this 拽讟谉 owns an 注讘讚, owns property, so we, the 讘讬转 讚讬谉, will appoint a guardian, an 讗驻讜讟专讜驻讜住, to this 注讘讚, 讜诪拽专拽砖 诇讬讛 讝讜讝讬, and the 注讘讚 should rattle some coins in front of the 拽讟谉. And the 拽讟谉 would definitely want the coins, so that's how the 拽讟谉 would agree that his 注讘讚 should be freed for those few coins. 讜讻转讘 诇讬讛 讙讬讟讗 讚讞讬专讜转讗 讗砖诪讬讛, and the 讗驻讜讟专讜驻讜住, the guardian, will write a 砖讟专 砖讞专讜专 for the 注讘讚 under the name of the 拽讟谉. And this is the only way it could be done. For the 讗驻讜讟专讜驻讜住 himself to write a 砖讟专 砖讞专讜专, he can't, as the 讙诪专讗 says later on in 讚祝 诪状讘 注诪讜讚 讗壮, the 讗驻讜讟专讜驻讜住 has no right to do a thing like that. To force the 拽讟谉 to write a 砖讟专 砖讞专讜专, we can't either. The only thing we could do is have the money rattled in front of the 拽讟谉, and the 拽讟谉 would agree to give the 砖讞专讜专, and then the 讗驻讜讟专讜驻讜住 would write a 砖讟专 砖讞专讜专 for the 拽讟谉. Now, the question that one could ask: why appoint an 讗驻讜讟专讜驻讜住 to begin with? Why can't we do it directly with the 拽讟谉? Let the 注讘讚 rattle money in front of the 拽讟谉, and let the 拽讟谉 then agree to be 诪砖讞专专 the 注讘讚, and let somebody write a 砖讟专 砖讞专讜专 under the name of the 拽讟谉? So 专砖状讬 explains, since the 讚讬谉 in this case is So a 讘讬转 讚讬谉 has to appoint an 讗驻讜讟专讜驻讜住 and he will evaluate the 注讘讚, and he will say exactly how much the 注讘讚 is worth, and we would know how much money to write into that 砖讟专, and that same 讗驻讜讟专讜驻讜住 would be the one to write the 砖讟专 砖讞专讜专 for the 注讘讚 on the name of the 拽讟谉. Then the 讙诪专讗 continues,

Written versus oral statements for emancipation and kinyan of land

转谞讜 专讘谞谉, and the 专讘谞谉 learned, 讛讗讜诪专, if someone says 注砖讬转讬 驻诇讜谞讬 注讘讚讬 讘谉 讞讜专讬谉, that I made my 注讘讚 so-and-so a 讘谉 讞讜专讬谉, a free person, or he said a 诇砖讜谉 注砖讜讬 讘谉 讞讜专讬谉, my 注讘讚 so-and-so is made a 讘谉 讞讜专讬谉, or he says a 诇砖讜谉 讛专讬 讛讜讗 讘谉 讞讜专讬谉, that he is a 讘谉 讞讜专讬谉, so in all these expressions the 讚讬谉 is 讛专讬 讛讜讗 讘谉 讞讜专讬谉, that he is a 讘谉 讞讜专讬谉. But if he says 讗注砖谞讜 讘谉 讞讜专讬谉, I will make him into a free person, so 专讘讬 讗讜诪专, 专讘讬 says 拽谞讛, he is 拽讜谞讛. In other words, that 诇砖讜谉 is a 诇砖讜谉 which is valid and he does become a 讘谉 讞讜专讬谉. 讜讞讻诪讬诐 讗讜诪专讬诐, but the 讞讻诪讬诐 say 诇讗 拽谞讛, he is not 拽讜谞讛. Because when he said, "I will make him into a 讘谉 讞讜专讬谉," what he meant was not that he is a 讘谉 讞讜专讬谉 now, not that I'm making him a 讘谉 讞讜专讬谉 now, it is just like a promise or a statement that in the future I will make him a 讘谉 讞讜专讬谉, I will give him a 砖讟专 later on to make him a 讘谉 讞讜专讬谉. So in the meantime he's still not a 讘谉 讞讜专讬谉 till he is 诪砖讞专专 him later. And the 讙诪专讗 says 讗诪专 专讘讬 讬讜讞谞谉, but 专讘讬 讬讜讞谞谉 said, 讜讻讜诇谉 讘砖讟专, that all these cases, when we said that these are expressions that are valid, it's only if it was written in a 砖讟专. By just saying these words is not sufficient. If he writes this these expressions in a 砖讟专, so then that 砖讟专 is a 砖讟专 砖讞专讜专. Then the 讙诪专讗 continues, 转谞讜 专讘谞谉, and the 专讘谞谉 learned, 讛讗讜诪专, if someone says 谞转转讬 砖讚讛 驻诇讜谞讬转 诇驻诇讜谞讬, I gave away my field so-and-so to a person so-and-so, or he said a 诇砖讜谉 谞转讜谞讛 诇驻诇讜谞讬, it is given away to Mr. So-and-so, or he says 讛专讬 讛讬讗 砖诇讜, it is his, so all these expressions are valid and 讛专讬 讛讬讗 砖诇讜, it is his. But if he says 讗转谞谞讛 诇驻诇讜谞讬, I will give it to somebody, to this and this person, so here 专讘 诪讗讬专, 诪讗讬专 讗讜诪专, 诪讗讬专 says, and according to the 讙讬专住讗 of the 讘状讞, it's supposed to say 专讘讬 讗讜诪专, 拽谞讛, that he is 拽讜谞讛. But even when he says I will give it, that is a 拽谞讬谉 in itself, that is a form of 诪转谞讛, a form of giving a present. But 讜讞讻诪讬诐 讗讜诪专讬诐, the 讞讻诪讬诐 say 诇讗 拽谞讛, he is not 拽讜谞讛, and the same reason as before, because he does not say I am giving him this as a present, it's like a promise that he will give him later a present. So later on, he has to give it to him as a present if he wants to. But if he doesn't do it later, just from the statement that he said now, he is still not 拽讜谞讛 that 砖讚讛. 讗诪专 专讘讬 讬讜讞谞谉, here too 专讘讬 讬讜讞谞谉 said, 讜讻讜诇谉 讘砖讟专. But all these expressions that we said before that are valid, that if he uses those expressions, that person gets the field, it's only if it was written in a 砖讟专. But if he just said it 讘注诇 驻讛, orally, that is not sufficient and the person is not 拽讜谞讛 the 砖讚讛, the field. And as 专砖状讬 explains in both cases, in the case of the 注讘讚 and in the case of the 砖讚讛, that the reason why it has to be written in a 砖讟专, but orally it would not be enough, is because a person cannot be 拽讜谞讛 anything or 拽讜谞讛 himself just by words of his master or words of the other person. It has to be through a 拽谞讬谉. In the case of 注讘讚 it could be through 讻住祝 if the 注讘讚 pays for his freedom, or if the 注讘讚 is 拽讜谞讛 something of his master and through that, through the 拽谞讬谉 讞诇讬驻讬谉 he would be 拽讜谞讛 himself, as the 讙诪专讗 tells a story earlier of this person who threw a hat to his 砖驻讞讛 and said to her, "Be 拽讜谞讛 my hat and through that be 拽讜谞讛 yourself," that would be valid. Or another case, if a person before he died said that "I want to free my 注讘讚," so that's an exception to the 讚讬谉, that 讚讘专讬 砖讻讬讘 诪专注 讻讻转讜讘讬谉 讜讻诪住讜专讬谉 讚诪讜, that the words of a person who is dying is as if a 拽谞讬谉 was made, and therefore that would be enough and the 注讘讚 would be free. But otherwise, just by saying to an 注讘讚, "You are free," the 注讘讚 doesn't become free. And therefore, all those expressions that the 讙诪专讗 says before that are valid to free the 注讘讚, they must be written in a 砖讟专. And the same thing with a 砖讚讛. A person cannot be 拽讜谞讛 a 砖讚讛 just by someone else saying, "I gave you the 砖讚讛 as a present," there has to be some kind of 拽谞讬谉, and therefore the 讙诪专讗 says if he writes it in a 砖讟专, that 砖讟专 is the 拽谞讬谉, and therefore the person is 拽讜谞讛 the field. But otherwise, just by saying it, he cannot be 拽讜谞讛. But 专砖状讬 brings that there were others that learned a different 驻砖讟 in the 讙诪专讗. They learned that when the 讙诪专讗 uses these expressions, it does not mean that these expressions have to be written in a 砖讟专. If they are said orally, it is sufficient. But when the 讙诪专讗 says 讚讻讜诇诐 讘砖讟专, what it means is that in addition to him saying these expressions and being valid, and the 注讘讚 becomes free through these expressions, and the other person gets the field through these expressions, but in addition to that, the 讙诪专讗 says the 注讘讚 must be given a 砖讟专 砖讞专讜专, and the person who gets the field must be given a 砖讟专 for the field. But 专砖状讬 says that that 驻砖讟 is not understood, because 诪诪讬诇讗 by the case of the 注讘讚 we could maybe explain that when the master just uses an expression of 讞讬专讜转, maybe that is enough to show that he gives up his ownership over the 注讘讚, and therefore the 注讘讚 goes out free, just the 讙诪专讗 says he needs a 砖讟专 砖讞专讜专. But in the case of the 砖讚讛, where did we hear such a thing that a person says to somebody, "I am giving you the 砖讚讛," that that automatically should make the 砖讚讛 become his? And even if we'll say that it becomes his for a different reason, because of the rule that 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, that when a person himself admits concerning monetary things that something is not his or that something belongs to someone else, we accept his words as strong as we would accept the words of a hundred witnesses. So in this case too, maybe when he says, "I gave this field away as a present to you," so just that 讛讜讚讗讛, that admittance that he admits, shows that he gave it away, and we accept it, and it belongs to someone else. But that could only be said in the case where he said, "I gave it to you." But we also had a case where he said, "I will give you the field," and according to 专讘讬 诪讗讬专 or according to 专讘讬, that is sufficient. Now how can that be sufficient? That is just a promise that he will give him the field. But it is not a 讛讜讚讗讛, it's not an admittance that the field belongs to the other person. So how can there even be a 住讘专讗 of 专讘讬 or of 专讘讬 诪讗讬专 that that should be sufficient, sufficient? Therefore 专砖状讬 says the 驻砖讟 in the 讙诪专讗 is not that orally it is enough, and the 讙诪专讗 just says that you need a 砖讟专 in addition to the 拽谞讬谉 that was made already by his oral statement. The 驻砖讟 in the 讙诪专讗 is 讜爪专讬讱 砖讟专, that all the 诇砖讜谞讜转, the expressions that we said before are valid, are only valid if they are used in a 砖讟专. By the case of 注讘讚, in a 砖讟专 砖讞专讜专, and by the case of the 砖讚讛, in a 砖讟专 诪转谞讛. Then the 讙诪专讗 continues: 转谞讜 专讘谞谉, the 专讘谞谉 learned, 讛讗讜诪专 if someone says, 注砖讬转讬 驻诇讜谞讬 注讘讚讬 讘谉 讞讜专讬谉, that I made my 注讘讚 so-and-so into a 讘谉 讞讜专讬谉, 讜讛讜讗 讗讜诪专 and the 注讘讚 says, 诇讗 注砖讗谞讬, he did not make me into a 讘谉 讞讜专讬谉, so we say, 讞讬讬砖讬谞谉, we suspect, 砖诪讗 讝讬讻讛 诇讜 注诇 讬讚讬 讗讞专, maybe the master was 诪讝讻讛 the 注讘讚 with a 砖讟专 砖讞专讜专 through someone else. Because the 讚讬谉 is that 讝讜讻讬谉 诇讗讚诐 砖诇讗 讘驻谞讬讜. You could give somebody something which is for his benefit even not in front of him, even if he doesn't even know about it. Since it is a good thing for an 注讘讚 to be free, so therefore it's called a 讝讻讜转. So you're allowed to free your 注讘讚 without even the 注讘讚 knowing about it. What you would have to do is, you would have to take the 砖讟专 砖讞专讜专, give it to somebody else, and tell that somebody else that he should be 讝讜讻讛 in that 砖讟专 砖讞专讜专 for that 注讘讚. And the moment that that person is 讝讜讻讛, is 拽讜谞讛, acquires this 砖讟专 砖讞专讜专, it's as if that moment the 注讘讚 acquired the 砖讟专 砖讞专讜专, and from that moment on, the 注讘讚 becomes free. So that's what the 讙诪专讗 says here: that if the 注讘讚 says he never made me into a 讘谉 讞讜专讬谉, so we don't accept the words of the 注讘讚, we accept the words of his master, because it's possible that the 注讘讚 doesn't even know that his master made him into a 讘谉 讞讜专讬谉. Maybe he was 诪讝讻讛 him the 砖讟专 砖讞专讜专 through someone else. But if the master says, 讻转讘转讬 讜谞转转讬 诇讜, I wrote the 砖讟专 砖讞专讜专 and I gave it to him, 讜讛讜讗 讗讜诪专, and the 注讘讚 himself says, 诇讗 讻转讘 诇讬, he didn't write for me, 讜诇讗 谞转谉 诇讬, he didn't give it to me, so here we say, 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, that if a person himself admits, then it's as strong as a hundred witnesses. So if the 注讘讚 himself admits that he did not get a 砖讟专 砖讞专讜专, so we accept his words. And here we cannot say maybe the master was 诪讝讻讛 him a 砖讟专 through someone else, because the master said, "I gave it to him." And since he denies it, we accept the words of the 注讘讚. Then the 讙诪专讗 says: 讛讗讜诪专 谞转转讬 砖讚讛 驻诇讜谞讬转 诇驻诇讜谞讬, that I gave a certain field to a certain person, 讜讛讜讗 讗讜诪专 and that person says 诇讗 谞转谉 诇讬, he didn't give it to me. 讞讬讬砖讬谞谉, we're afraid, 砖诪讗 讝讬讻讛 诇讜 注诇 讬讚讬 讗讞专, we suspect it maybe he was 诪讝讻讛 him through someone else. The same as we said before, since it is a 讝讻讜转, since it is for the benefit of a person to own a field, and the 讚讬谉 is 讝讻讬谉 诇讗讚诐 砖诇讗 讘驻谞讬讜, you're allowed to be 诪讝讻讛 something to somebody without him even knowing. So maybe the person that gave the field was 诪讝讻讛 this field to the other person through someone else and he doesn't even know about it. So therefore, when he denies that he got the field, we do not accept his words, because we say maybe he doesn't even know that he got this field. But if he says 讻转讘转讬 讜谞转转讬 诇讜, I wrote the 砖讟专 and I gave the 砖讟专 to him, 讜讛讜讗 讗讜诪专, and the other person says 诇讗 讻转讘 讜诇讗 谞转谉 诇讬, he never wrote a 砖讟专 and never gave me the 砖讟专 and the field, so here we say 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, that when the person himself admits, it's like a hundred witnesses. So since he admits that he never got the field, and we can't suspect that maybe it was given to him without him knowing, so therefore we say that the field is not his. But one might ask right away, why do we say this rule of 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬 concerning the receiver? Why don't we say it concerning the giver? We have two people here admitting. The giver admits that the field is not his, it was given away to the other person. The other person, the receiver, admits he never got it. So they're both admitting against owning the field. So why do we say 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬 and we accept the admittance of the receiver, why don't we say the same thing the opposite, that since the giver admits that the field was given to the other person, let's accept his words and let's say it belongs to the other person, not to him? The 转讜住驻讜转 explains because it is more possible that the giver is making a mistake than the receiver is making a mistake. If the receiver says, "I never received the field," then there is no way he made a mistake. If the guy says that "I gave it to you," and he says, "I never got it," so then there is no way he could make a mistake, so probably he is saying the truth. But the giver, it's possible that he made a mistake, because if he says, "I gave it to you," so maybe he gave it through somebody else and he thinks it came to the receiver and really it never came to him, or maybe some other way that the receiver never took it, but he thinks he gave it, so it's more possible that he made a mistake. And therefore But it's impossible that the receiver should make a mistake, so therefore we accept the words of the receiver and we say 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, that when he admits that he never got the field, he is saying the truth and there is no mistake involved, and the field belongs to the other person. Then the

Testimony of giver vs receiver in field transfer

讙诪专讗 asks, 诪讬 讗讜讻诇 驻讬专讜转, who eats the 驻讬专讜转 of this field when the giver says, "I gave it to you," and the receiver says, "I didn't take it, I didn't get it"? So 专讘 讞住讚讗 讗诪专, 谞讜转谉 讗讜讻诇 驻讬专讜转. 专讘 讞住讚讗 says the giver eats the 驻讬专讜转. Since we 驻住拽谉 that we accept the words of the receiver that he never got it, so it is in the ownership of the giver, so he eats the 驻讬专讜转, he eats the fruit of that field. 专讘讛 讗诪专, 专讘讛 says, 诪砖诇砖讬谉 讗转 讛驻讬专讜转. We put the 驻讬专讜转 in the hands of a third party, and as 专砖状讬 says, we leave it there till 讬讘讗 讗诇讬讛讜, which means we leave it there till we find out a hundred percent who is saying the truth. But the 讙诪专讗 says, 讜诇讗 驻诇讬讙讬, really there is no argument between 专讘 讞住讚讗 and 专讘讛. 讛讗 讘讗讘讗, 讛讗 讘讘专讗. That when they say that it's given to the 谞讜转谉 is in the case of the father. Let's say that the person himself that was told that he was given the field, he denies it, so here we say definitely 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, that he is definitely saying the truth. Since he claims he never got it and we accept his words, so the field belongs to the giver, and the giver is the one that eats the 驻讬专讜转, because it's his field. But the other one who said that we leave the 驻讬专讜转 in the hands of a third party is in a case where the one that denying it is not the person himself, but his son. A person says, "I gave the field to a certain person," and that other person is not living anymore, but his 讬讜专砖, his son says that "My father never received it." So here we say maybe he's making a mistake. Maybe he doesn't know all the affairs of his father. So therefore, we cannot 驻住拽谉 a hundred percent that 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, and really it belongs to the 谞讜转谉, to the giver, because maybe the son of the 诪拽讘诇, of the taker, is making a mistake. So in a case like that we say that who eats the 驻讬专讜转? We don't know who's saying the truth, so the 驻讬专讜转 is put into the hands of a third party. And 讘讗诪转, the way 转讜住驻讜转 explains, when the 讙诪专讗 asks the 砖讗诇讛, who eats the 驻讬专讜转, the 讙诪专讗 did not really mean that there is a question who eats the 驻讬专讜转. Since the 讙诪专讗 just 驻住拽谞讚 that 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬 and we accept the words of the 诪拽讘诇, of the receiver, that the field is not his, so the field definitely is the 谞讜转谉's, the one that gave it. So what kind of 砖讗诇讛 does the 讙诪专讗 have who eats the 驻讬专讜转? If the field belongs to the 谞讜转谉, so he eats the 驻讬专讜转. Why should there even be a 住讘专讗 that he shouldn't eat the 驻讬专讜转? So 转讜住驻讜转 says the 讙诪专讗 did not mean to ask it 讘诇砖讜谉 砖讗诇讛, even though that the way the 讙诪专讗 expressed itself, but the 讙诪专讗 really was just trying to explain that after we 驻住拽谉 the 讚讬谉, the 讙诪专讗 explains, so who eats the 驻讬专讜转? So it depends: if the person himself denies it, then the 谞讜转谉 eats the 驻讬专讜转, but if he is not around and his child is the one that denies it, and we are not sure that he knows, and we cannot 驻住拽谉 讛讜讚讗转 讘注诇 讚讬谉 讻诪讗讛 注讚讬诐 讚诪讬, in a case like that, the 驻讬专讜转 would be put in the hands of a third party, and when it's clarified, then it would be given to the one that really owns the field. Going back a little bit in this last 住讜讙讬讗 of the 讙诪专讗, where the 讙诪专讗 said that if the master says, "I freed my 注讘讚," and the 注讘讚 says that he didn't free me, so the 讙诪专讗 says 讞讬讬砖讬谞谉 砖诪讗 讝讬讻讛 诇讜 注诇 讬讚讬 讗讞专. We

When a Master鈥檚 Release Document Is Suspected

suspect that maybe the master was 诪讝讻讛 a 砖讟专 砖讞专讜专 to his 注讘讚 through somebody else. The way the 讙诪专讗 uses the expression is 讞讬讬砖讬谞谉, we suspect maybe he gave him a 砖讟专 砖讞专讜专 through somebody else. Usually, when we have a 诇砖讜谉 讞讬讬砖讬谞谉, that we suspect, it means we're not sure. So in a case like this, it would seem that the 讙诪专讗 is saying that we suspect maybe he gave him a 砖讟专 砖讞专讜专 through somebody else, but maybe not. So therefore, it would remain a 住驻拽. We wouldn't be sure whether he really freed him or he didn't free him. But 转讜住驻讜转 says it's not so. 转讜住驻讜转 says that sometimes the word 讞讬讬砖讬谞谉 means 讜讚讗讬, and here, too, 转讜住驻讜转 says, even though the 讙诪专讗 uses the 诇砖讜谉 讞讬讬砖讬谞谉, we suspect maybe he gave him a 砖讟专 砖讞专讜专 through somebody else, it is definite, and that's the way we accept it, and we 驻住拽谉 that he is a hundred percent 诪砖讜讞专专, he's a hundred percent free. And the 专讗状砖 brings even more 专讗讬讜转 than 转讜住驻讜转, and also says that even though the 讙诪专讗 uses the 诇砖讜谉 讞讬讬砖讬谞谉, really it means that we are definite that he gave him a 砖讟专 砖讞专讜专 注诇 讬讚讬 讗讞专, and he is free. But the 诪讛专砖状讗 asks a 拽砖讬讗 on 转讜住驻讜转 and on the 专讗状砖: why do we say that? What forces 转讜住驻讜转 and the 专讗状砖 to say that this 讙诪专讗 doesn't mean it's a 住驻拽, but means it's a 讜讚讗讬? Maybe the 驻砖讟 in the 讙诪专讗 is that we suspect maybe he gave him a 砖讟专 砖讞专讜专 through somebody else, and therefore we are not sure that he is not 诪砖讜讞专专. So the 讚讬谉 would be we'd have to go 诇讞讜诪专讗: he would automatically become a 讞讬讬讘 讘诪爪讜转, like a regular Jew, because maybe he did get a 砖讟专 砖讞专讜专. On the other hand, he wouldn't be able to marry a 讘转 讞讜专讬谉 because maybe he didn't get a 砖讟专 砖讞专讜专 注诇 讬讚讬 讗讞专, maybe his master is lying. What forced 转讜住驻讜转 and the 专讗状砖 to say that in this 讙诪专讗 it means 讜讚讗讬? And the 拽专谞讬 专讗诐 brings right away on the 诪讛专砖状讗 from the 专砖讘状讗, that the 专砖讘状讗 quotes a 转讜住驻转讗, where in 转讜住驻转讗 the 诇砖讜谉 is a little bit different. It says in 转讜住驻转讗 like this: 讛讗讜诪专 谞转转讬 砖讚讛 诇驻诇讜谞讬, a person says, "I gave a certain field to a certain person," 讜讛讜讗 讗讜诪专, and the person who received the field says 诇讗 谞转谉 诇讬, "He didn't give me," 诇讗 讗诪专 讻诇讜诐, the receiver didn't say anything, we do not accept his words, 砖诪讗 讝讬讻讛 诇讜 注诇 讬讚讬 讗讞专, maybe the other person was 诪讝讻讛 him the field through somebody else. And here we see clearly that even though the 转讜住驻转讗 uses the 诇砖讜谉 砖诪讗 讝讬讻讛 诇讜 注诇 讬讚讬 讗讞专, maybe he was 诪讝讻讛 him through somebody else, nevertheless, the 驻住拽 in 转讜住驻转讗 is 诇讗 讗诪专 讻诇讜诐, that the words of the receiver are nothing, we don't accept it at all, that we say definitely that the receiver is not saying the truth, and he did get the field. Now, just like the 转讜住驻转讗 says it concerning the field, the same 讚讬谉 would apply concerning the 注讘讚, because the two 讚讬谞讬诐 go together. So in the case of the 注讘讚 would be the same, that if the 注讘讚 says that, "I was not freed," 诇讗 讗诪专 讻诇讜诐, he didn't say anything, which means that it is definite that he is a 诪砖讜讞专专, he is free. And that forces 转讜住驻讜转 and the 专讗状砖 to say that when the 讙诪专讗 says 讞讬讬砖讬谞谉, maybe he was 诪讝讻讛 him 注诇 讬讚讬 讗讞专, it is not only a 讞砖砖, we only suspect it, but we accept it as a 讜讚讗讬, as a definite thing, and he is definitely 诪砖讜讞专专. On the other hand, the 拽专谞讬 专讗诐 brings that according to the 专状谉, we do not say that, because the 专状谉 says clearly on this 讙诪专讗 that when the 讙诪专讗 says that we suspect maybe he was 诪讝讻讛 him a 砖讟专 砖讞专讜专 through somebody else, so the 专状谉 says therefore he is 讞讬讬讘 讘诪爪讜转, he has to do all the 诪爪讜转, but on the other hand, the 专状谉 says, if he wants to marry a 讘转 讞讜专讬谉, he would have to get a 砖讟专 砖讞专讜专. So we see that the 专状谉 learns it's only a 讞砖砖 that he got a 砖讟专 注诇 讬讚讬 讗讞专, but it is not 讜讚讗讬. And then, the

Rif鈥檚 Theory on Deeds and Effective Ownership

拽专谞讬 专讗诐 adds even more: there is this famous 砖讬讟讛 of the 专讬状祝, that when we say a 讻诇诇 讝讻讬谉 诇讗讚诐 砖诇讗 讘驻谞讬讜, that you could be 诪讝讻讛 somebody without him even knowing about it, so the 专讬状祝 learns that it is only concerning 讞专讟讛, that it is valid enough that you can't change your mind, but it still does not take effect till actually it gets to that person. And that same thing would be by a 砖讟专 砖讞专讜专, that even though you're allowed to be 诪讝讻讛 a 砖讟专 砖讞专讜专 for an 注讘讚 to somebody else, all it means is that the master cannot have 讞专讟讛 after he gave the 砖讟专 砖讞专讜专 to the other party, even before it got to the hands of the 注讘讚. But the 注讘讚 is not 诪砖讜讞专专, doesn't become free, till after the 讙讟 reaches his hand. So in this case here, where the 注讘讚 claims that he definitely didn't get the 砖讟专 砖讞专讜专, and the 讙诪专讗 says that we suspect that maybe he was 诪讝讻讛 him the 砖讟专 砖讞专讜专 through somebody else, still he is definitely 讗住讜专 to marry a 讘转 讞讜专讬谉 according to the 专讬状祝, because he is still not 诪砖讜讞专专, because the 砖讟专 never reached his hand. But anyway, the 拽谞讛 讚专讗状诐 says that many, many 专讗砖讜谞讬诐 argue on the 砖讬讟讛 of the 专讬状祝. Another interesting discussion here in the 讙诪专讗 is concerning the earlier 讙诪专讗, where it says by the 拽讟谉, that that 注讘讚 that was a 讞爪讬 注讘讚 讞爪讬 讘谉 讞讜专讬谉, and his master was afraid that the 讞讻诪讬诐 would force him to free him, so he was 诪拽谞讛 his 注讘讚 to his son, the 拽讟谉, and 专讘 驻驻讗 驻住拽谞讟 that they should appoint an 讗驻讜讟专讜驻讜住 for this 拽讟谉, and the 注讘讚 should rattle some money in front of the 拽讟谉, and the 讗驻讜讟专讜驻讜住 would write a 砖讟专 砖讞专讜专 to the 注讘讚 注诇 砖诪讬讛, on the name of the 拽讟谉. So concerning that piece of 讙诪专讗, there is a 诪讞诇讜拽转 between 专砖状讬 and 转讜住驻讜转. The

Minor鈥檚 Guardian Frees a Slave: Rashi vs. Tosafot

way it seems from 专砖状讬 is that when the 砖讟专 砖讞专讜专 would be written by the 讗驻讜讟专讜驻讜住, it would be written on the name of the 拽讟谉. In other words, the 拽讟谉 would be the one that would free this 注讘讚. But since the 拽讟谉 cannot be forced to do it, so the way that would be done is through the 注讘讚 enticing the 拽讟谉 by rattling the money, but the 讗驻讜讟专讜驻讜住 would write the 砖讟专 on the name of the 拽讟谉. But 专讘讬谞讜 砖诪讜讗诇, 转讜住驻讜转 says, does not accept that 驻砖讟, because he says that 诪注砖讛 拽讟谉 doesn't mean anything. A 拽讟谉 cannot free an 注讘讚. So how can the 讙诪专讗 say here that the 拽讟谉's name would be on the 砖讟专, in other words, the 拽讟谉 would be the one to free the 注讘讚? Just like we find by the case of a 讬讘诪讛, that a 拽讟谉 cannot divorce his 讬讘诪讛, cannot give her a 讙讟 until he becomes a 讙讚讜诇, because the 诪注砖讛 拽讟谉, the actions of a 拽讟谉 are not valid, the same here, the actions of this 拽讟谉 to free the 注讘讚 would not be valid. So how can we say that the 砖讟专 砖讞专讜专 would be written on the name of the 拽讟谉? And even though the 讙诪专讗 does say that children from six and seven years old, their sale is valid, if it is concerning 诪讟诇讟诇讬谉, concerning movable objects, so we see that a 诪注砖讛 of a 拽讟谉 is valid? So he says, that's only concerning monetary things, because the 讚讬谉 is that 讛驻拽专 讘讬转 讚讬谉 讛驻拽专, that when it comes to monetary things, 讘讬转 讚讬谉 has the control over the money of a person, so if the 讘讬转 讚讬谉 decides that the sale of a 拽讟谉 should be a sale, then it's valid. But when it comes to 讗讬住讜专讬谉, to things which are more than just money, but questions of 讗讬住讜专讬谉, here the 诪注砖讛 of a 拽讟谉 is not valid. So in the case of a 砖讟专 砖讞专讜专, which is not just a question of money, but it's a question of 讗讬住讜专 too, so the 诪注砖讛 of a 拽讟谉 is nothing. So how can a 拽讟谉 give a 砖讟专 砖讞专讜专? And therefore, he explains the 驻砖讟 in the 讙诪专讗 different: that the 砖讟专 砖讞专讜专 was written on his name, meaning on the name of the 讗驻讜讟专讜驻讜住. And even though we know that the 讚讬谉 is that the 讗驻讜讟专讜驻住讬谉 have no right to free an 注讘讚, if a 拽讟谉 owns property, and amongst his estate we also have 注讘讚讬诐, and there is an 讗驻讜讟专讜驻讜住 appointed to take care of the estate of the 拽讟谉, the 讗驻讜讟专讜驻讜住 has no right to free the 注讘讚讬诐, so how can we say here that the 讗驻讜讟专讜驻讜住 has a right to free the 注讘讚讬诐? So 转讜住驻讜转 explains that in this case, since there was something wrong done here, the father was 诪拽谞讛 the 注讘讚 to the 拽讟谉 砖诇讗 讻讛讜讙谉, not properly, not the right way, so the 讞讻诪讬诐 were 诪驻拽讬专 the 注讘讚, have the control over the 注讘讚, and took away the 注讘讚 from this 拽讟谉, and they made it as if the 注讘讚 belongs to the 讗驻讜讟专讜驻讜住, and in a case like that, the 讗驻讜讟专讜驻讜住 himself has a right to free the 注讘讚. And we find another case similar to this, 转讜住驻讜转 says, we find regarding the 讚讬谉 of 转专讜诪讛 讜诪注砖专. The 讚讬谉 is that in order to take off 转专讜诪讛, you must appoint a 砖诇讬讞, or you do it yourself or you appoint a 砖诇讬讞. But if there are 拽讟谞讬诐 that own 转讘讜讗讛, own grain, the 讗驻讜讟专讜驻住讬谉 cannot take off 转专讜诪讛 讜诪注砖专, because we learn it out from a 驻住讜拽: 讗转诐, the 转讜专讛 says, you should do it yourself, and we learn out: 讗转诐 讜诇讗 讗驻讜讟专讜驻住讬谉, that a guardian of the 拽讟谉 cannot take off 转专讜诪讛 or 诪注砖专 for the sake of the 拽讟谉. Nevertheless, the 讞讻诪讬诐 said that an 讗驻讜讟专讜驻讜住 should take off 转专讜诪讛 讜诪注砖专. But the question is, how can an 讗驻讜讟专讜驻讜住 take off when the 讚讬谉 is that he's not allowed? And the answer is, because the 讞讻诪讬诐 saw that otherwise it would remain 讟讘诇, the grain, the 转讘讜讗讛, the crop would remain 讟讘诇 without 转专讜诪讛 讜诪注砖专, and you're not allowed to eat 讟讘诇. So what they said was that we are 诪驻拽讬专 the 转讘讜讗讛, we take away the ownership of the 转讘讜讗讛 from the 拽讟谞讬诐, and we give give it over to the 讗驻讜讟专讜驻讜住, and it's as if the 讗驻讜讟专讜驻讜住 owns the 转讘讜讗讛, and therefore, the 讗驻讜讟专讜驻讜住 is allowed to take off 转专讜诪讛 讜诪注砖专 in order it shouldn't remain 讟讘诇. And the same thing here too: in order to be able to free this 注讘讚, the 讞讻诪讬诐 拽谞住ed this person who did this 讚讘专 砖诇讗 讻讛讜讙谉, who did this wrong thing of giving it away to the 拽讟谉, and they, so to speak, took away the 注讘讚 from the ownership of the 拽讟谉, and they gave it over to the 讗驻讜讟专讜驻讜住, so now the 讗驻讜讟专讜驻讜住 has the right to free this 注讘讚. But if so, one might ask: so why do they have to go through the whole thing of having to rattle money in front of the 拽讟谉? They should have forgotten about the 拽讟谉, they should have just appointed an 讗驻讜讟专讜驻讜住, and automatically the 注讘讚 is now owned by the 讗驻讜讟专讜驻讜住, and the 讗驻讜讟专讜驻讜住 would free him. But because the 拽讟谉 did not want the 注讘讚 to be freed, so the 讞讻诪讬诐 did not want to have the 讗驻讜讟专讜驻讜住 free the 注讘讚 against the will of the 拽讟谉. So therefore they said that they should rattle the money in front of the 拽讟谉, so the 拽讟谉 would agree to this transaction, and then the 讗驻讜讟专讜驻讜住 would be the one to free the 注讘讚 on his name. But the

Rabbeinu Tam鈥檚 View: Selling a Slave as Freedom

专讘讬谞讜 转诐 doesn't accept this 驻砖讟 either. He says if the 驻砖讟 here would be as a 拽谞住, the 讙诪专讗 should have said that since he did something wrong, therefore the 讞讻诪讬诐 拽谞住ed him. So therefore the 专讘讬谞讜 转诐 learns a different 驻砖讟. He says that the 讗驻讜讟专讜驻住讬谉 have no right to free the 注讘讚讬诐, but an 讗驻讜讟专讜驻讜住 has a right to sell the 注讘讚讬诐. And we said before that when you sell the 注讘讚, that is a form of freedom. So what the 讗驻讜讟专讜驻讜住 did here was that he sold the 注讘讚 to himself, and that was a form of freeing the 注讘讚. And 讘讗诪转, they wouldn't need the whole thing of the rattling of the money in front of the 拽讟谉, because the 讗驻讜讟专讜驻讜住 has a right to sell the 注讘讚 himself. But because it would look like a joke that they would be freeing this 注讘讚, and the 拽讟谉 would be screaming, "I don't want to!", so therefore they wanted the 拽讟谉 to agree to what the 讗驻讜讟专讜驻讜住 was doing. And if they wouldn't rattle the money, he would have listened to his father who kept on saying, "Don't allow them to free the 注讘讚!" So they had to do something that the 拽讟谉 should agree to what the 讞讻诪讬诐 wanted, that the 讗驻讜讟专讜驻讜住 should sell the 注讘讚, which was a form of freedom. And 讘讗诪转, according to the 专讘讬谞讜 转诐, he 讟讗拽注 did not even need a 讙讟 砖讞专讜专, because when you sell the 注讘讚 and he buys his own freedom, he doesn't need a 讙讟 砖讞专讜专. It is only 诪讚专讘谞谉 that they said that he needs a 讙讟 砖讞专讜专, because since this was a case where the father did not want to free the 注讘讚, so the father would keep on saying that the 注讘讚 is still mine, and if he would meet the 注讘讚 in the street, he would claim, "You are my 注讘讚!" In order to avoid that, the 讞讻诪讬诐 said, "Let him write a 砖讟专 砖讞专讜专," so the 注讘讚 would have a document to show that he is really freed. But 讘讗诪转, he didn't even need a 砖讟专 砖讞专讜专, because the 讗驻讜讟专讜驻讜住 sold him to himself, and the 讗驻讜讟专讜驻讜住 has a right to do that.
