Today's 砖讬注讜专 will be in 诪住讻转 住谞讛讚专讬谉, 讚祝 讬', but we will start on 讚祝 讟' 注诪讜讚 讘', five lines from the bottom of the 注诪讜讚. 讗诪专 专讘 讬讜住祝, 专讘 讬讜住祝 said: If someone comes to 讘讬转 讚讬谉 and says, 驻诇讜谞讬 专讘注谞讬 诇讗讜谞住讬, that another man had relations with him by force, did the 注讘讬专讛 with him of 诪砖讻讘 讝讻专, but it was done by force, the other person forced him, so 讛讜讗 讜讗讞专 诪爪讟专驻讬谉 诇讛讜专讙讜, so this person and somebody else can be combined, and they can have the other person killed. In other words, he is considered a witness to testify against that person, and if there is another witness with him, together it is considered a group of 注讚讬诐, and they are able to have the other person killed. But if he said it was done 诇专爪讜谞讬, that that person committed this sin with him willingly, he agreed to it, so then, 专砖注 讛讜讗, so then this person is considered a 专砖注, because when a person does this 注讘讬专讛, he's automatically considered a wicked man, a 专砖注. But 转讜专讛, and the 转讜专讛 says, 讗诇 转砖转 专砖注 注讚, you cannot make a 专砖注 into a witness, so therefore his testimony is not accepted, because we do not accept testimony of a 专砖注. And since he admits that he did this 注讘讬专讛, so he admits he is a 专砖注, so we cannot accept his testimony, and therefore he, even if he would be 诪爪讟专祝, combined with another person, cannot be the cause of the other person to get killed because he is not considered a witness. 专讘讗 讗诪专, 专讘讗

Rava on Relatives and Self-Testimony

says, 讗讚诐 拽专讜讘 讗爪诇 注爪诪讜, a person is a relative to himself, and the 讚讬谉 is that a relative is not believed as an 注讚讜转 against a relative of his. So if you cannot testify concerning a relative of yours, you also cannot testify concerning yourself. And therefore, 讜讗讬谉 讗讚诐 诪砖讬诐 注爪诪讜 专砖注, a person cannot make himself into a 专砖注, since he is a relative to himself, so his testimony concerning himself is not accepted. So automatically, he is not considered a 专砖注, because how do we know that he did the 注讘讬专讛? Because he says so, but we do not accept his testimony concerning himself. And therefore, what we do say is that we do accept the testimony that he said concerning the other person. And we call it 驻诇讙讬谞谉 讚讬讘讜专讗, we divide, we separate his words. When he comes and says that that person had relations with him 诇专爪讜谞讬, willingly, so what we say is, we believe him that that person had relations with him, but the fact that he says that it was done with his own will, that we can't believe, because then he is testifying on himself, and a person is not believed to testify on himself. So therefore, we do not accept this testimony on himself, so he is not considered a 专砖注, because we have no testimony that he did an 注讘讬专讛. So then, since he is not a 专砖注, his testimony concerning the other person is accepted. So therefore, we do say that he and somebody else would be able to have that other person killed even if he comes and says that it was done 诇专爪讜谞讜, to his will. Then the 讙诪专讗

Rava on Adultery with One's Wife

says another 讚讬谉: 讗诪专 专讘讗, 专讘讗 said, 驻诇讜谞讬 讘讗 注诇 讗砖转讬, someone comes to 讘讬转 讚讬谉 and says that this and this person had relations with my wife, committed adultery with my wife, 讛讜讗 讜讗讞专 诪爪讟专驻讬谉 诇讛讜专讙讜, that he and if another person will come and testify the same, together they will be combined and they could have that person killed. Since that person committed adultery, he had relations with an 讗砖转 讗讬砖, with a married woman, so he is 讞讬讬讘 诪讬转讛, so the husband of the wife and somebody else together can have him put to death. 讗讘诇 诇讗 诇讛讜专讙讛, but he is not accepted to have her killed, because 诇讻讗讜专讛, according to his testimony, she who is an 讗砖转 讗讬砖, a married woman, also deserves to die, because she also is 讞讬讬讘 诪讬转讛. Nevertheless, we cannot accept his testimony on her, but we do accept his testimony on him. And we say again 驻诇讙讬谞谉 讚讬讘讜专讗, we divide his words, and we say, we believe him that that person committed adultery with an 讗砖转 讗讬砖, with a married woman, but when he says it was done to my wife, that we don't believe, because he is not believed concerning his wife. And the

Gamara Question on Rava's Teaching

讙诪专讗 asks: 诪讗讬 拽讗 诪砖诪注 诇谉? What is 专讘讗 trying to tell us with this 讚讬谉? 讚诪驻诇讙讬谞谉 讚讬讘讜专讗, that we divide his words, that we accept part of what he says and not the other part, we believe him that that person committed adultery, but we don't believe the other half of the statement that it was done with his wife, 讛讬讬谞讜 讛讱! Isn't this the same as the 讚讬谉 he said before? He said that already. In the previous 讚讬谉 he said that if someone comes and says that the other person did an 注讘讬专讛 with me, 诇专爪讜谞讬, willingly, I agreed to it. We say 驻诇讙讬谞谉 讚讬讘讜专讗, and we believe him that that person did the 注讘讬专讛, but we don't believe him it was done with him willingly. So it's self-understood that the same thing would apply here, that concerning his wife we can't believe him because he is a relative of his wife, so he cannot testify for his wife, and nevertheless, we believe him on the first part of the statement that that man did the 注讘讬专讛. So it's the same thing, why did 专讘讗 have to repeat it? And the 讙诪专讗 answers, 诪讛讜 讚转讬诪讗, I would have thought 讗讚诐 拽专讜讘 讗爪诇 注爪诪讜 讗诪专讬谞谉, that a person is a relative to himself we do say, but 讗爪诇 讗砖转讜 诇讗 讗诪专讬谞谉, that a person is considered a relative to his wife we do not say. 拽讗 诪砖诪注 诇谉, and that's what 专讘讗 had to tell us, that even concerning his wife we still say that, and therefore, we do not accept his testimony concerning his wife, and nevertheless, we accept his testimony concerning that person because we say 驻诇讙讬谞谉 讚讬讘讜专讗. And as 转讜住驻讜转 explains that 诇讻讗讜专讛 why should there be a 讛讜讛 讗诪讬谞讗 that a person is not considered a relative to his wife? Isn't there a 诪砖谞讛 in 驻专拽 讝讛 讘讜专专 where it says that 讘注诇 讻讗砖转讜, that concerning testimony, concerning being a witness, a husband is like his wife, and anybody who's a relative to his wife is considered a relative to him and he is 驻住讜诇 to testify for them? So we see that a husband is considered one with his wife, so why should we think here that we do not say a husband is a relative of his wife? So 转讜住驻讜转 and 专讗状砖 explain that we would have thought that when do we say a husband is a relative of his wife? Normally. But in a case of 驻诇讙讬谞谉 讚讬讘讜专讗, in a case where part of his statement is accepted, that there we would think that since we accept it concerning one part we should also accept it concerning his wife. In other words, concerning this 讚讬谉 only we should have not said that 讘注诇 is a 拽专讜讘 to his wife, and therefore 专讘讗 had to tell us that nevertheless we say a husband is a relative to his wife, and we do not accept his testimony concerning his wife, and we do accept his testimony concerning the other person. Then the 讙诪专讗 continues, 讜讗诪专 专讘讗,

Rava on Engaged Girl and Witnesses

also did 专讘讗 say a 讚讬谉, 驻诇讜谞讬 讘讗 注诇 谞注专讛 讛诪讗讜专住讛. If two people come to 讘讬转 讚讬谉 and they testify that this and this person had relations with a 谞注专讛 讛诪讗讜专住讛, with an engaged girl, they didn't say who that girl was, but they knew for sure it was an engaged girl. And at that time when a girl was engaged, she would be considered an 讗砖转 讗讬砖 because the engagement was through 拽讬讚讜砖讬谉, the husband would give her 拽讬讚讜砖讬谉, say 讛专讬 讗转 诪拽讜讚砖转 诇讬, so she would become an 讗砖转 讗讬砖 through the 拽讬讚讜砖讬谉. And even though she was still forbidden to live with her husband till after the 谞讬砖讜讗讬谉, until after the 讞讜驻讛, but nevertheless, she was considered already an 讗砖转 讗讬砖. And therefore, if somebody would be 诪讝谞讛 with this 谞注专讛 讛诪讗讜专住讛, with this engaged girl, he would deserve the death penalty. Another thing that would happen, the girl loses the 讻转讜讘讛. Like this, as soon as she is engaged, she deserves the 讻转讜讘讛. But when we find out that she was 诪讝谞讛, so she loses her 讻转讜讘讛. So here's a case when two witnesses come to 讘讬转 讚讬谉 and say, we know that this and this man had relations with a 谞注专讛 讛诪讗讜专住讛. So what they wanted to do was to have the man killed, not the woman, not the girl because they didn't know who the girl was, but they wanted to have the man killed, plus there would have been a loss of money. 讜讛讜讝诪讜, they became 注讚讬诐 讝讜诪诪讬谉, another group of witnesses came to 讘讬转 讚讬谉 and said that how can you testify that at this and this time, at this and this day, in this and this place you saw him do it, when at that time you were with us someplace else? And the 讚讬谉 by 注讚讬诐 讝讜诪诪讬谉 is that 讜注砖讬转诐 诇讜 讻讗砖专 讝诪诐 诇注砖讜转 诇讗讞讬讜, that you do unto them what they wanted to do to that person. So in this case, they wanted two things to happen: they wanted to have him killed and she to lose the 讻转讜讘讛. So we say 谞讛专讙讬谉, they get killed, since they wanted to have him killed, so you do to them what they wanted to do, but 讜讗讬谉 诪砖诇诪讬谉 诪诪讜谉, but there is no money they pay, even though they wanted to cause a loss of money, they wanted her to lose the 讻转讜讘讛, but nevertheless they don't pay, because since they didn't know who it was, so there was no person that actually would have lost the money, because they didn't specify who the girl was, and therefore, we do not consider it that they wanted somebody to lose money, so there is no 讚讬谉 that they have to lose money. But if they came and said 讘转讜 砖诇 驻诇讜谞讬, that this and this man had relations with the daughter of this and this man, the 谞注专讛 讛诪讗讜专住讛, and they specified which girl it was, 讜讛讜讝诪讜, and they became 注讚讬诐 讝讜诪诪讬谉, 谞讛专讙讬谉, they get killed because they wanted to have them both killed. Now that they also said who she was, she would have gotten killed too if they would have been saying the truth. So now they get killed because they wanted to have the man killed, the man gets they claimed did the 注讘讬专讛 with her, and they wanted to have her killed. 讜诪砖诇诪讬谉 诪诪讜谉, and they also pay money, since they wanted her to lose the 讻转讜讘讛, and there is a person specifically here that they claim should have lost the 讻转讜讘讛, so therefore now they have to pay that amount of money. It doesn't mean that they have to pay the exact amount of the 讻转讜讘讛, but they pay the 讟讜讘转 讛谞讗讛 of the 讻转讜讘讛, because a 讻转讜讘讛 really is paid only if the husband dies or if the husband divorces her, but otherwise the 讻转讜讘讛 is not paid. But nevertheless, there is still a value to the 讻转讜讘讛, because if she would want, she would be able to sell her 讻转讜讘讛, and the price that a person would pay for the 讻转讜讘讛 would be less than the value of the 讻转讜讘讛, because he's taking a risk, because maybe he will eventually get the full amount of the 讻转讜讘讛 if he dies or he divorces her, but maybe he won't get anything if she dies first, then the one that bought the 讻转讜讘讛 gets nothing because there is no 讻转讜讘讛 to be paid. So if somebody buys a 讻转讜讘讛 while she is alive and he is alive and they're not divorced, he is taking a risk, so therefore he would pay less than the value of the 讻转讜讘讛. But nevertheless, there is a value to the 讻转讜讘讛 now. So when these 注讚讬诐 testified that she was 诪讝谞讛, they wanted her to lose that value of the 讻转讜讘讛, so they have to pay that amount. 讗讬讬 we know a 讚讬谉 that if a person is 讞讬讬讘 诪讬转讛, and for the same thing he also is 讞讬讬讘 诪诪讜谉, has to pay money, we say 拽诐 诇讬讛 讘讚专讘讛 诪讬谞讬讛, and we only give him the 诪讬转讛, and he doesn't have to pay the money. So how come here we say that they get killed and they also have to pay? Because it's 诪诪讜谉 诇讝讛 讜谞驻砖讜转 诇讝讛. It is money to one person, the the loss they wanted to cause was to one person, and the death penalty they get is for somebody else. They are killed because they wanted to have the man and the woman killed, so it's because of them that they are 讞讬讬讘 诪讬转讛. The loss of money they wanted to cause was to a third person, that was to the father of this girl, because since this girl is still a 谞注专讛, so any money that she gets goes to her father, so if she would have gotten the 讻转讜讘讛 it would have gone to her father. So at that point, the loss was a loss to her father. And according to this opinion, if the loss of money is to one person, and the reason you are killed is because of somebody else, then we don't say 拽诐 诇讬讛 讘讚专讘讛 诪讬谞讬讛, and you get both. And therefore, these witnesses get both: they get 诪讬转讛, and they have to pay the loss of money. 讗讬讬 one might ask that 诇讻讗讜专讛 this contradicts what the 讙诪专讗 said before, because the 讙诪专讗 said before that 专讘讬 讬讜住祝 said that if the husband brings witnesses that she was 诪讝谞讛 at the time when she was engaged, and then the father brings witnesses and 讛讝讬诐 the witnesses of the husband, so the witnesses of the husband get killed, because they wanted to have her killed, but they don't pay any money. And the reason they don't pay any money, even though they wanted to cause a loss of money, was because we say 拽诐 诇讬讛 讘讚专讘讛 诪讬谞讬讛, they don't get both, they don't get killed and pay money. So we see before that 专讘讬 讬讜住祝 holds that they don't have to pay, and here 专讘讗 says they do have to pay. So it seems like it's a 诪讞诇讜拽转 between 专讘讗 and 专讘讬 讬讜住祝. So 专砖状讬 explains that it's not a 诪讞诇讜拽转, because before, in the case of 专讘讬 讬讜住祝, it wasn't in a case where she was just a 诪讗讜专住转, she was just engaged. When the husband brought the witnesses, it was already after she was already married. Now, in a case like that, the 讻转讜讘讛 goes to her, not to her father. If the husband would have divorced her after already she was married with the 讞讜驻讛, then she would have gotten the money of the 讻转讜讘讛. So the value of the 讻转讜讘讛 is for her. So the loss they wanted to cause was to her. So it comes out that the reason they get killed and the reason they have to pay money is for the same person. The reason they get killed, the 注讚讬诐 讝讜诪诪讬谉, is because they wanted to have her killed. The reason they should have to pay money is because they wanted to have her lose the money. So then it's for the same person 诪讬转讛 and 诪诪讜谉. So that's what 专讘讬 讬讜住祝 said, that they don't have to pay, because we say 拽诐 诇讬讛 讘讚专讘讛 诪讬谞讬讛. But the case of 专讘讗, it's a case where she was still a 谞注专讛 讛诪讗讜专住讛. She was just engaged, and she was a 谞注专讛, so the 讻转讜讘讛 goes to the father. So here, it is 诪讬转讛 for one person, the reason they get killed is because of the man they claimed was 诪讝谞讛 and her, and the reason they have to pay money is because they wanted to cause a loss to the father, that's another person. And in a case like that, we don't say 拽诐 诇讬讛 讘讚专讘讛 诪讬谞讬讛. Then the 讙诪专讗 continues, 讜讗诪专 专讘讗, also did 专讘讗 say: 驻诇讜谞讬 专讘注 讛砖讜专, if two people come to 讘讬转 讚讬谉 and say that this and this person had relations with an ox, and they don't say whose ox it was, 讜讛讜讝诪讜, then they become 注讚讬诐 讝讜诪诪讬谉, 谞讛专讙讬谉, they get killed, because by their testimony they wanted to have that person killed, because the 讚讬谉 is if a person has relations with an animal, he is 讞讬讬讘 诪讬转讛. So they wanted to have that person killed, and now that they are 注讚讬诐 讝讜诪诪讬谉, they have to get killed. 讜讗讬谉 诪砖诇诪讬谉 诪诪讜谉, they don't pay any money, even though they wanted to cause a loss of money, too, because if it would have been true what they have said, then that ox should have been killed, because the 讚讬谉 is that when a person has relations with an animal, the person is killed, and the ox is killed. So then it would have been a loss to the owner of the ox. But still, since they didn't specify whose ox it was, so there is no person, actually, that they caused a loss to, and therefore they don't have to pay. But if they said 砖讜专讜 砖诇 驻诇讜谞讬, that this and this person did an 注讘讬专讛 with the ox that belongs to this and this person, 讜讛讜讝诪讜, they became 注讚讬诐 讝讜诪诪讬谉, 谞讛专讙讬谉 讜诪砖诇诪讬谉 诪诪讜谉, then they get killed and they also pay the money, the loss they wanted to cause to the owner of the ox. Because it's 诪诪讜谉 诇讝讛 讜谞驻砖讜转 诇讝讛, because it is money to one, the loss they wanted to cause was to the person who is the owner of the ox, and the reason they get killed is because of the other person that they claimed did the 注讘讬专讛 with the ox. So therefore there is no 讚讬谉 of 拽诐 诇讬讛 讘讚专讘讛 诪讬谞讬讛. But then the 讙诪专讗 asks, 驻砖讜讟讛 诇诪讛 诇讬, why did 专讘讗 have to tell us this second 讚讬谉 concerning the ox? 讛讬讬谞讜 讛讱, isn't it the same 讚讬谉 as that he said before concerning the 谞注专讛 讛诪讗讜专住讛? And the 讙诪专讗 answers, 诪砖讜诐 讚拽讘注讬 讘注讬讗 诇讬讛, because really there was a question that 专讘讗 had concerning this 讚讬谉. 讚讘注讬 专讘讗, 专讘讗 asked a question: 驻诇讜谞讬 专讘注 砖讜专讬, 诪讛讜? But if someone comes to 讘讬转 讚讬谉, and says that this and this person had relations with my ox, what is the 讚讬谉? Is he believed concerning the ox or not? 诪讬 讗诪专讬谞谉, do we say 讗讚诐 拽专讜讘 讗爪诇 注爪诪讜, a person is considered a relative to himself, and therefore when he says that that person did an 注讘讬专讛 with me, with my 专爪讜谉, willingly, we said before we do not believe him on himself because he's a relative to himself. So he's not believed on himself, and we say 驻诇讙讬谞谉 讚讬讘讜专讗 and he's believed concerning the other person. But 讜讗讚诐 拽专讜讘 讗爪诇 诪诪讜谞讜, but concerning a person's property, we do not consider him a relative, and therefore he is believed even concerning his property. So when he says that that person did an 注讘讬专讛 with my ox, we believe him on the whole statement, and that person would be killed if there is another witness with him, and his ox would be killed. 讗讜 讚讬诇诪讗, or maybe 讗诪专讬谞谉 讗讚诐 拽专讜讘 讗爪诇 诪诪讜谞讜, we do say a person is considered a relative to his property, and therefore he would not be believed concerning the ox, we'd only believe him concerning that person. And therefore, if somebody else would be with him, they would be able to have that person killed, but the ox, he would not believe them. And he says, 讘转专 讚讘注讬, after he asked the question, 讛讚专 驻砖讟讛, then he resolved it, and he came to a conclusion that 讗讚诐 拽专讜讘 讗爪诇 注爪诪讜, a person is considered a relative 诇讙讘讬 himself, 讜讗讬谉 讗讚诐 拽专讜讘 讗爪诇 诪诪讜谞讜, but a person is not considered a relative concerning his property, and therefore he would be believed on his ox. And this answers why 专讘讗 had to also say the 讚讬谉. If two witnesses come and they testify that somebody had relations with the ox and the whole discussion whether they have to pay money too in addition to getting killed or not, because he wanted to continue after that with a question he had, that what happens if he himself says about his ox, is he believed concerning the ox or not? And it came ready to the conclusion that a person is believed on his animal because he is not considered a relative to his property. Then the 讙诪专讗 continues, we learned in the 诪砖谞讛, 诪讻讜转 讘砖诇砖讛, 讜讻讜诇讬, that in order to give a person 诪诇拽讜转, you have to have a 讘讬转 讚讬谉 of three people. And the 讙诪专讗 asks, 诪谞讗 讛谞讬 诪讬诇讬, where do we know that from? From which 驻住讜拽 do we learn this out? 讗诪专 专讘 讛讜谞讗, 专讘 讛讜谞讗 said, 讗诪专 拽专讗, the 驻住讜拽 says, 讜砖驻讟转诐, speaks about 诪诇拽讜转, and it says that they should judge him. When it says they should, automatically, it's 砖谞讬诐, it's two. And since 讜讗讬谉 讘讬转 讚讬谉 砖拽讜诇, you can't have an even 讘讬转 讚讬谉, 诪讜住讬驻讬谉 注诇讬讛谉 注讜讚 讗讞讚, you add one more, 讛专讬 讻讗谉 砖诇砖讛, so we have three. So from here we know that you have to have three concerning 诪诇拽讜转. The 讙诪专讗 asks, 讗诇讗 诪注转讛, if so, concerning 诪诇拽讜转, there it says another 驻住讜拽: 讜讛爪讚讬拽讜 讗转 讛爪讚讬拽 讜讛专砖讬注讜 讗转 讛专砖注, it says that they should make the righteous one right, and the wicked one, they should make wrong. So here also says they should make him righteous, and they should make him wicked. So it says twice the word they. So why don't we say, 讜讛爪讚讬拽讜, 砖谞讬诐, they should make him righteous, two already; 讜讛专砖讬注讜, they should make him wicked, 砖谞讬诐 is another two. So here we have another four, and since we said before that we have to have three from the previous 诇讬诪讜讚, 讛专讬 讻讗谉 砖讘注讛, so we have seven. So 诇讻讗讜专讛 we should learn now that you have to have seven when you judge a person concerning 诪诇拽讜转. And the 讙诪专讗 says, no, 讛讛讜讗 诪讬讘注讬 诇讬讛 诇讻讚注讜诇讗, that that 驻住讜拽, 讜讛爪讚讬拽讜 and 讜讛专砖讬注讜 cannot be used to tell us that we have to have this amount of people for a 讘讬转 讚讬谉, because we use that 驻住讜拽 for another thing, for what 注讜诇讗 said. And before the 讙诪专讗 concluded yet what 注讜诇讗 answered, the 讙诪专讗 stopped right away and asked, 诪谞讗讬谉 专诪讝 诇注讚讬诐 讝讜诪诪讬谉, what do you mean where is there a hint in the

Where does the Torah hint about false witnesses?

转讜专讛 to 注讚讬诐 讝讜诪诪讬谉? 讜讛讻转讬讘, doesn't it say clearly in the 转讜专讛, 讘驻讬专讜砖 a 驻住讜拽, 讻讗砖专 讝诪诐, that you should do to them what they intended to do to the person they testified about? So the 讚讬谉 of 注讚讬诐 讝讜诪诪讬谉 is a clear 讚讬谉 in the 转讜专讛? What do you mean, where do we have a hint to 注讚讬诐 讝讜诪诪讬谉? 讗诇讗, what did he mean? 专诪讝 诇注讚讬诐 讝讜诪诪讬谉 砖诇讜拽讬谉 诪谞讬讬谉? Where is there a hint in the 转讜专讛 that 注讚讬诐 讝讜诪诪讬谉 get 诪诇拽讜转? Normally the 讚讬谉 is that you do to them what they wanted to do to the other person, but not always can we do that. For instance, if two 注讚讬诐 come and testify on a certain 讻讛谉 that he is a 驻住讜诇 讻讛谉, that he's a 讘谉 讙专讜砖讛 讗讜 讘谉 讞诇讜爪讛, he is a son of a 讻讛谉, but his mother was a 讙专讜砖讛, was a divorcee, so when the 讻讛谉 married a divorcee, automatically the child is a 讞诇诇, is a 讻讛谉 which is not 讻砖专. So if they testify on a person that he is a 驻住讜诇 讻讛谉, and then they're found to be 讝讜诪诪讬谉, so the 讚讬谉 is we do not say that in turn they become 讞诇诇讬诐, even if they are 讻讛谞讬诐, but instead we say that they get 诪诇拽讜转. And that's his question: Where do we see in the 转讜专讛 a 专诪讝, a hint, that 注讚讬诐 讝讜诪诪讬谉 get 诪诇拽讜转 for testifying false? And he learns it out 讚讻转讬讘, because the 驻住讜拽 says: 讜讛爪讚讬拽讜 讗转 讛爪讚讬拽 讜讛专砖讬注讜 讗转 讛专砖注, that you should make righteous the 爪讚讬拽 and they should make wicked the wicked one. And

Understanding the verse 砖诇 讛爪讚讬拽 讜讛专砖讬注讜

what does the 驻住讜拽 mean? Its simple 驻砖讟 would mean that this refers to the judges, to the 砖讜驻讟讬诐, that the 讚讬讬谞讬诐 have to make the one that's right right, and the one that's wrong, he's a 专砖注, to make him a 专砖注. And then the 驻住讜拽 continues: 讜讛讬讛 讗诐 讘谉 讛讻讜转 讛专砖注, that if they will understand, they will give 诪诇拽讜转 to the 专砖注. But is it because they made this one right and that one wrong, that's why the one that's wrong gets 诪诇拽讜转? What does the fact that the other one is right have to do with this one that is wrong and his getting 诪诇拽讜转? So why does the 转讜专讛 give in this as an introduction to the fact that the other one gets 诪诇拽讜转, that the first one is right? So therefore we must say that the 驻住讜拽 is not referring only to the judges, but that the 转讜专讛 is hinting us also concerning to the witnesses. 讗诇讗 what does the 驻住讜拽 mean? That the case is as follows: 注讚讬诐 砖讛专砖讬注讜 讗转 讛爪讚讬拽, the first witnesses came and they made the righteous one wrong. They were false witnesses, and the person who was right, they made him wrong, they testified false against him. 讜讗转讜 注讚讬 讗讞专讬谞讬, and then other witnesses came, 讜讛爪讚讬拽讜 讗转 讛爪讚讬拽 讚诪注讬拽专讗, they made the righteous one from before, the one that was really right, they made him right again. They went against the first group of witnesses who wanted to make the righteous one wrong, and they were 诪讝讬诐 them, and they made the righteous one right. 讜砖讜讬谞讛讜 诇讛谞讱 专砖注讬诐, and they made these, meaning the first group of witnesses, into 专砖注讬诐 because they were 诪讝讬诐 them. So then the 转讜专讛 says: 讜讛讬讛 讗诐 讘谉 讛讻讜转 讛专砖注, that now you have to give 诪诇拽讜转 to the 专砖注. So who's the 专砖注 now? The first group of witnesses. So here in the 转讜专讛 we see a 专诪讝 that there is a possibility when the second group turns the first group into 专砖注讬诐, which is the case of 讛讝诪讛, so then the first group get 诪诇拽讜转. So we see from here that even though normally by 讛讝诪讛 the 讚讬谉 is that you do unto them what they wanted to do to that person, nevertheless there is a hint in the 转讜专讛 that sometimes the 注讚讬诐 讝讜诪诪讬谉 get 诪诇拽讜转, and that is in a case where you cannot do unto them what they wanted to do to that person. But then the 讙诪专讗 asks: 讜转讬驻讜拽 诇讬讛 let's learn this out 诪诇讗 转注谞讛?

Why need a special rule for 诪诇拽讜转 on false witnesses?

Why do you have to have a special 诇讬诪讜讚 that the 注讚讬诐 讝讜诪诪讬谉 get 诪诇拽讜转? Why don't they get 诪诇拽讜转 because of 诇讗 转注谞讛? The 转讜专讛 says in 注砖专转 讛讚讘专讜转: 诇讗 转注谞讛 讘专注讱 注讚 砖拽专, do not answer in your friend false testimony, and since the 转讜专讛 says it in the form of a 诇讗讜, do not do it, the rule is that for every 诇讗讜 you get 诪诇拽讜转, so then these false witnesses, the 注讚讬诐 讝讜诪诪讬谉, would get 诪诇拽讜转 anyway because they are 注讜讘专 on the 注讘讬专讛 of 诇讗 转注谞讛. Why do we have a special 驻住讜拽 that if you cannot do to them what they wanted to do to that person, they get 诪诇拽讜转? They would get 诪诇拽讜转 anyway because of 诇讗 转注谞讛! The rule is that anytime you are 注讜讘专 on a 诇讗讜, but it's a 诇讗讜 that has no act, you are not 注讜讘专 it by doing something, you do not get 诪诇拽讜转 for it. And therefore the 注讚讬诐 讝讜诪诪讬谉 would not get 诪诇拽讜转 for the 诇讗讜 of 诇讗 转注谞讛, so we have to have the 驻住讜拽 of 讜讛爪讚讬拽讜 讗转 讛爪讚讬拽 讜讛专砖讬注讜 讗转 讛专砖注 to tell us that the 注讚讬诐 讝讜诪诪讬谉 do get 诪诇拽讜转. Then the 讙诪专讗 continues, we

Rabi Yishmael鈥檚 requirement of 23 judges for 诪诇拽讜转

learned in the 诪砖谞讛: 诪砖讜诐 专讘讬 讬砖诪注讗诇 讗诪专讜, in the name of 专讘讬 讬砖诪注讗诇 said, 讘注砖专讬诐 讜砖诇砖讛, that to judge 讚讬谞讬诐 of 诪诇拽讜转, you have to have a 讘讬转 讚讬谉 of 23. And the 讙诪专讗 says: 诪讗讬 讟注诪讗 讚专讘讬 讬砖诪注讗诇? What is the reason of 专讘讬 讬砖诪注讗诇? 讗诪专 讗讘讬讬, so 讗讘讬讬 said: 讗转讬讗 he learns out a 讙讝讬专讛 砖讜讛 of 专砖注 专砖注 诪讞讬讬讘讬 诪讬转讜转, the word 专砖注 from the word 专砖注 that says by 讞讬讬讘讬 诪讬转讜转, by the 讚讬谉 of the death penalty. 讻转讬讘 讛讻讗, here it says concerning 诪诇拽讜转, 讜讛讬讛 讗诐 讘谉 讛讻讜转 讛专砖注 You will see to understand to hit the 专砖注. 讜讻转讬讘 讛转诐, it says concerning a person who's 讞讬讬讘 诪讬转讛: 讗砖专 讛讜讗 专砖注 诇诪讜转, that he is a 专砖注 to die. So we compare the two, and we say: 诪讛 诇讛诇谉 讘注砖专讬诐 讜砖诇砖讛, just like concerning 诪讬转讛 you have to have a 讘讬转 讚讬谉 of 23, 讗祝 讻讗谉 讘注砖专讬诐 讜砖诇砖讛, so too, when you judge the 讚讬谉 of 诪诇拽讜转, you have to have a 讘讬转 讚讬谉 of 23. 专讘讗 讗诪专, but 专讘讗 says he gives another reason for the opinion of 专讘讬 讬砖诪注讗诇: because 诪诇拽讜转 讘诪拽讜诐 诪讬转讛 注讜诪讚转. 诪诇拽讜转 is in the place of 诪讬转讛. 讘讗诪转, whenever a person is 注讜讘专 an 注讘讬专讛, he should get killed for it. Since he goes against the will of 讛砖诐, he's a 诪讜专讚 讘诪诇讻讜转, then he should get killed for it. It is only the 转讜专讛 said, instead of killing him, you should give him 诪诇拽讜转. So really 诪诇拽讜转 is another form of 诪讬转讛. Just like within 诪讬转讛 we have four types of 诪讬转讛, so too, we have another type which is in the category of 诪讬转讛, which is instead of 诪讬转讛, which is for somebody who really should get 诪讬转讛, and that is 诪诇拽讜转. So therefore, the same amount of people you have to have in the 讘讬转 讚讬谉 for 讚讬谞讬诐 of 诪讬转讛, you also have to have when you judge the person for 诪诇拽讜转. 转讜住驻讜转 brings two more 驻砖讟讬诐 in the words of 专讘讗, that 诪诇拽讜转 is in the place of 诪讬转讛. One 驻砖讟 is, because by 讘谞讬 谞讞, we know by 讙讜讬诐, whenever the 转讜专讛 says that they're not allowed to do something, the warning itself is 诪讬转讛. Meaning, that even though the 转讜专讛 just warned them not to do it, and the 转讜专讛 doesn't say they get killed for it, nevertheless, that is that is enough that they should get killed for it. When the 转讜专讛 was given to the 讗讬讚谉, it was changed. And when there is a 诇讗讜, instead of 诪讬转讛, you get 诪诇拽讜转. So that's what 专讘讗 meant when he said that 诪诇拽讜转 is instead of 诪讬转讛. Another 驻砖讟 转讜住驻讜转 says is, because sometimes through 诪诇拽讜转 a person could die. As we find a 讚讬谉, that if the 砖诇讬讞 讘讬转 讚讬谉 gave 诪诇拽讜转, and the person died through the 诪诇拽讜转, the 砖诇讬讞 讘讬转 讚讬谉 is 驻讟讜专, because he only did his job. So we see that there's a possibility for a person to die through the 诪诇拽讜转. So that's what he meant, that 诪诇拽讜转 instead of 诪讬转讛, 诪诇拽讜转 could bring to 诪讬转讛. But 转讜住驻讜转 says that the 驻砖讟 that 专砖"讬 gives is much better, because according to the other two 驻砖讟讬诐, the 拽砖讬讗 that the 讙诪专讗 is going to ask now will not fit, but according to 专砖"讬's 驻砖讟, the 拽砖讬讗 will fit. 讗诪专 专讘 讗讞讗 讘专讬讛 讚专讘讗 诇专讘 讗砖讬, so 专讘 讗讞讗 the son of 专讘讗 said to 专讘 讗砖讬: 讗讬 讛讻讬, if the reason is because 诪诇拽讜转 is in place of 诪讬转讛, 讗讜诪讚谞讗 诇诪讛? Why do we have to estimate the person before we give him 诪诇拽讜转? Because the 讚讬谉 is that before you give him 诪诇拽讜转, the doctor has to see if he will be able to take all 39 lashes. And if he is not able to take, then you give him as much as he is able to take. But why should we do that? 谞诪讞讬讬讛, let's give him all of them. 讜讗讬 诪讬讬转, 诇讬诪讜转, and if he will die, let him die! Anyway, he really should get killed. It is just a favor, so to speak, that we do to him, that the 转讜专讛 does to him, and gives him only 诪诇拽讜转. So then let's give him all the 诪诇拽讜转, and if he'll die, he'll die. 讗诪专 诇讬讛, so he said to him, 讗诪专 拽专讗, the 驻住讜拽 says: 讜谞拽诇讛 讗讞讬讱 诇注讬谞讬讱, concerning 诪诇拽讜转 it says that your brother should be embarrassed in your eyes, so that means that 讻讬 诪讞讬住, 讗讙讘讗 讚讞讬讬 诪讞讬住, that when you give 诪诇拽讜转, you have to give on a live person. So if he is going to die, so then you will continue giving 诪诇拽讜转 to a dead person. And the 转讜专讛 says clearly you have to give 诪诇拽讜转 to a live person. Therefore, we have to estimate how much he is able to take, and that's how much we give him, because that's when he'll be alive. But if we don't estimate, we might give him 诪诇拽讜转 and he'll die, so we'll be giving 诪诇拽讜转 to a dead person. But then the 讙诪专讗 asks: 讗诇讗, if so, 讛讗 讚转谞讬讗, we learn in a 讘专讬讬转讗: 讗诪讚讜讛讜 诇拽讘诇 注砖专讬诐, if they estimated that he cannot accept all 39, he can only accept less, for instance, he could accept 20, 讗讬谉 诪讻讬谉 讗讜转讜 讗诇讗 诪讻讛 讛专讗讜讬讛 诇讛砖转诇砖, you only give him 诪诇拽讜转 that you're able to divide by 3. 讜讻诪讛 讛谉, how much would you give him? 砖诪讜谞讛 注砖专讛, 18. If he only could take 20, which means he cannot take 21, but we can't give him 20 either, because we have to give him an amount that is able to be divided by 3, so therefore, we give him instead of that 18. Now the

question is: 谞诪讞讬讬讛 注砖专讬诐 讜讞讚, let's give him 21. 讜讻讬 诪讬讬转 讘讛讛讬讗, 诇讬诪讜转, if he will die with that last one, with that 21st, let him die! 讗讬讬, we said before we have to give 诪诇拽讜转 to a live person, but here, he's not going to die before we give him that 21st. When we give, when we give him the 21st, he is still alive, because 20 we said he was able to take, so after the 20 he is still alive. Now when we give him the 21st, he is still alive. He's only going to die after he gets the 21st. 讚讛讗 讻讬 诪讞讬住, 讗讙讘讗 讚讞讬讬 拽诪讞讬住, when you hit him with that extra one, you're giving it over a live person. So then why shouldn't we give him 21, why should we give him 18 instead? 讗诪专 诇讬讛, so he said to him, 讗诪专 拽专讗, the 驻住讜拽 says: 讜谞拽诇讛 讗讞讬讱 诇注讬谞讬讱, that your brother should be embarrassed in your eyes, which means 讗讞专 砖诇拽讛 讗讞讬讱 讛讜讗, that after he gets the 诪诇拽讜转, then we still have to have him your brother. In other words, not only when we give him the 诪诇拽讜转 he has to be alive, but he has to be your brother, a live person, even after you give him the 诪诇拽讜转. Well that, that we don't have if we're going to give him 21, so when we're giving the 21st, he'll still be alive, but since that will be the one that will kill him, so as soon as the 诪诇拽讜转 will be over, he won't be alive. And the 转讜专讛 says that you have to have him alive even after the 诪诇拽讜转, and therefore we cannot give him. But as we understand that this 拽讜砖讬讗 only fits according to 专砖''讬's 驻砖讟. According to 专砖''讬's 驻砖讟, that when 专讘讗 said that 诪诇拽讜转 instead of 诪讬转讛, he meant to say generally, that really he should get 诪讬转讛, and the 转讜专讛 said you give him 诪诇拽讜转 instead. So then the 讙诪专讗's 拽讜砖讬讗 is a good 拽讜砖讬讗. So then in that case, when you can't get 诪诇拽讜转 because he'll die, let him die. Anyway he deserves to die. But according to 转讜住驻讜转's both 驻砖讟讬诐, that it doesn't mean that he deserves to die, it just means that 诪诇拽讜转 was instead of 诪讬转讛, that for something that originally used to get 诪讬转讛, and later the 转讜专讛 said you get 诪诇拽讜转, or 诪诇拽讜转 could bring it to 诪讬转讛. According to these two 驻砖讟讬诐, what kind of 拽讜砖讬讗 does the 讙诪专讗 have then let's give him more than he could take and let him die? Therefore 转讜住驻讜转 says that 专砖''讬's 驻砖讟 is the better 驻砖讟. Then the 讙诪专讗 continues, we

Three judges required for declaring an intercalated month

learn in the 诪砖谞讛: 注讬讘讜专 讛讞讜讚砖 讘砖诇砖讛, when it comes to make the month 诪注讜讘专, that the month should have an extra day, you have to have three people for that. And the 讙诪专讗 says: 讞讬砖讜讘 诇讗 拽转谞讬, 拽讬讚讜砖 诇讗 拽转谞讬, 讗诇讗 注讬讘讜专. Now concerning the setting up of the calendar, it is as follows: The calendar is based on the cycle of the moon. Now the moon has a cycle of 29 and a half days and 793 讞诇拽讬诐. That's the complete cycle every month of the moon. But the 讚讬谉 is that we cannot have a month of half days, and therefore we can't say that every month should be 29 and a half days and 转砖爪''讙 讞诇拽讬诐. We have to have complete days in a month. So therefore, it comes out generally speaking that within two months we have 59 days. And therefore, the way we have it now, when everything works according to the 讞砖讘讜谉, one month is 诪注讜讘专, one month has 30 days, and the other month has 29 days, and then the next month again has 30 days, and then the next month again 29 days. But the way it used to be then was that they were 诪拽讚砖 讛讞讜讚砖 注诇 驻讬 专讗讬讛. To know whether the month should have 29 days or 30 days, that would depend on witnesses. On the 30th day, which was always the 住驻拽 whether that day should be the 30th of the past month, or really it should be already considered the first day of the new month, the 讘讬转 讚讬谉 would wait. If witnesses would come and testify that they already saw the new moon, then this day would be considered the first day of the new month. So the month before had 29 days, and the 30th day really was day number one of the next month. If no witnesses would come, then this would be considered the 30th day of the previous month, and the next day, which is the 31st, would be the first day of the new month. So on one hand, it seems that at that time there was no calculation needed. If the witnesses would come, then the month was not 诪注讜讘专, the month was 讞住专 we call it, if it is only 29 days, was missing the extra day. If the witnesses would not come, then that month was a 诪注讜讘专, was 30 days. But on the other hand, there are certain rules of how many months a year we could have 诪注讜讘专 and how many we can't. And the 讙诪专讗 says in 注专讻讬谉 that we should have at least four months a year 诪注讜讘专, and not more than eight months a year 诪注讜讘专, because if we would have different than that, then it would come out sometimes that the 诇讘谞讛 would be seen, the new moon would be seen a few days away from 专讗砖 讞讜讚砖, because if you have so many months a year 诪注讜讘专, then it'll get moved up, then the 诇讘谞讛 will be seen a few days before 专讗砖 讞讜讚砖. So therefore it comes out that even though generally speaking it all depended on the witnesses, but still there was a 讞砖讘讜谉, there was a certain calculation they had to make. In the 诪砖谞讛 it said that 注讬讘讜专 讛讞讜讚砖 讘砖诇砖讛, which the 驻砖讜讟'注专 驻砖讟 seems to be saying that if a month was 诪注讜讘专, if a month had 30 days, and just the next day, the 31st, would be the new month, so then the 讘讬转 讚讬谉 would have to say that the month is 诪注讜讘专. And that's what the 诪砖谞讛 means, 注讬讘讜专 讛讞讜讚砖 讘砖诇砖讛, that when it comes to make the month 诪注讜讘专, you have to have a 讘讬转 讚讬谉 of three, and they have to be the ones to say that this month is 诪注讜讘专, has the extra day. So the 讙诪专讗 asks: 讞讬砖讜讘 诇讗 拽转谞讬, it doesn't say in the 诪砖谞讛 that the calculations of whether to make it 诪注讜讘专 or not needs three. 拽讬讚讜砖 诇讗 拽转谞讬. It doesn't also say that when it comes to be 诪拽讚砖 the 讞讜讚砖, that means that if the month is 29 days and the next day is the first of the new month, so then 讘讬转 讚讬谉 would have to say on the 30th day, 诪拽讜讚砖 讛讞讜讚砖 诪拽讜讚砖, that this day is a holy day, is 专讗砖 讞讜讚砖. Because if 讘讬转 讚讬谉 doesn't say it, if they just leave it the way it is, this month would be a continuation of the previous month, and would be considered the 30th of the past month. If the 讘讬转 讚讬谉 wants that this day should be the first of the new month, 讘讬转 讚讬谉 has to say 诪拽讜讚砖. But nevertheless, it doesn't say in the 诪砖谞讛 that 拽讬讚讜砖 讛讞讜讚砖 needs three. All it says, 讗诇讗 注讬讘讜专, that if they want to make it 诪注讜讘专, if they want to make the 30th day as the 30th day of the past month, then they have to have three people. But the

Why a Beit Din is needed for declaring the month?

question is, for that, why do you 讘讻诇诇 need a 讘讬转 讚讬谉? 诇讗 诇拽讚砖讜, let them not be 诪拽讚砖 it at all, 讜诪诪讬诇讗 诇注讘专, and automatically it'll become 诪注讜讘专. Because if 讘讬转 讚讬谉 does not say on the 30th day that it is 专讗砖 讞讜讚砖, then it's not 专讗砖 讞讜讚砖. And if it's not 专讗砖 讞讜讚砖, it's automatically the 30th of the past month. So why do we need a 讘讬转 讚讬谉? And it has to be said in front of the 讘讬转 讚讬谉 that this month is 诪注讜讘专? Let them not say anything, and then automatically it'll be 诪注讜讘专. On the contrary, if they want to make it into 专讗砖 讞讜讚砖, then they have to say something, that today is 专讗砖 讞讜讚砖, 诪拽讜讚砖. But if they don't say anything, it's automatically 诪注讜讘专 for past month. So what does the 诪砖谞讛 mean that for 注讬讘讜专 讛讞讜讚砖 you have to have three? 讗诪专 讗讘讬讬, 讗讘讬讬 said, 转谞讬 拽讬讚讜砖 讛讞讜讚砖, that you should 讟讗拽注 change it, we should learn the 诪砖谞讛 not 注讬讘讜专 讛讞讜讚砖, but 拽讬讚讜砖 讛讞讜讚砖. That when you want the 30th day to be 专讗砖 讞讜讚砖, so then you have to have a 讘讬转 讚讬谉 of three, when the 讘讬转 讚讬谉 will be 诪拽讚砖 the 讞讜讚砖 in front of the three and say that this day, this 30th day, is 专讗砖 讞讜讚砖, is the beginning of the new month. 讜转谞讬谞讗 谞诪讬 讛讻讬, we 讟讗拽注 learn in a 讘专讬讬转讗 that way, 拽讬讚讜砖 讛讞讜讚砖 讜注讬讘讜专 讛砖谞讛 讘砖诇砖讛, 讚讘专讬 专讘讬 诪讗讬专, that when you're 诪拽讚砖 the 讞讜讚砖, and when you want to make a leap year, an extra month to the year, that's when you have to have three people. That's the opinion of 专讘讬 诪讗讬专. And that's what he said should be said in the 诪砖谞讛 also. 讗诪专 专讘讗, but 专讘讗 said, 讜讛讗 注讬讘讜专 拽转谞讬! How could you say that the 诪砖谞讛 means 拽讬讚讜砖, and that's what we're supposed to write in the 诪砖谞讛 when it says 注讬讘讜专? Sometimes we find that it says one word and the 讙诪专讗 says it's supposed to say a different word. But that's only when the two words sound alike, so then we're able to say that the one that wrote it down didn't hear exactly what it was supposed to say, and he made a mistake and wrote the wrong word. But when you have two words that don't sound alike, how can you say that he meant one and it says the other? In this case, if it was supposed to say 拽讬讚讜砖, how could a mistake come out and the word 注讬讘讜专 should be written? So you can't say that 注讬讘讜专 really was a mistake for the word 拽讬讚讜砖. So therefore it 讟讗拽注 has to say 注讬讘讜专, 专讘讗 says. 讗讬讚讱 拽砖讬讗 is, for 注讬讘讜专 why do we need three people? Why do we 讘讻诇诇 need a 讘讬转 讚讬谉 for 注讬讘讜专? Let them not say anything and automatically it'll become 诪注讜讘专! 讗诇讗 讗诪专 专讘讗, so 专讘讗 said, what does it mean? 拽讬讚讜砖 讘讬讜诐 注讬讘讜专, that is 讘砖诇砖讛. That if 讘讬转 讚讬谉 wants to be 诪拽讚砖 the 讞讜讚砖 on the day of 注讬讘讜专, the day of 注讬讘讜专 is the 30th day. That is the day that or it'll become 诪注讜讘专, or it'll become the last day, the extra day so to speak, to the past month, or it'll become the first day of the new month. So 讘讬转 讚讬谉 wants to be 诪拽讚砖 the day of 注讬讘讜专, the day which could have been an 注讬讘讜专, so that's when you have to have three. 讗讞专 注讬讘讜专, but if it's going to go after 注讬讘讜专, in other words the next day will be 专讗砖 讞讜讚砖, then 诇讬讻讗 拽讬讚讜砖. Then there is no 拽讬讚讜砖, 讘讬转 讚讬谉 doesn't have to say anything. So the word 注讬讘讜专 in the 诪砖谞讛 is only referring to the day when they are 诪拽讚砖, not that they make it into an 注讬讘讜专. It is the day that could have been a day of 注讬讘讜专, if they wanted not make it into 注讬讘讜专, but they want to make it into 专讗砖 讞讜讚砖, so then you have to have three. 讜诪讗谉, and who does this go according to? This goes according to If the 诇讘谞讛 was not seen in its proper time, in other words, there are no witnesses that say that they saw the 诇讘谞讛 on the 30th day, so then automatically 专讗砖 讞讜讚砖 is on the 31st, and 讘讬转 讚讬谉 doesn't have to be 诪拽讚砖 it. 讘讬转 讚讬谉 doesn't have to say on the 31st day that it is 专讗砖 讞讜讚砖, 砖讻讘专 拽讬讚砖讜讛讜 讘砖诪讬诐, because in 砖诪讬诐, in heaven, they already made it 拽讜讚砖. Which means that one thing is for sure: a month cannot have more than 30 days. So if the 30th is part of the last month, so automatically the next day is not part of the last month, automatically it is a new month. So the 讘讬转 讚讬谉 doesn't have to say 诪拽讜讚砖 on that day, because it is automatically

Heaven Declares the Day Sanctified First

诪拽讜讚砖. And the way the 讙诪专讗 expresses it is that 讻讘专 拽讬讚砖讜讛讜 砖诪讬诐, in heaven they already made it 诪拽讜讚砖. And as 专砖''讬 said, it means that the 讘讬转 讚讬谉 砖诇 诪注诇讛 already yesterday made it 诪拽讜讚砖. But 转讜住驻讜转 explains, what does that mean? That when it comes to the 30th day, the 讘讬转 讚讬谉 砖诇 诪注诇讛, the 讘讬转 讚讬谉 in heaven waits for the 讘讬转 讚讬谉 砖诇 诪讟讛, for the 讘讬转 讚讬谉 down here, to see what they will do, whether they will turn that day into 专讗砖 讞讜讚砖 or not. If the 讘讬转 讚讬谉 砖诇 诪讟讛 turns it into 专讗砖 讞讜讚砖, then the 讘讬转 讚讬谉 砖诇 诪注诇讛 also considers it 专讗砖 讞讜讚砖. If the 讘讬转 讚讬谉 砖诇 诪讟讛 does not turn it into 专讗砖 讞讜讚砖, so automatically it is known that tomorrow will be 专讗砖 讞讜讚砖. So right away in the morning of the 31st day, the 讘讬转 讚讬谉 砖诇 诪注诇讛 makes it into 专讗砖 讞讜讚砖. So before even the 讘讬转 讚讬谉 砖诇 诪讟讛 has a chance to say 诪拽讜讚砖, it is already said 诪拽讜讚砖 by the 讘讬转 讚讬谉 砖诇 诪注诇讛. That's what the 讙诪专讗 means 砖讻讘专 拽讬讚砖讜讛讜 砖诪讬诐, because that is an automatic thing. So in 砖诪讬诐, right away, they made it into 专讗砖 讞讜讚砖, so the 讘讬转 讚讬谉 砖诇 诪讟讛 doesn't have to say anything. Then the 讙诪专讗 says, 专讘 谞讞诪谉 讗诪专, 专讘 谞讞诪谉 says just the opposite, that what does the 诪砖谞讛 mean 注讬讘讜专 讛讞讜讚砖 讘砖诇砖讛? 拽讬讚讜砖 讗讞专 注讬讘讜专 讘砖诇砖讛, that the 讘讬转 讚讬谉 is 诪拽讚砖 the day after the 注讬讘讜专. If the thirtieth day is from the past month, and the day afterwards is 专讗砖 讞讜讚砖, that's when you have to have three people for 讘讬转 讚讬谉 to be 诪拽讚砖 that day. 讘讬讜诐 注讬讘讜专, 诇讬转讬讛 拽讬讚讜砖, but if 专讗砖 讞讜讚砖 is the day of the 注讬讘讜专, is the thirtieth day, then you don't have to be 诪拽讚砖, then you don't need the 讘讬转 讚讬谉 to be 诪拽讚砖.

Identifying the 转谞讗: 驻诇讬诪讜鈥檚 Position

讜诪讗谉 转谞讗, and who is the 转谞讗 of this 诪砖谞讛? If 专讗砖 讞讜讚砖 is in its time, the thirtieth day is 专讗砖 讞讜讚砖, the past month has twenty-nine days, and the thirtieth day is 专讗砖 讞讜讚砖, then 讘讬转 讚讬谉 doesn't have to be 诪拽讚砖 it. 砖诇讗 讘讝诪谞讜, 诪拽讚砖讬谉 讗讜转讜, if 专讗砖 讞讜讚砖 is not in its time, if 专讗砖 讞讜讚砖 is the thirty-first day, then 讘讬转 讚讬谉 has to be 诪拽讚砖 it. And the reason for that is because if it's in its time, then it's a common thing, that is the right way, the normal way for it to happen, so for that you don't need a special thing to make it into 专讗砖 讞讜讚砖, to make it into 拽讚讜砖. But if it is on the next day, which is not the normal regular standard way to do it, so then you have to have a special thing to turn it into 专讗砖 讞讜讚砖. So therefore, 讘讬转 讚讬谉 has to say 诪拽讜讚砖 on that day, and that's what the 诪砖谞讛 means, that you have to have three people when they do that. 专讘 讗砖讬 讗诪专, 专讘 讗砖讬 says, 诇注讜诇诐 讞讬砖讜讘 转谞讗. That 讘讗诪转 what does the 诪砖谞讛 mean 注讬讘讜专 讛讞讜讚砖 讘砖诇砖讛? That when it comes to calculate to see whether they are able to make the 注讬讘讜专 or not, that's when you have to have three people. 讜诪讗讬 注讬讘讜专? What does the 诪砖谞讛 mean with the word 注讬讘讜专? 讞讬砖讜讘 讚注讬讘讜专, the calculation of the 注讬讘讜专, when they calculate to see whether that should be 诪注讜讘专 or not. 讗讬, why does it use the 诇砖讜谉 注讬讘讜专, not the 诇砖讜谉 讞讬砖讜讘? But 讜讗讬讬讚讬 讚拽讘注讬 诇诪转谞讬 注讬讘讜专 砖谞讛, since he wants to use the term further, 注讬讘讜专 砖谞讛, when you make the year into a leap year, when you add the extra month, so there the 诇砖讜谉 is 注讬讘讜专, 转谞讬 谞诪讬 注讬讘讜专 讞讜讚砖. Therefore, he also used the 诇砖讜谉 注讬讘讜专 讞讜讚砖. Because concerning the year, it has to say the 诇砖讜谉 注讬讘讜专 砖谞讛, because there we're talking about actual making it into a leap year. There we have to have a 讘讬转 讚讬谉 that they should say that this year will be a leap year, because if they don't say anything, automatically, when 讗讚专 is finished, it'll become 谞讬住谉. In order to have the next month 讗讚专 砖谞讬 instead of 谞讬住谉, they actually have to say that it should be a leap year, it should be a second 讗讚专. So there, the 诪砖谞讛 must use the 诇砖讜谉 注讬讘讜专, because for the making of the leap year, you need the 讘讬转 讚讬谉. So there it has to say the 诇砖讜谉 注讬讘讜专 砖谞讛, and since it has the 诇砖讜谉 注讬讘讜专 砖谞讛, therefore it also has the 诇砖讜谉 注讬讘讜专 讞讜讚砖. But really, what does it mean? Not for 注讬讘讜专 讞讜讚砖 do you need the 讘讬转 讚讬谉, you need the 讘讬转 讚讬谉 for the 讞讬砖讜讘 讚注讬讘讜专, for the calculations whether you should make an 注讬讘讜专 or not. So 讞讬砖讜讘 讞讜讚砖, 讗讬谉, so only for calculating whether the month should be a extra day or not, for that you need a 讘讬转 讚讬谉. 拽讬讚讜砖 讞讜讚砖, 诇讗, but to be 诪拽讚砖 the 讞讜讚砖, to make the day into 专讗砖 讞讜讚砖, you don't need a 讘讬转 讚讬谉 at all. Not if the thirtieth day will be 专讗砖 讞讜讚砖 and not if the thirty-first day will be 专讗砖 讞讜讚砖. 讜诪谞讬? And

Rabbi Elazar on Sanctifying Months and Yovel

who is this? Whether the 专讗砖 讞讜讚砖 will be in its time, whether the thirtieth day is 专讗砖 讞讜讚砖 or the thirty-first day is 专讗砖 讞讜讚砖, 讗讬谉 诪拽讚砖讬谉 讗讜转讜, 讘讬转 讚讬谉 doesn't have to be 诪拽讚砖 it. 砖谞讗诪专, because the 驻住讜拽 says, 讜拽讚砖转诐 讗转 砖谞转 讛讞诪砖讬诐 砖谞讛. This is concerning 讬讜讘诇. Every fifty years, the fiftieth year is 讬讜讘诇. So the 转讜专讛 says you should make holy the fiftieth year, so we learn out, 砖谞讬诐 讗转讛 诪拽讚砖, that years you have to be 诪拽讚砖, that the year of 讬讜讘诇, that's where there is a 讚讬谉 that 讘讬转 讚讬谉 has to say that this year is 诪拽讜讚砖 for the sake of 讬讜讘诇, 讜讗讬 讗转讛 诪拽讚砖 讞讚砖讬诐, but there is no 讚讬谉 that you have to be 诪拽讚砖 months. And therefore, he holds that 拽讬讚讜砖 never needs a 讘讬转 讚讬谉. It is only the calculations whether you should be 诪注讘专 or not, that's where you need the 讘讬转 讚讬谉. Then the 讙诪专讗 continues, we learned in the 诪砖谞讛, 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 讗讜诪专, 讘砖诇砖讛 讜讻讜诇讬, 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 said that concerning what we said before, that 注讬讘讜专 讛讞讜讚砖 needs three and 注讬讘讜专 讛砖谞讛 needs three, that was the opinion of 专讘讬 诪讗讬专. But 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 said that you start with three and then five discuss it, and when it comes to the conclusion, you have to have seven. So the 讙诪专讗 says, 转谞讬讗, we learn in a 讘专讬讬转讗, 讻讬爪讚 讗诪专 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇? What is the meaning in what 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 said, that 讘砖诇砖讛 诪转讞讬诇讬谉, that you start with three, 讜讘讞诪砖讛 谞讜砖讗讬谉 讜谞讜转谞讬谉, and with five you discuss, 讜讙讜诪专讬谉 讘砖讘注讛, and you finish with seven? Now, what does that mean? So he says it means as follows: 讗讞讚 讗讜诪专 诇讬砖讘 讜 砖谞讬诐 讗讜诪专讬诐 砖诇讗 诇讬砖讘, you have a 讘讬转 讚讬谉 of three, and they talk whether is it important to sit down and discuss to see whether we should make the 注讬讘讜专 or not. So one of the three says, "Yes, let's discuss it, let's sit down to discuss it," and two say we don't even have to sit down to discuss it, because there is no question that we don't have to make that make the 注讬讘讜专. So then 讘讟诇 讬讞讬讚 讘诪讬注讜讟讜. So then this one is 讘讟诇 because he's the minority. And obviously no discussion takes place, and the month is not 诪注讜讘专. But if 砖谞讬诐 讗讜诪专讬诐 诇讬砖讘 讜讗讞讚 讗讜诪专 砖诇讗 诇讬砖讘, if two of the three say, "Yes, let's sit down to discuss it," and one says, "Let's not sit down," so here we have the majority saying we should sit down. So that is the 驻砖讟, we start with three, that two out of three say we should sit down, so that is enough to continue. 讜诪讜住讬驻讬谉 注诇讬讛诐 注讜讚 砖谞讬诐, we add two more. Now we have five. 讜谞讜砖讗讬谉 讜谞讜转谞讬谉 讘讚讘专, and they discuss this thing whether they should be 诪注讘专 or not, and they see: 砖谞讬诐 讗讜诪专讬诐 爪专讬讻讛 讜砖诇砖讛 讗讜诪专讬诐 讗讬谞讛 爪专讬讻讛, two out of the five say that we should be 诪注讘专, three out of the five say we shouldn't. 讘讟诇 砖谞讬诐 讘诪讬注讜讟谉, so the two are 讘讟诇 in the 诪讬注讜讟, and since the majority says that we don't have to be 诪注讘专, so we are not 诪注讘专, finish, and they leave. If 砖诇砖讛 讗讜诪专讬诐 爪专讬讻讛 砖谞讬诐 讗讜诪专讬诐 讗讬谞讛 爪专讬讻讛, if three out of the five say, "Yes, we have to be 诪注讘专," and two out of the five say we shouldn't be 诪注讘专, so now the majority says we should. So now we have to be 诪注讘专. Since the majority says yes, we have to be 诪注讘专. So now when it comes to be 诪注讘专, we said before we have to have seven to conclude, so 讜诪讜住讬驻讬谉 注诇讬讛诐 注讜讚 砖谞讬诐, we add two more, 砖讗讬谉 讛诪谞讬谉 驻讞讜转 诪砖讘注讛, because the count should not be less than seven, and then we are 诪注讘专 with seven. So that's the 驻砖讟: we start with three, we see out of the three what does the majority hold whether we should discuss it, and then if the majority holds we should discuss it, we get two more for five for the discussion, and then we see what the majority of the five say whether we should be 诪注讘专, and if they say we should be 诪注讘专, we add two more, now we have seven, and we're 诪注讘专 with the seven. Then the 讙诪专讗 continues: 讛谞讬 砖诇砖讛 讞诪讬砖讛 讜砖讘注讛 讻谞讙讚 诪讬? These three, five, and seven, what do they correspond? We said we start with three, we discuss with five, and we finish with seven. Now what do these correspond? So the 讙诪专讗 says, 驻诇讬讙讬 讘讛 专讘 讬爪讞拽 讘专 谞讞诪谞讬 讜讞讚 讚注讬诪讬讛. 专讘 讬爪讞拽 讘专 谞讞诪谞讬 and someone that was with him have an argument. 讜诪谞讜, who is that other person that was with him? 专讘 砖诪注讜谉 讘谉 驻讝讬. 讜讗诪专讬 诇讛, some say, that 专讘 砖诪注讜谉 讘谉 驻讝讬 讜讞讚 讚注讬诪讬讛, 专讘 砖诪注讜谉 讘谉 驻讝讬 had an argument with someone that's with him. 讜诪谞讜, 专讘 讬爪讞拽 讘专 谞讞诪谞讬, and who is that? 专讘 讬爪讞拽 讘专 谞讞诪谞讬. The difference between these two opinions is which one was the 注讬拽专, the main one, and which one was the one that was with him. And the 诪讞诇讜拽转 was, 讞讚 讗诪专, one says, 讻谞讙讚 讘专讻转 讻讛谞讬诐, it corresponds the 讘专讻讜转 of the 讘专讻转 讻讛谞讬诐. The three 驻住讜拽讬诐 of 讘专讻转 讻讛谞讬诐, the first 驻住讜拽 has three words, the second 驻住讜拽 has five words, and the third 驻住讜拽 has seven words. The first one is 讬讘专讻讱 讛' 讜讬砖诪专讱, the second one is 讬讗专 讛' 驻谞讬讜 讗诇讬讱 讜讬讞谞讱, and the third one is 讬砖讗 讛' 驻谞讬讜 讗诇讬讱 讜讬砖诐 诇讱 砖诇讜诐, and that's why we have these three numbers: three, five, and seven. 讜讞讚 讗诪专, and one of them says, that 讻谞讙讚 砖诇砖讛 砖讜诪专讬 讛住祝, it corresponds the three keepers of the threshold, 讞诪砖讛 诪专讜讗讬 驻谞讬 讛诪诇讱, the five represent the five people who see the face of the king, and then 砖讘注讛 专讜讗讬 驻谞讬 讛诪诇讱, and you also have seven that see the face of the king. In other words, we find by a king down here that there are different categories in people who are close to the king: we have a category of three, and we have a category of five, and a category of seven. We find by 爪讚拽讬讛讜 that there were three 砖讜诪专讬 讛住祝, three guardsmen that were called the three 砖讜诪专讬 讛住祝. We also find over there that there were five 专讜讗讬 驻谞讬 讛诪诇讱, there were five people who were considered those that see the face of the king, and then we also find seven, that is by 讗讞砖讜专讜砖, in the story of 讗住转专, so there we find that there were 砖讘注讛 砖专讬 驻专住 讜诪讚讬, that there were seven 砖专讬诐, seven princes of 驻专住 讜诪讚讬. So we see that there is a 讞砖讘讜谉 of seven also. So just like we find it concerning a king down here, now setting up the calendar and making the dates is 诪转讻住讬住讬 诪诇讻讜转 砖诪讬诐, 专砖"讬 says. It is also part of the of the governmental rule of 砖诪讬诐, of 讛砖诐, and therefore, just like down here we have these three categories, so also concerning setting up the dates, we have to have these three numbers: so we have a group of three and a group of five and a group of seven. And 转讜住驻讜转 says that even the number seven doesn't come from 讗讞砖讜专讜砖, because why should you make a 转拽谞讛 because of 砖专讬诐 that we find by 讙讜讬诐, and he says that it's also because of 讬讬讚谉, because in 讬专诪讬讛 we find that there were 砖讘注讛 讗谞砖讬诐 诪专讗讬 驻谞讬 讛诪诇讱. But they both agree that the 驻砖讟 is that we see the way it is in the 诪诇讻讜转 of this world, and the same 讞讻诪讬诐 讛讬讜 诪转拽谉 concerning the 诪诇讻讜转 砖诪讬诐. Then the 讙诪专讗 continues, 转谞讬 专讘 讬讜住祝, 专讘 讬讜住祝 had learned, 讛谞讬 砖诇讜砖讛 讜讞诪砖讛 讜砖讘注讛, these five, three, and seven, 讛谞讬 讻谞讙讚 砖诇讜砖讛 砖讜诪专讬 讛住祝, 讛谞讬 讻谞讙讚 the three watchers of the threshold. 讞诪砖讛 诪专讜讗讬 驻谞讬 讛诪诇讱, five are the see those that see the face of the king. 砖讘注讛 专讜讗讬 驻谞讬 讛诪诇讱, the seven are the seven that see the face of the king. He taught them the same thing like we learned before. 讗诪专 诇讬讛 讗讘讬讬 诇专讘 讬讜住祝, 讗讘讬讬 said to 专讘 讬讜住祝, 注讚 讛讗讬讚谞讗 诪讗讬 讟注诪讗 诇讗 驻讬专砖 诇谉 诪专 讛讻讬? Till now, why didn't you explain this to us? 讗诪专 诇讛讜, so he said to them, 诇讗 讛讜讛 讬讚注谞讗 讚爪专讬讻讬转讜. I didn't know that you need it, I didn't know that you needed this explanation. 诪讬 讘注讬转讜 诪讬谞讗讬 诪讬诇转讗 讜诇讗 讗诪专讬 诇讻讜? Did you ever ask me anything and I didn't tell you? So the reason I didn't tell you was because I thought you didn't need this explanation. But now that I saw that you need the explanation, I told it to you. Concerning what we learned before that concerning 注讬讘讜专 砖谞讛, the 讙诪专讗 definitely had to mention 注讬讘讜专 砖谞讛, because when it comes to make a leap year, 专砖状讬 says it means that you must say that it is for the sake of a leap year. Because if you will not say, if the 讘讬转 讚讬谉 will not say that this day is 专讗砖 讞讜讚砖 for 讗讚专 砖谞讬, automatically it'll become 专讗砖 讞讜讚砖 谞讬住谉. So therefore there we must say that it is 诪注讜讘专. So therefore it must say 注讬讘讜专 讛砖谞讛, and that's what the 讙诪专讗 said, since 讞讜讚砖 is mentioned next to 砖谞讛, so it also says 注讬讘讜专 讞讜讚砖. But 转讜住驻讜转 says that one thing, when 专砖状讬 said that on that day, concerning a leap year, the 讘讬转 讚讬谉 has to say 诪拽讜讚砖, that it is 诪拽讜讚砖 for the sake of 讗讚专 砖谞讬, not for 谞讬住谉, 专砖状讬 didn't mean exactly the wording the way he wrote it. Because now we're going according to the opinion that just to be 诪拽讚砖 the 讞讜讚砖 you never have to. This is the opinion that not when it is 讘讝诪谞讜 on the 30th day, and not when 专讗砖 讞讜讚砖 is on the 31st day, must they be 诪拽讚砖. The only time they must be 诪拽讚砖 is 讬讜讘诇, but never do they have to 诪拽讚砖 a 讞讜讚砖. So why should they have to be 诪拽讚砖 专讗砖 讞讜讚砖 of 讗讚专 砖谞讬 to say it is 诪拽讜讚砖 for 讗讚专 砖谞讬? So what 专砖状讬 meant was that they have to say it is established for 讗讚专 砖谞讬, not 诪拽讜讚砖, because you don't have to be 诪拽讚砖 it. But you do have to establish it for 讗讚专 砖谞讬, and therefore they have to say that it's 拽讘讜注 for 讗讚专 砖谞讬. But then 转讜住驻讜转 asks another question. According to 专砖状讬, it comes out that they do this on the 30th day of 讗讚专. So then they have to establish it to say that it is not for 谞讬住谉, but it is for 讗讚专 砖谞讬. But 转讜住驻讜转 asks, the 讚讬谉 is that you're not allowed to be 诪注讘专 the 砖谞讛, you can't make it into a leap year to have an extra month on the 30th day of 讗讚专. It must be done before. Because a day that could have been already a beginning of the month of 谞讬住谉, on that day you can't make it into a leap year, that's the 讚讬谉. You can only do it before. So how could the 讚讬谉 be that on the 30th day, when that day is supposed to be 专讗砖 讞讜讚砖 谞讬住谉, that's when they turn it into 专讗砖 讞讜讚砖 讗讚专 砖谞讬? So therefore, 转讜住驻讜转 learns that the 驻砖讟 is, when does the 讙诪专讗 mean that they have to say, by the case of 注讬讘讜专 讛砖谞讛, you have to have a 讘讬转 讚讬谉 in front of which you say that it is 诪注讜讘专? It means when they finish discussing that, and they come to a conclusion that they want to be 诪注讘专 the year, so that's when they have to say that the next month is going to be 诪注讜讘专. It is not on the 30th day of 讗讚专, it is earlier than that. But they say then that the next month, when we will make it into 专讗砖 讞讜讚砖, so that should not be 专讗砖 讞讜讚砖 of 谞讬住谉, but it should be 专讗砖 讞讜讚砖 of 讗讚专 砖谞讬. But if they don't say that, then automatically the next month will become 谞讬住谉. It is also important to note, concerning the earlier 讙诪专讗 that we learned in the 讚讬谉 of 驻诇讙讬谞谉 讚讬讘讜专讗, that according to 专讘讗, if a person makes a statement, and part of the statement is concerning himself, so we don't believe him on that part of the statement concerning himself, but on the other part of the statement that's not concerning himself, we could believe him. So 转讜住驻讜转 brings that there is an opinion in 讬砖 谞讜讞诇讬谉 in 讘讘讗 讘转专讗 that this is only said if it is in two 讙讜驻讬诐. But if the whole thing is on one 讙讜祝, then we do not say 驻诇讙讬谞谉 讚讬讘讜专讗. For instance, if someone says, 'I divorced my wife', so there we do not say that for the past we will not believe him, but let's believe him for the future, because then the 驻砖讟 is that we're changing what he said. Either we believe him or we don't believe him. In a case where we're able to say that we believe him and part of it we don't believe him at all, for instance, he says, 'That person did an 注讘讬专讛 with my ox.' So in the 讙诪专讗 there was a 砖讗诇讛 that maybe we should say 驻诇讙讬谞谉 讚讬讘讜专讗. If we would have said 驻诇讙讬谞谉 讚讬讘讜专讗, the 驻砖讟 would have been that we believe him that that person had relations with an ox, but we don't say it was his ox, we say it was another ox. But in a case where we don't say that, but in the words itself we change what he said, not the 驻砖讟 we don't believe him, but we change in the same 讙讜祝 what he said, then we don't say 驻诇讙讬谞谉 讚讬讘讜专讗. But according to that, in the case where he says 驻诇讜谞讬 专讘注谞讬 诇专爪讜谞讬, that somebody had relations with me willingly, and we do say 驻诇讙讬谞谉 讚讬讘讜专讗, so the 驻砖讟 is also not that we say that we don't believe him what he said that it was willingly, but we assume it was 诇讗讜谞住讬, that that person had relations with him, but we don't accept and say that it was with his 专爪讜谉, but we assume it was against his will, that's not the 驻砖讟, because then the 驻砖讟 is we're changing his words. What we mean is that we believe him that that person had relations with a man, but we don't accept that it was with him. We say it was not with him. So then everything that's concerning him is not accepted and is not there, so it's as if he just testified that somebody had relations with a man. But if we're going to say that we believe him even that it was with him, and in that with him 讙讜驻讗, in that same one body we say it wasn't the way he said, 诇专爪讜谉, but it was 诇讗讜谞住, then we wouldn't say 驻诇讙讬谞谉 讚讬讘讜专讗 according to that 住讘专讗.
