Intro: Today's Shiur on Sanhedrin daf V

Jewish Audio on Chabad.org. Today's ืฉื™ืขื•ืจ will be ืžืกื›ืช ืกื ื”ื“ืจื™ืŸ ื“ืฃ ื•, but what we will start towards the end of ื“ืฃ ื” ืขืžื•ื“ ื‘, twelve lines from the bottom of the ืขืžื•ื“. And the ื’ืžืจื says, ื’ื•ืคื, here is the ื’ื•ืฃ of the thing that we discussed before, we had mentioned earlier a few ื‘ืœืื˜ before, that ืืžืจ ืฉืžื•ืืœ, ืฉืžื•ืืœ said, ืฉื ื™ื ืฉื“ื ื•, if two people judged, ื“ื™ื ื™ื”ื ื“ื™ืŸ, their ื“ื™ืŸ is considered a ื“ื™ืŸ, their ืคืกืง is a ืคืกืง, ืืœื ืฉื ืงืจื ื‘ื™ืช ื“ื™ืŸ ื—ืฆื•ืฃ, but it is called a ื‘ื™ืช ื“ื™ืŸ of ื—ื•ืฆืคื”. And as ืชื•ืกืคื•ืช says, this doesn't only mean two, the same thing would be if one person judged, that according to ืฉืžื•ืืœ the ื“ื™ืŸ would be a ื“ื™ืŸ, just that it would be called a ื—ืฆื•ืฃ. The reason the ื’ืžืจื mentioned ืฉื ื™ื is to tell us that even if two do it, still it is a ื—ื•ืฆืคื”. But ืœืคื•ืขืœ the same ื“ื™ืŸ applies to one. And the ื’ืžืจื says, ื™ืชื™ื‘ ืจื‘ ื ื—ืžืŸ ื•ืงืืžืจ ืœื”ื ืฉืžืขืชื, ืจื‘ ื ื—ืžืŸ was sitting and was repeating this ื“ื™ืŸ, ืื™ืชื™ื‘ื™ื” ืจื‘ื ืœืจื‘ ื ื—ืžืŸ, said ืจื‘ื asked a ืงื•ืฉื™ื to ืจื‘ ื ื—ืžืŸ, we learned later on in a ืžืฉื ื”, it says, ืืคื™ืœื• ืฉื ื™ื ืžื–ื›ื™ืŸ ื•ืฉื ื™ื ืžื—ื™ื™ื‘ื™ืŸ, even if out of the three people of the ื‘ื™ืช ื“ื™ืŸ, two say that he is innocent, or two say that he is guilty, ื•ืื—ื“ ืื•ืžืจ ืื™ื ื™ ื™ื•ื“ืข, and one, the third one, says I don't know, ื™ื•ืกื™ืคื• ื”ื“ื™ื™ื ื™ืŸ, you add to the ื“ื™ื™ื ื™ื. If

Majority rule vs. adding a judge when one says 'I donโ€™t know'

two say one way and the other one says the other way, then we follow the majority, but if the third one says I don't know, then you have to add ื“ื™ื™ื ื™ื. But the question is, ื•ืื™ ืกืœืงื ื“ืขืชืš, if it is true that two people who ืคืกืงืŸ a ื“ื™ืŸ, ื‘ื“ื™ืขื‘ื“ the ื“ื™ืŸ is a ื“ื™ืŸ, ืœื”ื•ื• ื›ืฉื ื™ื ืฉื“ื ื•, let it be like two people who ืคืกืงื ื“! If two say ื–ื›ืื™ or two say ื—ื™ื™ื‘, why is it that you have to add another person, another ื“ื™ื™ืŸ? Why don't we say leave it the way it is and let's follow what these two say? ืื™ื™ the third one says he doesn't know, so automatically he falls out, but ื‘ื“ื™ืขื‘ื“ if two people ืคืกืงืŸ, it's also good, so let this be considered as if two people ืคืกืงื ื“. So he answered, ืฉืื ื™ ื”ืชื, there it's different, ื“ืžืขื™ืงืจื ืื“ืขืชื ื“ืชืœืชื ื™ืชื‘ื™, that ืœื›ืชื—ื™ืœื” when they sat down to ืคืกืงืŸ they sat down as three, so they had in mind that this should be a ื“ื™ืŸ ืชื•ืจื” ืคืกืงื ื“ by three, so therefore if one says I don't know, you must add another one in order to have three, because that's what they had in mind when they sat down. But ื”ื›ื, here, when he said a ื“ื™ืŸ that two people who ืคืกืงืŸ, ื‘ื“ื™ืขื‘ื“ the ื“ื™ืŸ is a ื“ื™ืŸ, ืœืื• ืื“ืขืชื ื“ืชืœืชื ื™ืชื™ื‘ื™, they didn't sit down in the order in mind to have three people, ืœื›ืชื—ื™ืœื” they sat down with two, so then it is good. Then the

Rabban Shimon ben Gamliel on three judges versus two for settlement

ื’ืžืจื says, ืื™ืชื™ื‘ื™ื”, I will ask you a ืงื•ืฉื™ื, we learned in a ื‘ืจื™ื™ืชื, ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ ืื•ืžืจ, ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ says, ื”ื“ื™ืŸ ื‘ืฉืœืฉื”, when you ืคืกืงืŸ a ื“ื™ืŸ you must have three people, ื•ืคืฉืจื” ื‘ืฉื ื™ื, but if you're going to make a ืคืฉืจื”, which is an arbitration, and you're going to make a settlement, so then two people are enough. ื•ื™ืคื” ื›ื— ืคืฉืจื” ืžื›ื— ื”ื“ื™ืŸ, and the ืคืฉืจื”, a settlement through arbitration, is stronger, has a stronger ื›ื— than a ื“ื™ืŸ itself, ืฉืฉื ื™ื ืฉื“ื ื•, if two people ืคืกืงื ื“ a ื“ื™ืŸ, ื‘ืขืœื™ ื“ื™ื ื™ืŸ ื™ื›ื•ืœื™ืŸ ืœื—ื–ื•ืจ ื‘ื”ืŸ, the two ื‘ืขืœื™ ื“ื™ื ื™ื, the two people involved, can change their mind, they don't have to accept the ืคืกืง ื“ื™ืŸ given by those two people who ืคืกืงื ื“. ืื‘ืœ ืฉื ื™ื ืฉืขืฉื• ืคืฉืจื”, but if two people made a ืคืฉืจื”, if two people made a settlement, ืื™ืŸ ื‘ืขืœื™ ื“ื™ื ื™ืŸ ื™ื›ื•ืœื™ืŸ ืœื—ื–ื•ืจ ื‘ื”ืŸ, so then the two ื‘ืขืœื™ ื“ื™ื ื™ื cannot change their mind afterwards. So here we see that if two people ืคืกืงื ื“, the ื“ื™ืŸ is not a ื“ื™ืŸ, only by a settlement we say that if two people do it, then the settlement is a settlement, it must be accepted, but not by a ื“ื™ืŸ, so that's a ืงื•ืฉื™ื on ืฉืžื•ืืœ who says that if two people ืคืกืงื ื“ the ื“ื™ืŸ is a ื“ื™ืŸ. ื•ื›ื™ ืชื™ืžื, ืื™ื™ you might say, ืคืœื™ื’ื™ ืจื‘ื ืŸ ืขืœื™ื” ื“ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, that the ืจื‘ื ืŸ argue against ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, this is only the opinion of ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, but the ืจื‘ื ืŸ argue and they would say that even by a ื“ื™ืŸ, if two people ืคืกืงืŸ, ื‘ื“ื™ืขื‘ื“ the ื“ื™ืŸ is a ื“ื™ืŸ. But you can't say that, because ื•ื”ืืžืจ ืจื‘ื™ ืื‘ื”ื•, didn't ืจื‘ื™ ืื‘ื”ื• say, ืฉื ื™ื ืฉื“ื ื• ืœื“ื‘ืจื™ ื”ื›ืœ ืื™ืŸ ื“ื™ื ื™ื”ื ื“ื™ืŸ, that if two people ืคืกืงืŸ a ื“ื™ืŸ, according to everybody the ื“ื™ืŸ is not a ื“ื™ืŸ, that even according to those that say that by a ืคืฉืจื”, by a settlement you do not have to have three, but when it comes to a ื“ื™ืŸ, if you ืคืกืงืŸ not through a settlement, but through a real ื“ื™ืŸ, everyone agrees that you must have three and two is not enough. So here we see that ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ's opinion is accepted by everybody, and the ืจื‘ื ืŸ do not argue on ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ. ื’ืžืจื says, "ื’ื‘ืจื ืื’ื‘ืจื ืงืจืžื™ืช? You're asking from one person to the other? Who said that the ืจื‘ื ืŸ don't argue on ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ and everyone agrees that by a ื“ื™ืŸ, if two people ืคืกืงื 'ื“, the ื“ื™ืŸ is not a ื“ื™ืŸ? ืจื‘ ืื‘ื”ื• said that. So what kind of ืงืฉื™ื do you have from ืจื‘ ืื‘ื”ื• on ืฉืžื•ืืœ? ืจื‘ ืื‘ื”ื• could hold that the ืจื‘ื ืŸ agree with ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, but ืฉืžื•ืืœ will hold that the ืจื‘ื ืŸ argue on ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ. It's only his own opinion that if two people ืคืกืงื 'ื“, the ื‘ืขืœื™ ื“ื™ื ื™ื could still change their mind because it's not a ื“ื™ืŸ. But the ื—ื›ืžื™ื, they argue on ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, and they would hold that if two people ืคืกืงื 'ื“, the ื“ื™ืŸ is a ื“ื™ืŸ." But ืชื•ืกืคื•ืช asks a ืงืฉื™ื, that what does he mean when he says that ืคืฉืจื” is stronger than ื“ื™ืŸ? That by ื“ื™ืŸ, if two people ืคืกืงื 'ื“, the ื‘ืขืœื™ ื“ื™ื ื™ื still could change their mind; by ืคืฉืจื”, they cannot change their mind. ืœื›ืื•ืจื”, by ืคืฉืจื”, the only reason they can't change their mind and they must accept the settlement is because they ืœื›ืชื—ื™ืœื” accepted it, because you can't just force a settlement upon them. If they agreed to make a settlement, so then after the people who are judging it come to a settlement, they must accept it, because ืœื›ืชื—ื™ืœื” they were ืžืงื‘ืœ upon themselves to make the settlement. If that is the case, so by a ื“ื™ืŸ the same thing: if they would have accepted the two people to ืคืกืง'ืŸ the ื“ื™ืŸ, then also they would have to accept their ืคืกืง ื“ื™ืŸ. The only reason why we say that if two people ืคืกืง'ืŸ a ื“ื™ืŸ they could change their mind, they don't have to accept it, is because they were not ืžืงื‘ืœ upon themselves to listen to them. But if they would have been ืžืงื‘ืœ upon themselves to listen to them, even by a ื“ื™ืŸ they would have to. And by a ืคืฉืจื” the same: the only reason that they must listen to the ืคืฉืจื” is because they accepted upon themselves. So where do we see that ืคืฉืจื” is stronger than ื“ื™ืŸ? In that case where they must accept the ืคืฉืจื”, a similar case by ื“ื™ืŸ they would also have to accept. If they were ืžืงื‘ืœ upon themselves to listen to their ื“ื™ืŸ, even if they're two, they would have to accept. So ืชื•ืกืคื•ืช says what he means is, in a case, for instance, when they came to two people and they said to them, "You ืคืกืง'ืŸ us as it is customary to ืคืกืง'ืŸ a ื“ื™ืŸ," or they said to them, "You make a ืคืฉืจื”, make a settlement with us as it is customary to make a ืคืฉืจื”." So in this case, in the case of a ืคืฉืจื”, since they said, "We accept upon ourselves that you should make a ืคืฉืจื” as it is the custom," so after they come with the ืคืฉืจื”, they must accept it. But if the same thing would happen by a ื“ื™ืŸ, they don't have to accept it. Since they said, "I want you to ืคืกืง'ืŸ as it is customary to ืคืกืง'ืŸ," and since it is customary to ืคืกืง'ืŸ with three, so then when the two come with the ืคืกืง ื“ื™ืŸ, they don't have to listen. So this is the case where we see that ื“ื™ืŸ is not as strong as ืคืฉืจื”. Then the ื’ืžืจื continues: ื’ื•ืคื, here is the ื’ื•ืฃ of the thing that we mentioned before. ืืžืจ ืจื‘ ืื‘ื”ื•, ืจื‘ ืื‘ื”ื• said, ืฉื ื™ื ืฉื“ื ื• ื“ื™ื ื™ ืžืžื•ื ื•ืช, if two people ืคืกืงื 'ื“ a monetary ื“ื™ืŸ, ื“ื‘ืจื™ ื”ื›ืœ, according to everybody, ืื™ืŸ ื“ื™ื ื™ื”ื ื“ื™ืŸ, the ื“ื™ืŸ is not a ื“ื™ืŸ. Even those that hold that by ืคืฉืจื” two is enough, but by a ื“ื™ืŸ, it is not enough. The ื’ืžืจื says, ืื™ืชื™ื‘ื™ื” ืจื‘ื ืœืจื‘ ืื‘ื”ื•, ืจื‘ื asked a ืงืฉื™ื to ืจื‘ ืื‘ื”ื•, we learned: ื“ืŸ ืืช ื”ื“ื™ืŸ, if one person ืคืกืงื 'ื“ a ื“ื™ืŸ, and this person was not a ืžื•ืžื—ื”, because a ืžื•ืžื—ื” is different, but here we're talking in a case where he was not a ืžื•ืžื—ื”, because at the end of this ื“ื™ืŸ, it says clearly, ืื ื”ื™ื” ืžื•ืžื—ื”, the ื“ื™ืŸ is different, so obviously the beginning is not talking about a ืžื•ืžื—ื”. So we're speaking about an individual who was not a ืžื•ืžื—ื”, who ืคืกืงื 'ื“ a ื“ื™ืŸ, ื•ื–ื™ื›ื” ืืช ื”ื—ื™ื™ื‘, and the one that really was supposed to be guilty, he made him innocent, ื•ื—ื™ื™ื‘ ืืช ื”ื–ื›ืื™, and the one that was supposed to be innocent, he made him guilty, or ื˜ื™ืžื ืืช ื”ื˜ื”ื•ืจ, something that was supposed to be ื˜ื”ื•ืจ, he made it ื˜ืžื, ื˜ื™ื”ืจ ืืช ื”ื˜ืžื, or something that was supposed to be ื˜ืžื, he made it ื˜ื”ื•ืจ, ืžื” ืฉืขืฉื” ืขืฉื•ื™, what he did is done, the ื“ื™ืŸ that he ืคืกืงื 'ื“ is a ื“ื™ืŸ, ื•ืžืฉืœื ืžื‘ื™ืชื•, but he has to pay from his house, from his own money, for the loss that he caused. So we see clearly that even though he is one, nevertheless, his ื“ื™ืŸ is a ื“ื™ืŸ. So how could ืจื‘ ืื‘ื”ื• say that everyone agrees that by a ื“ื™ืŸ then you must have three, and if two did it it's not enough, certainly if one? The

Case of a single judge accepted by the parties

ื’ืžืจื answers, ื”ื›ื ื‘ืžืื™ ืขืกืงื™ื ืŸ, that here we're talking in a case ื“ืงื‘ืœื•ื”ื• ืขืœื™ื™ื”ื•, that they accepted upon him. When we say that even if one ืคืกืงื 'ื“, who was not a ืžื•ืžื—ื”, nevertheless, his ื“ื™ืŸ is a ื“ื™ืŸ, is if the ื‘ืขืœื™ ื“ื™ื ื™ื accepted him upon them. And therefore, since they accepted to do as he will ืคืกืง'ืŸ, his ืคืกืง ื“ื™ืŸ is valid. But the ื’ืžืจื asks: ืื™ ื”ื›ื™, so ืืžืื™ ืžืฉืœื ืžื‘ื™ืชื•? Why does he have to pay from his house? If they accepted upon themselves his ืคืกืง ื“ื™ืŸ, then even if it's a mistake, he shouldn't have to pay the money, because they said that they're going to listen to what he says. The ื’ืžืจื answers, ื“ืืžืจื• ืœื™ื”, the case is when they said to him, "ื“ื™ื™ื ืกื˜ ืื•ื ื– ื“ื™ืŸ ืชื•ืจื”." we accept you to ืคืกืงืŸ to us, but according to the ื“ื™ืŸ of the ืชื•ืจื”. That, since he made a mistake, it is not the ื“ื™ืŸ of the ืชื•ืจื”, and therefore, he is responsible to pay. But nevertheless, the ื“ื™ืŸ he ืคืกืงื ื“ is a ื“ื™ืŸ, because they, generally speaking, did accept him to be their ื“ื™ื™ืŸ, their judge, and therefore, the ื“ื™ืŸ is a ื“ื™ืŸ. ืืžืจ ืœื™ื” ืจื‘ ืกืคืจื ืœืจื‘ื, ืจื‘ ืกืคืจื said to ืจื‘ื, ื“ื˜ืขื” ื‘ืžืื™, what was his mistake? When we say if he made a mistake, he has to pay, what kind of mistake did he make? ืื™ืœื™ืžื if you're going to say ื“ื˜ืขื” ื‘ืžืฉื ื”, that he made a mistake in a ื“ื™ืŸ which is a clear, open ืžืฉื ื”, and he ืคืกืงื ื“ a ื“ื™ืŸ against what the ืžืฉื ื” says, ื•ื”ืืžืจ ืจื‘ ืฉืฉืช didn't ืจื‘ ืฉืฉืช say, ืืžืจ ืจื‘ ืืกื™ in the name of ืจื‘ ืืกื™, ื˜ืขื” ื‘ืžืฉื ื” ื—ื•ื–ืจ, if a person ืคืกืงื ืก and makes a mistake in a clear ื“ื™ืŸ of a ืžืฉื ื”, the whole ื“ื™ืŸ goes back. It's not the ืคืฉื˜ the ื“ื™ืŸ is a ื“ื™ืŸ, but if there is any loss, he has to pay. ืœื›ืชื—ื™ืœื” the whole judgment is a mistake, and you have to redo the whole thing, because since it's such an open thing, it's not even considered a mistake that we should say it's something which is valid, but with a mistake. It's ืœื›ืชื—ื™ืœื” not valid. ืืœื therefore, we must say ื“ื˜ืขื” ื‘ืฉื™ืงื•ืœ ื”ื“ืขืช, that his mistake was not in an open ืžืฉื ื”, but in the judgment of his mind. He was supposed to judge it and compare it in a certain way to a certain ื“ื™ืŸ, and he made a mistake in the way he judged the case. Now ื”ื™ื›ื™ ื“ืžื™ ื‘ืฉื™ืงื•ืœ ื”ื“ืขืช, what do we mean he made a mistake in ืฉื™ืงื•ืœ ื”ื“ืขืช, in his estimation of his mind? ืืžืจ ืจื‘ ืคืคื so ืจื‘ ืคืคื said, ื›ื’ื•ืŸ for instance, ืชืจื™ ืชื ืื™ there is a ื“ื™ืŸ in which we have an argument between two ืชื ืื™ื, or ืชืจื™ ืืžื•ืจืื™ or two ืืžื•ืจืื™ื, ื“ืคืœื™ื’ื™ ืื”ื“ื“ื™ that are arguing, ื•ืœื ืื™ืชืžืจ ื”ืœื›ืชื ืœื ื›ืžืจ ื•ืœื ื›ืžืจ, we didn't learn clearly the ื”ืœื›ื” not like one, nor like the other, but ืกื•ื’ื™ื™ืŸ ื“ืขืœืžื ืืœื™ื‘ื ื“ื—ื“ ืžื™ื ื™ื™ื”ื•, the general ืกื•ื’ื™ื, the general trend of the ื“ื™ื ื™ื of the ื“ื™ื™ื ื™ื is like one of the two, but ื•ืื–ืœ ืื™ื”ื• he went, ื•ืขื‘ื“ ื›ืื™ื“ืš he did like the other, ื”ื™ื™ื ื• ืฉื™ืงื•ืœ ื”ื“ืขืช. That is called a mistake in ืฉื™ืงื•ืœ ื”ื“ืขืช. And this is a case where he would have to pay, because the one that he was ืžื–ื›ื”, that he said was innocent, you can't change now and tell him you pay the money, because he will say that, 'You ืคืกืงื ื“ that I am right, I don't have to pay. And we don't find anywhere that the ื”ืœื›ื” is like the other ืชื ื, like the other ืืžื•ืจื, and since you ืคืกืงื ื“ I was right, therefore, I don't have to pay.' So, they can't force him to pay. On the other hand, the one that lost the money could say, 'But after all, since the general trend is according to the other opinion, so I should be right, so why should I have lost the money?' So, they make the judge, the ื“ื™ื™ืŸ himself, that he should pay for the mistake that he made. Then the ื’ืžืจื continues, ืœื™ืžื ื›ืชื ืื™, let us say that there is a ืžื—ืœื•ืงืช between ืชื ืื™ื, that this ืžื—ืœื•ืงืช is between ืฉืžื•ืืœ and ืจื‘ ืื‘ื”ื•, whether two people that ืคืกืงืŸ a ื“ื™ืŸ if it's ื‘ื“ื™ืขื‘ื“ a ื“ื™ืŸ or not, is really a ืžื—ืœื•ืงืช between ืชื ืื™ื. Because we learned ื‘ื™ืฆื•ืข ื‘ืฉืœืฉื” ื“ื‘ืจื™ ืจื‘ื™ ืžืื™ืจ, ืจื‘ื™ ืžืื™ืจ holds that when you come to make a settlement, a ืคืฉืจื”, you have to have three people. ื•ื—ื›ืžื™ื ืื•ืžืจื™ื ืคืฉืจื” ื‘ื™ื—ื™ื“, and the ื—ื›ืžื™ื say that to make a ืคืฉืจื” is enough one person. ืกื‘ืจื•ื” so the ืชืœืžื™ื“ื™ื of the ื™ืฉื™ื‘ื” thought ื“ื›ื•ืœื™ ืขืœืžื ืžืงืฉื™ื ืŸ ืคืฉืจื” ืœื“ื™ืŸ, that everyone holds of this rule that we compare how many people we need to make a settlement to how many people we need for a ื“ื™ืŸ, that the same amount of people we need for a ื“ื™ืŸ we need for a ืคืฉืจื”. Everyone holds that. When we say everyone, we only refer to these two, ืจื‘ื™ ืžืื™ืจ and the ื—ื›ืžื™ื. It doesn't mean everyone all over, because one thing is for sure that ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ definitely doesn't hold that, because we learned before that ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ said clearly, ื”ื“ื™ืŸ ื‘ืฉืœืฉื” ื•ืคืฉืจื” ื‘ืฉื ื™ื, that for a ื“ื™ืŸ you need three, and for a ืคืฉืจื” it's enough two. So, when the ื’ืžืจื says here that ืœื›ืชื—ื™ืœื” they thought that everyone holds that a ืคืฉืจื” has the same ื“ื™ืŸ as a ื“ื™ืŸ, it definitely doesn't refer to ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ. So, what we mean here is that ืจื‘ื™ ืžืื™ืจ and the ื—ื›ืžื™ื who argue whether you need three or one is enough, these two definitely hold that a ืคืฉืจื” is like a ื“ื™ืŸ, the same amount we need for a ื“ื™ืŸ we need for a ืคืฉืจื”. And what is their ืžื—ืœื•ืงืช? ืžืื™ ืœืื• ื‘ื”ื ืงืžื™ืคืœื’ื™, don't you think the ืžื—ืœื•ืงืช is in this, ื“ืžืจ ืกื‘ืจ ื“ื™ืŸ ื‘ืฉืœืฉื”, ืจื‘ื™ ืžืื™ืจ holds that a ื“ื™ืŸ needs three people, and therefore, since we everyone holds a ืคืฉืจื” is like a ื“ื™ืŸ, so a ืคืฉืจื” also needs three people. That's why he said ืคืฉืจื” is ื‘ื™ืฆื•ืข ื‘ืฉืœืฉื”. ื•ืžืจ ืกื‘ืจ, and the ื—ื›ืžื™ื hold ื“ื™ืŸ ื‘ืฉื ื™ื, that a ื“ื™ืŸ is enough two, or one. So, since we compare a ืคืฉืจื” to a ื“ื™ืŸ, so just like by a ื“ื™ืŸ one is enough, or two, so too by a ืคืฉืจื” one is enough. So, according to that, if this is true, the ืžื—ืœื•ืงืช between ืจื‘ื™ ืžืื™ืจ and the ื—ื›ืžื™ื is not really concerning how many people you need by a ืคืฉืจื”, but really how many people you need by ื“ื™ืŸ, that according to ืจื‘ื™ ืžืื™ืจ you need three, and according To ืจื‘ื ืŸ two or one is enough. So it comes out that a ืžื—ืœื•ืงืช between ืฉืžื•ืืœ and ืจื‘ ืื‘ื”ื• really is a ืžื—ืœื•ืงืช between ืจื‘ื™ ืžืื™ืจ and the ื—ื›ืžื™ื. ืฉืžื•ืืœ holds that two is enough or one is enough, and ืจื‘ ืื‘ื”ื• holds that everyone agrees that you must have three by a ื“ื™ืŸ. And the ื’ืžืจื says ืœื no, ื“ื›ื•ืœื™ ืขืœืžื ื‘ืืžืช everyone holds ื“ื™ืŸ ื‘ืฉืœืฉื”. Could be that everyone holds that for a ื“ื™ืŸ you need three. ื•ื”ื›ื ื‘ื”ื ืงื ืžื™ืคืœื’ื™, here the ืžื—ืœื•ืงืช is as follows: ื“ืžืจ ืกื‘ืจ, one holds ืžืงืฉื™ื ืŸ ืคืฉืจื” ืœื“ื™ืŸ, that we do compare a ืคืฉืจื” to a ื“ื™ืŸ. ืจื‘ื™ ืžืื™ืจ holds that we compare the settlement to a ื“ื™ืŸ. So just like by a ื“ื™ืŸ you have to have three, by a settlement you also have to have three. ื•ืžืจ ืกื‘ืจ, and the ื—ื›ืžื™ื hold, ืœื ืžืงืฉื™ื ืŸ ืคืฉืจื” ืœื“ื™ืŸ, that we do not compare a ืคืฉืจื” to a ื“ื™ืŸ, and therefore even though by a ื“ื™ืŸ you have to have three, by a ืคืฉืจื” you do not have to have three. Now, what should be the ืกื‘ืจื, why we should think that we should

Comparing a settlement to a judgment via Davidโ€™s verse

compare ืคืฉืจื” to ื“ื™ืŸ? So ืจืฉืดื™ says, and he quotes from the ื’ืžืจื on ืขืžื•ื“ ื‘ืณ, where it brings the ืคืกื•ืง, ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื”, that ื“ื•ื“ did ืžืฉืคื˜ and ืฆื“ืงื”. ืžืฉืคื˜ means judgment, and ืฆื“ืงื” means righteousness. Now how do these two fit? That means that he made a ืคืฉืจื”. A ืคืฉืจื”, when you make a settlement, you have both, it's judgment and righteousness. On one hand it's judgment, but it's also righteousness, because otherwise, if you go according to the ื“ื™ืŸ, then if for one person it's good, for the other person it's not. But if you make a settlement, it's good for both. So we see that this ืคืกื•ืง is speaking about a settlement, and nevertheless, the ืคืกื•ืง says ืžืฉืคื˜ ื•ืฆื“ืงื”, it compares it to ืžืฉืคื˜. So that means that we should compare settlement, a ืคืฉืจื”, to ืžืฉืคื˜. That's the reason why the ื’ืžืจื says we should ืžืงืฉื™ื ืŸ ืคืฉืจื” ืœื“ื™ืŸ, compare the settlement to the ื“ื™ืŸ. But ืชื•ืกืคื•ืช says that we cannot say that the ื’ืžืจื ืกื‘ืจื here is based on that ืคืกื•ืง, because later on we find a ืžื—ืœื•ืงืช. The ืชื ื ืงืžื says, ื›ืฉื ืฉื”ื“ื™ืŸ ื‘ืฉืœืฉื” ื›ืš ื‘ื™ืฆื•ืข ื‘ืฉืœืฉื”, that just like a ื“ื™ืŸ has to have three people, so a ืคืฉืจื” must have three people too. So obviously that ืชื ื holds that we compare ืคืฉืจื” to ื“ื™ืŸ, that's why he says that just like ื“ื™ืŸ needs three, ืคืฉืจื” also needs three. Now, later on in the same ื‘ืจื™ื™ืชื, we find that ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” learns out from this ืคืกื•ืง ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื”, that it's a ืžืฆื•ื” to make a ืคืฉืจื”. Now, since this is the opinion of ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”, it comes out from the ื‘ืจื™ื™ืชื that the ืชื ื ืงืžื argued on ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”. He holds that it's not a ืžืฆื•ื” to make a ืคืฉืจื”. Now, since he doesn't hold it's a ืžืฆื•ื” to make a ืคืฉืจื”, obviously he doesn't ื“ืจืฉืŸ the ืคืกื•ืง ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื”. Because if he would ื“ืจืฉืŸ that ืคืกื•ืง, he would also admit that it's a ืžืฆื•ื”. Because if it's called ืฆื“ืงื”, it's a ืžืฆื•ื” to do ืฆื“ืงื”. Since the ืชื ื that we mentioned before that says that just like a ื“ื™ืŸ is ื‘ืฉืœืฉื”, ื›ืš ื‘ื™ืฆื•ืข ื‘ืฉืœืฉื”, does not hold it's a ืžืฆื•ื”, obviously he doesn't ื“ืจืฉืŸ the ืคืกื•ืง ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜. Now, according to ืจืฉืดื™, who says that the reason we compare ืคืฉืจื” to ื“ื™ืŸ is based on this ืคืกื•ืง ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื”, but in that ื‘ืจื™ื™ืชื later we see that the ืชื ื ืงืžื, who holds that we do compare ืคืฉืจื” to ื“ื™ืŸ, nevertheless doesn't ื“ืจืฉืŸ the ืคืกื•ืง ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื”. So we see that it's not from this ืคืกื•ืง that we learn out to compare ืคืฉืจื” to ื“ื™ืŸ, but we compare it with ืฉื›ืœ, that since a ื“ื™ืŸ must have three, so too a ืคืฉืจื”, but it's not based on this ืคืกื•ืง. And ืชื•ืกืคื•ืช adds, we also can't say that it comes from the other ืคืกื•ืง where it says ืืžืช ื•ืžืฉืคื˜ ืฉืœื•ื, as the ื’ืžืจื will bring later, for the same reason. Because if we would ื“ืจืฉืŸ the ืคืกื•ืง, then we should hold it's a ืžืฆื•ื” to make a ืคืฉืจื”. And since the ืชื ื ืงืžื doesn't hold it's a ืžืฆื•ื” to make a ืคืฉืจื”, obviously he doesn't ื“ืจืฉืŸ that ืคืกื•ืง. And nevertheless, that ืชื ื holds that we compare ืคืฉืจื” to ื“ื™ืŸ. So obviously, it's not based on these ืคืกื•ืงื™ื. Another thing that's important to note here is that even if we hold ืžืงืฉื™ื ืŸ ืคืฉืจื” ืœื“ื™ืŸ, that we compare the settlement to a ื“ื™ืŸ, it doesn't mean, ืชื•ืกืคื•ืช says, that concerning all the ื“ื™ื ื™ื, a ืคืฉืจื” will have the same ื“ื™ืŸ as a ื“ื™ืŸ. It's only concerning the amount of people you have to have to judge it. But not concerning other ื“ื™ื ื™ื. For instance, by a ื“ื™ืŸ, the ื“ื™ืŸ is when you have three ื“ื™ื™ื ื™ื sit down, so then you ืคืกืงืŸ according to the majority. If two out of the three go with one opinion, then you follow their opinion. But concerning a ืคืฉืจื”, the ื“ื™ืŸ is not so, that you must have a unanimous opinion, they all must hold the same way. So it comes out that even if we hold that ืžืงืฉื™ื ืŸ ืคืฉืจื” ืœื“ื™ืŸ, it doesn't mean that concerning everything. It is only concerning the amount of people you have to judge this ื“ื™ืŸ, to be the ื“ื™ื™ื ื™ื. Then the ื’ืžืจื continues: ืœื™ืžื, let us say, ืชืœืชื ืชื ืื™ ื‘ืคืฉืจื”, that there are three ืชื ืื™ื concerning ืคืฉืจื”, three opinions among the ืชื ืื™ื of how many judges you must have by a settlement. ื“ืžืจ ืกื‘ืจ ื‘ืฉืœืฉื”, ืจื‘ื™ ืžืื™ืจ we mentioned before holds you must have three people. ื•ืžืจ ืกื‘ืจ, and one holds ื‘ืฉื ื™ื, that is ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ that we brought in the previous ื‘ืจื™ื™ืชื, where he says clearly, ื”ื“ื™ืŸ ื‘ืฉืœืฉื” ื•ืคืฉืจื” ื‘ืฉื ื™ื. so he holds two people, ื•ืžืจ ืกื‘ืจ, and the ื—ื›ืžื™ื of the second ื‘ืจื™ื™ืชื they hold ื‘ื™ื—ื™ื“, that one is enough to make a ืคืฉืจื”. And the ื’ืžืจื says, ืืžืจ ืจื‘ ืื—ื ื‘ืจื™ื” ื“ืจื‘ ืื™ืงื, so ืจื‘ ืื—ื ื‘ืจื™ื” ื“ืจื‘ ืื™ืงื said, ื•ืื™ืชื™ืžื ืจื‘ ื™ื™ืžืจ ื‘ืจ ืฉืœืžื™ื, others say it was ืจื‘ ื™ื™ืžืจ ื‘ืจ ืฉืœืžื™ื that said that, that ื‘ืืžืช ืžืืŸ ื“ืืžืจ ืชืจื™ ืืคื™ืœื• ื—ื“ ื ืžื™, that the one that says two, which is ืจื‘ืŸ ืฉืžืขื•ืŸ ื‘ืŸ ื’ืžืœื™ืืœ, really he holds that one is also enough, ื•ื”ืื™ ื“ืงืืžืจ ืชืจื™, and the reason he says that you have to have two, ื›ื™ ื”ื™ื›ื™ ื“ืœื”ื•ื• ืขืœื™ื” ืกื”ื“ื™, in order that they should be witnesses, to be witnesses that this is the ืคืฉืจื”, the settlement they came to, so that's why you have to have

Settlement (ืคืฉืจื”) Does Not Require Acquisition (ืงื ื™ื™ืŸ)

two. ืืžืจ ืจื‘ ืืฉื™, ืจื‘ ืืฉื™ said, ืฉืžืข ืžื™ื ื”, we understand from here that ืคืฉืจื” ืื™ื ื” ืฆืจื™ื›ื” ืงื ื™ื™ืŸ, that you don't have to make a ืงื ื™ื™ืŸ when you are ready to make a ืคืฉืจื”. You don't have to make, do the act of acquisition in order to be ืžืฉืขื‘ื“ yourself, to give yourself over to accept the ืคืฉืจื”. How does he know that? ืื™ ืกืœืงื ื“ืขืชืš ืฆืจื™ื›ื” ืงื ื™ื™ืŸ, if you're going to say that when a person or the two, the ื‘ืขืœื™ ื“ื™ืŸ, agree for a settlement, they must make a ืงื ื™ื™ืŸ, so then ืœืžืืŸ ื“ืืžืจ ืฆืจื™ื›ื” ืชืœืชื, according to the one that holds that you need three people by a ืคืฉืจื”, ืœืžื” ืœื™, why do you need three? ืชืกื’ื™ ื‘ืชืจื™, should be enough two, ื•ืœืงื ื•, when they make a ืงื ื™ื™ืŸ. Really, what is a ืคืฉืจื”, a settlement? That he agrees that even if he is not sure that he owes the money, he agrees to make a settlement and come to some agreement. That is as if he is ืžื•ื—ืœ his part. Now why do we have to have three people as a ื‘ื™ืช ื“ื™ืŸ? Anytime a person gives up a certain right he has and he makes a ืงื ื™ื™ืŸ that he agrees to it, automatically that is valid. So here too, why should you have to have three people in the form of a ื‘ื™ืช ื“ื™ืŸ? Why shouldn't two be enough? And these two will be like witnesses. And he will make a ืงื ื™ื™ืŸ and he will make a ืงื ื™ื™ืŸ. So then they both agree to give in even if it is not so, and that should be enough, because when the two ื“ื™ื™ื ื™ื will come up with a settlement and they agreed to follow the settlement, so they agreed to be ืžื•ื—ืœ, to give in, even if they are right. So that should be enough, why should you have to have three people? Now since we say that you have to have three people according to this opinion, obviously a ืคืฉืจื” doesn't need a ืงื ื™ื™ืŸ. So since there is no ืงื ื™ื™ืŸ made, so as far as the ืžื—ื™ืœื” itself, the fact that they're giving in, that's not enough because they could later change their mind. As long as you don't make a ืงื ื™ื™ืŸ, you could change your mind. So if you have three people, then they cannot change their mind because it has a ื“ื™ืŸ of a ื‘ื™ืช ื“ื™ืŸ. So from this opinion that says that you have to have three people to the ืคืฉืจื”, that proves that by a ืคืฉืจื” you don't have to have a ืงื ื™ื™ืŸ, because if you would have to have a ืงื ื™ื™ืŸ, then you wouldn't need a ื‘ื™ืช ื“ื™ืŸ at all. The ืงื ื™ื™ืŸ itself would make it valid that they're giving in to do as they will say. But the ื’ืžืจื says, ื•ื”ืœื›ืชื ืคืฉืจื” ืฆืจื™ื›ื” ืงื ื™ื™ืŸ, and the ื”ืœื›ื” is ืคืฉืจื” does need a ืงื ื™ื™ืŸ, and even if you have three people, nevertheless in order that that ืคืฉืจื” should be valid and you have to follow the ืคืฉืจื”, you must make a ืงื ื™ื™ืŸ. And here in the ืจืืฉื•ื ื™ื we have a great discussion, starting from ืชื•ืกืคื•ืช, whether we have a ืจืื™ื” from this ื’ืžืจื that ืžื—ื™ืœื” ืฆืจื™ื›ื” ืงื ื™ื™ืŸ, that if a person is ืžื•ื—ืœ to somebody else a ื—ื•ื‘, a loan, or whatever it should be, whether he has to make a ืงื ื™ื™ืŸ for his ืžื—ื™ืœื” to be valid or not. And the whole discussion is, since in this ื’ืžืจื we say that if he would make a ืงื ื™ื™ืŸ you wouldn't need three because you are ืžื•ื—ืœ, so automatically your ืงื ื™ื™ืŸ makes your ืžื—ื™ืœื” valid, why do you need three? So it seems as if the ื’ืžืจื is saying that for ืžื—ื™ืœื” you have to have a ืงื ื™ื™ืŸ, and there's a whole discussion here whether we have a ืจืื™ื” from this ื’ืžืจื or there is no ืจืื™ื” from this ื’ืžืจื. Then the ื’ืžืจื says, ืชื ื• ืจื‘ื ืŸ, the ืจื‘ื ืŸ learned, ื›ืฉื ืฉื”ื“ื™ืŸ ื‘ืฉืœืฉื” ื›ืš ื‘ื™ืฆื•ืข ื‘ืฉืœืฉื”, the ืชื ื says that just like a ื“ื™ืŸ needs three people, so does ื‘ื™ืฆื•ืข, which means a ืคืฉืจื”, a settlement, also need three people. ื ื’ืžืจ ื”ื“ื™ืŸ, but after the ื“ื™ืŸ was over, after the verdict was given, ืื™ ืืชื” ืจืฉืื™ ืœื‘ืฆื•ืข, then you are already not allowed to make a settlement. And

Rashi on the Finality of a Verdict

ืจืฉืดื™ says, as we know that what is ื’ืžืจ ื“ื™ืŸ, ื’ืžืจ ื“ื™ืŸ means when the ื‘ื™ืช ื“ื™ืŸ comes out with a verdict and the ื‘ื™ืช ื“ื™ืŸ says ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื–ื›ืื™, you, person, are innocent, ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื—ื™ื™ื‘, you, person, you are guilty. So if they said that statement already, then you can't go back and make a settlement. This is the way ืจืฉืดื™ learns ืคืฉื˜ in the words of the ื’ืžืจื, ื ื’ืžืจ ื”ื“ื™ืŸ ืื™ ืืชื” ืจืฉืื™ ืœื‘ืฆื•ืข. And ืชื•ืกืคื•ืช says from the ืœืฉื•ืŸ of the ื’ืžืจื ืกืœืงื ืžืฉืžืข like that. ื ื’ืžืจ ื”ื“ื™ืŸ, when it says the ื“ื™ืŸ was finished, this is actually what we usually mean. The ื“ื™ืŸ is over when the ื‘ื™ืช ื“ื™ืŸ says ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื–ื›ืื™, ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื—ื™ื™ื‘. But still ืชื•ืกืคื•ืช asks what's the ื”ื•ื” ืืžื™ื ื in the ื’ืžืจื that we could have made a settlement? If after the ืคืกืง ื“ื™ืŸ was given already, certainly you cannot make a settlement. But the ื“ื•ื—ืง ืชื•ืกืคื•ืช says we could have said That maybe the ื‘ื™ืช ื“ื™ืŸ could say to them, we ื˜ืืงืข gave you the verdict, but maybe we made a mistake. So therefore, maybe you still want to make a settlement. And the ื—ื™ื“ื•ืฉ of the ืชื ื is that after the verdict was given, you cannot make a settlement. But still that ืคืฉื˜ is hard, so therefore ืชื•ืกืคื•ืช learns that here in the ื’ืžืจื ื ื’ืžืจ ื”ื“ื™ืŸ doesn't mean actually that they gave the verdict, but it only means that in the mind of the ื“ื™ื™ื ื™ื they already had the verdict made up, that in their mind they already see that this person is right and this person is wrong, but they still didn't say ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื–ื›ืื™, ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื—ื™ื™ื‘. So here, since already in their mind it is clear that this person is right, they have no right to suggest a settlement, because we have to assume that the one that really would have come out ื–ื›ืื™, would have come out innocent according to the way they have in their mind, had he known that in their mind they already had made up that he is innocent, if he would know that, he definitely wouldn't agree to the settlement. So it's like a settlement with a mistake, ื‘ื˜ืขื•ืช. So therefore, the ื“ื™ืŸ is that after they already know the ื“ื™ืŸ, even though they didn't say it yet, you shouldn't, you're not allowed to make a settlement. But according to the ืจืืดืฉ, this only applies after they already came out with the verdict. But nevertheless, ืชื•ืกืคื•ืช says that is for sure that if the ืคืกืง ื“ื™ืŸ is that one of them has to give a ืฉื‘ื•ืขื”, then definitely you still could suggest a settlement, because in order to avoid a ืฉื‘ื•ืขื” we always do everything we can, and therefore you're also allowed to suggest a settlement. Then the ื’ืžืจื continues, ืจื‘ื™ ืืœืขื–ืจ ื‘ื ื• ืฉืœ ืจื‘ื™ ื™ื•ืกื™ ื”ื’ืœื™ืœื™ ืื•ืžืจ, ืจื‘ื™ ืืœืขื–ืจ, the son of ืจื‘ื™ ื™ื•ืกื™ ื”ื’ืœื™ืœื™, says, ืืกื•ืจ ืœื‘ืฆื•ืข. You're not allowed to make a settlement. ื•ื›ืœ ื”ื‘ื•ืฆืข, and any ื“ื™ื™ืŸ who does make a settlement, ื”ืจื™ ื–ื” ื—ื•ื˜ื. He is a sinner. It's an ืขื‘ื™ืจื”. ื•ื›ืœ ื”ืžื‘ืจืš ืืช ื”ื‘ื•ืฆืข, and anybody who praises the one that made a settlement, ื”ืจื™ ื–ื” ืžื ืืฅ. So he's like cursing, it's like cursing ื”ืณ. He's cursing instead of ื‘ืขื ื˜ืฉื™ื ื’. ื•ืขืœ ื–ื” ื ืืžืจ, that's what the ืคืกื•ืง means, ื‘ื•ืฆืข ื‘ืจืš ื ืืฅ ื”ืณ. If someone ื‘ืขื ื˜ืฉืขืก the ื‘ื•ืฆืข, and here ื‘ื•ืฆืข means a settlement, if someone ื‘ืขื ื˜ืฉืขืก, blesses the one that made a settlement, really he is ื ืืฅ ื”ืณ, really he is cursing ื”ืณ. ืืœื what should be? ื™ืงื•ื‘ ื”ื“ื™ืŸ ืืช ื”ื”ืจ. The ื“ื™ืŸ should cut through the mountain, that you have to stick to the ื“ื™ืŸ, and the way the ื“ื™ืŸ is, that's the way you have to ืคืกืงืŸ. ืฉื ืืžืจ, because the ืคืกื•ืง says, ื›ื™ ื”ืžืฉืคื˜ ืœืืœืงื™ื ื”ื•ื. The ืžืฉืคื˜, the judgment is to ื”ืณ, and therefore you must follow judgment, and whatever the ื“ื™ืŸ is, that's how you go. ื•ื›ืŸ ืžืฉื” ื”ื™ื” ืื•ืžืจ, that's what ืžืฉื” used to say. He used to say ื™ืงื•ื‘ ื”ื“ื™ืŸ ืืช ื”ื”ืจ, let the ื“ื™ืŸ cut through the mountain, and we have to follow the ื“ื™ืŸ. ืื‘ืœ

Aaronโ€™s Approach: Peace-Making Over Judicial Ruling

ืื”ืจืŸ, but his brother ืื”ืจืŸ, he was different. ืื•ื”ื‘ ืฉืœื•ื, he loved peace, ื•ืจื•ื“ืฃ ืฉืœื•ื, he used to run after peace, ื•ืžืฉื™ื ืฉืœื•ื ื‘ื™ืŸ ืื“ื ืœื—ื‘ื™ืจื•, he used to make peace between a man and his friend. ืฉื ืืžืจ, the ืคืกื•ืง says, and this is a ืคืกื•ืง concerning ืื”ืจืŸ, because in the same place in ืžืœืื›ื™ the ืคืกื•ืง says, ื›ื™ ืฉืคืชื™ ื›ื”ืŸ ื™ืฉืžืจื• ื“ืขืช, the lips of the ื›ื”ืŸ would guard the ื“ืขืช. So we're talking about ืื”ืจืŸ ื”ื›ื”ืŸ, so there it says, ืชื•ืจืช ืืžืช ื”ื™ืชื” ื‘ืคื™ื”ื•, the true ืชื•ืจื” was in his mouth, ื•ืขื•ืœื” ืœื ื ืžืฆื ื‘ืฉืคืชื™ื•, no ืขื•ืœื”, no crookedness was found in his lips, ื‘ืฉืœื•ื ื•ื‘ืžื™ืฉื•ืจ ื”ืœืš ืืชื™, with peace and straightness he went with me, ื•ืจื‘ื™ื ื”ืฉื™ื‘ ืžืขื•ืŸ, and a lot he turned away from sins, from ืขื‘ื™ืจื•ืช. So ืื”ืจืŸ, what he did was, he tried to make peace. But as ืชื•ืกืคื•ืช says, the reason why he was allowed to do it, even according to this ืžืืŸ ื“ืืžืจ that you're not allowed to make a settlement, was because he wasn't the judge. The judge, the ื“ื™ื™ืŸ, is not allowed to ื‘ื•ืฆืข, he's supposed to stick to the ืžืฉืคื˜. But before you get to the judge, so then if a person wants to see that they make a settlement among themselves, that's very good, and that's what ืื”ืจืŸ did. Since ืžืฉื” was the judge, so ืื”ืจืŸ went to them before they went to ืžืฉื” the ื“ื™ื™ืŸ, and he saw that they should make a settlement among themselves.

Rabbi Elazar Prohibits Making Settlements

ืจื‘ื™ ืืœืขื–ืจ ืื•ืžืจ, ืจื‘ื™ ืืœืขื–ืจ says that the ืคืกื•ืง that he quoted, from where he sees that if you praise a person who makes a settlement really you're cursing ื”ืณ, the ืคืกื•ืง doesn't apply to that, the ืคืกื•ืง applies to something else. ื”ืจื™ ืฉื’ื–ืœ ืกืื” ืฉืœ ื—ื˜ื™ื, if a person stole a ืกืื” of wheat, ื•ื˜ื—ื ื”, and he ground it, ื•ืืคืื”, and he baked it, ื•ื”ืคืจื™ืฉ ืžืžื ื” ื—ืœื”, after he baked it he took off ื—ืœื”, the part that you take off which is holy and you give it to the ื›ื”ืŸ. ื›ื™ืฆื“ ืžื‘ืจืš, how could he make a ื‘ืจื›ื”? If he makes a ื‘ืจื›ื” on that ื—ืœื”, ืื™ืŸ ื–ื” ืžื‘ืจืš, not ื—ื™ื™ื‘ ื—ืœื” till after you bake it. On the other hand, even those things that you have to take off ื—ืœื” while it's dough, if you didn't do it ื‘ื“ื™ืขื‘ื“ you could take it off after you baked it, that's why he gives the example of taking off ื—ืœื” after it was baked. ืจื‘ื™ ืžืื™ืจ ืื•ืžืจ, ืจื‘ื™ ืžืื™ืจ says, ืœื ื ืืžืจ ื‘ื•ืฆืข ืืœื ื›ื ื’ื“ ื™ื”ื•ื“ื”, that when the ืคืกื•ืง says ื‘ื•ืฆืข ื‘ืจืš ื ืืฅ ื”ืณ, really it refers to ื™ื”ื•ื“ื”, ืฉื ืืžืจ, because it says in the ืชื•ืจื”, ื•ื™ืืžืจ ื•ื™ืืžืจ ื™ื”ื•ื“ื” ืืœ ืื—ื™ื•, ื™ื”ื•ื“ื” said to his brothers, ืžื” ื‘ืฆืข, what will we gain ื›ื™ ื ื”ืจื•ื’ ืืช ืื—ื™ื ื• if we will kill our brother. It was when they threw ื™ื•ืกืฃ into the pit, and then the group of ื™ืฉืžืขืืœื™ื passed by. So ื™ื”ื•ื“ื” said to his brothers, what will we gain if we kill him, let us sell him. So the ืชื•ืจื” uses the ืœืฉื•ืŸ ืžื” ื‘ืฆืข, that ื™ื”ื•ื“ื” said ืžื” ื‘ืฆืข ื›ื™ ื ื”ืจื•ื’ ืืช ืื—ื™ื ื•. ื‘ืฆืข really means money, but it means what money will we gain if we will kill our brother. So this ืคืกื•ืง, ื•ื‘ื•ืฆืข ื‘ืจืš ื ืืฅ ื”ืณ, which is from the same ืœืฉื•ืŸ as ื‘ืฆืข, refers to ื™ื”ื•ื“ื”. That the ืคืกื•ืง is saying, ื•ื›ืœ ื”ืžื‘ืจืš ืืช ื™ื”ื•ื“ื”, anybody who blesses ื™ื”ื•ื“ื”, ื”ืจื™ ื–ื” ืžื ืืฅ, he is cursing. ื•ืขืœ ื–ื” ื ืืžืจ, and on this it says, ื•ื‘ื•ืฆืข ื‘ืจืš ื ืืฅ ื”ืณ, that if ื‘ื•ืฆืข ื‘ืจืš, you bless the one that was ื‘ื•ืฆืข, the one that said ืžื” ื‘ืฆืข, really you're cursing ื”ืณ. And the reason why it is so is because since ื™ื”ื•ื“ื” saw that his brothers are listening to him, because after he told them to sell ื™ื•ืกืฃ, they listened to him and they sold ื™ื•ืกืฃ, why didn't he tell them to take ื™ื•ืกืฃ back to his father? So therefore, what ื™ื”ื•ื“ื” did is considered an ืขื‘ื™ืจื”, and anybody who blesses ื™ื”ื•ื“ื” is also doing an ืขื‘ื™ืจื”, is as if he's cursing ื”ืณ. Then the ื’ืžืจื says,

Rabbi Yehoshua Ben Karcha: Settlement as a Mitzvah

ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” ืื•ืžืจ, but ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” says, ืžืฆื•ื” ืœื‘ืฆื•ืข, it's a ืžืฆื•ื” to make a ืคืฉืจื”, to make a settlement. The first ืชื ื we mentioned before didn't say it's a ืžืฆื•ื”, he didn't say it's an ืขื‘ื™ืจื”, he just said that you have to have three people to make a settlement. After the ื“ื™ืŸ is over, then you already cannot make a settlement. But till then, it's a ืจืฉื•ืช. But ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” says, ืžืฆื•ื” ืœื‘ืฆื•ืข, it's a ืžืฆื•ื” to make a settlement. ืฉื ืืžืจ, because the ืคืกื•ืง says, ืืžืช ื•ืžืฉืคื˜ ืฉืœื•ื ืฉืคื˜ื• ื‘ืฉืขืจื™ื›ื, truth and ืžืฉืคื˜, judgment, ืฉืœื•ื and peace, should judge in your gates. So the question is asked, ื•ื”ืœื ื‘ืžืงื•ื ืฉื™ืฉ ืžืฉืคื˜ ืื™ืŸ ืฉืœื•ื. In a place where there is judgment, there is no peace, because when you judge, then automatically one person is ื—ื™ื™ื‘ and one person is ืคื˜ื•ืจ, so there is no peace between them. ื•ื‘ืžืงื•ื ืฉื™ืฉ ืฉืœื•ื ืื™ืŸ ืžืฉืคื˜, and in a place where there is peace, there is no ืžืฉืคื˜, there is no judgment. ืืœื, ืื™ื–ื”ื• ืžืฉืคื˜ ืฉื™ืฉ ื‘ื• ืฉืœื•ื? What kind of judgment is there that together with the judgment you have peace? ื”ื•ื™ ืื•ืžืจ ื–ื” ื‘ื™ืฆื•ืข. That is ื‘ื™ืฆื•ืข, that is making a settlement, making a ืคืฉืจื”. So since it says that this is a good thing, so therefore it's a ืžืฆื•ื” to do it. ื•ื›ืŸ ื‘ื“ื•ื“ ื”ื•ื ืื•ืžืจ, we ื˜ืืงืข see it says by ื“ื•ื“, ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื”, that ื“ื•ื“ did ืžืฉืคื˜ and ืฆื“ืงื”, judgment and righteousness. ื•ื”ืœื ื›ืœ ืžืงื•ื ืฉื™ืฉ ืžืฉืคื˜ ืื™ืŸ ืฆื“ืงื” ื•ืฆื“ืงื” ืื™ืŸ ืžืฉืคื˜, ืœื›ืื•ืจื”, any place you have judgment you don't have ืฆื“ืงื”, and any place you have ืฆื“ืงื”, you don't have judgment. ืืœื, ืื™ื–ื”ื• ืžืฉืคื˜ ืฉื™ืฉ ื‘ื• ืฆื“ืงื”? What is the judgment that has ืฆื“ืงื” with it? ื”ื•ื™ ืื•ืžืจ ื–ื” ื‘ื™ืฆื•ืข. That means a settlement, and therefore ื“ื•ื“ did a did ื‘ื™ืฆื•ืข, constantly tried to make settlements because the ืคืกื•ืง says he made ืžืฉืคื˜ and ืฆื“ืงื”. Then the ื’ืžืจื says, ื•ืชื ื ืงืžื, how will this fit according to the ืชื ื ืงืžื? According to the first ืชื ื, who doesn't hold it's a ืžืฆื•ื” to make a ืคืฉืจื”, what does he do with this ืคืกื•ืง where it says that it's called ืžืฉืคื˜ ื•ืฆื“ืงื”? How else can he translate this ืคืกื•ืง? And if there is no other way to translate this ืคืกื•ืง, so obviously it means making a settlement, so then he should have hold that it's a ืžืฆื•ื” to make a settlement. Since he doesn't hold it's a ืžืฆื•ื” to make a settlement, obviously he has another ืคืฉื˜ in this ืคืกื•ืง. What is the other ืคืฉื˜? So the ื’ืžืจื says it means like this: ื“ืŸ ืืช ื”ื“ื™ืŸ, when you judge the ื“ื™ืŸ, ื–ื™ื›ื” ืืช ื”ื–ื›ืื™, and the one that's innocent you ืคืกืงืŸ that he's innocent, ื•ื—ื™ื™ื‘ ืืช ื”ื—ื™ื™ื‘, and the one that's guilty you ืคืกืงืŸ that he's guilty, ื•ืจืื”, and you saw, ืฉื ืชื—ื™ื™ื‘ ืขื ื™ ืžืžื•ืŸ, that the poor man is obligated, ืžื—ื•ื™ื‘, to pay money, so what did he do? ื•ืฉื™ืœื ืœื• ืžืชื•ืš ื‘ื™ืชื•, if you pay him from your own house, ื–ื” ืžืฉืคื˜ ื•ืฆื“ืงื”, that is called ืžืฉืคื˜ and ืฆื“ืงื”. ืžืฉืคื˜ ืœื–ื”, judgment for him, ื•ืฆื“ืงื” ืœื–ื”, and righteousness for him. ืžืฉืคื˜ ืœื–ื”, it's judgment for him ืฉื”ื—ื–ื™ืจ ืœื• ืžืžื•ืŸ, that you returned him the money that belongs to him, but ืฆื“ืงื” ืœื–ื”, you did ืฆื“ืงื” to the other one ืฉืฉื™ืœื ืœื• ืžืชื•ืš ื‘ื™ืชื•, that you paid him from your own house. If the judge takes his own money and pays the one that lost, that is called ืฆื“ืงื”, you're doing him ืฆื“ืงื”. So this is what the ืคืกื•ืง would mean, that you should do ืžืฉืคื˜ and ืฆื“ืงื”. ื•ื›ืŸ ื‘ื“ื•ื“ ื”ื•ื ืื•ืžืจ, and that's ื˜ืืงืข the ืคืฉื˜ by ื“ื•ื“: ื•ื™ื”ื™ ื“ื•ื“ ืขื•ืฉื” ืžืฉืคื˜ ื•ืฆื“ืงื” ืœื›ืœ ืขืžื•, that ื“ื•ื“ did ืžืฉืคื˜ and ืฆื“ืงื” for the whole nation, it means ืžืฉืคื˜ ืœื–ื”, it was judgment for him ืฉื”ื—ื–ื™ืจ ืœื• ืืช ืžืžื•ื ื•, that he returned him the money, ื•ืฆื“ืงื” ืœื–ื” ืฉืฉื™ืœื ืœื• ืžืชื•ืš ื‘ื™ืชื•, and it was ืฆื“ืงื” to the other one that he paid him from his house. Then the ื’ืžืจื says, ืงืฉื™ื ืœื™ื” ืœืจื‘ื™, Rabbi had a ืงืฉื™ื. ื”ืื™ ืœื›ืœ ืขืžื•? Here where it says that ื“ื•ื“ did ืžืฉืคื˜ ื•ืฆื“ืงื” ืœื›ืœ ืขืžื•, to his whole nation, ืœืขื ื™ื™ื ืžื™ื‘ืขื™ ืœื™ื”. It should have said to the poor people. He didn't do this to everybody. Only if he saw the one that lost the case was an ืขื ื™, was a poor man, so he would pay him from his own money. So how could the ืคืกื•ืง say that he did ืžืฉืคื˜ ื•ืฆื“ืงื” ืœื›ืœ ืขืžื•, to his whole nation? ืืœื, what does it mean? ืืฃ ืขืœ ืคื™ ืฉืœื ืฉื™ืœื ืžืชื•ืš ื‘ื™ืชื•, ืจื‘ื” holds that even if he didn't pay him from his own house, still ื–ื”ื• ืžืฉืคื˜ ื•ืฆื“ืงื”. It's still called ืžืฉืคื˜ ื•ืฆื“ืงื”, even if one lost and he ื˜ืืงืข doesn't get his money back, still it is called ืžืฉืคื˜ ื•ืฆื“ืงื”. ืžืฉืคื˜ ืœื–ื” ื•ืฆื“ืงื” ืœื–ื”, ืžืฉืคื˜ to one and ืฆื“ืงื” to the other. ืžืฉืคื˜ ืœื–ื”, it is a ืžืฉืคื˜, a judgment to him, to the one that got the money, ืฉื”ื—ื–ื™ืจ ืœื• ืžืžื•ื ื•, that he had his money returned to him, ื•ืฆื“ืงื” ืœื–ื”, and ืฆื“ืงื” to the other one who lost the money, ืฉื”ื•ืฆื™ื ื’ื–ื™ืœื” ืžืชื—ืช ื™ื“ื•, he took the ื’ื–ื™ืœื” away from his hand. Because if he wouldn't have given the money, he would have been holding the money unrightfully. By him ืคืกืงืขื ื™ื ื’ that he has to give up the money, he's taking away the money that he wasn't holding rightfully from him, so he's doing him a favor. So that's why it's called that he's doing doing ืฆื“ืงื” to him. ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื ืื•ืžืจ, ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื says, ืฉื ื™ื ืฉื‘ืื• ืœืคื ื™ืš ืœื“ื™ืŸ, two people come to you for a ื“ื™ืŸ ืชื•ืจื”, ืขื“ ืฉืœื ืชืฉืžืข ื“ื‘ืจื™ื”ื, till you heard their ื˜ืขื ื•ืช, their words, ืื• ืืคื™ืœื•, even, ืžืฉืชืฉืžืข ื“ื‘ืจื™ื”ื, you already heard what they have to say, but ื•ืื™ ืืชื” ื™ื•ื“ืข ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, you still don't know to which side the ื“ื™ืŸ bends, you don't have the idea yet of who is right, then ืืชื” ืจืฉืื™ ืœื•ืžืจ ืœื”ื, you're allowed to tell them, ืฆืื•, go out, ื•ื‘ืฆืขื•, and make some kind of settlement. ืื‘ืœ ืžืฉืชืฉืžืข ื“ื‘ืจื™ื”ื, after you already heard their words, heard their ื˜ืขื ื•ืช, ื•ืืชื” ื™ื•ื“ืข ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, and you already know in your mind to which side the ื“ื™ืŸ is bending, you seem to understand which one is right, ืื™ ืืชื” ืจืฉืื™ ืœื•ืžืจ ืœื”ื, you're not allowed to tell them, ืฆืื• ื•ื‘ืฆืขื•, go out and make a ืคืฉืจื”, make a settlement. ืฉื ืืžืจ, because the ืคืกื•ืง says, ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ ื•ืœืคื ื™ ื”ืชื’ืœืข ื”ืจื™ื‘ ื ื˜ื•ืฉ, which means that the beginning of a strife is one that lets out the water, and before the quarrel breaks out, leave it. So the way he explained it here, it means that ืจืืฉื™ืช ืžื“ื•ืŸ, in the beginning of the argument, then ืคื•ื˜ืจ ืžื™ื, then you could ืคื•ื˜ืจ it. Before you get into the discussion of the argument, then you could drop it. Also ืœืคื ื™ ื”ืชื’ืœืข ื”ืจื™ื‘ ื ื˜ื•ืฉ, ืงื•ื“ื ืฉื ืชื’ืœืข ื”ืจื™ื‘, before the quarrel, the argument breaks out, ืืชื” ื™ื›ื•ืœ ืœื ื˜ืฉื•, you could leave go of it. But ืžืฉื ืชื’ืœืข ื”ืจื™ื‘, when the argument breaks out already, then ืื™ ืืชื” ื™ื›ื•ืœ ืœื ื˜ืฉื•, then you can't leave it. And that's what he said, that before you heard their arguments and know who is right in your mind, then you're still allowed to tell them, go out and and make a settlement. But after you already heard their arguments, and in your mind you know who is right, so then you're not allowed to drop it, you must ืคืกืง'ืŸ the ื“ื™ืŸ. ื•ืจื™ืฉ ืœืงื™ืฉ ืืžืจ, or according to another ื’ื™ืจืกื, where it says on the side of the ื’ืžืจื, ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœืงื™ืฉ, not ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืœืงื™ืฉ, but ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืœืงื™ืฉ, or another ื’ื™ืจืกื is ืจื‘ื™ ื™ื”ื•ื“ื” ื‘ืŸ ืœืงื™ืฉ. He said, ืฉื ื™ื ืฉื‘ืื• ืœื“ื™ืŸ, if two people come to a ื“ื™ืŸ, ืื—ื“ ืจืš ื•ืื—ื“ ืงืฉื”, one is soft and one is hard, ืขื“ ืฉืœื ืชืฉืžืข ื“ื‘ืจื™ื”ื, till you hear their words, ืื• ืžืฉืชืฉืžืข ื“ื‘ืจื™ื”ื ื•ืื™ ืืชื” ื™ื•ื“ืข ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, or even after you heard their arguments, but you still don't know to which side the ื“ื™ืŸ is bending, ืืชื” ืจืฉืื™ ืœื•ืžืจ ืœื”ื, you could tell them, ืื™ืŸ ืื ื™ ื ื–ืงืง ืœื›ื, I don't want to get involved in this. Why? ืฉืžื ื™ืชื—ื™ื™ื‘ ื—ื–ืง, maybe the hard one, the strong one will be guilty, ื•ื ืžืฆื ื—ื–ืง ืจื•ื“ืคื•. So then this guilty person who is strong will constantly make him trouble. So therefore you could get away from it before you heard their arguments, or at least before you know who's right. But ืžืฉืชืฉืžืข ื“ื‘ืจื™ื”ื ื•ืืชื” ื™ื•ื“ืข ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, but after you heard their words and you know to which side the ื“ื™ืŸ is ื ื•ื˜ื”, ืื™ ืืชื” ื™ื›ื•ืœ ืœื•ืžืจ ืœื”ื ืื™ืŸ ืื ื™ ื ื–ืงืง ืœื›ื, you cannot say, I don't want to get involved in this. ืฉื ืืžืจ, the ืคืกื•ืง says, ืœื ืชื’ื•ืจื• ืžืคื ื™ ืื™ืฉ, do not be afraid of any man. Since you get involved already, now you can't say, I'm afraid. Now you must continue with the ื“ื™ืŸ ืชื•ืจื”. ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” ืื•ืžืจ, ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” says, ืžื ื™ื™ืŸ, how do we know, ืœืชืœืžื™ื“ ืฉื™ื•ืฉื‘ ืœืคื ื™ ืจื‘ื•, a ืชืœืžื™ื“ is sitting in front of his ืจื‘ื™, ื•ืจืื” ื–ื›ื•ืช ืœืขื ื™ ื•ื—ื•ื‘ื” ืœืขืฉื™ืจ, and he sees a ื–ื›ื•ืช for the benefit of the poor man and something against the rich man. The ื“ื™ืŸ ืชื•ืจื” is not by him. He just is sitting on the side and he sees a ื“ื™ืŸ ืชื•ืจื” in front of his ืจื‘ื™, and he sees a ืกื‘ืจื that he has in his mind that will be for the benefit of the poor man and against the rich man, and his ืจื‘ื™ didn't think of that ืกื‘ืจื, and he sees that his ืจื‘ื™ is going to ืคืกืง'ืŸ the ื“ื™ืŸ to the different direction. ืžื ื™ื™ืŸ, how do we know ืฉืœื ื™ืฉืชื•ืง, that he shouldn't be quiet? ืฉื ืืžืจ, because the ืคืกื•ืง says, ืœื ืชื’ื•ืจื• ืžืคื ื™ ืื™ืฉ. And here he explains the word ืœื ืชื’ื•ืจื• from the meaning of gathering: do not gather your words, do not hold your words back in front of every anybody. If you have words that will help somebody, you must say it. ืจื‘ ื—ื ื™ืŸ ืื•ืžืจ, ืจื‘ ื—ื ื™ืŸ says, and this a continuation to what we learned before, ืœื ืชื›ื ื™ืก ื“ื‘ืจื™ืš ืžืคื ื™ ืื™ืฉ, that what does it mean ืœื ืชื’ื•ืจื• ืžืคื ื™ ืื™ืฉ, to not gather, hold in your words in front of anybody. And the ืžื”ืจืฉืดืœ is ื˜ืืงืข ื’ื•ืจืก that the words supposed to be in the ื’ืžืจื: ื•ืืžืจ ืจื‘ ื—ื ื™ืŸ, and ืจื‘ ื—ื ื™ืŸ said. This is a continuation to before. And in the ืชื•ืกืคืชื, it's ื‘ื›ืœืœ not mentioned ืจื‘ ื—ื ื™ืŸ's name. It says ืœื›ืชื—ื™ืœื” ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” said, that if you see the ื–ื›ื•ืช for the ืขื ื™ and the ื—ื•ื‘ื” for the ืขืฉื™ืจ, how do you know he shouldn't be quiet? It goes straight together, that you should not gather, hold your words back in front of anybody. And also, ื•ื™ื”ื™ื• ืขื“ื™ื ื™ื•ื“ืขื™ื ืืช ืžื™ ื”ื ืžืขื™ื“ื™ืŸ. The ืขื“ื™ื should know whom they're testifying for, because according to their

Witnesses and Judges Answer Before God

testimony, that's how they're going to ืคืกืงืŸ. So they're going to cause ื”ืฉื to see that the money is brought back to its rightful owner. So they are testifying really for ื”ืฉื. ื•ืœืคื ื™ ืžื™ ื”ื ืžืขื™ื“ื™ืŸ, and they should know in front of whom are they standing. ื•ืžื™ ืขืชื™ื“ ืœื™ืคืจืข ืžื”ืŸ, and who is going to punish them if they are lying? ืฉื ืืžืจ, because the ืคืกื•ืง says, ื•ืขืžื“ื• ืฉื ื™ ื”ืื ืฉื™ื ืืฉืจ ืœื”ื ื”ืจื™ื‘ ืœืคื ื™ ื”ืฉื, that the two men that they are arguing, that the argument is by them, that they should stand in front of ื”ืฉื. And the ื’ืžืจื in ืžืกื›ืช ืฉื‘ื•ืขื•ืช ื“ืฃ ืœืณ explains that this ืคืกื•ืง is referring to the witnesses. And also, ื•ื™ื”ื™ื• ื”ื“ื™ื™ื ื™ื ื™ื•ื“ืขื™ื ืืช ืžื™ ื”ื ื“ื ื™ืŸ, the ื“ื™ื™ื ื™ื, the judges, should also know whom they're judging, ื•ืœืคื ื™ ืžื™ ื”ื ื“ื ื™ืŸ, and in front of who are they judging, ื•ืžื™ ืขืชื™ื“ ืœื™ืคืจืข ืžื”ืŸ, and who's going to punish them if they are not judging it correctly? ืฉื ืืžืจ, because the ืคืกื•ืง says, ืืœืงื™ื ื ืฆื‘ ื‘ืขื“ืช ืงืœ, ื”ืฉื is standing in the community of ื”ืฉื, that refers to a ื“ื™ืŸ ืชื•ืจื”, that ื”ืฉื is there. So therefore, whatever they're doing is concerning ื”ืฉื. ื•ื›ืŸ ื‘ื™ื”ื•ืฉืคื˜ ื ืืžืจ, it also says by ื™ื”ื•ืฉืคื˜: ื•ื™ืืžืจ ืืœ ื”ืฉื•ืคื˜ื™ื, he said to the judges, ืจืื•, you should see, ืžื” ืืชื ืขื•ืฉื™ื, what you're doing, ื›ื™ ืœื ืœืื“ื ืชืฉืคื˜ื•, you are not judging a person, ื›ื™ ืœื”ืฉื, just ื”ืฉื. ืฉืžื ื™ืืžืจ ื”ื“ื™ื™ืŸ, if so, the judge might say, ืžื” ืœื™ ื‘ืฆืขืจ ื”ื–ื”, why do I need this trouble, why do I need this pain, why should I get involved in ืคืกืงื 'ื™ื ื’ a ื“ื™ืŸ? I might not ืคืกืงืŸ it correctly, and then I will be punished by ื”ืฉื. So

Judge's Fear and Responsibility to God

why should I get involved in this ืœื›ืชื—ื™ืœื”? ืชืœืžื•ื“ ืœื•ืžืจ, so therefore the ืคืกื•ืง says, ืขืžื›ื ื‘ื“ื‘ืจ ืžืฉืคื˜, and I am with you in the ืžืฉืคื˜. This is also from ื™ื”ื•ืฉืคื˜, right? He said that, with you in the ืžืฉืคื˜. That means, ืื™ืŸ ืœื• ืœื“ื™ื™ืŸ ืืœื ืžื” ืฉืขื™ื ื™ื• ืจื•ืื•ืช. The ื“ื™ื™ืŸ, the judge, only has what his eyes see. In other words, what he was saying is, ืขืžื›ื, with you, the ืžืฉืคื˜, when it comes to the ืžืฉืคื˜, you have to judge what you have. If you judge based on the information you have and the investigation you did and the things that you know, so then you cannot be at fault even if it's wrong, because you did as the ื“ื™ืŸ expects you to do. So therefore, you have nothing to be afraid of as long as you follow the ื˜ืขื ื•ืช and the information, etc. that you have. Then the ื’ืžืจื says, ื”ื™ื›ื ื“ืžื™ ื’ืžืจ ื“ื™ืŸ? What's ืคืฉื˜ ื’ืžืจ ื“ื™ืŸ? We said before that after the ื’ืžืจ ื“ื™ืŸ, when the ื“ื™ืŸ is over, so then the ืชื ื ืงืžื also says that you are not allowed to make a ืคืฉืจื”, make a settlement. What does it mean ื’ืžืจ ื“ื™ืŸ? ืืžืจ ืจื‘ ื™ื”ื•ื“ื” ืืžืจ ืจื‘, so ืจื‘ ื™ื”ื•ื“ื” said in the name of ืจื‘, that ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื—ื™ื™ื‘, that they say, you, person, are guilty, ืื™ืฉ ืคืœื•ื ื™ ืืชื” ื–ื›ืื™, and you are innocent. ืืžืจ ืจื‘, ืจื‘ said, ื”ืœื›ื” ื›ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”. ื”ืœื›ื” is like ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”, who said that it's a ืžืฆื•ื” to make a settlement. But the ื’ืžืจื asks, ืื™ื ื™? Is it not so? ื•ื”ื ืจื‘ ื”ื•ื ื ืชืœืžื™ื“ื™ื” ื“ืจื‘ ื”ื•ื”, that ืจื‘ ื”ื•ื ื was a ืชืœืžื™ื“ of ืจื‘. ื›ื™ ื”ื•ื• ืืชื• ืœืงืžื™ื” ื“ืจื‘ ื”ื•ื ื, when people used to come for a ื“ื™ืŸ ืชื•ืจื” to ืจื‘ ื”ื•ื ื, ืืžืจ ืœื”ื•, he used to say to them, ืื™ ื“ื™ื ื ื‘ืขื™ืชื•, ืื™ ืคืฉืจื” ื‘ืขื™ืชื•, what do you want? Do you want I should ืคืกืงืŸ according to the ื“ื™ืŸ, or do you want me to try to make a settlement? Now,

Settlement as ืžืฆื•ื” vs ืจืฉื•ืช Debate

since ืจื‘ said ื”ืœื›ื” ื›ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”, so ืจื‘ holds it's a ืžืฆื•ื” to make a settlement. Since ืจื‘ ื”ื•ื ื was a ืชืœืžื™ื“ of ืจื‘, so definitely he did according to the opinion of ืจื‘. So then what should have been? When they used to come to a ื“ื™ืŸ ืชื•ืจื”, he should have said, "I will make a settlement." Why did he ask them whether they want a ื“ื™ืŸ or a settlement? So the ื’ืžืจื says, ืžืื™ ืžืฆื•ื” ื ืžื™ ื“ืงืืžืจ ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”? What did ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” mean when he said it's a ืžืฆื•ื” to make a settlement? He didn't mean that you don't have to ask them. He meant ืžืฆื•ื” ืœืžื™ืžืจ ืœื”ื•, it's a ืžืฆื•ื” to say to them, ืื™ ื“ื™ื ื ื‘ืขื™ืชื•, ืื™ ืคืฉืจื” ื‘ืขื™ืชื•, do you want a ื“ื™ืŸ, do you want a settlement? In other words, it's a ืžืฆื•ื” to suggest to them to make a settlement. And that's actually what he did. But then the ื’ืžืจื asks, ื”ื™ื™ื ื• ืชื ื ืงืžื! Then it's the same opinion as ืชื ื ืงืžื! The first ืชื ื, who didn't say it's a ืžืฆื•ื” to make a settlement, on the other hand, he didn't say it's an ืื™ืกื•ืจ to make a settlement. He just said after ื’ืžืจ ื“ื™ืŸ you're not allowed, but before ื’ืžืจ ื“ื™ืŸ you're allowed. So according to the first ืชื ื, it's a ืจืฉื•ืช. You could make a settlement if you want, and you don't have to if you don't want. So ืœื›ืื•ืจื”, it's the same thing as ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื”. Before we thought that when ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” said it's a ืžืฆื•ื” to make a settlement, he meant that if they come to a ื“ื™ืŸ ืชื•ืจื”, you have to say to them, "I will make a settlement." But now that we're saying it means you have to ask them if they want, you do, if not, not, so it's really a ืจืฉื•ืช, you don't really have to. So it's the same opinion as ืชื ื ืงืžื. What is the ืžื—ืœื•ืงืช? And the ื’ืžืจื answers: ืื™ื›ื ื‘ื™ื ื™ื™ื”ื• ืžืฆื•ื”. The difference in the ืžื—ืœื•ืงืช is whether it's a ืžืฆื•ื”. ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” ืกื‘ืจ, ืจื‘ื™ ื™ื”ื•ืฉืข ื‘ืŸ ืงืจื—ื” holds, ืžืฆื•ื”, it's a ืžืฆื•ื” to mention to them that there is a possibility of a ืคืฉืจื”. In other words, you must suggest to them that there is such a thing as a settlement and ask them if they want. ืชื ื ืงืžื ืกื‘ืจ ืจืฉื•ืช, ืชื ื ืงืžื says it's a ืจืฉื•ืช, you don't have to. If you want, you can mention, but you don't have to. You could ืœื›ืชื—ื™ืœื” only ืคืกืงืŸ ืขืœ ืคื™ ื“ื™ืŸ, ืขืœ ืคื™ ืชื•ืจื” if you want. But then the ื’ืžืจื

Rabbi Shimon ben Menasya on Early Settlement

asks: ื”ื™ื™ื ื• ื“ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื? Isn't this the same opinion as ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื? We brought before the statement of ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื, he said that if two people come to you for a ื“ื™ืŸ, so before you hear their words, or even after you hear their words, and you still don't know ืœื”ื™ื›ืŸ ื“ื™ืŸ ื ื•ื˜ื”, you're allowed to say to them, "Go out and make a ืคืฉืจื”, go out and make a settlement." Afterwards, if you already know where the ื“ื™ืŸ is ื ื•ื˜ื”, you're not allowed to say that. So it comes out that according to ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื, you don't have to mention to them that there is a possibility of making a settlement, it just says that you're allowed to make a settlement if you want. Now, we said that according to the ืชื ื ืงืžื, it means that if you want, you can make a settlement, but you don't have to make a settlement. So it comes out that the ืชื ื ืงืžื and ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื are really saying the same thing. So the ื’ืžืจื says: ืื™ื›ื ื‘ื™ื ื™ื™ื”ื•, there is a difference, ืžืฉืชืฉืžืข ื“ื‘ืจื™ื”ื ื•ืืชื” ื™ื•ื“ืข ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, that in the case where you already heard their arguments and you already know to which side the ื“ื™ืŸ is ื ื•ื˜ื”, so ืื™ ืืชื” ืจืฉืื™ ืœื•ืžืจ ืœื”ื ืฆืื• ื•ื‘ืฆืขื•. You're not allowed to tell them, "Go out and make a ืคืฉืจื”." According to ืจื‘ื™ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื, after that point, you're not allowed to make a ืคืฉืจื”. But according to the ืชื ื ืงืžื who says that after ื’ืžืจ ื“ื™ืŸ you're not allowed to make a ืคืฉืจื”, so it comes out, up to ื’ืžืจ ื“ื™ืŸ, you're still allowed to make a ืคืฉืจื”. In other words, even after you already know ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, you're still allowed to make a ืคืฉืจื” according to ืชื ื ืงืžื. Then

Rabbi Tanchum bar Chanilai on the Golden Calf Verse

the ื’ืžืจื says: ื•ืคืœื™ื’ื ื“ืจื‘ื™ ืชื ื—ื•ื ื‘ืจ ื—ื ื™ืœืื™, that all those that ื“ืจืฉื ื“ in the ื’ืžืจื before the ืคืกื•ืง of ื•ื‘ื•ืฆืข ื‘ืจืš ื ืืฅ ื”ืณ the way they did, they all argue on what ืจื‘ื™ ืชื ื—ื•ื ื‘ืจ ื—ื ื™ืœืื™ said. Because he ื“ืจืฉื ื“ the ืคืกื•ืง different. ื“ืืžืจ ืจื‘ื™ ืชื ื—ื•ื ื‘ืจ ื—ื ื™ืœืื™, that ืจื‘ื™ ืชื ื—ื•ื ื‘ืจ ื—ื ื™ืœืื™ said, ืœื ื ืืžืจ ืžืงืจื ื–ื” ืืœื ื›ื ื’ื“ ืžืขืฉื” ื”ืขื’ืœ, that this ืคืกื•ืง was only said concerning the act of the ืขื’ืœ, when they made the ืขื’ืœ. ืฉื ืืžืจ, because the ืคืกื•ืง says: ื•ื™ืจื ืื”ืจืŸ, ืื”ืจืŸ saw, ื•ื™ื‘ืŸ ืžื–ื‘ื— ืœืคื ื™ื•, and he built a ืžื–ื‘ื— in front of him, in front of the ืขื’ืœ. So we ื“ืจืฉืŸ, ืžื” ืจืื”? What did he see? ืืžืจ ืจื‘ื™ ื‘ื ื™ืžื™ืŸ ื‘ืจ ื™ืคืช ืืžืจ ืจื‘ื™ ืืœืขื–ืจ, ืจื‘ื™ ื‘ื ื™ืžื™ืŸ ื‘ืจ ื™ืคืช said in the name of ืจื‘ื™ ืืœืขื–ืจ, ืจืื”, he saw, ื—ื•ืจ, that ื—ื•ืจ that was his nephew, he was the son of ืžืจื™ื, ืฉื–ื‘ื•ื— ืœืคื ื™ื•, that he was ื’ืขืฉื—ื˜ืŸ, he was killed in front of it. ื—ื•ืจ tried to stop them from making the ืขื’ืœ, and they killed him. So ืืžืจ, he said, ืื™ ืœื ืฉืžื™ืขื ื ืœื”ื•, if I will not listen to themโ€”they wanted him to make the ืขื’ืœโ€”so he said to himself, ืื”ืจืŸ, "If I will not listen to them and I will not make the ืขื’ืœ, ื”ืฉืชื ืขื‘ื“ื• ืœื™ ื›ื™ ื“ืขื‘ื“ื• ื‘ื—ื•ืจ, so they will do to me as they did to ื—ื•ืจ. They will kill me. ื•ืžืงื™ื™ื ื‘ื™, so they will be ืžืงื™ื through me the ืคืกื•ืง where it says, ืื ื™ื”ืจื’ ื‘ืžืงื“ืฉ ื”ืณ ื›ื”ืŸ ื•ื ื‘ื™ื, that if in the ืžืงื“ืฉ ื”ืณ will be killed a ื›ื”ืŸ and a ื ื‘ื™ื, so then ื•ืœื ื”ื•ื™ื ืœื”ื• ืชืงื ืชื ืœืขื•ืœื, they will never have a ืชืงื ื”, they will never be able to fix this." As actually happened later, that they killed ื–ื›ืจื™ื” ื‘ืŸ ื™ื”ื•ื™ื“ืข, who was a ื›ื”ืŸ and a ื ื‘ื™ื, and therefore the ื‘ื™ืช ื”ืžืงื“ืฉ was destroyed. So that would happen too, they would kill ืื”ืจืŸ, he was a ื›ื”ืŸ, he was also a ื ื‘ื™ื, so then there would be no ืชืงื ื”, they wouldn't have the ืžืฉื›ืŸ, that would be even worse. ืžื•ื˜ื‘, it's better, ื“ืœื™ืขื‘ื“ื• ืœืขื’ืœ, let them worship the ืขื’ืœ, which is only an ืขื‘ื™ืจื” of ืขื‘ื•ื“ื” ื–ืจื”, ืืคืฉืจ ื“ื”ื•ื™ื ืœื”ื• ืชืงื ืชื ื‘ืชืฉื•ื‘ื”. Then, there might be a ืชืงื ื”, they might fix it up through ืชืฉื•ื‘ื”. So that's how he ื“ืจืฉื ืก the ืคืกื•ืง: ื•ื™ืจื ืื”ืจืŸ ื•ื™ื‘ืŸ ืžื–ื‘ื— ืœืคื ื™ื•, that he ื˜ื™ื™ื˜ืฉืก ืžื–ื‘ื— from the word ื–ื‘ื—, and ื•ื™ื‘ืŸ, not from the word building, but ื•ื™ื‘ืŸ from the word ื‘ื™ื ื”, understanding. That when ืื”ืจืŸ saw what they did to ื—ื•ืจ, ื•ื™ื‘ืŸ, he understood, ืžื–ื‘ื•ื— ืœืคื ื™ื•, from the one that was killed in front of him, he understood what he should do. He understood that it's better he should make the ืขื’ืœ, than he should not listen to them. And that's the ืคืฉื˜ in the ืคืกื•ืง: ื•ื‘ื•ืฆืข ื‘ืจืš ื ืืฅ ื”ืณ, that ืื”ืจืŸ made a ื‘ื•ืฆืข, ืื”ืจืŸ made a ืคืฉืจื”. He made like a ื—ืฉื‘ื•ืŸ between himself, and he came out with a ื”ื™ืชืจ that it's better for him to make the ืขื’ืœ than not to make the ืขื’ืœ. And ืชื•ืกืคื•ืช even adds that he also ื“ืจืฉ's the end of the ืคืกื•ืง, because end of the ืคืกื•ืง it says, ื•ืจื‘ื™ื ื”ืฉื™ื‘ ืžืขื•ืŸ, that means that what he did was was in order that the many people should be able to return from the ืขื‘ื™ืจื”. As we said before, that if he wouldn't have made the ืขื’ืœ, then they would have done something that there would be never a ืชืงื ื”. So he did something, made the ืขื’ืœ, that they should have a ืชืงื ื”, they should be able to do ืชืฉื•ื‘ื”. Then the ื’ืžืจื says,

Other ืชื ืื™ื and the ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ Usage

ื•ื”ื ื™ ืชื ืื™, ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ ืžืื™ ื“ืจืฉื™ ื‘ื™ื”? The other ืชื ืื™ื that don't use this ืคืกื•ืง, ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ, like ืจื‘ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื, what do they use the ืคืกื•ืง for? ืจื‘ ืฉืžืขื•ืŸ ื‘ืŸ ืžื ืกื™ื, he used the ืคืกื•ืง to tell us that only in the beginning, before you know ืœื”ื™ื›ืŸ ื”ื“ื™ืŸ ื ื•ื˜ื”, that's when you're allowed to make a ืคืฉืจื”. Afterwards you're not. But those that don't say it that way, those that don't hold that this ืคืกื•ืง goes for that, what do they do with this ืคืกื•ืง? The ื’ืžืจื says, ื›ื“ืจื‘ ื”ืžื ื•ื ื. They ื“ืจืฉ'ืŸ the ืคืกื•ืง like ืจื‘ ื”ืžื ื•ื ื said. ื“ืืžืจ ืจื‘ ื”ืžื ื•ื ื, ืจื‘ ื”ืžื ื•ื ื said, ืื™ืŸ ืชื—ื™ืœืช ื“ื™ื ื• ืฉืœ ืื“ื ื ื™ื“ื•ืŸ ืืœื ืขืœ ื“ื‘ืจื™ ืชื•ืจื”, that when a person goes to ืขื•ืœื ื”ื‘ื, and he is judged by the ื‘ื™ืช ื“ื™ืŸ ืฉืœ ืžืขืœื”, the first judgment is concerning ื“ื‘ืจื™ ืชื•ืจื”, ืฉื ืืžืจ, that the ืคืกื•ืง says, ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ. That ืจืืฉื™ืช ืžื“ื•ืŸ, the beginning of the ื“ื™ืŸ, is for ืคื•ื˜ืจ ืžื™ื. ืžื™ื, water, means ืชื•ืจื”, as it says that ืื™ืŸ ืžื™ื ืืœื ืชื•ืจื”. Water is ืชื•ืจื”. They quote the ืคืกื•ืง, ื”ื•ื™ ื›ืœ ืฆืžื ืœื›ื• ืœืžื™ื. ืคื•ื˜ืจ ืžื™ื means he ืคื˜ืจ'd himself from the ืžื™ื, from the ืชื•ืจื”. That means he didn't learn ืชื•ืจื”. So what we say is ืคื•ื˜ืจ ืžื™ื, for not learning ืชื•ืจื”, ืจืืฉื™ืช ืžื“ื•ืŸ, that is the beginning of the ื“ื™ืŸ. This is the first thing that they judge the person about when he comes in ืขื•ืœื ื”ื‘ื ืœืžืขืœื” to the ื‘ื™ืช ื“ื™ืŸ ืฉืœ ืžืขืœื”. But ืชื•ืกืคื•ืช asks that ืœื›ืื•ืจื” this contradicts what the ื’ืžืจื says in ืฉื‘ืช. There the ื’ืžืจื says that the first thing they ask a person is ื ืฉืืช ื•ื ืชืช ื‘ืืžื•ื ื”? Did you do your business with ืืžื•ื ื”? And then, ืงื‘ืขืช ืขืชื™ื ืœืชื•ืจื”? You set up time to learn ืชื•ืจื”. And here it seems as if the first thing that they judge the person is concerning ื“ื‘ืจื™ ืชื•ืจื”. And ืชื•ืกืคื•ืช answers that over there we're talking about a person who learned ืชื•ืจื”, but he didn't set aside enough time to learn. So there, the first thing they ask him is about his ืžืฉื ื•ืžืชืŸ, his business, and then they go to the ืชื•ืจื”. Here we're talking about a person who didn't learn at all. So if he didn't learn at all, the first thing they ask him is, ืคื•ื˜ืจ ืžื™ื, why didn't you learn the ืชื•ืจื”? Another ืคืฉื˜ ืชื•ืกืคื•ืช says that ืœื›ืชื—ื™ืœื” the first thing they ask him is ื˜ืืงืข as the ื’ืžืจื says in ืฉื‘ืช concerning his business, whether he did his business with ืืžื•ื ื”. But when they punish him, when he gets his ื“ื™ืŸ, then he gets his ื“ื™ืŸ first on ื“ื‘ืจื™ ืชื•ืจื”. And that's why he ื“ืจืฉ's the ืคืกื•ืง, that ืชื—ื™ืœืช ื’ื™ืœื•ื™ ื“ื™ื ื• ื‘ืžื” ืฉื ืขื ืฉ ืžื“ื‘ืจื™ ืชื•ืจื”, that the first revelation, the first punishment on the ื“ื™ืŸ that he had is concerning the ื“ื‘ืจื™ ืชื•ืจื”. But ื‘ืืžืช it could be said that both ื’ืžืจื's really mean the same thing, because we know that when it comes to learn ืชื•ืจื”, there is always a ื”ืงื“ืžื” before you learn ืชื•ืจื”. Before you start learning you have to have the proper ื™ืจืืช ืฉืžื™ื. As the ื’ืžืจื ื˜ืืงืข says in ืฉื‘ืช over there, that ืจืืฉื™ืช ื—ื›ืžื” ื™ืจืืช ื”', that the first thing is ื™ืจืืช ื”', and the ื’ืžืจื there says that ื™ืจืืช ื”' ื”ื™ื ืื•ืฆืจื•, that if a person has ื™ืจืืช ืฉืžื™ื before he starts learning, then his learning is a good thing. If he doesn't have ื™ืจืืช ืฉืžื™ื, then his learning is not that good. So it comes out that when we talk about learning ืชื•ืจื”, we automatically already talk about him having the proper ื™ืจืืช ืฉืžื™ื, the proper approach to the learning ืชื•ืจื”. As it is known that the reason why the ืชื•ืจื” starts with a ื‘, not with an ื, is to tell us that when you come to learn the ืชื•ืจื”, that's already the ื‘, that the second step. The first step before you actually learn is the ืขื ื™ืŸ of ื™ืจืืช ืฉืžื™ื, the ืืžื•ื ื” that you have in ื”', the ืืžื•ื ื” that you have in the ืชื•ืจื”. So you could say that ื ืฉืืช ื•ื ืชืช ื‘ืืžื•ื ื”, when they ask him, did you do your business with ืืžื•ื ื”, and then they say ืงื‘ืขืช ืขืชื™ื ืœืชื•ืจื”, did you set aside time to learn ืชื•ืจื”, these are not two separate things. It goes together, because before they ask him about learning ืชื•ืจื”, they ask him about the ื”ืงื“ืžื” to learn ืชื•ืจื”. Did you do everything with ืืžื•ื ื”? Do you have the proper ืืžื•ื ื”, so then when you sat down to learn ืชื•ืจื” your ืชื•ืจื” was proper? So here, the ื’ืžืจื just says the general idea. The general thing is that the first thing that they judge the person is concerning learning. Over there they go into more details, and within the details, the learning itself comes as a second step after the ืืžื•ื ื”, because in order to learn properly you must have the ืืžื•ื ื”, and therefore there it says first they ask him ื ืฉืืช ื•ื ืชืช ื‘ืืžื•ื ื”, and then they mention the learning of ืชื•ืจื”. Then the ื’ืžืจื says,

Analogies of Arguments to Water and Bridge

ืืžืจ ืจื‘ ื”ื•ื ื, ืจื‘ ื”ื•ื ื said, ื”ืื™ ืชื™ื’ืจื, that an argument, ื“ืžื™ื ืœืฆื™ื ื•ืจื ื“ื‘ื™ื“ืงื ื“ืžื™ื, it is like the pipe of a flow of water, ื›ื™ื•ืŸ ื“ืจื•ื•ื— ืจื•ื•ื—. It gets wider, it gets even wider and you can't stop it. If the river overflows, and it starts going through small areas into the field, so if you stop it right away, you'll stop it. But if you don't stop it, and you let it go, it'll go and go without a stop and it will overflow everything. And the same with an argument. If you stop the argument in the beginning, then it stopped, but if you don't Stop it in the beginning and it could go on and on without an end. And he ื“ืจืฉ'ื ื“ this from the ืคืกื•ืง, ืจืืฉื™ืช ืž- ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ, it means that the ืจืืฉื™ืช ืžื“ื•ืŸ, the beginning of an argument, is similar to ืคื•ื˜ืจ ืžื™ื, is when you open up the water. ืคื•ื˜ืจ comes from the word ืคื˜ืจ ืจื—ื, which means opening, that when you open up water, it could continue without an end. So too, when you start an argument, it could go out, on without an end. Then the ื’ืžืจื says, ืื‘ื™ื™ ืงืฉื™ืฉื, the older ืื‘ื™ื™, and the reason they called him ืื‘ื™ื™ ืงืฉื™ืฉื, we shouldn't confuse him with the famous ืื‘ื™ื™ that always used to argue with ืจื‘ื, but this is a different ืื‘ื™ื™, so they called him ืื‘ื™ื™ ืงืฉื™ืฉื. ืืžืจ, he said, ื“ืžื™ ืœื’ื•ื“ื ื“ื’ืžืœื, that an argument is similar to pieces of wood from a bridge. ื›ื™ื•ืŸ ื“ืงื ืงื, when it stands and it's established, it's established. ืœื›ืชื—ื™ืœื”, when you have the pieces of wood from the bridge, so then it is shaky, but after you walk on it a lot, and the time passes, it gets set in and it gets settled and it gets hard and that's how it stays. The same thing with an argument, ืœื›ืชื—ื™ืœื”, it's not so strong, but if you continue and go on and on, it'll get settled, it'll stay, and the argument will go on and on. And ืจืฉ"ื™ says that this is just a saying by itself, and he doesn't ื“ืจืฉ'ืŸ it from a ืคืกื•ืง. But ืชื•ืกืคื•ืช says that he does ื“ืจืฉ'ืŸ it from the same ืคืกื•ืง, ืคื•ื˜ืจ ืžื™ื ืจืืฉื™ืช ืžื“ื•ืŸ. That ืคื•ื˜ืจ ืžื™ื, this refers to the wood from the bridge, which stops the person from the water, that he shouldn't fall into the water. That's called ืคื•ื˜ืจ ืžื™ื. ืจืืฉื™ืช ืžื“ื•ืŸ is the beginning of an argument, that when you start an argument, it's similar to when you build the wood on the bridge. That ืœื›ืชื—ื™ืœื”, it's not so strong, but after a while, it gets strong, and that's how it stays. So too with an argument, if you don't stop it right away, it'll go on and on, and it won't stop.
