Introduction to Seder Sanhedrin Daf Z

Jewish Audio on Chabad.org. This 砖讬注讜专 will be 诪住讻转 住谞讛讚专讬谉 讚祝 讝. We will start from the fourth line of the wide lines. And the 讙诪专讗 starts, 讛讛讜讗 讚讛讜讛 拽讗诪专 讜讗讝讬诇, there was this person who used to go around saying, 讟讜讘讬, happy should be, 讚砖诪注 讜讗讚讬砖, the person who listens to embarrassment and he goes by it, he accepted and doesn't answer, he doesn't start an argument over it. 讞诇驻讜 讘讬砖转讬讛 诪讗讛, that if he does that, he doesn't argue over it, then a hundred 讚讬谞讬诐, a hundred bad things will pass by him and won't affect him. 讗诪专 诇讬讛 砖诪讜讗诇 诇专讘 讬讛讜讚讛, 砖诪讜讗诇 said to 专讘 讬讛讜讚讛, 拽专讗 讻转讬讘, there's a 驻住讜拽 that tells us the same idea. This is the 驻住讜拽, 驻讜讟专 诪讬诐 专讗砖讬转 诪讚讜谉. Which means the one that lets out the water is the beginning of 诪讚讜谉, is the beginning of argument, but the way he explains it here is that it means 专讬砖 诪讗讛 讚讬谞讬, it's the beginning of a hundred 讚讬谞讬诐. Because the word 诪讚讜谉 is an abbreviation of the words 诪讗讛 讚讬谞讬诐, or as 专砖状讬 says, the word 诪讚讜谉 is the 讙讬诪讟专讬讗 a hundred. Its numerical value is a hundred. And what he's saying here is that 驻讜讟专 诪讬诐, the one that opens the water, the one that starts off the argument, so that is the beginning of a hundred 讚讬谞讬诐, of a hundred troubles. On the other hand, if someone listens to somebody else embarrass him and doesn't answer, he avoids argument, so then he will avoid the hundred troubles. Then the 讙诪专讗 continues,

Three Thefts Are Not Punished, Fourth Is Fatal

讛讛讜讗, there was this person, 讚讛讜讛 拽讗诪专 讜讗讝讬诇, he went around saying, 讗转专转讬 转诇转 讙谞讘讗 诇讗 诪讬拽讟诇, for the two or three times that a person steals, he still will not be killed. In other words, do not be surprised if a person is not killed for two or three times that he steals, because eventually, when he will steal the fourth time, that's when he will be killed. And 讗诪专 诇讬讛 砖诪讜讗诇 诇专讘 讬讛讜讚讛, 砖诪讜讗诇 said to 专讘 讬讛讜讚讛, 拽专讗 讻转讬讘, there's a 驻住讜拽 that says that. It's the 驻住讜拽, 讻讛 讗诪专 讛壮, this is what 讛壮 said, 注诇 砖诇砖讛 驻砖注讬 讬砖专讗诇, for three 注讘讬专讜转 of the 讗讬讚谉, so for those three, I still could take it, 讜注诇 讗专讘注讛 诇讗 讗砖讬讘谞讜, but for the fourth, I will not reverse, I will not take away my anger. And that's similar to what that person said, that the fourth time he steals, that's when he will be killed. 讛讛讜讗 讚讛讜讛 拽讗诪专 讜讗讝讬诇, there was this person that went around saying, 砖讘 讘讬专讬 诇砖诇诪讜谞讛, there could be seven pits for a person who is complete, who is peaceful, and nothing will happen to him. He will avoid falling in to these seven pits. 讜讞讚讗, but one, 讚注讘讬讚 讘讬砖, one is enough for a person that does bad, and he will fall into that one pit. 讗诪专 诇讬讛 砖诪讜讗诇 诇专讘 讬讛讜讚讛, 砖诪讜讗诇 said to 专讘 讬讛讜讚讛, 拽专讗 讻转讬讘, there's a 驻住讜拽 that says that, 讻讬 砖讘注 讬驻讜诇 爪讚讬拽 讜拽诐, that a 爪讚讬拽 could fall in seven, and he will get up. He won't get hurt, he will be saved from the seven. And then it

Rambam on the Judges' Tools

says, 讜专砖注 讬驻讜诇 讘讗讞转, the 专砖注 will fall into one. This is not 诇砖讜谉 of the 驻住讜拽, but this is what he's saying the 驻砖讟, that a 爪讚讬拽 could avoid seven, but a 专砖注 would fall even into one. The way the 诪讛专砖状讗 explains this, it means that since there are 砖讘注讛 讻讜讻讘讬 诇讻转, there are the seven stars, and we know that the stars, the constellations, they control what happens to a person. And that's what he's saying here, that by a 爪讚讬拽, even if in all the stars it is written that something bad should happen to him, he still won't fall, he's able to overcome it. But on the other hand, a 专砖注, even if in one of them it's written bad, it will affect him, he's not able to overcome it. 讛讛讜讗 讚讛讜讛 拽讗诪专 讜讗讝讬诇, there was this person that went around saying, 讚讗讝讬诇 诪讘讬 讚讬谞讗, if someone is coming from a 讘讬转 讚讬谉, from a 讚讬谉 转讜专讛, 砖拽讬诇 讙诇讬诪讗, and they took away his coat, he owed money, the 讘讬转 讚讬谉 驻住拽谞壮讚 that he owes, and they took away his coat as payment for the debt, 诇讬讝诪专 讝诪专 讜诇讬讝讬诇 讘讗讜专讞讗, let him sing and go on the road. In other words, let him be happy. He should be happy that the 讚讬谉 was 驻住拽谞壮讚 that he has to give it up, even though he had a loss of money, but on the other hand, this avoided him from keeping money that doesn't belong to him. So he should be happy. So not only the one that got the money should be happy, but even the one that lost the money, and even if they actually took away the coat that he was wearing, he still should be happy. This is a 驻住讜拽 that says that 讬转专讜 said to 诪砖讛 专讘讬谞讜, and he told him how to establish the 讚讬讬谞讬诐 of 驻住拽谞壮讬谞讙 讚讬谞讬诐. And then he said, and also the whole nation will be on its place and come with peace. Now he said "the whole nation". 诇讻讗讜专讛, only those people that will come out innocent, they will be peaceful. But those that will be guilty, 诇讻讗讜专讛 there will be no 砖诇讜诐 for them. But nevertheless, he said, 讜讙诐 讻诇 讛注诐 讛讝讛 注诇 诪拽讜诪讜 讬讘讗 讘砖诇讜诐, that the whole nation will come on its place with peace. avoided him from keeping money that doesn't belong to him.

Laziness Leads to Great Loss

讛讛讜讗 讚讛讜讛 拽讗诪专 讜讗讝讬诇, there was this person that went around saying, 讻讬 谞讬讬诪讗, if she, the woman, falls asleep, 讻讚讬拽讜诇讗 砖驻讬诇, so then the basket that she's wearing holding on her head that has all the different things that she needs for her work will fall down. What it means to say is, that if you are lazy and you don't do your job, then you will have a great loss. It's a 驻住讜拽 in 拽讛诇转 拽驻讬讟诇 讬' 驻住讜拽 讬"讞, it says: 讘注爪诇转讬讬诐 讬诪讱 讛诪拽专讛, which means that if a person is lazy and he doesn't fix a small crack in the roof, so then the whole roof will fall in and the whole house will fall in. That shows that if you are lazy, it eventually it will lead to a big loss. 讛讛讜讗 讚讛讜讛 拽讗诪专 讜讗讝讬诇, there was this person that went around saying, 讙讘专讗 讚专讞讬爪谞讗 注诇讬讛, the person that I relied on, 讗讙诇讬 诇讙讝讬讝讬讛 讜拽诐, he himself stuck his fist out to me. That shows that you can't rely even on a friend that you think you could rely on him. 讗诪专 诇讬讛 砖诪讜讗诇 诇专讘 讬讛讜讚讛, so 砖诪讜讗诇 said to 专讘 讬讛讜讚讛, 拽专讗 讻转讬讘, there's a 驻住讜拽 that tells us that: 讙诐 讗讬砖 砖诇讜诪讬 讗砖专 讘讟讞转讬 讘讜, even my 讗讬砖 砖诇讜诐, which means the person who is peaceful with me, that I relied on him, and the end of the 驻住讜拽 there is: 讛讙讚讬诇 注诇讬 注拽讘, that he picked up his heel upon me to stamp to step on me. That shows that even the person you rely on, you still are not sure, you can't rely on him.

Weakening Marital Love Reduces Comfort

讛讛讜讗 讚讛讜讛 拽讗诪专 讜讗讝讬诇, there was this man that went around saying, 讻讬 专讞讬诪转讬谉 讛讜讛 注讝讬讝讗, when the love between myself and my wife was strong, 讗驻讜砖讬讬讗 讚住驻住讬专讗 砖讻讬讘谞讗, we were able to sleep on the blade the edge of the blade of a sword. 讛砖转讗 讚诇讗 注讝讬讝讗 专讞讬诪转讬谉, now that our love is not strong, it was weakened, 驻讜专讬讗 讘专 砖讬转讬谉 讙专诪讬讚讬 诇讗 住讙讬 诇谉, even a bed of 60 讗诪讜转 is still not enough for us. 讗诪专 专讘 讛讜谞讗, so 专讘 讛讜谞讗 said, 拽专讗讬 讻转讬讘讬, this is mentioned in the 转讜专讛, we have a 专讗讬讛 from a 驻住讜拽 to this. Because 诪注讬拽专讗 讻转讬讘, 诇讻转讞讬诇讛 it says, that 讛' said to 诪砖讛: 讜谞讜注讚转讬 诇讱 砖诐, I will make a time to meet you there, 讜讚讬讘专转讬 讗讬转讱 诪注诇 讛讻驻讜专转, and I will speak to you from the 讻驻讜专转, from the top of the 讗专讜谉. Now, how big was the 讗专讜谉? 讚转谞讬讗, we learned: 讗专讜谉 转砖注讛, the 讗专讜谉 was nine 讟驻讞讬诐 high, 讜讻驻讜专转 讟驻讞, and the 讻驻讜专转 took up a 讟驻讞, the cover was a 讟驻讞, 讛专讬 讻讗谉 注砖专讛, so it's 10. So where 讛' says I will speak to you from the top of the 讻驻讜专转, that means 10 讟驻讞讬诐 off the ground. 讜讻转讬讘, and there's a 驻住讜拽 that says: 讜讛讘讬转 讗砖专 讘谞讛 讛诪诇讱 砖诇诪讛 诇讛', the house that 砖诇诪讛 built to 讛', 砖砖讬诐 讗诪讛 讗讜专讻讜, it was 60 讗诪讛 long, 讜注砖专讬诐 专讜讞讘讜, and 20 讗诪讛 wide, 讜砖诇讜砖讬诐 讗诪讛 拽讜诪转讜, and it was 30 讗诪讜转 high, and that's where the 讗专讜谉 stood, and that's where 讛' found Himself, so to speak. 讜诇讘住讜祝 讻转讬讘, and at the end it says, when the 讬讬讚谉 were not the way they're supposed to, it says: 讻讛 讗诪专 讛', this is what 讛' said: 讛砖诪讬诐 讻住讗讬, the heaven is My chair, 讜讛讗专抓 讛讚讜诐 专讙诇讬, and the earth is My foot footstool, 讗讬讝讛 讘讬转 讗砖专 转讘谞讜 诇讬 讜讙讜诪专, which is the house that you could build for Me? And which is the house that could hold Me? In other words, 诇讻转讞讬诇讛 when the 讬讬讚谉 were close to 讛', so then that house that he built was enough for 讛' to be there. But later on, when the 讬讬讚谉 turned away from 讛', and the love between 讛' and the 讬讬讚谉 was not there anymore, so then He says that this house is not enough. "Now which is the house," He says, "that you could build for Me that could hold the 砖讻讬谞讛 in it?" So we see that when the love is not there, then even a wide place is not enough. Then the 讙诪专讗 continues:

Interpretation of 诇讗 转讙讜专讜 as Not to Gather

诪讗讬 诪砖诪注 讚讛讗讬 诇讗 转讙讜专讜 诇讬砖谞讗 讚讻谞讜砖讗 讛讬讗, this goes back to what we learned in an earlier 讚祝. It says there that when the 驻住讜拽 says: 诇讗 转讙讜专讜 诪驻谞讬 讗讬砖, so the 驻砖讟 驻砖讟 means you should not be afraid of anybody, but the 讙诪专讗 said it also means that you should not hold back your words, not gather your words. And the 讙诪专讗 says, for instance, if a 转诇诪讬讚 is sitting in front of his 专讘讬, and a 讚讬谉 转讜专讛 comes to his 专讘讬, and the 转诇诪讬讚 has a kind of 住讘专讗 to show that the poor man was right and the rich man is wrong, so how do we know that he shouldn't hold back from saying? So the 讙诪专讗 brings the 驻住讜拽: 诇讗 转讙讜专讜 诪驻谞讬 讗讬砖. So it comes out that the word 诇讗 转讙讜专讜, according to that 驻砖讟, means to hold back, to gather into yourself. So the 讙诪专讗 now asks: How is the word 诇讗 转讙讜专讜 诪砖诪注 gathering? 讗诪专 专讘 谞讞诪谉, so 专讘 谞讞诪谉 said: 讗诪专 拽专讗, the 驻住讜拽 says, and it's a 驻住讜拽 in 驻专砖转 讻讬 转讘讜讗: 讬讬谉 诇讗 转砖转讛 讜诇讗 转讗讙讜专, but the wine you will not drink, and you will not gather the grapes. So there it says a 诇砖讜谉 namely 转讗讙讜专, from the same 砖讜专砖 as 诇讗 转讙讜专讜, and there it means gather. So too here, when it says 诇讗 转讙讜专讜, it means you should not gather. 专讘 讗讞讗 讘专 讬注拽讘 讗诪专, 专讘 讗讞讗 讘专 讬注拽讘 says 诪讛讻讗, from this 驻住讜拽. It says in 诪砖诇讬, 转讻讬谉 讘拽讬抓 诇讞诪讛, she will prepare in the summer her bread, 讗讙专讛 讘拽爪讬专 诪讗讻诇讛, and she will gather in the time when you cut the wheat, her food. So there it says 讗讙专讛, and it means gather, so we see that 诇讗 转讙讜专讜 could also mean gather. It says, 讗讜讙专 讘拽讬抓 讘谉 诪砖讻讬诇, that a son that is smart, he will gather his food in the summer time. A son that is foolish will do it some other time. When it comes time to gather in the summer, he will sleep. But if a son is smart, he will gather it in the summer. And there it also uses the 诇砖讜谉 讗讜讙专, and it means gather, so we see that the word 讗讜讙专 comes from the 砖讜专砖 of gathering, and therefore 诇讗 转讙讜专讜 also means gather. Then the 讙诪专讗 continues,

True Judgment Brings Divine Presence

Now, what do we mean when we say a 讚讬谉 讗诪转 诇讗诪讬转讜, a true 讚讬谉 to its truth? As if there is such a thing as a 讚讬谉 讗诪转, a true 讚讬谉, and then there is a thing as 讗诪转 诇讗诪讬转讜, true to its truth. So 转讜住驻讜转 explains in other places that what it means is that the judge himself makes sure that the 讚讬谉 is 讗诪转. Because 注诇 驻讬 讛诇讻讛, if you listen to the 注讚讜转, and you hear what they have to say, and you 驻住拽谉 based on what they said, then you did a 讚讬谉 讗诪转, you 驻住拽谞讟 a 讚讬谉 讗诪转. It was true, because you 驻住拽谞讟 a 讚讬谉 based on the evidence that you had. On the other hand, there is a thing as 讗诪转 诇讗诪讬转讜, that the judge goes further, doesn't just accept what the witnesses say, but he puts himself into it further to investigate more, till he will come out with the hundred percent truth. And that is called a 讚讬谉 讗诪转 诇讗诪讬转讜. So if a judge 驻住拽谞住 a 讚讬谉 讗诪转 诇讗诪讬转讜, true to its truth, so then he makes the 砖讻讬谞讛 dwell amongst the 讗讬讚谉. 砖谞讗诪专, because the 驻住讜拽 says, 讗诇拽讬诐 谞爪讘 讘注讚转 拽诇, 讛砖诐 stands in the community of 讛砖诐, 讘拽专讘 讗诇拽讬诐 讬砖驻讜讟, amongst the judges He will judge. So 讛砖诐 is there, so therefore if you judge a 讚讬谉 讗诪转 诇讗诪讬转讜, then 讛砖诐 stays there, so you make the 砖讻讬谞讛, 讛砖诐, dwell amongst the 讗讬讚谉. But 讜讻诇 讚讬讬谉 砖讗讬谞讜 讚谉 讚讬谉 讗诪转 诇讗诪讬转讜, but a judge that doesn't 驻住拽谉 a 讚讬谉 讗诪转 诇讗诪讬转讜, 讙讜专诐 诇砖讻讬谞讛 砖转住转诇拽 诪讬砖专讗诇, he causes the 砖讻讬谞讛 should go away from the 讗讬讚谉. 砖谞讗诪专, as the 驻住讜拽 says, 诪砖讜讚 注谞讬讬诐, because of the oppression of the poor people, 诪讗谞拽转 讗讘讬讜谞讬诐, because of the sighing of the poor people, 注转讛 讗拽讜诐, now I will get up, 讬讗诪专 讛', 讛砖诐 says, 讜讙讜诪专, etc. So we see that if you don't 驻住拽谉 the proper 讚讬谉 and you take away money from people that the money belongs to, so then you make 讛砖诐 get up and leave. 讜讗诪专 专讘 砖诪讜讗诇 讘专 谞讞诪谞讬, also did 专讘 砖诪讜讗诇 讘专 谞讞诪谞讬 say, 讗诪专 专讘讬 讬讜谞转谉, in the name of 专讘讬 讬讜谞转谉, 讻诇 讚讬讬谉 砖谞讜讟诇 诪讝讛 讜谞讜转谉 诇讝讛, any 讚讬讬谉 that takes from one and gives to the other, 砖诇讗 讻讚讬谉, not according to the 讚讬谉, 讛拽讚讜砖 讘专讜讱 讛讜讗 谞讜讟诇 诪诪谞讜 谞驻砖讜, 讛砖诐 will take away his 谞驻砖, his life, 砖谞讗诪专, the 驻住讜拽 says, 讗诇 转讙讝诇 讚诇, do not steal from the poor, 讻讬 讚诇 讛讜讗, because he is poor, 讜讗诇 转讚讻讗 注谞讬 讘砖注专, and do not oppress the poor man at the gate, 讻讬 讛' 讬专讬讘 专讬讘诐, because 讛砖诐 will argue their argument, 讜拽讘注 讗转 拽讘注讬讛诐 谞驻砖, and 讛砖诐 will spoil the 谞驻砖, take away the life from those that they spoil. That means that if somebody takes away something from a person it belongs to, he 驻住拽谞住 a wrong 讚讬谉, so then 讛砖诐 will take away his 谞驻砖.

The 讞讻诐 would teach, but he would say it quietly, and the 诪转讜专讙诪谉 would get up and say it out loud. So the 讞讻诪讬诐 said to 讬讛讜讚讛 讘专 谞讞诪谞讬 who was the 诪转讜专讙诪谉 of 专讬砖 诇拽讬砖, 拽讜诐 注诇讬讛 讘讗诪讜专讗, now you become the 诪转讜专讙诪谉 of that 讚讬讬谉 that was appointed by the family of the 谞砖讬讗, and you repeat what he has to say. 拽诐 讙讞讬谉 注诇讬讛, so he came, got up So he bent down to him to hear what he has to say, 讜诇讗 讗诪专 诇讬讛 讜诇讗 诪讬讚讬, he didn't say anything to him. 驻转讞 讜讗诪专, so he started to speak, and he said, he quoted this 驻住讜拽, it's a 驻住讜拽 in 讞讘拽讜拽 讘壮 驻住讜拽 讬状讟, it says, 讛讜讬 讗讜诪专 诇注抓 讛拽讬爪讛, woe is unto the person who says to wood, "Get up," 注讜专讬 诇讗讘谉 讚讜诪诐, "Arise," he says to a stone that is not movable, 讛讜讗 讬讜专讛, he will 驻住拽谉? 讛谞讛 讛讜讗 转驻讜砖 讝讛讘 讜讻住祝, isn't he surrounded, completely enveloped in gold and silver, 讜讻诇 专讜讞 讗讬谉 讘拽专讘讜, and all spirit, all breath, is not in him. Unfit Judges as Idolatrous Trees

讛住 诪驻谞讬讜 讻诇 讛讗专抓, let the whole world be quiet for him. So we see that 讛壮 is there, and he sees what's going on, and he will punish the one that appoints such a judge. 讗诪专 专讬砖 诇拽讬砖, 专讬砖 诇拽讬砖 said, 讻诇 讛诪注诪讬讚 讚讬讬谉 砖讗讬谞讜 讛讙讜谉, anybody who appoints a judge who is not fit, 讻讗讬诇讜 谞讜讟注 讗砖专讛 讘讬砖专讗诇, as if he planted an 讗砖专讛 amongst the 讬讬讚谉. And an 讗砖专讛 is a tree that was worshipped for 注讘讜讚讛 讝专讛. And how do we know that? 砖谞讗诪专, because the 驻住讜拽 says, 砖讜驻讟讬诐 讜砖讜讟专讬诐 转转谉 诇讱, judges and officers you should put for you, you should appoint judges and officers, 讜住诪讬讱 诇讬讛, and right next to it the 转讜专讛 says, 诇讗 转讟注 诇讱 讗砖专讛 讻诇 注抓, you should not plant any 讗砖专讛, any wood like an 讗砖专讛. And this refers to a judge, as 专砖状讬 says, the 驻住讜拽 says 讻讬 讛讗讚诐 注抓 讛砖讚讛, that a person is compared to the tree of the field. And the 讙诪专讗 says in 转注谞讬转 that it refers to a 转诇诪讬讚, this is a 诪砖诇 for a 转诇诪讬讚, for a scholar who studies. And that's what it says here, that 砖讜驻讟讬诐 讜砖讜讟专讬诐 转转谉 诇讱, you should make 砖讜驻讟讬诐 讜砖讜讟专讬诐, that the truth is you have to appoint judges, but 诇讗 转讟注 诇讱 讗砖专讛 讻诇 注抓, do not have that 注抓, that wood, which is a 专诪讝, a hint for the judge, should not be an 讗砖专讛. Obviously, if the judge is not the way he's supposed to, then he is like an 讗砖专讛, he's like a tree that was worshipped for 注讘讜讚讛 讝专讛. And therefore, anybody who appoints him is as if he's planting a tree for 注讘讜讚讛 讝专讛.

So that's what it says, if this was done amongst 转诇诪讬讚讬 讞讻诪讬诐, that not only did you plant an 讗砖专讛, but you planted it next to the 诪讝讘讞. Then the 讙诪专讗 says, the 驻住讜拽 says, 讻转讬讘 诇讗 转注砖讜谉 讗转讬 讗诇讛讬 讻住祝 讜讗诇讛讬 讝讛讘, do not make with me a god of silver or a god of gold. Does that mean that 讗诇讛讬 讻住祝 讜讗诇讛讬 讝讛讘 讛讜讗 讚诇讗 讬注讘讚, that only a god, an 注讘讜讚讛 讝专讛 of silver and gold you're not allowed to make, 讛讗 讚注抓 砖专讬, but a an 注讘讜讚讛 讝专讛 of wood you are allowed? That couldn't be. What does the 驻住讜拽 mean?

Judges Bought with Silver and Gold Forbidden

讗诪专 专讘 讗砖讬, so 专讘 讗砖讬 said, it means 讗诇讜讛 讛讘讗 讘砖讘讬诇 讻住祝, a god that comes because of silver, 讜讗诇讜讛 讛讘讗 讘砖讘讬诇 讝讛讘, a god that comes because of gold. And as we know that 讗诇讜拽讬诐 refers to a 讚讬讬谉, to a judge, so what he's saying here is that that you should not have a judge that comes because of silver and gold. You should appoint a judge who is fit for the position, but not he should buy that position with gold or silver. Because there used to be a time when they used to pay money to the king and buy that position to become a judge. And that's what the 驻住讜拽 is saying here, should not have a judge that was bought through 讻住祝 讜讝讛讘. Then the 讙诪专讗 continues, 专讘 讻讬 讛讜讛 讗转讬 诇讘讬 讚讬谞讗, when 专讘 used to come to 讚讬谉 转讜专讛, 讗诪专 讛讻讬, he would say like this, 讘专注讜转 谞驻砖讬讛 诇拽讟诇讗 谞驻讬拽, out of his own free will, he's going out for death. Because a judge, if he doesn't 驻住拽谉 the right 讚讬谉, as we said before, 讛壮 will take away his 谞驻砖. So he said it's out of my free will that I'm going for death. 讜爪讘讬 讘讬转讬讛 诇讬转 讛讜讗 注讘讬讚, and the 爪专讻讬, the needs of his house, he is not doing, 讜专讬拽谉 诇讘讬转讬讛 讗讝讬诇, and he's going to come into the house empty, 讜讛诇讜讗讬 砖转讛讗 讘讬讗讛 讻讬爪讬讗讛, 讛诇讜讗讬 when he comes into the house should be the same as when he went out, it shouldn't be worse, just like when he went out, he didn't have any sin on him, when he comes back, he also shouldn't have a sin, because since he's going to judge in the middle, who knows, maybe he might 驻住拽谉 驻住拽谉 it wrong. So therefore he says a 转驻讬诇讛 that 讛诇讜讜讗讬 when he comes back to the house it shouldn't be worse that when he came out of the house. That when he comes back he shouldn't be with a sin and shouldn't be punished for the 驻住拽 讚讬谉 that he 驻住拽谞'住. 讻讬 讛讜讜 讞讝讬 讗诪讘讜讛讗 讘转专讬讛, he would see a group of people follow him, 讗诪专 he would say like this. He would quote the 驻住讜拽 in 讗讬讜讘 拽驻讬讟诇 讻', 驻住讜拽 讜' 讝'. There it says 讗诐 讬注诇讛 诇砖诪讬诐 砖讬讗讜. If his excellence will go up to 砖诪讬诐, to heaven, he will have a lot of 讻讘讜讚, he still should remember 讻讙诇诇讜 诇谞爪讞 讬讗讘讚, just like gall, just like manure, forever he will be lost. He said this in order not to be a 讘注诇 讙讗讜讛, to stay humble. That's what he used to say.

Carrying the Elder Scholar on Shabbat

诪专 讝讜讟专讗 讞住讬讚讗, 诪专 讝讜讟专讗 讚讞住讬讚, 讻讬 诪讻转驻讬 诇讬讛 讘砖讘转讗 讚专讬讙诇讗, when they would carry him on the shoulder on the 砖讘转 of a 讬讜诐 讟讜讘, the 砖讘转 when they had to teach the 讚讬谞讬诐 of 讬讜诐 讟讜讘. As the 讚讬谉 is that thirty days before a 讬讜诐 讟讜讘 you must teach the 讚讬谞讬诐 of 讬讜诐 讟讜讘. So when they used to teach the 讚讬谞讬诐, so they used to take him, carry him on the shoulder since he was old and if he would walk, there would be a big 讟专讞讛, trouble for the people to stand the whole time till he comes to his place. So therefore they used to carry him on the shoulder. 讜讛讜讛 讗诪专 讛讻讬, and when this used to happen he used to say as follows: he would quote the 驻住讜拽 in 诪砖诇讬 讻"讝, 驻住讜拽 讻"讚, where it says 讻讬 诇讗 诇注讜诇诐 讞讜住谉, riches are not forever, 讜讗诐 谞讝专 诇讚讜专 讜讚讜专, and is the crown for all generations? And he would say that again not to be a 讘注诇 讙讗讜讛. 讚专砖 讘专 拽驻专讗, 讘专 拽驻专讗 讚专砖, 诪谞讗 讛讗 诪讬诇转讗 讚讗诪专讜 专讘谞谉, where do we have this thing that the 专讘谞谉 said 讛讜讜 诪转讜谞讬谉 讘讚讬谉, that you should be calm and slow in the 讚讬谉, that before you 驻住拽谉 the 讚讬谉, you should think about it from all sides and make sure that the 驻住拽 讚讬谉 will be correct? 讚讻转讬讘, because a 驻住讜拽 says 诇讗 转注诇讛 讘诪注诇讜转, you should not go up on steps. This is a 驻住讜拽 that refers to the 诪讝讘讞. And this is the end of 驻专砖转 讬转专讜, and right 住诪讬讱 诇讬讛, right next to it, it says 讜讗诇讛 讛诪砖驻讟讬诐, and these are the judgments. So we learn out from here that when you go to judge, you shouldn't go up on steps, which means you shouldn't run and you shouldn't go very strong, you should go very slow. You should make sure that the 驻住拽 讚讬谉 you're going to give is a correct 驻住拽 讚讬谉.

Judges Must Not Step Over Holy Heads

讗诪专 专讘讬 讗诇注讝专, 专讘讬 讗诇注讝专 said, 诪谞讬讬谉 诇讚讬讬谉 砖诇讗 讬驻住讬注 注诇 专讗砖讬 注诐 拽讜讚砖, how do we know that a 讚讬讬谉 should not step on the heads of the holy nation? When the 诪转讜专讙诪谉 used to speak, all the people would sit on the floor. Now, anybody would want to go through would have to pass between them, and it would look as if he's stepping over their heads. So how do we know that the 讚讬讬谉 should not do it, he should not go through in that way, it should look as if he's stepping on their heads? 砖谞讗诪专, the 驻住讜拽 says 诇讗 转注诇讛 讘诪注诇讜转, do not go up on step. 讜住诪讬讱 诇讬讛, and right next to it it says 讜讗诇讛 讛诪砖驻讟讬诐 讗砖专 转砖讬诐, and these are the judgments that you should put in front of them. So we see the connection, that the judges, they should not go up on top, they shouldn't step over the heads of the 讬讬讚谉. Then the 讙诪专讗 continues to explain 驻砖讟 in this 驻住讜拽 that we just brought, 讜讗诇讛 讛诪砖驻讟讬诐 讗砖专 转砖讬诐 诇驻谞讬讛诐. And the 讙诪专讗 asks 讗砖专 转诇诪讚诐 诪讬讘注讬 诇讬讛, the 转讜专讛 should have said 讗砖专 转诇诪讚诐, should have said 讜讗诇讛 讛诪砖驻讟讬诐 讗砖专 转诇诪讚诐, these are the judgments that you should teach them. What's the 驻砖讟, these are the judgments that you should put in front of them? The expression to put in front of them would fit to something that's tangible that you could put down. But here we're talking about 讚讬谞讬诐, we're talking about 讛诇讻讜转. So it should have said these are the judgments, the 讚讬谞讬诐 that you should teach them. These are the vessels that the 讚讬讬谞讬诐 have, and that's what it says, the 讚讬讬谞讬诐 should have these vessels and they should put it down in front of them when they come to judge the 讚讬谞讬诐. And for that it fits to say the 诇砖讜谉 转砖讬诐 诇驻谞讬讛诐, put down, because that is something that is tangible. Then the 讙诪专讗 continues, 专讘 讛讜谞讗 讻讬 讛讜讛 谞驻讬拽 诇讚讬谞讗, 专讘 讛讜谞讗 when he would go to a 讚讬谉 转讜专讛, 讗诪专 讛讻讬, he would say as follows:

Judge鈥檚 Required Judicial Tools Listed

讗驻讬拽讜 诇讬 诪讗谞讬 讞谞讜转讗讬, take out and give me the vessels for my office. And what are they? 诪拽诇, a stick, 讜专爪讜注讛, and a whip, 讜砖讜驻专讗, and a 砖讜驻专, 讜住谞讚诇讗, and a shoe. And as 专砖''讬 explains that each one was needed for the job of being a 讚讬讬谉. The stick was needed for 诪讻转 诪专讚讜转, that if a person didn't want to listen he would give him 诪讻转 诪专讚讜转. The 专爪讜注讛, the whip was needed for 诪诇拽讜转. The 砖讜驻专 was needed for 讞专诐, if the 讘讬转 讚讬谉 felt that they want to put somebody in 讞专诐 and excommunication. And the 砖讜驻专 was for 讞专诐, if the 讘讬转 讚讬谉 felt that they wanted to put somebody in 讞专诐 and excommunication, then they would blow 砖讜驻专. And the shoe was for 讞诇讬爪讛. And the 讚讬谉 is that if a person dies without any children, so his wife is supposed to get married to his brother if he has a brother. If he doesn't want to marry him, so then instead of 讬讬讘讜诐, he would give him 讞诇讬爪讛. And the way 讞诇讬爪讛 was done is that you take off the shoe of the brother, plus she spits on the floor in front of him, etc. So he would take along a shoe just in case he would have to perform a 讞诇讬爪讛. Concerning what the 讙诪专讗 said before before, that anybody who appoints a 讚讬讬谉 砖讗讬谞讜 讛讙讜谉 is as if he plants an 讗砖专讛 next to the 诪讝讘讞, so the 诪讛专砖状讗 explains, what is the connection between that and a 讚讬讬谉? Because he says a 讚讬讬谉 讘讻诇诇 has the same name as 讛砖诐. We know that when it says 讗诇拽讬诐 in the 转讜专讛, sometimes it means a 讚讬讬谉. And not only that, sometimes when it says 讗诇拽讬诐, it means both together. In the same word, we include 讛砖诐 and the 讚讬讬谉. For instance, the 讙诪专讗 says in 驻专拽 讚壮 诪讬转讜转, that when the 转讜专讛 says 讗诇拽讬诐 诇讗 转拽诇诇, you should not curse 讗诇拽讬诐, it means both, it means 拽讜讚砖 and 讞讜诇, it means 讛砖诐 and it means the 讚讬讬谉. So just like when a person plants an 讗砖专讛 next to the 诪讝讘讞, the 驻砖讟 is that right next to the 诪讝讘讞, which is connected to 讛砖诐, which represents 讛砖诐, you put 讗诇讛讬诐 讗讞专讬诐, other gods, so, too, if together with a 讚讬讬谉 讛讙讜谉, you appoint a 讚讬讬谉 砖讗讬谞讜 讛讙讜谉, then you're putting 讗诇讛讬诐 讗讞专讬诐 next to the true 讗诇拽讬诐. Since the real 讚讬讬谉 is called 讗诇拽讬诐, the 讚讬讬谉 砖讗讬谞讜 讛讙讜谉 is like 讗诇讛讬诐 讗讞专讬诐. He's also 讗诇拽讬诐 because he's a 讚讬讬谉, but he's a false 讗诇拽讬诐. So what you're doing is you're putting 讗诇讛讬诐 讗讞专讬诐 right next to 讗诇拽讬诐 拽讚讜砖讬诐, to 讛砖诐 Who is holy, which is similar to a person who plants an 讗砖专讛, which is 注讘讜讚讛 讝专讛, 讗诇讛讬诐 讗讞专讬诐, right next to the 诪讝讘讞, which represents 讛砖诐. When the 讙诪专讗 explains the 驻住讜拽 where it says 讗诇讛讬 讻住祝 讜讗诇讛讬 讝讛讘 诇讗 转注砖讜 讗转讬, that you should not make for Me God of silver or gold, and the 讙诪专讗 explains it means do not appoint a 讚讬讬谉 for silver and gold, which means like a 讚讬讬谉, as 专砖状讬 says, who bought his position from the king through gold and silver, that you shouldn't do, so the 诪讛专砖状讗 says that this really includes two 注讘讬专讜转. It doesn't only mean a 讚讬讬谉 who bought his position through gold and silver, but also a 讚讬讬谉 who keeps his position in order to make gold and silver, that he makes money through his being a 讚讬讬谉. That is also an 注讘讬专讛. And the 诪讛专砖状讗 goes into at length how terrible it is for those 专讘谞讬诐 or those 讚讬讬谞讬诐 that their whole position is there because they want to make money. Also, concerning what 专讘 said when he used to go to a 讚讬谉 转讜专讛 he would say that 讘专注讜转 谞驻砖讬 诇诪讬拽讟诇讗 谞驻讬拽, that with my own will I'm going out for death. And then he said that the 爪专讻讬诐 of my household will not be done, and empty I will go into my house, and 讛诇讜讜讗讬 when I go into my house I should be the same as I go out out of my house. And 专砖状讬 explains, that what does that mean? When he said that with my own will I'm going for death, it is because since he's going to a 讚讬谉 转讜专讛, maybe he will make a mistake and 驻住拽'谉 wrong and then he will be punished. And when he said 讛诇讜讜讗讬 when I go back to the house it should be the same as when I went out, it also means that 讛诇讜讜讗讬 when I come in, after the 讚讬谉 转讜专讛, I should not have a 讞讟讗 on me, I should not be punished for 驻住拽'谞讬谞讙 the 讚讬谉 wrong. So the 诪讛专砖状讗 asks a 拽砖讬讗, 诇讻讗讜专讛, both things are saying the same thing. The first statement he made, that on his own will he's going to death, it is because he might make a mistake and be punished. And later when he said 讛诇讜讜讗讬 when I come back to my house I should be the same as when I left the house, it is because he's afraid he might be punished for a mistake. So really, the both things are saying the same thing. Also, he asks, why was he so afraid? Didn't the 讙诪专讗 say later on 讚祝 讜壮 注诪讜讚 讘壮 that 砖诪讗 讬讗诪专 讛讚讬讬谉 诪讛 诇讬 讘爪注专 讛讝讛, the 讚讬讬谉 might say since I could be punished for my mistake, why should I 诇讻转讞讬诇讛 get involved in this problem? And if he judges based on the information and the evidence that he gets, so then he will not be punished. So, what was he afraid? He would follow the evidence, he would 驻住拽'谉 according to what he sees, and he won't be punished. So, why was he really afraid of being punished? And therefore, the 诪讛专砖状讗 learns that when he said that 讘专注讜转 谞驻砖讬 诇诪讬拽讟诇讗, that he with his own will is going into death, it is because he might come out with a 驻住拽 讚讬谉 that the strong one is going to be guilty, and that strong one might be 专讜讚祝 him, might make him problems. And that was he was afraid of. And when he said 讜专讬拽诐 诇讘讬转讬 讗讬注讜诇, that I enter my house empty, it is because the

Prohibition on Taking Payment for Judgments

讚讬谉 is that you're not allowed to receive 砖讻专, payment for 驻住拽'谞讬谞讙 a 讚讬谉, as the 讙诪专讗 says in 讘讻讜专讜转, that 讛谞讜讟诇 砖讻专 注诇 诪谞转 诇讚讜谉 讚讬谞讬讜 讘讟诇讬诐, that if someone takes payment for 驻住拽'谞讬谞讙 a 讚讬谉 转讜专讛, all his 讚讬谞讬诐 are 讘讟诇. So therefore, he said that from 驻住拽'谞讬谞讙 the 讚讬谉 转讜专讛, I don't gain any money, I will come home empty. The only thing I'm getting into is in trouble, that maybe the one that I'm going to say is guilty will be 专讜讚祝 me and make me problems and could kill me. And then when he said 讛诇讜讜讗讬 when I enter my house should be as when I left it, what he means to say is, the 诪讛专砖状讗 explains, that I shouldn't be worse off in the money, because if I will make a mistake in the 讚讬谉, I will have to pay. As we learned before, that the 讚讬讬谉 who makes a mistake has to pay the loss. So 讛诇讜讜讗讬 when I come back to my house, not only will I not make more money because I'm not allowed to take any money for 驻住拽'谞讬谞讙 the 讚讬谉 转讜专讛, 讛诇讜讜讗讬 I shouldn't have a loss of money. 讛诇讜讜讗讬 I shouldn't make a mistake take and have to pay from my pocket for the loss I caused. Now 讙诐 we learned before that if he got 专砖讜转 from the 专讬砖 讙诇讜转讗, then even if he makes a mistake he doesn't pay, so what was 专讘讗 afraid that if he'll make a mistake he would have to pay? But it's not so, because he did have 专砖讜转 as we learned before from the 专讬砖 讙诇讜转讗. But nevertheless, he didn't consider himself as a 诪讜诪讞讛, as an expert, because he was an 注谞讜. So therefore, he didn't feel that if he would make a mistake he would be 驻讟讜专 from paying, and therefore he said, 讛诇讜讗讬 when I come back home I shouldn't have a greater loss than when I left my house. Also concerning what 专讘 said, whenever he would see a group of people following him, he would quote the 驻住讜拽 that if his excellence will go up to 砖诪讬诐, nevertheless the end will be like 讙诇诇讜. So the 诪讛专砖状讗 says why did he mention going up to 砖诪讬诐? Because in the beginning of the creation, 讗讚诐 讛专讗砖讜谉 it says, was 诪谉 讛讗专抓 注讚 讛专拽讬注. He was that big, he was from the ground to the 专拽讬注. So therefore he said, if I'm going to be that big and will go up 注讚 讛专拽讬注, still the end will be 讻讙诇诇讜 诇谞爪讞 讬讗讘讚, that when he dies, what will happen to him? He'll be like 讙诇诇讜. And the reason he mentions 讙诇诇讜, because that, the 诪讛专砖状讗 says, is the lowest thing and the worst thing and something that everyone stays away from. And that's what he said, even though now I might feel I'm 注讚 诇砖诪讬诐, nevertheless when I die, what's going to happen to me? I'll be the worst thing, because the 讚讬谉 is that a 诪转 is 讟诪讗, and not only 讟诪讗, he is 讗讘讬 讗讘讜转 讛讟讜诪讗讛, that is the source of the source of 讟讜诪讗讛. And that's what he said, how can I hold myself big, even if I see that I'm going to be I'm that great, 注讚 诇砖诪讬诐, nevertheless the end will be that I will be like 讙诇诇讜. Concerning the 讚专砖 of 诇讗 转注诇讛 讘诪注诇讜转 注诇 诪讝讘讞讬, when the 讙诪专讗 says how do we know that 诪转讜谞讬谉 讘讚讬谉, that when it comes to 驻住拽谉 the 讚讬谉, you shouldn't rush? It is because the 转讜专讛 says 诇讗 转注诇讛 讘诪注诇讜转, and then it says 讜讗诇讛 讛诪砖驻讟讬诐, so we learn out that when it comes to 诪砖驻讟讬诐 to judge, 诇讗 转注诇讛 讘诪注诇讜转, do not go up steps, as 专砖状讬 says, do not run, do not go strong. So 诪讛专砖状讗 says 讘讗诪转 we could say another 驻砖讟, that it means do not go on steps, that a person should not think that he is already on the higher step. When he 驻住拽谞'住 the 讚讬谉, he shouldn't think right away I'm already on the higher step and I already know the end, I already know the 驻住拽 讚讬谉. You always have to consider yourself as if you are on the lower step and you still have to step on another step. That's what the 驻住讜拽 says, 诇讗 转注诇讛 讘诪注诇讜转, do not go up on steps, do not feel that you're on the upper step, you should feel that you're on the lower step, and you should take your time and go through the 讚讬谉 very carefully, and then you should 驻住拽谉 the 讚讬谉. And now we will continue the 讙诪专讗 inside. The 讙诪专讗 quotes the 驻住讜拽 in 讚讘专讬诐 where it says, 讜讗爪讜讛 讗转 砖驻讟讬讻诐, 诪砖讛 专讘讬谞讜 is saying I commanded your judges 讘注转 讛讛讬讗 at that time. Whenever it says the word 爪讜, it means to be extra careful, that 爪讜 is 诇砖讜谉 讝讬专讜讝, that the word 爪讜讜讗讛 is always to be 诪讝专讝, to make the person faster, to make the person more careful. Now what was he telling them that they have to be careful about? 讗诪专 专讘讬 讬讜讞谞谉, so 专讘讬 讬讜讞谞谉 said, 讻谞讙讚 诪拽诇 讜专爪讜注讛 转讛讗 讝讛讬专讜转. What he was saying is, be careful with your stick and your whip. That when the judge uses his stick or his whip, he should make sure to use it only 诇砖诐 砖诪讬诐, only for 讛砖诐's sake, not to show his own control. Then the 驻住讜拽 continues there, 砖诪注 讘讬谉 讗讞讬讻诐 讜砖驻讟转诐, you should listen amongst between your brothers and you should 驻住拽谉.

Warning Not to Hear One Side First

讗诪专 专讘 讞谞讬谞讗, so 专讘 讞谞讬谞讗 said, 讗讝讛专讛, that is a warning, 诇讘讬转 讚讬谉 砖诇讗 讬砖诪注 讚讘专讬 讘注诇 讚讬谉 拽讜讚诐 砖讬讘讗 讘注诇 讚讬谉 讞讘讬专讜, that is a warning for the 讘讬转 讚讬谉 that they should not listen to the words of one 讘注诇 讚讬谉 before the other 讘注诇 讚讬谉 comes, because when you hear the words of one 讘注诇 讚讬谉 and the other one is not there to answer the 住讘专讗 that he says, so then you only have the 住讘专讗 of one side. And since he explained it to you properly without your hearing the answer of the other side, it's absorbed in your mind. So later on, even though you will hear later on the 讟注谞讜转 of the other one, nevertheless it'll already be harder for you to see that the other one is right. Therefore, you are not allowed to listen to the words of one 讘注诇 讚讬谉 before the other. And that's what the 驻住讜拽 means, 砖诪注 讘讬谉 讗讞讬讻诐, you should only hear between your brothers; when both of them are there, that's when you should hear the 讟注谞讜转. And it's also It's also a warning to the 讘注诇 讚讬谉 himself that he should not try to explain his side, give his 讟注谞讜转 to the 讚讬讬谉, to the judge, before his other 讘注诇 讚讬谉 comes. So we have here the 驻住讜拽 telling us that the 讘讬转 讚讬谉 is not allowed to listen to the 讟注谞讛 of one 讘注诇 讚讬谉 without the other, and the same 驻住讜拽 also tells us that it's a 诇讗讜, an 注讘讬专讛, for the 讘注诇 讚讬谉 himself to give his 讟注谞讜转 before the other. How do we see in the 驻住讜拽 that this also applies to the 讘注诇 讚讬谉 himself? 拽专讬 讘讬讛 谞诪讬 砖诪注 讘讬谉 讗讞讬讻诐, that the same letters, 砖 诪 注, that is written and read 砖诪注, which means to be heard, can also be read 砖诪注, to make hear. So if we say it means hear, to be heard, then it refers to the 讘讬转 讚讬谉, that the 讘讬转 讚讬谉 should not not hear the 讟注谞讜转 of one 讘注诇 讚讬谉 without the other. But if we're gonna read it 砖诪注, it means make hear, so the 驻住讜拽 is saying that when you make hear your 讟注谞讛, it has to be

Judge and False Report

讘讬谉 讗讞讬讻诐. So it's talking not to the 讚讬讬谉, but talking to the 讘注诇 讚讬谉, that when he gives his 讟注谞讜转, it should be 讘讬谉 讗讞讬讻诐, between the brothers, when the other 讘注诇 讚讬谉 is there. 专讘 讞谞讗 讗诪专 诪讛讻讗, 专讘 讞谞讗 says we can learn out the same 讚讬谉 from here, from another 驻住讜拽, 诪状诇讗 转砖讗状, the 驻住讜拽 says, 诇讗 转砖讗 砖诪注 砖讜讗, do not receive, do not pick up a false report. So we could read the same word not 诇讗 转砖讗, but 诇讗 转砖讬讗. 诇讗 转砖讗 砖诪注 砖讜讗 means do not pick up a false report. So that refers to the 讚讬讬谉, the judge. He should not take the report in a false way, meaning when only one is there and not the other. But if we read it 诇讗 转砖讬讗, it means that you should not give the false report. So that is talking to the 讘注诇 讚讬谉 himself, that he should not give a report in a way that is like false if he says it when the other one is not there. Then the 驻住讜拽 continues, 讜砖驻讟转诐 爪讚拽, you should judge righteously. 讗诪专 专讬砖 诇拽讬砖, 专讬砖 诇拽讬砖 said, 爪讚拽 讗转 讛讚讬谉 讜讗讞专 讻讱 讞转讻讛讜. What it means is make your 讚讬谉, your 驻住拽 讚讬谉, your verdict righteous, and then you should cut it, then you should give it, which means that before you give the 驻住拽 讚讬谉, it should be very clear in your mind that this is the correct 讚讬谉. It should be very careful that it's 100% right in your mind, and then you should 驻住拽谉 the 讚讬谉. But the

Maharshal on the Difficulty of the Gemara

诪讛专砖状讗 explains that 诇讻讗讜专讛 it's not clear what the 讙诪专讗 means with this 讚专砖讛. How does it learned out from the 驻住讜拽, and what exactly does this 讚专砖讛 mean when we say that first you should be 爪讚拽 the 讚讬谉 and then 讞转讻讛讜? So the 诪讛专砖状讗 learns the 驻砖讟 like this, that 讘讗诪转 when we quoted the 驻住讜拽, 讜砖驻讟转诐 爪讚拽, the 讙诪专讗 meant to ask a 拽砖讬讗: What do we mean 讜砖驻讟转诐 爪讚拽? 爪讚拽 comes from the 诇砖讜谉 爪讚拽讛, and 讜砖驻讟转诐 爪讚拽 is like a contradiction within itself. As we learned in the 讙诪专讗 earlier, 讘诪拽讜诐 诪砖驻讟 讗讬谉 爪讚拽讛, 讘诪拽讜诐 爪讚拽讛 讗讬谉 诪砖驻讟. There is a 驻住讜拽, 诪砖驻讟 讜爪讚拽讛 the 讙诪专讗 quoted in the earlier 讚祝. And the 讙诪专讗 asked, what does that mean? 诪砖驻讟 and 爪讚拽讛 are two opposites. 爪讚拽讛 is righteousness, 诪砖驻讟 is judgment. If there is judgment, there is no righteousness; if there is righteousness, then there is no judgment. 讗诇讗, the 讙诪专讗 said, what kind of 诪砖驻讟 is it together with 爪讚拽讛? That is 驻砖专讛, that if you make a settlement, then you have both: it is judgment, but on the other hand it's righteousness, it's good for both. And that's what the 讙诪专讗 means here, that when it says 讜砖驻讟转诐 爪讚拽, it comes to tell us that 爪讚拽 讗转 讛讚讬谉 讜讗讞专 讻讱 讞转讻讛讜. The

Making a Settlement Before Verdict

first thing you should do, you should try to take the 诪砖驻讟 and make it in the form of 爪讚拽. The first thing you should do is that you should try to make a 驻砖专讛. That is 爪讚拽. 讜讗讞专 讻讱 讞转讻讛讜, that means that only afterwards, then you cannot make the 驻砖专讛, but it has to be 讞转讻讛讜, a clear 驻住拽 讚讬谉. As we said before, that after you already hear the 讟注谞讜转, and you already know 诇讛讬讻谉 讛讚讬谉 谞讜讟讛, to which side the 讚讬谉 is 谞讜讟讛, then you are not allowed to make a 驻砖专讛. And that's what the 驻住讜拽 is saying here: 讜砖驻讟转诐 爪讚拽, that you should try to make a 诪砖驻讟 with 爪讚拽, which is a 驻砖专讛. But 讜讗讞专 讻讱, if you are already holding further, you already heard the 讟注谞讜转, and you know 诇讛讬讻谉 讛讚讬谉 谞讜讟讛, then 讞转讻讛讜, then you would 驻住拽谉 the 讚讬谉 as a 讚讬谉, not as a 驻砖专讛, because then you're not allowed to make a 驻砖专讛, as the 讙诪专讗 brought an opinion before. Then the 讙诪专讗 continues to 讚专砖谉 the 驻住讜拽讬诐. It says there, 讘讬谉 讗讬砖 讜讘讬谉 讗讞讬讜. It says that you should judge righteous between a man and his brother. 讗诪专 专讘 讬讛讜讚讛, so 专讘 讬讛讜讚讛 said, 讗驻讬诇讜 讘讬谉 讘讬转 诇注诇讬讬讛, which means even between a house and a second floor, that you should always judge righteously, and you should not say, for instance, if two people come with a dispute over a house and a second floor, so don't say, I'll 驻住拽谉 that I'll give the house to one, and the second floor to another, so each one will have a place to live in. 讗讬讬, one of the two is worth more, who cares as long as each one will have a place to live in. So you can't say that; it has to be done 讘爪讚拽, and if there's a difference in price, you have to judge that difference too. And

Between Neighbor and Stranger (Ovens)

when the 驻住讜拽 continues, 讜讘讬谉 讙专讜, you should judge righteously between a man and his brother and his 讙专 and his stranger, what does that mean? 讗诪专 专讘 讬讛讜讚讛, so 专讘 讬讛讜讚讛 said, 讗驻讬诇讜 讘讬谉 转谞讜专 诇讻讬专讬讬诐, even if it's a dispute between a 转谞讜专 and a 讻讬专讬讬诐. These are two types of ovens. So the judge might say, since there is a dispute over these two, so I will give one to one and the other to another, so each one will have an oven to work with. 讗讬讬, one is more expensive than the other, a 转谞讜专 is bigger and more expensive than a 讻讬专讬讬诐, but he won't make that difference, and he will say as long as each one has an oven to use, then I won't make him pay extra money. So that's what it says, no, you have to judge 讘爪讚拽, that you have to see if there's a difference in price between one and the other, so you have to judge that difference and make him pay the difference. This is the way 专砖状讬 explains, but the 诪讛专砖状讗 adds to this 驻砖讟. He says that 讘讗诪转 there is a 拽砖讬讗 in the 驻住讜拽. When the 驻住讜拽 says you should 驻住拽谉 爪讚拽 讘讬谉 讗讬砖 讜讘讬谉 讗讞讬讜 讜讘讬谉 讙专讜, the 讙诪专讗 has a 拽砖讬讗: why does it say 讘讬谉 讗讬砖 讜讘讬谉 讗讞讬讜 讜讘讬谉 讙专讜, why doesn't it say 讘讬谉 讛讗谞砖讬诐, and you should 驻住拽谉 讘爪讚拽 between the people? Obviously, the 驻住讜拽 is trying to tell us something. 讘讬谉 讗讬砖 讜讘讬谉 讗讞讬讜 means a man and his brother, as if the 驻住讜拽 is saying a man is a 讙讚讜诇, an adult, his brother is smaller than him, he's a 拽讟谉. So the 驻住讜拽 is trying to tell us that if you have two brothers who inherited from their father, they inherited a house and it has a second floor, and they come to the 讚讬讬谉 that he should divide the 讬专讜砖讛. So the 讚讬讬谉 might think, since he is the 讗讬砖, he is the 讙讚讜诇, so he deserves the better part of it, the more expensive part of it. The brother who is only a 拽讟谉, he will get the smaller part. That's why the 驻住讜拽 says no, that you have to divide it equally. You can't look at it, since he is an 讗讬砖 and he is only a 拽讟谉, so he deserves less. No, since they both inherited, it belongs to both of them equally, and you have to divide it 讘爪讚拽, you have to divide it equally. And the same when it says 讜讘讬谉 讙讬专讜. The way 专砖''讬 learns, 讙讬专讜 comes from the word living, from the 诇砖讜谉 of 诪讙讜专. So it refers to the 讻诇讬诐 that you need to live. And therefore, the 讙诪专讗 said that it refers to a division between a 转谞讜专 and 讻讬专讬讬诐. But the 诪讛专砖''讗 says that it comes from the word living, but it means people who live in the house. So you might think that if a person has a bigger family, more people live in the house, he deserves a bigger oven because he has to use more. The one that has less people living in the house, he deserves a smaller oven. So the judge might say, let the 转谞讜专, the bigger oven go to the one that has more people in the house, and let the 讻讬专讛 go to the one that has less people in the house. So that's why the 驻住讜拽 says no, if they are both equal partners in it, you can't divide it based on their needs. So you divide it equally. If one is more expensive than the other, then the difference in the money has to be paid by the other. Then the 讙诪专讗 continues, the

Do Not Show Favor in Judgment

驻住讜拽 says further, 诇讗 转讻讬专讜 驻谞讬诐 讘诪砖驻讟, do not recognize a face in judgment. 专讘讬 讬讛讜讚讛 讗讜诪专, 专讘讬 讬讛讜讚讛 says, it means 诇讗 转讻讬专讜讛讜, do not recognize him. If one of the two 讘注诇讬 讚讬谞讬诐 is a friend of the judge, the judge is not allowed to show special recognition to that person. He is supposed to accept them both equally. But 专讘讬 讗诇注讝专 讗讜诪专, 专讘讬 讗诇注讝专 says, 诇讗 转谞讻专讜讛讜, do not make yourself strange to him. That means that if one of the two is your enemy, do not act strange to him more than to the other, but you have to act to both of them equally. Concerning what the 讙诪专讗 said before that we learn out from the 驻住讜拽, 讗诪讜专 诇讞讻诪讛 讗讞讜转讬 讗转, that you should say to the 讞讻诪讛 that you are my sister, that 讗诐 讘专讜专 诇讱 讛讚讘专 讻讗讞讜转讱 砖讛讬讗 讗住讜专讛 诇讱, that if it is clear to you like your sister that she is forbidden to you, then 讗诪专讛讜, then you should say it. If you know the 讚讬谉 that clear, 讜讗诐 诇讗讜, if you're not that clear, 讗诇 转讗诪专讛讜, do not say it. But 诇讻讗讜专讛, why did the 驻住讜拽 pick the example of a sister? A sister is not the only one of the 注专讬讜转 that is very clear that it is forbidden. There are other forbidden 注专讬讜转, for instance, a mother, etc. So why does he pick a sister? The 专讘讬谞讜 讞谞谞讗诇 learned what the 讙诪专讗 means not the 讗讬住讜专 of the sister, but the fact that she is your sister. He says that what does it mean, 讗诐 讘专讜专 诇讱 讛讚讘专 讘讘讬专讜专 砖讛讬讗 讗讞讜转讱 砖讛讬讗 讬讜爪讗讛 诪诪注讬 讗诪讱, that if it is clear to you like your sister is clear to you that she is your sister because she came out from your mother's stomach, so you know for sure that she is your sister. But

Why Mention the Forbidden Sister?

according to that, the question still remains, why is it important to mention that she is forbidden to you? Why doesn't it just say, 讗诐 讘专讜专 诇讱 讛讚讘专 讻讗讞讜转讱 讗诪专讛讜, if it is clear to you like your sister is clear to you that she is your sister, so then you say it. Why does the 讙诪专讗 have to mention that if it is clear to you like your sister that she is forbidden to you? On the other hand, if we're not going to learn like the 专''讞, and we're going to learn what it means is not the fact that she is your sister, but you should be clear to you like the 讗讬住讜专 of your sister, like it is clear that a sister is forbidden, so too if you are clear in the 讛诇讻讛 like that, then you should say it, so then the question on the 讙诪专讗 is, why does the 讙诪专讗 have to go through the 讗专讬讻讜转 and say 讗诐 讘专讜专 诇讱 讛讚讘专 讻讗讞讜转讱 砖讛讬讗 讗住讜专讛 诇讱, if it's clear to you like your sister that she is forbidden to you, it should have said 讗诐 讘专讜专 诇讱 讛讚讘专 讻讗讬住讜专 讗讞讜转讱, if it is clear to you like the 讗讬住讜专 of a sister, why does it say 讻讗讞讜转讱 砖讛讬讗 讗住讜专讛 诇讱? It's 诪砖诪注 the 讙诪专讗 is trying to tell us two things, that by a sister there are two 注谞讬谞讬诐: It is clear that she is your sister, plus that she is forbidden to you. Another question is why does the 讙诪专讗 use the 诇砖讜谉 讗诐 讘专讜专 诇讱 讛讚讘专? We see that in 拽讬讚讜砖讬谉, 讚祝 诪' 住讜祝 注诪讜讚 讗', where this is also brought down, there it doesn't say this 诇砖讜谉, and 专砖''讬 uses the 诇砖讜谉 讘拽讬. If it is 讘拽讬 to you, if you are 讘拽讬, you know for sure, and here the 讙诪专讗 uses the 诇砖讜谉 讘专讜专. Usually the expression 讘专讜专 is when you have to divide, separate two things, so you are 诪讘专专 one from the other. And here the

Clarity and Inquiry in Law

讙诪专讗 uses the 诇砖讜谉 讗诐 讘专讜专 诇讱 讛讚讘专 using the same 诇砖讜谉 of 讘讬专讜专. So the 诇讬讜讘讗讜讜讬讟砖注专 专讘讬 in 诇拽讜讟讬 砖讬讞讜转 explains that the 驻砖讟 in the 讙诪专讗 is as follows: The 讙诪专讗 specially picks the 诇砖讜谉 讘专讜专 to tell us that we're talking about something that needs a 讘讬专讜专. 讘讬专讜专 refers to a case where you have, for instance, two 住讘专讜转 and both are very strong 住讘专讜转, and you have to pick, be 诪讘专专 one out of the other, that is called 讘讬专讜专. Now concerning the 讗讬住讜专 of marrying a sister, the 驻住讜拽 specifically had to be 诪讘专专 out of two 住讘专讜转, because on one hand there is a strong 住讘专讗 to say you should have to marry your sister, it should be better to marry your sister, because we see the first marriage in the 转讜专讛 was when a brother married a sister. The first children from 讗讚诐 讜讞讜讛, how did they get married? So we know that they married a sister as the 讙诪专讗 says in 讬专讜砖诇诪讬 in 讬讘诪讜转 驻专拽 讬"讗 讛诇讻讛 讗'. So we would think that since it is better if a 讞转讜谞讛 is similar to the way it was originally, so it should be better to marry your sister. Especially that she is 讞爪讬 讘砖专讜 as it says in 讞讜诪砖, so it would be a 住讘专讗 that you should marry the sister, at least it should be better to marry one's sister. And this is a strong 住讘专讗. And nevertheless, the 转讜专讛 was 诪讘专专, took out from this 住讘专讗, and chose the other 住讘专讗 to say that it is 讗住讜专 to marry your sister. Also, this 住讘专讗 that we said, that there should be a 住讘专讗 that you should marry your sister, the more she is your sister the more 住讘专讗 is you should marry her. In other words, if you have a sister just from one mother and a sister from one mother and one father, then there is more 住讘专讗 to marry the one that's closer to you, the one that's from one father and one mother. Now in the

Debate on Marrying a Sister

case where you would marry a sister from one mother and one father, you would need an extra 讘讬专讜专. Because how do you know that she's a sister from one father? So the word 讘讬专讜专 applies to both things: to the general 讗讬住讜专 of 讗讞讜转讜, and also in which case to such an 讗讞讜转讜 where you need a 讘讬专讜专 that she is 讗讞讜转讜, that is a case where she's not only 讗讞讜转讜 from one mother, but 讗讞讜转讜 also from one father. And that's what the 讙诪专讗 means here. A person has to be clear in 讞讻诪讛, that he is able to be 诪讘专专 amongst two 住讘专讜转 which is the right 住讘专讗. Even if it's a case where both 住讘专讜转 seem to be strong, you have to have this 讻讞 of being 诪讘专专. And that's what it means, 讗诪讜专 诇讞讻诪讛 讗讞讜转讬 讗转, that you have to be 讘专讜专 in the 讞讻诪讛, which means that it has to be clear to you that even when there are two 住讘专讜转 and both are strong, you have to be able to be 诪讘专专 clearly which 住讘专讗 is the right one and which one is not. And that's what it means, 讗诐 讘专讜专 诇讱 讻讗讞讜转讱 砖讛讬讗 讗住讜专讛 诇讱. It takes both things: that it's 讘专讜专 to you, you are able to be 诪讘专专, like 讗讞讜转讱, where you need a 讘讬专讜专 to know for sure that this is the sister that is 讗住讜专, and also 砖讛讬讗 讗住讜专讛 诇讱, the 讗讬住讜专 itself needs a 讘讬专讜专, needs a clarification, needs a choice from another 住讘专讗. If you are able to do it like the 转讜专讛 did it concerning the 讗讬住讜专 of 讗讞讜转讜, then you are able to 驻住拽谉. But if not, then you shouldn't 驻住拽谉. Also, concerning what the 讙诪专讗 said before, 讜讗诇讛 讛诪砖驻讟讬诐 讗砖专 转砖讬诐 诇驻谞讬讛诐, and the 讙诪专讗 asks the 拽讜砖讬讗, it should have said 讗砖专 转诇诪讚诐, that you should teach them. 讗砖专 转砖讬诐 诇驻谞讬讛诐 could refer only to an object which is tangible that you could put down, so therefore he says 讗诇讜 讻诇讬 讛讚讬谞讬诐, this refers to the 讻诇讬诐 of the 讚讬讬谞讬诐. Now, it seems like certain 专讗砖讜谞讬诐 had a 讙讬专住讗 in this 讙诪专讗 after the 讙诪专讗 use the words that 讗诇讜 讻诇讬 讛讚讬谞讬诐, the 讙诪专讗 added which are the 讻诇讬 讛讚讬讬谞讬诐: 诪拽诇 讜专爪讜注讛 and a 砖讜驻专 and a 住谞讚诇, as the 讘"讞 explains in the beginning of 讞讜砖谉 诪砖驻讟. But as we see, the 讙讬专住讗 the way we have it in our 讙诪专讗 is that the 讙诪专讗 does not mention which are the 讻诇讬 讚讬讬谞讬诐. It is only later in the story of 专讘 讛讜谞讗 it mentions that he asked that they should give him a 诪拽诇, 专爪讜注讛 and a 砖讜驻专 and a 住谞讚诇. And according to our 讙讬专住讗, we could answer a 拽讜砖讬讗 that the 住诪"注 asks on the 专诪讘"诐 and on the 砖讜诇讞谉 注专讜讱. The 住诪"注 in the beginning of 讞讜砖谉 诪砖驻讟 asks a 拽讜砖讬讗 that why doesn't the 砖讜诇讞谉 注专讜讱 and the 专诪讘"诐 bring this 讚讬谉 that a 讚讬讬谉 should have his 讻诇讬 讛讚讬讬谞讬诐? And he answers that the reason is maybe because this 讚讬谉 only applies to 讘讬转 讚讬谉 that had 住诪讬讻讛, and since nowadays there is no 住诪讬讻讛, it doesn't apply nowadays. But 诇讻讗讜专讛, this answer is only good for the 砖讜诇讞谉 注专讜讱, because the 砖讜诇讞谉 注专讜讱 only mentions 讚讬谞讬诐 which are 谞讜讙注 讘讝诪谉 讛讝讛. But the 专诪讘"诐, we know he says all the 讚讬谞讬诐 that were 谞讜讙注 always and that will be 谞讜讙注 when 诪砖讬讞 will come. So what is the answer on the 专诪讘"诐, why doesn't the 专诪讘"诐 mention this 讚讬谉? But if we're going to say that the 专诪讘"诐 had the 讙讬专住讗 the way we have it in the 讙诪专讗, that the 讙诪专讗 does not mention which are the 讻诇讬 讛讚讬讬谞讬诐, we could answer the 拽讜砖讬讗 on the 专诪讘"诐. Because we could say that the 专诪讘"诐 讟讗拽讬 learns that when the 讙诪专讗 says 讗诇讜 讻诇讬 讛讚讬讬谞讬诐, it doesn't mean all four. It doesn't mean 诪拽诇 and a 专爪讜注讛 and a 砖讜驻专 and a 住谞讚诇. The 专诪讘"诐 could hold that it only refers to a 诪拽诇 and a 专爪讜注讛, only to the stick and to the whip, but the others we don't need. And concerning the 诪拽诇 and the 专爪讜注讛, the 专诪讘"诐 does mention it. In the 专诪讘"诐, 驻专拽 讬"讗 讛诇讻讛 讗' of 讛诇讻讜转 住谞讛讚专讬谉, the 专诪讘"诐 mentions there the 诪拽诇 and the 专爪讜注讛. And therefore the 专诪讘"诐 doesn't have to mention it again. But if he would have the 讙讬专住讗 that when the 讙诪专讗 says 讗诇讜 讻诇讬 讛讚讬讬谞讬诐 means 诪拽诇 讜专爪讜注讛 讜砖讜驻专 讜住谞讚诇, then this couldn't be a 转讬专讜抓. Because then why doesn't he say anywhere that you also have to have a 砖讜驻专 and a 住谞讚诇? So we must say that the 专诪讘"诐 has the 讙讬专住讗 the way we have it, and he learns that 讻诇讬 讛讚讬讬谞讬诐 only means a 诪拽诇 and a 专爪讜注讛. And a 专讗讬讛 that it means only a 诪拽诇 and a 专爪讜注讛 is because later in the 讙诪专讗, when the 讙诪专讗 quotes the 驻住讜拽, 讜讗爪讜讛 讗转 砖驻讟讬讻诐 讘注转 讛讛讬讗, the 讙诪专讗 says 讗诪专 专讘讬 讬讜讞谞谉, 讻谞讙讚 诪拽诇 讜专爪讜注讛 转讛讗 讝专讬讝. That he's telling us that the 砖讜驻讟讬诐, the judges judges should be careful with their 诪拽诇 and the 专爪讜注讛, that they should only use it 诇砖诐 砖诪讬诐, not for any other reason.

Stick and Whip as Primary Tools

Why doesn't the 讙诪专讗 also mention the 砖讜驻专 here? That shows that the main 讞讬讜讘 is only on the 诪拽诇 and the 专爪讜注讛. It's only that 专讘 讛讜谞讗 himself, he used to make sure to have not only a 诪拽诇 and a 专爪讜注讛, but also a 砖讜驻专 and a 住谞讚诇, but the 讚讬谉 is only concerning a 诪拽诇 and the 专爪讜注讛.
