Opening the Shiur on Sanhedrin Chapter 8

Jewish Audio on chabad.org. Today's 砖讬注讜专 will be 诪住讻转 住谞讛讚专讬谉 讚祝 讞. We will start two lines from the bottom of 讚祝 讝, 注诪讜讚 讘. And the 讙诪专讗 tells a story: 讗讜砖驻讬讝讬讻谞讬讛 讚专讘, a host of 专讘, 讗转讗 诇拽诪讬讛 诇讚讬谞讗, came to 专讘 for a 讚讬谉 转讜专讛. 讗诪专 诇讬讛, and he said to him, that host said to 专讘, "诇讗讜 讗讜砖驻讬讝讬讻谞讗 讗转? Aren't you one of my former guests?" 讗诪专 诇讬讛, "讗讬谉." So 专讘 said to him, "Yes." 讗诪专 诇讬讛, and he said to him, "讚讬谞讗 讗讬转 诇讬, I have a 讚讬谉 转讜专讛 and I want you to 驻住拽谉 my 讚讬谉 转讜专讛." 讗诪专 诇讬讛, so he said to him, "驻住讬诇谞讗 诇讱 诇讚讬谞讗. I disqualify myself to be a judge on this 讚讬谉 转讜专讛, since you started off by telling me that you are my host, automatically that shows some favor in my eyes to you, therefore, I am already disqualified to 驻住拽谉 the 讚讬谉 转讜专讛." Or as the 诪讛专砖"诇 has the 讙讬专住讗 here, that he asked him, that 专讘, it seems, asked the host, "Aren't you my host?" and he said, "Yes," and then 讗诪专 诇讬讛, he said to him, "诪讗讬 讘注讬转? What do you want?" 专讘 asked him, "What do you want? Why did you come?" 讗诪专 诇讬讛, so he said to him, "讚讬谞讗 讗讬转 诇讬, I have a 讚讬谉 转讜专讛 and I want you to 驻住拽谉 my 讚讬谉 转讜专讛," and that's when he said, "I disqualify myself to be a 讚讬讬谉 because of the favor that I might show you being that you were my host." And

When 转讜住驻讜转 Clarifies the Disqualification Rule

转讜住驻讜转 explains that it doesn't mean that 注诇 驻讬 讚讬谉, really he wasn't allowed to 驻住拽谉 that 讚讬谉 转讜专讛. By just saying that he was his host, or knowing that he was his host, that is not enough to make him 驻住讜诇 to be the 讚讬讬谉 for this 讚讬谉 转讜专讛, but he just wanted to be 诪讛讚专 that even if it was a far-far 住讘专讗 that he might be in favor of him because he was his host, already he didn't want to 驻住拽谉 the 讚讬谉 转讜专讛. And so too 转讜住驻讜转 says is the case in the 讙诪专讗 in 讻转讜讘讜转 where a person brought a 讚讬讬谉 a 转谞讗 讚讘讬 驻转讜专讗, so he also disqualified himself for 驻住拽谞'讬谞讙 the 讚讬谉 转讜专讛. It's not that 注诇 驻讬 讚讬谉 he wasn't allowed, but it was only a 讛讬讚讜专. And 讗诪专 诇讬讛 专讘 诇专讘 讻讛谞讗, so 专讘 said to 专讘 讻讛谞讗, "驻讜拽 讚讬讬谞讬讛, you go out and you be the judge." He gave over this 讚讬谉 转讜专讛 to 专讘 讻讛谞讗, his 转诇诪讬讚. 讞讝讬讬讛 讚讛讜讛 拽讗 讙讗讬住 讘讬讛, so 专讘 讻讛谞讗 saw on him that he was 讙讗讬住. He felt great, high, because he had acquaintance with 专讘. He relied on the fact that he was once the host of 专讘, that he is going to win the 讚讬谉 转讜专讛. 讗诪专 诇讬讛, so 专讘 讻讛谞讗 said to him, "讗讬 爪讬讬转 爪讬讬转, if you will listen to what I 驻住拽谉, then okay, listen. 讜讗讬 诇讗, if not, if you think you're going to rely on 专讘, 讗驻拽讬谞讗 诇讱 专讘 诪讗讜谞讱, I'm going to get the 专讘 out of your ears, which means I'm telling you that 专讘 will not be able to help you. I will do something that 专讘 won't be able to do anything for you." And as 专砖"讬 says, what he meant was, "I will put you in 讞专诐, and if I put you in 讞专诐, then no one will have anything to do with you, so 专讘 won't be able to have anything to do with you. That'll show you that you cannot rely on 专讘." And 转讜住驻讜转 asks a 拽讜砖讬讗, 诇讻讗讜专讛, we have a 讚讬谉 that 诪谞讜讚讛 诇转诇诪讬讚 讗讬谞讜 诪谞讜讚讛 诇专讘, that if a person is in 讞专诐 from a 转诇诪讬讚, it doesn't automatically mean that he is in 讞专诐 from the 专讘讬, too. So here too, if 专讘 讻讛谞讗 would have put him in 讞专诐, why would he automatically be in 讞专诐 from 专讘, also? So 转讜住驻讜转 says that that 讚讬谉, that if you're 诪谞讜讚讛 to a 转诇诪讬讚, you're not automatically 诪谞讜讚讛 to the 专讘, that's only if he was put in 讞专诐 诇讻讘讜讚 注爪诪讜, the 转诇诪讬讚 put him in 讞专诐 for his own 讻讘讜讚. But if he put him in 讞专诐 诇砖诐 砖诪讬诐, then he is in 讞专诐 even for the 专讘, too. And here, if he would have done it, it would have been 诇砖诐 砖诪讬诐, so he would have been in 讞专诐 for 专讘, too. And that's what he said, "If you listen to the 讚讬谉 转讜专讛, it's good; if not, I will put you in 讞专诐 and you will not have anything to do with 专讘." Then the 讙诪专讗 continues to 讚专砖谉 the 驻住讜拽讬诐 that we started 讚专砖谞'讬谞讙 in the previous 讚祝, and these are all 驻住讜拽讬诐 from the beginning of 讞讜诪砖 讚讘专讬诐. So there it says,

Equal Weight to Small and Large Laws

"讻拽讟谉 讻讙讚讜诇 转砖诪注讜谉, that you should listen to a big and to small." In other words, a big 讚讬谉 转讜专讛 and a small 讚讬谉 转讜专讛 should both be equal to you. 讗诪专 专讬砖 诇拽讬砖, so 专讬砖 诇拽讬砖 said, what does that mean? "砖讬讛讗 讞讘讬讘 注诇讬讱 讚讬谉 砖诇 驻专讜讟讛 讻讚讬谉 砖诇 诪讗讛 诪谞讛, there shall be beloved to you a 讚讬谉 转讜专讛 concerning one 驻专讜讟讛, one penny, as a 讚讬谉 转讜专讛 of a hundred 诪谞讛." The 讙诪专讗 asks, "诇诪讗讬 讛诇讻转讗? Concerning which 讚讬谉 did he say that? 讗讬诇讬诪讗, if he meant to say it, 诇注讬讜谞讬 讘讬讛, that you should look into it, 讜诪驻住拽讬讛, to 驻住拽谉 it, that you have to 驻住拽谉 the 讚讬谉 of one 驻专讜讟讛 with the same truth and with the same correctness as you would 驻住拽谉 a 讚讬谉 of a hundred 诪谞讛, 驻砖讬讟讗, that's simple, certainly you have to!" 讗诇讗, what does he mean? "诇讗拽讚讜诪讬, to make that first." In other words, since the order, the way you take the 讚讬谉 转讜专讛's is whichever comes first, that's the one you judge first, so if first came a 讚讬谉 转讜专讛 concerning a 驻专讜讟讛, and then came a 讚讬谉 转讜专讛 concerning a hundred 诪谞讛, you might think, since the hundred 诪谞讛 is more important than the 驻专讜讟讛, so you'll tell the one one with the 驻专讜讟讛 to wait, and you'll first take the 讚讬谉 转讜专讛 concerning the 诪讗讛 诪谞讛. But we say no, if the 讚讬谉 of 驻专讜讟讛 came first, so you have to judge that first. Then the 驻住讜拽 says:

Do Not Fear Anyone in Judgment

诇讗 转讙讜专讜 诪驻谞讬 讗讬砖, to not be afraid of any person. So here we have a 讙讬专住讗 that 讗诪专 专讘 讞谞谉: 诇讗 转讻谞讬住 讚讘专讬讱 诪驻谞讬 讗讬砖. What it means is, you should not hold back your words because of anybody. And as we said before, it means that if a 转诇诪讬讚 is sitting in front of his 专讘讬, and he sees a 讚讬谉 转讜专讛 come to his 专讘讬, but there is a 住讘专讗 the 转诇诪讬讚 has in his mind that he sees his 专讘讬 doesn't have, so the 转讜专讛 says, do not hold your words back, you have to tell your 专讘讬 the 住讘专讗 that you have. And then the 驻住讜拽 says: 讻讬 讛诪砖驻讟 诇讗诇拽讬诐 讛讜讗, that the judgment is to 讛砖诐. 讗诪专 专讘 讞诪讗 讘专讘 讞谞讬谞讗, that 专讘 讞诪讗 讘专讘 讞谞讬谞讗 said: 讗诪专 讛拽讚讜砖 讘专讜讱 讛讜讗, 讛砖诐 said, 诇讗 讚讬讬谉 诇专砖注讬诐 砖谞讜讟诇讬谉 诪讝讛 诪诪讜谉 讜谞讜转谞讬谉 诇讝讛 砖诇讗 讻讚讬谉, it's not enough for the 专砖注讬诐, that they take money from one person and they give it away to the other against the 讚讬谉, 讗诇讗, but more than that, 砖诪讟专讬讞讬谉 讗讜转讬 诇讛讞讝讬专 诪诪讜谉 诇讘注诇讬讜, that they also make me go through the trouble of seeing that the money should go back to its original owner. Since they take away money from the rightful owner, and they give it away to a person it doesn't belong to, so then 讛砖诐 has to go through, so to speak, 讻讘讬讻讜诇, the trouble of seeing that the money will go back to its rightful owner. So not only are they doing something wrong between the people, but they're also doing something wrong against 讛砖诐, because they cause 讛砖诐 to go through, 讻讘讬讻讜诇, this extra trouble of seeing that the money is restored to its rightful owner. Then the 驻住讜拽 says:

Moshe鈥檚 Punishment for Claiming Supreme Authority

讜讛讚讘专 讗砖专 讬拽砖讛 诪讻诐, 诪砖讛 专讘讬谞讜 said to the 讬讬讚谉, that anything which will be hard for the judges to 驻住拽谉, then they should come to him. The smaller things that they're able to 驻住拽谉, they should 驻住拽谉 themselves, but whatever will be hard for them, they should bring to 诪砖讛. For this, because 诪砖讛 said that anything is hard you bring to me, so for that he was punished. Because he took for himself the strong authority of saying that the highest authority is himself, and anything that no one else could 驻住拽谉, he will 驻住拽谉, because of that he was punished. What was his punishment? 砖谞讗诪专, because it says: 讜讬拽专讘 诪砖讛 讗转 诪砖驻讟谉 诇驻谞讬 讛', that 诪砖讛 brought their case in front of 讛砖诐. This is the case of the daughters of 爪诇驻讞讚. The daughters of 爪诇驻讞讚 came to ask for a 讞诇拽 in 讗专抓 讬砖专讗诇. Their father, 爪诇驻讞讚, died in the desert and had no sons, so they claimed that they want his 讞诇拽 in 讗专抓 讬砖专讗诇. And 诪砖讛 专讘讬谞讜 said to them: I don't know what the 讚讬谉 is, and he brought their case in front of 讛砖诐. So we see that there was a time when 诪砖讛 was asked a question, and he didn't know what to answer. Why didn't he know? Everything else he knew, why didn't he know this? This was a punishment, because he took the greatness for himself to say that whatever no one knows, they should ask him and he will 驻住拽谉. Because of that he was punished that at one point he 讟讗拽注 didn't know what to 驻住拽谉.

Rav Nachman鈥檚 Question About Punishment Verses

Why should he be punished? Did he say, does the 转讜专讛 say 讜讗砖诪讬注讻诐, and I will give, let you hear? Did he say that anything that will be hard for you, come to me and I will answer you the question? 讜砖诪注转讬讜 讻转讬讘. Come to me and ask me and I will hear it. That's all he said. He didn't say I will definitely know the answer, I will hear it. 讗讬 讙诪讬专谞讗 讙诪讬专谞讗, if I will know the answer, I will know, I will answer you, 讜讗讬 诇讗, and if I will not know the answer, 讗讝诇讬谞讗 I will go, 讜讙诪讬专谞讗 and I will learn. So why should he be punished for it? If he would have said that anything you no one else knows, I will know, I will answer you, then it shows that he took greatness for himself as if he says he knows everything. But since all he said was, whatever no one knows, you come to me and I will hear, maybe I will know, but if not I will go and learn, why should he be punished for that? 讗诇讗 讻讚转谞讬讗, therefore you must say that the reason he did not know the 讚讬谉 of the 讘谞讜转 爪诇驻讞讚 was not as a punishment, because he didn't do anything wrong, it was for a different reason, as we learned in a 讘专讬讬转讗. It says in the 讘专讬讬转讗: 专讗讜讬讛 讛讬转讛 驻专砖转 谞讞诇讜转 砖转讻转讘 注诇 讬讚讬 诪砖讛 专讘讬谞讜, really it was fit that even the 驻专砖讛 of 谞讞诇讜转, which was the answer 讛砖诐 gave to the daughters of 爪诇驻讞讚, to the whole 驻专砖讛 of order of inheritance, so 讘讗诪转 that 驻专砖讛 was also fit to be written through 诪砖讛 专讘讬谞讜, 讗诇讗 砖讝讻讜 讘谞讜转 爪诇驻讞讚 讜谞讻转讘讛 注诇 讬讚谉, but the daughters of 爪诇驻讞讚 were 讝讜讻讛, they had a special merit, and it was written through them. 讛砖诐 gave them the special 讝讻讜转 that they should be the cause for this extra 驻专砖讛 in the 转讜专讛. And the same is just opposite. 专讗讜讬讛 讛讬转讛 驻专砖讛 砖诇 诪拽讜砖砖 砖转讻转讘 注诇 讬讚讬 诪砖讛 专讘讬谞讜. There's a story in the 转讜专讛 that there was this person

The Requirement of Three Judges for Zimun

who gathered or chopped wood on 砖讘转, and they saw him, they locked him up in jail because they didn't know what to do with him. They knew that he was supposed to get killed because the 转讜专讛 says that anybody who is 诪讞诇诇 砖讘转 gets killed, but they didn't know which kind of 诪讬转讛 to give to give him, because there are four kinds of 诪讬转讜转 讘讬转 讚讬谉, and they didn't know which one of the four types of death penalty he deserved. So they locked him up, and 诪砖讛 asked 讛砖诐 what to do with him, and 讛砖诐 said that they should stone him. So 讘讗诪转, this 驻专砖讛, the 讚讬谉 that if a person is 诪讞诇诇 砖讘转, his 诪讬转讛 is through 住拽讬诇讛, through stoning, was also fit to be written through 诪砖讛 专讘讬谞讜. It didn't have to come in such a way that the 诪拽讜砖砖 should be 诪讞诇诇 砖讘转, and then it should be asked by 诪砖讛, and he wouldn't know, and he would ask 讛砖诐. 讘讗诪转, it was fit to be written through 诪砖讛. 讗诇讗 砖谞转讞讬讬讘 诪拽讜砖砖 讜谞讻转讘 注诇 讬讚讜. But the 诪拽讜砖砖 was 讞讬讬讘, and it was written through him. Since he was a bad person, so it was written through the one that was 讞讬讬讘. 诇诇诪讚讱, so both of these things teach us the fact that the 驻专砖讛 of 谞讞诇讜转 was written because of the daughters of 爪诇驻讞讚, and the 驻专砖讛 of 诪拽讜砖砖, the 讚讬谞讬诐 of 诪讬转讛 for a 诪讞诇诇 砖讘转, was written through the 诪拽讜砖砖, that teaches us 砖诪讙诇讙诇讬谉 讞讜讘 注诇 讬讚讬 讞讬讬讘, that you roll, you bring a 讞讜讘, a negative, a not good thing, through somebody who is not good, 讜讝讻讜转 注诇 讬讚讬 讝讻讗讬, and a good thing comes through a good person. That's what it teaches, that since the daughters of 爪诇驻讞讚 were good, so then they had another good thing that came through them, that a extra 驻专砖讛 in the 转讜专讛 was written, and the 诪拽讜砖砖, since he was bad, so something else bad came through him, that we found out what kind of death penalty is given to a 诪讞诇诇 砖讘转. And the 讙诪专讗 continues, 讻转讬讘, the 驻住讜拽 says, "讜讗爪讜讛 讗转 砖驻讟讬讻诐 讘注转 讛讛讬讗," that "I commanded your judges at that time," 讜讻转讬讘, there's another 驻住讜拽 that says, "讜讗爪讜讛 讗转讻诐 讘注转 讛讛讬讗," that "I commanded you at that time." So this seems like a contradiction. From the first 驻住讜拽 it's 诪砖诪注 that he commanded the judges, that he told the judges they should take care and teach the 讗讬讚谉 all the laws, but then the other 驻住讜拽 says, "I commanded you." He's speaking to the 爪讬讘讜专, he's speaking to the community itself. What did he command them? 讗诪专 专' 讗诇注讝专, so 专' 讗诇注讝专 said, 讗诪专 专' 砖诪诇讗讬, in the name of 专' 砖诪诇讗讬, 讗讝讛专讛 诇爪讬讘讜专, there is a warning to the community 砖转讛讗 讗讬诪转 讚讬讬谉 注诇讬讛诐, that the fear of the judge should be upon them, that they should fear the judge, they should give proper respect and fear to the judge, 讜讗讝讛专讛 诇讚讬讬谉, there is a warning to the judge 砖讬住讘讜诇 讗转 讛爪讬讘讜专, that he should have patience with the community. That's why we have these two 驻住讜拽讬诐. There is an 讗讝讛专讛, a warning to the judges, and there is a warning to the people. 注讚 讻诪讛, the 讙诪专讗 asks, how far, when we say that the judge has to have patience with the 爪讬讘讜专, how far does he have to have the patience? 讗诪专 专' 讬讜讞谞谉, 讜讗讬转讬诪讗 专讘 砖讘转讬, so 专' 讬讜讞谞谉 said, and some say it was 专讘 砖讘转讬 that said, "讻讗砖专 讬砖讗 讛讗诪谉 讗转 讛讬谞拽," "as the nurse carrieth the baby." This is a 驻住讜拽 said by 诪砖讛 专讘讬谞讜 concerning his caring for 讻诇诇 讬砖专讗诇, and this is how patient a 砖讜驻讟, a judge, is supposed to be with the 爪讬讘讜专. Then the 讙诪专讗 says we have a contradiction. 讻转讬讘, in one 驻住讜拽 it says, "讻讬 讗转讛 转讘讜讗." This was 诪砖讛 专讘讬谞讜 speaking to 讬讛讜砖注, and he said to him, "Because you will come into 讗专抓 讬砖专讗诇." 讜讻转讬讘, in another 驻住讜拽 it says, "讻讬 讗转讛 转讘讬讗," that "You will bring the 讗讬讚谉 into 讗专抓 讬砖专讗诇." From the first 驻住讜拽 it's 诪砖诪注 that he is going to go in together with the others. He will be like everybody else. But the other 驻住讜拽, where it says that "You will bring the 讗讬讚谉 into 讗专抓 讬砖专讗诇," so it's not that he's going to go with them, but he will be the leader. He will take them into 讗专抓 讬砖专讗诇. So which one is it? 讗诪专 专' 讬讜讞谞谉, so 专' 讬讜讞谞谉 said, 讗诪专 诇讬讛 诪砖讛 诇讬讛讜砖注, 诪砖讛 said to 讬讛讜砖注, 讗转讛 讜讛讝拽谞讬诐 砖讘讚讜专 注诪讛诐, "You and the elders of the generation with them." In other words, he said to him, "You won't be the only leader. You, together with the elders, are going to lead 讻诇诇 讬砖专讗诇, so you're going to go in together with others, what will be equal to you." That the way 诪砖讛 on his own said to 讬讛讜砖注. 讗诪专 诇讬讛 讛拽讚讜砖 讘专讜讱 讛讜讗, but 讛砖诐 said to him, "No. 讟讜诇 诪拽诇 讜讛讱 注诇 拽讚拽讚诐. Take a stick and hit them on their head. That means on the head of the 讝拽谞讬诐. 讚讘专 讗讞讚 诇讚讜专 讜讗讬谉 砖谞讬 讚讘专讬谉 诇讚讜专. Only one leader per generation, and not two leaders per generation." What he said was that "You will be the leader, and they will be under you. It's not like 诪砖讛 thought that the 讝拽谞讬诐 are going to be equal to 讬讛讜砖注, but 讛砖诐 said no, that the 讝拽谞讬诐 will be under 讬讛讜砖注. He will be the only leader." Then the 讙诪专讗 continues, 转谞讬, we learned, 讝讬诪讜谉 讘砖诇砖讛. 讝讬诪讜谉 means to invite or to summons, so you have to have three people for 讝讬诪讜谉. Now the 讙诪专讗 asks, 诪讗讬 讝讬诪讜谉, what do we mean with this 讝讬诪讜谉 when we say you have to have three people? 讗讬诇讬诪讗, if you're going to say 讘专讻转 讝讬诪讜谉, the 讘专讻讛 of 讝讬诪讜谉, this refers to 讘注谞讟砖谉, that before you 讘注谞讟砖 讘专讻转 讛诪讝讜谉, so then if you have three people, then you have a 讝讬诪讜谉. So if that's what he meant when he said 讝讬诪讜谉 needs three people, 讜讛转谞讬讗, didn't we learn, 讝讬诪讜谉 讜讘专讻转 讝讬诪讜谉 讘砖诇砖讛, that 讝讬诪讜谉 and the 讘专讻讛 of 讝讬诪讜谉 needs three people. So we see there are two 注谞讬谞讬诐. 讘专讻转 讝讬诪讜谉, that means the 讘专讻讛 of 讝讬诪讜谉 that we say before 讘注谞讟砖讬谞讙. So that says separately that you need three people. So obviously, when it says 讝讬诪讜谉 first, that means something else. So what does that mean? 讜讻讬 转讬诪讗, and if you're going to say, 驻专讜砖讬 拽讗 诪驻专砖, that really it's not two things, he's just explaining himself, that 诪讗讬 讝讬诪讜谉? 讘专讻转 讝讬诪讜谉. When it said in the 讘专讬讬转讗, 讝讬诪讜谉 讜讘专讻转 讝讬诪讜谉 讘砖诇砖讛, it wasn't two things he was saying. He was just saying 讝讬诪讜谉, which is 讘专讻转 讝讬诪讜谉, is 讘砖诇砖讛. But 讜讛转谞讬讗, we learned in another 讘专讬讬转讗, that 讝讬诪讜谉 讘砖诇砖讛, 讘专讻转 讝讬诪讜谉 讘砖诇砖讛. There it says clearly 讝讬诪讜谉 needs three and 讘专讻转 讝讬诪讜谉 needs three. And there you can't say that it's an explanation because it says the word 砖诇砖讛 in between. If it would only be an explanation, it should have said 讝讬诪讜谉 讜讘专讻转 讝讬诪讜谉 讘砖诇砖讛. Since it says 讝讬诪讜谉 讘砖诇砖讛 and 讘专讻转 讝讬诪讜谉 讘砖诇砖讛, so obviously 讝讬诪讜谉 is not 讘专讻转 讝讬诪讜谉, it's something else. So what is this 讝讬诪讜谉 that we say needs three people? 讗诇讗 诪讗讬 讝讬诪讜谉, what does 讝讬诪讜谉 mean? 讛讝诪谞讛 诇讚讬谉, inviting, summoning somebody to a 讚讬谉 转讜专讛. 讛讗 讚讗诪专 专讘讗, like 专讘讗 said, 讛谞讬 讘讬 转诇转讗 讚讬讬谞讬, three 讚讬讬谞讬诐, 讚讬转讘讬, they were sitting, 讜讗讝诇 砖诇讬讞讗 讚讘讬 讚讬谞讗, and the 砖诇讬讞, the agent of the 讘讬转 讚讬谉, went, 讜讗诪专 诪驻讜诪讬 讚讞讚, and he said in the name of one, he came to the one that is being summoned to the 讚讬谉 转讜专讛. He said to him in the name of one of the three that he is asked to come to a 讚讬谉 转讜专讛, 诇讗 讗诪专 讻诇讜诐, he didn't say anything, it doesn't mean anything, 注讚 讚讗诪专 诪砖诪讬讛 讚讻讜诇讛讜, until he says in the name of all three. And that's what we mean 讝讬诪讜谉 讘砖诇砖讛, that when you invite, you summon somebody to a 讚讬谉 转讜专讛, it must come from all three. It must be said in the name of all three. And the 讙诪专讗 says, 讛谞讬 诪讬诇讬 讘诇讗 讬讜诪讗 讚讚讬谞讗, when is this said? If it's not a regular day of 讚讬谞讬诐. It's not a set day when the 讘讬转 讚讬谉 sits. So then, if you do not say in the name of three, it is not valid. 讗讘诇 讘讬讜诪讗 讚讚讬谞讗, but in the day which is set aside anyway for the 讘讬转 讚讬谉 sitting, 诇讬转 诇谉 讘讛, then this 讚讬谉 doesn't apply, and even if he didn't say it in the name of all three, it's still considered a 讛讝诪谞讛, and you must come to the 讚讬谉 转讜专讛. And when is this? This is Monday and Thursday. And the 讙诪专讗 says in 讻转讜讘讜转 that 注讝专讗 made a 转拽谞讛 that on Monday and Thursday, always the 讘转讬 讚讬谞讬诐 should sit, and they should be ready, waiting if any 讚讬谉 转讜专讛'住 will come. So if somebody is summoned on Monday or Thursday to come to a 讚讬谉 转讜专讛, so even if he is not asked to come in the name of all three 讚讬讬谞讬诐, nevertheless it is a valid 讛讝诪谞讛, and he must come. Then the 讙诪专讗 continues, it quotes, in the 诪砖谞讛 it said, 转砖诇讜诪讬 讻驻诇 讜讻讜', among the things that you need a 讘讬转 讚讬谉 of three is when you judge the 讚讬谉 of 讻驻诇. If a person steals, so the 讚讬谉 is if he is caught he must pay double. Or 转砖诇讜诪讬 讗专讘注讛 讜讞诪砖讛, if he stole a sheep or an ox, and he sold it, or he 砖讞讟 it, so then the 讚讬谉 is that he must pay four times as much for the sheep, and five times as much for the ox. But you come to judge that, so then you have to do it 讘砖诇砖讛. He was asking him a question, what is the 讚讬谉, 讚讬谞讬 拽谞住讜转 讘讻诪讛, when it comes to judge 讚讬谞讬诐 of 拽谞住, of a fine, how many people must you have in the 讘讬转 讚讬谉? And we know the rule is, what is considered a 拽谞住? Anything which you don't pay the amount that you owe, or you pay less or you pay more, or if the 转讜专讛 gives you a fixed amount how much you must pay. For instance, 讗讜谞住 讜诪驻转讛, so there the 转讜专讛 says that you must pay 50 讻住祝 if you are 诪注谞讛 a woman, a 讘转讜诇讛 who is not an 讗砖转 讗讬砖, if you force her to do the 注讘讬专讛 or if you convince her to do the 注讘讬专讛, you must pay 50 讻住祝. So this is a fixed amount the 转讜专讛 gives no matter what the value of the damage is. Or the case of 砖诇砖讬诐 砖诇 注讘讚 for instance. If one's ox killed an 注讘讚, a 讻谞注谞讬砖注 slave of another 讗讬讚, so then you must pay 30 砖拽诇讬诐 no matter how much the damage was. All that is considered 拽谞住. So he asked him, when you judge the 讚讬谞讬诐 of 拽谞住, how many people must be in the 讘讬转 讚讬谉? So he said to him, 诪讗讬 拽讗 诪讬讘注讬讗 诇讬讛, what is this question? 讜讛讗 讗谞谉 转谞谉, didn't we learn clearly in the 诪砖谞讛 讘砖诇砖讛, that you have to have three? It says clearly 转砖诇讜诪讬 讻驻诇 讜讗专讘注讛 讜讞诪砖讛 is 讘砖诇砖讛, and 讻驻诇 is a 拽谞住, since you're paying more than you damaged. You stole only a certain amount, and you must pay double, or if you pay four, five times as much, it is 拽谞住, and the 诪砖谞讛 says clearly that you must have three. So what's the 砖讗诇讛? 讗诇讗 讬讞讬讚 诪讜诪讞讛 拽讗 诪讬讘注讬讗 诇讬讛, his question was, what is the 讚讬谉, can one person, if he is a 诪讜诪讞讛, can he judge the 讚讬谞讬诐 of 拽谞住? 讚讗讬谉 讚讬谞讬 拽谞住讜转 讗讜 诇讗, could he 讚谉, could he judge the 讚讬谞讬诐 of 拽谞住 or not? 讗诪专 诇讬讛, so he said to him, 转谞讬转讜讛, we learned that too, it says 转砖诇讜诪讬 讻驻诇 讜转砖诇讜诪讬 讗专讘注讛 讜讞诪砖讛 讘砖诇砖讛, comes to pay double, or to pay four or five times as much, you have to have three people. Now, 诪讗讬 砖诇砖讛, what does the 诪砖谞讛 mean when it says three people? 讗讬诇讬诪讗 砖诇砖讛 讛讚讬讜讟讜转, if you're going to say it means three 讛讚讬讜讟讜转, three ordinary, simple people, not 诪讜诪讞讬谉, 讛讗 讗诪专 讗讘讜讛 讚讗讘讜讱 诪砖诪讬讛 讚专讘, didn't your father's father say in the name of 专讘, 讗驻讬诇讜 注砖专讛 讚谞讛讚讬讜讟讜转 驻住讜诇讬谉 诇拽谞住讜转, that even if you have ten people, but if they are all 讛讚讬讜讟讜转, not experts, so then they are 驻住讜诇 to judge in 拽谞住讜转. 讗诇讗 诪讜诪讞讬谉, so we must say when the 诪砖谞讛 says that you have to have three people, that means definitely not 讛讚讬讜讟讜转, but 诪讜诪讞讬谉. 讜拽讗诪专 砖诇砖讛, and nevertheless it says three, so we see from the 诪砖谞讛 that comes to judge in 拽谞住讜转, you must have three 诪讜诪讞讬谉. So it comes out that a 讬讞讬讚 诪讜诪讞讛, if one person, even if he is a 诪讜诪讞讛, he is 驻住讜诇 to 讚谉 in 拽谞住讜转. Then the 讙诪专讗 continues, one of the things mentioned in the 诪砖谞讛 that you have to have three is 诪讜爪讬讗 砖诐 专注. But that is only the opinion of 专讘讬 诪讗讬专. 讜讞讻诪讬诐 讗讜诪专讬诐, the 讞讻诪讬诐 say, 诪讜爪讬讗 砖诐 专注 讘注砖专讬诐 讜砖诇砖讛, that when you come to judge the 讚讬谉 of a 诪讜爪讬讗 砖诐 专注, you have to have a 讘讬转 讚讬谉 of twenty-three. Now as we know, 诪讜爪讬讗 砖诐 专注 is the case when a person marries a woman, and later he claims that she is not a 讘转讜诇讛. He brings witnesses that she was 诪讝谞讛, she did an 注讘讬专讛 in between the 拽讬讚讜砖讬谉 and the 谞讬砖讜讗讬谉. Because the custom was that first they used to give the woman 拽讬讚讜砖讬谉, and through that she would automatically become an 讗砖转 讗讬砖, still wasn't allowed to live with her husband till after the marriage, after the 谞讬砖讜讗讬谉, the 讞讜驻讛, but nevertheless she was an 讗砖转 讗讬砖 right after the 拽讬讚讜砖讬谉. And there used to be a time between the 拽讬讚讜砖讬谉, the 讗讬专讜住讬谉, and the 谞讬砖讜讗讬谉. So after the 谞讬砖讜讗讬谉, he claims she was 诪讝谞讛 in between the 拽讬讚讜砖讬谉 and the 谞讬砖讜讗讬谉, so she was 诪讝谞讛 while she was an 讗砖转 讗讬砖. And the 讚讬谉 is that if it is true what he says, so two things happen: first of all, she loses her 讻转讜讘讛, like this a woman has a 讻转讜讘讛. When you marry a woman, the husband is obligated to give a 讻转讜讘讛, that means gives a document that if later he will divorce her or if he will die, she will get the amount of money that's written in the 讻转讜讘讛. But if she was 诪讝谞讛 during the time she was married to him, automatically she gets no 讻转讜讘讛. Plus that if there are witnesses that she was 诪讝谞讛, so then she would also get killed because she did an 注讘讬专讛 which you are 讞讬讬讘 诪讬转讛 for it. Concerning losing the 讻转讜讘讛, you don't have to have witnesses. The 讚讬谉 is that if the husband comes after the 讞转讜谞讛, and he says that he found that she is not a 讘转讜诇讛, 驻转讞 驻转讜讞 诪爪讗转讬, I found that she wasn't a virgin, and therefore there is a possibility that she was 诪讝谞讛 in between the 拽讬讚讜砖讬谉 and the 谞讬砖讜讗讬谉, so she was 诪讝谞讛 while she's an 讗砖转 讗讬砖, and the 讚讬谉 is a woman that is 诪讝谞讛 while she's an 讗砖转 讗讬砖 is forbidden to live with her husband, so if the husband himself claims that without even bringing witnesses, he is believed enough that she loses her 讻转讜讘讛. That's what the 讙诪专讗 says in 讻转讜讘讜转. And the reason for that is, the 讙诪专讗 says there, since the 讞讻诪讬诐 were 诪转拽谉 that a woman should get a 讻转讜讘讛, a 讘转讜诇讛 gets 200, a virgin gets 200, and an 讗诇诪谞讛 gets 100, so the 讞讻诪讬诐 were also 诪转拽谉 that if he comes later and he says 驻转讞 驻转讜讞 诪爪讗转讬, the 讚讬谉 is that

Dispute: 3 versus 23 judges for "Motsa Shem Ra"

she loses her 讻转讜讘讛 just on the word of the husband. Why? Why do we believe the husband? Because we have a rule, 讞讝拽讛 讗讬谉 讗讚诐 讟讜专讞 讘住注讜讚讛 讜诪驻住讬讚讛, a person would not go through the trouble of making a 住注讜讚讛, and then, for no reason, just lose it. If the 驻砖讟 is that really he is lying, and why does he say that she wasn't a 讘转讜诇讛, it's just because he doesn't like her and wants to get rid of her, but if so, why did he go through the trouble of making the 住注讜讚讛, making the party, spending the money for the 讞转讜谞讛? If he wouldn't like her, he had a choice that before he even married her, he could have given her a 讙讟. She was his wife because he gave her the 拽讬讚讜砖讬谉, but he could have given her a 讙讟, and then he would not go through the trouble of spending money for the 讞转讜谞讛. Since he went through the trouble of spending money for the 讞转讜谞讛, obviously he was wasn't just trying to get rid of her. So 诪住转诪讗, when he says that she wasn't a 讘转讜诇讛, that is true, and therefore he is believed, and she loses her 讻转讜讘讛. But if we find out that he was lying, that when the husband said that she was 诪讝谞讛 in between the 拽讬讚讜砖讬谉 and the 谞讬砖讜讗讬谉, he was lying, so then not only doesn't she lose the 讻转讜讘讛, and certainly she doesn't get killed, but on the other hand, he, the husband, has to pay a fine. He has to pay 诪讗讛 讻住祝 to the father of his wife. And here in the 诪砖谞讛, we have a 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐 that when it comes to judge the 讚讬谉 of 诪讜爪讬讗 砖诐 专注, must we have twenty-three people that Are we dealing with the first part, when the husband first comes to 讘讬转 讚讬谉 and he claims that his wife was 诪讝谞讛, and what he wants is that she should lose her 讻转讜讘讛, and that's where we have the 诪讞诇讜拽转, that 专讘讬 诪讗讬专 says, since all he is claiming is that she should lose her 讻转讜讘讛, so this is a monetary question, therefore, it's enough to have a 讘讬转 讚讬谉 of three, and the 讞讻诪讬诐 say, no, that since there is a possibility that it should lead to having her killed, therefore you must have 23 like you would judge 讚讬谞讬 谞驻砖讜转. Or are we dealing here with the second step, after we already know that the husband was lying, and the father of the wife is claiming the 诪讗讛 讻住祝 from the husband, that's where the 诪讞诇讜拽转 is, whether to do that you must have a 讘讬转 讚讬谉 of 23, or is it enough a 讘讬转 讚讬谉 of three? And this is a 诪讞诇讜拽转 here between 专砖状讬 and 转讜住驻讜转, what the 驻砖讟 in the 讙诪专讗 is. And the 讗诪转, 转讜住驻讜转 brings that in 讬专讜砖诇诪讬 there is a clear 诪讞诇讜拽转 between 讗诪讜专讗讬诐 what the 驻砖讟 in this 诪砖谞讛 is, whether the 诪砖谞讛 is concerning the first part of the process when the husband is calling the father to a 讚讬谉 转讜专讛, wanting to take away the 讻转讜讘讛 money from his wife, or is it the father calling the husband to a 讚讬谉 转讜专讛 asking him to pay the 诪讗讛 讻住祝. So, first we're going to learn this 讙诪专讗 the way 专砖状讬 learns the 驻砖讟, and then we're going to go back and explain the way 转讜住驻讜转 learned the 驻砖讟. 专砖状讬 learns the 驻砖讟 that we're talking here about the first step, that the husband is calling the father to a 讚讬谉 转讜专讛 saying that, "I found that your daughter is not a 讘转讜诇讛," and therefore he wants her to lose the 讻转讜讘讛. So, he is only dealing with money, he's asking her to lose the 讻转讜讘讛. He doesn't have witnesses that she was 诪讝谞讛, and therefore it has nothing to do with 讚讬谞讬 谞驻砖讜转. He is not saying anything that could lead her to get killed, because he's only claiming her to lose the 讻转讜讘讛, and he has no witnesses that she was 诪讝谞讛. And in order to make her lose the 讻转讜讘讛, he doesn't have to have witnesses that she was 诪讝谞讛. As we said before, the 讞讻诪讬诐 believed the husband because of the 讞讝拽讛 that he wouldn't lie and just waste money for nothing. So, therefore, he is believed when he says that she was 诪讝谞讛 just 诇讙讘讬 the 讚讬谉 of her losing the 讻转讜讘讛. So, therefore, when he comes and wants her to lose the 讻转讜讘讛, it is only a monetary dispute here, and therefore, 专讘讬 诪讗讬专 says it's enough to have a 讘讬转 讚讬谉 of three like any other 讚讬谞讬 诪诪讜谞讜转. But the 讞讻诪讬诐 say that since, in other cases, there is a possibility for this to lead to 讚讬谞讬 谞驻砖讜转, because if he would have had witnesses that she was 诪讝谞讛, if he would have had witnesses to his claim, then she would get killed, so 诪诪讬诇讗, even if he doesn't have witnesses, the 讚讬谉 is that you have to have a 讘讬转 讚讬谉 of 讻状讙, a 讘讬转 讚讬谉 of 23 like if it would be 讚讬谞讬 谞驻砖讜转. The 讙诪专讗 asks a 拽砖讬讗: 讜讻讬 讬砖 讘讜 讚讬谞讬 谞驻砖讜转 诪讗讬 讛讜讛? What do the 讞讻诪讬诐 say? That since 诪讜爪讬讗 砖诐 专注 could have 讚讬谞讬 谞驻砖讜转, therefore you have to have a 讘讬转 讚讬谉 of 23. But who cares that you could have in other cases 讚讬谞讬 谞驻砖讜转? 讘驻讜注诇 we're talking in a case where he doesn't have witnesses, and therefore, the case is where there is no 讚讬谞讬 谞驻砖讜转. So why should even this case need 23 because, in another case, there would be 讚讬谞讬 谞驻砖讜转, but this case doesn't have 讚讬谞讬 谞驻砖讜转? 讗诪专 注讜诇讗, 注讜诇讗 said: 讘讞讜砖砖讬谉 诇诇注讝 拽诪讬驻诇讙讬. That the 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐 is whether are we afraid of a 诇注讝? 诇注讝 means a rumor, that a rumor will spread that he claimed that his wife was 诪讝谞讛 after the 讗讬专讜住讬谉, and doesn't have witnesses. So he, 讟讗拽注, doesn't know that there are witnesses, and he's only coming to claim the money part of it. But nevertheless, maybe we're afraid that the rumor will go out, and what will happen? People who happen to see what she did will come to 讘讬转 讚讬谉, 讜诪诪讬诇讗, maybe there will be witnesses that she was 诪讝谞讛. So this itself could lead that even in this case, it could eventually come to 讚讬谞讬 谞驻砖讜转. So 专讘讬 诪讗讬专 住讘专, 专讘讬 诪讗讬专 holds, 讗讬谉 讞讜砖砖讬谉 诇诇注讝, we are not afraid of the rumor that this might lead to 讚讬谞讬 谞驻砖讜转 because other people might hear and come and testify in 讘讬转 讚讬谉. 讜专讘谞谉 住讘专讬 where we care about the 讻讘讜讚 of the original 讚讬讬谞讬诐 of the 讘讬转 讚讬谉. Meaning like this: 讛讻讗 讘诪讗讬 注住拽讬谞谉, and we're talking in a case 讻讙讜谉 讚讗讬讻谞讜祝 讘讬 注砖专讬谉 讜转诇转讗 诇诪讬讚谉 讚讬谞讬 谞驻砖讜转, that 23 got together to judge it 讚讬谞讬 谞驻砖讜转. The case is when the husband came to 讘讬转 讚讬谉 saying that he does have witnesses that she was 诪讝谞讛, and therefore he wants her to get killed. So they had to get a 讘讬转 讚讬谉 of 23 together, because when it comes to 讚讬谞讬 谞驻砖讜转, you need 23. So they got a 讘讬转 讚讬谉 of 23 together, 讜讗讬讘讚讬专, but then, they all left, they separated, because when it came down to the point, he did not have any witnesses. So since they saw he has no witnesses, so there is no more 讚讬谉, so they all left. But 讜讗诪专 诇讛讜, but then he said to them, 讚讬讬谞讜 诇讬 诪讬讛讗 讚讬谞讬 诪诪讜谞讜转, at least judge me 讚讬谞讬 诪诪讜谞讜转 part of it. I don't have the witnesses I thought I do, so I can't have her killed, but at least I want her to lose the 讻转讜讘讛, and for that, as we said before, you don't need witnesses. So he wants, at least, them to judge 讚讬谞讬 诪诪讜谞讜转. So the question here is, must we have all 23 for this, or three is enough? 专讘讬 诪讗讬专 says three is enough, because this is only 讚讬谞讬 诪诪讜谞讜转, so three is enough. 讗讬讬 it started off with 23, we don't care, we're not afraid that people might say that the reason that they left with three and those other 20 are not there anymore is because they weren't worthy or they weren't good 讚讬讬谞讬诐. We're not afraid that people would say that, and therefore, three is enough. But the 专讘谞谉 say, we do care about the 讻讘讜讚 of the other 讚讬讬谞讬诐. And therefore, if we're going to say that three is enough, people will think that the other 讚讬讬谞讬诐 were not good 讚讬讬谞讬诐. And therefore, just for their 讻讘讜讚, we have to have all 23 there, all those that we started this 讚讬谉 转讜专讛 with. Then the 讙诪专讗 says 诪讬转讬讘讬, I will ask you a 拽砖讬讗. We learned in a 讘专讬讬转讗, 讜讞讻诪讬诐 讗讜诪专讬诐, and the 讞讻诪讬诐 say, 转讘注讜 诪诪讜谉 讘砖诇砖讛. If he came to claim only money, then 讘砖诇砖讛, then it's enough to have three. 转讘注讜 谞驻砖讜转 讘注砖专讬诐 讜砖诇砖讛. If he came to claim death, then you must have 23. Now, what's the 驻砖讟 in this 讘专讬讬转讗, the opinion of the 讞讻诪讬诐? 讘砖诇诪讗 诇专讘讗 or 诇专讘讛, according to the second 驻砖讟, we understand the 驻砖讟 in this 讘专讬讬转讗. It means like this: 讘讗诪转, as we learned in the 诪砖谞讛, the 讞讻诪讬诐 hold that you always need, even when you come to claim 诪诪讜谉, you need 23. But the 驻砖讟 in the 讘专讬讬转讗 is that 转讘注讜 诪诪讜谉 转讞诇讛 讘砖诇砖讛. If he 诇讻转讞诇讛 came just to ask for money, he only came to have her lose the 讻转讜讘讛, so then all you need is three. 转讘注讜 谞驻砖讜转 转讞诇讛, if he came 诇讻转讞诇讛 to claim 谞驻砖讜转, because he claimed that he had witnesses that she was 诪讝谞讛 and he wants her killed, so then 讗驻讬诇讜 诪诪讜谉 讘注砖专讬诐 讜砖诇砖讛. Then even it turns out that all he's claiming is 诪诪讜谉, only money, because he has no witnesses, you still need the 23. This is as 专讘讗 or 专讘讛 said 驻砖讟 in the 诪砖谞讛 in the opinion of the 讞讻诪讬诐, that the reason the 讞讻诪讬诐 say you need 23 is only because of the 讻讘讜讚 of the 专讗砖讜谞讬诐. Only if you started off with having 23, because you thought it was 讚讬谞讬 谞驻砖讜转, and it turned out just to be 讚讬谞讬 诪诪讜谞讜转, you still need the 23 because of their 讻讘讜讚. But in a case where it started 诇讻转讞诇讛 off with three, he never said that he has witnesses, so then even the 讞讻诪讬诐 agree that you only need three, because as 专讘讗 or 专讘讛 said, we are not 讞讜砖砖 诇诇注讝, we are not afraid that maybe other people will hear and witnesses will turn up. So this is the 驻砖讟 in the 讘专讬讬转讗: that if he 诇讻转讞诇讛 starts with money, you only need three, even according to the 讞讻诪讬诐. If he started with 谞驻砖讜转 and you had 23, so then even if it turns out to be only 诪诪讜谉, so then you still need the 23. 讗诇讗 诇注讜诇讗 拽砖讬讗, but according to

Olah鈥檚 view on fear of rumors

注讜诇讗, 注讜诇讗 that learned the 驻砖讟 is that even if you start 诇讻转讞诇讛 with 诪诪讜谉, you still need 23 because 讞讬讬砖讬谞谉 诇诇注讝, we're afraid maybe other people will hear and the witnesses will come. So therefore, always, even if he 诇讻转讞诇讛 claims I have no witnesses, and all he's claiming is to make her lose the 讻转讜讘讛, nevertheless you must have 23. So what's the 驻砖讟 in this 讘专讬讬转讗, where the 讞讻诪讬诐 say 转讘注讜 诪诪讜谉 讘砖诇砖讛, that if he's claiming money three is enough, but according to the way 注讜诇讗 learned 驻砖讟 in the 讞讻诪讬诐, even if you claim money you should have to have 23? 讗诪专 专讘讗, so 专讘讗 said, 讗谞讬 讜讗专讬讗 砖讘讞讘讜专讛, me and the lion of the group, me and this great man, 转专讙讬诪谞讗, we explained it. 讜诪谞讜, who is this great man that together with 专讘讗 explained the 驻砖讟? 专讘讬 讗讘讗 讘专 讗讘讬谞讗, it's 专讘讬 讗讘讗 讘专 讗讘讬谞讗. And we explain this as follows: 讛讻讗 讘诪讗讬 注住拽讬谞谉, this 讘专讬讬转讗 is speaking in a case 砖讛讘讬讗 讛讘注诇 注讚讬诐 砖讝讬谞转讛, that the husband brought already witnesses that she was 诪讝谞讛, but 讜讛讘讬讗 讛讗讘 注讚讬诐 讜讛讝讬诪讜诐 诇注讚讬 讛讘注诇, but the father brought other witnesses that were 诪讝讬诐 the witnesses of the husband. So now, after you're 诪讝讬诐 the witnesses of the husband, we found out that he is a liar, that husband is a liar, so now the 讚讬谉 is that the husband is obligated to pay the 诪讗讛 讻住祝, the 100 讻住祝, because we know for sure that the husband is a liar. And we can't say here, oh, maybe other witnesses will come and testify for this benefit of the husband, because since the first group of witnesses that he brought, they were 诪讝讬诐, that shows that he 诇讻转讞诇讛 is looking to bring 注讚讬诐 which are liars, so even if other witnesses will come, we won't accept them. So therefore we can't be afraid That maybe more witnesses will come. He is not even believed to have her lose the 讻转讜讘讛, which we said before you don't need witnesses, because that is only when he never brought witnesses 诇讻转讞讬诇讛,

Death鈥憄enalty requirements in the Baraita

so then we believe him on his own word enough to make her lose the 讻转讜讘讛. But if he brought witnesses and they were being 诪讜讝诐, so then he is not even believed concerning make her lose the 讻转讜讘讛, because we know for sure that he is a liar. And therefore the 讚讬谉 is in a case like this, that he is obligated to pay 100 讻住祝 to the father of his wife. And the case here is that 讘讗 诇讙讘讜转 诪谞讛 诪谉 讛讘注诇, that we're talking not about a judgment concerning the claim of the husband, but we're holding already at the end of the process, that the father is coming to claim the money, the 100 讻住祝 from the husband, so that's where we say 讘砖诇砖讛, that here it's enough three, because here there is no possibility for this to turn into 讚讬谞讬 谞驻砖讜转. Because even if the husband is going to bring more witnesses that she was 诪讝谞讛, they will not be accepted. So this is only a question of 讚讬谞讬 诪诪讜谞讜转 that the father is claiming from the husband, and therefore the 讞讻诪讬诐 say it is 讘砖诇砖讛. 讜讘诪拽讜诐 谞驻砖讜转, but in a case where it would be 谞驻砖讜转, which means if it wouldn't be a case as just mentioned, that the husband's 注讚讬诐 were already 诪讜讝诐, and the case is where the father is claiming the 诪讗讛 讻住祝 from the husband. If it would be the beginning of the 讚讬谉, the beginning of the process, if the case would be that the husband is claiming money from his wife, meaning he wants her to lose the 讻转讜讘讛, so here the 讚讬谉 would be that it would have to be 讘注砖专讬诐 讜砖诇砖讛, 23. So this is the 驻砖讟 in the 讘专讬讬转讗 according to 注讜诇讗. 讞讻诪讬诐 讗讜诪专讬诐 转讘注 诪诪讜谉 讘砖诇砖讛, the 讞讻诪讬诐 say that if the father is claiming money, so there is only a 讚讬谞讬 诪诪讜谞讜转 involved, so then it's enough three. 转讘注 谞驻砖讜转, if the case would be different, the case would be where the husband is claiming money, so then, since that could lead to 谞驻砖讜转, because even though he starts off by saying that I don't have witnesses, and all I'm claiming is money, I want her to lose the 讻转讜讘讛, nevertheless, this could lead to 谞驻砖讜转, and therefore there the 讞讻诪讬诐 hold 讘注砖专讬诐 讜砖诇砖讛, that you need 23. Then the 讙诪专讗 continues, 讗讘讬讬 讗诪专, 讗讘讬讬 says, no. 讘讗诪转 the 驻砖讟 in the 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐 is different, 讚讻讜诇讬 注诇诪讗 讞讬讬砖讬谞谉 诇注讬诇讗. 讘讗诪转, they both hold that we are afraid of a 注讬诇讗. Which means that if he comes 诇讻转讞讬诇讛 and claims that he wants her to lose the 讻转讜讘讛 and doesn't have witnesses, nevertheless, even 专讘讬 诪讗讬专 would hold that we're afraid a rumor might go out and witnesses might come, and this could lead to 讚讬谞讬 谞驻砖讜转. 讜诪砖讜诐 讻讘讜讚诐 砖诇 专讗砖讜谞讬诐, plus they both agree that we care about the 讻讘讜讚诐 砖诇 专讗砖讜谞讬诐, the 讻讘讜讚 of the first ones. And therefore, they both would agree that if the case was that they sat down to 驻住拽谉 讚讬谞讬 谞驻砖讜转, and then they found out that there are no witnesses, nevertheless, you would have to have all 23 in order to 驻住拽谉 even the 讚讬谞讬 诪诪讜谞讜转, the 讚讬谉 of the 讻转讜讘讛, because they both hold that we care about the 讻讘讜讚 of all the previous 讚讬讬谞讬诐. And therefore, under normal circumstances, the 讚讬谉 would be that even if the husband comes and is just claiming 诪诪讜谉, he just wants her to lose the 讻转讜讘讛, even 专讘讬 诪讗讬专 would agree that you have to have 23. But here, 讛讻讗 讘诪讗讬 注住拽讬谞谉, here we're talking in a case 讻讙讜谉 讚讛转专讜 讘讛 住转诐, that the truth was he came with witnesses. He said, I do have witnesses that she was 诪讝谞讛, and he brought the witnesses. And the witnesses are here, but the witnesses claim that when they warned her when she was 诪讝谞讛, they just warned her 住转诐. They didn't say what kind of 诪讬转讛 she will get. 讜讛讗 转谞讗 讛讜讗 讚转谞讬讗, and this goes according to this specific 转谞讗 that we learned in a 讘专讬讬转讗. For we learned in a 讘专讬讬转讗: 砖讗专 讻诇 讞讬讬讘讬 诪讬转讜转 砖讘转讜专讛, that all other those people who get a death penalty of the 转讜专讛, 讗讬谉 诪诪讬转讬谉 讗讜转诐 讗诇讗 讘注讚讛. First of all, you have to have the community, meaning a 讘讬转 讚讬谉 of 23. 讜注讚讬诐, and you must have witnesses. 讜讛转专讗讛, and there must be a warning. They must have warned the person who did the 注讘讬专讛 at the time he did the 注讘讬专讛. And also, 注讚 砖讬讜讚讬注讜讛讜 砖讛讜讗 讞讬讬讘 诪讬转讛 讘讘讬转 讚讬谉, and he must be told at the time when he does the 注讘讬专讛 that he will get 诪讬转讛 if he does the 注讘讬专讛, he will get killed if he does the 注讘讬专讛. That's the opinion of the first 转谞讗. It's not enough just to warn him and tell him that if you do the 注讘讬专讛 you'll get killed, but you must also tell him which 诪讬转讛 he will get, which out of the four types of 诪讬转讜转 讘讬转 讚讬谉 there is, which one he will get. So we have this 诪讞诇讜拽转. And the reason the 讘专讬讬转讗 starts off by saying other people who are 讞讬讬讘讬 诪讬转讜转 in 转讜专讛, you only kill them if this and this happened, it is because the 讘专讬讬转讗 is 诇讻转讞讬诇讛 talking about a 诪住讬转. A 诪住讬转 is a person who convinces other people to do 注讘讜讚讛 讝专讛. There, there is a different 讚讬谉. Concerning a 诪住讬转, the 讚讬谉 is the 转讜专讛 says in 讚讘专讬诐 讬"讙: 诇讗 转讞诪讜诇 讜诇讗 转讻住讛, do not have any pity on him and do not cover cover up on him. So therefore, since the 转讜专讛 says do not cover up, you're not allowed to look for a 讝讻讜转, for a merit, to save the 诪住讬转. Therefore the 讚讬谉 is that he gets killed without even being warned. There has to be witnesses, but the witnesses don't have to stand that he should see them and they should warn him when he does the 注讘讬专讛, but it's enough if we hide witnesses behind the bushes, and they see that he is trying to convince somebody to do 注讘讜讚讛 讝专讛. And that somebody that he is trying to convince him doesn't have to actually warn him, say that if you will do what you do, you will get killed, but it's enough if he just says to him, "How in the world can you try to change that we should leave 讗讘讬谞讜 砖讘砖诪讬诐, we should leave over 讛砖诐, and we should worship stones or wood, etc.?" That is enough that if the two witnesses behind the bushes see that the other person said it to him, and he nevertheless continued and tried to convince him to worship 注讘讜讚讛 讝专讛, it's enough to have him killed. So that's what the 讘专讬讬转讗 says. That's only concerning a 诪住讬转. But all other 讞讬讬讘讬 诪讬转讜转 of the 转讜专讛, there it must have these conditions: You must have a 讻"讙, which really a 诪住讬转 also must have 讻"讙. You must have witnesses that stand there, and they must warn him, and they also must warn him that he will get 诪讬转讛. And then we have a 诪讞诇讜拽转 whether they have to also warn him and tell him exactly which 诪讬转讛 he will get. And this is really the 诪讞诇讜拽转 here between 专讘讬 诪讗讬专 and the 讞讻诪讬诐. The case of the 诪砖谞讛 is that the husband is coming to 讘讬转 讚讬谉, claiming, "I have witnesses she was 诪讝谞讛, and therefore I want her to lose the 讻转讜讘讛, that's one thing, plus I want her to get killed." And these witnesses come in front of three people, before they came to a 讘讬转 讚讬谉 of 23 that would have to judge it if it would be really 讚讬谞讬 谞驻砖讜转, but first they came in front of three, and the witnesses said that, "We did not warn her which 诪讬转讛 she will get." So 专讘讬 诪讗讬专 holds that 讘讗诪转, you do have to warn her which 诪讬转讛 she will get, otherwise she will not be killed. 诪诪讬诇讗, as soon as they say that they did not warn her, tell her which 诪讬转讛 she will get, she automatically will not get killed. So therefore, 专讘讬 诪讗讬专 holds there is no 讚讬谞讬 谞驻砖讜转 here. And therefore he says we don't have to get 23 together, because it'll never lead us to 讚讬谞讬 谞驻砖讜转, because they did not warn her with which 诪讬转讛. 讗讬讬, let's be afraid that maybe other witnesses will come, and they will say that they did warn her, because now we're holding that everyone holds 讞讬讬砖讬谞谉 诇诇注讝, that we are afraid maybe other witnesses will come, but that is not true either, because when are we afraid for a 诇注讝 that other witnesses will come? If he didn't bring any witnesses. He just comes to 讘讬转 讚讬谉, says, "I say she was 诪讝谞讛, I don't have witnesses." So then we're afraid maybe witnesses will hear and they will come. But in the case where he brings witnesses, so we're not afraid anymore that he, other witnesses will come, because the witnesses that were there are here already. And these witnesses claim that they did not warn her which 诪讬转讛 she will get, so automatically, even according to the witnesses, she will never get killed, so there is no 讚讬谞讬 谞驻砖讜转 here. That's why 专讘讬 诪讗讬专 says that you have to have only three, you don't need 23. But the 讞讻诪讬诐, they hold like the other 转谞讗, that you do not have to warn the person with which 诪讬转讛 he will get. If you just tell him that you're going to get 诪讬转讛, it's enough that he will be killed. And therefore, when these witnesses come in front of the three, and they say that, "We warned her that she will get killed, but we didn't tell her which 诪讬转讛," so the 专讘谞谉 hold that this could lead her to 讚讬谞讬 谞驻砖讜转. She could get killed if everything fit, because it is considered a 讛转专讗讛, a warning. So therefore, the 专讘谞谉 hold that now you must get 23 people together, and you must judge the case, because this is a case of 讚讬谞讬 谞驻砖讜转. But according to this, what will we do with the 讘专讬讬转讗 where it says that the 讞讻诪讬诐 讗讜诪专讬诐 转讜讘注 诪诪讜谉 讘砖诇砖讛, but the 讞讻诪讬诐 say that if he only is claiming money, it's enough to have three? But 诇讻讗讜专讛, if he's only claiming money, then we should have 23, because as we said before, everyone agrees 讞讬讬砖讬谞谉 诇诇注讝, that we're afraid maybe witnesses will come. So if he's only claiming money, which means he comes and says that, "I don't have witnesses," so then 诇讻讗讜专讛 the 讚讬谉 should be that you should have to have 23, according to the 驻砖讟 of 讗讘讬讬. So what is the 驻砖讟 in the 讘专讬讬转讗 where it says 转讜讘注 诪诪讜谉 讘砖诇砖讛? So 专砖"讬 says that 讗讘讬讬 will explain the 讘专讬讬转讗 as the 讙诪专讗 said before 专讘 讞讬讬讗 讘专 讗讘讬谉 explained, that when it says 转讜讘注 诪诪讜谉 讘砖诇砖讛, it doesn't mean that the husband is claiming money, but it means that the father is claiming money after we proved that the husband was a liar. So there the 讚讬谉 is that you have to have only 砖诇砖讛, and 转讜讘注 谞驻砖讜转 means if it is the husband that is coming to claim money, so since it could lead to 谞驻砖讜转, the 讚讬谉 is that you have to have 23. 专讘 驻驻讗, 诪专 讘专讬讛 讚专讘 驻驻讗 says, "讛讻讗 讘讗砖讛 讞讘讬专讛 注住拽讬谞谉," that here we're talking by a woman that is a 转诇诪讬讚 讞讻诐, that she is a scholar, she's a learned woman. In other words, 讘讗诪转 he is saying like 讗讘讬讬, that 专讘讬 诪讗讬专 and the 讞讻诪讬诐, they both hold that 讞讬讬砖讬谞谉 诇诇注讝. We're afraid that witnesses might come. In the case where the husband comes and says, "I have no witnesses," then everyone agrees that we need 23, because witnesses might hear and Also everyone agrees that we are afraid 诇讻讘讜讚 砖诇 专讗砖讜谞讬诐, and therefore, if they started with 23, you must continue with 23. But what is the 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐 in a case where he did bring witnesses, like 讗讘讬讬 says? And therefore, we're not afraid that more witnesses will come. But what is the 诪讞诇讜拽转 whether you need 23 or three? The case is where the witnesses claim that we didn't warn her. There was no 讛转专讗讛 at all. But 诇讻讗讜专讛, if there's no 讛转专讗讛, then definitely this will never lead to 讚讬谞讬 谞驻砖讜转, because we know one general rule that if you don't warn the person, then he's never 讞讬讬讘 诪讬转讛. But the case is where the woman was a 讞讘讬专讛, 讜拽诪讬驻诇讙讬 讘驻诇讜讙转讗 讚专讘讬 讬讜住讬 讘专 讬讛讜讚讛 讜专讘谞谉, that 专讘讬 诪讗讬专 and the 讞讻诪讬诐 argue in the same 诪讞诇讜拽转 as 专讘讬 讬讜住讬 讘专 讬讛讜讚讛 and the 专讘谞谉. Even if he wasn't warned and he did an 注讘讬专讛 that you're 讞讬讬讘 诪讬转讛 for, he would get 诪讬转讛. 诇驻讬 砖诇讗 谞讬转谞讛 讛转专讗讛 讗诇讗 诇讛讘讞讬谉 讘讬谉 砖讜讙讙 诇诪讝讬讚. The whole reason why there is a 讚讬谉 that a person is not 讞讬讬讘 unless he's warned is to make the difference between a 砖讜讙讙 and a 诪讝讬讚, because a person could always claim, "I was a 砖讜讙讙, I didn't know that you're not allowed to do it." But if they warned him 讘砖注转 诪注砖讛, then he doesn't have that excuse. A 转诇诪讬讚 讞讻诐 could never say, "I didn't know," because if he's a 转诇诪讬讚 讞讻诐, obviously he knew. So, therefore, a 转诇诪讬讚 讞讻诐 does not need 讛转专讗讛. But the other 诪讗谉 讚讗诪专 holds that even a 转诇诪讬讚 讞讻诐 also needs 讛转专讗讛. And this is the 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐. The case here is that the 注讚讬诐 did come, but they said we didn't warn her. Why didn't we warn her? Because she was a 讞讘讬专讛, she was a scholar. So 专讘讬 诪讗讬专 holds that you still need 讛转专讗讛. And therefore, since they didn't warn her, so this will never lead to 讚讬谞讬 谞驻砖讜转, she can't get killed. And we're not afraid other witnesses might come, because since he brought witnesses already, then we're not afraid more witnesses will come, because whatever witnesses he had, he brought. So therefore, 专讘讬 诪讗讬专 says there is no reason to have 23, three is enough. But the 讞讻诪讬诐, they hold that by a 讞讘讬专讛 you do not need 讛转专讗讛, so according to them, she could be 讞讬讬讘 诪讬转讛 even if there was no 讛转专讗讛. So therefore, you would have to have a 讘讬转 讚讬谉 of 23 when you judge this case, because this could lead to 讚讬谞讬 谞驻砖讜转. This is the 驻砖讟 the way 专砖状讬 learns in this 讙诪专讗, that in all cases we're talking about the husband coming to 讘讬转 讚讬谉 claiming that she was 诪讝谞讛, claiming that he wants her to lose the 讻转讜讘讛, and the discussion is whether this is only considered 讚讬谞讬 诪诪讜谞讜转 or 讚讬谞讬 谞驻砖讜转, except the 驻砖讟 in the 讘专讬讬转讗 where it said 讜讞讻诪讬诐 讗讜诪专讬诐 转讜讘注讬 诪诪讜谞诐 讘砖诇砖讛, 转讜讘注讬 谞驻砖讜转 讘注砖专讬诐 讜砖诇砖讛, the way 专讘讬 讞讬讬讗 讘专 讗讘讬谉 explained, that's what we said the 驻砖讟 is not concerning the husband claiming 讚讬谞讬 诪诪讜谞讜转, but it is the father of the wife that is claiming from the husband the 诪讗讛 讻住祝. But otherwise, the whole discussion here is concerning the 讚讬谉 that the husband is calling against his wife. And the reason 专砖状讬 learns that way, and he doesn't learn that we're talking here about the father calling the husband to a 讚讬谉 转讜专讛 to pay the 诪讗讛 讻住祝, he says it because if that would be the 驻砖讟 in the 诪砖谞讛, that 专讘讬 诪讗讬专 holds that when the father calls the husband to a 讚讬谉 转讜专讛 to pay the 诪讗讛 讻住祝, we need three, and the 讞讻诪讬诐 say that even for that you need 23, but how can you say that this is the 驻砖讟 in the 诪砖谞讛? Because when is the husband 讞讬讬讘 to pay the 诪讗讛 讻住祝? Only after the whole process. If he brought witnesses to show that she was 诪讝谞讛, then the father brought witnesses that were 诪讝讬诐 his witnesses, then he is 讞讬讬讘 诪讗讛 讻住祝. But otherwise, there is no 诪讗讛 讻住祝. So how could the father 诇讻转讞讬诇讛 call the husband to a 讚讬谉 转讜专讛 to pay 诪讗讛 讻住祝? I will say that the 诪砖谞讛 is talking speaking after the husband brought his witnesses and the father brought witnesses that were 诪讝讬诐, then the father is calling the husband to a 讚讬谉 转讜专讛 to pay the 诪讗讛 讻住祝. And that's the 驻砖讟 in the 诪砖谞讛, that's the point that the 诪砖谞讛 is talking about. If so, 专砖状讬 asks, how can the 讙诪专讗 say that the 诪讞诇讜拽转 is whether 讞讬讬砖讬谞谉 诇诇注讝, whether we're afraid that other witnesses will come? If we're talking here in a point that the first witnesses of the husband were already 诪讜讝诐, so then, as we said before, there is no reason to suspect that other witnesses will come, because even if other witnesses will come, the husband would bring more 注讚讜转, we still won't accept them, because we see already that he is bringing witnesses liars. 讜诪诪讬诇讗 there's no possibility for the 住讘专讗 of 讞讬讬砖讬谞谉 诇诇注讝. So how can the 讙诪专讗 say that the reason the 讞讻诪讬诐 hold you have to have 23 is because we're afraid of a 诇注讝, that maybe more witnesses will come? Even if more witnesses will come, we still won't accept them, because according to this, we're speaking already after his witnesses that he brought were 诪讜讝诐. So therefore, we cannot say that the 诪砖谞讛 is speaking in the case when the father is claiming the 诪讗讛 讻住祝 from the husband. Also, 专砖状讬 says, from the answer of 专讘讬 讞讬讬讗 讘专 讗讘讬谉 that the 驻砖讟 in the 讘专讬讬转讗 is that the husband husband brought witnesses, and then the father brought witnesses who were 诪讝讬诪讬谉 them, and now the father is claiming money from the husband, is 诪砖诪注 that this is a new thing that the 讙诪专讗 came up with. That the 讙诪专讗 now, when it's trying to answer 驻砖讟 in the 讘专讬讬转讗 where it says 讞讻诪讬诐 讗讜诪专讬诐 转讜讘注 诪诪讜谉 讘砖诇砖讛, so we say, if you know what the 讘专讬讬转讗 is speaking about, in a different case, the case where already the husband brought witnesses, and the father brought witnesses who were 诪讝讬诪讬谉 them, and we're talking, we're speaking, we're holding at the point when the father is claiming money from the husband. So obvious, up till now the whole 讙诪专讗 was speaking in a case where the husband is claiming the money from her, meaning that he wants her to lose the 讻转讜讘讛. So therefore, 专砖状讬 learns that the 讙诪专讗 here is speaking concerning the husband that is calling them to a 讚讬谉 转讜专讛 for 诪诪讜谉, and that is concerning the 讻转讜讘讛, and the discussion is whether it is considered 讚讬谞讬 谞驻砖讜转 and you have to have twenty-three or not. But 转讜住驻讜转 learns the 驻砖讟 in the whole 讙诪专讗 different. 转讜住驻讜转 asks many 拽讜砖讬讜转 on 专砖状讬's 驻砖讟. One 拽砖讬讗 is, in the 诪砖谞讛 it says 诪讜爪讬讗 砖诐 专注 together with 讗讜谞住 讜诪驻转讛. So obviously the 诪讜爪讬讗 砖诐 专注 is similar to 讗讜谞住 讜诪驻转讛, which means, just like 讗讜谞住 讜诪驻转讛 the husband has to pay 讞诪砖讬诐 讻住祝, 诪讜爪讬讗 砖诐 专注 we're talking about the 诪讗讛 讻住祝 that the husband has to pay. Also, 转讜住驻讜转 says, we know that whenever the 讙诪专讗 mentions the 讚讬谞讬诐 of 诪讜爪讬讗 砖诐 专注, we're always referring to the 诪讗讛 讻住祝 that he has to pay. Another thing, in the 诪砖谞讛 when it says that it needs 砖诇砖讛, obviously we're talking about three 诪讜诪讞讬诐. And if it would be talking about the husband's claim, meaning that he wants her to lose the 讻转讜讘讛, why would we need three 诪讜诪讞讬诐 for that? If we're talking about the hundred 住诇注讬诐 that he has to pay, that is a 拽谞住, and for that you have to have 诪讜诪讞讬诐. But if we're talking by 诪讜爪讬讗 砖诐 专注 concerning the claim of the husband that just wants her to lose the 讻转讜讘讛, so we're discussing 讚讬谞讬诐 of money of the 讻转讜讘讛, for that we wouldn't have to have 诪讜诪讞讬诐. Another thing, according to 专砖状讬, he says the 驻砖讟 in the 讙诪专讗, 讞讬讬砖讬谞谉 诇诇注讝 means that we're afraid that even though he says he has no witnesses, but when the rumor will go out that he is saying that she was 诪讝谞讛, maybe people will hear and witnesses will come. So 转讜住驻讜转 says, this is not the common meaning of the word 诇注讝. When the 讙诪专讗 uses the 诇砖讜谉 诇注讝, it usually means for a 砖拽专, for a lie. Like for instance, it says you shouldn't do certain things concerning a 讙讟, 砖诇讗 诇讛讜爪讬讗 诇注讝 注诇 讙讬讟讬谉 讛专讗砖讜谞讬诐, not to make a 诇注讝 on the original 讙讬讟讬谉 before they did that. There it means that people will say that the original 讙讬讟讬谉 are 驻住讜诇, when really it's not. So usually 诇注讝 is concerning a lie. But the way it says here, 诇注讝 doesn't have anything to do with a lie. The way 专砖状讬 learns the 驻砖讟 is that the rumor might go out and people might come to testify. Has nothing to do with a 诇注讝. So how could we say that this is what 诇注讝 means? And other 拽讜砖讬讜转 that 转讜住驻讜转 asks. And therefore 转讜住驻讜转 learns a complete different 驻砖讟 in the 讙诪专讗: that we're talking here, 讟讗拽注, about the claim that the father has against the husband that he should pay the 诪讗讛 讻住祝. And the 驻砖讟 is as follows: the case was that the husband 诇讻转讞讬诇讛 brought witnesses that she was 诪讝谞讛 after the 拽讬讚讜砖讬谉. Then the father brought witnesses, but they were not 诪讝讬诐 the witnesses of the husband, they were just 诪讻讞讬砖. The 讚讬谉 is that if the second group of witnesses come and say to the first, "How can you testify that this happened when at that time you were with us?", that's called 讛讝诪讛. And the 讚讬谉 by 讛讝诪讛 is that if a certain group is 诪讝讬诐 another group, so the first group is definitely a lie, and we believe the second over the first. But if the second group came and didn't say, "注诪谞讜 讛讬讬转诐, you were with us at that time," but they were just 诪讻讞讬砖, they had some other ways they proved that the first group is liars, so then the 讚讬谉 is not that we know for sure that the first group is lying, maybe the second group is lying. And therefore, we don't accept the first group's testimony anyway, but it's only called 讛讻讞砖讛, not 讛讝诪讛, and it's not as strong as 讛讝诪讛. So therefore, in the case of 讛讝诪讛, when the 注讚讬诐 of the father were 诪讝讬诐 the 注讚讬诐 of the husband, then 讟讗拽注 we cannot be afraid that maybe more witnesses will come, because if you're 诪讝讬诐 the first group of witnesses, we know for sure that they are liars, and since we know for sure they are liars, so we see that the husband is bringing liars as witnesses. So even if more witnesses come, we will not accept them. But if the second witnesses, the witnesses of the father, only were 诪讻讞讬砖 the witnesses of the husband, then there is still a possibility that other witnesses will come, and they will be accepted. And this is the case here: that after the husband brought his witnesses, the father brought witnesses that were 诪讻讞讬砖 the witnesses of the husband. Or a case that the father did not bring witnesses to be 诪讻讞讬砖 the witnesses of the husband, but the witnesses of the husband themselves didn't fit in their own testimony. So in a case like this we see that what he brought is not accepted. The witnesses of the husband is not acceptable. So therefore, now the father claims that the husband should give him the 诪讗讛 讻住祝, since he brought witnesses and they are not accepted. So now he owes 诪讗讛 讻住祝. So the 讚讬谉 is that 专讘讬 诪讗讬专 holds, since all he is claiming is 诪讗讛 讻住祝, that is money, Therefore, it's enough to have a 讘讬转 讚讬谉 of three. But the 讞讻诪讬诐 hold no, you must have a 讘讬转 讚讬谉 of twenty-three. And the first 驻砖讟 in the 讙诪专讗 is because 讞讬讬砖讬谞谉 诇注讝, we're afraid that maybe other witnesses might come, the husband might bring more witnesses, and since the first witnesses he brought were not 诪讜讝诐, just 诪讜讻讞砖, we would accept the other witnesses. And if the other witnesses will come, then it'll become back 讚讬谞讬 谞驻砖讜转, because the other witnesses will claim that she was 诪讝谞讛, and they might be accepted, so they might even come to kill her. It might become 讚讬谞讬 谞驻砖讜转 again. So at the point when the father wants the husband to pay the 诪讗讛 讻住祝, if you will have only a 讘讬转 讚讬谉 of three, but in the meantime, other witnesses might come to testify that she was 诪讝谞讛, it might turn into 讚讬谞讬 谞驻砖讜转. And if it does turn into 讚讬谞讬 谞驻砖讜转, you will have to have at that point twenty-three. So there might be a 诇注讝 that the original three, the reason they weren't good and you had to add twenty more, people won't know that it's because it turned into 讚讬谞讬 谞驻砖讜转, people will think it is because they were not good 讚讬讬谞讬诐, there will be a 诇注讝 on the authority of the first three 讚讬讬谞讬诐. So 专讘讬 诪讗讬专 says he doesn't care about the 诇注讝, and therefore, as long as the father is just claiming the 诪讗讛 讻住祝, so it's 讚讬谞讬 诪诪讜谞讜转 at this point. 讗讬讬, it might turn into 讚讬谞讬 谞驻砖讜转, and then you will have to get twenty-three, so you'll get twenty-three then, and he doesn't care that there might be a 诇注讝 on these 讚讬讬谞讬诐, he's not 讞讜砖砖 for that. But the 讞讻诪讬诐 say we are 讞讜砖砖 for that, and therefore, since it might turn into 讚讬谞讬 谞驻砖讜转, and then you will definitely have to get twenty-three and there will be a 诇注讝 on these three, so therefore they hold 诇讻转讞讬诇讛 you should get twenty-three. And the 驻砖讟 in 专讘讗's words, where he says that the 诪讞诇讜拽转 is whether we're 讞讜砖砖 诇讻讘讜讚谉 砖诇 专讗砖讜谞讬诐, so according to 转讜住驻讜转 the 驻砖讟 is as follows: that they gathered together the twenty-three to judge 讚讬谞讬 谞驻砖讜转. In other words, this is a case where the father claimed that he had witnesses that would be 诪讝讬诐 the witnesses of the husband. And like till they got a chance to listen to the testimony of the second group of witnesses, for some reason something happened and they had to separate, they had to leave, whether they got afraid of something or the king came or whatever reason there might be, and there were only three left. And the father says to these three that 讟讗拽注 now I wanted to bring the 注讚讬诐 that would be 诪讝讬诐 the 注讚讬诐 of the husband, and that would cause the 注讚讬诐 of the husband to get killed, since they came to testify that she was 诪讝谞讛, and they wanted her killed, so the 讚讬谉 is that when you're 诪讝讬诐 such 注讚讬诐, so then you do to the 注讚讬诐 what they wanted to do. So the father says I wanted to have the 注讚讬诐 killed, but now that we don't have twenty-three I can't do it, but at least there are three left, so at least judge me 讚讬谞讬 诪诪讜谞讜转, at least you three should judge me that he, the husband, should pay the 诪讗讛 讻住祝, at least that I should get. And that's what the 诪讞诇讜拽转 between 专讘讬 诪讗讬专 and the 讞讻诪讬诐 is. 专讘讬 诪讗讬专 says since now they're only talking about 讚讬谞讬 诪诪讜谞讜转, so then it's enough to have the three, and we're not afraid for the 讻讘讜讚 of the other twenty 讚讬讬谞讬诐, but the 讞讻诪讬诐 hold that we are afraid for the 讻讘讜讚 of the other 讚讬讬谞讬诐, and therefore, since we started with twenty-three, even for the 讚讬谞讬 诪诪讜谞讜转, we must have twenty-three.
