Today's 砖讬注讜专 will be in 诪住讻转 住谞讛讚专讬谉 讚祝 讟"讜. But we will start two lines from the bottom of 讚祝 讬"讚, 注诪讜讚 讘'. The 讙诪专讗 here quotes from the 诪砖谞讛 where it said that, "讛注专讻谉 讜讻讜壮", which means 讛注专讻讬谉 讛诪讟诇讟诇讬谉 讘砖诇砖讛. The 诪砖谞讛 said that 注专讻讬谉, which are immovable objects, in order to evaluate the value of it when you come to redeem it, you have to have a 讘讬转 讚讬谉 of three people. And the 讙诪专讗 asks, "诪讗讬 讛注专讻讬谉 讛诪讟诇讟诇讬谉?" What does 讛注专讻讬谉 讛诪讟诇讟诇讬谉 mean? We know that the term 注专讻讬谉 is referred to a special case, that when a person says, "注专讻讬 注诇讬", the 注专讱, the value of myself is upon me, but he uses the term 注专讱, or he says, "注专讻讱 注诇讬", your 注专讱 is upon me, or "注专讻讜 注诇讬", his 注专讱 is upon me, etc., then the 转讜专讛 prescribed a specific amount of money he has to give based on the age. It doesn't depend on the value of the person, but there is a specific amount of money prescribed in the 转讜专讛 how much he has to give depending on the age of the person. But that is only concerning a human being. We don't find the concept of 注专讱 concerning objects. The only thing we find concerning objects is that a person is able to be 诪拽讚讬砖 them, he's able to make them holy, meaning he's able to give them away to the 讘讚拽 讛讘讬转, to 讛拽讚砖, but that is not the concept of 注专讱. There, you wouldn't use the 诇砖讜谉 注专讱. You would use the 诇砖讜谉 讚诪讬诐. For instance, you would say, "讚诪讬 讻诇讬 讝讛 注诇讬", the money, the value of that 讻诇讬 is upon me, then you have to give to 讛拽讚砖 the value of that 讻诇讬. Or even if you use the term 讚诪讬诐 concerning yourself, if you say, "讚诪讬 注诇讬", my value is upon me, then also the 讚讬谉 would be that you have to give to 讛拽讚砖 the value of yourself. Only concerning a human being and if you use the 诇砖讜谉 注专讱, then there is a special 讚讬谉 of 注专讱. And that's the 讙诪专讗's question here. When it says in the 诪砖谞讛 that, "讛注专讻讬谉 讛诪讟诇讟诇讬谉", 讛注专讻讬谉 of un- of movable objects need a 讘讬转 讚讬谉 of three to evaluate how much you have to give, but there is no such thing as 讛注专讻讬谉 讘诪讟诇讟诇讬谉. 讛注专讻讬谉 are only concerning a human being. So,

Rav Gidel on 注专讱 讻诇讬 讝讛 注诇讬

讗诪专 专讘 讙讬讚诇 讗诪专 专讘, said 专讘 讙讬讚诇 said in the name of 专讘, that this means 讘讗讜诪专, if someone says, "注专讱 讻诇讬 讝讛 注诇讬", the 注专讱 of this vessel is upon me. Now, he used the 诇砖讜谉 注专讱, which really does not apply to a 讻诇讬. So there, the 讚讬谉 is that you do have to give the value of the 讻诇讬 even though he used the 诇砖讜谉 注专讱 which really doesn't apply, because 讚讗诪专 专讘 讙讬讚诇, because 专讘 讙讬讚诇 said, 讗诪专 专讘, in the name of 专讘, 讛讗讜诪专 注专讱 讻诇讬 讝讛 注诇讬, if someone says, "The 注专讱 of this vessel is upon me," 谞讜转谉 讚诪讬讜, he has to give the value of that 讻诇讬. 诪讗讬 讟注诪讗? What is the reason? Because 讗讚诐 讬讜讚注, a person knows, we assume that a person knows 砖讗讬谉 注专讱 诇讻诇讬, that there is no such thing as an 注专讱 to a vessel. So, when he used the 诇砖讜谉, "注专讱 讻诇讬 讝讛 注诇讬", he didn't make a mistake thinking that there is a concept of 注专讱 to a 讻诇讬. He knew there was no 注专讱 to a 讻诇讬. But 讜讙诪专 讜讗诪专 诇砖诐 讚诪讬诐, but when he said it, what he really meant was that he would give the value of that 讻诇讬. Because we have a rule that 讗讬谉 讗讚诐 诪讜爪讬讗 讚讘专讬讜 诇讘讟诇讛, a person doesn't just say words in vain. So, he wouldn't have said these words knowing that 注专讱 doesn't apply to a 讻诇讬, he wouldn't have said it in vain. So, if he did say it, probably what he meant was he used the term 注专讱, but he meant 讚诪讬诐, to give the value. 诪砖讜诐 讛讻讬, therefore, 谞讜转谉 讚诪讬讜. Therefore, he has to give the value as if he would have said that, the 讚诪讬 讻诇讬 讝讛 注诇讬, the money, the value of the 讻诇讬 is upon me. And this is what the 诪砖谞讛 means. 讛注专讻讬谉 讛诪讟诇讟诇讬谉 must have three people to evaluate, that means if you use the 诇砖讜谉 注专讱 concerning 诪讟诇讟诇讬谉 where you anyway have to give the value of the 讻诇讬 and there you need three people. But the 讙诪专讗 asks, "讛讗讬 讛注专讻讬谉 讛诪讟诇讟诇讬谉?" According to that, how could the 诪砖谞讛 use the 诇砖讜谉 讛注专讻讬谉 讛诪讟诇讟诇讬谉 which seems to be saying that the 注专讻讬谉 is 诪讟诇讟诇讬谉? 讛注专讻讬谉 砖诇 诪讟诇讟诇讬谉 诪讘注讬 诇讬讛. It should have said 注专讻讬谉 of 诪讟诇讟诇讬谉, that if you made an 注专讱 of 诪讟诇讟诇讬谉, then you have to pay the value, so you would need three people to evaluate. But when it says, "讛注专讻讬谉 讛诪讟诇讟诇讬谉", it's 诪砖诪注 that the 注专讻讬谉 are 诪讟诇讟诇讬谉, and therefore, it doesn't seem like this is the 驻砖讟 in the 诪砖谞讛. The 讙诪专讗 answers, 转谞讬 讛注专讻讬谉 砖诇 诪讟诇讟诇讬谉. Read it that way, that what it really means is 注专讻讬谉 of 诪讟诇讟诇讬谉. 专讘 讞住讚讗 讗诪专 讗讘讬诪讬, 专讘 讞住讚讗, in the name of 讗讘讬诪讬, said a different 驻砖讟 in the 诪砖谞讛 where it says, "讛注专讻讬谉 讛诪讟诇讟诇讬谉", that means 讚诪转驻讬住 诪讟诇讟诇讬谉 诇注专讻讬谉. If you grab onto 诪讟诇讟诇讬谉 for 注专讻讬谉, which means that if a person said, "注专讻讬 注诇讬", I give my 注专讱, or "I will give the 注专讱 of somebody else," which is the proper concept of 注专讱 because he said it concerning a human being. But then, when he was obligated to pay for that 注专讻讬谉, so he took a 诪讟诇讟诇讬谉 and he said that I designate this 诪讟诇讟诇讬谉 that this should be the payment for the 注专讻讬谉 that I owe. And this is what the 诪砖谞讛 says, that when the 讘讬转 讚讬谉 will come to take this 诪讟诇讟诇讬谉 for the sake of payment for his 注专讻讬谉, you would have to have three people to evaluate the value of that 诪讟诇讟诇讬谉. And the 讙诪专讗 asks, how 注专讻讬谉 讛诪讟诇讟诇讬谉? How can the 诪砖谞讛 use the 诇砖讜谉 注专讻讬谉 讛诪讟诇讟诇讬谉? It should have said 诪讟诇讟诇讬谉 砖诇 注专讻讬谉 诪讬讘注讬 诇讬讛, the 诪讟诇讟诇讬谉 of 注专讻讬谉, because that's really what it is. He made 注专讻讬谉, and now he has 诪讟诇讟诇讬谉 of that 注专讻讬谉 that he's going to pay with the 诪讟诇讟诇讬谉, and that's what the 诪砖谞讛 means. So it should have said 诪讟诇讟诇讬谉 砖诇 注专讻讬谉. The 讙诪专讗 answers, 转谞讬, learn 诪讟诇讟诇讬谉 砖诇 注专讻讬谉, that read it that way, this is what it really means, the 诪讟诇讟诇讬谉 of 注专讻讬谉. Then the 讙诪专讗 says 专讘 讗讘讛讜, 讗诪专 专讘 讗讘讛讜 says a different 转讬专抓, that what does the 诪砖谞讛 mean 注专讻讬谉 讛诪讟诇讟诇讬谉? 讘讗讜诪专, someone says 注专讻讬 注诇讬, my 注专讱 should be upon me, the regular case of 注专讻讬谉. 讘讗 讻讛谉 诇讙讘讜转 诪诪谞讜, when the 讻讛谉 comes to collect, because if the person himself does not pay for his donation, for his promise of 注专讻讬谉, then the 讻讛谉 would come and take things away from him as payment for his promise. So when the 讻讛谉 comes to collect, so if it's 诪讟诇讟诇讬谉, if the 讻讛谉 gets 诪讟诇讟诇讬谉 of this person to collect his debt, so then 讘砖诇砖讛. That's what the 诪砖谞讛 means, you will have to have three people evaluating the 诪讟诇讟诇讬谉 that will be taken as a payment for his 注专讻讬谉. But if it's 拽专拽注讜转, if what the 讘讬转 讚讬谉 will take, what the 讻讛谉 will take will be real estate, land, then 讘注砖专讛, you must have 10 people there to evaluate the value of the land. And that's what the 诪砖谞讛 means, 注专讻讬谉 讛诪讟诇讟诇讬谉 讘砖诇砖讛, that means that the 注专讻讬谉 that will be paid with 诪讟诇讟诇讬谉 that the 讻讛谉 will take away, you must have three people to evaluate. 讗诪专 诇讬讛 专讘 讗讞讗 诪讚驻转讬 诇专讘讬谞讗, 专讘 讗讞讗 诪讚驻转讬 said to 专讘讬谞讗, 讘砖诇诪讗 诇讗驻讜拽讬 诪讛拽讚砖 讘注讬谞谉 砖诇砖讛, 诪讬诇讗 we understand that when you come to take away from 讛拽讚砖, you must have three people to evaluate. That when something, an object is 讛拽讚砖, and then you want to redeem it from 讛拽讚砖, so what'll happen when you redeem it from 讛拽讚砖? You'll give the money to 讛拽讚砖 and the object goes to you, and the object is not 讛拽讚砖 anymore, it becomes 讞讜诇讬谉. So every time you redeem an object from 讛拽讚砖, you're taking it out of 讛拽讚砖, putting it into 讞讜诇讬谉. So there we understand that you have to have three people to evaluate, to make sure that you don't cheat 讛拽讚砖. 讗诇讗 诇注讬讜诇讬 诇讛拽讚砖 砖诇砖讛 诇诪讛 诇讬? But according to this last 驻砖讟, that the 诪讟诇讟诇讬谉 will be taken away as payment for the 注专讻讬谉, so what's happening here is that the 诪讟诇讟诇讬谉 is being made into 讛拽讚砖 now. Until now the 诪讟诇讟诇讬谉 belonged to the person, we want to take it away from him and turn it into 讛拽讚砖, and for that we need three people? Why should we need three people to make an object into 讛拽讚砖? What really he's saying is, that according to the first two 驻砖讟讬诐 in the 讙诪专讗 here, we understand why you need three people. According to the first 驻砖讟, when he said 注专讱 讻诇讬 讝讛 注诇讬, and we said that he has to have three people to evaluate, we understand why. Because when he said the 注专讱 of this 讻诇讬 is upon me, and we said that what he meant was the value of this 讻诇讬, so automatically the 讻诇讬 became 讛拽讚砖. Now, we want to know how much he has to pay to redeem it. That means that we have to see how much he has to pay to take it out of 讛拽讚砖, so then we know why we need three people. The same according to the second 驻砖讟, when a person said 注专讻讬 注诇讬, and then he was 诪转驻讬住 the 诪讟诇讟诇讬谉 for the payment, that he said, let this 诪讟诇讟诇讬谉 be the payment for my 注专讱. So when he said that, the 诪讟诇讟诇讬谉 became 讛拽讚砖 as payment for his 注专讱. Now, when he comes to pay to redeem for those 诪讟诇讟诇讬谉, he is trying to take the 诪讟诇讟诇讬谉 out of 讛拽讚砖, so we understand why we need three people. But according to this last 驻砖讟, that it means that he didn't designate the 诪讟诇讟诇讬谉 for 讛拽讚砖, the 诪讟诇讟诇讬谉 are his, he just said 注专讻讬 注诇讬, then the 讻讛谉 comes to take the 诪讟诇讟诇讬谉 away, and that's when we need three people, when he takes it away from the person and gives it to 讛拽讚砖. So in this case we need the three people to take it away from him to turn it into 讛拽讚砖. And that's his question, why should we need three people to turn an object into 讛拽讚砖? 讗诪专 诇讬讛, so he said to him, 住讘专讗 讛讜讗, it's a logical 住讘专讗. 诪讛 诇讬 注讜诇讬, 诪讛 诇讬 讗驻讜拽讬, what difference does it make whether we want to bring something into 讛拽讚砖 or we want to take something out of 讛拽讚砖? 讗驻讜拽讬 诪讗讬 讟注诪讗? What is the reason when we want to take something out of 讛拽讚砖 we need three people? 讚讬诇诪讗 讟注讜, just in case they might make a mistake. The person might pay less than the value of the object, and he will be cheating 讛拽讚砖, and that's why we have to have three people for the evaluation. 注讬讜诇讬 谞诪讬 讚讬诇诪讗 讟注讜, when we take it into 讛拽讚砖, we're also afraid they might make a mistake. You might evaluate it wrong, and you might think the object is worth more than it really is, is, and then you'll be cheating 讛拽讚砖, because 讛拽讚砖 will be taking the object thinking that this is worth the full amount when it really isn't. And therefore, even for bringing it into 讛拽讚砖, you must have three people. Then the 讙诪专讗 continues, it said in the 诪砖谞讛, 专讘讬 讬讛讜讚讛 讗讜诪专, 专讘讬 讬讛讜讚讛 says, 讜讻讜诇讬, which means that 专讘讬 讬讛讜讚讛 said when you come to evaluate the 讛拽讚砖, you must have one 讻讛谉 amongst them. By 诪讟诇讟诇讬谉, when we said that you have to have three people to evaluate, you must have one of the three a 讻讛谉. By 拽专拽注讜转, when you have to have 10 people to evaluate, you must have one of the 10 a 讻讛谉. The 讙诪专讗 asks, 讗诪专 诇讬讛 专讘 驻驻讗 诇讗讘讬讬, 专讘 驻驻讗 said to 讗讘讬讬, 讘砖诇诪讗 诇专讘讬 讬讛讜讚讛, 诪讬诇讗 according to 专讘讬 讬讛讜讚讛, who says that there must be a 讻讛谉 amongst them, 讛讬讬谞讜 讚讻转讬讘 讻讛谉. So that is the reason why the 转讜专讛 mentions 讻讛谉, and the 转讜专讛 says that when you'll come to evaluate, the 转讜专讛 refers to a 讻讛谉, because there has to be at least one 讻讛谉 amongst them. 讗诇讗 诇专讘谞谉, but according to the 专讘谞谉, which is the previous opinion, that doesn't mention a 讻讛谉, so obviously the 专讘谞谉 hold that you do not need a 讻讛谉, one of those who evaluate, so the question is 讻讛谉 诇诪讛 诇讛讜? Why does the 转讜专讛 have to write 讻讛谉 if there is no need for a 讻讛谉? And the 讙诪专讗 says, 拽砖讬讗, this is a question that remains unanswered. Then the 讙诪专讗 continues, 讛拽专拽注讜转 转砖注讛 讜讻讛谉, it said in the 诪砖谞讛 that when you come to evaluate 拽专拽注讜转, real estate, you have to have nine people with one 讻讛谉, together 10, but of the 10, one has to be a 讻讛谉. The 讙诪专讗 says, 诪谞讗 讛谞讬 诪讬诇讬? How do we know that? In this 驻专砖讛 that deals with 讛拽讚砖. And as we learned in the previous 讚祝, that in the 驻专砖讛 of 讛拽讚砖 there are three portions: one is the 驻专砖讛 of 注专讻讬谉, then the second 驻专砖讛 is of 驻讚讬讜谉 讘讛诪讛, and the third 驻专砖讛 is of 拽专拽注讜转. And we have three times the word 讻讛谉 in the 驻专砖讛 of 注专讻讬谉, three times the word 讻讛谉 in the 驻专砖讛 of 驻讚讬讜谉 讘讛诪讛, and we have four times the word 讻讛谉 in the 驻专砖讛 of 拽专拽注讜转. So together we have 10 times the word 讻讛谉, and therefore we have to have 10 people, and one of them has to be a 讻讛谉. Why only one of them a 讻讛谉? So he explains, because when the 转讜专讛 says 10 times the word 讻讛谉, 讞讚 诇讙讜驻讬讛, one is for itself. The first time it says 讻讛谉, that teaches us that you have to have a 讻讛谉. Now 讛谞讱, the rest, the next time it says 讻讛谉, 讛讜讛 诪讬注讜讟 讗讞专 诪讬注讜讟, that's an exemption of an exemption, a 诪讬注讜讟 after a 诪讬注讜讟. And the rule is, 讗讬谉 诪讬注讜讟 讗讞专 诪讬注讜讟 讗诇讗 诇专讘讜转, that whenever the 转讜专讛 writes a 诪讬注讜讟 after a 诪讬注讜讟, it comes to include. When the 转讜专讛 writes an expression which seems to exclude, so that if it says once, it excludes, but if the 转讜专讛 writes that expression twice, so it's an exclusion after an exclusion, so we say that this does not come to exclude, but it comes to include. As the general rule that two negatives make a positive, so when the 转讜专讛 writes two times something that excludes a certain thing, we know what the 转讜专讛 really means is to include. And therefore, here too: the first time it says 讻讛谉, so that means a 讻讛谉, so you have to have a 讻讛谉. Then the 转讜专讛 writes again 讻讛谉 and again 讻讛谉, so then it's already a 诪讬注讜讟 after a 诪讬注讜讟, because the word 讻讛谉 excludes, it excludes a 讬砖专讗诇, it has to be only a 讻讛谉, not a 讬砖专讗诇. So when the 转讜专讛 excludes it twice, so it's really 诇专讘讜转, it comes to include. So really what it comes to tell us that you don't need a 讻讛谉, but a 讬砖专讗诇 is also good. And therefore, all the other nine times that the 转讜专讛 says 讻讛谉, they're all in the category of a 诪讬注讜讟 after a 诪讬注讜讟, after a 诪讬注讜讟, after a 诪讬注讜讟. So therefore we say that they all come to include that you don't need only a 讻讛谉, a 讬砖专讗诇 is also good. So it comes out that we need nine 讬砖专讗诇讬诐, because nine times the word 讻讛谉 later and they are 诪专讘讛 a 讬砖专讗诇, so you have to have nine 讬砖专讗诇讬诐, and the first time, which is not the 诪讬注讜讟 讗讞专 诪讬注讜讟, remains as the simple 驻砖讟, which means 讻讛谉, you must have one 讻讛谉. So it comes out that 讗驻讬诇讜 转砖注讛 讬砖专讗诇 讜讗讞讚 讻讛谉, even if you have nine 讬砖专讗诇 and one 讻讛谉, is good enough. 诪转拽讬祝 诇讛 专讘 讛讜谞讗 讘专讬讛 讚专讘 谞转谉, but 专讘 讛讜谞讗 讘专讬讛 讚专讘 谞转谉 asked a question: 讗讬诪讗, let us say, 讞诪砖讛 讻讛谞讬诐 讜讞诪砖讛 讬砖专讗诇讬诐, maybe we have to have five 讻讛谞讬诐 and five 讬砖专讗诇讬诐, because he learns like this: the first time it says 讻讛谉, you need a 讻讛谉. The second time it says 讻讛谉, that is a 诪讬注讜讟 讗讞专 诪讬注讜讟, so that comes to include a 讬砖专讗诇. Now the third time it says 讻讛谉, that starts all over again, because now we already included a 讬砖专讗诇. So why does the 转讜专讛 write again 讻讛谉? Obviously the 转讜专讛 wants to teach us that you have to have a 讻讛谉. Then when the 转讜专讛 writes a fourth time 讻讛谉, that's already a 诪讬注讜讟 after the third 讻讛谉, so it's a 诪讬注讜讟 讗讞专 诪讬注讜讟. So now it comes to include a 讬砖专讗诇. Then we're finished, the 转讜专讛 writes a fifth time 讻讛谉, so now we start all over again, that now the 转讜专讛 means a 讻讛谉. And then the sixth time would come to include a 讬砖专讗诇, and that's how it would go on. So it would come out that the first and the third and the fifth and the seventh, and the ninth word 讻讛谉, and they should all mean a 讻讛谉 诪诪砖. But the second, and the fourth, and the sixth, and the eighth, and the tenth, they're each a 诪讬注讜讟 after the 诪讬注讜讟, they should come to include a 讬砖专讗诇. So it should come out that from this 驻专砖讛 we should learn that you have to have five 讻讛谞讬诐 and five 讬砖专讗诇讬诐. And 诇驻讜注诇 we say that nine 讬砖专讗诇讬诐 and one 讻讛谉 is enough, because we learn that all nine times the word 讻讛谉 are considered a 诪讬注讜讟 讗讞专 诪讬注讜讟. But his question is, maybe we shouldn't consider it that way, we should only consider the each two as 诪讬注讜讟 讗讞专 诪讬注讜讟. And the 讙诪专讗 says 拽砖讬讗, this is a 拽砖讬讗, a question which is not answered. Then the 讙诪专讗 continues, 讜讗讚诐 讻讬讜爪讗 讘讛谉, that when you come to evaluate the value of an 讗讚诐 for 讛拽讚砖, you also have the same 讚讬谉 like the previous cases. The 讙诪专讗 asks, 讗讚诐 诪讬 拽讚讬砖? Is an 讗讚诐 holy? Is there such a thing as a person becoming 拽讚讜砖, that we should say that when you evaluate the 讗讚诐, you must have a certain amount of people? A person, a human being cannot become 讛拽讚砖. 讗诪专 专讘 讗讘讛讜, so 专讘 讗讘讛讜 said, 讘讗讜诪专 讚诪讬 注诇讬. The case is when a person says 讚诪讬 注诇讬, that means my value upon me. But he doesn't use the 诇砖讜谉 注专讻讬, then he would have to pay a fixed amount that the 转讜专讛 prescribes. But he used the 诇砖讜谉 讚诪讬 注诇讬. So then the 讚讬谉 is, 讚转谞讬讗 we learned, 讛讗讜诪专 讚诪讬 注诇讬, if someone says 讚诪讬 注诇讬, my value is upon me, 砖诪讬谉 讗讜转讜 讻注讘讚 讛谞诪讻专 讘砖讜拽. You evaluate him as the in the price of a slave that is sold in the market. You look at him, how much would he be worth if he would be sold as a slave in the market, and that's how much he has to give to 讛拽讚砖. So since the value of a person depends on the price of him being sold as a slave, 注讘讚 讗讬转拽砖 诇拽专拽注讜转, and we have a rule that 注讘讚讬诐, slaves, 讙讜讬讬砖注 slaves are compared to 拽专拽注, to land. Because there is a 驻住讜拽 that says concerning 讙讜讬讬砖注 slaves, 讜讛转谞讞诇转诐 讗讜转诐 诇讘谞讬讻诐 讗讞专讬讻诐 诇讗讞讜讝转 注讜诇诐, that you should inherit them to your children. So the 转讜专讛 uses the concept of inheritance concerning slaves, the same 诇砖讜谉 as we find concerning 拽专拽注. So therefore we say that many of the 讚讬谞讬诐 that refer apply to 拽专拽注 apply to slaves also. So just like by 拽专拽注 we said that you have to have ten people to evaluate, so by a slave also. And a person who says 讚诪讬 注诇讬, since his value depends on his price as a slave, so he also needs ten people to evaluate his value when he pays his value to 讛拽讚砖. But 转讜住驻讜转 asks a 拽砖讬讗, what's the 讙诪专讗's question? 讗讚诐 诪讬 拽讚讬砖, can a person be 拽讚讜砖? Yes! Why can't we say we're talking about an 注讘讚 himself, that if a person is 诪拽讚讬砖 an 注讘讚, a person owns an 注讘讚 and he says let this 注讘讚 be 注讘讚 be 讛拽讚砖? And we know the 讙诪专讗 says in 驻专拽 讛砖讜诇讞, that if somebody is 诪拽讚讬砖 his property and amongst them were 注讘讚讬诐, so then the 讙讝讘专讬诐 of 讛拽讚砖, the treasurers of 讛拽讚砖 have no right to set them free. But what we see from there is that the 注讘讚讬诐 do become 讛拽讚砖, they belong to 讛拽讚砖. And we see later on from the 讙诪专讗 here too, there's a question concerning the hair as we will see, what we see from this 讙诪专讗 too that 注讘讚讬诐 can be 讛拽讚砖, and maybe that's what the 讙诪专讗 the 诪砖谞讛 means when it says that an 讗讚诐 is the same as 拽专拽注. Maybe it means when you are 诪拽讚讬砖 an 讗讚诐, an 注讘讚. So what is the 讙诪专讗's question, 讗讚诐 诪讬 拽讚讬砖? Can 讗讚诐 be holy? Sure an 讗讚诐 could be holy, an 注讘讚 can become 讛拽讚砖. And 转讜住驻讜转 answers that the word 讗讚诐 is not 诪砖诪注 that it means an 注讘讚, it would have said 注讘讚讬诐. When it says 讗讚诐, it usually doesn't mean an 注讘讚. Plus 转讜住驻讜转 says it's possible that here the 讙诪专讗 asks according to 专讘 who holds that if somebody is 诪拽讚讬砖 his 注讘讚, he automatically goes out free. And therefore, there is no such thing as being 诪拽讚讬砖 an 注讘讚. Now according to 专讘, the question will be: What does the 诪砖谞讛 mean 讗讚诐? And according to that we have to answer that we mean when a person says 讚诪讬 注诇讬, we have to have ten people to evaluate his value before he pays to 讛拽讚砖. A person is 诪拽讚讬砖 the hair, but hair that's long and is ready to be cut, so how many people do you have to have to evaluate that? Do we say 讻讙讜讝讝 讚诪讬 讜讘砖诇砖讛, that it's like it's cut already? Since it's ready to be cut, it's as if it's cut already, and if it's cut it is 诪讟诇讟诇讬谉, and therefore three would be enough like 诪讟诇讟诇讬谉. Because we do have a rule sometimes, 讻诇 讛注讜诪讚 诇讙讝讜讝 讻讙讝讜讝 讚诪讬, anything that's ready to be cut it's as if it's cut. So therefore this hair would be considered 诪讟诇讟诇讬谉, and three would be enough. 讗讜 讻诪讞讜讘专 讚诪讬 讜讘注砖专讛, or since it's still connected to the person, and by a person we said you have to have ten people to evaluate, so the hair which is connected to the person, you would also have to have ten people to evaluate. And hair definitely has a value, as 专砖''讬 says there are certain things you could make with human hair. And if the person was 诪拽讚讬砖 his hair, the question is how many people do you have to have to evaluate that? And the 讙诪专讗 says, 转讗 砖诪注, come and hear, I'll answer your question. We learned in a 讘专讬讬转讗, 讛诪拽讚讬砖 讗转 注讘讚讜, if someone makes his 注讘讚 讛拽讚砖, 讗讬谉 诪讜注诇讬谉 讘讜, you are not 诪讜注诇 So like this, if somebody has use from an object that belongs to 讛拽讚砖, he is

Misuse Laws Apply Only to Movable Property

诪讜注诇 讘讛拽讚砖, and there are certain 讚讬谞讬诐 that apply, 拽专讘谞讜转 he has to bring, etc. So if a person is 诪拽讚讬砖 his 注讘讚, you are not 诪讜注诇, and the reason is because we know that this 讚讬谉 of 诪注讬诇讛 does not apply to 拽专拽注讜转. Only if you are 诪讜注诇 in an object, in a 诪讟诇讟诇讬谉, in a in a movable object, that's when the 讚讬谉 of 诪注讬诇讛 applies. But if you are 诪讜注诇, you have use from 讛拽讚砖, from 拽专拽注, from real estate of 讛拽讚砖, then the 讚讬谉 of 诪注讬诇讛 does not apply. And therefore he says the same, if someone is 诪拽讚讬砖 his 注讘讚, and his 注讘讚 is 讛拽讚砖, you are not 诪讜注诇 in that because the 注讘讚 has a 讚讬谉 of 拽专拽注. 讟讗拽注, in the 注讘讚 himself you are not 诪讜注诇 because he is like 拽专拽注, but if you have use from his hair, you are 诪讜注诇. 讜拽讬讬诪讗 诇谉, and we understand, we know, 讚讘砖注专讜 讛注讜诪讚 诇讙讝讝 驻诇讬讙讬, that the 诪讞诇讜拽转 is here between 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 and the first 转谞讗 is concerning hair which is ready to be cut. If the hair is not ready to be cut, then everyone would agree that you are not 诪讜注诇, because this is part of the 注讘讚, and the 注讘讚 is like 拽专拽注. The 诪讞诇讜拽转 is, since the hair is ready to be cut, so the 转谞讗 拽诪讗 holds that you are not 诪讜注诇 in the hair either, because he holds, even if it's ready to be cut, it's still not cut and therefore has a 讚讬谉 of 拽专拽注. 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 says you are 诪讜注诇 in the hair because he holds since it's ready to be cut, it's considered as if it's cut, and it's 诪讟诇讟诇讬谉, and therefore you are 诪讜注诇. 砖诪注 诪讬谞讛, so from here we see the answer to the question.

How Many Witnesses for Hair Evaluation?

His question was whether you need 10 people or three people to evaluate the hair that is ready to be cut. So now we see this is a 诪讞诇讜拽转 between 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 and 转谞讗 拽诪讗. According to 转谞讗 拽诪讗 who holds that you are not 诪讜注诇 in the hair even if it's ready to be cut, because it's still like 拽专拽注, so by the case of the people that we need to evaluate, he would hold you would need 10 to evaluate. And 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 holds that you are 诪讜注诇 in the hair when it's ready to be cut because it's 诪讟诇讟诇讬谉, he will hold that you only need three people to evaluate the hair. Then the 讙诪专讗 says, 谞讬诪讗, let us say, 讛谞讬 转谞讗讬 讻转谞讗讬, that the 诪讞诇讜拽转 between 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 and 转谞讗 拽诪讗 is the same 诪讞诇讜拽转 as other 转谞讗讬诐 who argue. 讚转谞谉, because they learned in the 诪砖谞讛, 专讘讬 诪讗讬专 讗讜诪专, 专讘讬 诪讗讬专 says, 讬砖 讚讘专讬诐 砖讛谉 讻拽专拽注 讜讗讬谞谉 讻拽专拽注, there are certain things which are like 拽专拽注, which really are 拽专拽注, but in 讛诇讻讛 they don't have the 讚讬谉 of 拽专拽注. 讜讗讬谉 讞讻诪讬诐 诪讜讚讬诐 诇讜, but the 讞讻诪讬诐 are not 诪讜讚讛 to him. They argue and they say that they do have a 讚讬谉 of 拽专拽注. 讻讬爪讚,

Vine Dispute: Oath Requirement for Partial Claims

what is the 讚讬谉? What case is it? 注砖专 讙驻谞讬诐 讟注讜谞讜转 诪住专转讬 诇讱, if one person says to another that, "I gave you 10 full vines of grapes," 讜讛诇讛 讗讜诪专, and he says to him, 讗讬谞谉 讗诇讗 讞诪砖, "You only gave me five, and I only owe you five." So if this wouldn't be concerning vines, it would be concerning money for instance, then the 讚讬谉 is that 诪讜讚讛 讘诪拽爪转 讞讬讬讘 砖讘讜注讛. If somebody denies half and admits to half, or denies part and admits to part, he is 讞讬讬讘 a 砖讘讜注讛. So the 讚讬谉 would be that the person would have to swear that he only owes him five. But then there is also a 讚讬谉 that by 拽专拽注 you don't swear. If the same thing happens by 拽专拽注, if two people argue and he says, "You owe me this amount of 拽专拽注," and he says, "I only own you owe you part of it," so the 讚讬谉 is that he doesn't have to swear because by 拽专拽注 you don't swear. So here we have a case where he said, "You owe me 10 讙驻谞讬诐 讟注讜谞讜转, 10 full vines of grapes," and he says, "I only owe you five." 专讘讬 诪讗讬专 诪讞讬讬讘, 专讘讬 诪讗讬专 says you are 讞讬讬讘 a 砖讘讜注讛. 讜讞讻诪讬诐 讗讜诪专讬诐, the 讞讻诪讬诐 say, no, 讻诇 讛诪讞讜讘专 诇拽专拽注 讛专讬 讻拽专拽注, anything that's connected to the ground is like 拽专拽注. And since he argues over things which are connected to the ground, therefore you are 驻讟讜专, because the argument between the two is over 拽专拽注, and by 拽专拽注 there is no 讚讬谉 of a 砖讘讜注讛. 讜讗诪专 专讘讬 讬讜住讬 讘专 讞谞讬谞讗, and 专讘讬 讬讜住讬 讘专 讞谞讬谞讗 said, 讘注谞讘讬诐 讛注讜诪讚讜转 诇讬讘爪专 注住拽讬谞谉, that we're talking here in a case where the grapes were ready to be gathered to be taken off the vines. And the 诪讞诇讜拽转 between them is, 诪专 住讘专, our one holds, 讻讘爪讜专讜转 讚诪讬, it's as if it's cut off. 专讘讬 诪讗讬专 holds that since it's ready to be taken off, so we consider them as if they were taken off already, so they are not 拽专拽注 anymore. So therefore the 讚讬谉 is that he is a 诪讜讚讛 讘诪拽爪转 who has to swear. 讜诪专 住讘专, one holds, the 讞讻诪讬诐 hold, 诇讗讜 讻讘爪讜专讜转 讚诪讬讬谉, they are not as if they were already taken off, gathered. And therefore they are still considered 拽专拽注, and by 拽专拽注 there is no 讚讬谉 of a 砖讘讜注讛. So it seems as if that this 诪讞诇讜拽转 between these 转谞讗讬诐 is the same 诪讞诇讜拽转 as the 转谞讗讬诐 before. Just like we had before a 诪讞诇讜拽转 between 专讘谉 砖诪注讜谉 讘谉 讙诪诇讬讗诇 and the 讞讻诪讬诐 whether, when you're 诪拽讚讬砖 an 注讘讚, if you are 诪讜注诇 in the hair that's ready to be cut off, and the 诪讞诇讜拽转 was whether we consider that hair as if it's cut off already or not, seems to be the same 诪讞诇讜拽转 as here, that the grapes are ready to be taken off the vines, are they considered as if they are taken off already or not? And the 讙诪专讗 says, 诇讗, no, 讗驻讬诇讜 转讬诪讗 专讘讬 诪讗讬专, 讘讗诪转 you could say, in the previous 诪讞诇讜拽转 would also go according to 专讘讬 诪讗讬专. In other words, that even 专' 诪讗讬专, who holds in this 诪讞诇讜拽转 concerning the grapes that you are 讞讬讬讘, because he holds it's as if it was taken off already, nevertheless, by the hair, he might hold that it's not considered as if it's taken off. Why? Because 注讚 讻讗谉 诇讗 拽讗诪专 专' 诪讗讬专, only 专' 诪讗讬专 says here, 讛转诐 in the case of the grapes, because 讻诇 讻诪讛 讚砖讘拽讬讛, as long as you will leave it, 诪讻讞砖 讻讞讬砖, it'll get weaker. In other words, it'll deteriorate by staying on the vines, and therefore we consider it as if it's taken off because a person normally would definitely take it off. 讗讘诇 讛讻讗, but in the case of the hair, 讻诇 讻诪讛 讚砖讘拽讬讛, 诇讗砖讘讜讞讬 诪砖讘讞, as long as you leave it, the more you leave it, the better it will be. And therefore there, since it is not necessary to take it off, he could leave it, so there 诇讗讜 讚讜拽讗 that we say that it is considered as if it's taken off already. Then the 讙诪专讗 continues to quote from the 诪砖谞讛: 讚讬谞讬 谞驻砖讜转 讜讻讜诇讬, it said in the 诪砖谞讛 that when it comes to judge capital punishment, that it comes through 23, you have to have a 讘讬转 讚讬谉 of 23. 讛专讜讘注 讜讛谞专讘注, it said in the 诪砖谞讛, 讘注砖专讬诐 讜砖诇砖讛. If someone has relations with an animal, then the 讚讬谉 is that you have to kill the animal and the person, so also you have to have 23 people to judge the person and to judge the animal. So the

23 Judges for Human鈥慉nimal Relations: Gender Issue

讙诪专讗 says: 拽驻住讬拽 讜转谞讬, you're saying it in a very clear-cut way, 诇讗 砖谞讗 专讜讘注 讝讻专 讜诇讗 砖谞讗 专讜讘注 谞拽讘讛, that there's no difference whether the 注讘讬专讛 with the animal was done through a male or it was done through a female. In both cases, it has to be through 23. And the 讙诪专讗's question is: 讘砖诇诪讗 专讜讘注 谞拽讘讛, we understand if the person is the female that is doing the 注讘讬专讛 with the animal, we understand why the animal also has to have 23 for its judgment, 讚讻转讬讘 because the 驻住讜拽 says: 讜讛专讙转 讗转 讛讗砖讛 讜讗转 讛讘讛诪讛, you should kill the woman and the 讘讛诪讛. If a woman has relations with a 讘讛诪讛, the 驻住讜拽 says you should kill the woman and the 讘讛诪讛. So the 转讜专讛 compares them both, so we understand that just like to kill the woman you must have a 讘讬转 讚讬谉 of 23, to kill the 讘讛诪讛 you also must have a 讘讬转 讚讬谉 of 23. 讗诇讗 专讜讘注 讝讻专, but if the male did the 注讘讬专讛 with the 讘讛诪讛, 诪谞诇谉? How do we know that in order to kill the 讘讛诪讛 you also have to have a 讘讬转 讚讬谉 of 23? And as it seems, the main question of the 讙诪专讗 is only in the case where the male is the 谞砖讻讘, because concerning a male doing an 注讘讬专讛 with a 讘讛诪讛, there are two possibilities: you could have the male being the active participant, he is the 砖讜讻讘, he is the one that's doing it with the 讘讛诪讛; or he could be the 谞砖讻讘, he could be the one that's bringing the 讘讛诪讛 upon him. So in the case where he is the 砖讜讻讘, he is the one that is actively participating in this 注讘讬专讛, then the 讙诪专讗 wouldn't have a question, how do we know that the 讘讛诪讛 also has to have a 讘讬转 讚讬谉 of 讻"讙? Because we have a 驻住讜拽 for that, too. Because in the same place where we have a 驻住讜拽 concerning the woman where it says 讜讛专讙转 讗转 讛讗砖讛 讜讗转 讛讘讛诪讛, 诪讜转 讬讜诪转讜 讚诪讬讛诐 讘诐, and we learn out from that 驻住讜拽 that just like the woman needs 讻"讙, so does the 讘讛诪讛, the 驻住讜拽 before that says: 讜讗讬砖 讗砖专 讬转谉 砖讻讘转讜 讘讘讛诪讛 诪讜转 讬讜诪转 讜讗转 讛讘讛诪讛 转讛专讙讜. If a person will lay with a 讘讛诪讛, he should get killed and you should kill the 讘讛诪讛. So here too the 转讜专讛 compares the 讘讛诪讛 to the man. So we say that just like the man needs a 讘讬转 讚讬谉 of 23, so does the 讘讛诪讛 need a 讘讬转 讚讬谉 of 23. So that wouldn't be a question, how do we know that the 讘讛诪讛 also needs a 讘讬转 讚讬谉 of 23? The main question is in the case where the man is not the 砖讜讻讘, but the 谞砖讻讘, the man brings the 讘讛诪讛 upon him. And that is not included in this 驻住讜拽, because this 驻住讜拽 just said 讜讗讬砖 讗砖专 讬转谉 砖讻讘转讜 讘讘讛诪讛, he is the 砖讜讻讘, he is doing the act with the 讘讛诪讛. So there we know that he needs 讻"讙 for the 讘讛诪讛, but how do we know that even in the case where the person brings the 讘讛诪讛 upon him, you also need 讻"讙 for the 讘讛诪讛? And that's what the 讙诪专讗 says: 讚讻转讬讘, because there's another 驻住讜拽 in 驻专砖转 诪砖驻讟讬诐, it says: 讻诇 砖讜讻讘 注诐 讘讛诪讛 诪讜转 讬讜诪转, that anybody who lays with a 讘讛诪讛 should die. Now the question is, this 驻住讜拽 is extra. To say that a person has to die, we know from this 驻住讜拽 as we just brought, where it says 讜讗讬砖 讗砖专 讬转谉 砖讻讘转讜 讘讘讛诪讛 诪讜转 讬讜诪转, so we know that if a person does an 注讘讬专讛 with a 讘讛诪讛, he has to die. So why does the 驻住讜拽 in 驻专砖转 诪砖驻讟讬诐 have to say this 驻住讜拽, 讻诇 砖讜讻讘 注诐 讘讛诪讛 诪讜转 讬讜诪转? And we have a 讻诇诇, that whenever we have a 驻住讜拽 that is extra, so we use the 讻诇诇 of 讗诐 讗讬谞讜 注谞讬谉, which means that if it cannot be used for the 讚讬谉 that it seems to be saying, we use it for another 讚讬谉. 讗诐 讗讬谞讜 注谞讬谉 to this, 转谞讛讜 注谞讬谉, give it to something else, and that's what we do here. And we answer: 讗诐 讗讬谞讜 注谞讬谉 诇砖讜讻讘, if we don't need this 驻住讜拽 to tell us that if a person is the active participant in the 注讘讬专讛 that he gets killed, so if you don't need the 驻住讜拽 for that, 驻谞讛讜 注谞讬谉 诇谞砖讻讘. So let's use this 驻住讜拽 for a 谞砖讻讘, in the case where he is not actively participating, but he is bringing the 讘讛诪讛 upon himself, that's what the 驻住讜拽 means. But the question is, if that's what the 驻住讜拽 means, why did the 驻住讜拽 use the 诇砖讜谉 讜讗讬砖 讗砖专--he is not doing the act, but bringing the upon him, so why did the 转讜专讛 write it in such a 诇砖讜谉, which seems to be saying that he is the 砖讜讻讘? And therefore we say, 讜讗驻拽讬讛 专讞诪谞讗 讘诇砖讜谉 砖讜讻讘, the 转讜专讛 used, concerning the 谞砖讻讘, the 诇砖讜谉 of the 砖讜讻讘, 诇讗拽讜砖讬 谞砖讻讘 诇砖讜讻讘, to compare the 谞砖讻讘 to the 砖讜讻讘, to say, 诪讛 砖讜讻讘, just like in the case where he is a 砖讜讻讘, where he is the active participant, the 讚讬谉 is that 讛讜讗 讜讘讛诪转讜 讘注砖专讬诐 讜砖诇砖讛, that he and the 讘讛诪讛 have to have a 讘讬转 讚讬谉 of 23, 讗祝 谞砖讻讘, so too, in the case where he is a 谞砖讻讘, where he doesn't do the act, he brings the 讘讛诪讛 upon himself, also 讛讜讗 讜讘讛诪转讜 讘注砖专讬诐 讜砖诇砖讛, he and his 讘讛诪讛 need 23. So therefore, we have both here. The 转讜专讛 means the case of the 谞砖讻讘, but refers to it in the expression of a 砖讜讻讘 to tell us that the 讚讬谉 of the 谞砖讻讘 is exactly like the 讚讬谉 of the 砖讜讻讘. And just like by the 砖讜讻讘, we are sure that you have to have 23 because the 转讜专讛 says 讘驻讬专讜砖 as the 讘讛诪讛 转讛专讜讙讜 together with the person, as we said before, from there we know that the 讘讛诪讛 also needs 23, so the case of the 谞砖讻讘, we also learn that you have to have 23. Then the 讙诪专讗 continues and quotes from the 诪砖谞讛: 砖讜专 讛谞住拽诇 讘注砖专讬诐 讜砖诇砖讛. It said in the 诪砖谞讛 that when you stone an ox, you have to have a 讘讬转 讚讬谉 of 23. This refers to an ox that killed a person. So the 讚讬谉 is that this ox has to be killed, has to be stoned. So you have to have a 讘讬转 讚讬谉 of 23 to judge the ox and then to stone him. The 讙诪专讗 says, 砖谞讗诪专, how do we know that? Because the 驻住讜拽 says, 讛砖讜专 讬住拽诇 讜讙诐 讘注诇讬讜 讬讜诪转. It says you should stone the ox and also his master should die. So we say, what does the 转讜专讛 mean? 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专, that just like if you would have to kill the owner, if the owner would have done such an 注讘讬专讛 that he should have been killed for, then you would have to have 23, so too, when you stone the ox, when you kill the ox, you also have to have 23. In other words, the 驻住讜拽 doesn't really mean that if an ox kills a person, the master of the ox has to get killed also. What it means to say is that you kill the ox in the same fashion as you would kill his owner if the owner would have deserved 诪讬转讛. That means that just like the owner would need a 讘讬转 讚讬谉 of 23, so does the ox need a 讘讬转 讚讬谉 of 23. 讗诪专 诇讬讛 讗讘讬讬 诇专讘讗, 讗讘讬讬 said to 专讘讗, 诪诪讗讬, how do you know 讚讛讗讬 讜讙诐 讘注诇讬讜 讬讜诪转 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专 讛讜讗 讚讗转讗, that this 驻住讜拽 where it says 讜讙诐 讘注诇讬讜 讬讜诪转, that also his owner should die, comes to teach us this 讚讬谉 that just like when you kill a person, you have to have 23, so when you kill the 砖讜专 you also have to have 23, 讗讬诪讗, maybe what it means to say, 诇拽讟诇讗 讛讜讗 讚讗转讗, it actually means to tell us that you have to kill the owner, and if an ox kills a person, so you'll have to kill the owner, too? Why do we have to change the 驻砖讜讟 驻砖讟 of the 驻住讜拽? The 驻砖讜讟, the words of the 驻住讜拽 mean very simple, 讜讙诐 讘注诇讬讜 讬讜诪转, that also his owner should die, which means that you have to kill the owner. So why do we say that that's not what the 驻住讜拽 means and he doesn't have to be killed? And what the 驻住讜拽 means, it comes to teach us that you have to have a 讘讬转 讚讬谉 of 23 to kill the ox. The 讙诪专讗 says, 讗诐 讻谉, if it would be so, that the 驻住讜拽 would actually mean that you kill the owner, 诇讬讻转讜讘, let the 驻住讜拽 say 讜讙诐 讘注诇讬讜, and also his master, 讜诇讬砖转讜拽, and be quiet, and not say the word 讬讜诪转, to die. If the 驻住讜拽

would say 讛砖讜专 讬住拽诇, stone the ox, 讜讙诐 讘注诇讬讜, and also his master, so we understand that his master also dies. Why does the 转讜专讛 have to add the word 讬讜诪转? Obviously, the 转讜专讛 comes to teach us a 讚讬谉 in the 讚讬谉 of 诪讬转讛 of the 砖讜专. But the 讙诪专讗 says, 讗讬 讻转讘 专讞诪谞讗 讛讻讬, if the 转讜专讛 would write like that, without the word 讬讜诪转, just write 讜讙诐 讘注诇讬讜, 讛讜讛 讗诪讬谞讗 讘住拽讬诇讛, I would think that the owner also has to get 住拽讬诇讛. If the 转讜专讛 would just say that you stone the ox and also the master, we would say that the master has to get 住拽讬诇讛. But now that the 转讜专讛 says the word 讬讜诪转, it means not 住拽讬诇讛, because the 讻诇诇 is wherever the 转讜专讛 says a person should die and doesn't specify what kind of death, it is 讞谞拽, it is choking. So maybe really what the 驻住讜拽 means that the person should die, and the reason the 转讜专讛 writes the word 讬讜诪转 to teach us that the way the owner dies is through choking, but if the 转讜专讛 would not have written the word 讬讜诪转, we would say that the owner has to be stoned. So could be that really the 驻住讜拽 means that the person should die. But the 讙诪专讗 says, 讘住拽讬诇讛 住诇拽讗 讚注转讱? What are you telling me? That if the 转讜专讛 wouldn't write the word 讬讜诪转, we would think that the owner gets 住拽讬诇讛? How could you even think so? How could you have such an 讛讜讛 讗诪讬谞讗? 拽讟诇 讗讬讛讜, if he himself would have killed a person, 讘住讬祝, he would get killed through a sword, 诪诪讜谞讜, if his money, his property killed somebody, 讘住拽讬诇讛? He should get 住拽讬诇讛? Since 住拽讬诇讛 is worse, stricter than 住讬讬祝, so it makes no sense that if an ox killed a person, his owner should get 住拽讬诇讛. If the person himself would have killed a person, he wouldn't have got 住拽讬诇讛, he would have got 住讬讬祝. So certainly, if his ox only killed somebody, even if he does deserve to die, it shouldn't be 住拽讬诇讛. So therefore, even if the 转讜专讛 would not have written the word 讬讜诪转, we would have known that he doesn't get 住拽讬诇讛. So we can't say that the reason the 转讜专讛 writes the word 讬讜诪转 is in order to tell us that he doesn't get 住拽讬诇讛, because we would never think so. So we're back to the question, why does the 转讜专讛 Torah write the word 讬讜诪转? Obviously the Torah wants to teach us that he doesn't really die, we just have to compare the death of the person and the death of the ox. But then the 讙诪专讗 says, no, 讜讚讬诇诪讗, maybe 讛讗讬 讚讻转讘 专讞诪谞讗 讬讜诪转, the reason the Torah wrote 讬讜诪转, 诇讗拽讜诇讬 注诇讬讛, to make it easier on him, 诇讗驻讜拽讬 诪住讬讬祝 诇讞谞拽, to take him out from 住讬讬祝 to 讞谞拽. Which means that 讘讗诪转 he does deserve to die. But the question is if so, why does the Torah write 讬讜诪转? To take him out from 住讬讬祝 to 讞谞拽. One thing we know for sure, that 住拽讬诇讛 he doesn't get. Because if he himself would kill, he wouldn't get 住拽讬诇讛, certainly if his animal killed he doesn't get 住拽讬诇讛. But what would we think he would get? We would think he gets 住讬讬祝, just like when he kills somebody he gets 住讬讬祝, so too when his animal killed somebody he gets 住讬讬祝. That's why the Torah writes 讬讜诪转, and as we said before, wherever the Torah writes that he gets killed and doesn't specify, it means 讞谞拽, so the Torah tells us that here he gets 讞谞拽. Not as like when he himself would have killed somebody he would get 住讬讬祝, the Torah says no, here we make it easier on him and he only gets 讞谞拽. So still we remain that possible that he should get killed, and still the Torah has to write the word 讬讜诪转 to teach us that he doesn't get 住讬讬祝, but he gets 讞谞拽. And the 讙诪专讗 explains: 讛谞讬讞讗, is no question, is understood 诇诪讗谉 讚讗诪专 讞谞拽 讞诪讜专, according to the one that holds that 讞谞拽 is worse, so there is no question, because we can't say the Torah is trying to tell us that he doesn't get 住讬讬祝, but he gets 讞谞拽. If he kills himself, he gets 住讬讬祝, if his animal killed he gets 讞谞拽, can't be, because 讞谞拽 is worse. So then it's understood that we cannot say that the Torah writes the word 讬讜诪转 to teach us he gets 讞谞拽, because 讞谞拽 is worse, so then it couldn't be, so the word 讬讜诪转 is extra, and therefore you must say that he doesn't die, he just, the Torah writes 讬讜诪转 to compare the 诪讬转讛 of the 砖讜专 to the 诪讬转讛 of the owner. 讗诇讗 诇诪讗谉 讚讗诪专 讞谞拽 拽诇, according to the one that holds that 讞谞拽 is easier than 住讬讬祝, 诪讗讬 讗讬讻讗 诇诪讬诪专, what can we say? So the question remains: maybe the Torah writes 讬讜诪转 to tell us that he gets 讞谞拽 instead of 住讬讬祝? The Torah makes it easier on him, since after all, he himself didn't kill the person, just his ox killed. 讜诪诪讬诇讗 it could remain that the person does get killed, and the reason the Torah writes 讬讜诪转 is to teach us that he gets 讞谞拽, not 住讬讬祝. But the 讙诪专讗 says 诇讗 住诇拽讗 讚注转讱. There is no 住讘专讗 to say that the person himself, the owner, should get killed. 讚讻转讬讘, because it says further in the 驻住讜拽: 讗诐 讻讜驻专 讬讜砖转 注诇讬讜, if you will put a redeeming amount of money on the person, which means if the person will pay a certain amount of money, then he will not get killed. Now, 讜讗讬 住诇拽讗 讚注转讱 讘专 拽讟诇讗 讛讜讗, if you're going to say really he deserves to get killed, but if he pays money, that saves him from his death, 讜讛讻转讬讘 doesn't the 驻住讜拽 say someplace else: 诇讗 转拽讞讜 讻讜驻专 诇谞驻砖 专讜爪讞, that you shouldn't take any money to redeem the life of a murderer? So here, if he deserves to die, which means he is considered a murderer, how can the Torah say that if he pays money, then he doesn't get killed? But the 讙诪专讗 says, 讗讚专讘讛, on the contrary, 诪砖讜诐 讛讜讗 讙讜驻讬讛, for that reason itself the Torah writes it. Actually, because of what we just said now, the Torah writes this 讚讬谉: because 拽讟诇 讗讬讛讜, if he himself killed, he is a murderer, 诇讗 转驻专讜拽 诇讬讛 讘诪诪讜谞讗, then it is not enough if he pays money. If he gives 讻讜驻专, it doesn't help him. 讗诇讗 讘拽讟诇讗, the only thing that we can do to him is kill him. But 拽讟诇 砖讜专讬讛, but if his ox killed, 诇驻专讜拽 谞驻砖讬讛 讘诪诪讜谞讗, then he could redeem himself with money. But if he doesn't pay money, he would get killed. So could be this is actually what the Torah is telling us, that 诇讻转讞讬诇讛, since his ox killed somebody, 讙诐 讘注诇讬讜 讬讜诪转, he has to die. But since after all it's only his ox that killed, if he pays money, he could save himself. Not like if he would have killed himself, then the 讚讬谉 would be that he cannot save himself with money, but in this case he could. So we're back to the question: maybe when the Torah says 讙诐 讘注诇讬讜 讬讜诪转,

The principle: kill the murderer for his own murder

that his master, his owner should die, it actually means that his owner is 讞讬讬讘 诪讬转讛? 讗诇讗 讗诪专 讞讝拽讬讛, 讜讻谉 转谞讗 讚讘讬 讞讝拽讬讛, so 讞讝拽讬讛 answered, and that's how also the students in the 讬砖讬讘讛 of 讞讝拽讬讛 said, 讗诪专 拽专讗, the 驻住讜拽 says concerning a 专讜爪讞, concerning a murderer, the Torah says 诪讜转 讬讜诪转 讛诪讻讛 专讜爪讞 讛讜讗, that the one that hit, the one that killed should die, because he is a 专讜爪讞. So we 讚专砖'谉 from the word 专讜爪讞 讛讜讗, 注诇 专爪讬讞转讜 讗转讛 讛讜专讙讜, for his own 专爪讬讞讛, for his own murder you kill him, 讜讗讬 讗转讛 讛讜专讙讜 注诇 专爪讬讞转 砖讜专讜, but you can't kill a person for the murder of his ox. Then the 讙诪专讗 continues: 讗讬讘注讬讗 诇讛讜, there was an 讗讬讘注讬讗, a question asked: 砖讜专 住讬谞讬 讘讻诪讛? The ox by 住讬谞讬, how many people did you have to judge him to kill him? This refers to the 驻住讜拽 where it says, 讗诐 讘讛诪讛 讗诐 讗讬砖 诇讗 讬讞讬讛. It says that 讛砖诐 said before 诪转谉 转讜专讛 to surround the mountain and make sure that nobody goes on top of the mountain, and He said that if a 讘讛诪讛 or a man will go up, should not live, should get killed. The question of the 讙诪专讗 is: how many people in the 讘讬转 讚讬谉 did you need to judge the ox if he would go up on 讛专 住讬谞讬 in order to kill him? And the question

Temporary vs permanent law: learning from permanent case

is: 诪讬 讙诪专讬谞谉 砖注讛 诪讚讜专讜转 讗讜 诇讗? Do we learn out a temporary 讚讬谉 from a permanent 讚讬谉? In a case where you kill an ox in the 讚讬谉 诇讚讜专讜转, the 讚讬谉 that is permanent, as we said before by 砖讜专 讛谞住拽诇, you have to have a 讘讬转 讚讬谉 of 23. The 讚讬谉 of killing the ox that went up on 讛专 住讬谞讬 was a temporary 讚讬谉, it only applied at that time. So, do we learn out the 讚讬谉 of a temporary case from the 讚讬谉 of a permanent case and to say that just like in the permanent case you have to have 23 to judge the ox, so too in the temporary case? And the 讙诪专讗 says 转讗 砖诪注, come hear, I'll answer you this. 转谞讬 专诪讬 讘专 讬讞讝拽讗诇, 专诪讬 讘专 讬讞讝拽讗诇 learned, the 驻住讜拽 says 讗诐 讘讛诪讛 讗诐 讗讬砖 诇讗 讬讞讬讛, if it's a 讘讛诪讛 or a man he should not live if he goes on top of the mountain. So we compare the two and say 诪讛 讗讬砖 讘讻状讙, just like if a person would have gone up and would have to get killed, you would have to have a 讘讬转 讚讬谉 of 讻状讙, 讗祝 讘讛诪讛 讘讻状讙, so too in the case of a 讘讛诪讛 you would have to have 讻状讙. Now, how do we know by a man himself that he would have to have 讻状讙? The reason that we have to have 讻状讙 when you have to kill a person, the 讙诪专讗 said earlier, is because we learn it out from the 驻住讜拽 讜砖驻讟讜 讛注讚讛 讜讛爪讬诇讜 讛注讚讛, that you have to have an 注讚讛 which is 10 to judge, and you have to have an 注讚讛 which is 10 to save. Together it's 20, and then the 讙诪专讗 learns out three more, so altogether we have 23. But those are all 讚讬谞讬诐 that are said after 诪转谉 转讜专讛. We're talking here about the 讚讬谞讬诐 before 诪转谉 转讜专讛. So how do we know that even before 诪转谉 转讜专讛 the 讚讬谉 was that if a person had to get killed, then he would have to have 讻状讙? So 专砖状讬

Rashi and Tosafot: Jethro鈥檚 pre鈥慡inai Sanhedrin

and 转讜住驻讜转 say because 讬转专讜 yet, which was before 诪转谉 转讜专讛, had established the concept of a 住谞讛讚专讬谉, so he established it with all the 讚讬谞讬诐, also concerning 讚讬谞讬 谞驻砖讜转. So we assume that he established it with the proper 讚讬谞讬诐 of 讚讬谞讬 谞驻砖讜转 as we have it after 诪转谉 转讜专讛, and therefore a man definitely would get 讻状讙. The only question was concerning a 讘讛诪讛. And the 讙诪专讗's answer is that we compare a 讘讛诪讛 to a man, and a 讘讛诪讛 also needs 讻状讙. But 转讜住驻讜转 asks a 拽砖讬讗, what is 讘讻诇诇 the meaning of the 讙诪专讗's question, how many people you would need in the 讘讬转 讚讬谉 to kill the 砖讜专 of 住讬谞讬? What difference does it make? A lot of times we find an expression in the 讙诪专讗, 诪讗讬 讚讛讜讛 讛讜讛, what was, was. It is not a 讚讬谉 that could happen again. Now, this was a temporary thing, it happened only at that time, a 讛讜专讗转 砖注讛 concerning 诪转谉 转讜专讛. So what difference does it make now for us to know whether they needed 讻状讙 then or they didn't need 讻状讙? 转讜住驻讜转 says that maybe it is just to understand the 驻住讜拽讬诐. A lot of times we find that in the 讙诪专讗, that we ask questions concerning things that happened before, not because they are 谞驻拽讗 诪讬谞讛 诇讛诇讻讛, but they're just 谞讜讙注 to learn the 驻住讜拽讬诐. If we want to learn the 驻住讜拽 where it says that the ox should have got killed if he would go up on 讛专 住讬谞讬, to understand 驻砖讟 what the 驻住讜拽 means, that's why the 讙诪专讗 asks how many people in the 讘讬转 讚讬谉 did they need to kill that ox. Then the 讙诪专讗 continues, it said

Mishnah on killing wild animals with 23 judges

in the 诪砖谞讛 讛讗专讬 讜讛讝讗讘 讜讻讜诇讬. It said there that if a wolf, or a lion, or a bear, or a leopard, or a hyena, or a snake, if they are judged and sentenced to die, 诪讬转转谉 讘注砖专讬诐 讜砖诇砖讛, when you kill them you have to have a 讘讬转 讚讬谉 of 23. But then the 诪砖谞讛 continues that 专讘讬 讗诇注讝专 讗讜诪专, 专讘讬 讗诇注讝专 said, 讻诇 讛拽讜讚诐 诇讛讜专讙谉 讝讻讛, that anybody who is first to kill them, he is 讝讜讻讛. In other words, you don't have to have a 讘讬转 讚讬谉 of 23, but anybody who wants could kill them. The 讙诪专讗 says 讗诪专 专讬砖 诇拽讬砖, 专讬砖 诇拽讬砖 said, 讜讛讜讗 砖讛诪讬转讜, what 专讘讬 讗诇注讝专 said, that anybody could kill them, that's only if these animals killed somebody, 讗讘诇 诇讗 讛诪讬转讜 诇讗, but if they didn't kill anybody you can't. 专讘讬 讗诇注讝专 did not mean, 专讬砖 诇拽讬砖 says, that anybody, whenever you see a lion or a wolf, etc., you're able to kill them just like that. It is only if they killed a person, then you don't have to wait for a 讘讬转 讚讬谉 of 23 to sentence them to death, but anybody who wants could kill them. 讗诇诪讗, so the 讙诪专讗 says we see from here, 拽住讘专, that he holds, 讬砖 诇讛诐 转专讘讜转 讜讬砖 诇讛诐 讘注诇讬诐, that it's possible to tame these animals and they have owners. Since 专讬砖 诇拽讬砖 said that 专讘讬 讗诇注讝专 holds that you can't just walk over to a lion and kill them, the reason must be because he holds that they can be tamed and they can be owned by somebody. And therefore, if they didn't kill anybody, they don't deserve to die, you're not allowed to kill them, because if you kill them, then you would be killing and damaging property that belongs to somebody. But 专讘讬

Rabbi Yochanan permits killing even if not murderous

讬讜讞谞谉 讗诪专, 专讘讬 讬讜讞谞谉 says, 讗祝 注诇 驻讬 砖诇讗 讛诪讬转讜, that 专讘讬 讗诇注讝专, when he said that anybody is able to kill these animals, doesn't, is even if they did not kill anybody. When you see a lion, a wolf, etc., you're able to kill them just like that. 讗诇诪讗, so we see 拽住讘专 he holds, 讗讬谉 诇讛诐 转专讘讜转 讜讗讬谉 诇讛诐 讘注诇讬诐, that they cannot be tamed and they do not don't have owners. And therefore he says when you see a lion, you don't have to find out whether the lion has an owner or not in order to kill him. As soon as you see him you're allowed to kill him. Because even if he does have an owner, even if he is tamed, they are not considered tamed and they are not considered owned by anybody, and therefore you could kill them just like that. The 讙诪专讗 asks, 转谞谉, didn't we learn in the 诪砖谞讛, 专讘讬 讗诇注讝专 讗讜诪专, 专讘讬 讗诇注讝专 says, 讻诇 讛拽讜讚诐 诇讛讜专讙谉 讝讻讛, anybody who's first to kill them is 讝讜讻讛, 诪讗讬, what it means, he gained something. Now 讘砖诇诪讗 诇专讘讬 讬讜讞谞谉, according to 专讘讬 讬讜讞谞谉 who says that you're able to kill them even if they didn't kill anybody, then well 诪讗讬 讝讻讛, what is his 讝讜讻讛, what does he gain? 讝讻讛 诇注讜专谉, he gains the 注讜专. You kill the animal, there's nothing you can do with the animal itself, but you can at least take off the skin and keep it. 讗诇讗 诇专讬砖 诇拽讬砖, but according to 专讬砖 诇拽讬砖 who says that 专讘讬 讗诇注讝专 only meant that if they killed somebody, that's when anybody is allowed to kill them, 诇诪讗讬 讝讻讛, to what is he 讝讜讻讛? What does he gain by killing them? What does he have from it? 讻讬讜讜谉 讚砖讞讟讬讛, so since we're talking in a case that these animals killed, 砖讜讜讬谞讛讜 专讘谞谉 讻诪讗谉 讚讙诪专 讚讬谞讬讛讜, so it's as if the 讞讻诪讬诐 established that they were already sentenced. What is the 驻砖讟 according to 专讬砖 诇拽讬砖? That if any of these animals killed, so normally, if it would be an ox, you would have to have the 讘讬转 讚讬谉 to judge the ox, and then sentence him to death, then he would be killed. If it's a lion or a wolf, etc., then you don't have to have 讘讬转 讚讬谉 to sentence it to death, but anybody could kill it. In other words, as soon as it kills, it's already sentenced to death for anybody to kill him. Now, if it's sentenced to death, so it has a 讚讬谉 of a 砖讜专 讛谞住拽诇. 讜讛讗讬住讜专讬 讛谞讗讛, and it's 讗住讜专 讘讛谞讗讛, because the 讚讬谉 is that when an ox is sentenced to death, it is 讗住讜专 讘讛谞讗讛. And when it's stoned, you can't do anything with it. You can't have any use of any part of it, even of the skin. So, it would come out as if a lion or a wolf killed and we establish that the judgment was done already automatically, and you don't have to wait for a 讘讬转 讚讬谉, but they are as if they were sentenced, so they are also 讗住讜专 讘讛谞讗讛. So anybody who kills them is not allowed to use any part of it. So what did he mean when he said 讻诇 讛拽讜讚诐 讝讻讛, anybody who comes first to kill them is 讝讜讻讛 first, what is he 讝讜讻讛 in? And the 讙诪专讗 answers 诪讗讬 讝讻讛, you know what it means 讝讜讻讛? 讝讻讛 诇砖诪讬诐, he's 讝讜讻讛 to 砖诪讬诐, which means he did a good deed. It doesn't mean he is 讝讜讻讛, he gets something from it. It just merely he did a good deed. And the 讙诪专讗 says, 转谞讬讗 讻讜讜转讬讛 讚专讬砖 诇拽讬砖, we learned in a 讘专讬讬转讗 like 专讬砖 诇拽讬砖. It says in the 讘专讬讬转讗, 讗讞讚 砖讜专 砖讛诪讬转, whether it's an ox that killed, 讜讗讞讚 讘讛诪讛 讜讞讬讛 砖讛诪讬转讜, or whether it's a 讘讛诪讛 or a 讞讬讛 that killed, 讘注砖专讬诐 讜砖诇砖讛, you must have a 讘讬转 讚讬谉 of twenty-three to judge them. 专讘讬 讗诇注讝专 讗讜诪专, 专讘讬 讗诇注讝专 says, 砖讜专 砖讛诪讬转, if an ox killed, 讘注砖专讬诐 讜砖诇砖讛, you have to have twenty-three, 讜砖讗专 讘讛诪讛 讜讞讬讛 砖讛诪讬转讜, but any other 讘讛诪讛, 讞讬讛 that killed, 讻诇 讛拽讜讚诐 诇讛讜专讙谉 讝讻讛 讘讛谉 诇砖诪讬诐, anybody who comes first to kill them is 讝讜讻讛 to 砖诪讬诐. So here we see clearly that the only time you're allowed to kill them according to 专讘讬 讗诇注讝专 is if they killed. And what are you 讝讜讻讛 in? You are 讝讜讻讛 诇砖诪讬诐. You 讟讗拽注 can't have any use from any part of it, but you did a good deed 诇砖诪讬诐, you did a 诪爪讜讛. Concerning what we learned before, that we learn out from the 驻住讜拽 where it says 讜讙诐 讘注诇讬讜 讬讜诪转, that we compare the 诪讬转讛 of the 砖讜专 to the 诪讬转讛 of the 讘注诇讬诐. That just like if a person gets killed he needs a 讘讬转 讚讬谉 of 讻状讙, so, too, when the 砖讜专 讛谞住拽诇 gets killed he needs a 讘讬转 讚讬谉 of 讻状讙. And the 讙诪专讗 asks the question, how do you know that the words 讜讙诐 讘注诇讬讜 讬讜诪转 comes to teach us that? Maybe what it means really is that the owner has to get killed himself. Which means to say that if we use the 驻住讜拽 to teach us that 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专, then the 驻住讜拽 does not mean that the owner gets killed. And that's the 讙诪专讗's question, how do you know that, maybe the 驻住讜拽 refers to the 驻砖讜讟注 驻砖讟 that the owner gets killed. So, 转讜住驻讜转 驻专注讙讟 a 拽砖讬讗, that 住讜祝 讻诇 住讜祝, even after we 讚专砖谉 the 驻住讜拽 for 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专, the word 讜讙诐 讘注诇讬讜 讬讜诪转 still remains to mean that he gets 诪讬转讛. Because the 讚讬谉 is that the 讘注诇讬诐 gets 诪讬转讛 讘讬讚讬 砖诪讬诐, as we learn it out from this 驻住讜拽 of 讜讙诐 讘注诇讬讜 讬讜诪转. As the 讙诪专讗 says in 讻转讜讘讜转, that we find that a person who gets 诪讬转讛 讘讬讚讬 砖诪讬诐 is able to redeem his life through giving money. And the 讙诪专讗 quotes this 驻住讜拽. It says 讜讙诐 讘注诇讬讜 讬讜诪转, and then it says 讗诐 讻讜驻专 讬讜砖转 注诇讬讜. So we see that even though he's supposed to die 讘讬讚讬 砖诪讬诐, nevertheless he is able to redeem his life through money. So it seems as if the word 讬讜诪转 actually does mean that he should die, and this 讙诪专讗 is 诪砖诪注 that if we 讚专砖谉 the 驻住讜拽 for 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专, then the word 讬讜诪转 is not simple 驻砖讟, it doesn't mean he should die. But 诇驻讜注诇 it does mean he should die. And 转讜住驻讜转 answered, the 讙诪专讗 讟讗拽注 knows that when it says 讜讙诐 讘注诇讬讜 讬讜诪转, means that he dies 讘讬讚讬 砖诪讬诐, he gets 诪讬转讛 讘讬讚讬 砖诪讬诐. And we still were able to learn out 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专 from the word where it says 讬讜诪转. If it were just to mean that he gets 诪讬转讛 讘讬讚讬 砖诪讬诐, it would say 讬诪讜转, he would die. 讬讜诪转 means he should get killed. Now, what does the 驻住讜拽 mean he should get killed, when really he doesn't get killed 讘讬讚讬 讗讚诐? It comes to teach us 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专. Just like when a person gets killed by 讘讬转 讚讬谉 he needs twenty-three, so, too, when you kill the 砖讜专 he needs twenty-three. And that's the 讙诪专讗's question, how do you know that this word 讬讜诪转, the extra expression 讬讜诪转 instead of 讬诪讜转, comes to teach us 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专? Maybe what the 驻住讜拽 means when it says 讬讜诪转, actually he 讟讗拽注 gets killed by 讘讬转 讚讬谉. And that's what the 讙诪专讗 answers, that we can't say that because of the 讻诇诇 that we have that 注诇 专爪讬讞转讜 讗转讛 讛讜专讙讜, for his own murder you could kill him, but 讗讬 讗转讛 讛讜专讙讜 注诇 专爪讬讞转 砖讜专讜, you do not kill him for the murder of his 砖讜专. But the question that one can ask here is that 诇讻讗讜专讛, 住讜祝 讻诇 住讜祝, we have to understand the meaning of this 讚讬谉, 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专. That just like when you kill a person you have to have twenty-three, so, too, when you kill a 砖讜专, the 砖讜专 讛谞住拽诇, you have to have a 讘讬转 讚讬谉 of twenty-three. 诇讻讗讜专讛, how can you compare the two? After all, killing a person is in the category of 讚讬谞讬 谞驻砖讜转, and killing an ox is in the category of 讚讬谞讬 诪诪讜谞讜转, because after all, all an ox is is property of a person. So when you kill the ox, you're just ruining the property, you're damaging the person, it has a 讚讬谉 of 讚讬谞讬 诪诪讜谞讜转. So how can you compare 讚讬谞讬 诪诪讜谞讜转 to 讚讬谞讬 谞驻砖讜转? Now if we would assume that this is a 讙讝讬专转 讛讻转讜讘, that the 转讜专讛 makes a 讚讬谉 and it has no explanation, okay, so we'll say even though this is 讚讬谞讬 诪诪讜谞讜转 and this is 讚讬谞讬 谞驻砖讜转, nevertheless we say that just like by 诪讬转转 讛讘注诇讬诐 you need 23, 诪讬转转 讛砖讜专 also needs 23 without But usually we don't like to do that. Only when we have no choice, that's when we say that a certain 讚讬谉 would be a 讙讝讬专转 讛讻转讜讘. But for instance in this case, we don't find not in 专砖"讬 and not in 转讜住驻讜转 that this should be a 讙讝讬专转 讛讻转讜讘. So we should try to find an explanation to this 讚讬谉 of 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专, and not to leave it just as being a 讙讝讬专转 讛讻转讜讘. So the 诇讬讜讘讗讜讜讬讟砖注专 专讘讬 砖诇讬讟"讗 in his 住驻专 诇拽讜讟讬 砖讬讞讜转 explains it as follows: He explains it based on the 讞拽讬专讛 that we have in the 讗讞专讜谞讬诐 concerning the general 讚讬谉 of 谞讝拽讬 诪诪讜谉. We know that if somebody's property damages something, then the owner of that property, for instance the owner of the ox, he is obligated to pay to the one that got the damage. And there are two explanations given in the 讗讞专讜谞讬诐 for that 讚讬谉. Why is it that the owner is obligated to pay? Because on one hand, it would seem that he should be 驻讟讜专, because he didn't do any damage, and the fact that his ox did damage, it's only a 讙讜专诐. So why is he obligated to pay? So one explanation is because he did not watch the ox. Since he didn't watch the ox, he is responsible. Since it's his obligation to watch the ox and he didn't, so therefore he is responsible to pay for the damage that was done by the ox. And that would apply to damage done that you have to pay money, that would also apply to the case when his ox killed somebody, he is also responsible because he didn't watch the ox, so therefore he is responsible for it. Another explanation is because 诪诪讜谞讜 讛讝讬拽 or 诪诪讜谞讜 讛诪讬转. Since that object belongs to him, the ox belongs to him, so that is like an extension of him. Since it is his property that caused the damage, he is responsible to pay for that damage as if he did it himself. Because anything that belongs to him is an extension of him, because this is his, or using the example: how come people feel that if one's child causes damage, I'm not talking about 讛诇讻讛 now, but even in the feeling of people, that if a child causes damage, the father would feel responsible to pay because it's his child. The same here concerning 讛诇讻讛, that since the 砖讜专 is his 砖讜专, it's his 诪诪讜谉, so therefore he is responsible for anything the 砖讜专 did. Because when the 砖讜专 does it, it's his money, it's as if he did it because the 砖讜专 is his and it's an extension of him. One of the differences between these two 住讘专讜转 would be at what which point does the 讘注诇, the owner of the ox, do his 注讘讬专讛? According to the first way, that the reason he is responsible is because he did not watch the ox, so his 注讘讬专讛 is done before, when he did not watch the ox. But when the ox actually damaged or killed, we cannot say that the owner has part in that 注讘讬专讛. All the owner did was he was a cause that later the ox should go out and damage or kill. It would be similar to a 住讬讘讛 讜诪住讜讘讘. The owner would be the 住讬讘讛, he is the cause, and the ox is the 诪住讜讘讘, the damage of the ox or the murder of the ox is the 诪住讜讘讘, that is the reaction from the cause. But the owner did not take part in the actual damage or in the actual killing. While according to the second way when we say that the reason he is responsible is because the actions of the ox are really an extension of his actions because 诪诪讜谞讜 讛讝讬拽 or 诪诪讜谞讜 讛诪讬转, so then it comes out that when did the 讘注诇, the owner, do his 注讘讬专讛? When the ox damaged or killed, we say that at that moment it is an extension of the owner that's doing it, it's as if the owner himself did it. So according to the second way that we're saying now, we can explain the reason for 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专. The question we asked was: how can we compare the two? When we kill the ox really all we're doing is 讚讬谞讬 诪诪讜谞讜转, it's not 讚讬谞讬 谞驻砖讜转? The answer is: this is 讚讬谞讬 谞驻砖讜转. Because the ox, what he did was, he was doing it in the place of the owner, which means when he killed, we consider it as if a person killed, and therefore the whole 讚讬谉 that applies to this 砖讜专 讛谞住拽诇 is not 讚讬谞讬 诪诪讜谞讜转, but it is 讚讬谞讬 谞驻砖讜转. Especially according to the 住讘专讗 that we say that the owner really is 讞讬讬讘 诪讬转讛 讘讬讚讬 砖诪讬诐, certainly it seems to be showing that he has part in the murder itself. If we would learn according to the first way, then he has no part in the murder, all he is is a 住讬讘讛, then it is hard to say that killing the ox would be 讚讬谞讬 谞驻砖讜转, because when the ox kills, it has nothing to do to a human being, there is no 讚讬谞讬 谞驻砖讜转 involved. The owner's part in the 注讘讬专讛 is only that he didn't watch it, he is a 住讬讘讛. So therefore, it's even hard to understand why he should get 诪讬转讛 讘讬讚讬 砖诪讬诐. But if we're going to say that when the ox kills, the owner actually, as if, participated in the killing because 诪诪讜谞讜 讛讝讬拽, so then we understand why he gets 诪讬转讛 讘讬讚讬 砖诪讬诐, and we also understand why this whole thing is considered 讚讬谞讬 谞驻砖讜转. And therefore, the 讚讬谉 would be that when you kill the ox, you also need a 讘讬转 讚讬谉 of 讻状讙, just like when you kill the person. The truth is that even according to the first way, we could explain it, because whatever explanation we're going to give according to the first way why the owner gets 诪讬转讛 讘讬讚讬 砖诪讬诐, but if we do assume that he gets 诪讬转讛 讘讬讚讬 砖诪讬诐, that itself shows that there is some kind of 讚讬谞讬 谞驻砖讜转 here. And therefore we understand why 讻诪讬转转 讛讘注诇讬诐 讻讱 诪讬转转 讛砖讜专. But according to the second way, it is more understood, because here we actually have an explanation how the owner participated in the killing and therefore this is all called 讚讬谞讬 谞驻砖讜转. And the 专讘讬 continues to explain that according to both ways, we could understand the 驻砖讟 in the 讙诪专讗 when the 讙诪专讗 讚专砖谞'住: 注诇 专爪讬讞转讜 讗转讛 讛讜专讙讜, 讜讗讬 讗转讛 讛讜专讙讜 注诇 专爪讬讞转 砖讜专讜. Now, according to the first way that the reason the owner is punished is because he did not watch the 砖讜专, so what does the 讙诪专讗 mean: 注诇 专爪讬讞转讜 讗转讛 讛讜专讙讜, 讜讗讬 讗转讛 讛讜专讙讜 注诇 专爪讬讞转 砖讜专讜? 驻砖讜讟! Only if he himself killed, that's when he could get killed. But if his 砖讜专 killed, then you cannot kill the owner, because the owner did not participate in the killing. The question would be only why does he get 诪讬转讛 讘讬讚讬 砖诪讬诐, and that would need an explanation in itself. But as far as why he doesn't get killed 讘讬讚讬 讗讚诐, it's very understood, because he did not participate in the murder. According to the second way, we could explain just the opposite: that after all, the owner is not responsible at all. According to the second way, from one angle, it is less connection to the owner than according to the first way, because according to the second way, we do not say that the owner is responsible for the fact that he killed because he didn't watch him. According to the second way, the owner is not responsible at all, the owner didn't do anything wrong! Even though the 讚讬谉 is that if he did watch, he is 驻讟讜专, but that's like a 转谞讗讬. But the reason for the 讞讬讜讘 is not because he didn't watch, it is because 诪诪讜谞讜 讛讝讬拽. So that is, on one hand, it puts him more closer to the time when the ox kills, but on the other hand, actually, he didn't do anything wrong, but it's only that his ox killed, and since his ox belongs to him, it's an extension of him. And that's what the 讙诪专讗 means: 注诇 专爪讬讞转讜 讗转讛 讛讜专讙讜. We learn out from here if he himself does something, he gets killed. But if he doesn't do anything, it's only his ox that did it, so even though his ox is an extension of him, but after all it's only his ox, and therefore he is 驻讟讜专.
